Seizure -- Circumstances where permitted -- Impound lot standards.</bold></catline><subsection ssid="4-4-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-4-2" dnum="a-o" numlevel="1" lineno="30" slineno="1-4" level="2" space="false"><display>(a)</display><subsection ssid="4-4-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>"Criminal offense" means a class B misdemeanor offense, a class A <ln numlevel="1" lineno="31" slineno="1-5"/>misdemeanor offense, or a felony offense.</subsection><subsection ssid="4-4-4" dnum="ii-o" numlevel="1" lineno="32" slineno="1-6" level="3"><display>(ii)</display>"Criminal offense" includes:<subsection ssid="4-4-5" dnum="A-o" numlevel="1" lineno="33" slineno="1-7" level="4"><display>(A)</display>a class B misdemeanor offense, a class A misdemeanor offense, or a felony <ln numlevel="1" lineno="34" slineno="1-8"/>offense described in Chapter 6a, Traffic Code, Title 53, Chapter 3, Part 2, <ln numlevel="1" lineno="35" slineno="1-9"/>Driver Licensing Act, Title 73, Chapter 18, State Boating Act, or Title 76, Utah <ln numlevel="1" lineno="36" slineno="1-10"/>Criminal Code; and</subsection><subsection ssid="4-4-6" dnum="B-o" numlevel="1" lineno="37" slineno="1-11" level="4"><display>(B)</display>a local ordinance that is a class B misdemeanor and is substantially similar to <ln numlevel="1" lineno="38" slineno="1-12"/>an offense listed in Subsection (1)(a)(ii)(A).</subsection></subsection></subsection><subsection ssid="4-66" dnum="_-o:b-i" numlevel="1" lineno="39" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="31" style="1" owner="jchristopherson" level="1" amendtag="end">"Driving credential" means:</amend><subsection ssid="4-67" dnum="_-o:i-i" numlevel="1" lineno="40" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">a driver license, driving privilege card, or learner permit issued by the state of <ln numlevel="1" lineno="41" slineno="1-15"/>Utah pursuant to Title 53, Chapter 3, Uniform Driver License Act; or</amend></subsection><subsection ssid="4-75" dnum="_-o:ii-i" numlevel="1" lineno="42" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="44" style="1" owner="jchristopherson" level="1" amendtag="end">a driver license issued by:</amend><subsection ssid="4-83" dnum="_-o:A-i" numlevel="1" lineno="43" slineno="1-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="end">a state or territory of the United States;</amend></subsection><subsection ssid="4-85" dnum="_-o:B-i" numlevel="1" lineno="44" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="124" groupid="96" style="1" owner="jchristopherson" level="1" amendtag="end">the United States Department of State; or</amend></subsection><subsection ssid="4-84" dnum="_-o:C-i" numlevel="1" lineno="45" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="119" groupid="92" style="1" owner="jchristopherson" level="1" amendtag="end">a foreign country.</amend></subsection></subsection></subsection><subsection ssid="4-4-7" dnum="b-o:c-i" numlevel="1" lineno="46" slineno="1-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>"Operator" means the same as that term is defined in Section <xref depth="3" refnumber="41-6a-102">41-6a-102</xref>.</subsection><subsection ssid="4-4-8" dnum="c-o:d-i" numlevel="1" lineno="47" slineno="1-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display>"Road rage event" means the commission of a criminal offense:<subsection ssid="4-4-9" dnum="i-o" numlevel="1" lineno="48" slineno="1-22" level="3"><display>(i)</display>by an operator of a vehicle;</subsection><subsection ssid="4-4-10" dnum="ii-o" numlevel="1" lineno="49" slineno="1-23" level="3"><display>(ii)</display>in response to an incident that occurs or escalates upon a roadway; and</subsection><subsection ssid="4-4-11" dnum="iii-o" numlevel="1" lineno="50" slineno="1-24" level="3"><display>(iii)</display>with the intent to endanger or intimidate an individual in another vehicle.</subsection></subsection><subsection ssid="4-4-12" dnum="d-o:e-i" numlevel="1" lineno="51" slineno="1-25" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Roadway" means:<subsection ssid="4-4-13" dnum="i-o" numlevel="1" lineno="52" slineno="1-26" level="3"><display>(i)</display>a highway; or</subsection><subsection ssid="4-4-14" dnum="ii-o" numlevel="1" lineno="53" slineno="1-27" level="3"><display>(ii)</display>a private road or driveway as defined in Section <xref depth="3" refnumber="41-6a-102">41-6a-102</xref>.</subsection></subsection></subsection><subsection ssid="4-4-15" dnum="2-o" numlevel="1" lineno="54" slineno="1-28" level="1"><display>(2)</display>The division or any peace officer, without a warrant, may seize and take possession of <ln numlevel="1" lineno="55" slineno="1-29"/>any vehicle, vessel, or outboard motor:<subsection ssid="4-4-16" dnum="a-o" numlevel="1" lineno="56" slineno="1-30" level="2"><display>(a)</display>that the division or the peace officer has probable cause to believe has been stolen;</subsection><subsection ssid="4-4-17" dnum="b-o" numlevel="1" lineno="57" slineno="1-31" level="2"><display>(b)</display>on which any identification number has been defaced, altered, or obliterated;</subsection><subsection ssid="4-4-18" dnum="c-o" numlevel="1" lineno="58" slineno="1-32" level="2"><display>(c)</display>that has been abandoned in accordance with Section <xref depth="3" refnumber="41-6a-1408">41-6a-1408</xref>;</subsection><subsection ssid="4-4-19" dnum="d-o" numlevel="1" lineno="59" slineno="1-33" level="2"><display>(d)</display>for which the applicant has written a check for registration or title fees that has not <ln numlevel="1" lineno="60" slineno="1-34"/>been honored by the applicant's bank and that is not paid within 30 days;</subsection><subsection ssid="4-4-20" dnum="e-o" numlevel="1" lineno="61" slineno="1-35" level="2"><display>(e)</display>that is placed on the water with improper registration;</subsection><subsection ssid="4-4-21" dnum="f-o" numlevel="1" lineno="62" slineno="1-36" level="2"><display>(f)</display>that is being operated on a highway:<subsection ssid="4-4-22" dnum="i-o" numlevel="1" lineno="63" slineno="1-37" level="3"><display>(i)</display>with registration that has been expired for more than three months;</subsection><subsection ssid="4-4-23" dnum="ii-o" numlevel="1" lineno="64" slineno="1-38" level="3"><display>(ii)</display>having never been properly registered by the current owner; or</subsection><subsection ssid="4-4-24" dnum="iii-o" numlevel="1" lineno="65" slineno="1-39" level="3"><display>(iii)</display>with registration that is suspended or revoked; or</subsection></subsection><subsection ssid="4-4-25" dnum="g-o" numlevel="1" lineno="66" slineno="1-40" level="2" space="false"><display>(g)</display><subsection ssid="4-4-26" dnum="i-o" level="3" placement="sameline"><display>(i)</display>that the division or the peace officer has probable cause to believe has been <ln numlevel="1" lineno="67" slineno="1-41"/>involved in an accident described in Section <xref depth="3" refnumber="41-6a-401">41-6a-401</xref>, <xref depth="3" refnumber="41-6a-401.3">41-6a-401.3</xref>, or <xref depth="3" refnumber="41-6a-401.5"><ln numlevel="1" lineno="68" slineno="1-42"/>41-6a-401.5</xref>; and</subsection><subsection ssid="4-4-27" dnum="ii-o" numlevel="1" lineno="69" slineno="1-43" level="3"><display>(ii)</display>whose operator did not remain at the scene of the accident until the operator <ln numlevel="1" lineno="70" slineno="1-44"/>fulfilled the requirements described in Section <xref depth="3" refnumber="41-6a-401">41-6a-401</xref> or <xref depth="3" refnumber="41-6a-401.7">41-6a-401.7</xref>.</subsection></subsection></subsection><subsection ssid="4-4-28" dnum="3-o" numlevel="1" lineno="71" slineno="1-45" level="1" space="false"><display>(3)</display><subsection ssid="4-4-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division or a peace officer shall seize and take possession of a vehicle, <ln numlevel="1" lineno="72" slineno="1-46"/>without a warrant, when:<subsection ssid="4-4-30" dnum="i-o" numlevel="1" lineno="73" slineno="1-47" level="3" tab="1"><display>(i)</display>the division or the peace officer has probable cause to believe that an operator of <ln numlevel="1" lineno="74" slineno="1-48"/>the vehicle engaged in a road rage event; and</subsection><subsection ssid="4-4-31" dnum="ii-o" numlevel="1" lineno="75" slineno="1-49" level="3" tab="1"><display>(ii)</display>the operator of the vehicle has been arrested in conjunction with the road rage <ln numlevel="1" lineno="76" slineno="1-50"/>event.</subsection></subsection><subsection ssid="4-62" dnum="_-o:b-i" numlevel="1" lineno="77" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">Except as provided in Subsection <xref tempid="769" depth="4" refnumber="41-1a-1101(3)(d)">(3)(d)</xref>, the division or a peace officer shall seize <ln numlevel="1" lineno="78" slineno="1-52"/>and take possession of a vehicle, without a warrant, when an operator of a vehicle <ln numlevel="1" lineno="79" slineno="1-53"/>does not have a driving credential in the operator's possession unless the peace officer <ln numlevel="1" lineno="80" slineno="1-54"/>is able to verify that the operator has been issued a driving credential.</amend></subsection><subsection ssid="4-4-32" dnum="b-o:c-i" numlevel="1" lineno="81" slineno="1-55" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="both" space="true">(c)</amend></display>A peace officer may release a vehicle seized and possessed under Subsection <xref refnumber="41-1a-1101(3)(a)" depth="4"><ln numlevel="1" lineno="82" slineno="1-56"/>(3)(a)</xref> <amend anum="0" ea="amend" pairid="68" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="both">or (3)(b) </amend>to the registered owner of the vehicle if the registered owner is not the <ln numlevel="1" lineno="83" slineno="1-57"/>individual subject to arrest under Subsection (3)(a)<amend anum="0" ea="amend" pairid="74" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both"> or (3)(b)</amend> and is immediately <ln numlevel="1" lineno="84" slineno="1-58"/>available, at the location of the arrest, to take possession of the vehicle.</subsection><subsection ssid="4-77" dnum="_-o:d-i" numlevel="1" lineno="85" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="66" style="1" owner="jchristopherson" level="1" amendtag="end">The division or a peace officer is not required to seize and take possession of a <ln numlevel="1" lineno="86" slineno="1-60"/>vehicle as described in Subsection <xref refnumber="41-1a-1101(3)(b)" depth="4">(3)(b)</xref> if the division or a peace officer makes a <ln numlevel="1" lineno="87" slineno="1-61"/>reasonable determination that:</amend><subsection ssid="4-81" dnum="_-o:i-i" numlevel="1" lineno="88" slineno="1-62" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">the operator has been issued a driving credential that is expired;</amend></subsection><subsection ssid="4-78" dnum="_-o:ii-i" numlevel="1" lineno="89" slineno="1-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="72" style="1" owner="jchristopherson" level="1" amendtag="end">seizing the vehicle would create a public safety concern to the operator or any of <ln numlevel="1" lineno="90" slineno="1-64"/>the occupants in the vehicle;</amend></subsection><subsection ssid="4-79" dnum="_-o:iii-i" numlevel="1" lineno="91" slineno="1-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">seizing the vehicle would prevent the division or the peace officer from <ln numlevel="1" lineno="92" slineno="1-66"/>addressing other public safety considerations;</amend></subsection><subsection ssid="4-82" dnum="_-o:iv-i" numlevel="1" lineno="93" slineno="1-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">the operator is less than 18 years old; or</amend></subsection><subsection ssid="4-80" dnum="_-o:v-i" numlevel="1" lineno="94" slineno="1-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="99" groupid="76" style="1" owner="jchristopherson" level="1" amendtag="end">an occupant of the vehicle possesses a driving credential and is willing to operate <ln numlevel="1" lineno="95" slineno="1-69"/>the vehicle.</amend></subsection></subsection></subsection><subsection ssid="4-4-33" dnum="4-o" numlevel="1" lineno="96" slineno="1-70" level="1" space="false"><display>(4)</display><subsection ssid="4-4-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to the restriction in Subsection (4)(b), the division or any peace officer, <ln numlevel="1" lineno="97" slineno="1-71"/>without a warrant:<subsection ssid="4-4-35" dnum="i-o" numlevel="1" lineno="98" slineno="1-72" level="3" tab="1"><display>(i)</display>shall seize and take possession of any vehicle that is being operated on a highway <ln numlevel="1" lineno="99" slineno="1-73"/>without owner's or operator's security in effect for the vehicle as required under <ln numlevel="1" lineno="100" slineno="1-74"/>Section <xref depth="3" refnumber="41-12a-301">41-12a-301</xref> and the vehicle was involved in an accident; or</subsection><subsection ssid="4-4-36" dnum="ii-o" numlevel="1" lineno="101" slineno="1-75" level="3" tab="1"><display>(ii)</display>may seize and take possession of any vehicle that is being operated on a highway <ln numlevel="1" lineno="102" slineno="1-76"/>without owner's or operator's security in effect for the vehicle as required under <ln numlevel="1" lineno="103" slineno="1-77"/>Section <xref depth="3" refnumber="41-12a-301">41-12a-301</xref> after the division or any peace officer makes a reasonable <ln numlevel="1" lineno="104" slineno="1-78"/>determination whether the vehicle would:<subsection ssid="4-4-37" dnum="A-o" numlevel="1" lineno="105" slineno="1-79" level="4"><display>(A)</display>present a public safety concern to the operator or any of the occupants in the <ln numlevel="1" lineno="106" slineno="1-80"/>vehicle; or</subsection><subsection ssid="4-4-38" dnum="B-o" numlevel="1" lineno="107" slineno="1-81" level="4"><display>(B)</display>prevent the division or the peace officer from addressing other public safety <ln numlevel="1" lineno="108" slineno="1-82"/>considerations.</subsection></subsection></subsection><subsection ssid="4-4-39" dnum="b-o" numlevel="1" lineno="109" slineno="1-83" level="2"><display>(b)</display>The division or any peace officer may not seize and take possession of a vehicle <ln numlevel="1" lineno="110" slineno="1-84"/>under Subsection (4)(a):<subsection ssid="4-4-40" dnum="i-o" numlevel="1" lineno="111" slineno="1-85" level="3"><display>(i)</display>if the operator of the vehicle is not carrying evidence of owner's or operator's <ln numlevel="1" lineno="112" slineno="1-86"/>security as defined in Section <xref depth="3" refnumber="41-12a-303.2">41-12a-303.2</xref> in the vehicle unless the division or <ln numlevel="1" lineno="113" slineno="1-87"/>peace officer verifies that owner's or operator's security is not in effect for the <ln numlevel="1" lineno="114" slineno="1-88"/>vehicle through the Uninsured Motorist Identification Database created in <ln numlevel="1" lineno="115" slineno="1-89"/>accordance with Section <xref depth="3" refnumber="41-12a-803">41-12a-803</xref>; or</subsection><subsection ssid="4-4-41" dnum="ii-o" numlevel="1" lineno="116" slineno="1-90" level="3"><display>(ii)</display>if the operator of the vehicle is carrying evidence of owner's or operator's security <ln numlevel="1" lineno="117" slineno="1-91"/>as defined in Section <xref depth="3" refnumber="41-12a-303.2">41-12a-303.2</xref> in the vehicle and the Uninsured Motorist <ln numlevel="1" lineno="118" slineno="1-92"/>Identification Database created in accordance with Section <xref depth="3" refnumber="41-12a-803">41-12a-803</xref> indicates <ln numlevel="1" lineno="119" slineno="1-93"/>that the owner's or operator's security is not in effect for the vehicle, unless the <ln numlevel="1" lineno="120" slineno="1-94"/>division or a peace officer makes a reasonable attempt to independently verify that <ln numlevel="1" lineno="121" slineno="1-95"/>owner's or operator's security is not in effect for the vehicle.</subsection></subsection></subsection><subsection ssid="4-4-42" dnum="5-o" numlevel="1" lineno="122" slineno="1-96" level="1"><display>(5)</display>If necessary for the transportation of a seized vessel, the vessel's trailer may be seized to <ln numlevel="1" lineno="123" slineno="1-97"/>transport and store the vessel.</subsection><subsection ssid="4-4-43" dnum="6-o" numlevel="1" lineno="124" slineno="1-98" level="1"><display>(6)</display>Any peace officer seizing or taking possession of a vehicle, vessel, or outboard motor <ln numlevel="1" lineno="125" slineno="1-99"/>under this section shall comply with the provisions of Section <xref depth="3" refnumber="41-6a-1406">41-6a-1406</xref>.</subsection><subsection ssid="4-4-44" dnum="7-o" numlevel="1" lineno="126" slineno="1-100" level="1" space="false"><display>(7)</display><subsection ssid="4-4-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="127" slineno="1-101"/>the commission shall make rules setting standards for public garages, impound lots, <ln numlevel="1" lineno="128" slineno="1-102"/>and impound yards that may be used by peace officers and the division.</subsection><subsection ssid="4-4-46" dnum="b-o" numlevel="1" lineno="129" slineno="1-103" level="2"><display>(b)</display>The standards shall be equitable, reasonable, and unrestrictive as to the number of <ln numlevel="1" lineno="130" slineno="1-104"/>public garages, impound lots, or impound yards per geographical area.</subsection><subsection ssid="4-4-47" dnum="c-o" numlevel="1" lineno="131" slineno="1-105" level="2"><display>(c)</display>A crusher, dismantler, or salvage dealer may not operate as a state impound yard <ln numlevel="1" lineno="132" slineno="1-106"/>unless the crusher, dismantler, or salvage dealer meets all of the requirements for a <ln numlevel="1" lineno="133" slineno="1-107"/>state impound yard set forth in this section and rules made in accordance with <ln numlevel="1" lineno="134" slineno="1-108"/>Subsection (7)(a).</subsection><subsection ssid="4-4-48" dnum="d-o" numlevel="1" lineno="135" slineno="1-109" level="2" space="false"><display>(d)</display><subsection ssid="4-4-49" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Rules made by the commission shall include a requirement that a state impound <ln numlevel="1" lineno="136" slineno="1-110"/>yard have opaque fencing on any side of the state impound yard that has frontage <ln numlevel="1" lineno="137" slineno="1-111"/>with a highway.</subsection><subsection ssid="4-4-50" dnum="ii-o" numlevel="1" lineno="138" slineno="1-112" level="3"><display>(ii)</display>The opaque fencing described in Subsection (7)(d)(i) may be opaque chain link <ln numlevel="1" lineno="139" slineno="1-113"/>fencing.</subsection></subsection></subsection><subsection ssid="4-4-51" dnum="8-o" numlevel="1" lineno="140" slineno="1-114" level="1" space="false"><display>(8)</display><subsection ssid="4-4-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided under Subsection (8)(b), a person may not operate or allow to <ln numlevel="1" lineno="141" slineno="1-115"/>be operated a vehicle stored in a public garage, impound lot, or impound yard <ln numlevel="1" lineno="142" slineno="1-116"/>regulated under this part without prior written permission of the owner of the vehicle.</subsection><subsection ssid="4-4-53" dnum="b-o" numlevel="1" lineno="143" slineno="1-117" level="2"><display>(b)</display>Incidental and necessary operation of a vehicle to move the vehicle from one parking <ln numlevel="1" lineno="144" slineno="1-118"/>space to another within the facility and that is necessary for the normal management <ln numlevel="1" lineno="145" slineno="1-119"/>of the facility is not prohibited under Subsection (8)(a).</subsection></subsection><subsection ssid="4-4-54" dnum="9-o" numlevel="1" lineno="146" slineno="1-120" level="1"><display>(9)</display>A person who violates the provisions of Subsection (8) is guilty of a class C <ln numlevel="1" lineno="147" slineno="1-121"/>misdemeanor.</subsection><subsection ssid="4-4-55" dnum="10-o" numlevel="1" lineno="148" slineno="1-122" level="1"><display>(10)</display>The division or the peace officer who seizes a vehicle shall record the mileage shown <ln numlevel="1" lineno="149" slineno="1-123"/>on the vehicle's odometer at the time of seizure, if:<subsection ssid="4-4-56" dnum="a-o" numlevel="1" lineno="150" slineno="1-124" level="2"><display>(a)</display>the vehicle is equipped with an odometer; and</subsection><subsection ssid="4-4-57" dnum="b-o" numlevel="1" lineno="151" slineno="1-125" level="2"><display>(b)</display>the odometer reading is accessible to the division or the peace officer.</subsection></subsection></section></bsec><bsec buid="6" num="41-6a-1406" type="amend" src="code" uid="C41-6a-S1406_2025050720250507" sort="41 06a14060020250507" numlevel="1" lineno="152" slineno="2-1" sn="2"><section number="41-6a-1406" numlevel="1" lineno="153" slineno="2-2" type="amend"><secline lineno="152">Section 2, Section <bold>41-6a-1406</bold> is amended to read:</secline><catline lineno="153"><bold>41-6a-1406. Removal and impoundment of vehicles -- Reporting and notification <ln numlevel="1" lineno="154" slineno="2-3"/>requirements -- Administrative impound fee -- Refunds -- Possessory lien -- Rulemaking.</bold></catline><subsection ssid="6-6-1" dnum="1-o" numlevel="1" lineno="155" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>If a vehicle, vessel, or outboard motor is impounded as provided under Section <xref depth="3" refnumber="41-1a-1101"><ln numlevel="1" lineno="156" slineno="2-5"/>41-1a-1101</xref>, <xref depth="3" refnumber="41-6a-210">41-6a-210</xref>, <xref depth="3" refnumber="41-6a-527">41-6a-527</xref>, <xref depth="3" refnumber="41-6a-1405">41-6a-1405</xref>, <xref depth="3" refnumber="41-6a-1408">41-6a-1408</xref>, or <xref depth="3" refnumber="73-18-20.1">73-18-20.1</xref> by an order <ln numlevel="1" lineno="157" slineno="2-6"/>of a peace officer or by an order of a person acting on behalf of a law enforcement <ln numlevel="1" lineno="158" slineno="2-7"/>agency or highway authority, the impoundment of the vehicle, vessel, or outboard motor <ln numlevel="1" lineno="159" slineno="2-8"/>shall be at the expense of the owner.</subsection><subsection ssid="6-6-2" dnum="2-o" numlevel="1" lineno="160" slineno="2-9" level="1"><display>(2)</display>The vehicle, vessel, or outboard motor under Subsection (1) shall be impounded to a <ln numlevel="1" lineno="161" slineno="2-10"/>state impound yard.</subsection><subsection ssid="6-6-3" dnum="3-o" numlevel="1" lineno="162" slineno="2-11" level="1"><display>(3)</display>The peace officer may move a vehicle, vessel, or outboard motor or cause it to be <ln numlevel="1" lineno="163" slineno="2-12"/>removed by a tow truck motor carrier that meets standards established:<subsection ssid="6-6-4" dnum="a-o" numlevel="1" lineno="164" slineno="2-13" level="2"><display>(a)</display>under Title 72, Chapter 9, Motor Carrier Safety Act; and</subsection><subsection ssid="6-6-5" dnum="b-o" numlevel="1" lineno="165" slineno="2-14" level="2"><display>(b)</display>by the department under Subsection (11).</subsection></subsection><subsection ssid="6-6-6" dnum="4-o" numlevel="1" lineno="166" slineno="2-15" level="1" space="false"><display>(4)</display><subsection ssid="6-6-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A report described in this Subsection (4) is required for a vehicle, vessel, or <ln numlevel="1" lineno="167" slineno="2-16"/>outboard motor that is impounded as described in Subsection (1).</subsection><subsection ssid="6-6-8" dnum="b-o" numlevel="1" lineno="168" slineno="2-17" level="2"><display>(b)</display>Before noon on the next business day after the date of the removal of the vehicle, <ln numlevel="1" lineno="169" slineno="2-18"/>vessel, or outboard motor, a report of the impoundment shall be sent to the Motor <ln numlevel="1" lineno="170" slineno="2-19"/>Vehicle Division, in an electronic format approved by the Motor Vehicle Division, <ln numlevel="1" lineno="171" slineno="2-20"/>by:<subsection ssid="6-6-9" dnum="i-o" numlevel="1" lineno="172" slineno="2-21" level="3"><display>(i)</display>the peace officer or agency by whom the peace officer is employed; and</subsection><subsection ssid="6-6-10" dnum="ii-o" numlevel="1" lineno="173" slineno="2-22" level="3"><display>(ii)</display>the tow truck operator or the tow truck motor carrier by whom the tow truck <ln numlevel="1" lineno="174" slineno="2-23"/>operator is employed.</subsection></subsection><subsection ssid="6-6-11" dnum="c-o" numlevel="1" lineno="175" slineno="2-24" level="2"><display>(c)</display>The report shall be in a form specified by the Motor Vehicle Division and shall <ln numlevel="1" lineno="176" slineno="2-25"/>include:<subsection ssid="6-6-12" dnum="i-o" numlevel="1" lineno="177" slineno="2-26" level="3"><display>(i)</display>the operator's name, if known;</subsection><subsection ssid="6-6-13" dnum="ii-o" numlevel="1" lineno="178" slineno="2-27" level="3"><display>(ii)</display>a description of the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-6-14" dnum="iii-o" numlevel="1" lineno="179" slineno="2-28" level="3"><display>(iii)</display>the vehicle identification number or vessel or outboard motor identification <ln numlevel="1" lineno="180" slineno="2-29"/>number;</subsection><subsection ssid="6-6-15" dnum="iv-o" numlevel="1" lineno="181" slineno="2-30" level="3"><display>(iv)</display>the case number designated by the peace officer, law enforcement agency <ln numlevel="1" lineno="182" slineno="2-31"/>number, or government entity;</subsection><subsection ssid="6-6-16" dnum="v-o" numlevel="1" lineno="183" slineno="2-32" level="3"><display>(v)</display>the license number, temporary permit number, or other identification number <ln numlevel="1" lineno="184" slineno="2-33"/>issued by a state agency;</subsection><subsection ssid="6-6-17" dnum="vi-o" numlevel="1" lineno="185" slineno="2-34" level="3"><display>(vi)</display>the date, time, and place of impoundment;</subsection><subsection ssid="6-6-18" dnum="vii-o" numlevel="1" lineno="186" slineno="2-35" level="3"><display>(vii)</display>the reason for removal or impoundment;</subsection><subsection ssid="6-6-19" dnum="viii-o" numlevel="1" lineno="187" slineno="2-36" level="3"><display>(viii)</display>the name of the tow truck motor carrier who removed the vehicle, vessel, or <ln numlevel="1" lineno="188" slineno="2-37"/>outboard motor; and</subsection><subsection ssid="6-6-20" dnum="ix-o" numlevel="1" lineno="189" slineno="2-38" level="3"><display>(ix)</display>the place where the vehicle, vessel, or outboard motor is stored.</subsection></subsection><subsection ssid="6-120" dnum="_-o:d-i" numlevel="1" lineno="190" slineno="2-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><subsection ssid="6-121" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">If the form described in Subsection <xref refnumber="41-6a-1406(4)(c)" depth="4">(4)(c)</xref> does not include the reason for the <ln numlevel="1" lineno="191" slineno="2-40"/>removal or impoundment described in Subsection <xref tempid="554" depth="4" refnumber="41-6a-1406(4)(c)(vii)">(4)(c)(vii)</xref>, the peace officer and <ln numlevel="1" lineno="192" slineno="2-41"/>tow truck operator described in Subsection <xref refnumber="41-6a-1406(4)(b)" depth="4">(4)(b)</xref> shall note "other" as the reason <ln numlevel="1" lineno="193" slineno="2-42"/>for the removal or impoundment.</amend></subsection><subsection ssid="6-122" dnum="_-o:ii-i" numlevel="1" lineno="194" slineno="2-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">The commission shall update the form described in Subsection <xref refnumber="41-6a-1406(4)(c)" depth="4">(4)(c)</xref> to include <ln numlevel="1" lineno="195" slineno="2-44"/>driving without a driving credential as a reason for impoundment as described in <ln numlevel="1" lineno="196" slineno="2-45"/>Subsection <xref refnumber="41-1a-1101(3)" depth="4">41-1a-1101(3)</xref> no later than January 1, 2026.</amend></subsection></subsection><subsection ssid="6-6-21" dnum="d-o:e-i" numlevel="1" lineno="197" slineno="2-46" level="2" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1093" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display><subsection ssid="6-6-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking <ln numlevel="1" lineno="198" slineno="2-47"/>Act, the State Tax Commission shall make rules to establish proper format and <ln numlevel="1" lineno="199" slineno="2-48"/>information required on the form described in this Subsection (4).</subsection><subsection ssid="6-6-23" dnum="ii-o" numlevel="1" lineno="200" slineno="2-49" level="3"><display>(ii)</display>The State Tax Commission shall ensure that the form described in this Subsection <ln numlevel="1" lineno="201" slineno="2-50"/>(4) is provided in an electronic format.</subsection></subsection><subsection ssid="6-6-24" dnum="e-o:f-i" numlevel="1" lineno="202" slineno="2-51" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>Until the tow truck operator or tow truck motor carrier reports the removal as <ln numlevel="1" lineno="203" slineno="2-52"/>required under this Subsection (4), a tow truck motor carrier or impound yard may <ln numlevel="1" lineno="204" slineno="2-53"/>not:<subsection ssid="6-6-25" dnum="i-o" numlevel="1" lineno="205" slineno="2-54" level="3"><display>(i)</display>collect any fee associated with the removal; and</subsection><subsection ssid="6-6-26" dnum="ii-o" numlevel="1" lineno="206" slineno="2-55" level="3"><display>(ii)</display>begin charging storage fees.</subsection></subsection></subsection><subsection ssid="6-6-27" dnum="5-o" numlevel="1" lineno="207" slineno="2-56" level="1" space="false"><display>(5)</display><subsection ssid="6-6-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A report described in this Subsection (5) is required for any vehicle, vessel, or <ln numlevel="1" lineno="208" slineno="2-57"/>outboard motor that is removed, except for:<subsection ssid="6-6-29" dnum="i-o" numlevel="1" lineno="209" slineno="2-58" level="3" tab="1"><display>(i)</display>a vehicle, vessel, or outboard motor that is impounded for a reason described in <ln numlevel="1" lineno="210" slineno="2-59"/>Subsection (1); or</subsection><subsection ssid="6-6-30" dnum="ii-o" numlevel="1" lineno="211" slineno="2-60" level="3" tab="1"><display>(ii)</display>a vehicle, vessel, or outboard motor for which a removal is performed in <ln numlevel="1" lineno="212" slineno="2-61"/>accordance with Section <xref depth="3" refnumber="72-9-603">72-9-603</xref>.</subsection></subsection><subsection ssid="6-6-31" dnum="b-o" numlevel="1" lineno="213" slineno="2-62" level="2"><display>(b)</display>For a removal described in Subsection (5)(a), the relevant law enforcement officer <ln numlevel="1" lineno="214" slineno="2-63"/>shall provide documentation to the tow truck operator or tow truck motor carrier that <ln numlevel="1" lineno="215" slineno="2-64"/>includes:<subsection ssid="6-6-32" dnum="i-o" numlevel="1" lineno="216" slineno="2-65" level="3"><display>(i)</display>the name and badge number of the peace officer;</subsection><subsection ssid="6-6-33" dnum="ii-o" numlevel="1" lineno="217" slineno="2-66" level="3"><display>(ii)</display>the name and originating agency identifier of the law enforcement agency; and</subsection><subsection ssid="6-6-34" dnum="iii-o" numlevel="1" lineno="218" slineno="2-67" level="3"><display>(iii)</display>the case number designated by the law enforcement officer or law enforcement <ln numlevel="1" lineno="219" slineno="2-68"/>agency.</subsection></subsection><subsection ssid="6-6-35" dnum="c-o" numlevel="1" lineno="220" slineno="2-69" level="2"><display>(c)</display>For a removal described in Subsection (5)(a), before noon on the next business day <ln numlevel="1" lineno="221" slineno="2-70"/>following the date of the removal of the vehicle, vessel, or outboard motor, the tow <ln numlevel="1" lineno="222" slineno="2-71"/>truck operator or tow truck motor carrier shall send to the Motor Vehicle Division in <ln numlevel="1" lineno="223" slineno="2-72"/>an electronic format approved by the Motor Vehicle Division:<subsection ssid="6-6-36" dnum="i-o" numlevel="1" lineno="224" slineno="2-73" level="3"><display>(i)</display>the report described in Subsection (4); or</subsection><subsection ssid="6-6-37" dnum="ii-o" numlevel="1" lineno="225" slineno="2-74" level="3"><display>(ii)</display>the report described in Subsection (5)(d).</subsection></subsection><subsection ssid="6-6-38" dnum="d-o" numlevel="1" lineno="226" slineno="2-75" level="2"><display>(d)</display>For a removal described in Subsection (5)(a), if the tow truck operator or tow truck <ln numlevel="1" lineno="227" slineno="2-76"/>motor carrier does not provide the report described in Subsection (4), the tow truck <ln numlevel="1" lineno="228" slineno="2-77"/>operator or tow truck motor carrier shall provide a report to the Motor Vehicle <ln numlevel="1" lineno="229" slineno="2-78"/>Division that includes:<subsection ssid="6-6-39" dnum="i-o" numlevel="1" lineno="230" slineno="2-79" level="3"><display>(i)</display>the name and badge number of the relevant peace officer;</subsection><subsection ssid="6-6-40" dnum="ii-o" numlevel="1" lineno="231" slineno="2-80" level="3"><display>(ii)</display>the name and originating agency identifier of the law enforcement agency;</subsection><subsection ssid="6-6-41" dnum="iii-o" numlevel="1" lineno="232" slineno="2-81" level="3"><display>(iii)</display>the law enforcement agency case number;</subsection><subsection ssid="6-6-42" dnum="iv-o" numlevel="1" lineno="233" slineno="2-82" level="3"><display>(iv)</display>subject to Subsection (5)(e), the vehicle identification number and the license <ln numlevel="1" lineno="234" slineno="2-83"/>number, temporary permit number, or other identification number issued by a <ln numlevel="1" lineno="235" slineno="2-84"/>state agency;</subsection><subsection ssid="6-6-43" dnum="v-o" numlevel="1" lineno="236" slineno="2-85" level="3"><display>(v)</display>the date and time of the removal of the vehicle, vessel, or outboard motor; and</subsection><subsection ssid="6-6-44" dnum="vi-o" numlevel="1" lineno="237" slineno="2-86" level="3"><display>(vi)</display>the reason for the removal of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="6-6-45" dnum="e-o" numlevel="1" lineno="238" slineno="2-87" level="2"><display>(e)</display>If either the vehicle identification number or the license number, temporary permit <ln numlevel="1" lineno="239" slineno="2-88"/>number, or other identification number issued by a state agency is not available, the <ln numlevel="1" lineno="240" slineno="2-89"/>report shall include:<subsection ssid="6-6-46" dnum="i-o" numlevel="1" lineno="241" slineno="2-90" level="3"><display>(i)</display>as much information as is available from both the vehicle identification number <ln numlevel="1" lineno="242" slineno="2-91"/>and the license plate number of the vehicle, vessel, or outboard motor; and</subsection><subsection ssid="6-6-47" dnum="ii-o" numlevel="1" lineno="243" slineno="2-92" level="3"><display>(ii)</display>a description of the vehicle, vessel, or outboard motor, including the color, make, <ln numlevel="1" lineno="244" slineno="2-93"/>model, and model year of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="6-6-48" dnum="f-o" numlevel="1" lineno="245" slineno="2-94" level="2"><display>(f)</display>Until the tow truck operator or tow truck motor carrier reports the removal as <ln numlevel="1" lineno="246" slineno="2-95"/>required under this Subsection (5), a tow truck motor carrier may not:<subsection ssid="6-6-49" dnum="i-o" numlevel="1" lineno="247" slineno="2-96" level="3"><display>(i)</display>collect any fee associated with the removal; or</subsection><subsection ssid="6-6-50" dnum="ii-o" numlevel="1" lineno="248" slineno="2-97" level="3"><display>(ii)</display>begin charging storage fees.</subsection></subsection><subsection ssid="6-6-51" dnum="g-o" numlevel="1" lineno="249" slineno="2-98" level="2"><display>(g)</display>A vehicle, vessel, or outboard motor removed under this Subsection (5) shall be <ln numlevel="1" lineno="250" slineno="2-99"/>removed to:<subsection ssid="6-6-52" dnum="i-o" numlevel="1" lineno="251" slineno="2-100" level="3"><display>(i)</display>a state impound yard; or</subsection><subsection ssid="6-6-53" dnum="ii-o" numlevel="1" lineno="252" slineno="2-101" level="3"><display>(ii)</display>a location that has been requested by the registered owner at the time of removal, <ln numlevel="1" lineno="253" slineno="2-102"/>if payment is made to the tow truck motor carrier or tow truck operator at the time <ln numlevel="1" lineno="254" slineno="2-103"/>of removal.</subsection></subsection><subsection ssid="6-6-54" dnum="h-o" numlevel="1" lineno="255" slineno="2-104" level="2"><display>(h)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="256" slineno="2-105"/>State Tax Commission may make rules to establish proper format and information <ln numlevel="1" lineno="257" slineno="2-106"/>required on the form described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="64" style="2" owner="jchristopherson" level="1" deltag="both">(5)(e), </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="81" groupid="62" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)(d) </amend>including submission in <ln numlevel="1" lineno="258" slineno="2-107"/>an electronic format.</subsection></subsection><subsection ssid="6-6-55" dnum="6-o" numlevel="1" lineno="259" slineno="2-108" level="1" space="false"><display>(6)</display><subsection ssid="6-6-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (6)(d) and upon receipt of a report described in <ln numlevel="1" lineno="260" slineno="2-109"/>Subsection (4) or (5), the Motor Vehicle Division shall give notice, in the manner <ln numlevel="1" lineno="261" slineno="2-110"/>described in Section <xref depth="3" refnumber="41-1a-114">41-1a-114</xref>, to the following parties with an interest in the <ln numlevel="1" lineno="262" slineno="2-111"/>vehicle, vessel, or outboard motor, as applicable:<subsection ssid="6-6-57" dnum="i-o" numlevel="1" lineno="263" slineno="2-112" level="3" tab="1"><display>(i)</display>the registered owner;</subsection><subsection ssid="6-6-58" dnum="ii-o" numlevel="1" lineno="264" slineno="2-113" level="3" tab="1"><display>(ii)</display>any lien holder; or</subsection><subsection ssid="6-6-59" dnum="iii-o" numlevel="1" lineno="265" slineno="2-114" level="3" tab="1"><display>(iii)</display>a dealer, as defined in Section <xref depth="3" refnumber="41-1a-102">41-1a-102</xref>, if the vehicle, vessel, or outboard <ln numlevel="1" lineno="266" slineno="2-115"/>motor is currently operating under a temporary permit issued by the dealer, as <ln numlevel="1" lineno="267" slineno="2-116"/>described in Section <xref depth="3" refnumber="41-3-302">41-3-302</xref>.</subsection></subsection><subsection ssid="6-6-60" dnum="b-o" numlevel="1" lineno="268" slineno="2-117" level="2"><display>(b)</display>The notice shall:<subsection ssid="6-6-61" dnum="i-o" numlevel="1" lineno="269" slineno="2-118" level="3"><display>(i)</display>state the date, time, and place of removal, the name, if applicable, of the person <ln numlevel="1" lineno="270" slineno="2-119"/>operating the vehicle, vessel, or outboard motor at the time of removal, the reason <ln numlevel="1" lineno="271" slineno="2-120"/>for removal, and the place where the vehicle, vessel, or outboard motor is stored;</subsection><subsection ssid="6-6-62" dnum="ii-o" numlevel="1" lineno="272" slineno="2-121" level="3"><display>(ii)</display>state that the registered owner is responsible for payment of towing, impound, <ln numlevel="1" lineno="273" slineno="2-122"/>and storage fees charged against the vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-6-63" dnum="iii-o" numlevel="1" lineno="274" slineno="2-123" level="3"><display>(iii)</display>state the conditions that must be satisfied before the vehicle, vessel, or outboard <ln numlevel="1" lineno="275" slineno="2-124"/>motor is released; and</subsection><subsection ssid="6-6-64" dnum="iv-o" numlevel="1" lineno="276" slineno="2-125" level="3"><display>(iv)</display>inform the parties described in Subsection (6)(a) of the division's intent to sell the <ln numlevel="1" lineno="277" slineno="2-126"/>vehicle, vessel, or outboard motor, if, within 30 days after the day of the removal <ln numlevel="1" lineno="278" slineno="2-127"/>or impoundment under this section, one of the parties fails to make a claim for <ln numlevel="1" lineno="279" slineno="2-128"/>release of the vehicle, vessel, or outboard motor.</subsection></subsection><subsection ssid="6-6-65" dnum="c-o" numlevel="1" lineno="280" slineno="2-129" level="2"><display>(c)</display>Except as provided in Subsection (6)(d) and if the vehicle, vessel, or outboard motor <ln numlevel="1" lineno="281" slineno="2-130"/>is not registered in this state, the Motor Vehicle Division shall make a reasonable <ln numlevel="1" lineno="282" slineno="2-131"/>effort to notify the parties described in Subsection (6)(a) of the removal and the place <ln numlevel="1" lineno="283" slineno="2-132"/>where the vehicle, vessel, or outboard motor is stored.</subsection><subsection ssid="6-6-66" dnum="d-o" numlevel="1" lineno="284" slineno="2-133" level="2"><display>(d)</display>The Motor Vehicle Division is not required to give notice under this Subsection (6) <ln numlevel="1" lineno="285" slineno="2-134"/>if a report was received by a tow truck operator or tow truck motor carrier reporting a <ln numlevel="1" lineno="286" slineno="2-135"/>tow truck service in accordance with Subsection <xref depth="3" refnumber="72-9-603">72-9-603</xref>(1)(a)(i).</subsection><subsection ssid="6-6-67" dnum="e-o" numlevel="1" lineno="287" slineno="2-136" level="2" space="false"><display>(e)</display><subsection ssid="6-6-68" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The Motor Vehicle Division shall disclose the information in the report <ln numlevel="1" lineno="288" slineno="2-137"/>described in Subsection (4) and Subsection <xref depth="3" refnumber="72-9-603">72-9-603</xref>(1)(a)(i) to a designated agent <ln numlevel="1" lineno="289" slineno="2-138"/>as defined in Section <xref depth="3" refnumber="41-12a-802">41-12a-802</xref> regarding a tow that was initiated:<subsection ssid="6-6-69" dnum="A-o" numlevel="1" lineno="290" slineno="2-139" level="4" tab="1"><display>(A)</display>by law enforcement; or</subsection><subsection ssid="6-6-70" dnum="B-o" numlevel="1" lineno="291" slineno="2-140" level="4" tab="1"><display>(B)</display>without the vehicle owner's consent.</subsection></subsection><subsection ssid="6-6-71" dnum="ii-o" numlevel="1" lineno="292" slineno="2-141" level="3"><display>(ii)</display>The Motor Vehicle Division may rely on the information provided by the tow <ln numlevel="1" lineno="293" slineno="2-142"/>truck operator or tow truck motor carrier to determine if a tow meets the criteria <ln numlevel="1" lineno="294" slineno="2-143"/>described in Subsections (6)(e)(i)(A) and (B).</subsection><subsection ssid="6-6-72" dnum="iii-o" numlevel="1" lineno="295" slineno="2-144" level="3"><display>(iii)</display>The designated agent may disclose information received regarding a tow <ln numlevel="1" lineno="296" slineno="2-145"/>described in Subsections (6)(e)(i)(A) and (B) to the vehicle owner and to the <ln numlevel="1" lineno="297" slineno="2-146"/>vehicle owner's verified insurance company.</subsection><subsection ssid="6-6-73" dnum="iv-o" numlevel="1" lineno="298" slineno="2-147" level="3"><display>(iv)</display>The designated agent may not disclose information to a vehicle owner's <ln numlevel="1" lineno="299" slineno="2-148"/>insurance company if the tow does not meet the criteria described in Subsections <ln numlevel="1" lineno="300" slineno="2-149"/>(6)(e)(i)(A) and (B).</subsection></subsection></subsection><subsection ssid="6-6-74" dnum="7-o" numlevel="1" lineno="301" slineno="2-150" level="1" space="false"><display>(7)</display><subsection ssid="6-6-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The vehicle, vessel, or outboard motor impounded or removed to a state impound <ln numlevel="1" lineno="302" slineno="2-151"/>yard as described in this section shall be released after a party described in <ln numlevel="1" lineno="303" slineno="2-152"/>Subsection (6)(a):<subsection ssid="6-6-76" dnum="i-o" numlevel="1" lineno="304" slineno="2-153" level="3" tab="1"><display>(i)</display>makes a claim for release of the vehicle, vessel, or outboard motor at any office of <ln numlevel="1" lineno="305" slineno="2-154"/>the State Tax Commission;</subsection><subsection ssid="6-6-77" dnum="ii-o" numlevel="1" lineno="306" slineno="2-155" level="3" tab="1"><display>(ii)</display>presents identification sufficient to prove ownership of the impounded or <ln numlevel="1" lineno="307" slineno="2-156"/>removed vehicle, vessel, or outboard motor;</subsection><subsection ssid="6-6-78" dnum="iii-o" numlevel="1" lineno="308" slineno="2-157" level="3" tab="1"><display>(iii)</display>completes the registration, if needed, and pays the appropriate fees;</subsection><subsection ssid="6-6-79" dnum="iv-o" numlevel="1" lineno="309" slineno="2-158" level="3" tab="1"><display>(iv)</display>if the impoundment was made under Section <xref depth="3" refnumber="41-6a-527">41-6a-527</xref> or Subsection <xref depth="3" refnumber="41-1a-1101">41-1a-1101</xref><ln numlevel="1" lineno="310" slineno="2-159"/>(3), pays:<subsection ssid="6-6-80" dnum="A-o" numlevel="1" lineno="311" slineno="2-160" level="4"><display>(A)</display>an administrative impound fee of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">$425</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">$600</amend>; and</subsection><subsection ssid="6-6-81" dnum="B-o" numlevel="1" lineno="312" slineno="2-161" level="4"><display>(B)</display>in addition to the administrative fee described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">(6)(a)(iv)(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="313" slineno="2-162"/>(7)(a)(iv)(A)</amend>, an administrative testing fee of $30; and</subsection></subsection><subsection ssid="6-6-82" dnum="v-o" numlevel="1" lineno="314" slineno="2-163" level="3" tab="1"><display>(v)</display>pays all towing and storage fees to the place where the vehicle, vessel, or <ln numlevel="1" lineno="315" slineno="2-164"/>outboard motor is stored.</subsection></subsection><subsection ssid="6-6-83" dnum="b-o" numlevel="1" lineno="316" slineno="2-165" level="2" space="false"><display>(b)</display><subsection ssid="6-6-84" dnum="i-o" level="3" placement="sameline"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both">$29 </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Twenty nine dollars </amend>of the administrative impound fee assessed under <ln numlevel="1" lineno="317" slineno="2-166"/>Subsection (7)(a)(iv)(A) shall be dedicated credits to the Motor Vehicle Division.</subsection><subsection ssid="6-6-85" dnum="ii-o" numlevel="1" lineno="318" slineno="2-167" level="3"><display>(ii)</display>One-hundred and forty-seven dollars of the administrative impound fee assessed <ln numlevel="1" lineno="319" slineno="2-168"/>under Subsection (7)(a)(iv)(A) shall be deposited into the Department of Public <ln numlevel="1" lineno="320" slineno="2-169"/>Safety Restricted Account created in Section <xref depth="3" refnumber="53-3-106">53-3-106</xref>.</subsection><subsection ssid="6-6-86" dnum="iii-o" numlevel="1" lineno="321" slineno="2-170" level="3"><display>(iii)</display>Twenty dollars of the administrative impound fee assessed under Subsection <ln numlevel="1" lineno="322" slineno="2-171"/>(7)(a)(iv)(A) shall be deposited into the Brain and Spinal Cord Injury Fund <ln numlevel="1" lineno="323" slineno="2-172"/>created in Section <xref depth="3" refnumber="26B-1-318">26B-1-318</xref>.</subsection><subsection ssid="6-6-87" dnum="iv-o" numlevel="1" lineno="324" slineno="2-173" level="3"><display>(iv)</display>After the distributions described in Subsections <xref tempid="672" depth="4" refnumber="41-6a-1406(7)(b)(i)">(7)(b)(i)</xref> through (iii), the <ln numlevel="1" lineno="325" slineno="2-174"/>remainder of the administrative impound fee assessed under Subsection <ln numlevel="1" lineno="326" slineno="2-175"/>(7)(a)(iv)(A) shall be deposited into the General Fund.</subsection><subsection ssid="6-6-88" dnum="v-o" numlevel="1" lineno="327" slineno="2-176" level="3"><display>(v)</display>The administrative testing fee described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="84" groupid="65" style="2" owner="jchristopherson" level="1" deltag="both">(6)(a)(iv)(B) </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="82" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(7)(a)(iv)(B) </amend><ln numlevel="1" lineno="328" slineno="2-177"/>shall be deposited into the State Laboratory Drug Testing Account created in <ln numlevel="1" lineno="329" slineno="2-178"/>Section <xref depth="3" refnumber="26B-1-304">26B-1-304</xref>.</subsection></subsection><subsection ssid="6-6-89" dnum="c-o" numlevel="1" lineno="330" slineno="2-179" level="2"><display>(c)</display>The administrative impound fee and the administrative testing fee assessed under <ln numlevel="1" lineno="331" slineno="2-180"/>Subsection (7)(a)(iv) shall be waived or refunded by the State Tax Commission if the <ln numlevel="1" lineno="332" slineno="2-181"/>registered owner, lien holder, or owner's agent presents written evidence to the State <ln numlevel="1" lineno="333" slineno="2-182"/>Tax Commission that:<subsection ssid="6-6-90" dnum="i-o" numlevel="1" lineno="334" slineno="2-183" level="3"><display>(i)</display>the Driver License Division determined that the arrested person's driver license <ln numlevel="1" lineno="335" slineno="2-184"/>should not be suspended or revoked under Section <xref depth="3" refnumber="53-3-223">53-3-223</xref> or <xref depth="3" refnumber="41-6a-521">41-6a-521</xref> as <ln numlevel="1" lineno="336" slineno="2-185"/>shown by a letter or other report from the Driver License Division presented <ln numlevel="1" lineno="337" slineno="2-186"/>within 180 days after the day on which the Driver License Division mailed the <ln numlevel="1" lineno="338" slineno="2-187"/>final notification; or</subsection><subsection ssid="6-6-91" dnum="ii-o" numlevel="1" lineno="339" slineno="2-188" level="3"><display>(ii)</display>the vehicle was stolen at the time of the impoundment as shown by a copy of the <ln numlevel="1" lineno="340" slineno="2-189"/>stolen vehicle report presented within 180 days after the day of the impoundment.</subsection></subsection><subsection ssid="6-6-92" dnum="d-o" numlevel="1" lineno="341" slineno="2-190" level="2" space="false"><display>(d)</display><subsection ssid="6-116" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>A tow truck operator, a tow truck motor carrier, and an impound yard shall <ln numlevel="1" lineno="342" slineno="2-191"/>accept payment by cash and debit or credit card for a removal or impoundment <ln numlevel="1" lineno="343" slineno="2-192"/>under Subsection (1) or any service rendered, performed, or supplied in <ln numlevel="1" lineno="344" slineno="2-193"/>connection with a removal or impoundment under Subsection (1).</subsection><subsection ssid="6-115" dnum="_-o:ii-i" numlevel="1" lineno="345" slineno="2-194" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">An impound yard may not release a vehicle unless an individual with a driving <ln numlevel="1" lineno="346" slineno="2-195"/>credential, as defined in Section <xref depth="3" refnumber="41-1a-1101">41-1a-1101</xref>, is present and able to drive the <ln numlevel="1" lineno="347" slineno="2-196"/>vehicle.</amend></subsection></subsection><subsection ssid="6-6-93" dnum="e-o" numlevel="1" lineno="348" slineno="2-197" level="2"><display>(e)</display>The owner of an impounded vehicle may not be charged a fee for the storage of the <ln numlevel="1" lineno="349" slineno="2-198"/>impounded vehicle, vessel, or outboard motor if:<subsection ssid="6-6-94" dnum="i-o" numlevel="1" lineno="350" slineno="2-199" level="3"><display>(i)</display>the vehicle, vessel, or outboard motor is being held as evidence; and</subsection><subsection ssid="6-6-95" dnum="ii-o" numlevel="1" lineno="351" slineno="2-200" level="3"><display>(ii)</display>the vehicle, vessel, or outboard motor is not being released to a party described in <ln numlevel="1" lineno="352" slineno="2-201"/>Subsection (6)(a), even if the party satisfies the requirements to release the <ln numlevel="1" lineno="353" slineno="2-202"/>vehicle, vessel, or outboard motor under this Subsection (7).</subsection></subsection></subsection><subsection ssid="6-6-96" dnum="8-o" numlevel="1" lineno="354" slineno="2-203" level="1" space="false"><display>(8)</display><subsection ssid="6-6-97" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For an impounded or a removed vehicle, vessel, or outboard motor not claimed by <ln numlevel="1" lineno="355" slineno="2-204"/>a party described in Subsection (6)(a) within the time prescribed by Section <xref depth="3" refnumber="41-1a-1103"><ln numlevel="1" lineno="356" slineno="2-205"/>41-1a-1103</xref>, the Motor Vehicle Division shall issue a certificate of sale for the <ln numlevel="1" lineno="357" slineno="2-206"/>impounded or removed vehicle, vessel, or outboard motor as described in Section <xref depth="3" refnumber="41-1a-1103"><ln numlevel="1" lineno="358" slineno="2-207"/>41-1a-1103</xref>.</subsection><subsection ssid="6-6-98" dnum="b-o" numlevel="1" lineno="359" slineno="2-208" level="2"><display>(b)</display>The date of impoundment or removal is considered the date of seizure for computing <ln numlevel="1" lineno="360" slineno="2-209"/>the time period provided under Section <xref depth="3" refnumber="41-1a-1103">41-1a-1103</xref>.</subsection></subsection><subsection ssid="6-6-99" dnum="9-o" numlevel="1" lineno="361" slineno="2-210" level="1"><display>(9)</display>A party described in Subsection (6)(a) that pays all fees and charges incurred in the <ln numlevel="1" lineno="362" slineno="2-211"/>impoundment or removal of the owner's vehicle, vessel, or outboard motor has a cause <ln numlevel="1" lineno="363" slineno="2-212"/>of action for all the fees and charges, together with damages, court costs, and attorney <ln numlevel="1" lineno="364" slineno="2-213"/>fees, against the operator of the vehicle, vessel, or outboard motor whose actions caused <ln numlevel="1" lineno="365" slineno="2-214"/>the removal or impoundment.</subsection><subsection ssid="6-6-100" dnum="10-o" numlevel="1" lineno="366" slineno="2-215" level="1"><display>(10)</display>Towing, impound fees, and storage fees are a possessory lien on the vehicle, vessel, or <ln numlevel="1" lineno="367" slineno="2-216"/>outboard motor.</subsection><subsection ssid="6-6-101" dnum="11-o" numlevel="1" lineno="368" slineno="2-217" level="1"><display>(11)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="369" slineno="2-218"/>department shall make rules setting the performance standards for towing companies to <ln numlevel="1" lineno="370" slineno="2-219"/>be used by the department.</subsection><subsection ssid="6-6-102" dnum="12-o" numlevel="1" lineno="371" slineno="2-220" level="1" space="false"><display>(12)</display><subsection ssid="6-6-103" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Motor Vehicle Division may specify that a report required under Subsection <ln numlevel="1" lineno="372" slineno="2-221"/>(4) be submitted in electronic form utilizing a database for submission, storage, and <ln numlevel="1" lineno="373" slineno="2-222"/>retrieval of the information.</subsection><subsection ssid="6-6-104" dnum="b-o" numlevel="1" lineno="374" slineno="2-223" level="2" space="false"><display>(b)</display><subsection ssid="6-6-105" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Unless otherwise provided by statute, the Motor Vehicle Division or the <ln numlevel="1" lineno="375" slineno="2-224"/>administrator of the database may adopt a schedule of fees assessed for utilizing <ln numlevel="1" lineno="376" slineno="2-225"/>the database.</subsection><subsection ssid="6-6-106" dnum="ii-o" numlevel="1" lineno="377" slineno="2-226" level="3"><display>(ii)</display>The fees under this Subsection (12)(b) shall:<subsection ssid="6-6-107" dnum="A-o" numlevel="1" lineno="378" slineno="2-227" level="4"><display>(A)</display>be reasonable and fair; and</subsection><subsection ssid="6-6-108" dnum="B-o" numlevel="1" lineno="379" slineno="2-228" level="4"><display>(B)</display>reflect the cost of administering the database.</subsection></subsection></subsection></subsection></section></bsec><bsec buid="1" type="amend" src="code" num="53-3-202" uid="C53-3-S202_2025050720250507" sort="53 03 02020020250507" numlevel="1" lineno="380" slineno="3-1" sn="3"><section number="53-3-202" numlevel="1" lineno="381" slineno="3-2" type="amend"><secline lineno="380">Section 3, Section <bold>53-3-202</bold> is amended to read:</secline><catline lineno="381"><bold>53-3-202. Drivers must be licensed -- Violation.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="382" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>A human driver may not drive a motor vehicle or an autocycle on a highway in this state <ln numlevel="1" lineno="383" slineno="3-4"/>unless the human driver is:<subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="384" slineno="3-5" level="2"><display>(a)</display>granted the privilege to operate a motor vehicle by being licensed as a driver by the <ln numlevel="1" lineno="385" slineno="3-6"/>division under this chapter;</subsection><subsection ssid="1-3" dnum="b-o" numlevel="1" lineno="386" slineno="3-7" level="2"><display>(b)</display>driving an official United States Government class D motor vehicle with a valid <ln numlevel="1" lineno="387" slineno="3-8"/>United States Government driver permit or license for that type of vehicle;</subsection><subsection ssid="1-4" dnum="c-o" numlevel="1" lineno="388" slineno="3-9" level="2" space="false"><display>(c)</display><subsection ssid="1-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>driving a road roller, road machinery, or any farm tractor or implement of <ln numlevel="1" lineno="389" slineno="3-10"/>husbandry temporarily drawn, moved, or propelled on the highways; and</subsection><subsection ssid="1-6" dnum="ii-o" numlevel="1" lineno="390" slineno="3-11" level="3"><display>(ii)</display>driving the vehicle described in Subsection <xref depth="4" refnumber="53-3-202(1)(c)(i)" start="0">(1)(c)(i)</xref> in conjunction with a <ln numlevel="1" lineno="391" slineno="3-12"/>construction or agricultural activity;</subsection></subsection><subsection ssid="1-7" dnum="d-o" numlevel="1" lineno="392" slineno="3-13" level="2"><display>(d)</display>a nonresident who is at least 16 years of age and younger than 18 years of age who <ln numlevel="1" lineno="393" slineno="3-14"/>has in the nonresident's immediate possession a valid license certificate issued to the <ln numlevel="1" lineno="394" slineno="3-15"/>nonresident in the nonresident's home state or country and is driving in the class or <ln numlevel="1" lineno="395" slineno="3-16"/>classes identified on the home state license certificate, except those persons referred <ln numlevel="1" lineno="396" slineno="3-17"/>to in <xref depth="2" refnumber="53-3-6" start="2">Part 6, Drivers' License Compact</xref>, of this chapter;</subsection><subsection ssid="1-8" dnum="e-o" numlevel="1" lineno="397" slineno="3-18" level="2"><display>(e)</display>a nonresident who is at least 18 years of age and who has in the nonresident's <ln numlevel="1" lineno="398" slineno="3-19"/>immediate possession a valid license certificate issued to the nonresident in the <ln numlevel="1" lineno="399" slineno="3-20"/>nonresident's home state or country if driving in the class or classes identified on the <ln numlevel="1" lineno="400" slineno="3-21"/>home state license certificate, except those persons referred to in <xref depth="2" refnumber="53-3-6" start="2">Part 6, Drivers' <ln numlevel="1" lineno="401" slineno="3-22"/>License Compact</xref>, of this chapter;</subsection><subsection ssid="1-9" dnum="f-o" numlevel="1" lineno="402" slineno="3-23" level="2"><display>(f)</display>driving under a learner permit in accordance with Section <xref depth="3" refnumber="53-3-210.5" start="0">53-3-210.5</xref>;</subsection><subsection ssid="1-10" dnum="g-o" numlevel="1" lineno="403" slineno="3-24" level="2"><display>(g)</display>driving with a temporary license certificate issued in accordance with Section <xref depth="3" refnumber="53-3-207" start="0"><ln numlevel="1" lineno="404" slineno="3-25"/>53-3-207</xref>; or</subsection><subsection ssid="1-11" dnum="h-o" numlevel="1" lineno="405" slineno="3-26" level="2"><display>(h)</display>exempt under <xref depth="1" refnumber="41-22" start="0">Title 41, Chapter 22, Off-highway Vehicles</xref>.</subsection></subsection><subsection ssid="1-12" dnum="2-o" numlevel="1" lineno="406" slineno="3-27" level="1"><display>(2)</display>A human driver may not drive a motor vehicle or perform lateral or longitudinal vehicle <ln numlevel="1" lineno="407" slineno="3-28"/>motion control for a vehicle being towed by another motor vehicle upon a highway <ln numlevel="1" lineno="408" slineno="3-29"/>unless the human driver:<subsection ssid="1-13" dnum="a-o" numlevel="1" lineno="409" slineno="3-30" level="2"><display>(a)</display>is licensed under this chapter to drive a motor vehicle of the type or class of motor <ln numlevel="1" lineno="410" slineno="3-31"/>vehicle being towed; or</subsection><subsection ssid="1-14" dnum="b-o" numlevel="1" lineno="411" slineno="3-32" level="2"><display>(b)</display>is exempted under either Subsection <xref depth="4" refnumber="53-3-202(1)(b)" start="0">(1)(b)</xref> or <xref depth="4" refnumber="53-3-202(1)(c)" start="0">(1)(c)</xref>.</subsection></subsection><subsection ssid="1-15" dnum="3-o" numlevel="1" lineno="412" slineno="3-33" level="1" space="false"><display>(3)</display><subsection ssid="1-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A human driver may not drive a motor vehicle as a taxicab on a highway of this <ln numlevel="1" lineno="413" slineno="3-34"/>state unless the person has a valid class D driver license issued by the division.</subsection><subsection ssid="1-17" dnum="b-o" numlevel="1" lineno="414" slineno="3-35" level="2"><display>(b)</display>A human driver may not drive a motor vehicle as a private passenger carrier on a <ln numlevel="1" lineno="415" slineno="3-36"/>highway of this state unless the human driver has:<subsection ssid="1-18" dnum="i-o" numlevel="1" lineno="416" slineno="3-37" level="3"><display>(i)</display>a taxicab endorsement issued by the division on the human driver's license <ln numlevel="1" lineno="417" slineno="3-38"/>certificate; or</subsection><subsection ssid="1-19" dnum="ii-o" numlevel="1" lineno="418" slineno="3-39" level="3"><display>(ii)</display>a commercial driver license with:<subsection ssid="1-20" dnum="A-o" numlevel="1" lineno="419" slineno="3-40" level="4"><display>(A)</display>a taxicab endorsement;</subsection><subsection ssid="1-21" dnum="B-o" numlevel="1" lineno="420" slineno="3-41" level="4"><display>(B)</display>a passenger endorsement; or</subsection><subsection ssid="1-22" dnum="C-o" numlevel="1" lineno="421" slineno="3-42" level="4"><display>(C)</display>a school bus endorsement.</subsection></subsection></subsection><subsection ssid="1-23" dnum="c-o" numlevel="1" lineno="422" slineno="3-43" level="2"><display>(c)</display>Nothing in Subsection <xref depth="4" refnumber="53-3-202(3)(b)" start="0">(3)(b)</xref> is intended to exempt a human driver driving a motor <ln numlevel="1" lineno="423" slineno="3-44"/>vehicle as a private passenger carrier from regulation under other statutory and <ln numlevel="1" lineno="424" slineno="3-45"/>regulatory schemes, including:<subsection ssid="1-24" dnum="i-o" numlevel="1" lineno="425" slineno="3-46" level="3"><display>(i)</display>49 C.F.R. Parts 350-399, Federal Motor Carrier Safety Regulations;</subsection><subsection ssid="1-25" dnum="ii-o" numlevel="1" lineno="426" slineno="3-47" level="3"><display>(ii)</display><xref depth="1" refnumber="34-36" start="0">Title 34, Chapter 36, Transportation of Workers</xref>, and rules adopted by the Labor <ln numlevel="1" lineno="427" slineno="3-48"/>Commission in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="428" slineno="3-49"/>Rulemaking Act</xref>; and</subsection><subsection ssid="1-26" dnum="iii-o" numlevel="1" lineno="429" slineno="3-50" level="3"><display>(iii)</display><xref depth="1" refnumber="72-9" start="0">Title 72, Chapter 9, Motor Carrier Safety Act</xref>, and rules adopted by the Motor <ln numlevel="1" lineno="430" slineno="3-51"/>Carrier Division in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="431" slineno="3-52"/>Rulemaking Act</xref>.</subsection></subsection></subsection><subsection ssid="1-27" dnum="4-o" numlevel="1" lineno="432" slineno="3-53" level="1" space="false"><display>(4)</display><subsection ssid="1-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections <xref depth="4" refnumber="53-3-202(4)(b)" start="0">(4)(b)</xref>, <xref depth="4" refnumber="53-3-202(4)(c)" start="0">(c)</xref>, <xref depth="4" refnumber="53-3-202(4)(d)" start="0">(d)</xref>, and <xref depth="4" refnumber="53-3-202(4)(e)" start="0">(e)</xref>, a human driver may not <ln numlevel="1" lineno="433" slineno="3-54"/>operate:<subsection ssid="1-29" dnum="i-o" numlevel="1" lineno="434" slineno="3-55" level="3" tab="1"><display>(i)</display>a motorcycle unless the human driver has a valid class D driver license and a <ln numlevel="1" lineno="435" slineno="3-56"/>motorcycle endorsement issued under this chapter;</subsection><subsection ssid="1-30" dnum="ii-o" numlevel="1" lineno="436" slineno="3-57" level="3" tab="1"><display>(ii)</display>a street legal all-terrain vehicle unless the human driver has a valid class D driver <ln numlevel="1" lineno="437" slineno="3-58"/>license; or</subsection><subsection ssid="1-31" dnum="iii-o" numlevel="1" lineno="438" slineno="3-59" level="3" tab="1"><display>(iii)</display>a motor-driven cycle unless the human driver has a valid class D driver license <ln numlevel="1" lineno="439" slineno="3-60"/>and a motorcycle endorsement issued under this chapter.</subsection></subsection><subsection ssid="1-32" dnum="b-o" numlevel="1" lineno="440" slineno="3-61" level="2"><display>(b)</display>A human driver operating a moped, as defined in Section <xref depth="3" refnumber="41-6a-102" start="0">41-6a-102</xref>, is not required <ln numlevel="1" lineno="441" slineno="3-62"/>to have a motorcycle endorsement issued under this chapter.</subsection><subsection ssid="1-33" dnum="c-o" numlevel="1" lineno="442" slineno="3-63" level="2"><display>(c)</display>An individual operating an electric assisted bicycle, as defined in Section <xref depth="3" refnumber="41-6a-102" start="0">41-6a-102</xref>, <ln numlevel="1" lineno="443" slineno="3-64"/>is not required to have a valid class D driver license or a motorcycle endorsement <ln numlevel="1" lineno="444" slineno="3-65"/>issued under this chapter.</subsection><subsection ssid="1-34" dnum="d-o" numlevel="1" lineno="445" slineno="3-66" level="2"><display>(d)</display>An individual is not required to have a valid class D driver license if the person is:<subsection ssid="1-35" dnum="i-o" numlevel="1" lineno="446" slineno="3-67" level="3"><display>(i)</display>operating a motor assisted scooter, as defined in Section <xref depth="3" refnumber="41-6a-102" start="0">41-6a-102</xref>, in accordance <ln numlevel="1" lineno="447" slineno="3-68"/>with Section <xref depth="3" refnumber="41-6a-1115" start="0">41-6a-1115</xref>; or</subsection><subsection ssid="1-36" dnum="ii-o" numlevel="1" lineno="448" slineno="3-69" level="3"><display>(ii)</display>operating an electric personal assistive mobility device, as defined in Section <xref depth="3" refnumber="41-6a-102" start="0"><ln numlevel="1" lineno="449" slineno="3-70"/>41-6a-102</xref>, in accordance with Section <xref depth="3" refnumber="41-6a-1116" start="0">41-6a-1116</xref>.</subsection></subsection><subsection ssid="1-37" dnum="e-o" numlevel="1" lineno="450" slineno="3-71" level="2"><display>(e)</display>A human driver operating an autocycle is not required to have a motorcycle <ln numlevel="1" lineno="451" slineno="3-72"/>endorsement issued under this chapter.</subsection></subsection><subsection ssid="1-38" dnum="5-o" numlevel="1" lineno="452" slineno="3-73" level="1"><display>(5)</display>An automated driving system as defined in Section <xref depth="3" refnumber="41-26-102.1" start="0">41-26-102.1</xref> is not required to have <ln numlevel="1" lineno="453" slineno="3-74"/>a driver license.</subsection><subsection ssid="1-43" dnum="_-o:6-i" numlevel="1" lineno="454" slineno="3-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="1-45" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this Subsection <xref refnumber="53-3-202(6)" depth="4">(6)</xref>, a "quick fingerprint" is a fingerprint, taken on a <ln numlevel="1" lineno="455" slineno="3-76"/>biometric device, that is:</amend><subsection ssid="1-57" dnum="_-o:i-i" numlevel="1" lineno="456" slineno="3-77" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="84" style="1" owner="jchristopherson" level="1" amendtag="end">taken for the purpose of identifying an individual;</amend></subsection><subsection ssid="1-58" dnum="_-o:ii-i" numlevel="1" lineno="457" slineno="3-78" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="83" style="1" owner="jchristopherson" level="1" amendtag="end">queried against an Automated Fingerprint Identification System;</amend></subsection><subsection ssid="1-59" dnum="_-o:iii-i" numlevel="1" lineno="458" slineno="3-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="122" groupid="89" style="1" owner="jchristopherson" level="1" amendtag="end">is not added to or stored in the Automated Fingerprint Identification System; and</amend></subsection><subsection ssid="1-60" dnum="_-o:iv-i" numlevel="1" lineno="459" slineno="3-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">can be accomplished in approximately 15 minutes or less.</amend></subsection></subsection><subsection ssid="1-56" dnum="_-o:b-i" numlevel="1" lineno="460" slineno="3-81" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="end">An individual without a driver license, driving privilege card, or learner permit that <ln numlevel="1" lineno="461" slineno="3-82"/>is lawfully subjected to a stop by a peace officer as described in Section <xref depth="3" refnumber="77-7-15">77-7-15</xref> shall <ln numlevel="1" lineno="462" slineno="3-83"/>present another form of government-issued identification.</amend></subsection><subsection ssid="1-44" dnum="_-o:c-i" numlevel="1" lineno="463" slineno="3-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref refnumber="53-3-202(7)" depth="4">(7)</xref>, a peace officer shall take a quick fingerprint of an <ln numlevel="1" lineno="464" slineno="3-85"/>individual described in Subsection <xref refnumber="53-3-202(6)(b)" depth="4">(6)(b)</xref> if:</amend><subsection ssid="1-47" dnum="_-o:i-i" numlevel="1" lineno="465" slineno="3-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">the peace officer is unable to verify that the individual has been issued a driving <ln numlevel="1" lineno="466" slineno="3-87"/>credential;</amend></subsection><subsection ssid="1-61" dnum="_-o:ii-i" numlevel="1" lineno="467" slineno="3-88" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">the individual does not provide a form of identification; or</amend></subsection><subsection ssid="1-48" dnum="_-o:iii-i" numlevel="1" lineno="468" slineno="3-89" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">the peace officer has reasonable suspicion to believe that the form of <ln numlevel="1" lineno="469" slineno="3-90"/>identification presented is fraudulent.</amend></subsection></subsection><subsection ssid="1-55" dnum="_-o:d-i" numlevel="1" lineno="470" slineno="3-91" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="69" style="1" owner="jchristopherson" level="1" amendtag="end">Nothing in this Subsection <xref refnumber="53-3-202(6)" depth="4">(6)</xref> prohibits a peace officer from conducting a full <ln numlevel="1" lineno="471" slineno="3-92"/>fingerprint panel subject to a noncustodial booking.</amend></subsection></subsection><subsection ssid="1-49" dnum="_-o:7-i" numlevel="1" lineno="472" slineno="3-93" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">A peace officer is not required to comply with Subsection <xref refnumber="53-3-202(6)(c)" depth="4">(6)(c)</xref> if the peace officer <ln numlevel="1" lineno="473" slineno="3-94"/>makes a reasonable determination that:</amend><subsection ssid="1-50" dnum="_-o:a-i" numlevel="1" lineno="474" slineno="3-95" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">doing so would create a safety concern for the driver or peace officer;</amend></subsection><subsection ssid="1-51" dnum="_-o:b-i" numlevel="1" lineno="475" slineno="3-96" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">doing so would prevent the peace officer from addressing other public safety <ln numlevel="1" lineno="476" slineno="3-97"/>considerations;</amend></subsection><subsection ssid="1-52" dnum="_-o:c-i" numlevel="1" lineno="477" slineno="3-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">the peace officer does not have adequate equipment to take a fingerprint;</amend></subsection><subsection ssid="1-62" dnum="_-o:d-i" numlevel="1" lineno="478" slineno="3-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="141" groupid="102" style="1" owner="jchristopherson" level="1" amendtag="end">the driver is less than 18 years old; or</amend></subsection><subsection ssid="1-53" dnum="_-o:e-i" numlevel="1" lineno="479" slineno="3-100" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="end">the peace officer would be unable to complete a fingerprint check due to lack of <ln numlevel="1" lineno="480" slineno="3-101"/>cellular service.</amend></subsection></subsection><subsection ssid="1-54" dnum="_-o:8-i" numlevel="1" lineno="481" slineno="3-102" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">A law enforcement agency shall ensure access to fingerprinting equipment to comply <ln numlevel="1" lineno="482" slineno="3-103"/>with Subsection <xref refnumber="53-3-202(6)" depth="4">(6)</xref> no later than January 1, 2027.</amend></subsection><subsection ssid="1-39" dnum="6-o:9-i" numlevel="1" lineno="483" slineno="3-104" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1240" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="start" space="true">(9)</amend></display><subsection ssid="1-40" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="i" level="1" amendtag="end">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">A person</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="136" groupid="98" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as described in Subsection (9)(b), an individual</amend> who <ln numlevel="1" lineno="484" slineno="3-105"/>violates this section is guilty of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">an infraction.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a class C misdemeanor.</amend></subsection><subsection ssid="1-42" dnum="_-o:b-i" numlevel="1" lineno="485" slineno="3-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="end">An individual is guilty of a class B misdemeanor if, at the time of the offense, the <ln numlevel="1" lineno="486" slineno="3-107"/>individual has previously been convicted of a violation of this section.</amend></subsection><subsection ssid="1-46" dnum="_-o:c-i" numlevel="1" lineno="487" slineno="3-108" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">In addition to the penalties described in Subsections (9)(a) and (b), an individual who <ln numlevel="1" lineno="488" slineno="3-109"/>violates this section is also subject to seizure of the vehicle as described in Section <xref depth="3" refnumber="41-1a-1101"><ln numlevel="1" lineno="489" slineno="3-110"/>41-1a-1101</xref>.</amend></subsection></subsection></section></bsec><bsec buid="15" num="53-3-203" type="amend" src="code" uid="C53-3-S203_2025050720250507" sort="53 03 02030020250507" numlevel="1" lineno="490" slineno="4-1" sn="4"><section number="53-3-203" numlevel="1" lineno="491" slineno="4-2" type="amend"><secline lineno="490">Section 4, Section <bold>53-3-203</bold> is amended to read:</secline><catline lineno="491"><bold>53-3-203. Authorizing or permitting driving in violation of chapter -- Renting of <ln numlevel="1" lineno="492" slineno="4-3"/>motor vehicles -- License requirements -- Employees must be licensed -- Violations.</bold></catline><subsection ssid="15-15-1" dnum="1-o" numlevel="1" lineno="493" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>A person may not authorize or knowingly permit a motor vehicle owned by the person <ln numlevel="1" lineno="494" slineno="4-5"/>or under the person's control to be driven by a person in violation of this chapter.</subsection><subsection ssid="15-15-2" dnum="2-o" numlevel="1" lineno="495" slineno="4-6" level="1" space="false"><display>(2)</display><subsection ssid="15-15-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person may not rent a motor vehicle to another person unless the person who <ln numlevel="1" lineno="496" slineno="4-7"/>will be the driver is licensed in this state, or in the case of a nonresident, licensed <ln numlevel="1" lineno="497" slineno="4-8"/>under the laws of the state or country of his residence.</subsection><subsection ssid="15-15-4" dnum="b-o" numlevel="1" lineno="498" slineno="4-9" level="2"><display>(b)</display>A person may not rent a motor vehicle to another person until the person:<subsection ssid="15-15-5" dnum="i-o" numlevel="1" lineno="499" slineno="4-10" level="3"><display>(i)</display>has inspected the license certificate of the person who will be the driver; and</subsection><subsection ssid="15-15-6" dnum="ii-o" numlevel="1" lineno="500" slineno="4-11" level="3"><display>(ii)</display>verified the signature on the license certificate by comparison with the signature <ln numlevel="1" lineno="501" slineno="4-12"/>of the person who will be the driver written in his presence.</subsection></subsection><subsection ssid="15-15-7" dnum="c-o" numlevel="1" lineno="502" slineno="4-13" level="2" space="false"><display>(c)</display><subsection ssid="15-15-8" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A person may verify the information described in Subsection <xref depth="4" refnumber="53-3-203(2)(b)" start="0">(2)(b)</xref> for a <ln numlevel="1" lineno="503" slineno="4-14"/>subsequent vehicle rental through the use of an electronic system maintained by <ln numlevel="1" lineno="504" slineno="4-15"/>the person for the purposes of expediting the vehicle rental process.</subsection><subsection ssid="15-15-9" dnum="ii-o" numlevel="1" lineno="505" slineno="4-16" level="3"><display>(ii)</display>The electronic system described in Subsection <xref depth="4" refnumber="53-3-203(2)(c)(i)" start="0">(2)(c)(i)</xref> may contain information <ln numlevel="1" lineno="506" slineno="4-17"/>voluntarily provided by the person who will be the driver including:<subsection ssid="15-15-10" dnum="A-o" numlevel="1" lineno="507" slineno="4-18" level="4"><display>(A)</display>information included on the driver license certificate; and</subsection><subsection ssid="15-15-11" dnum="B-o" numlevel="1" lineno="508" slineno="4-19" level="4"><display>(B)</display>biometric information.</subsection></subsection></subsection><subsection ssid="15-15-12" dnum="d-o" numlevel="1" lineno="509" slineno="4-20" level="2"><display>(d)</display>A person renting a motor vehicle to another shall keep a record of the:<subsection ssid="15-15-13" dnum="i-o" numlevel="1" lineno="510" slineno="4-21" level="3"><display>(i)</display>registration number of the rented motor vehicle;</subsection><subsection ssid="15-15-14" dnum="ii-o" numlevel="1" lineno="511" slineno="4-22" level="3"><display>(ii)</display>name and address of the person to whom the motor vehicle is rented;</subsection><subsection ssid="15-15-15" dnum="iii-o" numlevel="1" lineno="512" slineno="4-23" level="3"><display>(iii)</display>number of the license certificate of the renter; and</subsection><subsection ssid="15-15-16" dnum="iv-o" numlevel="1" lineno="513" slineno="4-24" level="3"><display>(iv)</display>date and place the license certificate was issued.</subsection></subsection><subsection ssid="15-15-17" dnum="e-o" numlevel="1" lineno="514" slineno="4-25" level="2"><display>(e)</display>The record is open to inspection by any peace officer or officer or employee of the <ln numlevel="1" lineno="515" slineno="4-26"/>division.</subsection></subsection><subsection ssid="15-15-18" dnum="3-o" numlevel="1" lineno="516" slineno="4-27" level="1"><display>(3)</display>A person may not employ a person to drive a motor vehicle who is not licensed as <ln numlevel="1" lineno="517" slineno="4-28"/>required under this chapter.</subsection><subsection ssid="15-15-19" dnum="4-o" numlevel="1" lineno="518" slineno="4-29" level="1"><display>(4)</display>A person who violates this section is guilty of an infraction<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> and subject to a minimum <ln numlevel="1" lineno="519" slineno="4-30"/>fine of $500.</amend></subsection></section></bsec><bsec buid="17" num="63I-2-241" type="amend" src="code" uid="C63I-2-S241_2025050720250507" sort="63I02 02410020250507" numlevel="1" lineno="520" slineno="5-1" sn="5"><section number="63I-2-241" numlevel="1" lineno="521" slineno="5-2" type="amend"><secline lineno="520">Section 5, Section <bold>63I-2-241</bold> is amended to read:</secline><catline lineno="521"><bold>63I-2-241.
