Definitions.</bold></catline><sectionText lineno="29"><tab/>As used in this title:</sectionText><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-4" level="1"><display>(1)</display>"Circulator alley" means a publicly owned passageway:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-5" level="2"><display>(a)</display>with a right-of-way width of 20 feet or greater;</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="32" slineno="1-6" level="2"><display>(b)</display>located within a master planned community;</subsection><subsection ssid="1-1-4" dnum="c-o" numlevel="1" lineno="33" slineno="1-7" level="2"><display>(c)</display>established by the city having jurisdictional authority as part of the street network for <ln numlevel="1" lineno="34" slineno="1-8"/>traffic circulation that may also be used for:<subsection ssid="1-1-5" dnum="i-o" numlevel="1" lineno="35" slineno="1-9" level="3"><display>(i)</display>garbage collection;</subsection><subsection ssid="1-1-6" dnum="ii-o" numlevel="1" lineno="36" slineno="1-10" level="3"><display>(ii)</display>access to residential garages; or</subsection><subsection ssid="1-1-7" dnum="iii-o" numlevel="1" lineno="37" slineno="1-11" level="3"><display>(iii)</display>access rear entrances to a commercial establishment; and</subsection></subsection><subsection ssid="1-1-8" dnum="d-o" numlevel="1" lineno="38" slineno="1-12" level="2"><display>(d)</display>constructed with a bituminous or concrete pavement surface.</subsection></subsection><subsection ssid="1-1-9" dnum="2-o" numlevel="1" lineno="39" slineno="1-13" level="1"><display>(2)</display>"Commission" means the Transportation Commission created under Section <xref depth="3" refnumber="72-1-301" start="0">72-1-301</xref>.</subsection><subsection ssid="1-1-10" dnum="3-o" numlevel="1" lineno="40" slineno="1-14" level="1"><display>(3)</display>"Construction" means the construction, reconstruction, replacement, and improvement <ln numlevel="1" lineno="41" slineno="1-15"/>of the highways, including the acquisition of rights-of-way and material sites.</subsection><subsection ssid="1-1-11" dnum="4-o" numlevel="1" lineno="42" slineno="1-16" level="1"><display>(4)</display>"Department" means the Department of Transportation created in Section <xref depth="3" refnumber="72-1-201" start="0">72-1-201</xref>.</subsection><subsection ssid="1-1-12" dnum="5-o" numlevel="1" lineno="43" slineno="1-17" level="1"><display>(5)</display>"Executive director" means the executive director of the department appointed under <ln numlevel="1" lineno="44" slineno="1-18"/>Section <xref depth="3" refnumber="72-1-202" start="0">72-1-202</xref>.</subsection><subsection ssid="1-1-13" dnum="6-o" numlevel="1" lineno="45" slineno="1-19" level="1"><display>(6)</display>"Farm tractor" has the meaning set forth in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection><subsection ssid="1-1-14" dnum="7-o" numlevel="1" lineno="46" slineno="1-20" level="1"><display>(7)</display>"Federal aid primary highway" means that portion of connected main highways located <ln numlevel="1" lineno="47" slineno="1-21"/>within this state officially designated by the department and approved by the United <ln numlevel="1" lineno="48" slineno="1-22"/>States Secretary of Transportation under <ext_ref depth="0" refnumber="23" start="0">Title 23</ext_ref>, Highways, U.S.C.</subsection><subsection ssid="1-1-15" dnum="8-o" numlevel="1" lineno="49" slineno="1-23" level="1"><display>(8)</display>"Fixed guideway" means the same as that term is defined in Section <xref depth="3" refnumber="59-12-102" start="0">59-12-102</xref>.</subsection><subsection ssid="1-1-16" dnum="9-o" numlevel="1" lineno="50" slineno="1-24" level="1" space="false"><display>(9)</display><subsection ssid="1-1-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Fixed guideway capital development" means a project to construct or reconstruct <ln numlevel="1" lineno="51" slineno="1-25"/>a public transit fixed guideway facility that will add capacity to a fixed guideway <ln numlevel="1" lineno="52" slineno="1-26"/>public transit facility.</subsection><subsection ssid="1-1-18" dnum="b-o" numlevel="1" lineno="53" slineno="1-27" level="2"><display>(b)</display>"Fixed guideway capital development" includes:<subsection ssid="1-1-19" dnum="i-o" numlevel="1" lineno="54" slineno="1-28" level="3"><display>(i)</display>a project to strategically double track commuter rail lines; and</subsection><subsection ssid="1-1-20" dnum="ii-o" numlevel="1" lineno="55" slineno="1-29" level="3"><display>(ii)</display>a project to develop and construct public transit facilities and related <ln numlevel="1" lineno="56" slineno="1-30"/>infrastructure pertaining to the Point of the Mountain State Land Authority created <ln numlevel="1" lineno="57" slineno="1-31"/>in Section <xref depth="3" refnumber="11-59-201" start="0">11-59-201</xref>.</subsection></subsection></subsection><subsection ssid="1-1-21" dnum="10-o" numlevel="1" lineno="58" slineno="1-32" level="1"><display>(10)</display>"Greenfield" means the same as that term is defined in Section <xref depth="3" refnumber="17C-1-102" start="0">17C-1-102</xref>.</subsection><subsection ssid="1-1-22" dnum="11-o" numlevel="1" lineno="59" slineno="1-33" level="1"><display>(11)</display>"Highway" means any public road, street, alley, lane, court, place, viaduct, tunnel, <ln numlevel="1" lineno="60" slineno="1-34"/>culvert, bridge, or structure laid out or erected for public use, or dedicated or abandoned <ln numlevel="1" lineno="61" slineno="1-35"/>to the public, or made  public in an action for the partition of real property, including the <ln numlevel="1" lineno="62" slineno="1-36"/>entire area within the right-of-way.</subsection><subsection ssid="1-1-23" dnum="12-o" numlevel="1" lineno="63" slineno="1-37" level="1"><display>(12)</display>"Highway authority" means the department or the legislative, executive, or governing <ln numlevel="1" lineno="64" slineno="1-38"/>body of a county or municipality.</subsection><subsection ssid="1-1-24" dnum="13-o" numlevel="1" lineno="65" slineno="1-39" level="1"><display>(13)</display>"Housing and transit reinvestment zone" means the same as that term is defined in <ln numlevel="1" lineno="66" slineno="1-40"/>Section <xref depth="3" refnumber="63N-3-602" start="0">63N-3-602</xref>.</subsection><subsection ssid="1-1-25" dnum="14-o" numlevel="1" lineno="67" slineno="1-41" level="1"><display>(14)</display>"Implement of husbandry" has the meaning set forth in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection><subsection ssid="1-1-26" dnum="15-o" numlevel="1" lineno="68" slineno="1-42" level="1"><display>(15)</display>"Interstate system" means any highway officially designated by the department and <ln numlevel="1" lineno="69" slineno="1-43"/>included as part of the national interstate and defense highways, as provided in the <ln numlevel="1" lineno="70" slineno="1-44"/>Federal Aid Highway Act of 1956 and any supplemental acts or amendments.</subsection><subsection ssid="1-1-27" dnum="16-o" numlevel="1" lineno="71" slineno="1-45" level="1"><display>(16)</display>"Large public transit district" means the same as that term is defined in Section <xref depth="3" refnumber="17B-2a-802" start="0"><ln numlevel="1" lineno="72" slineno="1-46"/>17B-2a-802</xref>.</subsection><subsection ssid="1-1-28" dnum="17-o" numlevel="1" lineno="73" slineno="1-47" level="1"><display>(17)</display>"Limited-access facility" means a highway especially designated for through traffic, <ln numlevel="1" lineno="74" slineno="1-48"/>and over, from, or to which neither owners nor occupants of abutting lands nor other <ln numlevel="1" lineno="75" slineno="1-49"/>persons have any right or easement, or have only a limited right or easement of access, <ln numlevel="1" lineno="76" slineno="1-50"/>light, air, or view.</subsection><subsection ssid="1-1-29" dnum="18-o" numlevel="1" lineno="77" slineno="1-51" level="1"><display>(18)</display>"Master planned community" means a land use development:<subsection ssid="1-1-30" dnum="a-o" numlevel="1" lineno="78" slineno="1-52" level="2"><display>(a)</display>designated by the city as a master planned community; and</subsection><subsection ssid="1-1-31" dnum="b-o" numlevel="1" lineno="79" slineno="1-53" level="2"><display>(b)</display>comprised of a single development agreement for a development larger than 500 <ln numlevel="1" lineno="80" slineno="1-54"/>acres.</subsection></subsection><subsection ssid="1-1-32" dnum="19-o" numlevel="1" lineno="81" slineno="1-55" level="1"><display>(19)</display>"Motor vehicle" has the same meaning set forth in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection><subsection ssid="1-1-33" dnum="20-o" numlevel="1" lineno="82" slineno="1-56" level="1"><display>(20)</display>"Municipality" has the same meaning set forth in Section <xref depth="3" refnumber="10-1-104" start="0">10-1-104</xref>.</subsection><subsection ssid="1-1-34" dnum="21-o" numlevel="1" lineno="83" slineno="1-57" level="1"><display>(21)</display>"National highway systems highways" means that portion of connected main highways <ln numlevel="1" lineno="84" slineno="1-58"/>located within this state officially designated by the department and approved by the <ln numlevel="1" lineno="85" slineno="1-59"/>United States Secretary of Transportation under <ext_ref depth="0" refnumber="23" start="0">Title 23</ext_ref>, Highways, U.S.C.</subsection><subsection ssid="1-1-35" dnum="22-o" numlevel="1" lineno="86" slineno="1-60" level="1" space="false"><display>(22)</display><subsection ssid="1-1-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Port-of-entry" means a fixed or temporary facility constructed, operated, and <ln numlevel="1" lineno="87" slineno="1-61"/>maintained by the department where drivers, vehicles, and vehicle loads are checked <ln numlevel="1" lineno="88" slineno="1-62"/>or inspected for compliance with state and federal laws as specified in Section <xref depth="3" refnumber="72-9-501" start="0"><ln numlevel="1" lineno="89" slineno="1-63"/>72-9-501</xref>.</subsection><subsection ssid="1-1-37" dnum="b-o" numlevel="1" lineno="90" slineno="1-64" level="2"><display>(b)</display>"Port-of-entry" includes inspection and checking stations and weigh stations.</subsection></subsection><subsection ssid="1-1-38" dnum="23-o" numlevel="1" lineno="91" slineno="1-65" level="1"><display>(23)</display>"Port-of-entry agent" means a person employed at a port-of-entry to perform the duties <ln numlevel="1" lineno="92" slineno="1-66"/>specified in Section <xref depth="3" refnumber="72-9-501" start="0">72-9-501</xref>.</subsection><subsection ssid="1-1-39" dnum="24-o" numlevel="1" lineno="93" slineno="1-67" level="1"><display>(24)</display>"Public transit" means the same as that term is defined in Section <xref depth="3" refnumber="17B-2a-802" start="0">17B-2a-802</xref>.</subsection><subsection ssid="1-1-40" dnum="25-o" numlevel="1" lineno="94" slineno="1-68" level="1"><display>(25)</display>"Public transit facility" means a fixed guideway, transit vehicle, transit station, depot, <ln numlevel="1" lineno="95" slineno="1-69"/>passenger loading or unloading zone, parking lot, or other facility:<subsection ssid="1-1-41" dnum="a-o" numlevel="1" lineno="96" slineno="1-70" level="2"><display>(a)</display>leased by or operated by or on behalf of a public transit district; and</subsection><subsection ssid="1-1-42" dnum="b-o" numlevel="1" lineno="97" slineno="1-71" level="2"><display>(b)</display>related to the public transit services provided by the district, including:<subsection ssid="1-1-43" dnum="i-o" numlevel="1" lineno="98" slineno="1-72" level="3"><display>(i)</display>railway or other right-of-way;</subsection><subsection ssid="1-1-44" dnum="ii-o" numlevel="1" lineno="99" slineno="1-73" level="3"><display>(ii)</display>railway line; and</subsection><subsection ssid="1-1-45" dnum="iii-o" numlevel="1" lineno="100" slineno="1-74" level="3"><display>(iii)</display>a reasonable area immediately adjacent to a designated stop on a route traveled <ln numlevel="1" lineno="101" slineno="1-75"/>by a transit vehicle.</subsection></subsection></subsection><subsection ssid="1-1-46" dnum="26-o" numlevel="1" lineno="102" slineno="1-76" level="1"><display>(26)</display>"Right-of-way" means real property or an interest in real property, usually in a strip, <ln numlevel="1" lineno="103" slineno="1-77"/>acquired for or devoted to state transportation purposes.</subsection><subsection ssid="1-1-47" dnum="27-o" numlevel="1" lineno="104" slineno="1-78" level="1"><display>(27)</display>"Sealed" does not preclude acceptance of electronically sealed and submitted bids or <ln numlevel="1" lineno="105" slineno="1-79"/>proposals in addition to bids or proposals manually sealed and submitted.</subsection><subsection ssid="1-1-48" dnum="28-o" numlevel="1" lineno="106" slineno="1-80" level="1"><display>(28)</display>"Semitrailer" has the meaning set forth in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection><subsection ssid="1-1-49" dnum="29-o" numlevel="1" lineno="107" slineno="1-81" level="1"><display>(29)</display>"SR" means state route and has the same meaning as state highway as defined in this <ln numlevel="1" lineno="108" slineno="1-82"/>section.</subsection><subsection ssid="1-1-50" dnum="30-o" numlevel="1" lineno="109" slineno="1-83" level="1"><display>(30)</display>"State highway" means those highways designated as state highways in <xref depth="1" refnumber="72-4" start="0">Title 72, <ln numlevel="1" lineno="110" slineno="1-84"/>Chapter 4, Designation of State Highways Act</xref>.</subsection><subsection ssid="1-1-51" dnum="31-o" numlevel="1" lineno="111" slineno="1-85" level="1"><display>(31)</display>"State transportation purposes" has the meaning set forth in Section <xref depth="3" refnumber="72-5-102" start="0">72-5-102</xref>.</subsection><subsection ssid="1-1-52" dnum="32-o" numlevel="1" lineno="112" slineno="1-86" level="1"><display>(32)</display>"State transportation systems" means all streets, alleys, roads, highways, pathways, and <ln numlevel="1" lineno="113" slineno="1-87"/>thoroughfares of any kind, including connected structures, airports, aerial corridor <ln numlevel="1" lineno="114" slineno="1-88"/>infrastructure, spaceports, public transit facilities, and all other modes and forms of <ln numlevel="1" lineno="115" slineno="1-89"/>conveyance used by the public.</subsection><subsection ssid="1-1-53" dnum="33-o" numlevel="1" lineno="116" slineno="1-90" level="1"><display>(33)</display>"Trailer" has the meaning set forth in Section <xref depth="3" refnumber="41-1a-102" start="0">41-1a-102</xref>.</subsection><subsection ssid="1-58" dnum="_-o:34-i" numlevel="1" lineno="117" slineno="1-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(34)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">"Transportation corridor" means the path or proposed path of a transportation facility <ln numlevel="1" lineno="118" slineno="1-92"/>that exists or that may exist in the future.</amend></subsection><subsection ssid="1-60" dnum="_-o:35-i" numlevel="1" lineno="119" slineno="1-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(35)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">"Transportation corridor" may include:</amend><subsection ssid="1-61" dnum="_-o:a-i" numlevel="1" lineno="120" slineno="1-94" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">the land occupied or that may be occupied by a transportation facility; and</amend></subsection><subsection ssid="1-62" dnum="_-o:b-i" numlevel="1" lineno="121" slineno="1-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">any other land that may be needed for expanding, operating, or controlling access to <ln numlevel="1" lineno="122" slineno="1-96"/>the transportation facility.</amend></subsection></subsection><subsection ssid="1-63" dnum="_-o:36-i" numlevel="1" lineno="123" slineno="1-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(36)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">"Transportation facility" means:</amend><subsection ssid="1-64" dnum="_-o:a-i" numlevel="1" lineno="124" slineno="1-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">a highway; and</subsection><subsection ssid="3-3-3" dnum="b-o" numlevel="1" lineno="139" slineno="2-9" level="2"><display>(b)</display>the deputy director of planning and investment.</subsection></subsection><subsection ssid="3-3-4" dnum="2-o" numlevel="1" lineno="140" slineno="2-10" level="1"><display>(2)</display>As assigned by the executive director, the deputy directors described in Subsection (1) <ln numlevel="1" lineno="141" slineno="2-11"/>may assist the executive director with the following departmental responsibilities:<subsection ssid="3-3-5" dnum="a-o" numlevel="1" lineno="142" slineno="2-12" level="2"><display>(a)</display>project development, including statewide standards for project design and <ln numlevel="1" lineno="143" slineno="2-13"/>construction, right-of-way, materials, testing, structures, and construction;</subsection><subsection ssid="3-3-6" dnum="b-o" numlevel="1" lineno="144" slineno="2-14" level="2"><display>(b)</display>oversight of the management of the region offices described in Section <xref depth="3" refnumber="72-1-205">72-1-205</xref>;</subsection><subsection ssid="3-3-7" dnum="c-o" numlevel="1" lineno="145" slineno="2-15" level="2"><display>(c)</display>operations and traffic management;</subsection><subsection ssid="3-3-8" dnum="d-o" numlevel="1" lineno="146" slineno="2-16" level="2"><display>(d)</display>oversight of operations of motor carriers and ports;</subsection><subsection ssid="3-3-9" dnum="e-o" numlevel="1" lineno="147" slineno="2-17" level="2"><display>(e)</display>transportation systems safety;</subsection><subsection ssid="3-3-10" dnum="f-o" numlevel="1" lineno="148" slineno="2-18" level="2"><display>(f)</display>aeronautical operations;</subsection><subsection ssid="3-3-11" dnum="g-o" numlevel="1" lineno="149" slineno="2-19" level="2"><display>(g)</display>equipment for department engineering and maintenance functions;</subsection><subsection ssid="3-3-12" dnum="h-o" numlevel="1" lineno="150" slineno="2-20" level="2"><display>(h)</display>oversight and coordination of planning, including:<subsection ssid="3-3-13" dnum="i-o" numlevel="1" lineno="151" slineno="2-21" level="3"><display>(i)</display>development of statewide strategic initiatives for planning across all modes of <ln numlevel="1" lineno="152" slineno="2-22"/>transportation;</subsection><subsection ssid="3-3-14" dnum="ii-o" numlevel="1" lineno="153" slineno="2-23" level="3"><display>(ii)</display>coordination with metropolitan planning organizations and local governments;</subsection><subsection ssid="3-3-15" dnum="iii-o" numlevel="1" lineno="154" slineno="2-24" level="3"><display>(iii)</display>coordination with a large public transit district, including planning, project <ln numlevel="1" lineno="155" slineno="2-25"/>development, outreach, programming, environmental studies and impact <ln numlevel="1" lineno="156" slineno="2-26"/>statements, construction, and impacts on public transit operations; and</subsection><subsection ssid="3-3-16" dnum="iv-o" numlevel="1" lineno="157" slineno="2-27" level="3"><display>(iv)</display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor and area planning;</subsection></subsection><subsection ssid="3-3-17" dnum="i-o" numlevel="1" lineno="158" slineno="2-28" level="2"><display>(i)</display>asset management;</subsection><subsection ssid="3-3-18" dnum="j-o" numlevel="1" lineno="159" slineno="2-29" level="2"><display>(j)</display>programming and prioritization of transportation projects;</subsection><subsection ssid="3-3-19" dnum="k-o" numlevel="1" lineno="160" slineno="2-30" level="2"><display>(k)</display>fulfilling requirements for environmental studies and impact statements;</subsection><subsection ssid="3-3-20" dnum="l-o" numlevel="1" lineno="161" slineno="2-31" level="2"><display>(l)</display>resource investment, including identification, development, and oversight of <ln numlevel="1" lineno="162" slineno="2-32"/>public-private partnership opportunities;</subsection><subsection ssid="3-3-21" dnum="m-o" numlevel="1" lineno="163" slineno="2-33" level="2"><display>(m)</display>data analytics services to the department;</subsection><subsection ssid="3-3-22" dnum="n-o" numlevel="1" lineno="164" slineno="2-34" level="2"><display>(n)</display><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor preservation;</subsection><subsection ssid="3-3-23" dnum="o-o" numlevel="1" lineno="165" slineno="2-35" level="2"><display>(o)</display>employee development;</subsection><subsection ssid="3-3-24" dnum="p-o" numlevel="1" lineno="166" slineno="2-36" level="2"><display>(p)</display>maintenance planning;</subsection><subsection ssid="3-3-25" dnum="q-o" numlevel="1" lineno="167" slineno="2-37" level="2"><display>(q)</display>oversight and facilitation of the negotiations and integration of public transit <ln numlevel="1" lineno="168" slineno="2-38"/>providers described in Section <xref depth="3" refnumber="17B-2a-827">17B-2a-827</xref>;</subsection><subsection ssid="3-3-26" dnum="r-o" numlevel="1" lineno="169" slineno="2-39" level="2"><display>(r)</display>oversight and supervision of any fixed guideway capital development project within <ln numlevel="1" lineno="170" slineno="2-40"/>the boundaries of a large public transit district for which any state funds are <ln numlevel="1" lineno="171" slineno="2-41"/>expended, including those responsibilities described in Subsections (2)(a), (h), (j), <ln numlevel="1" lineno="172" slineno="2-42"/>(k), and (l), and the implementation and enforcement of any federal grant obligations <ln numlevel="1" lineno="173" slineno="2-43"/>associated with fixed guideway capital development project funding; and</subsection><subsection ssid="3-3-27" dnum="s-o" numlevel="1" lineno="174" slineno="2-44" level="2"><display>(s)</display>other departmental responsibilities as determined by the executive director.</subsection></subsection><subsection ssid="3-3-28" dnum="3-o" numlevel="1" lineno="175" slineno="2-45" level="1"><display>(3)</display>The executive director shall ensure that the same deputy director does not oversee or <ln numlevel="1" lineno="176" slineno="2-46"/>supervise both the fixed guideway capital development responsibilities described in <ln numlevel="1" lineno="177" slineno="2-47"/>Subsection (2)(r) and the department's fixed guideway rail safety responsibilities, <ln numlevel="1" lineno="178" slineno="2-48"/>including the responsibilities described in Section <xref depth="3" refnumber="72-1-214">72-1-214</xref>.</subsection></section></bsec><bsec buid="5" num="72-2-117" type="amend" src="code" uid="C72-2-S117_2025050720250507" sort="72 02 01170020250507" numlevel="1" lineno="179" slineno="3-1" sn="3"><section number="72-2-117" numlevel="1" lineno="180" slineno="3-2" type="amend"><secline lineno="179">Section 3, Section <bold>72-2-117</bold> is amended to read:</secline><catline lineno="180"><bold>72-2-117. Marda Dillree Corridor Preservation Fund -- Distribution -- <ln numlevel="1" lineno="181" slineno="3-3"/>Repayment -- Rulemaking.</bold></catline><subsection ssid="5-5-1" dnum="1-o" numlevel="1" lineno="182" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>There is created the Marda Dillree Corridor Preservation Fund within the Transportation <ln numlevel="1" lineno="183" slineno="3-5"/>Fund.</subsection><subsection ssid="5-5-2" dnum="2-o" numlevel="1" lineno="184" slineno="3-6" level="1"><display>(2)</display>The fund shall be funded from the following sources:<subsection ssid="5-5-3" dnum="a-o" numlevel="1" lineno="185" slineno="3-7" level="2"><display>(a)</display>motor vehicle rental tax imposed under Section <xref depth="3" refnumber="59-12-1201" start="0">59-12-1201</xref>;</subsection><subsection ssid="5-5-4" dnum="b-o" numlevel="1" lineno="186" slineno="3-8" level="2"><display>(b)</display>appropriations made to the fund by the Legislature;</subsection><subsection ssid="5-5-5" dnum="c-o" numlevel="1" lineno="187" slineno="3-9" level="2"><display>(c)</display>contributions from other public and private sources for deposit into the fund;</subsection><subsection ssid="5-5-6" dnum="d-o" numlevel="1" lineno="188" slineno="3-10" level="2"><display>(d)</display>interest earnings on cash balances;</subsection><subsection ssid="5-5-7" dnum="e-o" numlevel="1" lineno="189" slineno="3-11" level="2"><display>(e)</display>all money collected for repayments and interest on fund money;</subsection><subsection ssid="5-5-8" dnum="f-o" numlevel="1" lineno="190" slineno="3-12" level="2"><display>(f)</display>all money collected from rents and sales of real property acquired with fund money; <ln numlevel="1" lineno="191" slineno="3-13"/>and</subsection><subsection ssid="5-5-9" dnum="g-o" numlevel="1" lineno="192" slineno="3-14" level="2"><display>(g)</display>proceeds from general obligation bonds, revenue bonds, or other obligations as <ln numlevel="1" lineno="193" slineno="3-15"/>authorized by <xref depth="0" refnumber="63B" start="0">Title 63B, Bonds</xref>.</subsection></subsection><subsection ssid="5-5-10" dnum="3-o" numlevel="1" lineno="194" slineno="3-16" level="1" space="false"><display>(3)</display><subsection ssid="5-5-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission shall authorize the expenditure of fund money to allow the <ln numlevel="1" lineno="195" slineno="3-17"/>department to acquire real property or any interests in real property for state, county, <ln numlevel="1" lineno="196" slineno="3-18"/>and municipal transportation corridors subject to:<subsection ssid="5-5-12" dnum="i-o" numlevel="1" lineno="197" slineno="3-19" level="3" tab="1"><display>(i)</display>money available in the fund;</subsection><subsection ssid="5-5-13" dnum="ii-o" numlevel="1" lineno="198" slineno="3-20" level="3" tab="1"><display>(ii)</display>rules made under Subsection <xref depth="4" refnumber="72-2-117(6)" start="0">(6)</xref>; and</subsection><subsection ssid="5-5-14" dnum="iii-o" numlevel="1" lineno="199" slineno="3-21" level="3" tab="1"><display>(iii)</display>Subsection <xref depth="4" refnumber="72-2-117(8)" start="0">(8)</xref>.</subsection></subsection><subsection ssid="5-5-15" dnum="b-o" numlevel="1" lineno="200" slineno="3-22" level="2"><display>(b)</display>Fund money may be used to pay interest on debts incurred in accordance with this <ln numlevel="1" lineno="201" slineno="3-23"/>section.</subsection></subsection><subsection ssid="5-5-16" dnum="4-o" numlevel="1" lineno="202" slineno="3-24" level="1"><display>(4)</display>Administrative costs for transportation corridor preservation shall be paid from the fund.</subsection><subsection ssid="5-5-17" dnum="5-o" numlevel="1" lineno="203" slineno="3-25" level="1" space="false"><display>(5)</display><subsection ssid="5-5-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The department:<subsection ssid="5-5-19" dnum="i-o" numlevel="1" lineno="204" slineno="3-26" level="3" tab="1"><display>(i)</display>may apply to the commission under this section for money from the Marda Dillree <ln numlevel="1" lineno="205" slineno="3-27"/>Corridor Preservation Fund for a specified transportation corridor project, <ln numlevel="1" lineno="206" slineno="3-28"/>including for county and municipal projects; and</subsection><subsection ssid="5-5-20" dnum="ii-o" numlevel="1" lineno="207" slineno="3-29" level="3" tab="1"><display>(ii)</display>shall repay the fund money authorized for the project to the fund as required <ln numlevel="1" lineno="208" slineno="3-30"/>under Subsection <xref depth="4" refnumber="72-2-117(6)" start="0">(6)</xref>.</subsection></subsection><subsection ssid="5-5-21" dnum="b-o" numlevel="1" lineno="209" slineno="3-31" level="2"><display>(b)</display>The department may request and the commission may approve the expenditure of <ln numlevel="1" lineno="210" slineno="3-32"/>money from the fund to pay the costs of staff and overhead costs to administer the <ln numlevel="1" lineno="211" slineno="3-33"/>fund.</subsection></subsection><subsection ssid="5-5-22" dnum="6-o" numlevel="1" lineno="212" slineno="3-34" level="1"><display>(6)</display>The commission shall:<subsection ssid="5-5-23" dnum="a-o" numlevel="1" lineno="213" slineno="3-35" level="2"><display>(a)</display>administer the Marda Dillree Corridor Preservation Fund to:<subsection ssid="5-5-24" dnum="i-o" numlevel="1" lineno="214" slineno="3-36" level="3"><display>(i)</display>preserve transportation corridors;</subsection><subsection ssid="5-5-25" dnum="ii-o" numlevel="1" lineno="215" slineno="3-37" level="3"><display>(ii)</display>promote long-term statewide transportation planning;</subsection><subsection ssid="5-5-26" dnum="iii-o" numlevel="1" lineno="216" slineno="3-38" level="3"><display>(iii)</display>save on acquisition costs; and</subsection><subsection ssid="5-5-27" dnum="iv-o" numlevel="1" lineno="217" slineno="3-39" level="3"><display>(iv)</display>promote the best interests of the state in a manner which minimizes impact on <ln numlevel="1" lineno="218" slineno="3-40"/>prime agricultural land;</subsection></subsection><subsection ssid="5-5-28" dnum="b-o" numlevel="1" lineno="219" slineno="3-41" level="2"><display>(b)</display>prioritize fund money based on considerations, including:<subsection ssid="5-5-29" dnum="i-o" numlevel="1" lineno="220" slineno="3-42" level="3"><display>(i)</display>areas with rapidly expanding population;</subsection><subsection ssid="5-5-30" dnum="ii-o" numlevel="1" lineno="221" slineno="3-43" level="3"><display>(ii)</display>the willingness of local governments to complete studies and impact statements <ln numlevel="1" lineno="222" slineno="3-44"/>that meet department standards;</subsection><subsection ssid="5-5-31" dnum="iii-o" numlevel="1" lineno="223" slineno="3-45" level="3"><display>(iii)</display>the preservation of <amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridors by the use of local planning and <ln numlevel="1" lineno="224" slineno="3-46"/>zoning processes;</subsection><subsection ssid="5-5-32" dnum="iv-o" numlevel="1" lineno="225" slineno="3-47" level="3"><display>(iv)</display>the availability of other public and private matching funds for a project; and</subsection><subsection ssid="5-5-33" dnum="v-o" numlevel="1" lineno="226" slineno="3-48" level="3"><display>(v)</display>the cost-effectiveness of the preservation projects;</subsection></subsection><subsection ssid="5-5-34" dnum="c-o" numlevel="1" lineno="227" slineno="3-49" level="2"><display>(c)</display>designate high priority <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor preservation projects in cooperation <ln numlevel="1" lineno="228" slineno="3-50"/>with a metropolitan planning organization;</subsection><subsection ssid="5-5-35" dnum="d-o" numlevel="1" lineno="229" slineno="3-51" level="2"><display>(d)</display>administer the program for the purposes provided in this section;</subsection><subsection ssid="5-5-36" dnum="e-o" numlevel="1" lineno="230" slineno="3-52" level="2"><display>(e)</display>prioritize fund money in accordance with this section; and</subsection><subsection ssid="5-5-37" dnum="f-o" numlevel="1" lineno="231" slineno="3-53" level="2"><display>(f)</display>make rules in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="232" slineno="3-54"/>Rulemaking Act</xref>, establishing:<subsection ssid="5-5-38" dnum="i-o" numlevel="1" lineno="233" slineno="3-55" level="3"><display>(i)</display>the procedures for the awarding of fund money;</subsection><subsection ssid="5-5-39" dnum="ii-o" numlevel="1" lineno="234" slineno="3-56" level="3"><display>(ii)</display>the procedures for the department to apply for transportation corridor preservation <ln numlevel="1" lineno="235" slineno="3-57"/>money for projects; and</subsection><subsection ssid="5-5-40" dnum="iii-o" numlevel="1" lineno="236" slineno="3-58" level="3"><display>(iii)</display>repayment conditions of the money to the fund from the specified project funds.</subsection></subsection></subsection><subsection ssid="5-5-41" dnum="7-o" numlevel="1" lineno="237" slineno="3-59" level="1" space="false"><display>(7)</display><subsection ssid="5-5-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The proceeds from any bonds or other obligations secured by revenues of the <ln numlevel="1" lineno="238" slineno="3-60"/>Marda Dillree Corridor Preservation Fund shall be used for:<subsection ssid="5-5-43" dnum="i-o" numlevel="1" lineno="239" slineno="3-61" level="3" tab="1"><display>(i)</display>the acquisition of real property in hardship cases; and</subsection><subsection ssid="5-5-44" dnum="ii-o" numlevel="1" lineno="240" slineno="3-62" level="3" tab="1"><display>(ii)</display>any of the purposes authorized for funds in the Marda Dillree Corridor <ln numlevel="1" lineno="241" slineno="3-63"/>Preservation Fund under this section.</subsection></subsection><subsection ssid="5-5-45" dnum="b-o" numlevel="1" lineno="242" slineno="3-64" level="2"><display>(b)</display>The commission shall pledge the necessary part of the revenues of the Marda Dillree <ln numlevel="1" lineno="243" slineno="3-65"/>Corridor Preservation Fund to the payment of principal of and interest on the bonds <ln numlevel="1" lineno="244" slineno="3-66"/>or other obligations.</subsection></subsection><subsection ssid="5-5-46" dnum="8-o" numlevel="1" lineno="245" slineno="3-67" level="1" space="false"><display>(8)</display><subsection ssid="5-5-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except for the acquisition of a transportation corridor for a fixed guideway, <ln numlevel="1" lineno="246" slineno="3-68"/>the</amend> department may not apply for money under this section unless the highway <ln numlevel="1" lineno="247" slineno="3-69"/>authority has an access management policy or ordinance in effect that meets the <ln numlevel="1" lineno="248" slineno="3-70"/>requirements under Subsection <xref depth="4" refnumber="72-2-117(8)(b)" start="0">(8)(b)</xref>.</subsection><subsection ssid="5-5-48" dnum="b-o" numlevel="1" lineno="249" slineno="3-71" level="2"><display>(b)</display>The access management policy or ordinance shall:<subsection ssid="5-5-49" dnum="i-o" numlevel="1" lineno="250" slineno="3-72" level="3"><display>(i)</display>be for the purpose of balancing the need for reasonable access to land uses with <ln numlevel="1" lineno="251" slineno="3-73"/>the need to preserve the smooth flow of traffic on the highway system in terms of <ln numlevel="1" lineno="252" slineno="3-74"/>safety, capacity, and speed; and</subsection><subsection ssid="5-5-50" dnum="ii-o" numlevel="1" lineno="253" slineno="3-75" level="3"><display>(ii)</display>include provisions:<subsection ssid="5-5-51" dnum="A-o" numlevel="1" lineno="254" slineno="3-76" level="4"><display>(A)</display>limiting the number of conflict points at driveway locations;</subsection><subsection ssid="5-5-52" dnum="B-o" numlevel="1" lineno="255" slineno="3-77" level="4"><display>(B)</display>separating conflict areas;</subsection><subsection ssid="5-5-53" dnum="C-o" numlevel="1" lineno="256" slineno="3-78" level="4"><display>(C)</display>reducing the interference of through traffic;</subsection><subsection ssid="5-5-54" dnum="D-o" numlevel="1" lineno="257" slineno="3-79" level="4"><display>(D)</display>spacing at-grade signalized intersections; and</subsection><subsection ssid="5-5-55" dnum="E-o" numlevel="1" lineno="258" slineno="3-80" level="4"><display>(E)</display>providing for adequate on-site circulation and storage.</subsection></subsection></subsection><subsection ssid="5-5-56" dnum="c-o" numlevel="1" lineno="259" slineno="3-81" level="2"><display>(c)</display>The department shall develop a model access management policy or ordinance that <ln numlevel="1" lineno="260" slineno="3-82"/>meets the requirements of this Subsection <xref depth="4" refnumber="72-2-117(8)" start="0">(8)</xref> for the benefit of a county or <ln numlevel="1" lineno="261" slineno="3-83"/>municipality under this section.</subsection></subsection><subsection ssid="5-5-57" dnum="9-o" numlevel="1" lineno="262" slineno="3-84" level="1" space="false"><display>(9)</display><subsection ssid="5-5-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="263" slineno="3-85"/>the commission shall make rules establishing a <amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor preservation <ln numlevel="1" lineno="264" slineno="3-86"/>advisory council.</subsection><subsection ssid="5-5-59" dnum="b-o" numlevel="1" lineno="265" slineno="3-87" level="2"><display>(b)</display>The <amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor preservation advisory council shall:<subsection ssid="5-5-60" dnum="i-o" numlevel="1" lineno="266" slineno="3-88" level="3"><display>(i)</display>assist with and help coordinate the <amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor preservation efforts of <ln numlevel="1" lineno="267" slineno="3-89"/>the department and local governments;</subsection><subsection ssid="5-5-61" dnum="ii-o" numlevel="1" lineno="268" slineno="3-90" level="3"><display>(ii)</display>provide recommendations and priorities concerning <amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor <ln numlevel="1" lineno="269" slineno="3-91"/>preservation and the use of fund money to the department and to the commission; <ln numlevel="1" lineno="270" slineno="3-92"/>and</subsection><subsection ssid="5-5-62" dnum="iii-o" numlevel="1" lineno="271" slineno="3-93" level="3"><display>(iii)</display>include members designated by each metropolitan planning organization in the <ln numlevel="1" lineno="272" slineno="3-94"/>state to represent local governments that are involved with<amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both"> transportation</amend> corridor <ln numlevel="1" lineno="273" slineno="3-95"/>preservation through official maps and planning.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="72-2-117.5" type="amend" src="code" uid="C72-2-S117.5_2025050720250507" sort="72 02 01170520250507" numlevel="1" lineno="274" slineno="4-1" sn="4"><section number="72-2-117.5" numlevel="1" lineno="275" slineno="4-2" type="amend"><secline lineno="274">Section 4, Section <bold>72-2-117.5</bold> is amended to read:</secline><catline lineno="275"><bold>72-2-117.5. Definitions -- Local Highway and Transportation Corridor <ln numlevel="1" lineno="276" slineno="4-3"/>Preservation Fund -- Disposition of fund money.</bold></catline><subsection ssid="7-7-1" dnum="1-o" numlevel="1" lineno="277" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-7-2" dnum="a-o" numlevel="1" lineno="278" slineno="4-5" level="2"><display>(a)</display>"Council of governments" means a decision-making body in each county composed <ln numlevel="1" lineno="279" slineno="4-6"/>of membership including the county governing body and the mayors of each <ln numlevel="1" lineno="280" slineno="4-7"/>municipality in the county.</subsection><subsection ssid="7-7-3" dnum="b-o" numlevel="1" lineno="281" slineno="4-8" level="2"><display>(b)</display>"Metropolitan planning organization" has the same meaning as defined in Section <xref depth="3" refnumber="72-1-208.5" start="0"><ln numlevel="1" lineno="282" slineno="4-9"/>72-1-208.5</xref>.</subsection></subsection><subsection ssid="7-7-4" dnum="2-o" numlevel="1" lineno="283" slineno="4-10" level="1"><display>(2)</display>There is created the Local Highway and Transportation Corridor Preservation Fund <ln numlevel="1" lineno="284" slineno="4-11"/>within the Transportation Fund.</subsection><subsection ssid="7-7-5" dnum="3-o" numlevel="1" lineno="285" slineno="4-12" level="1"><display>(3)</display>The fund shall be funded from the following sources:<subsection ssid="7-7-6" dnum="a-o" numlevel="1" lineno="286" slineno="4-13" level="2"><display>(a)</display>a local option highway construction and transportation corridor preservation fee <ln numlevel="1" lineno="287" slineno="4-14"/>imposed under Section <xref depth="3" refnumber="41-1a-1222" start="0">41-1a-1222</xref>;</subsection><subsection ssid="7-7-7" dnum="b-o" numlevel="1" lineno="288" slineno="4-15" level="2"><display>(b)</display>appropriations made to the fund by the Legislature;</subsection><subsection ssid="7-7-8" dnum="c-o" numlevel="1" lineno="289" slineno="4-16" level="2"><display>(c)</display>contributions from other public and private sources for deposit into the fund;</subsection><subsection ssid="7-7-9" dnum="d-o" numlevel="1" lineno="290" slineno="4-17" level="2"><display>(d)</display>all money collected from rents and sales of real property acquired with fund money;</subsection><subsection ssid="7-7-10" dnum="e-o" numlevel="1" lineno="291" slineno="4-18" level="2"><display>(e)</display>proceeds from general obligation bonds, revenue bonds, or other obligations issued <ln numlevel="1" lineno="292" slineno="4-19"/>as authorized by <xref depth="0" refnumber="63B" start="0">Title 63B, Bonds</xref>; and</subsection><subsection ssid="7-7-11" dnum="f-o" numlevel="1" lineno="293" slineno="4-20" level="2"><display>(f)</display>sales and use tax revenues deposited into the fund in accordance with <xref depth="2" refnumber="59-12-22" start="0">Title 59, <ln numlevel="1" lineno="294" slineno="4-21"/>Chapter 12, Part 22, Local Option Sales and Use Taxes for Transportation Act</xref>.</subsection></subsection><subsection ssid="7-7-12" dnum="4-o" numlevel="1" lineno="295" slineno="4-22" level="1" space="false"><display>(4)</display><subsection ssid="7-7-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The fund shall earn interest.</subsection><subsection ssid="7-7-14" dnum="b-o" numlevel="1" lineno="296" slineno="4-23" level="2"><display>(b)</display>All interest earned on fund money shall be deposited into the fund.</subsection><subsection ssid="7-7-15" dnum="c-o" numlevel="1" lineno="297" slineno="4-24" level="2"><display>(c)</display>The State Tax Commission shall allocate the revenues:<subsection ssid="7-7-16" dnum="i-o" numlevel="1" lineno="298" slineno="4-25" level="3"><display>(i)</display>provided under Subsection <xref depth="4" refnumber="72-2-117.5(3)(a)" start="0">(3)(a)</xref> to each county imposing a local option highway <ln numlevel="1" lineno="299" slineno="4-26"/>construction and transportation corridor preservation fee under Section <xref depth="3" refnumber="41-1a-1222" start="0">41-1a-1222</xref>;</subsection><subsection ssid="7-7-17" dnum="ii-o" numlevel="1" lineno="300" slineno="4-27" level="3"><display>(ii)</display>provided under Subsection <xref depth="4" refnumber="59-12-2217(2)" start="0">59-12-2217(2)</xref> to each county imposing a county <ln numlevel="1" lineno="301" slineno="4-28"/>option sales and use tax for transportation; and</subsection><subsection ssid="7-7-18" dnum="iii-o" numlevel="1" lineno="302" slineno="4-29" level="3"><display>(iii)</display>provided under Subsection <xref depth="4" refnumber="72-2-117.5(3)(f)" start="0">(3)(f)</xref> to each county of the second class or city or <ln numlevel="1" lineno="303" slineno="4-30"/>town within a county of the second class that imposes the sales and use tax <ln numlevel="1" lineno="304" slineno="4-31"/>authorized by Section <xref depth="3" refnumber="59-12-2218" start="0">59-12-2218</xref>.</subsection></subsection><subsection ssid="7-7-19" dnum="d-o" numlevel="1" lineno="305" slineno="4-32" level="2"><display>(d)</display>The department shall distribute the funds allocated to each county, city, or town <ln numlevel="1" lineno="306" slineno="4-33"/>under Subsection <xref depth="4" refnumber="72-2-117.5(4)(c)" start="0">(4)(c)</xref> to each county, city, or town.</subsection><subsection ssid="7-7-20" dnum="e-o" numlevel="1" lineno="307" slineno="4-34" level="2"><display>(e)</display>The money allocated and distributed under this Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref>:<subsection ssid="7-7-21" dnum="i-o" numlevel="1" lineno="308" slineno="4-35" level="3"><display>(i)</display>shall be used for the purposes provided in this section for each county, city, or <ln numlevel="1" lineno="309" slineno="4-36"/>town;</subsection><subsection ssid="7-7-22" dnum="ii-o" numlevel="1" lineno="310" slineno="4-37" level="3"><display>(ii)</display>is allocated to each county, city, or town as provided in this section with the <ln numlevel="1" lineno="311" slineno="4-38"/>condition that the state will not be charged for any asset purchased with the money <ln numlevel="1" lineno="312" slineno="4-39"/>allocated and distributed under this Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref>, unless there is a written <ln numlevel="1" lineno="313" slineno="4-40"/>agreement in place with the department prior to the purchase of the asset <ln numlevel="1" lineno="314" slineno="4-41"/>stipulating a reimbursement by the state to the county, city, or town of no more <ln numlevel="1" lineno="315" slineno="4-42"/>than the original purchase price paid by the county, city, or town; and</subsection><subsection ssid="7-7-23" dnum="iii-o" numlevel="1" lineno="316" slineno="4-43" level="3"><display>(iii)</display>is considered a local matching contribution for the purposes described under <ln numlevel="1" lineno="317" slineno="4-44"/>Section <xref depth="3" refnumber="72-2-123" start="0">72-2-123</xref> if used on a state highway.</subsection></subsection><subsection ssid="7-7-24" dnum="f-o" numlevel="1" lineno="318" slineno="4-45" level="2"><display>(f)</display>Administrative costs of the department to implement this section shall be paid from <ln numlevel="1" lineno="319" slineno="4-46"/>the fund.</subsection></subsection><subsection ssid="7-7-25" dnum="5-o" numlevel="1" lineno="320" slineno="4-47" level="1" space="false"><display>(5)</display><subsection ssid="7-7-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A highway authority may acquire real property or any interests in real property <ln numlevel="1" lineno="321" slineno="4-48"/>for state, county, and municipal <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">highway or public transit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> corridors <ln numlevel="1" lineno="322" slineno="4-49"/>subject to:<subsection ssid="7-7-27" dnum="i-o" numlevel="1" lineno="323" slineno="4-50" level="3" tab="1"><display>(i)</display>money available in the fund to each county under Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref>; and</subsection><subsection ssid="7-7-28" dnum="ii-o" numlevel="1" lineno="324" slineno="4-51" level="3" tab="1"><display>(ii)</display>the provisions of this section.</subsection></subsection><subsection ssid="7-7-29" dnum="b-o" numlevel="1" lineno="325" slineno="4-52" level="2"><display>(b)</display>Fund money may be used to pay interest on debts incurred in accordance with this <ln numlevel="1" lineno="326" slineno="4-53"/>section.</subsection><subsection ssid="7-7-30" dnum="c-o" numlevel="1" lineno="327" slineno="4-54" level="2" space="false"><display>(c)</display><subsection ssid="7-7-31" dnum="i-o" level="3" placement="sameline" space="false"><display>(i)</display><subsection ssid="7-7-32" dnum="A-o" level="4" tab="1" placement="sameline"><display>(A)</display>Fund money may be used to pay maintenance costs of properties <ln numlevel="1" lineno="328" slineno="4-55"/>acquired under this section but limited to a total of 5% of the purchase price of <ln numlevel="1" lineno="329" slineno="4-56"/>the property.</subsection><subsection ssid="7-7-33" dnum="B-o" numlevel="1" lineno="330" slineno="4-57" level="4" tab="1"><display>(B)</display>Any additional maintenance cost shall be paid from funds other than under <ln numlevel="1" lineno="331" slineno="4-58"/>this section.</subsection><subsection ssid="7-7-34" dnum="C-o" numlevel="1" lineno="332" slineno="4-59" level="4" tab="1"><display>(C)</display>Revenue generated by any property acquired under this section is excluded <ln numlevel="1" lineno="333" slineno="4-60"/>from the limitations under this Subsection <xref depth="4" refnumber="72-2-117.5(5)(c)(i)" start="0">(5)(c)(i)</xref>.</subsection></subsection><subsection ssid="7-7-35" dnum="ii-o" numlevel="1" lineno="334" slineno="4-61" level="3"><display>(ii)</display>Fund money may be used to pay direct costs of acquisition of properties acquired <ln numlevel="1" lineno="335" slineno="4-62"/>under this section.</subsection></subsection><subsection ssid="7-7-36" dnum="d-o" numlevel="1" lineno="336" slineno="4-63" level="2"><display>(d)</display>Fund money allocated and distributed under Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> may be used by a county <ln numlevel="1" lineno="337" slineno="4-64"/>highway authority for countywide transportation or public transit planning if:<subsection ssid="7-7-37" dnum="i-o" numlevel="1" lineno="338" slineno="4-65" level="3"><display>(i)</display>the county's planning focus area is outside the boundaries of a metropolitan <ln numlevel="1" lineno="339" slineno="4-66"/>planning organization;</subsection><subsection ssid="7-7-38" dnum="ii-o" numlevel="1" lineno="340" slineno="4-67" level="3"><display>(ii)</display>the transportation planning is part of the county's continuing, cooperative, and <ln numlevel="1" lineno="341" slineno="4-68"/>comprehensive process for transportation or public transit planning, <amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend><ln numlevel="1" lineno="342" slineno="4-69"/>corridor preservation, right-of-way acquisition, and project programming;</subsection><subsection ssid="7-7-39" dnum="iii-o" numlevel="1" lineno="343" slineno="4-70" level="3"><display>(iii)</display>no more than four years allocation every 20 years to each county is used for <ln numlevel="1" lineno="344" slineno="4-71"/>transportation planning under this Subsection <xref depth="4" refnumber="72-2-117.5(5)(d)" start="0">(5)(d)</xref>; and</subsection><subsection ssid="7-7-40" dnum="iv-o" numlevel="1" lineno="345" slineno="4-72" level="3"><display>(iv)</display>the county otherwise qualifies to use the fund money as provided under this <ln numlevel="1" lineno="346" slineno="4-73"/>section.</subsection></subsection><subsection ssid="7-7-41" dnum="e-o" numlevel="1" lineno="347" slineno="4-74" level="2" space="false"><display>(e)</display><subsection ssid="7-7-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subject to Subsection <xref depth="4" refnumber="72-2-117.5(11)" start="0">(11)</xref>, fund money allocated and distributed under <ln numlevel="1" lineno="348" slineno="4-75"/>Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> may be used by a county highway authority for transportation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">or <ln numlevel="1" lineno="349" slineno="4-76"/>public transit </amend><amendoutend style="2"/>corridor planning that is part of the <amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridor elements <ln numlevel="1" lineno="350" slineno="4-77"/>of an ongoing work program of transportation or public transit projects.</subsection><subsection ssid="7-7-43" dnum="ii-o" numlevel="1" lineno="351" slineno="4-78" level="3"><display>(ii)</display>The transportation corridor planning under Subsection <xref depth="4" refnumber="72-2-117.5(5)(e)(i)" start="0">(5)(e)(i)</xref> shall be under the <ln numlevel="1" lineno="352" slineno="4-79"/>direction of:<subsection ssid="7-7-44" dnum="A-o" numlevel="1" lineno="353" slineno="4-80" level="4"><display>(A)</display>the metropolitan planning organization if the county is within the boundaries <ln numlevel="1" lineno="354" slineno="4-81"/>of a metropolitan planning organization; or</subsection><subsection ssid="7-7-45" dnum="B-o" numlevel="1" lineno="355" slineno="4-82" level="4"><display>(B)</display>the department if the county is not within the boundaries of a metropolitan <ln numlevel="1" lineno="356" slineno="4-83"/>planning organization.</subsection></subsection></subsection><subsection ssid="7-7-46" dnum="f-o" numlevel="1" lineno="357" slineno="4-84" level="2" space="false"><display>(f)</display><subsection ssid="7-7-47" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A county, city, or town that imposes a local option highway construction and <ln numlevel="1" lineno="358" slineno="4-85"/>transportation corridor preservation fee under Section <xref depth="3" refnumber="41-1a-1222" start="0">41-1a-1222</xref> may elect to <ln numlevel="1" lineno="359" slineno="4-86"/>administer the funds allocated and distributed to that county, city, or town under <ln numlevel="1" lineno="360" slineno="4-87"/>Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> as a revolving loan fund.</subsection><subsection ssid="7-7-48" dnum="ii-o" numlevel="1" lineno="361" slineno="4-88" level="3"><display>(ii)</display>If a county, city, or town elects to administer the funds allocated and distributed <ln numlevel="1" lineno="362" slineno="4-89"/>to that county, city, or town under Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> as a revolving loan fund, a local <ln numlevel="1" lineno="363" slineno="4-90"/>highway authority shall repay the fund money authorized for the project to the <ln numlevel="1" lineno="364" slineno="4-91"/>fund.</subsection><subsection ssid="7-7-49" dnum="iii-o" numlevel="1" lineno="365" slineno="4-92" level="3"><display>(iii)</display>A county, city, or town that elects to administer the funds allocated and <ln numlevel="1" lineno="366" slineno="4-93"/>distributed to that county, city, or town under Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> as a revolving loan <ln numlevel="1" lineno="367" slineno="4-94"/>fund shall establish repayment conditions of the money to the fund from the <ln numlevel="1" lineno="368" slineno="4-95"/>specified project funds.</subsection></subsection><subsection ssid="7-7-50" dnum="g-o" numlevel="1" lineno="369" slineno="4-96" level="2" space="false"><display>(g)</display><subsection ssid="7-7-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Subject to the restrictions in Subsections <xref depth="4" refnumber="72-2-117.5(5)(g)(ii)" start="0">(5)(g)(ii)</xref> and <xref depth="4" refnumber="72-2-117.5(5)(g)(iii)" start="0">(iii)</xref>, fund money may <ln numlevel="1" lineno="370" slineno="4-97"/>be used by a county of the third, fourth, fifth, or sixth class or by a city or town <ln numlevel="1" lineno="371" slineno="4-98"/>within a county of the third, fourth, fifth, or sixth class for:<subsection ssid="7-7-52" dnum="A-o" numlevel="1" lineno="372" slineno="4-99" level="4" tab="1"><display>(A)</display>the construction, operation, or maintenance of a class B road or class C road; <ln numlevel="1" lineno="373" slineno="4-100"/>or</subsection><subsection ssid="7-7-53" dnum="B-o" numlevel="1" lineno="374" slineno="4-101" level="4" tab="1"><display>(B)</display>the restoration or repair of survey monuments associated with transportation <ln numlevel="1" lineno="375" slineno="4-102"/>infrastructure.</subsection></subsection><subsection ssid="7-7-54" dnum="ii-o" numlevel="1" lineno="376" slineno="4-103" level="3"><display>(ii)</display>A county, city, or town may not use more than 50% of the current balance of fund <ln numlevel="1" lineno="377" slineno="4-104"/>money allocated to the county, city, or town for the purposes described in <ln numlevel="1" lineno="378" slineno="4-105"/>Subsection <xref depth="4" refnumber="72-2-117.5(5)(g)(i)" start="0">(5)(g)(i)</xref>.</subsection><subsection ssid="7-7-55" dnum="iii-o" numlevel="1" lineno="379" slineno="4-106" level="3"><display>(iii)</display>A county, city, or town may not use more than 50% of the fund revenue <ln numlevel="1" lineno="380" slineno="4-107"/>collections allocated to a county, city, or town in the current fiscal year for the <ln numlevel="1" lineno="381" slineno="4-108"/>purposes described in Subsection <xref depth="4" refnumber="72-2-117.5(5)(g)(i)" start="0">(5)(g)(i)</xref>.</subsection></subsection></subsection><subsection ssid="7-7-56" dnum="6-o" numlevel="1" lineno="382" slineno="4-109" level="1" space="false"><display>(6)</display><subsection ssid="7-7-57" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="7-7-58" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The Local Highway and Transportation Corridor Preservation Fund shall <ln numlevel="1" lineno="383" slineno="4-110"/>be used to preserve <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">highway and public transit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> corridors, promote <ln numlevel="1" lineno="384" slineno="4-111"/>long-term statewide transportation planning, save on acquisition costs, and <ln numlevel="1" lineno="385" slineno="4-112"/>promote the best interests of the state in a manner which minimizes impact on <ln numlevel="1" lineno="386" slineno="4-113"/>prime agricultural land.</subsection><subsection ssid="7-7-59" dnum="ii-o" numlevel="1" lineno="387" slineno="4-114" level="3" tab="1"><display>(ii)</display>The Local Highway and Transportation Corridor Preservation Fund shall only be <ln numlevel="1" lineno="388" slineno="4-115"/>used to preserve a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">highway or public transit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> corridor that is <ln numlevel="1" lineno="389" slineno="4-116"/>right-of-way:<subsection ssid="7-7-60" dnum="A-o" numlevel="1" lineno="390" slineno="4-117" level="4"><display>(A)</display>in a county of the first or second class for:<subsection ssid="7-7-61" dnum="I-o" numlevel="1" lineno="391" slineno="4-118" level="5"><display>(I)</display>a state highway;</subsection><subsection ssid="7-7-62" dnum="II-o" numlevel="1" lineno="392" slineno="4-119" level="5"><display>(II)</display>a principal arterial highway as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>;</subsection><subsection ssid="7-7-63" dnum="III-o" numlevel="1" lineno="393" slineno="4-120" level="5"><display>(III)</display>a minor arterial highway as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>;</subsection><subsection ssid="7-7-64" dnum="IV-o" numlevel="1" lineno="394" slineno="4-121" level="5"><display>(IV)</display>a collector highway in an urban area as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>; or</subsection><subsection ssid="7-7-65" dnum="V-o" numlevel="1" lineno="395" slineno="4-122" level="5"><display>(V)</display>a transit facility as defined in Section <xref depth="3" refnumber="17B-2a-802" start="0">17B-2a-802</xref>; or</subsection></subsection><subsection ssid="7-7-66" dnum="B-o" numlevel="1" lineno="396" slineno="4-123" level="4"><display>(B)</display>in a county of the third, fourth, fifth, or sixth class for:<subsection ssid="7-7-67" dnum="I-o" numlevel="1" lineno="397" slineno="4-124" level="5"><display>(I)</display>a state highway;</subsection><subsection ssid="7-7-68" dnum="II-o" numlevel="1" lineno="398" slineno="4-125" level="5"><display>(II)</display>a principal arterial highway as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>;</subsection><subsection ssid="7-7-69" dnum="III-o" numlevel="1" lineno="399" slineno="4-126" level="5"><display>(III)</display>a minor arterial highway as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>;</subsection><subsection ssid="7-7-70" dnum="IV-o" numlevel="1" lineno="400" slineno="4-127" level="5"><display>(IV)</display>a major collector highway as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>;</subsection><subsection ssid="7-7-71" dnum="V-o" numlevel="1" lineno="401" slineno="4-128" level="5"><display>(V)</display>a minor collector road as defined in Section <xref depth="3" refnumber="72-4-102.5" start="0">72-4-102.5</xref>; or</subsection><subsection ssid="7-7-72" dnum="VI-o" numlevel="1" lineno="402" slineno="4-129" level="5"><display>(VI)</display>a transit facility as defined in Section <xref depth="3" refnumber="17B-2a-802" start="0">17B-2a-802</xref>.</subsection></subsection></subsection><subsection ssid="7-7-73" dnum="iii-o" numlevel="1" lineno="403" slineno="4-130" level="3" tab="1"><display>(iii)</display>The Local Highway and Transportation Corridor Preservation Fund may not be <ln numlevel="1" lineno="404" slineno="4-131"/>used for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">highway</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> corridor that is primarily a recreational trail as <ln numlevel="1" lineno="405" slineno="4-132"/>defined under Section <xref depth="3" refnumber="79-5-102" start="0">79-5-102</xref>.</subsection></subsection><subsection ssid="7-7-74" dnum="b-o" numlevel="1" lineno="406" slineno="4-133" level="2"><display>(b)</display>A highway authority shall authorize the expenditure of fund money after determining <ln numlevel="1" lineno="407" slineno="4-134"/>that the expenditure is being made in accordance with this section from applications <ln numlevel="1" lineno="408" slineno="4-135"/>that are:<subsection ssid="7-7-75" dnum="i-o" numlevel="1" lineno="409" slineno="4-136" level="3"><display>(i)</display>endorsed by the council of governments; and</subsection><subsection ssid="7-7-76" dnum="ii-o" numlevel="1" lineno="410" slineno="4-137" level="3"><display>(ii)</display>for a right-of-way purchase for a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">highway or public transit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> <ln numlevel="1" lineno="411" slineno="4-138"/>corridor authorized under Subsection <xref depth="4" refnumber="72-2-117.5(6)(a)(ii)" start="0">(6)(a)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="7-7-77" dnum="7-o" numlevel="1" lineno="412" slineno="4-139" level="1" space="false"><display>(7)</display><subsection ssid="7-7-78" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="7-7-79" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A council of governments shall establish a council of governments <ln numlevel="1" lineno="413" slineno="4-140"/>endorsement process which includes prioritization and application procedures for <ln numlevel="1" lineno="414" slineno="4-141"/>use of the money allocated to each county under this section.</subsection><subsection ssid="7-7-80" dnum="ii-o" numlevel="1" lineno="415" slineno="4-142" level="3" tab="1"><display>(ii)</display>The endorsement process under Subsection <xref depth="4" refnumber="72-2-117.5(7)(a)(i)" start="0">(7)(a)(i)</xref> may include review or <ln numlevel="1" lineno="416" slineno="4-143"/>endorsement of the preservation project by:<subsection ssid="7-7-81" dnum="A-o" numlevel="1" lineno="417" slineno="4-144" level="4"><display>(A)</display>the metropolitan planning organization if the county is within the boundaries <ln numlevel="1" lineno="418" slineno="4-145"/>of a metropolitan planning organization; or</subsection><subsection ssid="7-7-82" dnum="B-o" numlevel="1" lineno="419" slineno="4-146" level="4"><display>(B)</display>the department if the county is not within the boundaries of a metropolitan <ln numlevel="1" lineno="420" slineno="4-147"/>planning organization.</subsection></subsection></subsection><subsection ssid="7-7-83" dnum="b-o" numlevel="1" lineno="421" slineno="4-148" level="2"><display>(b)</display>All fund money shall be prioritized by each highway authority and council of <ln numlevel="1" lineno="422" slineno="4-149"/>governments based on considerations, including:<subsection ssid="7-7-84" dnum="i-o" numlevel="1" lineno="423" slineno="4-150" level="3"><display>(i)</display>areas with rapidly expanding population;</subsection><subsection ssid="7-7-85" dnum="ii-o" numlevel="1" lineno="424" slineno="4-151" level="3"><display>(ii)</display>the willingness of local governments to complete studies and impact statements <ln numlevel="1" lineno="425" slineno="4-152"/>that meet department standards;</subsection><subsection ssid="7-7-86" dnum="iii-o" numlevel="1" lineno="426" slineno="4-153" level="3"><display>(iii)</display>the preservation of <amend anum="0" ea="amend" pairid="17" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridors by the use of local planning and <ln numlevel="1" lineno="427" slineno="4-154"/>zoning processes;</subsection><subsection ssid="7-7-87" dnum="iv-o" numlevel="1" lineno="428" slineno="4-155" level="3"><display>(iv)</display>the availability of other public and private matching funds for a project;</subsection><subsection ssid="7-7-88" dnum="v-o" numlevel="1" lineno="429" slineno="4-156" level="3"><display>(v)</display>the cost-effectiveness of the preservation projects;</subsection><subsection ssid="7-7-89" dnum="vi-o" numlevel="1" lineno="430" slineno="4-157" level="3"><display>(vi)</display>long and short-term maintenance costs for property acquired; and</subsection><subsection ssid="7-7-90" dnum="vii-o" numlevel="1" lineno="431" slineno="4-158" level="3"><display>(vii)</display>whether the transportation <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">or public transit </amend><amendoutend style="2"/>corridor is included as part of:<subsection ssid="7-7-91" dnum="A-o" numlevel="1" lineno="432" slineno="4-159" level="4"><display>(A)</display>the county and municipal master plan; and</subsection><subsection ssid="7-7-92" dnum="B-o" numlevel="1" lineno="433" slineno="4-160" level="4" space="false"><display>(B)</display><subsection ssid="7-7-93" dnum="I-o" level="5" placement="sameline"><display>(I)</display>the statewide long range plan; or</subsection><subsection ssid="7-7-94" dnum="II-o" numlevel="1" lineno="434" slineno="4-161" level="5"><display>(II)</display>the regional transportation plan of the area metropolitan planning <ln numlevel="1" lineno="435" slineno="4-162"/>organization if one exists for the area.</subsection></subsection></subsection></subsection><subsection ssid="7-7-95" dnum="c-o" numlevel="1" lineno="436" slineno="4-163" level="2"><display>(c)</display>The council of governments shall:<subsection ssid="7-7-96" dnum="i-o" numlevel="1" lineno="437" slineno="4-164" level="3"><display>(i)</display>establish a priority list of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">highway and public transit</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">transportation</amend> corridor <ln numlevel="1" lineno="438" slineno="4-165"/>preservation projects within the county;</subsection><subsection ssid="7-7-97" dnum="ii-o" numlevel="1" lineno="439" slineno="4-166" level="3"><display>(ii)</display>submit the list described in Subsection <xref depth="4" refnumber="72-2-117.5(7)(c)(i)" start="0">(7)(c)(i)</xref> to the county's legislative body <ln numlevel="1" lineno="440" slineno="4-167"/>for approval; and</subsection><subsection ssid="7-7-98" dnum="iii-o" numlevel="1" lineno="441" slineno="4-168" level="3"><display>(iii)</display>obtain approval of the list described in Subsection <xref depth="4" refnumber="72-2-117.5(7)(c)(i)" start="0">(7)(c)(i)</xref> from a majority of the <ln numlevel="1" lineno="442" slineno="4-169"/>members of the county legislative body.</subsection></subsection><subsection ssid="7-7-99" dnum="d-o" numlevel="1" lineno="443" slineno="4-170" level="2"><display>(d)</display>A county's council of governments may only submit one priority list described in <ln numlevel="1" lineno="444" slineno="4-171"/>Subsection <xref depth="4" refnumber="72-2-117.5(7)(c)(i)" start="0">(7)(c)(i)</xref> per calendar year.</subsection><subsection ssid="7-7-100" dnum="e-o" numlevel="1" lineno="445" slineno="4-172" level="2"><display>(e)</display>A county legislative body may only consider and approve one priority list described <ln numlevel="1" lineno="446" slineno="4-173"/>in Subsection <xref depth="4" refnumber="72-2-117.5(7)(c)(i)" start="0">(7)(c)(i)</xref> per calendar year.</subsection></subsection><subsection ssid="7-7-101" dnum="8-o" numlevel="1" lineno="447" slineno="4-174" level="1" space="false"><display>(8)</display><subsection ssid="7-7-102" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless otherwise provided by written agreement with another highway authority <ln numlevel="1" lineno="448" slineno="4-175"/>or public transit district, the highway authority that holds the deed to the property is <ln numlevel="1" lineno="449" slineno="4-176"/>responsible for maintenance of the property.</subsection><subsection ssid="7-7-103" dnum="b-o" numlevel="1" lineno="450" slineno="4-177" level="2"><display>(b)</display>The transfer of ownership for property acquired under this section from one highway <ln numlevel="1" lineno="451" slineno="4-178"/>authority to another shall include a recorded deed for the property and a written <ln numlevel="1" lineno="452" slineno="4-179"/>agreement between the highway authorities or public transit district.</subsection></subsection><subsection ssid="7-7-104" dnum="9-o" numlevel="1" lineno="453" slineno="4-180" level="1" space="false"><display>(9)</display><subsection ssid="7-7-105" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The proceeds from any bonds or other obligations secured by revenues of the <ln numlevel="1" lineno="454" slineno="4-181"/>Local Highway and Transportation Corridor Preservation Fund shall be used for the <ln numlevel="1" lineno="455" slineno="4-182"/>purposes authorized for funds under this section.</subsection><subsection ssid="7-7-106" dnum="b-o" numlevel="1" lineno="456" slineno="4-183" level="2"><display>(b)</display>The highway authority shall pledge the necessary part of the revenues of the Local <ln numlevel="1" lineno="457" slineno="4-184"/>Highway and Transportation Corridor Preservation Fund to the payment of principal <ln numlevel="1" lineno="458" slineno="4-185"/>and interest on the bonds or other obligations.</subsection></subsection><subsection ssid="7-7-107" dnum="10-o" numlevel="1" lineno="459" slineno="4-186" level="1" space="false"><display>(10)</display><subsection ssid="7-7-108" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A highway authority may not expend money under this section to purchase a <ln numlevel="1" lineno="460" slineno="4-187"/>right-of-way for a state highway unless the highway authority has:<subsection ssid="7-7-109" dnum="i-o" numlevel="1" lineno="461" slineno="4-188" level="3" tab="1"><display>(i)</display>a transportation corridor property acquisition policy or ordinance in effect that <ln numlevel="1" lineno="462" slineno="4-189"/>meets department requirements for the acquisition of real property or any interests <ln numlevel="1" lineno="463" slineno="4-190"/>in real property under this section; and</subsection><subsection ssid="7-7-110" dnum="ii-o" numlevel="1" lineno="464" slineno="4-191" level="3" tab="1"><display>(ii)</display>an access management policy or ordinance in effect that meets the requirements <ln numlevel="1" lineno="465" slineno="4-192"/>under Subsection <xref depth="4" refnumber="72-2-117(8)" start="0">72-2-117(8)</xref>.</subsection></subsection><subsection ssid="7-7-111" dnum="b-o" numlevel="1" lineno="466" slineno="4-193" level="2"><display>(b)</display>The provisions of Subsection <xref depth="4" refnumber="72-2-117.5(10)(a)(i)" start="0">(10)(a)(i)</xref> do not apply if the highway authority has a <ln numlevel="1" lineno="467" slineno="4-194"/>written agreement with the department for the department to acquire real property or <ln numlevel="1" lineno="468" slineno="4-195"/>any interests in real property on behalf of the local highway authority under this <ln numlevel="1" lineno="469" slineno="4-196"/>section.</subsection></subsection><subsection ssid="7-7-112" dnum="11-o" numlevel="1" lineno="470" slineno="4-197" level="1"><display>(11)</display>The county shall ensure, to the extent possible, that the fund money allocated and <ln numlevel="1" lineno="471" slineno="4-198"/>distributed to a city or town in accordance with Subsection <xref depth="4" refnumber="72-2-117.5(4)" start="0">(4)</xref> is expended:<subsection ssid="7-7-113" dnum="a-o" numlevel="1" lineno="472" slineno="4-199" level="2"><display>(a)</display>to fund a project or service as allowed by this section within the city or town to <ln numlevel="1" lineno="473" slineno="4-200"/>which the fund money is allocated;</subsection><subsection ssid="7-7-114" dnum="b-o" numlevel="1" lineno="474" slineno="4-201" level="2"><display>(b)</display>to pay debt service, principal, or interest on a bond or other obligation as allowed by <ln numlevel="1" lineno="475" slineno="4-202"/>this section if that bond or other obligation is:<subsection ssid="7-7-115" dnum="i-o" numlevel="1" lineno="476" slineno="4-203" level="3"><display>(i)</display>secured by money allocated to the city or town; and</subsection><subsection ssid="7-7-116" dnum="ii-o" numlevel="1" lineno="477" slineno="4-204" level="3"><display>(ii)</display>issued to finance a project or service as allowed by this section within the city or <ln numlevel="1" lineno="478" slineno="4-205"/>town to which the fund money is allocated;</subsection></subsection><subsection ssid="7-7-117" dnum="c-o" numlevel="1" lineno="479" slineno="4-206" level="2"><display>(c)</display>to fund transportation planning as allowed by this section within the city or town to <ln numlevel="1" lineno="480" slineno="4-207"/>which the fund money is allocated; or</subsection><subsection ssid="7-7-118" dnum="d-o" numlevel="1" lineno="481" slineno="4-208" level="2"><display>(d)</display>for another purpose allowed by this section within the city or town to which the fund <ln numlevel="1" lineno="482" slineno="4-209"/>money is allocated.</subsection></subsection><subsection ssid="7-7-119" dnum="12-o" numlevel="1" lineno="483" slineno="4-210" level="1"><display>(12)</display>Notwithstanding any other provision in this section, any amounts within the fund <ln numlevel="1" lineno="484" slineno="4-211"/>allocated to a public transit district or for a public transit corridor may only be derived <ln numlevel="1" lineno="485" slineno="4-212"/>from the portion of the fund that does not include constitutionally restricted sources <ln numlevel="1" lineno="486" slineno="4-213"/>related to the operation of a motor vehicle on a public highway or proceeds from an <ln numlevel="1" lineno="487" slineno="4-214"/>excise tax on liquid motor fuel to propel a motor vehicle.</subsection></section></bsec><bsec buid="9" num="72-5-103" type="amend" src="code" uid="C72-5-S103_2025050720250507" sort="72 05 01030020250507" numlevel="1" lineno="488" slineno="5-1" sn="5"><section number="72-5-103" numlevel="1" lineno="489" slineno="5-2" type="amend"><secline lineno="488">Section 5, Section <bold>72-5-103</bold> is amended to read:</secline><catline lineno="489"><bold>72-5-103. Acquisition of rights-of-way and other real property -- Title to <ln numlevel="1" lineno="490" slineno="5-3"/>property acquired.</bold></catline><subsection ssid="9-9-1" dnum="1-o" numlevel="1" lineno="491" slineno="5-4" level="1" placement="noreturn"><display>(1)</display>The department may acquire any real property or interests in real property necessary for <ln numlevel="1" lineno="492" slineno="5-5"/>temporary, present, or reasonable future state transportation purposes by gift, agreement, <ln numlevel="1" lineno="493" slineno="5-6"/>exchange, purchase, condemnation, or otherwise.</subsection><subsection ssid="9-9-2" dnum="2-o" numlevel="1" lineno="494" slineno="5-7" level="1" space="false"><display>(2)</display><subsection ssid="9-9-3" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="9-9-4" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>Title to real property acquired by the  department or the counties, cities, <ln numlevel="1" lineno="495" slineno="5-8"/>and towns by gift, agreement, exchange, purchase, condemnation, or otherwise for <ln numlevel="1" lineno="496" slineno="5-9"/>highway rights-of-way or other transportation purposes may be in fee simple or <ln numlevel="1" lineno="497" slineno="5-10"/>any lesser estate or interest.</subsection><subsection ssid="9-9-5" dnum="ii-o" numlevel="1" lineno="498" slineno="5-11" level="3" tab="1"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">Title</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">As determined by the department, title</amend> to real property acquired by the <ln numlevel="1" lineno="499" slineno="5-12"/>department for a public transit project <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">shall</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">may</amend> be transferred to the public <ln numlevel="1" lineno="500" slineno="5-13"/>transit district responsible for the project.</subsection><subsection ssid="9-9-6" dnum="iii-o" numlevel="1" lineno="501" slineno="5-14" level="3" tab="1"><display>(iii)</display>A public transit district shall cover all costs associated with any condemnation on <ln numlevel="1" lineno="502" slineno="5-15"/>its behalf.</subsection></subsection><subsection ssid="9-9-7" dnum="b-o" numlevel="1" lineno="503" slineno="5-16" level="2"><display>(b)</display>If the highway is a county road, city street under joint title as provided in Subsection <xref depth="4" refid="C72-3-S104_1800010118000101" refnumber="72-3-104(3)" start="0"><ln numlevel="1" lineno="504" slineno="5-17"/>72-3-104(3)</xref>, or right-of-way described in <xref depth="2" refid="C72-5-P3_1800010118000101" refnumber="72-5-3" start="0">Title 72, Chapter 5, Part 3, Rights-Of-Way <ln numlevel="1" lineno="505" slineno="5-18"/>Across Federal Lands Act</xref>, title to all interests in real property less than fee simple <ln numlevel="1" lineno="506" slineno="5-19"/>held under this section is held jointly by the state and the county, city, or town <ln numlevel="1" lineno="507" slineno="5-20"/>holding the interest.</subsection></subsection><subsection ssid="9-9-8" dnum="3-o" numlevel="1" lineno="508" slineno="5-21" level="1"><display>(3)</display>A transfer of land bounded by a highway on a right-of-way for which the public has <ln numlevel="1" lineno="509" slineno="5-22"/>only an easement passes the title of the person whose estate is transferred to the middle <ln numlevel="1" lineno="510" slineno="5-23"/>of the highway.</subsection></section></bsec><bsec buid="11" num="72-5-401" type="amend" src="code" uid="C72-5-S401_2025050720250507" sort="72 05 04010020250507" numlevel="1" lineno="511" slineno="6-1" sn="6"><section number="72-5-401" numlevel="1" lineno="512" slineno="6-2" type="amend"><secline lineno="511">Section 6, Section <bold>72-5-401</bold> is amended to read:</secline><catline lineno="512"><bold>72-5-401. Definitions.</bold></catline><sectionText lineno="513"><tab/>As used in this part:</sectionText><subsection ssid="11-11-1" dnum="1-o:_-i" numlevel="1" lineno="514" slineno="6-4" ea="erase" anum="0" owner="jchristopherson" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1281" style="2" owner="o" level="1" deltag="start">(1)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="jchristopherson" level="1" deltag="end">"Corridor" means the path or proposed path of a transportation facility, including a <ln numlevel="1" lineno="515" slineno="6-5"/>public transit facility, that exists or that may exist in the future, and may include the land <ln numlevel="1" lineno="516" slineno="6-6"/>occupied or to be occupied by a transportation facility, and any other land that may be <ln numlevel="1" lineno="517" slineno="6-7"/>needed for expanding a transportation facility or for controlling access to it.</amend><amendoutend style="2"/></subsection><subsection ssid="11-11-2" dnum="2-o:1-i" numlevel="1" lineno="518" slineno="6-8" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1282" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1283" style="1" owner="i" level="1" amendtag="both" space="true">(1)</amend></display>"Corridor preservation" means planning or acquisition processes intended to:<subsection ssid="11-11-3" dnum="a-o" numlevel="1" lineno="519" slineno="6-9" level="2"><display>(a)</display>protect or enhance the capacity of existing <amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridors; and</subsection><subsection ssid="11-11-4" dnum="b-o" numlevel="1" lineno="520" slineno="6-10" level="2"><display>(b)</display>protect the availability of proposed <amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both">transportation </amend>corridors in advance of the need <ln numlevel="1" lineno="521" slineno="6-11"/>for and the actual commencement of the transportation facility construction.</subsection></subsection><subsection ssid="11-11-5" dnum="3-o:2-i" numlevel="1" lineno="522" slineno="6-12" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1285" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1286" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display>"Development" means:<subsection ssid="11-11-6" dnum="a-o" numlevel="1" lineno="523" slineno="6-13" level="2"><display>(a)</display>the subdividing of land;</subsection><subsection ssid="11-11-7" dnum="b-o" numlevel="1" lineno="524" slineno="6-14" level="2"><display>(b)</display>the construction of improvements, expansions, or additions; or</subsection><subsection ssid="11-11-8" dnum="c-o" numlevel="1" lineno="525" slineno="6-15" level="2"><display>(c)</display>any other action that will appreciably increase the value of and the future acquisition <ln numlevel="1" lineno="526" slineno="6-16"/>cost of land.</subsection></subsection><subsection ssid="11-11-9" dnum="4-o:3-i" numlevel="1" lineno="527" slineno="6-17" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1289" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1290" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>"Official map" means a map, drawn by government authorities and recorded in <ln numlevel="1" lineno="528" slineno="6-18"/>county recording offices that:<subsection ssid="11-11-10" dnum="a-o" numlevel="1" lineno="529" slineno="6-19" level="2"><display>(a)</display>shows actual and proposed rights-of-way, centerline alignments, and setbacks for <ln numlevel="1" lineno="530" slineno="6-20"/>highways and other transportation facilities;</subsection><subsection ssid="11-11-11" dnum="b-o" numlevel="1" lineno="531" slineno="6-21" level="2"><display>(b)</display>provides a basis for restricting development in designated rights-of-way or between <ln numlevel="1" lineno="532" slineno="6-22"/>designated setbacks to allow the government authorities time to purchase or <ln numlevel="1" lineno="533" slineno="6-23"/>otherwise reserve the land; and</subsection><subsection ssid="11-11-12" dnum="c-o" numlevel="1" lineno="534" slineno="6-24" level="2"><display>(c)</display>for counties and municipalities may be adopted as an element of the general plan, <ln numlevel="1" lineno="535" slineno="6-25"/>pursuant to <xref depth="2" refnumber="17-27a-4" start="0">Title 17, Chapter 27a, Part 4, General Plan</xref>, or <xref depth="2" refnumber="10-9a-4" start="0">Title 10, Chapter 9a, Part <ln numlevel="1" lineno="536" slineno="6-26"/>4, General Plan</xref>.</subsection></subsection><subsection ssid="11-11-13" dnum="5-o:4-i" numlevel="1" lineno="537" slineno="6-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1293" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>"Taking" means an act or regulation, either by exercise of eminent domain or other <ln numlevel="1" lineno="538" slineno="6-28"/>police power, whereby <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">government</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a government entity</amend> puts private property to public <ln numlevel="1" lineno="539" slineno="6-29"/>use or restrains use of private property for public purposes, and that requires <ln numlevel="1" lineno="540" slineno="6-30"/>compensation to be paid to private property owners.</subsection></section></bsec><bsec buid="12" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="541" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="541">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="542"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-15-25 4:40 PM</tm></rev></foot></leg>
