Tie votes.</bold></catline><sectionText lineno="37"><tab/></sectionText><subsection ssid="27-null-1" dnum="1-o" numlevel="1" lineno="38" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>This section does not apply to a race conducted by instant runoff voting under Chapter <ln numlevel="1" lineno="39" slineno="1-5"/>4, Part 6, Municipal Alternate Voting Methods Pilot Project.</subsection><subsection ssid="27-null-2" dnum="2-o" numlevel="1" lineno="40" slineno="1-6" level="1"><display>(2)</display>Except as provided in Subsection (3), if, after conducting a recount under Subsection <xref refnumber="20A-4-401(5)" depth="4"><ln numlevel="1" lineno="41" slineno="1-7"/>20A-4-401(5)</xref>, a tie vote occurs, the election officer shall, in a public meeting held no <ln numlevel="1" lineno="42" slineno="1-8"/>later than three days after the day on which the recount canvass is completed:<subsection ssid="27-null-3" dnum="a-o" numlevel="1" lineno="43" slineno="1-9" level="2"><display>(a)</display>determine the winning candidate, by lot, in whatever manner the election officer <ln numlevel="1" lineno="44" slineno="1-10"/>determines; and</subsection><subsection ssid="27-null-4" dnum="b-o" numlevel="1" lineno="45" slineno="1-11" level="2"><display>(b)</display>provide notice and an opportunity for each candidate involved in the tie to observe <ln numlevel="1" lineno="46" slineno="1-12"/>the casting or drawing of the lot or to send a representative to observe the casting or <ln numlevel="1" lineno="47" slineno="1-13"/>drawing of the lot.</subsection></subsection><subsection ssid="27-null-5" dnum="3-o" numlevel="1" lineno="48" slineno="1-14" level="1" space="false"><display>(3)</display><subsection ssid="27-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as otherwise provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref></amend>,<amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both"> if,</amend> after conducting a <ln numlevel="1" lineno="49" slineno="1-15"/>recount under Subsection <xref depth="3" refnumber="20A-4-401">20A-4-401</xref>(5), a tie vote occurs in a primary election race <ln numlevel="1" lineno="50" slineno="1-16"/>for a national, statewide, or other office that represents more than one county, the <ln numlevel="1" lineno="51" slineno="1-17"/>governor, lieutenant governor, and attorney general shall, at a public meeting called <ln numlevel="1" lineno="52" slineno="1-18"/>by the governor no later than three days after the day on which the recount canvass is <ln numlevel="1" lineno="53" slineno="1-19"/>completed:<subsection ssid="27-null-7" dnum="i-o" numlevel="1" lineno="54" slineno="1-20" level="3" tab="1"><display>(i)</display>determine the winning nominee, by lot, in whatever manner the governor <ln numlevel="1" lineno="55" slineno="1-21"/>determines; and</subsection><subsection ssid="27-null-8" dnum="ii-o" numlevel="1" lineno="56" slineno="1-22" level="3" tab="1"><display>(ii)</display>provide notice and an opportunity for each candidate involved in the tie to <ln numlevel="1" lineno="57" slineno="1-23"/>observe the casting or drawing of the lot or to send a representative to observe the <ln numlevel="1" lineno="58" slineno="1-24"/>casting or drawing of the lot.</subsection></subsection><subsection ssid="27-null-9" dnum="b-o" numlevel="1" lineno="59" slineno="1-25" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="ahaskell" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as otherwise provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, if</amend>, after conducting a <ln numlevel="1" lineno="60" slineno="1-26"/>recount under Subsection <xref depth="3" refnumber="20A-4-401">20A-4-401</xref>(5), a tie vote occurs in a primary election race <ln numlevel="1" lineno="61" slineno="1-27"/>for a county office, the district court judges of the district in which the county is <ln numlevel="1" lineno="62" slineno="1-28"/>located shall, at a public meeting called by the judges no later than three days after <ln numlevel="1" lineno="63" slineno="1-29"/>the day on which the recount canvass is completed:<subsection ssid="27-null-10" dnum="i-o" numlevel="1" lineno="64" slineno="1-30" level="3"><display>(i)</display>determine the winning nominee, by lot, in whatever manner the judges determine; <ln numlevel="1" lineno="65" slineno="1-31"/>and</subsection><subsection ssid="27-null-11" dnum="ii-o" numlevel="1" lineno="66" slineno="1-32" level="3"><display>(ii)</display>provide notice and an opportunity for each candidate involved in the tie to <ln numlevel="1" lineno="67" slineno="1-33"/>observe the casting or drawing of the lot or to send a representative to observe the <ln numlevel="1" lineno="68" slineno="1-34"/>casting or drawing of the lot.</subsection></subsection></subsection></section></bsec><bsec buid="12" num="20A-3a-601" type="amend" src="code" uid="C20A-3a-S601_2025050720250507" sort="20A03a06010020250507" numlevel="1" lineno="69" slineno="2-1" sn="2"><section number="20A-3a-601" numlevel="1" lineno="70" slineno="2-2" type="amend"><secline lineno="69">Section 2, Section <bold>20A-3a-601</bold> is amended to read:</secline><catline lineno="70"><bold>20A-3a-601 (Effective 05/07/25). Early voting.</bold></catline><subsection ssid="12-12-1" dnum="1-o" numlevel="1" lineno="71" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">Subsection <xref depth="4" refnumber="20A-9-409.1(4)(b)">20A-9-409.1(4)(b)</xref> or </amend>Section <xref depth="3" refnumber="20A-7-609.5" start="0">20A-7-609.5</xref>:<subsection ssid="12-12-2" dnum="a-o" numlevel="1" lineno="72" slineno="2-4" level="2"><display>(a)</display>an individual who is registered to vote may vote at a polling place before the election <ln numlevel="1" lineno="73" slineno="2-5"/>date in accordance with this section; and</subsection><subsection ssid="12-12-3" dnum="b-o" numlevel="1" lineno="74" slineno="2-6" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-2-207(6)" start="0">20A-2-207(6)</xref>, an individual who is not registered <ln numlevel="1" lineno="75" slineno="2-7"/>to vote may register to vote and vote at a polling place before the election date in <ln numlevel="1" lineno="76" slineno="2-8"/>accordance with this section if the individual:<subsection ssid="12-12-4" dnum="i-o" numlevel="1" lineno="77" slineno="2-9" level="3"><display>(i)</display>is otherwise legally entitled to vote the ballot; and</subsection><subsection ssid="12-12-5" dnum="ii-o" numlevel="1" lineno="78" slineno="2-10" level="3"><display>(ii)</display>casts a provisional ballot in accordance with Section <xref depth="3" refnumber="20A-2-207" start="0">20A-2-207</xref>.</subsection></subsection></subsection><subsection ssid="12-12-6" dnum="2-o" numlevel="1" lineno="79" slineno="2-11" level="1"><display>(2)</display>Except as provided in Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref> or Subsection <xref depth="4" refnumber="20A-3a-601(3)" start="0">(3)</xref>, the early voting period:<subsection ssid="12-12-7" dnum="a-o" numlevel="1" lineno="80" slineno="2-12" level="2"><display>(a)</display>begins on the date that is 14 days before the date of the election; and</subsection><subsection ssid="12-12-8" dnum="b-o" numlevel="1" lineno="81" slineno="2-13" level="2"><display>(b)</display>continues through the Friday before the election if the election date is a Tuesday.</subsection></subsection><subsection ssid="12-12-9" dnum="3-o" numlevel="1" lineno="82" slineno="2-14" level="1" space="false"><display>(3)</display><subsection ssid="12-12-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An election officer may extend the end of the early voting period to the day before <ln numlevel="1" lineno="83" slineno="2-15"/>the election date if the election officer provides notice of the extension in accordance <ln numlevel="1" lineno="84" slineno="2-16"/>with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection><subsection ssid="12-12-11" dnum="b-o" numlevel="1" lineno="85" slineno="2-17" level="2"><display>(b)</display>For a municipal election, the municipal clerk may reduce the early voting period <ln numlevel="1" lineno="86" slineno="2-18"/>described in this section if:<subsection ssid="12-12-12" dnum="i-o" numlevel="1" lineno="87" slineno="2-19" level="3"><display>(i)</display>the municipal clerk conducts early voting on at least four days;</subsection><subsection ssid="12-12-13" dnum="ii-o" numlevel="1" lineno="88" slineno="2-20" level="3"><display>(ii)</display>the early voting days are within the period beginning on the date that is 14 days <ln numlevel="1" lineno="89" slineno="2-21"/>before the date of the election and ending on the day before the election; and</subsection><subsection ssid="12-12-14" dnum="iii-o" numlevel="1" lineno="90" slineno="2-22" level="3"><display>(iii)</display>the municipal clerk provides notice of the reduced early voting period in <ln numlevel="1" lineno="91" slineno="2-23"/>accordance with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection></subsection><subsection ssid="12-12-15" dnum="c-o" numlevel="1" lineno="92" slineno="2-24" level="2"><display>(c)</display>For a county election, the county clerk may reduce the early voting period described <ln numlevel="1" lineno="93" slineno="2-25"/>in this section if:<subsection ssid="12-12-16" dnum="i-o" numlevel="1" lineno="94" slineno="2-26" level="3"><display>(i)</display>the county clerk conducts early voting on at least four days;</subsection><subsection ssid="12-12-17" dnum="ii-o" numlevel="1" lineno="95" slineno="2-27" level="3"><display>(ii)</display>the early voting days are within the period beginning on the date that is 14 days <ln numlevel="1" lineno="96" slineno="2-28"/>before the date of the election and ending on the day before the election; and</subsection><subsection ssid="12-12-18" dnum="iii-o" numlevel="1" lineno="97" slineno="2-29" level="3"><display>(iii)</display>the county clerk provides notice of the reduced early voting period in accordance <ln numlevel="1" lineno="98" slineno="2-30"/>with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection></subsection></subsection><subsection ssid="12-12-19" dnum="4-o" numlevel="1" lineno="99" slineno="2-31" level="1"><display>(4)</display>Except as provided in Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref>, during the early voting period, the election <ln numlevel="1" lineno="100" slineno="2-32"/>officer:<subsection ssid="12-12-20" dnum="a-o" numlevel="1" lineno="101" slineno="2-33" level="2"><display>(a)</display>for a local special election, a municipal primary election, and a municipal general <ln numlevel="1" lineno="102" slineno="2-34"/>election:<subsection ssid="12-12-21" dnum="i-o" numlevel="1" lineno="103" slineno="2-35" level="3"><display>(i)</display>shall conduct early voting on a minimum of four days during each week of the <ln numlevel="1" lineno="104" slineno="2-36"/>early voting period; and</subsection><subsection ssid="12-12-22" dnum="ii-o" numlevel="1" lineno="105" slineno="2-37" level="3"><display>(ii)</display>shall conduct early voting on the last day of the early voting period; and</subsection></subsection><subsection ssid="12-12-23" dnum="b-o" numlevel="1" lineno="106" slineno="2-38" level="2"><display>(b)</display>for all other elections:<subsection ssid="12-12-24" dnum="i-o" numlevel="1" lineno="107" slineno="2-39" level="3"><display>(i)</display>shall conduct early voting on each weekday; and</subsection><subsection ssid="12-12-25" dnum="ii-o" numlevel="1" lineno="108" slineno="2-40" level="3"><display>(ii)</display>may elect to conduct early voting on a Saturday, Sunday, or holiday.</subsection></subsection></subsection><subsection ssid="12-12-26" dnum="5-o" numlevel="1" lineno="109" slineno="2-41" level="1"><display>(5)</display>Except as specifically provided in this <xref depth="2" refnumber="20A-3a-6" start="2">Part 6, Early Voting</xref>, or Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref>, early <ln numlevel="1" lineno="110" slineno="2-42"/>voting shall be administered in accordance with the requirements of this title.</subsection></section></bsec><bsec buid="17" num="20A-4-301" type="amend" src="code" uid="C20A-4-S301_2025050720250507" sort="20A04 03010020250507" style="" numlevel="1" lineno="111" slineno="3-1" sn="3"><section number="20A-4-301" numlevel="1" lineno="112" slineno="3-2" type="amend"><secline lineno="111">Section 3, Section <bold>20A-4-301</bold> is amended to read:</secline><catline lineno="112"><bold>20A-4-301 (Effective 05/07/25) (Applies beginning 06/21/24). Board of canvassers.</bold></catline><subsection ssid="17-17-1" dnum="1-o" numlevel="1" lineno="113" slineno="3-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="17-17-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each county legislative body is the board of county canvassers for:<subsection ssid="17-17-3" dnum="i-o" numlevel="1" lineno="114" slineno="3-4" level="3" tab="1"><display>(i)</display>the county; and</subsection><subsection ssid="17-17-4" dnum="ii-o" numlevel="1" lineno="115" slineno="3-5" level="3" tab="1"><display>(ii)</display>each special district whose election is conducted by the county if:<subsection ssid="17-17-5" dnum="A-o" numlevel="1" lineno="116" slineno="3-6" level="4"><display>(A)</display>the election relates to the creation of the special district;</subsection><subsection ssid="17-17-6" dnum="B-o" numlevel="1" lineno="117" slineno="3-7" level="4"><display>(B)</display>the county legislative body serves as the governing body of the special <ln numlevel="1" lineno="118" slineno="3-8"/>district; or</subsection><subsection ssid="17-17-7" dnum="C-o" numlevel="1" lineno="119" slineno="3-9" level="4"><display>(C)</display>there is no duly constituted governing body of the special district.</subsection></subsection></subsection><subsection ssid="17-17-8" dnum="b-o" numlevel="1" lineno="120" slineno="3-10" level="2" space="false"><display>(b)</display><subsection ssid="17-35" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The board of county canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="121" slineno="3-11"/>place of meeting of the county legislative body<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">, at a date and time determined by <ln numlevel="1" lineno="122" slineno="3-12"/>the county clerk that is</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend> <subsection ssid="17-33" dnum="_-o:A-i" numlevel="1" lineno="123" slineno="3-13" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="ahaskell" level="1" amendtag="end">for canvassing of returns from a regular general election, </amend>no sooner than seven <ln numlevel="1" lineno="124" slineno="3-14"/>days after the election and no later than 14 days after the election<amend anum="0" ea="amend" pairid="20" groupid="18" style="1" owner="ahaskell" level="1" amendtag="both">; or</amend></subsection><subsection ssid="17-34" dnum="_-o:B-i" numlevel="1" lineno="125" slineno="3-15" ea="amend" anum="0" owner="ahaskell" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">for canvassing of returns from a regular primary election, including from a <ln numlevel="1" lineno="126" slineno="3-16"/>primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, on the seventh day after <ln numlevel="1" lineno="127" slineno="3-17"/>the day of the election</amend>.</subsection></subsection></subsection><subsection ssid="17-36" dnum="_-o:c-i" numlevel="1" lineno="128" slineno="3-18" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">In an election described in Subsection (1)(b)(i) the county clerk shall, immediately <ln numlevel="1" lineno="129" slineno="3-19"/>upon adjournment of the board of county canvassers, transmit to the lieutenant <ln numlevel="1" lineno="130" slineno="3-20"/>governor, via a secure electronic method:</amend><subsection ssid="17-37" dnum="_-o:i-i" numlevel="1" lineno="131" slineno="3-21" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">the county totals for the election; and</amend></subsection><subsection ssid="17-38" dnum="_-o:ii-i" numlevel="1" lineno="132" slineno="3-22" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">the signed canvassing report described in Section <xref depth="3" refnumber="20A-4-304">20A-4-304</xref>.</amend></subsection></subsection><subsection ssid="17-17-9" dnum="c-o:d-i" numlevel="1" lineno="133" slineno="3-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1051" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>If one or more of the county legislative body fails to attend the meeting of the <ln numlevel="1" lineno="134" slineno="3-24"/>board of county canvassers, the remaining members shall replace the absent member <ln numlevel="1" lineno="135" slineno="3-25"/>by appointing in the order named:<subsection ssid="17-17-10" dnum="i-o" numlevel="1" lineno="136" slineno="3-26" level="3"><display>(i)</display>the county treasurer;</subsection><subsection ssid="17-17-11" dnum="ii-o" numlevel="1" lineno="137" slineno="3-27" level="3"><display>(ii)</display>the county assessor; or</subsection><subsection ssid="17-17-12" dnum="iii-o" numlevel="1" lineno="138" slineno="3-28" level="3"><display>(iii)</display>the county sheriff.</subsection></subsection><subsection ssid="17-17-13" dnum="d-o:e-i" numlevel="1" lineno="139" slineno="3-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>Attendance of the number of persons equal to a simple majority of the county <ln numlevel="1" lineno="140" slineno="3-30"/>legislative body, but not less than three persons, shall constitute a quorum for <ln numlevel="1" lineno="141" slineno="3-31"/>conducting the canvass.</subsection><subsection ssid="17-17-14" dnum="e-o:f-i" numlevel="1" lineno="142" slineno="3-32" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>The county clerk is the clerk of the board of county canvassers.</subsection></subsection><subsection ssid="17-17-15" dnum="2-o" numlevel="1" lineno="143" slineno="3-33" level="1" space="false"><display>(2)</display><subsection ssid="17-17-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The mayor and the municipal legislative body are the board of municipal <ln numlevel="1" lineno="144" slineno="3-34"/>canvassers for the municipality.</subsection><subsection ssid="17-17-17" dnum="b-o" numlevel="1" lineno="145" slineno="3-35" level="2"><display>(b)</display>The board of municipal canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="146" slineno="3-36"/>place of meeting of the municipal legislative body:<subsection ssid="17-17-18" dnum="i-o" numlevel="1" lineno="147" slineno="3-37" level="3"><display>(i)</display>for canvassing of returns from a municipal general election, no sooner than seven <ln numlevel="1" lineno="148" slineno="3-38"/>days after the election and no later than 14 days after the election; or</subsection><subsection ssid="17-17-19" dnum="ii-o" numlevel="1" lineno="149" slineno="3-39" level="3"><display>(ii)</display>for canvassing of returns from a municipal primary election, no sooner than seven <ln numlevel="1" lineno="150" slineno="3-40"/>days after the election and no later than 14 days after the election.</subsection></subsection><subsection ssid="17-17-20" dnum="c-o" numlevel="1" lineno="151" slineno="3-41" level="2"><display>(c)</display>Attendance of a simple majority of the municipal legislative body shall constitute a <ln numlevel="1" lineno="152" slineno="3-42"/>quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-21" dnum="3-o" numlevel="1" lineno="153" slineno="3-43" level="1" space="false"><display>(3)</display><subsection ssid="17-17-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legislative body of the entity authorizing a bond election is the board of <ln numlevel="1" lineno="154" slineno="3-44"/>canvassers for each bond election.</subsection><subsection ssid="17-17-23" dnum="b-o" numlevel="1" lineno="155" slineno="3-45" level="2"><display>(b)</display>The board of canvassers for the bond election shall comply with the canvassing <ln numlevel="1" lineno="156" slineno="3-46"/>procedures and requirements of Section <xref depth="3" refnumber="11-14-207">11-14-207</xref>.</subsection><subsection ssid="17-17-24" dnum="c-o" numlevel="1" lineno="157" slineno="3-47" level="2"><display>(c)</display>Attendance of a simple majority of the legislative body of the entity authorizing a <ln numlevel="1" lineno="158" slineno="3-48"/>bond election shall constitute a quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-25" dnum="4-o" numlevel="1" lineno="159" slineno="3-49" level="1" space="false"><display>(4)</display><subsection ssid="17-17-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a board of trustees or an administrative control board is the governing body of a <ln numlevel="1" lineno="160" slineno="3-50"/>special district, the board of trustees or the administrative control board is the board <ln numlevel="1" lineno="161" slineno="3-51"/>of special district canvassers for the special district.</subsection><subsection ssid="17-17-27" dnum="b-o" numlevel="1" lineno="162" slineno="3-52" level="2"><display>(b)</display>The board of special district canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="163" slineno="3-53"/>place of meeting for the board of trustees or the administrative control board, as <ln numlevel="1" lineno="164" slineno="3-54"/>applicable, at a date and time determined by the special district clerk that is no sooner <ln numlevel="1" lineno="165" slineno="3-55"/>than seven days after the day of the election and no later than 14 days after the day of <ln numlevel="1" lineno="166" slineno="3-56"/>the election.</subsection><subsection ssid="17-17-28" dnum="c-o" numlevel="1" lineno="167" slineno="3-57" level="2"><display>(c)</display>Attendance of a simple majority of the board of trustees or the administrative control <ln numlevel="1" lineno="168" slineno="3-58"/>board is a quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-29" dnum="5-o" numlevel="1" lineno="169" slineno="3-59" level="1"><display>(5)</display>In relation to an election for the creation of a new school district under Section <xref depth="3" refnumber="53G-3-301.1"><ln numlevel="1" lineno="170" slineno="3-60"/>53G-3-301.1</xref>, <xref depth="3" refnumber="53G-3-301.3">53G-3-301.3</xref>, or <xref depth="3" refnumber="53G-3-301.4">53G-3-301.4</xref>, or in relation to an election of members of a <ln numlevel="1" lineno="171" slineno="3-61"/>local school board for a new school district or a reorganized new school district under <ln numlevel="1" lineno="172" slineno="3-62"/>Section <xref depth="3" refnumber="53G-3-302">53G-3-302</xref>, the board of canvassers is:<subsection ssid="17-17-30" dnum="a-o" numlevel="1" lineno="173" slineno="3-63" level="2"><display>(a)</display>if the voters permitted to vote in the election are all residents of the same <ln numlevel="1" lineno="174" slineno="3-64"/>municipality, the mayor and the municipal legislative body;</subsection><subsection ssid="17-17-31" dnum="b-o" numlevel="1" lineno="175" slineno="3-65" level="2"><display>(b)</display>if the voters permitted to vote in the election are not all residents of the same <ln numlevel="1" lineno="176" slineno="3-66"/>municipality, but are all residents of the same county, the county legislative body; or</subsection><subsection ssid="17-17-32" dnum="c-o" numlevel="1" lineno="177" slineno="3-67" level="2"><display>(c)</display>if the voters permitted to vote in the election are not all residents of the same <ln numlevel="1" lineno="178" slineno="3-68"/>municipality and are not all residents of the same county, the county legislative body <ln numlevel="1" lineno="179" slineno="3-69"/>of the county where the majority of the voters permitted to vote in the election are <ln numlevel="1" lineno="180" slineno="3-70"/>residents.</subsection></subsection></section></bsec><bsec buid="19" num="20A-4-306" type="amend" src="code" uid="C20A-4-S306_2025050720250507" sort="20A04 03060020250507" style="" numlevel="1" lineno="181" slineno="4-1" sn="4"><section number="20A-4-306" numlevel="1" lineno="182" slineno="4-2" type="amend"><secline lineno="181">Section 4, Section <bold>20A-4-306</bold> is amended to read:</secline><catline lineno="182"><bold>20A-4-306 (Effective 05/07/25). Statewide canvass.</bold></catline><subsection ssid="19-19-1" dnum="1-o" numlevel="1" lineno="183" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="19-19-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board of canvassers shall convene:<subsection ssid="19-19-3" dnum="i-o" numlevel="1" lineno="184" slineno="4-4" level="3" tab="1"><display>(i)</display>on the fourth Monday of November, at noon; or</subsection><subsection ssid="19-19-4" dnum="ii-o" numlevel="1" lineno="185" slineno="4-5" level="3" tab="1"><display>(ii)</display>at noon on the day following the receipt by the lieutenant governor of the last of <ln numlevel="1" lineno="186" slineno="4-6"/>the returns of a statewide special election.</subsection></subsection><subsection ssid="19-19-5" dnum="b-o" numlevel="1" lineno="187" slineno="4-7" level="2"><display>(b)</display>The state auditor, the state treasurer, and the attorney general are the state board of <ln numlevel="1" lineno="188" slineno="4-8"/>canvassers.</subsection><subsection ssid="19-19-6" dnum="c-o" numlevel="1" lineno="189" slineno="4-9" level="2"><display>(c)</display>Attendance of all members of the state board of canvassers is required to constitute a <ln numlevel="1" lineno="190" slineno="4-10"/>quorum for conducting the canvass.</subsection></subsection><subsection ssid="19-19-7" dnum="2-o" numlevel="1" lineno="191" slineno="4-11" level="1" space="false"><display>(2)</display><subsection ssid="19-19-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board of canvassers shall:<subsection ssid="19-19-9" dnum="i-o" numlevel="1" lineno="192" slineno="4-12" level="3" tab="1"><display>(i)</display>meet in the lieutenant governor's office; and</subsection><subsection ssid="19-19-10" dnum="ii-o" numlevel="1" lineno="193" slineno="4-13" level="3" tab="1"><display>(ii)</display>compute and determine the vote for officers and for and against any ballot <ln numlevel="1" lineno="194" slineno="4-14"/>propositions voted upon by the voters of the entire state or of two or more <ln numlevel="1" lineno="195" slineno="4-15"/>counties.</subsection></subsection><subsection ssid="19-19-11" dnum="b-o" numlevel="1" lineno="196" slineno="4-16" level="2"><display>(b)</display>The lieutenant governor, as secretary of the board shall file a report in the lieutenant <ln numlevel="1" lineno="197" slineno="4-17"/>governor's office that details:<subsection ssid="19-19-12" dnum="i-o" numlevel="1" lineno="198" slineno="4-18" level="3"><display>(i)</display>for each statewide officer and ballot proposition:<subsection ssid="19-19-13" dnum="A-o" numlevel="1" lineno="199" slineno="4-19" level="4"><display>(A)</display>the name of the statewide office or ballot proposition that appeared on the <ln numlevel="1" lineno="200" slineno="4-20"/>ballot;</subsection><subsection ssid="19-19-14" dnum="B-o" numlevel="1" lineno="201" slineno="4-21" level="4"><display>(B)</display>the candidates for each statewide office whose names appeared on the ballot, <ln numlevel="1" lineno="202" slineno="4-22"/>plus any recorded write-in candidates;</subsection><subsection ssid="19-19-15" dnum="C-o" numlevel="1" lineno="203" slineno="4-23" level="4"><display>(C)</display>the number of votes from each county cast for each candidate and for and <ln numlevel="1" lineno="204" slineno="4-24"/>against each ballot proposition;</subsection><subsection ssid="19-19-16" dnum="D-o" numlevel="1" lineno="205" slineno="4-25" level="4"><display>(D)</display>the total number of votes cast statewide for each candidate and for and against <ln numlevel="1" lineno="206" slineno="4-26"/>each ballot proposition; and</subsection><subsection ssid="19-19-17" dnum="E-o" numlevel="1" lineno="207" slineno="4-27" level="4"><display>(E)</display>the total number of votes cast statewide; and</subsection></subsection><subsection ssid="19-19-18" dnum="ii-o" numlevel="1" lineno="208" slineno="4-28" level="3"><display>(ii)</display>for each officer or ballot proposition voted on in two or more counties:<subsection ssid="19-19-19" dnum="A-o" numlevel="1" lineno="209" slineno="4-29" level="4"><display>(A)</display>the name of each of those offices and ballot propositions that appeared on the <ln numlevel="1" lineno="210" slineno="4-30"/>ballot;</subsection><subsection ssid="19-19-20" dnum="B-o" numlevel="1" lineno="211" slineno="4-31" level="4"><display>(B)</display>the candidates for those offices, plus any recorded write-in candidates;</subsection><subsection ssid="19-19-21" dnum="C-o" numlevel="1" lineno="212" slineno="4-32" level="4"><display>(C)</display>the number of votes from each county cast for each candidate and for and <ln numlevel="1" lineno="213" slineno="4-33"/>against each ballot proposition; and</subsection><subsection ssid="19-19-22" dnum="D-o" numlevel="1" lineno="214" slineno="4-34" level="4"><display>(D)</display>the total number of votes cast for each candidate and for and against each <ln numlevel="1" lineno="215" slineno="4-35"/>ballot proposition.</subsection></subsection></subsection><subsection ssid="19-19-23" dnum="c-o" numlevel="1" lineno="216" slineno="4-36" level="2"><display>(c)</display>Except as provided in Subsection (2)(d), the lieutenant governor shall:<subsection ssid="19-19-24" dnum="i-o" numlevel="1" lineno="217" slineno="4-37" level="3"><display>(i)</display>prepare certificates of election for:<subsection ssid="19-19-25" dnum="A-o" numlevel="1" lineno="218" slineno="4-38" level="4"><display>(A)</display>each successful candidate; and</subsection><subsection ssid="19-19-26" dnum="B-o" numlevel="1" lineno="219" slineno="4-39" level="4"><display>(B)</display>each of the presidential electors of the candidate for president who received a <ln numlevel="1" lineno="220" slineno="4-40"/>majority of the votes;</subsection></subsection><subsection ssid="19-19-27" dnum="ii-o" numlevel="1" lineno="221" slineno="4-41" level="3"><display>(ii)</display>authenticate each certificate with the lieutenant governor's seal; and</subsection><subsection ssid="19-19-28" dnum="iii-o" numlevel="1" lineno="222" slineno="4-42" level="3"><display>(iii)</display>deliver a certificate of election to:<subsection ssid="19-19-29" dnum="A-o" numlevel="1" lineno="223" slineno="4-43" level="4"><display>(A)</display>each candidate who had the highest number of votes for each office; and</subsection><subsection ssid="19-19-30" dnum="B-o" numlevel="1" lineno="224" slineno="4-44" level="4"><display>(B)</display>each of the presidential electors of the candidate for president who received a <ln numlevel="1" lineno="225" slineno="4-45"/>majority of the votes.</subsection></subsection></subsection><subsection ssid="19-19-31" dnum="d-o" numlevel="1" lineno="226" slineno="4-46" level="2"><display>(d)</display>The lieutenant governor shall, in the report described in Subsection (2)(b), declare a <ln numlevel="1" lineno="227" slineno="4-47"/>tie vote if:<subsection ssid="19-19-32" dnum="i-o" numlevel="1" lineno="228" slineno="4-48" level="3"><display>(i)</display>two or more officers receive an equal and the highest number of votes for an <ln numlevel="1" lineno="229" slineno="4-49"/>office; or</subsection><subsection ssid="19-19-33" dnum="ii-o" numlevel="1" lineno="230" slineno="4-50" level="3"><display>(ii)</display>in a race for an at-large office:<subsection ssid="19-19-34" dnum="A-o" numlevel="1" lineno="231" slineno="4-51" level="4"><display>(A)</display>two or more candidates receive an equal number of votes; and</subsection><subsection ssid="19-19-35" dnum="B-o" numlevel="1" lineno="232" slineno="4-52" level="4"><display>(B)</display>a recount is necessary to determine which candidates are elected to the at-large <ln numlevel="1" lineno="233" slineno="4-53"/>office.</subsection></subsection></subsection></subsection><subsection ssid="19-19-36" dnum="3-o" numlevel="1" lineno="234" slineno="4-54" level="1"><display>(3)</display>If the lieutenant governor has not received election returns from all counties on the fifth <ln numlevel="1" lineno="235" slineno="4-55"/>day before the day designated for the meeting of the state board of canvassers, the <ln numlevel="1" lineno="236" slineno="4-56"/>lieutenant governor shall:<subsection ssid="19-19-37" dnum="a-o" numlevel="1" lineno="237" slineno="4-57" level="2"><display>(a)</display>send a messenger to the clerk of the board of county canvassers of the delinquent <ln numlevel="1" lineno="238" slineno="4-58"/>county;</subsection><subsection ssid="19-19-38" dnum="b-o" numlevel="1" lineno="239" slineno="4-59" level="2"><display>(b)</display>instruct the messenger to demand a certified copy of the board of canvasser's report <ln numlevel="1" lineno="240" slineno="4-60"/>required by Section <xref depth="3" refnumber="20A-4-304">20A-4-304</xref> from the clerk; and</subsection><subsection ssid="19-19-39" dnum="c-o" numlevel="1" lineno="241" slineno="4-61" level="2"><display>(c)</display>pay the messenger the per diem provided by law as compensation.</subsection></subsection><subsection ssid="19-19-40" dnum="4-o" numlevel="1" lineno="242" slineno="4-62" level="1"><display>(4)</display>The state board of canvassers may not withhold the declaration of the result or any <ln numlevel="1" lineno="243" slineno="4-63"/>certificate of election because of any defect or informality in the returns of any election <ln numlevel="1" lineno="244" slineno="4-64"/>if the board can determine from the returns, with reasonable certainty, what office is <ln numlevel="1" lineno="245" slineno="4-65"/>intended and who is elected to it.</subsection><subsection ssid="19-19-41" dnum="5-o" numlevel="1" lineno="246" slineno="4-66" level="1" space="false"><display>(5)</display><subsection ssid="19-19-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At noon <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="ahaskell" level="1" deltag="both">on the fourth Monday after the regular primary election</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="ahaskell" level="1" amendtag="both" space="true">no later than 14 <ln numlevel="1" lineno="247" slineno="4-67"/>days after the day of the regular primary election or a primary runoff election</amend>, the <ln numlevel="1" lineno="248" slineno="4-68"/>lieutenant governor shall:<subsection ssid="19-19-43" dnum="i-o" numlevel="1" lineno="249" slineno="4-69" level="3" tab="1"><display>(i)</display>canvass the returns for all multicounty candidates required to file with the office <ln numlevel="1" lineno="250" slineno="4-70"/>of the lieutenant governor; and</subsection><subsection ssid="19-19-44" dnum="ii-o" numlevel="1" lineno="251" slineno="4-71" level="3" tab="1"><display>(ii)</display>publish and file the results of the canvass in the lieutenant governor's office.</subsection></subsection><subsection ssid="19-19-45" dnum="b-o" numlevel="1" lineno="252" slineno="4-72" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="ahaskell" level="1" deltag="both">Not later than the August 1 after the primary election, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">The</amend> lieutenant governor <ln numlevel="1" lineno="253" slineno="4-73"/>shall certify the results of the primary canvass to the county clerks<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="ahaskell" level="1" amendtag="both" space="true">:</amend><subsection ssid="19-52" dnum="_-o:i-i" numlevel="1" lineno="254" slineno="4-74" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">no later than the August 1 after the primary election; or</amend></subsection><subsection ssid="19-53" dnum="_-o:ii-i" numlevel="1" lineno="255" slineno="4-75" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">if there is a primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, no later than the <ln numlevel="1" lineno="256" slineno="4-76"/>August 31 after the runoff election.</amend></subsection></subsection></subsection><subsection ssid="19-19-46" dnum="6-o" numlevel="1" lineno="257" slineno="4-77" level="1" space="false"><display>(6)</display><subsection ssid="19-19-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At noon on the fourth Tuesday in March of a year in which a presidential election <ln numlevel="1" lineno="258" slineno="4-78"/>will be held, the lieutenant governor shall:<subsection ssid="19-19-48" dnum="i-o" numlevel="1" lineno="259" slineno="4-79" level="3" tab="1"><display>(i)</display>canvass the returns of the presidential primary election; and</subsection><subsection ssid="19-19-49" dnum="ii-o" numlevel="1" lineno="260" slineno="4-80" level="3" tab="1"><display>(ii)</display>publish and file the results of the canvass in the lieutenant governor's office.</subsection></subsection><subsection ssid="19-19-50" dnum="b-o" numlevel="1" lineno="261" slineno="4-81" level="2"><display>(b)</display>The lieutenant governor shall certify the results of the presidential primary election <ln numlevel="1" lineno="262" slineno="4-82"/>canvass to each registered political party that participated in the primary not later <ln numlevel="1" lineno="263" slineno="4-83"/>than the April 15 after the primary election.</subsection></subsection></section></bsec><bsec buid="15" num="20A-6-203" type="amend" src="code" uid="C20A-6-S203_2025050720250507" sort="20A06 02030020250507" numlevel="1" lineno="264" slineno="5-1" sn="5"><section number="20A-6-203" numlevel="1" lineno="265" slineno="5-2" type="amend"><secline lineno="264">Section 5, Section <bold>20A-6-203</bold> is amended to read:</secline><catline lineno="265"><bold>20A-6-203 (Effective 05/07/25). Ballots for regular primary elections.</bold></catline><subsection ssid="15-15-1" dnum="1-o" numlevel="1" lineno="266" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>The lieutenant governor, together with county clerks, suppliers of election materials, <ln numlevel="1" lineno="267" slineno="5-4"/>and representatives of registered political parties, shall:<subsection ssid="15-15-2" dnum="a-o" numlevel="1" lineno="268" slineno="5-5" level="2"><display>(a)</display>develop ballots to be used in Utah's regular primary election;</subsection><subsection ssid="15-15-3" dnum="b-o" numlevel="1" lineno="269" slineno="5-6" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">except to the extent otherwise provided in Subsection <xref depth="4" refnumber="20A-9-409.1(6)">20A-9-409.1(6)</xref>, </amend>ensure that <ln numlevel="1" lineno="270" slineno="5-7"/>the ballots comply generally, where applicable, with the requirements of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="2" refnumber="20A-6-1" start="0">Title 20A, <ln numlevel="1" lineno="271" slineno="5-8"/>Chapter 6, Part 1, General Requirements for All Ballots</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Part 1, General <ln numlevel="1" lineno="272" slineno="5-9"/>Requirements for All Ballots</amend>, and this section; and</subsection><subsection ssid="15-15-4" dnum="c-o" numlevel="1" lineno="273" slineno="5-10" level="2"><display>(c)</display>provide voting booths, election records and supplies, ballot boxes, and as applicable, <ln numlevel="1" lineno="274" slineno="5-11"/>voting devices, for each voting precinct as required by Section <xref depth="3" refnumber="20A-5-403" start="0">20A-5-403</xref>.</subsection></subsection><subsection ssid="15-15-5" dnum="2-o" numlevel="1" lineno="275" slineno="5-12" level="1" space="false"><display>(2)</display><subsection ssid="15-15-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the requirements of Subsections <xref depth="4" refnumber="20A-6-203(1)(b)" start="0">(1)(b)</xref> and <xref depth="4" refnumber="20A-6-203(1)(c)" start="0">(c)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="2" refnumber="20A-6-1" start="0">Title 20A, <ln numlevel="1" lineno="276" slineno="5-13"/>Chapter 6, Part 1, General Requirements for All Ballots</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Part 1, General <ln numlevel="1" lineno="277" slineno="5-14"/>Requirements for All Ballots</amend>, and Sections <xref depth="3" refnumber="20A-5-403" start="0">20A-5-403</xref>, <xref depth="3" refnumber="20A-6-401" start="0">20A-6-401</xref>, and <xref depth="3" refnumber="20A-6-401.1" start="0">20A-6-401.1</xref>, <ln numlevel="1" lineno="278" slineno="5-15"/>the lieutenant governor, together with county clerks, suppliers of election materials, <ln numlevel="1" lineno="279" slineno="5-16"/>and representatives of registered political parties shall ensure that the ballots, voting <ln numlevel="1" lineno="280" slineno="5-17"/>booths, election records and supplies, and ballot boxes:<subsection ssid="15-15-7" dnum="i-o" numlevel="1" lineno="281" slineno="5-18" level="3" tab="1"><display>(i)</display>facilitate the distribution, voting, and tallying of ballots in a primary where not all <ln numlevel="1" lineno="282" slineno="5-19"/>voters are authorized to vote for a party's candidate;</subsection><subsection ssid="15-15-8" dnum="ii-o" numlevel="1" lineno="283" slineno="5-20" level="3" tab="1"><display>(ii)</display>simplify the task of poll workers, particularly in determining a voter's party <ln numlevel="1" lineno="284" slineno="5-21"/>affiliation;</subsection><subsection ssid="15-15-9" dnum="iii-o" numlevel="1" lineno="285" slineno="5-22" level="3" tab="1"><display>(iii)</display>minimize the possibility of spoiled ballots due to voter confusion; and</subsection><subsection ssid="15-15-10" dnum="iv-o" numlevel="1" lineno="286" slineno="5-23" level="3" tab="1"><display>(iv)</display>protect against fraud.</subsection></subsection><subsection ssid="15-15-11" dnum="b-o" numlevel="1" lineno="287" slineno="5-24" level="2"><display>(b)</display>To accomplish the requirements of this Subsection <xref depth="4" refnumber="20A-6-203(2)" start="0">(2)</xref>, the lieutenant governor, <ln numlevel="1" lineno="288" slineno="5-25"/>county clerks, suppliers of election materials, and representatives of registered <ln numlevel="1" lineno="289" slineno="5-26"/>political parties shall:<subsection ssid="15-15-12" dnum="i-o" numlevel="1" lineno="290" slineno="5-27" level="3"><display>(i)</display>mark ballots as being for a particular registered political party; and</subsection><subsection ssid="15-15-13" dnum="ii-o" numlevel="1" lineno="291" slineno="5-28" level="3"><display>(ii)</display>instruct individuals counting the ballots to count only those votes for candidates <ln numlevel="1" lineno="292" slineno="5-29"/>from the registered political party whose ballot the voter received.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="20A-9-403" type="amend" src="code" uid="C20A-9-S403_2025050720250507" sort="20A09 04030020250507" numlevel="1" lineno="293" slineno="6-1" sn="6"><section number="20A-9-403" numlevel="1" lineno="294" slineno="6-2" type="amend"><secline lineno="293">Section 6, Section <bold>20A-9-403</bold> is amended to read:</secline><catline lineno="294"><bold>20A-9-403 (Effective 05/07/25). Regular primary elections  -- Candidate <ln numlevel="1" lineno="295" slineno="6-3"/>nomination process for a registered political party that is not a qualified political party -- <ln numlevel="1" lineno="296" slineno="6-4"/>Determining winning nominee for any registered political party, including a qualified <ln numlevel="1" lineno="297" slineno="6-5"/>political party -- Election expenses.</bold></catline><subsection ssid="7-7-1" dnum="1-o" numlevel="1" lineno="298" slineno="6-6" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="7-7-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Candidates for elective office that are to be filled at the next regular general <ln numlevel="1" lineno="299" slineno="6-7"/>election shall be nominated in a regular primary election by direct vote of the people <ln numlevel="1" lineno="300" slineno="6-8"/>in the manner <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="ahaskell" level="1" deltag="both">prescribed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">described</amend> in this section<amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both"> and, as applicable, Section <xref depth="3" refnumber="20A-9-409.1"><ln numlevel="1" lineno="301" slineno="6-9"/>20A-9-409.1</xref></amend>.  The regular primary election is held on the date specified in Section <xref depth="3" refnumber="20A-1-201.5"><ln numlevel="1" lineno="302" slineno="6-10"/>20A-1-201.5</xref>.  Nothing in this section shall affect a candidate's ability to qualify for a <ln numlevel="1" lineno="303" slineno="6-11"/>regular general election's ballot as an unaffiliated candidate under Section <xref depth="3" refnumber="20A-9-501">20A-9-501</xref> <ln numlevel="1" lineno="304" slineno="6-12"/>or to participate in a regular general election as a write-in candidate under Section <xref depth="3" refnumber="20A-9-601"><ln numlevel="1" lineno="305" slineno="6-13"/>20A-9-601</xref>.</subsection><subsection ssid="7-7-3" dnum="b-o" numlevel="1" lineno="306" slineno="6-14" level="2"><display>(b)</display>Each registered political party that chooses to have the names of the registered <ln numlevel="1" lineno="307" slineno="6-15"/>political party's candidates for elective office featured with party affiliation on the <ln numlevel="1" lineno="308" slineno="6-16"/>ballot at a regular general election shall comply with the requirements of this section <ln numlevel="1" lineno="309" slineno="6-17"/>and shall nominate the registered political party's candidates for elective office in the <ln numlevel="1" lineno="310" slineno="6-18"/>manner described in this section.</subsection><subsection ssid="7-7-4" dnum="c-o" numlevel="1" lineno="311" slineno="6-19" level="2"><display>(c)</display>A filing officer may not permit an official ballot at a regular general election to be <ln numlevel="1" lineno="312" slineno="6-20"/>produced or used if the ballot denotes affiliation between a registered political party <ln numlevel="1" lineno="313" slineno="6-21"/>or any other political group and a candidate for elective office who is not nominated <ln numlevel="1" lineno="314" slineno="6-22"/>in the manner prescribed in this section or in Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(4).</subsection><subsection ssid="7-7-5" dnum="d-o" numlevel="1" lineno="315" slineno="6-23" level="2"><display>(d)</display>Unless noted otherwise, the dates in this section refer to those that occur in each <ln numlevel="1" lineno="316" slineno="6-24"/>even-numbered year in which a regular general election will be held.</subsection></subsection><subsection ssid="7-7-6" dnum="2-o" numlevel="1" lineno="317" slineno="6-25" level="1" space="false"><display>(2)</display><subsection ssid="7-7-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each registered political party, in a statement filed with the lieutenant governor, <ln numlevel="1" lineno="318" slineno="6-26"/>shall:<subsection ssid="7-7-8" dnum="i-o" numlevel="1" lineno="319" slineno="6-27" level="3" tab="1"><display>(i)</display>either declare the registered political party's intent to participate in the next regular <ln numlevel="1" lineno="320" slineno="6-28"/>primary election or declare that the registered political party chooses not to have <ln numlevel="1" lineno="321" slineno="6-29"/>the names of the registered political party's candidates for elective office featured <ln numlevel="1" lineno="322" slineno="6-30"/>on the ballot at the next regular general election; and</subsection><subsection ssid="7-7-9" dnum="ii-o" numlevel="1" lineno="323" slineno="6-31" level="3" tab="1"><display>(ii)</display>if the registered political party participates in the upcoming regular primary <ln numlevel="1" lineno="324" slineno="6-32"/>election, identify one or more registered political parties whose members may <ln numlevel="1" lineno="325" slineno="6-33"/>vote for the registered political party's candidates and whether individuals <ln numlevel="1" lineno="326" slineno="6-34"/>identified as unaffiliated with a political party may vote for the registered political <ln numlevel="1" lineno="327" slineno="6-35"/>party's candidates.</subsection></subsection><subsection ssid="7-7-10" dnum="b-o" numlevel="1" lineno="328" slineno="6-36" level="2" space="false"><display>(b)</display><subsection ssid="7-7-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A registered political party that is a continuing political party shall file the <ln numlevel="1" lineno="329" slineno="6-37"/>statement described in Subsection (2)(a) with the lieutenant governor no later than <ln numlevel="1" lineno="330" slineno="6-38"/>5 p.m. on November 30 of each odd-numbered year.</subsection><subsection ssid="7-7-12" dnum="ii-o" numlevel="1" lineno="331" slineno="6-39" level="3"><display>(ii)</display>An organization that is seeking to become a registered political party under <ln numlevel="1" lineno="332" slineno="6-40"/>Section <xref depth="3" refnumber="20A-8-103">20A-8-103</xref> shall file the statement described in Subsection (2)(a) at the <ln numlevel="1" lineno="333" slineno="6-41"/>time that the registered political party files the petition described in Section <xref depth="3" refnumber="20A-8-103"><ln numlevel="1" lineno="334" slineno="6-42"/>20A-8-103</xref>.</subsection></subsection></subsection><subsection ssid="7-7-13" dnum="3-o" numlevel="1" lineno="335" slineno="6-43" level="1" space="false"><display>(3)</display><subsection ssid="7-7-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (3)(e), an individual who submits a declaration <ln numlevel="1" lineno="336" slineno="6-44"/>of candidacy under Section <xref depth="3" refnumber="20A-9-202">20A-9-202</xref> shall appear as a candidate for elective office <ln numlevel="1" lineno="337" slineno="6-45"/>on the regular primary ballot of the registered political party listed on the declaration <ln numlevel="1" lineno="338" slineno="6-46"/>of candidacy only if the individual is certified by the appropriate filing officer as <ln numlevel="1" lineno="339" slineno="6-47"/>having submitted a nomination petition that was:<subsection ssid="7-7-15" dnum="i-o" numlevel="1" lineno="340" slineno="6-48" level="3" tab="1"><display>(i)</display>circulated and completed in accordance with Section <xref depth="3" refnumber="20A-9-405">20A-9-405</xref>; and</subsection><subsection ssid="7-7-16" dnum="ii-o" numlevel="1" lineno="341" slineno="6-49" level="3" tab="1"><display>(ii)</display>signed by at least 2% of the registered political party's members who reside in the <ln numlevel="1" lineno="342" slineno="6-50"/>political division of the office that the individual seeks.</subsection></subsection><subsection ssid="7-7-17" dnum="b-o" numlevel="1" lineno="343" slineno="6-51" level="2" space="false"><display>(b)</display><subsection ssid="7-7-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A candidate for elective office shall submit signatures for a nomination petition <ln numlevel="1" lineno="344" slineno="6-52"/>to the appropriate filing officer for verification and certification no later than 5 <ln numlevel="1" lineno="345" slineno="6-53"/>p.m. on the final day in March.</subsection><subsection ssid="7-7-19" dnum="ii-o" numlevel="1" lineno="346" slineno="6-54" level="3"><display>(ii)</display>A candidate may supplement the candidate's submissions at any time on or before <ln numlevel="1" lineno="347" slineno="6-55"/>the filing deadline.</subsection></subsection><subsection ssid="7-7-20" dnum="c-o" numlevel="1" lineno="348" slineno="6-56" level="2" space="false"><display>(c)</display><subsection ssid="7-7-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The lieutenant governor shall determine for each elective office the total <ln numlevel="1" lineno="349" slineno="6-57"/>number of signatures that must be submitted under Subsection (3)(a)(ii) or <xref depth="3" refnumber="20A-9-408"><ln numlevel="1" lineno="350" slineno="6-58"/>20A-9-408</xref>(8) by counting the aggregate number of individuals residing in each <ln numlevel="1" lineno="351" slineno="6-59"/>elective office's political division who have designated a particular registered <ln numlevel="1" lineno="352" slineno="6-60"/>political party on the individuals' voter registration forms on or before November <ln numlevel="1" lineno="353" slineno="6-61"/>15 of each odd-numbered year.</subsection><subsection ssid="7-7-22" dnum="ii-o" numlevel="1" lineno="354" slineno="6-62" level="3"><display>(ii)</display>The lieutenant governor shall publish the determination for each elective office <ln numlevel="1" lineno="355" slineno="6-63"/>no later than November 30 of each odd-numbered year.</subsection></subsection><subsection ssid="7-7-23" dnum="d-o" numlevel="1" lineno="356" slineno="6-64" level="2"><display>(d)</display>The filing officer shall:<subsection ssid="7-7-24" dnum="i-o" numlevel="1" lineno="357" slineno="6-65" level="3"><display>(i)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, verify signatures on <ln numlevel="1" lineno="358" slineno="6-66"/>nomination petitions in a transparent and orderly manner, no later than 14 days <ln numlevel="1" lineno="359" slineno="6-67"/>after the day on which a candidate submits the signatures to the filing officer;</subsection><subsection ssid="7-7-25" dnum="ii-o" numlevel="1" lineno="360" slineno="6-68" level="3"><display>(ii)</display>for all qualifying candidates for elective office who submit nomination petitions <ln numlevel="1" lineno="361" slineno="6-69"/>to the filing officer, issue certifications referenced in Subsection (3)(a) no later <ln numlevel="1" lineno="362" slineno="6-70"/>than the deadline described in Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(1)(b);</subsection><subsection ssid="7-7-26" dnum="iii-o" numlevel="1" lineno="363" slineno="6-71" level="3"><display>(iii)</display>consider active and inactive voters eligible to sign nomination petitions;</subsection><subsection ssid="7-7-27" dnum="iv-o" numlevel="1" lineno="364" slineno="6-72" level="3"><display>(iv)</display>consider an individual who signs a nomination petition a member of a registered <ln numlevel="1" lineno="365" slineno="6-73"/>political party for purposes of Subsection (3)(a)(ii) if the individual has designated <ln numlevel="1" lineno="366" slineno="6-74"/>that registered political party as the individual's party membership on the <ln numlevel="1" lineno="367" slineno="6-75"/>individual's voter registration form; and</subsection><subsection ssid="7-7-28" dnum="v-o" numlevel="1" lineno="368" slineno="6-76" level="3"><display>(v)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref> and with the assistance of <ln numlevel="1" lineno="369" slineno="6-77"/>the county clerk as applicable, use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> <ln numlevel="1" lineno="370" slineno="6-78"/>to verify submitted nomination petition signatures, or use statistical sampling <ln numlevel="1" lineno="371" slineno="6-79"/>procedures to verify submitted nomination petition signatures in accordance with <ln numlevel="1" lineno="372" slineno="6-80"/>rules made under Subsection (3)(f).</subsection></subsection><subsection ssid="7-7-29" dnum="e-o" numlevel="1" lineno="373" slineno="6-81" level="2"><display>(e)</display>Notwithstanding any other provision in this Subsection (3), a candidate for lieutenant <ln numlevel="1" lineno="374" slineno="6-82"/>governor may appear on the regular primary ballot of a registered political party <ln numlevel="1" lineno="375" slineno="6-83"/>without submitting nomination petitions if the candidate files a declaration of <ln numlevel="1" lineno="376" slineno="6-84"/>candidacy and complies with Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(3).</subsection><subsection ssid="7-7-30" dnum="f-o" numlevel="1" lineno="377" slineno="6-85" level="2"><display>(f)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="378" slineno="6-86"/>director of elections, within the Office of the Lieutenant Governor, may make rules <ln numlevel="1" lineno="379" slineno="6-87"/>that:<subsection ssid="7-7-31" dnum="i-o" numlevel="1" lineno="380" slineno="6-88" level="3"><display>(i)</display>provide for the use of statistical sampling procedures that:<subsection ssid="7-7-32" dnum="A-o" numlevel="1" lineno="381" slineno="6-89" level="4"><display>(A)</display>filing officers are required to use to verify signatures under Subsection (3)(d); <ln numlevel="1" lineno="382" slineno="6-90"/>and</subsection><subsection ssid="7-7-33" dnum="B-o" numlevel="1" lineno="383" slineno="6-91" level="4"><display>(B)</display>reflect a bona fide effort to determine the validity of a candidate's entire <ln numlevel="1" lineno="384" slineno="6-92"/>submission, using widely recognized statistical sampling techniques; and</subsection></subsection><subsection ssid="7-7-34" dnum="ii-o" numlevel="1" lineno="385" slineno="6-93" level="3"><display>(ii)</display>provide for the transparent, orderly, and timely submission, verification, and <ln numlevel="1" lineno="386" slineno="6-94"/>certification of nomination petition signatures.</subsection></subsection><subsection ssid="7-7-35" dnum="g-o" numlevel="1" lineno="387" slineno="6-95" level="2"><display>(g)</display>The county clerk shall:<subsection ssid="7-7-36" dnum="i-o" numlevel="1" lineno="388" slineno="6-96" level="3"><display>(i)</display>review the declarations of candidacy filed by candidates for local boards of <ln numlevel="1" lineno="389" slineno="6-97"/>education to determine if more than two candidates have filed for the same seat;</subsection><subsection ssid="7-7-37" dnum="ii-o" numlevel="1" lineno="390" slineno="6-98" level="3"><display>(ii)</display>place the names of all candidates who have filed a declaration of candidacy for a <ln numlevel="1" lineno="391" slineno="6-99"/>local board of education seat on the nonpartisan section of the ballot if more than <ln numlevel="1" lineno="392" slineno="6-100"/>two candidates have filed for the same seat; and</subsection><subsection ssid="7-7-38" dnum="iii-o" numlevel="1" lineno="393" slineno="6-101" level="3"><display>(iii)</display>determine the order of the local board of education candidates' names on the <ln numlevel="1" lineno="394" slineno="6-102"/>ballot in accordance with Section <xref depth="3" refnumber="20A-6-305">20A-6-305</xref>.</subsection></subsection></subsection><subsection ssid="7-7-39" dnum="4-o" numlevel="1" lineno="395" slineno="6-103" level="1" space="false"><display>(4)</display><subsection ssid="7-7-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the deadline described in Subsection <xref depth="3" refnumber="20A-9-409">20A-9-409</xref>(4)(c), the lieutenant <ln numlevel="1" lineno="396" slineno="6-104"/>governor shall provide to the county clerks:<subsection ssid="7-7-41" dnum="i-o" numlevel="1" lineno="397" slineno="6-105" level="3" tab="1"><display>(i)</display>a list of the names of all candidates for federal, constitutional, multi-county, single <ln numlevel="1" lineno="398" slineno="6-106"/>county, and county offices who have received certifications under Subsection (3), <ln numlevel="1" lineno="399" slineno="6-107"/>along with instructions on how those names shall appear on the primary election <ln numlevel="1" lineno="400" slineno="6-108"/>ballot in accordance with Section <xref depth="3" refnumber="20A-6-305">20A-6-305</xref>; and</subsection><subsection ssid="7-7-42" dnum="ii-o" numlevel="1" lineno="401" slineno="6-109" level="3" tab="1"><display>(ii)</display>a list of unopposed candidates for elective office who have been nominated by a <ln numlevel="1" lineno="402" slineno="6-110"/>registered political party under Subsection (5)(c) and instruct the county clerks to <ln numlevel="1" lineno="403" slineno="6-111"/>exclude the unopposed candidates from the primary election ballot.</subsection></subsection><subsection ssid="7-7-43" dnum="b-o" numlevel="1" lineno="404" slineno="6-112" level="2"><display>(b)</display>A candidate for lieutenant governor and a candidate for governor campaigning as <ln numlevel="1" lineno="405" slineno="6-113"/>joint-ticket running mates shall appear jointly on the primary election ballot.</subsection><subsection ssid="7-7-44" dnum="c-o" numlevel="1" lineno="406" slineno="6-114" level="2" format="full"><display>(c)</display>After the county clerk receives the certified list from the lieutenant governor under <ln numlevel="1" lineno="407" slineno="6-115"/>Subsection (4)(a), the county clerk shall post or publish a primary election notice in <ln numlevel="1" lineno="408" slineno="6-116"/>substantially the following form:<eol numlevel="1" lineno="409" slineno="6-117"/><para/>"Notice is given that a primary election will be held Tuesday, June ____, <ln numlevel="1" lineno="410" slineno="6-118"/>________(year), to nominate party candidates for the parties and candidates for nonpartisan <ln numlevel="1" lineno="411" slineno="6-119"/>local school board positions listed on the primary ballot.  The polling place for voting precinct <ln numlevel="1" lineno="412" slineno="6-120"/>____ is ____.  The polls will open at 7 a.m. and continue open until 8 p.m. of the same day.  <ln numlevel="1" lineno="413" slineno="6-121"/>Attest: county clerk."</subsection></subsection><subsection ssid="7-7-45" dnum="5-o" numlevel="1" lineno="414" slineno="6-122" level="1" space="false"><display>(5)</display><subsection ssid="7-7-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A candidate who, at the regular primary election, receives the highest number of <ln numlevel="1" lineno="415" slineno="6-123"/>votes cast for the office sought by the candidate is:<subsection ssid="7-7-47" dnum="i-o" numlevel="1" lineno="416" slineno="6-124" level="3" tab="1"><display>(i)</display><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both">except as otherwise provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, </amend>nominated for that office by <ln numlevel="1" lineno="417" slineno="6-125"/>the candidate's registered political party; or</subsection><subsection ssid="7-7-48" dnum="ii-o" numlevel="1" lineno="418" slineno="6-126" level="3" tab="1"><display>(ii)</display>for a nonpartisan local school board position, nominated for that office.</subsection></subsection><subsection ssid="7-7-49" dnum="b-o" numlevel="1" lineno="419" slineno="6-127" level="2"><display>(b)</display>If two or more candidates are to be elected to the office at the regular general <ln numlevel="1" lineno="420" slineno="6-128"/>election, those party candidates equal in number to positions to be filled who receive <ln numlevel="1" lineno="421" slineno="6-129"/>the highest number of votes at the regular primary election are the nominees of the <ln numlevel="1" lineno="422" slineno="6-130"/>candidates' party for those positions.</subsection><subsection ssid="7-7-50" dnum="c-o" numlevel="1" lineno="423" slineno="6-131" level="2" space="false"><display>(c)</display><subsection ssid="7-7-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection (5)(c), a candidate is "unopposed" if:<subsection ssid="7-7-52" dnum="A-o" numlevel="1" lineno="424" slineno="6-132" level="4" tab="1"><display>(A)</display>no individual other than the candidate receives a certification under <ln numlevel="1" lineno="425" slineno="6-133"/>Subsection (3) for the regular primary election ballot of the candidate's <ln numlevel="1" lineno="426" slineno="6-134"/>registered political party for a particular elective office; or</subsection><subsection ssid="7-7-53" dnum="B-o" numlevel="1" lineno="427" slineno="6-135" level="4" tab="1"><display>(B)</display>for an office where more than one individual is to be elected or nominated, the <ln numlevel="1" lineno="428" slineno="6-136"/>number of candidates who receive certification under Subsection (3) for the <ln numlevel="1" lineno="429" slineno="6-137"/>regular primary election of the candidate's registered political party does not <ln numlevel="1" lineno="430" slineno="6-138"/>exceed the total number of candidates to be elected or nominated for that office.</subsection></subsection><subsection ssid="7-7-54" dnum="ii-o" numlevel="1" lineno="431" slineno="6-139" level="3"><display>(ii)</display>A candidate who is unopposed for an elective office in the regular primary <ln numlevel="1" lineno="432" slineno="6-140"/>election of a registered political party is nominated by the party for that office <ln numlevel="1" lineno="433" slineno="6-141"/>without appearing on the primary election ballot.</subsection></subsection></subsection><subsection ssid="7-7-55" dnum="6-o" numlevel="1" lineno="434" slineno="6-142" level="1"><display>(6)</display>The expense of providing all ballots, blanks, or other supplies to be used at any primary <ln numlevel="1" lineno="435" slineno="6-143"/>election provided for by this section, and all expenses necessarily incurred in the <ln numlevel="1" lineno="436" slineno="6-144"/>preparation for or the conduct of that primary election shall be paid out of the treasury of <ln numlevel="1" lineno="437" slineno="6-145"/>the county or state, in the same manner as for the regular general elections.</subsection><subsection ssid="7-7-56" dnum="7-o" numlevel="1" lineno="438" slineno="6-146" level="1"><display>(7)</display>An individual may not file a declaration of candidacy for a registered political party of <ln numlevel="1" lineno="439" slineno="6-147"/>which the individual is not a member, except to the extent that the registered political <ln numlevel="1" lineno="440" slineno="6-148"/>party permits otherwise under the registered political party's bylaws.</subsection></section></bsec><bsec buid="4" num="20A-9-409.1" type="enact" src="code" uid="C20A-9-S409.1_2023050320230503" sort="20A09 04090120230503" style="" numlevel="1" lineno="441" slineno="7-1" sn="7"><section number="20A-9-409.1" numlevel="1" lineno="442" slineno="7-2" type="enact"><secline lineno="441">Section 7, Section <bold>20A-9-409.1</bold> is enacted to read:</secline><catline lineno="442"><bold>20A-9-409.1 (Effective 05/07/25). Determining winner of certain primary <ln numlevel="1" lineno="443" slineno="7-3"/>election races where a candidate does not receive a majority of the votes cast -- Runoff <ln numlevel="1" lineno="444" slineno="7-4"/>primary election for certain races -- Election requirements and notice.</bold></catline><subsection ssid="4-4-102" dnum="_-o:1-i" numlevel="1" lineno="445" slineno="7-5" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="127" style="1" owner="ahaskell" level="1" amendtag="end">In a regular primary election race for a qualified political party, the election officer shall <ln numlevel="1" lineno="446" slineno="7-6"/>determine the winning nominee in accordance with Subsection (2) if:</amend><subsection ssid="4-4-103" dnum="_-o:a-i" numlevel="1" lineno="447" slineno="7-7" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="128" style="1" owner="ahaskell" level="1" amendtag="end">the race is to nominate a qualified political party candidate for United States senator, <ln numlevel="1" lineno="448" slineno="7-8"/>United States representative, governor, attorney general, state treasurer, state auditor, <ln numlevel="1" lineno="449" slineno="7-9"/>state senator, or state representative; and</amend></subsection><subsection ssid="4-4-104" dnum="_-o:b-i" numlevel="1" lineno="450" slineno="7-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="129" style="1" owner="ahaskell" level="1" amendtag="end">the candidate who receives the most votes in the initial primary election race does <ln numlevel="1" lineno="451" slineno="7-11"/>not receive more than 50% of the votes in the race.</amend></subsection></subsection><subsection ssid="4-4-105" dnum="_-o:2-i" numlevel="1" lineno="452" slineno="7-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="130" style="1" owner="ahaskell" level="1" amendtag="end">To determine the winning nominee for a race described in Subsection (1), the election <ln numlevel="1" lineno="453" slineno="7-13"/>officer shall declare as the nominee for that race the candidate who wins the runoff <ln numlevel="1" lineno="454" slineno="7-14"/>election, described in Subsection (4), between the two candidates who received the <ln numlevel="1" lineno="455" slineno="7-15"/>highest number of votes in the initial primary race.</amend></subsection><subsection ssid="4-4-106" dnum="_-o:3-i" numlevel="1" lineno="456" slineno="7-16" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="1" style="1" owner="ahaskell" level="1" amendtag="end">If a tie in the number of votes received in the initial primary election race makes it <ln numlevel="1" lineno="457" slineno="7-17"/>impossible to determine, under Subsection (2), the two candidates who received the <ln numlevel="1" lineno="458" slineno="7-18"/>highest number of votes in the initial primary race, the tie shall be broken, by lot, in the <ln numlevel="1" lineno="459" slineno="7-19"/>presence of the tied candidates or representatives of the tied candidates, by:</amend><subsection ssid="4-4-107" dnum="_-o:a-i" numlevel="1" lineno="460" slineno="7-20" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="131" style="1" owner="ahaskell" level="1" amendtag="end">the election officer; or</amend></subsection><subsection ssid="4-4-108" dnum="_-o:b-i" numlevel="1" lineno="461" slineno="7-21" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="4" style="1" owner="ahaskell" level="1" amendtag="end">if the election officer is the lieutenant governor and the race is for governor, one of <ln numlevel="1" lineno="462" slineno="7-22"/>the following, as designated by the lieutenant governor:</amend><subsection ssid="4-4-109" dnum="_-o:i-i" numlevel="1" lineno="463" slineno="7-23" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="6" style="1" owner="ahaskell" level="1" amendtag="end">the attorney general;</amend></subsection><subsection ssid="4-4-110" dnum="_-o:ii-i" numlevel="1" lineno="464" slineno="7-24" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1204" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="8" style="1" owner="ahaskell" level="1" amendtag="end">the state treasurer; or</amend></subsection><subsection ssid="4-4-111" dnum="_-o:iii-i" numlevel="1" lineno="465" slineno="7-25" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">the state auditor.</amend></subsection></subsection></subsection><subsection ssid="4-4-112" dnum="_-o:4-i" numlevel="1" lineno="466" slineno="7-26" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">To conduct a runoff election described in Subsection (2), the election officer shall:</amend><subsection ssid="4-4-113" dnum="_-o:a-i" numlevel="1" lineno="467" slineno="7-27" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1207" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">35 days after the day of the regular primary election, hold a runoff election between <ln numlevel="1" lineno="468" slineno="7-28"/>the two candidates identified under Subsection (2);</amend></subsection><subsection ssid="4-4-114" dnum="_-o:b-i" numlevel="1" lineno="469" slineno="7-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="2" style="1" owner="ahaskell" level="1" amendtag="end">conduct the election in accordance with Section <xref depth="3" refnumber="20A-3a-202">20A-3a-202</xref>, except that the election <ln numlevel="1" lineno="470" slineno="7-30"/>officer may not provide early voting for the runoff election;</amend></subsection><subsection ssid="4-4-115" dnum="_-o:c-i" numlevel="1" lineno="471" slineno="7-31" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1209" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="27" style="1" owner="ahaskell" level="1" amendtag="end">provide notice of the runoff election by:</amend><subsection ssid="4-145" dnum="_-o:i-i" numlevel="1" lineno="472" slineno="7-32" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="213" groupid="142" style="1" owner="ahaskell" level="1" amendtag="end">for 14 days before the day of the election, publishing the notice, as a class A <ln numlevel="1" lineno="473" slineno="7-33"/>notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for the county or jurisdiction to which the <ln numlevel="1" lineno="474" slineno="7-34"/>election relates; and</amend></subsection><subsection ssid="4-4-116" dnum="_-o:ii-i" numlevel="1" lineno="475" slineno="7-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="4-4-117" dnum="_-o:A-i" ea="amend" anum="0" owner="ahaskell" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="39" style="1" owner="ahaskell" level="1" amendtag="end">at least two days before the day of the election, publishing the notice in a <ln numlevel="1" lineno="476" slineno="7-36"/>newspaper of general circulation in the jurisdiction to which the election <ln numlevel="1" lineno="477" slineno="7-37"/>pertains; or</amend></subsection><subsection ssid="4-4-119" dnum="_-o:B-i" numlevel="1" lineno="478" slineno="7-38" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="45" style="1" owner="ahaskell" level="1" amendtag="end">at least five days before the day of the election, mailing the notice to each <ln numlevel="1" lineno="479" slineno="7-39"/>registered voter who resides in the jurisdiction to which the election pertains; <ln numlevel="1" lineno="480" slineno="7-40"/>and</amend></subsection></subsection></subsection><subsection ssid="4-4-122" dnum="_-o:d-i" numlevel="1" lineno="481" slineno="7-41" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="54" style="1" owner="ahaskell" level="1" amendtag="end">except as provided in Subsection (5), include in the notice described in Subsection <ln numlevel="1" lineno="482" slineno="7-42"/>(4)(c):</amend><subsection ssid="4-4-123" dnum="_-o:i-i" numlevel="1" lineno="483" slineno="7-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">at the top of the notice, the following statement:<eol numlevel="1" lineno="484" slineno="7-44"/>"NOTICE OF RUNOFF ELECTION<eol numlevel="1" lineno="485" slineno="7-45"/>Notice is given that a runoff election will be held at the date and times <ln numlevel="1" lineno="486" slineno="7-46"/>indicated below to nominate the candidate for the [name of registered political <ln numlevel="1" lineno="487" slineno="7-47"/>party] to run for [name of office] in the upcoming regular general election. The <ln numlevel="1" lineno="488" slineno="7-48"/>candidates in the runoff election are:<eol numlevel="1" lineno="489" slineno="7-49"/>[list the names of the two candidates participating in the runoff election, in the <ln numlevel="1" lineno="490" slineno="7-50"/>same order as the candidates will appear on the ballot]<eol numlevel="1" lineno="491" slineno="7-51"/>A voter who is eligible to vote in the primary election for the [insert the name <ln numlevel="1" lineno="492" slineno="7-52"/>of the applicable political party] may cast a vote in the runoff election.";</amend></subsection><subsection ssid="4-4-124" dnum="_-o:ii-i" numlevel="1" lineno="493" slineno="7-53" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="60" style="1" owner="ahaskell" level="1" amendtag="end">the hours during which the polls will be open;</amend></subsection><subsection ssid="4-4-125" dnum="_-o:iii-i" numlevel="1" lineno="494" slineno="7-54" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="66" style="1" owner="ahaskell" level="1" amendtag="end">the polling places for each voting precinct and election day voting center;</amend></subsection><subsection ssid="4-4-126" dnum="_-o:iv-i" numlevel="1" lineno="495" slineno="7-55" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="69" style="1" owner="ahaskell" level="1" amendtag="end">the address of the Statewide Electronic Voter Information Website and the <ln numlevel="1" lineno="496" slineno="7-56"/>election officer's website, with a statement indicating that the election officer will <ln numlevel="1" lineno="497" slineno="7-57"/>post on the websites any changes to the location of a polling place and the location <ln numlevel="1" lineno="498" slineno="7-58"/>of any additional polling place;</amend></subsection><subsection ssid="4-4-127" dnum="_-o:v-i" numlevel="1" lineno="499" slineno="7-59" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">a phone number that a voter may call to obtain information regarding the location <ln numlevel="1" lineno="500" slineno="7-60"/>of a polling place; and</amend></subsection><subsection ssid="4-4-128" dnum="_-o:vi-i" numlevel="1" lineno="501" slineno="7-61" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="75" style="1" owner="ahaskell" level="1" amendtag="end">the qualifications for an individual to vote in the election; and</amend></subsection></subsection><subsection ssid="4-4-129" dnum="_-o:e-i" numlevel="1" lineno="502" slineno="7-62" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="78" style="1" owner="ahaskell" level="1" amendtag="end">no later than 14 days after the day of the election, declaring nominated by the <ln numlevel="1" lineno="503" slineno="7-63"/>applicable party:</amend><subsection ssid="4-4-130" dnum="_-o:i-i" numlevel="1" lineno="504" slineno="7-64" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="81" style="1" owner="ahaskell" level="1" amendtag="end">the candidate who receives the highest number of votes in the runoff election; or</amend></subsection><subsection ssid="4-4-131" dnum="_-o:ii-i" numlevel="1" lineno="505" slineno="7-65" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="84" style="1" owner="ahaskell" level="1" amendtag="end">in the case of a tie, the candidate selected by lot, in the presence of the tied <ln numlevel="1" lineno="506" slineno="7-66"/>candidates or representatives of the tied candidates, by the individual described in <ln numlevel="1" lineno="507" slineno="7-67"/>Subsection (3).</amend></subsection></subsection></subsection><subsection ssid="4-4-132" dnum="_-o:5-i" numlevel="1" lineno="508" slineno="7-68" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="87" style="1" owner="ahaskell" level="1" amendtag="end">Instead of including the information described in Subsection (4)(d) in the notice <ln numlevel="1" lineno="509" slineno="7-69"/>described in Subsection (4)(c), the election officer may include the following in the <ln numlevel="1" lineno="510" slineno="7-70"/>notice:</amend><subsection ssid="4-4-133" dnum="_-o:a-i" numlevel="1" lineno="511" slineno="7-71" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="92" style="1" owner="ahaskell" level="1" amendtag="end">the statement described in Subsection (4)(d)(i);</amend></subsection><subsection ssid="4-4-134" dnum="_-o:b-i" numlevel="1" lineno="512" slineno="7-72" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="95" style="1" owner="ahaskell" level="1" amendtag="end">the following statement: "The election will be held in [indicate the jurisdiction] on <ln numlevel="1" lineno="513" slineno="7-73"/>[indicate date of election]. or</amend></subsection><subsection ssid="4-160" dnum="_-o:ii-i" numlevel="1" lineno="526" slineno="7-86" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="269" groupid="177" style="1" owner="ahaskell" level="1" amendtag="end">provide each voter with:</amend><subsection ssid="4-167" dnum="_-o:A-i" numlevel="1" lineno="527" slineno="7-87" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="305" groupid="205" style="1" owner="ahaskell" level="1" amendtag="end">a ballot that permits the voter to cast a vote for only one candidate in the <ln numlevel="1" lineno="528" slineno="7-88"/>regular primary election race; and</amend></subsection><subsection ssid="4-168" dnum="_-o:B-i" numlevel="1" lineno="529" slineno="7-89" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="203" style="1" owner="ahaskell" level="1" amendtag="end">a separate ballot that permits the voter to rank the candidates in the regular <ln numlevel="1" lineno="530" slineno="7-90"/>primary election race, in accordance with Subsection <xref tempid="347" depth="4" refnumber="20A-9-409.1(6)(a)(i)">(6)(a)(i)</xref>.</amend></subsection></subsection></subsection><subsection ssid="4-4-141" dnum="_-o:b-i" numlevel="1" lineno="531" slineno="7-91" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">To count a vote cast in a race described in Subsection <xref refnumber="20A-9-409.1(6)(a)" depth="4">(6)(a)</xref>, where the voter ranked <ln numlevel="1" lineno="532" slineno="7-92"/>at least two of the candidates on a ballot, the election officer shall:</amend><subsection ssid="4-4-142" dnum="_-o:i-i" numlevel="1" lineno="533" slineno="7-93" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="119" style="1" owner="ahaskell" level="1" amendtag="end">for a race in which the election officer provides the voter with a ballot described in <ln numlevel="1" lineno="534" slineno="7-94"/>Subsection <xref tempid="491" depth="4" refnumber="20A-9-409.1(6)(a)(i)">(6)(a)(i)</xref>:</amend><subsection ssid="4-163" dnum="_-o:A-i" numlevel="1" lineno="535" slineno="7-95" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="181" style="1" owner="ahaskell" level="1" amendtag="end">initially, only count a vote for the candidate who the voter ranked highest; and</amend></subsection><subsection ssid="4-149" dnum="_-o:B-i" numlevel="1" lineno="536" slineno="7-96" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="145" style="1" owner="ahaskell" level="1" amendtag="end">if the race results in a runoff election, count a vote in the runoff election for <ln numlevel="1" lineno="537" slineno="7-97"/>the candidate who is the voter's highest choice preference among the two <ln numlevel="1" lineno="538" slineno="7-98"/>candidates participating in the election; or</amend></subsection></subsection><subsection ssid="4-164" dnum="_-o:ii-i" numlevel="1" lineno="539" slineno="7-99" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="186" style="1" owner="ahaskell" level="1" amendtag="end">for a race in which the election officer provides the voter with the ballots <ln numlevel="1" lineno="540" slineno="7-100"/>described in Subsection <xref tempid="525" depth="4" refnumber="20A-9-409.1(6)(a)(ii)">(6)(a)(ii)</xref>:</amend><subsection ssid="4-165" dnum="_-o:A-i" numlevel="1" lineno="541" slineno="7-101" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="190" style="1" owner="ahaskell" level="1" amendtag="end">initially, count a vote for the candidate the voter selects on the ballot <ln numlevel="1" lineno="542" slineno="7-102"/>described in Subsection <xref refnumber="20A-9-409.1(6)" depth="4">(6)</xref>(a)(ii)(A); Duties of lieutenant governor.</bold></catline><sectionText lineno="548"><tab/>The lieutenant governor shall:</sectionText><subsection ssid="21-21-1" dnum="1-o" numlevel="1" lineno="549" slineno="8-4" level="1"><display>(1)</display>implement this chapter and the state's responsibilities under the Uniformed and <ln numlevel="1" lineno="550" slineno="8-5"/>Overseas Citizens Absentee Voting Act, 52 U.S.C. 20301 et seq.;<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both"> </amend></subsection><subsection ssid="21-21-2" dnum="2-o" numlevel="1" lineno="551" slineno="8-6" level="1"><display>(2)</display>make available to covered voters information regarding voter registration procedures for <ln numlevel="1" lineno="552" slineno="8-7"/>covered voters and procedures for casting military-overseas ballots;</subsection><subsection ssid="21-21-3" dnum="3-o" numlevel="1" lineno="553" slineno="8-8" level="1"><display>(3)</display>establish an electronic transmission system through which a covered voter may apply <ln numlevel="1" lineno="554" slineno="8-9"/>for and receive voter registration materials, military-overseas ballots, and other <ln numlevel="1" lineno="555" slineno="8-10"/>information under this chapter;</subsection><subsection ssid="21-21-4" dnum="4-o" numlevel="1" lineno="556" slineno="8-11" level="1" space="false"><display>(4)</display><subsection ssid="21-21-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>develop standardized absentee-voting materials, including privacy and <ln numlevel="1" lineno="557" slineno="8-12"/>transmission envelopes and electronic equivalents of the envelopes, authentication <ln numlevel="1" lineno="558" slineno="8-13"/>materials, and voting instructions, <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="both">including instructions for casting a vote in a <ln numlevel="1" lineno="559" slineno="8-14"/>primary election race that may result in a runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, </amend><ln numlevel="1" lineno="560" slineno="8-15"/>to be used with the military-overseas ballot of a voter authorized to vote in any <ln numlevel="1" lineno="561" slineno="8-16"/>jurisdiction in the state; and</subsection><subsection ssid="21-21-6" dnum="b-o" numlevel="1" lineno="562" slineno="8-17" level="2"><display>(b)</display>to the extent reasonably possible, coordinate with other states on the development <ln numlevel="1" lineno="563" slineno="8-18"/>required by Subsection <xref depth="4" refnumber="20A-16-201(4)(a)" start="0">(4)(a)</xref>; and</subsection></subsection><subsection ssid="21-21-7" dnum="5-o" numlevel="1" lineno="564" slineno="8-19" level="1"><display>(5)</display>prescribe the form and content of a declaration:<subsection ssid="21-21-8" dnum="a-o" numlevel="1" lineno="565" slineno="8-20" level="2"><display>(a)</display>for use by a covered voter to swear or affirm specific representations pertaining to <ln numlevel="1" lineno="566" slineno="8-21"/>the voter's identity, eligibility to vote, status as a covered voter, and timely and proper <ln numlevel="1" lineno="567" slineno="8-22"/>completion of an overseas-military ballot;</subsection><subsection ssid="21-21-9" dnum="b-o" numlevel="1" lineno="568" slineno="8-23" level="2"><display>(b)</display>that is based on the declaration prescribed to accompany a federal write-in absentee <ln numlevel="1" lineno="569" slineno="8-24"/>ballot, as modified to be consistent with this chapter; and</subsection><subsection ssid="21-21-10" dnum="c-o" numlevel="1" lineno="570" slineno="8-25" level="2"><display>(c)</display>that is a prominent part of all balloting materials for which the declaration is <ln numlevel="1" lineno="571" slineno="8-26"/>required, including an indication of the date of execution of the declaration.</subsection></subsection></section></bsec><bsec buid="28" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="572" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="572">Section 9.  <bold>Effective Date.</bold></secline><sectionText lineno="573"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-10-25 3:19 PM</tm></rev></foot></leg>
