and</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">educating and incentivizing employers to hire county residents who have a criminal <ln numlevel="1" lineno="16" slineno="0-16"/>record or a juvenile record;</hl></hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">adds an expunged conviction and an arrest that occurred as a juvenile to the <ln numlevel="1" lineno="18" slineno="0-18"/>circumstances when a public employer may not exclude an applicant from an initial <ln numlevel="1" lineno="19" slineno="0-19"/>interview;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">modifies procedural requirements for appealing a denial of a license under the Division of <ln numlevel="1" lineno="21" slineno="0-21"/>Professional Licensing Act;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">reduces the amount of time following an individual's incarceration for purposes of <ln numlevel="1" lineno="23" slineno="0-23"/>defining unprofessional conduct in certain circumstances;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">creates the Rehabilitation and Reentry Services Restricted Account, which:<hl numlevel="1" lineno="25" slineno="0-25" level="2"> allows the department to accept donations and other funds; and</hl><hl numlevel="1" lineno="26" slineno="0-26" level="2">restricts funds for specified purposes relating to the successful reintegration of <ln numlevel="1" lineno="27" slineno="0-27"/>offenders and former offenders into the general public; Local mental health authorities <ln numlevel="1" lineno="51" slineno="1-3"/>-- Responsibilities.</bold></catline><subsection ssid="3-1" dnum="1-o" numlevel="1" lineno="52" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-2" dnum="a-o" numlevel="1" lineno="53" slineno="1-5" level="2"><display>(a)</display>"Assisted outpatient treatment" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-301"><ln numlevel="1" lineno="54" slineno="1-6"/>26B-5-301</xref>.</subsection><subsection ssid="3-3" dnum="b-o" numlevel="1" lineno="55" slineno="1-7" level="2"><display>(b)</display>"Crisis worker" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-610">26B-5-610</xref>.</subsection><subsection ssid="3-4" dnum="c-o" numlevel="1" lineno="56" slineno="1-8" level="2"><display>(c)</display>"Local mental health crisis line" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-610"><ln numlevel="1" lineno="57" slineno="1-9"/>26B-5-610</xref>.</subsection><subsection ssid="3-5" dnum="d-o" numlevel="1" lineno="58" slineno="1-10" level="2"><display>(d)</display>"Mental health therapist" means the same as that term is defined in Section <xref depth="3" refnumber="58-60-102">58-60-102</xref>.</subsection><subsection ssid="3-6" dnum="e-o" numlevel="1" lineno="59" slineno="1-11" level="2"><display>(e)</display>"Public funds" means the same as that term is defined in Section <xref depth="3" refnumber="17-43-303">17-43-303</xref>.</subsection><subsection ssid="3-7" dnum="f-o" numlevel="1" lineno="60" slineno="1-12" level="2"><display>(f)</display>"Statewide mental health crisis line" means the same as that term is defined in <ln numlevel="1" lineno="61" slineno="1-13"/>Section <xref depth="3" refnumber="26B-5-610">26B-5-610</xref>.</subsection></subsection><subsection ssid="3-8" dnum="2-o" numlevel="1" lineno="62" slineno="1-14" level="1" space="false"><display>(2)</display><subsection ssid="3-9" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-10" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>In each county operating under a county executive-council form of <ln numlevel="1" lineno="63" slineno="1-15"/>government under Section <xref depth="3" refnumber="17-52a-203">17-52a-203</xref>, the county legislative body is the local <ln numlevel="1" lineno="64" slineno="1-16"/>mental health authority, provided however that any contract for plan services shall <ln numlevel="1" lineno="65" slineno="1-17"/>be administered by the county executive.</subsection><subsection ssid="3-11" dnum="ii-o" numlevel="1" lineno="66" slineno="1-18" level="3" tab="1"><display>(ii)</display>In each county operating under a council-manager form of government under <ln numlevel="1" lineno="67" slineno="1-19"/>Section <xref depth="3" refnumber="17-52a-204">17-52a-204</xref>, the county manager is the local mental health authority.</subsection><subsection ssid="3-12" dnum="iii-o" numlevel="1" lineno="68" slineno="1-20" level="3" tab="1"><display>(iii)</display>In each county other than a county described in Subsection (2)(a)(i) or (ii), the <ln numlevel="1" lineno="69" slineno="1-21"/>county legislative body is the local mental health authority.</subsection></subsection><subsection ssid="3-13" dnum="b-o" numlevel="1" lineno="70" slineno="1-22" level="2"><display>(b)</display>Within legislative appropriations and county matching funds required by this section, <ln numlevel="1" lineno="71" slineno="1-23"/>under the direction of the division, each local mental health authority shall:<subsection ssid="3-14" dnum="i-o" numlevel="1" lineno="72" slineno="1-24" level="3"><display>(i)</display>provide mental health services to individuals within the county; and</subsection><subsection ssid="3-15" dnum="ii-o" numlevel="1" lineno="73" slineno="1-25" level="3"><display>(ii)</display>cooperate with efforts of the division to promote integrated programs that address <ln numlevel="1" lineno="74" slineno="1-26"/>an individual's substance use, mental health, and physical healthcare needs, as <ln numlevel="1" lineno="75" slineno="1-27"/>described in Section <xref depth="3" refnumber="26B-5-102">26B-5-102</xref>.</subsection></subsection><subsection ssid="3-16" dnum="c-o" numlevel="1" lineno="76" slineno="1-28" level="2"><display>(c)</display>Within legislative appropriations and county matching funds required by this section, <ln numlevel="1" lineno="77" slineno="1-29"/>each local mental health authority shall cooperate with the efforts of the department <ln numlevel="1" lineno="78" slineno="1-30"/>to promote a system of care, as defined in Section <xref depth="3" refnumber="26B-5-101">26B-5-101</xref>, for minors with or at <ln numlevel="1" lineno="79" slineno="1-31"/>risk for complex emotional and behavioral needs, as described in Section <xref depth="3" refnumber="26B-1-202">26B-1-202</xref>.</subsection></subsection><subsection ssid="3-17" dnum="3-o" numlevel="1" lineno="80" slineno="1-32" level="1" space="false"><display>(3)</display><subsection ssid="3-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>By executing an interlocal agreement under Title 11, Chapter 13, Interlocal <ln numlevel="1" lineno="81" slineno="1-33"/>Cooperation Act, two or more counties may join to:<subsection ssid="3-19" dnum="i-o" numlevel="1" lineno="82" slineno="1-34" level="3" tab="1"><display>(i)</display>provide mental health prevention and treatment services; or</subsection><subsection ssid="3-20" dnum="ii-o" numlevel="1" lineno="83" slineno="1-35" level="3" tab="1"><display>(ii)</display>create a united local health department that combines substance use treatment <ln numlevel="1" lineno="84" slineno="1-36"/>services, mental health services, and local health department services in <ln numlevel="1" lineno="85" slineno="1-37"/>accordance with Subsection (4).</subsection></subsection><subsection ssid="3-21" dnum="b-o" numlevel="1" lineno="86" slineno="1-38" level="2"><display>(b)</display>The legislative bodies of counties joining to provide services may establish <ln numlevel="1" lineno="87" slineno="1-39"/>acceptable ways of apportioning the cost of mental health services.</subsection><subsection ssid="3-22" dnum="c-o" numlevel="1" lineno="88" slineno="1-40" level="2"><display>(c)</display>Each agreement for joint mental health services shall:<subsection ssid="3-23" dnum="i-o" numlevel="1" lineno="89" slineno="1-41" level="3" space="false"><display>(i)</display><subsection ssid="3-24" dnum="A-o" level="4" placement="sameline"><display>(A)</display>designate the treasurer of one of the participating counties or another person <ln numlevel="1" lineno="90" slineno="1-42"/>as the treasurer for the combined mental health authorities and as the custodian <ln numlevel="1" lineno="91" slineno="1-43"/>of money available for the joint services; and</subsection><subsection ssid="3-25" dnum="B-o" numlevel="1" lineno="92" slineno="1-44" level="4"><display>(B)</display>provide that the designated treasurer, or other disbursing officer authorized by <ln numlevel="1" lineno="93" slineno="1-45"/>the treasurer, may make payments from the money available for the joint <ln numlevel="1" lineno="94" slineno="1-46"/>services upon audit of the appropriate auditing officer or officers representing <ln numlevel="1" lineno="95" slineno="1-47"/>the participating counties;</subsection></subsection><subsection ssid="3-26" dnum="ii-o" numlevel="1" lineno="96" slineno="1-48" level="3"><display>(ii)</display>provide for the appointment of an independent auditor or a county auditor of one <ln numlevel="1" lineno="97" slineno="1-49"/>of the participating counties as the designated auditing officer for the combined <ln numlevel="1" lineno="98" slineno="1-50"/>mental health authorities;</subsection><subsection ssid="3-27" dnum="iii-o" numlevel="1" lineno="99" slineno="1-51" level="3" space="false"><display>(iii)</display><subsection ssid="3-28" dnum="A-o" level="4" placement="sameline"><display>(A)</display>provide for the appointment of the county or district attorney of one of the <ln numlevel="1" lineno="100" slineno="1-52"/>participating counties as the designated legal officer for the combined mental <ln numlevel="1" lineno="101" slineno="1-53"/>health authorities; and</subsection><subsection ssid="3-29" dnum="B-o" numlevel="1" lineno="102" slineno="1-54" level="4"><display>(B)</display>authorize the designated legal officer to request and receive the assistance of <ln numlevel="1" lineno="103" slineno="1-55"/>the county or district attorneys of the other participating counties in defending <ln numlevel="1" lineno="104" slineno="1-56"/>or prosecuting actions within their counties relating to the combined mental <ln numlevel="1" lineno="105" slineno="1-57"/>health authorities; and</subsection></subsection><subsection ssid="3-30" dnum="iv-o" numlevel="1" lineno="106" slineno="1-58" level="3"><display>(iv)</display>provide for the adoption of management, clinical, financial, procurement, <ln numlevel="1" lineno="107" slineno="1-59"/>personnel, and administrative policies as already established by one of the <ln numlevel="1" lineno="108" slineno="1-60"/>participating counties or as approved by the legislative body of each participating <ln numlevel="1" lineno="109" slineno="1-61"/>county or interlocal board.</subsection></subsection><subsection ssid="3-31" dnum="d-o" numlevel="1" lineno="110" slineno="1-62" level="2"><display>(d)</display>An agreement for joint mental health services may provide for:<subsection ssid="3-32" dnum="i-o" numlevel="1" lineno="111" slineno="1-63" level="3"><display>(i)</display>joint operation of services and facilities or for operation of services and facilities <ln numlevel="1" lineno="112" slineno="1-64"/>under contract by one participating local mental health authority for other <ln numlevel="1" lineno="113" slineno="1-65"/>participating local mental health authorities; and</subsection><subsection ssid="3-33" dnum="ii-o" numlevel="1" lineno="114" slineno="1-66" level="3"><display>(ii)</display>allocation of appointments of members of the mental health advisory council <ln numlevel="1" lineno="115" slineno="1-67"/>between or among participating counties.</subsection></subsection></subsection><subsection ssid="3-34" dnum="4-o" numlevel="1" lineno="116" slineno="1-68" level="1"><display>(4)</display>A county governing body may elect to combine the local mental health authority with <ln numlevel="1" lineno="117" slineno="1-69"/>the local substance abuse authority created in Part 2, Local Substance Abuse Authorities, <ln numlevel="1" lineno="118" slineno="1-70"/>and the local health department created in Title 26A, Chapter 1, Part 1, Local Health <ln numlevel="1" lineno="119" slineno="1-71"/>Department Act, to create a united local health department under Section <xref depth="3" refnumber="26A-1-105.5">26A-1-105.5</xref>. <ln numlevel="1" lineno="120" slineno="1-72"/>A local mental health authority that joins with a united local health department shall <ln numlevel="1" lineno="121" slineno="1-73"/>comply with this part.</subsection><subsection ssid="3-35" dnum="5-o" numlevel="1" lineno="122" slineno="1-74" level="1" space="false"><display>(5)</display><subsection ssid="3-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each local mental health authority is accountable to the department and the state <ln numlevel="1" lineno="123" slineno="1-75"/>with regard to the use of state and federal funds received from those departments for <ln numlevel="1" lineno="124" slineno="1-76"/>mental health services, regardless of whether the services are provided by a private <ln numlevel="1" lineno="125" slineno="1-77"/>contract provider.</subsection><subsection ssid="3-37" dnum="b-o" numlevel="1" lineno="126" slineno="1-78" level="2"><display>(b)</display>Each local mental health authority shall comply, and require compliance by its <ln numlevel="1" lineno="127" slineno="1-79"/>contract provider, with all directives issued by the department regarding the use and <ln numlevel="1" lineno="128" slineno="1-80"/>expenditure of state and federal funds received from those departments for the <ln numlevel="1" lineno="129" slineno="1-81"/>purpose of providing mental health programs and services.  The department shall <ln numlevel="1" lineno="130" slineno="1-82"/>ensure that those directives are not duplicative or conflicting, and shall consult and <ln numlevel="1" lineno="131" slineno="1-83"/>coordinate with local mental health authorities with regard to programs and services.</subsection></subsection><subsection ssid="3-38" dnum="6-o" numlevel="1" lineno="132" slineno="1-84" level="1" space="false"><display>(6)</display><subsection ssid="3-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each local mental health authority shall:<subsection ssid="3-40" dnum="i-o" numlevel="1" lineno="133" slineno="1-85" level="3" tab="1"><display>(i)</display>review and evaluate mental health needs and services, including mental health <ln numlevel="1" lineno="134" slineno="1-86"/>needs and services for:<subsection ssid="3-41" dnum="A-o" numlevel="1" lineno="135" slineno="1-87" level="4"><display>(A)</display>an individual incarcerated in a county jail or other county correctional facility; <ln numlevel="1" lineno="136" slineno="1-88"/>and</subsection><subsection ssid="3-42" dnum="B-o" numlevel="1" lineno="137" slineno="1-89" level="4"><display>(B)</display>an individual who is a resident of the county and who is court ordered to <ln numlevel="1" lineno="138" slineno="1-90"/>receive assisted outpatient treatment under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref>;</subsection></subsection><subsection ssid="3-43" dnum="ii-o" numlevel="1" lineno="139" slineno="1-91" level="3" tab="1"><display>(ii)</display>in accordance with Subsection (6)(b), annually prepare and submit to the division <ln numlevel="1" lineno="140" slineno="1-92"/>a plan approved by the county legislative body for mental health funding and <ln numlevel="1" lineno="141" slineno="1-93"/>service delivery, either directly by the local mental health authority or by contract;</subsection><subsection ssid="3-44" dnum="iii-o" numlevel="1" lineno="142" slineno="1-94" level="3" tab="1"><display>(iii)</display>establish and maintain, either directly or by contract, programs licensed under <ln numlevel="1" lineno="143" slineno="1-95"/>Title 26B, Chapter 2, Part 1, Human Services Programs and Facilities;</subsection><subsection ssid="3-45" dnum="iv-o" numlevel="1" lineno="144" slineno="1-96" level="3" tab="1"><display>(iv)</display>appoint, directly or by contract, a full-time or part-time director for mental health <ln numlevel="1" lineno="145" slineno="1-97"/>programs and prescribe the director's duties;</subsection><subsection ssid="3-46" dnum="v-o" numlevel="1" lineno="146" slineno="1-98" level="3" tab="1"><display>(v)</display>provide input and comment on new and revised rules established by the division;</subsection><subsection ssid="3-47" dnum="vi-o" numlevel="1" lineno="147" slineno="1-99" level="3" tab="1"><display>(vi)</display>establish and require contract providers to establish administrative, clinical, <ln numlevel="1" lineno="148" slineno="1-100"/>personnel, financial, procurement, and management policies regarding mental <ln numlevel="1" lineno="149" slineno="1-101"/>health services and facilities, in accordance with the rules of the division, and state <ln numlevel="1" lineno="150" slineno="1-102"/>and federal law;</subsection><subsection ssid="3-48" dnum="vii-o" numlevel="1" lineno="151" slineno="1-103" level="3" tab="1"><display>(vii)</display>establish mechanisms allowing for direct citizen input;</subsection><subsection ssid="3-49" dnum="viii-o" numlevel="1" lineno="152" slineno="1-104" level="3" tab="1"><display>(viii)</display>annually contract with the division to provide mental health programs and <ln numlevel="1" lineno="153" slineno="1-105"/>services in accordance with the provisions of Title 26B, Chapter 5, Health Care - <ln numlevel="1" lineno="154" slineno="1-106"/>Substance Use and Mental Health;</subsection><subsection ssid="3-50" dnum="ix-o" numlevel="1" lineno="155" slineno="1-107" level="3" tab="1"><display>(ix)</display>comply with all applicable state and federal statutes, policies, audit requirements, <ln numlevel="1" lineno="156" slineno="1-108"/>contract requirements, and any directives resulting from those audits and contract <ln numlevel="1" lineno="157" slineno="1-109"/>requirements;</subsection><subsection ssid="3-51" dnum="x-o" numlevel="1" lineno="158" slineno="1-110" level="3" tab="1"><display>(x)</display>provide funding equal to at least 20% of the state funds that it receives to fund <ln numlevel="1" lineno="159" slineno="1-111"/>services described in the plan;</subsection><subsection ssid="3-52" dnum="xi-o" numlevel="1" lineno="160" slineno="1-112" level="3" tab="1"><display>(xi)</display>comply with the requirements and procedures of Title 11, Chapter 13, Interlocal <ln numlevel="1" lineno="161" slineno="1-113"/>Cooperation Act, Title 17B, Chapter 1, Part 6, Fiscal Procedures for Special <ln numlevel="1" lineno="162" slineno="1-114"/>Districts, and Title 51, Chapter 2a, Accounting Reports from Political <ln numlevel="1" lineno="163" slineno="1-115"/>Subdivisions, Interlocal Organizations, and Other Local Entities Act; and</subsection><subsection ssid="3-53" dnum="xii-o" numlevel="1" lineno="164" slineno="1-116" level="3" tab="1"><display>(xii)</display>take and retain physical custody of minors committed to the physical custody of <ln numlevel="1" lineno="165" slineno="1-117"/>local mental health authorities by a judicial proceeding under Title 26B, Chapter <ln numlevel="1" lineno="166" slineno="1-118"/>5, Part 4, Commitment of Persons Under Age 18.</subsection></subsection><subsection ssid="3-54" dnum="b-o" numlevel="1" lineno="167" slineno="1-119" level="2"><display>(b)</display>Each plan under Subsection (6)(a)(ii) shall include services for adults, youth, and <ln numlevel="1" lineno="168" slineno="1-120"/>children, which shall include:<subsection ssid="3-55" dnum="i-o" numlevel="1" lineno="169" slineno="1-121" level="3"><display>(i)</display>inpatient care and services;</subsection><subsection ssid="3-56" dnum="ii-o" numlevel="1" lineno="170" slineno="1-122" level="3"><display>(ii)</display>residential care and services;</subsection><subsection ssid="3-57" dnum="iii-o" numlevel="1" lineno="171" slineno="1-123" level="3"><display>(iii)</display>outpatient care and services;</subsection><subsection ssid="3-58" dnum="iv-o" numlevel="1" lineno="172" slineno="1-124" level="3"><display>(iv)</display>24-hour crisis care and services;</subsection><subsection ssid="3-59" dnum="v-o" numlevel="1" lineno="173" slineno="1-125" level="3"><display>(v)</display>psychotropic medication management;</subsection><subsection ssid="3-60" dnum="vi-o" numlevel="1" lineno="174" slineno="1-126" level="3"><display>(vi)</display>psychosocial rehabilitation, including vocational training and skills development;</subsection><subsection ssid="3-61" dnum="vii-o" numlevel="1" lineno="175" slineno="1-127" level="3"><display>(vii)</display>case management;</subsection><subsection ssid="3-62" dnum="viii-o" numlevel="1" lineno="176" slineno="1-128" level="3"><display>(viii)</display>community supports, including in-home services, housing, family support <ln numlevel="1" lineno="177" slineno="1-129"/>services, and respite services;</subsection><subsection ssid="3-63" dnum="ix-o" numlevel="1" lineno="178" slineno="1-130" level="3"><display>(ix)</display>consultation and education services, including case consultation, collaboration <ln numlevel="1" lineno="179" slineno="1-131"/>with other county service agencies, public education, and public information; and</subsection><subsection ssid="3-64" dnum="x-o" numlevel="1" lineno="180" slineno="1-132" level="3"><display>(x)</display>services to persons incarcerated in a county jail or other county correctional <ln numlevel="1" lineno="181" slineno="1-133"/>facility.</subsection></subsection></subsection><subsection ssid="3-65" dnum="7-o" numlevel="1" lineno="182" slineno="1-134" level="1" space="false"><display>(7)</display><subsection ssid="3-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a local mental health authority provides for a local mental health crisis line <ln numlevel="1" lineno="183" slineno="1-135"/>under the plan for 24-hour crisis care and services described in Subsection (6)(b)(iv), <ln numlevel="1" lineno="184" slineno="1-136"/>the local mental health authority shall:<subsection ssid="3-67" dnum="i-o" numlevel="1" lineno="185" slineno="1-137" level="3" tab="1"><display>(i)</display>collaborate with the statewide mental health crisis line described in Section <xref depth="3" refnumber="26B-5-610"><ln numlevel="1" lineno="186" slineno="1-138"/>26B-5-610</xref>;</subsection><subsection ssid="3-68" dnum="ii-o" numlevel="1" lineno="187" slineno="1-139" level="3" tab="1"><display>(ii)</display>ensure that each individual who answers calls to the local mental health crisis line:<subsection ssid="3-69" dnum="A-o" numlevel="1" lineno="188" slineno="1-140" level="4"><display>(A)</display>is a mental health therapist or a crisis worker; and</subsection><subsection ssid="3-70" dnum="B-o" numlevel="1" lineno="189" slineno="1-141" level="4"><display>(B)</display>meets the standards of care and practice established by the Division of <ln numlevel="1" lineno="190" slineno="1-142"/>Integrated Healthcare, in accordance with Section <xref depth="3" refnumber="26B-5-610">26B-5-610</xref>; and</subsection></subsection><subsection ssid="3-71" dnum="iii-o" numlevel="1" lineno="191" slineno="1-143" level="3" tab="1"><display>(iii)</display>ensure that when necessary, based on the local mental health crisis line's <ln numlevel="1" lineno="192" slineno="1-144"/>capacity, calls are immediately routed to the statewide mental health crisis line to <ln numlevel="1" lineno="193" slineno="1-145"/>ensure that when an individual calls the local mental health crisis line, regardless <ln numlevel="1" lineno="194" slineno="1-146"/>of the time, date, or number of individuals trying to simultaneously access the <ln numlevel="1" lineno="195" slineno="1-147"/>local mental health crisis line, a mental health therapist or a crisis worker answers <ln numlevel="1" lineno="196" slineno="1-148"/>the call without the caller first:<subsection ssid="3-72" dnum="A-o" numlevel="1" lineno="197" slineno="1-149" level="4"><display>(A)</display>waiting on hold; or</subsection><subsection ssid="3-73" dnum="B-o" numlevel="1" lineno="198" slineno="1-150" level="4"><display>(B)</display>being screened by an individual other than a mental health therapist or crisis <ln numlevel="1" lineno="199" slineno="1-151"/>worker.</subsection></subsection></subsection><subsection ssid="3-74" dnum="b-o" numlevel="1" lineno="200" slineno="1-152" level="2"><display>(b)</display>If a local mental health authority does not provide for a local mental health crisis line <ln numlevel="1" lineno="201" slineno="1-153"/>under the plan for 24-hour crisis care and services described in Subsection (6)(b)(iv), <ln numlevel="1" lineno="202" slineno="1-154"/>the local mental health authority shall use the statewide mental health crisis line as a <ln numlevel="1" lineno="203" slineno="1-155"/>local crisis line resource.</subsection></subsection><subsection ssid="3-75" dnum="8-o" numlevel="1" lineno="204" slineno="1-156" level="1"><display>(8)</display>Before disbursing any public funds, each local mental health authority shall require that <ln numlevel="1" lineno="205" slineno="1-157"/>each entity that receives any public funds from a local mental health authority agrees in <ln numlevel="1" lineno="206" slineno="1-158"/>writing that:<subsection ssid="3-76" dnum="a-o" numlevel="1" lineno="207" slineno="1-159" level="2"><display>(a)</display>the entity's financial records and other records relevant to the entity's performance of <ln numlevel="1" lineno="208" slineno="1-160"/>the services provided to the mental health authority shall be subject to examination <ln numlevel="1" lineno="209" slineno="1-161"/>by:<subsection ssid="3-77" dnum="i-o" numlevel="1" lineno="210" slineno="1-162" level="3"><display>(i)</display>the division;</subsection><subsection ssid="3-78" dnum="ii-o" numlevel="1" lineno="211" slineno="1-163" level="3"><display>(ii)</display>the local mental health authority director;</subsection><subsection ssid="3-79" dnum="iii-o" numlevel="1" lineno="212" slineno="1-164" level="3" space="false"><display>(iii)</display><subsection ssid="3-80" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the county treasurer and county or district attorney; or</subsection><subsection ssid="3-81" dnum="B-o" numlevel="1" lineno="213" slineno="1-165" level="4"><display>(B)</display>if two or more counties jointly provide mental health services under an <ln numlevel="1" lineno="214" slineno="1-166"/>agreement under Subsection (3), the designated treasurer and the designated <ln numlevel="1" lineno="215" slineno="1-167"/>legal officer;</subsection></subsection><subsection ssid="3-82" dnum="iv-o" numlevel="1" lineno="216" slineno="1-168" level="3"><display>(iv)</display>the county legislative body; and</subsection><subsection ssid="3-83" dnum="v-o" numlevel="1" lineno="217" slineno="1-169" level="3"><display>(v)</display>in a county with a county executive that is separate from the county legislative <ln numlevel="1" lineno="218" slineno="1-170"/>body, the county executive;</subsection></subsection><subsection ssid="3-84" dnum="b-o" numlevel="1" lineno="219" slineno="1-171" level="2"><display>(b)</display>the county auditor may examine and audit the entity's financial and other records <ln numlevel="1" lineno="220" slineno="1-172"/>relevant to the entity's performance of the services provided to the local mental health <ln numlevel="1" lineno="221" slineno="1-173"/>authority; and</subsection><subsection ssid="3-85" dnum="c-o" numlevel="1" lineno="222" slineno="1-174" level="2"><display>(c)</display>the entity will comply with the provisions of Subsection (5)(b).</subsection></subsection><subsection ssid="3-86" dnum="9-o" numlevel="1" lineno="223" slineno="1-175" level="1"><display>(9)</display>A local mental health authority may receive property, grants, gifts, supplies, materials, <ln numlevel="1" lineno="224" slineno="1-176"/>contributions, and any benefit derived therefrom, for mental health services.  If those <ln numlevel="1" lineno="225" slineno="1-177"/>gifts are conditioned upon their use for a specified service or program, they shall be so <ln numlevel="1" lineno="226" slineno="1-178"/>used.</subsection><subsection ssid="3-87" dnum="10-o" numlevel="1" lineno="227" slineno="1-179" level="1"><display>(10)</display>Public funds received for the provision of services pursuant to the local mental health <ln numlevel="1" lineno="228" slineno="1-180"/>plan may not be used for any other purpose except those authorized in the contract <ln numlevel="1" lineno="229" slineno="1-181"/>between the local mental health authority and the provider for the provision of plan <ln numlevel="1" lineno="230" slineno="1-182"/>services.</subsection><subsection ssid="3-88" dnum="11-o" numlevel="1" lineno="231" slineno="1-183" level="1"><display>(11)</display>A local mental health authority shall<amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="3-90" dnum="_-o:a-i" numlevel="1" lineno="232" slineno="1-184" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="both">(a)</amend></display> provide assisted outpatient treatment services to a resident of the county who has <ln numlevel="1" lineno="233" slineno="1-185"/>been ordered under Section <xref depth="3" refnumber="26B-5-351">26B-5-351</xref> to receive assisted outpatient treatment<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="3-89" dnum="_-o:b-i" numlevel="1" lineno="234" slineno="1-186" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">to the extent feasible, coordinate with the Department of Corrections to ensure the <ln numlevel="1" lineno="235" slineno="1-187"/>continuity of mental health services for county residents who are on probation or <ln numlevel="1" lineno="236" slineno="1-188"/>parole.</amend></subsection></subsection></section></bsec><bsec buid="1" type="amend" src="code" num="17-55-201" uid="C17-55-S201_1800010118000101" sort="17 55 02010018000101" numlevel="1" lineno="237" slineno="2-1" sn="2"><section number="17-55-201" numlevel="1" lineno="238" slineno="2-2" type="amend"><secline lineno="237">Section 2, Section <bold>17-55-201</bold> is amended to read:</secline><catline lineno="238"><bold>17-55-201 (Effective upon governor's approval). Criminal justice coordinating <ln numlevel="1" lineno="239" slineno="2-3"/>councils -- Creation -- Strategic plan -- Reporting requirements.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="240" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning January 1, 2023, a county shall:<subsection ssid="1-3" dnum="i-o" numlevel="1" lineno="241" slineno="2-5" level="3" tab="1"><display>(i)</display>create a criminal justice coordinating council; or</subsection><subsection ssid="1-4" dnum="ii-o" numlevel="1" lineno="242" slineno="2-6" level="3" tab="1"><display>(ii)</display>jointly with another county or counties, create a criminal justice coordinating <ln numlevel="1" lineno="243" slineno="2-7"/>council.</subsection></subsection><subsection ssid="1-5" dnum="b-o" numlevel="1" lineno="244" slineno="2-8" level="2"><display>(b)</display>The purpose of a council is to coordinate and improve components of the criminal <ln numlevel="1" lineno="245" slineno="2-9"/>justice system in the county or counties.</subsection></subsection><subsection ssid="1-6" dnum="2-o" numlevel="1" lineno="246" slineno="2-10" level="1" space="false"><display>(2)</display><subsection ssid="1-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A council shall include:<subsection ssid="1-8" dnum="i-o" numlevel="1" lineno="247" slineno="2-11" level="3" tab="1"><display>(i)</display>one county commissioner or county council member;</subsection><subsection ssid="1-9" dnum="ii-o" numlevel="1" lineno="248" slineno="2-12" level="3" tab="1"><display>(ii)</display>the county sheriff or the sheriff's designee;</subsection><subsection ssid="1-10" dnum="iii-o" numlevel="1" lineno="249" slineno="2-13" level="3" tab="1"><display>(iii)</display>one chief of police of a municipality within the county or the chief's designee;</subsection><subsection ssid="1-11" dnum="iv-o" numlevel="1" lineno="250" slineno="2-14" level="3" tab="1"><display>(iv)</display>the county attorney or the attorney's designee;</subsection><subsection ssid="1-12" dnum="v-o" numlevel="1" lineno="251" slineno="2-15" level="3" tab="1"><display>(v)</display>one public defender or attorney who provides public defense within the county;</subsection><subsection ssid="1-13" dnum="vi-o" numlevel="1" lineno="252" slineno="2-16" level="3" tab="1"><display>(vi)</display>one district court judge;</subsection><subsection ssid="1-14" dnum="vii-o" numlevel="1" lineno="253" slineno="2-17" level="3" tab="1"><display>(vii)</display>one justice court judge;</subsection><subsection ssid="1-15" dnum="viii-o" numlevel="1" lineno="254" slineno="2-18" level="3" tab="1"><display>(viii)</display>one representative from the Division of Adult Probation and Parole within the <ln numlevel="1" lineno="255" slineno="2-19"/>Department of Corrections;</subsection><subsection ssid="1-16" dnum="ix-o" numlevel="1" lineno="256" slineno="2-20" level="3" tab="1"><display>(ix)</display>one representative from the local mental health authority within the county; and</subsection><subsection ssid="1-17" dnum="x-o" numlevel="1" lineno="257" slineno="2-21" level="3" tab="1"><display>(x)</display>one individual who is:<subsection ssid="1-18" dnum="A-o" numlevel="1" lineno="258" slineno="2-22" level="4"><display>(A)</display>a crime victim; or</subsection><subsection ssid="1-19" dnum="B-o" numlevel="1" lineno="259" slineno="2-23" level="4"><display>(B)</display>a victim advocate, as defined in Section <xref depth="3" refnumber="77-38-403">77-38-403</xref>.</subsection></subsection></subsection><subsection ssid="1-20" dnum="b-o" numlevel="1" lineno="260" slineno="2-24" level="2"><display>(b)</display>A council may include:<subsection ssid="1-21" dnum="i-o" numlevel="1" lineno="261" slineno="2-25" level="3"><display>(i)</display>an individual representing:<subsection ssid="1-22" dnum="A-o" numlevel="1" lineno="262" slineno="2-26" level="4"><display>(A)</display>local government;</subsection><subsection ssid="1-23" dnum="B-o" numlevel="1" lineno="263" slineno="2-27" level="4"><display>(B)</display>human services programs;</subsection><subsection ssid="1-24" dnum="C-o" numlevel="1" lineno="264" slineno="2-28" level="4"><display>(C)</display>higher education;</subsection><subsection ssid="1-25" dnum="D-o" numlevel="1" lineno="265" slineno="2-29" level="4"><display>(D)</display>peer support services;</subsection><subsection ssid="1-26" dnum="E-o" numlevel="1" lineno="266" slineno="2-30" level="4"><display>(E)</display>workforce services;</subsection><subsection ssid="1-27" dnum="F-o" numlevel="1" lineno="267" slineno="2-31" level="4"><display>(F)</display>local housing services;</subsection><subsection ssid="1-28" dnum="G-o" numlevel="1" lineno="268" slineno="2-32" level="4"><display>(G)</display>mental health or substance use disorder providers;</subsection><subsection ssid="1-29" dnum="H-o" numlevel="1" lineno="269" slineno="2-33" level="4"><display>(H)</display>a health care organization within the county;</subsection><subsection ssid="1-30" dnum="I-o" numlevel="1" lineno="270" slineno="2-34" level="4"><display>(I)</display>a local homeless council;</subsection><subsection ssid="1-31" dnum="J-o" numlevel="1" lineno="271" slineno="2-35" level="4"><display>(J)</display>family counseling and support groups; or</subsection><subsection ssid="1-32" dnum="K-o" numlevel="1" lineno="272" slineno="2-36" level="4"><display>(K)</display>organizations that work with families of incarcerated individuals; or</subsection></subsection><subsection ssid="1-33" dnum="ii-o" numlevel="1" lineno="273" slineno="2-37" level="3"><display>(ii)</display>an individual with lived experiences in the criminal justice system.</subsection></subsection></subsection><subsection ssid="1-34" dnum="3-o" numlevel="1" lineno="274" slineno="2-38" level="1" space="false"><display>(3)</display><subsection ssid="1-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A member who is an elected county official shall serve as chair of the council.</subsection><subsection ssid="1-36" dnum="b-o" numlevel="1" lineno="275" slineno="2-39" level="2"><display>(b)</display>The council shall elect the member to serve as chair under Subsection (3)(a).</subsection></subsection><subsection ssid="1-37" dnum="4-o" numlevel="1" lineno="276" slineno="2-40" level="1" space="false"><display>(4)</display><subsection ssid="1-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A council shall develop and implement a strategic plan for the county's or <ln numlevel="1" lineno="277" slineno="2-41"/>counties' criminal justice system that includes:<subsection ssid="1-39" dnum="i-o" numlevel="1" lineno="278" slineno="2-42" level="3" tab="1"><display>(i)</display>mapping of all systems, resources, assets, and services within the county's or <ln numlevel="1" lineno="279" slineno="2-43"/>counties' criminal justice system;</subsection><subsection ssid="1-40" dnum="ii-o" numlevel="1" lineno="280" slineno="2-44" level="3" tab="1"><display>(ii)</display>a plan for data sharing across the county's or counties' criminal justice system;</subsection><subsection ssid="1-41" dnum="iii-o" numlevel="1" lineno="281" slineno="2-45" level="3" tab="1"><display>(iii)</display>recidivism reduction objectives; and</subsection><subsection ssid="1-42" dnum="iv-o" numlevel="1" lineno="282" slineno="2-46" level="3" tab="1"><display>(iv)</display>community reintegration goals<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, including identifying strategies for:</amend><subsection ssid="1-48" dnum="_-o:A-i" numlevel="1" lineno="283" slineno="2-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">connecting county residents who are on probation or parole, including those <ln numlevel="1" lineno="284" slineno="2-48"/>under the custody of the Division of Juvenile Justice and Youth Services, with <ln numlevel="1" lineno="285" slineno="2-49"/>county-based housing, employment, mental health services, substance use <ln numlevel="1" lineno="286" slineno="2-50"/>treatment, and related resources; and</amend></subsection><subsection ssid="1-49" dnum="_-o:B-i" numlevel="1" lineno="287" slineno="2-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1133" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">educating and incentivizing employers to hire county residents who have a <ln numlevel="1" lineno="288" slineno="2-52"/>criminal record or a juvenile record</amend>.</subsection></subsection></subsection><subsection ssid="1-43" dnum="b-o" numlevel="1" lineno="289" slineno="2-53" level="2"><display>(b)</display>The commission may assist a council in the development of a strategic plan.</subsection></subsection><subsection ssid="1-44" dnum="5-o" numlevel="1" lineno="290" slineno="2-54" level="1"><display>(5)</display>As part of the council's duties described in Subsection (4)(a)(i), the council shall prepare <ln numlevel="1" lineno="291" slineno="2-55"/>a list of private probation providers for a court to provide to defendants as described in <ln numlevel="1" lineno="292" slineno="2-56"/>Section <xref depth="3" refnumber="77-18-105">77-18-105</xref>.</subsection><subsection ssid="1-45" dnum="6-o" numlevel="1" lineno="293" slineno="2-57" level="1"><display>(6)</display>Before November 30 of each year, a council shall provide a written report to the <ln numlevel="1" lineno="294" slineno="2-58"/>commission regarding:<subsection ssid="1-46" dnum="a-o" numlevel="1" lineno="295" slineno="2-59" level="2"><display>(a)</display>the implementation of a strategic plan described in Subsection (4); and</subsection><subsection ssid="1-47" dnum="b-o" numlevel="1" lineno="296" slineno="2-60" level="2"><display>(b)</display>any data on the impact of the council on the criminal justice system in the county or <ln numlevel="1" lineno="297" slineno="2-61"/>counties.</subsection></subsection></section></bsec><bsec buid="12" num="34-52-201" type="amend" src="code" uid="C34-52-S201_2023100120231001" sort="34 52 02010018000101" numlevel="1" lineno="298" slineno="3-1" sn="3"><section number="34-52-201" numlevel="1" lineno="299" slineno="3-2" type="amend"><secline lineno="298">Section 3, Section <bold>34-52-201</bold> is amended to read:</secline><catline lineno="299"><bold>34-52-201 (Effective 10/01/23). Public employer requirements.</bold></catline><subsection ssid="12-12-1" dnum="1-o" numlevel="1" lineno="300" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsections <xref depth="4" refnumber="34-52-201(3)" start="0">(3)</xref> and <xref depth="4" refnumber="34-52-201(6)" start="0">(6)</xref>, a public employer may not:<subsection ssid="12-12-2" dnum="a-o" numlevel="1" lineno="301" slineno="3-4" level="2"><display>(a)</display>exclude an applicant from an initial interview because of:<subsection ssid="12-12-3" dnum="i-o" numlevel="1" lineno="302" slineno="3-5" level="3"><display>(i)</display>a past criminal conviction<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">, an expunged conviction, an arrest for an offense that <ln numlevel="1" lineno="303" slineno="3-6"/>occurred before the applicant was 18 years old,</amend> or <amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">a </amend>juvenile adjudication; or</subsection><subsection ssid="12-12-4" dnum="ii-o" numlevel="1" lineno="304" slineno="3-7" level="3"><display>(ii)</display>if the applicant is a mental health professional applicant, an arrest for an offense <ln numlevel="1" lineno="305" slineno="3-8"/>that occurred before the applicant was 18 years old;</subsection></subsection><subsection ssid="12-12-5" dnum="b-o" numlevel="1" lineno="306" slineno="3-9" level="2"><display>(b)</display>make an inquiry related to an applicant's expunged criminal or juvenile delinquency <ln numlevel="1" lineno="307" slineno="3-10"/>history;</subsection><subsection ssid="12-12-6" dnum="c-o" numlevel="1" lineno="308" slineno="3-11" level="2"><display>(c)</display>when making a hiring decision regarding a mental health professional applicant, <ln numlevel="1" lineno="309" slineno="3-12"/>consider:<subsection ssid="12-12-7" dnum="i-o" numlevel="1" lineno="310" slineno="3-13" level="3"><display>(i)</display>an arrest for an offense that occurred before the mental health professional <ln numlevel="1" lineno="311" slineno="3-14"/>applicant was 18 years old;</subsection><subsection ssid="12-12-8" dnum="ii-o" numlevel="1" lineno="312" slineno="3-15" level="3"><display>(ii)</display>an arrest not followed by a criminal conviction or juvenile adjudication;</subsection><subsection ssid="12-12-9" dnum="iii-o" numlevel="1" lineno="313" slineno="3-16" level="3"><display>(iii)</display>a juvenile adjudication; or</subsection><subsection ssid="12-12-10" dnum="iv-o" numlevel="1" lineno="314" slineno="3-17" level="3"><display>(iv)</display>a past criminal conviction if:<subsection ssid="12-12-11" dnum="A-o" numlevel="1" lineno="315" slineno="3-18" level="4"><display>(A)</display>the sentence for the criminal conviction is terminated; and</subsection><subsection ssid="12-12-12" dnum="B-o" numlevel="1" lineno="316" slineno="3-19" level="4"><display>(B)</display>the mental health professional applicant was not incarcerated for the past <ln numlevel="1" lineno="317" slineno="3-20"/>criminal conviction or the mental health professional applicant's incarceration <ln numlevel="1" lineno="318" slineno="3-21"/>for the past criminal conviction ended at least three years before the day on <ln numlevel="1" lineno="319" slineno="3-22"/>which the mental health professional applicant applied for employment; or</subsection></subsection></subsection><subsection ssid="12-12-13" dnum="d-o" numlevel="1" lineno="320" slineno="3-23" level="2"><display>(d)</display>deny a mental health professional applicant employment based on a past criminal <ln numlevel="1" lineno="321" slineno="3-24"/>conviction that does not bear a direct relationship to the mental health professional <ln numlevel="1" lineno="322" slineno="3-25"/>applicant's ability to safely or competently perform the duties of employment.</subsection></subsection><subsection ssid="12-12-14" dnum="2-o" numlevel="1" lineno="323" slineno="3-26" level="1"><display>(2)</display>A public employer excludes an applicant from an initial interview under Subsection <xref depth="4" refnumber="34-52-201(1)" start="0">(1)</xref> <ln numlevel="1" lineno="324" slineno="3-27"/>if the public employer:<subsection ssid="12-12-15" dnum="a-o" numlevel="1" lineno="325" slineno="3-28" level="2"><display>(a)</display>requires an applicant to disclose a criminal conviction or juvenile adjudication:<subsection ssid="12-12-16" dnum="i-o" numlevel="1" lineno="326" slineno="3-29" level="3"><display>(i)</display>on an employment application;</subsection><subsection ssid="12-12-17" dnum="ii-o" numlevel="1" lineno="327" slineno="3-30" level="3"><display>(ii)</display>before an initial interview; or</subsection><subsection ssid="12-12-18" dnum="iii-o" numlevel="1" lineno="328" slineno="3-31" level="3"><display>(iii)</display>if no interview is conducted, before making a conditional offer of employment; or</subsection></subsection><subsection ssid="12-12-19" dnum="b-o" numlevel="1" lineno="329" slineno="3-32" level="2"><display>(b)</display>requires an applicant who is a mental health professional applicant to disclose an <ln numlevel="1" lineno="330" slineno="3-33"/>arrest for an offense that occurred before the applicant was 18 years old:<subsection ssid="12-12-20" dnum="i-o" numlevel="1" lineno="331" slineno="3-34" level="3"><display>(i)</display>on an employment application;</subsection><subsection ssid="12-12-21" dnum="ii-o" numlevel="1" lineno="332" slineno="3-35" level="3"><display>(ii)</display>before an initial interview; or</subsection><subsection ssid="12-12-22" dnum="iii-o" numlevel="1" lineno="333" slineno="3-36" level="3"><display>(iii)</display>if no interview is conducted, before making a conditional offer of employment.</subsection></subsection></subsection><subsection ssid="12-12-23" dnum="3-o" numlevel="1" lineno="334" slineno="3-37" level="1"><display>(3)</display>A public employer may not deny a mental health professional applicant employment <ln numlevel="1" lineno="335" slineno="3-38"/>that requires the mental health professional applicant to provide substance use treatment <ln numlevel="1" lineno="336" slineno="3-39"/>based on:<subsection ssid="12-12-24" dnum="a-o" numlevel="1" lineno="337" slineno="3-40" level="2"><display>(a)</display>the mental health professional applicant's participation in substance use treatment; or</subsection><subsection ssid="12-12-25" dnum="b-o" numlevel="1" lineno="338" slineno="3-41" level="2"><display>(b)</display>a past criminal conviction for a nonviolent drug offense if:<subsection ssid="12-12-26" dnum="i-o" numlevel="1" lineno="339" slineno="3-42" level="3"><display>(i)</display>the sentence for the criminal conviction is terminated; and</subsection><subsection ssid="12-12-27" dnum="ii-o" numlevel="1" lineno="340" slineno="3-43" level="3" space="false"><display>(ii)</display><subsection ssid="12-12-28" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the mental health professional applicant was not incarcerated for the past <ln numlevel="1" lineno="341" slineno="3-44"/>criminal conviction; or</subsection><subsection ssid="12-12-29" dnum="B-o" numlevel="1" lineno="342" slineno="3-45" level="4"><display>(B)</display>the mental health professional applicant's incarceration for the past criminal <ln numlevel="1" lineno="343" slineno="3-46"/>conviction ended at least three years before the day on which the mental health <ln numlevel="1" lineno="344" slineno="3-47"/>professional applicant applied for employment.</subsection></subsection></subsection></subsection><subsection ssid="12-12-30" dnum="4-o" numlevel="1" lineno="345" slineno="3-48" level="1"><display>(4)</display>An applicant seeking employment from a public employer may answer a question <ln numlevel="1" lineno="346" slineno="3-49"/>related to an expunged criminal or juvenile delinquency record as though the action <ln numlevel="1" lineno="347" slineno="3-50"/>underlying the expunged criminal or juvenile delinquency record never occurred.</subsection><subsection ssid="12-12-31" dnum="5-o" numlevel="1" lineno="348" slineno="3-51" level="1"><display>(5)</display>Except as provided in Subsections <xref depth="4" refnumber="34-52-201(1)" start="0">(1)</xref> through <xref depth="4" refnumber="34-52-201(3)" start="0">(3)</xref>, this section does not prevent a public <ln numlevel="1" lineno="349" slineno="3-52"/>employer from:<subsection ssid="12-12-32" dnum="a-o" numlevel="1" lineno="350" slineno="3-53" level="2"><display>(a)</display>asking an applicant for information about an applicant's criminal conviction or <ln numlevel="1" lineno="351" slineno="3-54"/>juvenile delinquency history during an initial interview or after an initial interview; or</subsection><subsection ssid="12-12-33" dnum="b-o" numlevel="1" lineno="352" slineno="3-55" level="2"><display>(b)</display>considering an applicant's criminal conviction or juvenile delinquency history when <ln numlevel="1" lineno="353" slineno="3-56"/>making a hiring decision.</subsection></subsection><subsection ssid="12-12-34" dnum="6-o" numlevel="1" lineno="354" slineno="3-57" level="1" space="false"><display>(6)</display><subsection ssid="12-12-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subsections <xref depth="4" refnumber="34-52-201(1)" start="0">(1)</xref> through <xref depth="4" refnumber="34-52-201(4)" start="0">(4)</xref> do not apply:<subsection ssid="12-12-36" dnum="i-o" numlevel="1" lineno="355" slineno="3-58" level="3" tab="1"><display>(i)</display>if federal, state, or local law, including corresponding administrative rules, <ln numlevel="1" lineno="356" slineno="3-59"/>requires the consideration of an applicant's criminal conviction<amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">, an expunged <ln numlevel="1" lineno="357" slineno="3-60"/>conviction, an arrest for an offense that occurred before the applicant was 18 years <ln numlevel="1" lineno="358" slineno="3-61"/>old,</amend> or juvenile delinquency history;</subsection><subsection ssid="12-12-37" dnum="ii-o" numlevel="1" lineno="359" slineno="3-62" level="3" tab="1"><display>(ii)</display>to a public employer that is a law enforcement agency;</subsection><subsection ssid="12-12-38" dnum="iii-o" numlevel="1" lineno="360" slineno="3-63" level="3" tab="1"><display>(iii)</display>to a public employer that is part of the criminal or juvenile justice system;</subsection><subsection ssid="12-12-39" dnum="iv-o" numlevel="1" lineno="361" slineno="3-64" level="3" tab="1"><display>(iv)</display>to a public employer seeking a nonemployee volunteer;</subsection><subsection ssid="12-12-40" dnum="v-o" numlevel="1" lineno="362" slineno="3-65" level="3" tab="1"><display>(v)</display>to a public employer that works with children or vulnerable adults;</subsection><subsection ssid="12-12-41" dnum="vi-o" numlevel="1" lineno="363" slineno="3-66" level="3" tab="1"><display>(vi)</display>to the Department of Alcoholic Beverage Services created in Section <xref depth="3" refnumber="32B-2-203" start="0">32B-2-203</xref>;</subsection><subsection ssid="12-12-42" dnum="vii-o" numlevel="1" lineno="364" slineno="3-67" level="3" tab="1"><display>(vii)</display>to the State Tax Commission;</subsection><subsection ssid="12-12-43" dnum="viii-o" numlevel="1" lineno="365" slineno="3-68" level="3" tab="1"><display>(viii)</display>to a public employer whose primary purpose is performing financial or <ln numlevel="1" lineno="366" slineno="3-69"/>fiduciary functions; or</subsection><subsection ssid="12-12-44" dnum="ix-o" numlevel="1" lineno="367" slineno="3-70" level="3" tab="1"><display>(ix)</display>to a public transit district hiring or promoting an individual for a safety sensitive <ln numlevel="1" lineno="368" slineno="3-71"/>position described in Section <xref depth="3" refnumber="17B-2a-825" start="0">17B-2a-825</xref>.</subsection></subsection><subsection ssid="12-12-45" dnum="b-o" numlevel="1" lineno="369" slineno="3-72" level="2"><display>(b)</display>Subsections <xref depth="4" refnumber="34-52-201(1)(c)(iv)" start="0">(1)(c)(iv)</xref> and <xref depth="4" refnumber="34-52-201(1)(d)" start="0">(1)(d)</xref> do not apply to a criminal conviction for:<subsection ssid="12-12-46" dnum="i-o" numlevel="1" lineno="370" slineno="3-73" level="3"><display>(i)</display>a violent felony as defined in Section <xref depth="3" refnumber="76-3-203.5" start="0">76-3-203.5</xref>; or</subsection><subsection ssid="12-12-47" dnum="ii-o" numlevel="1" lineno="371" slineno="3-74" level="3"><display>(ii)</display>a felony related to a criminal sexual act under <xref depth="2" refnumber="76-5-4" start="0">Title 76, Chapter 5, Part 4, Sexual <ln numlevel="1" lineno="372" slineno="3-75"/>Offenses</xref>, or <xref depth="1" refnumber="76-5b" start="0">Title 76, Chapter 5b, Sexual Exploitation Act</xref>.</subsection></subsection><subsection ssid="12-12-48" dnum="c-o" numlevel="1" lineno="373" slineno="3-76" level="2"><display>(c)</display>Subsections <xref depth="4" refnumber="34-52-201(1)(a)(ii)" start="0">(1)(a)(ii)</xref>, <xref depth="4" refnumber="34-52-201(1)(c)" start="0">(1)(c)</xref>, <xref depth="4" refnumber="34-52-201(1)(d)" start="0">(1)(d)</xref>, and <xref depth="4" refnumber="34-52-201(3)" start="0">(3)</xref> apply to a person under contract with a <ln numlevel="1" lineno="374" slineno="3-77"/>public employer.</subsection></subsection></section></bsec><bsec buid="9" num="58-1-402" type="amend" src="code" uid="C58-1-S402_2020051220200512" sort="58 01 04020018000101" numlevel="1" lineno="375" slineno="4-1" sn="4"><section number="58-1-402" numlevel="1" lineno="376" slineno="4-2" type="amend"><secline lineno="375">Section 4, Section <bold>58-1-402</bold> is amended to read:</secline><catline lineno="376"><bold>58-1-402 (Effective 05/12/20). Administrative review -- Special appeals boards.</bold></catline><subsection ssid="9-9-1" dnum="1-o" numlevel="1" lineno="377" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="9-9-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any applicant who has been denied a license to practice on the basis of <ln numlevel="1" lineno="378" slineno="4-4"/>credentials, character, a criminal record, or failure to pass a required examination, or <ln numlevel="1" lineno="379" slineno="4-5"/>who has been refused renewal or reinstatement of a license to practice on the basis <ln numlevel="1" lineno="380" slineno="4-6"/>that the applicant does not meet qualifications for continued licensure in any <ln numlevel="1" lineno="381" slineno="4-7"/>occupation or profession under the jurisdiction of the division may submit a request <ln numlevel="1" lineno="382" slineno="4-8"/>for agency review to the executive director within 30 days following notification of <ln numlevel="1" lineno="383" slineno="4-9"/>the denial of a license or refusal to renew or reinstate a license.</subsection><subsection ssid="9-9-3" dnum="b-o" numlevel="1" lineno="384" slineno="4-10" level="2" space="false"><display>(b)</display><subsection ssid="9-17" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The executive director shall determine whether the circumstances for denying <ln numlevel="1" lineno="385" slineno="4-11"/>an application for an initial license or for renewal or reinstatement of a license <ln numlevel="1" lineno="386" slineno="4-12"/>would justify calling a special appeals board under Subsection <xref depth="4" refnumber="58-1-402(2)" start="0">(2)</xref>.  </subsection><subsection ssid="9-18" dnum="_-o:ii-i" numlevel="1" lineno="387" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">In making the determination described in Subsection <xref tempid="272" depth="4" refnumber="58-1-402(1)(b)(i)">(1)(b)(i)</xref>, the executive <ln numlevel="1" lineno="388" slineno="4-14"/>director shall, if the denial is based on a criminal record, independently consider <ln numlevel="1" lineno="389" slineno="4-15"/>the factors described in Subsection <xref tempid="225" depth="4" refnumber="58-1-401(7)">58-1-401(7)</xref>.</amend></subsection><subsection ssid="9-19" dnum="_-o:iii-i" numlevel="1" lineno="390" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="both">(iii)</amend></display>The executive director's decision is not subject to agency review.</subsection></subsection></subsection><subsection ssid="9-9-4" dnum="2-o" numlevel="1" lineno="391" slineno="4-17" level="1"><display>(2)</display>A special appeals board shall consist of three members appointed by the executive <ln numlevel="1" lineno="392" slineno="4-18"/>director as follows:<subsection ssid="9-9-5" dnum="a-o" numlevel="1" lineno="393" slineno="4-19" level="2"><display>(a)</display>one member from the occupation or profession in question who is not on the board of <ln numlevel="1" lineno="394" slineno="4-20"/>that occupation or profession;</subsection><subsection ssid="9-9-6" dnum="b-o" numlevel="1" lineno="395" slineno="4-21" level="2"><display>(b)</display>one member from the general public who is neither an attorney nor a practitioner in <ln numlevel="1" lineno="396" slineno="4-22"/>an occupation or profession regulated by the division; and</subsection><subsection ssid="9-9-7" dnum="c-o" numlevel="1" lineno="397" slineno="4-23" level="2"><display>(c)</display>one member who is a resident lawyer currently licensed to practice law in this state <ln numlevel="1" lineno="398" slineno="4-24"/>who shall serve as chair of the special appeals board.</subsection></subsection><subsection ssid="9-9-8" dnum="3-o" numlevel="1" lineno="399" slineno="4-25" level="1"><display>(3)</display>The special appeals board shall comply with the procedures and requirements of <xref depth="1" refnumber="63G-4" start="0">Title <ln numlevel="1" lineno="400" slineno="4-26"/>63G, Chapter 4, Administrative Procedures Act</xref>, in its proceedings.</subsection><subsection ssid="9-9-9" dnum="4-o" numlevel="1" lineno="401" slineno="4-27" level="1" space="false"><display>(4)</display><subsection ssid="9-9-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within a reasonable amount of time following the conclusion of a hearing before a <ln numlevel="1" lineno="402" slineno="4-28"/>special appeals board, the board shall enter an order based upon the record developed <ln numlevel="1" lineno="403" slineno="4-29"/>at the hearing.  The order shall state whether a legal basis exists for denying the <ln numlevel="1" lineno="404" slineno="4-30"/>application for an initial license or for renewal or reinstatement of a license that is the <ln numlevel="1" lineno="405" slineno="4-31"/>subject of the appeal.  The order is not subject to further agency review.</subsection><subsection ssid="9-9-11" dnum="b-o" numlevel="1" lineno="406" slineno="4-32" level="2"><display>(b)</display>The division or the applicant may obtain judicial review of the decision of the special <ln numlevel="1" lineno="407" slineno="4-33"/>appeals board in accordance with Sections <xref depth="3" refnumber="63G-4-401" start="0">63G-4-401</xref> and <xref depth="3" refnumber="63G-4-403" start="0">63G-4-403</xref>.</subsection></subsection><subsection ssid="9-9-12" dnum="5-o" numlevel="1" lineno="408" slineno="4-34" level="1"><display>(5)</display>A member may not receive compensation or benefits for the member's service, but may <ln numlevel="1" lineno="409" slineno="4-35"/>receive per diem and travel expenses in accordance with:<subsection ssid="9-9-13" dnum="a-o" numlevel="1" lineno="410" slineno="4-36" level="2"><display>(a)</display>Section <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref>;</subsection><subsection ssid="9-9-14" dnum="b-o" numlevel="1" lineno="411" slineno="4-37" level="2"><display>(b)</display>Section <xref depth="3" refnumber="63A-3-107" start="0">63A-3-107</xref>; and</subsection><subsection ssid="9-9-15" dnum="c-o" numlevel="1" lineno="412" slineno="4-38" level="2"><display>(c)</display>rules made by the Division of Finance pursuant to Sections <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107" start="0"><ln numlevel="1" lineno="413" slineno="4-39"/>63A-3-107</xref>.</subsection></subsection><subsection ssid="9-9-16" dnum="6-o" numlevel="1" lineno="414" slineno="4-40" level="1"><display>(6)</display>If an applicant under Subsection <xref depth="4" refnumber="58-1-402(1)" start="0">(1)</xref> is not given a special appeals board, the applicant <ln numlevel="1" lineno="415" slineno="4-41"/>shall be given agency review under the ordinary agency review procedures specified by <ln numlevel="1" lineno="416" slineno="4-42"/>rule.</subsection></section></bsec><bsec buid="10" num="58-1-501" type="amend" src="code" uid="C58-1-S501_2024050120240501" sort="58 01 05010018000101" numlevel="1" lineno="417" slineno="5-1" sn="5"><section number="58-1-501" numlevel="1" lineno="418" slineno="5-2" type="amend"><secline lineno="417">Section 5, Section <bold>58-1-501</bold> is amended to read:</secline><catline lineno="418"><bold>58-1-501 (Effective 05/01/24). Unlawful and unprofessional conduct.</bold></catline><subsection ssid="10-10-1" dnum="1-o" numlevel="1" lineno="419" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>"Unlawful conduct" means conduct, by any person, that is defined as unlawful under <ln numlevel="1" lineno="420" slineno="5-4"/>this title and includes:<subsection ssid="10-10-2" dnum="a-o" numlevel="1" lineno="421" slineno="5-5" level="2"><display>(a)</display>practicing or engaging in, representing oneself to be practicing or engaging in, or <ln numlevel="1" lineno="422" slineno="5-6"/>attempting to practice or engage in any profession requiring licensure under this title, <ln numlevel="1" lineno="423" slineno="5-7"/>except the behavioral health technician under Chapter 60, Part 6, Behavioral Health <ln numlevel="1" lineno="424" slineno="5-8"/>Coach and Technician Licensing Act, if the person is:<subsection ssid="10-10-3" dnum="i-o" numlevel="1" lineno="425" slineno="5-9" level="3"><display>(i)</display>not licensed to do so or not exempted from licensure under this title; or</subsection><subsection ssid="10-10-4" dnum="ii-o" numlevel="1" lineno="426" slineno="5-10" level="3"><display>(ii)</display>restricted from doing so by a suspended, revoked, restricted, temporary, <ln numlevel="1" lineno="427" slineno="5-11"/>probationary, or inactive license;</subsection></subsection><subsection ssid="10-10-5" dnum="b-o" numlevel="1" lineno="428" slineno="5-12" level="2" space="false"><display>(b)</display><subsection ssid="10-10-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>impersonating another licensee or practicing a profession under a false or <ln numlevel="1" lineno="429" slineno="5-13"/>assumed name, except as permitted by law; or</subsection><subsection ssid="10-10-7" dnum="ii-o" numlevel="1" lineno="430" slineno="5-14" level="3"><display>(ii)</display>for a licensee who has had a license under this title reinstated following <ln numlevel="1" lineno="431" slineno="5-15"/>disciplinary action, practicing the same profession using a different name than the <ln numlevel="1" lineno="432" slineno="5-16"/>name used before the disciplinary action, except as permitted by law and after <ln numlevel="1" lineno="433" slineno="5-17"/>notice to, and approval by, the division;</subsection></subsection><subsection ssid="10-10-8" dnum="c-o" numlevel="1" lineno="434" slineno="5-18" level="2"><display>(c)</display>knowingly employing any other person to practice or engage in or attempt to practice <ln numlevel="1" lineno="435" slineno="5-19"/>or engage in any profession licensed under this title if the employee is not licensed to <ln numlevel="1" lineno="436" slineno="5-20"/>do so under this title;</subsection><subsection ssid="10-10-9" dnum="d-o" numlevel="1" lineno="437" slineno="5-21" level="2"><display>(d)</display>knowingly permitting the person's authority to practice or engage in any profession <ln numlevel="1" lineno="438" slineno="5-22"/>licensed under this title to be used by another, except as permitted by law;</subsection><subsection ssid="10-10-10" dnum="e-o" numlevel="1" lineno="439" slineno="5-23" level="2"><display>(e)</display>obtaining a passing score on a licensure examination, applying for or obtaining a <ln numlevel="1" lineno="440" slineno="5-24"/>license, or otherwise dealing with the division or a licensing board through the use of <ln numlevel="1" lineno="441" slineno="5-25"/>fraud, forgery, or intentional deception, misrepresentation, misstatement, or omission;</subsection><subsection ssid="10-10-11" dnum="f-o" numlevel="1" lineno="442" slineno="5-26" level="2" space="false"><display>(f)</display><subsection ssid="10-10-12" dnum="i-o" level="3" placement="sameline"><display>(i)</display>issuing, or aiding and abetting in the issuance of, an order or prescription for a <ln numlevel="1" lineno="443" slineno="5-27"/>drug or device to a person located in this state:<subsection ssid="10-10-13" dnum="A-o" numlevel="1" lineno="444" slineno="5-28" level="4" tab="1"><display>(A)</display>without prescriptive authority conferred by a license issued under this title, or <ln numlevel="1" lineno="445" slineno="5-29"/>by an exemption to licensure under this title; or</subsection><subsection ssid="10-10-14" dnum="B-o" numlevel="1" lineno="446" slineno="5-30" level="4" tab="1"><display>(B)</display>with prescriptive authority conferred by an exception issued under this title or <ln numlevel="1" lineno="447" slineno="5-31"/>a multistate practice privilege recognized under this title, if the prescription <ln numlevel="1" lineno="448" slineno="5-32"/>was issued without first obtaining information, in the usual course of <ln numlevel="1" lineno="449" slineno="5-33"/>professional practice, that is sufficient to establish a diagnosis, to identify <ln numlevel="1" lineno="450" slineno="5-34"/>underlying conditions, and to identify contraindications to the proposed <ln numlevel="1" lineno="451" slineno="5-35"/>treatment; and</subsection></subsection><subsection ssid="10-10-15" dnum="ii-o" numlevel="1" lineno="452" slineno="5-36" level="3"><display>(ii)</display>Subsection (1)(f)(i) does not apply to treatment rendered in an emergency, on-call <ln numlevel="1" lineno="453" slineno="5-37"/>or cross coverage situation, provided that the person who issues the prescription <ln numlevel="1" lineno="454" slineno="5-38"/>has prescriptive authority conferred by a license under this title, or is exempt from <ln numlevel="1" lineno="455" slineno="5-39"/>licensure under this title; or</subsection></subsection><subsection ssid="10-10-16" dnum="g-o" numlevel="1" lineno="456" slineno="5-40" level="2"><display>(g)</display>aiding or abetting any other person to violate any statute, rule, or order regulating a <ln numlevel="1" lineno="457" slineno="5-41"/>profession under this title.</subsection></subsection><subsection ssid="10-10-17" dnum="2-o" numlevel="1" lineno="458" slineno="5-42" level="1" space="false"><display>(2)</display><subsection ssid="10-10-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Unprofessional conduct" means conduct, by a licensee or applicant, that is <ln numlevel="1" lineno="459" slineno="5-43"/>defined as unprofessional conduct under this title or under any rule adopted under <ln numlevel="1" lineno="460" slineno="5-44"/>this title and includes:<subsection ssid="10-10-19" dnum="i-o" numlevel="1" lineno="461" slineno="5-45" level="3" tab="1"><display>(i)</display>violating any statute, rule, or order regulating <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">an </amend><amendoutend style="2"/>a profession under this title;</subsection><subsection ssid="10-10-20" dnum="ii-o" numlevel="1" lineno="462" slineno="5-46" level="3" tab="1"><display>(ii)</display>violating, or aiding or abetting any other person to violate, any generally accepted <ln numlevel="1" lineno="463" slineno="5-47"/>professional or ethical standard applicable to an occupation or profession <ln numlevel="1" lineno="464" slineno="5-48"/>regulated under this title;</subsection><subsection ssid="10-10-21" dnum="iii-o" numlevel="1" lineno="465" slineno="5-49" level="3" tab="1"><display>(iii)</display>subject to the provisions of Subsection (4), engaging in conduct that results in <ln numlevel="1" lineno="466" slineno="5-50"/>conviction, a plea of nolo contendere, or a plea of guilty or nolo contendere that is <ln numlevel="1" lineno="467" slineno="5-51"/>held in abeyance pending the successful completion of probation with respect to a <ln numlevel="1" lineno="468" slineno="5-52"/>crime that, when considered with the functions and duties of the profession for <ln numlevel="1" lineno="469" slineno="5-53"/>which the license was issued or is to be issued, bears a substantial relationship to <ln numlevel="1" lineno="470" slineno="5-54"/>the licensee's or applicant's ability to safely or competently practice the profession;</subsection><subsection ssid="10-10-22" dnum="iv-o" numlevel="1" lineno="471" slineno="5-55" level="3" tab="1"><display>(iv)</display>engaging in conduct that results in disciplinary action, including reprimand, <ln numlevel="1" lineno="472" slineno="5-56"/>censure, diversion, probation, suspension, or revocation, by any other licensing or <ln numlevel="1" lineno="473" slineno="5-57"/>regulatory authority having jurisdiction over the licensee or applicant in the same <ln numlevel="1" lineno="474" slineno="5-58"/>profession if the conduct would, in this state, constitute grounds for denial of <ln numlevel="1" lineno="475" slineno="5-59"/>licensure or disciplinary proceedings under Section <xref depth="3" refnumber="58-1-401">58-1-401</xref>;</subsection><subsection ssid="10-10-23" dnum="v-o" numlevel="1" lineno="476" slineno="5-60" level="3" tab="1"><display>(v)</display>engaging in conduct, including the use of intoxicants, drugs, narcotics, or similar <ln numlevel="1" lineno="477" slineno="5-61"/>chemicals, to the extent that the conduct does, or might reasonably be considered <ln numlevel="1" lineno="478" slineno="5-62"/>to, impair the ability of the licensee or applicant to safely engage in the profession;</subsection><subsection ssid="10-10-24" dnum="vi-o" numlevel="1" lineno="479" slineno="5-63" level="3" tab="1"><display>(vi)</display>practicing or attempting to practice a profession regulated under this title despite <ln numlevel="1" lineno="480" slineno="5-64"/>being physically or mentally unfit to do so;</subsection><subsection ssid="10-10-25" dnum="vii-o" numlevel="1" lineno="481" slineno="5-65" level="3" tab="1"><display>(vii)</display>practicing or attempting to practice a or profession regulated under this title <ln numlevel="1" lineno="482" slineno="5-66"/>through gross incompetence, gross negligence, or a pattern of incompetency or <ln numlevel="1" lineno="483" slineno="5-67"/>negligence;</subsection><subsection ssid="10-10-26" dnum="viii-o" numlevel="1" lineno="484" slineno="5-68" level="3" tab="1"><display>(viii)</display>practicing or attempting to practice a profession requiring licensure under this <ln numlevel="1" lineno="485" slineno="5-69"/>title by any form of action or communication which is false, misleading, <ln numlevel="1" lineno="486" slineno="5-70"/>deceptive, or fraudulent;</subsection><subsection ssid="10-10-27" dnum="ix-o" numlevel="1" lineno="487" slineno="5-71" level="3" tab="1"><display>(ix)</display>practicing or attempting to practice a profession regulated under this title beyond <ln numlevel="1" lineno="488" slineno="5-72"/>the scope of the licensee's competency, abilities, or education;</subsection><subsection ssid="10-10-28" dnum="x-o" numlevel="1" lineno="489" slineno="5-73" level="3" tab="1"><display>(x)</display>practicing or attempting to practice a profession regulated under this title beyond <ln numlevel="1" lineno="490" slineno="5-74"/>the scope of the licensee's license;</subsection><subsection ssid="10-10-29" dnum="xi-o" numlevel="1" lineno="491" slineno="5-75" level="3" tab="1"><display>(xi)</display>verbally, physically, mentally, or sexually abusing or exploiting any person <ln numlevel="1" lineno="492" slineno="5-76"/>through conduct connected with the licensee's practice under this title or otherwise <ln numlevel="1" lineno="493" slineno="5-77"/>facilitated by the licensee's license;</subsection><subsection ssid="10-10-30" dnum="xii-o" numlevel="1" lineno="494" slineno="5-78" level="3" tab="1"><display>(xii)</display>acting as a supervisor without meeting the qualification requirements for that <ln numlevel="1" lineno="495" slineno="5-79"/>position that are defined by statute or rule;</subsection><subsection ssid="10-10-31" dnum="xiii-o" numlevel="1" lineno="496" slineno="5-80" level="3" tab="1"><display>(xiii)</display>issuing, or aiding and abetting in the issuance of, an order or prescription for a <ln numlevel="1" lineno="497" slineno="5-81"/>drug or device:<subsection ssid="10-10-32" dnum="A-o" numlevel="1" lineno="498" slineno="5-82" level="4"><display>(A)</display>without first obtaining information in the usual course of professional <ln numlevel="1" lineno="499" slineno="5-83"/>practice, that is sufficient to establish a diagnosis, to identify conditions, and to <ln numlevel="1" lineno="500" slineno="5-84"/>identify contraindications to the proposed treatment; or</subsection><subsection ssid="10-10-33" dnum="B-o" numlevel="1" lineno="501" slineno="5-85" level="4"><display>(B)</display>with prescriptive authority conferred by an exception issued under this title, or <ln numlevel="1" lineno="502" slineno="5-86"/>a multi-state practice privilege recognized under this title, if the prescription <ln numlevel="1" lineno="503" slineno="5-87"/>was issued without first obtaining information, in the usual course of <ln numlevel="1" lineno="504" slineno="5-88"/>professional practice, that is sufficient to establish a diagnosis, to identify <ln numlevel="1" lineno="505" slineno="5-89"/>underlying conditions, and to identify contraindications to the proposed <ln numlevel="1" lineno="506" slineno="5-90"/>treatment;</subsection></subsection><subsection ssid="10-10-34" dnum="xiv-o" numlevel="1" lineno="507" slineno="5-91" level="3" tab="1"><display>(xiv)</display>violating a provision of Section <xref depth="3" refnumber="58-1-501.5">58-1-501.5</xref>;</subsection><subsection ssid="10-10-35" dnum="xv-o" numlevel="1" lineno="508" slineno="5-92" level="3" tab="1"><display>(xv)</display>violating the terms of an order governing a license; or</subsection><subsection ssid="10-10-36" dnum="xvi-o" numlevel="1" lineno="509" slineno="5-93" level="3" tab="1"><display>(xvi)</display>violating Section <xref depth="3" refnumber="58-1-511">58-1-511</xref>.</subsection></subsection><subsection ssid="10-10-37" dnum="b-o" numlevel="1" lineno="510" slineno="5-94" level="2"><display>(b)</display>"Unprofessional conduct" does not include:<subsection ssid="10-10-38" dnum="i-o" numlevel="1" lineno="511" slineno="5-95" level="3"><display>(i)</display>a health care provider, as defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref> and who is licensed under <ln numlevel="1" lineno="512" slineno="5-96"/>this title, deviating from medical norms or established practices if the conditions <ln numlevel="1" lineno="513" slineno="5-97"/>described in Subsection (5) are met; and</subsection><subsection ssid="10-10-39" dnum="ii-o" numlevel="1" lineno="514" slineno="5-98" level="3"><display>(ii)</display>notwithstanding Section <xref depth="3" refnumber="58-1-501.6">58-1-501.6</xref>, a health care provider advertising that the <ln numlevel="1" lineno="515" slineno="5-99"/>health care provider deviates from medical norms or established practices, <ln numlevel="1" lineno="516" slineno="5-100"/>including the maladies the health care provider treats, if the health care provider:<subsection ssid="10-10-40" dnum="A-o" numlevel="1" lineno="517" slineno="5-101" level="4"><display>(A)</display>does not guarantee any results regarding any health care service;</subsection><subsection ssid="10-10-41" dnum="B-o" numlevel="1" lineno="518" slineno="5-102" level="4"><display>(B)</display>fully discloses on the health care provider's website that the health care <ln numlevel="1" lineno="519" slineno="5-103"/>provider deviates from medical norms or established practices with a <ln numlevel="1" lineno="520" slineno="5-104"/>conspicuous statement; and</subsection><subsection ssid="10-10-42" dnum="C-o" numlevel="1" lineno="521" slineno="5-105" level="4"><display>(C)</display>includes the health care provider's contact information on the website.</subsection></subsection></subsection></subsection><subsection ssid="10-10-43" dnum="3-o" numlevel="1" lineno="522" slineno="5-106" level="1"><display>(3)</display>Unless otherwise specified by statute or administrative rule, in a civil or administrative <ln numlevel="1" lineno="523" slineno="5-107"/>proceeding commenced by the division under this title, a person subject to any of the <ln numlevel="1" lineno="524" slineno="5-108"/>unlawful and unprofessional conduct provisions of this title is strictly liable for each <ln numlevel="1" lineno="525" slineno="5-109"/>violation.</subsection><subsection ssid="10-10-44" dnum="4-o" numlevel="1" lineno="526" slineno="5-110" level="1"><display>(4)</display>The following are not evidence of engaging in unprofessional conduct under Subsection <ln numlevel="1" lineno="527" slineno="5-111"/>(2)(a)(iii):<subsection ssid="10-10-45" dnum="a-o" numlevel="1" lineno="528" slineno="5-112" level="2"><display>(a)</display>an arrest not followed by a conviction; or</subsection><subsection ssid="10-10-46" dnum="b-o" numlevel="1" lineno="529" slineno="5-113" level="2"><display>(b)</display>a conviction for which an individual's incarceration has ended more than <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">seven</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">five</amend> <ln numlevel="1" lineno="530" slineno="5-114"/>years before the date of the division's consideration, unless:<subsection ssid="10-10-47" dnum="i-o" numlevel="1" lineno="531" slineno="5-115" level="3"><display>(i)</display>after the incarceration the individual has engaged in additional conduct that results <ln numlevel="1" lineno="532" slineno="5-116"/>in another conviction, a plea of nolo contendere, or a plea of guilty or nolo <ln numlevel="1" lineno="533" slineno="5-117"/>contendere that is held in abeyance pending the successful completion of <ln numlevel="1" lineno="534" slineno="5-118"/>probation; or</subsection><subsection ssid="10-10-48" dnum="ii-o" numlevel="1" lineno="535" slineno="5-119" level="3"><display>(ii)</display>the conviction was for:<subsection ssid="10-10-49" dnum="A-o" numlevel="1" lineno="536" slineno="5-120" level="4"><display>(A)</display>a violent felony as defined in Section <xref depth="3" refnumber="76-3-203.5">76-3-203.5</xref>;</subsection><subsection ssid="10-10-50" dnum="B-o" numlevel="1" lineno="537" slineno="5-121" level="4"><display>(B)</display>a felony related to a criminal sexual act under Title 76, Chapter 5, Part 4, <ln numlevel="1" lineno="538" slineno="5-122"/>Sexual Offenses, or Title 76, Chapter 5b, Sexual Exploitation Act; or</subsection><subsection ssid="10-10-51" dnum="C-o" numlevel="1" lineno="539" slineno="5-123" level="4"><display>(C)</display>a felony related to criminal fraud or embezzlement, including a felony under <ln numlevel="1" lineno="540" slineno="5-124"/>Title 76, Chapter 6, Part 5, Fraud, or Title 76, Chapter 6, Part 4, Theft.</subsection></subsection></subsection></subsection><subsection ssid="10-10-52" dnum="5-o" numlevel="1" lineno="541" slineno="5-125" level="1"><display>(5)</display>In accordance with Subsection (2)(b)(i), a health care provider may deviate from <ln numlevel="1" lineno="542" slineno="5-126"/>medical norms or established practices if:<subsection ssid="10-10-53" dnum="a-o" numlevel="1" lineno="543" slineno="5-127" level="2"><display>(a)</display>the health care provider does not deviate outside of the health care provider's scope <ln numlevel="1" lineno="544" slineno="5-128"/>of practice and possesses the education, training, and experience to competently and <ln numlevel="1" lineno="545" slineno="5-129"/>safely administer the alternative health care service;</subsection><subsection ssid="10-10-54" dnum="b-o" numlevel="1" lineno="546" slineno="5-130" level="2"><display>(b)</display>the health care provider does not provide an alternative health care service that is <ln numlevel="1" lineno="547" slineno="5-131"/>otherwise contrary to any state or federal law;</subsection><subsection ssid="10-10-55" dnum="c-o" numlevel="1" lineno="548" slineno="5-132" level="2"><display>(c)</display>the alternative health care service has reasonable potential to be of benefit to the <ln numlevel="1" lineno="549" slineno="5-133"/>patient to whom the alternative health care service is to be given;</subsection><subsection ssid="10-10-56" dnum="d-o" numlevel="1" lineno="550" slineno="5-134" level="2"><display>(d)</display>the potential benefit of the alternative health care service outweighs the known <ln numlevel="1" lineno="551" slineno="5-135"/>harms or side effects of the alternative health care service;</subsection><subsection ssid="10-10-57" dnum="e-o" numlevel="1" lineno="552" slineno="5-136" level="2"><display>(e)</display>the alternative health care service is reasonably justified under the totality of the <ln numlevel="1" lineno="553" slineno="5-137"/>circumstances;</subsection><subsection ssid="10-10-58" dnum="f-o" numlevel="1" lineno="554" slineno="5-138" level="2"><display>(f)</display>after diagnosis but before providing the alternative health care service:<subsection ssid="10-10-59" dnum="i-o" numlevel="1" lineno="555" slineno="5-139" level="3"><display>(i)</display>the health care provider educates the patient on the health care services that are <ln numlevel="1" lineno="556" slineno="5-140"/>within the medical norms and established practices;</subsection><subsection ssid="10-10-60" dnum="ii-o" numlevel="1" lineno="557" slineno="5-141" level="3"><display>(ii)</display>the health care provider discloses to the patient that the health care provider is <ln numlevel="1" lineno="558" slineno="5-142"/>recommending an alternative health care service that deviates from medical norms <ln numlevel="1" lineno="559" slineno="5-143"/>and established practices;</subsection><subsection ssid="10-10-61" dnum="iii-o" numlevel="1" lineno="560" slineno="5-144" level="3"><display>(iii)</display>the health care provider discusses the rationale for deviating from medical norms <ln numlevel="1" lineno="561" slineno="5-145"/>and established practices with the patient;</subsection><subsection ssid="10-10-62" dnum="iv-o" numlevel="1" lineno="562" slineno="5-146" level="3"><display>(iv)</display>the health care provider discloses any potential risks associated with deviation <ln numlevel="1" lineno="563" slineno="5-147"/>from medical norms and established practices; and</subsection><subsection ssid="10-10-63" dnum="v-o" numlevel="1" lineno="564" slineno="5-148" level="3"><display>(v)</display>the patient signs and acknowledges a notice of deviation; and</subsection></subsection><subsection ssid="10-10-64" dnum="g-o" numlevel="1" lineno="565" slineno="5-149" level="2"><display>(g)</display>before providing an alternative health care service, the health care provider discloses <ln numlevel="1" lineno="566" slineno="5-150"/>to the patient that the patient may enter into an agreement describing what would <ln numlevel="1" lineno="567" slineno="5-151"/>constitute the health care provider's negligence related to deviation.</subsection></subsection><subsection ssid="10-10-65" dnum="6-o" numlevel="1" lineno="568" slineno="5-152" level="1"><display>(6)</display>As used in this section, "notice of deviation" means a written notice provided by a <ln numlevel="1" lineno="569" slineno="5-153"/>health care provider to a patient that:<subsection ssid="10-10-66" dnum="a-o" numlevel="1" lineno="570" slineno="5-154" level="2"><display>(a)</display>is specific to the patient;</subsection><subsection ssid="10-10-67" dnum="b-o" numlevel="1" lineno="571" slineno="5-155" level="2"><display>(b)</display>indicates that the health care provider is deviating from medical norms or established <ln numlevel="1" lineno="572" slineno="5-156"/>practices in the health care provider's recommendation for the patient's treatment;</subsection><subsection ssid="10-10-68" dnum="c-o" numlevel="1" lineno="573" slineno="5-157" level="2"><display>(c)</display>describes how the alternative health care service deviates from medical norms or <ln numlevel="1" lineno="574" slineno="5-158"/>established practices;</subsection><subsection ssid="10-10-69" dnum="d-o" numlevel="1" lineno="575" slineno="5-159" level="2"><display>(d)</display>describes the potential risks and benefits associated with the alternative health care <ln numlevel="1" lineno="576" slineno="5-160"/>service;</subsection><subsection ssid="10-10-70" dnum="e-o" numlevel="1" lineno="577" slineno="5-161" level="2"><display>(e)</display>describes the health care provider's reasonably justified rationale regarding the <ln numlevel="1" lineno="578" slineno="5-162"/>reason for the deviation; and</subsection><subsection ssid="10-10-71" dnum="f-o" numlevel="1" lineno="579" slineno="5-163" level="2"><display>(f)</display>provides clear and unequivocal notice to the patient that the patient is agreeing to <ln numlevel="1" lineno="580" slineno="5-164"/>receive the alternative health care service which is outside medical norms and <ln numlevel="1" lineno="581" slineno="5-165"/>established practices.</subsection></subsection></section></bsec><bsec buid="6" type="enact" src="code" num="64-13h-101" uid="C64-13h-S101_1800010118000101" sort="64 13h01010018000101" style="" numlevel="1" lineno="582" slineno="6-1" sn="6"><section number="64-13h-101" numlevel="1" lineno="584" slineno="6-3" type="enact"><secline lineno="582">Section 6, Section <bold>64-13h-101</bold> is enacted to read:</secline><headchap number="64-13h" numlevel="1" lineno="583" slineno="6-2">13h. REHABILITATION AND REENTRY SERVICES</headchap><catline lineno="584"><bold>64-13h-101 (Effective upon governor's approval). Creation of Rehabilitation and <ln numlevel="1" lineno="592" slineno="7-3"/>Reentry Services Restricted Account.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="593" slineno="7-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1280" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">There is created a restricted account within the General Fund known as the <ln numlevel="1" lineno="594" slineno="7-5"/>Rehabilitation and Reentry Services Restricted Account.</amend></subsection><subsection ssid="4-6" dnum="_-o:2-i" numlevel="1" lineno="595" slineno="7-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1281" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">The account includes:</amend><subsection ssid="4-7" dnum="_-o:a-i" numlevel="1" lineno="596" slineno="7-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">private donations, grants, gifts, bequests, or money made available from any other <ln numlevel="1" lineno="597" slineno="7-8"/>source to implement this section and Section <xref depth="3" refnumber="64-13h-103">64-13h-103</xref>;</amend></subsection><subsection ssid="4-9" dnum="_-o:b-i" numlevel="1" lineno="598" slineno="7-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">money appropriated to the account by the Legislature; and</amend></subsection><subsection ssid="4-8" dnum="_-o:c-i" numlevel="1" lineno="599" slineno="7-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">any interest earned on the account.</amend></subsection></subsection><subsection ssid="4-24" dnum="_-o:3-i" numlevel="1" lineno="600" slineno="7-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1285" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">The department shall administer the account for the purposes described in Section <xref depth="3" refnumber="64-13h-103"><ln numlevel="1" lineno="601" slineno="7-12"/>64-13h-103</xref>.</amend></subsection><subsection ssid="4-25" dnum="_-o:4-i" numlevel="1" lineno="602" slineno="7-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">Upon appropriation by the Legislature, the department shall use money in the account as <ln numlevel="1" lineno="603" slineno="7-14"/>described in Section <xref depth="3" refnumber="64-13h-103">64-13h-103</xref>.</amend></subsection></section></bsec><bsec buid="5" type="enact" src="code" num="64-13h-103" uid="C64-13h-S103_1800010118000101" sort="64 13h01030018000101" numlevel="1" lineno="604" slineno="8-1" sn="8"><section number="64-13h-103" numlevel="1" lineno="605" slineno="8-2" type="enact"><secline lineno="604">Section 8, Section <bold>64-13h-103</bold> is enacted to read:</secline><catline lineno="605"><bold>64-13h-103 (Effective upon governor's approval). Uses of Rehabilitation and <ln numlevel="1" lineno="606" slineno="8-3"/>Reentry Services Restricted Account.</bold></catline><subsection ssid="5-1" dnum="_-o:1-i" numlevel="1" lineno="607" slineno="8-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1287" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">Account funds shall be used to provide direct services to offenders that will increase the <ln numlevel="1" lineno="608" slineno="8-5"/>likelihood of successful reintegration into the general public and decrease the likelihood <ln numlevel="1" lineno="609" slineno="8-6"/>of recidivism, which may include:</amend><subsection ssid="5-7" dnum="_-o:a-i" numlevel="1" lineno="610" slineno="8-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1288" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">educational services;</amend></subsection><subsection ssid="5-8" dnum="_-o:b-i" numlevel="1" lineno="611" slineno="8-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1289" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">job skills training;</amend></subsection><subsection ssid="5-9" dnum="_-o:c-i" numlevel="1" lineno="612" slineno="8-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1290" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">life skills training;</amend></subsection><subsection ssid="5-29" dnum="_-o:d-i" numlevel="1" lineno="613" slineno="8-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1291" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">apprenticeships;</amend></subsection><subsection ssid="5-10" dnum="_-o:e-i" numlevel="1" lineno="614" slineno="8-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1292" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">job placement assistance;</amend></subsection><subsection ssid="5-30" dnum="_-o:f-i" numlevel="1" lineno="615" slineno="8-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1293" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">assistance with affordable housing or supervised or transitional housing services;</amend></subsection><subsection ssid="5-11" dnum="_-o:g-i" numlevel="1" lineno="616" slineno="8-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">substance use treatment, mental health services, or physical health services; or</amend></subsection><subsection ssid="5-12" dnum="_-o:h-i" numlevel="1" lineno="617" slineno="8-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">case worker access, before or after leaving incarceration.</amend></subsection></subsection><subsection ssid="5-25" dnum="_-o:2-i" numlevel="1" lineno="618" slineno="8-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">The department may expend money from the account to offset actual department <ln numlevel="1" lineno="619" slineno="8-16"/>expenses related to administering this section.</amend></subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="620" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="620">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="621"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="622" slineno="9-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection (2), May 7, 2025;
