Definitions.</bold></catline><sectionText lineno="36"><tab/>As used in this part:</sectionText><subsection ssid="8-1" dnum="1-o" numlevel="1" lineno="37" slineno="1-4" level="1"><display>(1)</display>"Chief executive officer" means:<subsection ssid="8-2" dnum="a-o" numlevel="1" lineno="38" slineno="1-5" level="2"><display>(a)</display>for a municipality:<subsection ssid="8-3" dnum="i-o" numlevel="1" lineno="39" slineno="1-6" level="3"><display>(i)</display>the mayor for a municipality operating under all forms of municipal government <ln numlevel="1" lineno="40" slineno="1-7"/>except the council-manager form of government; or</subsection><subsection ssid="8-4" dnum="ii-o" numlevel="1" lineno="41" slineno="1-8" level="3"><display>(ii)</display>the city manager for a municipality operating under the council-manager form of <ln numlevel="1" lineno="42" slineno="1-9"/>government;</subsection></subsection><subsection ssid="8-5" dnum="b-o" numlevel="1" lineno="43" slineno="1-10" level="2"><display>(b)</display>for a county:<subsection ssid="8-6" dnum="i-o" numlevel="1" lineno="44" slineno="1-11" level="3"><display>(i)</display>the chair of the county commission for a county operating under the county <ln numlevel="1" lineno="45" slineno="1-12"/>commission or expanded county commission form of government;</subsection><subsection ssid="8-7" dnum="ii-o" numlevel="1" lineno="46" slineno="1-13" level="3"><display>(ii)</display>the county executive officer for a county operating under the county-executive <ln numlevel="1" lineno="47" slineno="1-14"/>council form of government; or</subsection><subsection ssid="8-8" dnum="iii-o" numlevel="1" lineno="48" slineno="1-15" level="3"><display>(iii)</display>the county manager for a county operating under the council-manager form of <ln numlevel="1" lineno="49" slineno="1-16"/>government;</subsection></subsection><subsection ssid="8-9" dnum="c-o" numlevel="1" lineno="50" slineno="1-17" level="2"><display>(c)</display>for a special service district:<subsection ssid="8-10" dnum="i-o" numlevel="1" lineno="51" slineno="1-18" level="3"><display>(i)</display>the chief executive officer of the county or municipality that created the special <ln numlevel="1" lineno="52" slineno="1-19"/>service district if authority has not been delegated to an administrative control <ln numlevel="1" lineno="53" slineno="1-20"/>board as provided in Section <xref depth="3" refnumber="17D-1-301" start="0">17D-1-301</xref>;</subsection><subsection ssid="8-11" dnum="ii-o" numlevel="1" lineno="54" slineno="1-21" level="3"><display>(ii)</display>the chair of the administrative control board to which authority has been <ln numlevel="1" lineno="55" slineno="1-22"/>delegated as provided in Section <xref depth="3" refnumber="17D-1-301" start="0">17D-1-301</xref>; or</subsection><subsection ssid="8-12" dnum="iii-o" numlevel="1" lineno="56" slineno="1-23" level="3"><display>(iii)</display>the general manager or other officer or employee to whom authority has been <ln numlevel="1" lineno="57" slineno="1-24"/>delegated by the governing body of the special service district as provided in <ln numlevel="1" lineno="58" slineno="1-25"/>Section <xref depth="3" refnumber="17D-1-301" start="0">17D-1-301</xref>; or</subsection></subsection><subsection ssid="8-13" dnum="d-o" numlevel="1" lineno="59" slineno="1-26" level="2"><display>(d)</display>for a special district:<subsection ssid="8-14" dnum="i-o" numlevel="1" lineno="60" slineno="1-27" level="3"><display>(i)</display>the chair of the board of trustees selected as provided in Section <xref depth="3" refnumber="17B-1-309" start="0">17B-1-309</xref>; or</subsection><subsection ssid="8-15" dnum="ii-o" numlevel="1" lineno="61" slineno="1-28" level="3"><display>(ii)</display>the general manager or other officer or employee to whom authority has been <ln numlevel="1" lineno="62" slineno="1-29"/>delegated by the board of trustees.</subsection></subsection></subsection><subsection ssid="8-16" dnum="2-o" numlevel="1" lineno="63" slineno="1-30" level="1"><display>(2)</display>"Executive action" means any of the following actions by the governor during a state of <ln numlevel="1" lineno="64" slineno="1-31"/>emergency:<subsection ssid="8-17" dnum="a-o" numlevel="1" lineno="65" slineno="1-32" level="2"><display>(a)</display>an order, a rule, or a regulation made by the governor as described in Section <xref depth="3" refnumber="53-2a-209" start="0"><ln numlevel="1" lineno="66" slineno="1-33"/>53-2a-209</xref>;</subsection><subsection ssid="8-18" dnum="b-o" numlevel="1" lineno="67" slineno="1-34" level="2"><display>(b)</display>an action by the governor to suspend or modify a statute as described in Subsection <xref depth="4" refnumber="53-2a-204(1)(j)" start="0"><ln numlevel="1" lineno="68" slineno="1-35"/>53-2a-204(1)(j)</xref>; or</subsection><subsection ssid="8-19" dnum="c-o" numlevel="1" lineno="69" slineno="1-36" level="2"><display>(c)</display>an action by the governor to suspend the enforcement of a statute as described in <ln numlevel="1" lineno="70" slineno="1-37"/>Subsection <xref depth="4" refnumber="53-2a-209(4)" start="0">53-2a-209(4)</xref>.</subsection></subsection><subsection ssid="8-20" dnum="3-o" numlevel="1" lineno="71" slineno="1-38" level="1"><display>(3)</display>"Exigent circumstances" means a significant change in circumstances following the <ln numlevel="1" lineno="72" slineno="1-39"/>expiration of a state of emergency declared in accordance with this chapter that:<subsection ssid="8-21" dnum="a-o" numlevel="1" lineno="73" slineno="1-40" level="2"><display>(a)</display>substantially increases the threat to public safety or health relative to the <ln numlevel="1" lineno="74" slineno="1-41"/>circumstances in existence when the state of emergency expired;</subsection><subsection ssid="8-22" dnum="b-o" numlevel="1" lineno="75" slineno="1-42" level="2"><display>(b)</display>poses an imminent threat to public safety or health; and</subsection><subsection ssid="8-23" dnum="c-o" numlevel="1" lineno="76" slineno="1-43" level="2"><display>(c)</display>was not known or foreseen and could not have been known or foreseen at the time <ln numlevel="1" lineno="77" slineno="1-44"/>the state of emergency expired.</subsection></subsection><subsection ssid="8-34" dnum="_-o:4-i" numlevel="1" lineno="78" slineno="1-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">"International organization" means the same as that term is defined in Section <xref depth="3" refnumber="63G-16-201"><ln numlevel="1" lineno="79" slineno="1-46"/>63G-16-201</xref>.</amend></subsection><subsection ssid="8-24" dnum="4-o:5-i" numlevel="1" lineno="80" slineno="1-47" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>"Legislative emergency response committee" means the Legislative Emergency <ln numlevel="1" lineno="81" slineno="1-48"/>Response Committee created in Section <xref depth="3" refnumber="53-2a-218" start="0">53-2a-218</xref>.</subsection><subsection ssid="8-25" dnum="5-o:6-i" numlevel="1" lineno="82" slineno="1-49" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>"Local emergency" means a condition in any municipality or county of the state <ln numlevel="1" lineno="83" slineno="1-50"/>which requires that emergency assistance be provided by the affected municipality or <ln numlevel="1" lineno="84" slineno="1-51"/>county or another political subdivision to save lives and protect property within its <ln numlevel="1" lineno="85" slineno="1-52"/>jurisdiction in response to a disaster, or to avoid or reduce the threat of a disaster.</subsection><subsection ssid="8-26" dnum="6-o:7-i" numlevel="1" lineno="86" slineno="1-53" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Long-term state of emergency" means a state of emergency:<subsection ssid="8-27" dnum="a-o" numlevel="1" lineno="87" slineno="1-54" level="2"><display>(a)</display>that lasts longer than 30 days; or</subsection><subsection ssid="8-28" dnum="b-o" numlevel="1" lineno="88" slineno="1-55" level="2"><display>(b)</display>declared to respond to exigent circumstances as described in Subsection <xref depth="4" refnumber="53-2a-206(3)" start="0">53-2a-206(3)</xref>.</subsection></subsection><subsection ssid="8-29" dnum="7-o:8-i" numlevel="1" lineno="89" slineno="1-56" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Political subdivision" means a municipality, county, special service district, or <ln numlevel="1" lineno="90" slineno="1-57"/>special district.</subsection></section></bsec><bsec buid="10" type="amend" src="code" num="53-2a-205" uid="C53-2a-S205_2025050720250507" sort="53 02a02050020250507" numlevel="1" lineno="91" slineno="2-1" sn="2"><section number="53-2a-205" numlevel="1" lineno="92" slineno="2-2" type="amend"><secline lineno="91">Section 2, Section <bold>53-2a-205</bold> is amended to read:</secline><catline lineno="92"><bold>53-2a-205. Authority of chief executive officers of political subdivisions -- <ln numlevel="1" lineno="93" slineno="2-3"/>Ordering of evacuations.</bold></catline><subsection ssid="10-1" dnum="1-o" numlevel="1" lineno="94" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="10-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In order to protect life and property when a state of emergency or local emergency <ln numlevel="1" lineno="95" slineno="2-5"/>has been declared, subject to limitation by the Legislature as described in Subsection <xref depth="4" refnumber="53-2a-206(5)" start="0"><ln numlevel="1" lineno="96" slineno="2-6"/>53-2a-206(5)</xref>, and subject to Section <xref depth="3" refnumber="53-2a-216" start="0">53-2a-216</xref>, the chief executive officer of each <ln numlevel="1" lineno="97" slineno="2-7"/>political subdivision of the state is authorized to:<subsection ssid="10-3" dnum="i-o" numlevel="1" lineno="98" slineno="2-8" level="3" tab="1"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">carry out, in the chief executive officer's jurisdiction, the measures as may be <ln numlevel="1" lineno="99" slineno="2-9"/>ordered by the governor under this part</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">implement the measures the governor <ln numlevel="1" lineno="100" slineno="2-10"/>orders under this part in the chief executive officer's jurisdiction</amend>; and</subsection><subsection ssid="10-4" dnum="ii-o" numlevel="1" lineno="101" slineno="2-11" level="3" tab="1"><display>(ii)</display>take any additional measures the chief executive officer may consider necessary, <ln numlevel="1" lineno="102" slineno="2-12"/>subject to the limitations and provisions of this part.</subsection></subsection><subsection ssid="10-5" dnum="b-o" numlevel="1" lineno="103" slineno="2-13" level="2"><display>(b)</display>The chief executive officer may not take an action that is inconsistent with any order, <ln numlevel="1" lineno="104" slineno="2-14"/>rule, regulation, or action of the governor.</subsection><subsection ssid="10-6" dnum="c-o" numlevel="1" lineno="105" slineno="2-15" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">A chief executive officer of a municipality may not exercise powers under this <ln numlevel="1" lineno="106" slineno="2-16"/>chapter to respond to an epidemic or a pandemic.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A chief executive officer may not <ln numlevel="1" lineno="107" slineno="2-17"/>exercise powers under this chapter in response to:</amend><subsection ssid="10-24" dnum="_-o:i-i" numlevel="1" lineno="108" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">a proclamation declaring a state of emergency that is issued by an international <ln numlevel="1" lineno="109" slineno="2-19"/>organization; or</amend></subsection><subsection ssid="10-25" dnum="_-o:ii-i" numlevel="1" lineno="110" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">an epidemic or a pandemic, if the chief executive officer is the chief executive <ln numlevel="1" lineno="111" slineno="2-21"/>officer of a municipality.</amend></subsection></subsection></subsection><subsection ssid="10-7" dnum="2-o" numlevel="1" lineno="112" slineno="2-22" level="1"><display>(2)</display>Subject to Section <xref depth="3" refnumber="53-2a-216" start="0">53-2a-216</xref>, when a state of emergency or local emergency is <ln numlevel="1" lineno="113" slineno="2-23"/>declared, the authority of the chief executive officer includes:<subsection ssid="10-8" dnum="a-o" numlevel="1" lineno="114" slineno="2-24" level="2"><display>(a)</display>utilizing all available resources of the political subdivision as reasonably necessary to <ln numlevel="1" lineno="115" slineno="2-25"/>manage a state of emergency or local emergency;</subsection><subsection ssid="10-9" dnum="b-o" numlevel="1" lineno="116" slineno="2-26" level="2"><display>(b)</display>employing measures and giving direction to local officers and agencies which are <ln numlevel="1" lineno="117" slineno="2-27"/>reasonable and necessary for the purpose of securing compliance with the provisions <ln numlevel="1" lineno="118" slineno="2-28"/>of this part and with orders, rules, and regulations made under this part;</subsection><subsection ssid="10-10" dnum="c-o" numlevel="1" lineno="119" slineno="2-29" level="2"><display>(c)</display>if necessary for the preservation of life, issuing an order for the evacuation of all or <ln numlevel="1" lineno="120" slineno="2-30"/>part of the population from any stricken or threatened area within the political <ln numlevel="1" lineno="121" slineno="2-31"/>subdivision;</subsection><subsection ssid="10-11" dnum="d-o" numlevel="1" lineno="122" slineno="2-32" level="2"><display>(d)</display>recommending routes, modes of transportation, and destinations in relation to an <ln numlevel="1" lineno="123" slineno="2-33"/>evacuation;</subsection><subsection ssid="10-12" dnum="e-o" numlevel="1" lineno="124" slineno="2-34" level="2"><display>(e)</display>suspending or limiting the sale, dispensing, or transportation of alcoholic beverages, <ln numlevel="1" lineno="125" slineno="2-35"/>explosives, and combustibles in relation to an evacuation, except that the chief <ln numlevel="1" lineno="126" slineno="2-36"/>executive officer may not restrict the lawful bearing of arms;</subsection><subsection ssid="10-13" dnum="f-o" numlevel="1" lineno="127" slineno="2-37" level="2"><display>(f)</display>controlling ingress and egress to and from a disaster area, controlling the movement <ln numlevel="1" lineno="128" slineno="2-38"/>of persons within a disaster area, and ordering the occupancy or evacuation of <ln numlevel="1" lineno="129" slineno="2-39"/>premises in a disaster area;</subsection><subsection ssid="10-14" dnum="g-o" numlevel="1" lineno="130" slineno="2-40" level="2"><display>(g)</display>clearing or removing debris or wreckage that may threaten public health, public <ln numlevel="1" lineno="131" slineno="2-41"/>safety, or private property from publicly or privately owned land or waters, except <ln numlevel="1" lineno="132" slineno="2-42"/>that where there is no immediate threat to public health or safety, the chief executive <ln numlevel="1" lineno="133" slineno="2-43"/>officer shall not exercise this authority in relation to privately owned land or waters <ln numlevel="1" lineno="134" slineno="2-44"/>unless:<subsection ssid="10-15" dnum="i-o" numlevel="1" lineno="135" slineno="2-45" level="3"><display>(i)</display>the owner authorizes the employees of designated local agencies to enter upon the <ln numlevel="1" lineno="136" slineno="2-46"/>private land or waters to perform any tasks necessary for the removal or clearance; <ln numlevel="1" lineno="137" slineno="2-47"/>and</subsection><subsection ssid="10-16" dnum="ii-o" numlevel="1" lineno="138" slineno="2-48" level="3"><display>(ii)</display>the owner provides an unconditional authorization for removal of the debris or <ln numlevel="1" lineno="139" slineno="2-49"/>wreckage and agrees to indemnify the local and state government against any <ln numlevel="1" lineno="140" slineno="2-50"/>claim arising from the removal; and</subsection></subsection><subsection ssid="10-17" dnum="h-o" numlevel="1" lineno="141" slineno="2-51" level="2"><display>(h)</display>invoking the provisions of any mutual aid agreement entered into by the political <ln numlevel="1" lineno="142" slineno="2-52"/>subdivision.</subsection></subsection><subsection ssid="10-18" dnum="3-o" numlevel="1" lineno="143" slineno="2-53" level="1" space="false"><display>(3)</display><subsection ssid="10-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the chief executive is unavailable to issue an order for evacuation under <ln numlevel="1" lineno="144" slineno="2-54"/>Subsection <xref depth="4" refnumber="53-2a-205(2)(c)" start="0">(2)(c)</xref>, the chief law enforcement officer having jurisdiction for the area <ln numlevel="1" lineno="145" slineno="2-55"/>may issue an urgent order for evacuation, for a period not to exceed 36 hours, if the <ln numlevel="1" lineno="146" slineno="2-56"/>order is necessary for the preservation of life.</subsection><subsection ssid="10-20" dnum="b-o" numlevel="1" lineno="147" slineno="2-57" level="2"><display>(b)</display>The chief executive officer may ratify, modify, or revoke the chief law enforcement <ln numlevel="1" lineno="148" slineno="2-58"/>officer's order.</subsection></subsection><subsection ssid="10-21" dnum="4-o" numlevel="1" lineno="149" slineno="2-59" level="1"><display>(4)</display>Notice of an order or the ratification, modification, or revocation of an order issued <ln numlevel="1" lineno="150" slineno="2-60"/>under this section shall be:<subsection ssid="10-22" dnum="a-o" numlevel="1" lineno="151" slineno="2-61" level="2"><display>(a)</display>given to the persons within the jurisdiction by the most effective and reasonable <ln numlevel="1" lineno="152" slineno="2-62"/>means available; and</subsection><subsection ssid="10-23" dnum="b-o" numlevel="1" lineno="153" slineno="2-63" level="2"><display>(b)</display>filed in accordance with Subsection <xref depth="4" refnumber="53-2a-209(1)" start="0">53-2a-209(1)</xref>.</subsection></subsection></section></bsec><bsec buid="12" type="amend" src="code" num="53-2a-206" uid="C53-2a-S206_2025050720250507" sort="53 02a02060020250507" style="" numlevel="1" lineno="154" slineno="3-1" sn="3"><section number="53-2a-206" numlevel="1" lineno="155" slineno="3-2" type="amend"><secline lineno="154">Section 3, Section <bold>53-2a-206</bold> is amended to read:</secline><catline lineno="155"><bold>53-2a-206. State of emergency -- Declaration -- Termination -- Commander in <ln numlevel="1" lineno="156" slineno="3-3"/>chief of military forces.</bold></catline><subsection ssid="12-1" dnum="1-o" numlevel="1" lineno="157" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="12-40" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">A state of emergency may be declared by executive order of the governor</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject <ln numlevel="1" lineno="158" slineno="3-5"/>to Subsection <xref tempid="658" depth="4" refnumber="53-2a-206(1)(b)">(1)(b)</xref>, the governor may declare a state of emergency by executive <ln numlevel="1" lineno="159" slineno="3-6"/>order</amend> if the governor finds a disaster has occurred or the occurrence or threat of a <ln numlevel="1" lineno="160" slineno="3-7"/>disaster is imminent in any area of the state in which state government assistance is <ln numlevel="1" lineno="161" slineno="3-8"/>required to supplement the response and recovery efforts of the affected political <ln numlevel="1" lineno="162" slineno="3-9"/>subdivision or political subdivisions.</subsection><subsection ssid="12-45" dnum="_-o:b-i" numlevel="1" lineno="163" slineno="3-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">The governor may not base a finding described in Subsection <xref refnumber="53-2a-206(1)(a)" depth="4">(1)(a)</xref> on a <ln numlevel="1" lineno="164" slineno="3-11"/>proclamation declaring a state of emergency that is issued by an international <ln numlevel="1" lineno="165" slineno="3-12"/>organization.</amend></subsection></subsection><subsection ssid="12-2" dnum="2-o" numlevel="1" lineno="166" slineno="3-13" level="1" space="false"><display>(2)</display><subsection ssid="12-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (2)(b), a state of emergency described in <ln numlevel="1" lineno="167" slineno="3-14"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(a)</amend> expires at the earlier of:<subsection ssid="12-4" dnum="i-o" numlevel="1" lineno="168" slineno="3-15" level="3" tab="1"><display>(i)</display>the day on which the governor finds that the threat or danger has passed or the <ln numlevel="1" lineno="169" slineno="3-16"/>disaster reduced to the extent that emergency conditions no longer exist;</subsection><subsection ssid="12-5" dnum="ii-o" numlevel="1" lineno="170" slineno="3-17" level="3" tab="1"><display>(ii)</display>30 days after the date on which the governor declared the state of emergency; or</subsection><subsection ssid="12-6" dnum="iii-o" numlevel="1" lineno="171" slineno="3-18" level="3" tab="1"><display>(iii)</display>the day on which the Legislature terminates the state of emergency by joint <ln numlevel="1" lineno="172" slineno="3-19"/>resolution.</subsection></subsection><subsection ssid="12-7" dnum="b-o" numlevel="1" lineno="173" slineno="3-20" level="2" space="false"><display>(b)</display><subsection ssid="12-8" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The Legislature may, by joint resolution, extend a state of emergency for a time <ln numlevel="1" lineno="174" slineno="3-21"/>period designated in the joint resolution.</subsection><subsection ssid="12-9" dnum="ii-o" numlevel="1" lineno="175" slineno="3-22" level="3"><display>(ii)</display>If the Legislature extends a state of emergency in accordance with this <ln numlevel="1" lineno="176" slineno="3-23"/>subsection, the state of emergency expires on the date designated in the joint <ln numlevel="1" lineno="177" slineno="3-24"/>resolution.</subsection></subsection><subsection ssid="12-10" dnum="c-o" numlevel="1" lineno="178" slineno="3-25" level="2"><display>(c)</display>Except as provided in Subsection (3), if a state of emergency expires as described in <ln numlevel="1" lineno="179" slineno="3-26"/>Subsection (2), the governor may not declare a new state of emergency for the same <ln numlevel="1" lineno="180" slineno="3-27"/>disaster or occurrence as the expired state of emergency.</subsection></subsection><subsection ssid="12-11" dnum="3-o" numlevel="1" lineno="181" slineno="3-28" level="1" space="false"><display>(3)</display><subsection ssid="12-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After a state of emergency expires in accordance with Subsection (2), and subject <ln numlevel="1" lineno="182" slineno="3-29"/>to Subsection (4), the governor may declare a new state of emergency in response to <ln numlevel="1" lineno="183" slineno="3-30"/>the same disaster or occurrence as the expired state of emergency, if the governor <ln numlevel="1" lineno="184" slineno="3-31"/>finds that exigent circumstances exist.</subsection><subsection ssid="12-13" dnum="b-o" numlevel="1" lineno="185" slineno="3-32" level="2"><display>(b)</display>A state of emergency declared in accordance with Subsection (3)(a) expires in <ln numlevel="1" lineno="186" slineno="3-33"/>accordance with Subsections (2)(a) and (b).</subsection><subsection ssid="12-14" dnum="c-o" numlevel="1" lineno="187" slineno="3-34" level="2"><display>(c)</display>After a state of emergency declared in accordance with Subsection (3)(a) expires, the <ln numlevel="1" lineno="188" slineno="3-35"/>governor may not declare a new state of emergency in response to the same disaster <ln numlevel="1" lineno="189" slineno="3-36"/>or occurrence as the expired state of emergency, regardless of whether exigent <ln numlevel="1" lineno="190" slineno="3-37"/>circumstances exist.</subsection></subsection><subsection ssid="12-15" dnum="4-o" numlevel="1" lineno="191" slineno="3-38" level="1" space="false"><display>(4)</display><subsection ssid="12-16" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="12-17" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>If the Legislature finds that emergency conditions warrant the extension of a <ln numlevel="1" lineno="192" slineno="3-39"/>state of emergency beyond 30 days as described in Subsection (2)(b), the <ln numlevel="1" lineno="193" slineno="3-40"/>Legislature may extend the state of emergency and specify which emergency <ln numlevel="1" lineno="194" slineno="3-41"/>powers described in this part are necessary to respond to the emergency conditions <ln numlevel="1" lineno="195" slineno="3-42"/>present at the time of the extension of the state of emergency.</subsection><subsection ssid="12-18" dnum="ii-o" numlevel="1" lineno="196" slineno="3-43" level="3" tab="1"><display>(ii)</display>Circumstances that may warrant the extension of a state of emergency with <ln numlevel="1" lineno="197" slineno="3-44"/>limited emergency powers include:<subsection ssid="12-19" dnum="A-o" numlevel="1" lineno="198" slineno="3-45" level="4"><display>(A)</display>the imminent threat of the emergency has passed, but continued fiscal <ln numlevel="1" lineno="199" slineno="3-46"/>response remains necessary; or</subsection><subsection ssid="12-20" dnum="B-o" numlevel="1" lineno="200" slineno="3-47" level="4"><display>(B)</display>emergency conditions warrant certain executive actions, but certain <ln numlevel="1" lineno="201" slineno="3-48"/>emergency powers such as suspension of enforcement of statute are not <ln numlevel="1" lineno="202" slineno="3-49"/>necessary.</subsection></subsection></subsection><subsection ssid="12-21" dnum="b-o" numlevel="1" lineno="203" slineno="3-50" level="2"><display>(b)</display>For any state of emergency extended by the Legislature beyond 30 days as described <ln numlevel="1" lineno="204" slineno="3-51"/>in Subsection (2)(b), the Legislature may, by joint resolution:<subsection ssid="12-22" dnum="i-o" numlevel="1" lineno="205" slineno="3-52" level="3"><display>(i)</display>extend the state of emergency and maintain all of the emergency powers described <ln numlevel="1" lineno="206" slineno="3-53"/>in this part; or</subsection><subsection ssid="12-23" dnum="ii-o" numlevel="1" lineno="207" slineno="3-54" level="3"><display>(ii)</display>limit or restrict certain emergency powers of:<subsection ssid="12-24" dnum="A-o" numlevel="1" lineno="208" slineno="3-55" level="4"><display>(A)</display>the division as described in Section <xref depth="3" refnumber="53-2a-104">53-2a-104</xref>;</subsection><subsection ssid="12-25" dnum="B-o" numlevel="1" lineno="209" slineno="3-56" level="4"><display>(B)</display>the governor as described in Section <xref depth="3" refnumber="53-2a-204">53-2a-204</xref>;</subsection><subsection ssid="12-26" dnum="C-o" numlevel="1" lineno="210" slineno="3-57" level="4"><display>(C)</display>a chief executive officer of a political subdivision as described in Section <xref depth="3" refnumber="53-2a-205"><ln numlevel="1" lineno="211" slineno="3-58"/>53-2a-205</xref>; or</subsection><subsection ssid="12-27" dnum="D-o" numlevel="1" lineno="212" slineno="3-59" level="4"><display>(D)</display>other executive emergency powers described in this chapter.</subsection></subsection></subsection><subsection ssid="12-28" dnum="c-o" numlevel="1" lineno="213" slineno="3-60" level="2"><display>(c)</display>If the Legislature limits emergency powers as described in Subsection (4)(b), the <ln numlevel="1" lineno="214" slineno="3-61"/>Legislature shall:<subsection ssid="12-29" dnum="i-o" numlevel="1" lineno="215" slineno="3-62" level="3"><display>(i)</display>include in the joint resolution findings describing the nature and current conditions <ln numlevel="1" lineno="216" slineno="3-63"/>of the emergency that warrant the continuation or limitation of certain emergency <ln numlevel="1" lineno="217" slineno="3-64"/>powers; and</subsection><subsection ssid="12-30" dnum="ii-o" numlevel="1" lineno="218" slineno="3-65" level="3"><display>(ii)</display>clearly enumerate and describe in the joint resolution which powers:<subsection ssid="12-31" dnum="A-o" numlevel="1" lineno="219" slineno="3-66" level="4"><display>(A)</display>are being limited or restricted; or</subsection><subsection ssid="12-32" dnum="B-o" numlevel="1" lineno="220" slineno="3-67" level="4"><display>(B)</display>shall remain in force.</subsection></subsection></subsection></subsection><subsection ssid="12-33" dnum="5-o" numlevel="1" lineno="221" slineno="3-68" level="1"><display>(5)</display>If the Legislature terminates a state of emergency by joint resolution, the governor shall <ln numlevel="1" lineno="222" slineno="3-69"/>issue an executive order ending the state of emergency on receipt of the Legislature's <ln numlevel="1" lineno="223" slineno="3-70"/>resolution.</subsection><subsection ssid="12-34" dnum="6-o" numlevel="1" lineno="224" slineno="3-71" level="1"><display>(6)</display>An executive order described in this section to declare a state of emergency shall state:<subsection ssid="12-35" dnum="a-o" numlevel="1" lineno="225" slineno="3-72" level="2"><display>(a)</display>the nature of the state of emergency;</subsection><subsection ssid="12-36" dnum="b-o" numlevel="1" lineno="226" slineno="3-73" level="2"><display>(b)</display>the area or areas threatened; and</subsection><subsection ssid="12-37" dnum="c-o" numlevel="1" lineno="227" slineno="3-74" level="2"><display>(c)</display>the conditions creating such an emergency or those conditions allowing termination <ln numlevel="1" lineno="228" slineno="3-75"/>of the state of emergency.</subsection></subsection><subsection ssid="12-38" dnum="7-o" numlevel="1" lineno="229" slineno="3-76" level="1"><display>(7)</display>During the continuance of any state of emergency the governor is commander in chief <ln numlevel="1" lineno="230" slineno="3-77"/>of the military forces of the state in accordance with Utah Constitution Article VII, <ln numlevel="1" lineno="231" slineno="3-78"/>Section 4, and Title 39A, National Guard and Militia Act.</subsection></section></bsec><bsec buid="11" type="amend" src="code" num="53-2a-208" uid="C53-2a-S208_2025050720250507" sort="53 02a02080020250507" style="" numlevel="1" lineno="232" slineno="4-1" sn="4"><section number="53-2a-208" numlevel="1" lineno="233" slineno="4-2" type="amend"><secline lineno="232">Section 4, Section <bold>53-2a-208</bold> is amended to read:</secline><catline lineno="233"><bold>53-2a-208. Local emergency -- Declarations -- Termination of a local emergency.</bold></catline><subsection ssid="11-1" dnum="1-o" numlevel="1" lineno="234" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="11-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">Subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections</amend> (1)(b)<amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both"> and (c)</amend>, a chief executive <ln numlevel="1" lineno="235" slineno="4-4"/>officer of a municipality or county may declare by proclamation a state of emergency <ln numlevel="1" lineno="236" slineno="4-5"/>if the chief executive officer finds:<subsection ssid="11-3" dnum="i-o" numlevel="1" lineno="237" slineno="4-6" level="3" tab="1"><display>(i)</display>a disaster has occurred or the occurrence or threat of a disaster is imminent in an <ln numlevel="1" lineno="238" slineno="4-7"/>area of the municipality or county; and</subsection><subsection ssid="11-4" dnum="ii-o" numlevel="1" lineno="239" slineno="4-8" level="3" tab="1"><display>(ii)</display>the municipality or county requires additional assistance to supplement the <ln numlevel="1" lineno="240" slineno="4-9"/>response and recovery efforts of the municipality or county.</subsection></subsection><subsection ssid="11-5" dnum="b-o" numlevel="1" lineno="241" slineno="4-10" level="2"><display>(b)</display>A chief executive officer of a municipality may not declare by proclamation a state <ln numlevel="1" lineno="242" slineno="4-11"/>of emergency in response to an epidemic or a pandemic.</subsection><subsection ssid="11-46" dnum="_-o:c-i" numlevel="1" lineno="243" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">A chief executive officer of a municipality or county may not declare by <ln numlevel="1" lineno="244" slineno="4-13"/>proclamation a state of emergency in response to a proclamation declaring a state of <ln numlevel="1" lineno="245" slineno="4-14"/>emergency that is issued by an international organization.</amend></subsection></subsection><subsection ssid="11-6" dnum="2-o" numlevel="1" lineno="246" slineno="4-15" level="1"><display>(2)</display>A declaration of a local emergency:<subsection ssid="11-7" dnum="a-o" numlevel="1" lineno="247" slineno="4-16" level="2"><display>(a)</display>constitutes an official recognition that a disaster situation exists within the affected <ln numlevel="1" lineno="248" slineno="4-17"/>municipality or county;</subsection><subsection ssid="11-8" dnum="b-o" numlevel="1" lineno="249" slineno="4-18" level="2"><display>(b)</display>provides a legal basis for requesting and obtaining mutual aid or disaster assistance <ln numlevel="1" lineno="250" slineno="4-19"/>from other political subdivisions or from the state or federal government;</subsection><subsection ssid="11-9" dnum="c-o" numlevel="1" lineno="251" slineno="4-20" level="2"><display>(c)</display>activates the response and recovery aspects of any and all applicable local disaster <ln numlevel="1" lineno="252" slineno="4-21"/>emergency plans; and</subsection><subsection ssid="11-10" dnum="d-o" numlevel="1" lineno="253" slineno="4-22" level="2"><display>(d)</display>authorizes the furnishing of aid and assistance in relation to the proclamation.</subsection></subsection><subsection ssid="11-11" dnum="3-o" numlevel="1" lineno="254" slineno="4-23" level="1"><display>(3)</display>A local emergency proclamation issued under this section shall state:<subsection ssid="11-12" dnum="a-o" numlevel="1" lineno="255" slineno="4-24" level="2"><display>(a)</display>the nature of the local emergency;</subsection><subsection ssid="11-13" dnum="b-o" numlevel="1" lineno="256" slineno="4-25" level="2"><display>(b)</display>the area or areas that are affected or threatened; and</subsection><subsection ssid="11-14" dnum="c-o" numlevel="1" lineno="257" slineno="4-26" level="2"><display>(c)</display>the conditions which caused the emergency.</subsection></subsection><subsection ssid="11-15" dnum="4-o" numlevel="1" lineno="258" slineno="4-27" level="1"><display>(4)</display>The emergency declaration process within the state shall be as follows:<subsection ssid="11-16" dnum="a-o" numlevel="1" lineno="259" slineno="4-28" level="2"><display>(a)</display>a city or town, shall declare to the county;</subsection><subsection ssid="11-17" dnum="b-o" numlevel="1" lineno="260" slineno="4-29" level="2"><display>(b)</display>a county shall declare to the state;</subsection><subsection ssid="11-18" dnum="c-o" numlevel="1" lineno="261" slineno="4-30" level="2"><display>(c)</display>the state shall declare to the federal government; and</subsection><subsection ssid="11-19" dnum="d-o" numlevel="1" lineno="262" slineno="4-31" level="2"><display>(d)</display>a tribe, as defined in Section <xref depth="3" refnumber="23A-1-202">23A-1-202</xref>, shall declare as determined under the <ln numlevel="1" lineno="263" slineno="4-32"/>Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. Sec. <ln numlevel="1" lineno="264" slineno="4-33"/>5121 et seq.</subsection></subsection><subsection ssid="11-20" dnum="5-o" numlevel="1" lineno="265" slineno="4-34" level="1"><display>(5)</display>Nothing in this part affects:<subsection ssid="11-21" dnum="a-o" numlevel="1" lineno="266" slineno="4-35" level="2"><display>(a)</display>the governor's authority to declare a state of emergency under Section <xref depth="3" refnumber="53-2a-206">53-2a-206</xref>; or</subsection><subsection ssid="11-22" dnum="b-o" numlevel="1" lineno="267" slineno="4-36" level="2"><display>(b)</display>the duties, requests, reimbursements, or other actions taken by a political subdivision <ln numlevel="1" lineno="268" slineno="4-37"/>participating in the state-wide mutual aid system pursuant to Title 53, Chapter 2a, <ln numlevel="1" lineno="269" slineno="4-38"/>Part 3, Statewide Mutual Aid Act.</subsection></subsection><subsection ssid="11-23" dnum="6-o" numlevel="1" lineno="270" slineno="4-39" level="1" space="false"><display>(6)</display><subsection ssid="11-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (6)(b), a state of emergency described in <ln numlevel="1" lineno="271" slineno="4-40"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(1)(a)</amend> expires the earlier of:<subsection ssid="11-25" dnum="i-o" numlevel="1" lineno="272" slineno="4-41" level="3" tab="1"><display>(i)</display>the day on which the chief executive officer finds that:<subsection ssid="11-26" dnum="A-o" numlevel="1" lineno="273" slineno="4-42" level="4"><display>(A)</display>the threat or danger has passed;</subsection><subsection ssid="11-27" dnum="B-o" numlevel="1" lineno="274" slineno="4-43" level="4"><display>(B)</display>the disaster reduced to the extent that emergency conditions no longer exist; or</subsection><subsection ssid="11-28" dnum="C-o" numlevel="1" lineno="275" slineno="4-44" level="4"><display>(C)</display>the municipality or county no longer requires state government assistance to <ln numlevel="1" lineno="276" slineno="4-45"/>supplement the response and recovery efforts of the municipality or county;</subsection></subsection><subsection ssid="11-29" dnum="ii-o" numlevel="1" lineno="277" slineno="4-46" level="3" tab="1"><display>(ii)</display>30 days after the day on which the chief executive officer declares the state of <ln numlevel="1" lineno="278" slineno="4-47"/>emergency; or</subsection><subsection ssid="11-30" dnum="iii-o" numlevel="1" lineno="279" slineno="4-48" level="3" tab="1"><display>(iii)</display>the day on which the legislative body of the municipality or county terminates <ln numlevel="1" lineno="280" slineno="4-49"/>the state of emergency by majority vote.</subsection></subsection><subsection ssid="11-31" dnum="b-o" numlevel="1" lineno="281" slineno="4-50" level="2" space="false"><display>(b)</display><subsection ssid="11-32" dnum="i-o" level="3" placement="sameline" space="false"><display>(i)</display><subsection ssid="11-33" dnum="A-o" level="4" tab="1" placement="sameline"><display>(A)</display>The legislative body of a municipality may at any time terminate by <ln numlevel="1" lineno="282" slineno="4-51"/>majority vote a state of emergency declared by the chief executive officer of <ln numlevel="1" lineno="283" slineno="4-52"/>the municipality.</subsection><subsection ssid="11-34" dnum="B-o" numlevel="1" lineno="284" slineno="4-53" level="4" tab="1"><display>(B)</display>The legislative body of a county may at any time terminate by majority vote a <ln numlevel="1" lineno="285" slineno="4-54"/>state of emergency declared by the chief executive officer of the county.</subsection></subsection><subsection ssid="11-35" dnum="ii-o" numlevel="1" lineno="286" slineno="4-55" level="3"><display>(ii)</display>The legislative body of a municipality or county may by majority vote extend a <ln numlevel="1" lineno="287" slineno="4-56"/>state of emergency for a time period stated in the motion.</subsection><subsection ssid="11-36" dnum="iii-o" numlevel="1" lineno="288" slineno="4-57" level="3"><display>(iii)</display>If the legislative body of a municipality or county extends a state of emergency <ln numlevel="1" lineno="289" slineno="4-58"/>in accordance with this subsection, the state of emergency expires on the date <ln numlevel="1" lineno="290" slineno="4-59"/>designated by the legislative body in the motion.</subsection><subsection ssid="11-37" dnum="iv-o" numlevel="1" lineno="291" slineno="4-60" level="3"><display>(iv)</display>An action by a legislative body of a municipality or county to terminate a state of <ln numlevel="1" lineno="292" slineno="4-61"/>emergency as described in this Subsection (6)(b) is not subject to veto by the <ln numlevel="1" lineno="293" slineno="4-62"/>relevant chief executive officer.</subsection></subsection><subsection ssid="11-38" dnum="c-o" numlevel="1" lineno="294" slineno="4-63" level="2"><display>(c)</display>Except as provided in Subsection (7), after a state of emergency expires in <ln numlevel="1" lineno="295" slineno="4-64"/>accordance with this Subsection (6), the chief executive officer may not declare a <ln numlevel="1" lineno="296" slineno="4-65"/>new state of emergency in response to the same disaster or occurrence as the expired <ln numlevel="1" lineno="297" slineno="4-66"/>state of emergency.</subsection></subsection><subsection ssid="11-39" dnum="7-o" numlevel="1" lineno="298" slineno="4-67" level="1" space="false"><display>(7)</display><subsection ssid="11-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>After a state of emergency expires in accordance with Subsection (6), the chief <ln numlevel="1" lineno="299" slineno="4-68"/>executive officer may declare a new state of emergency in response to the same <ln numlevel="1" lineno="300" slineno="4-69"/>disaster or occurrence as the expired state of emergency, if the chief executive officer <ln numlevel="1" lineno="301" slineno="4-70"/>finds that exigent circumstances exist.</subsection><subsection ssid="11-41" dnum="b-o" numlevel="1" lineno="302" slineno="4-71" level="2"><display>(b)</display>A state of emergency declared in accordance with Subsection (7)(a) expires in <ln numlevel="1" lineno="303" slineno="4-72"/>accordance with Subsections (6)(a) and (b).</subsection><subsection ssid="11-42" dnum="c-o" numlevel="1" lineno="304" slineno="4-73" level="2"><display>(c)</display>After a state of emergency declared in accordance with Subsection (7)(a) expires, the <ln numlevel="1" lineno="305" slineno="4-74"/>chief executive officer may not declare a new state of emergency in response to the <ln numlevel="1" lineno="306" slineno="4-75"/>same disaster or occurrence as the expired state of emergency, regardless of whether <ln numlevel="1" lineno="307" slineno="4-76"/>exigent circumstances exist.</subsection></subsection></section></bsec><bsec buid="14" num="63G-16-201" type="amend" src="code" uid="C63G-16-S201_2025050720250507" sort="63G16 02010020250507" style="" numlevel="1" lineno="308" slineno="5-1" sn="5"><section number="63G-16-201" numlevel="1" lineno="309" slineno="5-2" type="amend"><secline lineno="308">Section 5, Section <bold>63G-16-201</bold> is amended to read:</secline><catline lineno="309"><bold>63G-16-201. Definitions.</bold></catline><sectionText lineno="310"><tab/>As used in this part:</sectionText><subsection ssid="14-14-1" dnum="1-o" numlevel="1" lineno="311" slineno="5-4" level="1"><display>(1)</display>"Board of education" means:<subsection ssid="14-14-2" dnum="a-o" numlevel="1" lineno="312" slineno="5-5" level="2"><display>(a)</display>a local school board described in Title 53G, Chapter 4, School Districts;</subsection><subsection ssid="14-14-3" dnum="b-o" numlevel="1" lineno="313" slineno="5-6" level="2"><display>(b)</display>the State Board of Education;</subsection><subsection ssid="14-14-4" dnum="c-o" numlevel="1" lineno="314" slineno="5-7" level="2"><display>(c)</display>the State Charter School Board created under Section <xref depth="3" refnumber="53G-5-201">53G-5-201</xref>; or</subsection><subsection ssid="14-14-5" dnum="d-o" numlevel="1" lineno="315" slineno="5-8" level="2"><display>(d)</display>a charter school governing board described in Title 53G, Chapter 5, Charter Schools.</subsection></subsection><subsection ssid="14-14-6" dnum="2-o" numlevel="1" lineno="316" slineno="5-9" level="1"><display>(2)</display>"Federal agency" means a department, agency, authority, commission, council, board, <ln numlevel="1" lineno="317" slineno="5-10"/>office, bureau, or other administrative unit of the executive branch of the United States <ln numlevel="1" lineno="318" slineno="5-11"/>government.</subsection><subsection ssid="14-14-7" dnum="3-o" numlevel="1" lineno="319" slineno="5-12" level="1" space="false"><display>(3)</display><subsection ssid="14-14-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Federal directive" means:<subsection ssid="14-14-9" dnum="i-o" numlevel="1" lineno="320" slineno="5-13" level="3" tab="1"><display>(i)</display>a statute passed by the United States Congress;</subsection><subsection ssid="14-14-10" dnum="ii-o" numlevel="1" lineno="321" slineno="5-14" level="3" tab="1"><display>(ii)</display>an executive order by the president of the United States;</subsection><subsection ssid="14-14-11" dnum="iii-o" numlevel="1" lineno="322" slineno="5-15" level="3" tab="1"><display>(iii)</display>a rule or regulation adopted by a federal agency; or</subsection><subsection ssid="14-14-12" dnum="iv-o" numlevel="1" lineno="323" slineno="5-16" level="3" tab="1"><display>(iv)</display>an order or action by:<subsection ssid="14-14-13" dnum="A-o" numlevel="1" lineno="324" slineno="5-17" level="4"><display>(A)</display>a federal agency; or</subsection><subsection ssid="14-14-14" dnum="B-o" numlevel="1" lineno="325" slineno="5-18" level="4"><display>(B)</display>an employee or official appointed by the president of the United States.</subsection></subsection></subsection><subsection ssid="14-14-15" dnum="b-o" numlevel="1" lineno="326" slineno="5-19" level="2"><display>(b)</display>"Federal directive" does not include any order by the federal government calling the <ln numlevel="1" lineno="327" slineno="5-20"/>Utah National Guard into the service of the United States.</subsection></subsection><subsection ssid="14-14-16" dnum="4-o" numlevel="1" lineno="328" slineno="5-21" level="1" space="false"><display>(4)</display><subsection ssid="14-14-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Government officer" means:<subsection ssid="14-14-18" dnum="i-o" numlevel="1" lineno="329" slineno="5-22" level="3" tab="1"><display>(i)</display>an individual elected to a position in state or local government, when acting in the <ln numlevel="1" lineno="330" slineno="5-23"/>capacity of the state or local government position;</subsection><subsection ssid="14-14-19" dnum="ii-o" numlevel="1" lineno="331" slineno="5-24" level="3" tab="1"><display>(ii)</display>an individual elected to a board of education, when acting in the capacity of a <ln numlevel="1" lineno="332" slineno="5-25"/>member of a board of education;</subsection><subsection ssid="14-14-20" dnum="iii-o" numlevel="1" lineno="333" slineno="5-26" level="3" tab="1"><display>(iii)</display>an individual appointed to fill a vacancy in a position described in Subsection <ln numlevel="1" lineno="334" slineno="5-27"/>(4)(a)(i) or (ii), when acting in the capacity of the position; or</subsection><subsection ssid="14-14-21" dnum="iv-o" numlevel="1" lineno="335" slineno="5-28" level="3" tab="1"><display>(iv)</display>an individual appointed to or employed in a full-time position by state <ln numlevel="1" lineno="336" slineno="5-29"/>government, local government, or a board of education, when acting in the <ln numlevel="1" lineno="337" slineno="5-30"/>capacity of the individual's appointment or employment.</subsection></subsection><subsection ssid="14-14-22" dnum="b-o" numlevel="1" lineno="338" slineno="5-31" level="2"><display>(b)</display>"Government officer" does not include a member or employee of the legislative <ln numlevel="1" lineno="339" slineno="5-32"/>branch of state government.</subsection></subsection><subsection ssid="14-32" dnum="_-o:5-i" numlevel="1" lineno="340" slineno="5-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">"International directive" means a rule, resolution, tax, policy, or mandate issued by an <ln numlevel="1" lineno="341" slineno="5-34"/>international organization that purports to have the force and effect of law.</amend></subsection><subsection ssid="14-33" dnum="_-o:6-i" numlevel="1" lineno="342" slineno="5-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">"International organization" means the United Nations, the World Economic Forum, or <ln numlevel="1" lineno="343" slineno="5-36"/>the World Health Organization.</amend></subsection><subsection ssid="14-14-23" dnum="5-o:7-i" numlevel="1" lineno="344" slineno="5-37" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1162" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1163" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Local government" means:<subsection ssid="14-14-24" dnum="a-o" numlevel="1" lineno="345" slineno="5-38" level="2"><display>(a)</display>a county, city, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">town, or metro township</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or town</amend>;</subsection><subsection ssid="14-14-25" dnum="b-o" numlevel="1" lineno="346" slineno="5-39" level="2"><display>(b)</display>a special district governed by Title 17B, Limited Purpose Local Government Entities <ln numlevel="1" lineno="347" slineno="5-40"/>- Special Districts;</subsection><subsection ssid="14-14-26" dnum="c-o" numlevel="1" lineno="348" slineno="5-41" level="2"><display>(c)</display>a special service district governed by Title 17D, Chapter 1, Special Service District <ln numlevel="1" lineno="349" slineno="5-42"/>Act;</subsection><subsection ssid="14-14-27" dnum="d-o" numlevel="1" lineno="350" slineno="5-43" level="2"><display>(d)</display>a community reinvestment agency governed by Title 17C, Limited Purpose Local <ln numlevel="1" lineno="351" slineno="5-44"/>Government Entities - Community Reinvestment Agency Act;</subsection><subsection ssid="14-14-28" dnum="e-o" numlevel="1" lineno="352" slineno="5-45" level="2"><display>(e)</display>a conservation district governed by Title 17D, Chapter 3, Conservation District Act;</subsection><subsection ssid="14-14-29" dnum="f-o" numlevel="1" lineno="353" slineno="5-46" level="2"><display>(f)</display>a redevelopment agency; or</subsection><subsection ssid="14-14-30" dnum="g-o" numlevel="1" lineno="354" slineno="5-47" level="2"><display>(g)</display>an interlocal entity or a joint cooperative undertaking governed by Title 11, Chapter <ln numlevel="1" lineno="355" slineno="5-48"/>13, Interlocal Cooperation Act.</subsection></subsection><subsection ssid="14-34" dnum="_-o:8-i" numlevel="1" lineno="356" slineno="5-49" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">"State agency" means a department, commission, board, council, agency, institution, <ln numlevel="1" lineno="357" slineno="5-50"/>officer, corporation, fund, division, office, committee, authority, laboratory, library, unit, <ln numlevel="1" lineno="358" slineno="5-51"/>bureau, panel, or any other administrative unit of the state.</amend></subsection></section></bsec><bsec buid="3" type="enact" src="code" num="63G-16-203" uid="C63G-16-S203_2025050720250507" sort="63G16 02030020250507" numlevel="1" lineno="359" slineno="6-1" sn="6"><section number="63G-16-203" numlevel="1" lineno="360" slineno="6-2" type="enact"><secline lineno="359">Section 6, Section <bold>63G-16-203</bold> is enacted to read:</secline><catline lineno="360"><bold>63G-16-203.
