Talent advisory councils.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="21" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="22" slineno="1-4" level="2"><display>(a)</display>"Advisory council" means an advisory council the talent board creates under <ln numlevel="1" lineno="23" slineno="1-5"/>Subsection (10).</subsection><subsection ssid="1-3" dnum="b-o" numlevel="1" lineno="24" slineno="1-6" level="2"><display>(b)</display>"Institution of higher education" means the same as the term is defined in Section <xref depth="3" refnumber="53B-1-102"><ln numlevel="1" lineno="25" slineno="1-7"/>53B-1-102</xref>.</subsection><subsection ssid="1-4" dnum="c-o" numlevel="1" lineno="26" slineno="1-8" level="2"><display>(c)</display>"Talent initiative" means an initiative the board creates under Subsection (2).</subsection></subsection><subsection ssid="1-5" dnum="2-o" numlevel="1" lineno="27" slineno="1-9" level="1" space="false"><display>(2)</display><subsection ssid="1-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to legislative appropriations and in accordance with the proposal process <ln numlevel="1" lineno="28" slineno="1-10"/>and other provisions of this section, the board shall develop and oversee one or more <ln numlevel="1" lineno="29" slineno="1-11"/>talent initiatives that include providing funding for expanded programs at an <ln numlevel="1" lineno="30" slineno="1-12"/>institution of higher education related to the talent initiative.</subsection><subsection ssid="1-7" dnum="b-o" numlevel="1" lineno="31" slineno="1-13" level="2"><display>(b)</display>The board shall ensure that a talent initiative the board creates:<subsection ssid="1-8" dnum="i-o" numlevel="1" lineno="32" slineno="1-14" level="3"><display>(i)</display>uses a name for the talent initiative that reflects the area the initiative is targeting;</subsection><subsection ssid="1-9" dnum="ii-o" numlevel="1" lineno="33" slineno="1-15" level="3"><display>(ii)</display>contains an outline of the disciplines, industries, degrees, certifications, <ln numlevel="1" lineno="34" slineno="1-16"/>credentials, and types of skills the talent initiative will target; and</subsection><subsection ssid="1-10" dnum="iii-o" numlevel="1" lineno="35" slineno="1-17" level="3"><display>(iii)</display>uses a corresponding advisory council created in Subsection (10).</subsection></subsection></subsection><subsection ssid="1-11" dnum="3-o" numlevel="1" lineno="36" slineno="1-18" level="1"><display>(3)</display>In creating a talent initiative, the board shall facilitate collaborations between an <ln numlevel="1" lineno="37" slineno="1-19"/>institution of higher education and participating employers that:<subsection ssid="1-12" dnum="a-o" numlevel="1" lineno="38" slineno="1-20" level="2"><display>(a)</display>create expanded, multidisciplinary programs or stackable credential programs offered <ln numlevel="1" lineno="39" slineno="1-21"/>at a technical college, undergraduate, or graduate level of study; and</subsection><subsection ssid="1-13" dnum="b-o" numlevel="1" lineno="40" slineno="1-22" level="2"><display>(b)</display>prepare students to be workforce participants in jobs requiring skills related to a <ln numlevel="1" lineno="41" slineno="1-23"/>talent initiative.</subsection></subsection><subsection ssid="1-14" dnum="4-o" numlevel="1" lineno="42" slineno="1-24" level="1" space="false"><display>(4)</display><subsection ssid="1-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An institution of higher education seeking to partner with one or more <ln numlevel="1" lineno="43" slineno="1-25"/>participating employers to create a program related to a talent initiative shall submit a <ln numlevel="1" lineno="44" slineno="1-26"/>proposal to the talent board through a process the talent board creates.</subsection><subsection ssid="1-16" dnum="b-o" numlevel="1" lineno="45" slineno="1-27" level="2"><display>(b)</display>An institution of higher education shall submit a proposal that contains:<subsection ssid="1-17" dnum="i-o" numlevel="1" lineno="46" slineno="1-28" level="3"><display>(i)</display>a description of the proposed program, including:<subsection ssid="1-18" dnum="A-o" numlevel="1" lineno="47" slineno="1-29" level="4"><display>(A)</display>implementation timelines for the program;</subsection><subsection ssid="1-19" dnum="B-o" numlevel="1" lineno="48" slineno="1-30" level="4"><display>(B)</display>a demonstration of how the program will be responsive to the talent needs <ln numlevel="1" lineno="49" slineno="1-31"/>related to the talent initiative;</subsection><subsection ssid="1-20" dnum="C-o" numlevel="1" lineno="50" slineno="1-32" level="4"><display>(C)</display>an outline of relevant industry involvement that includes at least one <ln numlevel="1" lineno="51" slineno="1-33"/>participating employer that partners with the institution of higher education; and</subsection><subsection ssid="1-21" dnum="D-o" numlevel="1" lineno="52" slineno="1-34" level="4"><display>(D)</display>an explanation of how the program addresses an unmet regional workforce <ln numlevel="1" lineno="53" slineno="1-35"/>need related to a talent initiative;</subsection></subsection><subsection ssid="1-22" dnum="ii-o" numlevel="1" lineno="54" slineno="1-36" level="3"><display>(ii)</display>an estimate of:<subsection ssid="1-23" dnum="A-o" numlevel="1" lineno="55" slineno="1-37" level="4"><display>(A)</display>projected student enrollment and completion rates for a program;</subsection><subsection ssid="1-24" dnum="B-o" numlevel="1" lineno="56" slineno="1-38" level="4"><display>(B)</display>the academic credit or credentials that a program will provide; and</subsection><subsection ssid="1-25" dnum="C-o" numlevel="1" lineno="57" slineno="1-39" level="4"><display>(C)</display>occupations for which a graduate will qualify;</subsection></subsection><subsection ssid="1-26" dnum="iii-o" numlevel="1" lineno="58" slineno="1-40" level="3"><display>(iii)</display>evidence that each participating employer is committed to participating and <ln numlevel="1" lineno="59" slineno="1-41"/>contributing to the program by providing any combination of:<subsection ssid="1-27" dnum="A-o" numlevel="1" lineno="60" slineno="1-42" level="4"><display>(A)</display>instruction;</subsection><subsection ssid="1-28" dnum="B-o" numlevel="1" lineno="61" slineno="1-43" level="4"><display>(B)</display>curriculum review;</subsection><subsection ssid="1-29" dnum="C-o" numlevel="1" lineno="62" slineno="1-44" level="4"><display>(C)</display>feedback regarding effectiveness of program graduates as employees;</subsection><subsection ssid="1-30" dnum="D-o" numlevel="1" lineno="63" slineno="1-45" level="4"><display>(D)</display>work-based learning opportunities; or</subsection><subsection ssid="1-31" dnum="E-o" numlevel="1" lineno="64" slineno="1-46" level="4"><display>(E)</display>mentoring;</subsection></subsection><subsection ssid="1-32" dnum="iv-o" numlevel="1" lineno="65" slineno="1-47" level="3"><display>(iv)</display>a description of any resources a participating employer will provide within the <ln numlevel="1" lineno="66" slineno="1-48"/>program; and</subsection><subsection ssid="1-33" dnum="v-o" numlevel="1" lineno="67" slineno="1-49" level="3"><display>(v)</display>the amount of funding requested for the program, including:<subsection ssid="1-34" dnum="A-o" numlevel="1" lineno="68" slineno="1-50" level="4"><display>(A)</display>the justification for the funding; and</subsection><subsection ssid="1-35" dnum="B-o" numlevel="1" lineno="69" slineno="1-51" level="4"><display>(B)</display>the cost per student served as estimated under Subsection (4)(b)(ii).</subsection></subsection></subsection></subsection><subsection ssid="1-36" dnum="5-o" numlevel="1" lineno="70" slineno="1-52" level="1"><display>(5)</display>In reviewing a proposal, the talent board shall provide a proposal to the relevant <ln numlevel="1" lineno="71" slineno="1-53"/>advisory council described in Subsections (10) and (11).</subsection><subsection ssid="1-37" dnum="6-o" numlevel="1" lineno="72" slineno="1-54" level="1"><display>(6)</display>The relevant advisory council shall:<subsection ssid="1-38" dnum="a-o" numlevel="1" lineno="73" slineno="1-55" level="2"><display>(a)</display>review and prioritize each proposal the advisory council receives; and</subsection><subsection ssid="1-39" dnum="b-o" numlevel="1" lineno="74" slineno="1-56" level="2"><display>(b)</display>recommend to the talent board whether the proposal should be funded and the <ln numlevel="1" lineno="75" slineno="1-57"/>funding amount based on:<subsection ssid="1-40" dnum="i-o" numlevel="1" lineno="76" slineno="1-58" level="3"><display>(i)</display>the quality and completeness of the elements of the proposal described in <ln numlevel="1" lineno="77" slineno="1-59"/>Subsection (4)(b);</subsection><subsection ssid="1-41" dnum="ii-o" numlevel="1" lineno="78" slineno="1-60" level="3"><display>(ii)</display>to what extent the proposed program:<subsection ssid="1-42" dnum="A-o" numlevel="1" lineno="79" slineno="1-61" level="4"><display>(A)</display>would expand the capacity to meet state or regional workforce needs related <ln numlevel="1" lineno="80" slineno="1-62"/>to the talent initiative;</subsection><subsection ssid="1-43" dnum="B-o" numlevel="1" lineno="81" slineno="1-63" level="4"><display>(B)</display>would integrate industry-relevant competencies with disciplinary expertise;</subsection><subsection ssid="1-44" dnum="C-o" numlevel="1" lineno="82" slineno="1-64" level="4"><display>(C)</display>would incorporate internships or significant project experiences, including <ln numlevel="1" lineno="83" slineno="1-65"/>team-based experiences;</subsection><subsection ssid="1-45" dnum="D-o" numlevel="1" lineno="84" slineno="1-66" level="4"><display>(D)</display>identifies how industry professionals would participate in elements described <ln numlevel="1" lineno="85" slineno="1-67"/>in Subsection (4)(b)(iii); and</subsection><subsection ssid="1-46" dnum="E-o" numlevel="1" lineno="86" slineno="1-68" level="4"><display>(E)</display>would be cost effective; and</subsection></subsection><subsection ssid="1-47" dnum="iii-o" numlevel="1" lineno="87" slineno="1-69" level="3"><display>(iii)</display>other relevant criteria as the relevant advisory council and the talent board <ln numlevel="1" lineno="88" slineno="1-70"/>determines.</subsection></subsection></subsection><subsection ssid="1-48" dnum="7-o" numlevel="1" lineno="89" slineno="1-71" level="1"><display>(7)</display>The board shall review the recommendations of an advisory council and may provide <ln numlevel="1" lineno="90" slineno="1-72"/>funding for a program related to a talent initiative using the criteria described in <ln numlevel="1" lineno="91" slineno="1-73"/>Subsection (6)(b).</subsection><subsection ssid="1-49" dnum="8-o" numlevel="1" lineno="92" slineno="1-74" level="1"><display>(8)</display>In a form that the board approves, each institution of higher education that receives <ln numlevel="1" lineno="93" slineno="1-75"/>funding shall annually provide written information to the board regarding the activities, <ln numlevel="1" lineno="94" slineno="1-76"/>successes, and challenges related to administering the program related to the talent <ln numlevel="1" lineno="95" slineno="1-77"/>initiative, including:<subsection ssid="1-50" dnum="a-o" numlevel="1" lineno="96" slineno="1-78" level="2"><display>(a)</display>specific entities that received funding under this section;</subsection><subsection ssid="1-51" dnum="b-o" numlevel="1" lineno="97" slineno="1-79" level="2"><display>(b)</display>the amount of funding provided to each entity;</subsection><subsection ssid="1-52" dnum="c-o" numlevel="1" lineno="98" slineno="1-80" level="2"><display>(c)</display>the number of participating students in each program;</subsection><subsection ssid="1-53" dnum="d-o" numlevel="1" lineno="99" slineno="1-81" level="2"><display>(d)</display>the number of graduates of the program;</subsection><subsection ssid="1-54" dnum="e-o" numlevel="1" lineno="100" slineno="1-82" level="2"><display>(e)</display>the number of graduates of the program employed in jobs requiring skills related to <ln numlevel="1" lineno="101" slineno="1-83"/>the talent initiative; and</subsection><subsection ssid="1-55" dnum="f-o" numlevel="1" lineno="102" slineno="1-84" level="2"><display>(f)</display>progress and achievements relevant to the implementation timeline submitted under <ln numlevel="1" lineno="103" slineno="1-85"/>Subsection (4)(b)(i)(A).</subsection></subsection><subsection ssid="1-56" dnum="9-o" numlevel="1" lineno="104" slineno="1-86" level="1"><display>(9)</display>On or before October 1 of each year, the board shall provide an annual written report <ln numlevel="1" lineno="105" slineno="1-87"/>containing the information described in Subsection (8) to the:<subsection ssid="1-57" dnum="a-o" numlevel="1" lineno="106" slineno="1-88" level="2"><display>(a)</display>Education Interim Committee; and</subsection><subsection ssid="1-58" dnum="b-o" numlevel="1" lineno="107" slineno="1-89" level="2"><display>(b)</display>Higher Education Appropriations Subcommittee.</subsection></subsection><subsection ssid="1-59" dnum="10-o" numlevel="1" lineno="108" slineno="1-90" level="1"><display>(10)</display>The talent board shall create a talent advisory council for each talent initiative created <ln numlevel="1" lineno="109" slineno="1-91"/>under Subsection (2) to make recommendations to the board regarding the <ln numlevel="1" lineno="110" slineno="1-92"/>administration of a talent initiative including:<subsection ssid="1-60" dnum="a-o" numlevel="1" lineno="111" slineno="1-93" level="2"><display>(a)</display>a deep technology initiative;</subsection><subsection ssid="1-61" dnum="b-o" numlevel="1" lineno="112" slineno="1-94" level="2"><display>(b)</display>a life sciences workforce initiative; </subsection><subsection ssid="1-84" dnum="_-o:c-i" numlevel="1" lineno="113" slineno="1-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">engineering and computer technology; </amend>and</subsection><subsection ssid="1-62" dnum="c-o:d-i" numlevel="1" lineno="114" slineno="1-96" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1062" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>health professions initiatives including a nursing initiative.</subsection></subsection><subsection ssid="1-63" dnum="11-o" numlevel="1" lineno="115" slineno="1-97" level="1"><display>(11)</display>An advisory council shall consist of the following members:<subsection ssid="1-64" dnum="a-o" numlevel="1" lineno="116" slineno="1-98" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">a minimum of </amend>four members who have extensive experience in the talent initiative's <ln numlevel="1" lineno="117" slineno="1-99"/>subject matter from the private sector whom the chair of the talent board appoints and <ln numlevel="1" lineno="118" slineno="1-100"/>the board approves;</subsection><subsection ssid="1-65" dnum="b-o" numlevel="1" lineno="119" slineno="1-101" level="2"><display>(b)</display>a representative of the board described in Section <xref depth="3" refnumber="53B-1-402">53B-1-402</xref> whom the chair of the <ln numlevel="1" lineno="120" slineno="1-102"/>board appoints;</subsection><subsection ssid="1-66" dnum="c-o" numlevel="1" lineno="121" slineno="1-103" level="2"><display>(c)</display>a representative of the Governor's Office of Economic Opportunity whom the <ln numlevel="1" lineno="122" slineno="1-104"/>executive director of the Governor's Office of Economic Opportunity appoints;</subsection><subsection ssid="1-67" dnum="d-o" numlevel="1" lineno="123" slineno="1-105" level="2"><display>(d)</display>a representative from Talent Ready Utah;</subsection><subsection ssid="1-68" dnum="e-o" numlevel="1" lineno="124" slineno="1-106" level="2"><display>(e)</display>one member of the Senate whom the president of the Senate appoints;</subsection><subsection ssid="1-69" dnum="f-o" numlevel="1" lineno="125" slineno="1-107" level="2"><display>(f)</display>one member of the House of Representatives whom the speaker of the House of <ln numlevel="1" lineno="126" slineno="1-108"/>Representatives appoints; and</subsection><subsection ssid="1-70" dnum="g-o" numlevel="1" lineno="127" slineno="1-109" level="2"><display>(g)</display>any other specialized industry experts whom a majority of the advisory council may <ln numlevel="1" lineno="128" slineno="1-110"/>invite to participate as needed as nonvoting members.</subsection></subsection><subsection ssid="1-71" dnum="12-o" numlevel="1" lineno="129" slineno="1-111" level="1"><display>(12)</display>Talent Ready Utah shall provide staff support for an advisory council.</subsection><subsection ssid="1-72" dnum="13-o" numlevel="1" lineno="130" slineno="1-112" level="1" space="false"><display>(13)</display><subsection ssid="1-73" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Two advisory council members appointed under Subsection (11)(a) shall serve <ln numlevel="1" lineno="131" slineno="1-113"/>an initial term of two years.</subsection><subsection ssid="1-74" dnum="b-o" numlevel="1" lineno="132" slineno="1-114" level="2"><display>(b)</display>Except as described in Subsection (13)(a), all other advisory council members shall <ln numlevel="1" lineno="133" slineno="1-115"/>serve an initial term of four years.</subsection><subsection ssid="1-75" dnum="c-o" numlevel="1" lineno="134" slineno="1-116" level="2"><display>(c)</display>Successor advisory council members upon appointment or reappointment shall each <ln numlevel="1" lineno="135" slineno="1-117"/>serve a term of four years.</subsection><subsection ssid="1-76" dnum="d-o" numlevel="1" lineno="136" slineno="1-118" level="2"><display>(d)</display>When a vacancy occurs in the membership for any reason, the initial appointing <ln numlevel="1" lineno="137" slineno="1-119"/>authority shall appoint a replacement for the unexpired term.</subsection><subsection ssid="1-77" dnum="e-o" numlevel="1" lineno="138" slineno="1-120" level="2"><display>(e)</display>An advisory council member may not serve more than two consecutive terms.</subsection></subsection><subsection ssid="1-78" dnum="14-o" numlevel="1" lineno="139" slineno="1-121" level="1"><display>(14)</display>A vote of a majority of the advisory council members constitutes an action of the <ln numlevel="1" lineno="140" slineno="1-122"/>advisory council.</subsection><subsection ssid="1-79" dnum="15-o" numlevel="1" lineno="141" slineno="1-123" level="1"><display>(15)</display>The duties of the advisory council include reviewing, prioritizing, and making <ln numlevel="1" lineno="142" slineno="1-124"/>recommendations to the board regarding proposals for funding under the talent initiative <ln numlevel="1" lineno="143" slineno="1-125"/>created in accordance with Subsection (2) for which the council was created.</subsection><subsection ssid="1-80" dnum="16-o" numlevel="1" lineno="144" slineno="1-126" level="1"><display>(16)</display>An advisory council member may not receive compensation or benefits for the <ln numlevel="1" lineno="145" slineno="1-127"/>member's service, but an advisory council member who is not a legislator may receive <ln numlevel="1" lineno="146" slineno="1-128"/>per diem and travel expenses in accordance with:<subsection ssid="1-81" dnum="a-o" numlevel="1" lineno="147" slineno="1-129" level="2"><display>(a)</display>Sections <xref depth="3" refnumber="63A-3-106">63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107">63A-3-107</xref>;
