Appointment of water commissioners -- Procedure.</bold></catline><subsection ssid="45-null-37" dnum="1-o" numlevel="1" lineno="56" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="45-null-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If, in the judgment of the state engineer or the district court, it is necessary to <ln numlevel="1" lineno="57" slineno="2-4"/>appoint a water commissioner for the distribution of water from any river system or <ln numlevel="1" lineno="58" slineno="2-5"/>water source, the commissioner shall be appointed for a four-year term by the state <ln numlevel="1" lineno="59" slineno="2-6"/>engineer.</subsection><subsection ssid="45-null-39" dnum="b-o" numlevel="1" lineno="60" slineno="2-7" level="2"><display>(b)</display>The state engineer shall determine whether all or a part of a river system or other <ln numlevel="1" lineno="61" slineno="2-8"/>water source shall be served by a commissioner, and if only a part is to be served, the <ln numlevel="1" lineno="62" slineno="2-9"/>state engineer shall determine the boundaries of that part.</subsection><subsection ssid="45-null-40" dnum="c-o" numlevel="1" lineno="63" slineno="2-10" level="2"><display>(c)</display>The state engineer may appoint:<subsection ssid="45-null-41" dnum="i-o" numlevel="1" lineno="64" slineno="2-11" level="3"><display>(i)</display>more than one commissioner to distribute water from all or a part of a water <ln numlevel="1" lineno="65" slineno="2-12"/>source; or</subsection><subsection ssid="45-null-42" dnum="ii-o" numlevel="1" lineno="66" slineno="2-13" level="3"><display>(ii)</display>a single commissioner to distribute water from several separate and distinct water <ln numlevel="1" lineno="67" slineno="2-14"/>sources.</subsection></subsection><subsection ssid="45-null-43" dnum="d-o" numlevel="1" lineno="68" slineno="2-15" level="2"><display>(d)</display>A water commissioner appointed by the state engineer under this section is:<subsection ssid="45-null-44" dnum="i-o" numlevel="1" lineno="69" slineno="2-16" level="3"><display>(i)</display>an employee of the Division of Water Rights;</subsection><subsection ssid="45-null-45" dnum="_-o:ii-i" numlevel="1" lineno="70" slineno="2-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">an appointed officer under Subsection <xref tempid="553" depth="4" refnumber="49-13-102(5)(b)(iii)">49-13-102(5)(b)(iii)</xref>, if the water <ln numlevel="1" lineno="71" slineno="2-18"/>commissioner meets the requirements for a regular full-time employee under <ln numlevel="1" lineno="72" slineno="2-19"/>Subsection <xref tempid="624" depth="4" refnumber="49-13-102(5)(a)">49-13-102(5)(a)</xref>;</amend></subsection><subsection ssid="45-null-46" dnum="_-o:iii-i" numlevel="1" lineno="73" slineno="2-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">eligible for health and retirement benefits as determined by the water <ln numlevel="1" lineno="74" slineno="2-21"/>commissioner's distribution system committee, if the water commissioner is a <ln numlevel="1" lineno="75" slineno="2-22"/>regular full-time employee as that term is defined in Section <xref depth="3" refnumber="49-13-102">49-13-102</xref>; and</amend></subsection><subsection ssid="45-null-47" dnum="_-o:iv-i" numlevel="1" lineno="76" slineno="2-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">exempt from Title 63A, Chapter 17, Utah State Personnel Management Act.</amend></subsection><subsection ssid="45-null-48" dnum="ii-o:_-i" numlevel="1" lineno="77" slineno="2-24" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="38" groupid="22" style="2" owner="jchristopherson" level="1" deltag="end">career service exempt under Subsection <xref depth="4" refnumber="63A-17-301(1)(k)" start="0">63A-17-301(1)(k)</xref>; and</amend><amendoutend style="2"/></subsection><subsection ssid="45-null-49" dnum="iii-o:_-i" numlevel="1" lineno="78" slineno="2-25" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="43" groupid="24" style="2" owner="jchristopherson" level="1" deltag="end">exempt under Subsection <xref depth="4" refnumber="63A-17-307(2)(f)" start="0">63A-17-307(2)(f)</xref> from the classified service <ln numlevel="1" lineno="79" slineno="2-26"/>provisions of Section <xref depth="3" refnumber="63A-17-307" start="0">63A-17-307</xref>.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="45-null-50" dnum="2-o" numlevel="1" lineno="80" slineno="2-27" level="1" space="false"><display>(2)</display><subsection ssid="45-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state engineer shall consult with the water users before appointing a <ln numlevel="1" lineno="81" slineno="2-28"/>commissioner.  The form of consultation and notice to be given shall be determined <ln numlevel="1" lineno="82" slineno="2-29"/>by the state engineer so as to best suit local conditions, while providing for full <ln numlevel="1" lineno="83" slineno="2-30"/>expression of majority opinion.</subsection><subsection ssid="45-null-52" dnum="b-o" numlevel="1" lineno="84" slineno="2-31" level="2"><display>(b)</display>The state engineer shall act in accordance with the recommendation of a majority of <ln numlevel="1" lineno="85" slineno="2-32"/>the water users, if the majority of the water users:<subsection ssid="45-null-53" dnum="i-o" numlevel="1" lineno="86" slineno="2-33" level="3"><display>(i)</display>agree upon:<subsection ssid="45-null-54" dnum="A-o" numlevel="1" lineno="87" slineno="2-34" level="4"><display>(A)</display>a qualified individual to be appointed as a water commissioner;</subsection><subsection ssid="45-null-55" dnum="B-o" numlevel="1" lineno="88" slineno="2-35" level="4"><display>(B)</display>the duties the individual shall perform; and</subsection><subsection ssid="45-null-56" dnum="C-o" numlevel="1" lineno="89" slineno="2-36" level="4"><display>(C)</display>subject to the requirements of <xref depth="0" refnumber="49" start="0">Title 49, Utah State Retirement and Insurance <ln numlevel="1" lineno="90" slineno="2-37"/>Benefit Act</xref>, the compensation the individual shall receive; and</subsection></subsection><subsection ssid="45-null-57" dnum="ii-o" numlevel="1" lineno="91" slineno="2-38" level="3"><display>(ii)</display>submit a recommendation to the state engineer on the items described in <ln numlevel="1" lineno="92" slineno="2-39"/>Subsection <xref depth="4" refnumber="73-5-1(2)(b)(i)" start="0">(2)(b)(i)</xref>.</subsection></subsection><subsection ssid="45-null-58" dnum="c-o" numlevel="1" lineno="93" slineno="2-40" level="2"><display>(c)</display>If a majority of water users do not agree on the appointment, duties, or <ln numlevel="1" lineno="94" slineno="2-41"/>compensation, the state engineer shall make a determination for them.</subsection></subsection><subsection ssid="45-null-59" dnum="3-o" numlevel="1" lineno="95" slineno="2-42" level="1" space="false"><display>(3)</display><subsection ssid="45-null-60" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="45-null-61" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The salary and expenses of the commissioner and all other expenses of <ln numlevel="1" lineno="96" slineno="2-43"/>distribution, including printing,  postage, equipment, water users' expenses, and <ln numlevel="1" lineno="97" slineno="2-44"/>any other expenses considered necessary by the state engineer, shall be borne pro <ln numlevel="1" lineno="98" slineno="2-45"/>rata by the users of water from the river system or water source in accordance <ln numlevel="1" lineno="99" slineno="2-46"/>with a schedule to be fixed by the state engineer.</subsection><subsection ssid="45-null-62" dnum="ii-o" numlevel="1" lineno="100" slineno="2-47" level="3" tab="1"><display>(ii)</display>The schedule shall be based on the established rights of each water user, and the <ln numlevel="1" lineno="101" slineno="2-48"/>pro rata share shall be paid by each water user to the state engineer on or before <ln numlevel="1" lineno="102" slineno="2-49"/>May 1 of each year.</subsection></subsection><subsection ssid="45-null-63" dnum="b-o" numlevel="1" lineno="103" slineno="2-50" level="2"><display>(b)</display>The payments shall be deposited in the Water Commissioner Fund created in Section <xref depth="3" refnumber="73-5-1.5" start="0"><ln numlevel="1" lineno="104" slineno="2-51"/>73-5-1.5</xref>.</subsection><subsection ssid="45-null-64" dnum="c-o" numlevel="1" lineno="105" slineno="2-52" level="2"><display>(c)</display>If a water user fails to pay the assessment as provided by Subsection <xref depth="4" refnumber="73-5-1(3)(a)" start="0">(3)(a)</xref>, the state <ln numlevel="1" lineno="106" slineno="2-53"/>engineer may do any or all of the following:<subsection ssid="45-null-65" dnum="i-o" numlevel="1" lineno="107" slineno="2-54" level="3"><display>(i)</display>create a lien upon the water right affected by filing a notice of lien in the office of <ln numlevel="1" lineno="108" slineno="2-55"/>the county recorder in the county where the water is diverted and bring an action <ln numlevel="1" lineno="109" slineno="2-56"/>to enforce the lien;</subsection><subsection ssid="45-null-66" dnum="ii-o" numlevel="1" lineno="110" slineno="2-57" level="3"><display>(ii)</display>forbid the use of water by the delinquent  water user or the delinquent water user's <ln numlevel="1" lineno="111" slineno="2-58"/>successors or assignees, while  the default continues; or</subsection><subsection ssid="45-null-67" dnum="iii-o" numlevel="1" lineno="112" slineno="2-59" level="3"><display>(iii)</display>bring an action in the district court for the unpaid expense and salary.</subsection></subsection><subsection ssid="45-null-68" dnum="d-o" numlevel="1" lineno="113" slineno="2-60" level="2"><display>(d)</display>In any action brought to collect any unpaid assessment or to enforce any lien under <ln numlevel="1" lineno="114" slineno="2-61"/>this section, the delinquent water user shall be liable for the amount of the <ln numlevel="1" lineno="115" slineno="2-62"/>assessment, interest, any penalty, and for all costs of collection, including all court <ln numlevel="1" lineno="116" slineno="2-63"/>costs and a reasonable attorney fee.</subsection></subsection><subsection ssid="45-null-69" dnum="4-o" numlevel="1" lineno="117" slineno="2-64" level="1" space="false"><display>(4)</display><subsection ssid="45-null-70" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A commissioner may be removed by the state engineer for cause.</subsection><subsection ssid="45-null-71" dnum="b-o" numlevel="1" lineno="118" slineno="2-65" level="2"><display>(b)</display>The users of water from any river system or water source may petition the district <ln numlevel="1" lineno="119" slineno="2-66"/>court for the removal of a commissioner and after notice and hearing, the court may <ln numlevel="1" lineno="120" slineno="2-67"/>order the removal of the commissioner and direct the state engineer to appoint a <ln numlevel="1" lineno="121" slineno="2-68"/>successor.</subsection></subsection></section></bsec><bsec buid="28" num="73-10-4" type="amend" src="code" uid="C73-10-S4_2025050720250507" sort="73 10 00040020250507" numlevel="1" lineno="122" slineno="3-1" sn="3"><section number="73-10-4" numlevel="1" lineno="123" slineno="3-2" type="amend"><secline lineno="122">Section 3, Section <bold>73-10-4</bold> is amended to read:</secline><catline lineno="123"><bold>73-10-4. Powers and duties of board.</bold></catline><subsection ssid="28-28-1" dnum="1-o" numlevel="1" lineno="124" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>The board shall have the following powers and duties to:<subsection ssid="28-28-2" dnum="a-o" numlevel="1" lineno="125" slineno="3-4" level="2"><display>(a)</display>authorize studies, investigations, and plans for the full development, use, and <ln numlevel="1" lineno="126" slineno="3-5"/>promotion of the water and power resources of the state, including preliminary <ln numlevel="1" lineno="127" slineno="3-6"/>surveys, stream gauging, examinations, tests, and other estimates either separately or <ln numlevel="1" lineno="128" slineno="3-7"/>in consultation with federal, state and other agencies;</subsection><subsection ssid="28-28-3" dnum="b-o" numlevel="1" lineno="129" slineno="3-8" level="2"><display>(b)</display>enter into contracts subject to the provisions of this chapter for the construction <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">of <ln numlevel="1" lineno="130" slineno="3-9"/>conservation projects</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">or purchase of a project</amend> that in the opinion of the board will <ln numlevel="1" lineno="131" slineno="3-10"/>conserve and use for the best advantage of the people of this state the water and <ln numlevel="1" lineno="132" slineno="3-11"/>power resources of the state, including projects beyond the boundaries of the state of <ln numlevel="1" lineno="133" slineno="3-12"/>Utah located on interstate waters when the benefit of such projects accrues to the <ln numlevel="1" lineno="134" slineno="3-13"/>citizens of the state;</subsection><subsection ssid="28-28-4" dnum="c-o" numlevel="1" lineno="135" slineno="3-14" level="2"><display>(c)</display>sue and be sued in accordance with applicable law;</subsection><subsection ssid="28-16" dnum="_-o:d-i" numlevel="1" lineno="136" slineno="3-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="2" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">enter into a contract that the Utah water agent, appointed under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref>, <ln numlevel="1" lineno="137" slineno="3-16"/>recommends for a water augmentation project under Section <xref depth="3" refnumber="73-10g-703">73-10g-703</xref>;</amend></subsection><subsection ssid="28-28-5" dnum="d-o:e-i" numlevel="1" lineno="138" slineno="3-17" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1050" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>cooperate with the Utah water agent, appointed under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref>, in <ln numlevel="1" lineno="139" slineno="3-18"/>matters affecting interstate compact negotiations and the administration of the <ln numlevel="1" lineno="140" slineno="3-19"/>compacts affecting the waters of interstate rivers, lakes and other sources of supply, <ln numlevel="1" lineno="141" slineno="3-20"/>with the exception of:<subsection ssid="28-28-6" dnum="i-o" numlevel="1" lineno="142" slineno="3-21" level="3"><display>(i)</display>the waters of the Colorado River system that are governed by <xref depth="1" refnumber="63M-14" start="0">Title 63M, Chapter <ln numlevel="1" lineno="143" slineno="3-22"/>14, Colorado River Authority of Utah Act</xref>; or</subsection><subsection ssid="28-28-7" dnum="ii-o" numlevel="1" lineno="144" slineno="3-23" level="3"><display>(ii)</display>state representation under:<subsection ssid="28-28-8" dnum="A-o" numlevel="1" lineno="145" slineno="3-24" level="4"><display>(A)</display>the Bear River Compact as provided in Section <xref depth="3" refnumber="73-16-4">73-16-4</xref>; or</subsection><subsection ssid="28-28-9" dnum="B-o" numlevel="1" lineno="146" slineno="3-25" level="4"><display>(B)</display>the Columbia Interstate Compact as provided in Section <xref depth="3" refnumber="73-19-9">73-19-9</xref>;</subsection></subsection></subsection><subsection ssid="28-28-10" dnum="e-o:f-i" numlevel="1" lineno="147" slineno="3-26" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1055" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>contract with federal and other agencies and with the National Water Resources <ln numlevel="1" lineno="148" slineno="3-27"/>Association and to make studies, investigations and recommendations and do all <ln numlevel="1" lineno="149" slineno="3-28"/>other things on behalf of the state for any purpose that relates to the development, <ln numlevel="1" lineno="150" slineno="3-29"/>conservation, protection and control of the water and power resources of the state;</subsection><subsection ssid="28-28-11" dnum="f-o:g-i" numlevel="1" lineno="151" slineno="3-30" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>consult and advise with the Utah Water Users' Association and other organized <ln numlevel="1" lineno="152" slineno="3-31"/>water users' associations in the state;</subsection><subsection ssid="28-28-12" dnum="g-o:h-i" numlevel="1" lineno="153" slineno="3-32" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1057" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="both" space="true">(h)</amend></display>consider and make recommendations on behalf of the state of reclamation <ln numlevel="1" lineno="154" slineno="3-33"/>projects or other water development projects for construction by any agency of the <ln numlevel="1" lineno="155" slineno="3-34"/>state or United States and in so doing recommend the order in which projects shall be <ln numlevel="1" lineno="156" slineno="3-35"/>undertaken; or</subsection><subsection ssid="28-28-13" dnum="h-o:i-i" numlevel="1" lineno="157" slineno="3-36" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1058" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>review, approve, and revoke an application to create a water bank under <xref depth="2" refnumber="73-31" start="0">Chapter <ln numlevel="1" lineno="158" slineno="3-37"/>31, Water Banking Act</xref>, collect an annual report, maintain the water banking website, <ln numlevel="1" lineno="159" slineno="3-38"/>and conduct any other function related to a water bank as described in <xref depth="2" refnumber="73-31" start="0">Chapter 31, <ln numlevel="1" lineno="160" slineno="3-39"/>Water Banking Act</xref>.</subsection></subsection><subsection ssid="28-28-14" dnum="2-o" numlevel="1" lineno="161" slineno="3-40" level="1"><display>(2)</display>Nothing contained in this section shall be construed to impair or otherwise interfere <ln numlevel="1" lineno="162" slineno="3-41"/>with the authority of the state engineer granted by this title, except as specifically <ln numlevel="1" lineno="163" slineno="3-42"/>otherwise provided in this section.</subsection></section></bsec><bsec buid="35" num="73-10g-701" type="amend" src="code" uid="C73-10g-S701_2025050720250507" sort="73 10g07010020250507" numlevel="1" lineno="164" slineno="4-1" sn="4"><section number="73-10g-701" numlevel="1" lineno="165" slineno="4-2" type="amend"><secline lineno="164">Section 4, Section <bold>73-10g-701</bold> is amended to read:</secline><catline lineno="165"><bold>73-10g-701. Powers and duties of water agent.</bold></catline><subsection ssid="23-23-1" dnum="1-o" numlevel="1" lineno="180" slineno="5-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="23-23-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">Subject to Subsection (1)(b) and in </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">In </amend>consultation with the speaker of the House <ln numlevel="1" lineno="181" slineno="5-4"/>of Representatives, president of the Senate, and governor, the water agent shall <ln numlevel="1" lineno="182" slineno="5-5"/>explore and negotiate with officials of other states, tribes, and other government <ln numlevel="1" lineno="183" slineno="5-6"/>entities regarding possible water <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">importation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">augmentation</amend> projects, including:<subsection ssid="23-23-3" dnum="i-o" numlevel="1" lineno="184" slineno="5-7" level="3" tab="1"><display>(i)</display>for the citizens of Utah, representing the state concerning waters of out-of-state <ln numlevel="1" lineno="185" slineno="5-8"/>rivers, lakes, and other sources of supply of waters except when representation is <ln numlevel="1" lineno="186" slineno="5-9"/>otherwise provided in statute;</subsection><subsection ssid="23-23-4" dnum="ii-o" numlevel="1" lineno="187" slineno="5-10" level="3" tab="1"><display>(ii)</display>identifying potential out-of-state water resources<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">, including land or a facility <ln numlevel="1" lineno="188" slineno="5-11"/>necessary for the use of the water resources</amend>;</subsection><subsection ssid="23-23-5" dnum="iii-o" numlevel="1" lineno="189" slineno="5-12" level="3" tab="1"><display>(iii)</display>working with the council and division to match the water resources described in <ln numlevel="1" lineno="190" slineno="5-13"/>Subsection (1)(a)(ii) to needs identified by the council or division;</subsection><subsection ssid="23-23-6" dnum="iv-o" numlevel="1" lineno="191" slineno="5-14" level="3" tab="1"><display>(iv)</display>establishing a strategy to designate what out-of-state water resources to pursue <ln numlevel="1" lineno="192" slineno="5-15"/>and how to execute that strategy;</subsection><subsection ssid="23-23-7" dnum="v-o" numlevel="1" lineno="193" slineno="5-16" level="3" tab="1"><display>(v)</display>negotiating directly with out-of-state partners to execute the strategy described in <ln numlevel="1" lineno="194" slineno="5-17"/>Subsection (1)(a)(iv);</subsection><subsection ssid="23-23-8" dnum="vi-o" numlevel="1" lineno="195" slineno="5-18" level="3" tab="1"><display>(vi)</display>represent the state in interstate conferences between the state and one or more <ln numlevel="1" lineno="196" slineno="5-19"/>sister states held for the purpose of entering into compacts between such states for <ln numlevel="1" lineno="197" slineno="5-20"/>the division of the waters of interstate rivers, lakes, or other sources of water <ln numlevel="1" lineno="198" slineno="5-21"/>supply, and to represent the state upon commissions or other governing bodies <ln numlevel="1" lineno="199" slineno="5-22"/>provided for by any compacts that have been or may be entered into between the <ln numlevel="1" lineno="200" slineno="5-23"/>state and one or more sister states, except that a compact is not binding on the <ln numlevel="1" lineno="201" slineno="5-24"/>state until the compact is ratified and approved by the Legislature and the <ln numlevel="1" lineno="202" slineno="5-25"/>legislatures of other states that are parties to the compact;</subsection><subsection ssid="23-23-9" dnum="vii-o" numlevel="1" lineno="203" slineno="5-26" level="3" tab="1"><display>(vii)</display>recommending to the Legislature and to the council actions that may assist in the <ln numlevel="1" lineno="204" slineno="5-27"/>development of, strategies for, and execution of water <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">importation</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">augmentation</amend> <ln numlevel="1" lineno="205" slineno="5-28"/>projects; and</subsection><subsection ssid="23-23-16" dnum="F-o" numlevel="1" lineno="212" slineno="5-35" level="4"><display>(F)</display>the Board of Water Resources created in Section <xref depth="3" refnumber="73-10-1.5">73-10-1.5</xref>.</subsection></subsection></subsection><subsection ssid="23-23-17" dnum="b-o:_-i" numlevel="1" lineno="213" slineno="5-36" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1083" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">The water agent may not act under this section in relation to interests governed by <ln numlevel="1" lineno="214" slineno="5-37"/>interstate compacts in which Utah is a party, such as the 1922 and 1948 Colorado <ln numlevel="1" lineno="215" slineno="5-38"/>River Compacts and the 1980 Amended Bear River Compact.</amend><amendoutend style="2"/></subsection><subsection ssid="23-23" dnum="_-o:b-i" numlevel="1" lineno="216" slineno="5-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">The water agent may recommend to the Board of Water Resources, created in <ln numlevel="1" lineno="217" slineno="5-40"/>Section <xref depth="3" refnumber="73-10-1.5">73-10-1.5</xref>, a water augmentation project that the water agent negotiates under <ln numlevel="1" lineno="218" slineno="5-41"/>this section, if the water augmentation project is in the best interest of the people of <ln numlevel="1" lineno="219" slineno="5-42"/>this state and the state's water resources.</amend></subsection></subsection><subsection ssid="23-23-18" dnum="2-o" numlevel="1" lineno="220" slineno="5-43" level="1"><display>(2)</display>The water agent shall consult and work with the council, state entities, the Colorado <ln numlevel="1" lineno="221" slineno="5-44"/>River Authority of Utah, and other bodies established by the state for interstate water <ln numlevel="1" lineno="222" slineno="5-45"/>negotiations.</subsection><subsection ssid="23-23-19" dnum="3-o" numlevel="1" lineno="223" slineno="5-46" level="1"><display>(3)</display>Subject to Title 63G, Chapter 2, Government Records Access and Management Act, <ln numlevel="1" lineno="224" slineno="5-47"/>upon request of the water agent, a state or local entity shall provide to the water agent a <ln numlevel="1" lineno="225" slineno="5-48"/>document, report, or information available within the state or local entity.</subsection><subsection ssid="23-23-20" dnum="4-o" numlevel="1" lineno="226" slineno="5-49" level="1"><display>(4)</display>The water agent may negotiate with tribes in accordance with this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">, except to the <ln numlevel="1" lineno="227" slineno="5-50"/>extent that the water at issue comes from the Colorado River</amend><amendoutend style="2"/>.</subsection><subsection ssid="23-23-21" dnum="5-o" numlevel="1" lineno="228" slineno="5-51" level="1"><display>(5)</display>This chapter may not be interpreted to override, substitute, or modify a water right <ln numlevel="1" lineno="229" slineno="5-52"/>within the state or the role and authority of the state engineer.</subsection></section></bsec><bsec buid="43" num="73-27-102" type="amend" src="code" uid="C73-27-S102_2025050720250507" sort="73 27 01020020250507" numlevel="1" lineno="230" slineno="6-1" sn="6"><section number="73-27-102" numlevel="1" lineno="231" slineno="6-2" type="amend"><secline lineno="230">Section 6, Section <bold>73-27-102</bold> is amended to read:</secline><catline lineno="231"><bold>73-27-102. Legislative Water Development Commission created.</bold></catline><subsection ssid="43-null-24" dnum="1-o" numlevel="1" lineno="232" slineno="6-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="43-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Legislative Water Development Commission is created to determine the <ln numlevel="1" lineno="233" slineno="6-4"/>state's role in the protection, conservation, and development of the state's water <ln numlevel="1" lineno="234" slineno="6-5"/>resources.</subsection><subsection ssid="43-null-26" dnum="b-o" numlevel="1" lineno="235" slineno="6-6" level="2"><display>(b)</display>For purposes of this chapter, "commission" means the Legislative Water <ln numlevel="1" lineno="236" slineno="6-7"/>Development Commission.</subsection></subsection><subsection ssid="43-null-27" dnum="2-o" numlevel="1" lineno="237" slineno="6-8" level="1" space="false"><display>(2)</display><subsection ssid="43-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The commission membership shall include:<subsection level="1" amendtag="both" space="true">, with at least one member from the minority <ln numlevel="1" lineno="244" slineno="6-15"/>political party</amend>; and</subsection><subsection ssid="43-null-31" dnum="iii-o" numlevel="1" lineno="245" slineno="6-16" level="3" tab="1"><display>(iii)</display>subject to Subsections <xref depth="4" refnumber="73-27-102(2)(b)" start="0">(2)(b)</xref> and <xref depth="4" refnumber="73-27-102(2)(c)" start="0">(c)</xref>, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>nonvoting members, appointed by the <ln numlevel="1" lineno="246" slineno="6-17"/>Legislative Management Committee, from a list recommended by the cochairs of <ln numlevel="1" lineno="247" slineno="6-18"/>the commission described in Subsection <xref depth="4" refnumber="73-27-102(5)" start="0">(5)</xref>.</subsection></subsection><subsection ssid="43-null-32" dnum="b-o" numlevel="1" lineno="248" slineno="6-19" level="2"><display>(b)</display>If the Legislative Management Committee chooses to not appoint an individual on <ln numlevel="1" lineno="249" slineno="6-20"/>the list described in Subsection <xref depth="4" refnumber="73-27-102(2)(a)(iii)" start="0">(2)(a)(iii)</xref>, the Legislative Management Committee <ln numlevel="1" lineno="250" slineno="6-21"/>may ask the cochairs of the commission to submit an additional list of <ln numlevel="1" lineno="251" slineno="6-22"/>recommendations.</subsection><subsection ssid="43-null-33" dnum="c-o" numlevel="1" lineno="252" slineno="6-23" level="2"><display>(c)</display>The Legislative Management Committee may not appoint an individual who is not <ln numlevel="1" lineno="253" slineno="6-24"/>recommended by the cochairs of the commission.</subsection></subsection><subsection ssid="43-null-34" dnum="3-o" numlevel="1" lineno="254" slineno="6-25" level="1" space="false"><display>(3)</display><subsection ssid="43-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The members appointed by the Legislative Management Committee under <ln numlevel="1" lineno="255" slineno="6-26"/>Subsection <xref depth="4" refnumber="73-27-102(2)(a)(iii)" start="0">(2)(a)(iii)</xref> shall be appointed or reappointed to a two-year term.</subsection><subsection ssid="43-null-36" dnum="b-o" numlevel="1" lineno="256" slineno="6-27" level="2"><display>(b)</display>When a vacancy occurs in the membership for any reason, the Legislative <ln numlevel="1" lineno="257" slineno="6-28"/>Management Committee, in consultation with the cochairs of the commission, shall <ln numlevel="1" lineno="258" slineno="6-29"/>appoint a replacement for the unexpired term.</subsection></subsection><subsection ssid="43-null-37" dnum="4-o" numlevel="1" lineno="259" slineno="6-30" level="1"><display>(4)</display>The president of the Senate and the speaker of the House of Representatives shall, to the <ln numlevel="1" lineno="260" slineno="6-31"/>extent possible, appoint members under Subsections <xref depth="4" refnumber="73-27-102(2)(a)(i)" start="0">(2)(a)(i)</xref> and <xref depth="4" refnumber="73-27-102(2)(a)(ii)" start="0">(ii)</xref> that represent both <ln numlevel="1" lineno="261" slineno="6-32"/>rural and urban areas of the state.</subsection><subsection ssid="43-null-38" dnum="5-o" numlevel="1" lineno="262" slineno="6-33" level="1" space="false"><display>(5)</display><subsection ssid="43-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The president of the Senate shall designate a member of the Senate appointed <ln numlevel="1" lineno="263" slineno="6-34"/>under Subsection <xref depth="4" refnumber="73-27-102(2)(a)(i)" start="0">(2)(a)(i)</xref> as a cochair of the commission.</subsection><subsection ssid="43-null-40" dnum="b-o" numlevel="1" lineno="264" slineno="6-35" level="2"><display>(b)</display>The speaker of the House of Representatives shall designate a member of the House <ln numlevel="1" lineno="265" slineno="6-36"/>of Representatives appointed under Subsection <xref depth="4" refnumber="73-27-102(2)(a)(ii)" start="0">(2)(a)(ii)</xref> as a cochair of the <ln numlevel="1" lineno="266" slineno="6-37"/>commission.</subsection></subsection><subsection ssid="43-null-41" dnum="6-o" numlevel="1" lineno="267" slineno="6-38" level="1"><display>(6)</display>What constitutes a quorum of the commission is determined in accordance with <ln numlevel="1" lineno="268" slineno="6-39"/>Legislative Joint Rules, <xref depth="2" refnumber="JR7-1-2" start="0">Title 7, Chapter 1, Part 2, Creation and Organization of <ln numlevel="1" lineno="269" slineno="6-40"/>Legislative Committees</xref>, except nonvoting members of the commission described in <ln numlevel="1" lineno="270" slineno="6-41"/>Subsection <xref depth="4" refnumber="73-27-102(2)(a)(iii)" start="0">(2)(a)(iii)</xref> may not be considered for purposes of determining a quorum.</subsection><subsection ssid="43-null-42" dnum="7-o" numlevel="1" lineno="271" slineno="6-42" level="1" space="false"><display>(7)</display><subsection ssid="43-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Compensation and expenses of a member of the commission who is a legislator <ln numlevel="1" lineno="272" slineno="6-43"/>are governed by Section <xref depth="3" refnumber="36-2-2" start="0">36-2-2</xref> and Legislative Joint Rules, <xref depth="0" refnumber="JR5" start="0">Title 5, Legislative <ln numlevel="1" lineno="273" slineno="6-44"/>Compensation and Expenses</xref>.</subsection><subsection ssid="43-null-44" dnum="b-o" numlevel="1" lineno="274" slineno="6-45" level="2"><display>(b)</display>Commission members who are employees of the state shall receive no additional <ln numlevel="1" lineno="275" slineno="6-46"/>compensation.</subsection><subsection ssid="43-null-45" dnum="c-o" numlevel="1" lineno="276" slineno="6-47" level="2"><display>(c)</display>Other commission members shall receive no compensation or expenses for their <ln numlevel="1" lineno="277" slineno="6-48"/>service on the commission.</subsection></subsection><subsection ssid="43-null-46" dnum="8-o" numlevel="1" lineno="278" slineno="6-49" level="1"><display>(8)</display>The Office of Legislative Research and General Counsel shall provide staff support to <ln numlevel="1" lineno="279" slineno="6-50"/>the commission.</subsection></section></bsec><bsec buid="46" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="280" slineno="7-1" sn="7"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="280">Section 7.  <bold>Effective Date.</bold></secline><sectionText lineno="281"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate
