Kyle</sponsorhead><otherSponsorhead>Senate Sponsor: Daniel McCay</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses primary elections.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that, for certain primary election races, the person who wins the nomination will <ln numlevel="1" lineno="9" slineno="0-9"/>be determined by conducting a runoff election between the two candidates who received <ln numlevel="1" lineno="10" slineno="0-10"/>the most votes in the initial primary election if: <hl numlevel="1" lineno="11" slineno="0-11" level="2">no candidate receives more than 50% of the votes in the race; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">the candidate who receives the highest number of votes does not receive at least 10% <ln numlevel="1" lineno="13" slineno="0-13"/>more of the total votes cast in the race than the candidate who receives the second <ln numlevel="1" lineno="14" slineno="0-14"/>highest number of votes;</hl></hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">describes deadlines, notice requirements, and procedures relating to a runoff election, <ln numlevel="1" lineno="16" slineno="0-16"/>including party affiliation deadlines and procedures for a military or overseas voter to <ln numlevel="1" lineno="17" slineno="0-17"/>cast a ballot in a runoff election;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">includes coordination clauses:<hl numlevel="1" lineno="19" slineno="0-19" level="2">merging the changes to Section 20A-3a-601 in this bill and in H.B. 300, Amendments <ln numlevel="1" lineno="20" slineno="0-20"/>to Election Law, if both bills pass and become law; and</hl><hl numlevel="1" lineno="21" slineno="0-21" level="2">merging the changes to Section 20A-1-304 and Section 20A-4-306 in this bill and in <ln numlevel="1" lineno="22" slineno="0-22"/>S.B. 341, Election Modifications, if both bills pass and become law; Tie votes.</bold></catline><sectionText lineno="56"/><subsection ssid="27-null-1" dnum="1-o" numlevel="1" lineno="57" slineno="1-5" level="1"><display>(1)</display>This section does not apply to a race conducted by instant runoff voting under Chapter <ln numlevel="1" lineno="58" slineno="1-6"/>4, Part 6, Municipal Alternate Voting Methods Pilot Project.</subsection><subsection ssid="27-null-2" dnum="2-o" numlevel="1" lineno="59" slineno="1-7" level="1"><display>(2)</display>Except as provided in Subsection (3), if, after conducting a recount under Subsection <xref refnumber="20A-4-401(5)" depth="4"><ln numlevel="1" lineno="60" slineno="1-8"/>20A-4-401(5)</xref>, a tie vote occurs, the election officer shall, in a public meeting held no <ln numlevel="1" lineno="61" slineno="1-9"/>later than three days after the day on which the recount canvass is completed:<subsection ssid="27-null-3" dnum="a-o" numlevel="1" lineno="62" slineno="1-10" level="2"><display>(a)</display>determine the winning candidate, by lot, in whatever manner the election officer <ln numlevel="1" lineno="63" slineno="1-11"/>determines; and</subsection><subsection ssid="27-null-4" dnum="b-o" numlevel="1" lineno="64" slineno="1-12" level="2"><display>(b)</display>provide notice and an opportunity for each candidate involved in the tie to observe <ln numlevel="1" lineno="65" slineno="1-13"/>the casting or drawing of the lot or to send a representative to observe the casting or <ln numlevel="1" lineno="66" slineno="1-14"/>drawing of the lot.</subsection></subsection><subsection ssid="27-null-5" dnum="3-o" numlevel="1" lineno="67" slineno="1-15" level="1" space="false"><display>(3)</display><subsection ssid="27-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref></amend>,<amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both"> if,</amend> after conducting a recount <ln numlevel="1" lineno="68" slineno="1-16"/>under Subsection <xref depth="3" refnumber="20A-4-401">20A-4-401</xref>(5), a tie vote occurs in a primary election race for a <ln numlevel="1" lineno="69" slineno="1-17"/>national, statewide, or other office that represents more than one county, the <ln numlevel="1" lineno="70" slineno="1-18"/>governor, lieutenant governor, and attorney general shall, at a public meeting called <ln numlevel="1" lineno="71" slineno="1-19"/>by the governor no later than three days after the day on which the recount canvass is <ln numlevel="1" lineno="72" slineno="1-20"/>completed:<subsection ssid="27-null-7" dnum="i-o" numlevel="1" lineno="73" slineno="1-21" level="3" tab="1"><display>(i)</display>determine the winning nominee, by lot, in whatever manner the governor <ln numlevel="1" lineno="74" slineno="1-22"/>determines; and</subsection><subsection ssid="27-null-8" dnum="ii-o" numlevel="1" lineno="75" slineno="1-23" level="3" tab="1"><display>(ii)</display>provide notice and an opportunity for each candidate involved in the tie to <ln numlevel="1" lineno="76" slineno="1-24"/>observe the casting or drawing of the lot or to send a representative to observe the <ln numlevel="1" lineno="77" slineno="1-25"/>casting or drawing of the lot.</subsection></subsection><subsection ssid="27-null-9" dnum="b-o" numlevel="1" lineno="78" slineno="1-26" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, if</amend>, after conducting a recount under <ln numlevel="1" lineno="79" slineno="1-27"/>Subsection <xref depth="3" refnumber="20A-4-401">20A-4-401</xref>(5), a tie vote occurs in a primary election race for a county <ln numlevel="1" lineno="80" slineno="1-28"/>office, the district court judges of the district in which the county is located shall, at a <ln numlevel="1" lineno="81" slineno="1-29"/>public meeting called by the judges no later than three days after the day on which <ln numlevel="1" lineno="82" slineno="1-30"/>the recount canvass is completed:<subsection ssid="27-null-10" dnum="i-o" numlevel="1" lineno="83" slineno="1-31" level="3"><display>(i)</display>determine the winning nominee, by lot, in whatever manner the judges determine; <ln numlevel="1" lineno="84" slineno="1-32"/>and</subsection><subsection ssid="27-null-11" dnum="ii-o" numlevel="1" lineno="85" slineno="1-33" level="3"><display>(ii)</display>provide notice and an opportunity for each candidate involved in the tie to <ln numlevel="1" lineno="86" slineno="1-34"/>observe the casting or drawing of the lot or to send a representative to observe the <ln numlevel="1" lineno="87" slineno="1-35"/>casting or drawing of the lot.</subsection></subsection></subsection></section></bsec><bsec buid="29" num="20A-2-107" type="amend" src="code" uid="C20A-2-S107_2025050720250507" sort="20A02 01070020250507" numlevel="1" lineno="88" slineno="2-1" sn="2"><section number="20A-2-107" numlevel="1" lineno="89" slineno="2-2" type="amend"><secline lineno="88">Section 2, Section <bold>20A-2-107</bold> is amended to read:</secline><catline lineno="89"><bold>20A-2-107<parens/>. Designating or changing party affiliation -- Times permitted.</bold></catline><subsection ssid="29-null-1" dnum="1-o" numlevel="1" lineno="90" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "change of affiliation deadline" means:<subsection ssid="29-null-2" dnum="a-o" numlevel="1" lineno="91" slineno="2-4" level="2"><display>(a)</display>for an election held in an even-numbered year in which a presidential election will be <ln numlevel="1" lineno="92" slineno="2-5"/>held, the day after the declaration of candidacy deadline described in Subsection <xref depth="4" refnumber="20A-9-201.5(2)(b)" start="0"><ln numlevel="1" lineno="93" slineno="2-6"/>20A-9-201.5(2)(b)</xref>; or</subsection><subsection ssid="29-null-3" dnum="b-o" numlevel="1" lineno="94" slineno="2-7" level="2"><display>(b)</display>for an election held in an even-numbered year in which a presidential election will <ln numlevel="1" lineno="95" slineno="2-8"/>not be held, April 1.</subsection></subsection><subsection ssid="29-null-4" dnum="2-o" numlevel="1" lineno="96" slineno="2-9" level="1"><display>(2)</display>The county clerk shall:<subsection ssid="29-null-5" dnum="a-o" numlevel="1" lineno="97" slineno="2-10" level="2"><display>(a)</display>except as provided in Subsection <xref depth="4" refnumber="20A-2-107(6)" start="0">(6)</xref> or <xref depth="4" refnumber="20A-2-107.5(3)" start="0">20A-2-107.5(3)</xref>, record the party affiliation <ln numlevel="1" lineno="98" slineno="2-11"/>designated by the voter on the voter registration form as the voter's party affiliation; or</subsection><subsection ssid="29-null-6" dnum="b-o" numlevel="1" lineno="99" slineno="2-12" level="2"><display>(b)</display>if no political party affiliation is designated by the voter on the voter registration <ln numlevel="1" lineno="100" slineno="2-13"/>form:<subsection ssid="29-null-7" dnum="i-o" numlevel="1" lineno="101" slineno="2-14" level="3"><display>(i)</display>except as provided in Subsection <xref depth="4" refnumber="20A-2-107(2)(b)(ii)" start="0">(2)(b)(ii)</xref>, record the voter's party affiliation as <ln numlevel="1" lineno="102" slineno="2-15"/>the party that the voter designated the last time that the voter designated a party on <ln numlevel="1" lineno="103" slineno="2-16"/>a voter registration form, unless the voter more recently registered as <ln numlevel="1" lineno="104" slineno="2-17"/>"unaffiliated"; or</subsection><subsection ssid="29-null-8" dnum="ii-o" numlevel="1" lineno="105" slineno="2-18" level="3"><display>(ii)</display>record the voter's party affiliation as "unaffiliated" if the voter:<subsection ssid="29-null-9" dnum="A-o" numlevel="1" lineno="106" slineno="2-19" level="4"><display>(A)</display>did not previously designate a party;</subsection><subsection ssid="29-null-10" dnum="B-o" numlevel="1" lineno="107" slineno="2-20" level="4"><display>(B)</display>most recently designated the voter's party affiliation as "unaffiliated"; or</subsection><subsection ssid="29-null-11" dnum="C-o" numlevel="1" lineno="108" slineno="2-21" level="4"><display>(C)</display>did not previously register.</subsection></subsection></subsection></subsection><subsection ssid="29-null-12" dnum="3-o" numlevel="1" lineno="109" slineno="2-22" level="1" space="false"><display>(3)</display><subsection ssid="29-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Any registered voter may designate or change the voter's political party affiliation <ln numlevel="1" lineno="110" slineno="2-23"/>by complying with the procedures and requirements of this Subsection <xref depth="4" refnumber="20A-2-107(3)" start="0">(3)</xref>.</subsection><subsection ssid="29-null-14" dnum="b-o" numlevel="1" lineno="111" slineno="2-24" level="2"><display>(b)</display>A registered voter may designate or change the voter's political party affiliation by <ln numlevel="1" lineno="112" slineno="2-25"/>filing with the county clerk, the municipal clerk, or the lieutenant governor a voter <ln numlevel="1" lineno="113" slineno="2-26"/>registration form or another signed form that identifies the registered political party <ln numlevel="1" lineno="114" slineno="2-27"/>with which the voter chooses to affiliate.</subsection><subsection ssid="29-null-15" dnum="c-o" numlevel="1" lineno="115" slineno="2-28" level="2"><display>(c)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-2-107(3)(d)" start="0">(3)(d)</xref>, a voter registration form or another signed <ln numlevel="1" lineno="116" slineno="2-29"/>form designating or changing a voter's political party affiliation takes effect when the <ln numlevel="1" lineno="117" slineno="2-30"/>county clerk receives the signed form.</subsection><subsection ssid="29-null-16" dnum="d-o" numlevel="1" lineno="118" slineno="2-31" level="2"><display>(d)</display>The party affiliation of a voter who changes party affiliation, or who becomes <ln numlevel="1" lineno="119" slineno="2-32"/>unaffiliated from a political party, at any time on or after the change of affiliation <ln numlevel="1" lineno="120" slineno="2-33"/>deadline and on or before the date of the regular primary election, takes effect<amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="29-29" dnum="_-o:i-i" numlevel="1" lineno="121" slineno="2-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the day after the statewide canvass for the regular primary election<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="29-30" dnum="_-o:ii-i" numlevel="1" lineno="122" slineno="2-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">if the regular primary election results in a primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1"><ln numlevel="1" lineno="123" slineno="2-36"/>20A-9-409.1</xref>, the day after the statewide canvass for the primary runoff election.</amend></subsection></subsection></subsection><subsection ssid="29-null-17" dnum="4-o" numlevel="1" lineno="124" slineno="2-37" level="1"><display>(4)</display>For purposes of Subsection <xref depth="4" refnumber="20A-2-107(3)(d)" start="0">(3)(d)</xref>, a form described in Subsection <xref depth="4" refnumber="20A-2-107(3)(c)" start="0">(3)(c)</xref> is received by <ln numlevel="1" lineno="125" slineno="2-38"/>the county clerk before the change of affiliation deadline if:<subsection ssid="29-null-18" dnum="a-o" numlevel="1" lineno="126" slineno="2-39" level="2"><display>(a)</display>the individual submits the form in person at the county clerk's office no later than 5 <ln numlevel="1" lineno="127" slineno="2-40"/>p.m. on the day before the change of affiliation deadline;</subsection><subsection ssid="29-null-19" dnum="b-o" numlevel="1" lineno="128" slineno="2-41" level="2"><display>(b)</display>the individual submits the form electronically through the system described in <ln numlevel="1" lineno="129" slineno="2-42"/>Section <xref depth="3" refnumber="20A-2-206" start="0">20A-2-206</xref>, at or before 11:59 p.m. before the day of the change of affiliation <ln numlevel="1" lineno="130" slineno="2-43"/>deadline; or</subsection><subsection ssid="29-null-20" dnum="c-o" numlevel="1" lineno="131" slineno="2-44" level="2"><display>(c)</display>the individual's form is clearly postmarked before the change of affiliation deadline.</subsection></subsection><subsection ssid="29-null-21" dnum="5-o" numlevel="1" lineno="132" slineno="2-45" level="1"><display>(5)</display>Subsection <xref depth="4" refnumber="20A-2-107(3)(d)" start="0">(3)(d)</xref> does not apply to the party affiliation designated by a voter on a voter <ln numlevel="1" lineno="133" slineno="2-46"/>registration form if:<subsection ssid="29-null-22" dnum="a-o" numlevel="1" lineno="134" slineno="2-47" level="2"><display>(a)</display>the voter has not previously been registered to vote in the state; or</subsection><subsection ssid="29-null-23" dnum="b-o" numlevel="1" lineno="135" slineno="2-48" level="2"><display>(b)</display>the voter's most recent party affiliation was changed to "unaffiliated" by a county <ln numlevel="1" lineno="136" slineno="2-49"/>clerk under Subsection <xref depth="4" refnumber="20A-2-107(6)" start="0">(6)</xref>.</subsection></subsection><subsection ssid="29-null-24" dnum="6-o" numlevel="1" lineno="137" slineno="2-50" level="1"><display>(6)</display>If the most recent party affiliation designated by a voter is for a political party that is no <ln numlevel="1" lineno="138" slineno="2-51"/>longer a registered political party, the county clerk shall:<subsection ssid="29-null-25" dnum="a-o" numlevel="1" lineno="139" slineno="2-52" level="2"><display>(a)</display>change the voter's party affiliation to "unaffiliated"; and</subsection><subsection ssid="29-null-26" dnum="b-o" numlevel="1" lineno="140" slineno="2-53" level="2"><display>(b)</display>notify the voter electronically or by mail:<subsection ssid="29-null-27" dnum="i-o" numlevel="1" lineno="141" slineno="2-54" level="3"><display>(i)</display>that the voter's affiliation has been changed to "unaffiliated" because the most <ln numlevel="1" lineno="142" slineno="2-55"/>recent party affiliation designated by the voter is for a political party that is no <ln numlevel="1" lineno="143" slineno="2-56"/>longer a registered political party; and</subsection><subsection ssid="29-null-28" dnum="ii-o" numlevel="1" lineno="144" slineno="2-57" level="3"><display>(ii)</display>of the methods and deadlines for changing the voter's party affiliation.</subsection></subsection></subsection></section></bsec><bsec buid="31" num="20A-2-107.5" type="amend" src="code" uid="C20A-2-S107.5_2025050720250507" sort="20A02 01070520250507" numlevel="1" lineno="145" slineno="3-1" sn="3"><section number="20A-2-107.5" numlevel="1" lineno="146" slineno="3-2" type="amend"><secline lineno="145">Section 3, Section <bold>20A-2-107.5</bold> is amended to read:</secline><catline lineno="146"><bold>20A-2-107.5<parens/>. Designating or changing party affiliation -- Regular primary <ln numlevel="1" lineno="147" slineno="3-3"/>election and presidential primary election -- Voting in primaries of multiple parties <ln numlevel="1" lineno="148" slineno="3-4"/>prohibited.</bold></catline><subsection ssid="31-null-1" dnum="1-o" numlevel="1" lineno="149" slineno="3-5" level="1" placement="noreturn"><display>(1)</display>As used in this section, "change of affiliation deadline" means the same as that term is <ln numlevel="1" lineno="150" slineno="3-6"/>defined in Subsection <xref depth="4" refnumber="20A-2-107(1)" start="0">20A-2-107(1)</xref>.</subsection><subsection ssid="31-null-2" dnum="2-o" numlevel="1" lineno="151" slineno="3-7" level="1"><display>(2)</display>Except as provided in Subsection <xref depth="4" refnumber="20A-2-107.5(3)" start="0">(3)</xref>, a registered voter who is classified as <ln numlevel="1" lineno="152" slineno="3-8"/>"unaffiliated" may, at a regular primary election or a presidential primary election:<subsection ssid="31-null-3" dnum="a-o" numlevel="1" lineno="153" slineno="3-9" level="2"><display>(a)</display>affiliate with a political party by completing a change of party affiliation form or <ln numlevel="1" lineno="154" slineno="3-10"/>voter registration form and submitting the form to the county clerk or a poll worker; <ln numlevel="1" lineno="155" slineno="3-11"/>and</subsection><subsection ssid="31-null-4" dnum="b-o" numlevel="1" lineno="156" slineno="3-12" level="2"><display>(b)</display>vote in that party's primary election.</subsection></subsection><subsection ssid="31-null-5" dnum="3-o" numlevel="1" lineno="157" slineno="3-13" level="1"><display>(3)</display>The party affiliation of a voter who changes party affiliation, or who becomes <ln numlevel="1" lineno="158" slineno="3-14"/>unaffiliated from a political party, at any time on or after the change of affiliation <ln numlevel="1" lineno="159" slineno="3-15"/>deadline and on or before the date of the regular primary election, takes effect<amend anum="0" ea="amend" pairid="19" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <subsection ssid="31-11" dnum="_-o:a-i" numlevel="1" lineno="160" slineno="3-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>the day after the statewide canvass for the regular primary election<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="31-12" dnum="_-o:b-i" numlevel="1" lineno="161" slineno="3-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">if the regular primary election results in a primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1"><ln numlevel="1" lineno="162" slineno="3-18"/>20A-9-409.1</xref>, the day after the statewide canvass for the primary runoff election.</amend></subsection></subsection><subsection ssid="31-null-6" dnum="4-o" numlevel="1" lineno="163" slineno="3-19" level="1" space="false"><display>(4)</display><subsection ssid="31-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A voter who votes in the presidential primary election of a registered political <ln numlevel="1" lineno="164" slineno="3-20"/>party may not, for the same election, vote in the presidential primary election of <ln numlevel="1" lineno="165" slineno="3-21"/>another registered political party.</subsection><subsection ssid="31-null-8" dnum="b-o" numlevel="1" lineno="166" slineno="3-22" level="2"><display>(b)</display>A voter who votes in the regular primary election of a registered political party may <ln numlevel="1" lineno="167" slineno="3-23"/>not, for the same election, vote in the regular primary election of another registered <ln numlevel="1" lineno="168" slineno="3-24"/>political party.</subsection></subsection></section></bsec><bsec buid="12" num="20A-3a-601" type="amend" src="code" uid="C20A-3a-S601_2025050720250507" sort="20A03a06010020250507" numlevel="1" lineno="170" slineno="4-2" sn="4"><section number="20A-3a-601" numlevel="1" lineno="171" slineno="4-3" type="amend"><secline lineno="170">Section 4, Section <bold>20A-3a-601</bold> is amended to read:</secline><catline lineno="171"><bold>20A-3a-601<parens/>. Early voting.</bold></catline><subsection ssid="12-12-1" dnum="1-o" numlevel="1" lineno="172" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>Except as provided in <amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">Subsection <xref depth="4" refnumber="20A-9-409.1(4)(b)">20A-9-409.1(4)(b)</xref> or </amend>Section <xref depth="3" refnumber="20A-7-609.5" start="0">20A-7-609.5</xref>:<subsection ssid="12-12-2" dnum="a-o" numlevel="1" lineno="173" slineno="4-5" level="2"><display>(a)</display>an individual who is registered to vote may vote at a polling place before the election <ln numlevel="1" lineno="174" slineno="4-6"/>date in accordance with this section; and</subsection><subsection ssid="12-12-3" dnum="b-o" numlevel="1" lineno="175" slineno="4-7" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-2-207(6)" start="0">20A-2-207(6)</xref>, an individual who is not registered <ln numlevel="1" lineno="176" slineno="4-8"/>to vote may register to vote and vote at a polling place before the election date in <ln numlevel="1" lineno="177" slineno="4-9"/>accordance with this section if the individual:<subsection ssid="12-12-4" dnum="i-o" numlevel="1" lineno="178" slineno="4-10" level="3"><display>(i)</display>is otherwise legally entitled to vote the ballot; and</subsection><subsection ssid="12-12-5" dnum="ii-o" numlevel="1" lineno="179" slineno="4-11" level="3"><display>(ii)</display>casts a provisional ballot in accordance with Section <xref depth="3" refnumber="20A-2-207" start="0">20A-2-207</xref>.</subsection></subsection></subsection><subsection ssid="12-12-6" dnum="2-o" numlevel="1" lineno="180" slineno="4-12" level="1"><display>(2)</display>Except as provided in Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref> or Subsection <xref depth="4" refnumber="20A-3a-601(3)" start="0">(3)</xref>, the early voting period:<subsection ssid="12-12-7" dnum="a-o" numlevel="1" lineno="181" slineno="4-13" level="2"><display>(a)</display>begins on the date that is 14 days before the date of the election; and</subsection><subsection ssid="12-12-8" dnum="b-o" numlevel="1" lineno="182" slineno="4-14" level="2"><display>(b)</display>continues through the Friday before the election if the election date is a Tuesday.</subsection></subsection><subsection ssid="12-12-9" dnum="3-o" numlevel="1" lineno="183" slineno="4-15" level="1" space="false"><display>(3)</display><subsection ssid="12-12-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An election officer may extend the end of the early voting period to the day before <ln numlevel="1" lineno="184" slineno="4-16"/>the election date if the election officer provides notice of the extension in accordance <ln numlevel="1" lineno="185" slineno="4-17"/>with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection><subsection ssid="12-12-11" dnum="b-o" numlevel="1" lineno="186" slineno="4-18" level="2"><display>(b)</display>For a municipal election, the municipal clerk may reduce the early voting period <ln numlevel="1" lineno="187" slineno="4-19"/>described in this section if:<subsection ssid="12-12-12" dnum="i-o" numlevel="1" lineno="188" slineno="4-20" level="3"><display>(i)</display>the municipal clerk conducts early voting on at least four days;</subsection><subsection ssid="12-12-13" dnum="ii-o" numlevel="1" lineno="189" slineno="4-21" level="3"><display>(ii)</display>the early voting days are within the period beginning on the date that is 14 days <ln numlevel="1" lineno="190" slineno="4-22"/>before the date of the election and ending on the day before the election; and</subsection><subsection ssid="12-12-14" dnum="iii-o" numlevel="1" lineno="191" slineno="4-23" level="3"><display>(iii)</display>the municipal clerk provides notice of the reduced early voting period in <ln numlevel="1" lineno="192" slineno="4-24"/>accordance with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection></subsection><subsection ssid="12-12-15" dnum="c-o" numlevel="1" lineno="193" slineno="4-25" level="2"><display>(c)</display>For a county election, the county clerk may reduce the early voting period described <ln numlevel="1" lineno="194" slineno="4-26"/>in this section if:<subsection ssid="12-12-16" dnum="i-o" numlevel="1" lineno="195" slineno="4-27" level="3"><display>(i)</display>the county clerk conducts early voting on at least four days;</subsection><subsection ssid="12-12-17" dnum="ii-o" numlevel="1" lineno="196" slineno="4-28" level="3"><display>(ii)</display>the early voting days are within the period beginning on the date that is 14 days <ln numlevel="1" lineno="197" slineno="4-29"/>before the date of the election and ending on the day before the election; and</subsection><subsection ssid="12-12-18" dnum="iii-o" numlevel="1" lineno="198" slineno="4-30" level="3"><display>(iii)</display>the county clerk provides notice of the reduced early voting period in accordance <ln numlevel="1" lineno="199" slineno="4-31"/>with Section <xref depth="3" refnumber="20A-3a-604" start="0">20A-3a-604</xref>.</subsection></subsection></subsection><subsection ssid="12-12-19" dnum="4-o" numlevel="1" lineno="200" slineno="4-32" level="1"><display>(4)</display>Except as provided in Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref>, during the early voting period, the election <ln numlevel="1" lineno="201" slineno="4-33"/>officer:<subsection ssid="12-12-20" dnum="a-o" numlevel="1" lineno="202" slineno="4-34" level="2"><display>(a)</display>for a local special election, a municipal primary election, and a municipal general <ln numlevel="1" lineno="203" slineno="4-35"/>election:<subsection ssid="12-12-21" dnum="i-o" numlevel="1" lineno="204" slineno="4-36" level="3"><display>(i)</display>shall conduct early voting on a minimum of four days during each week of the <ln numlevel="1" lineno="205" slineno="4-37"/>early voting period; and</subsection><subsection ssid="12-12-22" dnum="ii-o" numlevel="1" lineno="206" slineno="4-38" level="3"><display>(ii)</display>shall conduct early voting on the last day of the early voting period; and</subsection></subsection><subsection ssid="12-12-23" dnum="b-o" numlevel="1" lineno="207" slineno="4-39" level="2"><display>(b)</display>for all other elections:<subsection ssid="12-12-24" dnum="i-o" numlevel="1" lineno="208" slineno="4-40" level="3"><display>(i)</display>shall conduct early voting on each weekday; and</subsection><subsection ssid="12-12-25" dnum="ii-o" numlevel="1" lineno="209" slineno="4-41" level="3"><display>(ii)</display>may elect to conduct early voting on a Saturday, Sunday, or holiday.</subsection></subsection></subsection><subsection ssid="12-12-26" dnum="5-o" numlevel="1" lineno="210" slineno="4-42" level="1"><display>(5)</display>Except as specifically provided in this <xref depth="2" refnumber="20A-3a-6" start="2">Part 6, Early Voting</xref>, or Section <xref depth="3" refnumber="20A-1-308" start="0">20A-1-308</xref>, early <ln numlevel="1" lineno="211" slineno="4-43"/>voting shall be administered in accordance with the requirements of this title.</subsection></section></bsec><bsec buid="17" num="20A-4-301" type="amend" src="code" uid="C20A-4-S301_2025050720250507" sort="20A04 03010020250507" numlevel="1" lineno="212" slineno="5-1" sn="5"><section number="20A-4-301" numlevel="1" lineno="213" slineno="5-2" type="amend"><secline lineno="212">Section 5, Section <bold>20A-4-301</bold> is amended to read:</secline><catline lineno="213"><bold>20A-4-301<parens/>. Board of canvassers.</bold></catline><subsection ssid="17-17-1" dnum="1-o" numlevel="1" lineno="214" slineno="5-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="17-17-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each county legislative body is the board of county canvassers for:<subsection ssid="17-17-3" dnum="i-o" numlevel="1" lineno="215" slineno="5-4" level="3" tab="1"><display>(i)</display>the county; and</subsection><subsection ssid="17-17-4" dnum="ii-o" numlevel="1" lineno="216" slineno="5-5" level="3" tab="1"><display>(ii)</display>each special district whose election is conducted by the county if:<subsection ssid="17-17-5" dnum="A-o" numlevel="1" lineno="217" slineno="5-6" level="4"><display>(A)</display>the election relates to the creation of the special district;</subsection><subsection ssid="17-17-6" dnum="B-o" numlevel="1" lineno="218" slineno="5-7" level="4"><display>(B)</display>the county legislative body serves as the governing body of the special <ln numlevel="1" lineno="219" slineno="5-8"/>district; or</subsection><subsection ssid="17-17-7" dnum="C-o" numlevel="1" lineno="220" slineno="5-9" level="4"><display>(C)</display>there is no duly constituted governing body of the special district.</subsection></subsection></subsection><subsection ssid="17-17-8" dnum="b-o" numlevel="1" lineno="221" slineno="5-10" level="2" space="false"><display>(b)</display><subsection ssid="17-35" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>The board of county canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="222" slineno="5-11"/>place of meeting of the county legislative body<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">, at a date and time determined by <ln numlevel="1" lineno="223" slineno="5-12"/>the county clerk that is</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend> <subsection ssid="17-33" dnum="_-o:A-i" numlevel="1" lineno="224" slineno="5-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">for canvassing of returns from a regular general election, </amend>no sooner than seven <ln numlevel="1" lineno="225" slineno="5-14"/>days after the election and no later than 14 days after the election<amend anum="0" ea="amend" pairid="20" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both">; or</amend></subsection><subsection ssid="17-34" dnum="_-o:B-i" numlevel="1" lineno="226" slineno="5-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">for canvassing of returns from a regular primary election, including from a <ln numlevel="1" lineno="227" slineno="5-16"/>primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, on the seventh calendar <ln numlevel="1" lineno="228" slineno="5-17"/>day after the day of the election</amend>.</subsection></subsection></subsection><subsection ssid="17-36" dnum="_-o:c-i" numlevel="1" lineno="229" slineno="5-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">In an election described in Subsection (1)(b)(i) the county clerk shall, immediately <ln numlevel="1" lineno="230" slineno="5-19"/>upon adjournment of the board of county canvassers, transmit to the lieutenant <ln numlevel="1" lineno="231" slineno="5-20"/>governor, via a secure electronic method:</amend><subsection ssid="17-37" dnum="_-o:i-i" numlevel="1" lineno="232" slineno="5-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">the county totals for the election; and</amend></subsection><subsection ssid="17-38" dnum="_-o:ii-i" numlevel="1" lineno="233" slineno="5-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the signed canvassing report described in Section <xref depth="3" refnumber="20A-4-304">20A-4-304</xref>.</amend></subsection></subsection><subsection ssid="17-17-9" dnum="c-o:d-i" numlevel="1" lineno="234" slineno="5-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1091" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>If one or more of the county legislative body fails to attend the meeting of the <ln numlevel="1" lineno="235" slineno="5-24"/>board of county canvassers, the remaining members shall replace the absent member <ln numlevel="1" lineno="236" slineno="5-25"/>by appointing in the order named:<subsection ssid="17-17-10" dnum="i-o" numlevel="1" lineno="237" slineno="5-26" level="3"><display>(i)</display>the county treasurer;</subsection><subsection ssid="17-17-11" dnum="ii-o" numlevel="1" lineno="238" slineno="5-27" level="3"><display>(ii)</display>the county assessor; or</subsection><subsection ssid="17-17-12" dnum="iii-o" numlevel="1" lineno="239" slineno="5-28" level="3"><display>(iii)</display>the county sheriff.</subsection></subsection><subsection ssid="17-17-13" dnum="d-o:e-i" numlevel="1" lineno="240" slineno="5-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1095" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1096" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>Attendance of the number of persons equal to a simple majority of the county <ln numlevel="1" lineno="241" slineno="5-30"/>legislative body, but not less than three persons, shall constitute a quorum for <ln numlevel="1" lineno="242" slineno="5-31"/>conducting the canvass.</subsection><subsection ssid="17-17-14" dnum="e-o:f-i" numlevel="1" lineno="243" slineno="5-32" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>The county clerk is the clerk of the board of county canvassers.</subsection></subsection><subsection ssid="17-17-15" dnum="2-o" numlevel="1" lineno="244" slineno="5-33" level="1" space="false"><display>(2)</display><subsection ssid="17-17-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The mayor and the municipal legislative body are the board of municipal <ln numlevel="1" lineno="245" slineno="5-34"/>canvassers for the municipality.</subsection><subsection ssid="17-17-17" dnum="b-o" numlevel="1" lineno="246" slineno="5-35" level="2"><display>(b)</display>The board of municipal canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="247" slineno="5-36"/>place of meeting of the municipal legislative body:<subsection ssid="17-17-18" dnum="i-o" numlevel="1" lineno="248" slineno="5-37" level="3"><display>(i)</display>for canvassing of returns from a municipal general election, no sooner than seven <ln numlevel="1" lineno="249" slineno="5-38"/>days after the election and no later than 14 days after the election; or</subsection><subsection ssid="17-17-19" dnum="ii-o" numlevel="1" lineno="250" slineno="5-39" level="3"><display>(ii)</display>for canvassing of returns from a municipal primary election, no sooner than seven <ln numlevel="1" lineno="251" slineno="5-40"/>days after the election and no later than 14 days after the election.</subsection></subsection><subsection ssid="17-17-20" dnum="c-o" numlevel="1" lineno="252" slineno="5-41" level="2"><display>(c)</display>Attendance of a simple majority of the municipal legislative body shall constitute a <ln numlevel="1" lineno="253" slineno="5-42"/>quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-21" dnum="3-o" numlevel="1" lineno="254" slineno="5-43" level="1" space="false"><display>(3)</display><subsection ssid="17-17-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The legislative body of the entity authorizing a bond election is the board of <ln numlevel="1" lineno="255" slineno="5-44"/>canvassers for each bond election.</subsection><subsection ssid="17-17-23" dnum="b-o" numlevel="1" lineno="256" slineno="5-45" level="2"><display>(b)</display>The board of canvassers for the bond election shall comply with the canvassing <ln numlevel="1" lineno="257" slineno="5-46"/>procedures and requirements of Section <xref depth="3" refnumber="11-14-207">11-14-207</xref>.</subsection><subsection ssid="17-17-24" dnum="c-o" numlevel="1" lineno="258" slineno="5-47" level="2"><display>(c)</display>Attendance of a simple majority of the legislative body of the entity authorizing a <ln numlevel="1" lineno="259" slineno="5-48"/>bond election shall constitute a quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-25" dnum="4-o" numlevel="1" lineno="260" slineno="5-49" level="1" space="false"><display>(4)</display><subsection ssid="17-17-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a board of trustees or an administrative control board is the governing body of a <ln numlevel="1" lineno="261" slineno="5-50"/>special district, the board of trustees or the administrative control board is the board <ln numlevel="1" lineno="262" slineno="5-51"/>of special district canvassers for the special district.</subsection><subsection ssid="17-17-27" dnum="b-o" numlevel="1" lineno="263" slineno="5-52" level="2"><display>(b)</display>The board of special district canvassers shall meet to canvass the returns at the usual <ln numlevel="1" lineno="264" slineno="5-53"/>place of meeting for the board of trustees or the administrative control board, as <ln numlevel="1" lineno="265" slineno="5-54"/>applicable, at a date and time determined by the special district clerk that is no sooner <ln numlevel="1" lineno="266" slineno="5-55"/>than seven days after the day of the election and no later than 14 days after the day of <ln numlevel="1" lineno="267" slineno="5-56"/>the election.</subsection><subsection ssid="17-17-28" dnum="c-o" numlevel="1" lineno="268" slineno="5-57" level="2"><display>(c)</display>Attendance of a simple majority of the board of trustees or the administrative control <ln numlevel="1" lineno="269" slineno="5-58"/>board is a quorum for conducting the canvass.</subsection></subsection><subsection ssid="17-17-29" dnum="5-o" numlevel="1" lineno="270" slineno="5-59" level="1"><display>(5)</display>In relation to an election for the creation of a new school district under Section <xref depth="3" refnumber="53G-3-301.1"><ln numlevel="1" lineno="271" slineno="5-60"/>53G-3-301.1</xref>, <xref depth="3" refnumber="53G-3-301.3">53G-3-301.3</xref>, or <xref depth="3" refnumber="53G-3-301.4">53G-3-301.4</xref>, or in relation to an election of members of a <ln numlevel="1" lineno="272" slineno="5-61"/>local school board for a new school district or a reorganized new school district under <ln numlevel="1" lineno="273" slineno="5-62"/>Section <xref depth="3" refnumber="53G-3-302">53G-3-302</xref>, the board of canvassers is:<subsection ssid="17-17-30" dnum="a-o" numlevel="1" lineno="274" slineno="5-63" level="2"><display>(a)</display>if the voters permitted to vote in the election are all residents of the same <ln numlevel="1" lineno="275" slineno="5-64"/>municipality, the mayor and the municipal legislative body;</subsection><subsection ssid="17-17-31" dnum="b-o" numlevel="1" lineno="276" slineno="5-65" level="2"><display>(b)</display>if the voters permitted to vote in the election are not all residents of the same <ln numlevel="1" lineno="277" slineno="5-66"/>municipality, but are all residents of the same county, the county legislative body; or</subsection><subsection ssid="17-17-32" dnum="c-o" numlevel="1" lineno="278" slineno="5-67" level="2"><display>(c)</display>if the voters permitted to vote in the election are not all residents of the same <ln numlevel="1" lineno="279" slineno="5-68"/>municipality and are not all residents of the same county, the county legislative body <ln numlevel="1" lineno="280" slineno="5-69"/>of the county where the majority of the voters permitted to vote in the election are <ln numlevel="1" lineno="281" slineno="5-70"/>residents.</subsection></subsection></section></bsec><bsec buid="37" num="20A-4-304" type="amend" src="code" uid="C20A-4-S304_2025050720250507" sort="20A04 03040020250507" numlevel="1" lineno="282" slineno="6-1" sn="6"><section number="20A-4-304" numlevel="1" lineno="283" slineno="6-2" type="amend"><secline lineno="282">Section 6, Section <bold>20A-4-304</bold> is amended to read:</secline><catline lineno="283"><bold>20A-4-304<parens/>. Declaration of results -- Canvassers' report.</bold></catline><subsection ssid="37-null-1" dnum="1-o" numlevel="1" lineno="284" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="37-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Part 6, Municipal Alternate Voting Methods Pilot Project, a <ln numlevel="1" lineno="285" slineno="6-4"/>board of canvassers shall declare "elected" or "nominated" those persons who:<subsection ssid="37-null-3" dnum="i-o" numlevel="1" lineno="286" slineno="6-5" level="3" tab="1"><display>(i)</display>had the highest number of votes; and</subsection><subsection ssid="37-null-4" dnum="ii-o" numlevel="1" lineno="287" slineno="6-6" level="3" tab="1"><display>(ii)</display>sought election or nomination to an office completely within the board's <ln numlevel="1" lineno="288" slineno="6-7"/>jurisdiction.</subsection></subsection><subsection ssid="37-null-5" dnum="b-o" numlevel="1" lineno="289" slineno="6-8" level="2"><display>(b)</display>Except as provided in Part 6, Municipal Alternate Voting Methods Pilot Project, a <ln numlevel="1" lineno="290" slineno="6-9"/>board of canvassers shall declare a "tie vote" if:<subsection ssid="37-null-6" dnum="i-o" numlevel="1" lineno="291" slineno="6-10" level="3"><display>(i)</display>two or more candidates for an office receive an equal and the highest number of <ln numlevel="1" lineno="292" slineno="6-11"/>votes for that office; or</subsection><subsection ssid="37-null-7" dnum="ii-o" numlevel="1" lineno="293" slineno="6-12" level="3"><display>(ii)</display>in a race for an at-large office:<subsection ssid="37-null-8" dnum="A-o" numlevel="1" lineno="294" slineno="6-13" level="4"><display>(A)</display>two or more candidates receive an equal number of votes; and</subsection><subsection ssid="37-null-9" dnum="B-o" numlevel="1" lineno="295" slineno="6-14" level="4"><display>(B)</display>a recount is necessary to determine which candidates are elected to the at-large <ln numlevel="1" lineno="296" slineno="6-15"/>office.</subsection></subsection></subsection><subsection ssid="37-null-10" dnum="c-o" numlevel="1" lineno="297" slineno="6-16" level="2"><display>(c)</display>A board of canvassers shall declare:<subsection ssid="37-null-11" dnum="i-o" numlevel="1" lineno="298" slineno="6-17" level="3"><display>(i)</display>"approved" those ballot propositions that:<subsection ssid="37-null-12" dnum="A-o" numlevel="1" lineno="299" slineno="6-18" level="4"><display>(A)</display>had more "yes" votes than "no" votes; and</subsection><subsection ssid="37-null-13" dnum="B-o" numlevel="1" lineno="300" slineno="6-19" level="4"><display>(B)</display>were submitted only to the voters within the board's jurisdiction; or</subsection></subsection><subsection ssid="37-null-14" dnum="ii-o" numlevel="1" lineno="301" slineno="6-20" level="3"><display>(ii)</display>"rejected" those ballot propositions that:<subsection ssid="37-null-15" dnum="A-o" numlevel="1" lineno="302" slineno="6-21" level="4"><display>(A)</display>had more "no" votes than "yes" votes or an equal number of "no" votes and <ln numlevel="1" lineno="303" slineno="6-22"/>"yes" votes; and</subsection><subsection ssid="37-null-16" dnum="B-o" numlevel="1" lineno="304" slineno="6-23" level="4"><display>(B)</display>were submitted only to the voters within the board's jurisdiction.</subsection></subsection></subsection><subsection ssid="37-null-17" dnum="d-o" numlevel="1" lineno="305" slineno="6-24" level="2"><display>(d)</display>A board of canvassers shall:<subsection ssid="37-null-18" dnum="i-o" numlevel="1" lineno="306" slineno="6-25" level="3"><display>(i)</display>certify the vote totals for persons and for and against ballot propositions that were <ln numlevel="1" lineno="307" slineno="6-26"/>submitted to voters within and beyond the board's jurisdiction and transmit those <ln numlevel="1" lineno="308" slineno="6-27"/>vote totals to the lieutenant governor; and</subsection><subsection ssid="37-null-19" dnum="ii-o" numlevel="1" lineno="309" slineno="6-28" level="3"><display>(ii)</display>if applicable, certify the results of each special district election to the special <ln numlevel="1" lineno="310" slineno="6-29"/>district clerk.</subsection></subsection></subsection><subsection ssid="37-null-20" dnum="2-o" numlevel="1" lineno="311" slineno="6-30" level="1"><display>(2)</display>The election officer shall submit a report to the board of canvassers that includes the <ln numlevel="1" lineno="312" slineno="6-31"/>following information:<subsection ssid="37-null-21" dnum="a-o" numlevel="1" lineno="313" slineno="6-32" level="2"><display>(a)</display>the total number of votes cast in the board's jurisdiction;</subsection><subsection ssid="37-null-22" dnum="b-o" numlevel="1" lineno="314" slineno="6-33" level="2"><display>(b)</display>the names of each candidate whose name appeared on the ballot;</subsection><subsection ssid="37-null-23" dnum="c-o" numlevel="1" lineno="315" slineno="6-34" level="2"><display>(c)</display>the title of each ballot proposition that appeared on the ballot;</subsection><subsection ssid="37-null-24" dnum="d-o" numlevel="1" lineno="316" slineno="6-35" level="2"><display>(d)</display>each office that appeared on the ballot;</subsection><subsection ssid="37-null-25" dnum="e-o" numlevel="1" lineno="317" slineno="6-36" level="2"><display>(e)</display>from each voting precinct:<subsection ssid="37-null-26" dnum="i-o" numlevel="1" lineno="318" slineno="6-37" level="3"><display>(i)</display>the number of votes for each candidate;</subsection><subsection ssid="37-null-27" dnum="ii-o" numlevel="1" lineno="319" slineno="6-38" level="3"><display>(ii)</display>for each race conducted by instant runoff voting under Part 6, Municipal <ln numlevel="1" lineno="320" slineno="6-39"/>Alternate Voting Methods Pilot Project, the number of valid votes cast for each <ln numlevel="1" lineno="321" slineno="6-40"/>candidate for each potential ballot-counting phase and the name of the candidate <ln numlevel="1" lineno="322" slineno="6-41"/>excluded in each ballot-counting phase; and</subsection><subsection ssid="37-null-28" dnum="iii-o" numlevel="1" lineno="323" slineno="6-42" level="3"><display>(iii)</display>the number of votes for and against each ballot proposition;</subsection></subsection><subsection ssid="37-null-29" dnum="f-o" numlevel="1" lineno="324" slineno="6-43" level="2"><display>(f)</display>the total number of votes given in the board's jurisdiction to each candidate, and for <ln numlevel="1" lineno="325" slineno="6-44"/>and against each ballot proposition;</subsection><subsection ssid="37-null-30" dnum="g-o" numlevel="1" lineno="326" slineno="6-45" level="2"><display>(g)</display>standardized statistics, on a form provided by the lieutenant governor, disclosing:<subsection ssid="37-null-31" dnum="i-o" numlevel="1" lineno="327" slineno="6-46" level="3"><display>(i)</display>the number of ballots counted;</subsection><subsection ssid="37-null-32" dnum="ii-o" numlevel="1" lineno="328" slineno="6-47" level="3"><display>(ii)</display>provisional ballots; and</subsection><subsection ssid="37-null-33" dnum="iii-o" numlevel="1" lineno="329" slineno="6-48" level="3"><display>(iii)</display>the number of ballots rejected;</subsection></subsection><subsection ssid="37-null-34" dnum="h-o" numlevel="1" lineno="330" slineno="6-49" level="2"><display>(h)</display>a final ballot reconciliation report;</subsection><subsection ssid="37-null-35" dnum="i-o" numlevel="1" lineno="331" slineno="6-50" level="2"><display>(i)</display>other information required by law to be provided to the board of canvassers; and</subsection><subsection ssid="37-null-36" dnum="j-o" numlevel="1" lineno="332" slineno="6-51" level="2"><display>(j)</display>a statement certifying that the information contained in the report is accurate.</subsection></subsection><subsection ssid="37-null-37" dnum="3-o" numlevel="1" lineno="333" slineno="6-52" level="1"><display>(3)</display>The election officer and the board of canvassers shall:<subsection ssid="37-null-38" dnum="a-o" numlevel="1" lineno="334" slineno="6-53" level="2"><display>(a)</display>review the report to ensure that the report is correct; and</subsection><subsection ssid="37-null-39" dnum="b-o" numlevel="1" lineno="335" slineno="6-54" level="2"><display>(b)</display>sign the report.</subsection></subsection><subsection ssid="37-null-40" dnum="4-o" numlevel="1" lineno="336" slineno="6-55" level="1"><display>(4)</display>The election officer shall:<subsection ssid="37-null-41" dnum="a-o" numlevel="1" lineno="337" slineno="6-56" level="2"><display>(a)</display>record or file the certified report in a book kept for that purpose;</subsection><subsection ssid="37-null-42" dnum="b-o" numlevel="1" lineno="338" slineno="6-57" level="2"><display>(b)</display>prepare and transmit a certificate of nomination or election under the officer's seal to <ln numlevel="1" lineno="339" slineno="6-58"/>each nominated or elected candidate;</subsection><subsection ssid="37-null-43" dnum="c-o" numlevel="1" lineno="340" slineno="6-59" level="2"><display>(c)</display>publish a copy of the certified report in accordance with Subsection (5); and</subsection><subsection ssid="37-null-44" dnum="d-o" numlevel="1" lineno="341" slineno="6-60" level="2"><display>(d)</display>file a copy of the certified report with the lieutenant governor.</subsection></subsection><subsection ssid="37-null-45" dnum="5-o" numlevel="1" lineno="342" slineno="6-61" level="1"><display>(5)</display>Except as provided in Subsection (6), the election officer shall, no later than seven days <ln numlevel="1" lineno="343" slineno="6-62"/>after the day on which the board of canvassers declares the election results, publicize the <ln numlevel="1" lineno="344" slineno="6-63"/>certified report described in Subsection (2) for the jurisdiction, as a class A notice under <ln numlevel="1" lineno="345" slineno="6-64"/>Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least seven days.</subsection><subsection ssid="37-null-46" dnum="6-o" numlevel="1" lineno="346" slineno="6-65" level="1"><display>(6)</display>Instead of including a copy of the entire certified report, a notice required under <ln numlevel="1" lineno="347" slineno="6-66"/>Subsection (5) may contain a statement that:<subsection ssid="37-null-47" dnum="a-o" numlevel="1" lineno="348" slineno="6-67" level="2"><display>(a)</display>includes the following: "The Board of Canvassers for [indicate name of jurisdiction] <ln numlevel="1" lineno="349" slineno="6-68"/>has prepared a report of the election results for the [indicate type and date of <ln numlevel="1" lineno="350" slineno="6-69"/>election]."; and</subsection><subsection ssid="37-null-48" dnum="b-o" numlevel="1" lineno="351" slineno="6-70" level="2"><display>(b)</display>specifies the following sources where an individual may view or obtain a copy of the <ln numlevel="1" lineno="352" slineno="6-71"/>entire certified report:<subsection ssid="37-null-49" dnum="i-o" numlevel="1" lineno="353" slineno="6-72" level="3"><display>(i)</display>if the jurisdiction has a website, the jurisdiction's website;</subsection><subsection ssid="37-null-50" dnum="ii-o" numlevel="1" lineno="354" slineno="6-73" level="3"><display>(ii)</display>the physical address for the jurisdiction; and</subsection><subsection ssid="37-null-51" dnum="iii-o" numlevel="1" lineno="355" slineno="6-74" level="3"><display>(iii)</display>a mailing address and telephone number.</subsection></subsection></subsection><subsection ssid="37-null-52" dnum="7-o" numlevel="1" lineno="356" slineno="6-75" level="1"><display>(7)</display>When there has been a regular general or a statewide special election for statewide <ln numlevel="1" lineno="357" slineno="6-76"/>officers, for officers that appear on the ballot in more than one county, or for a statewide <ln numlevel="1" lineno="358" slineno="6-77"/>or two or more county ballot proposition, each board of canvassers shall:<subsection ssid="37-null-53" dnum="a-o" numlevel="1" lineno="359" slineno="6-78" level="2"><display>(a)</display>prepare a separate report detailing the number of votes for each candidate and the <ln numlevel="1" lineno="360" slineno="6-79"/>number of votes for and against each ballot proposition; and</subsection><subsection ssid="37-null-54" dnum="b-o" numlevel="1" lineno="361" slineno="6-80" level="2"><display>(b)</display>transmit the separate report by registered mail to the lieutenant governor.</subsection></subsection><subsection ssid="37-null-55" dnum="8-o" numlevel="1" lineno="362" slineno="6-81" level="1"><display>(8)</display>In each county election, municipal election, school election, special district election, and <ln numlevel="1" lineno="363" slineno="6-82"/>local special election, the election officer shall transmit the reports to the lieutenant <ln numlevel="1" lineno="364" slineno="6-83"/>governor within 14 days after the date of the election.</subsection><subsection ssid="37-null-56" dnum="9-o" numlevel="1" lineno="365" slineno="6-84" level="1"><display>(9)</display>In a regular primary election<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both"> and in a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, primary runoff election, or</amend> presidential primary <ln numlevel="1" lineno="366" slineno="6-85"/>election, the board shall transmit to the lieutenant governor:<subsection ssid="37-null-57" dnum="a-o" numlevel="1" lineno="367" slineno="6-86" level="2"><display>(a)</display>the county totals for multi-county races, to be telephoned or faxed to the lieutenant <ln numlevel="1" lineno="368" slineno="6-87"/>governor not later than the second Tuesday after the election; and</subsection><subsection ssid="37-null-58" dnum="b-o" numlevel="1" lineno="369" slineno="6-88" level="2"><display>(b)</display>a complete tabulation showing voting totals for all primary races, precinct by <ln numlevel="1" lineno="370" slineno="6-89"/>precinct, to be mailed to the lieutenant governor on or before the third Friday <ln numlevel="1" lineno="371" slineno="6-90"/>following the primary election.</subsection></subsection></section></bsec><bsec buid="19" num="20A-4-306" type="amend" src="code" uid="C20A-4-S306_2025050720250507" sort="20A04 03060020250507" numlevel="1" lineno="373" slineno="7-2" sn="7"><section number="20A-4-306" numlevel="1" lineno="374" slineno="7-3" type="amend"><secline lineno="373">Section 7, Section <bold>20A-4-306</bold> is amended to read:</secline><catline lineno="374"><bold>20A-4-306<parens/>. Statewide canvass.</bold></catline><subsection ssid="19-19-1" dnum="1-o" numlevel="1" lineno="375" slineno="7-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="19-19-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board of canvassers shall convene:<subsection ssid="19-19-3" dnum="i-o" numlevel="1" lineno="376" slineno="7-5" level="3" tab="1"><display>(i)</display>on the fourth Monday of November, at noon; or</subsection><subsection ssid="19-19-4" dnum="ii-o" numlevel="1" lineno="377" slineno="7-6" level="3" tab="1"><display>(ii)</display>at noon on the day following the receipt by the lieutenant governor of the last of <ln numlevel="1" lineno="378" slineno="7-7"/>the returns of a statewide special election.</subsection></subsection><subsection ssid="19-19-5" dnum="b-o" numlevel="1" lineno="379" slineno="7-8" level="2"><display>(b)</display>The state auditor, the state treasurer, and the attorney general are the state board of <ln numlevel="1" lineno="380" slineno="7-9"/>canvassers.</subsection><subsection ssid="19-19-6" dnum="c-o" numlevel="1" lineno="381" slineno="7-10" level="2"><display>(c)</display>Attendance of all members of the state board of canvassers is required to constitute a <ln numlevel="1" lineno="382" slineno="7-11"/>quorum for conducting the canvass.</subsection></subsection><subsection ssid="19-19-7" dnum="2-o" numlevel="1" lineno="383" slineno="7-12" level="1" space="false"><display>(2)</display><subsection ssid="19-19-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board of canvassers shall:<subsection ssid="19-19-9" dnum="i-o" numlevel="1" lineno="384" slineno="7-13" level="3" tab="1"><display>(i)</display>meet in the lieutenant governor's office; and</subsection><subsection ssid="19-19-10" dnum="ii-o" numlevel="1" lineno="385" slineno="7-14" level="3" tab="1"><display>(ii)</display>compute and determine the vote for officers and for and against any ballot <ln numlevel="1" lineno="386" slineno="7-15"/>propositions voted upon by the voters of the entire state or of two or more <ln numlevel="1" lineno="387" slineno="7-16"/>counties.</subsection></subsection><subsection ssid="19-19-11" dnum="b-o" numlevel="1" lineno="388" slineno="7-17" level="2"><display>(b)</display>The lieutenant governor, as secretary of the board shall file a report in the lieutenant <ln numlevel="1" lineno="389" slineno="7-18"/>governor's office that details:<subsection ssid="19-19-12" dnum="i-o" numlevel="1" lineno="390" slineno="7-19" level="3"><display>(i)</display>for each statewide officer and ballot proposition:<subsection ssid="19-19-13" dnum="A-o" numlevel="1" lineno="391" slineno="7-20" level="4"><display>(A)</display>the name of the statewide office or ballot proposition that appeared on the <ln numlevel="1" lineno="392" slineno="7-21"/>ballot;</subsection><subsection ssid="19-19-14" dnum="B-o" numlevel="1" lineno="393" slineno="7-22" level="4"><display>(B)</display>the candidates for each statewide office whose names appeared on the ballot, <ln numlevel="1" lineno="394" slineno="7-23"/>plus any recorded write-in candidates;</subsection><subsection ssid="19-19-15" dnum="C-o" numlevel="1" lineno="395" slineno="7-24" level="4"><display>(C)</display>the number of votes from each county cast for each candidate and for and <ln numlevel="1" lineno="396" slineno="7-25"/>against each ballot proposition;</subsection><subsection ssid="19-19-16" dnum="D-o" numlevel="1" lineno="397" slineno="7-26" level="4"><display>(D)</display>the total number of votes cast statewide for each candidate and for and against <ln numlevel="1" lineno="398" slineno="7-27"/>each ballot proposition; and</subsection><subsection ssid="19-19-17" dnum="E-o" numlevel="1" lineno="399" slineno="7-28" level="4"><display>(E)</display>the total number of votes cast statewide; and</subsection></subsection><subsection ssid="19-19-18" dnum="ii-o" numlevel="1" lineno="400" slineno="7-29" level="3"><display>(ii)</display>for each officer or ballot proposition voted on in two or more counties:<subsection ssid="19-19-19" dnum="A-o" numlevel="1" lineno="401" slineno="7-30" level="4"><display>(A)</display>the name of each of those offices and ballot propositions that appeared on the <ln numlevel="1" lineno="402" slineno="7-31"/>ballot;</subsection><subsection ssid="19-19-20" dnum="B-o" numlevel="1" lineno="403" slineno="7-32" level="4"><display>(B)</display>the candidates for those offices, plus any recorded write-in candidates;</subsection><subsection ssid="19-19-21" dnum="C-o" numlevel="1" lineno="404" slineno="7-33" level="4"><display>(C)</display>the number of votes from each county cast for each candidate and for and <ln numlevel="1" lineno="405" slineno="7-34"/>against each ballot proposition; and</subsection><subsection ssid="19-19-22" dnum="D-o" numlevel="1" lineno="406" slineno="7-35" level="4"><display>(D)</display>the total number of votes cast for each candidate and for and against each <ln numlevel="1" lineno="407" slineno="7-36"/>ballot proposition.</subsection></subsection></subsection><subsection ssid="19-19-23" dnum="c-o" numlevel="1" lineno="408" slineno="7-37" level="2"><display>(c)</display>Except as provided in Subsection (2)(d), the lieutenant governor shall:<subsection ssid="19-19-24" dnum="i-o" numlevel="1" lineno="409" slineno="7-38" level="3"><display>(i)</display>prepare certificates of election for:<subsection ssid="19-19-25" dnum="A-o" numlevel="1" lineno="410" slineno="7-39" level="4"><display>(A)</display>each successful candidate; and</subsection><subsection ssid="19-19-26" dnum="B-o" numlevel="1" lineno="411" slineno="7-40" level="4"><display>(B)</display>each of the presidential electors of the candidate for president who received a <ln numlevel="1" lineno="412" slineno="7-41"/>majority of the votes;</subsection></subsection><subsection ssid="19-19-27" dnum="ii-o" numlevel="1" lineno="413" slineno="7-42" level="3"><display>(ii)</display>authenticate each certificate with the lieutenant governor's seal; and</subsection><subsection ssid="19-19-28" dnum="iii-o" numlevel="1" lineno="414" slineno="7-43" level="3"><display>(iii)</display>deliver a certificate of election to:<subsection ssid="19-19-29" dnum="A-o" numlevel="1" lineno="415" slineno="7-44" level="4"><display>(A)</display>each candidate who had the highest number of votes for each office; and</subsection><subsection ssid="19-19-30" dnum="B-o" numlevel="1" lineno="416" slineno="7-45" level="4"><display>(B)</display>each of the presidential electors of the candidate for president who received a <ln numlevel="1" lineno="417" slineno="7-46"/>majority of the votes.</subsection></subsection></subsection><subsection ssid="19-19-31" dnum="d-o" numlevel="1" lineno="418" slineno="7-47" level="2"><display>(d)</display>The lieutenant governor shall, in the report described in Subsection (2)(b), declare a <ln numlevel="1" lineno="419" slineno="7-48"/>tie vote if:<subsection ssid="19-19-32" dnum="i-o" numlevel="1" lineno="420" slineno="7-49" level="3"><display>(i)</display>two or more officers receive an equal and the highest number of votes for an <ln numlevel="1" lineno="421" slineno="7-50"/>office; or</subsection><subsection ssid="19-19-33" dnum="ii-o" numlevel="1" lineno="422" slineno="7-51" level="3"><display>(ii)</display>in a race for an at-large office:<subsection ssid="19-19-34" dnum="A-o" numlevel="1" lineno="423" slineno="7-52" level="4"><display>(A)</display>two or more candidates receive an equal number of votes; and</subsection><subsection ssid="19-19-35" dnum="B-o" numlevel="1" lineno="424" slineno="7-53" level="4"><display>(B)</display>a recount is necessary to determine which candidates are elected to the at-large <ln numlevel="1" lineno="425" slineno="7-54"/>office.</subsection></subsection></subsection></subsection><subsection ssid="19-19-36" dnum="3-o" numlevel="1" lineno="426" slineno="7-55" level="1"><display>(3)</display>If the lieutenant governor has not received election returns from all counties on the fifth <ln numlevel="1" lineno="427" slineno="7-56"/>day before the day designated for the meeting of the state board of canvassers, the <ln numlevel="1" lineno="428" slineno="7-57"/>lieutenant governor shall:<subsection ssid="19-19-37" dnum="a-o" numlevel="1" lineno="429" slineno="7-58" level="2"><display>(a)</display>send a messenger to the clerk of the board of county canvassers of the delinquent <ln numlevel="1" lineno="430" slineno="7-59"/>county;</subsection><subsection ssid="19-19-38" dnum="b-o" numlevel="1" lineno="431" slineno="7-60" level="2"><display>(b)</display>instruct the messenger to demand a certified copy of the board of canvasser's report <ln numlevel="1" lineno="432" slineno="7-61"/>required by Section <xref depth="3" refnumber="20A-4-304">20A-4-304</xref> from the clerk; and</subsection><subsection ssid="19-19-39" dnum="c-o" numlevel="1" lineno="433" slineno="7-62" level="2"><display>(c)</display>pay the messenger the per diem provided by law as compensation.</subsection></subsection><subsection ssid="19-19-40" dnum="4-o" numlevel="1" lineno="434" slineno="7-63" level="1"><display>(4)</display>The state board of canvassers may not withhold the declaration of the result or any <ln numlevel="1" lineno="435" slineno="7-64"/>certificate of election because of any defect or informality in the returns of any election <ln numlevel="1" lineno="436" slineno="7-65"/>if the board can determine from the returns, with reasonable certainty, what office is <ln numlevel="1" lineno="437" slineno="7-66"/>intended and who is elected to it.</subsection><subsection ssid="19-19-41" dnum="5-o" numlevel="1" lineno="438" slineno="7-67" level="1" space="false"><display>(5)</display><subsection ssid="19-19-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At noon <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">on the fourth Monday after the regular primary election</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">no later than 14 <ln numlevel="1" lineno="439" slineno="7-68"/>calendar days after the day of the regular primary election or a primary runoff election</amend>, <ln numlevel="1" lineno="440" slineno="7-69"/>the lieutenant governor shall:<subsection ssid="19-19-43" dnum="i-o" numlevel="1" lineno="441" slineno="7-70" level="3" tab="1"><display>(i)</display>canvass the returns for all multicounty candidates required to file with the office <ln numlevel="1" lineno="442" slineno="7-71"/>of the lieutenant governor; and</subsection><subsection ssid="19-19-44" dnum="ii-o" numlevel="1" lineno="443" slineno="7-72" level="3" tab="1"><display>(ii)</display>publish and file the results of the canvass in the lieutenant governor's office.</subsection></subsection><subsection ssid="19-19-45" dnum="b-o" numlevel="1" lineno="444" slineno="7-73" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">Not later than the August 1 after the primary election, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">The</amend> lieutenant governor <ln numlevel="1" lineno="445" slineno="7-74"/>shall certify the results of the primary canvass to the county clerks<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="19-52" dnum="_-o:i-i" numlevel="1" lineno="446" slineno="7-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">no later than the August 1 after the primary election; or</amend></subsection><subsection ssid="19-53" dnum="_-o:ii-i" numlevel="1" lineno="447" slineno="7-76" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">if there is a primary runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, no later than the <ln numlevel="1" lineno="448" slineno="7-77"/>August 31 after the runoff election.</amend></subsection></subsection></subsection><subsection ssid="19-19-46" dnum="6-o" numlevel="1" lineno="449" slineno="7-78" level="1" space="false"><display>(6)</display><subsection ssid="19-19-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>At noon on the fourth Tuesday in March of a year in which a presidential election <ln numlevel="1" lineno="450" slineno="7-79"/>will be held, the lieutenant governor shall:<subsection ssid="19-19-48" dnum="i-o" numlevel="1" lineno="451" slineno="7-80" level="3" tab="1"><display>(i)</display>canvass the returns of the presidential primary election; and</subsection><subsection ssid="19-19-49" dnum="ii-o" numlevel="1" lineno="452" slineno="7-81" level="3" tab="1"><display>(ii)</display>publish and file the results of the canvass in the lieutenant governor's office.</subsection></subsection><subsection ssid="19-19-50" dnum="b-o" numlevel="1" lineno="453" slineno="7-82" level="2"><display>(b)</display>The lieutenant governor shall certify the results of the presidential primary election <ln numlevel="1" lineno="454" slineno="7-83"/>canvass to each registered political party that participated in the primary not later <ln numlevel="1" lineno="455" slineno="7-84"/>than the April 15 after the primary election.</subsection></subsection></section></bsec><bsec buid="15" num="20A-6-203" type="amend" src="code" uid="C20A-6-S203_2025050720250507" sort="20A06 02030020250507" numlevel="1" lineno="456" slineno="8-1" sn="8"><section number="20A-6-203" numlevel="1" lineno="457" slineno="8-2" type="amend"><secline lineno="456">Section 8, Section <bold>20A-6-203</bold> is amended to read:</secline><catline lineno="457"><bold>20A-6-203<parens/>. Ballots for regular primary elections.</bold></catline><subsection ssid="15-15-1" dnum="1-o" numlevel="1" lineno="458" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>The lieutenant governor, together with county clerks, suppliers of election materials, <ln numlevel="1" lineno="459" slineno="8-4"/>and representatives of registered political parties, shall:<subsection ssid="15-15-2" dnum="a-o" numlevel="1" lineno="460" slineno="8-5" level="2"><display>(a)</display>develop ballots to be used in Utah's regular primary election;</subsection><subsection ssid="15-15-3" dnum="b-o" numlevel="1" lineno="461" slineno="8-6" level="2"><display>(b)</display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">except to the extent otherwise provided in Subsection <xref depth="4" refnumber="20A-9-409.1(6)">20A-9-409.1(6)</xref>, </amend>ensure that <ln numlevel="1" lineno="462" slineno="8-7"/>the ballots comply generally, where applicable, with the requirements of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="2" refnumber="20A-6-1" start="0">Title 20A, <ln numlevel="1" lineno="463" slineno="8-8"/>Chapter 6, Part 1, General Requirements for All Ballots</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Part 1, General <ln numlevel="1" lineno="464" slineno="8-9"/>Requirements for All Ballots</amend>, and this section; and</subsection><subsection ssid="15-15-4" dnum="c-o" numlevel="1" lineno="465" slineno="8-10" level="2"><display>(c)</display>provide voting booths, election records and supplies, ballot boxes, and as applicable, <ln numlevel="1" lineno="466" slineno="8-11"/>voting devices, for each voting precinct as required by Section <xref depth="3" refnumber="20A-5-403" start="0">20A-5-403</xref>.</subsection></subsection><subsection ssid="15-15-5" dnum="2-o" numlevel="1" lineno="467" slineno="8-12" level="1" space="false"><display>(2)</display><subsection ssid="15-15-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the requirements of Subsections <xref depth="4" refnumber="20A-6-203(1)(b)" start="0">(1)(b)</xref> and <xref depth="4" refnumber="20A-6-203(1)(c)" start="0">(c)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="2" refnumber="20A-6-1" start="0">Title 20A, <ln numlevel="1" lineno="468" slineno="8-13"/>Chapter 6, Part 1, General Requirements for All Ballots</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Part 1, General <ln numlevel="1" lineno="469" slineno="8-14"/>Requirements for All Ballots</amend>, and Sections <xref depth="3" refnumber="20A-5-403" start="0">20A-5-403</xref>, <xref depth="3" refnumber="20A-6-401" start="0">20A-6-401</xref>, and <xref depth="3" refnumber="20A-6-401.1" start="0">20A-6-401.1</xref>, <ln numlevel="1" lineno="470" slineno="8-15"/>the lieutenant governor, together with county clerks, suppliers of election materials, <ln numlevel="1" lineno="471" slineno="8-16"/>and representatives of registered political parties shall ensure that the ballots, voting <ln numlevel="1" lineno="472" slineno="8-17"/>booths, election records and supplies, and ballot boxes:<subsection ssid="15-15-7" dnum="i-o" numlevel="1" lineno="473" slineno="8-18" level="3" tab="1"><display>(i)</display>facilitate the distribution, voting, and tallying of ballots in a primary where not all <ln numlevel="1" lineno="474" slineno="8-19"/>voters are authorized to vote for a party's candidate;</subsection><subsection ssid="15-15-8" dnum="ii-o" numlevel="1" lineno="475" slineno="8-20" level="3" tab="1"><display>(ii)</display>simplify the task of poll workers, particularly in determining a voter's party <ln numlevel="1" lineno="476" slineno="8-21"/>affiliation;</subsection><subsection ssid="15-15-9" dnum="iii-o" numlevel="1" lineno="477" slineno="8-22" level="3" tab="1"><display>(iii)</display>minimize the possibility of spoiled ballots due to voter confusion; and</subsection><subsection ssid="15-15-10" dnum="iv-o" numlevel="1" lineno="478" slineno="8-23" level="3" tab="1"><display>(iv)</display>protect against fraud.</subsection></subsection><subsection ssid="15-15-11" dnum="b-o" numlevel="1" lineno="479" slineno="8-24" level="2"><display>(b)</display>To accomplish the requirements of this Subsection <xref depth="4" refnumber="20A-6-203(2)" start="0">(2)</xref>, the lieutenant governor, <ln numlevel="1" lineno="480" slineno="8-25"/>county clerks, suppliers of election materials, and representatives of registered <ln numlevel="1" lineno="481" slineno="8-26"/>political parties shall:<subsection ssid="15-15-12" dnum="i-o" numlevel="1" lineno="482" slineno="8-27" level="3"><display>(i)</display>mark ballots as being for a particular registered political party; and</subsection><subsection ssid="15-15-13" dnum="ii-o" numlevel="1" lineno="483" slineno="8-28" level="3"><display>(ii)</display>instruct individuals counting the ballots to count only those votes for candidates <ln numlevel="1" lineno="484" slineno="8-29"/>from the registered political party whose ballot the voter received.</subsection></subsection></subsection></section></bsec><bsec buid="7" num="20A-9-403" type="amend" src="code" uid="C20A-9-S403_2025050720250507" sort="20A09 04030020250507" numlevel="1" lineno="485" slineno="9-1" sn="9"><section number="20A-9-403" numlevel="1" lineno="486" slineno="9-2" type="amend"><secline lineno="485">Section 9, Section <bold>20A-9-403</bold> is amended to read:</secline><catline lineno="486"><bold>20A-9-403<parens/>. Regular primary elections  -- Candidate nomination process for a <ln numlevel="1" lineno="487" slineno="9-3"/>registered political party that is not a qualified political party -- Determining winning <ln numlevel="1" lineno="488" slineno="9-4"/>nominee for any registered political party, including a qualified political party -- Election <ln numlevel="1" lineno="489" slineno="9-5"/>expenses.</bold></catline><subsection ssid="7-7-1" dnum="1-o" numlevel="1" lineno="490" slineno="9-6" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="7-7-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Candidates for elective office that are to be filled at the next regular general <ln numlevel="1" lineno="491" slineno="9-7"/>election shall be nominated in a regular primary election by direct vote of the people <ln numlevel="1" lineno="492" slineno="9-8"/>in the manner <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">prescribed</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">described</amend> in this section<amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both"> and, as applicable, Section <xref depth="3" refnumber="20A-9-409.1"><ln numlevel="1" lineno="493" slineno="9-9"/>20A-9-409.1</xref></amend>.  The regular primary election is held on the date specified in Section <xref depth="3" refnumber="20A-1-201.5"><ln numlevel="1" lineno="494" slineno="9-10"/>20A-1-201.5</xref>.  Nothing in this section shall affect a candidate's ability to qualify for a <ln numlevel="1" lineno="495" slineno="9-11"/>regular general election's ballot as an unaffiliated candidate under Section <xref depth="3" refnumber="20A-9-501">20A-9-501</xref> <ln numlevel="1" lineno="496" slineno="9-12"/>or to participate in a regular general election as a write-in candidate under Section <xref depth="3" refnumber="20A-9-601"><ln numlevel="1" lineno="497" slineno="9-13"/>20A-9-601</xref>.</subsection><subsection ssid="7-7-3" dnum="b-o" numlevel="1" lineno="498" slineno="9-14" level="2"><display>(b)</display>Each registered political party that chooses to have the names of the registered <ln numlevel="1" lineno="499" slineno="9-15"/>political party's candidates for elective office featured with party affiliation on the <ln numlevel="1" lineno="500" slineno="9-16"/>ballot at a regular general election shall comply with the requirements of this section <ln numlevel="1" lineno="501" slineno="9-17"/>and shall nominate the registered political party's candidates for elective office in the <ln numlevel="1" lineno="502" slineno="9-18"/>manner described in this section.</subsection><subsection ssid="7-7-4" dnum="c-o" numlevel="1" lineno="503" slineno="9-19" level="2"><display>(c)</display>A filing officer may not permit an official ballot at a regular general election to be <ln numlevel="1" lineno="504" slineno="9-20"/>produced or used if the ballot denotes affiliation between a registered political party <ln numlevel="1" lineno="505" slineno="9-21"/>or any other political group and a candidate for elective office who is not nominated <ln numlevel="1" lineno="506" slineno="9-22"/>in the manner prescribed in this section or in Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(4).</subsection><subsection ssid="7-7-5" dnum="d-o" numlevel="1" lineno="507" slineno="9-23" level="2"><display>(d)</display>Unless noted otherwise, the dates in this section refer to those that occur in each <ln numlevel="1" lineno="508" slineno="9-24"/>even-numbered year in which a regular general election will be held.</subsection></subsection><subsection ssid="7-7-6" dnum="2-o" numlevel="1" lineno="509" slineno="9-25" level="1" space="false"><display>(2)</display><subsection ssid="7-7-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each registered political party, in a statement filed with the lieutenant governor, <ln numlevel="1" lineno="510" slineno="9-26"/>shall:<subsection ssid="7-7-8" dnum="i-o" numlevel="1" lineno="511" slineno="9-27" level="3" tab="1"><display>(i)</display>either declare the registered political party's intent to participate in the next regular <ln numlevel="1" lineno="512" slineno="9-28"/>primary election or declare that the registered political party chooses not to have <ln numlevel="1" lineno="513" slineno="9-29"/>the names of the registered political party's candidates for elective office featured <ln numlevel="1" lineno="514" slineno="9-30"/>on the ballot at the next regular general election; and</subsection><subsection ssid="7-7-9" dnum="ii-o" numlevel="1" lineno="515" slineno="9-31" level="3" tab="1"><display>(ii)</display>if the registered political party participates in the upcoming regular primary <ln numlevel="1" lineno="516" slineno="9-32"/>election, identify one or more registered political parties whose members may <ln numlevel="1" lineno="517" slineno="9-33"/>vote for the registered political party's candidates and whether individuals <ln numlevel="1" lineno="518" slineno="9-34"/>identified as unaffiliated with a political party may vote for the registered political <ln numlevel="1" lineno="519" slineno="9-35"/>party's candidates.</subsection></subsection><subsection ssid="7-7-10" dnum="b-o" numlevel="1" lineno="520" slineno="9-36" level="2" space="false"><display>(b)</display><subsection ssid="7-7-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A registered political party that is a continuing political party shall file the <ln numlevel="1" lineno="521" slineno="9-37"/>statement described in Subsection (2)(a) with the lieutenant governor no later than <ln numlevel="1" lineno="522" slineno="9-38"/>5 p.m. on November 30 of each odd-numbered year.</subsection><subsection ssid="7-7-12" dnum="ii-o" numlevel="1" lineno="523" slineno="9-39" level="3"><display>(ii)</display>An organization that is seeking to become a registered political party under <ln numlevel="1" lineno="524" slineno="9-40"/>Section <xref depth="3" refnumber="20A-8-103">20A-8-103</xref> shall file the statement described in Subsection (2)(a) at the <ln numlevel="1" lineno="525" slineno="9-41"/>time that the registered political party files the petition described in Section <xref depth="3" refnumber="20A-8-103"><ln numlevel="1" lineno="526" slineno="9-42"/>20A-8-103</xref>.</subsection></subsection></subsection><subsection ssid="7-7-13" dnum="3-o" numlevel="1" lineno="527" slineno="9-43" level="1" space="false"><display>(3)</display><subsection ssid="7-7-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (3)(e), an individual who submits a declaration <ln numlevel="1" lineno="528" slineno="9-44"/>of candidacy under Section <xref depth="3" refnumber="20A-9-202">20A-9-202</xref> shall appear as a candidate for elective office <ln numlevel="1" lineno="529" slineno="9-45"/>on the regular primary ballot of the registered political party listed on the declaration <ln numlevel="1" lineno="530" slineno="9-46"/>of candidacy only if the individual is certified by the appropriate filing officer as <ln numlevel="1" lineno="531" slineno="9-47"/>having submitted a nomination petition that was:<subsection ssid="7-7-15" dnum="i-o" numlevel="1" lineno="532" slineno="9-48" level="3" tab="1"><display>(i)</display>circulated and completed in accordance with Section <xref depth="3" refnumber="20A-9-405">20A-9-405</xref>; and</subsection><subsection ssid="7-7-16" dnum="ii-o" numlevel="1" lineno="533" slineno="9-49" level="3" tab="1"><display>(ii)</display>signed by at least 2% of the registered political party's members who reside in the <ln numlevel="1" lineno="534" slineno="9-50"/>political division of the office that the individual seeks.</subsection></subsection><subsection ssid="7-7-17" dnum="b-o" numlevel="1" lineno="535" slineno="9-51" level="2" space="false"><display>(b)</display><subsection ssid="7-7-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A candidate for elective office shall submit signatures for a nomination petition <ln numlevel="1" lineno="536" slineno="9-52"/>to the appropriate filing officer for verification and certification no later than 5 <ln numlevel="1" lineno="537" slineno="9-53"/>p.m. on the final day in March.</subsection><subsection ssid="7-7-19" dnum="ii-o" numlevel="1" lineno="538" slineno="9-54" level="3"><display>(ii)</display>A candidate may supplement the candidate's submissions at any time on or before <ln numlevel="1" lineno="539" slineno="9-55"/>the filing deadline.</subsection></subsection><subsection ssid="7-7-20" dnum="c-o" numlevel="1" lineno="540" slineno="9-56" level="2" space="false"><display>(c)</display><subsection ssid="7-7-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The lieutenant governor shall determine for each elective office the total <ln numlevel="1" lineno="541" slineno="9-57"/>number of signatures that must be submitted under Subsection (3)(a)(ii) or <xref depth="3" refnumber="20A-9-408"><ln numlevel="1" lineno="542" slineno="9-58"/>20A-9-408</xref>(8) by counting the aggregate number of individuals residing in each <ln numlevel="1" lineno="543" slineno="9-59"/>elective office's political division who have designated a particular registered <ln numlevel="1" lineno="544" slineno="9-60"/>political party on the individuals' voter registration forms on or before November <ln numlevel="1" lineno="545" slineno="9-61"/>15 of each odd-numbered year.</subsection><subsection ssid="7-7-22" dnum="ii-o" numlevel="1" lineno="546" slineno="9-62" level="3"><display>(ii)</display>The lieutenant governor shall publish the determination for each elective office <ln numlevel="1" lineno="547" slineno="9-63"/>no later than November 30 of each odd-numbered year.</subsection></subsection><subsection ssid="7-7-23" dnum="d-o" numlevel="1" lineno="548" slineno="9-64" level="2"><display>(d)</display>The filing officer shall:<subsection ssid="7-7-24" dnum="i-o" numlevel="1" lineno="549" slineno="9-65" level="3"><display>(i)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref>, verify signatures on <ln numlevel="1" lineno="550" slineno="9-66"/>nomination petitions in a transparent and orderly manner, no later than 14 days <ln numlevel="1" lineno="551" slineno="9-67"/>after the day on which a candidate submits the signatures to the filing officer;</subsection><subsection ssid="7-7-25" dnum="ii-o" numlevel="1" lineno="552" slineno="9-68" level="3"><display>(ii)</display>for all qualifying candidates for elective office who submit nomination petitions <ln numlevel="1" lineno="553" slineno="9-69"/>to the filing officer, issue certifications referenced in Subsection (3)(a) no later <ln numlevel="1" lineno="554" slineno="9-70"/>than the deadline described in Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(1)(b);</subsection><subsection ssid="7-7-26" dnum="iii-o" numlevel="1" lineno="555" slineno="9-71" level="3"><display>(iii)</display>consider active and inactive voters eligible to sign nomination petitions;</subsection><subsection ssid="7-7-27" dnum="iv-o" numlevel="1" lineno="556" slineno="9-72" level="3"><display>(iv)</display>consider an individual who signs a nomination petition a member of a registered <ln numlevel="1" lineno="557" slineno="9-73"/>political party for purposes of Subsection (3)(a)(ii) if the individual has designated <ln numlevel="1" lineno="558" slineno="9-74"/>that registered political party as the individual's party membership on the <ln numlevel="1" lineno="559" slineno="9-75"/>individual's voter registration form; and</subsection><subsection ssid="7-7-28" dnum="v-o" numlevel="1" lineno="560" slineno="9-76" level="3"><display>(v)</display>except as otherwise provided in Section <xref depth="3" refnumber="20A-21-201">20A-21-201</xref> and with the assistance of <ln numlevel="1" lineno="561" slineno="9-77"/>the county clerk as applicable, use the procedures described in Section <xref depth="3" refnumber="20A-1-1002">20A-1-1002</xref> <ln numlevel="1" lineno="562" slineno="9-78"/>to verify submitted nomination petition signatures, or use statistical sampling <ln numlevel="1" lineno="563" slineno="9-79"/>procedures to verify submitted nomination petition signatures in accordance with <ln numlevel="1" lineno="564" slineno="9-80"/>rules made under Subsection (3)(f).</subsection></subsection><subsection ssid="7-7-29" dnum="e-o" numlevel="1" lineno="565" slineno="9-81" level="2"><display>(e)</display>Notwithstanding any other provision in this Subsection (3), a candidate for lieutenant <ln numlevel="1" lineno="566" slineno="9-82"/>governor may appear on the regular primary ballot of a registered political party <ln numlevel="1" lineno="567" slineno="9-83"/>without submitting nomination petitions if the candidate files a declaration of <ln numlevel="1" lineno="568" slineno="9-84"/>candidacy and complies with Subsection <xref depth="3" refnumber="20A-9-202">20A-9-202</xref>(3).</subsection><subsection ssid="7-7-30" dnum="f-o" numlevel="1" lineno="569" slineno="9-85" level="2"><display>(f)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="570" slineno="9-86"/>director of elections, within the Office of the Lieutenant Governor, may make rules <ln numlevel="1" lineno="571" slineno="9-87"/>that:<subsection ssid="7-7-31" dnum="i-o" numlevel="1" lineno="572" slineno="9-88" level="3"><display>(i)</display>provide for the use of statistical sampling procedures that:<subsection ssid="7-7-32" dnum="A-o" numlevel="1" lineno="573" slineno="9-89" level="4"><display>(A)</display>filing officers are required to use to verify signatures under Subsection (3)(d); <ln numlevel="1" lineno="574" slineno="9-90"/>and</subsection><subsection ssid="7-7-33" dnum="B-o" numlevel="1" lineno="575" slineno="9-91" level="4"><display>(B)</display>reflect a bona fide effort to determine the validity of a candidate's entire <ln numlevel="1" lineno="576" slineno="9-92"/>submission, using widely recognized statistical sampling techniques; and</subsection></subsection><subsection ssid="7-7-34" dnum="ii-o" numlevel="1" lineno="577" slineno="9-93" level="3"><display>(ii)</display>provide for the transparent, orderly, and timely submission, verification, and <ln numlevel="1" lineno="578" slineno="9-94"/>certification of nomination petition signatures.</subsection></subsection><subsection ssid="7-7-35" dnum="g-o" numlevel="1" lineno="579" slineno="9-95" level="2"><display>(g)</display>The county clerk shall:<subsection ssid="7-7-36" dnum="i-o" numlevel="1" lineno="580" slineno="9-96" level="3"><display>(i)</display>review the declarations of candidacy filed by candidates for local boards of <ln numlevel="1" lineno="581" slineno="9-97"/>education to determine if more than two candidates have filed for the same seat;</subsection><subsection ssid="7-7-37" dnum="ii-o" numlevel="1" lineno="582" slineno="9-98" level="3"><display>(ii)</display>place the names of all candidates who have filed a declaration of candidacy for a <ln numlevel="1" lineno="583" slineno="9-99"/>local board of education seat on the nonpartisan section of the ballot if more than <ln numlevel="1" lineno="584" slineno="9-100"/>two candidates have filed for the same seat; and</subsection><subsection ssid="7-7-38" dnum="iii-o" numlevel="1" lineno="585" slineno="9-101" level="3"><display>(iii)</display>determine the order of the local board of education candidates' names on the <ln numlevel="1" lineno="586" slineno="9-102"/>ballot in accordance with Section <xref depth="3" refnumber="20A-6-305">20A-6-305</xref>.</subsection></subsection></subsection><subsection ssid="7-7-39" dnum="4-o" numlevel="1" lineno="587" slineno="9-103" level="1" space="false"><display>(4)</display><subsection ssid="7-7-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Before the deadline described in Subsection <xref depth="3" refnumber="20A-9-409">20A-9-409</xref>(4)(c), the lieutenant <ln numlevel="1" lineno="588" slineno="9-104"/>governor shall provide to the county clerks:<subsection ssid="7-7-41" dnum="i-o" numlevel="1" lineno="589" slineno="9-105" level="3" tab="1"><display>(i)</display>a list of the names of all candidates for federal, constitutional, multi-county, single <ln numlevel="1" lineno="590" slineno="9-106"/>county, and county offices who have received certifications under Subsection (3), <ln numlevel="1" lineno="591" slineno="9-107"/>along with instructions on how those names shall appear on the primary election <ln numlevel="1" lineno="592" slineno="9-108"/>ballot in accordance with Section <xref depth="3" refnumber="20A-6-305">20A-6-305</xref>; and</subsection><subsection ssid="7-7-42" dnum="ii-o" numlevel="1" lineno="593" slineno="9-109" level="3" tab="1"><display>(ii)</display>a list of unopposed candidates for elective office who have been nominated by a <ln numlevel="1" lineno="594" slineno="9-110"/>registered political party under Subsection (5)(c) and instruct the county clerks to <ln numlevel="1" lineno="595" slineno="9-111"/>exclude the unopposed candidates from the primary election ballot.</subsection></subsection><subsection ssid="7-7-43" dnum="b-o" numlevel="1" lineno="596" slineno="9-112" level="2"><display>(b)</display>A candidate for lieutenant governor and a candidate for governor campaigning as <ln numlevel="1" lineno="597" slineno="9-113"/>joint-ticket running mates shall appear jointly on the primary election ballot.</subsection><subsection ssid="7-7-44" dnum="c-o" numlevel="1" lineno="598" slineno="9-114" level="2" format="full"><display>(c)</display>After the county clerk receives the certified list from the lieutenant governor under <ln numlevel="1" lineno="599" slineno="9-115"/>Subsection (4)(a), the county clerk shall post or publish a primary election notice in <ln numlevel="1" lineno="600" slineno="9-116"/>substantially the following form:<eol numlevel="1" lineno="601" slineno="9-117"/><para/>"Notice is given that a primary election will be held Tuesday, June ____, <ln numlevel="1" lineno="602" slineno="9-118"/>________(year), to nominate party candidates for the parties and candidates for nonpartisan <ln numlevel="1" lineno="603" slineno="9-119"/>local school board positions listed on the primary ballot.  The polling place for voting precinct <ln numlevel="1" lineno="604" slineno="9-120"/>____ is ____.  The polls will open at 7 a.m. and continue open until 8 p.m. of the same day.  <ln numlevel="1" lineno="605" slineno="9-121"/>Attest: county clerk."</subsection></subsection><subsection ssid="7-7-45" dnum="5-o" numlevel="1" lineno="606" slineno="9-122" level="1" space="false"><display>(5)</display><subsection ssid="7-7-46" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A candidate who, at the regular primary election, receives the highest number of <ln numlevel="1" lineno="607" slineno="9-123"/>votes cast for the office sought by the candidate is:<subsection ssid="7-7-47" dnum="i-o" numlevel="1" lineno="608" slineno="9-124" level="3" tab="1"><display>(i)</display><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">except as otherwise provided in Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, </amend>nominated for that office by <ln numlevel="1" lineno="609" slineno="9-125"/>the candidate's registered political party; or</subsection><subsection ssid="7-7-48" dnum="ii-o" numlevel="1" lineno="610" slineno="9-126" level="3" tab="1"><display>(ii)</display>for a nonpartisan local school board position, nominated for that office.</subsection></subsection><subsection ssid="7-7-49" dnum="b-o" numlevel="1" lineno="611" slineno="9-127" level="2"><display>(b)</display>If two or more candidates are to be elected to the office at the regular general <ln numlevel="1" lineno="612" slineno="9-128"/>election, those party candidates equal in number to positions to be filled who receive <ln numlevel="1" lineno="613" slineno="9-129"/>the highest number of votes at the regular primary election are the nominees of the <ln numlevel="1" lineno="614" slineno="9-130"/>candidates' party for those positions.</subsection><subsection ssid="7-7-50" dnum="c-o" numlevel="1" lineno="615" slineno="9-131" level="2" space="false"><display>(c)</display><subsection ssid="7-7-51" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection (5)(c), a candidate is "unopposed" if:<subsection ssid="7-7-52" dnum="A-o" numlevel="1" lineno="616" slineno="9-132" level="4" tab="1"><display>(A)</display>no individual other than the candidate receives a certification under <ln numlevel="1" lineno="617" slineno="9-133"/>Subsection (3) for the regular primary election ballot of the candidate's <ln numlevel="1" lineno="618" slineno="9-134"/>registered political party for a particular elective office; or</subsection><subsection ssid="7-7-53" dnum="B-o" numlevel="1" lineno="619" slineno="9-135" level="4" tab="1"><display>(B)</display>for an office where more than one individual is to be elected or nominated, the <ln numlevel="1" lineno="620" slineno="9-136"/>number of candidates who receive certification under Subsection (3) for the <ln numlevel="1" lineno="621" slineno="9-137"/>regular primary election of the candidate's registered political party does not <ln numlevel="1" lineno="622" slineno="9-138"/>exceed the total number of candidates to be elected or nominated for that office.</subsection></subsection><subsection ssid="7-7-54" dnum="ii-o" numlevel="1" lineno="623" slineno="9-139" level="3"><display>(ii)</display>A candidate who is unopposed for an elective office in the regular primary <ln numlevel="1" lineno="624" slineno="9-140"/>election of a registered political party is nominated by the party for that office <ln numlevel="1" lineno="625" slineno="9-141"/>without appearing on the primary election ballot.</subsection></subsection></subsection><subsection ssid="7-7-55" dnum="6-o" numlevel="1" lineno="626" slineno="9-142" level="1"><display>(6)</display>The expense of providing all ballots, blanks, or other supplies to be used at any primary <ln numlevel="1" lineno="627" slineno="9-143"/>election provided for by this section, and all expenses necessarily incurred in the <ln numlevel="1" lineno="628" slineno="9-144"/>preparation for or the conduct of that primary election shall be paid out of the treasury of <ln numlevel="1" lineno="629" slineno="9-145"/>the county or state, in the same manner as for the regular general elections.</subsection><subsection ssid="7-7-56" dnum="7-o" numlevel="1" lineno="630" slineno="9-146" level="1"><display>(7)</display>An individual may not file a declaration of candidacy for a registered political party of <ln numlevel="1" lineno="631" slineno="9-147"/>which the individual is not a member, except to the extent that the registered political <ln numlevel="1" lineno="632" slineno="9-148"/>party permits otherwise under the registered political party's bylaws.</subsection></section></bsec><bsec buid="4" num="20A-9-409.1" type="enact" src="code" uid="C20A-9-S409.1_2023050320230503" sort="20A09 04090120230503" numlevel="1" lineno="633" slineno="10-1" sn="10"><section number="20A-9-409.1" numlevel="1" lineno="634" slineno="10-2" type="enact"><secline lineno="633">Section 10, Section <bold>20A-9-409.1</bold> is enacted to read:</secline><catline lineno="634"><bold>20A-9-409.1<parens/>. Determining winner of certain primary election races where a <ln numlevel="1" lineno="635" slineno="10-3"/>candidate does not receive a majority of the votes cast -- Runoff primary election for <ln numlevel="1" lineno="636" slineno="10-4"/>certain races -- Election requirements and notice.</bold></catline><subsection ssid="4-4-102" dnum="_-o:1-i" numlevel="1" lineno="637" slineno="10-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1294" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="127" style="1" owner="jchristopherson" level="1" amendtag="end">In a regular primary election race for a qualified political party, the election officer shall <ln numlevel="1" lineno="638" slineno="10-6"/>determine the winning nominee in accordance with Subsection (2) if:</amend><subsection ssid="4-4-103" dnum="_-o:a-i" numlevel="1" lineno="639" slineno="10-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1295" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="128" style="1" owner="jchristopherson" level="1" amendtag="end">the race is to nominate a qualified political party candidate for United States senator, <ln numlevel="1" lineno="640" slineno="10-8"/>United States representative, governor, attorney general, state treasurer, state auditor, <ln numlevel="1" lineno="641" slineno="10-9"/>state senator, or state representative; and</amend></subsection><subsection ssid="4-4-104" dnum="_-o:b-i" numlevel="1" lineno="642" slineno="10-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1296" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">the candidate who receives the most votes in the initial primary election race:</amend><subsection ssid="4-169" dnum="_-o:i-i" numlevel="1" lineno="643" slineno="10-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1297" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="310" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="end">does not receive more than 50% of the votes in the race; and</amend></subsection><subsection ssid="4-170" dnum="_-o:ii-i" numlevel="1" lineno="644" slineno="10-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1298" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="213" style="1" owner="jchristopherson" level="1" amendtag="end">does not receive at least 10% more of the total votes cast in the race than the <ln numlevel="1" lineno="645" slineno="10-13"/>candidate who received the second highest number of votes.</amend></subsection></subsection></subsection><subsection ssid="4-4-105" dnum="_-o:2-i" numlevel="1" lineno="646" slineno="10-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1299" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">To determine the winning nominee for a race described in Subsection (1), the election <ln numlevel="1" lineno="647" slineno="10-15"/>officer shall declare as the nominee for that race the candidate who wins the runoff <ln numlevel="1" lineno="648" slineno="10-16"/>election, described in Subsection (4), between the two candidates who received the <ln numlevel="1" lineno="649" slineno="10-17"/>highest number of votes in the initial primary race.</amend></subsection><subsection ssid="4-4-106" dnum="_-o:3-i" numlevel="1" lineno="650" slineno="10-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1300" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">If a tie in the number of votes received in the initial primary election race makes it <ln numlevel="1" lineno="651" slineno="10-19"/>impossible to determine, under Subsection (2), the two candidates who received the <ln numlevel="1" lineno="652" slineno="10-20"/>highest number of votes in the initial primary race, the tie shall be broken, by lot, in the <ln numlevel="1" lineno="653" slineno="10-21"/>presence of the tied candidates or representatives of the tied candidates, by:</amend><subsection ssid="4-4-107" dnum="_-o:a-i" numlevel="1" lineno="654" slineno="10-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1301" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="131" style="1" owner="jchristopherson" level="1" amendtag="end">the election officer; or</amend></subsection><subsection ssid="4-4-108" dnum="_-o:b-i" numlevel="1" lineno="655" slineno="10-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1302" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">if the election officer is the lieutenant governor and the race is for governor, one of <ln numlevel="1" lineno="656" slineno="10-24"/>the following, as designated by the lieutenant governor:</amend><subsection ssid="4-4-109" dnum="_-o:i-i" numlevel="1" lineno="657" slineno="10-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="end">the attorney general;</amend></subsection><subsection ssid="4-4-110" dnum="_-o:ii-i" numlevel="1" lineno="658" slineno="10-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">the state treasurer; or</amend></subsection><subsection ssid="4-4-111" dnum="_-o:iii-i" numlevel="1" lineno="659" slineno="10-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1305" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">the state auditor.</amend></subsection></subsection></subsection><subsection ssid="4-4-112" dnum="_-o:4-i" numlevel="1" lineno="660" slineno="10-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">To conduct a runoff election described in Subsection (2), the election officer shall:</amend><subsection ssid="4-4-113" dnum="_-o:a-i" numlevel="1" lineno="661" slineno="10-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">35 calendar days after the day of the regular primary election, hold a runoff election <ln numlevel="1" lineno="662" slineno="10-30"/>between the two candidates identified under Subsection (2);</amend></subsection><subsection ssid="4-4-114" dnum="_-o:b-i" numlevel="1" lineno="663" slineno="10-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1308" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="120" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">conduct the election in accordance with Section <xref depth="3" refnumber="20A-3a-202">20A-3a-202</xref>, except that the election <ln numlevel="1" lineno="664" slineno="10-32"/>officer may not provide early voting for the runoff election;</amend></subsection><subsection ssid="4-4-115" dnum="_-o:c-i" numlevel="1" lineno="665" slineno="10-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1309" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="end">provide notice of the runoff election by:</amend><subsection ssid="4-145" dnum="_-o:i-i" numlevel="1" lineno="666" slineno="10-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1310" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="213" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">for 14 calendar days before the day of the election, publishing the notice, as a <ln numlevel="1" lineno="667" slineno="10-35"/>class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for the county or jurisdiction to which <ln numlevel="1" lineno="668" slineno="10-36"/>the election relates; and</amend></subsection><subsection ssid="4-4-116" dnum="_-o:ii-i" numlevel="1" lineno="669" slineno="10-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1311" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="4-4-117" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1312" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="end">at least two calendar days before the day of the election, publishing the <ln numlevel="1" lineno="670" slineno="10-38"/>notice in a newspaper of general circulation in the jurisdiction to which the <ln numlevel="1" lineno="671" slineno="10-39"/>election pertains; or</amend></subsection><subsection ssid="4-4-119" dnum="_-o:B-i" numlevel="1" lineno="672" slineno="10-40" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1313" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">at least five calendar days before the day of the election, mailing the notice to <ln numlevel="1" lineno="673" slineno="10-41"/>each registered voter who resides in the jurisdiction to which the election <ln numlevel="1" lineno="674" slineno="10-42"/>pertains; and</amend></subsection></subsection></subsection><subsection ssid="4-4-122" dnum="_-o:d-i" numlevel="1" lineno="675" slineno="10-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1314" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection (5), include in the notice described in Subsection <ln numlevel="1" lineno="676" slineno="10-44"/>(4)(c):</amend><subsection ssid="4-4-123" dnum="_-o:i-i" numlevel="1" lineno="677" slineno="10-45" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1315" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">at the top of the notice, the following statement:<eol numlevel="1" lineno="678" slineno="10-46"/>"NOTICE OF RUNOFF ELECTION<eol numlevel="1" lineno="679" slineno="10-47"/>Notice is given that a runoff election will be held at the date and times <ln numlevel="1" lineno="680" slineno="10-48"/>indicated below to nominate the candidate for the [name of registered political <ln numlevel="1" lineno="681" slineno="10-49"/>party] to run for [name of office] in the upcoming regular general election. The <ln numlevel="1" lineno="682" slineno="10-50"/>candidates in the runoff election are:<eol numlevel="1" lineno="683" slineno="10-51"/>[list the names of the two candidates participating in the runoff election, in the <ln numlevel="1" lineno="684" slineno="10-52"/>same order as the candidates will appear on the ballot]<eol numlevel="1" lineno="685" slineno="10-53"/>A voter who is eligible to vote in the primary election for the [insert the name <ln numlevel="1" lineno="686" slineno="10-54"/>of the applicable political party] may cast a vote in the runoff election.";</amend></subsection><subsection ssid="4-4-124" dnum="_-o:ii-i" numlevel="1" lineno="687" slineno="10-55" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1316" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="end">the hours during which the polls will be open;</amend></subsection><subsection ssid="4-4-125" dnum="_-o:iii-i" numlevel="1" lineno="688" slineno="10-56" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1317" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">the polling places for each voting precinct and election day voting center;</amend></subsection><subsection ssid="4-4-126" dnum="_-o:iv-i" numlevel="1" lineno="689" slineno="10-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1318" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="126" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">the address of the Statewide Electronic Voter Information Website and the <ln numlevel="1" lineno="690" slineno="10-58"/>election officer's website, with a statement indicating that the election officer will <ln numlevel="1" lineno="691" slineno="10-59"/>post on the websites any changes to the location of a polling place and the location <ln numlevel="1" lineno="692" slineno="10-60"/>of any additional polling place;</amend></subsection><subsection ssid="4-4-127" dnum="_-o:v-i" numlevel="1" lineno="693" slineno="10-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1319" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">a phone number that a voter may call to obtain information regarding the location <ln numlevel="1" lineno="694" slineno="10-62"/>of a polling place; and</amend></subsection><subsection ssid="4-4-128" dnum="_-o:vi-i" numlevel="1" lineno="695" slineno="10-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1320" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">the qualifications for an individual to vote in the election; and</amend></subsection></subsection><subsection ssid="4-4-129" dnum="_-o:e-i" numlevel="1" lineno="696" slineno="10-64" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1321" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">no later than 14 calendar days after the day of the election, declaring nominated by <ln numlevel="1" lineno="697" slineno="10-65"/>the applicable party:</amend><subsection ssid="4-4-130" dnum="_-o:i-i" numlevel="1" lineno="698" slineno="10-66" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1322" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">the candidate who receives the highest number of votes in the runoff election; or</amend></subsection><subsection ssid="4-4-131" dnum="_-o:ii-i" numlevel="1" lineno="699" slineno="10-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1323" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">in the case of a tie, the candidate selected by lot, in the presence of the tied <ln numlevel="1" lineno="700" slineno="10-68"/>candidates or representatives of the tied candidates, by the individual described in <ln numlevel="1" lineno="701" slineno="10-69"/>Subsection (3).</amend></subsection></subsection></subsection><subsection ssid="4-4-132" dnum="_-o:5-i" numlevel="1" lineno="702" slineno="10-70" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1324" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="150" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">Instead of including the information described in Subsection (4)(d) in the notice <ln numlevel="1" lineno="703" slineno="10-71"/>described in Subsection (4)(c), the election officer may include the following in the <ln numlevel="1" lineno="704" slineno="10-72"/>notice:</amend><subsection ssid="4-4-133" dnum="_-o:a-i" numlevel="1" lineno="705" slineno="10-73" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1325" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">the statement described in Subsection (4)(d)(i);</amend></subsection><subsection ssid="4-4-134" dnum="_-o:b-i" numlevel="1" lineno="706" slineno="10-74" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1326" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="161" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">the following statement: "The election will be held in [indicate the jurisdiction] on <ln numlevel="1" lineno="707" slineno="10-75"/>[indicate date of election]. Information relating to the election, including polling <ln numlevel="1" lineno="708" slineno="10-76"/>places, polling place hours, and qualifications of voters may be obtained from the <ln numlevel="1" lineno="709" slineno="10-77"/>following sources:"; and</amend></subsection><subsection ssid="4-4-135" dnum="_-o:c-i" numlevel="1" lineno="710" slineno="10-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1327" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">a list of the following sources where an individual may view or obtain the <ln numlevel="1" lineno="711" slineno="10-79"/>information described in Subsections (4)(d)(ii) through (vi):</amend><subsection ssid="4-4-136" dnum="_-o:i-i" numlevel="1" lineno="712" slineno="10-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1328" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">the jurisdiction's website;</amend></subsection><subsection ssid="4-4-137" dnum="_-o:ii-i" numlevel="1" lineno="713" slineno="10-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1329" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="173" groupid="104" style="1" owner="jchristopherson" level="1" amendtag="end">the physical address of the jurisdiction offices; and</amend></subsection><subsection ssid="4-4-138" dnum="_-o:iii-i" numlevel="1" lineno="714" slineno="10-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1330" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">a mailing address and telephone number.</amend></subsection></subsection></subsection><subsection ssid="4-4-139" dnum="_-o:6-i" numlevel="1" lineno="715" slineno="10-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="4-4-140" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1332" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="180" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">In order to comply with Chapter 16, Uniform Military and Overseas Voters Act, <ln numlevel="1" lineno="716" slineno="10-84"/>the election officer shall, for a regular primary election race that may result in a <ln numlevel="1" lineno="717" slineno="10-85"/>runoff election under this section:</amend><subsection ssid="4-159" dnum="_-o:i-i" numlevel="1" lineno="718" slineno="10-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1333" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="end">provide each voter with a ballot that permits the voter to rank the candidates in the <ln numlevel="1" lineno="719" slineno="10-87"/>regular primary election race, in the order the voter prefers the candidates; or</amend></subsection><subsection ssid="4-160" dnum="_-o:ii-i" numlevel="1" lineno="720" slineno="10-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1334" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="269" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">provide each voter with:</amend><subsection ssid="4-167" dnum="_-o:A-i" numlevel="1" lineno="721" slineno="10-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1335" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="305" groupid="205" style="1" owner="jchristopherson" level="1" amendtag="end">a ballot that permits the voter to cast a vote for only one candidate in the <ln numlevel="1" lineno="722" slineno="10-90"/>regular primary election race; and</amend></subsection><subsection ssid="4-168" dnum="_-o:B-i" numlevel="1" lineno="723" slineno="10-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1336" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="303" groupid="203" style="1" owner="jchristopherson" level="1" amendtag="end">a separate ballot that permits the voter to rank the candidates in the regular <ln numlevel="1" lineno="724" slineno="10-92"/>primary election race, in accordance with Subsection <xref tempid="347" depth="4" refnumber="20A-9-409.1(6)(a)(i)">(6)(a)(i)</xref>.</amend></subsection></subsection></subsection><subsection ssid="4-4-141" dnum="_-o:b-i" numlevel="1" lineno="725" slineno="10-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1337" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="116" style="1" owner="jchristopherson" level="1" amendtag="end">To count a vote cast in a race described in Subsection <xref refnumber="20A-9-409.1(6)(a)" depth="4">(6)(a)</xref>, where the voter ranked <ln numlevel="1" lineno="726" slineno="10-94"/>at least two of the candidates on a ballot, the election officer shall:</amend><subsection ssid="4-4-142" dnum="_-o:i-i" numlevel="1" lineno="727" slineno="10-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1338" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="198" groupid="119" style="1" owner="jchristopherson" level="1" amendtag="end">for a race in which the election officer provides the voter with a ballot described in <ln numlevel="1" lineno="728" slineno="10-96"/>Subsection <xref tempid="491" depth="4" refnumber="20A-9-409.1(6)(a)(i)">(6)(a)(i)</xref>:</amend><subsection ssid="4-163" dnum="_-o:A-i" numlevel="1" lineno="729" slineno="10-97" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1339" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="274" groupid="181" style="1" owner="jchristopherson" level="1" amendtag="end">initially, only count a vote for the candidate who the voter ranked highest; and</amend></subsection><subsection ssid="4-149" dnum="_-o:B-i" numlevel="1" lineno="730" slineno="10-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1340" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="217" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">if the race results in a runoff election, count a vote in the runoff election for <ln numlevel="1" lineno="731" slineno="10-99"/>the candidate who is the voter's highest choice preference among the two <ln numlevel="1" lineno="732" slineno="10-100"/>candidates participating in the election; or</amend></subsection></subsection><subsection ssid="4-164" dnum="_-o:ii-i" numlevel="1" lineno="733" slineno="10-101" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1341" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="186" style="1" owner="jchristopherson" level="1" amendtag="end">for a race in which the election officer provides the voter with the ballots <ln numlevel="1" lineno="734" slineno="10-102"/>described in Subsection <xref tempid="525" depth="4" refnumber="20A-9-409.1(6)(a)(ii)">(6)(a)(ii)</xref>:</amend><subsection ssid="4-165" dnum="_-o:A-i" numlevel="1" lineno="735" slineno="10-103" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1342" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="190" style="1" owner="jchristopherson" level="1" amendtag="end">initially, count a vote for the candidate the voter selects on the ballot <ln numlevel="1" lineno="736" slineno="10-104"/>described in Subsection <xref refnumber="20A-9-409.1(6)" depth="4">(6)</xref>(a)(ii)(A); Duties of lieutenant governor.</bold></catline><sectionText lineno="742"><tab/>The lieutenant governor shall:</sectionText><subsection ssid="21-21-1" dnum="1-o" numlevel="1" lineno="743" slineno="11-4" level="1"><display>(1)</display>implement this chapter and the state's responsibilities under the Uniformed and <ln numlevel="1" lineno="744" slineno="11-5"/>Overseas Citizens Absentee Voting Act, 52 U.S.C. 20301 et seq.;<amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend></subsection><subsection ssid="21-21-2" dnum="2-o" numlevel="1" lineno="745" slineno="11-6" level="1"><display>(2)</display>make available to covered voters information regarding voter registration procedures for <ln numlevel="1" lineno="746" slineno="11-7"/>covered voters and procedures for casting military-overseas ballots;</subsection><subsection ssid="21-21-3" dnum="3-o" numlevel="1" lineno="747" slineno="11-8" level="1"><display>(3)</display>establish an electronic transmission system through which a covered voter may apply <ln numlevel="1" lineno="748" slineno="11-9"/>for and receive voter registration materials, military-overseas ballots, and other <ln numlevel="1" lineno="749" slineno="11-10"/>information under this chapter;</subsection><subsection ssid="21-21-4" dnum="4-o" numlevel="1" lineno="750" slineno="11-11" level="1" space="false"><display>(4)</display><subsection ssid="21-21-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>develop standardized absentee-voting materials, including privacy and <ln numlevel="1" lineno="751" slineno="11-12"/>transmission envelopes and electronic equivalents of the envelopes, authentication <ln numlevel="1" lineno="752" slineno="11-13"/>materials, and voting instructions, <amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">including instructions for casting a vote in a <ln numlevel="1" lineno="753" slineno="11-14"/>primary election race that may result in a runoff election under Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref>, </amend><ln numlevel="1" lineno="754" slineno="11-15"/>to be used with the military-overseas ballot of a voter authorized to vote in any <ln numlevel="1" lineno="755" slineno="11-16"/>jurisdiction in the state; and</subsection><subsection ssid="21-21-6" dnum="b-o" numlevel="1" lineno="756" slineno="11-17" level="2"><display>(b)</display>to the extent reasonably possible, coordinate with other states on the development <ln numlevel="1" lineno="757" slineno="11-18"/>required by Subsection <xref depth="4" refnumber="20A-16-201(4)(a)" start="0">(4)(a)</xref>; and</subsection></subsection><subsection ssid="21-21-7" dnum="5-o" numlevel="1" lineno="758" slineno="11-19" level="1"><display>(5)</display>prescribe the form and content of a declaration:<subsection ssid="21-21-8" dnum="a-o" numlevel="1" lineno="759" slineno="11-20" level="2"><display>(a)</display>for use by a covered voter to swear or affirm specific representations pertaining to <ln numlevel="1" lineno="760" slineno="11-21"/>the voter's identity, eligibility to vote, status as a covered voter, and timely and proper <ln numlevel="1" lineno="761" slineno="11-22"/>completion of an overseas-military ballot;</subsection><subsection ssid="21-21-9" dnum="b-o" numlevel="1" lineno="762" slineno="11-23" level="2"><display>(b)</display>that is based on the declaration prescribed to accompany a federal write-in absentee <ln numlevel="1" lineno="763" slineno="11-24"/>ballot, as modified to be consistent with this chapter; and</subsection><subsection ssid="21-21-10" dnum="c-o" numlevel="1" lineno="764" slineno="11-25" level="2"><display>(c)</display>that is a prominent part of all balloting materials for which the declaration is <ln numlevel="1" lineno="765" slineno="11-26"/>required, including an indication of the date of execution of the declaration.</subsection></subsection></section></bsec><bsec buid="40" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="766" slineno="12-1" sn="12"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="766">Section 12.  <bold>Effective Date.</bold></secline><sectionText lineno="767"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec><bsec buid="33" type="uncod" untype="coord" src="uncod" uid="CRD0000" sort="UZT00000" langlock="false" numlevel="1" lineno="768" slineno="13-1" sn="13"><section ccsum="true" type="uncod" untype="coord" display="false" src="uncod"><secline lineno="768">Section 13.  <bold>Coordinating H.B. 231 with H.B. 300.</bold></secline><sectionText lineno="769"><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"><tab/>If H.B. 231, Primary Election Amendments, and H.B. 300, Amendments to Election <ln numlevel="1" lineno="770" slineno="13-3"/>Law, both pass and become law, the Legislature intends that, on May 7, 2025, Subsection <xref depth="4" refnumber="20A-3a-601(1)"><ln numlevel="1" lineno="771" slineno="13-4"/>20A-3a-601(1)</xref> be amended to read:<eol numlevel="1" lineno="772" slineno="13-5"/><para/>"</amend>(1) Except as provided in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">Section 20A-7-609.5</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="20A-9-409.1(4)(b)">20A-9-409.1(4)(b)</xref></amend>:<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="773" slineno="13-6"/><para/><tab/></amend>(a) an individual who is registered to vote may vote at a polling place before the <ln numlevel="1" lineno="774" slineno="13-7"/>election date in accordance with this section; and<amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="775" slineno="13-8"/><para/><tab/></amend>(b) except as provided in Subsection <xref depth="4" refnumber="20A-2-207(6)">20A-2-207(6)</xref>, an individual who is not <ln numlevel="1" lineno="776" slineno="13-9"/>registered to vote may register to vote and vote at a polling place before the election date in <ln numlevel="1" lineno="777" slineno="13-10"/>accordance with this section if the individual:<amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="778" slineno="13-11"/><para/><tab/><tab/></amend>(i) is otherwise legally entitled to vote the ballot; and<amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="779" slineno="13-12"/><para/><tab/><tab/></amend>(ii) casts a provisional ballot in accordance with Section <xref depth="3" refnumber="20A-2-207">20A-2-207</xref>.<amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">".</amend></sectionText></section></bsec><bsec buid="35" type="uncod" untype="coord" src="uncod" uid="CRD0001" sort="UZT00001" langlock="false" numlevel="1" lineno="780" slineno="14-1" sn="14"><section ccsum="true" type="uncod" untype="coord" display="false" src="uncod"><secline lineno="780">Section 14.  <bold>Coordinating H.B. 231 with S.B. 341.</bold></secline><sectionText lineno="781"><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both"><tab/>If H.B. 231, Primary Election Amendments, and S.B. 341, Election Modifications, <ln numlevel="1" lineno="782" slineno="14-3"/>both pass and become law, the Legislature intends that, on May 7, 2025:<eol numlevel="1" lineno="783" slineno="14-4"/><para/>(1) Subsection <xref refnumber="20A-1-304(3)(a)" depth="4">20A-1-304(3)(a)</xref> in H.B. 231 and Subsection <xref tempid="217" depth="4" refnumber="20A-1-304(4)(a)">20A-1-304(4)(a)</xref> in S.B. <ln numlevel="1" lineno="784" slineno="14-5"/>341 be amended to read:<eol numlevel="1" lineno="785" slineno="14-6"/><para/>"</amend>(a) <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided in Subsection <xref tempid="596" depth="4" refnumber="(4)(c)">(4)(c)</xref> or Section <xref depth="3" refnumber="20A-9-409.1">20A-9-409.1</xref></amend>,<amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"> if,</amend> after <ln numlevel="1" lineno="786" slineno="14-7"/>conducting a recount under Subsection <xref depth="4" refnumber="20A-4-401(5)">20A-4-401(5)</xref>, a tie vote occurs in a primary election <ln numlevel="1" lineno="787" slineno="14-8"/>race for a national, statewide, or other office that represents more than one county, the <ln numlevel="1" lineno="788" slineno="14-9"/>governor, lieutenant governor, and attorney general shall, at a public meeting called by the <ln numlevel="1" lineno="789" slineno="14-10"/>governor no later than three days after the day on which the recount canvass is completed:<amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="790" slineno="14-11"/><para/><tab/></amend>(i) determine the winning nominee, by lot, in whatever manner the governor <ln numlevel="1" lineno="791" slineno="14-12"/>determines; and<amend anum="0" ea="amend" pairid="6" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="792" slineno="14-13"/><para/><tab/></amend>(ii) provide notice and an opportunity for each candidate involved in the tie to <ln numlevel="1" lineno="793" slineno="14-14"/>observe the casting or drawing of the lot or to send a representative to observe the casting or <ln numlevel="1" lineno="794" slineno="14-15"/>drawing of the lot.<amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">"; and<eol numlevel="1" lineno="795" slineno="14-16"/><para/>(2) Subsection <xref refnumber="20A-4-306(1)" depth="4">20A-4-306(1)</xref> in S.B. 341 be amended to read:<eol numlevel="1" lineno="796" slineno="14-17"/><para/>"</amend>(1)<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/> The state board of canvassers shall convene:<amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="797" slineno="14-18"/><para/><tab/>(a) for a presidential primary election, on the fourth Tuesday in March, at noon;<eol numlevel="1" lineno="798" slineno="14-19"/><para/><tab/>(b) for a regular primary election, on the second Tuesday after the regular primary <ln numlevel="1" lineno="799" slineno="14-20"/>election, at noon;<eol numlevel="1" lineno="800" slineno="14-21"/><para/><tab/>(c) for a primary runoff election, on the second Tuesday after the primary runoff <ln numlevel="1" lineno="801" slineno="14-22"/>election, at noon;<eol numlevel="1" lineno="802" slineno="14-23"/><para/><tab/></amend><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(d) for a regular general election, </amend>on the fourth Monday of November, at noon;
