Neil Walter</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to homeowners' associations.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">establishes the Office of the Homeowners' Association Ombudsman;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">establishes the duties, jurisdiction, and functions of the Office of the Homeowners' <ln numlevel="1" lineno="11" slineno="0-11"/>Association Ombudsman;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">requires the Office of the Homeowners' Association Ombudsman to issue an advisory <ln numlevel="1" lineno="13" slineno="0-13"/>opinion under certain circumstances;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">provides the circumstances under which an advisory opinion of the Office of the <ln numlevel="1" lineno="15" slineno="0-15"/>Homeowners' Association Ombudsman is admissible in a subsequent proceeding;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes void and unenforceable a homeowners' association transfer fee;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">establishes requirements for a homeowners' association to impose a reinvestment fee;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">changes requirements for amending governing documents;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">sets limits on the amount a homeowners' association may charge as a late fee;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">requires that a homeowners' association provide, upon request, certain documents;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">prohibits a declarant from selling a part of a common area during the period of <ln numlevel="1" lineno="22" slineno="0-22"/>administrative control under certain circumstances; Office of the Homeowners' Association Ombudsman</headpart><catline lineno="49"><bold>13-75-101. Definitions.</bold></catline><sectionText lineno="50"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="7-2" dnum="_-o:1-i" numlevel="1" lineno="51" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"Association of lot owners" means an association as that term is defined in Section <xref depth="3" refnumber="57-8a-102"><ln numlevel="1" lineno="52" Creation of Office of the Homeowners' Association Ombudsman.</bold></catline><subsection ssid="8-1" dnum="_-o:1-i" numlevel="1" lineno="65" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">There is created an Office of the Homeowners' Association Ombudsman in the <ln numlevel="1" lineno="66" slineno="2-4"/>department.</amend></subsection><subsection ssid="8-2" dnum="_-o:2-i" numlevel="1" lineno="67" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The executive director of the department shall appoint attorneys with background or <ln numlevel="1" lineno="68" slineno="2-6"/>expertise in real estate law to fill legal positions within the office in the department.</amend></subsection><subsection ssid="8-3" dnum="_-o:3-i" numlevel="1" lineno="69" slineno="2-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">An individual appointed under this section is an exempt employee.</amend></subsection></section></bsec><bsec buid="12" type="enact" src="code" num="13-75-103" uid="C13-75-S103_2025050720250507" sort="13 75 01030020250507" style="" numlevel="1" lineno="70" slineno="3-1" sn="3"><section number="13-75-103" numlevel="1" lineno="71" slineno="3-2" type="enact"><secline lineno="70">Section 3, Section <bold>13-75-103</bold> is enacted to read:</secline><catline lineno="71"><bold>13-75-103. and</amend></subsection><subsection ssid="12-3" dnum="_-o:b-i" numlevel="1" lineno="75" slineno="3-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">upon request:</amend><subsection ssid="12-4" dnum="_-o:i-i" numlevel="1" lineno="76" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">analyze a complaint from a lot owner, a unit owner, an association of lot owners, <ln numlevel="1" lineno="77" slineno="3-8"/>or an association of unit owners regarding the unlawful conduct of a lot owner, a <ln numlevel="1" lineno="78" slineno="3-9"/>unit owner, an association of lot owners, or an association of unit owners; and</amend></subsection><subsection ssid="12-21" dnum="_-o:b-i" numlevel="1" lineno="92" slineno="3-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">may not provide any service that requires interpreting the governing documents of an <ln numlevel="1" lineno="93" slineno="3-24"/>association of lot owners or the governing documents of an association of unit <ln numlevel="1" lineno="94" slineno="3-25"/>owners, unless the complaint alleges the governing documents of an association of lot <ln numlevel="1" lineno="95" slineno="3-26"/>owners or the governing documents of an association of unit owners contain at least <ln numlevel="1" lineno="96" slineno="3-27"/>one provision that violates the law.</amend></subsection></subsection></section></bsec><bsec buid="13" type="enact" src="code" num="13-75-104" uid="C13-75-S104_2025050720250507" sort="13 75 01040020250507" style="" numlevel="1" lineno="97" slineno="4-1" sn="4"><section number="13-75-104" numlevel="1" lineno="98" slineno="4-2" type="enact"><secline lineno="97">Section 4, Section <bold>13-75-104</bold> is enacted to read:</secline><catline lineno="98"><bold>13-75-104. style="1" owner="jchristopherson" level="1" amendtag="end">A lot owner, a unit owner, an association of lot owners, or an association of unit owners <ln numlevel="1" lineno="100" slineno="4-4"/>may groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">Title 57, Chapter 8, Condominium Ownership Act, and Title 57, Chapter 8a, <ln numlevel="1" lineno="103" slineno="4-7"/>Community Association Act; or</amend></subsection><subsection ssid="13-10" dnum="_-o:ii-i" numlevel="1" lineno="104" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend amendtag="end">other applicable laws of this state; and</amend></subsection></subsection><subsection ssid="13-11" dnum="_-o:b-i" numlevel="1" lineno="105" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">at any time before a court with jurisdiction issues a final decision regarding the issue <ln numlevel="1" lineno="106" slineno="4-10"/>of the requested opinion.</amend></subsection></subsection><subsection ssid="13-12" dnum="_-o:2-i" numlevel="1" lineno="107" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">A person making a request for an advisory opinion described in Subsection (1) shall:</amend><subsection ssid="13-13" dnum="_-o:a-i" numlevel="1" lineno="108" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">file the request with the office; and</amend></subsection><subsection ssid="13-14" dnum="_-o:b-i" numlevel="1" lineno="109" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">pay a filing fee of $150.</amend></subsection></subsection><subsection ssid="13-15" dnum="_-o:3-i" numlevel="1" lineno="110" slineno="4-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">The office may establish policies providing for partial fee waivers for a person who is <ln numlevel="1" lineno="111" slineno="4-15"/>financially unable to pay the entire fee described in Subsection (2)(b).</amend></subsection><subsection ssid="13-16" dnum="_-o:4-i" numlevel="1" lineno="112" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="13-45" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">The office may not issue an advisory opinion unless the person requesting an <ln numlevel="1" lineno="113" slineno="4-17"/>advisory opinion exhausts all existing remedies provided in:</amend><subsection ssid="13-50" dnum="_-o:i-i" numlevel="1" lineno="114" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">the governing documents of an association of lot owners, if the dispute involves a <ln numlevel="1" lineno="115" slineno="4-19"/>lot owner; or</amend></subsection><subsection ssid="13-52" dnum="_-o:ii-i" numlevel="1" lineno="116" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="106" style="1" owner="jchristopherson" level="1" amendtag="end">the governing documents of an association of unit owners, if the dispute involves <ln numlevel="1" lineno="117" slineno="4-21"/>a unit owner.</amend></subsection></subsection><subsection ssid="13-46" dnum="_-o:b-i" numlevel="1" lineno="118" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">A person requesting an advisory opinion shall include in the person's complaint a <ln numlevel="1" lineno="119" slineno="4-23"/>description of how that person exhausted all existing remedies provided in the <ln numlevel="1" lineno="120" slineno="4-24"/>applicable governing documents.</amend></subsection></subsection><subsection ssid="13-17" dnum="_-o:5-i" numlevel="1" lineno="121" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">Upon receipt of a request for an advisory opinion, the office shall:</amend><subsection ssid="13-19" dnum="_-o:a-i" numlevel="1" lineno="122" slineno="4-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">inquire of all parties if there are other necessary parties to the dispute; and</amend></subsection><subsection ssid="13-20" dnum="_-o:b-i" numlevel="1" lineno="123" slineno="4-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">deliver notice of the request to the opposing parties indicated in the request and any <ln numlevel="1" lineno="124" slineno="4-28"/>other necessary party identified in accordance with Subsection <xref refnumber="13-75-104(5)(a)" depth="4">(5)(a)</xref>.</amend></subsection></subsection><subsection ssid="13-21" dnum="_-o:6-i" numlevel="1" lineno="125" slineno="4-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection (7), after analyzing a complaint, the office shall:</amend><subsection ssid="13-22" dnum="_-o:a-i" numlevel="1" lineno="126" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="end">issue a written advisory opinion addressing the issues described in the request for an <ln numlevel="1" lineno="127" slineno="4-31"/>advisory opinion;</amend></subsection><subsection ssid="13-23" dnum="_-o:b-i" numlevel="1" lineno="128" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">include in the advisory opinion a statement of the facts and law supporting the <ln numlevel="1" lineno="129" slineno="4-33"/>opinion's conclusions; and</amend></subsection><subsection ssid="13-24" dnum="_-o:c-i" numlevel="1" lineno="130" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="end">deliver copies of the advisory opinion to all necessary parties identified in <ln numlevel="1" lineno="131" slineno="4-35"/>accordance with Subsection <xref refnumber="13-75-104(5)(a)" depth="4">(5)(a)</xref>.</amend></subsection></subsection><subsection ssid="13-25" dnum="_-o:7-i" numlevel="1" lineno="132" slineno="4-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><subsection ssid="13-26" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">The office shall issue a written statement declining to issue an advisory opinion <ln numlevel="1" lineno="133" slineno="4-37"/>when, in the opinion of the office:</amend><subsection ssid="13-27" dnum="_-o:i-i" numlevel="1" lineno="134" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="94" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">the issues are not ripe for review; or</amend></subsection><subsection ssid="13-28" dnum="_-o:ii-i" numlevel="1" lineno="135" slineno="4-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">the issues raised are beyond the scope of the office's statutory duty to review.</amend></subsection></subsection><subsection ssid="13-29" dnum="_-o:b-i" numlevel="1" lineno="136" slineno="4-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">Notwithstanding Subsection (7)(a), the office is not required to issue a written <ln numlevel="1" lineno="137" slineno="4-41"/>statement, and may decline to review a request, if the request deals solely with a <ln numlevel="1" lineno="138" slineno="4-42"/>contractual dispute.</amend></subsection></subsection><subsection ssid="13-30" dnum="_-o:8-i" numlevel="1" lineno="139" slineno="4-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="end">The party that requests the advisory opinion shall pay the filing fee described in <ln numlevel="1" lineno="140" slineno="4-44"/>Subsection <xref refnumber="13-75-104(2)(b)" depth="4">(2)(b)</xref>, unless the office issues an advisory opinion in favor of the party that <ln numlevel="1" lineno="141" slineno="4-45"/>requests the advisory opinion, in which case all necessary parties shall share the cost of <ln numlevel="1" lineno="142" slineno="4-46"/>the filing fee equally.</amend></subsection><subsection ssid="13-44" dnum="_-o:9-i" numlevel="1" lineno="143" slineno="4-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">An advisory opinion issued as described in Subsection (6) is neither binding on any <ln numlevel="1" lineno="144" slineno="4-48"/>party to, nor admissible as evidence in, a dispute involving an association of lot owners <ln numlevel="1" lineno="145" slineno="4-49"/>or an association of unit owners, except as provided in Subsection <xref refnumber="13-75-104(10)" depth="4">(10)</xref>.</amend></subsection><subsection ssid="13-32" dnum="_-o:10-i" numlevel="1" lineno="146" slineno="4-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><subsection ssid="13-48" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this Subsection <xref refnumber="13-75-104(10)" depth="4">(10)</xref>, "qualifying conditions" means the office issues <ln numlevel="1" lineno="147" slineno="4-51"/>an advisory opinion described in this section, the same issue that is the subject of the <ln numlevel="1" lineno="148" slineno="4-52"/>advisory opinion is subsequently litigated in court, and the court rules in favor of the <ln numlevel="1" lineno="149" slineno="4-53"/>same party as the advisory opinion in a final judgment.</amend></subsection><subsection ssid="13-49" dnum="_-o:b-i" numlevel="1" lineno="150" slineno="4-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">If the qualifying conditions are met, the court may award the substantially prevailing <ln numlevel="1" lineno="151" slineno="4-55"/>party:</amend><subsection ssid="13-33" dnum="_-o:i-i" numlevel="1" lineno="152" slineno="4-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">reasonable attorney fees and court costs relating to the development of the cause <ln numlevel="1" lineno="153" slineno="4-57"/>of action from the date the office delivers the advisory opinion to the date of the <ln numlevel="1" lineno="154" slineno="4-58"/>court's resolution; and</amend></subsection><subsection ssid="13-34" dnum="_-o:ii-i" numlevel="1" lineno="155" slineno="4-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">if the court finds that the opposing party knowingly and intentionally violated the <ln numlevel="1" lineno="156" slineno="4-60"/>law governing the cause of action, a civil penalty of $250 for each day described <ln numlevel="1" lineno="157" slineno="4-61"/>in Subsection <xref tempid="216" depth="4" refnumber="13-75-104(11)">(11)</xref>.</amend></subsection></subsection></subsection><subsection ssid="13-37" dnum="_-o:11-i" numlevel="1" lineno="158" slineno="4-62" ea="amend" anum="0" and</subsection><subsection ssid="6-20" dnum="ii-o" numlevel="1" lineno="201" slineno="5-38" level="3"><display>(ii)</display>that includes a commitment to fund, construct, develop, or maintain:<subsection ssid="6-21" dnum="A-o" numlevel="1" lineno="202" slineno="5-39" level="4"><display>(A)</display>common infrastructure;</subsection><subsection ssid="6-22" dnum="B-o" numlevel="1" lineno="203" slineno="5-40" level="4"><display>(B)</display>association facilities;</subsection><subsection ssid="6-23" dnum="C-o" numlevel="1" lineno="204" slineno="5-41" level="4"><display>(C)</display>community programming;</subsection><subsection ssid="6-24" dnum="D-o" numlevel="1" lineno="205" slineno="5-42" level="4"><display>(D)</display>resort facilities;</subsection><subsection ssid="6-25" dnum="E-o" numlevel="1" lineno="206" slineno="5-43" level="4"><display>(E)</display>open space; or</subsection><subsection ssid="6-26" dnum="F-o" numlevel="1" lineno="207" slineno="5-44" level="4"><display>(F)</display>recreation amenities.</subsection></subsection></subsection><subsection ssid="6-27" dnum="g-o:h-i" numlevel="1" lineno="208" slineno="5-45" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1093" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>"Nonprofit association" means a nonprofit corporation organized under Title 16, <ln numlevel="1" lineno="209" slineno="5-46"/>Chapter 6a, Utah Revised Nonprofit Corporation Act, to benefit, enhance, preserve, <ln numlevel="1" lineno="210" slineno="5-47"/>govern, manage, or maintain burdened property.</subsection><subsection ssid="6-28" dnum="h-o:i-i" numlevel="1" lineno="211" slineno="5-48" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1094" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1095" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>"Organizational documents"<amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both"> means</amend>:<subsection ssid="6-29" dnum="i-o" numlevel="1" lineno="212" slineno="5-49" level="3"><display>(i)</display>for an association, as defined in Section <xref depth="3" refnumber="57-8a-102">57-8a-102</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">means </amend><amendoutend style="2"/>governing documents <ln numlevel="1" lineno="213" slineno="5-50"/>as defined in Section <xref depth="3" refnumber="57-8a-102">57-8a-102</xref>;</subsection><subsection ssid="6-30" dnum="ii-o" numlevel="1" lineno="214" slineno="5-51" level="3"><display>(ii)</display>for an association of unit owners, as defined in Section <xref depth="3" refnumber="57-8-3">57-8-3</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">means </amend><amendoutend style="2"/>a <ln numlevel="1" lineno="215" slineno="5-52"/>declaration as defined in Section <xref depth="3" refnumber="57-8-3">57-8-3</xref>; and</subsection><subsection ssid="6-31" dnum="iii-o" numlevel="1" lineno="216" slineno="5-53" level="3"><display>(iii)</display>for a nonprofit association:<subsection ssid="6-32" dnum="A-o" numlevel="1" lineno="217" slineno="5-54" level="4"><display>(A)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">means </amend><amendoutend style="2"/>a written instrument by which the nonprofit association exercises <ln numlevel="1" lineno="218" slineno="5-55"/>powers or manages, maintains, or otherwise affects the property under the <ln numlevel="1" lineno="219" slineno="5-56"/>jurisdiction of the nonprofit association; or</amend></subsection><subsection ssid="6-131" dnum="_-o:H-i" numlevel="1" lineno="234" slineno="5-71" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="i" level="1" amendtag="start">(H)</amend></display><amend anum="0" ea="amend" pairid="218" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">association expenses.</amend></subsection></subsection></subsection><subsection ssid="6-34" dnum="i-o:k-i" numlevel="1" lineno="235" slineno="5-72" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1112" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1113" style="1" owner="i" level="1" amendtag="both" space="true">(k)</amend></display>"Reinvestment fee covenant" means a covenant, restriction, or agreement that:<subsection ssid="6-35" dnum="i-o" numlevel="1" lineno="236" slineno="5-73" level="3"><display>(i)</display>affects real property; and</subsection><subsection ssid="6-36" dnum="ii-o" numlevel="1" lineno="237" slineno="5-74" level="3"><display>(ii)</display>obligates a future buyer or seller of the real property to pay to a common interest <ln numlevel="1" lineno="238" slineno="5-75"/>association, upon and as a result of a transfer of the real property, a fee that is <ln numlevel="1" lineno="239" slineno="5-76"/>dedicated to benefitting the burdened property, including payment for:<subsection ssid="6-37" dnum="A-o" numlevel="1" lineno="240" slineno="5-77" level="4"><display>(A)</display>common planning, facilities, and infrastructure;</subsection><subsection ssid="6-38" dnum="B-o" numlevel="1" lineno="241" slineno="5-78" level="4"><display>(B)</display>obligations arising from an environmental covenant;</subsection><subsection ssid="6-39" dnum="C-o" numlevel="1" lineno="242" slineno="5-79" level="4"><display>(C)</display>community programming;</subsection><subsection ssid="6-40" dnum="D-o" numlevel="1" lineno="243" slineno="5-80" level="4"><display>(D)</display>resort facilities;</subsection><subsection ssid="6-41" dnum="E-o" numlevel="1" lineno="244" slineno="5-81" level="4"><display>(E)</display>open space;</subsection><subsection ssid="6-42" dnum="F-o" numlevel="1" lineno="245" slineno="5-82" level="4"><display>(F)</display>recreation amenities;</subsection><subsection ssid="6-43" dnum="G-o" numlevel="1" lineno="246" slineno="5-83" level="4"><display>(G)</display>charitable purposes; or</subsection><subsection ssid="6-44" dnum="H-o" numlevel="1" lineno="247" slineno="5-84" level="4"><display>(H)</display>association expenses.</subsection></subsection></subsection><subsection ssid="6-45" dnum="j-o:l-i" numlevel="1" lineno="248" slineno="5-85" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1123" style="2" owner="o" level="1" deltag="both">(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1124" style="1" owner="i" level="1" amendtag="both" space="true">(l)</amend></display>"Transfer fee covenant":<subsection ssid="6-46" dnum="i-o" numlevel="1" lineno="249" slineno="5-86" level="3"><display>(i)</display>means an obligation, however denominated, expressed in a covenant, restriction, <ln numlevel="1" lineno="250" slineno="5-87"/>agreement, or other instrument or document:<subsection ssid="6-47" dnum="A-o" numlevel="1" lineno="251" slineno="5-88" level="4"><display>(A)</display>that affects real property;</subsection><subsection ssid="6-48" dnum="B-o" numlevel="1" lineno="252" slineno="5-89" level="4"><display>(B)</display>that is imposed on a future buyer or seller of real property, other than a person <ln numlevel="1" lineno="253" slineno="5-90"/>who is a party to the covenant, restriction, agreement, or other instrument or <ln numlevel="1" lineno="254" slineno="5-91"/>document; and</subsection><subsection ssid="6-49" dnum="C-o" numlevel="1" lineno="255" slineno="5-92" level="4"><display>(C)</display>to pay a fee upon and as a result of a transfer of the real property; and</subsection></subsection><subsection ssid="6-50" dnum="ii-o" numlevel="1" lineno="256" slineno="5-93" level="3"><display>(ii)</display>does not include:<subsection ssid="6-51" dnum="A-o" numlevel="1" lineno="257" slineno="5-94" level="4"><display>(A)</display>an obligation imposed by a court judgment, order, or decree;</subsection><subsection ssid="6-52" dnum="B-o" numlevel="1" lineno="258" slineno="5-95" level="4"><display>(B)</display>an obligation imposed by the federal government or a state or local <ln numlevel="1" lineno="259" slineno="5-96"/>government entity; or</subsection><subsection ssid="6-53" dnum="C-o" numlevel="1" lineno="260" slineno="5-97" level="4"><display>(C)</display>a reinvestment fee covenant.</subsection></subsection></subsection></subsection><subsection ssid="6-54" dnum="2-o" numlevel="1" lineno="261" slineno="5-98" level="1"><display>(2)</display>A transfer fee covenant recorded on or after March 16, 2010<amend anum="0" ea="amend" pairid="240" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> is void and unenforceable.</subsection><subsection ssid="6-55" dnum="3-o" numlevel="1" lineno="262" slineno="5-99" level="1" space="false"><display>(3)</display><subsection ssid="6-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (3)(b), a reinvestment fee covenant may not be <ln numlevel="1" lineno="263" slineno="5-100"/>sold, assigned, or conveyed unless the sale, assignment, or conveyance is to a <ln numlevel="1" lineno="264" slineno="5-101"/>common interest association that was formed to benefit the burdened property.</subsection><subsection ssid="6-57" dnum="b-o" numlevel="1" lineno="265" slineno="5-102" level="2"><display>(b)</display>A common interest association may assign or pledge to a lender the right to receive <ln numlevel="1" lineno="266" slineno="5-103"/>payment under a reinvestment fee covenant if:<subsection ssid="6-58" dnum="i-o" numlevel="1" lineno="267" slineno="5-104" level="3"><display>(i)</display>the assignment or pledge is as collateral for a credit facility; and</subsection><subsection ssid="6-59" dnum="ii-o" numlevel="1" lineno="268" slineno="5-105" level="3"><display>(ii)</display>the lender releases the collateral interest upon payment in full of all amounts that <ln numlevel="1" lineno="269" slineno="5-106"/>the common interest association owes to the lender under the credit facility.</subsection></subsection></subsection><subsection ssid="6-60" dnum="4-o" numlevel="1" lineno="270" slineno="5-107" level="1"><display>(4)</display>A reinvestment fee covenant recorded on or after March 16, 2010<amend anum="0" ea="amend" pairid="241" groupid="174" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> is not enforceable if <ln numlevel="1" lineno="271" slineno="5-108"/>the reinvestment fee covenant is intended to affect property that is the subject of a <ln numlevel="1" lineno="272" slineno="5-109"/>previously recorded transfer fee covenant or reinvestment fee covenant.</subsection><subsection ssid="6-61" dnum="5-o" numlevel="1" lineno="273" slineno="5-110" level="1"><display>(5)</display>A reinvestment fee covenant recorded on or after March 16, 2010<amend anum="0" ea="amend" pairid="242" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> may not obligate the <ln numlevel="1" lineno="274" slineno="5-111"/>payment of a fee that exceeds .5% of the value of the burdened property, unless the <ln numlevel="1" lineno="275" slineno="5-112"/>burdened property is part of a large master planned development.</subsection><subsection ssid="6-62" dnum="6-o" numlevel="1" lineno="276" slineno="5-113" level="1" space="false"><display>(6)</display><subsection ssid="6-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A reinvestment fee covenant recorded on or after March 16, 2010<amend anum="0" ea="amend" pairid="243" groupid="176" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> is void and <ln numlevel="1" lineno="277" slineno="5-114"/>unenforceable unless a notice of reinvestment fee covenant, separate from the <ln numlevel="1" lineno="278" slineno="5-115"/>reinvestment fee covenant, is recorded in the office of the recorder of each county in <ln numlevel="1" lineno="279" slineno="5-116"/>which any of the burdened property is located.</subsection><subsection ssid="6-64" dnum="b-o" numlevel="1" lineno="280" slineno="5-117" level="2"><display>(b)</display>A notice under Subsection (6)(a) shall:<subsection ssid="6-65" dnum="i-o" numlevel="1" lineno="281" slineno="5-118" level="3"><display>(i)</display>state the name and address of the common interest association to which the fee <ln numlevel="1" lineno="282" slineno="5-119"/>under the reinvestment fee covenant is required to be paid;</subsection><subsection ssid="6-66" dnum="ii-o" numlevel="1" lineno="283" slineno="5-120" level="3"><display>(ii)</display>include the notarized signature of the common interest association's authorized <ln numlevel="1" lineno="284" slineno="5-121"/>representative;</subsection><subsection ssid="6-67" dnum="iii-o" numlevel="1" lineno="285" slineno="5-122" level="3"><display>(iii)</display>state that the burden of the reinvestment fee covenant is intended to run with the <ln numlevel="1" lineno="286" slineno="5-123"/>land and to bind successors in interest and assigns;</subsection><subsection ssid="6-68" dnum="iv-o" numlevel="1" lineno="287" slineno="5-124" level="3"><display>(iv)</display>state that the existence of the reinvestment fee covenant precludes the imposition <ln numlevel="1" lineno="288" slineno="5-125"/>of an additional reinvestment fee covenant on the burdened property;</subsection><subsection ssid="6-69" dnum="v-o" numlevel="1" lineno="289" slineno="5-126" level="3"><display>(v)</display>state the duration of the reinvestment fee covenant;</subsection><subsection ssid="6-70" dnum="vi-o" numlevel="1" lineno="290" slineno="5-127" level="3"><display>(vi)</display>state the purpose of the fee required to be paid under the reinvestment fee <ln numlevel="1" lineno="291" slineno="5-128"/>covenant; and</subsection><subsection ssid="6-71" dnum="vii-o" numlevel="1" lineno="292" slineno="5-129" level="3"><display>(vii)</display>state that the fee required to be paid under the reinvestment fee covenant is <ln numlevel="1" lineno="293" slineno="5-130"/>required to benefit the burdened property.</subsection></subsection><subsection ssid="6-72" dnum="c-o" numlevel="1" lineno="294" slineno="5-131" level="2"><display>(c)</display>A recorded notice of reinvestment fee covenant that substantially complies with the <ln numlevel="1" lineno="295" slineno="5-132"/>requirements of Subsection (6)(b) is valid and effective.</subsection></subsection><subsection ssid="6-73" dnum="7-o" numlevel="1" lineno="296" slineno="5-133" level="1" space="false"><display>(7)</display><subsection ssid="6-74" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A reinvestment fee covenant or transfer fee covenant recorded before March 16, <ln numlevel="1" lineno="297" slineno="5-134"/>2010<amend anum="0" ea="amend" pairid="244" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> is not enforceable after May 31, 2010, unless:<subsection ssid="6-75" dnum="i-o" numlevel="1" lineno="298" slineno="5-135" level="3" tab="1"><display>(i)</display>a notice that is consistent with the notice described in Subsection (6) is recorded in <ln numlevel="1" lineno="299" slineno="5-136"/>the office of the recorder of each county in which any of the burdened property is <ln numlevel="1" lineno="300" slineno="5-137"/>located; or</subsection><subsection ssid="6-76" dnum="ii-o" numlevel="1" lineno="301" slineno="5-138" level="3" tab="1"><display>(ii)</display>a notice of reinvestment fee covenant or transfer fee covenant, as described in <ln numlevel="1" lineno="302" slineno="5-139"/>Subsection (7)(b), is recorded in the office of the recorder of each county in which <ln numlevel="1" lineno="303" slineno="5-140"/>any of the burdened property is located.</subsection></subsection><subsection ssid="6-77" dnum="b-o" numlevel="1" lineno="304" slineno="5-141" level="2"><display>(b)</display>A notice under Subsection (7)(a)(ii) shall:<subsection ssid="6-78" dnum="i-o" numlevel="1" lineno="305" slineno="5-142" level="3"><display>(i)</display>include the notarized signature of the beneficiary of the reinvestment fee covenant <ln numlevel="1" lineno="306" slineno="5-143"/>or transfer fee covenant, or the beneficiary's authorized representative;</subsection><subsection ssid="6-79" dnum="ii-o" numlevel="1" lineno="307" slineno="5-144" level="3"><display>(ii)</display>state the name and current address of the beneficiary under the reinvestment fee <ln numlevel="1" lineno="308" slineno="5-145"/>covenant or transfer fee covenant;</subsection><subsection ssid="6-80" dnum="iii-o" numlevel="1" lineno="309" slineno="5-146" level="3"><display>(iii)</display>state that the burden of the reinvestment fee covenant or transfer fee covenant is <ln numlevel="1" lineno="310" slineno="5-147"/>intended to run with the land and to bind successors in interest and assigns; and</subsection><subsection ssid="6-81" dnum="iv-o" numlevel="1" lineno="311" slineno="5-148" level="3"><display>(iv)</display>state the duration of the reinvestment fee covenant or transfer fee covenant.</subsection></subsection><subsection ssid="6-82" dnum="c-o" numlevel="1" lineno="312" slineno="5-149" level="2"><display>(c)</display>A recorded notice of reinvestment fee covenant or transfer fee covenant that <ln numlevel="1" lineno="313" slineno="5-150"/>substantially complies with the requirements of Subsection (7)(b) is valid and <ln numlevel="1" lineno="314" slineno="5-151"/>effective.</subsection><subsection ssid="6-83" dnum="d-o" numlevel="1" lineno="315" slineno="5-152" level="2"><display>(d)</display>A notice under Subsection (7)(b):<subsection ssid="6-84" dnum="i-o" numlevel="1" lineno="316" slineno="5-153" level="3"><display>(i)</display>that is recorded after May 31, 2010, is not enforceable; and</subsection><subsection ssid="6-85" dnum="ii-o" numlevel="1" lineno="317" slineno="5-154" level="3"><display>(ii)</display>shall comply with the requirements of Section <xref depth="3" refnumber="57-1-47">57-1-47</xref>.</subsection></subsection><subsection ssid="6-86" dnum="e-o" numlevel="1" lineno="318" slineno="5-155" level="2"><display>(e)</display>An amendment to a notice under Subsection (7)(b) recorded after May 31, 2010, <ln numlevel="1" lineno="319" slineno="5-156"/>seeking to amend a notice under Subsection (7)(b) recorded before May 31, 2010, is <ln numlevel="1" lineno="320" slineno="5-157"/>not an enforceable amendment.</subsection></subsection><subsection ssid="6-87" dnum="8-o" numlevel="1" lineno="321" slineno="5-158" level="1"><display>(8)</display>A reinvestment fee covenant recorded on or after March 16, 2010, may not be enforced <ln numlevel="1" lineno="322" slineno="5-159"/>upon:<subsection ssid="6-88" dnum="a-o" numlevel="1" lineno="323" slineno="5-160" level="2"><display>(a)</display>an involuntary transfer;</subsection><subsection ssid="6-89" dnum="b-o" numlevel="1" lineno="324" slineno="5-161" level="2"><display>(b)</display>a transfer that results from a court order;</subsection><subsection ssid="6-90" dnum="c-o" numlevel="1" lineno="325" slineno="5-162" level="2"><display>(c)</display>a bona fide transfer to a family member of the seller within three degrees of <ln numlevel="1" lineno="326" slineno="5-163"/>consanguinity who, before the transfer, provides adequate proof of consanguinity;</subsection><subsection ssid="6-91" dnum="d-o" numlevel="1" lineno="327" slineno="5-164" level="2"><display>(d)</display>a transfer or change of interest due to death, whether provided in a will, trust, or <ln numlevel="1" lineno="328" slineno="5-165"/>decree of distribution; or</subsection><subsection ssid="6-92" dnum="e-o" numlevel="1" lineno="329" slineno="5-166" level="2"><display>(e)</display>the transfer of burdened property by a financial institution, except to the extent that <ln numlevel="1" lineno="330" slineno="5-167"/>the reinvestment fee covenant requires the payment of a common interest <ln numlevel="1" lineno="331" slineno="5-168"/>association's costs directly related to the transfer of the burdened property, not to <ln numlevel="1" lineno="332" slineno="5-169"/>exceed $250.</subsection></subsection><subsection ssid="6-97" dnum="_-o:9-i" numlevel="1" lineno="333" slineno="5-170" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="i" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">An association transfer fee imposed on or after May 7, 2025, is void and unenforceable <ln numlevel="1" lineno="334" slineno="5-171"/>unless:</amend><subsection ssid="6-132" dnum="_-o:a-i" numlevel="1" lineno="335" slineno="5-172" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="223" groupid="158" style="1" owner="jchristopherson" level="1" amendtag="end">the association uses the fee only to pay expenses related to the transfer; and</amend></subsection><subsection ssid="6-134" dnum="_-o:b-i" numlevel="1" lineno="336" slineno="5-173" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="234" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">the fee does not exceed $100.</amend></subsection></subsection><subsection ssid="6-121" dnum="_-o:10-i" numlevel="1" lineno="337" slineno="5-174" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">An association may not impose or set the amount of a reinvestment fee unless a <ln numlevel="1" lineno="338" slineno="5-175"/>majority of voting interests in the association, or a higher percentage if required in the <ln numlevel="1" lineno="339" slineno="5-176"/>organizational documents, approves the reinvestment fee.</amend></subsection></section></bsec><bsec buid="30" num="57-8-8.1" type="amend" src="code" uid="C57-8-S8.1_2025050720250507" sort="57 08 00080120250507" numlevel="1" lineno="340" slineno="6-1" sn="6"><section number="57-8-8.1" numlevel="1" lineno="341" slineno="6-2" type="amend"><secline lineno="340">Section 6, Section <bold>57-8-8.1</bold> is amended to read:</secline><catline lineno="341"><bold>57-8-8.1. Equal treatment by rules required -- Limits on rules.</bold></catline><subsection ssid="30-30-1" dnum="1-o" numlevel="1" lineno="342" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="30-30-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (1)(b), a rule shall treat similarly situated unit <ln numlevel="1" lineno="343" slineno="6-4"/>owners similarly.</subsection><subsection ssid="30-30-3" dnum="b-o" numlevel="1" lineno="344" slineno="6-5" level="2"><display>(b)</display>Notwithstanding Subsection (1)(a), a rule may:<subsection ssid="30-30-4" dnum="i-o" numlevel="1" lineno="345" slineno="6-6" level="3"><display>(i)</display>vary according to the level and type of service that the association of unit owners <ln numlevel="1" lineno="346" slineno="6-7"/>provides to unit owners;</subsection><subsection ssid="30-30-5" dnum="ii-o" numlevel="1" lineno="347" slineno="6-8" level="3"><display>(ii)</display>differ between residential and nonresidential uses; or</subsection><subsection ssid="30-30-6" dnum="iii-o" numlevel="1" lineno="348" slineno="6-9" level="3"><display>(iii)</display>for a unit that a unit owner leases for a term of less than 30 days, impose a <ln numlevel="1" lineno="349" slineno="6-10"/>reasonable limit on the number of individuals that may use the common areas and <ln numlevel="1" lineno="350" slineno="6-11"/>facilities as the rental unit tenant's guest or as the unit owner's guest.</subsection></subsection></subsection><subsection ssid="30-30-7" dnum="2-o" numlevel="1" lineno="351" slineno="6-12" level="1" space="false"><display>(2)</display><subsection ssid="30-30-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a unit owner owns a rental unit and is in compliance with the association of unit <ln numlevel="1" lineno="352" slineno="6-13"/>owners' governing documents and any rule that the association of unit owners adopts <ln numlevel="1" lineno="353" slineno="6-14"/>under Subsection (5), a rule may not treat the unit owner differently because the unit <ln numlevel="1" lineno="354" slineno="6-15"/>owner owns a rental unit.</subsection><subsection ssid="30-30-9" dnum="b-o" numlevel="1" lineno="355" slineno="6-16" level="2"><display>(b)</display>Notwithstanding Subsection (2)(a), a rule may:<subsection ssid="30-30-10" dnum="i-o" numlevel="1" lineno="356" slineno="6-17" level="3"><display>(i)</display>limit or prohibit a rental unit owner from using the common areas and facilities for <ln numlevel="1" lineno="357" slineno="6-18"/>purposes other than attending an association meeting or managing the rental unit;</subsection><subsection ssid="30-30-11" dnum="ii-o" numlevel="1" lineno="358" slineno="6-19" level="3"><display>(ii)</display>if the rental unit owner retains the right to use the association of unit owners' <ln numlevel="1" lineno="359" slineno="6-20"/>common areas and facilities, even occasionally:<subsection ssid="30-30-12" dnum="A-o" numlevel="1" lineno="360" slineno="6-21" level="4"><display>(A)</display>charge a rental unit owner a fee to use the common areas and facilities; and</subsection><subsection ssid="30-30-13" dnum="B-o" numlevel="1" lineno="361" slineno="6-22" level="4"><display>(B)</display>for a unit that a unit owner leases for a term of less than 30 days, impose a <ln numlevel="1" lineno="362" slineno="6-23"/>reasonable limit on the number of individuals that may use the common areas <ln numlevel="1" lineno="363" slineno="6-24"/>and facilities as the rental unit tenant's guest or as the unit owner's guest; or</subsection></subsection><subsection ssid="30-30-14" dnum="iii-o" numlevel="1" lineno="364" slineno="6-25" level="3"><display>(iii)</display>include a provision in the association of unit owners' governing documents that:<subsection ssid="30-30-15" dnum="A-o" numlevel="1" lineno="365" slineno="6-26" level="4"><display>(A)</display>requires each tenant of a rental unit to abide by the terms of the governing <ln numlevel="1" lineno="366" slineno="6-27"/>documents; and</subsection><subsection ssid="30-30-16" dnum="B-o" numlevel="1" lineno="367" slineno="6-28" level="4"><display>(B)</display>holds the tenant and the rental unit owner jointly and severally liable for a <ln numlevel="1" lineno="368" slineno="6-29"/>violation of a provision of the governing documents.</subsection></subsection></subsection></subsection><subsection ssid="30-30-17" dnum="3-o" numlevel="1" lineno="369" slineno="6-30" level="1" space="false"><display>(3)</display><subsection ssid="30-30-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not interfere with the freedom of a unit owner to determine the <ln numlevel="1" lineno="370" slineno="6-31"/>composition of the unit owner's household.</subsection><subsection ssid="30-30-19" dnum="b-o" numlevel="1" lineno="371" slineno="6-32" level="2"><display>(b)</display>Notwithstanding Subsection (3)(a), an association of unit owners may:<subsection ssid="30-30-20" dnum="i-o" numlevel="1" lineno="372" slineno="6-33" level="3"><display>(i)</display>require that all occupants of a dwelling be members of a single housekeeping unit; <ln numlevel="1" lineno="373" slineno="6-34"/>or</subsection><subsection ssid="30-30-21" dnum="ii-o" numlevel="1" lineno="374" slineno="6-35" level="3"><display>(ii)</display>limit the total number of occupants permitted in each residential dwelling on the <ln numlevel="1" lineno="375" slineno="6-36"/>basis of the residential dwelling's:<subsection ssid="30-30-22" dnum="A-o" numlevel="1" lineno="376" slineno="6-37" level="4"><display>(A)</display>size and facilities; and</subsection><subsection ssid="30-30-23" dnum="B-o" numlevel="1" lineno="377" slineno="6-38" level="4"><display>(B)</display>fair use of the common areas and facilities.</subsection></subsection></subsection></subsection><subsection ssid="30-30-24" dnum="4-o" numlevel="1" lineno="378" slineno="6-39" level="1"><display>(4)</display>Unless contrary to a declaration, a rule may require a minimum lease term.</subsection><subsection ssid="30-30-25" dnum="5-o" numlevel="1" lineno="379" slineno="6-40" level="1"><display>(5)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">Unless otherwise provided in the declaration, an </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">An </amend>association of unit owners may by <ln numlevel="1" lineno="380" slineno="6-41"/>rule:<subsection ssid="30-30-26" dnum="a-o" numlevel="1" lineno="381" slineno="6-42" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="59" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both">unless otherwise provided in the declaration:</amend><subsection ssid="30-80" dnum="_-o:i-i" numlevel="1" lineno="382" slineno="6-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>regulate the use, maintenance, repair, replacement, and modification of common <ln numlevel="1" lineno="383" slineno="6-44"/>areas and facilities;<amend anum="0" ea="amend" pairid="68" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both"> and</amend></subsection><subsection ssid="30-30-27" dnum="b-o:ii-i" numlevel="1" lineno="384" slineno="6-45" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1202" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>impose and receive any payment, fee, or charge for:<subsection ssid="30-30-28" dnum="i-o:A-i" numlevel="1" lineno="385" slineno="6-46" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1203" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>the use, rental, or operation of the common areas, except limited common <ln numlevel="1" lineno="386" slineno="6-47"/>areas and facilities; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="70" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or</amend></subsection><subsection ssid="30-30-29" dnum="ii-o:B-i" numlevel="1" lineno="387" slineno="6-48" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1204" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>a service provided to a unit owner;</subsection></subsection></subsection><subsection ssid="30-30-30" dnum="c-o:b-i" numlevel="1" lineno="388" slineno="6-49" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1205" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="both" space="true">(b)</amend></display>impose<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both"> a charge</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> for a late payment of an assessment<amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend><subsection ssid="30-70" dnum="_-o:i-i" numlevel="1" lineno="389" slineno="6-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">a monthly penalty, not to exceed the lesser of:</amend><subsection ssid="30-78" dnum="_-o:A-i" numlevel="1" lineno="390" slineno="6-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">5% of the assessment amount; and</amend></subsection></subsection><subsection ssid="30-77" dnum="_-o:ii-i" numlevel="1" lineno="392" slineno="6-53" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">interest on the assessment and penalty of up to 1.5% per month</amend>; or</subsection></subsection><subsection ssid="30-30-31" dnum="d-o:c-i" numlevel="1" lineno="393" slineno="6-54" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1210" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>provide for the indemnification of the association of unit owners' officers and <ln numlevel="1" lineno="394" slineno="6-55"/>management committee consistent with Title 16, Chapter 6a, Utah Revised Nonprofit <ln numlevel="1" lineno="395" slineno="6-56"/>Corporation Act.</subsection></subsection><subsection ssid="30-30-32" dnum="6-o" numlevel="1" lineno="396" slineno="6-57" level="1" space="false"><display>(6)</display><subsection ssid="30-30-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (6)(b), a rule may not prohibit a unit owner from <ln numlevel="1" lineno="397" slineno="6-58"/>installing a personal security camera immediately adjacent to the entryway, window, <ln numlevel="1" lineno="398" slineno="6-59"/>or other outside entry point of the owner's condominium unit.</subsection><subsection ssid="30-30-34" dnum="b-o" numlevel="1" lineno="399" slineno="6-60" level="2"><display>(b)</display>A rule may prohibit a unit owner from installing a personal security camera in a <ln numlevel="1" lineno="400" slineno="6-61"/>common area not physically connected to the owner's unit.</subsection></subsection><subsection ssid="30-30-35" dnum="7-o" numlevel="1" lineno="401" slineno="6-62" level="1" space="false"><display>(7)</display><subsection ssid="30-30-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not abridge the right of a unit owner to display a religious or holiday <ln numlevel="1" lineno="402" slineno="6-63"/>sign, symbol, or decoration inside the owner's condominium unit.</subsection><subsection ssid="30-30-37" dnum="b-o" numlevel="1" lineno="403" slineno="6-64" level="2"><display>(b)</display>An association may adopt a reasonable time, place, and manner restriction with <ln numlevel="1" lineno="404" slineno="6-65"/>respect to a display that is visible from the exterior of a unit.</subsection></subsection><subsection ssid="30-30-38" dnum="8-o" numlevel="1" lineno="405" slineno="6-66" level="1" space="false"><display>(8)</display><subsection ssid="30-30-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not:<subsection ssid="30-30-40" dnum="i-o" numlevel="1" lineno="406" slineno="6-67" level="3" tab="1"><display>(i)</display>prohibit a unit owner from displaying in a window of the owner's condominium <ln numlevel="1" lineno="407" slineno="6-68"/>unit:<subsection ssid="30-30-41" dnum="A-o" numlevel="1" lineno="408" slineno="6-69" level="4"><display>(A)</display>a for-sale sign; or</subsection><subsection ssid="30-30-42" dnum="B-o" numlevel="1" lineno="409" slineno="6-70" level="4"><display>(B)</display>a political sign;</subsection></subsection><subsection ssid="30-30-43" dnum="ii-o" numlevel="1" lineno="410" slineno="6-71" level="3" tab="1"><display>(ii)</display>regulate the content of a political sign; or</subsection><subsection ssid="30-30-44" dnum="iii-o" numlevel="1" lineno="411" slineno="6-72" level="3" tab="1"><display>(iii)</display>establish design criteria for a political sign.</subsection></subsection><subsection ssid="30-30-45" dnum="b-o" numlevel="1" lineno="412" slineno="6-73" level="2"><display>(b)</display>Notwithstanding Subsection (8)(a), a rule may reasonably regulate the size and time, <ln numlevel="1" lineno="413" slineno="6-74"/>place, and manner of posting a for-sale sign or a political sign.</subsection></subsection><subsection ssid="30-30-46" dnum="9-o" numlevel="1" lineno="414" slineno="6-75" level="1"><display>(9)</display>For any area for which one or more unit owners are responsible for landscape <ln numlevel="1" lineno="415" slineno="6-76"/>maintenance, the association of unit owners:<subsection ssid="30-30-47" dnum="a-o" numlevel="1" lineno="416" slineno="6-77" level="2"><display>(a)</display>shall adopt rules supporting water wise landscaping, including:<subsection ssid="30-30-48" dnum="i-o" numlevel="1" lineno="417" slineno="6-78" level="3"><display>(i)</display>low water use requirements on lawns during drought conditions;</subsection><subsection ssid="30-30-49" dnum="ii-o" numlevel="1" lineno="418" slineno="6-79" level="3"><display>(ii)</display>design criterion for water wise landscaping; and</subsection><subsection ssid="30-30-50" dnum="iii-o" numlevel="1" lineno="419" slineno="6-80" level="3"><display>(iii)</display>limiting permissible plant material to specific water wise plant material;</subsection></subsection><subsection ssid="30-30-51" dnum="b-o" numlevel="1" lineno="420" slineno="6-81" level="2"><display>(b)</display>may not prohibit low water use on lawns during drought conditions; and</subsection><subsection ssid="30-30-52" dnum="c-o" numlevel="1" lineno="421" slineno="6-82" level="2"><display>(c)</display>may not prohibit or restrict the conversion of a grass park strip to water-efficient <ln numlevel="1" lineno="422" slineno="6-83"/>landscaping.</subsection></subsection><subsection ssid="30-30-53" dnum="10-o" numlevel="1" lineno="423" slineno="6-84" level="1"><display>(10)</display>A rule may restrict a sex offender from accessing a protected area that is maintained, <ln numlevel="1" lineno="424" slineno="6-85"/>operated, or owned by the association, subject to the exceptions described in Subsection <xref depth="3" refnumber="77-27-21.7"><ln numlevel="1" lineno="425" slineno="6-86"/>77-27-21.7</xref>(3).</subsection><subsection ssid="30-30-54" dnum="11-o" numlevel="1" lineno="426" slineno="6-87" level="1" space="false"><display>(11)</display><subsection ssid="30-30-55" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in this Subsection (11), a rule may not prohibit a unit owner <ln numlevel="1" lineno="427" slineno="6-88"/>from making modifications, consistent with industry standards, for radon mitigation.</subsection><subsection ssid="30-30-56" dnum="b-o" numlevel="1" lineno="428" slineno="6-89" level="2"><display>(b)</display>Subsection (11)(a) does not apply if the modifications would violate:<subsection ssid="30-30-57" dnum="i-o" numlevel="1" lineno="429" slineno="6-90" level="3"><display>(i)</display>a local land use ordinance;</subsection><subsection ssid="30-30-58" dnum="ii-o" numlevel="1" lineno="430" slineno="6-91" level="3"><display>(ii)</display>a building code;</subsection><subsection ssid="30-30-59" dnum="iii-o" numlevel="1" lineno="431" slineno="6-92" level="3"><display>(iii)</display>a health code; or</subsection><subsection ssid="30-30-60" dnum="iv-o" numlevel="1" lineno="432" slineno="6-93" level="3"><display>(iv)</display>a fire code.</subsection></subsection><subsection ssid="30-30-61" dnum="c-o" numlevel="1" lineno="433" slineno="6-94" level="2"><display>(c)</display>A rule governing the placement or external appearance of modifications may apply to <ln numlevel="1" lineno="434" slineno="6-95"/>modifications for radon mitigation unless the rule would:<subsection ssid="30-30-62" dnum="i-o" numlevel="1" lineno="435" slineno="6-96" level="3"><display>(i)</display>unreasonably interfere with the modifications' functionality; or</subsection><subsection ssid="30-30-63" dnum="ii-o" numlevel="1" lineno="436" slineno="6-97" level="3"><display>(ii)</display>add more than 40% of the modifications' original cost to the cost of installing the <ln numlevel="1" lineno="437" slineno="6-98"/>modifications.</subsection></subsection><subsection ssid="30-30-64" dnum="d-o" numlevel="1" lineno="438" slineno="6-99" level="2"><display>(d)</display>A rule may require that a unit owner making modifications related to radon <ln numlevel="1" lineno="439" slineno="6-100"/>mitigation:<subsection ssid="30-30-65" dnum="i-o" numlevel="1" lineno="440" slineno="6-101" level="3"><display>(i)</display>demonstrate or provide proof of radon contamination; and</subsection><subsection ssid="30-30-66" dnum="ii-o" numlevel="1" lineno="441" slineno="6-102" level="3"><display>(ii)</display>provide proof that the modifications and any related construction will be <ln numlevel="1" lineno="442" slineno="6-103"/>performed by a licensed person.</subsection></subsection></subsection><subsection ssid="30-30-67" dnum="12-o" numlevel="1" lineno="443" slineno="6-104" level="1"><display>(12)</display>A rule shall be reasonable.</subsection><subsection ssid="30-30-68" dnum="13-o" numlevel="1" lineno="444" slineno="6-105" level="1"><display>(13)</display>A declaration, or an amendment to a declaration, may vary any of the requirements of <ln numlevel="1" lineno="445" slineno="6-106"/>Subsections (1) through (5), except Subsection (1)(b)(ii).</subsection><subsection ssid="30-30-69" dnum="14-o" numlevel="1" lineno="446" slineno="6-107" level="1"><display>(14)</display>This section applies to an association of unit owners regardless of when the association <ln numlevel="1" lineno="447" slineno="6-108"/>of unit owners is created.</subsection></section></bsec><bsec buid="4" type="amend" src="code" num="57-8-17" uid="C57-8-S17_2025050720250507" sort="57 08 00170020250507" style="" numlevel="1" lineno="448" slineno="7-1" sn="7"><section number="57-8-17" numlevel="1" lineno="449" slineno="7-2" type="amend"><secline lineno="448">Section 7, Section <bold>57-8-17</bold> is amended to read:</secline><catline lineno="449"><bold>57-8-17. or</subsection><subsection ssid="4-13" dnum="iii-o" numlevel="1" lineno="473" slineno="7-26" level="3"><display>(iii)</display>any communication subject to attorney-client privilege.</subsection></subsection></subsection><subsection ssid="4-14" dnum="2-o" numlevel="1" lineno="474" slineno="7-27" level="1" space="false"><display>(2)</display><subsection ssid="4-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the requirements described in Subsection <xref depth="4" refnumber="57-8-17(1)" start="0">(1)</xref>, an association of unit <ln numlevel="1" lineno="475" slineno="7-28"/>owners shall:<subsection ssid="4-16" dnum="i-o" numlevel="1" lineno="476" slineno="7-29" level="3" tab="1"><display>(i)</display>make documents available to unit owners in accordance with the association of <ln numlevel="1" lineno="477" slineno="7-30"/>unit owners' governing documents; and</subsection><subsection ssid="4-17" dnum="ii-o" numlevel="1" lineno="478" slineno="7-31" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="4-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>if the association of unit owners has an active website, make the documents <ln numlevel="1" lineno="479" slineno="7-32"/>described in Subsections <xref depth="4" refnumber="57-8-17(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) through (C) available to unit owners, free <ln numlevel="1" lineno="480" slineno="7-33"/>of charge, through the website; or</subsection><subsection ssid="4-19" dnum="B-o" numlevel="1" lineno="481" slineno="7-34" level="4"><display>(B)</display>if the association of unit owners does not have an active website, make <ln numlevel="1" lineno="482" slineno="7-35"/>physical copies of the documents described in Subsections <xref depth="4" refnumber="57-8-17(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) <ln numlevel="1" lineno="483" slineno="7-36"/>through (C) available to unit owners during regular business hours at the <ln numlevel="1" lineno="484" slineno="7-37"/>association of unit owners' address registered with the Department of <ln numlevel="1" lineno="485" slineno="7-38"/>Commerce under Section <xref depth="3" refnumber="57-8-13.1" start="0">57-8-13.1</xref>.</subsection></subsection></subsection><subsection ssid="4-20" dnum="b-o" numlevel="1" lineno="486" slineno="7-39" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="57-8-17(2)(a)(ii)" start="0">(2)(a)(ii)</xref> does not apply to an association as defined in Section <xref depth="3" refnumber="57-19-2" start="0">57-19-2</xref>.</subsection><subsection ssid="4-21" dnum="c-o" numlevel="1" lineno="487" slineno="7-40" level="2"><display>(c)</display>If a provision of an association of unit owners' governing documents conflicts with a <ln numlevel="1" lineno="488" slineno="7-41"/>provision of this section, the provision of this section governs.</subsection></subsection><subsection ssid="4-22" dnum="3-o" numlevel="1" lineno="489" slineno="7-42" level="1"><display>(3)</display>In a written request to inspect or copy documents:<subsection ssid="4-23" dnum="a-o" numlevel="1" lineno="490" slineno="7-43" level="2"><display>(a)</display>a unit owner shall include:<subsection ssid="4-24" dnum="i-o" numlevel="1" lineno="491" slineno="7-44" level="3"><display>(i)</display>the association of unit owners' name;</subsection><subsection ssid="4-25" dnum="ii-o" numlevel="1" lineno="492" slineno="7-45" level="3"><display>(ii)</display>the unit owner's name;</subsection><subsection ssid="4-26" dnum="iii-o" numlevel="1" lineno="493" slineno="7-46" level="3"><display>(iii)</display>the unit owner's property address;</subsection><subsection ssid="4-27" dnum="iv-o" numlevel="1" lineno="494" slineno="7-47" level="3"><display>(iv)</display>the unit owner's email address;</subsection><subsection ssid="4-28" dnum="v-o" numlevel="1" lineno="495" slineno="7-48" level="3"><display>(v)</display>a description of the documents requested; and</subsection><subsection ssid="4-29" dnum="vi-o" numlevel="1" lineno="496" slineno="7-49" level="3"><display>(vi)</display>any election or request described in Subsection <xref depth="4" refnumber="57-8-17(3)(b)" start="0">(3)(b)</xref>; and</subsection></subsection><subsection ssid="4-30" dnum="b-o" numlevel="1" lineno="497" slineno="7-50" level="2"><display>(b)</display>a unit owner may:<subsection ssid="4-31" dnum="i-o" numlevel="1" lineno="498" slineno="7-51" level="3"><display>(i)</display>elect whether to inspect or copy the documents;</subsection><subsection ssid="4-32" dnum="ii-o" numlevel="1" lineno="499" slineno="7-52" level="3"><display>(ii)</display>if the unit owner elects to copy the documents, request hard copies or electronic <ln numlevel="1" lineno="500" slineno="7-53"/>scans of the documents; or</subsection><subsection ssid="4-33" dnum="iii-o" numlevel="1" lineno="501" slineno="7-54" level="3"><display>(iii)</display>subject to Subsection <xref depth="4" refnumber="57-8-17(4)" start="0">(4)</xref>, request that:<subsection ssid="4-34" dnum="A-o" numlevel="1" lineno="502" slineno="7-55" level="4"><display>(A)</display>the association of unit owners make the copies or electronic scans of the <ln numlevel="1" lineno="503" slineno="7-56"/>requested documents;</subsection><subsection ssid="4-35" dnum="B-o" numlevel="1" lineno="504" slineno="7-57" level="4"><display>(B)</display>a recognized third party duplicating service make the copies or electronic <ln numlevel="1" lineno="505" slineno="7-58"/>scans of the requested documents;</subsection><subsection ssid="4-36" dnum="C-o" numlevel="1" lineno="506" slineno="7-59" level="4"><display>(C)</display>the unit owner be allowed to bring any necessary imaging equipment to the <ln numlevel="1" lineno="507" slineno="7-60"/>place of inspection and make copies or electronic scans of the documents while <ln numlevel="1" lineno="508" slineno="7-61"/>inspecting the documents; or</subsection><subsection ssid="4-37" dnum="D-o" numlevel="1" lineno="509" slineno="7-62" level="4"><display>(D)</display>the association of unit owners email the requested documents to an email <ln numlevel="1" lineno="510" slineno="7-63"/>address provided in the request.</subsection></subsection></subsection></subsection><subsection ssid="4-38" dnum="4-o" numlevel="1" lineno="511" slineno="7-64" level="1" space="false"><display>(4)</display><subsection ssid="4-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An association of unit owners shall comply with a request described in Subsection <xref depth="4" refnumber="57-8-17(3)" start="0"><ln numlevel="1" lineno="512" slineno="7-65"/>(3)</xref><amend anum="0" ea="amend" pairid="67" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both"> within two weeks after the day on which the association of unit owners receives <ln numlevel="1" lineno="513" slineno="7-66"/>the request</amend>.</subsection><subsection ssid="4-40" dnum="b-o" numlevel="1" lineno="514" slineno="7-67" level="2"><display>(b)</display>If an association of unit owners produces the copies or electronic scans:<subsection ssid="4-41" dnum="i-o" numlevel="1" lineno="515" slineno="7-68" level="3"><display>(i)</display>the copies or electronic scans shall be legible and accurate;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="4-42" dnum="ii-o" numlevel="1" lineno="516" slineno="7-69" level="3"><display>(ii)</display>the unit owner shall pay the association of unit owners the reasonable cost of the <ln numlevel="1" lineno="517" slineno="7-70"/>copies <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">or electronic scans </amend><amendoutend style="2"/>and for time spent meeting with the unit owner, which <ln numlevel="1" lineno="518" slineno="7-71"/>may not exceed:<subsection ssid="4-43" dnum="A-o" numlevel="1" lineno="519" slineno="7-72" level="4"><display>(A)</display>the actual cost that the association of unit owners paid to a recognized third <ln numlevel="1" lineno="520" slineno="7-73"/>party duplicating service to make the copies or electronic scans; or</subsection><subsection ssid="4-44" dnum="B-o" numlevel="1" lineno="521" slineno="7-74" level="4"><display>(B)</display>10 cents per page and $15 per hour for the employee's, manager's, or other <ln numlevel="1" lineno="522" slineno="7-75"/>agent's time making the copies or electronic scans<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="71" groupid="55" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="4-85" dnum="_-o:iii-i" numlevel="1" lineno="523" slineno="7-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="end">the association may not charge the unit owner for any costs associated with <ln numlevel="1" lineno="524" slineno="7-77"/>fulfilling a request for the electronic transmission of the documents described in <ln numlevel="1" lineno="525" slineno="7-78"/>Subsection (3).</amend></subsection></subsection><subsection ssid="4-45" dnum="c-o" numlevel="1" lineno="526" slineno="7-79" level="2"><display>(c)</display>If a unit owner requests a recognized third party duplicating service make the copies <ln numlevel="1" lineno="527" slineno="7-80"/>or electronic scans:<subsection ssid="4-46" dnum="i-o" numlevel="1" lineno="528" slineno="7-81" level="3"><display>(i)</display>the association of unit owners shall arrange for the delivery and pick up of the <ln numlevel="1" lineno="529" slineno="7-82"/>original documents; and</subsection><subsection ssid="4-47" dnum="ii-o" numlevel="1" lineno="530" slineno="7-83" level="3"><display>(ii)</display>the unit owner shall pay the duplicating service directly.</subsection></subsection><subsection ssid="4-48" dnum="d-o" numlevel="1" lineno="531" slineno="7-84" level="2"><display>(d)</display>Subject to Subsection <xref depth="4" refnumber="57-8-17(9)" start="0">(9)</xref>, if a unit owner requests to bring imaging equipment to the <ln numlevel="1" lineno="532" slineno="7-85"/>inspection, the association of unit owners shall provide the necessary space, light, and <ln numlevel="1" lineno="533" slineno="7-86"/>power for the imaging equipment.</subsection></subsection><subsection ssid="4-49" dnum="5-o" numlevel="1" lineno="534" slineno="7-87" level="1"><display>(5)</display>If, in response to a unit owner's request to inspect or copy documents, an association of <ln numlevel="1" lineno="535" slineno="7-88"/>unit owners fails to comply with a provision of this section, the association of unit <ln numlevel="1" lineno="536" slineno="7-89"/>owners shall pay:<subsection ssid="4-50" dnum="a-o" numlevel="1" lineno="537" slineno="7-90" level="2"><display>(a)</display>the reasonable costs of inspecting and copying the requested documents;</subsection><subsection ssid="4-51" dnum="b-o" numlevel="1" lineno="538" slineno="7-91" level="2"><display>(b)</display>for items described in Subsections <xref depth="4" refnumber="57-8-17(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) through (C), $25 to the unit owner <ln numlevel="1" lineno="539" slineno="7-92"/>who made the request for each day the request continues unfulfilled, beginning the <ln numlevel="1" lineno="540" slineno="7-93"/>sixth day after the day on which the unit owner made the request; and</subsection><subsection ssid="4-52" dnum="c-o" numlevel="1" lineno="541" slineno="7-94" level="2"><display>(c)</display>reasonable attorney fees and costs incurred by the unit owner in obtaining the <ln numlevel="1" lineno="542" slineno="7-95"/>inspection and copies of the requested documents.</subsection></subsection><subsection ssid="4-53" dnum="6-o" numlevel="1" lineno="543" slineno="7-96" level="1" space="false"><display>(6)</display><subsection ssid="4-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to any remedy in the association of unit owners' governing documents <ln numlevel="1" lineno="544" slineno="7-97"/>or as otherwise provided by law, a unit owner may file an action in court under this <ln numlevel="1" lineno="545" slineno="7-98"/>section if:<subsection ssid="4-55" dnum="i-o" numlevel="1" lineno="546" slineno="7-99" level="3" tab="1"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="57-8-17(9)" start="0">(9)</xref>, an association of unit owners fails to make documents <ln numlevel="1" lineno="547" slineno="7-100"/>available to the unit owner in accordance with this section, the association of unit <ln numlevel="1" lineno="548" slineno="7-101"/>owners' governing documents, or as otherwise provided by law; and</subsection><subsection ssid="4-56" dnum="ii-o" numlevel="1" lineno="549" slineno="7-102" level="3" tab="1"><display>(ii)</display>the association of unit owners fails to timely comply with a notice described in <ln numlevel="1" lineno="550" slineno="7-103"/>Subsection <xref depth="4" refnumber="57-8-17(6)(d)" start="0">(6)(d)</xref>.</subsection></subsection><subsection ssid="4-57" dnum="b-o" numlevel="1" lineno="551" slineno="7-104" level="2"><display>(b)</display>In an action described in Subsection <xref depth="4" refnumber="57-8-17(6)(a)" start="0">(6)(a)</xref>:<subsection ssid="4-58" dnum="i-o" numlevel="1" lineno="552" slineno="7-105" level="3"><display>(i)</display>the unit owner may request:<subsection ssid="4-59" dnum="A-o" numlevel="1" lineno="553" slineno="7-106" level="4"><display>(A)</display>injunctive relief requiring the association of unit owners to comply with the <ln numlevel="1" lineno="554" slineno="7-107"/>provisions of this section;</subsection><subsection ssid="4-60" dnum="B-o" numlevel="1" lineno="555" slineno="7-108" level="4"><display>(B)</display>$500 or actual damage, whichever is greater; or</subsection><subsection ssid="4-61" dnum="C-o" numlevel="1" lineno="556" slineno="7-109" level="4"><display>(C)</display>any other relief provided by law; and</subsection></subsection><subsection ssid="4-62" dnum="ii-o" numlevel="1" lineno="557" slineno="7-110" level="3"><display>(ii)</display>the court shall award costs and reasonable attorney fees to the prevailing party, <ln numlevel="1" lineno="558" slineno="7-111"/>including any reasonable attorney fees incurred before the action was filed that <ln numlevel="1" lineno="559" slineno="7-112"/>relate to the request that is the subject of the action.</subsection></subsection><subsection ssid="4-63" dnum="c-o" numlevel="1" lineno="560" slineno="7-113" level="2" space="false"><display>(c)</display><subsection ssid="4-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>In an action described in Subsection <xref depth="4" refnumber="57-8-17(6)(a)" start="0">(6)(a)</xref>, upon motion by the unit owner, <ln numlevel="1" lineno="561" slineno="7-114"/>notice to the association of unit owners, and a hearing in which the court finds a <ln numlevel="1" lineno="562" slineno="7-115"/>likelihood that the association of unit owners failed to comply with a provision of <ln numlevel="1" lineno="563" slineno="7-116"/>this section, the court shall order the association of unit owners to immediately <ln numlevel="1" lineno="564" slineno="7-117"/>comply with the provision.</subsection><subsection ssid="4-65" dnum="ii-o" numlevel="1" lineno="565" slineno="7-118" level="3"><display>(ii)</display>The court shall hold a hearing described in Subsection <xref depth="4" refnumber="57-8-17(6)(c)(i)" start="0">(6)(c)(i)</xref> within 30 days <ln numlevel="1" lineno="566" slineno="7-119"/>after the day on which the unit owner files the motion.</subsection></subsection><subsection ssid="4-66" dnum="d-o" numlevel="1" lineno="567" slineno="7-120" level="2"><display>(d)</display>At least 10 days before the day on which a unit owner files an action described in <ln numlevel="1" lineno="568" slineno="7-121"/>Subsection <xref depth="4" refnumber="57-8-17(6)(a)" start="0">(6)(a)</xref>, the unit owner shall deliver a written notice to the association of <ln numlevel="1" lineno="569" slineno="7-122"/>unit owners that states:<subsection ssid="4-67" dnum="i-o" numlevel="1" lineno="570" slineno="7-123" level="3"><display>(i)</display>the unit owner's name, address, telephone number, and email address;</subsection><subsection ssid="4-68" dnum="ii-o" numlevel="1" lineno="571" slineno="7-124" level="3"><display>(ii)</display>each requirement of this section with which the association of unit owners has <ln numlevel="1" lineno="572" slineno="7-125"/>failed to comply;</subsection><subsection ssid="4-69" dnum="iii-o" numlevel="1" lineno="573" slineno="7-126" level="3"><display>(iii)</display>a demand that the association of unit owners comply with each requirement with <ln numlevel="1" lineno="574" slineno="7-127"/>which the association of unit owners has failed to comply; and</subsection><subsection ssid="4-70" dnum="iv-o" numlevel="1" lineno="575" slineno="7-128" level="3"><display>(iv)</display>a date by which the association of unit owners shall remedy the association of <ln numlevel="1" lineno="576" slineno="7-129"/>unit owners' noncompliance that is at least 10 days after the day on which the unit <ln numlevel="1" lineno="577" slineno="7-130"/>owner delivers the notice to the association of unit owners.</subsection></subsection></subsection><subsection ssid="4-71" dnum="7-o" numlevel="1" lineno="578" slineno="7-131" level="1" space="false"><display>(7)</display><subsection ssid="4-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The provisions of Section <xref depth="3" refnumber="16-6a-1604" start="0">16-6a-1604</xref> do not apply to an association of unit <ln numlevel="1" lineno="579" slineno="7-132"/>owners.</subsection><subsection ssid="4-73" dnum="b-o" numlevel="1" lineno="580" slineno="7-133" level="2"><display>(b)</display>The provisions of this section apply regardless of any conflicting provision in <xref depth="1" refnumber="16-6a" start="0">Title <ln numlevel="1" lineno="581" slineno="7-134"/>16, Chapter 6a, Utah Revised Nonprofit Corporation Act</xref>.</subsection></subsection><subsection ssid="4-74" dnum="8-o" numlevel="1" lineno="582" slineno="7-135" level="1"><display>(8)</display>A unit owner's agent may, on the unit owner's behalf, exercise or assert any right that <ln numlevel="1" lineno="583" slineno="7-136"/>the unit owner has under this section.</subsection><subsection ssid="4-75" dnum="9-o" numlevel="1" lineno="584" slineno="7-137" level="1"><display>(9)</display>An association of unit owners is not liable for identifying or providing a document in <ln numlevel="1" lineno="585" slineno="7-138"/>error, if the association of unit owners identified or provided the erroneous document in <ln numlevel="1" lineno="586" slineno="7-139"/>good faith.</subsection></section></bsec><bsec buid="26" num="57-8-32" type="amend" src="code" uid="C57-8-S32_2025050720250507" sort="57 08 00320020250507" numlevel="1" lineno="587" slineno="8-1" sn="8"><section number="57-8-32" numlevel="1" lineno="588" slineno="8-2" type="amend"><secline lineno="587">Section 8, Section <bold>57-8-32</bold> is amended to read:</secline><catline lineno="588"><bold>57-8-32. Sale of property and common areas and facilities.</bold></catline><subsection ssid="26-26-1" dnum="1-o" numlevel="1" lineno="589" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsection <xref depth="3" refnumber="10-9a-605">10-9a-605</xref>(5) or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>(5), unless otherwise provided in the <ln numlevel="1" lineno="590" slineno="8-4"/>declaration or bylaws, and notwithstanding the provisions of Sections <xref depth="3" refnumber="57-8-30">57-8-30</xref> and <xref depth="3" refnumber="57-8-31"><ln numlevel="1" lineno="591" slineno="8-5"/>57-8-31</xref>, the unit owners may by an affirmative vote of at least 67% of unit owners, elect <ln numlevel="1" lineno="592" slineno="8-6"/>to sell, convey, transfer, or otherwise dispose of the property or all or part of the <ln numlevel="1" lineno="593" slineno="8-7"/>common areas and facilities.</subsection><subsection ssid="26-26-2" dnum="2-o" numlevel="1" lineno="594" slineno="8-8" level="1"><display>(2)</display>An affirmative vote described in Subsection (1) is binding upon all unit owners, and <ln numlevel="1" lineno="595" slineno="8-9"/>each unit owner shall execute and deliver the appropriate instruments and perform all <ln numlevel="1" lineno="596" slineno="8-10"/>acts as necessary to effect the sale, conveyance, transfer, or other disposition of the <ln numlevel="1" lineno="597" slineno="8-11"/>property or common areas and facilities.</subsection><subsection ssid="26-26-3" dnum="3-o" numlevel="1" lineno="598" slineno="8-12" level="1"><display>(3)</display>The general easement of ingress, egress, and use of the common areas and facilities <ln numlevel="1" lineno="599" slineno="8-13"/>granted to an association and unit owners through recorded governing documents is <ln numlevel="1" lineno="600" slineno="8-14"/>extinguished in any portion of the common areas and facilities the unit owners sell, <ln numlevel="1" lineno="601" slineno="8-15"/>convey, transfer, or otherwise dispose of, if:<subsection ssid="26-26-4" dnum="a-o" numlevel="1" lineno="602" slineno="8-16" level="2"><display>(a)</display>the unit owners, in selling, conveying, transferring, or otherwise disposing of the <ln numlevel="1" lineno="603" slineno="8-17"/>portion of the common areas and facilities, comply with:<subsection ssid="26-26-5" dnum="i-o" numlevel="1" lineno="604" slineno="8-18" level="3"><display>(i)</display>the provisions of this section; and</subsection><subsection ssid="26-26-6" dnum="ii-o" numlevel="1" lineno="605" slineno="8-19" level="3"><display>(ii)</display>Section <xref depth="3" refnumber="10-9a-606">10-9a-606</xref> or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>; and</subsection></subsection><subsection ssid="26-26-7" dnum="b-o" numlevel="1" lineno="606" slineno="8-20" level="2"><display>(b)</display>the sale, conveyance, transfer, or other disposition of the portion of the common <ln numlevel="1" lineno="607" slineno="8-21"/>areas and facilities results in a person other than the association or a unit owner <ln numlevel="1" lineno="608" slineno="8-22"/>owning the portion of the common areas and facilities.</subsection></subsection><subsection ssid="26-26-8" dnum="4-o" numlevel="1" lineno="609" slineno="8-23" level="1"><display>(4)</display>This section applies to an association of unit owners regardless of when the association <ln numlevel="1" lineno="610" slineno="8-24"/>of unit owners is created.</subsection><subsection ssid="26-9" dnum="_-o:5-i" numlevel="1" lineno="611" slineno="8-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1337" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">A declarant may not sell any part of the common areas and facilities during the period <ln numlevel="1" lineno="612" slineno="8-26"/>of administrative control, except as provided in Section <xref depth="3" refnumber="10-9a-606">10-9a-606</xref> or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>.</amend></subsection></section></bsec><bsec buid="24" num="57-8-39" type="amend" src="code" uid="C57-8-S39_2025050720250507" sort="57 08 00390020250507" numlevel="1" lineno="613" slineno="9-1" sn="9"><section number="57-8-39" numlevel="1" lineno="614" slineno="9-2" type="amend"><secline lineno="613">Section 9, Section <bold>57-8-39</bold> is amended to read:</secline><catline lineno="614"><bold>57-8-39. slineno="11-7"/>determined by the board of directors in accordance with the terms of the:<subsection ssid="28-28-5" dnum="a-o" numlevel="1" lineno="689" slineno="11-8" level="2"><display>(a)</display>declaration; or</subsection><subsection ssid="28-28-6" dnum="b-o" numlevel="1" lineno="690" slineno="11-9" level="2"><display>(b)</display>bylaws.</subsection></subsection><subsection ssid="28-28-7" dnum="3-o" numlevel="1" lineno="691" slineno="11-10" level="1"><display>(3)</display>An assessment levied against a lot is:<subsection ssid="28-28-8" dnum="a-o" numlevel="1" lineno="692" slineno="11-11" level="2"><display>(a)</display>a debt of the owner at the time the assessment is made; and</subsection><subsection ssid="28-28-9" dnum="b-o" numlevel="1" lineno="693" slineno="11-12" level="2"><display>(b)</display>collectible as a debt described in Subsection <xref depth="4" Availability for examination.</bold></catline><subsection ssid="3-1" dnum="1-o" numlevel="1" lineno="701" slineno="12-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="57-8a-227(1)(b)" start="0">(1)(b)</xref> and regardless of whether the refnumber="16-6a-1602" start="0">16-6a-1602</xref>, <xref depth="3" refnumber="16-6a-1603" start="0">16-6a-1603</xref>, <xref depth="3" refnumber="16-6a-1605" start="0">16-6a-1605</xref>, <xref depth="3" refnumber="16-6a-1606" start="0">16-6a-1606</xref>, and <xref depth="3" refnumber="16-6a-1610" start="0"><ln numlevel="1" lineno="706" slineno="12-8"/>16-6a-1610</xref>;<amendoutstart which the association is currently a party.</amend></subsection></subsection><subsection ssid="3-10" dnum="b-o" numlevel="1" lineno="717" slineno="12-19" level="2"><display>(b)</display>An association may redact the following information from any document the <ln numlevel="1" lineno="718" slineno="12-20"/>association produces for inspection or copying:<subsection ssid="3-11" dnum="i-o" numlevel="1" lineno="719" slineno="12-21" level="3"><display>(i)</display>a Social Security number;</subsection><subsection ssid="3-12" dnum="ii-o" numlevel="1" lineno="720" slineno="12-22" level="3"><display>(ii)</display>a bank account number; or</subsection><subsection ssid="3-13" dnum="iii-o" numlevel="1" lineno="721" slineno="12-23" level="3"><display>(iii)</display>any communication subject to attorney-client privilege.</subsection></subsection></subsection><subsection ssid="3-14" dnum="2-o" numlevel="1" lineno="722" slineno="12-24" level="1" space="false"><display>(2)</display><subsection ssid="3-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the requirements described in Subsection <xref depth="4" refnumber="57-8a-227(1)" start="0">(1)</xref>, an association shall:<subsection ssid="3-16" dnum="i-o" numlevel="1" lineno="723" slineno="12-25" level="3" tab="1"><display>(i)</display>make documents available to lot owners in accordance with the association's <ln numlevel="1" lineno="724" slineno="12-26"/>governing documents; and</subsection><subsection ssid="3-17" dnum="ii-o" numlevel="1" lineno="725" slineno="12-27" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="3-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>if the association has an active website, make the documents described in <ln numlevel="1" lineno="726" slineno="12-28"/>Subsections <xref depth="4" refnumber="57-8a-227(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) through (C) available to lot owners, free of charge, <ln numlevel="1" lineno="727" slineno="12-29"/>through the website; or</subsection><subsection ssid="3-19" dnum="B-o" numlevel="1" lineno="728" slineno="12-30" level="4"><display>(B)</display>if the association does not have an active website, make physical copies of the <ln numlevel="1" lineno="729" slineno="12-31"/>documents described in Subsections <xref depth="4" refnumber="57-8a-227(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) through (C) available to lot <ln numlevel="1" lineno="730" slineno="12-32"/>owners during regular business hours at the association's address registered <ln numlevel="1" lineno="731" slineno="12-33"/>with the Department of Commerce under Section <xref depth="3" refnumber="57-8a-105" start="0">57-8a-105</xref>.</subsection></subsection></subsection><subsection ssid="3-20" dnum="b-o" numlevel="1" lineno="732" slineno="12-34" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="57-8a-227(2)(a)(ii)" start="0">(2)(a)(ii)</xref> does not apply to an association as defined in Section <xref depth="3" refnumber="57-19-2" start="0">57-19-2</xref>.</subsection><subsection ssid="3-21" dnum="c-o" numlevel="1" lineno="733" slineno="12-35" level="2"><display>(c)</display>If a provision of an association's governing documents conflicts with a provision of <ln numlevel="1" lineno="734" slineno="12-36"/>this section, the provision of this section governs.</subsection></subsection><subsection ssid="3-22" dnum="3-o" numlevel="1" lineno="735" slineno="12-37" level="1"><display>(3)</display>In a written request to inspect or copy documents:<subsection ssid="3-23" dnum="a-o" numlevel="1" lineno="736" slineno="12-38" level="2"><display>(a)</display>a lot owner shall include:<subsection ssid="3-24" dnum="i-o" numlevel="1" lineno="737" slineno="12-39" level="3"><display>(i)</display>the association's name;</subsection><subsection ssid="3-25" dnum="ii-o" numlevel="1" lineno="738" slineno="12-40" level="3"><display>(ii)</display>the lot owner's name;</subsection><subsection ssid="3-26" dnum="iii-o" numlevel="1" lineno="739" slineno="12-41" level="3"><display>(iii)</display>the lot owner's property address;</subsection><subsection ssid="3-27" dnum="iv-o" numlevel="1" lineno="740" slineno="12-42" level="3"><display>(iv)</display>the lot owner's email address;</subsection><subsection ssid="3-28" dnum="v-o" numlevel="1" lineno="741" slineno="12-43" level="3"><display>(v)</display>a description of the documents requested; and</subsection><subsection ssid="3-29" dnum="vi-o" numlevel="1" lineno="742" slineno="12-44" level="3"><display>(vi)</display>any election or request described in Subsection <xref depth="4" refnumber="57-8a-227(3)(b)" start="0">(3)(b)</xref>; and</subsection></subsection><subsection ssid="3-30" dnum="b-o" numlevel="1" lineno="743" slineno="12-45" level="2"><display>(b)</display>a lot owner may:<subsection ssid="3-31" dnum="i-o" numlevel="1" lineno="744" slineno="12-46" level="3"><display>(i)</display>elect whether to inspect or copy the documents;</subsection><subsection ssid="3-32" dnum="ii-o" numlevel="1" lineno="745" slineno="12-47" level="3"><display>(ii)</display>if the lot owner elects to copy the documents, request hard copies or electronic <ln numlevel="1" lineno="746" slineno="12-48"/>scans of the documents; or</subsection><subsection ssid="3-33" dnum="iii-o" numlevel="1" lineno="747" slineno="12-49" level="3"><display>(iii)</display>subject to Subsection <xref depth="4" refnumber="57-8a-227(4)" start="0">(4)</xref>, request that:<subsection ssid="3-34" dnum="A-o" numlevel="1" lineno="748" slineno="12-50" level="4"><display>(A)</display>the association make the copies or electronic scans of the requested <ln numlevel="1" lineno="749" slineno="12-51"/>documents;</subsection><subsection ssid="3-35" dnum="B-o" numlevel="1" lineno="750" slineno="12-52" level="4"><display>(B)</display>a recognized third party duplicating service make the copies or electronic <ln numlevel="1" lineno="751" slineno="12-53"/>scans of the requested documents;</subsection><subsection ssid="3-36" dnum="C-o" numlevel="1" lineno="752" slineno="12-54" level="4"><display>(C)</display>the lot owner be allowed to bring any necessary imaging equipment to the <ln numlevel="1" lineno="753" slineno="12-55"/>place of inspection and make copies or electronic scans of the documents while <ln numlevel="1" lineno="754" slineno="12-56"/>inspecting the documents; or</subsection><subsection ssid="3-37" dnum="D-o" numlevel="1" lineno="755" slineno="12-57" level="4"><display>(D)</display>the association email the requested documents to an email address provided in <ln numlevel="1" lineno="756" slineno="12-58"/>the request.</subsection></subsection></subsection></subsection><subsection ssid="3-38" dnum="4-o" numlevel="1" lineno="757" slineno="12-59" level="1" space="false"><display>(4)</display><subsection ssid="3-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An association shall comply with a request described in Subsection <xref depth="4" refnumber="57-8a-227(3)" start="0">(3)</xref><amend anum="0" ea="amend" pairid="55" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both"> within two <ln numlevel="1" lineno="758" slineno="12-60"/>weeks after the day on which the association receives the request</amend>.</subsection><subsection ssid="3-40" dnum="b-o" numlevel="1" lineno="759" slineno="12-61" level="2"><display>(b)</display>If an association produces the copies or electronic scans:<subsection ssid="3-41" dnum="i-o" numlevel="1" lineno="760" slineno="12-62" level="3"><display>(i)</display>the copies or electronic scans shall be legible and accurate;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="3-42" dnum="ii-o" numlevel="1" lineno="761" slineno="12-63" level="3"><display>(ii)</display>the lot owner shall pay the association the reasonable cost of the copies <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">or <ln numlevel="1" lineno="762" slineno="12-64"/>electronic scans </amend><amendoutend style="2"/>and for time spent meeting with the lot owner, which may not <ln numlevel="1" lineno="763" slineno="12-65"/>exceed:<subsection ssid="3-43" dnum="A-o" numlevel="1" lineno="764" slineno="12-66" level="4"><display>(A)</display>the actual cost that the association paid to a recognized third party duplicating <ln numlevel="1" lineno="765" slineno="12-67"/>service to make the copies or electronic scans; or</subsection><subsection ssid="3-44" dnum="B-o" numlevel="1" lineno="766" slineno="12-68" level="4"><display>(B)</display>10 cents per page and $15 per hour for the employee's, manager's, or other <ln numlevel="1" lineno="767" slineno="12-69"/>agent's time<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="61" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="3-84" dnum="_-o:iii-i" numlevel="1" lineno="768" slineno="12-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1437" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">the association may not charge the lot owner for any costs associated with <ln numlevel="1" lineno="769" slineno="12-71"/>fulfilling a request for electronic transmission of the documents described in <ln numlevel="1" lineno="770" slineno="12-72"/>Subsection (3).</amend></subsection></subsection><subsection ssid="3-45" dnum="c-o" numlevel="1" lineno="771" slineno="12-73" level="2"><display>(c)</display>If a lot owner requests a recognized third party duplicating service make the copies <ln numlevel="1" lineno="772" slineno="12-74"/>or electronic scans:<subsection ssid="3-46" dnum="i-o" numlevel="1" lineno="773" slineno="12-75" level="3"><display>(i)</display>the association shall arrange for the delivery and pick up of the original <ln numlevel="1" lineno="774" slineno="12-76"/>documents; and</subsection><subsection ssid="3-47" dnum="ii-o" numlevel="1" lineno="775" slineno="12-77" level="3"><display>(ii)</display>the lot owner shall pay the duplicating service directly.</subsection></subsection><subsection ssid="3-48" dnum="d-o" numlevel="1" lineno="776" slineno="12-78" level="2"><display>(d)</display>If a lot owner requests to bring imaging equipment to the inspection, the association <ln numlevel="1" lineno="777" slineno="12-79"/>shall provide the necessary space, light, and power for the imaging equipment.</subsection></subsection><subsection ssid="3-49" dnum="5-o" numlevel="1" lineno="778" slineno="12-80" level="1"><display>(5)</display>Subject to Subsection <xref depth="4" refnumber="57-8a-227(9)" start="0">(9)</xref>, if, in response to a lot owner's request to inspect or copy <ln numlevel="1" lineno="779" slineno="12-81"/>documents, an association fails to comply with a provision of this section, the <ln numlevel="1" lineno="780" slineno="12-82"/>association shall pay:<subsection ssid="3-50" dnum="a-o" numlevel="1" lineno="781" slineno="12-83" level="2"><display>(a)</display>the reasonable costs of inspecting and copying the requested documents;</subsection><subsection ssid="3-51" dnum="b-o" numlevel="1" lineno="782" slineno="12-84" level="2"><display>(b)</display>for items described in Subsections <xref depth="4" refnumber="57-8a-227(1)(a)(ii)" start="0">(1)(a)(ii)</xref>(A) through (C), $25 to the lot owner <ln numlevel="1" lineno="783" slineno="12-85"/>who made the request for each day the request continues unfulfilled, beginning the <ln numlevel="1" lineno="784" slineno="12-86"/>sixth day after the day on which the lot owner made the request; and</subsection><subsection ssid="3-52" dnum="c-o" numlevel="1" lineno="785" slineno="12-87" level="2"><display>(c)</display>reasonable attorney fees and costs incurred by the lot owner in obtaining the <ln numlevel="1" lineno="786" slineno="12-88"/>inspection and copies of the requested documents.</subsection></subsection><subsection ssid="3-53" dnum="6-o" numlevel="1" lineno="787" slineno="12-89" level="1" space="false"><display>(6)</display><subsection ssid="3-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to any remedy in the association's governing documents or otherwise <ln numlevel="1" lineno="788" slineno="12-90"/>provided by law, a lot owner may file an action in court under this section if:<subsection ssid="3-55" dnum="i-o" numlevel="1" lineno="789" slineno="12-91" level="3" tab="1"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="57-8a-227(9)" start="0">(9)</xref>, an association fails to make documents available to the <ln numlevel="1" lineno="790" slineno="12-92"/>lot owner in accordance with this section, the association's governing documents, <ln numlevel="1" lineno="791" slineno="12-93"/>or as otherwise provided by law; and</subsection><subsection ssid="3-56" dnum="ii-o" numlevel="1" lineno="792" slineno="12-94" level="3" tab="1"><display>(ii)</display>the association fails to timely comply with a notice described in Subsection <xref depth="4" refnumber="57-8a-227(6)(d)" start="0">(6)(d)</xref>.</subsection></subsection><subsection ssid="3-57" dnum="b-o" numlevel="1" lineno="793" slineno="12-95" level="2"><display>(b)</display>In an action described in Subsection <xref depth="4" refnumber="57-8a-227(6)(a)" start="0">(6)(a)</xref>:<subsection ssid="3-58" dnum="i-o" numlevel="1" lineno="794" slineno="12-96" level="3"><display>(i)</display>the lot owner may request:<subsection ssid="3-59" dnum="A-o" numlevel="1" lineno="795" slineno="12-97" level="4"><display>(A)</display>injunctive relief requiring the association to comply with the provisions of this <ln numlevel="1" lineno="796" slineno="12-98"/>section;</subsection><subsection ssid="3-60" dnum="B-o" numlevel="1" lineno="797" slineno="12-99" level="4"><display>(B)</display>$500 or actual damage, whichever is greater; or</subsection><subsection ssid="3-61" dnum="C-o" numlevel="1" lineno="798" slineno="12-100" level="4"><display>(C)</display>any other relief provided by law; and</subsection></subsection><subsection ssid="3-62" dnum="ii-o" numlevel="1" lineno="799" slineno="12-101" level="3"><display>(ii)</display>the court shall award costs and reasonable attorney fees to the prevailing party, <ln numlevel="1" lineno="800" slineno="12-102"/>including any reasonable attorney fees incurred before the action was filed that <ln numlevel="1" lineno="801" slineno="12-103"/>relate to the request that is the subject of the action.</subsection></subsection><subsection ssid="3-63" dnum="c-o" numlevel="1" lineno="802" slineno="12-104" level="2" space="false"><display>(c)</display><subsection ssid="3-64" dnum="i-o" level="3" placement="sameline"><display>(i)</display>In an action described in Subsection <xref depth="4" refnumber="57-8a-227(6)(a)" start="0">(6)(a)</xref>, upon motion by the lot owner, <ln numlevel="1" lineno="803" slineno="12-105"/>notice to the association, and a hearing in which the court finds a likelihood that <ln numlevel="1" lineno="804" slineno="12-106"/>the association failed to comply with a provision of this section, the court shall <ln numlevel="1" lineno="805" slineno="12-107"/>order the association to immediately comply with the provision.</subsection><subsection ssid="3-65" dnum="ii-o" numlevel="1" lineno="806" slineno="12-108" level="3"><display>(ii)</display>The court shall hold a hearing described in Subsection <xref depth="4" refnumber="57-8a-227(6)(c)(i)" start="0">(6)(c)(i)</xref> within 30 days <ln numlevel="1" lineno="807" slineno="12-109"/>after the day on which the lot owner files the motion.</subsection></subsection><subsection ssid="3-66" dnum="d-o" numlevel="1" lineno="808" slineno="12-110" level="2"><display>(d)</display>At least 10 days before the day on which a lot owner files an action described in <ln numlevel="1" lineno="809" slineno="12-111"/>Subsection <xref depth="4" refnumber="57-8a-227(6)(a)" start="0">(6)(a)</xref>, the lot owner shall deliver a written notice to the association that <ln numlevel="1" lineno="810" slineno="12-112"/>states:<subsection ssid="3-67" dnum="i-o" numlevel="1" lineno="811" slineno="12-113" level="3"><display>(i)</display>the lot owner's name, address, telephone number, and email address;</subsection><subsection ssid="3-68" dnum="ii-o" numlevel="1" lineno="812" slineno="12-114" level="3"><display>(ii)</display>each requirement of this section with which the association has failed to comply;</subsection><subsection ssid="3-69" dnum="iii-o" numlevel="1" lineno="813" slineno="12-115" level="3"><display>(iii)</display>a demand that the association comply with each requirement with which the <ln numlevel="1" lineno="814" slineno="12-116"/>association has failed to comply; and</subsection><subsection ssid="3-70" dnum="iv-o" numlevel="1" lineno="815" slineno="12-117" level="3"><display>(iv)</display>a date by which the association shall remedy the association's noncompliance <ln numlevel="1" lineno="816" slineno="12-118"/>that is at least 10 days after the day on which the lot owner delivers the notice to <ln numlevel="1" lineno="817" slineno="12-119"/>the association.</subsection></subsection></subsection><subsection ssid="3-71" dnum="7-o" numlevel="1" lineno="818" slineno="12-120" level="1" space="false"><display>(7)</display><subsection ssid="3-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The provisions of Section <xref depth="3" refnumber="16-6a-1604" start="0">16-6a-1604</xref> do not apply to an association.</subsection><subsection ssid="3-73" dnum="b-o" numlevel="1" lineno="819" slineno="12-121" level="2"><display>(b)</display>The provisions of this section apply regardless of any conflicting provision in <xref depth="1" refnumber="16-6a" start="0">Title <ln numlevel="1" lineno="820" slineno="12-122"/>16, Chapter 6a, Utah Revised Nonprofit Corporation Act</xref>.</subsection></subsection><subsection ssid="3-74" dnum="8-o" numlevel="1" lineno="821" slineno="12-123" level="1"><display>(8)</display>A lot owner's agent may, on the lot owner's behalf, exercise or assert any right that the <ln numlevel="1" lineno="822" slineno="12-124"/>lot owner has under this section.</subsection><subsection ssid="3-75" dnum="9-o" numlevel="1" lineno="823" slineno="12-125" level="1"><display>(9)</display>An association is not liable for identifying or providing a document in error, if the <ln numlevel="1" lineno="824" slineno="12-126"/>association identified or provided the erroneous document in good faith.</subsection></section></bsec><bsec buid="15" type="amend" src="code" num="57-8a-232" uid="C57-8a-S232_2025050720250507" sort="57 08a02320020250507" numlevel="1" lineno="825" slineno="13-1" sn="13"><section number="57-8a-232" numlevel="1" lineno="826" slineno="13-2" type="amend"><secline lineno="825">Section 13, Section <bold>57-8a-232</bold> is amended to read:</secline><catline lineno="826"><bold>57-8a-232. Sale of common areas.</bold></catline><subsection ssid="15-1" dnum="1-o" numlevel="1" lineno="827" slineno="13-3" level="1" placement="noreturn"><display>(1)</display>Subject to Subsection <xref depth="3" refnumber="10-9a-606">10-9a-606</xref>(5) or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>(5), unless otherwise provided in the <ln numlevel="1" lineno="828" slineno="13-4"/>governing documents, an association may by an affirmative vote of at least 67% of the <ln numlevel="1" lineno="829" slineno="13-5"/>voting interests of the association, elect to sell, convey, transfer, or otherwise dispose of <ln numlevel="1" lineno="830" slineno="13-6"/>all or part of the common areas.</subsection><subsection ssid="15-2" dnum="2-o" numlevel="1" lineno="831" slineno="13-7" level="1"><display>(2)</display>An affirmative vote described in Subsection (1) is binding upon all lot owners, and each <ln numlevel="1" lineno="832" slineno="13-8"/>lot owner shall execute and deliver the appropriate instruments and perform all acts as <ln numlevel="1" lineno="833" slineno="13-9"/>necessary to effect the sale, conveyance, transfer, or other disposition of the common <ln numlevel="1" lineno="834" slineno="13-10"/>areas.</subsection><subsection ssid="15-3" dnum="3-o" numlevel="1" lineno="835" slineno="13-11" level="1"><display>(3)</display>The general easement of ingress, egress, and use of the common areas and facilities <ln numlevel="1" lineno="836" slineno="13-12"/>granted to an association and lot owners through recorded governing documents is <ln numlevel="1" lineno="837" slineno="13-13"/>extinguished in any portion of the common areas and facilities the association sells, <ln numlevel="1" lineno="838" slineno="13-14"/>conveys, transfers, or otherwise disposes of, if:<subsection ssid="15-4" dnum="a-o" numlevel="1" lineno="839" slineno="13-15" level="2"><display>(a)</display>the lot owners, in selling, conveying, transferring, or otherwise disposing of the <ln numlevel="1" lineno="840" slineno="13-16"/>portion of the common areas, comply with:<subsection ssid="15-5" dnum="i-o" numlevel="1" lineno="841" slineno="13-17" level="3"><display>(i)</display>the provisions of this section; and</subsection><subsection ssid="15-6" dnum="ii-o" numlevel="1" lineno="842" slineno="13-18" level="3"><display>(ii)</display>Section <xref depth="3" refnumber="10-9a-606">10-9a-606</xref> or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>; and</subsection></subsection><subsection ssid="15-7" dnum="b-o" numlevel="1" lineno="843" slineno="13-19" level="2"><display>(b)</display>the sale, conveyance, transfer, or other disposition of the portion of the common <ln numlevel="1" lineno="844" slineno="13-20"/>areas results in a person other than the association or a lot owner owning the portion <ln numlevel="1" lineno="845" slineno="13-21"/>of the common areas and facilities.</subsection></subsection><subsection ssid="15-8" dnum="4-o" numlevel="1" lineno="846" slineno="13-22" level="1"><display>(4)</display>This section applies to an association regardless of when the association is created.</subsection><subsection ssid="15-9" dnum="_-o:5-i" numlevel="1" lineno="847" slineno="13-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1477" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">A declarant may not sell any part of the common areas during the period of <ln numlevel="1" lineno="848" slineno="13-24"/>administrative control, except as provided in Section <xref depth="3" refnumber="10-9a-606">10-9a-606</xref> or <xref depth="3" refnumber="17-27a-606">17-27a-606</xref>.</amend></subsection></section></bsec><bsec buid="33" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="849" slineno="14-1" sn="14"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="849">Section 14.  <bold>Effective Date.</bold></secline><sectionText lineno="850"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-5-25 1:04 PM</tm></rev></foot></leg>
