Application -- Signed statement -- Consent to creation of a lien -- <ln numlevel="1" lineno="25" slineno="1-3"/>Consent to audit and review -- Notice.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-4" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">For land to be assessed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Before a county assessor may assess land</amend> under this part, an <ln numlevel="1" lineno="27" slineno="1-5"/>owner of land eligible for assessment under this part shall submit <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">annually</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="28" slineno="1-6"/>application described in Subsection <xref refnumber="59-2-1707(2)" depth="4">(2)</xref></amend> to the county assessor of the county in which the <ln numlevel="1" lineno="29" slineno="1-7"/>land is located<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">:</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend><subsection ssid="1-1-2" dnum="a-o:_-i" numlevel="1" lineno="30" slineno="1-8" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1001" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">an application described in Subsection <xref depth="4" refnumber="59-2-1707(2)" start="0">(2)</xref>; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-3" dnum="b-o:_-i" numlevel="1" lineno="31" slineno="1-9" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1002" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="21" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">a renewal application described in Subsection <xref depth="4" refnumber="59-2-1707(3)" start="0">(3)</xref> if:</amend><amendoutend style="2"/><subsection ssid="1-1-4" dnum="i-o:_-i" numlevel="1" lineno="32" slineno="1-10" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="24" groupid="18" style="2" owner="jchristopherson" level="1" deltag="end">the land was assessed under this part for the preceding tax year; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-5" dnum="ii-o:_-i" numlevel="1" lineno="33" slineno="1-11" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="25" groupid="19" style="2" owner="jchristopherson" level="1" deltag="end">there have been no changes to the eligibility information provided in the most <ln numlevel="1" lineno="34" slineno="1-12"/>recently submitted application described in Subsection <xref depth="4" refnumber="59-2-1707(2)" start="0">(2)</xref>, other than the information <ln numlevel="1" lineno="35" slineno="1-13"/>described in Subsection <xref depth="4" refnumber="59-2-1703(2)(b)" start="0">59-2-1703(2)(b)</xref>.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="1-1-6" dnum="2-o" numlevel="1" lineno="36" slineno="1-14" level="1"><display>(2)</display>An application required by Subsection <xref depth="4" refnumber="59-2-1707(1)" start="0">(1)</xref> shall:<subsection ssid="1-1-7" dnum="a-o" numlevel="1" lineno="37" slineno="1-15" level="2"><display>(a)</display>be on a form:<subsection ssid="1-1-8" dnum="i-o" numlevel="1" lineno="38" slineno="1-16" level="3"><display>(i)</display>approved by the commission; and</subsection><subsection ssid="1-1-9" dnum="ii-o" numlevel="1" lineno="39" slineno="1-17" level="3"><display>(ii)</display>provided to an owner:<subsection ssid="1-1-10" dnum="A-o" numlevel="1" lineno="40" slineno="1-18" level="4"><display>(A)</display>by the county assessor; and</subsection><subsection ssid="1-1-11" dnum="B-o" numlevel="1" lineno="41" slineno="1-19" level="4"><display>(B)</display>at the request of an owner;</subsection></subsection></subsection><subsection ssid="1-1-12" dnum="b-o" numlevel="1" lineno="42" slineno="1-20" level="2"><display>(b)</display>provide for the reporting of information related to this part;</subsection><subsection ssid="1-1-13" dnum="c-o" numlevel="1" lineno="43" slineno="1-21" level="2"><display>(c)</display>be submitted by:<subsection ssid="1-1-14" dnum="i-o" numlevel="1" lineno="44" slineno="1-22" level="3"><display>(i)</display>May 1 of the tax year in which assessment under Subsection <xref depth="4" refnumber="59-2-1707(1)" start="0">(1)</xref> is requested if the <ln numlevel="1" lineno="45" slineno="1-23"/>land was not assessed under this part in the year before the application is <ln numlevel="1" lineno="46" slineno="1-24"/>submitted; or</subsection><subsection ssid="1-1-15" dnum="ii-o" numlevel="1" lineno="47" slineno="1-25" level="3"><display>(ii)</display>the date otherwise required by this part for land that before the application being <ln numlevel="1" lineno="48" slineno="1-26"/>submitted has been assessed under this part;</subsection></subsection><subsection ssid="1-1-16" dnum="d-o" numlevel="1" lineno="49" slineno="1-27" level="2"><display>(d)</display>be signed by all of the owners of the land that under the application would be <ln numlevel="1" lineno="50" slineno="1-28"/>assessed under this part;</subsection><subsection ssid="1-1-17" dnum="e-o" numlevel="1" lineno="51" slineno="1-29" level="2"><display>(e)</display>be accompanied by the prescribed fees made payable to the county recorder;</subsection><subsection ssid="1-1-18" dnum="f-o" numlevel="1" lineno="52" slineno="1-30" level="2"><display>(f)</display>include a certification by an owner that the facts set forth in the application or signed <ln numlevel="1" lineno="53" slineno="1-31"/>statement are true;</subsection><subsection ssid="1-1-19" dnum="g-o" numlevel="1" lineno="54" slineno="1-32" level="2"><display>(g)</display>include a statement that the application constitutes consent by the owners of the land <ln numlevel="1" lineno="55" slineno="1-33"/>to the creation of a lien upon the land as provided in this part; and</subsection><subsection ssid="1-1-20" dnum="h-o" numlevel="1" lineno="56" slineno="1-34" level="2"><display>(h)</display>be recorded by the county recorder.</subsection></subsection><subsection ssid="1-1-21" dnum="3-o:_-i" numlevel="1" lineno="57" slineno="1-35" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="start">(3)</amend></display><amend anum="0" ea="erase" pairid="60" groupid="35" style="2" owner="jchristopherson" level="1" deltag="end">A renewal application required by Subsection <xref depth="4" refnumber="59-2-1707(1)" start="0">(1)</xref> shall:</amend><amendoutend style="2"/><subsection ssid="1-1-22" dnum="a-o:_-i" numlevel="1" lineno="58" slineno="1-36" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="63" groupid="38" style="2" owner="jchristopherson" level="1" deltag="end">be on a form:</amend><amendoutend style="2"/><subsection ssid="1-1-23" dnum="i-o:_-i" numlevel="1" lineno="59" slineno="1-37" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="64" groupid="39" style="2" owner="jchristopherson" level="1" deltag="end">approved by the commission; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-24" dnum="ii-o:_-i" numlevel="1" lineno="60" slineno="1-38" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="65" groupid="40" style="2" owner="jchristopherson" level="1" deltag="end">provided to an owner:</amend><amendoutend style="2"/><subsection ssid="1-1-25" dnum="A-o:_-i" numlevel="1" lineno="61" slineno="1-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="start">(A)</amend></display><amend anum="0" ea="erase" pairid="66" groupid="41" style="2" owner="jchristopherson" level="1" deltag="end">by the county assessor; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-26" dnum="B-o:_-i" numlevel="1" lineno="62" slineno="1-40" ea="erase" anum="0" owner="jchristopherson" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1025" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="67" groupid="42" style="2" owner="jchristopherson" level="1" deltag="end">at the request of an owner;</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="1-1-27" dnum="b-o:_-i" numlevel="1" lineno="63" slineno="1-41" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="68" groupid="43" style="2" owner="jchristopherson" level="1" deltag="end">provide for the reporting of the information described in Subsection <xref depth="4" refnumber="59-2-1703(2)(b)" start="0">59-2-1703(2)(b)</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-28" dnum="c-o:_-i" numlevel="1" lineno="64" slineno="1-42" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1027" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="71" groupid="46" style="2" owner="jchristopherson" level="1" deltag="end">be submitted on or before January 30 of the tax year in which the owner requests <ln numlevel="1" lineno="65" slineno="1-43"/>assessment under this part;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-29" dnum="d-o:_-i" numlevel="1" lineno="66" slineno="1-44" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="72" groupid="47" style="2" owner="jchristopherson" level="1" deltag="end">be signed by all of the owners of the land;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-30" dnum="e-o:_-i" numlevel="1" lineno="67" slineno="1-45" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="start">(e)</amend></display><amend anum="0" ea="erase" pairid="73" groupid="48" style="2" owner="jchristopherson" level="1" deltag="end">be accompanied by the prescribed fees made payable to the county recorder;</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-31" dnum="f-o:_-i" numlevel="1" lineno="68" slineno="1-46" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="start">(f)</amend></display><amend anum="0" ea="erase" pairid="74" groupid="49" style="2" owner="jchristopherson" level="1" deltag="end">include a certification by an owner that the following are true:</amend><amendoutend style="2"/><subsection ssid="1-1-32" dnum="i-o:_-i" numlevel="1" lineno="69" slineno="1-47" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="75" groupid="50" style="2" owner="jchristopherson" level="1" deltag="end">the facts set forth in the renewal application or signed statement; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-33" dnum="ii-o:_-i" numlevel="1" lineno="70" slineno="1-48" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="76" groupid="51" style="2" owner="jchristopherson" level="1" deltag="end">other than the information described in Subsection <xref depth="4" refnumber="59-2-1703(2)(b)" start="0">59-2-1703(2)(b)</xref>, the facts set forth <ln numlevel="1" lineno="71" slineno="1-49"/>in the most recently submitted application described in Subsection <xref depth="4" refnumber="59-2-1707(2)" start="0">(2)</xref>, as of the date the <ln numlevel="1" lineno="72" slineno="1-50"/>renewal application is submitted;</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-1-34" dnum="g-o:_-i" numlevel="1" lineno="73" slineno="1-51" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="start">(g)</amend></display><amend anum="0" ea="erase" pairid="81" groupid="56" style="2" owner="jchristopherson" level="1" deltag="end">include a statement that the renewal application constitutes consent by the owners of <ln numlevel="1" lineno="74" slineno="1-52"/>the land to the creation of a lien upon the land as provided in this part; and</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-35" dnum="h-o:_-i" numlevel="1" lineno="75" slineno="1-53" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1034" style="2" owner="o" level="1" deltag="start">(h)</amend></display><amend anum="0" ea="erase" pairid="82" groupid="57" style="2" owner="jchristopherson" level="1" deltag="end">be recorded by the county recorder.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-1-36" dnum="4-o:3-i" numlevel="1" lineno="76" slineno="1-54" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1035" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>An application described in Subsection <xref depth="4" refnumber="59-2-1707(2)" start="0">(2)</xref> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="91" groupid="66" style="2" owner="jchristopherson" level="1" deltag="both">or a renewal application described in <ln numlevel="1" lineno="77" slineno="1-55"/>Subsection <xref depth="4" refnumber="59-2-1707(3)" start="0">(3)</xref> </amend><amendoutend style="2"/>constitutes consent by the owners of the land to the creation of a lien <ln numlevel="1" lineno="78" slineno="1-56"/>upon the land as provided in this part.</subsection><subsection ssid="1-1-37" dnum="5-o:4-i" numlevel="1" lineno="79" slineno="1-57" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1036" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="1-1-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the county determines that a timely filed application<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="94" groupid="69" style="2" owner="jchristopherson" level="1" deltag="both"> or a timely filed <ln numlevel="1" lineno="80" slineno="1-58"/>renewal application</amend><amendoutend style="2"/> is incomplete, the county shall:<subsection ssid="1-1-39" dnum="i-o" numlevel="1" lineno="81" slineno="1-59" level="3" tab="1"><display>(i)</display>notify the owner of the incomplete application<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="95" groupid="70" style="2" owner="jchristopherson" level="1" deltag="both"> or renewal application</amend><amendoutend style="2"/>; and</subsection><subsection ssid="1-1-40" dnum="ii-o" numlevel="1" lineno="82" slineno="1-60" level="3" tab="1"><display>(ii)</display>allow the owner to complete the application<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="96" groupid="71" style="2" owner="jchristopherson" level="1" deltag="both"> or renewal application</amend><amendoutend style="2"/> within 30 <ln numlevel="1" lineno="83" slineno="1-61"/>days from the day on which the county provides notice to the owner.</subsection></subsection><subsection ssid="1-1-41" dnum="b-o" numlevel="1" lineno="84" slineno="1-62" level="2"><display>(b)</display>An application that has not been completed within 30 days of the day of the notice <ln numlevel="1" lineno="85" slineno="1-63"/>described in Subsection <xref depth="4" refnumber="59-2-1707(5)(a)" start="0">(5)(a)</xref> <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="97" groupid="72" style="2" owner="jchristopherson" level="1" deltag="both">shall be</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="87" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">is</amend> considered denied.</subsection></subsection><subsection ssid="1-1-42" dnum="6-o:5-i" numlevel="1" lineno="86" slineno="1-64" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display><subsection ssid="1-1-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="99" groupid="74" style="2" owner="jchristopherson" level="1" deltag="both">Except as provided in Subsections <xref depth="4" refnumber="59-2-1707(1)" start="0">(1)</xref> through <xref depth="4" refnumber="59-2-1707(3)" start="0">(3)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="88" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Once the application <ln numlevel="1" lineno="87" slineno="1-65"/>required by Subsection (1) has been approved, the</amend> county assessor may <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="114" groupid="82" style="2" owner="jchristopherson" level="1" deltag="both">not require <ln numlevel="1" lineno="88" slineno="1-66"/>an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="113" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="1-59" dnum="_-o:i-i" numlevel="1" lineno="89" slineno="1-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="120" style="1" owner="jchristopherson" level="1" amendtag="end">require, by written request of the county assessor, the owner to submit a new <ln numlevel="1" lineno="90" slineno="1-68"/>application or a signed statement that verifies that the land qualifies for <ln numlevel="1" lineno="91" slineno="1-69"/>assessment under this part; or</amend></subsection><subsection ssid="1-58" dnum="_-o:ii-i" numlevel="1" lineno="92" slineno="1-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="114" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection (5)(b), require no</amend> additional signed statement or <ln numlevel="1" lineno="93" slineno="1-71"/>application for assessment under this part.</subsection></subsection><subsection ssid="1-1-44" dnum="b-o" numlevel="1" lineno="94" slineno="1-72" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="122" groupid="89" style="2" owner="jchristopherson" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="59-2-1707(6)(a)" start="0">(6)(a)</xref>, a county</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="120" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A county assessor</amend> shall require that<amend anum="0" ea="amend" pairid="121" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="1-55" dnum="_-o:i-i" numlevel="1" lineno="95" slineno="1-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>an owner provide notice if land is withdrawn from this part as provided in Section <xref depth="3" refnumber="59-2-1705" start="0"><ln numlevel="1" lineno="96" slineno="1-74"/>59-2-1705</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="135" groupid="101" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="133" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="1-56" dnum="_-o:ii-i" numlevel="1" lineno="97" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">a new owner submit an application in accordance with this section.</amend></subsection></subsection><subsection ssid="1-57" dnum="_-o:c-i" numlevel="1" lineno="98" slineno="1-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="140" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">An owner shall submit an application or signed statement required under Subsection <ln numlevel="1" lineno="99" slineno="1-77"/>(5)(a) by the date specified in the written request of the county assessor for the <ln numlevel="1" lineno="100" slineno="1-78"/>application or signed statement.</amend></subsection></subsection><subsection ssid="1-1-45" dnum="7-o:6-i" numlevel="1" lineno="101" slineno="1-79" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>A certification under Subsection <xref depth="4" refnumber="59-2-1707(2)(f)" start="0">(2)(f)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="147" groupid="109" style="2" owner="jchristopherson" level="1" deltag="both"> or <xref depth="4" refnumber="59-2-1707(3)(f)" start="0">(3)(f)</xref></amend><amendoutend style="2"/> is considered as if made under <ln numlevel="1" lineno="102" slineno="1-80"/>oath and subject to the same penalties as provided by law for perjury.</subsection><subsection ssid="1-1-46" dnum="8-o:7-i" numlevel="1" lineno="103" slineno="1-81" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="1-1-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An owner applying for participation under this part or a purchaser or lessee <ln numlevel="1" lineno="104" slineno="1-82"/>that signs a statement under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="148" groupid="110" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="59-2-1707(9)" start="0">(9)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="145" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)</amend> is considered to have given consent <ln numlevel="1" lineno="105" slineno="1-83"/>to a field audit and review by:<subsection ssid="1-1-48" dnum="i-o" numlevel="1" lineno="106" slineno="1-84" level="3" tab="1"><display>(i)</display>the commission;</subsection><subsection ssid="1-1-49" dnum="ii-o" numlevel="1" lineno="107" slineno="1-85" level="3" tab="1"><display>(ii)</display>the county assessor; or</subsection><subsection ssid="1-1-50" dnum="iii-o" numlevel="1" lineno="108" slineno="1-86" level="3" tab="1"><display>(iii)</display>the commission and the county assessor.</subsection></subsection><subsection ssid="1-1-51" dnum="b-o" numlevel="1" lineno="109" slineno="1-87" level="2"><display>(b)</display>The consent described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="149" groupid="111" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="59-2-1707(8)(a)" start="0">(8)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="146" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)(a)</amend> is a condition to the acceptance of <ln numlevel="1" lineno="110" slineno="1-88"/>an application or signed statement.</subsection></subsection><subsection ssid="1-1-52" dnum="9-o:8-i" numlevel="1" lineno="111" slineno="1-89" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>An owner of land eligible for assessment under this part, because a purchaser or <ln numlevel="1" lineno="112" slineno="1-90"/>lessee actively devotes the land to agricultural use as required by Section <xref depth="3" refnumber="59-2-1703" start="0">59-2-1703</xref>, <ln numlevel="1" lineno="113" slineno="1-91"/>may qualify the land for assessment under this part by submitting, with the application <ln numlevel="1" lineno="114" slineno="1-92"/>described in Subsection <xref depth="4" refnumber="59-2-1707(2)" start="0">(2)</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="151" groupid="113" style="2" owner="jchristopherson" level="1" deltag="both"> or the renewal application described in Subsection <xref depth="4" refnumber="59-2-1707(3)" start="0">(3)</xref></amend><amendoutend style="2"/>, a <ln numlevel="1" lineno="115" slineno="1-93"/>signed statement from that purchaser or lessee certifying those facts that would be <ln numlevel="1" lineno="116" slineno="1-94"/>necessary to meet the requirements of Section <xref depth="3" refnumber="59-2-1703" start="0">59-2-1703</xref> for assessment under this part.</subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="117" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="117">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="118"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec><bsec buid="3" type="uncod" untype="retro" src="uncod" uid="REO0000" sort="UZF" langlock="false" numlevel="1" lineno="119" slineno="3-1" sn="3"><section type="uncod" untype="retro" display="false" src="uncod"><secline lineno="119">Section 3.  <bold>Retrospective operation.</bold></secline><sectionText lineno="120"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill has retrospective operation to January 1, 2025.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-14-25 2:15 PM</tm></rev></foot></leg>
