Weighted pupil units for students in rural school districts and <ln numlevel="1" lineno="20" slineno="1-3"/>necessarily existent small schools.</bold></catline><subsection ssid="4-1" dnum="_-o:1-i" numlevel="1" lineno="21" slineno="1-4" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this section:</amend><subsection ssid="4-2" dnum="_-o:a-i" numlevel="1" lineno="22" slineno="1-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="220" groupid="155" style="1" owner="jchristopherson" level="1" amendtag="end">"Necessarily existent small school" means a school that:</amend><subsection ssid="4-75" dnum="_-o:i-i" numlevel="1" lineno="23" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="225" groupid="159" style="1" owner="jchristopherson" level="1" amendtag="end">is located in an area with a National Center for Education Statistics locale code of <ln numlevel="1" lineno="24" slineno="1-7"/>33 or higher;</amend></subsection><subsection ssid="4-76" dnum="_-o:ii-i" numlevel="1" lineno="25" slineno="1-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="230" groupid="163" style="1" owner="jchristopherson" level="1" amendtag="end">is located more than 10 miles from an area with a National Center for Education <ln numlevel="1" lineno="26" slineno="1-9"/>Statistics locale code of 21 or less;</amend></subsection><subsection ssid="4-77" dnum="_-o:iii-i" numlevel="1" lineno="27" slineno="1-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="235" groupid="167" style="1" owner="jchristopherson" level="1" amendtag="end">is not an online school, specialty school, technical school, alternative school, or <ln numlevel="1" lineno="28" slineno="1-11"/>charter school; and</amend></subsection><subsection ssid="4-78" dnum="_-o:iv-i" numlevel="1" lineno="29" slineno="1-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="240" groupid="171" style="1" owner="jchristopherson" level="1" amendtag="end">has an average daily membership less than or equal to:</amend><subsection ssid="4-79" dnum="_-o:A-i" numlevel="1" lineno="30" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="175" style="1" owner="jchristopherson" level="1" amendtag="end">27 in any individual grade band kindergarten through 6; or</amend></subsection><subsection ssid="4-80" dnum="_-o:B-i" numlevel="1" lineno="31" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="179" style="1" owner="jchristopherson" level="1" amendtag="end">125 in any individual grade band 7 through 12.</amend></subsection></subsection></subsection><subsection ssid="4-4" dnum="_-o:b-i" numlevel="1" lineno="32" slineno="1-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="end">"Scale of operations" means a cost function analysis conducted by the state board to <ln numlevel="1" lineno="33" slineno="1-16"/>determine the relative higher cost of providing educational services for students <ln numlevel="1" lineno="34" slineno="1-17"/>enrolled in smaller school districts when compared to larger school districts.</amend></subsection></subsection><subsection ssid="4-5" dnum="_-o:2-i" numlevel="1" lineno="35" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="4-6" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall adopt a formula to calculate additional weighted pupil units <ln numlevel="1" lineno="36" slineno="1-19"/>using a two-factor distribution described in Subsection (2)(b).</amend></subsection><subsection ssid="4-7" dnum="_-o:b-i" numlevel="1" lineno="37" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="end">The two-factor distribution shall be the sum of a scale of operations weighting and a <ln numlevel="1" lineno="38" slineno="1-21"/>rural-school weighting as follows:</amend><subsection ssid="4-8" dnum="_-o:i-i" numlevel="1" lineno="39" slineno="1-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">a scale of operations weighting that provides up to 1.5 weighted pupil units based <ln numlevel="1" lineno="40" slineno="1-23"/>on the cost function analysis the state board conducts and for each student <ln numlevel="1" lineno="41" slineno="1-24"/>enrolled in:</amend><subsection ssid="4-10" dnum="_-o:A-i" numlevel="1" lineno="42" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">a school district in a county of the fourth, fifth, or sixth class as described in <ln numlevel="1" lineno="43" slineno="1-26"/>Section <xref depth="3" refnumber="17-50-501">17-50-501</xref>; or</amend></subsection><subsection ssid="4-11" dnum="_-o:B-i" numlevel="1" lineno="44" slineno="1-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="end">a school district in a county of the third class as described in Section <xref depth="3" refnumber="17-50-501">17-50-501</xref> <ln numlevel="1" lineno="45" slineno="1-28"/>with fewer than 2,000 students; and</amend></subsection></subsection><subsection ssid="4-13" dnum="_-o:ii-i" numlevel="1" lineno="46" slineno="1-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="end">a rural-school weighting for each necessarily existent small school that provides <ln numlevel="1" lineno="47" slineno="1-30"/>weighted pupil units for each grade band from kindergarten to grade 6 offered:</amend><subsection ssid="4-67" dnum="_-o:A-i" numlevel="1" lineno="48" slineno="1-31" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="184" groupid="126" style="1" owner="jchristopherson" level="1" amendtag="end">with five or fewer students, a base of nine weighted pupil units;</amend></subsection><subsection ssid="4-68" dnum="_-o:B-i" numlevel="1" lineno="49" slineno="1-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="130" style="1" owner="jchristopherson" level="1" amendtag="end">for each student above five students but fewer than 12 students, one additional <ln numlevel="1" lineno="50" slineno="1-33"/>weighted pupil unit for each additional student above five; and</amend></subsection><subsection ssid="4-69" dnum="_-o:C-i" numlevel="1" lineno="51" slineno="1-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="134" style="1" owner="jchristopherson" level="1" amendtag="end">for each student above 12 students, one less weighted pupil unit for each <ln numlevel="1" lineno="52" slineno="1-35"/>additional student; and</amend></subsection></subsection><subsection ssid="4-70" dnum="_-o:iii-i" numlevel="1" lineno="53" slineno="1-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="end">a rural-school weighting for each necessarily existent small school that provides <ln numlevel="1" lineno="54" slineno="1-37"/>weighted pupil units for each grade band from grade 7 to grade 12 offered:</amend><subsection ssid="4-71" dnum="_-o:A-i" numlevel="1" lineno="55" slineno="1-38" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="204" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">with five or fewer students, a base of nine weighted pupil units;</amend></subsection><subsection ssid="4-72" dnum="_-o:B-i" numlevel="1" lineno="56" slineno="1-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="209" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="end">for each student above five students but fewer than 61 students, one additional <ln numlevel="1" lineno="57" slineno="1-40"/>weighted pupil unit for each additional student above five;</amend></subsection><subsection ssid="4-73" dnum="_-o:C-i" numlevel="1" lineno="58" slineno="1-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="214" groupid="150" style="1" owner="jchristopherson" level="1" amendtag="end">for each student above 61 students, one less weighted pupil unit for each <ln numlevel="1" lineno="59" slineno="1-42"/>additional student; and</amend></subsection><subsection ssid="4-74" dnum="_-o:D-i" numlevel="1" lineno="60" slineno="1-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="219" groupid="154" style="1" owner="jchristopherson" level="1" amendtag="end">for each necessarily existent small school with 15 or fewer students, the state <ln numlevel="1" lineno="61" slineno="1-44"/>board may provide the base level of nine weighted pupil units for each grade <ln numlevel="1" lineno="62" slineno="1-45"/>band offered.</amend></subsection></subsection></subsection><subsection ssid="4-110" dnum="_-o:c-i" numlevel="1" lineno="63" slineno="1-46" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="397" groupid="292" style="1" owner="jchristopherson" level="1" amendtag="end">If any grade band under Subsection <xref tempid="408" depth="4" refnumber="(2)(b)">(2)(b)</xref> generates negative weighted pupil units, <ln numlevel="1" lineno="64" slineno="1-47"/>the weighted pupil units for that grade band shall be zero.</amend></subsection><subsection ssid="4-20" dnum="_-o:d-i" numlevel="1" lineno="65" slineno="1-48" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="end">The funding for a student who falls within the weighting factors described in <ln numlevel="1" lineno="66" slineno="1-49"/>Subsections (2)(b)(i) and (2)(b)(ii) shall be computed under both weighting factors.</amend></subsection></subsection><subsection ssid="4-21" dnum="_-o:3-i" numlevel="1" lineno="67" slineno="1-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="68" slineno="1-51"/>state board shall make rules to:</amend><subsection ssid="4-22" dnum="_-o:a-i" numlevel="1" lineno="69" slineno="1-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="end">establish the formula described in Subsection <xref tempid="759" depth="4" refnumber="(2)">(2)</xref> including the scale of weighted <ln numlevel="1" lineno="70" slineno="1-53"/>pupil units described in Subsection (2)(b)(i) by:</amend><subsection ssid="4-23" dnum="_-o:i-i" numlevel="1" lineno="71" slineno="1-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">conducting a cost function analysis measuring the scale of operations weighting <ln numlevel="1" lineno="72" slineno="1-55"/>including factors identified by the state board for each small and rural school <ln numlevel="1" lineno="73" slineno="1-56"/>district compared to all school districts;</amend></subsection><subsection ssid="4-24" dnum="_-o:ii-i" numlevel="1" lineno="74" slineno="1-57" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">determining a weighting relative to the cost function prediction for each school <ln numlevel="1" lineno="75" slineno="1-58"/>district that is above the minimum prediction for all school districts;</amend></subsection><subsection ssid="4-25" dnum="_-o:iii-i" numlevel="1" lineno="76" slineno="1-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="53" style="1" owner="jchristopherson" level="1" amendtag="end">establishing a percentile cutoff for a full weighted pupil unit that:</amend><subsection ssid="4-26" dnum="_-o:A-i" numlevel="1" lineno="77" slineno="1-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">provides a full weighting for districts enrolling fewer than 1,100 students; and</amend></subsection><subsection ssid="4-27" dnum="_-o:B-i" numlevel="1" lineno="78" slineno="1-61" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="57" style="1" owner="jchristopherson" level="1" amendtag="end">provides no scale of operations weighting described in Subsection (2)(b)(i) for <ln numlevel="1" lineno="79" slineno="1-62"/>school districts enrolling greater than seven times the full-weight cutoff; and</amend></subsection></subsection><subsection ssid="4-28" dnum="_-o:iv-i" numlevel="1" lineno="80" slineno="1-63" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">based on the cost function analysis, establishing a gradually reduced weighted <ln numlevel="1" lineno="81" slineno="1-64"/>pupil unit for each school district above the percentile cutoff established;</amend></subsection></subsection><subsection ssid="4-29" dnum="_-o:b-i" numlevel="1" lineno="82" slineno="1-65" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="61" style="1" owner="jchristopherson" level="1" amendtag="end">establish a timeline for the distribution of funds to school districts provided under <ln numlevel="1" lineno="83" slineno="1-66"/>this section; and</amend></subsection><subsection ssid="4-30" dnum="_-o:c-i" numlevel="1" lineno="84" slineno="1-67" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="63" style="1" owner="jchristopherson" level="1" amendtag="end">for fiscal year 2030 and subsequently each fifth fiscal year:</amend><subsection ssid="4-31" dnum="_-o:i-i" numlevel="1" lineno="85" slineno="1-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="95" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="end">revise the:</amend><subsection ssid="4-111" slineno="1-74"/>to the scale of operations or rural-school weightings for each school district.</amend></subsection></subsection></subsection><subsection ssid="4-33" dnum="_-o:4-i" numlevel="1" lineno="92" slineno="1-75" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">If an allocation under this section to a school district would be less than the allocation <ln numlevel="1" lineno="95" slineno="1-78"/>the school district received for necessarily existent small schools in the 2025 fiscal year, <ln numlevel="1" lineno="96" slineno="1-79"/>the Executive Appropriations Committee shall:</amend><subsection ssid="4-45" dnum="_-o:a-i" numlevel="1" lineno="97" slineno="1-80" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="77" style="1" owner="jchristopherson" level="1" amendtag="end">include a one-time appropriation in the public education budget to provide the 2025 <ln numlevel="1" lineno="98" slineno="1-81"/>fiscal year amount to the school district in the 2026 fiscal year; and</amend></subsection><subsection ssid="4-46" dnum="_-o:b-i" numlevel="1" lineno="99" slineno="1-82" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="115" groupid="79" style="1" owner="jchristopherson" level="1" amendtag="end">decrease the amount described in Subsection (5)(a) to zero in the 2027 fiscal year.</amend></subsection></subsection><subsection ssid="4-52" dnum="_-o:6-i" numlevel="1" lineno="100" slineno="1-83" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="133" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">During each five year review described in Subsection (3)(c):</amend><subsection ssid="4-53" dnum="_-o:a-i" numlevel="1" lineno="101" slineno="1-84" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="93" style="1" owner="jchristopherson" level="1" amendtag="end">if a school or school district no longer qualifies under the criteria described in <ln numlevel="1" lineno="102" slineno="1-85"/>Subsection <xref tempid="501" depth="4" refnumber="(2)">(2)</xref>, the state board shall:</amend><subsection ssid="4-54" dnum="_-o:i-i" numlevel="1" lineno="103" slineno="1-86" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="139" groupid="95" style="1" owner="jchristopherson" level="1" amendtag="end">review the conditions causing the school or school district to no longer qualify;</amend></subsection><subsection ssid="4-55" dnum="_-o:ii-i" numlevel="1" lineno="104" slineno="1-87" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="97" style="1" owner="jchristopherson" level="1" amendtag="end">if the school or school district has an average daily membership increase of no <ln numlevel="1" lineno="105" slineno="1-88"/>more than 10% over the preceding five years, allow the school or school district to <ln numlevel="1" lineno="106" slineno="1-89"/>remain eligible for funding in an amount that is at least equivalent to the amount <ln numlevel="1" lineno="107" slineno="1-90"/>the school or school district received in the current fiscal year under this section; <ln numlevel="1" lineno="108" slineno="1-91"/>and</amend></subsection><subsection ssid="4-56" dnum="_-o:iii-i" numlevel="1" lineno="109" slineno="1-92" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="145" groupid="99" style="1" owner="jchristopherson" level="1" amendtag="end">if the school or school district has an average daily membership increase of more <ln numlevel="1" lineno="110" slineno="1-93"/>than 10% but less than 30% over the preceding five years, make recommendations <ln numlevel="1" lineno="111" slineno="1-94"/>to the Public Education Appropriations Subcommittee regarding an extension of <ln numlevel="1" lineno="112" slineno="1-95"/>the funding received under this section; and</amend></subsection></subsection><subsection ssid="4-57" dnum="_-o:b-i" numlevel="1" lineno="113" slineno="1-96" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="148" groupid="101" style="1" owner="jchristopherson" level="1" amendtag="end">if a school district is receiving an extension of funds as described in this Subsection <xref tempid="123" depth="4" refnumber="(6)"><ln numlevel="1" lineno="114" slineno="1-97"/>(6)</xref>, the state board shall:</amend><subsection ssid="4-58" dnum="_-o:i-i" numlevel="1" lineno="115" slineno="1-98" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="151" groupid="103" style="1" owner="jchristopherson" level="1" amendtag="end">review the necessity and impacts of continued eligibility; and</amend></subsection><subsection ssid="4-59" dnum="_-o:ii-i" numlevel="1" lineno="116" slineno="1-99" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="105" style="1" owner="jchristopherson" level="1" amendtag="end">make recommendations to the Public Education Appropriations Subcommittee <ln numlevel="1" lineno="117" slineno="1-100"/>regarding the renewal of eligibility.</amend></subsection></subsection></subsection><subsection ssid="4-60" dnum="_-o:7-i" numlevel="1" lineno="118" slineno="1-101" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(7)</amend></display><amend anum="0" ea="amend" pairid="157" groupid="107" style="1" owner="jchristopherson" level="1" amendtag="end">If, after the review described in Subsection <xref tempid="520" depth="4" refnumber="(6)">(6)</xref>, a school or school district no longer <ln numlevel="1" lineno="119" slineno="1-102"/>qualifies for funding under this section, the Executive Appropriations Committee shall:</amend><subsection ssid="4-61" dnum="_-o:a-i" numlevel="1" lineno="120" slineno="1-103" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="109" style="1" owner="jchristopherson" level="1" amendtag="end">include a one-time appropriation in the public education budget to provide the same <ln numlevel="1" lineno="121" slineno="1-104"/>amount of funding the school district received in the preceding fiscal year; and</amend></subsection><subsection ssid="4-62" dnum="_-o:b-i" numlevel="1" lineno="122" slineno="1-105" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="111" style="1" owner="jchristopherson" level="1" amendtag="end">decrease the amount to zero in the next fiscal year.</amend></subsection></subsection><subsection ssid="4-81" dnum="_-o:8-i" numlevel="1" lineno="123" slineno="1-106" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><subsection ssid="4-83" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="254" groupid="182" style="1" owner="jchristopherson" level="1" amendtag="end">A school district that intends to split a school that qualifies as a necessarily <ln numlevel="1" lineno="124" slineno="1-107"/>existent small school or has qualified as a necessarily existent small school within the <ln numlevel="1" lineno="125" slineno="1-108"/>past five years shall submit a proposal to the state board for review and approval.</amend></subsection><subsection ssid="4-84" dnum="_-o:b-i" numlevel="1" lineno="126" slineno="1-109" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="265" groupid="189" style="1" owner="jchristopherson" level="1" amendtag="end">The school district proposal shall include:</amend><subsection ssid="4-85" dnum="_-o:i-i" numlevel="1" lineno="127" slineno="1-110" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="270" groupid="193" style="1" owner="jchristopherson" level="1" amendtag="end">the current enrollment and projected enrollment for the next five years for the <ln numlevel="1" lineno="128" slineno="1-111"/>existing school and the proposed new school;</amend></subsection><subsection ssid="4-86" dnum="_-o:ii-i" numlevel="1" lineno="129" slineno="1-112" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="275" groupid="197" style="1" owner="jchristopherson" level="1" amendtag="end">a detailed explanation of the educational and operational reasons for the proposed <ln numlevel="1" lineno="130" slineno="1-113"/>split;</amend></subsection><subsection ssid="4-87" dnum="_-o:iii-i" numlevel="1" lineno="131" slineno="1-114" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="280" groupid="201" style="1" owner="jchristopherson" level="1" amendtag="end">an analysis of the financial impact on the district and the state, including any <ln numlevel="1" lineno="132" slineno="1-115"/>changes in necessarily existent small school funding that would result from the <ln numlevel="1" lineno="133" slineno="1-116"/>split;</amend></subsection><subsection ssid="4-88" dnum="_-o:iv-i" numlevel="1" lineno="134" slineno="1-117" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="205" style="1" owner="jchristopherson" level="1" amendtag="end">a plan for ensuring that educational quality will be maintained or improved in <ln numlevel="1" lineno="135" slineno="1-118"/>both the existing and new school; and</amend></subsection><subsection ssid="4-89" dnum="_-o:v-i" numlevel="1" lineno="136" slineno="1-119" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="290" groupid="209" style="1" owner="jchristopherson" level="1" amendtag="end">any other information requested by the state board.</amend></subsection></subsection><subsection ssid="4-90" dnum="_-o:c-i" numlevel="1" lineno="137" slineno="1-120" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="295" groupid="213" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall review the proposal and may:</amend><subsection ssid="4-91" dnum="_-o:i-i" numlevel="1" lineno="138" slineno="1-121" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="300" groupid="217" style="1" owner="jchristopherson" level="1" amendtag="end">approve the proposal if the state board determines that the split is educationally <ln numlevel="1" lineno="139" slineno="1-122"/>and operationally necessary and not primarily motivated by financial <ln numlevel="1" lineno="140" slineno="1-123"/>considerations related to necessarily existent small school funding;</amend></subsection><subsection ssid="4-92" dnum="_-o:ii-i" numlevel="1" lineno="141" slineno="1-124" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="305" groupid="221" style="1" owner="jchristopherson" level="1" amendtag="end">deny the proposal if the state board determines that the split is unnecessary or <ln numlevel="1" lineno="142" slineno="1-125"/>primarily motivated by financial considerations related to necessarily existent <ln numlevel="1" lineno="143" slineno="1-126"/>small school funding; or</amend></subsection><subsection ssid="4-93" dnum="_-o:iii-i" numlevel="1" lineno="144" slineno="1-127" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="310" groupid="225" style="1" owner="jchristopherson" level="1" amendtag="end">request additional information or modifications to the proposal before making a <ln numlevel="1" lineno="145" slineno="1-128"/>final decision.</amend></subsection></subsection><subsection ssid="4-94" dnum="_-o:d-i" numlevel="1" lineno="146" slineno="1-129" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="229" style="1" owner="jchristopherson" level="1" amendtag="end">If the state board approves the proposal, the state board shall submit a report to the <ln numlevel="1" lineno="147" slineno="1-130"/>Public Education Appropriations Subcommittee, which shall include:</amend><subsection ssid="4-95" dnum="_-o:i-i" numlevel="1" lineno="148" slineno="1-131" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="233" style="1" owner="jchristopherson" level="1" amendtag="end">summary of the approved proposal;</amend></subsection><subsection ssid="4-96" dnum="_-o:ii-i" numlevel="1" lineno="149" slineno="1-132" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="325" groupid="237" style="1" owner="jchristopherson" level="1" amendtag="end">the state board's rationale for approving the proposal; and</amend></subsection><subsection ssid="4-97" dnum="_-o:iii-i" numlevel="1" lineno="150" slineno="1-133" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="330" groupid="241" style="1" owner="jchristopherson" level="1" amendtag="end">any recommended changes to necessarily existent small school funding <ln numlevel="1" lineno="151" slineno="1-134"/>allocations resulting from the approved split.</amend></subsection></subsection><subsection ssid="4-98" dnum="_-o:e-i" numlevel="1" lineno="152" slineno="1-135" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="335" groupid="245" style="1" owner="jchristopherson" level="1" amendtag="end">The Public Education Appropriations Subcommittee shall review the state board's <ln numlevel="1" lineno="153" slineno="1-136"/>report and may:</amend><subsection ssid="4-99" dnum="_-o:i-i" numlevel="1" lineno="154" slineno="1-137" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="340" groupid="249" style="1" owner="jchristopherson" level="1" amendtag="end">approve the funding changes recommended by the state board;</amend></subsection><subsection ssid="4-100" dnum="_-o:ii-i" numlevel="1" lineno="155" slineno="1-138" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="345" groupid="253" style="1" owner="jchristopherson" level="1" amendtag="end">modify the funding changes; or</amend></subsection><subsection ssid="4-101" dnum="_-o:iii-i" numlevel="1" lineno="156" slineno="1-139" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="350" groupid="257" style="1" owner="jchristopherson" level="1" amendtag="end">deny the funding changes and require the school district to maintain the current <ln numlevel="1" lineno="157" slineno="1-140"/>funding allocation.</amend></subsection></subsection><subsection ssid="4-102" dnum="_-o:f-i" numlevel="1" lineno="158" slineno="1-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><subsection ssid="4-108" dnum="_-o:i-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="391" groupid="289" style="1" owner="jchristopherson" level="1" amendtag="end">Subject to Subsection <xref tempid="416" depth="4" refnumber="(8)(f)(ii)">(8)(f)(ii)</xref>, a school district may split a school that qualifies <ln numlevel="1" lineno="159" slineno="1-142"/>as a necessarily existent small school or has qualified as a necessarily existent <ln numlevel="1" lineno="160" slineno="1-143"/>small school within the past five years without submitting a proposal as described <ln numlevel="1" lineno="161" slineno="1-144"/>in this Subsection <xref tempid="824" depth="4" refnumber="(8)">(8)</xref>.</amend></subsection><subsection ssid="4-109" dnum="_-o:ii-i" numlevel="1" lineno="162" slineno="1-145" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="388" groupid="286" style="1" owner="jchristopherson" level="1" amendtag="end">If a school district proceeds with splitting a necessarily existent small school <ln numlevel="1" lineno="163" slineno="1-146"/>without applying for or receiving approval from both the state board and the <ln numlevel="1" lineno="164" slineno="1-147"/>Public Education Appropriations Subcommittee, the schools created from the split <ln numlevel="1" lineno="165" slineno="1-148"/>may not qualify as necessarily existent small schools.</amend></subsection></subsection><subsection ssid="4-103" dnum="_-o:g-i" numlevel="1" lineno="166" slineno="1-149" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="i" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="360" groupid="265" style="1" owner="jchristopherson" level="1" amendtag="end">The state board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="167" slineno="1-150"/>Administrative Rulemaking Act, to establish:</amend><subsection ssid="4-104" dnum="_-o:i-i" numlevel="1" lineno="168" slineno="1-151" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="269" style="1" owner="jchristopherson" level="1" amendtag="end">the timeline and procedures for submitting and reviewing proposals;</amend></subsection><subsection ssid="4-105" dnum="_-o:ii-i" numlevel="1" lineno="169" slineno="1-152" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="370" groupid="273" style="1" owner="jchristopherson" level="1" amendtag="end">criteria for evaluating the necessity and appropriateness of proposed school splits;</amend></subsection><subsection ssid="4-106" dnum="_-o:iii-i" numlevel="1" lineno="170" slineno="1-153" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="375" groupid="277" style="1" owner="jchristopherson" level="1" amendtag="end">requirements for post-approval monitoring and reporting by a school district that <ln numlevel="1" lineno="171" slineno="1-154"/>has split a necessarily existent small school; and</amend></subsection><subsection ssid="4-107" dnum="_-o:iv-i" numlevel="1" lineno="172" slineno="1-155" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="380" groupid="281" style="1" owner="jchristopherson" level="1" amendtag="end">any other provisions necessary to implement this subsection.</amend></subsection></subsection></subsection></section></bsec><bsec buid="7" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="173" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="173">Section 2.  <bold>Effective Date.</bold></secline><sectionText lineno="174"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on
