Definitions.</bold></catline><sectionText lineno="25"><tab/>As used in this part:</sectionText><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-4" level="1"><display>(1)</display>"Adoption services" means the same as that term is defined in Section <xref depth="3" refnumber="80-2-801">80-2-801</xref>.</subsection><subsection ssid="3-3-2" dnum="2-o" numlevel="1" lineno="27" slineno="1-5" level="1"><display>(2)</display>"Adult day care" means nonresidential care and supervision:<subsection ssid="3-3-3" dnum="a-o" numlevel="1" lineno="28" slineno="1-6" level="2"><display>(a)</display>for three or more adults for at least four but less than 24 hours a day; and</subsection><subsection ssid="3-3-4" dnum="b-o" numlevel="1" lineno="29" slineno="1-7" level="2"><display>(b)</display>that meets the needs of functionally impaired adults through a comprehensive <ln numlevel="1" lineno="30" slineno="1-8"/>program that provides a variety of health, social, recreational, and related support <ln numlevel="1" lineno="31" slineno="1-9"/>services in a protective setting.</subsection></subsection><subsection ssid="3-3-5" dnum="3-o" numlevel="1" lineno="32" slineno="1-10" level="1"><display>(3)</display>"Applicant" means a person that applies for an initial license or a license renewal under <ln numlevel="1" lineno="33" slineno="1-11"/>this part.</subsection><subsection ssid="3-3-6" dnum="4-o" numlevel="1" lineno="34" slineno="1-12" level="1" space="false"><display>(4)</display><subsection ssid="3-3-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Associated with the licensee" means that an individual is:<subsection ssid="3-3-8" dnum="i-o" numlevel="1" lineno="35" slineno="1-13" level="3" tab="1"><display>(i)</display>affiliated with a licensee as an owner, director, member of the governing body, <ln numlevel="1" lineno="36" slineno="1-14"/>employee, agent, provider of care, department contractor, or volunteer; or</subsection><subsection ssid="3-3-9" dnum="ii-o" numlevel="1" lineno="37" slineno="1-15" level="3" tab="1"><display>(ii)</display>applying to become affiliated with a licensee in a capacity described in <ln numlevel="1" lineno="38" slineno="1-16"/>Subsection (4)(a)(i).</subsection></subsection><subsection ssid="3-3-10" dnum="b-o" numlevel="1" lineno="39" slineno="1-17" level="2"><display>(b)</display>"Associated with the licensee" does not include:<subsection ssid="3-3-11" dnum="i-o" numlevel="1" lineno="40" slineno="1-18" level="3"><display>(i)</display>service on the following bodies, unless that service includes direct access to a <ln numlevel="1" lineno="41" slineno="1-19"/>child or a vulnerable adult:<subsection ssid="3-3-12" dnum="A-o" numlevel="1" lineno="42" slineno="1-20" level="4"><display>(A)</display>a local mental health authority described in Section <xref depth="3" refnumber="17-43-301">17-43-301</xref>;</subsection><subsection ssid="3-3-13" dnum="B-o" numlevel="1" lineno="43" slineno="1-21" level="4"><display>(B)</display>a local substance abuse authority described in Section <xref depth="3" refnumber="17-43-201">17-43-201</xref>; or</subsection><subsection ssid="3-3-14" dnum="C-o" numlevel="1" lineno="44" slineno="1-22" level="4"><display>(C)</display>a board of an organization operating under a contract to provide mental health <ln numlevel="1" lineno="45" slineno="1-23"/>or substance use programs, or services for the local mental health authority or <ln numlevel="1" lineno="46" slineno="1-24"/>substance abuse authority; or</subsection></subsection><subsection ssid="3-3-15" dnum="ii-o" numlevel="1" lineno="47" slineno="1-25" level="3"><display>(ii)</display>a guest or visitor whose access to a child or a vulnerable adult is directly <ln numlevel="1" lineno="48" slineno="1-26"/>supervised at all times.</subsection></subsection></subsection><subsection ssid="3-3-16" dnum="5-o" numlevel="1" lineno="49" slineno="1-27" level="1" space="false"><display>(5)</display><subsection ssid="3-3-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Boarding school" means a private school that:<subsection ssid="3-3-18" dnum="i-o" numlevel="1" lineno="50" slineno="1-28" level="3" tab="1"><display>(i)</display>uses a regionally accredited education program;</subsection><subsection ssid="3-3-19" dnum="ii-o" numlevel="1" lineno="51" slineno="1-29" level="3" tab="1"><display>(ii)</display>provides a residence to the school's students:<subsection ssid="3-3-20" dnum="A-o" numlevel="1" lineno="52" slineno="1-30" level="4"><display>(A)</display>for the purpose of enabling the school's students to attend classes at the <ln numlevel="1" lineno="53" slineno="1-31"/>school; and</subsection><subsection ssid="3-3-21" dnum="B-o" numlevel="1" lineno="54" slineno="1-32" level="4"><display>(B)</display>as an ancillary service to educating the students at the school;</subsection></subsection><subsection ssid="3-3-22" dnum="iii-o" numlevel="1" lineno="55" slineno="1-33" level="3" tab="1"><display>(iii)</display>has the primary purpose of providing the school's students with an education, as <ln numlevel="1" lineno="56" slineno="1-34"/>defined in Subsection (5)(b)(i); and</subsection><subsection ssid="3-3-23" dnum="iv-o" numlevel="1" lineno="57" slineno="1-35" level="3" tab="1" space="false"><display>(iv)</display><subsection ssid="3-3-24" dnum="A-o" level="4" placement="sameline"><display>(A)</display>does not provide the treatment or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="admin" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="58" slineno="1-36"/>(42)(a)</amend>; or</subsection><subsection ssid="3-3-25" dnum="B-o" numlevel="1" lineno="59" slineno="1-37" level="4"><display>(B)</display>provides the treatment or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="admin" level="1" amendtag="both" space="true">(42)(a)</amend> on <ln numlevel="1" lineno="60" slineno="1-38"/>a limited basis, as described in Subsection (5)(b)(ii).</subsection></subsection></subsection><subsection ssid="3-3-26" dnum="b-o" numlevel="1" lineno="61" slineno="1-39" level="2" space="false"><display>(b)</display><subsection ssid="3-3-27" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For purposes of Subsection (5)(a)(iii), "education" means a course of study for <ln numlevel="1" lineno="62" slineno="1-40"/>one or more grades from kindergarten through grade 12.</subsection><subsection ssid="3-3-28" dnum="ii-o" numlevel="1" lineno="63" slineno="1-41" level="3"><display>(ii)</display>For purposes of Subsection (5)(a)(iv)(B), a private school provides the treatment <ln numlevel="1" lineno="64" slineno="1-42"/>or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="53" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="52" style="1" owner="admin" level="1" amendtag="both" space="true">(42)(a)</amend> on a limited basis if:<subsection ssid="3-3-29" dnum="A-o" numlevel="1" lineno="65" slineno="1-43" level="4"><display>(A)</display>the treatment or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="admin" level="1" amendtag="both" space="true">(42)(a)</amend> are provided <ln numlevel="1" lineno="66" slineno="1-44"/>only as an incidental service to a student; and</subsection><subsection ssid="3-3-30" dnum="B-o" numlevel="1" lineno="67" slineno="1-45" level="4"><display>(B)</display>the school does not:<subsection ssid="3-3-31" dnum="I-o" numlevel="1" lineno="68" slineno="1-46" level="5"><display>(I)</display>specifically solicit a student for the purpose of providing the treatment or <ln numlevel="1" lineno="69" slineno="1-47"/>services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="19" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="admin" level="1" amendtag="both" space="true">(42)(a)</amend>; or</subsection><subsection ssid="3-3-32" dnum="II-o" numlevel="1" lineno="70" slineno="1-48" level="5"><display>(II)</display>have a primary purpose of providing the treatment or services described in <ln numlevel="1" lineno="71" slineno="1-49"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="20" style="2" owner="admin" level="1" deltag="both">(40)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="admin" level="1" amendtag="both" space="true">(42)(a)</amend>.</subsection></subsection></subsection></subsection><subsection ssid="3-3-33" dnum="c-o" numlevel="1" lineno="72" slineno="1-50" level="2"><display>(c)</display>"Boarding school" does not include a therapeutic school.</subsection></subsection><subsection ssid="3-3-34" dnum="6-o" numlevel="1" lineno="73" slineno="1-51" level="1"><display>(6)</display>"Certification" means a less restrictive level of licensure issued by the department.</subsection><subsection ssid="3-3-35" dnum="7-o" numlevel="1" lineno="74" slineno="1-52" level="1"><display>(7)</display>"Child" means an individual under 18 years old.</subsection><subsection ssid="3-3-36" dnum="8-o" numlevel="1" lineno="75" slineno="1-53" level="1"><display>(8)</display>"Child placing" means receiving, accepting, or providing custody or care for any child, <ln numlevel="1" lineno="76" slineno="1-54"/>temporarily or permanently, for the purpose of:<subsection ssid="3-3-37" dnum="a-o" numlevel="1" lineno="77" slineno="1-55" level="2"><display>(a)</display>finding a person to adopt the child;</subsection><subsection ssid="3-3-38" dnum="b-o" numlevel="1" lineno="78" slineno="1-56" level="2"><display>(b)</display>placing the child in a home for adoption; or</subsection><subsection ssid="3-3-39" dnum="c-o" numlevel="1" lineno="79" slineno="1-57" level="2"><display>(c)</display>foster home placement.</subsection></subsection><subsection ssid="3-3-40" dnum="9-o" numlevel="1" lineno="80" slineno="1-58" level="1"><display>(9)</display>"Child-placing agency" means a person that engages in child placing.</subsection><subsection ssid="3-3-41" dnum="10-o" numlevel="1" lineno="81" slineno="1-59" level="1"><display>(10)</display>"Client" means an individual who receives or has received services from a licensee.</subsection><subsection ssid="3-3-42" dnum="11-o" numlevel="1" lineno="82" slineno="1-60" level="1" space="false"><display>(11)</display><subsection ssid="3-3-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Congregate care program" means any of the following that provide services to a <ln numlevel="1" lineno="83" slineno="1-61"/>child:<subsection ssid="3-3-44" dnum="i-o" numlevel="1" lineno="84" slineno="1-62" level="3" tab="1"><display>(i)</display>an outdoor youth program;</subsection><subsection ssid="3-3-45" dnum="ii-o" numlevel="1" lineno="85" slineno="1-63" level="3" tab="1"><display>(ii)</display>a residential support program;</subsection><subsection ssid="3-3-46" dnum="iii-o" numlevel="1" lineno="86" slineno="1-64" level="3" tab="1"><display>(iii)</display>a residential treatment program; or</subsection><subsection ssid="3-3-47" dnum="iv-o" numlevel="1" lineno="87" slineno="1-65" level="3" tab="1"><display>(iv)</display>a therapeutic school.</subsection></subsection><subsection ssid="3-3-48" dnum="b-o" numlevel="1" lineno="88" slineno="1-66" level="2"><display>(b)</display>"Congregate care program" does not include a human services program that:<subsection ssid="3-3-49" dnum="i-o" numlevel="1" lineno="89" slineno="1-67" level="3"><display>(i)</display>is licensed to serve adults; and</subsection><subsection ssid="3-3-50" dnum="ii-o" numlevel="1" lineno="90" slineno="1-68" level="3"><display>(ii)</display>is approved by the office to service a child for a limited time.</subsection></subsection></subsection><subsection ssid="3-3-51" dnum="12-o" numlevel="1" lineno="91" slineno="1-69" level="1"><display>(12)</display>"Day treatment" means specialized treatment that is provided to:<subsection ssid="3-3-52" dnum="a-o" numlevel="1" lineno="92" slineno="1-70" level="2"><display>(a)</display>a client less than 24 hours a day; and</subsection><subsection ssid="3-3-53" dnum="b-o" numlevel="1" lineno="93" slineno="1-71" level="2"><display>(b)</display>four or more persons who:<subsection ssid="3-3-54" dnum="i-o" numlevel="1" lineno="94" slineno="1-72" level="3"><display>(i)</display>are unrelated to the owner or provider; and</subsection><subsection ssid="3-3-55" dnum="ii-o" numlevel="1" lineno="95" slineno="1-73" level="3"><display>(ii)</display>have emotional, psychological, developmental, physical, or behavioral <ln numlevel="1" lineno="96" slineno="1-74"/>dysfunctions, impairments, or chemical dependencies.</subsection></subsection></subsection><subsection ssid="3-3-56" dnum="13-o" numlevel="1" lineno="97" slineno="1-75" level="1"><display>(13)</display>"Department contractor" means an individual who:<subsection ssid="3-3-57" dnum="a-o" numlevel="1" lineno="98" slineno="1-76" level="2"><display>(a)</display>provides services under a contract with the department; and</subsection><subsection ssid="3-3-58" dnum="b-o" numlevel="1" lineno="99" slineno="1-77" level="2"><display>(b)</display>due to the contract with the department, has or will likely have direct access to a <ln numlevel="1" lineno="100" slineno="1-78"/>child or vulnerable adult.</subsection></subsection><subsection ssid="3-3-59" dnum="14-o" numlevel="1" lineno="101" slineno="1-79" level="1"><display>(14)</display>"Direct access" means that an individual has, or likely will have:<subsection ssid="3-3-60" dnum="a-o" numlevel="1" lineno="102" slineno="1-80" level="2"><display>(a)</display>contact with or access to a child or vulnerable adult that provides the individual with <ln numlevel="1" lineno="103" slineno="1-81"/>an opportunity for personal communication or touch; or</subsection><subsection ssid="3-3-61" dnum="b-o" numlevel="1" lineno="104" slineno="1-82" level="2"><display>(b)</display>an opportunity to view medical, financial, or other confidential personal identifying <ln numlevel="1" lineno="105" slineno="1-83"/>information of the child, the child's parents or legal guardians, or the vulnerable adult.</subsection></subsection><subsection ssid="3-3-62" dnum="15-o" numlevel="1" lineno="106" slineno="1-84" level="1"><display>(15)</display>"Directly supervised" means that an individual is being supervised under the <ln numlevel="1" lineno="107" slineno="1-85"/>uninterrupted visual and auditory surveillance of another individual who has a current <ln numlevel="1" lineno="108" slineno="1-86"/>background check approval issued by the office.</subsection><subsection ssid="3-3-63" dnum="16-o" numlevel="1" lineno="109" slineno="1-87" level="1"><display>(16)</display>"Director" means the director of the office.</subsection><subsection ssid="3-3-64" dnum="17-o" numlevel="1" lineno="110" slineno="1-88" level="1"><display>(17)</display>"Domestic violence" means the same as that term is defined in Section <xref depth="3" refnumber="77-36-1">77-36-1</xref>.</subsection><subsection ssid="3-3-65" dnum="18-o" numlevel="1" lineno="111" slineno="1-89" level="1"><display>(18)</display>"Domestic violence treatment program" means a nonresidential program designed to <ln numlevel="1" lineno="112" slineno="1-90"/>provide psychological treatment and educational services to perpetrators and victims of <ln numlevel="1" lineno="113" slineno="1-91"/>domestic violence.</subsection><subsection ssid="3-3-66" dnum="19-o" numlevel="1" lineno="114" slineno="1-92" level="1"><display>(19)</display>"Elder adult" means a person 65 years old or older.</subsection><subsection ssid="3-3-67" dnum="20-o" numlevel="1" lineno="115" slineno="1-93" level="1"><display>(20)</display>"Emergency safety intervention" means a tactic used to protect staff or a client from <ln numlevel="1" lineno="116" slineno="1-94"/>being physically injured, utilized by an appropriately trained direct care staff and only <ln numlevel="1" lineno="117" slineno="1-95"/>performed in accordance with a nationally or regionally recognized curriculum in the <ln numlevel="1" lineno="118" slineno="1-96"/>least restrictive manner to restore staff or client safety.</subsection><subsection ssid="3-3-68" dnum="21-o" numlevel="1" lineno="119" slineno="1-97" level="1"><display>(21)</display>"Foster home" means a residence that is licensed or certified by the office for the <ln numlevel="1" lineno="120" slineno="1-98"/>full-time substitute care of a child.</subsection><subsection ssid="3-3-69" dnum="22-o" numlevel="1" lineno="121" slineno="1-99" level="1"><display>(22)</display>"Health benefit plan" means the same as that term is defined in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="31" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="31A-22-634">31A-22-634</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="28" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="31A-1-301"><ln numlevel="1" lineno="122" slineno="1-100"/>31A-1-301</xref></amend>.</subsection><subsection ssid="3-3-70" dnum="23-o" numlevel="1" lineno="123" slineno="1-101" level="1"><display>(23)</display>"Health care provider" means the same as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>.</subsection><subsection ssid="3-3-71" dnum="24-o" numlevel="1" lineno="124" slineno="1-102" level="1"><display>(24)</display>"Health insurer" means<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="32" style="2" owner="admin" level="1" deltag="both"> the same as that term is defined in Section <xref depth="3" refnumber="31A-22-615.5">31A-22-615.5</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="29" style="1" owner="admin" level="1" amendtag="both" space="true">:</amend><subsection ssid="3-226" dnum="_-o:a-e" numlevel="1" lineno="125" slineno="1-103" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="27" style="1" owner="admin" level="1" amendtag="end">an insurer who offers health care insurance as that term is defined in Section <xref depth="3" refnumber="31A-1-301"><ln numlevel="1" lineno="126" slineno="1-104"/>31A-1-301</xref>;</amend></subsection><subsection ssid="3-227" dnum="_-o:b-e" numlevel="1" lineno="127" slineno="1-105" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="e" tab="1"><display>(ii)</display>a therapeutic school;</subsection><subsection ssid="3-3-76" dnum="iii-o" numlevel="1" lineno="134" slineno="1-112" level="3" tab="1"><display>(iii)</display>a youth program;</subsection><subsection ssid="3-3-77" dnum="iv-o" numlevel="1" lineno="135" slineno="1-113" level="3" tab="1"><display>(iv)</display>an outdoor youth program;</subsection><subsection ssid="3-3-78" dnum="v-o" numlevel="1" lineno="136" slineno="1-114" level="3" tab="1"><display>(v)</display>a residential treatment program;</subsection><subsection ssid="3-3-79" dnum="vi-o" numlevel="1" lineno="137" slineno="1-115" level="3" tab="1"><display>(vi)</display>a residential support program;</subsection><subsection ssid="3-3-80" dnum="vii-o" numlevel="1" lineno="138" slineno="1-116" level="3" tab="1"><display>(vii)</display>a resource family home;</subsection><subsection ssid="3-3-81" dnum="viii-o" numlevel="1" lineno="139" slineno="1-117" level="3" tab="1"><display>(viii)</display>a recovery residence; or</subsection><subsection ssid="3-3-82" dnum="ix-o" numlevel="1" lineno="140" slineno="1-118" level="3" tab="1"><display>(ix)</display>a facility or program that provides:<subsection ssid="3-3-83" dnum="A-o" numlevel="1" lineno="141" slineno="1-119" level="4"><display>(A)</display>adult day care;</subsection><subsection ssid="3-3-84" dnum="B-o" numlevel="1" lineno="142" slineno="1-120" level="4"><display>(B)</display>day treatment;</subsection><subsection ssid="3-3-85" dnum="C-o" numlevel="1" lineno="143" slineno="1-121" level="4"><display>(C)</display>outpatient treatment;</subsection><subsection ssid="3-3-86" dnum="D-o" numlevel="1" lineno="144" slineno="1-122" level="4"><display>(D)</display>domestic violence treatment;</subsection><subsection ssid="3-3-87" dnum="E-o" numlevel="1" lineno="145" slineno="1-123" level="4"><display>(E)</display>child-placing services;</subsection><subsection ssid="3-3-88" dnum="F-o" numlevel="1" lineno="146" slineno="1-124" level="4"><display>(F)</display>social detoxification; or</subsection><subsection ssid="3-3-89" dnum="G-o" numlevel="1" lineno="147" slineno="1-125" level="4"><display>(G)</display>any other human services that are required by contract with the department to <ln numlevel="1" lineno="148" slineno="1-126"/>be licensed with the department.</subsection></subsection></subsection><subsection ssid="3-3-90" dnum="b-o" numlevel="1" lineno="149" slineno="1-127" level="2"><display>(b)</display>"Human services program" does not include:<subsection ssid="3-3-91" dnum="i-o" numlevel="1" lineno="150" slineno="1-128" level="3"><display>(i)</display>a boarding school;</subsection><subsection ssid="3-3-92" dnum="ii-o" numlevel="1" lineno="151" slineno="1-129" level="3"><display>(ii)</display>a residential, vocational and life skills program, as defined in Section <xref depth="3" refnumber="13-53-102">13-53-102</xref>; <ln numlevel="1" lineno="152" slineno="1-130"/>or</subsection><subsection ssid="3-3-93" dnum="iii-o" numlevel="1" lineno="153" slineno="1-131" level="3"><display>(iii)</display>a short-term relief care provider.</subsection></subsection></subsection><subsection ssid="3-3-94" dnum="26-o" numlevel="1" lineno="154" slineno="1-132" level="1"><display>(26)</display>"Indian child" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="3-3-95" dnum="27-o" numlevel="1" lineno="155" slineno="1-133" level="1"><display>(27)</display>"Indian country" means the same as that term is defined in 18 U.S.C. Sec. 1151.</subsection><subsection ssid="3-3-96" dnum="28-o" numlevel="1" lineno="156" slineno="1-134" level="1"><display>(28)</display>"Indian tribe" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="3-3-97" dnum="29-o" numlevel="1" lineno="157" slineno="1-135" level="1"><display>(29)</display>"Intermediate secure treatment" means 24-hour specialized residential treatment or <ln numlevel="1" lineno="158" slineno="1-136"/>care for an individual who:<subsection ssid="3-3-98" dnum="a-o" numlevel="1" lineno="159" slineno="1-137" level="2"><display>(a)</display>cannot live independently or in a less restrictive environment; and</subsection><subsection ssid="3-3-99" dnum="b-o" numlevel="1" lineno="160" slineno="1-138" level="2"><display>(b)</display>requires, without the individual's consent or control, the use of locked doors to care <ln numlevel="1" lineno="161" slineno="1-139"/>for the individual.</subsection></subsection><subsection ssid="3-3-100" dnum="30-o" numlevel="1" lineno="162" slineno="1-140" level="1"><display>(30)</display>"Licensee" means an individual or a human services program licensed by the office.</subsection><subsection ssid="3-3-101" dnum="31-o" numlevel="1" lineno="163" slineno="1-141" level="1"><display>(31)</display>"Local government" means a city, town, or county.</subsection><subsection ssid="3-224" dnum="_-o:32-e" numlevel="1" lineno="164" slineno="1-142" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="start">(32)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="end">"Medication assisted treatment" means the use of a prescribed medication approved by <ln numlevel="1" lineno="165" slineno="1-143"/>the United States Food and Drug Administration, such as buprenorphine, methadone, or <ln numlevel="1" lineno="166" slineno="1-144"/>naltrexone, to treat substance use withdrawal symptoms or a substance use disorder.</amend></subsection><subsection ssid="3-3-102" dnum="32-o:33-e" numlevel="1" lineno="167" slineno="1-145" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1107" style="2" owner="o" level="1" deltag="both">(32)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="both" space="true">(33)</amend></display>"Minor" means child.</subsection><subsection ssid="3-3-103" dnum="33-o:34-e" numlevel="1" lineno="168" slineno="1-146" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1108" style="2" owner="o" level="1" deltag="both">(33)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1109" style="1" owner="e" level="1" amendtag="both" space="true">(34)</amend></display>"Office" means the Office of Licensing within the department.</subsection><subsection ssid="3-3-104" dnum="34-o:35-e" numlevel="1" lineno="169" slineno="1-147" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1109" style="2" owner="o" level="1" deltag="both">(34)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1110" style="1" owner="e" level="1" amendtag="both" space="true">(35)</amend></display>"Outdoor youth program" means a program that provides:<subsection ssid="3-3-105" dnum="a-o" numlevel="1" lineno="170" slineno="1-148" level="2"><display>(a)</display>services to a child that has:<subsection ssid="3-3-106" dnum="i-o" numlevel="1" lineno="171" slineno="1-149" level="3"><display>(i)</display>a chemical dependency; or</subsection><subsection ssid="3-3-107" dnum="ii-o" numlevel="1" lineno="172" slineno="1-150" level="3"><display>(ii)</display>a dysfunction or impairment that is emotional, psychological, developmental, <ln numlevel="1" lineno="173" slineno="1-151"/>physical, or behavioral;</subsection></subsection><subsection ssid="3-3-108" dnum="b-o" numlevel="1" lineno="174" slineno="1-152" level="2"><display>(b)</display>a 24-hour outdoor group living environment; and</subsection><subsection ssid="3-3-109" dnum="c-o" numlevel="1" lineno="175" slineno="1-153" level="2" space="false"><display>(c)</display><subsection ssid="3-3-110" dnum="i-o" level="3" placement="sameline"><display>(i)</display>regular therapy, including group, individual, or supportive family therapy; or</subsection><subsection ssid="3-3-111" dnum="ii-o" numlevel="1" lineno="176" slineno="1-154" level="3"><display>(ii)</display>informal therapy or similar services, including wilderness therapy, adventure <ln numlevel="1" lineno="177" slineno="1-155"/>therapy, or outdoor behavioral healthcare.</subsection></subsection></subsection><subsection ssid="3-3-112" dnum="35-o:36-e" numlevel="1" lineno="178" slineno="1-156" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1117" style="2" owner="o" level="1" deltag="both">(35)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1118" style="1" owner="e" level="1" amendtag="both" space="true">(36)</amend></display>"Outpatient treatment" means individual, family, or group therapy or counseling <ln numlevel="1" lineno="179" slineno="1-157"/>designed to improve and enhance social or psychological functioning for those whose <ln numlevel="1" lineno="180" slineno="1-158"/>physical and emotional status allows them to continue functioning in their usual living <ln numlevel="1" lineno="181" slineno="1-159"/>environment.</subsection><subsection ssid="3-3-113" dnum="36-o:37-e" numlevel="1" lineno="182" slineno="1-160" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1118" style="2" owner="o" level="1" deltag="both">(36)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1119" style="1" owner="e" level="1" amendtag="both" space="true">(37)</amend></display>"Practice group" or "group practice" means two or more health care providers <ln numlevel="1" lineno="183" slineno="1-161"/>legally organized as a partnership, professional corporation, or similar association, for <ln numlevel="1" lineno="184" slineno="1-162"/>which:<subsection ssid="3-3-114" dnum="a-o" numlevel="1" lineno="185" slineno="1-163" level="2"><display>(a)</display>substantially all of the services of the health care providers who are members of the <ln numlevel="1" lineno="186" slineno="1-164"/>group are provided through the group and are billed in the name of the group and <ln numlevel="1" lineno="187" slineno="1-165"/>amounts received are treated as receipts of the group; and</subsection><subsection ssid="3-3-115" dnum="b-o" numlevel="1" lineno="188" slineno="1-166" level="2"><display>(b)</display>the overhead expenses of and the income from the practice are distributed in <ln numlevel="1" lineno="189" slineno="1-167"/>accordance with methods previously determined by members of the group.</subsection></subsection><subsection ssid="3-3-116" dnum="37-o:38-e" numlevel="1" lineno="190" slineno="1-168" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1121" style="2" owner="o" level="1" deltag="both">(37)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1" amendtag="both" space="true">(38)</amend></display>"Private-placement child" means a child whose parent or guardian enters into a <ln numlevel="1" lineno="191" slineno="1-169"/>contract with a congregate care program for the child to receive services.</subsection><subsection ssid="3-231" dnum="_-o:39-e" numlevel="1" lineno="192" slineno="1-170" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1" amendtag="start">(39)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="56" style="1" owner="admin" level="1" amendtag="end">"Qualifying residential treatment program" means a residential treatment program that <ln numlevel="1" lineno="193" slineno="1-171"/>is licensed under this part and:</amend><subsection ssid="3-233" dnum="_-o:a-e" numlevel="1" lineno="194" slineno="1-172" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="88" style="1" owner="admin" level="1" amendtag="end">is operated as a nonprofit corporation or foreign nonprofit corporation, as those terms <ln numlevel="1" lineno="195" slineno="1-173"/>are defined in Section <xref depth="3" refnumber="16-6a-102">16-6a-102</xref>; or</amend></subsection><subsection ssid="3-238" dnum="_-o:b-e" numlevel="1" lineno="196" slineno="1-174" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="93" style="1" owner="admin" level="1" amendtag="end">receives any local, state, or federal government funding, government grant money, or <ln numlevel="1" lineno="197" slineno="1-175"/>any other form of government assistance to operate or provide services or training in <ln numlevel="1" lineno="198" slineno="1-176"/>the ordinary course of business.</amend></subsection></subsection><subsection ssid="3-234" dnum="_-o:40-e" numlevel="1" lineno="199" slineno="1-177" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="e" level="1" amendtag="start">(40)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="68" style="1" owner="admin" level="1" amendtag="end">"Qualifying recovery residence" means a recovery residence that is licensed under this <ln numlevel="1" lineno="200" slineno="1-178"/>part and:</amend><subsection ssid="3-236" dnum="_-o:a-e" numlevel="1" lineno="201" slineno="1-179" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="76" style="1" owner="admin" level="1" amendtag="end">is operated as a nonprofit corporation or foreign nonprofit corporation, as those terms <ln numlevel="1" lineno="202" slineno="1-180"/>are defined in Section <xref depth="3" refnumber="16-6a-102">16-6a-102</xref>; or</amend></subsection><subsection ssid="3-239" dnum="_-o:b-e" numlevel="1" lineno="203" slineno="1-181" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="91" style="1" owner="admin" level="1" amendtag="end">receives any local, state, or federal government funding, government grant money, or <ln numlevel="1" lineno="204" slineno="1-182"/>any other form of government assistance to operate or provide services or training in <ln numlevel="1" lineno="205" slineno="1-183"/>the ordinary course of business.</amend></subsection></subsection><subsection ssid="3-3-117" dnum="38-o:41-e" numlevel="1" lineno="206" slineno="1-184" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1" deltag="both">(38)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1129" style="1" owner="e" level="1" amendtag="both" space="true">(41)</amend></display><subsection ssid="3-3-118" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Recovery residence" means a home, residence, or facility that meets at <ln numlevel="1" lineno="207" slineno="1-185"/>least two of the following requirements:<subsection ssid="3-3-119" dnum="i-o" numlevel="1" lineno="208" slineno="1-186" level="3" tab="1"><display>(i)</display>provides a supervised living environment for individuals recovering from a <ln numlevel="1" lineno="209" slineno="1-187"/>substance use disorder;</subsection><subsection ssid="3-3-120" dnum="ii-o" numlevel="1" lineno="210" slineno="1-188" level="3" tab="1"><display>(ii)</display>provides a living environment in which more than half of the individuals in the <ln numlevel="1" lineno="211" slineno="1-189"/>residence are recovering from a substance use disorder;</subsection><subsection ssid="3-3-121" dnum="iii-o" numlevel="1" lineno="212" slineno="1-190" level="3" tab="1"><display>(iii)</display>provides or arranges for residents to receive services related to the resident's <ln numlevel="1" lineno="213" slineno="1-191"/>recovery from a substance use disorder, either on or off site;</subsection><subsection ssid="3-3-122" dnum="iv-o" numlevel="1" lineno="214" slineno="1-192" level="3" tab="1"><display>(iv)</display>is held out as a living environment in which individuals recovering from <ln numlevel="1" lineno="215" slineno="1-193"/>substance abuse disorders live together to encourage continued sobriety; or</subsection><subsection ssid="3-3-123" dnum="v-o" numlevel="1" lineno="216" slineno="1-194" level="3" tab="1" space="false"><display>(v)</display><subsection ssid="3-3-124" dnum="A-o" level="4" placement="sameline"><display>(A)</display>receives public funding; or</subsection><subsection ssid="3-3-125" dnum="B-o" numlevel="1" lineno="217" slineno="1-195" level="4"><display>(B)</display>is run as a business venture, either for-profit or not-for-profit.</subsection></subsection></subsection><subsection ssid="3-3-126" dnum="b-o" numlevel="1" lineno="218" slineno="1-196" level="2"><display>(b)</display>"Recovery residence" does not mean:<subsection ssid="3-3-127" dnum="i-o" numlevel="1" lineno="219" slineno="1-197" level="3"><display>(i)</display>a residential treatment program;</subsection><subsection ssid="3-3-128" dnum="ii-o" numlevel="1" lineno="220" slineno="1-198" level="3"><display>(ii)</display>residential support program; or</subsection><subsection ssid="3-3-129" dnum="iii-o" numlevel="1" lineno="221" slineno="1-199" level="3"><display>(iii)</display>a home, residence, or facility, in which:<subsection ssid="3-3-130" dnum="A-o" numlevel="1" lineno="222" slineno="1-200" level="4"><display>(A)</display>residents, by a majority vote of the residents, establish, implement, and <ln numlevel="1" lineno="223" slineno="1-201"/>enforce policies governing the living environment, including the manner in <ln numlevel="1" lineno="224" slineno="1-202"/>which applications for residence are approved and the manner in which <ln numlevel="1" lineno="225" slineno="1-203"/>residents are expelled;</subsection><subsection ssid="3-3-131" dnum="B-o" numlevel="1" lineno="226" slineno="1-204" level="4"><display>(B)</display>residents equitably share rent and housing-related expenses; and</subsection><subsection ssid="3-3-132" dnum="C-o" numlevel="1" lineno="227" slineno="1-205" level="4"><display>(C)</display>a landlord, owner, or operator does not receive compensation, other than fair <ln numlevel="1" lineno="228" slineno="1-206"/>market rental income, for establishing, implementing, or enforcing policies <ln numlevel="1" lineno="229" slineno="1-207"/>governing the living environment.</subsection></subsection></subsection></subsection><subsection ssid="3-3-133" dnum="39-o:42-e" numlevel="1" lineno="230" slineno="1-208" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1144" style="2" owner="o" level="1" deltag="both">(39)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1145" style="1" owner="e" level="1" amendtag="both" space="true">(42)</amend></display>"Regular business hours" means:<subsection ssid="3-3-134" dnum="a-o" numlevel="1" lineno="231" slineno="1-209" level="2"><display>(a)</display>the hours during which services of any kind are provided to a client; or</subsection><subsection ssid="3-3-135" dnum="b-o" numlevel="1" lineno="232" slineno="1-210" level="2"><display>(b)</display>the hours during which a client is present at the facility of a licensee.</subsection></subsection><subsection ssid="3-3-136" dnum="40-o:43-e" numlevel="1" lineno="233" slineno="1-211" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1147" style="2" owner="o" level="1" deltag="both">(40)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1148" style="1" owner="e" level="1" amendtag="both" space="true">(43)</amend></display><subsection ssid="3-3-137" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residential support program" means a program that arranges for or <ln numlevel="1" lineno="234" slineno="1-212"/>provides the necessities of life as a protective service to individuals or families who <ln numlevel="1" lineno="235" slineno="1-213"/>have a disability or who are experiencing a dislocation or emergency that prevents <ln numlevel="1" lineno="236" slineno="1-214"/>them from providing these services for themselves or their families.</subsection><subsection ssid="3-3-138" dnum="b-o" numlevel="1" lineno="237" slineno="1-215" level="2"><display>(b)</display>"Residential support program" includes a program that provides a supervised living <ln numlevel="1" lineno="238" slineno="1-216"/>environment for individuals with dysfunctions or impairments that are:<subsection ssid="3-3-139" dnum="i-o" numlevel="1" lineno="239" slineno="1-217" level="3"><display>(i)</display>emotional;</subsection><subsection ssid="3-3-140" dnum="ii-o" numlevel="1" lineno="240" slineno="1-218" level="3"><display>(ii)</display>psychological;</subsection><subsection ssid="3-3-141" dnum="iii-o" numlevel="1" lineno="241" slineno="1-219" level="3"><display>(iii)</display>developmental; or</subsection><subsection ssid="3-3-142" dnum="iv-o" numlevel="1" lineno="242" slineno="1-220" level="3"><display>(iv)</display>behavioral.</subsection></subsection><subsection ssid="3-3-143" dnum="c-o" numlevel="1" lineno="243" slineno="1-221" level="2"><display>(c)</display>Treatment is not a necessary component of a residential support program.</subsection><subsection ssid="3-3-144" dnum="d-o" numlevel="1" lineno="244" slineno="1-222" level="2"><display>(d)</display>"Residential support program" does not include:<subsection ssid="3-3-145" dnum="i-o" numlevel="1" lineno="245" slineno="1-223" level="3"><display>(i)</display>a recovery residence; or</subsection><subsection ssid="3-3-146" dnum="ii-o" numlevel="1" lineno="246" slineno="1-224" level="3"><display>(ii)</display>a program that provides residential services that are performed:<subsection ssid="3-3-147" dnum="A-o" numlevel="1" lineno="247" slineno="1-225" level="4"><display>(A)</display>exclusively under contract with the department and provided to individuals <ln numlevel="1" lineno="248" slineno="1-226"/>through the Division of Services for People with Disabilities; or</subsection><subsection ssid="3-3-148" dnum="B-o" numlevel="1" lineno="249" slineno="1-227" level="4"><display>(B)</display>in a facility that serves fewer than four individuals.</subsection></subsection></subsection></subsection><subsection ssid="3-3-149" dnum="41-o:44-e" numlevel="1" lineno="250" slineno="1-228" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1160" style="2" owner="o" level="1" deltag="both">(41)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1161" style="1" owner="e" level="1" amendtag="both" space="true">(44)</amend></display><subsection ssid="3-3-150" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residential treatment" means a 24-hour group living environment for four <ln numlevel="1" lineno="251" slineno="1-229"/>or more individuals unrelated to the owner or provider that offers room or board and <ln numlevel="1" lineno="252" slineno="1-230"/>specialized treatment, behavior modification, rehabilitation, discipline, emotional <ln numlevel="1" lineno="253" slineno="1-231"/>growth, or habilitation services for persons with emotional, psychological, <ln numlevel="1" lineno="254" slineno="1-232"/>developmental, or behavioral dysfunctions, impairments, or chemical dependencies.</subsection><subsection ssid="3-3-151" dnum="b-o" numlevel="1" lineno="255" slineno="1-233" level="2"><display>(b)</display>"Residential treatment" does not include a:<subsection ssid="3-3-152" dnum="i-o" numlevel="1" lineno="256" slineno="1-234" level="3"><display>(i)</display>boarding school;</subsection><subsection ssid="3-3-153" dnum="ii-o" numlevel="1" lineno="257" slineno="1-235" level="3"><display>(ii)</display>foster home; or</subsection><subsection ssid="3-3-154" dnum="iii-o" numlevel="1" lineno="258" slineno="1-236" level="3"><display>(iii)</display>recovery residence.</subsection></subsection></subsection><subsection ssid="3-3-155" dnum="42-o:45-e" numlevel="1" lineno="259" slineno="1-237" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1166" style="2" owner="o" level="1" deltag="both">(42)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1167" style="1" owner="e" level="1" amendtag="both" space="true">(45)</amend></display>"Residential treatment program" means a program or facility that provides:<subsection ssid="3-3-156" dnum="a-o" numlevel="1" lineno="260" slineno="1-238" level="2"><display>(a)</display>residential treatment; or</subsection><subsection ssid="3-3-157" dnum="b-o" numlevel="1" lineno="261" slineno="1-239" level="2"><display>(b)</display>intermediate secure treatment.</subsection></subsection><subsection ssid="3-3-158" dnum="43-o:46-e" numlevel="1" lineno="262" slineno="1-240" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1169" style="2" owner="o" level="1" deltag="both">(43)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1170" style="1" owner="e" level="1" amendtag="both" space="true">(46)</amend></display>"Seclusion" means the involuntary confinement of an individual in a room or an <ln numlevel="1" lineno="263" slineno="1-241"/>area:<subsection ssid="3-3-159" dnum="a-o" numlevel="1" lineno="264" slineno="1-242" level="2"><display>(a)</display>away from the individual's peers; and</subsection><subsection ssid="3-3-160" dnum="b-o" numlevel="1" lineno="265" slineno="1-243" level="2"><display>(b)</display>in a manner that physically prevents the individual from leaving the room or area.</subsection></subsection><subsection ssid="3-3-161" dnum="44-o:47-e" numlevel="1" lineno="266" slineno="1-244" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1172" style="2" owner="o" level="1" deltag="both">(44)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1173" style="1" owner="e" level="1" amendtag="both" space="true">(47)</amend></display>"Short-term relief care provider" means an individual who:<subsection ssid="3-3-162" dnum="a-o" numlevel="1" lineno="267" slineno="1-245" level="2"><display>(a)</display>provides short-term and temporary relief care to a foster parent:<subsection ssid="3-3-163" dnum="i-o" numlevel="1" lineno="268" slineno="1-246" level="3"><display>(i)</display>for less than six consecutive nights; and</subsection><subsection ssid="3-3-164" dnum="ii-o" numlevel="1" lineno="269" slineno="1-247" level="3"><display>(ii)</display>in the short-term relief care provider's home;</subsection></subsection><subsection ssid="3-3-165" dnum="b-o" numlevel="1" lineno="270" slineno="1-248" level="2"><display>(b)</display>is an immediate family member or relative, as those terms are defined in Section <xref depth="3" refnumber="80-3-102"><ln numlevel="1" lineno="271" slineno="1-249"/>80-3-102</xref>, of the foster parent;</subsection><subsection ssid="3-3-166" dnum="c-o" numlevel="1" lineno="272" slineno="1-250" level="2"><display>(c)</display>is direct access qualified, as that term is defined in Section <xref depth="3" refnumber="26B-2-120">26B-2-120</xref>;</subsection><subsection ssid="3-3-167" dnum="d-o" numlevel="1" lineno="273" slineno="1-251" level="2"><display>(d)</display>has been approved to provide short-term relief care by the department;</subsection><subsection ssid="3-3-168" dnum="e-o" numlevel="1" lineno="274" slineno="1-252" level="2"><display>(e)</display>is not reimbursed by the department for the temporary relief care provided; and</subsection><subsection ssid="3-3-169" dnum="f-o" numlevel="1" lineno="275" slineno="1-253" level="2"><display>(f)</display>is not an immediate family member or relative, as those terms are defined in Section <xref depth="3" refnumber="80-3-102"><ln numlevel="1" lineno="276" slineno="1-254"/>80-3-102</xref>, of the foster child.</subsection></subsection><subsection ssid="3-3-170" dnum="45-o:48-e" numlevel="1" lineno="277" slineno="1-255" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1181" style="2" owner="o" level="1" deltag="both">(45)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1182" style="1" owner="e" level="1" amendtag="both" space="true">(48)</amend></display>"Social detoxification" means short-term residential services for persons who are <ln numlevel="1" lineno="278" slineno="1-256"/>experiencing or have recently experienced drug or alcohol intoxication, that are provided <ln numlevel="1" lineno="279" slineno="1-257"/>outside of a health care facility licensed under Part 2, Health Care Facility Licensing and <ln numlevel="1" lineno="280" slineno="1-258"/>Inspection, and that include:<subsection ssid="3-3-171" dnum="a-o" numlevel="1" lineno="281" slineno="1-259" level="2"><display>(a)</display>room and board for persons who are unrelated to the owner or manager of the facility;</subsection><subsection ssid="3-3-172" dnum="b-o" numlevel="1" lineno="282" slineno="1-260" level="2"><display>(b)</display>specialized rehabilitation to acquire sobriety; and</subsection><subsection ssid="3-3-173" dnum="c-o" numlevel="1" lineno="283" slineno="1-261" level="2"><display>(c)</display>aftercare services.</subsection></subsection><subsection ssid="3-3-174" dnum="46-o:49-e" numlevel="1" lineno="284" slineno="1-262" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1185" style="2" owner="o" level="1" deltag="both">(46)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1186" style="1" owner="e" level="1" amendtag="both" space="true">(49)</amend></display>"Substance abuse disorder" or "substance use disorder" mean the same as <ln numlevel="1" lineno="285" slineno="1-263"/>"substance use disorder" is defined in Section <xref depth="3" refnumber="26B-5-501">26B-5-501</xref>.</subsection><subsection ssid="3-3-175" dnum="47-o:50-e" numlevel="1" lineno="286" slineno="1-264" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1186" style="2" owner="o" level="1" deltag="both">(47)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1187" style="1" owner="e" level="1" amendtag="both" space="true">(50)</amend></display>"Substance abuse treatment program" or "substance use disorder treatment <ln numlevel="1" lineno="287" slineno="1-265"/>program" means a program:<subsection ssid="3-3-176" dnum="a-o" numlevel="1" lineno="288" slineno="1-266" level="2"><display>(a)</display>designed to provide:<subsection ssid="3-3-177" dnum="i-o" numlevel="1" lineno="289" slineno="1-267" level="3"><display>(i)</display>specialized drug or alcohol treatment;</subsection><subsection ssid="3-3-178" dnum="ii-o" numlevel="1" lineno="290" slineno="1-268" level="3"><display>(ii)</display>rehabilitation; or</subsection><subsection ssid="3-3-179" dnum="iii-o" numlevel="1" lineno="291" slineno="1-269" level="3"><display>(iii)</display>habilitation services; and</subsection></subsection><subsection ssid="3-3-180" dnum="b-o" numlevel="1" lineno="292" slineno="1-270" level="2"><display>(b)</display>that provides the treatment or services described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="21" style="2" owner="admin" level="1" deltag="both">(47)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="admin" level="1" amendtag="both" space="true">(49)(a)</amend> to <ln numlevel="1" lineno="293" slineno="1-271"/>persons with:<subsection ssid="3-3-181" dnum="i-o" numlevel="1" lineno="294" slineno="1-272" level="3"><display>(i)</display>a diagnosed substance use disorder; or</subsection><subsection ssid="3-3-182" dnum="ii-o" numlevel="1" lineno="295" slineno="1-273" level="3"><display>(ii)</display>chemical dependency disorder.</subsection></subsection></subsection><subsection ssid="3-3-183" dnum="48-o:51-e" numlevel="1" lineno="296" slineno="1-274" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1194" style="2" owner="o" level="1" deltag="both">(48)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1195" style="1" owner="e" level="1" amendtag="both" space="true">(51)</amend></display>"Therapeutic school" means a residential group living facility:<subsection ssid="3-3-184" dnum="a-o" numlevel="1" lineno="297" slineno="1-275" level="2"><display>(a)</display>for four or more individuals that are not related to:<subsection ssid="3-3-185" dnum="i-o" numlevel="1" lineno="298" slineno="1-276" level="3"><display>(i)</display>the owner of the facility; or</subsection><subsection ssid="3-3-186" dnum="ii-o" numlevel="1" lineno="299" slineno="1-277" level="3"><display>(ii)</display>the primary service provider of the facility;</subsection></subsection><subsection ssid="3-3-187" dnum="b-o" numlevel="1" lineno="300" slineno="1-278" level="2"><display>(b)</display>that serves students who have a history of failing to function:<subsection ssid="3-3-188" dnum="i-o" numlevel="1" lineno="301" slineno="1-279" level="3"><display>(i)</display>at home;</subsection><subsection ssid="3-3-189" dnum="ii-o" numlevel="1" lineno="302" slineno="1-280" level="3"><display>(ii)</display>in a public school; or</subsection><subsection ssid="3-3-190" dnum="iii-o" numlevel="1" lineno="303" slineno="1-281" level="3"><display>(iii)</display>in a nonresidential private school; and</subsection></subsection><subsection ssid="3-3-191" dnum="c-o" numlevel="1" lineno="304" slineno="1-282" level="2"><display>(c)</display>that offers:<subsection ssid="3-3-192" dnum="i-o" numlevel="1" lineno="305" slineno="1-283" level="3"><display>(i)</display>room and board; and</subsection><subsection ssid="3-3-193" dnum="ii-o" numlevel="1" lineno="306" slineno="1-284" level="3"><display>(ii)</display>an academic education integrated with:<subsection ssid="3-3-194" dnum="A-o" numlevel="1" lineno="307" slineno="1-285" level="4"><display>(A)</display>specialized structure and supervision; or</subsection><subsection ssid="3-3-195" dnum="B-o" numlevel="1" lineno="308" slineno="1-286" level="4"><display>(B)</display>services or treatment related to:<subsection ssid="3-3-196" dnum="I-o" numlevel="1" lineno="309" slineno="1-287" level="5"><display>(I)</display>a disability;</subsection><subsection ssid="3-3-197" dnum="II-o" numlevel="1" lineno="310" slineno="1-288" level="5"><display>(II)</display>emotional development;</subsection><subsection ssid="3-3-198" dnum="III-o" numlevel="1" lineno="311" slineno="1-289" level="5"><display>(III)</display>behavioral development;</subsection><subsection ssid="3-3-199" dnum="IV-o" numlevel="1" lineno="312" slineno="1-290" level="5"><display>(IV)</display>familial development; or</subsection><subsection ssid="3-3-200" dnum="V-o" numlevel="1" lineno="313" slineno="1-291" level="5"><display>(V)</display>social development.</subsection></subsection></subsection></subsection></subsection><subsection ssid="3-3-201" dnum="49-o:52-e" numlevel="1" lineno="314" slineno="1-292" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1212" style="2" owner="o" level="1" deltag="both">(49)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1213" style="1" owner="e" level="1" amendtag="both" space="true">(52)</amend></display>"Unrelated persons" means persons other than parents, legal guardians, <ln numlevel="1" lineno="315" slineno="1-293"/>grandparents, brothers, sisters, uncles, or aunts.</subsection><subsection ssid="3-3-202" dnum="50-o:53-e" numlevel="1" lineno="316" slineno="1-294" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1213" style="2" owner="o" level="1" deltag="both">(50)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1214" style="1" owner="e" level="1" amendtag="both" space="true">(53)</amend></display>"Vulnerable adult" means an elder adult or an adult who has a temporary or <ln numlevel="1" lineno="317" slineno="1-295"/>permanent mental or physical impairment that substantially affects the person's ability to:<subsection ssid="3-3-203" dnum="a-o" numlevel="1" lineno="318" slineno="1-296" level="2"><display>(a)</display>provide personal protection;</subsection><subsection ssid="3-3-204" dnum="b-o" numlevel="1" lineno="319" slineno="1-297" level="2"><display>(b)</display>provide necessities such as food, shelter, clothing, or mental or other health care;</subsection><subsection ssid="3-3-205" dnum="c-o" numlevel="1" lineno="320" slineno="1-298" level="2"><display>(c)</display>obtain services necessary for health, safety, or welfare;</subsection><subsection ssid="3-3-206" dnum="d-o" numlevel="1" lineno="321" slineno="1-299" level="2"><display>(d)</display>carry out the activities of daily living;</subsection><subsection ssid="3-3-207" dnum="e-o" numlevel="1" lineno="322" slineno="1-300" level="2"><display>(e)</display>manage the adult's own resources; or</subsection><subsection ssid="3-3-208" dnum="f-o" numlevel="1" lineno="323" slineno="1-301" level="2"><display>(f)</display>comprehend the nature and consequences of remaining in a situation of abuse, <ln numlevel="1" lineno="324" slineno="1-302"/>neglect, or exploitation.</subsection></subsection><subsection ssid="3-3-209" dnum="51-o:54-e" numlevel="1" lineno="325" slineno="1-303" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1220" style="2" owner="o" level="1" deltag="both">(51)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1221" style="1" owner="e" level="1" amendtag="both" space="true">(54)</amend></display><subsection ssid="3-3-210" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Youth program" means a program designed to provide behavioral, <ln numlevel="1" lineno="326" slineno="1-304"/>substance use, or mental health services to minors that:<subsection ssid="3-3-211" dnum="i-o" numlevel="1" lineno="327" slineno="1-305" level="3" tab="1"><display>(i)</display>serves adjudicated or nonadjudicated youth;</subsection><subsection ssid="3-3-212" dnum="ii-o" numlevel="1" lineno="328" slineno="1-306" level="3" tab="1"><display>(ii)</display>charges a fee for the program's services;</subsection><subsection ssid="3-3-213" dnum="iii-o" numlevel="1" lineno="329" slineno="1-307" level="3" tab="1"><display>(iii)</display>may provide host homes or other arrangements for overnight accommodation of <ln numlevel="1" lineno="330" slineno="1-308"/>the youth;</subsection><subsection ssid="3-3-214" dnum="iv-o" numlevel="1" lineno="331" slineno="1-309" level="3" tab="1"><display>(iv)</display>may provide all or part of the program's services in the outdoors;</subsection><subsection ssid="3-3-215" dnum="v-o" numlevel="1" lineno="332" slineno="1-310" level="3" tab="1"><display>(v)</display>may limit or censor access to parents or guardians; and</subsection><subsection ssid="3-3-216" dnum="vi-o" numlevel="1" lineno="333" slineno="1-311" level="3" tab="1"><display>(vi)</display>prohibits or restricts a minor's ability to leave the program at any time of the <ln numlevel="1" lineno="334" slineno="1-312"/>minor's own free will.</subsection></subsection><subsection ssid="3-3-217" dnum="b-o" numlevel="1" lineno="335" slineno="1-313" level="2"><display>(b)</display>"Youth program" does not include recreational programs such as Boy Scouts, Girl <ln numlevel="1" lineno="336" slineno="1-314"/>Scouts, 4-H, and other such organizations.</subsection></subsection><subsection ssid="3-3-218" dnum="52-o:55-e" numlevel="1" lineno="337" slineno="1-315" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1229" style="2" owner="o" level="1" deltag="both">(52)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1230" style="1" owner="e" level="1" amendtag="both" space="true">(55)</amend></display><subsection ssid="3-3-219" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Youth transportation company" means any person that transports a child <ln numlevel="1" lineno="338" slineno="1-316"/>for payment to or from a congregate care program in Utah.</subsection><subsection ssid="3-3-220" dnum="b-o" numlevel="1" lineno="339" slineno="1-317" level="2"><display>(b)</display>"Youth transportation company" does not include:<subsection ssid="3-3-221" dnum="i-o" numlevel="1" lineno="340" slineno="1-318" level="3"><display>(i)</display>a relative of the child;</subsection><subsection ssid="3-3-222" dnum="ii-o" numlevel="1" lineno="341" slineno="1-319" level="3"><display>(ii)</display>a state agency; or</subsection><subsection ssid="3-3-223" dnum="iii-o" numlevel="1" lineno="342" slineno="1-320" level="3"><display>(iii)</display>a congregate care program's employee who transports the child from the <ln numlevel="1" lineno="343" slineno="1-321"/>congregate care program that employs the employee and returns the child to the <ln numlevel="1" lineno="344" slineno="1-322"/>same congregate care program.</subsection></subsection></subsection></section></bsec><bsec buid="1" num="26B-2-117" type="amend" src="code" uid="C26B-2-S117_2025050720250507" sort="26B02 01170020250507" numlevel="1" lineno="345" slineno="2-1" sn="2"><section number="26B-2-117" numlevel="1" lineno="346" slineno="2-2" type="amend"><secline lineno="345">Section 2, Section <bold>26B-2-117</bold> is amended to read:</secline><catline lineno="346"><bold>26B-2-117<parens/>. Licensing residential treatment programs and recovery residences -- <ln numlevel="1" lineno="347" slineno="2-3"/>Notification of local government.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="348" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-1-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="349" slineno="2-5"/>the office shall make rules that establish categories of residential treatment and <ln numlevel="1" lineno="350" slineno="2-6"/>recovery residence licenses based on differences in the types of residential treatment <ln numlevel="1" lineno="351" slineno="2-7"/>programs and recovery residences.</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="352" slineno="2-8" level="2"><display>(b)</display>The categories referred to in Subsection <xref depth="4" refnumber="26B-2-117(1)(a)" start="0">(1)(a)</xref> may be based on differences in:<subsection ssid="1-1-4" dnum="i-o" numlevel="1" lineno="353" slineno="2-9" level="3"><display>(i)</display>services offered;</subsection><subsection ssid="1-1-5" dnum="ii-o" numlevel="1" lineno="354" slineno="2-10" level="3"><display>(ii)</display>types of clients served;</subsection><subsection ssid="1-1-6" dnum="iii-o" numlevel="1" lineno="355" slineno="2-11" level="3"><display>(iii)</display>risks posed to the community; or</subsection><subsection ssid="1-1-7" dnum="iv-o" numlevel="1" lineno="356" slineno="2-12" level="3"><display>(iv)</display>other factors that make regulatory differences advisable.</subsection></subsection></subsection><subsection ssid="1-1-8" dnum="2-o" numlevel="1" lineno="357" slineno="2-13" level="1"><display>(2)</display>Subject to the requirements of federal and state law, and pursuant to the authority <ln numlevel="1" lineno="358" slineno="2-14"/>granted by Section <xref depth="3" refnumber="26B-2-104" start="0">26B-2-104</xref>, the office shall establish and enforce rules that:<subsection ssid="1-1-9" dnum="a-o" numlevel="1" lineno="359" slineno="2-15" level="2" space="false"><display>(a)</display><subsection ssid="1-28" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="e" level="1" amendtag="both">(i)</amend></display>relate generally to all categories of residential treatment program and recovery <ln numlevel="1" lineno="360" slineno="2-16"/>residence licenses; and</subsection><subsection ssid="1-1-10" dnum="b-o:ii-e" numlevel="1" lineno="361" slineno="2-17" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1245" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1246" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>relate to specific categories of residential treatment program and recovery <ln numlevel="1" lineno="362" slineno="2-18"/>residence licenses on the basis of the regulatory needs, as determined by the <ln numlevel="1" lineno="363" slineno="2-19"/>office, of residential treatment programs and recovery residences within those <ln numlevel="1" lineno="364" slineno="2-20"/>specific categories<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="27" style="1" owner="admin" level="1" amendtag="both" space="true">;</amend></subsection></subsection><subsection ssid="1-29" dnum="_-o:b-e" numlevel="1" lineno="365" slineno="2-21" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="admin" level="1" amendtag="end">preclude each qualified residential treatment program and each qualified recovery <ln numlevel="1" lineno="366" slineno="2-22"/>residence from refusing to accept a client based solely on the client's use of <ln numlevel="1" lineno="367" slineno="2-23"/>medication assisted treatment consistent with the recommendation of a licensed <ln numlevel="1" lineno="368" slineno="2-24"/>prescriber or provider;</amend></subsection><subsection ssid="1-31" dnum="_-o:c-e" numlevel="1" lineno="369" slineno="2-25" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="25" style="1" owner="admin" level="1" amendtag="end">require each qualified residential treatment program and each qualified recovery <ln numlevel="1" lineno="370" slineno="2-26"/>residence to allow a client to receive medication assisted treatment as recommended <ln numlevel="1" lineno="371" slineno="2-27"/>by a licensed prescriber or provider; and</amend></subsection><subsection ssid="1-32" dnum="_-o:d-e" numlevel="1" lineno="372" slineno="2-28" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="31" style="1" owner="admin" level="1" amendtag="end">require that each Medicaid provider contract with a qualified residential treatment <ln numlevel="1" lineno="373" slineno="2-29"/>program or a qualified recovery residence includes a provision obligating the <ln numlevel="1" lineno="374" slineno="2-30"/>provider to comply with rules enacted pursuant to Subsections (2)(b) and (c), subject <ln numlevel="1" lineno="375" slineno="2-31"/>to the sanctions provided pursuant to Subsection <xref tempid="741" depth="4" refnumber="26B-3-108(6)">26B-3-108(6)</xref>.</amend></subsection></subsection><subsection ssid="1-1-11" dnum="3-o" numlevel="1" lineno="376" slineno="2-32" level="1" space="false"><display>(3)</display><subsection ssid="1-1-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2014, the office shall charge an annual licensing fee, set by the <ln numlevel="1" lineno="377" slineno="2-33"/>office in accordance with the procedures described in Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, to a <ln numlevel="1" lineno="378" slineno="2-34"/>recovery residence in an amount that will pay for the cost of the licensing and <ln numlevel="1" lineno="379" slineno="2-35"/>inspection requirements described in this section and in Section <xref depth="3" refnumber="26B-2-104" start="0">26B-2-104</xref>.</subsection><subsection ssid="1-1-13" dnum="b-o" numlevel="1" lineno="380" slineno="2-36" level="2"><display>(b)</display>The office shall deposit the licensing fees described in this section in the General <ln numlevel="1" lineno="381" slineno="2-37"/>Fund as a dedicated credit to be used solely to pay for the cost of the licensing and <ln numlevel="1" lineno="382" slineno="2-38"/>inspection requirements described in this section and in Section <xref depth="3" refnumber="26B-2-104" start="0">26B-2-104</xref>.</subsection></subsection><subsection ssid="1-1-14" dnum="4-o" numlevel="1" lineno="383" slineno="2-39" level="1"><display>(4)</display>Before submitting an application for a license to operate a residential treatment <ln numlevel="1" lineno="384" slineno="2-40"/>program, the applicant shall serve notice of its intent to operate a residential treatment <ln numlevel="1" lineno="385" slineno="2-41"/>program on the governing body of:<subsection ssid="1-1-15" dnum="a-o" numlevel="1" lineno="386" slineno="2-42" level="2"><display>(a)</display>the city in which the residential treatment program will be located; or</subsection><subsection ssid="1-1-16" dnum="b-o" numlevel="1" lineno="387" slineno="2-43" level="2"><display>(b)</display>if the residential treatment program will be located in the unincorporated area of a <ln numlevel="1" lineno="388" slineno="2-44"/>county, the county in which the residential treatment program will be located.</subsection></subsection><subsection ssid="1-1-17" dnum="5-o" numlevel="1" lineno="389" slineno="2-45" level="1"><display>(5)</display>The notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref> shall include the following information relating <ln numlevel="1" lineno="390" slineno="2-46"/>to the residential treatment program:<subsection ssid="1-1-18" dnum="a-o" numlevel="1" lineno="391" slineno="2-47" level="2"><display>(a)</display>an accurate description of the residential treatment program;</subsection><subsection ssid="1-1-19" dnum="b-o" numlevel="1" lineno="392" slineno="2-48" level="2"><display>(b)</display>the location where the residential treatment program will be operated;</subsection><subsection ssid="1-1-20" dnum="c-o" numlevel="1" lineno="393" slineno="2-49" level="2"><display>(c)</display>the services that will be provided by the residential treatment program;</subsection><subsection ssid="1-1-21" dnum="d-o" numlevel="1" lineno="394" slineno="2-50" level="2"><display>(d)</display>the type of clients that the residential treatment program will serve;</subsection><subsection ssid="1-1-22" dnum="e-o" numlevel="1" lineno="395" slineno="2-51" level="2"><display>(e)</display>the category of license for which the residential treatment program is applying to the <ln numlevel="1" lineno="396" slineno="2-52"/>office;</subsection><subsection ssid="1-1-23" dnum="f-o" numlevel="1" lineno="397" slineno="2-53" level="2"><display>(f)</display>the name, telephone number, and address of a person that may be contacted to make <ln numlevel="1" lineno="398" slineno="2-54"/>inquiries about the residential treatment program; and</subsection><subsection ssid="1-1-24" dnum="g-o" numlevel="1" lineno="399" slineno="2-55" level="2"><display>(g)</display>any other information that the office may require by rule.</subsection></subsection><subsection ssid="1-1-25" dnum="6-o" numlevel="1" lineno="400" slineno="2-56" level="1"><display>(6)</display>When submitting an application for a license to operate a residential treatment program, <ln numlevel="1" lineno="401" slineno="2-57"/>the applicant shall include with the application:<subsection ssid="1-1-26" dnum="a-o" numlevel="1" lineno="402" slineno="2-58" level="2"><display>(a)</display>a copy of the notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref>; and</subsection><subsection ssid="1-1-27" dnum="b-o" numlevel="1" lineno="403" slineno="2-59" level="2"><display>(b)</display>proof that the applicant served the notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref> on the <ln numlevel="1" lineno="404" slineno="2-60"/>governing body described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref>.</subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="405" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="405">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="406"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-7-25 3:03 PM</tm></rev></foot></leg>
