Water rates.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="32" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="33" slineno="1-4" level="2"><display>(a)</display>"Designated water service area" means the area defined by a municipality in <ln numlevel="1" lineno="34" slineno="1-5"/>accordance with the <ext_ref type="Utah Constitution">Utah Constitution, Article XI, Section 6</ext_ref>, Subsection <xref depth="4" refnumber="10-8-22(1)(c)" start="0">(1)(c)</xref>.</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="35" slineno="1-6" level="2"><display>(b)</display>"Large municipal drinking water system" means a municipally owned and operated <ln numlevel="1" lineno="36" slineno="1-7"/>drinking water system serving a population of 10,000 or more.</subsection><subsection ssid="1-1-4" dnum="c-o" numlevel="1" lineno="37" slineno="1-8" level="2"><display>(c)</display>"Retail customer" means an end user:<subsection ssid="1-1-5" dnum="i-o" numlevel="1" lineno="38" slineno="1-9" level="3"><display>(i)</display>who receives culinary water directly from a municipality's waterworks system; and</subsection><subsection ssid="1-1-6" dnum="ii-o" numlevel="1" lineno="39" slineno="1-10" level="3"><display>(ii)</display>whom the municipality described in Subsection <xref depth="4" refnumber="10-8-22(1)(c)(i)" start="0">(1)(c)(i)</xref> bills for water service.</subsection></subsection></subsection><subsection ssid="1-1-7" dnum="2-o" numlevel="1" lineno="40" slineno="1-11" level="1"><display>(2)</display>A municipality shall fix the rates to be paid for the use of water furnished by the <ln numlevel="1" lineno="41" slineno="1-12"/>municipality.</subsection><subsection ssid="1-1-8" dnum="3-o" numlevel="1" lineno="42" slineno="1-13" level="1"><display>(3)</display>The setting of municipal water rates is a legislative act.</subsection><subsection ssid="1-1-9" dnum="4-o" numlevel="1" lineno="43" slineno="1-14" level="1"><display>(4)</display>Within the municipality's designated water service area, a municipality shall:<subsection ssid="1-1-10" dnum="a-o" numlevel="1" lineno="44" slineno="1-15" level="2"><display>(a)</display>establish, by ordinance, reasonable rates for the services provided to the <ln numlevel="1" lineno="45" slineno="1-16"/>municipality's retail customers;</subsection><subsection ssid="1-1-11" dnum="b-o" numlevel="1" lineno="46" slineno="1-17" level="2"><display>(b)</display>use the same method of providing notice to all retail customers of proposed rate <ln numlevel="1" lineno="47" slineno="1-18"/>changes; and</subsection><subsection ssid="1-1-12" dnum="c-o" numlevel="1" lineno="48" slineno="1-19" level="2"><display>(c)</display>allow all retail customers the same opportunity to appear and participate in a public <ln numlevel="1" lineno="49" slineno="1-20"/>meeting addressing water rates.</subsection></subsection><subsection ssid="1-1-13" dnum="5-o" numlevel="1" lineno="50" slineno="1-21" level="1" space="false"><display>(5)</display><subsection ssid="1-1-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A municipality may establish different rates for different classifications of retail <ln numlevel="1" lineno="51" slineno="1-22"/>customers within the municipality's designated water service area, if the rates and <ln numlevel="1" lineno="52" slineno="1-23"/>classifications have a reasonable basis.</subsection><subsection ssid="1-1-15" dnum="b-o" numlevel="1" lineno="53" slineno="1-24" level="2"><display>(b)</display>A reasonable basis for charging different rates for different classifications may <ln numlevel="1" lineno="54" slineno="1-25"/>include, among other things, a situation in which:<subsection ssid="1-1-16" dnum="i-o" numlevel="1" lineno="55" slineno="1-26" level="3"><display>(i)</display>there is a difference in the cost of providing service to a particular classification;</subsection><subsection ssid="1-1-17" dnum="ii-o" numlevel="1" lineno="56" slineno="1-27" level="3"><display>(ii)</display>one classification bears more risk in relation to a system operation or obligation;</subsection><subsection ssid="1-1-18" dnum="iii-o" numlevel="1" lineno="57" slineno="1-28" level="3"><display>(iii)</display>retail customers in one classification invested or contributed to acquire a water <ln numlevel="1" lineno="58" slineno="1-29"/>source or supply or build or maintain a system differently than retail customers in <ln numlevel="1" lineno="59" slineno="1-30"/>another classification;</subsection><subsection ssid="1-1-19" dnum="iv-o" numlevel="1" lineno="60" slineno="1-31" level="3"><display>(iv)</display>the needs or conditions of one classification:<subsection ssid="1-1-20" dnum="A-o" numlevel="1" lineno="61" slineno="1-32" level="4"><display>(A)</display>are distinguishable from the needs or conditions of another classification; and</subsection><subsection ssid="1-1-21" dnum="B-o" numlevel="1" lineno="62" slineno="1-33" level="4"><display>(B)</display>based on economic, public policy, or other identifiable elements, support a <ln numlevel="1" lineno="63" slineno="1-34"/>different rate; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-1-22" dnum="v-o" numlevel="1" lineno="64" slineno="1-35" level="3"><display>(v)</display>there is a differential between the classifications based on a cost of service <ln numlevel="1" lineno="65" slineno="1-36"/>standard or a generally accepted rate setting method, including a standard or <ln numlevel="1" lineno="66" slineno="1-37"/>method the American Water Works Association establishes<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; or</amend></subsection><subsection ssid="1-36" dnum="_-o:vi-i" numlevel="1" lineno="67" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="end">water conservation is used as an element in determining the rate charged for a <ln numlevel="1" lineno="68" slineno="1-39"/>block unit of water as provided in Section <xref depth="3" refnumber="73-10-32.5">73-10-32.5</xref>.</amend></subsection></subsection><subsection ssid="1-1-23" dnum="c-o" numlevel="1" lineno="69" slineno="1-40" level="2"><display>(c)</display>An adjustment based solely on the fact that a particular classification of retail <ln numlevel="1" lineno="70" slineno="1-41"/>customers is located either inside or outside of the municipality's corporate boundary <ln numlevel="1" lineno="71" slineno="1-42"/>is not a reasonable basis.</subsection></subsection><subsection ssid="1-1-24" dnum="6-o" numlevel="1" lineno="72" slineno="1-43" level="1" space="false"><display>(6)</display><subsection ssid="1-1-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If more than 10% of the retail customers within a large municipal drinking water <ln numlevel="1" lineno="73" slineno="1-44"/>system's designated water service area are located outside of the municipality's <ln numlevel="1" lineno="74" slineno="1-45"/>corporate boundary, the municipality shall:<subsection ssid="1-1-26" dnum="i-o" numlevel="1" lineno="75" slineno="1-46" level="3" tab="1"><display>(i)</display>post on the municipality's website the rates assessed to retail customers within the <ln numlevel="1" lineno="76" slineno="1-47"/>designated water service area; and</subsection><subsection ssid="1-1-27" dnum="ii-o" numlevel="1" lineno="77" slineno="1-48" level="3" tab="1"><display>(ii)</display>establish an advisory board to make recommendations to the municipal legislative <ln numlevel="1" lineno="78" slineno="1-49"/>body regarding water rates, capital projects, and other water service standards.</subsection></subsection><subsection ssid="1-1-28" dnum="b-o" numlevel="1" lineno="79" slineno="1-50" level="2"><display>(b)</display>In establishing an advisory board described in Subsection <xref depth="4" refnumber="10-8-22(6)(a)(ii)" start="0">(6)(a)(ii)</xref>, a municipality <ln numlevel="1" lineno="80" slineno="1-51"/>shall:<subsection ssid="1-1-29" dnum="i-o" numlevel="1" lineno="81" slineno="1-52" level="3"><display>(i)</display>if more than 10% but no more than 30% of the municipality's retail customers <ln numlevel="1" lineno="82" slineno="1-53"/>receive service outside the municipality's municipal boundary, ensure that at least <ln numlevel="1" lineno="83" slineno="1-54"/>20% of the advisory board's members represent the municipality's retail customers <ln numlevel="1" lineno="84" slineno="1-55"/>receiving service outside the municipality's municipal boundary;</subsection><subsection ssid="1-1-30" dnum="ii-o" numlevel="1" lineno="85" slineno="1-56" level="3"><display>(ii)</display>if more than 30% of the municipality's retail customers receive service outside of <ln numlevel="1" lineno="86" slineno="1-57"/>the municipality's municipal boundary, ensure that at least 40% of the advisory <ln numlevel="1" lineno="87" slineno="1-58"/>board's members represent the municipality's retail customers receiving service <ln numlevel="1" lineno="88" slineno="1-59"/>outside of the municipality's municipal boundary; and</subsection><subsection ssid="1-1-31" dnum="iii-o" numlevel="1" lineno="89" slineno="1-60" level="3"><display>(iii)</display>in appointing board members who represent retail customers receiving service <ln numlevel="1" lineno="90" slineno="1-61"/>outside of the municipality's municipal boundary, as required in Subsections <xref depth="4" refnumber="10-8-22(6)(b)(i)" start="0"><ln numlevel="1" lineno="91" slineno="1-62"/>(6)(b)(i)</xref> and <xref depth="4" refnumber="10-8-22(6)(b)(ii)" start="0">(ii)</xref>, solicit recommendations from each municipality and county <ln numlevel="1" lineno="92" slineno="1-63"/>outside of the municipality's municipal boundary whose residents are retail <ln numlevel="1" lineno="93" slineno="1-64"/>customers within the municipality's designated water service area.</subsection></subsection></subsection><subsection ssid="1-1-32" dnum="7-o" numlevel="1" lineno="94" slineno="1-65" level="1"><display>(7)</display>A municipality that supplies water outside of the municipality's designated water service <ln numlevel="1" lineno="95" slineno="1-66"/>area shall supply the water only by contract and shall include in the contract the terms <ln numlevel="1" lineno="96" slineno="1-67"/>and conditions under which the contract can be terminated.</subsection><subsection ssid="1-1-33" dnum="8-o" numlevel="1" lineno="97" slineno="1-68" level="1"><display>(8)</display>A municipality shall:<subsection ssid="1-1-34" dnum="a-o" numlevel="1" lineno="98" slineno="1-69" level="2"><display>(a)</display>notify the director of the Division of Drinking Water of a contract the municipality <ln numlevel="1" lineno="99" slineno="1-70"/>enters into with a person outside of the municipality's designated water service area, <ln numlevel="1" lineno="100" slineno="1-71"/>including the name and contact information of the person named in each contract; and</subsection><subsection ssid="1-1-35" dnum="b-o" numlevel="1" lineno="101" slineno="1-72" level="2"><display>(b)</display>each year, provide <amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">to the director of the Division of Drinking Water </amend>any <ln numlevel="1" lineno="102" slineno="1-73"/>supplementing or new information regarding a contract described in Subsection <xref depth="4" refnumber="10-8-22(8)(a)" start="0">(8)(a)</xref>, <ln numlevel="1" lineno="103" slineno="1-74"/>including whether there is no new information to provide at that time.</subsection></subsection></section></bsec><bsec buid="10" num="73-10-2" type="amend" src="code" uid="C73-10-S2_2025050720250507" sort="73 10 00020020250507" numlevel="1" lineno="104" slineno="2-1" sn="2"><section number="73-10-2" numlevel="1" lineno="105" slineno="2-2" type="amend"><secline lineno="104">Section 2, Section <bold>73-10-2</bold> is amended to read:</secline><catline lineno="105"><bold>73-10-2. Board of Water Resources -- Members -- Appointment -- Terms -- <ln numlevel="1" lineno="106" slineno="2-3"/>Vacancies.</bold></catline><subsection ssid="10-10-1" dnum="1-o" numlevel="1" lineno="107" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="10-10-2" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1037" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>The Board of Water Resources shall be comprised of nine members to be <ln numlevel="1" lineno="108" slineno="2-5"/>appointed by the governor with the advice and consent of the Senate in accordance <ln numlevel="1" lineno="109" slineno="2-6"/>with <xref depth="2" refnumber="63G-24-2" start="0">Title 63G, Chapter 24, Part 2, Vacancies</xref>.</subsection><subsection ssid="10-10-3" dnum="b-o:_-i" numlevel="1" lineno="110" slineno="2-7" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="3" style="2" owner="jchristopherson" level="1" deltag="end">In addition to the requirements of Section <xref depth="3" refnumber="79-2-203" start="0">79-2-203</xref>, not more than five members <ln numlevel="1" lineno="111" slineno="2-8"/>shall be from the same political party.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="10-10-4" dnum="2-o" numlevel="1" lineno="112" slineno="2-9" level="1"><display>(2)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">The </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Section <xref depth="3" refnumber="79-2-203">79-2-203</xref>, the </amend>Board of Water Resources shall consist of:<subsection ssid="10-10-5" dnum="a-o" numlevel="1" lineno="113" slineno="2-10" level="2"><display>(a)</display>one member appointed from each of the following districts:<subsection ssid="10-10-6" dnum="i-o" numlevel="1" lineno="114" slineno="2-11" level="3"><display>(i)</display>Bear River District, comprising the counties of Box Elder, Cache, and Rich;</subsection><subsection ssid="10-10-7" dnum="ii-o" numlevel="1" lineno="115" slineno="2-12" level="3"><display>(ii)</display>Weber District, comprising the counties of Weber, Davis, Morgan, and Summit;</subsection><subsection ssid="10-10-8" dnum="iii-o" numlevel="1" lineno="116" slineno="2-13" level="3"><display>(iii)</display>Salt Lake District, comprising the counties of Salt Lake and Tooele;</subsection><subsection ssid="10-10-9" dnum="iv-o" numlevel="1" lineno="117" slineno="2-14" level="3"><display>(iv)</display>Provo River District, comprising the counties of Juab, Utah, and Wasatch;</subsection><subsection ssid="10-10-10" dnum="v-o" numlevel="1" lineno="118" slineno="2-15" level="3"><display>(v)</display>Sevier River District, comprising the counties of Millard, Sanpete, Sevier, Piute, <ln numlevel="1" lineno="119" slineno="2-16"/>and Wayne;</subsection><subsection ssid="10-10-11" dnum="vi-o" numlevel="1" lineno="120" slineno="2-17" level="3"><display>(vi)</display>Green River District, comprising the counties of Daggett, Duchesne, and Uintah;</subsection><subsection ssid="10-10-12" dnum="vii-o" numlevel="1" lineno="121" slineno="2-18" level="3"><display>(vii)</display>Upper Colorado River District, comprising the counties of Carbon, Emery, <ln numlevel="1" lineno="122" slineno="2-19"/>Grand, and San Juan; and</subsection><subsection ssid="10-10-13" dnum="viii-o" numlevel="1" lineno="123" slineno="2-20" level="3"><display>(viii)</display>Lower Colorado River District, comprising the counties of Beaver, Garfield, <ln numlevel="1" lineno="124" slineno="2-21"/>Iron, Washington, and Kane; and</subsection></subsection><subsection ssid="10-10-14" dnum="b-o" numlevel="1" lineno="125" slineno="2-22" level="2"><display>(b)</display>one member that represents the interests of the Great Salt Lake.</subsection></subsection><subsection ssid="10-10-15" dnum="3-o" numlevel="1" lineno="126" slineno="2-23" level="1" space="false"><display>(3)</display><subsection ssid="10-10-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as required by Subsection <xref depth="4" refnumber="73-10-2(3)(b)" start="0">(3)(b)</xref>, all appointments shall be for terms of <ln numlevel="1" lineno="127" slineno="2-24"/>four years.</subsection><subsection ssid="10-10-17" dnum="b-o" numlevel="1" lineno="128" slineno="2-25" level="2"><display>(b)</display>Notwithstanding the requirements of Subsection <xref depth="4" refnumber="73-10-2(3)(a)" start="0">(3)(a)</xref>, the governor shall, at the <ln numlevel="1" lineno="129" slineno="2-26"/>time of appointment or reappointment, adjust the length of terms to ensure that the <ln numlevel="1" lineno="130" slineno="2-27"/>terms of board members are staggered so that approximately half of the board is <ln numlevel="1" lineno="131" slineno="2-28"/>appointed every two years.</subsection><subsection ssid="10-10-18" dnum="c-o" numlevel="1" lineno="132" slineno="2-29" level="2"><display>(c)</display>When a vacancy occurs in the membership for any reason, the governor shall appoint <ln numlevel="1" lineno="133" slineno="2-30"/>a replacement member for the unexpired term, with the advice and consent of the <ln numlevel="1" lineno="134" slineno="2-31"/>Senate, who:<subsection ssid="10-10-19" dnum="i-o" numlevel="1" lineno="135" slineno="2-32" level="3"><display>(i)</display>is from the same district as the individual leaving the board; Culinary water pricing structure.</bold></catline><subsection ssid="2-2-1" dnum="1-o" numlevel="1" lineno="148" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">, "retail </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="2-8" dnum="_-o:a-i" numlevel="1" lineno="149" slineno="3-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="end">"Retail </amend>water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102" start="0">19-4-102</xref>.</subsection><subsection ssid="2-9" dnum="_-o:b-i" numlevel="1" lineno="150" slineno="3-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="2-10" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">"Water conservation effort" means a program that is designed to incentivize, <ln numlevel="1" lineno="151" slineno="3-6"/>encourage, or result in reduced water usage or more efficient use of water.</amend></subsection><subsection ssid="2-11" dnum="_-o:ii-i" numlevel="1" lineno="152" slineno="3-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">"Water conservation effort" includes the costs associated with designing, <ln numlevel="1" lineno="153" slineno="3-8"/>implementing, and operating a program described in Subsection <xref tempid="1035" depth="4" refnumber="73-10-32.5(1)(b)(i)">(1)(b)(i)</xref>.</amend></subsection></subsection><subsection ssid="2-12" dnum="_-o:c-i" numlevel="1" lineno="154" slineno="3-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">"Wholesale water supplier" means the same as that term is defined in Section <xref depth="3" refnumber="19-4-102"><ln numlevel="1" lineno="155" slineno="3-10"/>19-4-102</xref>.</amend></subsection></subsection><subsection ssid="2-2-2" dnum="2-o" numlevel="1" lineno="156" slineno="3-11" level="1"><display>(2)</display>A retail water supplier shall:<subsection ssid="2-2-3" dnum="a-o" numlevel="1" lineno="157" slineno="3-12" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="32" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both">consider water conservation in setting water rates with the goal of encouraging <ln numlevel="1" lineno="158" slineno="3-13"/>efficient water use and eliminating wasteful or excessive water use;</amend></subsection><subsection ssid="2-13" dnum="_-o:b-i" numlevel="1" lineno="159" slineno="3-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="both">(b)</amend></display>establish a culinary water rate structure that:<subsection ssid="2-2-4" dnum="i-o" numlevel="1" lineno="160" slineno="3-15" level="3"><display>(i)</display>incorporates increasing block units of water used; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="2-2-5" dnum="ii-o" numlevel="1" lineno="161" slineno="3-16" level="3"><display>(ii)</display>provides for an increase in the rate charged for additional block units of water <ln numlevel="1" lineno="162" slineno="3-17"/>used as usage increases from one block unit to the next;</subsection><subsection ssid="2-14" dnum="_-o:iii-i" numlevel="1" lineno="163" slineno="3-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">by July 1, 2027, includes water conservation as an element in determining the <ln numlevel="1" lineno="164" slineno="3-19"/>rate charged for at least the highest usage block unit of water for a customer <ln numlevel="1" lineno="165" slineno="3-20"/>classification that primarily serves residential customers; and</amend></subsection><subsection ssid="2-15" dnum="_-o:iv-i" numlevel="1" lineno="166" slineno="3-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">is based on a generally accepted rate setting method, including a standard or <ln numlevel="1" lineno="167" slineno="3-22"/>method established by the American Water Works Association;</amend></subsection></subsection><subsection ssid="2-2-6" dnum="b-o:c-i" numlevel="1" lineno="168" slineno="3-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>provide in customer billing notices, or in a notice that is distributed to customers <ln numlevel="1" lineno="169" slineno="3-24"/>at least annually, block unit rates and the customer's billing cycle; and</subsection><subsection ssid="2-2-7" dnum="c-o:d-i" numlevel="1" lineno="170" slineno="3-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>include individual customer water usage in customer billing notices.</subsection></subsection><subsection ssid="2-16" dnum="_-o:3-i" numlevel="1" lineno="171" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">This section does not prohibit a retail water supplier from including water conservation <ln numlevel="1" lineno="172" slineno="3-27"/>as an element in setting rates for customer classifications that do not primarily serve <ln numlevel="1" lineno="173" slineno="3-28"/>residential customers.</amend></subsection><subsection ssid="2-17" dnum="_-o:4-i" numlevel="1" lineno="174" slineno="3-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">A retail water supplier:</amend><subsection ssid="2-18" dnum="_-o:a-i" numlevel="1" lineno="175" slineno="3-30" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">is not required to establish or show that the portion of the rate designed to encourage <ln numlevel="1" lineno="176" slineno="3-31"/>water conservation within the highest usage block unit of water for a customer <ln numlevel="1" lineno="177" slineno="3-32"/>classification:</amend><subsection ssid="2-19" dnum="_-o:i-i" numlevel="1" lineno="178" slineno="3-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">is based on the retail water supplier's actual cost of service;</amend></subsection><subsection ssid="2-20" dnum="_-o:ii-i" numlevel="1" lineno="179" slineno="3-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">has a reasonable basis when compared to rates the retail water supplier charges:</amend><subsection ssid="2-21" dnum="_-o:A-i" numlevel="1" lineno="180" slineno="3-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">for other block units of water within a customer classification; or</amend></subsection><subsection ssid="2-22" dnum="_-o:B-i" numlevel="1" lineno="181" slineno="3-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">for block units of water in other customer classifications; or</amend></subsection></subsection><subsection ssid="2-23" dnum="_-o:iii-i" numlevel="1" lineno="182" slineno="3-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">is limited to a reasonable profit or return on investment;</amend></subsection></subsection><subsection ssid="2-24" dnum="_-o:b-i" numlevel="1" lineno="183" slineno="3-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">may include in a customer billing a fee, surcharge, penalty, or other charge that is <ln numlevel="1" lineno="184" slineno="3-39"/>collected pursuant to an agreement between the retail water supplier and the <ln numlevel="1" lineno="185" slineno="3-40"/>wholesale water supplier from whom the retail water supplier purchases water;</amend></subsection><subsection ssid="2-25" dnum="_-o:c-i" numlevel="1" lineno="186" slineno="3-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">if the retail water supplier is a for-profit entity, may not use revenue from the portion <ln numlevel="1" lineno="187" slineno="3-42"/>of a block unit of water designed to encourage water conservation to pay profits or <ln numlevel="1" lineno="188" slineno="3-43"/>dividends to the retail water supplier's investors or owners; and</amend></subsection><subsection ssid="2-26" dnum="_-o:d-i" numlevel="1" lineno="189" slineno="3-44" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">shall use the revenue collected from the portion of any block unit of water designed <ln numlevel="1" lineno="190" slineno="3-45"/>to encourage water conservation to fund the retail water supplier's water conservation <ln numlevel="1" lineno="191" slineno="3-46"/>efforts.</amend></subsection></subsection><subsection ssid="2-27" dnum="_-o:5-i" numlevel="1" lineno="192" slineno="3-47" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">The use of revenue described in Subsection (4)(d) may include funding water <ln numlevel="1" lineno="193" slineno="3-48"/>conservation efforts that are shared with or administered by another retail water supplier <ln numlevel="1" lineno="194" slineno="3-49"/>or a wholesale water supplier.</amend></subsection><subsection ssid="2-28" dnum="_-o:6-i" numlevel="1" lineno="195" slineno="3-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">The adoption and implementation of that portion of a retail water supplier's water rate <ln numlevel="1" lineno="196" slineno="3-51"/>that includes water conservation as an element in determining the rate charged for the <ln numlevel="1" lineno="197" slineno="3-52"/>highest usage block unit of water, as provided in this section, is conclusively presumed <ln numlevel="1" lineno="198" slineno="3-53"/>to be reasonable.</amend></subsection></section></bsec><bsec buid="8" num="73-10-34" type="amend" src="code" uid="C73-10-S34_2025050720250507" sort="73 10 00340020250507" numlevel="1" lineno="199" slineno="4-1" sn="4"><section number="73-10-34" numlevel="1" lineno="200" slineno="4-2" type="amend"><secline lineno="199">Section 4, Section <bold>73-10-34</bold> is amended to read:</secline><catline lineno="200"><bold>73-10-34. Secondary water metering -- Loans and grants.</bold></catline><subsection ssid="8-8-1" dnum="1-o" numlevel="1" lineno="201" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="8-8-2" dnum="a-o" numlevel="1" lineno="202" slineno="4-4" level="2"><display>(a)</display>"Agriculture use" means water used on land assessed under Title 59, Chapter 2, Part 5, <ln numlevel="1" lineno="203" slineno="4-5"/>Farmland Assessment Act.</subsection><subsection ssid="8-8-3" dnum="b-o" numlevel="1" lineno="204" slineno="4-6" level="2" space="false"><display>(b)</display><subsection ssid="8-8-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Commercial user" means a secondary water user that is a place of business.</subsection><subsection ssid="8-8-5" dnum="ii-o" numlevel="1" lineno="205" slineno="4-7" level="3"><display>(ii)</display>"Commercial user" does not include a multi-family residence, an agricultural <ln numlevel="1" lineno="206" slineno="4-8"/>user, or a customer that falls within the industrial or institutional classification.</subsection></subsection><subsection ssid="8-8-6" dnum="c-o" numlevel="1" lineno="207" slineno="4-9" level="2"><display>(c)</display>"Critical area" means an area:<subsection ssid="8-8-7" dnum="i-o" numlevel="1" lineno="208" slineno="4-10" level="3"><display>(i)</display>serviced by one of the four largest water conservancy districts, as defined in <ln numlevel="1" lineno="209" slineno="4-11"/>Section <xref depth="3" refnumber="17B-1-102">17B-1-102</xref>, measured by operating budgets; or</subsection><subsection ssid="8-8-8" dnum="ii-o" numlevel="1" lineno="210" slineno="4-12" level="3"><display>(ii)</display>within the Great Salt Lake basin, which includes:<subsection ssid="8-8-9" dnum="A-o" numlevel="1" lineno="211" slineno="4-13" level="4"><display>(A)</display>the surveyed meander line of the Great Salt Lake;</subsection><subsection ssid="8-8-10" dnum="B-o" numlevel="1" lineno="212" slineno="4-14" level="4"><display>(B)</display>the drainage areas of the Bear River or the Bear River's tributaries;</subsection><subsection ssid="8-8-11" dnum="C-o" numlevel="1" lineno="213" slineno="4-15" level="4"><display>(C)</display>the drainage areas of Bear Lake or Bear tributaries;</subsection><subsection ssid="8-8-13" dnum="E-o" numlevel="1" lineno="215" slineno="4-17" level="4"><display>(E)</display>the drainage areas of the Jordan River or the Jordan River's tributaries;</subsection><subsection ssid="8-8-14" dnum="F-o" numlevel="1" lineno="216" slineno="4-18" level="4"><display>(F)</display>the drainage areas of Utah Lake or Utah Lake's tributaries;</subsection><subsection ssid="8-8-15" dnum="G-o" numlevel="1" lineno="217" slineno="4-19" level="4"><display>(G)</display>other water drainages lying between the Bear River and the Jordan River that <ln numlevel="1" lineno="218" slineno="4-20"/>are tributary to the Great Salt Lake and not included in the drainage areas <ln numlevel="1" lineno="219" slineno="4-21"/>described in Subsections (1)(c)(ii)(B) through (F); and</subsection><subsection ssid="8-8-16" dnum="H-o" numlevel="1" lineno="220" slineno="4-22" level="4"><display>(H)</display>the drainage area of Tooele Valley.</subsection></subsection></subsection><subsection ssid="8-8-17" dnum="d-o" numlevel="1" lineno="221" slineno="4-23" level="2"><display>(d)</display>"Full metering" means that use of secondary water is accurately metered by a meter <ln numlevel="1" lineno="222" slineno="4-24"/>that is installed and maintained on every secondary water connection of a secondary <ln numlevel="1" lineno="223" slineno="4-25"/>water supplier.</subsection><subsection ssid="8-8-18" dnum="e-o" numlevel="1" lineno="224" slineno="4-26" level="2" space="false"><display>(e)</display><subsection ssid="8-8-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Industrial user" means a secondary water user that manufactures or produces <ln numlevel="1" lineno="225" slineno="4-27"/>materials.</subsection><subsection ssid="8-8-20" dnum="ii-o" numlevel="1" lineno="226" slineno="4-28" level="3"><display>(ii)</display>"Industrial user" includes a manufacturing plant, an oil and gas producer, and a <ln numlevel="1" lineno="227" slineno="4-29"/>mining company.</subsection></subsection><subsection ssid="8-8-21" dnum="f-o" numlevel="1" lineno="228" slineno="4-30" level="2" space="false"><display>(f)</display><subsection ssid="8-8-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Institutional user" means a secondary water user that is dedicated to public <ln numlevel="1" lineno="229" slineno="4-31"/>service, regardless of ownership.</subsection><subsection ssid="8-8-23" dnum="ii-o" numlevel="1" lineno="230" slineno="4-32" level="3"><display>(ii)</display>"Institutional user" includes a school, church, hospital, park, golf course, and <ln numlevel="1" lineno="231" slineno="4-33"/>government facility.</subsection></subsection><subsection ssid="8-8-24" dnum="g-o" numlevel="1" lineno="232" slineno="4-34" level="2"><display>(g)</display>"Power generation use" means water used in the production of energy, such as use in <ln numlevel="1" lineno="233" slineno="4-35"/>an electric generation facility, natural gas refinery, or coal processing plant.</subsection><subsection ssid="8-8-25" dnum="h-o" numlevel="1" lineno="234" slineno="4-36" level="2" space="false"><display>(h)</display><subsection ssid="8-8-26" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Residential user" means a secondary water user in a residence.</subsection><subsection ssid="8-8-27" dnum="ii-o" numlevel="1" lineno="235" slineno="4-37" level="3"><display>(ii)</display>"Residential user" includes a single-family or multi-family home, apartment, <ln numlevel="1" lineno="236" slineno="4-38"/>duplex, twin home, condominium, or planned community.</subsection></subsection><subsection ssid="8-8-28" dnum="i-o" numlevel="1" lineno="237" slineno="4-39" level="2"><display>(i)</display>"Secondary water" means water that is:<subsection ssid="8-8-29" dnum="i-o" numlevel="1" lineno="238" slineno="4-40" level="3"><display>(i)</display>not culinary or water used on land assessed under Title 59, Chapter 2, Part 5, <ln numlevel="1" lineno="239" slineno="4-41"/>Farmland Assessment Act; and</subsection><subsection ssid="8-8-30" dnum="ii-o" numlevel="1" lineno="240" slineno="4-42" level="3"><display>(ii)</display>delivered to and used by an end user for the irrigation of landscaping or a garden.</subsection></subsection><subsection ssid="8-8-31" dnum="j-o" numlevel="1" lineno="241" slineno="4-43" level="2"><display>(j)</display>"Secondary water connection" means the location at which the water leaves the <ln numlevel="1" lineno="242" slineno="4-44"/>secondary water supplier's pipeline and enters into the remainder of the pipes that are <ln numlevel="1" lineno="243" slineno="4-45"/>owned by another person to supply water to an end user.</subsection><subsection ssid="8-8-32" dnum="k-o" numlevel="1" lineno="244" slineno="4-46" level="2"><display>(k)</display>"Secondary water supplier" means an entity that supplies pressurized secondary <ln numlevel="1" lineno="245" slineno="4-47"/>water.</subsection><subsection ssid="8-8-33" dnum="l-o" numlevel="1" lineno="246" slineno="4-48" level="2"><display>(l)</display>"Small secondary water retail supplier" means an entity that:<subsection ssid="8-8-34" dnum="i-o" numlevel="1" lineno="247" slineno="4-49" level="3"><display>(i)</display>supplies pressurized secondary water only to the end user of the secondary water; <ln numlevel="1" lineno="248" slineno="4-50"/>and</subsection><subsection ssid="8-8-35" dnum="ii-o" numlevel="1" lineno="249" slineno="4-51" level="3" space="false"><display>(ii)</display><subsection ssid="8-8-36" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is a city or town; or</subsection><subsection ssid="8-8-37" dnum="B-o" numlevel="1" lineno="250" slineno="4-52" level="4"><display>(B)</display>supplies 5,000 or fewer secondary water connections.</subsection></subsection></subsection></subsection><subsection ssid="8-8-38" dnum="2-o" numlevel="1" lineno="251" slineno="4-53" level="1" space="false"><display>(2)</display><subsection ssid="8-8-39" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-8-40" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A secondary water supplier that supplies secondary water within a county of <ln numlevel="1" lineno="252" slineno="4-54"/>the first or second class and begins design work for new service on or after April <ln numlevel="1" lineno="253" slineno="4-55"/>1, 2020, to a commercial, industrial, institutional, or residential user shall meter <ln numlevel="1" lineno="254" slineno="4-56"/>the use of pressurized secondary water by the users receiving that new service.</subsection><subsection ssid="8-8-41" dnum="ii-o" numlevel="1" lineno="255" slineno="4-57" level="3" tab="1"><display>(ii)</display>A secondary water supplier that supplies secondary water within a county of the <ln numlevel="1" lineno="256" slineno="4-58"/>third, fourth, fifth, or sixth class and begins design work for new service on or <ln numlevel="1" lineno="257" slineno="4-59"/>after May 4, 2022, to a commercial, industrial, institutional, or residential user <ln numlevel="1" lineno="258" slineno="4-60"/>shall meter the use of pressurized secondary water by the users receiving that new <ln numlevel="1" lineno="259" slineno="4-61"/>service.</subsection></subsection><subsection ssid="8-8-42" dnum="b-o" numlevel="1" lineno="260" slineno="4-62" level="2"><display>(b)</display>By no later than January 1, 2030, a secondary water supplier shall install and <ln numlevel="1" lineno="261" slineno="4-63"/>maintain a meter of the use of pressurized secondary water by each user receiving <ln numlevel="1" lineno="262" slineno="4-64"/>secondary water service from the secondary water supplier.</subsection><subsection ssid="8-8-43" dnum="c-o" numlevel="1" lineno="263" slineno="4-65" level="2"><display>(c)</display>Beginning January 1, 2022, a secondary water supplier shall establish a meter <ln numlevel="1" lineno="264" slineno="4-66"/>installation reserve for metering installation and replacement projects.</subsection><subsection ssid="8-8-44" dnum="d-o" numlevel="1" lineno="265" slineno="4-67" level="2"><display>(d)</display>A secondary water supplier, including a small secondary water retail supplier, may <ln numlevel="1" lineno="266" slineno="4-68"/>not raise the rates charged for secondary water:<subsection ssid="8-8-45" dnum="i-o" numlevel="1" lineno="267" slineno="4-69" level="3"><display>(i)</display>by more than 10% in a calendar year for costs associated with metering secondary <ln numlevel="1" lineno="268" slineno="4-70"/>water unless the rise in rates is necessary because the secondary water supplier <ln numlevel="1" lineno="269" slineno="4-71"/>experiences a catastrophic failure or other similar event; or</subsection><subsection ssid="8-8-46" dnum="ii-o" numlevel="1" lineno="270" slineno="4-72" level="3"><display>(ii)</display>unless, before raising the rates on the end user, the entity charging the end user <ln numlevel="1" lineno="271" slineno="4-73"/>provides a statement explaining the basis for why the needs of the secondary <ln numlevel="1" lineno="272" slineno="4-74"/>water supplier required an increase in rates.</subsection></subsection><subsection ssid="8-8-47" dnum="e-o" numlevel="1" lineno="273" slineno="4-75" level="2" space="false"><display>(e)</display><subsection ssid="8-8-48" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier that provides pressurized secondary water to a <ln numlevel="1" lineno="274" slineno="4-76"/>commercial, industrial, institutional, or residential user shall develop a plan, or if <ln numlevel="1" lineno="275" slineno="4-77"/>the secondary water supplier previously filed a similar plan, update the plan for <ln numlevel="1" lineno="276" slineno="4-78"/>metering the use of the pressurized water.</subsection><subsection ssid="8-8-49" dnum="ii-o" numlevel="1" lineno="277" slineno="4-79" level="3"><display>(ii)</display>The plan required by this Subsection (2)(e) shall be filed or updated with the <ln numlevel="1" lineno="278" slineno="4-80"/>Division of Water Resources by no later than December 31, 2025, and address the <ln numlevel="1" lineno="279" slineno="4-81"/>process the secondary water supplier will follow to implement metering, including:<subsection ssid="8-8-50" dnum="A-o" numlevel="1" lineno="280" slineno="4-82" level="4"><display>(A)</display>the costs of full metering by the secondary water supplier;</subsection><subsection ssid="8-8-51" dnum="B-o" numlevel="1" lineno="281" slineno="4-83" level="4"><display>(B)</display>how long it would take the secondary water supplier to complete full <ln numlevel="1" lineno="282" slineno="4-84"/>metering, including an anticipated beginning date and completion date, except <ln numlevel="1" lineno="283" slineno="4-85"/>a secondary water supplier shall achieve full metering by no later than January <ln numlevel="1" lineno="284" slineno="4-86"/>1, 2030; and</subsection><subsection ssid="8-8-52" dnum="C-o" numlevel="1" lineno="285" slineno="4-87" level="4"><display>(C)</display>how the secondary water supplier will finance metering.</subsection></subsection></subsection></subsection><subsection ssid="8-8-53" dnum="3-o" numlevel="1" lineno="286" slineno="4-88" level="1"><display>(3)</display>A secondary water supplier shall on or before March 31 of each year, report to the <ln numlevel="1" lineno="287" slineno="4-89"/>Division of Water Rights:<subsection ssid="8-8-54" dnum="a-o" numlevel="1" lineno="288" slineno="4-90" level="2"><display>(a)</display>for commercial, industrial, institutional, and residential users whose pressurized <ln numlevel="1" lineno="289" slineno="4-91"/>secondary water use is metered, the number of acre feet of pressurized secondary <ln numlevel="1" lineno="290" slineno="4-92"/>water the secondary water supplier supplied to the commercial, industrial, <ln numlevel="1" lineno="291" slineno="4-93"/>institutional, and residential users during the preceding 12-month period;</subsection><subsection ssid="8-8-55" dnum="b-o" numlevel="1" lineno="292" slineno="4-94" level="2"><display>(b)</display>the number of secondary water meters within the secondary water supplier's service <ln numlevel="1" lineno="293" slineno="4-95"/>boundary;</subsection><subsection ssid="8-8-56" dnum="c-o" numlevel="1" lineno="294" slineno="4-96" level="2"><display>(c)</display>a description of the secondary water supplier's service boundary;</subsection><subsection ssid="8-8-57" dnum="d-o" numlevel="1" lineno="295" slineno="4-97" level="2"><display>(d)</display>the number of secondary water connections in each of the following categories <ln numlevel="1" lineno="296" slineno="4-98"/>through which the secondary water supplier supplies pressurized secondary water:<subsection ssid="8-8-58" dnum="i-o" numlevel="1" lineno="297" slineno="4-99" level="3"><display>(i)</display>commercial;</subsection><subsection ssid="8-8-59" dnum="ii-o" numlevel="1" lineno="298" slineno="4-100" level="3"><display>(ii)</display>industrial;</subsection><subsection ssid="8-8-60" dnum="iii-o" numlevel="1" lineno="299" slineno="4-101" level="3"><display>(iii)</display>institutional; and</subsection><subsection ssid="8-8-61" dnum="iv-o" numlevel="1" lineno="300" slineno="4-102" level="3"><display>(iv)</display>residential;</subsection></subsection><subsection ssid="8-8-62" dnum="e-o" numlevel="1" lineno="301" slineno="4-103" level="2"><display>(e)</display>the total volume of water that the secondary water supplier receives from the <ln numlevel="1" lineno="302" slineno="4-104"/>secondary water supplier's sources; and</subsection><subsection ssid="8-8-63" dnum="f-o" numlevel="1" lineno="303" slineno="4-105" level="2"><display>(f)</display>the dates of service during the preceding 12-month period in which the secondary <ln numlevel="1" lineno="304" slineno="4-106"/>water supplier supplied pressurized secondary water.</subsection></subsection><subsection ssid="8-8-64" dnum="4-o" numlevel="1" lineno="305" slineno="4-107" level="1" space="false"><display>(4)</display><subsection ssid="8-8-65" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2019, the Board of Water Resources may make up to <ln numlevel="1" lineno="306" slineno="4-108"/>$10,000,000 in low-interest loans available each year:<subsection ssid="8-8-66" dnum="i-o" numlevel="1" lineno="307" slineno="4-109" level="3" tab="1"><display>(i)</display>from the Water Resources Conservation and Development Fund, created in <ln numlevel="1" lineno="308" slineno="4-110"/>Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>; and</subsection><subsection ssid="8-8-67" dnum="ii-o" numlevel="1" lineno="309" slineno="4-111" level="3" tab="1"><display>(ii)</display>for financing the cost of secondary water metering.</subsection></subsection><subsection ssid="8-8-68" dnum="b-o" numlevel="1" lineno="310" slineno="4-112" level="2"><display>(b)</display>The Division of Water Resources and the Board of Water Resources shall make rules <ln numlevel="1" lineno="311" slineno="4-113"/>in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="312" slineno="4-114"/>establishing the criteria and process for receiving a loan described in this Subsection <ln numlevel="1" lineno="313" slineno="4-115"/>(4), except the rules may not include prepayment penalties.</subsection></subsection><subsection ssid="8-8-69" dnum="5-o" numlevel="1" lineno="314" slineno="4-116" level="1" space="false"><display>(5)</display><subsection ssid="8-8-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2021, subject to appropriation, the Division of Water Resources <ln numlevel="1" lineno="315" slineno="4-117"/>may make matching grants each year for financing the cost of secondary water <ln numlevel="1" lineno="316" slineno="4-118"/>metering for a commercial, industrial, institutional, or residential user by a small <ln numlevel="1" lineno="317" slineno="4-119"/>secondary water retail supplier that:<subsection ssid="8-8-71" dnum="i-o" numlevel="1" lineno="318" slineno="4-120" level="3" tab="1"><display>(i)</display>is not for new service described in Subsection (2)(a); and</subsection><subsection ssid="8-8-72" dnum="ii-o" numlevel="1" lineno="319" slineno="4-121" level="3" tab="1"><display>(ii)</display>matches the amount of the grant.</subsection></subsection><subsection ssid="8-8-73" dnum="b-o" numlevel="1" lineno="320" slineno="4-122" level="2"><display>(b)</display>For purposes of issuing grants under this section, the division shall prioritize the <ln numlevel="1" lineno="321" slineno="4-123"/>small secondary water retail suppliers that can demonstrate the greatest need or <ln numlevel="1" lineno="322" slineno="4-124"/>greatest inability to pay the entire cost of installing secondary water meters.</subsection><subsection ssid="8-8-74" dnum="c-o" numlevel="1" lineno="323" slineno="4-125" level="2"><display>(c)</display>The amount of a grant under this Subsection (5) may not:<subsection ssid="8-8-75" dnum="i-o" numlevel="1" lineno="324" slineno="4-126" level="3"><display>(i)</display>exceed 50% of the small secondary water retail supplier's cost of installing <ln numlevel="1" lineno="325" slineno="4-127"/>secondary water meters; or</subsection><subsection ssid="8-8-76" dnum="ii-o" numlevel="1" lineno="326" slineno="4-128" level="3"><display>(ii)</display>supplant federal, state, or local money previously allocated to pay the small <ln numlevel="1" lineno="327" slineno="4-129"/>secondary water retail supplier's cost of installing secondary water meters.</subsection></subsection><subsection ssid="8-8-77" dnum="d-o" numlevel="1" lineno="328" slineno="4-130" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="329" slineno="4-131"/>Board of Water Resources shall make rules establishing:<subsection ssid="8-8-78" dnum="i-o" numlevel="1" lineno="330" slineno="4-132" level="3"><display>(i)</display>the procedure for applying for a grant under this Subsection (5); and</subsection><subsection ssid="8-8-79" dnum="ii-o" numlevel="1" lineno="331" slineno="4-133" level="3"><display>(ii)</display>how a small secondary water retail supplier can establish that the small secondary <ln numlevel="1" lineno="332" slineno="4-134"/>water retail supplier meets the eligibility requirements of this Subsection (5).</subsection></subsection></subsection><subsection ssid="8-8-80" dnum="6-o" numlevel="1" lineno="333" slineno="4-135" level="1"><display>(6)</display>Nothing in this section affects a water right holder's obligation to measure and report <ln numlevel="1" lineno="334" slineno="4-136"/>water usage as described in Sections <xref depth="3" refnumber="73-5-4">73-5-4</xref> and <xref depth="3" refnumber="73-5-8">73-5-8</xref>.</subsection><subsection ssid="8-8-81" dnum="7-o" numlevel="1" lineno="335" slineno="4-137" level="1"><display>(7)</display>If a secondary water supplier fails to comply with Subsection (2)(b), the secondary <ln numlevel="1" lineno="336" slineno="4-138"/>water supplier:<subsection ssid="8-8-82" dnum="a-o" numlevel="1" lineno="337" slineno="4-139" level="2"><display>(a)</display>beginning January 1, 2030, may not receive state money for water related purposes <ln numlevel="1" lineno="338" slineno="4-140"/>until the secondary water supplier completes full metering; and</subsection><subsection ssid="8-8-83" dnum="b-o" numlevel="1" lineno="339" slineno="4-141" level="2"><display>(b)</display>is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="340" slineno="4-142"/>Subsection (8).</subsection></subsection><subsection ssid="8-8-84" dnum="8-o" numlevel="1" lineno="341" slineno="4-143" level="1" space="false"><display>(8)</display><subsection ssid="8-8-85" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-8-86" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The state engineer shall commence an enforcement action under this <ln numlevel="1" lineno="342" slineno="4-144"/>Subsection (8) if the state engineer receives a referral from the director of the <ln numlevel="1" lineno="343" slineno="4-145"/>Division of Water Resources.</subsection><subsection ssid="8-8-87" dnum="ii-o" numlevel="1" lineno="344" slineno="4-146" level="3" tab="1"><display>(ii)</display>The director of the Division of Water Resources shall submit a referral to the state <ln numlevel="1" lineno="345" slineno="4-147"/>engineer if the director:<subsection ssid="8-8-88" dnum="A-o" numlevel="1" lineno="346" slineno="4-148" level="4"><display>(A)</display>finds that a secondary water supplier fails to fully meter secondary water as <ln numlevel="1" lineno="347" slineno="4-149"/>required by this section; and</subsection><subsection ssid="8-8-89" dnum="B-o" numlevel="1" lineno="348" slineno="4-150" level="4"><display>(B)</display>determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="349" slineno="4-151"/>resource in the state.</subsection></subsection></subsection><subsection ssid="8-8-90" dnum="b-o" numlevel="1" lineno="350" slineno="4-152" level="2"><display>(b)</display>To commence an enforcement action under this Subsection (8), the state engineer <ln numlevel="1" lineno="351" slineno="4-153"/>shall issue a notice of violation that includes notice of the administrative fine to <ln numlevel="1" lineno="352" slineno="4-154"/>which a secondary water supplier is subject.</subsection><subsection ssid="8-8-91" dnum="c-o" numlevel="1" lineno="353" slineno="4-155" level="2"><display>(c)</display>The state engineer's issuance and enforcement of a notice of violation is exempt from <ln numlevel="1" lineno="354" slineno="4-156"/>Title 63G, Chapter 4, Administrative Procedures Act.</subsection><subsection ssid="8-8-92" dnum="d-o" numlevel="1" lineno="355" slineno="4-157" level="2"><display>(d)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="356" slineno="4-158"/>state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="357" slineno="4-159"/>includes:<subsection ssid="8-8-93" dnum="i-o" numlevel="1" lineno="358" slineno="4-160" level="3"><display>(i)</display>provisions consistent with this Subsection (8) for enforcement of the notice if a <ln numlevel="1" lineno="359" slineno="4-161"/>secondary water supplier to whom a notice is issued fails to respond to the notice <ln numlevel="1" lineno="360" slineno="4-162"/>or abate the violation;</subsection><subsection ssid="8-8-94" dnum="ii-o" numlevel="1" lineno="361" slineno="4-163" level="3"><display>(ii)</display>the right to a hearing, upon request by a secondary water supplier against whom <ln numlevel="1" lineno="362" slineno="4-164"/>the notice is issued; and</subsection><subsection ssid="8-8-95" dnum="iii-o" numlevel="1" lineno="363" slineno="4-165" level="3"><display>(iii)</display>provisions for timely issuance of a final order after the secondary water supplier <ln numlevel="1" lineno="364" slineno="4-166"/>to whom the notice is issued fails to respond to the notice or abate the violation, or <ln numlevel="1" lineno="365" slineno="4-167"/>after a hearing held under Subsection (8)(d)(ii).</subsection></subsection><subsection ssid="8-8-96" dnum="e-o" numlevel="1" lineno="366" slineno="4-168" level="2"><display>(e)</display>A person may not intervene in an enforcement action commenced under this section.</subsection><subsection ssid="8-8-97" dnum="f-o" numlevel="1" lineno="367" slineno="4-169" level="2"><display>(f)</display>After issuance of a final order under rules made pursuant to Subsection (8)(d), the <ln numlevel="1" lineno="368" slineno="4-170"/>state engineer shall serve a copy of the final order on the secondary water supplier <ln numlevel="1" lineno="369" slineno="4-171"/>against whom the order is issued by:<subsection ssid="8-8-98" dnum="i-o" numlevel="1" lineno="370" slineno="4-172" level="3"><display>(i)</display>personal service under Utah Rules of Civil Procedure, Rule 5; or</subsection><subsection ssid="8-8-99" dnum="ii-o" numlevel="1" lineno="371" slineno="4-173" level="3"><display>(ii)</display>certified mail.</subsection></subsection><subsection ssid="8-8-100" dnum="g-o" numlevel="1" lineno="372" slineno="4-174" level="2" space="false"><display>(g)</display><subsection ssid="8-8-101" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state engineer's final order may be reviewed by trial de novo by the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="214" groupid="167" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="373" slineno="4-175"/>district </amend><amendoutend style="2"/>court <amend anum="0" ea="amend" pairid="213" groupid="166" style="1" owner="jchristopherson" level="1" amendtag="both">with jurisdiction </amend>in Salt Lake County or the county where the <ln numlevel="1" lineno="374" slineno="4-176"/>violation occurred.</subsection><subsection ssid="8-8-102" dnum="ii-o" numlevel="1" lineno="375" slineno="4-177" level="3"><display>(ii)</display>A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="376" slineno="4-178"/>engineer's final order issued under this section within 20 days from the day on <ln numlevel="1" lineno="377" slineno="4-179"/>which the final order was served on the secondary water supplier.</subsection></subsection><subsection ssid="8-8-103" dnum="h-o" numlevel="1" lineno="378" slineno="4-180" level="2"><display>(h)</display>The state engineer may bring suit in a court of competent jurisdiction to enforce a <ln numlevel="1" lineno="379" slineno="4-181"/>final order issued under this Subsection (8).</subsection><subsection ssid="8-8-104" dnum="i-o" numlevel="1" lineno="380" slineno="4-182" level="2"><display>(i)</display>If the state engineer prevails in an action brought under Subsection (8)(g) or (h), the <ln numlevel="1" lineno="381" slineno="4-183"/>state may recover court costs and a reasonable attorney fee.</subsection><subsection ssid="8-8-105" dnum="j-o" numlevel="1" lineno="382" slineno="4-184" level="2"><display>(j)</display>As part of a final order issued under this Subsection (8), the state engineer shall order <ln numlevel="1" lineno="383" slineno="4-185"/>that a secondary water supplier to whom an order is issued pay an administrative fine <ln numlevel="1" lineno="384" slineno="4-186"/>equal to:<subsection ssid="8-8-106" dnum="i-o" numlevel="1" lineno="385" slineno="4-187" level="3"><display>(i)</display>$10 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="386" slineno="4-188"/>supplier for failure to comply with full metering by January 1, 2030;</subsection><subsection ssid="8-8-107" dnum="ii-o" numlevel="1" lineno="387" slineno="4-189" level="3"><display>(ii)</display>$20 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="388" slineno="4-190"/>supplier for failure to comply with full metering by January 1, 2031;</subsection><subsection ssid="8-8-108" dnum="iii-o" numlevel="1" lineno="389" slineno="4-191" level="3"><display>(iii)</display>$30 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="390" slineno="4-192"/>supplier for failure to comply with full metering by January 1, 2032;</subsection><subsection ssid="8-8-109" dnum="iv-o" numlevel="1" lineno="391" slineno="4-193" level="3"><display>(iv)</display>$40 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="392" slineno="4-194"/>supplier for failure to comply with full metering by January 1, 2033; and</subsection><subsection ssid="8-8-110" dnum="v-o" numlevel="1" lineno="393" slineno="4-195" level="3"><display>(v)</display>$50 for each non-metered secondary water connection of the secondary water <ln numlevel="1" lineno="394" slineno="4-196"/>supplier for failure to comply with full metering by January 1, 2034, and for each <ln numlevel="1" lineno="395" slineno="4-197"/>subsequent year the secondary water supplier fails to comply with full metering.</subsection></subsection><subsection ssid="8-8-111" dnum="k-o" numlevel="1" lineno="396" slineno="4-198" level="2"><display>(k)</display>Money collected under this Subsection (8) shall be deposited into the Water <ln numlevel="1" lineno="397" slineno="4-199"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</subsection></subsection><subsection ssid="8-8-112" dnum="9-o" numlevel="1" lineno="398" slineno="4-200" level="1"><display>(9)</display>A secondary water supplier located within a county of the fifth or sixth class is exempt <ln numlevel="1" lineno="399" slineno="4-201"/>from Subsections (2)(a), (2)(b), (2)(c), (2)(e), (7), and (8) if:<subsection ssid="8-8-113" dnum="a-o" numlevel="1" lineno="400" slineno="4-202" level="2"><display>(a)</display>the owner or operator of the secondary water supplier seeks an exemption under this <ln numlevel="1" lineno="401" slineno="4-203"/>Subsection (9) by establishing with the Division of Water Resources that the cost of <ln numlevel="1" lineno="402" slineno="4-204"/>purchasing, installing, and upgrading systems to accept meters exceeds 25% of the <ln numlevel="1" lineno="403" slineno="4-205"/>total operating budget of the owner or operator of the secondary water supplier;</subsection><subsection ssid="8-8-114" dnum="b-o" numlevel="1" lineno="404" slineno="4-206" level="2"><display>(b)</display>the secondary water supplier agrees to not add a new secondary water connection to <ln numlevel="1" lineno="405" slineno="4-207"/>the secondary water supplier's system on or after May 4, 2022;</subsection><subsection ssid="8-8-115" dnum="c-o" numlevel="1" lineno="406" slineno="4-208" level="2"><display>(c)</display>within six months of  when the secondary water supplier seeks an exemption under <ln numlevel="1" lineno="407" slineno="4-209"/>Subsection (9)(a), the secondary water supplier provides to the Division of Water <ln numlevel="1" lineno="408" slineno="4-210"/>Resources a plan for conservation within the secondary water supplier's service area <ln numlevel="1" lineno="409" slineno="4-211"/>that does not require metering;</subsection><subsection ssid="8-8-116" dnum="d-o" numlevel="1" lineno="410" slineno="4-212" level="2"><display>(d)</display>the secondary water supplier annually reports to the Division of Water Resources on <ln numlevel="1" lineno="411" slineno="4-213"/>the results of the plan described in Subsection (9)(c); and</subsection><subsection ssid="8-8-117" dnum="e-o" numlevel="1" lineno="412" slineno="4-214" level="2"><display>(e)</display>the secondary water supplier submits to evaluations by the Division of Water <ln numlevel="1" lineno="413" slineno="4-215"/>Resources of the effectiveness of the plan described in Subsection (9)(c).</subsection></subsection><subsection ssid="8-8-118" dnum="10-o" numlevel="1" lineno="414" slineno="4-216" level="1"><display>(10)</display>A secondary water supplier is exempt from Subsections (2)(a), (2)(b), (2)(c), (2)(e), <ln numlevel="1" lineno="415" slineno="4-217"/>(7), and (8) to the extent that the secondary water supplier:<subsection ssid="8-8-119" dnum="a-o" numlevel="1" lineno="416" slineno="4-218" level="2"><display>(a)</display>is unable to obtain a meter that a meter manufacturer will warranty because of the <ln numlevel="1" lineno="417" slineno="4-219"/>water quality within a specific location served by the secondary water supplier;</subsection><subsection ssid="8-8-120" dnum="b-o" numlevel="1" lineno="418" slineno="4-220" level="2"><display>(b)</display>submits reasonable proof to the Division of Water Resources that the secondary <ln numlevel="1" lineno="419" slineno="4-221"/>water supplier is unable to obtain a meter as described in Subsection (10)(a);</subsection><subsection ssid="8-8-121" dnum="c-o" numlevel="1" lineno="420" slineno="4-222" level="2"><display>(c)</display>within six months of when the secondary water supplier submits reasonable proof <ln numlevel="1" lineno="421" slineno="4-223"/>under Subsection (10)(b), provides to the Division of Water Resources a plan for <ln numlevel="1" lineno="422" slineno="4-224"/>conservation within the secondary water supplier's service area that does not require <ln numlevel="1" lineno="423" slineno="4-225"/>metering;</subsection><subsection ssid="8-8-122" dnum="d-o" numlevel="1" lineno="424" slineno="4-226" level="2"><display>(d)</display>annually reports to the Division of Water Resources on the results of the plan <ln numlevel="1" lineno="425" slineno="4-227"/>described in Subsection (10)(c); and</subsection><subsection ssid="8-8-123" dnum="e-o" numlevel="1" lineno="426" slineno="4-228" level="2"><display>(e)</display>submits to evaluations by the Division of Water Resources of the effectiveness of the <ln numlevel="1" lineno="427" slineno="4-229"/>plan described in Subsection (10)(c).</subsection></subsection><subsection ssid="8-8-124" dnum="11-o" numlevel="1" lineno="428" slineno="4-230" level="1"><display>(11)</display>A secondary water supplier that is located within a critical management area that is <ln numlevel="1" lineno="429" slineno="4-231"/>subject to a groundwater management plan adopted or amended under Section <xref depth="3" refnumber="73-5-15">73-5-15</xref> <ln numlevel="1" lineno="430" slineno="4-232"/>on or after May 1, 2006, is exempt from Subsections (2)(a), (2)(b), (2)(c), (2)(e), (7), and <ln numlevel="1" lineno="431" slineno="4-233"/>(8).</subsection><subsection ssid="8-8-125" dnum="12-o" numlevel="1" lineno="432" slineno="4-234" level="1"><display>(12)</display>If a secondary water supplier is required to have a water conservation plan under <ln numlevel="1" lineno="433" slineno="4-235"/>Section <xref depth="3" refnumber="73-10-32">73-10-32</xref>, that water conservation plan satisfies the requirements of Subsection <ln numlevel="1" lineno="434" slineno="4-236"/>(9)(c) or (10)(c).</subsection><subsection ssid="8-8-126" dnum="13-o" numlevel="1" lineno="435" slineno="4-237" level="1" space="false"><display>(13)</display><subsection ssid="8-8-127" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding the other provisions of this section and unless exempt under <ln numlevel="1" lineno="436" slineno="4-238"/>Subsection (9), (10), or (11), to comply with this section, a secondary water supplier <ln numlevel="1" lineno="437" slineno="4-239"/>is not required to meter every secondary water connection of the secondary water <ln numlevel="1" lineno="438" slineno="4-240"/>supplier's system, but shall meter at strategic points of the system as approved by the <ln numlevel="1" lineno="439" slineno="4-241"/>state engineer under this Subsection (13) if:<subsection ssid="8-8-128" dnum="i-o" numlevel="1" lineno="440" slineno="4-242" level="3" tab="1"><display>(i)</display>the system has no or minimal storage and relies primarily on stream flow;</subsection><subsection ssid="8-8-129" dnum="ii-o" numlevel="1" lineno="441" slineno="4-243" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="8-8-130" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the majority of secondary water users on the system are associated with <ln numlevel="1" lineno="442" slineno="4-244"/>agriculture use or power generation use; and</subsection><subsection ssid="8-8-131" dnum="B-o" numlevel="1" lineno="443" slineno="4-245" level="4"><display>(B)</display>less than 50% of the secondary water is used by residential secondary water <ln numlevel="1" lineno="444" slineno="4-246"/>users; or</subsection></subsection><subsection ssid="8-8-132" dnum="iii-o" numlevel="1" lineno="445" slineno="4-247" level="3" tab="1"><display>(iii)</display>the system has a mix of pressurized lines and open ditches and:<subsection ssid="8-8-133" dnum="A-o" numlevel="1" lineno="446" slineno="4-248" level="4"><display>(A)</display>1,000 or fewer users if any part of the system is within a critical area; or</subsection><subsection ssid="8-8-134" dnum="B-o" numlevel="1" lineno="447" slineno="4-249" level="4"><display>(B)</display>2,500 or fewer users for a system not described in Subsection (13)(a)(iii)(A).</subsection></subsection></subsection><subsection ssid="8-8-135" dnum="b-o" numlevel="1" lineno="448" slineno="4-250" level="2" space="false"><display>(b)</display><subsection ssid="8-8-136" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A secondary water supplier may obtain the approval by the state engineer of <ln numlevel="1" lineno="449" slineno="4-251"/>strategic points where metering is to occur as required under this Subsection (13) <ln numlevel="1" lineno="450" slineno="4-252"/>by filing an application with the state engineer in the form established by the state <ln numlevel="1" lineno="451" slineno="4-253"/>engineer.</subsection><subsection ssid="8-8-137" dnum="ii-o" numlevel="1" lineno="452" slineno="4-254" level="3"><display>(ii)</display>The state engineer may by rule, made in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="453" slineno="4-255"/>Utah Administrative Rulemaking Act, establish procedures for approving strategic <ln numlevel="1" lineno="454" slineno="4-256"/>points for metering under this Subsection (13).</subsection></subsection></subsection><subsection ssid="8-141" dnum="_-o:14-i" numlevel="1" lineno="455" slineno="4-257" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(14)</amend></display><subsection ssid="8-142" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">A contract entered into or renewed on or after July 1, 2025, between a secondary <ln numlevel="1" lineno="456" slineno="4-258"/>water supplier and an end user shall allow for billing by tiered conservation rates.</amend></subsection><subsection ssid="8-143" dnum="_-o:b-i" numlevel="1" lineno="457" slineno="4-259" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">By no later than April 1, 2030, regardless of whether the secondary water supplier is <ln numlevel="1" lineno="458" slineno="4-260"/>fully metered or has modified existing contracts with end users, a secondary water <ln numlevel="1" lineno="459" slineno="4-261"/>supplier shall enter into a contract with the public water system that serves an end <ln numlevel="1" lineno="460" slineno="4-262"/>user of the secondary water supplier that requires the public water system:</amend><subsection ssid="8-145" dnum="_-o:i-i" numlevel="1" lineno="461" slineno="4-263" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">to bill an account according to usage of secondary water using a tiered <ln numlevel="1" lineno="462" slineno="4-264"/>conservation rate that considers:</amend><subsection ssid="8-146" dnum="_-o:A-i" numlevel="1" lineno="463" slineno="4-265" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">revenue stability;</amend></subsection><subsection ssid="8-147" dnum="_-o:B-i" numlevel="1" lineno="464" slineno="4-266" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="48" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">water conservation; and</amend></subsection><subsection ssid="8-148" dnum="_-o:C-i" numlevel="1" lineno="465" slineno="4-267" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">cost of service; and</amend></subsection></subsection><subsection ssid="8-149" dnum="_-o:ii-i" numlevel="1" lineno="466" slineno="4-268" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">to begin billing an end user using the tiered conservation rate by no later than July <ln numlevel="1" lineno="467" slineno="4-269"/>1, 2030.</amend></subsection></subsection><subsection ssid="8-150" dnum="_-o:c-i" numlevel="1" lineno="468" slineno="4-270" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">By no later than April 1, 2030, a secondary water supplier shall provide an <ln numlevel="1" lineno="469" slineno="4-271"/>educational component for end users as determined by the division by rule made in <ln numlevel="1" lineno="470" slineno="4-272"/>accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, either <ln numlevel="1" lineno="471" slineno="4-273"/>on a monthly statement or by an end user specific Internet portal that provides <ln numlevel="1" lineno="472" slineno="4-274"/>information on the end user's usage more frequently than monthly.</amend></subsection><subsection ssid="8-151" dnum="_-o:d-i" numlevel="1" lineno="473" slineno="4-275" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="50" style="1" owner="jchristopherson" level="1" amendtag="end">A public water system with a contract with a secondary water supplier described in <ln numlevel="1" lineno="474" slineno="4-276"/>Subsection <xref refnumber="73-10-34(14)(b)" depth="4">(14)(b)</xref> shall exchange with the secondary water supplier, for the purpose <ln numlevel="1" lineno="475" slineno="4-277"/>of maintaining accurate records, the following with regard to an end user of the <ln numlevel="1" lineno="476" slineno="4-278"/>secondary water supplier:</amend><subsection ssid="8-152" dnum="_-o:i-i" numlevel="1" lineno="477" slineno="4-279" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">a billing address;</amend></subsection><subsection ssid="8-179" dnum="_-o:ii-i" numlevel="1" lineno="478" slineno="4-280" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="207" groupid="161" style="1" owner="jchristopherson" level="1" amendtag="end">an address where the secondary water is delivered;</amend></subsection><subsection ssid="8-153" dnum="_-o:iii-i" numlevel="1" lineno="479" slineno="4-281" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="end">a parcel identification number; and</amend></subsection><subsection ssid="8-154" dnum="_-o:iv-i" numlevel="1" lineno="480" slineno="4-282" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="end">ownership information.</amend></subsection></subsection><subsection ssid="8-155" dnum="_-o:e-i" numlevel="1" lineno="481" slineno="4-283" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><subsection ssid="8-156" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">If a secondary water supplier violates this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref> on or after April 1, <ln numlevel="1" lineno="482" slineno="4-284"/>2030, the secondary water supplier:</amend><subsection ssid="8-159" dnum="_-o:A-i" numlevel="1" lineno="483" slineno="4-285" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">may not receive state money for water related purposes until the secondary <ln numlevel="1" lineno="484" slineno="4-286"/>water supplier complies with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; and</amend></subsection><subsection ssid="8-158" dnum="_-o:B-i" numlevel="1" lineno="485" slineno="4-287" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">is subject to an enforcement action of the state engineer in accordance with <ln numlevel="1" lineno="486" slineno="4-288"/>this Subsection (14)(e).</amend></subsection></subsection><subsection ssid="8-160" dnum="_-o:ii-i" numlevel="1" lineno="487" slineno="4-289" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="85" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer shall commence an enforcement action under this Subsection <ln numlevel="1" lineno="488" slineno="4-290"/>(14)(e) if the state engineer receives a referral from the director of the Division of <ln numlevel="1" lineno="489" slineno="4-291"/>Water Resources.</amend></subsection><subsection ssid="8-161" dnum="_-o:iii-i" numlevel="1" lineno="490" slineno="4-292" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">The director of the Division of Water Resources shall submit a referral to the <ln numlevel="1" lineno="491" slineno="4-293"/>state engineer if the director:</amend><subsection ssid="8-162" dnum="_-o:A-i" numlevel="1" lineno="492" slineno="4-294" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">finds that a secondary water supplier fails to comply with this Subsection <xref refnumber="73-10-34(14)" depth="4">(14)</xref>; <ln numlevel="1" lineno="493" slineno="4-295"/>and</amend></subsection><subsection ssid="8-163" dnum="_-o:B-i" numlevel="1" lineno="494" slineno="4-296" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">determines an enforcement action is necessary to conserve or protect a water <ln numlevel="1" lineno="495" slineno="4-297"/>resource in the state.</amend></subsection></subsection><subsection ssid="8-164" dnum="_-o:iv-i" numlevel="1" lineno="496" slineno="4-298" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">To commence an enforcement action under this Subsection (14)(e), the state <ln numlevel="1" lineno="497" slineno="4-299"/>engineer shall issue a notice of violation that includes notice of the administrative <ln numlevel="1" lineno="498" slineno="4-300"/>fine described in Subsection <xref tempid="509" depth="4" refnumber="73-10-34(14)(e)(xiii)">(14)(e)(xiii)</xref> to which a secondary water supplier is <ln numlevel="1" lineno="499" slineno="4-301"/>subject.</amend></subsection><subsection ssid="8-165" dnum="_-o:v-i" numlevel="1" lineno="500" slineno="4-302" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer's issuance and enforcement of a notice of violation is exempt <ln numlevel="1" lineno="501" slineno="4-303"/>from Title 63G, Chapter 4, Administrative Procedures Act.</amend></subsection><subsection ssid="8-166" dnum="_-o:vi-i" numlevel="1" lineno="502" slineno="4-304" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="503" slineno="4-305"/>the state engineer shall make rules necessary to enforce a notice of violation, that <ln numlevel="1" lineno="504" anum="0" ea="amend" pairid="1251" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="113" style="1" owner="jchristopherson" level="1" amendtag="end">provisions consistent with this Subsection (14)(e) for enforcement of the <ln numlevel="1" lineno="506" slineno="4-308"/>notice if a secondary water supplier to whom a notice is issued fails to respond <ln numlevel="1" lineno="507" slineno="4-309"/>to the notice or abate the violation;</amend></subsection><subsection ssid="8-168" dnum="_-o:B-i" numlevel="1" lineno="508" slineno="4-310" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1252" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="117" style="1" owner="jchristopherson" level="1" amendtag="end">the right to a hearing, upon request by a secondary water supplier against <ln numlevel="1" lineno="509" slineno="4-311"/>whom the notice is issued; and</amend></subsection><subsection ssid="8-169" dnum="_-o:C-i" numlevel="1" lineno="510" slineno="4-312" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1253" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="121" style="1" owner="jchristopherson" level="1" amendtag="end">provisions for timely issuance of a final order after the secondary water <ln numlevel="1" lineno="511" slineno="4-313"/>supplier to whom the notice is issued fails to respond to the notice or abate the <ln numlevel="1" lineno="512" slineno="4-314"/>violation, or after a hearing held under Subsection (14)(e)(vi)(B).</amend></subsection></subsection><subsection ssid="8-170" dnum="_-o:vii-i" numlevel="1" lineno="513" slineno="4-315" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1254" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="162" groupid="125" style="1" owner="jchristopherson" level="1" amendtag="end">A person may not intervene in an enforcement action commenced under this <ln numlevel="1" lineno="514" slineno="4-316"/>Subsection <xref refnumber="73-10-34(14)(e)" depth="4">(14)(e)</xref>.</amend></subsection><subsection ssid="8-171" dnum="_-o:viii-i" numlevel="1" lineno="515" slineno="4-317" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1255" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="129" style="1" owner="jchristopherson" level="1" amendtag="end">After issuance of a final order under rules made pursuant to Subsection <ln numlevel="1" lineno="516" slineno="4-318"/>(14)(e)(vi), the state engineer shall serve a copy of the final order on the <ln numlevel="1" lineno="517" slineno="4-319"/>secondary water supplier against whom the order is issued by:</amend><subsection ssid="8-172" dnum="_-o:A-i" numlevel="1" lineno="518" slineno="4-320" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1256" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="172" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="end">personal service under Utah Rules of Civil Procedure, Rule 5; or</amend></subsection><subsection ssid="8-173" dnum="_-o:B-i" numlevel="1" lineno="519" slineno="4-321" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="177" groupid="137" style="1" owner="jchristopherson" level="1" amendtag="end">certified mail.</amend></subsection></subsection><subsection ssid="8-174" dnum="_-o:ix-i" numlevel="1" lineno="520" slineno="4-322" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1258" style="1" owner="i" level="1" amendtag="start">(ix)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="141" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer's final order may be reviewed by trial de novo by a court with <ln numlevel="1" lineno="521" slineno="4-323"/>jurisdiction in Salt Lake County or the county where the violation occurred.</amend></subsection><subsection ssid="8-175" dnum="_-o:x-i" numlevel="1" lineno="522" slineno="4-324" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="start">(x)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="145" style="1" owner="jchristopherson" level="1" amendtag="end">A secondary water supplier shall file a petition for judicial review of the state <ln numlevel="1" lineno="523" slineno="4-325"/>engineer's final order issued under this Subsection <xref refnumber="73-10-34(14)(e)" depth="4">(14)(e)</xref> within 20 days from the <ln numlevel="1" lineno="524" slineno="4-326"/>day on which the final order was served on the secondary water supplier.</amend></subsection><subsection ssid="8-176" dnum="_-o:xi-i" numlevel="1" lineno="525" slineno="4-327" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1260" style="1" owner="i" level="1" amendtag="start">(xi)</amend></display><amend anum="0" ea="amend" pairid="192" groupid="149" style="1" owner="jchristopherson" level="1" amendtag="end">The state engineer may bring suit in a court to enforce a final order issued under <ln numlevel="1" lineno="526" slineno="4-328"/>this Subsection (14)(e).</amend></subsection><subsection ssid="8-177" dnum="_-o:xii-i" numlevel="1" lineno="527" slineno="4-329" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1261" style="1" owner="i" level="1" amendtag="start">(xii)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="153" style="1" owner="jchristopherson" level="1" amendtag="end">If the state engineer prevails in an action brought under Subsection (14)(e)(x) or <ln numlevel="1" lineno="528" slineno="4-330"/>(xi), the state may recover court costs and reasonable attorney fees.</amend></subsection><subsection ssid="8-178" dnum="_-o:xiii-i" numlevel="1" lineno="529" slineno="4-331" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1262" style="1" owner="i" level="1" amendtag="start">(xiii)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="157" style="1" owner="jchristopherson" level="1" amendtag="end">The administrative fine imposed under this section shall be an amount not to <ln numlevel="1" lineno="530" slineno="4-332"/>exceed the sum of any money received by the secondary water supplier under this <ln numlevel="1" lineno="531" slineno="4-333"/>section or Section <xref depth="3" refnumber="73-10-34.5">73-10-34.5</xref> to fund costs related to metering.</amend></subsection><subsection ssid="8-181" dnum="_-o:xiv-i" numlevel="1" lineno="532" slineno="4-334" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1263" style="1" owner="i" level="1" amendtag="start">(xiv)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="169" style="1" owner="jchristopherson" level="1" amendtag="end">Money collected under this Subsection (14) shall be deposited into the Water <ln numlevel="1" lineno="533" slineno="4-335"/>Resources Conservation and Development Fund, created in Section <xref depth="3" refnumber="73-10-24">73-10-24</xref>.</amend></subsection></subsection></subsection></section></bsec><bsec buid="33" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="534" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="534">Section 5.  <bold>Effective Date.</bold></secline><sectionText
