Acton</sponsorhead><otherSponsorhead>Senate Sponsor: </otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses kinship caregivers for children in the custody of the Division of Child <ln numlevel="1" lineno="6" slineno="0-6"/>and Family Services.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">when a child in the custody of the Division of Child and Family Services (division) is <ln numlevel="1" lineno="11" slineno="0-11"/>placed with the child's relative, requires the division to offer a one-time payment to the <ln numlevel="1" lineno="12" slineno="0-12"/>relative to help support the child prior to the relative becoming a licensed or certified <ln numlevel="1" lineno="13" slineno="0-13"/>kinship caregiver;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires the division to report information regarding payments provided to kinship <ln numlevel="1" lineno="15" slineno="0-15"/>caregivers to the Social Services Appropriations Subcommittee; and</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="17" slineno="0-17" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="18">None</moniNone><oc numlevel="1" lineno="19" slineno="0-19">Other Special Clauses:</oc><ocNone lineno="20">None</ocNone><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="26B-2-130" src="code" uid="C26B-2-S130_2025050720250507" buid="1" sort="26B02 01300020250507" numlevel="1" lineno="23" slineno="0-23"><bold>26B-2-130</bold>, as renumbered and amended by Laws of Utah 2023, Chapter 305</sn><sn num="80-2-301" src="code" uid="C80-2-S301_2025050720250507" buid="10" sort="80 02 03010020250507" numlevel="1" lineno="24" slineno="0-24"><bold>80-2-301</bold>, as last amended by Laws of Utah 2024, Chapters 240, 307</sn></saamd></sa></lt><enacthead lineno="25"/><enact numlevel="1" lineno="26" slineno="0-26">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" num="26B-2-130" type="amend" src="code" uid="C26B-2-S130_2025050720250507" sort="26B02 01300020250507" numlevel="1" lineno="27" slineno="1-1" sn="1"><section number="26B-2-130" numlevel="1" lineno="28" slineno="1-2" type="amend"><secline lineno="27">Section 1, Section <bold>26B-2-130</bold> is amended to read:</secline><catline lineno="28"><bold>26B-2-130. Foster care by a child's relative -- Maintenance payments.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="30" slineno="1-4" level="2"><display>(a)</display>"Custody" means the same as that term is defined in Section <xref depth="3" refnumber="80-2-102" start="0">80-2-102</xref>.</subsection><subsection ssid="1-23" dnum="_-o:b-i" numlevel="1" lineno="31" slineno="1-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">"Division" means the Division of Child and Family Services.</amend></subsection><subsection ssid="1-30" dnum="_-o:c-i" numlevel="1" lineno="32" slineno="1-6" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="72" style="1" owner="ahaskell" level="1" amendtag="end">"Initial kinship caregiver" means a kinship caregiver who is not a licensed foster care <ln numlevel="1" lineno="33" slineno="1-7"/>provider and who is the first kinship placement for a child in the temporary custody <ln numlevel="1" lineno="34" slineno="1-8"/>or custody of the division.</amend></subsection><subsection ssid="1-15" dnum="_-o:d-i" numlevel="1" lineno="35" slineno="1-9" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="23" style="1" owner="ahaskell" level="1" amendtag="end">"Kinship caregiver" means an individual who is responsible for the care and <ln numlevel="1" lineno="36" slineno="1-10"/>supervision of the child when the child is in the temporary custody or custody of the <ln numlevel="1" lineno="37" slineno="1-11"/>division and who:</amend><subsection ssid="1-31" dnum="_-o:i-i" numlevel="1" lineno="38" slineno="1-12" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="111" groupid="80" style="1" owner="ahaskell" level="1" amendtag="end">is a relative of the child; or</amend></subsection><subsection ssid="1-32" dnum="_-o:ii-i" numlevel="1" lineno="39" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="85" style="1" owner="ahaskell" level="1" amendtag="end">is not related to the child by birth or marriage, but who has an emotionally <ln numlevel="1" lineno="40" slineno="1-14"/>significant relationship with the child such that the individual's relationship with <ln numlevel="1" lineno="41" slineno="1-15"/>the child takes on the characteristics of a family relationship.</amend></subsection></subsection><subsection ssid="1-1-3" dnum="b-o:e-i" numlevel="1" lineno="42" slineno="1-16" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>"Relative" means the same as that term is defined in Section <xref depth="3" refnumber="80-3-102" start="0">80-3-102</xref>.</subsection><subsection ssid="1-1-4" dnum="c-o:f-i" numlevel="1" lineno="43" slineno="1-17" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Temporary custody" means the same as that term is defined in Section <xref depth="3" refnumber="80-2-102" start="0">80-2-102</xref>.</subsection></subsection><subsection ssid="1-1-5" dnum="2-o" numlevel="1" lineno="44" slineno="1-18" level="1" space="false"><display>(2)</display><subsection ssid="1-1-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with state and federal law, the division shall provide for licensure of <ln numlevel="1" lineno="45" slineno="1-19"/>a child's relative for foster or substitute care, when the child is in the temporary <ln numlevel="1" lineno="46" slineno="1-20"/>custody or custody of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="93" groupid="69" style="2" owner="ahaskell" level="1" deltag="both">Division of Child and Family Services</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="92" groupid="68" style="1" owner="ahaskell" level="1" amendtag="both" space="true">division</amend>.</subsection><subsection ssid="1-1-7" dnum="b-o" numlevel="1" lineno="47" slineno="1-21" level="2"><display>(b)</display>If it is determined that, under federal law, allowance is made for an approval process <ln numlevel="1" lineno="48" slineno="1-22"/>requiring less than full foster parent licensure proceedings for a child's relative, the <ln numlevel="1" lineno="49" slineno="1-23"/>division shall establish an approval process to accomplish that purpose.</subsection></subsection><subsection ssid="1-14" dnum="_-o:3-i" numlevel="1" lineno="50" slineno="1-24" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-28" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="63" style="1" owner="ahaskell" level="1" amendtag="end">The division shall offer an initial kinship caregiver a one-time payment to assist <ln numlevel="1" lineno="51" slineno="1-25"/>with providing care and supervision to the child.</amend></subsection><subsection ssid="1-33" dnum="_-o:b-i" numlevel="1" lineno="52" slineno="1-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="117" groupid="84" style="1" owner="ahaskell" level="1" amendtag="end">The amount of the one-time initial kinship caregiver payment shall be included as <ln numlevel="1" lineno="53" slineno="1-27"/>part of the division's foster care rate table.</amend></subsection></subsection></section></bsec><bsec buid="10" num="80-2-301" type="amend" src="code" uid="C80-2-S301_2025050720250507" sort="80 02 03010020250507" numlevel="1" lineno="54" slineno="2-1" sn="2"><section number="80-2-301" numlevel="1" lineno="55" slineno="2-2" type="amend"><secline lineno="54">Section 2, Section <bold>80-2-301</bold> is amended to read:</secline><catline lineno="55"><bold>80-2-301. Division responsibilities.</bold></catline><subsection ssid="10-10-1" dnum="1-o" numlevel="1" lineno="56" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The division is the child, youth, and family services authority of the state.</subsection><subsection ssid="10-10-2" dnum="2-o" numlevel="1" lineno="57" slineno="2-4" level="1"><display>(2)</display>The division shall:<subsection ssid="10-10-3" dnum="a-o" numlevel="1" lineno="58" slineno="2-5" level="2"><display>(a)</display>administer services to minors and families, including:<subsection ssid="10-10-4" dnum="i-o" numlevel="1" lineno="59" slineno="2-6" level="3"><display>(i)</display>child welfare services;</subsection><subsection ssid="10-10-5" dnum="ii-o" numlevel="1" lineno="60" slineno="2-7" level="3"><display>(ii)</display>domestic violence services; and</subsection><subsection ssid="10-10-6" dnum="iii-o" numlevel="1" lineno="61" slineno="2-8" level="3"><display>(iii)</display>all other responsibilities that the Legislature or the executive director of the <ln numlevel="1" lineno="62" slineno="2-9"/>department may assign to the division;</subsection></subsection><subsection ssid="10-10-7" dnum="b-o" numlevel="1" lineno="63" slineno="2-10" level="2"><display>(b)</display>provide the following services:<subsection ssid="10-10-8" dnum="i-o" numlevel="1" lineno="64" slineno="2-11" level="3"><display>(i)</display>financial and other assistance to an individual adopting a child with special needs <ln numlevel="1" lineno="65" slineno="2-12"/>under Sections <xref depth="3" refnumber="80-2-806">80-2-806</xref> through <xref depth="3" refnumber="80-2-809">80-2-809</xref>, not to exceed the amount the division <ln numlevel="1" lineno="66" slineno="2-13"/>would provide for the child as a legal ward of the state;</subsection><subsection ssid="10-10-9" dnum="ii-o" numlevel="1" lineno="67" slineno="2-14" level="3"><display>(ii)</display>non-custodial and in-home services in accordance with Section <xref depth="3" refnumber="80-2-306">80-2-306</xref>, <ln numlevel="1" lineno="68" slineno="2-15"/>including:<subsection ssid="10-10-10" dnum="A-o" numlevel="1" lineno="69" slineno="2-16" level="4"><display>(A)</display>services designed to prevent family break-up; and</subsection><subsection ssid="10-10-11" dnum="B-o" numlevel="1" lineno="70" slineno="2-17" level="4"><display>(B)</display>family preservation services;</subsection></subsection><subsection ssid="10-10-12" dnum="iii-o" numlevel="1" lineno="71" slineno="2-18" level="3"><display>(iii)</display>reunification services to families whose children are in substitute care in <ln numlevel="1" lineno="72" slineno="2-19"/>accordance with this chapter, Chapter 2a, Removal and Protective Custody of a <ln numlevel="1" lineno="73" slineno="2-20"/>Child, and Chapter 3, Abuse, Neglect, and Dependency Proceedings;</subsection><subsection ssid="10-10-13" dnum="iv-o" numlevel="1" lineno="74" slineno="2-21" level="3"><display>(iv)</display>protective supervision of a family, upon court order, in an effort to eliminate <ln numlevel="1" lineno="75" slineno="2-22"/>abuse or neglect of a child in that family;</subsection><subsection ssid="10-10-14" dnum="v-o" numlevel="1" lineno="76" slineno="2-23" level="3"><display>(v)</display>shelter care in accordance with this chapter, Chapter 2a, Removal and Protective <ln numlevel="1" lineno="77" slineno="2-24"/>Custody of a Child, and Chapter 3, Abuse, Neglect, and Dependency Proceedings;</subsection><subsection ssid="10-10-15" dnum="vi-o" numlevel="1" lineno="78" slineno="2-25" level="3"><display>(vi)</display>domestic violence services, in accordance with the requirements of federal law;</subsection><subsection ssid="10-10-16" dnum="vii-o" numlevel="1" lineno="79" slineno="2-26" level="3"><display>(vii)</display>protective services to victims of domestic violence and the victims' children, in <ln numlevel="1" lineno="80" slineno="2-27"/>accordance with this chapter, Chapter 2a, Removal and Protective Custody of a <ln numlevel="1" lineno="81" slineno="2-28"/>Child, and Chapter 3, Abuse, Neglect, and Dependency Proceedings;</subsection><subsection ssid="10-10-17" dnum="viii-o" numlevel="1" lineno="82" slineno="2-29" level="3"><display>(viii)</display>substitute care for dependent, abused, and neglected children;</subsection><subsection ssid="10-10-18" dnum="ix-o" numlevel="1" lineno="83" slineno="2-30" level="3"><display>(ix)</display>services for minors who are victims of human trafficking or human smuggling, <ln numlevel="1" lineno="84" slineno="2-31"/>as described in Sections <xref depth="3" refnumber="76-5-308">76-5-308</xref> through <xref depth="3" refnumber="76-5-310.1">76-5-310.1</xref>, or who have engaged in <ln numlevel="1" lineno="85" slineno="2-32"/>prostitution or sexual solicitation, as defined in Sections <xref depth="3" refnumber="76-10-1302">76-10-1302</xref> and <xref depth="3" refnumber="76-10-1313"><ln numlevel="1" lineno="86" slineno="2-33"/>76-10-1313</xref>; and</subsection><subsection ssid="10-10-19" dnum="x-o" numlevel="1" lineno="87" slineno="2-34" level="3"><display>(x)</display>training for staff and providers involved in the administration and delivery of <ln numlevel="1" lineno="88" slineno="2-35"/>services offered by the division in accordance with this chapter and Chapter 2a, <ln numlevel="1" lineno="89" slineno="2-36"/>Removal and Protective Custody of a Child;</subsection></subsection><subsection ssid="10-10-20" dnum="c-o" numlevel="1" lineno="90" slineno="2-37" level="2"><display>(c)</display>establish standards for all:<subsection ssid="10-10-21" dnum="i-o" numlevel="1" lineno="91" slineno="2-38" level="3"><display>(i)</display>contract providers of out-of-home care for minors and families;</subsection><subsection ssid="10-10-22" dnum="ii-o" numlevel="1" lineno="92" slineno="2-39" level="3"><display>(ii)</display>facilities that provide substitute care for dependent, abused, or neglected children <ln numlevel="1" lineno="93" slineno="2-40"/>placed in the custody of the division; and</subsection><subsection ssid="10-10-23" dnum="iii-o" numlevel="1" lineno="94" slineno="2-41" level="3"><display>(iii)</display>direct or contract providers of domestic violence services described in <ln numlevel="1" lineno="95" slineno="2-42"/>Subsection (2)(b)(vi);</subsection></subsection><subsection ssid="10-10-24" dnum="d-o" numlevel="1" lineno="96" slineno="2-43" level="2"><display>(d)</display>have authority to:<subsection ssid="10-10-25" dnum="i-o" numlevel="1" lineno="97" slineno="2-44" level="3"><display>(i)</display>contract with a private, nonprofit organization to recruit and train foster care <ln numlevel="1" lineno="98" slineno="2-45"/>families and child welfare volunteers in accordance with Section <xref depth="3" refnumber="80-2-405">80-2-405</xref>; </subsection><subsection ssid="10-10-26" dnum="ii-o" numlevel="1" lineno="99" slineno="2-46" level="3"><display>(ii)</display>approve facilities that meet the standards established under Subsection (2)(c) to <ln numlevel="1" lineno="100" slineno="2-47"/>provide substitute care for dependent, abused, or neglected children placed in the <ln numlevel="1" lineno="101" slineno="2-48"/>custody of the division; and</subsection><subsection ssid="10-10-27" dnum="iii-o" numlevel="1" lineno="102" slineno="2-49" level="3"><display>(iii)</display>approve an individual to provide short-term relief care to a foster parent if the <ln numlevel="1" lineno="103" slineno="2-50"/>individual:<subsection ssid="10-10-28" dnum="A-o" numlevel="1" lineno="104" slineno="2-51" level="4"><display>(A)</display>provides the relief care for less than six consecutive nights;</subsection><subsection ssid="10-10-29" dnum="B-o" numlevel="1" lineno="105" slineno="2-52" level="4"><display>(B)</display>provides the relief care in the short-term relief care provider's home;</subsection><subsection ssid="10-10-30" dnum="C-o" numlevel="1" lineno="106" slineno="2-53" level="4"><display>(C)</display>is direct access qualified, as that term is defined in Section <xref depth="3" refnumber="26B-2-120">26B-2-120</xref>; and</subsection><subsection ssid="10-10-31" dnum="D-o" numlevel="1" lineno="107" slineno="2-54" level="4"><display>(D)</display>is an immediate family member or relative, as those terms are defined in <ln numlevel="1" lineno="108" slineno="2-55"/>Section <xref depth="3" refnumber="80-3-102">80-3-102</xref>, of the foster parent;</subsection></subsection></subsection><subsection ssid="10-10-32" dnum="e-o" numlevel="1" lineno="109" slineno="2-56" level="2"><display>(e)</display>cooperate with the federal government in the administration of child welfare and <ln numlevel="1" lineno="110" slineno="2-57"/>domestic violence programs and other human service activities assigned by the <ln numlevel="1" lineno="111" slineno="2-58"/>department;</subsection><subsection ssid="10-10-33" dnum="f-o" numlevel="1" lineno="112" slineno="2-59" level="2"><display>(f)</display>in accordance with Subsection (5)(a), promote and enforce state and federal laws <ln numlevel="1" lineno="113" slineno="2-60"/>enacted for the protection of abused, neglected, or dependent children, in accordance <ln numlevel="1" lineno="114" slineno="2-61"/>with this chapter and Chapter 2a, Removal and Protective Custody of a Child, unless <ln numlevel="1" lineno="115" slineno="2-62"/>administration is expressly vested in another division or department of the state;</subsection><subsection ssid="10-10-34" dnum="g-o" numlevel="1" lineno="116" slineno="2-63" level="2"><display>(g)</display>cooperate with the Workforce Development Division within the Department of <ln numlevel="1" lineno="117" slineno="2-64"/>Workforce Services in meeting the social and economic needs of an individual who is <ln numlevel="1" lineno="118" slineno="2-65"/>eligible for public assistance;</subsection><subsection ssid="10-10-35" dnum="h-o" numlevel="1" lineno="119" slineno="2-66" level="2"><display>(h)</display>compile relevant information, statistics, and reports on child and family service <ln numlevel="1" lineno="120" slineno="2-67"/>matters in the state;</subsection><subsection ssid="10-10-36" dnum="i-o" numlevel="1" lineno="121" slineno="2-68" level="2"><display>(i)</display>prepare and submit to the department, the governor, and the Legislature reports of the <ln numlevel="1" lineno="122" slineno="2-69"/>operation and administration of the division in accordance with the requirements of <ln numlevel="1" lineno="123" slineno="2-70"/>Sections <xref depth="3" refnumber="80-2-1102">80-2-1102</xref> and <xref depth="3" refnumber="80-2-1103">80-2-1103</xref>;</subsection><subsection ssid="10-10-37" dnum="j-o" numlevel="1" lineno="124" slineno="2-71" level="2"><display>(j)</display>within appropriations from the Legislature, provide or contract for a variety of <ln numlevel="1" lineno="125" slineno="2-72"/>domestic violence services and treatment methods;</subsection><subsection ssid="10-10-38" dnum="k-o" numlevel="1" lineno="126" slineno="2-73" level="2"><display>(k)</display>enter into contracts for programs designed to reduce the occurrence or recurrence of <ln numlevel="1" lineno="127" slineno="2-74"/>abuse and neglect in accordance with Section <xref depth="3" refnumber="80-2-503">80-2-503</xref>;</subsection><subsection ssid="10-10-39" dnum="l-o" numlevel="1" lineno="128" slineno="2-75" level="2"><display>(l)</display>seek reimbursement of funds the division expends on behalf of a child in the <ln numlevel="1" lineno="129" slineno="2-76"/>protective custody, temporary custody, or custody of the division, from the child's <ln numlevel="1" lineno="130" slineno="2-77"/>parent or guardian in accordance with an order for child support under Section <xref depth="3" refnumber="78A-6-356"><ln numlevel="1" lineno="131" slineno="2-78"/>78A-6-356</xref>;</subsection><subsection ssid="10-10-40" dnum="m-o" numlevel="1" lineno="132" slineno="2-79" level="2"><display>(m)</display>ensure regular, periodic publication, including electronic publication, regarding the <ln numlevel="1" lineno="133" slineno="2-80"/>number of children in the custody of the division who:<subsection ssid="10-10-41" dnum="i-o" numlevel="1" lineno="134" slineno="2-81" level="3"><display>(i)</display>have a permanency goal of adoption; or</subsection><subsection ssid="10-10-42" dnum="ii-o" numlevel="1" lineno="135" slineno="2-82" level="3"><display>(ii)</display>have a final plan of termination of parental rights, under Section <xref depth="3" refnumber="80-3-409">80-3-409</xref>, and <ln numlevel="1" lineno="136" slineno="2-83"/>promote adoption of the children;</subsection></subsection><subsection ssid="10-10-43" dnum="n-o" numlevel="1" lineno="137" slineno="2-84" level="2"><display>(n)</display>subject to Subsections (5) and (7), refer an individual receiving services from the <ln numlevel="1" lineno="138" slineno="2-85"/>division to the local substance abuse authority or other private or public resource for <ln numlevel="1" lineno="139" slineno="2-86"/>a court-ordered drug screening test;</subsection><subsection ssid="10-10-44" dnum="o-o" numlevel="1" lineno="140" slineno="2-87" level="2"><display>(o)</display>report before November 30, 2020, and every third year thereafter, to the Social <ln numlevel="1" lineno="141" slineno="2-88"/>Services Appropriations Subcommittee regarding:<subsection ssid="10-10-45" dnum="i-o" numlevel="1" lineno="142" slineno="2-89" level="3"><display>(i)</display>the daily reimbursement rate that is provided to licensed foster parents based on <ln numlevel="1" lineno="143" slineno="2-90"/>level of care;</subsection><subsection ssid="10-10-46" dnum="ii-o" numlevel="1" lineno="144" slineno="2-91" level="3"><display>(ii)</display>the amount of money spent on daily reimbursements for licensed foster parents<amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="ahaskell" level="1" amendtag="both"> <ln numlevel="1" lineno="145" slineno="2-92"/>and initial kinship caregiver payments</amend> during the previous fiscal year; and</subsection><subsection ssid="10-10-47" dnum="iii-o" numlevel="1" lineno="146" slineno="2-93" level="3"><display>(iii)</display>any recommended changes to the division's budget to support the daily <ln numlevel="1" lineno="147" slineno="2-94"/>reimbursement rates <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="ahaskell" level="1" amendtag="both">or the initial kinship caregiver payments </amend>described in <ln numlevel="1" lineno="148" slineno="2-95"/>Subsection (2)(o)(i); </subsection></subsection><subsection ssid="10-10-48" dnum="p-o" numlevel="1" lineno="149" slineno="2-96" level="2"><display>(p)</display>when a division child welfare caseworker identifies a safety concern with the foster <ln numlevel="1" lineno="150" slineno="2-97"/>home, cooperate with the Office of Licensing and make a recommendation to the <ln numlevel="1" lineno="151" slineno="2-98"/>Office of Licensing concerning whether the foster home's license should be placed on <ln numlevel="1" lineno="152" slineno="2-99"/>conditions, suspended, or revoked; and</subsection><subsection ssid="10-10-49" dnum="q-o" numlevel="1" lineno="153" slineno="2-100" level="2"><display>(q)</display>perform other duties and functions required by law.</subsection></subsection><subsection ssid="10-10-50" dnum="3-o" numlevel="1" lineno="154" slineno="2-101" level="1" space="false"><display>(3)</display><subsection ssid="10-10-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division may provide, directly or through contract, services that include the <ln numlevel="1" lineno="155" slineno="2-102"/>following:<subsection ssid="10-10-52" dnum="i-o" numlevel="1" lineno="156" slineno="2-103" level="3" tab="1"><display>(i)</display>adoptions;</subsection><subsection ssid="10-10-53" dnum="ii-o" numlevel="1" lineno="157" slineno="2-104" level="3" tab="1"><display>(ii)</display>day-care services;</subsection><subsection ssid="10-10-54" dnum="iii-o" numlevel="1" lineno="158" slineno="2-105" level="3" tab="1"><display>(iii)</display>out-of-home placements for minors;</subsection><subsection ssid="10-10-55" dnum="iv-o" numlevel="1" lineno="159" slineno="2-106" level="3" tab="1"><display>(iv)</display>health-related services;</subsection><subsection ssid="10-10-56" dnum="v-o" numlevel="1" lineno="160" slineno="2-107" level="3" tab="1"><display>(v)</display>homemaking services;</subsection><subsection ssid="10-10-57" dnum="vi-o" numlevel="1" lineno="161" slineno="2-108" level="3" tab="1"><display>(vi)</display>home management services;</subsection><subsection ssid="10-10-58" dnum="vii-o" numlevel="1" lineno="162" slineno="2-109" level="3" tab="1"><display>(vii)</display>protective services for minors;</subsection><subsection ssid="10-10-59" dnum="viii-o" numlevel="1" lineno="163" slineno="2-110" level="3" tab="1"><display>(viii)</display>transportation services; or</subsection><subsection ssid="10-10-60" dnum="ix-o" numlevel="1" lineno="164" slineno="2-111" level="3" tab="1"><display>(ix)</display>domestic violence services.</subsection></subsection><subsection ssid="10-10-61" dnum="b-o" numlevel="1" lineno="165" slineno="2-112" level="2"><display>(b)</display>The division shall monitor services provided directly by the division or through <ln numlevel="1" lineno="166" slineno="2-113"/>contract to ensure compliance with applicable law and rules made in accordance with <ln numlevel="1" lineno="167" slineno="2-114"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act.</subsection><subsection ssid="10-10-62" dnum="c-o" numlevel="1" lineno="168" slineno="2-115" level="2" space="false"><display>(c)</display><subsection ssid="10-10-63" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection (3)(c)(ii), if the division provides a service <ln numlevel="1" lineno="169" slineno="2-116"/>through a private contract, the division shall post the name of the service provider <ln numlevel="1" lineno="170" slineno="2-117"/>on the division's website.</subsection><subsection ssid="10-10-64" dnum="ii-o" numlevel="1" lineno="171" slineno="2-118" level="3"><display>(ii)</display>Subsection (3)(c)(i) does not apply to a foster parent placement.</subsection></subsection></subsection><subsection ssid="10-10-65" dnum="4-o" numlevel="1" lineno="172" slineno="2-119" level="1" space="false"><display>(4)</display><subsection ssid="10-10-66" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division may:<subsection ssid="10-10-67" dnum="i-o" numlevel="1" lineno="173" slineno="2-120" level="3" tab="1"><display>(i)</display>receive gifts, grants, devises, and donations;</subsection><subsection ssid="10-10-68" dnum="ii-o" numlevel="1" lineno="174" slineno="2-121" level="3" tab="1"><display>(ii)</display>encourage merchants and service providers to:<subsection ssid="10-10-69" dnum="A-o" numlevel="1" lineno="175" slineno="2-122" level="4"><display>(A)</display>donate goods or services; or</subsection><subsection ssid="10-10-70" dnum="B-o" numlevel="1" lineno="176" slineno="2-123" level="4"><display>(B)</display>provide goods or services at a nominal price or below cost;</subsection></subsection><subsection ssid="10-10-71" dnum="iii-o" numlevel="1" lineno="177" slineno="2-124" level="3" tab="1"><display>(iii)</display>distribute goods to applicants or consumers of division services free or for a <ln numlevel="1" lineno="178" slineno="2-125"/>nominal charge and tax free; and</subsection><subsection ssid="10-10-72" dnum="iv-o" numlevel="1" lineno="179" slineno="2-126" level="3" tab="1"><display>(iv)</display>appeal to the public for funds to meet needs of applicants or consumers of <ln numlevel="1" lineno="180" slineno="2-127"/>division services that are not otherwise provided by law, including Sub-for-Santa <ln numlevel="1" lineno="181" slineno="2-128"/>programs, recreational programs for minors, and requests for household <ln numlevel="1" lineno="182" slineno="2-129"/>appliances and home repairs.</subsection></subsection><subsection ssid="10-10-73" dnum="b-o" numlevel="1" lineno="183" slineno="2-130" level="2"><display>(b)</display>If requested by the donor and subject to state and federal law, the division shall use a <ln numlevel="1" lineno="184" slineno="2-131"/>gift, grant, devise, donation, or proceeds from the gift, grant, devise, or donation for <ln numlevel="1" lineno="185" slineno="2-132"/>the purpose requested by the donor.</subsection></subsection><subsection ssid="10-10-74" dnum="5-o" numlevel="1" lineno="186" slineno="2-133" level="1" space="false"><display>(5)</display><subsection ssid="10-10-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In carrying out the requirements of Subsection (2)(f), the division shall:<subsection ssid="10-10-76" dnum="i-o" numlevel="1" lineno="187" slineno="2-134" level="3" tab="1"><display>(i)</display>cooperate with the juvenile courts, the Division of Juvenile Justice and Youth <ln numlevel="1" lineno="188" slineno="2-135"/>Services, and with all public and private licensed child welfare agencies and <ln numlevel="1" lineno="189" slineno="2-136"/>institutions to develop and administer a broad range of services and support;</subsection><subsection ssid="10-10-77" dnum="ii-o" numlevel="1" lineno="190" slineno="2-137" level="3" tab="1"><display>(ii)</display>take the initiative in all matters involving the protection of abused or neglected <ln numlevel="1" lineno="191" slineno="2-138"/>children, if adequate provisions have not been made or are not likely to be made; <ln numlevel="1" lineno="192" slineno="2-139"/>and</subsection><subsection ssid="10-10-78" dnum="iii-o" numlevel="1" lineno="193" slineno="2-140" level="3" tab="1"><display>(iii)</display>make expenditures necessary for the care and protection of the children described <ln numlevel="1" lineno="194" slineno="2-141"/>in Subsection (5)(a)(ii), within the division's budget.</subsection></subsection><subsection ssid="10-10-79" dnum="b-o" numlevel="1" lineno="195" slineno="2-142" level="2"><display>(b)</display>If an individual is referred to a local substance abuse authority or other private or <ln numlevel="1" lineno="196" slineno="2-143"/>public resource for court-ordered drug screening under Subsection (2)(n), the court <ln numlevel="1" lineno="197" slineno="2-144"/>shall order the individual to pay all costs of the tests unless:<subsection ssid="10-10-80" dnum="i-o" numlevel="1" lineno="198" slineno="2-145" level="3"><display>(i)</display>the cost of the drug screening is specifically funded or provided for by other <ln numlevel="1" lineno="199" slineno="2-146"/>federal or state programs;</subsection><subsection ssid="10-10-81" dnum="ii-o" numlevel="1" lineno="200" slineno="2-147" level="3"><display>(ii)</display>the individual is a participant in a drug court; or</subsection><subsection ssid="10-10-82" dnum="iii-o" numlevel="1" lineno="201" slineno="2-148" level="3"><display>(iii)</display>the court finds that the individual is an indigent individual.</subsection></subsection></subsection><subsection ssid="10-10-83" dnum="6-o" numlevel="1" lineno="202" slineno="2-149" level="1"><display>(6)</display>Except to the extent provided by rules made in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="203" slineno="2-150"/>Utah Administrative Rulemaking Act, the division is not required to investigate <ln numlevel="1" lineno="204" slineno="2-151"/>domestic violence in the presence of a child, as described in Section <xref depth="3" refnumber="76-5-114">76-5-114</xref>.</subsection><subsection ssid="10-10-84" dnum="7-o" numlevel="1" lineno="205" slineno="2-152" level="1" space="false"><display>(7)</display><subsection ssid="10-10-85" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (7)(b), the division may not:<subsection ssid="10-10-86" dnum="i-o" numlevel="1" lineno="206" slineno="2-153" level="3" tab="1"><display>(i)</display>require a parent who has a child in the custody of the division to pay for some or <ln numlevel="1" lineno="207" slineno="2-154"/>all of the cost of any drug testing the parent is required to undergo; or</subsection><subsection ssid="10-10-87" dnum="ii-o" numlevel="1" lineno="208" slineno="2-155" level="3" tab="1"><display>(ii)</display>refer an individual who is receiving services from the division for drug testing by <ln numlevel="1" lineno="209" slineno="2-156"/>means of a hair, fingernail, or saliva test that is administered to detect the presence <ln numlevel="1" lineno="210" slineno="2-157"/>of drugs.</subsection></subsection><subsection ssid="10-10-88" dnum="b-o" numlevel="1" lineno="211" slineno="2-158" level="2"><display>(b)</display>Notwithstanding Subsection (7)(a)(ii), the division may refer an individual who is <ln numlevel="1" lineno="212" slineno="2-159"/>receiving services from the division for drug testing by means of a saliva test if:<subsection ssid="10-10-89" dnum="i-o" numlevel="1" lineno="213" slineno="2-160" level="3"><display>(i)</display>the individual consents to drug testing by means of a saliva test; or</subsection><subsection ssid="10-10-90" dnum="ii-o" numlevel="1" lineno="214" slineno="2-161" level="3"><display>(ii)</display>the court, based on a finding that a saliva test is necessary in the circumstances, <ln numlevel="1" lineno="215" slineno="2-162"/>orders the individual to complete drug testing by means of a saliva test.</subsection></subsection></subsection></section></bsec><bsec buid="19" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="216" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="216">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="217"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-7-25 11:55 AM</tm></rev></foot></leg>
