Ward</sponsorhead><otherSponsorhead>Senate Sponsor: Lincoln Fillmore</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill modifies zoning authority in an urban municipality.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines the term "urban municipality"; </hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">provides that a detached single family dwelling that is built on a lot of at least 6,000 <ln numlevel="1" lineno="10" slineno="0-10"/>square feet is a permitted use in a residential zone of an urban municipality; and</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="12" slineno="0-12" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="13">None</moniNone><oc numlevel="1" lineno="14" slineno="0-14">Other Special Clauses:</oc><ocNone lineno="15">None</ocNone><sa numlevel="1" lineno="16" slineno="0-16">Utah Code Sections Affected:<saamd numlevel="1" lineno="17" slineno="0-17"><snhead>AMENDS:</snhead><sn num="10-9a-505" src="code" uid="C10-9a-S505_2025050720250507" buid="2" sort="10 09a05050020250507" numlevel="1" lineno="18" slineno="0-18"><bold>10-9a-505</bold>, as last amended by Laws of Utah 2015, Chapter 327</sn></saamd><saent numlevel="1" lineno="19" slineno="0-19"><snhead>ENACTS:</snhead><sn num="10-9a-505.1" src="code" uid="C10-9a-S505.1_2025050720250507" buid="10" sort="10 09a05050120250507" numlevel="1" lineno="20" slineno="0-20"><bold>10-9a-505.1</bold>, Utah Code Annotated 1953</sn></saent></sa></lt><enacthead lineno="21"/><enact numlevel="1" lineno="22" slineno="0-22">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="2" num="10-9a-505" type="amend" src="code" uid="C10-9a-S505_2025050720250507" sort="10 09a05050020250507" numlevel="1" lineno="23" slineno="1-1" sn="1"><section number="10-9a-505" numlevel="1" lineno="24" slineno="1-2" type="amend"><secline lineno="23">Section 1, Section <bold>10-9a-505</bold> is amended to read:</secline><catline lineno="24"><bold>10-9a-505. Zoning districts.</bold></catline><subsection ssid="2-2-31" dnum="1-o" numlevel="1" lineno="25" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-2-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legislative body may divide the territory over which it has jurisdiction into <ln numlevel="1" lineno="26" slineno="1-4"/>zoning districts of a number, shape, and area that it considers appropriate to carry out <ln numlevel="1" lineno="27" slineno="1-5"/>the purposes of this chapter.</subsection><subsection ssid="2-2-33" dnum="b-o" numlevel="1" lineno="28" slineno="1-6" level="2"><display>(b)</display>Within those zoning districts, the legislative body may<amend anum="0" ea="amend" pairid="81" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="both">, subject to Section <xref depth="3" refnumber="10-9a-505.1"><ln numlevel="1" lineno="29" slineno="1-7"/>10-9a-505.1</xref>,</amend> regulate and restrict the erection, construction, reconstruction, <ln numlevel="1" lineno="30" slineno="1-8"/>alteration, repair, or use of buildings and structures, and the use of land.</subsection><subsection ssid="2-2-34" dnum="c-o" numlevel="1" lineno="31" slineno="1-9" level="2"><display>(c)</display>A municipality may enact an ordinance regulating land use and development in a <ln numlevel="1" lineno="32" slineno="1-10"/>flood plain or potential geologic hazard area to:<subsection ssid="2-2-35" dnum="i-o" numlevel="1" lineno="33" slineno="1-11" level="3"><display>(i)</display>protect life; and</subsection><subsection ssid="2-2-36" dnum="ii-o" numlevel="1" lineno="34" slineno="1-12" level="3"><display>(ii)</display>prevent:<subsection ssid="2-2-37" dnum="A-o" numlevel="1" lineno="35" slineno="1-13" level="4"><display>(A)</display>the substantial loss of real property; or</subsection><subsection ssid="2-2-38" dnum="B-o" numlevel="1" lineno="36" slineno="1-14" level="4"><display>(B)</display>substantial damage to real property.</subsection></subsection></subsection></subsection><subsection ssid="2-2-39" dnum="2-o" numlevel="1" lineno="37" slineno="1-15" level="1"><display>(2)</display>The legislative body shall ensure that the regulations are uniform for each class or kind <ln numlevel="1" lineno="38" slineno="1-16"/>of buildings throughout each zoning district, but the regulations in one zone may differ <ln numlevel="1" lineno="39" slineno="1-17"/>from those in other zones.</subsection><subsection ssid="2-2-40" dnum="3-o" numlevel="1" lineno="40" slineno="1-18" level="1" space="false"><display>(3)</display><subsection ssid="2-2-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is no minimum area or diversity of ownership requirement for a zone <ln numlevel="1" lineno="41" slineno="1-19"/>designation.</subsection><subsection ssid="2-2-42" dnum="b-o" numlevel="1" lineno="42" slineno="1-20" level="2"><display>(b)</display>Neither the size of a zoning district nor the number of landowners within the district <ln numlevel="1" lineno="43" slineno="1-21"/>may be used as evidence of the illegality of a zoning district or of the invalidity of a <ln numlevel="1" lineno="44" slineno="1-22"/>municipal decision.</subsection></subsection><subsection ssid="2-2-43" dnum="4-o" numlevel="1" lineno="45" slineno="1-23" level="1"><display>(4)</display>A municipality may by ordinance exempt from specific zoning district standards a <ln numlevel="1" lineno="46" slineno="1-24"/>subdivision of land to accommodate the siting of a public utility infrastructure.</subsection></section></bsec><bsec buid="10" num="10-9a-505.1" type="enact" src="code" uid="C10-9a-S505.1_2025050720250507" sort="10 09a05050120250507" numlevel="1" lineno="47" slineno="2-1" sn="2"><section number="10-9a-505.1" numlevel="1" lineno="48" slineno="2-2" type="enact"><secline lineno="47">Section 2, Section <bold>10-9a-505.1</bold> is enacted to read:</secline><catline lineno="48"><bold>10-9a-505.1.
