Ethics requirements governing State Board of Education members.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="23" slineno="1-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall establish within the state board's bylaws and policies, a code of <ln numlevel="1" lineno="24" slineno="1-4"/>conduct and ethical standards for board members, incorporating standards and <ln numlevel="1" lineno="25" slineno="1-5"/>procedures relevant to the state board's constitutional and statutory roles including:</amend><subsection ssid="1-2" dnum="_-o:a-i" numlevel="1" lineno="26" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">provisions for ethics training for state board members;</amend></subsection><subsection ssid="1-3" dnum="_-o:b-i" numlevel="1" lineno="27" slineno="1-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">a process for filing and reviewing ethics complaints against state board members;</amend></subsection><subsection ssid="1-4" dnum="_-o:c-i" numlevel="1" lineno="28" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">protections related to complaint privacy before and during the preliminary review <ln numlevel="1" lineno="29" slineno="1-9"/>period;</amend></subsection><subsection ssid="1-5" dnum="_-o:d-i" numlevel="1" lineno="30" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">options for disciplinary action for violations;</amend></subsection><subsection ssid="1-6" dnum="_-o:e-i" numlevel="1" lineno="31" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">prohibitions related to filing complaints before a primary or general election; and</amend></subsection><subsection ssid="1-7" dnum="_-o:f-i" numlevel="1" lineno="32" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">declarations related to a conflict of interest;</amend></subsection></subsection><subsection ssid="1-8" dnum="_-o:2-i" numlevel="1" lineno="33" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">The records received or generated for review of an ethics violation under this section <ln numlevel="1" lineno="34" slineno="1-14"/>shall be private records in accordance with Section 63G-2-302.</amend></subsection><subsection ssid="1-9" dnum="_-o:3-i" numlevel="1" lineno="35" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall maintain a summary record of actions, which shall be classified as <ln numlevel="1" lineno="36" slineno="1-16"/>a public record.</amend></subsection><subsection ssid="1-10" dnum="_-o:4-i" numlevel="1" lineno="37" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall:</amend><subsection ssid="1-11" dnum="_-o:a-i" numlevel="1" lineno="38" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">report to the Education Interim Committee at or before the committee's October 2025 <ln numlevel="1" lineno="39" slineno="1-19"/>interim meeting regarding:</amend><subsection ssid="1-12" dnum="_-o:i-i" numlevel="1" lineno="40" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">the code of conduct and ethical standards established under Subsection (1);</amend></subsection><subsection ssid="1-13" dnum="_-o:ii-i" numlevel="1" lineno="41" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">the number and types of ethics complaints received;</amend></subsection><subsection ssid="1-14" dnum="_-o:iii-i" numlevel="1" lineno="42" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">the disposition of ethics complaints; and</amend></subsection><subsection ssid="1-15" dnum="_-o:iv-i" numlevel="1" lineno="43" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">any recommendations for statutory modifications to the ethics requirements; and</amend></subsection></subsection><subsection ssid="1-16" dnum="_-o:b-i" numlevel="1" lineno="44" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">provide any additional information requested by the committee for purposes of <ln numlevel="1" lineno="45" slineno="1-25"/>reviewing:</amend><subsection ssid="1-17" dnum="_-o:i-i" numlevel="1" lineno="46" slineno="1-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">the effectiveness of the ethics requirements established under this section; and</amend></subsection><subsection ssid="1-18" dnum="_-o:ii-i" numlevel="1" lineno="47" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">whether additional legislation is necessary.</amend></subsection></subsection></subsection><subsection ssid="1-19" dnum="_-o:5-i" numlevel="1" lineno="48" slineno="1-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">The Education Interim Committee shall:</amend><subsection ssid="1-20" dnum="_-o:a-i" numlevel="1" lineno="49" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">review the report submitted under Subsection (4);</amend></subsection><subsection ssid="1-21" dnum="_-o:b-i" numlevel="1" lineno="50" slineno="1-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">evaluate the effectiveness of the ethics requirements established by the state board; <ln numlevel="1" lineno="51" slineno="1-31"/>and</amend></subsection><subsection ssid="1-22" dnum="_-o:c-i" numlevel="1" lineno="52" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">consider whether to recommend legislation to:</amend><subsection ssid="1-23" dnum="_-o:i-i" numlevel="1" lineno="53" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">modify the ethics requirements under this section; or</amend></subsection><subsection ssid="1-24" numlevel="1" lineno="54" slineno="1-34" dnum="_-o:ii-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">establish additional statutory requirements governing state board member conduct.</amend></subsection></subsection></subsection></section></bsec><bsec buid="3" num="63G-2-302" type="amend" src="code" uid="C63G-2-S302_2025050720250507" sort="63G02 03020020250507" numlevel="1" lineno="55" slineno="2-1" sn="2"><section number="63G-2-302" numlevel="1" lineno="56" slineno="2-2" type="amend"><secline lineno="55">Section 2, Section <bold>63G-2-302</bold> is amended to read:</secline><catline lineno="56"><bold>63G-2-302. Private records.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="57" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The following records are private:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="58" slineno="2-4" level="2"><display>(a)</display>records concerning an individual's eligibility for unemployment insurance benefits, <ln numlevel="1" lineno="59" slineno="2-5"/>social services, welfare benefits, or the determination of benefit levels;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="60" slineno="2-6" level="2"><display>(b)</display>records containing data on individuals describing medical history, diagnosis, <ln numlevel="1" lineno="61" slineno="2-7"/>condition, treatment, evaluation, or similar medical data;</subsection><subsection ssid="3-null-4" dnum="c-o" numlevel="1" lineno="62" slineno="2-8" level="2"><display>(c)</display>records of publicly funded libraries that when examined alone or with other records <ln numlevel="1" lineno="63" slineno="2-9"/>identify a patron;</subsection><subsection ssid="3-null-5" dnum="d-o" numlevel="1" lineno="64" slineno="2-10" level="2"><display>(d)</display>records received by or generated by or for:<subsection ssid="3-null-6" dnum="i-o" numlevel="1" lineno="65" slineno="2-11" level="3"><display>(i)</display>the Independent Legislative Ethics Commission, except for:<subsection ssid="3-null-7" dnum="A-o" numlevel="1" lineno="66" slineno="2-12" level="4"><display>(A)</display>the commission's summary data report that is required under legislative rule; <ln numlevel="1" lineno="67" slineno="2-13"/>and</subsection><subsection ssid="3-null-8" dnum="B-o" numlevel="1" lineno="68" slineno="2-14" level="4"><display>(B)</display>any other document that is classified as public under legislative rule; or</subsection></subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="69" slineno="2-15" level="3"><display>(ii)</display>a Senate or House Ethics Committee in relation to the review of ethics <ln numlevel="1" lineno="70" slineno="2-16"/>complaints, unless the record is classified as public under legislative rule;</subsection></subsection><subsection ssid="3-null-10" dnum="e-o" numlevel="1" lineno="71" slineno="2-17" level="2"><display>(e)</display>records received by, or generated by or for, the Independent Executive Branch Ethics <ln numlevel="1" lineno="72" slineno="2-18"/>Commission, except as otherwise expressly provided in Title 63A, Chapter 14, <ln numlevel="1" lineno="73" slineno="2-19"/>Review of Executive Branch Ethics Complaints;</subsection><subsection ssid="3-null-11" dnum="f-o" numlevel="1" lineno="74" slineno="2-20" level="2"><display>(f)</display>records received or generated for a Senate confirmation committee concerning <ln numlevel="1" lineno="75" slineno="2-21"/>character, professional competence, or physical or mental health of an individual:<subsection ssid="3-null-12" dnum="i-o" numlevel="1" lineno="76" slineno="2-22" level="3"><display>(i)</display>if, prior to the meeting, the chair of the committee determines release of the <ln numlevel="1" lineno="77" slineno="2-23"/>records:<subsection ssid="3-null-13" dnum="A-o" numlevel="1" lineno="78" slineno="2-24" level="4"><display>(A)</display>reasonably could be expected to interfere with the investigation undertaken by <ln numlevel="1" lineno="79" slineno="2-25"/>the committee; or</subsection><subsection ssid="3-null-14" dnum="B-o" numlevel="1" lineno="80" slineno="2-26" level="4"><display>(B)</display>would create a danger of depriving a person of a right to a fair proceeding or <ln numlevel="1" lineno="81" slineno="2-27"/>impartial hearing; and</subsection></subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="82" slineno="2-28" level="3"><display>(ii)</display>after the meeting, if the meeting was closed to the public;</subsection></subsection><subsection ssid="3-null-16" dnum="g-o" numlevel="1" lineno="83" slineno="2-29" level="2"><display>(g)</display>employment records concerning a current or former employee of, or applicant for <ln numlevel="1" lineno="84" slineno="2-30"/>employment with, a governmental entity that would disclose that individual's home <ln numlevel="1" lineno="85" slineno="2-31"/>address, home telephone number, social security number, insurance coverage, marital <ln numlevel="1" lineno="86" slineno="2-32"/>status, or payroll deductions;</subsection><subsection ssid="3-null-17" dnum="h-o" numlevel="1" lineno="87" slineno="2-33" level="2"><display>(h)</display>records or parts of records under Section <xref depth="3" refnumber="63G-2-303">63G-2-303</xref> that a current or former <ln numlevel="1" lineno="88" slineno="2-34"/>employee identifies as private according to the requirements of that section;</subsection><subsection ssid="3-null-18" dnum="i-o" numlevel="1" lineno="89" slineno="2-35" level="2"><display>(i)</display>that part of a record indicating a person's social security number or federal employer <ln numlevel="1" lineno="90" slineno="2-36"/>identification number if provided under Section <xref depth="3" refnumber="31A-23a-104">31A-23a-104</xref>, <xref depth="3" refnumber="31A-25-202">31A-25-202</xref>, <xref depth="3" refnumber="31A-26-202"><ln numlevel="1" lineno="91" slineno="2-37"/>31A-26-202</xref>, <xref depth="3" refnumber="58-1-301">58-1-301</xref>, <xref depth="3" refnumber="58-55-302">58-55-302</xref>, <xref depth="3" refnumber="61-1-4">61-1-4</xref>, or <xref depth="3" refnumber="61-2f-203">61-2f-203</xref>;</subsection><subsection ssid="3-null-19" dnum="j-o" numlevel="1" lineno="92" slineno="2-38" level="2"><display>(j)</display>that part of a voter registration record identifying a voter's:<subsection ssid="3-null-20" dnum="i-o" numlevel="1" lineno="93" slineno="2-39" level="3"><display>(i)</display>driver license or identification card number;</subsection><subsection ssid="3-null-21" dnum="ii-o" numlevel="1" lineno="94" slineno="2-40" level="3"><display>(ii)</display>social security number, or last four digits of the social security number;</subsection><subsection ssid="3-null-22" dnum="iii-o" numlevel="1" lineno="95" slineno="2-41" level="3"><display>(iii)</display>email address;</subsection><subsection ssid="3-null-23" dnum="iv-o" numlevel="1" lineno="96" slineno="2-42" level="3"><display>(iv)</display>date of birth; or</subsection><subsection ssid="3-null-24" dnum="v-o" numlevel="1" lineno="97" slineno="2-43" level="3"><display>(v)</display>phone number;</subsection></subsection><subsection ssid="3-null-25" dnum="k-o" numlevel="1" lineno="98" slineno="2-44" level="2"><display>(k)</display>a voter registration record that is classified as a private record by the lieutenant <ln numlevel="1" lineno="99" slineno="2-45"/>governor or a county clerk under Subsection <xref depth="3" refnumber="20A-2-101.1">20A-2-101.1</xref>(5)(a), <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>(4)(h), or <xref depth="3" refnumber="20A-2-204"><ln numlevel="1" lineno="100" slineno="2-46"/>20A-2-204</xref>(4)(b);</subsection><subsection ssid="3-null-26" dnum="l-o" numlevel="1" lineno="101" slineno="2-47" level="2"><display>(l)</display>a voter registration record that is withheld under Subsection <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>(7);</subsection><subsection ssid="3-null-27" dnum="m-o" numlevel="1" lineno="102" slineno="2-48" level="2"><display>(m)</display>a withholding request form described in Subsections <xref depth="3" refnumber="20A-2-104">20A-2-104</xref>(7) and (8) and any <ln numlevel="1" lineno="103" slineno="2-49"/>verification submitted in support of the form;</subsection><subsection ssid="3-null-28" dnum="n-o" numlevel="1" lineno="104" slineno="2-50" level="2"><display>(n)</display>a record that:<subsection ssid="3-null-29" dnum="i-o" numlevel="1" lineno="105" slineno="2-51" level="3"><display>(i)</display>contains information about an individual;</subsection><subsection ssid="3-null-30" dnum="ii-o" numlevel="1" lineno="106" slineno="2-52" level="3"><display>(ii)</display>is voluntarily provided by the individual; and</subsection><subsection ssid="3-null-31" dnum="iii-o" numlevel="1" lineno="107" slineno="2-53" level="3"><display>(iii)</display>goes into an electronic database that:<subsection ssid="3-null-32" dnum="A-o" numlevel="1" lineno="108" slineno="2-54" level="4"><display>(A)</display>is designated by and administered under the authority of the Chief Information <ln numlevel="1" lineno="109" slineno="2-55"/>Officer; and</subsection><subsection ssid="3-null-33" dnum="B-o" numlevel="1" lineno="110" slineno="2-56" level="4"><display>(B)</display>acts as a repository of information about the individual that can be <ln numlevel="1" lineno="111" slineno="2-57"/>electronically retrieved and used to facilitate the individual's online interaction <ln numlevel="1" lineno="112" slineno="2-58"/>with a state agency;</subsection></subsection></subsection><subsection ssid="3-null-34" dnum="o-o" numlevel="1" lineno="113" slineno="2-59" level="2"><display>(o)</display>information provided to the Commissioner of Insurance under:<subsection ssid="3-null-35" dnum="i-o" numlevel="1" lineno="114" slineno="2-60" level="3"><display>(i)</display>Subsection <xref depth="3" refnumber="31A-23a-115">31A-23a-115</xref>(3)(a);</subsection><subsection ssid="3-null-36" dnum="ii-o" numlevel="1" lineno="115" slineno="2-61" level="3"><display>(ii)</display>Subsection <xref depth="3" refnumber="31A-23a-302">31A-23a-302</xref>(4); or</subsection><subsection ssid="3-null-37" dnum="iii-o" numlevel="1" lineno="116" slineno="2-62" level="3"><display>(iii)</display>Subsection <xref depth="3" refnumber="31A-26-210">31A-26-210</xref>(4);</subsection></subsection><subsection ssid="3-null-38" dnum="p-o" numlevel="1" lineno="117" slineno="2-63" level="2"><display>(p)</display>information obtained through a criminal background check under Title 11, Chapter <ln numlevel="1" lineno="118" slineno="2-64"/>40, Criminal Background Checks by Political Subdivisions Operating Water Systems;</subsection><subsection ssid="3-null-39" dnum="q-o" numlevel="1" lineno="119" slineno="2-65" level="2"><display>(q)</display>information provided by an offender that is:<subsection ssid="3-null-40" dnum="i-o" numlevel="1" lineno="120" slineno="2-66" level="3"><display>(i)</display>required by the registration requirements of Title 77, Chapter 41, Sex, Kidnap, and <ln numlevel="1" lineno="121" slineno="2-67"/>Child Abuse Offender Registry; and</subsection><subsection ssid="3-null-41" dnum="ii-o" numlevel="1" lineno="122" slineno="2-68" level="3"><display>(ii)</display>not required to be made available to the public under Subsection <xref depth="3" refnumber="77-41-110">77-41-110</xref>(4);</subsection></subsection><subsection ssid="3-null-42" dnum="r-o" numlevel="1" lineno="123" slineno="2-69" level="2"><display>(r)</display>a statement and any supporting documentation filed with the attorney general in <ln numlevel="1" lineno="124" slineno="2-70"/>accordance with Section <xref depth="3" refnumber="34-45-107">34-45-107</xref>, if the federal law or action supporting the filing <ln numlevel="1" lineno="125" slineno="2-71"/>involves homeland security;</subsection><subsection ssid="3-null-43" dnum="s-o" numlevel="1" lineno="126" slineno="2-72" level="2"><display>(s)</display>electronic toll collection customer account information received or collected under <ln numlevel="1" lineno="127" slineno="2-73"/>Section <xref depth="3" refnumber="72-6-118">72-6-118</xref> and customer information described in Section <xref depth="3" refnumber="17B-2a-815">17B-2a-815</xref> <ln numlevel="1" lineno="128" slineno="2-74"/>received or collected by a public transit district, including contact and payment <ln numlevel="1" lineno="129" slineno="2-75"/>information and customer travel data;</subsection><subsection ssid="3-null-44" dnum="t-o" numlevel="1" lineno="130" slineno="2-76" level="2"><display>(t)</display>an email address provided by a military or overseas voter under Section <xref depth="3" refnumber="20A-16-501">20A-16-501</xref>;</subsection><subsection ssid="3-null-45" dnum="u-o" numlevel="1" lineno="131" slineno="2-77" level="2"><display>(u)</display>a completed military-overseas ballot that is electronically transmitted under Title <ln numlevel="1" lineno="132" slineno="2-78"/>20A, Chapter 16, Uniform Military and Overseas Voters Act;</subsection><subsection ssid="3-null-46" dnum="v-o" numlevel="1" lineno="133" slineno="2-79" level="2"><display>(v)</display>records received by or generated by or for the Political Subdivisions Ethics Review <ln numlevel="1" lineno="134" slineno="2-80"/>Commission established in Section <xref depth="3" refnumber="63A-15-201">63A-15-201</xref>, except for:<subsection ssid="3-null-47" dnum="i-o" numlevel="1" lineno="135" slineno="2-81" level="3"><display>(i)</display>the commission's summary data report that is required in Section <xref depth="3" refnumber="63A-15-202">63A-15-202</xref>; and</subsection><subsection ssid="3-null-48" dnum="ii-o" numlevel="1" lineno="136" slineno="2-82" level="3"><display>(ii)</display>any other document that is classified as public in accordance with Title 63A, <ln numlevel="1" lineno="137" slineno="2-83"/>Chapter 15, Political Subdivisions Ethics Review Commission;</subsection></subsection><subsection ssid="3-null-49" dnum="w-o" numlevel="1" lineno="138" slineno="2-84" level="2"><display>(w)</display>a record described in Section <xref depth="3" refnumber="53G-9-604">53G-9-604</xref> that verifies that a parent was notified of an <ln numlevel="1" lineno="139" slineno="2-85"/>incident or threat;</subsection><subsection ssid="3-null-50" dnum="x-o" numlevel="1" lineno="140" slineno="2-86" level="2"><display>(x)</display>a criminal background check or credit history report conducted in accordance with <ln numlevel="1" lineno="141" slineno="2-87"/>Section <xref depth="3" refnumber="63A-3-201">63A-3-201</xref>;</subsection><subsection ssid="3-null-51" dnum="y-o" numlevel="1" lineno="142" slineno="2-88" level="2"><display>(y)</display>a record described in Subsection <xref depth="3" refnumber="53-5a-104">53-5a-104</xref>(7);</subsection><subsection ssid="3-null-52" dnum="z-o" numlevel="1" lineno="143" slineno="2-89" level="2"><display>(z)</display>on a record maintained by a county for the purpose of administering property taxes, <ln numlevel="1" lineno="144" slineno="2-90"/>an individual's:<subsection ssid="3-null-53" dnum="i-o" numlevel="1" lineno="145" slineno="2-91" level="3"><display>(i)</display>email address;</subsection><subsection ssid="3-null-54" dnum="ii-o" numlevel="1" lineno="146" slineno="2-92" level="3"><display>(ii)</display>phone number; or</subsection><subsection ssid="3-null-55" dnum="iii-o" numlevel="1" lineno="147" slineno="2-93" level="3"><display>(iii)</display>personal financial information related to a person's payment method;</subsection></subsection><subsection ssid="3-null-56" dnum="aa-o" numlevel="1" lineno="148" slineno="2-94" level="2"><display>(aa)</display>a record submitted by a taxpayer to establish the taxpayer's eligibility for an <ln numlevel="1" lineno="149" slineno="2-95"/>exemption, deferral, abatement, or relief under:<subsection ssid="3-null-57" dnum="i-o" numlevel="1" lineno="150" slineno="2-96" level="3"><display>(i)</display>Title 59, Chapter 2, Part 11, Exemptions;</subsection><subsection ssid="3-null-58" dnum="ii-o" numlevel="1" lineno="151" slineno="2-97" level="3"><display>(ii)</display>Title 59, Chapter 2, Part 12, Property Tax Relief;</subsection><subsection ssid="3-null-59" dnum="iii-o" numlevel="1" lineno="152" slineno="2-98" level="3"><display>(iii)</display>Title 59, Chapter 2, Part 18, Tax Deferral and Tax Abatement; or</subsection><subsection ssid="3-null-60" dnum="iv-o" numlevel="1" lineno="153" slineno="2-99" level="3"><display>(iv)</display>Title 59, Chapter 2, Part 19, Armed Forces Exemptions;</subsection></subsection><subsection ssid="3-null-61" dnum="bb-o" numlevel="1" lineno="154" slineno="2-100" level="2"><display>(bb)</display>a record provided by the State Tax Commission in response to a request under <ln numlevel="1" lineno="155" slineno="2-101"/>Subsection <xref depth="3" refnumber="59-1-403">59-1-403</xref>(4)(y)(iii);</subsection><subsection ssid="3-null-62" dnum="cc-o" numlevel="1" lineno="156" slineno="2-102" level="2"><display>(cc)</display>a record of the Child Welfare Legislative Oversight Panel regarding an individual <ln numlevel="1" lineno="157" slineno="2-103"/>child welfare case, as described in Subsection <xref depth="3" refnumber="36-33-103">36-33-103</xref>(3); and</subsection><subsection ssid="3-null-63" dnum="dd-o" numlevel="1" lineno="158" slineno="2-104" level="2"><display>(dd)</display>a record relating to drug or alcohol testing of a state employee under Section <xref depth="3" refnumber="63A-17-1004"><ln numlevel="1" lineno="159" slineno="2-105"/>63A-17-1004</xref>;</subsection><subsection ssid="3-null-64" dnum="ee-o" numlevel="1" lineno="160" slineno="2-106" level="2"><display>(ee)</display>a record relating to a request by a state elected official or state employee who has <ln numlevel="1" lineno="161" slineno="2-107"/>been threatened to the Division of Technology Services to remove personal <ln numlevel="1" lineno="162" slineno="2-108"/>identifying information from the open web under Section <xref depth="3" refnumber="63A-16-109">63A-16-109</xref>; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="3-null-65" dnum="ff-o" numlevel="1" lineno="163" slineno="2-109" level="2"><display>(ff)</display>a record including confidential information as that term is defined in Section <xref depth="3" refnumber="67-27-105"><ln numlevel="1" lineno="164" slineno="2-110"/>67-27-105</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="3-88" dnum="_-o:gg-i" numlevel="1" lineno="165" slineno="2-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(gg)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">a record of an ethics violation as described in Section 53E-3-1201.</amend></subsection></subsection><subsection ssid="3-null-66" dnum="2-o" numlevel="1" lineno="166" slineno="2-112" level="1"><display>(2)</display>The following records are private if properly classified by a governmental entity:<subsection ssid="3-null-67" dnum="a-o" numlevel="1" lineno="167" slineno="2-113" level="2"><display>(a)</display>records concerning a current or former employee of, or applicant for employment <ln numlevel="1" lineno="168" slineno="2-114"/>with a governmental entity, including performance evaluations and personal status <ln numlevel="1" lineno="169" slineno="2-115"/>information such as race, religion, or disabilities, but not including records that are <ln numlevel="1" lineno="170" slineno="2-116"/>public under Subsection <xref depth="3" refnumber="63G-2-301">63G-2-301</xref>(2)(b) or <xref depth="3" refnumber="63G-2-301">63G-2-301</xref>(3)(o) or private under <ln numlevel="1" lineno="171" slineno="2-117"/>Subsection (1)(b);</subsection><subsection ssid="3-null-68" dnum="b-o" numlevel="1" lineno="172" slineno="2-118" level="2"><display>(b)</display>records describing an individual's finances, except that the following are public:<subsection ssid="3-null-69" dnum="i-o" numlevel="1" lineno="173" slineno="2-119" level="3"><display>(i)</display>records described in Subsection <xref depth="3" refnumber="63G-2-301">63G-2-301</xref>(2);</subsection><subsection ssid="3-null-70" dnum="ii-o" numlevel="1" lineno="174" slineno="2-120" level="3"><display>(ii)</display>information provided to the governmental entity for the purpose of complying <ln numlevel="1" lineno="175" slineno="2-121"/>with a financial assurance requirement; or</subsection><subsection ssid="3-null-71" dnum="iii-o" numlevel="1" lineno="176" slineno="2-122" level="3"><display>(iii)</display>records that must be disclosed in accordance with another statute;</subsection></subsection><subsection ssid="3-null-72" dnum="c-o" numlevel="1" lineno="177" slineno="2-123" level="2"><display>(c)</display>records of independent state agencies if the disclosure of those records would <ln numlevel="1" lineno="178" slineno="2-124"/>conflict with the fiduciary obligations of the agency;</subsection><subsection ssid="3-null-73" dnum="d-o" numlevel="1" lineno="179" slineno="2-125" level="2"><display>(d)</display>other records containing data on individuals the disclosure of which constitutes a <ln numlevel="1" lineno="180" slineno="2-126"/>clearly unwarranted invasion of personal privacy;</subsection><subsection ssid="3-null-74" dnum="e-o" numlevel="1" lineno="181" slineno="2-127" level="2"><display>(e)</display>records provided by the United States or by a government entity outside the state that <ln numlevel="1" lineno="182" slineno="2-128"/>are given with the requirement that the records be managed as private records, if the <ln numlevel="1" lineno="183" slineno="2-129"/>providing entity states in writing that the record would not be subject to public <ln numlevel="1" lineno="184" slineno="2-130"/>disclosure if retained by it;</subsection><subsection ssid="3-null-75" dnum="f-o" numlevel="1" lineno="185" slineno="2-131" level="2"><display>(f)</display>any portion of a record in the custody of the Division of Aging and Adult Services, <ln numlevel="1" lineno="186" slineno="2-132"/>created in Section <xref depth="3" refnumber="26B-6-102">26B-6-102</xref>, that may disclose, or lead to the discovery of, the <ln numlevel="1" lineno="187" slineno="2-133"/>identity of a person who made a report of alleged abuse, neglect, or exploitation of a <ln numlevel="1" lineno="188" slineno="2-134"/>vulnerable adult; and</subsection><subsection ssid="3-null-76" dnum="g-o" numlevel="1" lineno="189" slineno="2-135" level="2"><display>(g)</display>audio and video recordings created by a body-worn camera, as defined in Section <xref depth="3" refnumber="77-7a-103"><ln numlevel="1" lineno="190" slineno="2-136"/>77-7a-103</xref>, that record sound or images inside a home or residence except for <ln numlevel="1" lineno="191" slineno="2-137"/>recordings that:<subsection ssid="3-null-77" dnum="i-o" numlevel="1" lineno="192" slineno="2-138" level="3"><display>(i)</display>depict the commission of an alleged crime;</subsection><subsection ssid="3-null-78" dnum="ii-o" numlevel="1" lineno="193" slineno="2-139" level="3"><display>(ii)</display>record any encounter between a law enforcement officer and a person that results <ln numlevel="1" lineno="194" slineno="2-140"/>in death or bodily injury, or includes an instance when an officer fires a weapon;</subsection><subsection ssid="3-null-79" dnum="iii-o" numlevel="1" lineno="195" slineno="2-141" level="3"><display>(iii)</display>record any encounter that is the subject of a complaint or a legal proceeding <ln numlevel="1" lineno="196" slineno="2-142"/>against a law enforcement officer or law enforcement agency;</subsection><subsection ssid="3-null-80" dnum="iv-o" numlevel="1" lineno="197" slineno="2-143" level="3"><display>(iv)</display>contain an officer involved critical incident as defined in Subsection <xref depth="3" refnumber="76-2-408">76-2-408</xref><ln numlevel="1" lineno="198" slineno="2-144"/>(1)(f); or</subsection><subsection ssid="3-null-81" dnum="v-o" numlevel="1" lineno="199" slineno="2-145" level="3"><display>(v)</display>have been requested for reclassification as a public record by a subject or <ln numlevel="1" lineno="200" slineno="2-146"/>authorized agent of a subject featured in the recording.</subsection></subsection></subsection><subsection ssid="3-null-82" dnum="3-o" numlevel="1" lineno="201" slineno="2-147" level="1" space="false"><display>(3)</display><subsection ssid="3-null-83" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection (3), "medical records" means medical reports, records, <ln numlevel="1" lineno="202" slineno="2-148"/>statements, history, diagnosis, condition, treatment, and evaluation.</subsection><subsection ssid="3-null-84" dnum="b-o" numlevel="1" lineno="203" slineno="2-149" level="2"><display>(b)</display>Medical records in the possession of the University of Utah Hospital, its clinics, <ln numlevel="1" lineno="204" slineno="2-150"/>doctors, or affiliated entities are not private records or controlled records under <ln numlevel="1" lineno="205" slineno="2-151"/>Section <xref depth="3" refnumber="63G-2-304">63G-2-304</xref> when the records are sought:<subsection ssid="3-null-85" dnum="i-o" numlevel="1" lineno="206" slineno="2-152" level="3"><display>(i)</display>in connection with any legal or administrative proceeding in which the patient's <ln numlevel="1" lineno="207" slineno="2-153"/>physical, mental, or emotional condition is an element of any claim or defense; or</subsection><subsection ssid="3-null-86" dnum="ii-o" numlevel="1" lineno="208" slineno="2-154" level="3"><display>(ii)</display>after a patient's death, in any legal or administrative proceeding in which any <ln numlevel="1" lineno="209" slineno="2-155"/>party relies upon the condition as an element of the claim or defense.</subsection></subsection><subsection ssid="3-null-87" dnum="c-o" numlevel="1" lineno="210" slineno="2-156" level="2"><display>(c)</display>Medical records are subject to production in a legal or administrative proceeding <ln numlevel="1" lineno="211" slineno="2-157"/>according to state or federal statutes or rules of procedure and evidence as if the <ln numlevel="1" lineno="212" slineno="2-158"/>medical records were in the possession of a nongovernmental medical care provider.</subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="213" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="213">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="214"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-19-25 5:17 PM</tm></rev></foot></leg>
