Approval of plans.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="28" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="29" slineno="1-4" level="2"><display>(a)</display>"Plan fee" means a fee that an association of unit owners charges for review and <ln numlevel="1" lineno="30" slineno="1-5"/>approval of unit plans.</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="31" slineno="1-6" level="2"><display>(b)</display>"Unit plans" means plans:<subsection ssid="1-1-4" dnum="i-o" numlevel="1" lineno="32" slineno="1-7" level="3"><display>(i)</display>for the construction or improvement of a unit; and</subsection><subsection ssid="1-1-5" dnum="ii-o" numlevel="1" lineno="33" slineno="1-8" level="3"><display>(ii)</display>that are required to be approved by the association of unit owners before the unit <ln numlevel="1" lineno="34" slineno="1-9"/>construction or improvement may occur.</subsection></subsection></subsection><subsection ssid="1-1-6" dnum="2-o" numlevel="1" lineno="35" slineno="1-10" level="1"><display>(2)</display>An association of unit owners may not charge a plan fee that exceeds the actual cost of <ln numlevel="1" lineno="36" slineno="1-11"/>reviewing and approving the unit plans.</subsection><subsection ssid="1-7" dnum="_-o:3-i" numlevel="1" lineno="37" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="ahaskell" level="1" amendtag="end">If the association denies a unit plan, the association shall provide written notice to the <ln numlevel="1" lineno="38" slineno="1-13"/>unit owner specifying:</amend><subsection ssid="1-8" dnum="_-o:a-i" numlevel="1" lineno="39" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="ahaskell" level="1" amendtag="end">each governing document provision on which the association relied when denying <ln numlevel="1" lineno="40" slineno="1-15"/>the plan; and</amend></subsection><subsection ssid="1-9" dnum="_-o:b-i" numlevel="1" lineno="41" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="ahaskell" level="1" amendtag="end">the specific aspect of the proposed plan that does not conform to the specified <ln numlevel="1" lineno="42" slineno="1-17"/>governing document provision.</amend></subsection></subsection></section></bsec><bsec buid="3" num="57-8-8.1" type="amend" src="code" uid="C57-8-S8.1_2025050720250507" sort="57 08 00080120250507" numlevel="1" lineno="43" slineno="2-1" sn="2"><section number="57-8-8.1" numlevel="1" lineno="44" slineno="2-2" type="amend"><secline lineno="43">Section 2, Section <bold>57-8-8.1</bold> is amended to read:</secline><catline lineno="44"><bold>57-8-8.1. Equal treatment by rules required -- Limits on rules.</bold></catline><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="45" slineno="2-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-3-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (1)(b), a rule shall treat similarly situated unit <ln numlevel="1" lineno="46" slineno="2-4"/>owners similarly.</subsection><subsection ssid="3-3-3" dnum="b-o" numlevel="1" lineno="47" slineno="2-5" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="385" groupid="301" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection (1)(a), a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="384" groupid="300" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may:<subsection ssid="3-3-4" dnum="i-o" numlevel="1" lineno="48" slineno="2-6" level="3"><display>(i)</display>vary according to the level and type of service that the association of unit owners <ln numlevel="1" lineno="49" slineno="2-7"/>provides to unit owners;</subsection><subsection ssid="3-3-5" dnum="ii-o" numlevel="1" lineno="50" slineno="2-8" level="3"><display>(ii)</display>differ between residential and nonresidential uses; or</subsection><subsection ssid="3-3-6" dnum="iii-o" numlevel="1" lineno="51" slineno="2-9" level="3"><display>(iii)</display>for a unit that a unit owner leases for a term of less than 30 days, impose a <ln numlevel="1" lineno="52" slineno="2-10"/>reasonable limit on the number of individuals that may use the common areas and <ln numlevel="1" lineno="53" slineno="2-11"/>facilities as the rental unit tenant's guest or as the unit owner's guest.</subsection></subsection></subsection><subsection ssid="3-3-7" dnum="2-o" numlevel="1" lineno="54" slineno="2-12" level="1" space="false"><display>(2)</display><subsection ssid="3-3-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (2)(b), if</amend> a unit owner owns a rental unit and <ln numlevel="1" lineno="55" slineno="2-13"/>is in compliance with the association of unit owners' governing documents and any <ln numlevel="1" lineno="56" slineno="2-14"/>rule that the association of unit owners adopts under Subsection (5), a rule may not <ln numlevel="1" lineno="57" slineno="2-15"/>treat the unit owner differently because the unit owner owns a rental unit.</subsection><subsection ssid="3-3-9" dnum="b-o" numlevel="1" lineno="58" slineno="2-16" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="388" groupid="304" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection (2)(a), a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="387" groupid="303" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may:<subsection ssid="3-3-10" dnum="i-o" numlevel="1" lineno="59" slineno="2-17" level="3"><display>(i)</display>limit or prohibit a rental unit owner from using the common areas and facilities for <ln numlevel="1" lineno="60" slineno="2-18"/>purposes other than attending an association meeting or managing the rental unit;</subsection><subsection ssid="3-3-11" dnum="ii-o" numlevel="1" lineno="61" slineno="2-19" level="3"><display>(ii)</display>if the rental unit owner retains the right to use the association of unit owners' <ln numlevel="1" lineno="62" slineno="2-20"/>common areas and facilities, even occasionally:<subsection ssid="3-3-12" dnum="A-o" numlevel="1" lineno="63" slineno="2-21" level="4"><display>(A)</display>charge a rental unit owner a fee to use the common areas and facilities; and</subsection><subsection ssid="3-3-13" dnum="B-o" numlevel="1" lineno="64" slineno="2-22" level="4"><display>(B)</display>for a unit that a unit owner leases for a term of less than 30 days, impose a <ln numlevel="1" lineno="65" slineno="2-23"/>reasonable limit on the number of individuals that may use the common areas <ln numlevel="1" lineno="66" slineno="2-24"/>and facilities as the rental unit tenant's guest or as the unit owner's guest; or</subsection></subsection><subsection ssid="3-3-14" dnum="iii-o" numlevel="1" lineno="67" slineno="2-25" level="3"><display>(iii)</display>include a provision in the association of unit owners' governing documents that:<subsection ssid="3-3-15" dnum="A-o" numlevel="1" lineno="68" slineno="2-26" level="4"><display>(A)</display>requires each tenant of a rental unit to abide by the terms of the governing <ln numlevel="1" lineno="69" slineno="2-27"/>documents; and</subsection><subsection ssid="3-3-16" dnum="B-o" numlevel="1" lineno="70" slineno="2-28" level="4"><display>(B)</display>holds the tenant and the rental unit owner jointly and severally liable for a <ln numlevel="1" lineno="71" slineno="2-29"/>violation of a provision of the governing documents.</subsection></subsection></subsection></subsection><subsection ssid="3-3-17" dnum="3-o" numlevel="1" lineno="72" slineno="2-30" level="1" space="false"><display>(3)</display><subsection ssid="3-3-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="17" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (3)(b), a</amend> rule may not interfere with the <ln numlevel="1" lineno="73" slineno="2-31"/>freedom of a unit owner to determine the composition of the unit owner's household.</subsection><subsection ssid="3-3-19" dnum="b-o" numlevel="1" lineno="74" slineno="2-32" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="391" groupid="307" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection (3)(a), an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="390" groupid="306" style="1" owner="ahaskell" level="1" amendtag="both" space="true">An</amend> association of unit owners may:<subsection ssid="3-3-20" dnum="i-o" numlevel="1" lineno="75" slineno="2-33" level="3"><display>(i)</display>require that all occupants of a dwelling be members of a single housekeeping unit; <ln numlevel="1" lineno="76" slineno="2-34"/>or</subsection><subsection ssid="3-3-21" dnum="ii-o" numlevel="1" lineno="77" slineno="2-35" level="3"><display>(ii)</display>limit the total number of occupants permitted in each residential dwelling on the <ln numlevel="1" lineno="78" slineno="2-36"/>basis of the residential dwelling's:<subsection ssid="3-3-22" dnum="A-o" numlevel="1" lineno="79" slineno="2-37" level="4"><display>(A)</display>size and facilities; and</subsection><subsection ssid="3-3-23" dnum="B-o" numlevel="1" lineno="80" slineno="2-38" level="4"><display>(B)</display>fair use of the common areas and facilities.</subsection></subsection></subsection></subsection><subsection ssid="3-3-24" dnum="4-o" numlevel="1" lineno="81" slineno="2-39" level="1"><display>(4)</display>Unless contrary to a declaration, a rule may require a minimum lease term.</subsection><subsection ssid="3-3-25" dnum="5-o" numlevel="1" lineno="82" slineno="2-40" level="1"><display>(5)</display>Unless otherwise provided in the declaration, an association of unit owners may by rule:<subsection ssid="3-3-26" dnum="a-o" numlevel="1" lineno="83" slineno="2-41" level="2"><display>(a)</display>regulate the use, maintenance, repair, replacement, and modification of common <ln numlevel="1" lineno="84" slineno="2-42"/>areas and facilities;</subsection><subsection ssid="3-3-27" dnum="b-o" numlevel="1" lineno="85" slineno="2-43" level="2"><display>(b)</display>impose and receive any payment, fee, or charge for:<subsection ssid="3-3-28" dnum="i-o" numlevel="1" lineno="86" slineno="2-44" level="3"><display>(i)</display>the use, rental, or operation of the common areas, except limited common areas <ln numlevel="1" lineno="87" slineno="2-45"/>and facilities; and</subsection><subsection ssid="3-3-29" dnum="ii-o" numlevel="1" lineno="88" slineno="2-46" level="3"><display>(ii)</display>a service provided to a unit owner;</subsection></subsection><subsection ssid="3-3-30" dnum="c-o" numlevel="1" lineno="89" slineno="2-47" level="2"><display>(c)</display>impose a charge for a late payment of an assessment; or</subsection><subsection ssid="3-3-31" dnum="d-o" numlevel="1" lineno="90" slineno="2-48" level="2"><display>(d)</display>provide for the indemnification of the association of unit owners' officers and <ln numlevel="1" lineno="91" slineno="2-49"/>management committee consistent with Title 16, Chapter 6a, Utah Revised Nonprofit <ln numlevel="1" lineno="92" slineno="2-50"/>Corporation Act.</subsection></subsection><subsection ssid="3-3-32" dnum="6-o" numlevel="1" lineno="93" slineno="2-51" level="1" space="false"><display>(6)</display><subsection ssid="3-3-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (6)(b), a rule may not prohibit a unit owner from <ln numlevel="1" lineno="94" slineno="2-52"/>installing a personal security camera immediately adjacent to the entryway, window, <ln numlevel="1" lineno="95" slineno="2-53"/>or other outside entry point of the owner's condominium unit.</subsection><subsection ssid="3-3-34" dnum="b-o" numlevel="1" lineno="96" slineno="2-54" level="2"><display>(b)</display>A rule may prohibit a unit owner from installing a personal security camera in a <ln numlevel="1" lineno="97" slineno="2-55"/>common area not physically connected to the owner's unit.</subsection></subsection><subsection ssid="3-3-35" dnum="7-o" numlevel="1" lineno="98" slineno="2-56" level="1" space="false"><display>(7)</display><subsection ssid="3-3-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not abridge the right of a unit owner to display a religious or holiday <ln numlevel="1" lineno="99" slineno="2-57"/>sign, symbol, or decoration inside the owner's condominium unit.</subsection><subsection ssid="3-3-37" dnum="b-o" numlevel="1" lineno="100" slineno="2-58" level="2"><display>(b)</display>An association may adopt a reasonable time, place, and manner restriction with <ln numlevel="1" lineno="101" slineno="2-59"/>respect to a display that is visible from the exterior of a unit.</subsection></subsection><subsection ssid="3-3-38" dnum="8-o" numlevel="1" lineno="102" slineno="2-60" level="1" space="false"><display>(8)</display><subsection ssid="3-3-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not:<subsection ssid="3-3-40" dnum="i-o" numlevel="1" lineno="103" slineno="2-61" level="3" tab="1"><display>(i)</display>prohibit a unit owner from displaying in a window of the owner's condominium <ln numlevel="1" lineno="104" slineno="2-62"/>unit:<subsection ssid="3-3-41" dnum="A-o" numlevel="1" lineno="105" slineno="2-63" level="4"><display>(A)</display>a for-sale sign;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="468" groupid="365" style="2" owner="ahaskell" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="3-3-42" dnum="B-o" numlevel="1" lineno="106" slineno="2-64" level="4"><display>(B)</display>a political sign;<amend anum="0" ea="amend" pairid="464" groupid="361" style="1" owner="ahaskell" level="1" amendtag="both"> or</amend></subsection><subsection ssid="3-141" dnum="_-o:C-i" numlevel="1" lineno="107" slineno="2-65" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="462" groupid="359" style="1" owner="ahaskell" level="1" amendtag="end">a political flag; or</amend></subsection></subsection><subsection ssid="3-3-43" dnum="ii-o" numlevel="1" lineno="108" slineno="2-66" level="3" tab="1"><display>(ii)</display><amend anum="0" ea="amend" pairid="453" groupid="351" style="1" owner="ahaskell" level="1" amendtag="both">except as provided in Subsection <xref refnumber="57-8-8.1(8)(b)" depth="4">(8)(b)</xref>, </amend>regulate the content<amend anum="0" ea="amend" pairid="396" groupid="311" style="1" owner="ahaskell" level="1" amendtag="both"> or establish specific <ln numlevel="1" lineno="109" slineno="2-67"/>design criteria for the content</amend> of a political sign<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="478" groupid="374" style="2" owner="ahaskell" level="1" deltag="both">; and</subsection><subsection ssid="3-3-50" dnum="iii-o" numlevel="1" lineno="121" slineno="2-79" level="3"><display>(iii)</display>limiting permissible plant material to specific water wise plant material;</subsection></subsection><subsection ssid="3-3-51" dnum="b-o" numlevel="1" lineno="122" slineno="2-80" level="2"><display>(b)</display>may not prohibit low water use on lawns during drought conditions; and</subsection><subsection ssid="3-3-52" dnum="c-o" numlevel="1" lineno="123" slineno="2-81" level="2"><display>(c)</display>may not prohibit or restrict the conversion of a grass park strip to water-efficient <ln numlevel="1" lineno="124" slineno="2-82"/>landscaping.</subsection></subsection><subsection ssid="3-3-53" dnum="10-o" numlevel="1" lineno="125" slineno="2-83" level="1"><display>(10)</display>A rule may restrict a sex offender from accessing a protected area that is maintained, <ln numlevel="1" lineno="126" slineno="2-84"/>operated, or owned by the association, subject to the exceptions described in Subsection <xref depth="3" refnumber="77-27-21.7"><ln numlevel="1" lineno="127" slineno="2-85"/>77-27-21.7</xref>(3).</subsection><subsection ssid="3-3-54" dnum="11-o" numlevel="1" lineno="128" slineno="2-86" level="1" space="false"><display>(11)</display><subsection ssid="3-3-55" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in this Subsection (11), a rule may not prohibit a unit owner <ln numlevel="1" lineno="129" slineno="2-87"/>from making modifications, consistent with industry standards, for radon mitigation.</subsection><subsection ssid="3-3-56" dnum="b-o" numlevel="1" lineno="130" slineno="2-88" level="2"><display>(b)</display>Subsection (11)(a) does not apply if the modifications would violate:<subsection ssid="3-3-57" dnum="i-o" numlevel="1" lineno="131" slineno="2-89" level="3"><display>(i)</display>a local land use ordinance;</subsection><subsection ssid="3-3-58" dnum="ii-o" numlevel="1" lineno="132" slineno="2-90" level="3"><display>(ii)</display>a building code;</subsection><subsection ssid="3-3-59" dnum="iii-o" numlevel="1" lineno="133" slineno="2-91" level="3"><display>(iii)</display>a health code; or</subsection><subsection ssid="3-3-60" dnum="iv-o" numlevel="1" lineno="134" slineno="2-92" level="3"><display>(iv)</display>a fire code.</subsection></subsection><subsection ssid="3-3-61" dnum="c-o" numlevel="1" lineno="135" slineno="2-93" level="2"><display>(c)</display>A rule governing the placement or external appearance of modifications may apply to <ln numlevel="1" lineno="136" slineno="2-94"/>modifications for radon mitigation unless the rule would:<subsection ssid="3-3-62" dnum="i-o" numlevel="1" lineno="137" slineno="2-95" level="3"><display>(i)</display>unreasonably interfere with the modifications' functionality; or</subsection><subsection ssid="3-3-63" dnum="ii-o" numlevel="1" lineno="138" slineno="2-96" level="3"><display>(ii)</display>add more than 40% of the modifications' original cost to the cost of installing the <ln numlevel="1" lineno="139" slineno="2-97"/>modifications.</subsection></subsection><subsection ssid="3-3-64" dnum="d-o" numlevel="1" lineno="140" slineno="2-98" level="2"><display>(d)</display>A rule may require that a unit owner making modifications related to radon <ln numlevel="1" lineno="141" slineno="2-99"/>mitigation:<subsection ssid="3-3-65" dnum="i-o" numlevel="1" lineno="142" slineno="2-100" level="3"><display>(i)</display>demonstrate or provide proof of radon contamination; provided in Subsection <xref depth="4" refnumber="57-8a-218(1)(b)" start="0">(1)(b)</xref>, a rule shall treat similarly situated lot <ln numlevel="1" lineno="199" slineno="4-5"/>owners similarly.</subsection><subsection ssid="15-15-3" dnum="b-o" numlevel="1" lineno="200" slineno="4-6" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(1)(a)" start="0">(1)(a)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may:<subsection ssid="15-15-4" dnum="i-o" numlevel="1" lineno="201" slineno="4-7" level="3"><display>(i)</display>vary according to the level and type of service that the association provides to lot <ln numlevel="1" lineno="202" slineno="4-8"/>owners;</subsection><subsection ssid="15-15-5" dnum="ii-o" numlevel="1" lineno="203" slineno="4-9" level="3"><display>(ii)</display>differ between residential and nonresidential uses; and</subsection><subsection ssid="15-15-6" dnum="iii-o" numlevel="1" lineno="204" slineno="4-10" level="3"><display>(iii)</display>for a lot that an owner leases for a term of less than 30 days, impose a reasonable <ln numlevel="1" lineno="205" slineno="4-11"/>limit on the number of individuals who may use the common areas and facilities <ln numlevel="1" lineno="206" slineno="4-12"/>as guests of the lot tenant or lot owner.</subsection></subsection></subsection><subsection ssid="15-15-7" dnum="2-o" numlevel="1" lineno="207" slineno="4-13" level="1" space="false"><display>(2)</display><subsection ssid="15-15-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="ahaskell" level="1" deltag="both">If</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (2)(b), if</amend> a lot owner owns a rental lot and is <ln numlevel="1" lineno="208" slineno="4-14"/>in compliance with the association's governing documents and any rule that the <ln numlevel="1" lineno="209" slineno="4-15"/>association adopts under Subsection (4), a rule may not treat the lot owner differently <ln numlevel="1" lineno="210" slineno="4-16"/>because the lot owner owns a rental lot.</subsection><subsection ssid="15-15-9" dnum="b-o" numlevel="1" lineno="211" slineno="4-17" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(2)(a)" start="0">(2)(a)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may:<subsection ssid="15-15-10" dnum="i-o" numlevel="1" lineno="212" slineno="4-18" level="3"><display>(i)</display>limit or prohibit a rental lot owner from using the common areas for purposes <ln numlevel="1" lineno="213" slineno="4-19"/>other than attending an association meeting or managing the rental lot;</subsection><subsection ssid="15-15-11" dnum="ii-o" numlevel="1" lineno="214" slineno="4-20" level="3"><display>(ii)</display>if the rental lot owner retains the right to use the association's common areas, <ln numlevel="1" lineno="215" slineno="4-21"/>even occasionally:<subsection ssid="15-15-12" dnum="A-o" numlevel="1" lineno="216" slineno="4-22" level="4"><display>(A)</display>charge a rental lot owner a fee to use the common areas; or</subsection><subsection ssid="15-15-13" dnum="B-o" numlevel="1" lineno="217" slineno="4-23" level="4"><display>(B)</display>for a lot that an owner leases for a term of less than 30 days, impose a <ln numlevel="1" lineno="218" slineno="4-24"/>reasonable limit on the number of individuals who may use the common areas <ln numlevel="1" lineno="219" slineno="4-25"/>and facilities as guests of the lot tenant or lot owner; or</subsection></subsection><subsection ssid="15-15-14" dnum="iii-o" numlevel="1" lineno="220" slineno="4-26" level="3"><display>(iii)</display>include a provision in the association's governing documents that:<subsection ssid="15-15-15" dnum="A-o" numlevel="1" lineno="221" slineno="4-27" level="4"><display>(A)</display>requires each tenant of a rental lot to abide by the terms of the governing <ln numlevel="1" lineno="222" slineno="4-28"/>documents; and</subsection><subsection ssid="15-15-16" dnum="B-o" numlevel="1" lineno="223" slineno="4-29" level="4"><display>(B)</display>holds the tenant and the rental lot owner jointly and severally liable for a <ln numlevel="1" lineno="224" slineno="4-30"/>violation of a provision of the governing documents.</subsection></subsection></subsection></subsection><subsection ssid="15-15-17" dnum="3-o" numlevel="1" lineno="225" slineno="4-31" level="1" space="false"><display>(3)</display><subsection ssid="15-15-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="18" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (3)(b), a</amend> rule <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="22" style="2" owner="ahaskell" level="1" deltag="both">criterion </amend><amendoutend style="2"/>may not abridge the <ln numlevel="1" lineno="226" slineno="4-32"/>rights of a lot owner to display a religious or holiday sign, symbol, or decoration<amend anum="0" ea="amend" pairid="24" groupid="21" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="26" groupid="23" style="2" owner="ahaskell" level="1" deltag="end">inside a dwelling on a lot; or</amend><amendoutend style="2"/></subsection><subsection ssid="15-15-20" dnum="ii-o:_-i" numlevel="1" lineno="228" slineno="4-34" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1128" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="35" groupid="31" style="2" owner="ahaskell" level="1" deltag="end">outside a dwelling on:</amend><amendoutend style="2"/></subsection><subsection ssid="15-15-21" dnum="A-o:i-i" numlevel="1" lineno="229" slineno="4-35" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" space="true">(ii)</amend></display>the exterior of the dwelling, unless the association has an ownership interest <ln numlevel="1" lineno="231" slineno="4-37"/>in, or a maintenance, repair, or replacement obligation for, the exterior; or</subsection><subsection ssid="15-15-23" dnum="C-o:iii-i" numlevel="1" lineno="232" slineno="4-38" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1131" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1132" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the front yard of the dwelling, unless the association has an ownership <ln numlevel="1" lineno="233" slineno="4-39"/>interest in, or a maintenance, repair, or replacement obligation for, the yard.</subsection></subsection><subsection ssid="15-15-24" dnum="b-o" numlevel="1" lineno="234" slineno="4-40" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="37" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(3)(a)" start="0">(3)(a)</xref>, the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="35" style="1" owner="ahaskell" level="1" amendtag="both" space="true">The</amend> association may adopt a reasonable <ln numlevel="1" lineno="235" slineno="4-41"/>time, place, and manner restriction with respect to a display that is:<subsection ssid="15-15-25" dnum="i-o" numlevel="1" lineno="236" slineno="4-42" level="3"><display>(i)</display>outside a dwelling on:<subsection ssid="15-15-26" dnum="A-o" numlevel="1" lineno="237" slineno="4-43" level="4"><display>(A)</display>a lot;</subsection><subsection ssid="15-15-27" dnum="B-o" numlevel="1" lineno="238" slineno="4-44" level="4"><display>(B)</display>the exterior of the dwelling; or</subsection><subsection ssid="15-15-28" dnum="C-o" numlevel="1" lineno="239" slineno="4-45" level="4"><display>(C)</display>the front yard of the dwelling; and</subsection></subsection><subsection ssid="15-15-29" dnum="ii-o" numlevel="1" lineno="240" slineno="4-46" level="3"><display>(ii)</display>visible from outside the lot.</subsection></subsection></subsection><subsection ssid="15-15-30" dnum="4-o" numlevel="1" lineno="241" slineno="4-47" level="1" space="false"><display>(4)</display><subsection ssid="15-15-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not prohibit a lot owner from displaying a political sign<amend anum="0" ea="amend" pairid="41" groupid="36" style="1" owner="ahaskell" level="1" amendtag="both"> or political <ln numlevel="1" lineno="242" slineno="4-48"/>flag on</amend>:<subsection ssid="15-15-32" dnum="i-o:_-i" numlevel="1" lineno="243" slineno="4-49" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1140" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="45" groupid="40" style="2" owner="ahaskell" level="1" deltag="end">inside a dwelling on a lot; or</amend><amendoutend style="2"/><amend anum="0" ea="erase" pairid="1144" style="2" owner="o" level="1" deltag="both">(C)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1145" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the front yard of the dwelling, regardless of whether the association has an <ln numlevel="1" lineno="249" slineno="4-55"/>ownership interest in the yard.</subsection></subsection><subsection ssid="15-15-37" dnum="b-o" numlevel="1" lineno="250" slineno="4-56" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="301" groupid="246" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="300" groupid="245" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection <xref refnumber="57-8a-218(4)(c)" depth="4">(4)(c)</xref>, a</amend> rule may not regulate the content of a <ln numlevel="1" lineno="251" slineno="4-57"/>political sign<amend anum="0" ea="amend" pairid="60" groupid="53" style="1" owner="ahaskell" level="1" amendtag="both"> or political flag.</amend></subsection><subsection ssid="15-172" dnum="_-o:c-i" numlevel="1" lineno="252" slineno="4-58" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="295" groupid="241" style="1" owner="ahaskell" level="1" amendtag="end">A rule may restrict a political sign or political flag that contains obscene, profane, or <ln numlevel="1" lineno="253" slineno="4-59"/>commercial content</amend>.</subsection><subsection ssid="15-15-38" dnum="c-o:d-i" numlevel="1" lineno="254" slineno="4-60" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1147" style="2" owner="o" level="1" level="1" amendtag="both" space="true">(e)</amend></display>An association design provision may not establish design criteria for a political <ln numlevel="1" lineno="257" slineno="4-63"/>sign<amend anum="0" ea="amend" pairid="228" groupid="195" style="1" owner="ahaskell" level="1" amendtag="both"> or political flag</amend>.</subsection></subsection><subsection ssid="15-15-40" dnum="5-o" pairid="1156" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>the front yard of the dwelling, regardless of whether the association has an <ln numlevel="1" lineno="265" slineno="4-71"/>ownership interest in the yard.</subsection></subsection><subsection ssid="15-15-47" dnum="b-o" numlevel="1" lineno="266" slineno="4-72" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="96" groupid="87" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(5)(a)" start="0">(5)(a)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="87" groupid="78" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may reasonably regulate the time, <ln numlevel="1" lineno="267" slineno="4-73"/>place, and manner of posting a for-sale sign.</subsection></subsection><subsection ssid="15-15-48" dnum="6-o" numlevel="1" lineno="268" slineno="4-74" level="1" space="false"><display>(6)</display><subsection ssid="15-15-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="99" groupid="90" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="89" groupid="80" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (6)(b), a</amend> rule may not interfere with the <ln numlevel="1" lineno="269" slineno="4-75"/>freedom of a lot owner to determine the composition of the lot owner's household.</subsection><subsection ssid="15-15-50" dnum="b-o" numlevel="1" lineno="270" slineno="4-76" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="100" groupid="91" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(6)(a)" start="0">(6)(a)</xref>, an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="90" groupid="81" style="1" owner="ahaskell" level="1" amendtag="both" space="true">An</amend> association may:<subsection ssid="15-15-51" dnum="i-o" numlevel="1" lineno="271" slineno="4-77" level="3"><display>(i)</display>require that all occupants of a dwelling be members of a single housekeeping unit; <ln numlevel="1" lineno="272" slineno="4-78"/>or</subsection><subsection ssid="15-15-52" dnum="ii-o" numlevel="1" lineno="273" slineno="4-79" level="3"><display>(ii)</display>limit the total number of occupants permitted in each residential dwelling on the <ln numlevel="1" lineno="274" slineno="4-80"/>basis of the residential dwelling's:<subsection ssid="15-15-53" dnum="A-o" numlevel="1" lineno="275" slineno="4-81" level="4"><display>(A)</display>size and facilities; and</subsection><subsection ssid="15-15-54" dnum="B-o" numlevel="1" lineno="276" slineno="4-82" level="4"><display>(B)</display>fair use of the common areas.</subsection></subsection></subsection></subsection><subsection ssid="15-15-55" dnum="7-o" numlevel="1" lineno="277" slineno="4-83" level="1" space="false"><display>(7)</display><subsection ssid="15-15-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="103" groupid="94" style="2" owner="ahaskell" level="1" deltag="both">A</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="92" groupid="83" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Except as provided in Subsection (7)(b), a</amend> rule may not interfere with a <ln numlevel="1" lineno="278" slineno="4-84"/>reasonable activity of a lot owner within the confines of a dwelling or lot, including <ln numlevel="1" lineno="279" slineno="4-85"/>backyard landscaping or amenities, to the extent that the activity is in compliance <ln numlevel="1" lineno="280" slineno="4-86"/>with local laws and ordinances, including nuisance laws and ordinances.</subsection><subsection ssid="15-15-57" dnum="b-o" numlevel="1" lineno="281" slineno="4-87" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="104" groupid="95" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(7)(a)" start="0">(7)(a)</xref>, a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="93" groupid="84" style="1" owner="ahaskell" level="1" amendtag="both" space="true">A</amend> rule may prohibit an activity within the <ln numlevel="1" lineno="282" slineno="4-88"/>confines of a dwelling or lot, including backyard landscaping or amenities, if the <ln numlevel="1" lineno="283" slineno="4-89"/>activity:<subsection ssid="15-15-58" dnum="i-o" numlevel="1" lineno="284" slineno="4-90" level="3"><display>(i)</display>is not normally associated with a project restricted to residential use; or</subsection><subsection ssid="15-15-59" dnum="ii-o" numlevel="1" lineno="285" slineno="4-91" level="3" space="false"><display>(ii)</display><subsection ssid="15-15-60" dnum="A-o" level="4" placement="sameline"><display>(A)</display>creates monetary costs for the association or other lot owners;</subsection><subsection ssid="15-15-61" dnum="B-o" numlevel="1" lineno="286" slineno="4-92" level="4"><display>(B)</display>creates a danger to the health or safety of occupants of other lots;</subsection><subsection ssid="15-15-62" dnum="C-o" numlevel="1" lineno="287" slineno="4-93" level="4"><display>(C)</display>generates excessive noise or traffic;</subsection><subsection ssid="15-15-63" dnum="D-o" numlevel="1" lineno="288" slineno="4-94" level="4"><display>(D)</display>creates unsightly conditions visible <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="107" groupid="98" style="2" owner="ahaskell" level="1" deltag="both">from</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="94" groupid="85" style="1" owner="ahaskell" level="1" amendtag="both" space="true">to an individual standing</amend> outside the <ln numlevel="1" lineno="289" slineno="4-95"/>dwelling;</subsection><subsection ssid="15-15-64" dnum="E-o" numlevel="1" lineno="290" slineno="4-96" level="4"><display>(E)</display>creates an unreasonable source of annoyance to persons outside the lot; or</subsection><subsection ssid="15-15-65" dnum="F-o" numlevel="1" lineno="291" slineno="4-97" level="4"><display>(F)</display>if there are attached dwellings, creates the potential for smoke to enter another <ln numlevel="1" lineno="292" slineno="4-98"/>lot owner's dwelling, the common areas, or limited common areas.</subsection></subsection></subsection><subsection ssid="15-15-66" dnum="c-o" numlevel="1" lineno="293" slineno="4-99" level="2"><display>(c)</display>If permitted by law, an association may adopt rules described in Subsection <xref depth="4" refnumber="57-8a-218(7)(b)" start="0">(7)(b)</xref> <ln numlevel="1" lineno="294" slineno="4-100"/>that affect the use of or behavior inside the dwelling.</subsection></subsection><subsection ssid="15-15-67" dnum="8-o" numlevel="1" lineno="295" slineno="4-101" level="1" space="false"><display>(8)</display><subsection ssid="15-15-68" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not, to the detriment of a lot owner and over the lot owner's written <ln numlevel="1" lineno="296" slineno="4-102"/>objection to the board, alter the allocation of financial burdens among the various lots.</subsection><subsection ssid="15-15-69" dnum="b-o" numlevel="1" lineno="297" slineno="4-103" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="108" groupid="99" style="2" owner="ahaskell" level="1" deltag="both">Notwithstanding Subsection <xref depth="4" refnumber="57-8a-218(7)(b)" start="0">(7)(b)</xref>, an</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="95" groupid="86" style="1" owner="ahaskell" level="1" amendtag="both" space="true">An</amend> association may:<subsection ssid="15-15-70" dnum="i-o" numlevel="1" lineno="298" slineno="4-104" level="3"><display>(i)</display>change the common areas available to a lot owner;</subsection><subsection ssid="15-15-71" dnum="ii-o" numlevel="1" lineno="299" slineno="4-105" level="3"><display>(ii)</display>adopt generally applicable rules for the use of common areas; or</subsection><subsection ssid="15-15-72" dnum="iii-o" numlevel="1" lineno="300" slineno="4-106" level="3"><display>(iii)</display>deny use privileges to a lot owner who:<subsection ssid="15-15-73" dnum="A-o" numlevel="1" lineno="301" slineno="4-107" level="4"><display>(A)</display>is delinquent in paying assessments;</subsection><subsection ssid="15-15-74" dnum="B-o" numlevel="1" lineno="302" slineno="4-108" level="4"><display>(B)</display>abuses the common areas; or</subsection><subsection ssid="15-15-75" dnum="C-o" numlevel="1" lineno="303" slineno="4-109" level="4"><display>(C)</display>violates the governing documents.</subsection></subsection></subsection><subsection ssid="15-15-76" dnum="c-o" numlevel="1" lineno="304" slineno="4-110" level="2"><display>(c)</display>This Subsection <xref depth="4" refnumber="57-8a-218(8)" start="0">(8)</xref> does not permit a rule that:<subsection ssid="15-15-77" dnum="i-o" numlevel="1" lineno="305" slineno="4-111" level="3"><display>(i)</display>alters the method of levying assessments; or</subsection><subsection ssid="15-15-78" dnum="ii-o" numlevel="1" lineno="306" slineno="4-112" level="3"><display>(ii)</display>increases the amount of assessments as provided in the declaration.</subsection></subsection></subsection><subsection ssid="15-15-79" dnum="9-o" numlevel="1" lineno="307" slineno="4-113" level="1" space="false"><display>(9)</display><subsection ssid="15-15-80" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="57-8a-218(9)(b)" start="0">(9)(b)</xref>, a rule may not:<subsection ssid="15-15-81" dnum="i-o" numlevel="1" lineno="308" slineno="4-114" level="3" tab="1"><display>(i)</display>prohibit the transfer of a lot; or</subsection><subsection ssid="15-15-82" dnum="ii-o" numlevel="1" lineno="309" slineno="4-115" level="3" tab="1"><display>(ii)</display>require the consent of the association or board to transfer a lot.</subsection></subsection><subsection ssid="15-15-83" dnum="b-o" numlevel="1" lineno="310" slineno="4-116" level="2"><display>(b)</display>Unless contrary to a declaration, a rule may require a minimum lease term.</subsection></subsection><subsection ssid="15-15-84" dnum="10-o" numlevel="1" lineno="311" slineno="4-117" level="1" space="false"><display>(10)</display><subsection ssid="15-15-85" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A rule may not require a lot owner to dispose of personal property that was in or <ln numlevel="1" lineno="312" slineno="4-118"/>on a lot before the adoption of the rule or design criteria if the personal property was <ln numlevel="1" lineno="313" slineno="4-119"/>in compliance with all rules and other governing documents previously in force.</subsection><subsection ssid="15-15-86" dnum="b-o" numlevel="1" lineno="314" slineno="4-120" level="2"><display>(b)</display>The exemption in Subsection <xref depth="4" refnumber="57-8a-218(10)(a)" start="0">(10)(a)</xref>:<subsection ssid="15-15-87" dnum="i-o" numlevel="1" lineno="315" slineno="4-121" level="3"><display>(i)</display>applies during the period of the lot owner's ownership of the lot; and</subsection><subsection ssid="15-15-88" dnum="ii-o" numlevel="1" lineno="316" slineno="4-122" level="3"><display>(ii)</display>does not apply to a subsequent lot owner who takes title to the lot after adoption <ln numlevel="1" lineno="317" slineno="4-123"/>of the rule described in Subsection <xref depth="4" refnumber="57-8a-218(10)(a)" start="0">(10)(a)</xref>.</subsection></subsection></subsection><subsection ssid="15-15-89" dnum="11-o" numlevel="1" lineno="318" slineno="4-124" level="1"><display>(11)</display>A rule or action by the association or action by the board may not unreasonably <ln numlevel="1" lineno="319" slineno="4-125"/>impede a declarant's ability to satisfy existing development financing for community <ln numlevel="1" lineno="320" slineno="4-126"/>improvements and right to develop:<subsection ssid="15-15-90" dnum="a-o" numlevel="1" lineno="321" slineno="4-127" level="2"><display>(a)</display>the project; or</subsection><subsection ssid="15-15-91" dnum="b-o" numlevel="1" lineno="322" slineno="4-128" level="2"><display>(b)</display>other properties in the vicinity of the project.</subsection></subsection><subsection ssid="15-15-92" dnum="12-o" numlevel="1" lineno="323" slineno="4-129" level="1"><display>(12)</display>A rule or association or board action may not interfere with:<subsection ssid="15-15-93" dnum="a-o" numlevel="1" lineno="324" slineno="4-130" level="2"><display>(a)</display>the use or operation of an amenity that the association does not own or control; or</subsection><subsection ssid="15-15-94" dnum="b-o" numlevel="1" lineno="325" slineno="4-131" level="2"><display>(b)</display>the exercise of a right associated with an easement.</subsection></subsection><subsection ssid="15-15-95" dnum="13-o" numlevel="1" lineno="326" slineno="4-132" level="1"><display>(13)</display>A rule may not divest a lot owner of the right to proceed in accordance with a <ln numlevel="1" lineno="327" slineno="4-133"/>completed application for design review, or to proceed in accordance with another <ln numlevel="1" lineno="328" slineno="4-134"/>approval process, under the terms of the governing documents in existence at the time <ln numlevel="1" lineno="329" slineno="4-135"/>the completed application was submitted by the owner for review.</subsection><subsection ssid="15-15-96" dnum="14-o" numlevel="1" lineno="330" slineno="4-136" level="1"><display>(14)</display>Unless otherwise provided in the declaration, an association may by rule:<subsection ssid="15-15-97" dnum="a-o" numlevel="1" lineno="331" slineno="4-137" level="2"><display>(a)</display>regulate the use, maintenance, repair, replacement, and modification of common <ln numlevel="1" lineno="332" slineno="4-138"/>areas;</subsection><subsection ssid="15-15-98" dnum="b-o" numlevel="1" lineno="333" slineno="4-139" level="2"><display>(b)</display>impose and receive any payment, fee, or charge for:<subsection ssid="15-15-99" dnum="i-o" numlevel="1" lineno="334" slineno="4-140" level="3"><display>(i)</display>the use, rental, or operation of the common areas, except limited common areas; <ln numlevel="1" lineno="335" slineno="4-141"/>and</subsection><subsection ssid="15-15-100" dnum="ii-o" numlevel="1" lineno="336" slineno="4-142" level="3"><display>(ii)</display>a service provided to a lot owner;</subsection></subsection><subsection ssid="15-15-101" dnum="c-o" numlevel="1" lineno="337" slineno="4-143" level="2"><display>(c)</display>impose a charge for a late payment of an assessment; or</subsection><subsection ssid="15-15-102" dnum="d-o" numlevel="1" lineno="338" slineno="4-144" level="2"><display>(d)</display>provide for the indemnification of the association's officers and board consistent with <xref depth="2" refnumber="16-6a" start="0"><ln numlevel="1" lineno="339" slineno="4-145"/>Title 16, Chapter 6a, Utah Revised Nonprofit Corporation Act</xref>.</subsection></subsection><subsection ssid="15-15-103" dnum="15-o:_-i" numlevel="1" lineno="340" slineno="4-146" ea="erase" anum="0" owner="ahaskell" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1212" style="2" owner="o" level="1" deltag="start">(15)</amend></display><amend anum="0" ea="erase" pairid="111" groupid="102" style="2" owner="ahaskell" level="1" deltag="end">A rule may not prohibit a lot owner from installing a personal security camera <ln numlevel="1" lineno="341" slineno="4-147"/>immediately adjacent to the entryway, window, or other outside entry point of the <ln numlevel="1" lineno="342" slineno="4-148"/>owner's dwelling unit.</amend><amendoutend style="2"/></subsection><subsection ssid="15-15-104" dnum="16-o:15-i" numlevel="1" lineno="343" slineno="4-149" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1213" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display><subsection ssid="15-15-105" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For any area for which one or more lot owners are responsible for <ln numlevel="1" lineno="344" slineno="4-150"/>landscape maintenance of any landscaping within the lot owner's lot or the common <ln numlevel="1" lineno="345" slineno="4-151"/>areas, the association shall adopt rules supporting water wise landscaping as defined <ln numlevel="1" lineno="346" slineno="4-152"/>in Section <xref depth="3" refnumber="57-8a-231">57-8a-231</xref> including:<subsection ssid="15-15-106" dnum="i-o" numlevel="1" lineno="347" slineno="4-153" level="3" tab="1"><display>(i)</display>low water use requirements on lawns during drought conditions;</subsection><subsection ssid="15-15-107" dnum="ii-o" numlevel="1" lineno="348" slineno="4-154" level="3" tab="1"><display>(ii)</display>design criterion for water wise landscaping; and</subsection><subsection ssid="15-15-108" dnum="iii-o" numlevel="1" lineno="349" slineno="4-155" level="3" tab="1"><display>(iii)</display>limiting permissible plant material to specific water wise plant material.</subsection></subsection><subsection ssid="15-15-109" dnum="b-o" numlevel="1" lineno="350" slineno="4-156" level="2"><display>(b)</display>A rule may not:<subsection ssid="15-15-110" dnum="i-o" numlevel="1" lineno="351" slineno="4-157" level="3"><display>(i)</display>prohibit or restrict the conversion of a grass park strip to water wise landscaping <ln numlevel="1" lineno="352" slineno="4-158"/>as defined in Section <xref depth="3" refnumber="57-8a-231">57-8a-231</xref>; or</subsection><subsection ssid="15-15-111" dnum="ii-o" numlevel="1" lineno="353" slineno="4-159" level="3"><display>(ii)</display>prohibit low water use on lawns during drought conditions.</subsection></subsection></subsection><subsection ssid="15-15-112" dnum="17-o:16-i" numlevel="1" lineno="354" slineno="4-160" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1221" style="2" owner="o" level="1" deltag="both">(17)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display><subsection ssid="15-15-113" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="123" groupid="113" style="2" owner="ahaskell" level="1" deltag="both">(17)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="119" groupid="109" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(16)(b)</amend>, a rule may not prohibit <ln numlevel="1" lineno="355" slineno="4-161"/>the owner of a residential lot from constructing an internal accessory dwelling unit, <ln numlevel="1" lineno="356" slineno="4-162"/>as defined in Section <xref depth="3" refnumber="10-9a-530">10-9a-530</xref> or <xref depth="3" refnumber="17-27a-526">17-27a-526</xref>, within the owner's residential lot.</subsection><subsection ssid="15-15-114" dnum="b-o" numlevel="1" lineno="357" slineno="4-163" level="2"><display>(b)</display>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="124" groupid="114" style="2" owner="ahaskell" level="1" deltag="both">(17)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="120" groupid="110" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(16)(a)</amend> does not apply if the construction would violate:<subsection ssid="15-15-115" dnum="i-o" numlevel="1" lineno="358" slineno="4-164" level="3"><display>(i)</display>a local ea="erase" pairid="126" groupid="116" style="2" owner="ahaskell" level="1" deltag="both">(18)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="122" groupid="112" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(17)(a)</amend> does not apply if the modifications would violate:<subsection ssid="15-15-122" dnum="i-o" numlevel="1" lineno="366" slineno="4-172" level="3"><display>(i)</display>a local land use ordinance;</subsection><subsection ssid="15-15-123" dnum="ii-o" numlevel="1" lineno="367" slineno="4-173" level="3"><display>(ii)</display>a building code;</subsection><subsection ssid="15-15-124" dnum="iii-o" numlevel="1" lineno="368" slineno="4-174" level="3"><display>(iii)</display>a health code; or</subsection><subsection ssid="15-15-125" dnum="iv-o" numlevel="1" lineno="369" slineno="4-175" level="3"><display>(iv)</display>a fire code.</subsection></subsection><subsection ssid="15-15-126" dnum="c-o" numlevel="1" lineno="370" slineno="4-176" level="2"><display>(c)</display>A rule governing the placement or external appearance of modifications for radon <ln numlevel="1" lineno="371" slineno="4-177"/>mitigation does not apply to a lot owner's modifications if the rule would:<subsection ssid="15-15-127" dnum="i-o" numlevel="1" lineno="372" slineno="4-178" level="3"><display>(i)</display>unreasonably interfere with the modifications' functionality; or</subsection><subsection ssid="15-15-128" dnum="ii-o" numlevel="1" lineno="373" slineno="4-179" level="3"><display>(ii)</display>add more than 40% of the modifications' original cost to the cost of installing the <ln numlevel="1" lineno="374" slineno="4-180"/>modifications.</subsection></subsection><subsection ssid="15-15-129" dnum="d-o" numlevel="1" lineno="375" slineno="4-181" level="2"><display>(d)</display>A rule may require that a lot owner making modifications related to radon mitigation:<subsection ssid="15-15-130" dnum="i-o" numlevel="1" lineno="376" slineno="4-182" level="3"><display>(i)</display>demonstrate or provide proof of radon contamination; and</subsection><subsection ssid="15-15-131" dnum="ii-o" numlevel="1" lineno="377" slineno="4-183" level="3"><display>(ii)</display>provide proof that the modifications and any related construction will be <ln numlevel="1" lineno="378" slineno="4-184"/>performed by a licensed person.</subsection></subsection></subsection><subsection ssid="15-15-132" dnum="19-o:18-i" numlevel="1" lineno="379" slineno="4-185" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1241" style="2" owner="o" level="1" deltag="both">(19)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="both" space="true">(18)</amend></display>A rule may restrict a sex offender from accessing a protected area that is <ln numlevel="1" lineno="380" slineno="4-186"/>maintained, operated, or owned by the association, subject to the exceptions described in <ln numlevel="1" lineno="381" slineno="4-187"/>Subsection <xref depth="3" refnumber="77-27-21.7">77-27-21.7</xref>(3).</subsection><subsection ssid="15-137" dnum="_-o:19-i" numlevel="1" lineno="382" slineno="4-188" ea="amend" ea="amend" pairid="136" groupid="121" style="1" owner="ahaskell" level="1" amendtag="end">A rule may not prohibit a vegetable garden on the rear yard of a lot on which the <ln numlevel="1" lineno="386" slineno="4-192"/>association does not have an ownership interest or a maintenance responsibility.</amend></subsection><subsection ssid="15-140" dnum="_-o:c-i" numlevel="1" lineno="387" slineno="4-193" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="125" style="1" owner="ahaskell" level="1" amendtag="end">A rule may:</amend><subsection ssid="15-141" dnum="_-o:i-i" numlevel="1" lineno="388" slineno="4-194" regulations on plant height, <ln numlevel="1" lineno="391" slineno="4-197"/>water use, fertilizer use, and weed maintenance; and</amend></subsection><subsection ssid="15-142" dnum="_-o:ii-i" numlevel="1" lineno="392" slineno="4-198" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="133" style="1" owner="ahaskell" level="1" amendtag="end">prohibit the cultivation of invasive or unlawful Water wise landscaping.</bold></catline><subsection ssid="9-9-1" dnum="1-o" numlevel="1" lineno="433" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="9-9-2" dnum="a-o" numlevel="1" lineno="434" slineno="5-4" level="2"><display>(a)</display>"Lawn or turf" means nonagricultural land planted in closely mowed, managed <ln numlevel="1" lineno="435" slineno="5-5"/>grasses.</subsection><subsection ssid="9-9-3" dnum="b-o" numlevel="1" lineno="436" slineno="5-6" level="2"><display>(b)</display>"Mulch" means material such as rock, bark, wood chips, or other materials left loose <ln numlevel="1" lineno="437" slineno="5-7"/>and applied to the soil.</subsection><subsection ssid="9-9-4" dnum="c-o" numlevel="1" lineno="438" slineno="5-8" level="2"><display>(c)</display>"Overhead spray irrigation" means above ground irrigation heads that spray water <ln numlevel="1" lineno="439" slineno="5-9"/>through a nozzle.</subsection><subsection ssid="9-9-5" dnum="d-o" numlevel="1" lineno="440" slineno="5-10" level="2" space="false"><display>(d)</display><subsection ssid="9-9-6" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Vegetative coverage" means the ground level surface area covered by the <ln numlevel="1" lineno="441" slineno="5-11"/>exposed leaf area of a plant or group of plants at full maturity.</subsection><subsection ssid="9-9-7" dnum="ii-o" numlevel="1" lineno="442" slineno="5-12" level="3"><display>(ii)</display>"Vegetative coverage" does not mean the ground level surface area covered by <ln numlevel="1" lineno="443" slineno="5-13"/>the exposed leaf area of a tree or trees.</subsection></subsection><subsection ssid="9-9-8" dnum="e-o" numlevel="1" lineno="444" slineno="5-14" level="2"><display>(e)</display>"Water wise landscaping" means any or all of the following:<subsection ssid="9-9-9" dnum="i-o" numlevel="1" lineno="445" slineno="5-15" level="3"><display>(i)</display>installation of plant materials suited to the microclimate and soil conditions that <ln numlevel="1" lineno="446" slineno="5-16"/>can:<subsection ssid="9-9-10" dnum="A-o" numlevel="1" lineno="447" slineno="5-17" level="4"><display>(A)</display>remain healthy with minimal irrigation once established; or</subsection><subsection ssid="9-9-11" dnum="B-o" numlevel="1" lineno="448" slineno="5-18" level="4"><display>(B)</display>be maintained without the use of overhead spray irrigation;</subsection></subsection><subsection ssid="9-9-12" dnum="ii-o" numlevel="1" lineno="449" slineno="5-19" level="3"><display>(ii)</display>use of water for outdoor irrigation through proper and efficient irrigation design <ln numlevel="1" lineno="450" slineno="5-20"/>and water application; or</subsection><subsection ssid="9-9-13" dnum="iii-o" numlevel="1" lineno="451" slineno="5-21" level="3"><display>(iii)</display>the use of other landscape design features that:<subsection ssid="9-9-14" dnum="A-o" numlevel="1" lineno="452" slineno="5-22" level="4"><display>(A)</display>minimize the need of the landscape for supplemental water from irrigation;</subsection><subsection ssid="9-9-15" dnum="B-o" numlevel="1" lineno="453" slineno="5-23" level="4"><display>(B)</display>reduce the landscape area dedicated to lawn or turf; or</subsection><subsection ssid="9-9-16" dnum="C-o" numlevel="1" lineno="454" slineno="5-24" level="4"><display>(C)</display>encourage vegetative coverage.</subsection></subsection></subsection><subsection ssid="9-9-17" dnum="f-o" numlevel="1" lineno="455" slineno="5-25" level="2"><display>(f)</display>"Water wise plant material" means a plant material suited to water wise landscaping <ln numlevel="1" lineno="456" slineno="5-26"/>as defined in this section.</subsection></subsection><subsection ssid="9-9-18" dnum="2-o" numlevel="1" lineno="457" slineno="5-27" level="1"><display>(2)</display>An association may not enact or enforce a governing document that prohibits, or has the <ln numlevel="1" lineno="458" slineno="5-28"/>effect of prohibiting, a lot owner of a detached dwelling from incorporating water wise <ln numlevel="1" lineno="459" slineno="5-29"/>landscaping on the lot owner's lot.</subsection><subsection ssid="9-9-19" dnum="3-o" numlevel="1" lineno="460" slineno="5-30" level="1" space="false"><display>(3)</display><subsection ssid="9-9-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection (3)(b), Subsection (2) does not prohibit an association from <ln numlevel="1" lineno="461" slineno="5-31"/>requiring a property owner to:<subsection ssid="9-9-21" dnum="i-o" numlevel="1" lineno="462" slineno="5-32" level="3" tab="1"><display>(i)</display>comply with a site plan review or other review process before installing water <ln numlevel="1" lineno="463" slineno="5-33"/>wise landscaping;</subsection><subsection ssid="9-9-22" dnum="ii-o" numlevel="1" lineno="464" slineno="5-34" level="3" tab="1"><display>(ii)</display>maintain plant material in a healthy condition; and</subsection><subsection ssid="9-9-23" dnum="iii-o" numlevel="1" lineno="465" slineno="5-35" level="3" tab="1"><display>(iii)</display>follow specific water wise landscaping design requirements adopted by the <ln numlevel="1" lineno="466" slineno="5-36"/>association including a requirement that:<subsection ssid="9-9-24" dnum="A-o" numlevel="1" lineno="467" slineno="5-37" level="4"><display>(A)</display>restricts or clarifies the use of mulches considered detrimental to the <ln numlevel="1" lineno="468" slineno="5-38"/>association's operations; and</subsection><subsection ssid="9-9-25" dnum="B-o" numlevel="1" lineno="469" slineno="5-39" level="4"><display>(B)</display>restricts or prohibits the use of specific plant materials other than water wise <ln numlevel="1" lineno="470" slineno="5-40"/>plant materials.</subsection></subsection></subsection><subsection ssid="9-9-26" dnum="b-o" numlevel="1" lineno="471" slineno="5-41" level="2"><display>(b)</display>An association may not require a lot owner to<amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both"> </amend>install or keep in place lawn or turf in <ln numlevel="1" lineno="472" slineno="5-42"/>an area.</subsection></subsection><subsection ssid="9-9-27" dnum="4-o" numlevel="1" lineno="473" slineno="5-43" level="1" space="false"><display>(4)</display><subsection ssid="9-9-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection (4)(b), if an association does not adopt rules as required by <ln numlevel="1" lineno="474" slineno="5-44"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="57-8a-218">57-8a-218</xref>(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="57-8a-218(15)" depth="4">57-8a-218(15)</xref></amend> and fails to remedy the noncompliance <ln numlevel="1" lineno="475" slineno="5-45"/>within the time specified in Subsection (4)(c), a lot owner may file an action in state <ln numlevel="1" lineno="476" slineno="5-46"/>court for:<subsection ssid="9-9-29" dnum="i-o" numlevel="1" lineno="477" slineno="5-47" level="3" tab="1"><display>(i)</display>injunctive relief requiring the association to comply with the requirements of <ln numlevel="1" lineno="478" slineno="5-48"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="57-8a-218">57-8a-218</xref>(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="57-8a-218(15)" depth="4">57-8a-218(15)</xref></amend>;</subsection><subsection ssid="9-9-30" dnum="ii-o" numlevel="1" lineno="479" slineno="5-49" level="3" tab="1"><display>(ii)</display>$500, or the lot owner's actual damages, whichever is greater;</subsection><subsection ssid="9-9-31" dnum="iii-o" numlevel="1" lineno="480" slineno="5-50" level="3" tab="1"><display>(iii)</display>any other remedy provided by law; and</subsection><subsection ssid="9-9-32" dnum="iv-o" numlevel="1" lineno="481" slineno="5-51" level="3" tab="1"><display>(iv)</display>reasonable costs and attorney fees.</subsection></subsection><subsection ssid="9-9-33" dnum="b-o" numlevel="1" lineno="482" slineno="5-52" level="2"><display>(b)</display>No fewer than 90 days before the day on which a lot owner files a complaint under <ln numlevel="1" lineno="483" slineno="5-53"/>Subsection (4)(a), the lot owner shall deliver written notice described in Subsection <ln numlevel="1" lineno="484" slineno="5-54"/>(4)(c) to the association.</subsection><subsection ssid="9-9-34" dnum="c-o" numlevel="1" lineno="485" slineno="5-55" level="2"><display>(c)</display>The lot owner shall include in a notice described in Subsection (4)(b):<subsection ssid="9-9-35" dnum="i-o" numlevel="1" lineno="486" slineno="5-56" level="3"><display>(i)</display>the requirements in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="57-8a-218">57-8a-218</xref>(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="57-8a-218(15)">57-8a-218(15)</xref></amend> for adopting water <ln numlevel="1" lineno="487" slineno="5-57"/>wise landscaping rules with which the association has failed to comply;</subsection><subsection ssid="9-9-36" dnum="ii-o" numlevel="1" lineno="488" slineno="5-58" level="3"><display>(ii)</display>a demand that the association come into compliance with the requirements;
