Definitions.</bold></catline><sectionText lineno="21"><tab/>As used in this part:</sectionText><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="22" slineno="1-4" level="1"><display>(1)</display>"Administrator" means an individual who supervises educators and holds an appropriate <ln numlevel="1" lineno="23" slineno="1-5"/>license.</subsection><subsection ssid="1-1-2" dnum="2-o" numlevel="1" lineno="24" slineno="1-6" level="1"><display>(2)</display>"Career educator" means a licensed employee who has a reasonable expectation of <ln numlevel="1" lineno="25" slineno="1-7"/>continued employment under the policies of a local school board.</subsection><subsection ssid="1-1-3" dnum="3-o" numlevel="1" lineno="26" slineno="1-8" level="1"><display>(3)</display>"Career employee" means an employee of a school district who has obtained a <ln numlevel="1" lineno="27" slineno="1-9"/>reasonable expectation of continued employment based upon Section <xref depth="3" refnumber="53G-11-503">53G-11-503</xref> and <ln numlevel="1" lineno="28" slineno="1-10"/>an agreement with the employee or the employee's association, district practice, or <ln numlevel="1" lineno="29" slineno="1-11"/>policy.</subsection><subsection ssid="1-1-4" dnum="4-o" numlevel="1" lineno="30" slineno="1-12" level="1"><display>(4)</display>"Chronically absent" means a student who:<subsection ssid="1-1-5" dnum="a-o" numlevel="1" lineno="31" slineno="1-13" level="2"><display>(a)</display>was enrolled in an LEA for at least 60 calendar days; and</subsection><subsection ssid="1-1-6" dnum="b-o" numlevel="1" lineno="32" slineno="1-14" level="2"><display>(b)</display>missed 10% or more days of instruction, whether the absence was excused or not.</subsection></subsection><subsection ssid="1-1-7" dnum="5-o" numlevel="1" lineno="33" slineno="1-15" level="1"><display>(5)</display>"Contract term" or "term of employment" means the period of time during which an <ln numlevel="1" lineno="34" slineno="1-16"/>employee is engaged by the school district under a contract of employment, whether oral <ln numlevel="1" lineno="35" slineno="1-17"/>or written.</subsection><subsection ssid="1-1-8" dnum="6-o" numlevel="1" lineno="36" slineno="1-18" level="1"><display>(6)</display>"Dismissal" or "termination" means:<subsection ssid="1-1-9" dnum="a-o" numlevel="1" lineno="37" slineno="1-19" level="2"><display>(a)</display>termination of the status of employment of an employee;</subsection><subsection ssid="1-1-10" dnum="b-o" numlevel="1" lineno="38" slineno="1-20" level="2"><display>(b)</display>failure to renew or continue the employment contract of a career employee beyond <ln numlevel="1" lineno="39" slineno="1-21"/>the then-current school year;</subsection><subsection ssid="1-1-11" dnum="c-o" numlevel="1" lineno="40" slineno="1-22" level="2"><display>(c)</display>reduction in salary of an employee not generally applied to all employees of the same <ln numlevel="1" lineno="41" slineno="1-23"/>category employed by the school district during the employee's contract term; or</subsection><subsection ssid="1-1-12" dnum="d-o" numlevel="1" lineno="42" slineno="1-24" level="2"><display>(d)</display>change of assignment of an employee with an accompanying reduction in pay, unless <ln numlevel="1" lineno="43" slineno="1-25"/>the assignment change and salary reduction are agreed to in writing.</subsection></subsection><subsection ssid="1-1-13" dnum="7-o" numlevel="1" lineno="44" slineno="1-26" level="1"><display>(7)</display>"Educator" means an individual employed by a school district who is required to hold a <ln numlevel="1" lineno="45" slineno="1-27"/>professional license issued by the state board, except:<subsection ssid="1-1-14" dnum="a-o" numlevel="1" lineno="46" slineno="1-28" level="2"><display>(a)</display>a superintendent; or</subsection><subsection ssid="1-1-15" dnum="b-o" numlevel="1" lineno="47" slineno="1-29" level="2"><display>(b)</display>an individual who works less than three hours per day or is hired for less than half of <ln numlevel="1" lineno="48" slineno="1-30"/>a school year.</subsection></subsection><subsection ssid="1-1-16" dnum="8-o" numlevel="1" lineno="49" slineno="1-31" level="1" space="false"><display>(8)</display><subsection ssid="1-1-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Employee" means a career or provisional employee of a school district, except as <ln numlevel="1" lineno="50" slineno="1-32"/>provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">(7)(b).</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b).</amend></subsection><subsection ssid="1-1-18" dnum="b-o" numlevel="1" lineno="51" slineno="1-33" level="2"><display>(b)</display>Excluding Section <xref depth="3" refnumber="53G-11-518">53G-11-518</xref>, for purposes of this part, "employee" does not <ln numlevel="1" lineno="52" slineno="1-34"/>include:<subsection ssid="1-1-19" dnum="i-o" numlevel="1" lineno="53" slineno="1-35" level="3"><display>(i)</display>a district superintendent or the equivalent at the Utah Schools for the Deaf and the <ln numlevel="1" lineno="54" slineno="1-36"/>Blind;</subsection><subsection ssid="1-1-20" dnum="ii-o" numlevel="1" lineno="55" slineno="1-37" level="3"><display>(ii)</display>a district business administrator or the equivalent at the Utah Schools for the Deaf <ln numlevel="1" lineno="56" slineno="1-38"/>and the Blind; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="1-45" dnum="_-o:iii-i" numlevel="1" lineno="57" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">excluding a school level administrator, a member of a school district's executive <ln numlevel="1" lineno="58" slineno="1-40"/>leadership team or cabinet who:</amend><subsection ssid="1-46" dnum="_-o:A-i" numlevel="1" lineno="59" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">the school district's superintendent supervises, or the equivalent at the Utah <ln numlevel="1" lineno="60" slineno="1-42"/>Schools for the Deaf and the Blind; and</amend></subsection><subsection ssid="1-47" dnum="_-o:B-i" numlevel="1" lineno="61" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">is hired after July 1, 2025; or</amend></subsection></subsection><subsection ssid="1-1-21" dnum="iii-o:iv-i" numlevel="1" lineno="62" slineno="1-44" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>a temporary employee.</subsection></subsection></subsection><subsection ssid="1-1-22" dnum="9-o" numlevel="1" lineno="63" slineno="1-45" level="1"><display>(9)</display>"Formative evaluation" means a planned, ongoing process which allows educators to <ln numlevel="1" lineno="64" slineno="1-46"/>engage in reflection and growth of professional skills as related to the Utah Effective <ln numlevel="1" lineno="65" slineno="1-47"/>Teaching Standards.</subsection><subsection ssid="1-1-23" dnum="10-o" numlevel="1" lineno="66" slineno="1-48" level="1"><display>(10)</display>"Last-hired, first-fired layoff policy" means a staff reduction policy that mandates the <ln numlevel="1" lineno="67" slineno="1-49"/>termination of an employee who started to work for a district most recently before <ln numlevel="1" lineno="68" slineno="1-50"/>terminating a more senior employee.</subsection><subsection ssid="1-1-24" dnum="11-o" numlevel="1" lineno="69" slineno="1-51" level="1"><display>(11)</display>"Provisional educator" means an educator employed by a school district who has not <ln numlevel="1" lineno="70" slineno="1-52"/>achieved status as a career educator within the school district.</subsection><subsection ssid="1-1-25" dnum="12-o" numlevel="1" lineno="71" slineno="1-53" level="1"><display>(12)</display>"Provisional employee" means an individual, other than a career employee or a <ln numlevel="1" lineno="72" slineno="1-54"/>temporary employee, who is employed by a school district.</subsection><subsection ssid="1-1-26" dnum="13-o" numlevel="1" lineno="73" slineno="1-55" level="1"><display>(13)</display>"School board" means a local school board or, for the Utah Schools for the Deaf and <ln numlevel="1" lineno="74" slineno="1-56"/>the Blind, the state board.</subsection><subsection ssid="1-1-27" dnum="14-o" numlevel="1" lineno="75" slineno="1-57" level="1"><display>(14)</display>"School district" or "district" means:<subsection ssid="1-1-28" dnum="a-o" numlevel="1" lineno="76" slineno="1-58" level="2"><display>(a)</display>a public school district; or</subsection><subsection ssid="1-1-29" dnum="b-o" numlevel="1" lineno="77" slineno="1-59" level="2"><display>(b)</display>the Utah Schools for the Deaf and the Blind.</subsection></subsection><subsection ssid="1-1-30" dnum="15-o" numlevel="1" lineno="78" slineno="1-60" level="1"><display>(15)</display>"Summative evaluation" means an evaluation that:<subsection ssid="1-1-31" dnum="a-o" numlevel="1" lineno="79" slineno="1-61" level="2"><display>(a)</display>a supervisor conducts;</subsection><subsection ssid="1-1-32" dnum="b-o" numlevel="1" lineno="80" slineno="1-62" level="2"><display>(b)</display>summarizes an educator's performance during an evaluation cycle; and</subsection><subsection ssid="1-1-33" dnum="c-o" numlevel="1" lineno="81" slineno="1-63" level="2"><display>(c)</display>a supervisor or school district may use to make decisions related to an educator's <ln numlevel="1" lineno="82" slineno="1-64"/>employment.</subsection></subsection><subsection ssid="1-1-34" dnum="16-o" numlevel="1" lineno="83" slineno="1-65" level="1"><display>(16)</display>"Temporary employee" means an individual who is employed on a temporary basis as <ln numlevel="1" lineno="84" slineno="1-66"/>defined by policies adopted by the school board.  If the class of employees in question is <ln numlevel="1" lineno="85" slineno="1-67"/>represented by an employee organization recognized by the school board, the school <ln numlevel="1" lineno="86" slineno="1-68"/>board shall adopt the school board's policies based upon an agreement with that <ln numlevel="1" lineno="87" slineno="1-69"/>organization.  Temporary employees serve at will and have no expectation of continued <ln numlevel="1" lineno="88" slineno="1-70"/>employment.</subsection><subsection ssid="1-1-35" dnum="17-o" numlevel="1" lineno="89" slineno="1-71" level="1" space="false"><display>(17)</display><subsection ssid="1-1-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Unsatisfactory performance" means a deficiency in performing work tasks that <ln numlevel="1" lineno="90" slineno="1-72"/>may be:<subsection ssid="1-1-37" dnum="i-o" numlevel="1" lineno="91" slineno="1-73" level="3" tab="1"><display>(i)</display>due to insufficient or undeveloped skills or a lack of knowledge or aptitude; and</subsection><subsection ssid="1-1-38" dnum="ii-o" numlevel="1" lineno="92" slineno="1-74" level="3" tab="1"><display>(ii)</display>remediated through training, study, mentoring, or practice.</subsection></subsection><subsection ssid="1-1-39" dnum="b-o" numlevel="1" lineno="93" slineno="1-75" level="2"><display>(b)</display>"Unsatisfactory performance" does not include the following conduct that is <ln numlevel="1" lineno="94" slineno="1-76"/>designated as a cause for termination under Section <xref depth="3" refnumber="53G-11-512">53G-11-512</xref> or a reason for <ln numlevel="1" lineno="95" slineno="1-77"/>license discipline by the state board or Utah Professional Practices Advisory <ln numlevel="1" lineno="96" slineno="1-78"/>Commission:<subsection ssid="1-1-40" dnum="i-o" numlevel="1" lineno="97" slineno="1-79" level="3"><display>(i)</display>a violation of work policies;</subsection><subsection ssid="1-1-41" dnum="ii-o" numlevel="1" lineno="98" slineno="1-80" level="3"><display>(ii)</display>a violation of school board policies, state board rules, or law;</subsection><subsection ssid="1-1-42" dnum="iii-o" numlevel="1" lineno="99" slineno="1-81" level="3"><display>(iii)</display>a violation of standards of ethical, moral, or professional conduct; or</subsection><subsection ssid="1-1-43" dnum="iv-o" numlevel="1" lineno="100" slineno="1-82" level="3"><display>(iv)</display>insubordination.</subsection></subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="101" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="101">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="102"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-19-25 3:37 PM</tm></rev></foot></leg>
