Harper</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to the imposition of a civil penalty for a municipal <ln numlevel="1" lineno="6" slineno="0-6"/>ordinance violation.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">allows a municipality to impose a civil fine that exceeds the maximum class B <ln numlevel="1" lineno="10" slineno="0-10"/>misdemeanor fine under Section 76-3-301 if:<hl numlevel="1" lineno="11" slineno="0-11" level="2">the fine is imposed for violation of an ordinance that regulates occupancy, the <ln numlevel="1" lineno="12" slineno="0-12"/>provision of off-street parking, or the operation of a rental dwelling or short-term <ln numlevel="1" lineno="13" slineno="0-13"/>rental;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="2">the municipality has previously imposed a fine on the individual for the same violation <ln numlevel="1" lineno="15" slineno="0-15"/>three or more times within the past 12 months; and</hl><hl numlevel="1" lineno="16" slineno="0-16" level="2">the fine does not exceed the applicable maximum amount described in this bill.</hl></hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:</oc><ocNone lineno="20">None</ocNone><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="10-3-703" src="code" uid="C10-3-S703_2025050720250507" buid="1" sort="10 03 07030020250507" numlevel="1" lineno="23" slineno="0-23"><bold>10-3-703</bold>, as last amended by Laws of Utah 2020, Chapter 89</sn><sn num="10-11-2" src="code" uid="C10-11-S2_2025050720250507" buid="3" sort="10 11 00020020250507" numlevel="1" lineno="24" slineno="0-24"><bold>10-11-2</bold>, as last amended by Laws of Utah 2022, Chapter 432</sn></saamd></sa></lt><enacthead lineno="25"/><enact numlevel="1" lineno="26" slineno="0-26">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="10-3-703" type="amend" src="code" uid="C10-3-S703_2025050720250507" sort="10 03 07030020250507" numlevel="1" lineno="27" slineno="1-1" sn="1"><section number="10-3-703" numlevel="1" lineno="28" slineno="1-2" type="amend"><secline lineno="27">Section 1, Section <bold>10-3-703</bold> is amended to read:</secline><catline lineno="28"><bold>10-3-703. Criminal penalties for violation of ordinance -- Civil penalties <ln numlevel="1" lineno="29" slineno="1-3"/>prohibited -- Exceptions.</bold></catline><subsection ssid="1-42" dnum="_-o:1-i" numlevel="1" lineno="30" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-44" dnum="_-o:a-i" numlevel="1" lineno="31" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="86" style="1" owner="jchristopherson" level="1" amendtag="end">"Rental dwelling" means the same as that term is defined in Section 10-8-85.5.</amend></subsection><subsection ssid="1-45" dnum="_-o:b-i" numlevel="1" lineno="32" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="88" style="1" owner="jchristopherson" level="1" amendtag="end">"Short-term rental" means the same as that term is defined in Section 10-8-85.4.</amend></subsection></subsection><subsection ssid="1-1-1" dnum="1-o:2-i" numlevel="1" lineno="33" slineno="1-7" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="both" space="true">(2)</amend></display><subsection ssid="1-1-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governing body of a municipality may impose a criminal penalty for the <ln numlevel="1" lineno="34" slineno="1-8"/>violation of any municipal ordinance by a fine not to exceed the maximum class B <ln numlevel="1" lineno="35" slineno="1-9"/>misdemeanor fine under Section <xref depth="3" refnumber="76-3-301" start="0">76-3-301</xref>, by a term of imprisonment up to six <ln numlevel="1" lineno="36" slineno="1-10"/>months, or by both the fine and term of imprisonment.</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="37" slineno="1-11" level="2"><display>(b)</display>Notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="121" groupid="94" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(1)(a)" start="0">(1)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="119" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(a)</amend>, a municipality may not impose a criminal <ln numlevel="1" lineno="38" slineno="1-12"/>penalty greater than an infraction for a violation pertaining to an individual's pet, as <ln numlevel="1" lineno="39" slineno="1-13"/>defined in Section <xref depth="3" refnumber="4-12-102" start="0">4-12-102</xref>, or an individual's use of the individual's residence <ln numlevel="1" lineno="40" slineno="1-14"/>unless:<subsection ssid="1-1-4" dnum="i-o" numlevel="1" lineno="41" slineno="1-15" level="3"><display>(i)</display>the violation:<subsection ssid="1-1-5" dnum="A-o" numlevel="1" lineno="42" slineno="1-16" level="4"><display>(A)</display>is a nuisance as defined in Subsection <xref depth="4" refnumber="78B-6-1101(1)" start="0">78B-6-1101(1)</xref>; and</subsection><subsection ssid="1-1-6" dnum="B-o" numlevel="1" lineno="43" slineno="1-17" level="4"><display>(B)</display>threatens the health, safety, or welfare of the individual or an identifiable third <ln numlevel="1" lineno="44" slineno="1-18"/>party; or</subsection></subsection><subsection ssid="1-1-7" dnum="ii-o" numlevel="1" lineno="45" slineno="1-19" level="3"><display>(ii)</display>the municipality has imposed a fine on the individual for a violation that involves <ln numlevel="1" lineno="46" slineno="1-20"/>the same residence or pet on three previous occasions within the past 12 months.</subsection></subsection><subsection ssid="1-1-8" dnum="c-o" numlevel="1" lineno="47" slineno="1-21" level="2"><display>(c)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="122" groupid="95" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(1)(b)" start="0">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="120" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(b)</amend> does not apply to municipal enforcement of a building code <ln numlevel="1" lineno="48" slineno="1-22"/>or fire code ordinance in accordance with <xref depth="0" refnumber="15A" start="0">Title 15A, State Construction and Fire <ln numlevel="1" lineno="49" slineno="1-23"/>Codes Act</xref>.</subsection></subsection><subsection ssid="1-1-9" dnum="2-o:3-i" numlevel="1" lineno="50" slineno="1-24" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display><subsection ssid="1-1-10" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="145" groupid="113" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(2)(b)" start="0">(2)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="143" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(4) or (5)</amend>, the governing body may <ln numlevel="1" lineno="51" slineno="1-25"/>prescribe a civil penalty for the violation of any municipal ordinance by a fine not to <ln numlevel="1" lineno="52" slineno="1-26"/>exceed the maximum class B misdemeanor fine under Section <xref depth="3" refnumber="76-3-301" start="0">76-3-301</xref>.</subsection></subsection><subsection ssid="1-1-11" dnum="b-o:4-i" numlevel="1" lineno="53" slineno="1-27" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A municipality may not impose a civil penalty and adjudication for the violation of <ln numlevel="1" lineno="54" slineno="1-28"/>a municipal moving traffic ordinance.</subsection><subsection ssid="1-18" dnum="_-o:5-i" numlevel="1" lineno="55" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref tempid="843">(6)</xref>, a civil penalty that is a fine may exceed the maximum class B <ln numlevel="1" lineno="56" slineno="1-30"/>misdemeanor fine under Section <xref depth="3" refnumber="76-3-301">76-3-301</xref>, if:</amend><subsection ssid="1-46" dnum="_-o:a-i" numlevel="1" lineno="57" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="130" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">the penalty is for the violation of an ordinance that regulates occupancy, the <ln numlevel="1" lineno="58" slineno="1-32"/>provision of off-street parking, or the operation of a rental dwelling or short-term <ln numlevel="1" lineno="59" slineno="1-33"/>rental; and</amend></subsection><subsection ssid="1-24" dnum="_-o:b-i" numlevel="1" lineno="60" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><subsection ssid="1-40" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="108" style="1" owner="jchristopherson" level="1" amendtag="end">except as provided in Subsection (5)(b)(ii):</amend><subsection ssid="1-48" dnum="_-o:A-i" numlevel="1" lineno="61" slineno="1-35" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">the municipality previously imposed a civil or criminal fine on the individual <ln numlevel="1" lineno="62" slineno="1-36"/>for the same violation three times within the 12 months immediately preceding <ln numlevel="1" lineno="63" slineno="1-37"/>the violation; and,</amend></subsection><subsection ssid="1-34" dnum="_-o:B-i" numlevel="1" lineno="64" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">the fine does not exceed $2,500; or</amend></subsection></subsection><subsection ssid="1-47" dnum="_-o:ii-i" numlevel="1" lineno="65" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><subsection ssid="1-35" dnum="_-o:A-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">the municipality previously imposed a fine on the individual for the same <ln numlevel="1" lineno="66" slineno="1-40"/>violation four or more times within the 12 months immediately preceding the <ln numlevel="1" lineno="67" slineno="1-41"/>violation; and</amend></subsection><subsection ssid="1-36" dnum="_-o:B-i" numlevel="1" lineno="68" slineno="1-42" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">the fine does not exceed $5,000.</amend></subsection></subsection></subsection></subsection><subsection ssid="1-37" dnum="_-o:6-i" numlevel="1" lineno="69" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">In calculating, under Subsection <xref tempid="251">(5)(b)</xref>, the total number of times an individual was <ln numlevel="1" lineno="70" slineno="1-44"/>previously fined, the municipality may only include times that are separated by at least <ln numlevel="1" lineno="71" slineno="1-45"/>14 days of compliance.</amend></subsection><subsection ssid="1-1-12" dnum="3-o:7-i" numlevel="1" lineno="72" slineno="1-46" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="1-1-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="155" groupid="123" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="10-3-703(3)(b)" start="0">(3)(b)</xref> or </amend><amendoutend style="2"/>Section <xref depth="3" refnumber="77-7-18" start="0">77-7-18</xref>, a municipal <ln numlevel="1" lineno="73" slineno="1-47"/>officer or official who is not a law enforcement officer described in Section  <xref depth="3" refnumber="53-13-103" start="0"><ln numlevel="1" lineno="74" slineno="1-48"/>53-13-103</xref> or a special function officer described in Section <xref depth="3" refnumber="53-13-105" start="0">53-13-105</xref> may not issue <ln numlevel="1" lineno="75" slineno="1-49"/>a criminal citation for a violation that is punished as a misdemeanor.</subsection><subsection ssid="1-1-14" dnum="b-o" numlevel="1" lineno="76" slineno="1-50" level="2"><display>(b)</display>Notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="157" groupid="125" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(1)" start="0">(1)</xref> or <xref depth="4" refnumber="10-3-703(3)(a)" start="0">(3)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="154" groupid="122" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2) or (7)(a)</amend>, the following may issue a <ln numlevel="1" lineno="77" slineno="1-51"/>criminal citation for a violation that is punished as a misdemeanor if the violation <ln numlevel="1" lineno="78" slineno="1-52"/>threatens the health and safety of an animal or the public:<subsection ssid="1-1-15" dnum="i-o" numlevel="1" lineno="79" slineno="1-53" level="3"><display>(i)</display>a fire officer described in Section <xref depth="3" refnumber="53-7-102" start="0">53-7-102</xref>; or</subsection><subsection ssid="1-1-16" dnum="ii-o" numlevel="1" lineno="80" slineno="1-54" level="3"><display>(ii)</display>an animal control officer described in Section <xref depth="3" refnumber="11-46-102" start="0">11-46-102</xref>.</subsection></subsection></subsection><subsection ssid="1-1-17" dnum="4-o:8-i" numlevel="1" lineno="81" slineno="1-55" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>A municipality may not issue more than one infraction within a 14-day time period <ln numlevel="1" lineno="82" slineno="1-56"/>for a violation described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="152" groupid="120" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(1)(b)" start="0">(1)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="150" groupid="118" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(2)(b)</amend> that is ongoing.</subsection></section></bsec><bsec buid="3" num="10-11-2" type="amend" src="code" uid="C10-11-S2_2025050720250507" sort="10 11 00020020250507" numlevel="1" lineno="83" slineno="2-1" sn="2"><section number="10-11-2" numlevel="1" lineno="84" slineno="2-2" type="amend"><secline lineno="83">Section 2, Section <bold>10-11-2</bold> is amended to read:</secline><catline lineno="84"><bold>10-11-2. Inspection of property -- Notice -- Penalties.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="85" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a municipality adopts an ordinance describing the duties of a municipal <ln numlevel="1" lineno="86" slineno="2-4"/>inspector appointed under Section <xref depth="3" refnumber="10-11-1" start="0">10-11-1</xref>, the ordinance:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="87" slineno="2-5" level="3" tab="1"><display>(i)</display>may, subject to Subsection <xref depth="4" refnumber="10-11-2(1)(b)" start="0">(1)(b)</xref>, direct the inspector to examine and investigate <ln numlevel="1" lineno="88" slineno="2-6"/>real property for:<subsection ssid="3-null-4" dnum="A-o" numlevel="1" lineno="89" slineno="2-7" level="4"><display>(A)</display>the growth and spread of injurious and noxious weeds;</subsection><subsection ssid="3-null-5" dnum="B-o" numlevel="1" lineno="90" slineno="2-8" level="4"><display>(B)</display>garbage and refuse;</subsection><subsection ssid="3-null-6" dnum="C-o" numlevel="1" lineno="91" slineno="2-9" level="4"><display>(C)</display>a public nuisance;</subsection><subsection ssid="3-null-7" dnum="D-o" numlevel="1" lineno="92" slineno="2-10" level="4"><display>(D)</display>an illegal object or structure; or</subsection><subsection ssid="3-null-8" dnum="E-o" numlevel="1" lineno="93" slineno="2-11" level="4"><display>(E)</display>hazardous materials; and</subsection></subsection><subsection ssid="3-null-9" dnum="ii-o" numlevel="1" lineno="94" slineno="2-12" level="3" tab="1"><display>(ii)</display>if an inspector conducts an examination and investigation under Subsection <xref depth="4" refnumber="10-11-2(1)(a)" start="0">(1)(a)</xref>, <ln numlevel="1" lineno="95" slineno="2-13"/>shall direct the inspector to deliver written notice of the examination and <ln numlevel="1" lineno="96" slineno="2-14"/>investigation in accordance with Subsection <xref depth="4" refnumber="10-11-2(2)" start="0">(2)</xref>.</subsection></subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="97" slineno="2-15" level="2"><display>(b)</display>An ordinance described in Subsection <xref depth="4" refnumber="10-11-2(1)(a)" start="0">(1)(a)</xref> may not direct an inspector or authorize <ln numlevel="1" lineno="98" slineno="2-16"/>a municipality to abate conditions solely associated with the interior of a structure, <ln numlevel="1" lineno="99" slineno="2-17"/>unless required:<subsection ssid="3-null-11" dnum="i-o" numlevel="1" lineno="100" slineno="2-18" level="3"><display>(i)</display>for the demolition and removal of the structure; or</subsection><subsection ssid="3-null-12" dnum="ii-o" numlevel="1" lineno="101" slineno="2-19" level="3"><display>(ii)</display>to eliminate or remove hazardous materials within a structure that has been closed <ln numlevel="1" lineno="102" slineno="2-20"/>to occupancy or entry by a local health department or fire department.</subsection></subsection><subsection ssid="3-null-13" dnum="c-o" numlevel="1" lineno="103" slineno="2-21" level="2"><display>(c)</display>An ordinance described in Subsection <xref depth="4" refnumber="10-11-2(1)(a)" start="0">(1)(a)</xref> may direct an inspector or authorize a <ln numlevel="1" lineno="104" slineno="2-22"/>municipality to issue an order limiting or restricting access to a structure and the real <ln numlevel="1" lineno="105" slineno="2-23"/>property appurtenant to the structure while the municipal inspector or a certified <ln numlevel="1" lineno="106" slineno="2-24"/>decontamination specialist destroys, removes, or abates hazardous materials within <ln numlevel="1" lineno="107" slineno="2-25"/>the structure.</subsection><subsection ssid="3-null-14" dnum="d-o" numlevel="1" lineno="108" slineno="2-26" level="2"><display>(d)</display>If a municipality has adopted an ordinance establishing an administrative proceeding <ln numlevel="1" lineno="109" slineno="2-27"/>process for the violation of a municipal ordinance in accordance with the <ln numlevel="1" lineno="110" slineno="2-28"/>requirements of Section <xref depth="3" refnumber="10-3-703.7" start="0">10-3-703.7</xref>, the municipality may adopt an ordinance <ln numlevel="1" lineno="111" slineno="2-29"/>imposing the following for a violation of an order issued under Subsection <xref depth="4" refnumber="10-11-2(1)(c)" start="0">(1)(c)</xref>:<subsection ssid="3-null-15" dnum="i-o" numlevel="1" lineno="112" slineno="2-30" level="3"><display>(i)</display>a civil penalty in accordance with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Subsection <xref depth="4" refnumber="10-3-703(2)" start="0">10-3-703(2)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsections <ln numlevel="1" lineno="113" slineno="2-31"/>10-3-703(3) and (4)</amend>; or</subsection><subsection ssid="3-null-16" dnum="ii-o" numlevel="1" lineno="114" slineno="2-32" level="3"><display>(ii)</display>in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="10-3-703(1)" start="0">10-3-703(1)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">10-3-703(2)</amend>, a criminal penalty, <ln numlevel="1" lineno="115" slineno="2-33"/>including by a fine not to exceed the maximum class B misdemeanor fine under <ln numlevel="1" lineno="116" slineno="2-34"/>Section <xref depth="3" refnumber="76-3-301" start="0">76-3-301</xref>, by a term of imprisonment up to six months, or by both the fine <ln numlevel="1" lineno="117" slineno="2-35"/>and term of imprisonment.</subsection></subsection><subsection ssid="3-null-17" dnum="e-o" numlevel="1" lineno="118" slineno="2-36" level="2"><display>(e)</display>An ordinance adopted in accordance with Subsection <xref depth="4" refnumber="10-11-2(1)(d)" start="0">(1)(d)</xref> shall provide 180 days <ln numlevel="1" lineno="119" slineno="2-37"/>after the day on which the written notice from an inspector is delivered in person or <ln numlevel="1" lineno="120" slineno="2-38"/>the date the notice is post-marked for the recipient of the notice to:<subsection ssid="3-null-18" dnum="i-o" numlevel="1" lineno="121" slineno="2-39" level="3"><display>(i)</display>abate the hazardous materials; or</subsection><subsection ssid="3-null-19" dnum="ii-o" numlevel="1" lineno="122" slineno="2-40" level="3"><display>(ii)</display>appeal the notice and begin the administrative proceeding process.</subsection></subsection></subsection><subsection ssid="3-null-20" dnum="2-o" numlevel="1" lineno="123" slineno="2-41" level="1" space="false"><display>(2)</display><subsection ssid="3-null-21" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="3-null-22" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The municipal inspector shall serve written notice to a property owner of <ln numlevel="1" lineno="124" slineno="2-42"/>record according to the records of the county recorder in accordance with <ln numlevel="1" lineno="125" slineno="2-43"/>Subsection <xref depth="4" refnumber="10-11-2(2)(b)" start="0">(2)(b)</xref>.</subsection><subsection ssid="3-null-23" dnum="ii-o" numlevel="1" lineno="126" slineno="2-44" level="3" tab="1"><display>(ii)</display>The municipal inspector may serve written notice in accordance with Subsection <xref depth="4" refnumber="10-11-2(2)(b)" start="0"><ln numlevel="1" lineno="127" slineno="2-45"/>(2)(b)</xref> to a non-owner occupant of the property or another person responsible for <ln numlevel="1" lineno="128" slineno="2-46"/>the property who is not the owner of record, including a manager or agent of the <ln numlevel="1" lineno="129" slineno="2-47"/>owner, if:<subsection ssid="3-null-24" dnum="A-o" numlevel="1" lineno="130" slineno="2-48" level="4"><display>(A)</display>the property owner is not an occupant of the property; and</subsection><subsection ssid="3-null-25" dnum="B-o" numlevel="1" lineno="131" slineno="2-49" level="4"><display>(B)</display>the municipality in which the property is located has adopted an ordinance <ln numlevel="1" lineno="132" slineno="2-50"/>imposing a duty to maintain the property on an occupant who is not the <ln numlevel="1" lineno="133" slineno="2-51"/>property owner of record or a person other than the property owner of record <ln numlevel="1" lineno="134" slineno="2-52"/>who is responsible for the property.</subsection></subsection></subsection><subsection ssid="3-null-26" dnum="b-o" numlevel="1" lineno="135" slineno="2-53" level="2"><display>(b)</display>The municipal inspector may serve the written notice:<subsection ssid="3-null-27" dnum="i-o" numlevel="1" lineno="136" slineno="2-54" level="3"><display>(i)</display>in person or by mail to the property owner of record as described in Subsection <xref depth="4" refnumber="10-11-2(2)(a)(i)" start="0"><ln numlevel="1" lineno="137" slineno="2-55"/>(2)(a)(i)</xref>, if mailed to the last-known address of the owner according to the records <ln numlevel="1" lineno="138" slineno="2-56"/>of the county recorder; or</subsection><subsection ssid="3-null-28" dnum="ii-o" numlevel="1" lineno="139" slineno="2-57" level="3"><display>(ii)</display>in person or by mail to a non-owner occupant or another person responsible for <ln numlevel="1" lineno="140" slineno="2-58"/>the property who is not the owner of record as described in Subsection <xref depth="4" refnumber="10-11-2(2)(a)(ii)" start="0">(2)(a)(ii)</xref>, if <ln numlevel="1" lineno="141" slineno="2-59"/>mailed to the property address.</subsection></subsection><subsection ssid="3-null-29" dnum="c-o" numlevel="1" lineno="142" slineno="2-60" level="2"><display>(c)</display>In the written notice described in Subsection <xref depth="4" refnumber="10-11-2(2)(a)" start="0">(2)(a)</xref>, the municipal inspector shall:<subsection ssid="3-null-30" dnum="i-o" numlevel="1" lineno="143" slineno="2-61" level="3"><display>(i)</display>identify the property owner of record according to the records of the county <ln numlevel="1" lineno="144" slineno="2-62"/>recorder;</subsection><subsection ssid="3-null-31" dnum="ii-o" numlevel="1" lineno="145" slineno="2-63" level="3"><display>(ii)</display>describe the property and the nature and results of the examination and <ln numlevel="1" lineno="146" slineno="2-64"/>investigation conducted in accordance with Subsection <xref depth="4" refnumber="10-11-2(1)(a)" start="0">(1)(a)</xref>;</subsection><subsection ssid="3-null-32" dnum="iii-o" numlevel="1" lineno="147" slineno="2-65" level="3"><display>(iii)</display>identify the relevant regulation or ordinance at issue and describe the violation of <ln numlevel="1" lineno="148" slineno="2-66"/>the relevant regulation or ordinance;</subsection><subsection ssid="3-null-33" dnum="iv-o" numlevel="1" lineno="149" slineno="2-67" level="3"><display>(iv)</display>describe each order, fine, or penalty that may be imposed;</subsection><subsection ssid="3-null-34" dnum="v-o" numlevel="1" lineno="150" slineno="2-68" level="3"><display>(v)</display>for a structure or any real property closed to occupancy or entry by a local health <ln numlevel="1" lineno="151" slineno="2-69"/>department because of hazardous materials, explain the right of a property owner, <ln numlevel="1" lineno="152" slineno="2-70"/>occupant, or, if applicable, another person responsible for the property to abate the <ln numlevel="1" lineno="153" slineno="2-71"/>hazardous materials or appeal the notice within 180 days after the day on which <ln numlevel="1" lineno="154" slineno="2-72"/>notice is delivered in person or the date the notice is post-marked; and</subsection><subsection ssid="3-null-35" dnum="vi-o" numlevel="1" lineno="155" slineno="2-73" level="3"><display>(vi)</display>require the property owner, occupant, or, if applicable, another person <ln numlevel="1" lineno="156" slineno="2-74"/>responsible for the property to:<subsection ssid="3-null-36" dnum="A-o" numlevel="1" lineno="157" slineno="2-75" level="4"><display>(A)</display>eradicate or destroy and remove any identified item examined and <ln numlevel="1" lineno="158" slineno="2-76"/>investigated under Subsection <xref depth="4" refnumber="10-11-2(1)(a)" start="0">(1)(a)</xref>; and</subsection><subsection ssid="3-null-37" dnum="B-o" numlevel="1" lineno="159" slineno="2-77" level="4"><display>(B)</display>comply with Subsection <xref depth="4" refnumber="10-11-2(2)(c)(vi)(A)" start="0">(2)(c)(vi)(A)</xref> in a time period designated by the <ln numlevel="1" lineno="160" slineno="2-78"/>municipal inspector but no less than 10 days after the day on which notice is <ln numlevel="1" lineno="161" slineno="2-79"/>delivered in person or post-marked, or for a notice related to hazardous <ln numlevel="1" lineno="162" slineno="2-80"/>materials, no less than 180 days after the day on which notice is delivered in <ln numlevel="1" lineno="163" slineno="2-81"/>person or post-marked.</subsection></subsection></subsection><subsection ssid="3-null-38" dnum="d-o" numlevel="1" lineno="164" slineno="2-82" level="2"><display>(d)</display>For a notice of injurious and noxious weeds described in Subsection <xref depth="4" refnumber="10-11-2(2)(a)" start="0">(2)(a)</xref>, the <ln numlevel="1" lineno="165" slineno="2-83"/>municipal inspector is not required to make more than one notice for each annual <ln numlevel="1" lineno="166" slineno="2-84"/>season of weed growth for weeds growing on a property.</subsection><subsection ssid="3-null-39" dnum="e-o" numlevel="1" lineno="167" slineno="2-85" level="2"><display>(e)</display>The municipal inspector shall serve the notice required under Subsection <xref depth="4" refnumber="10-11-2(2)(a)(i)" start="0">(2)(a)(i)</xref> <ln numlevel="1" lineno="168" slineno="2-86"/>under penalty of perjury.</subsection><subsection ssid="3-null-40" dnum="f-o" numlevel="1" lineno="169" slineno="2-87" level="2"><display>(f)</display>For a structure or any real property closed to occupancy or entry by a local health <ln numlevel="1" lineno="170" slineno="2-88"/>department because of hazardous materials, unless an order issued by a court of <ln numlevel="1" lineno="171" slineno="2-89"/>competent jurisdiction states otherwise, a municipality may not impose a fine or <ln numlevel="1" lineno="172" slineno="2-90"/>penalty on a property owner, occupant, or another person responsible for the structure <ln numlevel="1" lineno="173" slineno="2-91"/>or real property, and may not authorize a municipal inspector or a certified <ln numlevel="1" lineno="174" slineno="2-92"/>decontamination specialist to begin abatement of the hazardous materials, until:<subsection ssid="3-null-41" dnum="i-o" numlevel="1" lineno="175" slineno="2-93" level="3"><display>(i)</display>the appeal and administrative proceeding process is completed; or</subsection><subsection ssid="3-null-42" dnum="ii-o" numlevel="1" lineno="176" slineno="2-94" level="3"><display>(ii)</display>the property owner, occupant, or another person responsible for the property has <ln numlevel="1" lineno="177" slineno="2-95"/>missed the deadline for filing the appeal.</subsection></subsection></subsection></section></bsec><bsec buid="4" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="178" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="178">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="179"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-24-25 4:31 PM</tm></rev></foot></leg>
