Loubet</sponsorhead><otherSponsorhead>Senate Sponsor: Daniel McCay</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This joint resolution of the Legislature proposes to amend the Utah Constitution regarding <ln numlevel="1" lineno="6" slineno="0-6"/>the publication of a proposed constitutional amendment. </gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This resolution proposes to amend the Utah Constitution to:<hl numlevel="1" lineno="9" slineno="0-9" level="1">require a proposed constitutional amendment to be published, in a manner provided by <ln numlevel="1" lineno="10" slineno="0-10"/>statute, for 60 calendar days immediately preceding the general election.</hl></hp><oc numlevel="1" lineno="11" slineno="0-11">Other Special Clauses:<ocl type="votesub" sort="1" numlevel="1" lineno="12" slineno="0-12">This resolution directs the lieutenant governor to submit this proposal to voters.</ocl><ocl type="contingent" sort="10" numlevel="1" lineno="13" slineno="0-13">This resolution provides a contingent effective date of <effdate>January 1, 2027</effdate> for this proposal.</ocl></oc><ca numlevel="1" lineno="14" slineno="0-14">Utah Constitution Sections Affected:<caamd numlevel="1" lineno="15" slineno="0-15"><snhead>AMENDS:</snhead><sn num="Article XXIII, Section 1" src="const" uid="UC_AXXIII_S1_2025050720250507" buid="3" sort="00I23 00010020250507" numlevel="1" lineno="16" slineno="0-16"><bold>Article XXIII, Section 1</bold>, </sn></caamd></ca></lt><enacthead lineno="17"/><enact numlevel="1" lineno="18" slineno="0-18">Be it resolved by the Legislature of the state of Utah, two-thirds of all members elected to each <ln numlevel="1" lineno="19" slineno="0-19"/>of the two houses voting in favor thereof:</enact><bdy><bsec buid="3" num="Article XXIII, Section 1" type="amend" src="const" uid="UC_AXXIII_S1_2025050720250507" sort="00I23 00010020250507" numlevel="1" lineno="20" slineno="1-1" sn="1"><section number="Article XXIII, Section 1" numlevel="1" lineno="21" slineno="1-2" type="amend"><secline lineno="20">Section 1. It is proposed to amend Utah Constitution, Article XXIII, Section 1 to read</secline><catline lineno="21"><bold>Article XXIII, Section 1<parens/>. [Amendments: proposal, election.]</bold></catline><sectionText lineno="22"><tab/>Any amendment or amendments to this Constitution may be proposed in either house of <ln numlevel="1" lineno="23" slineno="1-4"/>the Legislature, and if two-thirds of all the members elected to each of the two houses, shall <ln numlevel="1" lineno="24" slineno="1-5"/>vote in favor thereof, such proposed amendment or amendments shall be entered on their <ln numlevel="1" lineno="25" slineno="1-6"/>respective journals with the yeas and nays taken thereon; and the Legislature shall cause the <ln numlevel="1" lineno="26" slineno="1-7"/>same to be published<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="admin" level="1" deltag="both"> in at least one newspaper in every county of the state, where a <ln numlevel="1" lineno="27" slineno="1-8"/>newspaper is published, for two months</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="admin" level="1" amendtag="both" space="true">, in a manner provided by statute, for 60 calendar days</amend> <ln numlevel="1" lineno="28" slineno="1-9"/>immediately preceding the next general election, at which time the said amendment or <ln numlevel="1" lineno="29" slineno="1-10"/>amendments shall be submitted to the electors of the state for their approval or rejection, and if <ln numlevel="1" lineno="30" slineno="1-11"/>a majority of the electors voting thereon shall approve the same, such amendment or <ln numlevel="1" lineno="31" slineno="1-12"/>amendments shall become part of this Constitution.<eol numlevel="1" lineno="32" slineno="1-13"/><para/>The revision or amendment of an entire article or the addition of a new article to this <ln numlevel="1" lineno="33" slineno="1-14"/>Constitution may be proposed as a single amendment and may be submitted to the electors as a <ln numlevel="1" lineno="34" slineno="1-15"/>single question or proposition. Such amendment may relate to one subject, or any number of <ln numlevel="1" lineno="35" slineno="1-16"/>subjects, and may modify, or repeal provisions contained in other articles of the Constitution, <ln numlevel="1" lineno="36" slineno="1-17"/>if such provisions are germane to the subject matter of the article being revised, amended or <ln numlevel="1" lineno="37" slineno="1-18"/>being proposed as a new article.</sectionText></section></bsec><bsec buid="2" type="uncod" untype="votesub" src="uncod" uid="VS0000" sort="UB" langlock="false" numlevel="1" lineno="38" slineno="2-1" sn="2"><section type="uncod" untype="votesub" display="false" src="uncod"><secline lineno="38">Section 2.  <bold>Submittal to voters.</bold></secline><sectionText lineno="39"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">The lieutenant governor is directed to submit this proposed amendment to the voters of <ln numlevel="1" lineno="40" slineno="2-3"/>the state at the next regular general election in the manner provided by law.</amend></sectionText></section></bsec><bsec buid="1" type="uncod" untype="contingent" src="uncod" uid="CT0000" sort="UC" langlock="false" numlevel="1" lineno="41" slineno="3-1" sn="3"><section type="uncod" untype="contingent" display="false" src="uncod"><secline lineno="41">Section 3.  <bold>Contingent effective date.</bold></secline><sectionText lineno="42"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">If the amendment proposed by this joint resolution is approved by a majority of those <ln numlevel="1" lineno="43" slineno="3-3"/>voting on it at the next regular general election, the amendment shall take effect on January 1, <ln numlevel="1" lineno="44" slineno="3-4"/>2027.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-12-25 4:22 PM</tm></rev></foot></leg>
