Definitions.</bold></catline><sectionText lineno="31"><para/><amend anum="0" ea="amend" pairid="2" groupid="0" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this part, "solar power plant" means a utility-scale commercial facility that:</amend></sectionText><subsection ssid="1-2" dnum="_-o:1-i" numlevel="1" lineno="32" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">has a nameplate generating capacity in excess of one megawatt; and</amend></subsection><subsection ssid="1-3" dnum="_-o:2-i" numlevel="1" lineno="33" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">converts sunlight into electricity for the primary purpose of wholesale or retail sales of <ln numlevel="1" lineno="34" slineno="1-6"/>generated electricity.</amend></subsection></section></bsec><bsec buid="2" type="enact" src="code" num="54-17-1102" uid="C54-17-S1102_2025050720250507" sort="54 17 11020020250507" numlevel="1" lineno="35" slineno="2-1" sn="2"><section number="54-17-1102" numlevel="1" lineno="36" slineno="2-2" type="enact"><secline lineno="35">Section 2, Section <bold>54-17-1102</bold> is enacted to read:</secline><catline lineno="36"><bold>54-17-1102. Eligibility for state incentives.</bold></catline><subsection ssid="2-37" dnum="_-o:1-i" numlevel="1" lineno="37" slineno="2-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">A solar power plant is not eligible to receive state incentives if the soil where the project <ln numlevel="1" lineno="38" slineno="2-4"/>is located is:</amend><subsection ssid="2-51" dnum="_-o:a-i" numlevel="1" lineno="39" slineno="2-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">prime farmland, farmland of statewide importance, farmland of local importance, or <ln numlevel="1" lineno="40" slineno="2-6"/>farmland of unique importance, as designated by the Natural Resource Conservation <ln numlevel="1" lineno="41" slineno="2-7"/>Service;</amend></subsection><subsection ssid="2-52" dnum="_-o:b-i" numlevel="1" lineno="42" slineno="2-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="165" style="1" owner="jchristopherson" level="1" amendtag="end">irrigated cropland; or</amend></subsection><subsection ssid="2-53" dnum="_-o:c-i" numlevel="1" lineno="43" slineno="2-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">non-irrigated cropland of a capability class one through four, as designated by the <ln numlevel="1" lineno="44" slineno="2-10"/>Natural Resources Conservation Service.</amend></subsection></subsection><subsection ssid="2-54" dnum="_-o:2-i" numlevel="1" lineno="45" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="173" style="1" owner="jchristopherson" level="1" amendtag="end">A solar power plant may receive half of an eligible state incentive if the soil where the <ln numlevel="1" lineno="46" slineno="2-12"/>project is located is non-irrigated cropland of a capability class five or six, as designated <ln numlevel="1" lineno="47" slineno="2-13"/>by the Natural Resources Conservation Service.</amend></subsection><subsection ssid="2-55" dnum="_-o:3-i" numlevel="1" lineno="48" slineno="2-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="224" groupid="177" style="1" owner="jchristopherson" level="1" amendtag="end">A solar power plant located on grazing land is not eligible to receive state incentives if <ln numlevel="1" lineno="49" slineno="2-15"/>the land produces greater than 1,000 pounds of vegetative production per acre in a <ln numlevel="1" lineno="50" slineno="2-16"/>normal year, according to the Web Soil Survey produced by the Natural Resources <ln numlevel="1" lineno="51" slineno="2-17"/>Conservation Service.</amend></subsection><subsection ssid="2-56" dnum="_-o:4-i" numlevel="1" lineno="52" slineno="2-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="229" groupid="181" style="1" owner="jchristopherson" level="1" amendtag="end">A solar power plant located on grazing land may receive half of an eligible state <ln numlevel="1" lineno="53" slineno="2-19"/>incentive if the land produces between 500 and 1,000 pounds of vegetative production <ln numlevel="1" lineno="54" slineno="2-20"/>per acre in a normal year, according to the Web Soil Survey produced by the Natural <ln numlevel="1" lineno="55" slineno="2-21"/>Resources Conservation Service.</amend></subsection><subsection ssid="2-57" dnum="_-o:5-i" numlevel="1" lineno="56" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="234" groupid="185" style="1" owner="jchristopherson" level="1" amendtag="end">Pursuant to Subsection <xref depth="4" refnumber="17D-3-103(2)">17D-3-103(2)</xref>, a conservation district may make a <ln numlevel="1" lineno="57" slineno="2-23"/>recommendation to exempt a solar power plant from the eligibility limitations described <ln numlevel="1" lineno="58" slineno="2-24"/>in Subsections (1) through (4).</amend></subsection></section></bsec><bsec buid="7" type="enact" src="code" num="54-17-1103" uid="C54-17-S1103_2025050720250507" sort="54 17 11030020250507" numlevel="1" lineno="59" slineno="3-1" sn="3"><section number="54-17-1103" numlevel="1" lineno="60" slineno="3-2" type="enact"><secline lineno="59">Section 3, Section <bold>54-17-1103</bold> is enacted to read:</secline><catline lineno="60"><bold>54-17-1103. Consultation requirements.</bold></catline><sectionText lineno="61"><para/><amend anum="0" ea="amend" pairid="134" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="both">The owner or operator of a solar power plant shall consult with the Division of Wildlife <ln numlevel="1" lineno="62" slineno="3-4"/>Resources or United States Fish and Wildlife Service regarding how the solar power plant <ln numlevel="1" lineno="63" slineno="3-5"/>could potentially impact wildlife on affected land.</amend></sectionText></section></bsec><bsec buid="3" type="enact" src="code" num="54-17-1104" uid="C54-17-S1104_2025050720250507" sort="54 17 11040020250507" numlevel="1" lineno="64" slineno="4-1" sn="4"><section number="54-17-1104" numlevel="1" lineno="65" slineno="4-2" type="enact"><secline lineno="64">Section 4, Section <bold>54-17-1104</bold> is enacted to read:</secline><catline lineno="65"><bold>54-17-1104. Decommissioning plan.</bold></catline><subsection ssid="3-1" dnum="_-o:1-i" numlevel="1" lineno="66" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">An owner of a solar power plant shall:</amend><subsection ssid="3-7" dnum="_-o:a-i" numlevel="1" lineno="67" slineno="4-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">place financial assurance with the appropriate local jurisdiction in accordance with <ln numlevel="1" lineno="68" slineno="4-5"/>Section <xref depth="3" refnumber="11-17-12">11-17-12</xref> in the form of:</amend><subsection ssid="3-8" dnum="_-o:i-i" numlevel="1" lineno="69" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">a bond;</amend></subsection><subsection ssid="3-9" dnum="_-o:ii-i" numlevel="1" lineno="70" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">a parent company guarantee;</amend></subsection><subsection ssid="3-10" dnum="_-o:iii-i" numlevel="1" lineno="71" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">an irrevocable letter of credit; or</amend></subsection><subsection ssid="3-11" dnum="_-o:iv-i" numlevel="1" lineno="72" slineno="4-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">an alternate form of financial security;</amend></subsection></subsection><subsection ssid="3-12" dnum="_-o:b-i" numlevel="1" lineno="73" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">ensure the amount of financial security is not less than the estimated cost of <ln numlevel="1" lineno="74" slineno="4-11"/>decommissioning and reclaiming the solar power plant, after deducting reasonable <ln numlevel="1" lineno="75" slineno="4-12"/>salvage value, as calculated by:</amend><subsection ssid="3-13" dnum="_-o:i-i" numlevel="1" lineno="76" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">a third party with expertise in decommissioning, hired by the owner and agreed to <ln numlevel="1" lineno="77" slineno="4-14"/>by the appropriate local jurisdiction; and</amend></subsection><subsection ssid="3-14" dnum="_-o:ii-i" numlevel="1" lineno="78" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">if required by the appropriate local jurisdiction, an engineer registered with the <ln numlevel="1" lineno="79" slineno="4-16"/>state;</amend></subsection></subsection><subsection ssid="3-15" dnum="_-o:c-i" numlevel="1" lineno="80" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">create and update a decommissioning and reclamation plan every five years from the <ln numlevel="1" lineno="81" slineno="4-18"/>initial commercial operating date of the solar power plant that:</amend><subsection ssid="3-16" dnum="_-o:i-i" numlevel="1" lineno="82" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">incorporates changes resulting from inflation or changes in total cost estimates;</amend></subsection><subsection ssid="3-17" dnum="_-o:ii-i" numlevel="1" lineno="83" slineno="4-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">specifies the condition to which the site must be returned, unless otherwise <ln numlevel="1" lineno="84" slineno="4-21"/>specified and agreed upon by the property owner and appropriate local jurisdiction;</amend></subsection><subsection ssid="3-18" dnum="_-o:iii-i" numlevel="1" lineno="85" slineno="4-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="end">requires removal of materials, including steel piles, concrete foundations, and <ln numlevel="1" lineno="86" slineno="4-23"/>buried cabling, to a depth of three feet below the surface, unless otherwise <ln numlevel="1" lineno="87" slineno="4-24"/>specified in the plan due to local permitting requirements; and</amend></subsection><subsection ssid="3-19" dnum="_-o:iv-i" numlevel="1" lineno="88" slineno="4-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="74" style="1" owner="jchristopherson" level="1" amendtag="end">addresses vegetation and soil restoration, based on environmental field surveys <ln numlevel="1" lineno="89" slineno="4-26"/>and site characterizations conducted before construction, unless otherwise <ln numlevel="1" lineno="90" slineno="4-27"/>specified in the plan due to local permitting requirements;</amend></subsection></subsection><subsection ssid="3-20" dnum="_-o:d-i" numlevel="1" lineno="91" slineno="4-28" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="end">in the case of cessation of operation, abandonment, or damage of the solar power <ln numlevel="1" lineno="92" slineno="4-29"/>plant:</amend><subsection ssid="3-26" dnum="_-o:i-i" numlevel="1" lineno="93" slineno="4-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="end">rectify any deficiency within 90 days after receiving written notice from the <ln numlevel="1" lineno="94" slineno="4-31"/>appropriate local jurisdiction by certified mail; or</amend></subsection><subsection ssid="3-27" dnum="_-o:ii-i" numlevel="1" lineno="95" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">provide a written plan to the appropriate local jurisdiction with an amended cure <ln numlevel="1" lineno="96" slineno="4-33"/>date if 90 days is insufficient due to circumstances beyond the owner's control; and</amend></subsection></subsection><subsection ssid="3-21" dnum="_-o:e-i" numlevel="1" lineno="97" slineno="4-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="82" style="1" owner="jchristopherson" level="1" amendtag="end">if seeking to repower the solar power plant at the end of the initial permitted use:</amend><subsection ssid="3-23" dnum="_-o:i-i" numlevel="1" lineno="98" slineno="4-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="end">complete necessary local permitting and approval requirements within 18 months <ln numlevel="1" lineno="99" slineno="4-36"/>before decommissioning requirements or penalties are incurred; or</amend></subsection><subsection ssid="3-24" dnum="_-o:ii-i" numlevel="1" lineno="100" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="94" style="1" owner="jchristopherson" level="1" amendtag="end">obtain an extension from the local permitting authority.</amend></subsection></subsection></subsection><subsection ssid="3-22" dnum="_-o:2-i" numlevel="1" lineno="101" slineno="4-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">As a condition of the permit, the decommissioning plan shall be approved by the <ln numlevel="1" lineno="102" slineno="4-39"/>appropriate local jurisdiction's governing body.</amend></subsection></section></bsec><bsec buid="4" type="enact" src="code" num="54-17-1105" uid="C54-17-S1105_2025050720250507" sort="54 17 11050020250507" numlevel="1" lineno="103" slineno="5-1" sn="5"><section number="54-17-1105" numlevel="1" lineno="104" slineno="5-2" type="enact"><secline lineno="103">Section 5, Section <bold>54-17-1105</bold> is enacted to read:</secline><catline lineno="104"><bold>54-17-1105. Permit application and review.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="105" slineno="5-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not construct a solar power plant without first applying for and receiving <ln numlevel="1" lineno="106" slineno="5-4"/>a solar power plant construction permit.</amend></subsection><subsection ssid="4-2" dnum="_-o:2-i" numlevel="1" lineno="107" slineno="5-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">An application for constructing a solar power plant shall specify how the location and <ln numlevel="1" lineno="108" slineno="5-6"/>design standards will be met.</amend></subsection><subsection ssid="4-3" dnum="_-o:3-i" numlevel="1" lineno="109" slineno="5-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">Site and development plans must identify all existing and proposed structures, setbacks, <ln numlevel="1" lineno="110" slineno="5-8"/>access routes, utilities, drainage pathways, areas of vegetation removal, and other <ln numlevel="1" lineno="111" slineno="5-9"/>relevant items identified by staff or the planning commission.</amend></subsection></section></bsec><bsec buid="5" type="enact" src="code" num="54-17-1106" uid="C54-17-S1106_2025050720250507" sort="54 17 11060020250507" numlevel="1" lineno="112" slineno="6-1" sn="6"><section number="54-17-1106" numlevel="1" lineno="113" slineno="6-2" type="enact"><secline lineno="112">Section 6, Section <bold>54-17-1106</bold> is enacted to read:</secline><catline lineno="113"><bold>54-17-1106.
