Ward</sponsorhead><otherSponsorhead>Senate Sponsor: Heidi Balderree</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses access to adoption records.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">allows an individual who is adopted to access records associated with the individual's <ln numlevel="1" lineno="9" slineno="0-9"/>adoption when the individual is 18 years old or older;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">allows a birth parent to petition a court to keep the records associated with an individual's <ln numlevel="1" lineno="11" slineno="0-11"/>adoption sealed; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="13" slineno="0-13" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="14">None</moniNone><oc numlevel="1" lineno="15" slineno="0-15">Other Special Clauses:</oc><ocNone lineno="16">None</ocNone><sa numlevel="1" lineno="17" slineno="0-17">Utah Code Sections Affected:<saamd numlevel="1" lineno="18" slineno="0-18"><snhead>AMENDS:</snhead><sn num="26B-8-125" src="code" uid="C26B-8-S125_2025050720250507" buid="1" sort="26B08 01250020250507" numlevel="1" lineno="19" slineno="0-19"><bold>26B-8-125</bold>, as renumbered and amended by Laws of Utah 2023, Chapter 306</sn><sn num="78B-6-141" src="code" uid="C78B-6-S141_2025050720250507" buid="2" sort="78B06 01410020250507" numlevel="1" lineno="20" slineno="0-20"><bold>78B-6-141</bold>, as last amended by Laws of Utah 2021, Chapter 262</sn></saamd></sa></lt><enacthead lineno="21"/><enact numlevel="1" lineno="22" slineno="0-22">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="26B-8-125" type="amend" src="code" uid="C26B-8-S125_2025050720250507" sort="26B08 01250020250507" numlevel="1" lineno="23" slineno="1-1" sn="1"><section number="26B-8-125" numlevel="1" lineno="24" slineno="1-2" type="amend"><secline lineno="23">Section 1, Section <bold>26B-8-125</bold> is amended to read:</secline><catline lineno="24"><bold>26B-8-125. Inspection of vital records.</bold></catline><subsection ssid="1-1-37" dnum="1-o" numlevel="1" lineno="25" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-38" dnum="a-o" numlevel="1" lineno="26" slineno="1-4" level="2"><display>(a)</display>"Designated legal representative" means an attorney, physician, funeral service <ln numlevel="1" lineno="27" slineno="1-5"/>director, genealogist, or other agent of the subject, or an immediate family member of <ln numlevel="1" lineno="28" slineno="1-6"/>the subject, who has been delegated the authority to access vital records.</subsection><subsection ssid="1-1-39" dnum="b-o" numlevel="1" lineno="29" slineno="1-7" level="2"><display>(b)</display>"Drug use intervention or suicide prevention effort" means a program that studies or <ln numlevel="1" lineno="30" slineno="1-8"/>promotes the prevention of drug overdose deaths or suicides in the state.</subsection><subsection ssid="1-1-40" dnum="c-o" numlevel="1" lineno="31" slineno="1-9" level="2"><display>(c)</display>"Immediate family member" means a spouse, child, parent, sibling, grandparent, or <ln numlevel="1" lineno="32" slineno="1-10"/>grandchild.</subsection></subsection><subsection ssid="1-1-41" dnum="2-o" numlevel="1" lineno="33" slineno="1-11" level="1" space="false"><display>(2)</display><subsection ssid="1-1-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The vital records shall be open to inspection, but only in compliance with the <ln numlevel="1" lineno="34" slineno="1-12"/>provisions of this part, department rules, and Sections <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> and <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>.</subsection><subsection ssid="1-1-43" dnum="b-o" numlevel="1" lineno="35" slineno="1-13" level="2"><display>(b)</display>It is unlawful for any state or local officer or employee to disclose data contained in <ln numlevel="1" lineno="36" slineno="1-14"/>vital records contrary to this part, department rule, Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref>, or Section <xref depth="3" refnumber="78B-6-144" start="0"><ln numlevel="1" lineno="37" slineno="1-15"/>78B-6-144</xref>.</subsection><subsection ssid="1-1-44" dnum="c-o" numlevel="1" lineno="38" slineno="1-16" level="2" space="false"><display>(c)</display><subsection ssid="1-1-45" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An adoption document is open to inspection as provided in Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> <ln numlevel="1" lineno="39" slineno="1-17"/>or Section <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>.</subsection><subsection ssid="1-1-46" dnum="ii-o" numlevel="1" lineno="40" slineno="1-18" level="3"><display>(ii)</display>A birth parent may not access an adoption document under Subsection <xref depth="4" refnumber="78B-6-141(3)" start="0"><ln numlevel="1" lineno="41" slineno="1-19"/>78B-6-141(3)</xref>.</subsection></subsection><subsection ssid="1-1-47" dnum="d-o" numlevel="1" lineno="42" slineno="1-20" level="2"><display>(d)</display>A custodian of vital records may permit inspection of a vital record or issue a <ln numlevel="1" lineno="43" slineno="1-21"/>certified copy of a record or a part of a record when the custodian is satisfied that the <ln numlevel="1" lineno="44" slineno="1-22"/>applicant has demonstrated a direct, tangible, and legitimate interest.</subsection></subsection><subsection ssid="1-1-48" dnum="3-o" numlevel="1" lineno="45" slineno="1-23" level="1"><display>(3)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-8-125(4)" start="0">(4)</xref>, a direct, tangible, and legitimate interest in a vital <ln numlevel="1" lineno="46" slineno="1-24"/>record is present only if:<subsection ssid="1-1-49" dnum="a-o" numlevel="1" lineno="47" slineno="1-25" level="2"><display>(a)</display>the request is from:<subsection ssid="1-1-50" dnum="i-o" numlevel="1" lineno="48" slineno="1-26" level="3"><display>(i)</display>the subject;</subsection><subsection ssid="1-1-51" dnum="ii-o" numlevel="1" lineno="49" slineno="1-27" level="3"><display>(ii)</display>an immediate family member of the subject;</subsection><subsection ssid="1-1-52" dnum="iii-o" numlevel="1" lineno="50" slineno="1-28" level="3"><display>(iii)</display>the guardian of the subject;</subsection><subsection ssid="1-1-53" dnum="iv-o" numlevel="1" lineno="51" slineno="1-29" level="3"><display>(iv)</display>a designated legal representative of the subject; or</subsection><subsection ssid="1-1-54" dnum="v-o" numlevel="1" lineno="52" slineno="1-30" level="3"><display>(v)</display>a person, including a child-placing agency as defined in Section <xref depth="3" refnumber="78B-6-103" start="0">78B-6-103</xref>, with <ln numlevel="1" lineno="53" slineno="1-31"/>whom a child has been placed pending finalization of an adoption of the child;</subsection></subsection><subsection ssid="1-1-55" dnum="b-o" numlevel="1" lineno="54" slineno="1-32" level="2"><display>(b)</display>the request involves a personal or property right of the subject of the record;</subsection><subsection ssid="1-1-56" dnum="c-o" numlevel="1" lineno="55" slineno="1-33" level="2"><display>(c)</display>the request is for official purposes of a public health authority or a state, local, or <ln numlevel="1" lineno="56" slineno="1-34"/>federal governmental agency;</subsection><subsection ssid="1-1-57" dnum="d-o" numlevel="1" lineno="57" slineno="1-35" level="2"><display>(d)</display>the request is for a drug use intervention or suicide prevention effort or a statistical or <ln numlevel="1" lineno="58" slineno="1-36"/>medical research program and prior consent has been obtained from the state <ln numlevel="1" lineno="59" slineno="1-37"/>registrar; or</subsection><subsection ssid="1-1-58" dnum="e-o" numlevel="1" lineno="60" slineno="1-38" level="2"><display>(e)</display>the request is a certified copy of an order of a court of record specifying the record to <ln numlevel="1" lineno="61" slineno="1-39"/>be examined or copied.</subsection></subsection><subsection ssid="1-1-59" dnum="4-o" numlevel="1" lineno="62" slineno="1-40" level="1" space="false"><display>(4)</display><subsection ssid="1-1-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in <xref depth="2" refnumber="78B-6-1" start="0">Title 78B, Chapter 6, Part 1, Utah Adoption Act</xref>, a parent, <ln numlevel="1" lineno="63" slineno="1-41"/>or an immediate family member of a parent, who does not have legal or physical <ln numlevel="1" lineno="64" slineno="1-42"/>custody of or visitation or parent-time rights for a child because of the termination of <ln numlevel="1" lineno="65" slineno="1-43"/>parental rights under <xref depth="1" refnumber="80-4" start="0">Title 80, Chapter 4, Termination and Restoration of Parental <ln numlevel="1" lineno="66" slineno="1-44"/>Rights</xref>, or by virtue of consenting to or relinquishing a child for adoption pursuant to <xref depth="2" refnumber="78B-6-1" start="0"><ln numlevel="1" lineno="67" slineno="1-45"/>Title 78B, Chapter 6, Part 1, Utah Adoption Act</xref>, may not be considered as having a <ln numlevel="1" lineno="68" slineno="1-46"/>direct, tangible, and legitimate interest under this section.</subsection><subsection ssid="1-1-61" dnum="b-o" numlevel="1" lineno="69" slineno="1-47" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="26B-8-125(2)(d)" start="0">(2)(d)</xref>, a commercial firm or agency requesting <ln numlevel="1" lineno="70" slineno="1-48"/>names, addresses, or similar information may not be considered as having a direct, <ln numlevel="1" lineno="71" slineno="1-49"/>tangible, and legitimate interest under this section.</subsection></subsection><subsection ssid="1-1-62" dnum="5-o" numlevel="1" lineno="72" slineno="1-50" level="1"><display>(5)</display>Upon payment of a fee established in accordance with Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the office <ln numlevel="1" lineno="73" slineno="1-51"/>shall make the following records available to the public:<subsection ssid="1-1-63" dnum="a-o" numlevel="1" lineno="74" slineno="1-52" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="26B-8-110(4)(b)" start="0">26B-8-110(4)(b)</xref>, a birth record, excluding <ln numlevel="1" lineno="75" slineno="1-53"/>confidential information collected for medical and health use, if 100 years or more <ln numlevel="1" lineno="76" slineno="1-54"/>have passed since the date of birth;</subsection><subsection ssid="1-1-64" dnum="b-o" numlevel="1" lineno="77" slineno="1-55" level="2"><display>(b)</display>a death record if 50 years or more have passed since the date of death; and</subsection><subsection ssid="1-1-65" dnum="c-o" numlevel="1" lineno="78" slineno="1-56" level="2"><display>(c)</display>a vital record not subject to Subsection <xref depth="4" refnumber="26B-8-125(5)(a)" start="0">(5)(a)</xref> or <xref depth="4" refnumber="26B-8-125(5)(b)" start="0">(b)</xref> if 75 years or more have passed <ln numlevel="1" lineno="79" slineno="1-57"/>since the date of the event upon which the record is based.</subsection></subsection><subsection ssid="1-1-66" dnum="6-o" numlevel="1" lineno="80" slineno="1-58" level="1"><display>(6)</display>Upon payment of a fee established in accordance with Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, the office <ln numlevel="1" lineno="81" slineno="1-59"/>shall make an adoption document available as provided in Sections <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref> and <xref depth="3" refnumber="78B-6-144" start="0"><ln numlevel="1" lineno="82" slineno="1-60"/>78B-6-144</xref>.</subsection><subsection ssid="1-1-67" dnum="7-o" numlevel="1" lineno="83" slineno="1-61" level="1"><display>(7)</display>The office shall make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="84" slineno="1-62"/>Administrative Rulemaking Act</xref>, establishing procedures and the content of forms as <ln numlevel="1" lineno="85" slineno="1-63"/>follows:<subsection ssid="1-1-68" dnum="a-o" numlevel="1" lineno="86" slineno="1-64" level="2"><display>(a)</display>for the inspection of adoption documents under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(4)" start="0">78B-6-141(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref refnumber="78B-6-141(3)" depth="4"><ln numlevel="1" lineno="87" slineno="1-65"/>78B-6-141(3)</xref></amend>;</subsection><subsection ssid="1-1-69" dnum="b-o:_-i" numlevel="1" lineno="88" slineno="1-66" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="end">for a birth parent's election to permit identifying information about the birth parent <ln numlevel="1" lineno="89" slineno="1-67"/>to be made available, under Section <xref depth="3" refnumber="78B-6-141" start="0">78B-6-141</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-70" dnum="c-o:b-i" numlevel="1" lineno="90" slineno="1-68" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>for the release of information by the mutual-consent, voluntary adoption <ln numlevel="1" lineno="91" slineno="1-69"/>registry, under Section <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>;</subsection><subsection ssid="1-1-71" dnum="d-o:c-i" numlevel="1" lineno="92" slineno="1-70" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>for collecting fees and donations under Section <xref depth="3" refnumber="78B-6-144.5" start="0">78B-6-144.5</xref>; and</subsection><subsection ssid="1-1-72" dnum="e-o:d-i" numlevel="1" lineno="93" slineno="1-71" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>for the review and approval of a request described in Subsection <xref depth="4" refnumber="26B-8-125(3)(d)" start="0">(3)(d)</xref>.</subsection></subsection></section></bsec><bsec buid="2" num="78B-6-141" type="amend" src="code" uid="C78B-6-S141_2025050720250507" sort="78B06 01410020250507" style="" numlevel="1" lineno="94" slineno="2-1" sn="2"><section number="78B-6-141" numlevel="1" lineno="95" slineno="2-2" type="amend"><secline lineno="94">Section 2, Section <bold>78B-6-141</bold> is amended to read:</secline><catline lineno="95"><bold>78B-6-141. Court hearings may be closed -- Adoption documents.</bold></catline><subsection ssid="2-2-71" dnum="1-o" numlevel="1" lineno="96" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="2-2-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Section <xref depth="3" refnumber="80-4-106" start="0">80-4-106</xref>, court hearings in adoption cases may be <ln numlevel="1" lineno="97" slineno="2-4"/>closed to the public upon request of a party to the adoption petition and upon court <ln numlevel="1" lineno="98" slineno="2-5"/>approval.</subsection><subsection ssid="2-2-73" dnum="b-o" numlevel="1" lineno="99" slineno="2-6" level="2"><display>(b)</display>In a closed hearing, only the following individuals may be admitted:<subsection ssid="2-2-74" dnum="i-o" numlevel="1" lineno="100" slineno="2-7" level="3"><display>(i)</display>a party to the proceeding;</subsection><subsection ssid="2-2-75" dnum="ii-o" numlevel="1" lineno="101" slineno="2-8" level="3"><display>(ii)</display>the adoptee;</subsection><subsection ssid="2-2-76" dnum="iii-o" numlevel="1" lineno="102" slineno="2-9" level="3"><display>(iii)</display>a representative of an agency having custody of the adoptee;</subsection><subsection ssid="2-2-77" dnum="iv-o" numlevel="1" lineno="103" slineno="2-10" level="3"><display>(iv)</display>in a hearing to relinquish parental rights, the individual whose rights are to be <ln numlevel="1" lineno="104" slineno="2-11"/>relinquished and invitees of that individual to provide emotional support;</subsection><subsection ssid="2-2-78" dnum="v-o" numlevel="1" lineno="105" slineno="2-12" level="3"><display>(v)</display>in a hearing on the termination of parental rights, the individual whose rights may <ln numlevel="1" lineno="106" slineno="2-13"/>be terminated;</subsection><subsection ssid="2-2-79" dnum="vi-o" numlevel="1" lineno="107" slineno="2-14" level="3"><display>(vi)</display>in a hearing on a petition to intervene, the proposed intervenor;</subsection><subsection ssid="2-2-80" dnum="vii-o" numlevel="1" lineno="108" slineno="2-15" level="3"><display>(vii)</display>in a hearing to finalize an adoption, invitees of the petitioner; and</subsection><subsection ssid="2-2-81" dnum="viii-o" numlevel="1" lineno="109" slineno="2-16" level="3"><display>(viii)</display>other individuals for good cause, upon order of the court.</subsection></subsection></subsection><subsection ssid="2-2-82" dnum="2-o" numlevel="1" lineno="110" slineno="2-17" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="217" groupid="168" style="2" owner="jchristopherson" level="1" deltag="both">An</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="215" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref refnumber="78B-6-141(3)" depth="4">(3)</xref>, an</amend> adoption document and any other <ln numlevel="1" lineno="111" slineno="2-18"/>documents filed in connection with a petition for adoption are sealed.</subsection><subsection ssid="2-2-83" dnum="3-o" numlevel="1" lineno="112" slineno="2-19" level="1"><display>(3)</display>The documents described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref> may only be open to inspection and copying:<subsection ssid="2-2-84" dnum="a-o" numlevel="1" lineno="113" slineno="2-20" level="2"><display>(a)</display>in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="224" groupid="175" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(5)(a)" start="0">(5)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="222" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(a)</amend>, by a party to the adoption proceeding:<subsection ssid="2-2-85" dnum="i-o" numlevel="1" lineno="114" slineno="2-21" level="3"><display>(i)</display>while the proceeding is pending; or</subsection><subsection ssid="2-2-86" dnum="ii-o" numlevel="1" lineno="115" slineno="2-22" level="3"><display>(ii)</display>within six months after the day on which the adoption decree is entered;</subsection></subsection><subsection ssid="2-2-87" dnum="b-o" numlevel="1" lineno="116" slineno="2-23" level="2"><display>(b)</display>subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="225" groupid="176" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(5)(b)" start="0">(5)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="223" groupid="174" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(b)</amend>, if a court enters an order permitting access to the <ln numlevel="1" lineno="117" slineno="2-24"/>documents by an individual who has appealed the denial of that individual's motion <ln numlevel="1" lineno="118" slineno="2-25"/>to intervene;</subsection><subsection ssid="2-2-88" dnum="c-o" numlevel="1" lineno="119" slineno="2-26" level="2"><display>(c)</display>upon order of the court expressly permitting inspection or copying, after good cause <ln numlevel="1" lineno="120" slineno="2-27"/>has been shown;</subsection><subsection ssid="2-2-89" dnum="d-o" numlevel="1" lineno="121" slineno="2-28" level="2"><display>(d)</display>as provided under Section <xref depth="3" refnumber="78B-6-144" start="0">78B-6-144</xref>;</subsection><subsection ssid="2-2-90" dnum="e-o" numlevel="1" lineno="122" slineno="2-29" level="2"><display>(e)</display>when the adoption document becomes public on the one hundredth anniversary of <ln numlevel="1" lineno="123" slineno="2-30"/>the date the final decree of adoption was entered;</subsection><subsection ssid="2-2-91" dnum="f-o" numlevel="1" lineno="124" slineno="2-31" level="2"><display>(f)</display>when the birth certificate becomes public on the one hundredth anniversary of the <ln numlevel="1" lineno="125" slineno="2-32"/>date of birth;</subsection><subsection ssid="2-2-92" dnum="g-o" numlevel="1" lineno="126" slineno="2-33" level="2"><display>(g)</display>to a mature adoptee or a parent who adopted the mature adoptee, without a court <ln numlevel="1" lineno="127" slineno="2-34"/>order, unless the final decree of adoption is entered by the juvenile court under <ln numlevel="1" lineno="128" slineno="2-35"/>Subsection <xref depth="4" refnumber="78B-6-115(3)(b)" start="0">78B-6-115(3)(b)</xref>; or</subsection><subsection ssid="2-2-93" dnum="h-o" numlevel="1" lineno="129" slineno="2-36" level="2"><display>(h)</display>to an adult adoptee<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="212" groupid="163" style="2" owner="jchristopherson" level="1" deltag="both">, to the extent permitted under Subsection <xref depth="4" refnumber="78B-6-141(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="219" groupid="170" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> who is the subject <ln numlevel="1" lineno="130" slineno="2-37"/>of the adoption, unless there is a court order sealing the documents as described in <ln numlevel="1" lineno="131" slineno="2-38"/>Subsection <xref refnumber="78B-6-141(5)" depth="4">(5)</xref></amend>.</subsection></subsection><subsection ssid="2-2-94" dnum="4-o:_-i" numlevel="1" lineno="132" slineno="2-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1059" style="2" owner="o" level="1" deltag="start">(4)</amend></display><subsection ssid="2-2-95" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1060" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="44" groupid="29" style="2" owner="jchristopherson" level="1" deltag="end">An adult adoptee that was born in the state may access an adoption document <ln numlevel="1" lineno="133" slineno="2-40"/>associated with the adult adoptee's adoption without a court order:</amend><amendoutend style="2"/><subsection ssid="2-2-96" dnum="i-o:_-i" numlevel="1" lineno="134" slineno="2-41" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="45" groupid="30" style="2" owner="jchristopherson" level="1" deltag="end">to the extent that a birth parent consents under Subsection <xref depth="4" refnumber="78B-6-141(4)(b)" start="0">(4)(b)</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-97" dnum="ii-o:_-i" numlevel="1" lineno="135" slineno="2-42" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="48" groupid="33" style="2" owner="jchristopherson" level="1" deltag="end">if the birth parents listed on the original birth certificate are deceased.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-2-98" dnum="b-o:_-i" numlevel="1" lineno="136" slineno="2-43" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="49" groupid="34" style="2" owner="jchristopherson" level="1" deltag="end">A birth parent may:</amend><amendoutend style="2"/><subsection ssid="2-2-99" dnum="i-o:_-i" numlevel="1" lineno="137" slineno="2-44" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="50" groupid="35" style="2" owner="jchristopherson" level="1" deltag="end">provide consent to allow the access described in Subsection <xref depth="4" refnumber="78B-6-141(4)(a)" start="0">(4)(a)</xref> by electing, <ln numlevel="1" lineno="138" slineno="2-45"/>electronically or on a written form provided by the office, allowing the birth <ln numlevel="1" lineno="139" slineno="2-46"/>parent to elect to:</amend><amendoutend style="2"/><subsection ssid="2-2-100" dnum="A-o:_-i" numlevel="1" lineno="140" slineno="2-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="53" groupid="38" style="2" owner="jchristopherson" level="1" deltag="end">allow the office to provide the adult adoptee with the contact information of <ln numlevel="1" lineno="141" slineno="2-48"/>the birth parent that the birth parent indicates;</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-101" dnum="B-o:_-i" numlevel="1" lineno="142" slineno="2-49" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="54" groupid="39" style="2" owner="jchristopherson" level="1" deltag="end">allow the office to provide the adult adoptee with the contact information of <ln numlevel="1" lineno="143" slineno="2-50"/>an intermediary that the birth parent indicates;</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-102" dnum="C-o:_-i" numlevel="1" lineno="144" slineno="2-51" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1067" style="2" owner="o" level="1" deltag="start">(C)</amend></display><amend anum="0" ea="erase" pairid="55" groupid="40" style="2" owner="jchristopherson" level="1" deltag="end">prohibit the office from providing any contact information to the adult <ln numlevel="1" lineno="145" slineno="2-52"/>adoptee;</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-103" dnum="D-o:_-i" numlevel="1" lineno="146" slineno="2-53" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1068" style="2" owner="o" level="1" deltag="start">(D)</amend></display><amend anum="0" ea="erase" pairid="56" groupid="41" style="2" owner="jchristopherson" level="1" deltag="end">allow the office to provide the adult adoptee with a noncertified copy of the <ln numlevel="1" lineno="147" slineno="2-54"/>original birth certificate; and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-2-104" dnum="ii-o:_-i" numlevel="1" lineno="148" slineno="2-55" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1069" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="57" groupid="42" style="2" owner="jchristopherson" level="1" deltag="end">at any time, file, electronically or on a written document with the office, to:</amend><amendoutend style="2"/><subsection ssid="2-2-105" dnum="A-o:_-i" numlevel="1" lineno="149" slineno="2-56" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1070" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="58" groupid="43" style="2" owner="jchristopherson" level="1" deltag="end">change the election described in Subsection <xref depth="4" refnumber="78B-6-141(4)(b)" start="0">(4)(b)</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-106" dnum="B-o:_-i" numlevel="1" lineno="150" slineno="2-57" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1071" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="61" groupid="46" style="2" owner="jchristopherson" level="1" deltag="end">elect to make other information about the birth parent, including an updated <ln numlevel="1" lineno="151" slineno="2-58"/>medical history, available for inspection by an adult adoptee.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="2-2-107" dnum="c-o:_-i" numlevel="1" lineno="152" slineno="2-59" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="62" groupid="47" style="2" owner="jchristopherson" level="1" deltag="end">A birth parent may not access any identifying information or an adoption document <ln numlevel="1" lineno="153" slineno="2-60"/>under this Subsection <xref depth="4" refnumber="78B-6-141(4)" start="0">(4)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-108" dnum="d-o:_-i" numlevel="1" lineno="154" slineno="2-61" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="50" style="2" owner="jchristopherson" level="1" deltag="end">If two birth parents are listed on the original birth certificate and only one birth <ln numlevel="1" lineno="155" slineno="2-62"/>parent consents under Subsection <xref depth="4" refnumber="78B-6-141(4)(b)" start="0">(4)(b)</xref> or is deceased, the office may redact the <ln numlevel="1" lineno="156" slineno="2-63"/>name of the other birth parent.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="2-2-109" dnum="5-o:4-i" numlevel="1" lineno="157" slineno="2-64" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="2-2-110" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual who files a motion to intervene in an adoption proceeding:<subsection ssid="2-2-111" dnum="i-o" numlevel="1" lineno="158" slineno="2-65" level="3" tab="1"><display>(i)</display>is not a party to the adoption proceeding, unless the motion to intervene is granted; <ln numlevel="1" lineno="159" slineno="2-66"/>and</subsection><subsection ssid="2-2-112" dnum="ii-o" numlevel="1" lineno="160" slineno="2-67" level="3" tab="1"><display>(ii)</display>may not be granted access to the documents described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref>, unless <ln numlevel="1" lineno="161" slineno="2-68"/>the motion to intervene is granted.</subsection></subsection><subsection ssid="2-2-113" dnum="b-o" numlevel="1" lineno="162" slineno="2-69" level="2"><display>(b)</display>An order described in Subsection <xref depth="4" refnumber="78B-6-141(3)(b)" start="0">(3)(b)</xref> shall:<subsection ssid="2-2-114" dnum="i-o" numlevel="1" lineno="163" slineno="2-70" level="3"><display>(i)</display>prohibit the individual described in Subsection <xref depth="4" refnumber="78B-6-141(3)(b)" start="0">(3)(b)</xref> from inspecting a document <ln numlevel="1" lineno="164" slineno="2-71"/>described in Subsection <xref depth="4" refnumber="78B-6-141(2)" start="0">(2)</xref> that contains identifying information of the adoptive <ln numlevel="1" lineno="165" slineno="2-72"/>or prospective adoptive parent; and</subsection><subsection ssid="2-2-115" dnum="ii-o" numlevel="1" lineno="166" slineno="2-73" level="3"><display>(ii)</display>permit the individual described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="153" groupid="114" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="151" groupid="112" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(b)</amend> to review a copy of <ln numlevel="1" lineno="167" slineno="2-74"/>a document described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="154" groupid="115" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="152" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4)(b)(i)</amend> after the identifying <ln numlevel="1" lineno="168" slineno="2-75"/>information <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="162" groupid="122" style="2" owner="jchristopherson" level="1" deltag="both">described in Subsection <xref depth="4" refnumber="78B-6-141(5)(b)(i)" start="0">(5)(b)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="161" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">of the adoptive or prospective <ln numlevel="1" lineno="169" slineno="2-76"/>adoptive parent</amend> is redacted from the document.</subsection></subsection></subsection><subsection ssid="2-2-116" dnum="_-o:5-i" numlevel="1" lineno="170" slineno="2-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="2-2-117" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="191" style="1" owner="jchristopherson" level="1" amendtag="end">For a birth parent of an individual who is adopted as a minor, the birth parent may <ln numlevel="1" lineno="171" slineno="2-78"/>bring a petition in a court before the individual reaches 18 years old to keep the <ln numlevel="1" lineno="172" slineno="2-79"/>documents described in Subsection <xref refnumber="78B-6-141(2)" depth="4">(2)</xref> sealed for 10 years after the day on which the <ln numlevel="1" lineno="173" slineno="2-80"/>individual reaches 18 years old.</amend></subsection><subsection ssid="2-2-118" dnum="_-o:b-i" numlevel="1" lineno="174" slineno="2-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="269" groupid="211" style="1" owner="jchristopherson" level="1" amendtag="end">If the court grants a birth parent's petition under Subsection (5)(a), the birth parent <ln numlevel="1" lineno="175" slineno="2-82"/>may bring a petition, every 10 years and before the court order expires, to keep the <ln numlevel="1" lineno="176" slineno="2-83"/>documents sealed for an additional 10 years.</amend></subsection><subsection ssid="2-2-119" dnum="_-o:c-i" numlevel="1" lineno="177" slineno="2-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="236" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="end">The court may only grant a petition under Subsection <xref refnumber="78B-6-141(5)" depth="4">(5)</xref>(a) or (5)(b) if:</amend><subsection ssid="2-2-120" dnum="_-o:i-i" numlevel="1" lineno="178" slineno="2-85" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="201" style="1" owner="jchristopherson" level="1" amendtag="end">access to the documents described in Subsection <xref refnumber="78B-6-141(2)" depth="4">(2)</xref> would place the birth parent <ln numlevel="1" lineno="179" slineno="2-86"/>in reasonable fear of harm;
