Transfer or discharge from an assisted living facility -- Sale of an <ln numlevel="1" lineno="32" slineno="1-3"/>assisted living facility -- Appointment of receiver.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="33" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="34" slineno="1-5" level="2"><display>(a)</display><amend anum="0" ea="amend" pairid="271" groupid="221" style="1" owner="ahaskell" level="1" amendtag="both">"Acquisition sale" means the sale of an assisted living facility:</amend><subsection ssid="1-74" dnum="_-o:i-i" numlevel="1" lineno="35" slineno="1-6" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="277" groupid="226" style="1" owner="ahaskell" level="1" amendtag="end">that is not expected to cause the transfer or discharge of a resident within 60 days <ln numlevel="1" lineno="36" slineno="1-7"/>after the date of the sale; and</amend></subsection><subsection ssid="1-75" dnum="_-o:ii-i" numlevel="1" lineno="37" slineno="1-8" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="285" groupid="232" style="1" owner="ahaskell" level="1" amendtag="end">where the buyer intends to continue operating the facility as an assisted living <ln numlevel="1" lineno="38" slineno="1-9"/>facility.</amend></subsection></subsection><subsection ssid="1-76" dnum="_-o:b-i" numlevel="1" lineno="39" slineno="1-10" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="289" groupid="235" style="1" owner="ahaskell" level="1" amendtag="end">"Change of use" means that the owner of an assisted living facility intends to change <ln numlevel="1" lineno="40" slineno="1-11"/>the use of the assisted living facility in a way that will require or result in the transfer <ln numlevel="1" lineno="41" slineno="1-12"/>or discharge of a resident.</amend></subsection><subsection ssid="1-71" dnum="_-o:c-i" numlevel="1" lineno="42" slineno="1-13" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="260" groupid="212" style="1" owner="ahaskell" level="1" amendtag="end">"Division" means the Division of Licensing and Background Checks.</amend></subsection><subsection ssid="1-35" dnum="_-o:d-i" numlevel="1" lineno="43" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both">(d)</amend></display>"Ombudsman" means the same as that term is defined in Section <xref depth="3" refnumber="26B-2-301" start="0">26B-2-301</xref>.</subsection><subsection ssid="1-36" dnum="_-o:e-i" numlevel="1" lineno="44" slineno="1-15" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">"Qualifying sale" means the sale of an assisted living facility:</amend><subsection ssid="1-72" dnum="_-o:i-i" numlevel="1" lineno="45" slineno="1-16" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="270" groupid="220" style="1" owner="ahaskell" level="1" amendtag="end">that is expected to cause the transfer or discharge of a resident within 60 days after <ln numlevel="1" lineno="46" slineno="1-17"/>the date of the sale; or</amend></subsection><subsection ssid="1-73" dnum="_-o:ii-i" numlevel="1" lineno="47" slineno="1-18" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="225" style="1" owner="ahaskell" level="1" amendtag="end">where the buyer intends to change the use of all or some of the facility to <ln numlevel="1" lineno="48" slineno="1-19"/>something other than an assisted living facility.</amend></subsection></subsection><subsection ssid="1-1-3" dnum="b-o:f-i" numlevel="1" lineno="49" slineno="1-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>"Resident" means an individual who receives health care from an assisted living <ln numlevel="1" lineno="50" slineno="1-21"/>facility.</subsection><subsection ssid="1-1-4" dnum="c-o:g-i" numlevel="1" lineno="51" slineno="1-22" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(g)</amend></display>"Responsible person" means an individual who:<subsection ssid="1-1-5" dnum="i-o" numlevel="1" lineno="52" slineno="1-23" level="3"><display>(i)</display>is designated in writing by a resident to receive communication on behalf of the <ln numlevel="1" lineno="53" slineno="1-24"/>resident; or</subsection><subsection ssid="1-1-6" dnum="ii-o" numlevel="1" lineno="54" slineno="1-25" level="3"><display>(ii)</display>is legally authorized to make health care decisions on behalf of the resident.</subsection></subsection><subsection ssid="1-40" dnum="_-o:h-i" numlevel="1" lineno="55" slineno="1-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="64" groupid="54" style="1" owner="ahaskell" level="1" amendtag="end">"Transition plan" means a plan for the closure, qualifying sale, or change of use of an <ln numlevel="1" lineno="56" slineno="1-27"/>assisted living facility that:</amend><subsection ssid="1-41" dnum="_-o:i-i" numlevel="1" lineno="57" slineno="1-28" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="170" groupid="140" style="1" owner="ahaskell" level="1" amendtag="end">describes the facility's resident population and the population's needs;</amend></subsection><subsection ssid="1-55" dnum="_-o:ii-i" numlevel="1" lineno="58" slineno="1-29" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="139" style="1" owner="ahaskell" level="1" amendtag="end">identifies available relocation options and resources, including a list of facilities <ln numlevel="1" lineno="59" slineno="1-30"/>within a 60-mile radius that may meet a resident's needs;</amend></subsection><subsection ssid="1-54" dnum="_-o:iii-i" numlevel="1" lineno="60" slineno="1-31" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="134" style="1" owner="ahaskell" level="1" amendtag="end">describes how the facility will accomplish the safe, orderly, and appropriate <ln numlevel="1" lineno="61" slineno="1-32"/>transfer or discharge of residents;</amend></subsection><subsection ssid="1-56" dnum="_-o:iv-i" numlevel="1" lineno="62" slineno="1-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="176" groupid="144" style="1" owner="ahaskell" level="1" amendtag="end">specifically addresses how the facility will address the transfer or discharge of <ln numlevel="1" lineno="63" slineno="1-34"/>each resident who may be difficult to relocate due to specialized care needs;</amend></subsection><subsection ssid="1-57" dnum="_-o:v-i" numlevel="1" lineno="64" slineno="1-35" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="181" groupid="148" style="1" owner="ahaskell" level="1" amendtag="end">identifies steps needed to share information and coordinate with managed care <ln numlevel="1" lineno="65" slineno="1-36"/>organizations;</amend></subsection><subsection ssid="1-42" dnum="_-o:vi-i" numlevel="1" lineno="66" slineno="1-37" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="63" style="1" owner="ahaskell" level="1" amendtag="end">includes timetables for all steps in the closure or sale process;</amend></subsection><subsection ssid="1-43" dnum="_-o:vii-i" numlevel="1" lineno="67" slineno="1-38" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="68" style="1" owner="ahaskell" level="1" amendtag="end">describes how the facility will maintain compliance with all applicable laws and <ln numlevel="1" lineno="68" slineno="1-39"/>regulations until the date of closure or sale; and</amend></subsection><subsection ssid="1-46" dnum="_-o:viii-i" numlevel="1" lineno="69" slineno="1-40" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="105" groupid="88" style="1" owner="ahaskell" level="1" amendtag="end">complies with any additional requirements that the department may impose by <ln numlevel="1" lineno="70" slineno="1-41"/>rule made in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="71" slineno="1-42"/>Rulemaking Act.</amend></subsection></subsection></subsection><subsection ssid="1-1-7" dnum="2-o" numlevel="1" lineno="72" slineno="1-43" level="1"><display>(2)</display>A facility is subject to the requirements in Subsection <xref depth="4" refnumber="26B-2-237(3)" start="0">(3)</xref> if the transfer or discharge:<subsection ssid="1-1-8" dnum="a-o" numlevel="1" lineno="73" slineno="1-44" level="2"><display>(a)</display>is initiated by the facility for any reason;</subsection><subsection ssid="1-1-9" dnum="b-o" numlevel="1" lineno="74" slineno="1-45" level="2"><display>(b)</display>is objected to by the resident or the resident's responsible person;</subsection><subsection ssid="1-1-10" dnum="c-o" numlevel="1" lineno="75" slineno="1-46" level="2"><display>(c)</display>was not initiated by a verbal or written request from the resident; or</subsection><subsection ssid="1-1-11" dnum="d-o" numlevel="1" lineno="76" slineno="1-47" level="2"><display>(d)</display>is inconsistent with the resident's preferences and stated goals for care.</subsection></subsection><subsection ssid="1-1-12" dnum="3-o" numlevel="1" lineno="77" slineno="1-48" level="1"><display>(3)</display>Before a transfer or discharge described in Subsection <xref depth="4" refnumber="26B-2-237(2)" start="0">(2)</xref> occurs, the assisted living <ln numlevel="1" lineno="78" slineno="1-49"/>facility from which the resident is transferred or discharged shall:<subsection ssid="1-1-13" dnum="a-o" numlevel="1" lineno="79" slineno="1-50" level="2"><display>(a)</display>notify the resident and the resident's responsible person, if any, in writing and in a <ln numlevel="1" lineno="80" slineno="1-51"/>language and a manner that is most likely to be understood by the resident and the <ln numlevel="1" lineno="81" slineno="1-52"/>resident's responsible person, of:<subsection ssid="1-1-14" dnum="i-o" numlevel="1" lineno="82" slineno="1-53" level="3"><display>(i)</display>the reasons for the transfer or discharge;</subsection><subsection ssid="1-1-15" dnum="ii-o" numlevel="1" lineno="83" slineno="1-54" level="3"><display>(ii)</display>the effective date of the transfer or discharge;</subsection><subsection ssid="1-1-16" dnum="iii-o" numlevel="1" lineno="84" slineno="1-55" level="3"><display>(iii)</display>the location to which the resident will be transferred or discharged, if known; and</subsection><subsection ssid="1-1-17" dnum="iv-o" numlevel="1" lineno="85" slineno="1-56" level="3"><display>(iv)</display>the name, address, email, and telephone number of the ombudsman;</subsection></subsection><subsection ssid="1-1-18" dnum="b-o" numlevel="1" lineno="86" slineno="1-57" level="2"><display>(b)</display>send a copy, in English, of the notice described in Subsection <xref depth="4" refnumber="26B-2-237(3)(a)" start="0">(3)(a)</xref> to the <ln numlevel="1" lineno="87" slineno="1-58"/>ombudsman on the same day on which the assisted living facility delivers the notice <ln numlevel="1" lineno="88" slineno="1-59"/>described in Subsection <xref depth="4" refnumber="26B-2-237(3)(a)" start="0">(3)(a)</xref> to the resident and the resident's responsible person;</subsection><subsection ssid="1-1-19" dnum="c-o" numlevel="1" lineno="89" slineno="1-60" level="2"><display>(c)</display>provide the notice described in Subsection <xref depth="4" refnumber="26B-2-237(3)(a)" start="0">(3)(a)</xref> at least 30 days before the day on <ln numlevel="1" lineno="90" slineno="1-61"/>which the resident is transferred or discharged, unless:<subsection ssid="1-1-20" dnum="i-o" numlevel="1" lineno="91" slineno="1-62" level="3"><display>(i)</display>notice for a shorter period of time is necessary to protect:<subsection ssid="1-1-21" dnum="A-o" numlevel="1" lineno="92" slineno="1-63" level="4"><display>(A)</display>the safety of individuals in the assisted living facility from endangerment due <ln numlevel="1" lineno="93" slineno="1-64"/>to the medical or behavioral status of the resident; or</subsection><subsection ssid="1-1-22" dnum="B-o" numlevel="1" lineno="94" slineno="1-65" level="4"><display>(B)</display>the health of individuals in the assisted living facility from endangerment due <ln numlevel="1" lineno="95" slineno="1-66"/>to the resident's continued residency;</subsection></subsection><subsection ssid="1-1-23" dnum="ii-o" numlevel="1" lineno="96" slineno="1-67" level="3"><display>(ii)</display>an immediate transfer or discharge is required by the resident's urgent medical <ln numlevel="1" lineno="97" slineno="1-68"/>needs; or</subsection><subsection ssid="1-1-24" dnum="iii-o" numlevel="1" lineno="98" slineno="1-69" level="3"><display>(iii)</display>the resident has not resided in the assisted living facility for at least 30 days;</subsection></subsection><subsection ssid="1-1-25" dnum="d-o" numlevel="1" lineno="99" slineno="1-70" level="2"><display>(d)</display>update the transfer or discharge notice as soon as practicable before the transfer or <ln numlevel="1" lineno="100" slineno="1-71"/>discharge if information in the notice changes before the transfer or discharge;</subsection><subsection ssid="1-1-26" dnum="e-o" numlevel="1" lineno="101" slineno="1-72" level="2"><display>(e)</display>orally explain to the resident:<subsection ssid="1-1-27" dnum="i-o" numlevel="1" lineno="102" slineno="1-73" level="3"><display>(i)</display>the services available through the ombudsman; and</subsection><subsection ssid="1-1-28" dnum="ii-o" numlevel="1" lineno="103" slineno="1-74" level="3"><display>(ii)</display>the contact information for the ombudsman; and</subsection></subsection><subsection ssid="1-1-29" dnum="f-o" numlevel="1" lineno="104" slineno="1-75" level="2"><display>(f)</display>provide and document the provision of preparation and orientation for the resident, in <ln numlevel="1" lineno="105" slineno="1-76"/>a language and manner the resident is most likely to understand, to ensure a safe and <ln numlevel="1" lineno="106" slineno="1-77"/>orderly transfer or discharge from the assisted living facility.</subsection></subsection><subsection ssid="1-1-30" dnum="4-o" numlevel="1" lineno="107" slineno="1-78" level="1" space="false"><display>(4)</display><subsection ssid="1-31" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>In the event of an assisted living facility closure<amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="ahaskell" level="1" amendtag="both">, qualifying sale</amend>,<amend anum="0" ea="amend" pairid="296" groupid="242" style="1" owner="ahaskell" level="1" amendtag="both"> or change of use,</amend> <amend anum="0" ea="amend" pairid="27" groupid="24" style="1" owner="ahaskell" level="1" amendtag="both"><ln numlevel="1" lineno="108" slineno="1-79"/>in addition to the requirements in Subsection (3):</amend><subsection ssid="1-37" dnum="_-o:i-i" numlevel="1" lineno="109" slineno="1-80" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="74" style="1" owner="ahaskell" level="1" amendtag="end">at least 120 days prior to the intended date of closure, qualifying sale, or change of <ln numlevel="1" lineno="110" slineno="1-81"/>use, the assisted living facility shall submit a proposed transition plan to the <ln numlevel="1" lineno="111" slineno="1-82"/>division for approval; and</amend></subsection><subsection ssid="1-44" dnum="_-o:ii-i" numlevel="1" lineno="112" slineno="1-83" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="76" style="1" owner="ahaskell" level="1" amendtag="end">at least 60 days before the day on which the assisted living facility intends to <ln numlevel="1" lineno="113" slineno="1-84"/>close, complete a qualifying sale, or undertake a change of use, </amend>the assisted living <ln numlevel="1" lineno="114" slineno="1-85"/>facility shall provide written notification of the closure<amend anum="0" ea="amend" pairid="297" groupid="243" style="1" owner="ahaskell" level="1" amendtag="both">,</amend> <amend anum="0" ea="amend" pairid="17" groupid="15" style="1" owner="ahaskell" level="1" amendtag="both">qualifying sale, or change <ln numlevel="1" lineno="115" slineno="1-86"/>of use, including a copy of the approved transition plan, </amend>to the ombudsman, <amend anum="0" ea="amend" pairid="18" groupid="16" style="1" owner="ahaskell" level="1" amendtag="both">the <ln numlevel="1" lineno="116" slineno="1-87"/>division, </amend>each resident of the facility, and each resident's responsible person.</subsection></subsection><subsection ssid="1-32" dnum="_-o:b-i" numlevel="1" lineno="117" slineno="1-88" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="51" style="1" owner="ahaskell" level="1" amendtag="end">An assisted living facility may not accept any new resident or application for <ln numlevel="1" lineno="118" slineno="1-89"/>residency on or after the date the assisted living facility first submits a proposed <ln numlevel="1" lineno="119" slineno="1-90"/>transition plan required by Subsection (4)(a)(i).</amend></subsection><subsection ssid="1-39" dnum="_-o:c-i" numlevel="1" lineno="120" slineno="1-91" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="112" groupid="94" style="1" owner="ahaskell" level="1" amendtag="end">An assisted living facility that provides a written notification required by Subsection <xref tempid="925" depth="4" refnumber="26B-2-237(4)(a)(ii)"><ln numlevel="1" lineno="121" slineno="1-92"/>(4)(a)(ii)</xref> shall:</amend><subsection ssid="1-47" dnum="_-o:i-i" numlevel="1" lineno="122" slineno="1-93" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">conduct meetings with residents and responsible persons to discuss the relocation <ln numlevel="1" lineno="123" slineno="1-94"/>process;</amend></subsection><subsection ssid="1-49" dnum="_-o:ii-i" numlevel="1" lineno="124" slineno="1-95" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="104" style="1" owner="ahaskell" level="1" amendtag="end">assist each resident with finding a new placement, taking into consideration the <ln numlevel="1" lineno="125" slineno="1-96"/>resident's needs, choices, and best interests;</amend></subsection><subsection ssid="1-48" dnum="_-o:iii-i" numlevel="1" lineno="126" slineno="1-97" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="136" groupid="114" style="1" owner="ahaskell" level="1" amendtag="end">invite assisted living facility operators from the surrounding area to visit and <ln numlevel="1" lineno="127" slineno="1-98"/>meet with residents of the assisted living facility that provided the notification <ln numlevel="1" lineno="128" slineno="1-99"/>under Subsection <xref tempid="405" depth="4" refnumber="26B-2-237(4)(a)(ii)">(4)(a)(ii)</xref>;</amend></subsection><subsection ssid="1-77" dnum="_-o:iv-i" numlevel="1" lineno="129" slineno="1-100" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="301" groupid="246" style="1" owner="ahaskell" level="1" amendtag="end">as of the date that a resident transfers or is discharged, provide the resident with a <ln numlevel="1" lineno="130" slineno="1-101"/>prorated refund of any funds the resident has prepaid to the facility, such as a <ln numlevel="1" lineno="131" slineno="1-102"/>reservation deposit, community fee, or rent; and</amend></subsection><subsection ssid="1-53" dnum="_-o:v-i" numlevel="1" lineno="132" slineno="1-103" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="189" groupid="155" style="1" owner="ahaskell" level="1" amendtag="end">provide a resident's new facility or care entity with complete and accurate resident <ln numlevel="1" lineno="133" slineno="1-104"/>records, including contact information for the resident's family members and <ln numlevel="1" lineno="134" slineno="1-105"/>responsible person.</amend></subsection></subsection><subsection ssid="1-58" dnum="_-o:d-i" numlevel="1" lineno="135" slineno="1-106" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="199" groupid="164" style="1" owner="ahaskell" level="1" amendtag="end">An assisted living facility may not close or undertake a change of use until all <ln numlevel="1" lineno="136" slineno="1-107"/>affected residents have been relocated to an appropriate alternative setting.</amend></subsection></subsection><subsection ssid="1-66" dnum="_-o:5-i" numlevel="1" lineno="137" slineno="1-108" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="239" groupid="195" style="1" owner="ahaskell" level="1" amendtag="end">In the event of an acquisition sale:</amend><subsection ssid="1-69" dnum="_-o:a-i" numlevel="1" lineno="138" slineno="1-109" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="312" groupid="256" style="1" owner="ahaskell" level="1" amendtag="end">the assisted living facility shall notify each resident and each resident's responsible <ln numlevel="1" lineno="139" slineno="1-110"/>person, if any, of the acquisition sale at least 30 days before the day of the acquisition <ln numlevel="1" lineno="140" slineno="1-111"/>sale; and</amend></subsection><subsection ssid="1-70" dnum="_-o:b-i" numlevel="1" lineno="141" slineno="1-112" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="259" groupid="211" style="1" owner="ahaskell" level="1" amendtag="end">for residents of the assisted living facility at the time of the acquisition sale, the <ln numlevel="1" lineno="142" slineno="1-113"/>purchaser of the assisted living facility may not raise the rates charged to those <ln numlevel="1" lineno="143" slineno="1-114"/>residents until at least 90 days after the day of the acquisition sale.</amend></subsection></subsection><subsection ssid="1-60" dnum="_-o:6-i" numlevel="1" lineno="144" slineno="1-115" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="1-61" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="175" style="1" owner="ahaskell" level="1" amendtag="end">A county attorney or the attorney general may bring a petition in a court with <ln numlevel="1" lineno="145" slineno="1-116"/>jurisdiction for the appointment of a receiver if an assisted living facility has not <ln numlevel="1" lineno="146" slineno="1-117"/>complied with the requirements of this section.</amend></subsection><subsection ssid="1-62" dnum="_-o:b-i" numlevel="1" lineno="147" slineno="1-118" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="218" groupid="180" style="1" owner="ahaskell" level="1" amendtag="end">A court shall issue an order to show cause why a receiver should not be appointed <ln numlevel="1" lineno="148" slineno="1-119"/>returnable within five days after the filing of the petition.</amend></subsection><subsection ssid="1-63" dnum="_-o:c-i" numlevel="1" lineno="149" slineno="1-120" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="225" groupid="184" style="1" owner="ahaskell" level="1" amendtag="end">If the court finds that the facts warrant the granting of the petition, the court shall <ln numlevel="1" lineno="150" slineno="1-121"/>appoint a receiver to take charge of the facility.</amend></subsection><subsection ssid="1-64" dnum="_-o:d-i" numlevel="1" lineno="151" slineno="1-122" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="230" groupid="188" style="1" owner="ahaskell" level="1" amendtag="end">The court may determine fair compensation for the receiver.</amend></subsection><subsection ssid="1-65" dnum="_-o:e-i" numlevel="1" lineno="152" slineno="1-123" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="235" groupid="192" style="1" owner="ahaskell" level="1" amendtag="end">A receiver appointed pursuant to this section has the powers and duties prescribed by <ln numlevel="1" lineno="153" slineno="1-124"/>the court.</amend></subsection></subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="154" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="154">Section 2.
