Director -- Appointment -- <ln numlevel="1" lineno="33" slineno="1-3"/>Authority.</bold></catline><subsection ssid="5-5-1" dnum="1-o" numlevel="1" lineno="34" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>The executive director shall appoint the director.  The director shall serve under the <ln numlevel="1" lineno="35" slineno="1-5"/>administrative direction of the executive director.</subsection><subsection ssid="5-5-2" dnum="2-o" numlevel="1" lineno="36" slineno="1-6" level="1"><display>(2)</display>The director shall:<subsection ssid="5-5-3" dnum="a-o" numlevel="1" lineno="37" slineno="1-7" level="2"><display>(a)</display>develop programs to promote and protect the quality of the public drinking water <ln numlevel="1" lineno="38" slineno="1-8"/>supplies of the state;</subsection><subsection ssid="5-5-4" dnum="b-o" numlevel="1" lineno="39" slineno="1-9" level="2"><display>(b)</display>advise, consult, and cooperate with other agencies of this and other states, the federal <ln numlevel="1" lineno="40" slineno="1-10"/>government, and with other groups, political subdivisions, and industries in <ln numlevel="1" lineno="41" slineno="1-11"/>furtherance of the purpose of this chapter;</subsection><subsection ssid="5-5-5" dnum="c-o" numlevel="1" lineno="42" slineno="1-12" level="2"><display>(c)</display>review plans, specifications, and other data pertinent to proposed or expanded water <ln numlevel="1" lineno="43" slineno="1-13"/>supply systems to ensure proper design and construction;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="24" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="5-24" dnum="_-o:d-i" numlevel="1" lineno="44" slineno="1-14" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">ensure that a community water system has a security plan that meets the <ln numlevel="1" lineno="45" slineno="1-15"/>requirements described in Subsection <xref refnumber="19-4-116(2)" depth="4">19-4-116(2)</xref>;</amend></subsection><subsection ssid="5-5-6" dnum="d-o:e-i" numlevel="1" lineno="46" slineno="1-16" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(e)</amend></display>subject to the provisions of this chapter, enforce rules made by the board <ln numlevel="1" lineno="47" slineno="1-17"/>through the issuance of orders that may be subsequently revoked, which orders may <ln numlevel="1" lineno="48" slineno="1-18"/>require:<subsection ssid="5-5-7" dnum="i-o" numlevel="1" lineno="49" slineno="1-19" level="3"><display>(i)</display>discontinuance of use of unsatisfactory sources of drinking water;</subsection><subsection ssid="5-5-8" dnum="ii-o" numlevel="1" lineno="50" slineno="1-20" level="3"><display>(ii)</display>suppliers to notify the public concerning the need to boil water; or</subsection><subsection ssid="5-5-9" dnum="iii-o" numlevel="1" lineno="51" slineno="1-21" level="3"><display>(iii)</display>suppliers in accordance with existing rules, to take remedial actions necessary to <ln numlevel="1" lineno="52" slineno="1-22"/>protect or improve an existing water system; and</subsection></subsection><subsection ssid="5-5-10" dnum="e-o:f-i" numlevel="1" lineno="53" slineno="1-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1010" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>as authorized by the board and subject to the provisions of this chapter, act as <ln numlevel="1" lineno="54" slineno="1-24"/>executive secretary of the board under the direction of the chair of the board.</subsection></subsection><subsection ssid="5-5-11" dnum="3-o" numlevel="1" lineno="55" slineno="1-25" level="1"><display>(3)</display>The director may authorize employees or agents of the department, after reasonable <ln numlevel="1" lineno="56" slineno="1-26"/>notice and presentation of credentials, to enter any part of a public water system at <ln numlevel="1" lineno="57" slineno="1-27"/>reasonable times to inspect the facilities and water quality records required by board <ln numlevel="1" lineno="58" slineno="1-28"/>rules, conduct sanitary surveys, take samples, and investigate the standard of operation <ln numlevel="1" lineno="59" slineno="1-29"/>and service delivered by public water systems.</subsection><subsection ssid="5-5-12" dnum="4-o" numlevel="1" lineno="60" slineno="1-30" level="1"><display>(4)</display>As provided in this chapter and in accordance with rules made by the board, the director <ln numlevel="1" lineno="61" slineno="1-31"/>may:<subsection ssid="5-5-13" dnum="a-o" numlevel="1" lineno="62" slineno="1-32" level="2"><display>(a)</display>issue and enforce a notice of violation and an administrative order; and</subsection><subsection ssid="5-5-14" dnum="b-o" numlevel="1" lineno="63" slineno="1-33" level="2"><display>(b)</display>assess and make a demand for payment of an administrative penalty arising from a <ln numlevel="1" lineno="64" slineno="1-34"/>violation of this chapter, a rule or order issued under the authority of this chapter, or <ln numlevel="1" lineno="65" slineno="1-35"/>the terms of a permit or other administrative authorization issued under the authority <ln numlevel="1" lineno="66" slineno="1-36"/>of this chapter.</subsection></subsection><subsection ssid="5-5-15" dnum="5-o:_-i" numlevel="1" lineno="67" slineno="1-37" ea="erase" anum="0" owner="ahaskell" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="start">(5)</amend></display><subsection ssid="5-5-16" dnum="a-o:_-i" ea="erase" anum="0" owner="ahaskell" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="10" style="2" owner="ahaskell" level="1" deltag="end">The director shall study how water providers, municipalities, counties, and state <ln numlevel="1" lineno="68" slineno="1-38"/>agencies may find greater efficiencies through improved coordination, consolidation, <ln numlevel="1" lineno="69" slineno="1-39"/>and regionalization related to:</amend><amendoutend style="2"/><subsection ssid="5-5-17" dnum="i-o:_-i" numlevel="1" lineno="70" slineno="1-40" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1017" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="11" style="2" owner="ahaskell" level="1" deltag="end">water use and conservation; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-5-18" dnum="ii-o:_-i" numlevel="1" lineno="71" slineno="1-41" ea="erase" anum="0" owner="ahaskell" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="21" groupid="12" style="2" owner="ahaskell" level="1" deltag="end">administrative and economic efficiencies.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-5-19" dnum="b-o:_-i" numlevel="1" lineno="72" slineno="1-42" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1019" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="22" groupid="13" style="2" owner="ahaskell" level="1" deltag="end">The study under this Subsection <xref depth="4" refnumber="19-4-106(5)" start="0">(5)</xref> shall consider recommendations including <ln numlevel="1" lineno="73" slineno="1-43"/>incentives, funding, regulatory changes, and statutory changes to promote greater <ln numlevel="1" lineno="74" slineno="1-44"/>coordination and efficiency and to help meet water infrastructure needs statewide.</amend><amendoutend style="2"/></subsection><subsection ssid="5-5-20" dnum="c-o:_-i" numlevel="1" lineno="75" slineno="1-45" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="25" groupid="16" style="2" owner="ahaskell" level="1" deltag="end">The director shall:</amend><amendoutend style="2"/><subsection ssid="5-5-21" dnum="i-o:_-i" numlevel="1" lineno="76" slineno="1-46" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="26" groupid="17" style="2" owner="ahaskell" level="1" deltag="end">conduct the study in conjunction with the Division of Water Resources; and</amend><amendoutend style="2"/></subsection><subsection ssid="5-5-22" dnum="ii-o:_-i" numlevel="1" lineno="77" slineno="1-47" ea="erase" anum="0" owner="ahaskell" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="27" groupid="18" style="2" owner="ahaskell" level="1" deltag="end">consult with a diverse group consisting of water providers, state agencies, local <ln numlevel="1" lineno="78" slineno="1-48"/>governments, and relevant stakeholders to help the director conduct the study and <ln numlevel="1" lineno="79" slineno="1-49"/>develop recommendations described in this Subsection <xref depth="4" refnumber="19-4-106(5)" start="0">(5)</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="5-5-23" dnum="d-o:_-i" numlevel="1" lineno="80" slineno="1-50" ea="erase" anum="0" owner="ahaskell" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="30" groupid="21" style="2" owner="ahaskell" level="1" deltag="end">On or before October 30, 2024, the director shall provide a written report of the <ln numlevel="1" lineno="81" slineno="1-51"/>study's findings, including any recommended legislative action, to the Natural <ln numlevel="1" lineno="82" slineno="1-52"/>Resources, Agriculture, and Environment Interim Committee.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="1" num="19-4-116" type="enact" src="code" uid="C19-4-S116_2025050720250507" sort="19 04 01160020250507" numlevel="1" lineno="83" slineno="2-1" sn="2"><section numlevel="1" lineno="84" slineno="2-2" number="19-4-116" type="enact"><secline lineno="83">Section 2, Section <bold>19-4-116</bold> is enacted to read:</secline><catline lineno="84"><bold>19-4-116 (Effective 05/07/25). Security plan for community water systems -- <ln numlevel="1" lineno="85" slineno="2-3"/>Requirements -- Report.</bold></catline><subsection ssid="1-1" dnum="_-o:1-i" numlevel="1" lineno="86" slineno="2-4" ea="amend" anum="0" owner="ahaskell" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="ahaskell" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-24" dnum="_-o:a-i" numlevel="1" lineno="87" slineno="2-5" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="146" groupid="101" style="1" owner="ahaskell" level="1" amendtag="end">"Authorized employee" means an employee of a community water system authorized <ln numlevel="1" lineno="88" slineno="2-6"/>to access:</amend><subsection ssid="1-26" dnum="_-o:i-i" numlevel="1" lineno="89" slineno="2-7" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="112" style="1" owner="ahaskell" level="1" amendtag="end">an operational technology;</amend></subsection><subsection ssid="1-46" dnum="_-o:ii-i" numlevel="1" lineno="90" slineno="2-8" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="289" groupid="197" style="1" owner="ahaskell" level="1" amendtag="end">a control system; or</amend></subsection><subsection ssid="1-27" dnum="_-o:iii-i" numlevel="1" lineno="91" slineno="2-9" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="165" groupid="116" style="1" owner="ahaskell" level="1" amendtag="end">a secure area.</amend></subsection></subsection><subsection ssid="1-17" dnum="_-o:b-i" numlevel="1" lineno="92" physical or electronic system that implements a <ln numlevel="1" lineno="93" slineno="2-11"/>procedure or process for water treatment or water delivery at a community water <ln numlevel="1" lineno="94" slineno="2-12"/>system.</amend></subsection><subsection ssid="1-61" dnum="_-o:ii-i" numlevel="1" lineno="95" slineno="2-13" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="347" groupid="235" style="1" owner="ahaskell" level="1" amendtag="end">"Control system" includes:</amend><subsection ssid="1-62" dnum="_-o:A-i" numlevel="1" lineno="96" slineno="2-14" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="354" groupid="240" style="1" owner="ahaskell" level="1" amendtag="end">a computer system that monitors or controls water treatment or water delivery <ln numlevel="1" lineno="97" slineno="2-15"/>equipment in real time, including a supervisory control and data acquisition <ln numlevel="1" lineno="98" slineno="2-16"/>system;</amend></subsection><subsection ssid="1-63" dnum="_-o:B-i" numlevel="1" lineno="99" slineno="2-17" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="359" groupid="244" style="1" owner="ahaskell" level="1" amendtag="end">a computer device that performs calculations or processes data related to water <ln numlevel="1" lineno="100" slineno="2-18"/>treatment or water delivery; and</amend></subsection><subsection ssid="1-64" dnum="_-o:C-i" numlevel="1" lineno="101" slineno="2-19" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="365" groupid="249" style="1" owner="ahaskell" level="1" amendtag="end">a network device or server that allows an authorized employee to remotely <ln numlevel="1" lineno="102" slineno="2-20"/>access a computer system or computer device that monitors or controls water <ln numlevel="1" lineno="103" slineno="2-21"/>treatment or water delivery.</amend></subsection></subsection></subsection><subsection ssid="1-75" dnum="_-o:c-i" numlevel="1" lineno="104" slineno="2-22" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="400" groupid="274" style="1" owner="ahaskell" level="1" amendtag="end">"Operational technology" means a hardware, software, or firmware component of a <ln numlevel="1" lineno="105" slineno="2-23"/>control system.</amend></subsection><subsection ssid="1-23" dnum="_-o:d-i" numlevel="1" lineno="106" slineno="2-24" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="143" groupid="99" style="1" owner="ahaskell" level="1" amendtag="end">"Secure area" means an area in a community water system that is not normally <ln numlevel="1" lineno="107" slineno="2-25"/>accessible by the public.</amend></subsection><subsection ssid="1-18" dnum="_-o:e-i" numlevel="1" lineno="108" slineno="2-26" ea="amend" anum="0" owner="ahaskell" style="1" level="2" groupid="77" style="1" owner="ahaskell" level="1" amendtag="end">"Security breach" means an incident that threatens the security of a community <ln numlevel="1" lineno="109" slineno="2-27"/>water system with the potential to impact the quality or quantity of delivered <ln numlevel="1" lineno="110" slineno="2-28"/>water.</amend></subsection><subsection ssid="1-20" dnum="_-o:ii-i" numlevel="1" lineno="111" slineno="2-29" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="131" groupid="91" style="1" owner="ahaskell" level="1" amendtag="end">"Security breach" includes:</amend><subsection ssid="1-29" dnum="_-o:A-i" numlevel="1" lineno="112" slineno="2-30" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="184" groupid="126" style="1" owner="ahaskell" level="1" amendtag="end">a breach of an operational technology or control system; or</amend></subsection><subsection ssid="1-33" dnum="_-o:B-i" numlevel="1" lineno="113" slineno="2-31" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="216" groupid="144" style="1" owner="ahaskell" level="1" amendtag="end">an unauthorized attempt to delete, disable, destroy, or override data, an <ln numlevel="1" lineno="114" slineno="2-32"/>application, a device, or a computer network.</amend></subsection></subsection></subsection></subsection><subsection ssid="1-3" dnum="_-o:2-i" numlevel="1" lineno="115" slineno="2-33" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><subsection ssid="1-5" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="18" style="1" owner="ahaskell" level="1" amendtag="end">By no later than December 31, 2025, and July 1 annually thereafter, a supplier of <ln numlevel="1" lineno="116" slineno="2-34"/>a community water system serving a population of 10,000 or greater shall complete a <ln numlevel="1" lineno="117" slineno="2-35"/>security plan.</amend></subsection><subsection ssid="1-52" dnum="_-o:b-i" numlevel="1" lineno="118" slineno="2-36" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="308" groupid="211" style="1" owner="ahaskell" level="1" amendtag="end">By no later than July 1, 2026, and annually thereafter, a supplier of a community <ln numlevel="1" lineno="119" slineno="2-37"/>water system serving a population less than 10,000 shall complete a security plan.</amend></subsection><subsection ssid="1-69" dnum="_-o:c-i" numlevel="1" lineno="120" slineno="2-38" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="375" groupid="257" style="1" owner="ahaskell" level="1" amendtag="end">A supplier of a community water system shall report to the division on or before July <ln numlevel="1" lineno="121" slineno="2-39"/>1 of each year whether the supplier has completed a security plan described in this <ln numlevel="1" lineno="122" slineno="2-40"/>Subsection <xref tempid="206" depth="4" refnumber="(2)">(2)</xref>.</amend></subsection><subsection ssid="1-6" dnum="_-o:d-i" numlevel="1" lineno="123" slineno="2-41" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="19" style="1" owner="ahaskell" level="1" amendtag="end">A security plan described in this Subsection <xref tempid="233" depth="4" refnumber="(2)">(2)</xref> shall include a requirement to:</amend><subsection ssid="1-7" dnum="_-o:i-i" numlevel="1" lineno="124" slineno="2-42" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="31" style="1" owner="ahaskell" level="1" amendtag="end">support and regularly update software used in a control system;</amend></subsection><subsection ssid="1-80" dnum="_-o:ii-i" numlevel="1" lineno="125" slineno="2-43" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="422" groupid="291" style="1" owner="ahaskell" level="1" amendtag="end">deploy and maintain network protection for a control system, as needed;</amend></subsection><subsection ssid="1-8" dnum="_-o:iii-i" numlevel="1" lineno="126" slineno="2-44" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="30" style="1" owner="ahaskell" level="1" amendtag="end">adopt best practices for secure authentication;</amend></subsection><subsection ssid="1-9" dnum="_-o:iv-i" numlevel="1" lineno="127" slineno="2-45" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">provide annual cybersecurity training to an employee who has regular access to <ln numlevel="1" lineno="128" slineno="2-46"/>an operational technology or control system;</amend></subsection><subsection ssid="1-54" dnum="_-o:v-i" numlevel="1" lineno="129" slineno="2-47" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="318" groupid="215" style="1" owner="ahaskell" level="1" amendtag="end">complete an internal assessment of the community water system's security <ln numlevel="1" lineno="130" slineno="2-48"/>vulnerabilities and implement corrective controls to address a security <ln numlevel="1" lineno="131" slineno="2-49"/>vulnerability;</amend></subsection><subsection ssid="1-11" dnum="_-o:vi-i" numlevel="1" lineno="132" slineno="2-50" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="47" style="1" owner="ahaskell" level="1" amendtag="end">promptly remove access to all operational technology and control systems from <ln numlevel="1" lineno="133" slineno="2-51"/>an employee whose employment is terminated;</amend></subsection><subsection ssid="1-12" dnum="_-o:vii-i" numlevel="1" lineno="134" slineno="2-52" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="59" style="1" owner="ahaskell" level="1" amendtag="end">prohibit an unauthorized copying of software and data;</amend></subsection><subsection ssid="1-14" dnum="_-o:viii-i" numlevel="1" lineno="135" slineno="2-53" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="61" style="1" owner="ahaskell" level="1" amendtag="end">ensure that an automated operational technology or control system can be <ln numlevel="1" lineno="136" slineno="2-54"/>operated manually, as needed;</amend></subsection><subsection ssid="1-66" dnum="_-o:ix-i" numlevel="1" lineno="137" slineno="2-55" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="start">(ix)</amend></display><amend anum="0" ea="amend" pairid="367" groupid="251" style="1" owner="ahaskell" level="1" amendtag="end">report a security breach in accordance with Subsection <xref tempid="748" depth="4" refnumber="(3)">(3)</xref>;</amend></subsection><subsection ssid="1-15" dnum="_-o:x-i" numlevel="1" lineno="138" slineno="2-56" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="i" level="1" amendtag="start">(x)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="67" style="1" owner="ahaskell" level="1" amendtag="end">adopt other security and records management requirements in conformity with <ln numlevel="1" lineno="139" slineno="2-57"/>federal requirements; and</amend></subsection><subsection ssid="1-53" dnum="_-o:xi-i" numlevel="1" lineno="140" slineno="2-58" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="i" level="1" amendtag="start">(xi)</amend></display><amend anum="0" ea="amend" pairid="311" groupid="213" style="1" owner="ahaskell" level="1" amendtag="end">comply with a security directive by the director.</amend></subsection></subsection><subsection ssid="1-55" dnum="_-o:e-i" numlevel="1" lineno="141" slineno="2-59" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="321" groupid="217" style="1" owner="ahaskell" level="1" amendtag="end">A supplier of a community water system shall make available for review to the <ln numlevel="1" lineno="142" slineno="2-60"/>director or the director's authorized representative, upon request:</amend><subsection ssid="1-56" dnum="_-o:i-i" numlevel="1" lineno="143" slineno="2-61" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="329" groupid="223" style="1" owner="ahaskell" level="1" amendtag="end">the supplier's security plan under this Subsection <xref tempid="497" depth="4" refnumber="(2)">(2)</xref>;</amend></subsection><subsection ssid="1-58" dnum="_-o:ii-i" numlevel="1" lineno="144" slineno="2-62" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="343" groupid="233" style="1" owner="ahaskell" level="1" amendtag="end">an incident report; and</amend></subsection><subsection ssid="1-59" dnum="_-o:iii-i" numlevel="1" lineno="145" slineno="2-63" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="342" groupid="232" style="1" owner="ahaskell" level="1" amendtag="end">any information related to a security plan as requested by the director.</amend></subsection></subsection><subsection ssid="1-77" dnum="_-o:f-i" numlevel="1" lineno="146" slineno="2-64" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="i" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="403" groupid="276" style="1" owner="ahaskell" level="1" amendtag="end">For resources not related to water treatment and delivery owned or managed by a <ln numlevel="1" lineno="147" slineno="2-65"/>supplier of a community water system, the supplier may:</amend><subsection ssid="1-78" dnum="_-o:i-i" numlevel="1" lineno="148" slineno="2-66" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="418" groupid="288" style="1" owner="ahaskell" level="1" amendtag="end">create a different security plan from the security plan described in this Subsection <xref tempid="469" depth="4" refnumber="(2)"><ln numlevel="1" lineno="149" slineno="2-67"/>(2)</xref>; or</amend></subsection><subsection ssid="1-79" dnum="_-o:ii-i" numlevel="1" lineno="150" slineno="2-68" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="421" groupid="290" style="1" owner="ahaskell" level="1" amendtag="end">incorporate the security plan developed under this Subsection <xref tempid="617" depth="4" refnumber="(2)">(2)</xref>, or any part <ln numlevel="1" lineno="151" slineno="2-69"/>thereof, into the security plan for the resource not related to water treatment and <ln numlevel="1" lineno="152" slineno="2-70"/>delivery.</amend></subsection></subsection></subsection><subsection ssid="1-16" dnum="_-o:3-i" numlevel="1" lineno="153" slineno="2-71" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><subsection ssid="1-72" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">A supplier of a community water system shall report a security breach no later <ln numlevel="1" lineno="154" slineno="2-72"/>than two hours after the supplier discovers the security breach to the Utah Cyber <ln numlevel="1" lineno="155" slineno="2-73"/>Center created in Section <xref depth="3" refnumber="63A-16-1102">63A-16-1102</xref>.</amend></subsection><subsection ssid="1-73" dnum="_-o:b-i" numlevel="1" lineno="156" slineno="2-74" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="393" groupid="269" style="1" owner="ahaskell" level="1" amendtag="end">The Utah Cyber Center shall notify the division of a reported security breach <ln numlevel="1" lineno="157" slineno="2-75"/>described in Subsection <xref tempid="567" depth="4" refnumber="(3)(a)">(3)(a)</xref> as soon as possible, but not later than one day after <ln numlevel="1" lineno="158" slineno="2-76"/>receiving the report from the supplier.</amend></subsection></subsection><subsection ssid="1-38" dnum="_-o:4-i" numlevel="1" lineno="159" slineno="2-77" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><subsection ssid="1-42" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="173" style="1" owner="ahaskell" level="1" amendtag="end">By no later than October 31 of each year, the division shall submit a report on <ln numlevel="1" lineno="160" slineno="2-78"/>security at community water systems in the state to:</amend><subsection ssid="1-40" dnum="_-o:i-i" numlevel="1" lineno="161" slineno="2-79" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="179" style="1" owner="ahaskell" level="1" amendtag="end">the Natural Resources, Agriculture, and Environment Interim Committee; and</amend></subsection><subsection ssid="1-41" dnum="_-o:ii-i" numlevel="1" lineno="162" slineno="2-80" ea="amend" anum="0" owner="ahaskell" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="263" groupid="178" style="1" owner="ahaskell" level="1" amendtag="end">the Public Utilities, Energy, and Technology Interim Committee.</amend></subsection></subsection><subsection ssid="1-43" dnum="_-o:b-i" numlevel="1" lineno="163" slineno="2-81" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="269" groupid="181" style="1" owner="ahaskell" level="1" amendtag="end">The report described in this Subsection <xref tempid="1088" depth="4" refnumber="(4)">(4)</xref> shall include:</amend><subsection ssid="1-44" dnum="_-o:i-i" numlevel="1" lineno="164" slineno="2-82" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="186" style="1" owner="ahaskell" level="1" amendtag="end">information collected by the division regarding security incidents and security <ln numlevel="1" lineno="165" slineno="2-83"/>plans at community water systems in the state; and</amend></subsection><subsection ssid="1-45" dnum="_-o:ii-i" numlevel="1" lineno="166" slineno="2-84" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="284" groupid="193" style="1" owner="ahaskell" level="1" amendtag="end">recommendations from the division, if any, for legislative action and funding to <ln numlevel="1" lineno="167" slineno="2-85"/>improve physical and electronic security at community water systems.</amend></subsection></subsection></subsection><subsection ssid="1-48" dnum="_-o:5-i" numlevel="1" lineno="168" slineno="2-86" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="293" groupid="200" style="1" owner="ahaskell" level="1" amendtag="end">The director shall provide information and technical resources to a community water <ln numlevel="1" lineno="169" slineno="2-87"/>system completing a security plan described in Subsection <xref tempid="707" depth="4" refnumber="(2)">(2)</xref>.</amend></subsection></section></bsec><bsec buid="8" num="63G-2-305" Protected records.</bold></catline><sectionText lineno="172"><tab/>The following records are protected if properly classified by a governmental entity:</sectionText><subsection ssid="8-8-1" dnum="1-o" numlevel="1" lineno="173" slineno="3-4" level="1"><display>(1)</display>trade secrets as defined in Section <xref depth="3" refnumber="13-24-2">13-24-2</xref> if the person submitting the trade secret has <ln numlevel="1" lineno="174" slineno="3-5"/>provided the governmental entity with the information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection><subsection ssid="8-8-2" dnum="2-o" numlevel="1" lineno="175" slineno="3-6" level="1"><display>(2)</display>commercial information or nonindividual financial information obtained from a person <ln numlevel="1" lineno="176" slineno="3-7"/>if:<subsection ssid="8-8-3" dnum="a-o" numlevel="1" lineno="177" slineno="3-8" level="2"><display>(a)</display>disclosure of the information could reasonably be expected to result in unfair <ln numlevel="1" lineno="178" slineno="3-9"/>competitive injury to the person submitting the information or would impair the <ln numlevel="1" lineno="179" slineno="3-10"/>ability of the governmental entity to obtain necessary information in the future;</subsection><subsection ssid="8-8-4" dnum="b-o" numlevel="1" lineno="180" slineno="3-11" level="2"><display>(b)</display>the person submitting the information has a greater interest in prohibiting access than <ln numlevel="1" lineno="181" slineno="3-12"/>the public in obtaining access; and</subsection><subsection ssid="8-8-5" dnum="c-o" numlevel="1" lineno="182" slineno="3-13" level="2"><display>(c)</display>the person submitting the information has provided the governmental entity with the <ln numlevel="1" lineno="183" slineno="3-14"/>information specified in Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>;</subsection></subsection><subsection ssid="8-8-6" dnum="3-o" numlevel="1" lineno="184" slineno="3-15" level="1"><display>(3)</display>commercial or financial numlevel="1" lineno="190" slineno="3-21"/>entity as defined in Subsection <xref depth="3" refnumber="11-13-103">11-13-103</xref>(4);</subsection><subsection ssid="8-8-8" dnum="5-o" numlevel="1" lineno="191" slineno="3-22" level="1"><display>(5)</display>test questions and answers to be used in future license, certification, registration, <ln numlevel="1" lineno="192" slineno="3-23"/>employment, or academic examinations;</subsection><subsection ssid="8-8-9" dnum="6-o" numlevel="1" lineno="193" slineno="3-24" level="1"><display>(6)</display>records, the disclosure of which would impair governmental procurement proceedings <ln numlevel="1" lineno="194" slineno="3-25"/>or give an unfair advantage to any person proposing to enter into a contract or agreement <ln numlevel="1" lineno="195" slineno="3-26"/>with a governmental entity, except, subject to Subsections (1) and (2), that this <ln numlevel="1" lineno="196" slineno="3-27"/>Subsection (6) does not restrict the right of a person to have access to, after the contract <ln numlevel="1" lineno="197" slineno="3-28"/>or grant has been awarded and signed by all parties:<subsection ssid="8-8-10" dnum="a-o" numlevel="1" lineno="198" slineno="3-29" level="2"><display>(a)</display>a bid, proposal, application, or other information submitted to or by a governmental <ln numlevel="1" lineno="199" slineno="3-30"/>entity in response to:<subsection ssid="8-8-11" dnum="i-o" numlevel="1" lineno="200" slineno="3-31" level="3"><display>(i)</display>an invitation for bids;</subsection><subsection ssid="8-8-12" dnum="ii-o" numlevel="1" lineno="201" slineno="3-32" level="3"><display>(ii)</display>a request for proposals;</subsection><subsection ssid="8-8-13" dnum="iii-o" numlevel="1" lineno="202" slineno="3-33" level="3"><display>(iii)</display>a request for quotes;</subsection><subsection ssid="8-8-14" dnum="iv-o" numlevel="1" lineno="203" slineno="3-34" level="3"><display>(iv)</display>a grant; or</subsection><subsection ssid="8-8-15" dnum="v-o" numlevel="1" lineno="204" slineno="3-35" level="3"><display>(v)</display>other similar document; or</subsection></subsection><subsection ssid="8-8-16" dnum="b-o" numlevel="1" lineno="205" slineno="3-36" level="2"><display>(b)</display>an unsolicited proposal, as defined in Section <xref depth="3" refnumber="63G-6a-712">63G-6a-712</xref>;</subsection></subsection><subsection ssid="8-8-17" dnum="7-o" numlevel="1" lineno="206" slineno="3-37" level="1"><display>(7)</display>information submitted to or by a governmental entity in response to a request for <ln numlevel="1" lineno="207" slineno="3-38"/>information, except, subject to Subsections (1) and (2), that this Subsection (7) does not <ln numlevel="1" lineno="208" slineno="3-39"/>restrict the right of a person to have access to the information, after:<subsection ssid="8-8-18" dnum="a-o" numlevel="1" lineno="209" slineno="3-40" level="2"><display>(a)</display>a contract directly relating to the subject of the request for information has been <ln numlevel="1" lineno="210" slineno="3-41"/>awarded and signed by all parties; or</subsection><subsection ssid="8-8-19" dnum="b-o" numlevel="1" lineno="211" slineno="3-42" level="2" space="false"><display>(b)</display><subsection ssid="8-8-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a final determination is made not to enter into a contract that relates to the <ln numlevel="1" lineno="212" slineno="3-43"/>subject of the request for information; and</subsection><subsection ssid="8-8-21" dnum="ii-o" numlevel="1" lineno="213" slineno="3-44" level="3"><display>(ii)</display>at least two years have passed after the day on which the request for information <ln numlevel="1" lineno="214" slineno="3-45"/>is issued;</subsection></subsection></subsection><subsection ssid="8-8-22" dnum="8-o" numlevel="1" lineno="215" slineno="3-46" level="1"><display>(8)</display>records that would identify real property or the appraisal or estimated value of real or <ln numlevel="1" lineno="216" slineno="3-47"/>personal property, including intellectual property, under consideration for public <ln numlevel="1" lineno="217" slineno="3-48"/>acquisition before any rights to the property are acquired unless:<subsection ssid="8-8-23" dnum="a-o" numlevel="1" lineno="218" slineno="3-49" level="2"><display>(a)</display>public interest in obtaining access to the information is greater than or equal to the <ln numlevel="1" lineno="219" slineno="3-50"/>governmental entity's need to acquire the property on the best terms possible;</subsection><subsection ssid="8-8-24" dnum="b-o" numlevel="1" lineno="220" slineno="3-51" level="2"><display>(b)</display>the information has already been disclosed to persons not employed by or under a <ln numlevel="1" lineno="221" slineno="3-52"/>duty of confidentiality to the entity;</subsection><subsection ssid="8-8-25" dnum="c-o" numlevel="1" lineno="222" slineno="3-53" level="2"><display>(c)</display>in the case of records that would identify property, potential sellers of the described <ln numlevel="1" lineno="223" slineno="3-54"/>property have already learned of the governmental entity's plans to acquire the <ln numlevel="1" lineno="224" slineno="3-55"/>property;</subsection><subsection ssid="8-8-26" dnum="d-o" numlevel="1" lineno="225" slineno="3-56" level="2"><display>(d)</display>in the case of records that would identify the appraisal or estimated value of <ln numlevel="1" lineno="226" slineno="3-57"/>property, the potential sellers have already learned of the governmental entity's <ln numlevel="1" lineno="227" slineno="3-58"/>estimated value of the property; or</subsection><subsection ssid="8-8-27" dnum="e-o" numlevel="1" lineno="228" slineno="3-59" level="2"><display>(e)</display>the property under consideration for public acquisition is a single family residence <ln numlevel="1" lineno="229" slineno="3-60"/>and the governmental entity seeking to acquire the property has initiated negotiations <ln numlevel="1" lineno="230" slineno="3-61"/>to acquire the property as required under Section <xref depth="3" refnumber="78B-6-505">78B-6-505</xref>;</subsection></subsection><subsection ssid="8-8-28" dnum="9-o" numlevel="1" lineno="231" slineno="3-62" level="1"><display>(9)</display>records prepared in contemplation of sale, exchange, lease, rental, or other compensated <ln numlevel="1" lineno="232" slineno="3-63"/>transaction of real or personal property including intellectual property, which, if <ln numlevel="1" lineno="233" slineno="3-64"/>disclosed prior to completion of the transaction, would reveal the appraisal or estimated <ln numlevel="1" lineno="234" slineno="3-65"/>value of the subject property, unless:<subsection ssid="8-8-29" dnum="a-o" numlevel="1" lineno="235" slineno="3-66" level="2"><display>(a)</display>the public interest in access is greater than or equal to the interests in restricting <ln numlevel="1" lineno="236" slineno="3-67"/>access, including the governmental entity's interest in maximizing the financial <ln numlevel="1" lineno="237" slineno="3-68"/>benefit of the transaction; or</subsection><subsection ssid="8-8-30" dnum="b-o" numlevel="1" lineno="238" slineno="3-69" level="2"><display>(b)</display>when prepared by or on behalf of a governmental entity, appraisals or estimates of <ln numlevel="1" lineno="239" slineno="3-70"/>the value of the subject property have already been disclosed to persons not <ln numlevel="1" lineno="240" slineno="3-71"/>employed by or under a duty of confidentiality to the entity;</subsection></subsection><subsection ssid="8-8-31" dnum="10-o" numlevel="1" lineno="241" slineno="3-72" level="1"><display>(10)</display>records created or maintained for civil, criminal, or administrative enforcement <ln numlevel="1" lineno="242" slineno="3-73"/>purposes or audit purposes, or for discipline, licensing, certification, or registration <ln numlevel="1" lineno="243" slineno="3-74"/>purposes, if release of the records:<subsection ssid="8-8-32" dnum="a-o" numlevel="1" lineno="244" slineno="3-75" level="2"><display>(a)</display>reasonably could be expected to interfere with investigations undertaken for <ln numlevel="1" lineno="245" slineno="3-76"/>enforcement, discipline, licensing, certification, or registration purposes;</subsection><subsection ssid="8-8-33" dnum="b-o" numlevel="1" lineno="246" slineno="3-77" level="2"><display>(b)</display>reasonably could be expected to interfere with audits, disciplinary, or enforcement <ln numlevel="1" lineno="247" slineno="3-78"/>proceedings;</subsection><subsection ssid="8-8-34" dnum="c-o" numlevel="1" lineno="248" slineno="3-79" level="2"><display>(c)</display>would create a danger of depriving a person of a right to a fair trial or impartial <ln numlevel="1" lineno="249" slineno="3-80"/>hearing;</subsection><subsection ssid="8-8-35" dnum="d-o" numlevel="1" lineno="250" slineno="3-81" level="2"><display>(d)</display>reasonably could be expected to disclose the identity of a source who is not generally <ln numlevel="1" lineno="251" slineno="3-82"/>known outside of government and, in the case of a record compiled in the course of <ln numlevel="1" lineno="252" slineno="3-83"/>an investigation, disclose information furnished by a source not generally known <ln numlevel="1" lineno="253" slineno="3-84"/>outside of government if disclosure would compromise the source; or</subsection><subsection ssid="8-8-36" dnum="e-o" numlevel="1" lineno="254" slineno="3-85" level="2"><display>(e)</display>reasonably could be expected to disclose investigative or audit techniques, <ln numlevel="1" lineno="255" slineno="3-86"/>procedures, policies, or orders not generally known outside of government if <ln numlevel="1" lineno="256" slineno="3-87"/>disclosure would interfere with enforcement or audit efforts;</subsection></subsection><subsection ssid="8-8-37" dnum="11-o" numlevel="1" lineno="257" slineno="3-88" level="1"><display>(11)</display>records the disclosure of which would jeopardize the life or safety of an individual;</subsection><subsection ssid="8-8-38" dnum="12-o" numlevel="1" lineno="258" slineno="3-89" level="1"><display>(12)</display>records the disclosure of which would jeopardize the security of governmental <ln numlevel="1" lineno="259" slineno="3-90"/>property, governmental programs, or governmental recordkeeping systems from <ln numlevel="1" lineno="260" slineno="3-91"/>damage, theft, or other appropriation or use contrary to law or public policy;</subsection><subsection ssid="8-8-39" dnum="13-o" numlevel="1" lineno="261" slineno="3-92" level="1"><display>(13)</display>records that, if disclosed, would jeopardize the security or safety of a correctional <ln numlevel="1" lineno="262" slineno="3-93"/>facility, or records relating to incarceration, treatment, probation, or parole, that would <ln numlevel="1" lineno="263" slineno="3-94"/>interfere with the control and supervision of an offender's incarceration, treatment, <ln numlevel="1" lineno="264" slineno="3-95"/>probation, or parole;</subsection><subsection ssid="8-8-40" dnum="14-o" numlevel="1" lineno="265" slineno="3-96" level="1"><display>(14)</display>records that, if disclosed, would reveal recommendations made to the Board of <ln numlevel="1" lineno="266" slineno="3-97"/>Pardons and Parole by an employee of or contractor for the Department of Corrections, <ln numlevel="1" lineno="267" slineno="3-98"/>the Board of Pardons and Parole, or the Department of Health and Human Services that <ln numlevel="1" lineno="268" slineno="3-99"/>are based on the employee's or contractor's supervision, diagnosis, or treatment of any <ln numlevel="1" lineno="269" slineno="3-100"/>person within the board's jurisdiction;</subsection><subsection ssid="8-8-41" dnum="15-o" numlevel="1" lineno="270" slineno="3-101" level="1"><display>(15)</display>records and audit workpapers that identify audit, collection, and operational procedures <ln numlevel="1" lineno="271" slineno="3-102"/>and methods used by the State Tax Commission, if disclosure would interfere with <ln numlevel="1" lineno="272" slineno="3-103"/>audits or collections;</subsection><subsection ssid="8-8-42" dnum="16-o" numlevel="1" lineno="273" slineno="3-104" level="1"><display>(16)</display>records of a governmental audit agency relating to an ongoing or planned audit until <ln numlevel="1" lineno="274" slineno="3-105"/>the final audit is released;</subsection><subsection ssid="8-8-43" dnum="17-o" numlevel="1" lineno="275" slineno="3-106" level="1"><display>(17)</display>records that are subject to the attorney client privilege;</subsection><subsection ssid="8-8-44" dnum="18-o" numlevel="1" lineno="276" slineno="3-107" level="1"><display>(18)</display>records prepared for or by an attorney, consultant, surety, indemnitor, insurer, <ln numlevel="1" lineno="277" slineno="3-108"/>employee, or agent of a governmental entity for, or in anticipation of, litigation or a <ln numlevel="1" lineno="278" slineno="3-109"/>judicial, quasi-judicial, or administrative proceeding;</subsection><subsection ssid="8-8-45" dnum="19-o" numlevel="1" lineno="279" slineno="3-110" level="1" space="false"><display>(19)</display><subsection ssid="8-8-46" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="8-8-47" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>personal files of a state legislator, including personal correspondence to or <ln numlevel="1" lineno="280" slineno="3-111"/>from a member of the Legislature; and</subsection><subsection ssid="8-8-48" dnum="ii-o" numlevel="1" lineno="281" slineno="3-112" level="3" tab="1"><display>(ii)</display>notwithstanding Subsection (19)(a)(i), correspondence that gives notice of <ln numlevel="1" lineno="282" slineno="3-113"/>legislative action or policy may not be classified as protected under this section; <ln numlevel="1" lineno="283" slineno="3-114"/>and</subsection></subsection><subsection ssid="8-8-49" dnum="b-o" numlevel="1" lineno="284" slineno="3-115" level="2" space="false"><display>(b)</display><subsection ssid="8-8-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>an internal communication that is part of the deliberative process in connection <ln numlevel="1" lineno="285" slineno="3-116"/>with the preparation of legislation between:<subsection ssid="8-8-51" dnum="A-o" numlevel="1" lineno="286" slineno="3-117" level="4" tab="1"><display>(A)</display>members of a legislative body;</subsection><subsection ssid="8-8-52" dnum="B-o" numlevel="1" lineno="287" slineno="3-118" level="4" tab="1"><display>(B)</display>a member of a legislative body and a member of the legislative body's staff; or</subsection><subsection ssid="8-8-53" dnum="C-o" numlevel="1" lineno="288" slineno="3-119" level="4" tab="1"><display>(C)</display>members of a legislative body's staff; and</subsection></subsection><subsection ssid="8-8-54" dnum="ii-o" numlevel="1" lineno="289" slineno="3-120" level="3"><display>(ii)</display>notwithstanding Subsection (19)(b)(i), a communication that gives notice of <ln numlevel="1" lineno="290" slineno="3-121"/>legislative action or policy may not be classified as protected under this section;</subsection></subsection></subsection><subsection ssid="8-8-55" dnum="20-o" numlevel="1" lineno="291" slineno="3-122" level="1" space="false"><display>(20)</display><subsection ssid="8-8-56" dnum="a-o" level="2" placement="sameline"><display>(a)</display>records in the custody or control of the Office of Legislative Research and <ln numlevel="1" lineno="292" slineno="3-123"/>General Counsel, that, if disclosed, would reveal a particular legislator's <ln numlevel="1" lineno="293" slineno="3-124"/>contemplated legislation or contemplated course of action before the legislator has <ln numlevel="1" lineno="294" slineno="3-125"/>elected to support the legislation or course of action, or made the legislation or course <ln numlevel="1" lineno="295" slineno="3-126"/>of action public; and</subsection><subsection ssid="8-8-57" dnum="b-o" numlevel="1" lineno="296" slineno="3-127" level="2"><display>(b)</display>notwithstanding Subsection (20)(a), the form to request legislation submitted to the <ln numlevel="1" lineno="297" slineno="3-128"/>Office of Legislative Research and General Counsel is a public document unless a <ln numlevel="1" lineno="298" slineno="3-129"/>legislator asks that the records requesting the legislation be maintained as protected <ln numlevel="1" lineno="299" slineno="3-130"/>records until such time as the legislator elects to make the legislation or course of <ln numlevel="1" lineno="300" slineno="3-131"/>action public;</subsection></subsection><subsection ssid="8-8-58" dnum="21-o" numlevel="1" lineno="301" slineno="3-132" level="1"><display>(21)</display>a research request from a legislator to a legislative staff member and research findings <ln numlevel="1" lineno="302" slineno="3-133"/>prepared in response to the request;</subsection><subsection ssid="8-8-59" dnum="22-o" numlevel="1" lineno="303" slineno="3-134" level="1"><display>(22)</display>drafts, unless otherwise classified as public;</subsection><subsection ssid="8-8-60" dnum="23-o" numlevel="1" lineno="304" slineno="3-135" level="1"><display>(23)</display>records concerning a governmental entity's strategy about:<subsection ssid="8-8-61" dnum="a-o" numlevel="1" lineno="305" slineno="3-136" level="2"><display>(a)</display>collective bargaining; or</subsection><subsection ssid="8-8-62" dnum="b-o" numlevel="1" lineno="306" slineno="3-137" level="2"><display>(b)</display>imminent or pending litigation;</subsection></subsection><subsection ssid="8-8-63" dnum="24-o" numlevel="1" lineno="307" slineno="3-138" level="1"><display>(24)</display>records of investigations of loss occurrences and analyses of loss occurrences that may <ln numlevel="1" lineno="308" slineno="3-139"/>be covered by the Risk Management Fund, the Employers' Reinsurance Fund, the <ln numlevel="1" lineno="309" slineno="3-140"/>Uninsured Employers' Fund, or similar divisions in other governmental entities;</subsection><subsection ssid="8-8-64" dnum="25-o" numlevel="1" lineno="310" slineno="3-141" level="1"><display>(25)</display>records, other than personnel evaluations, that contain a personal recommendation <ln numlevel="1" lineno="311" slineno="3-142"/>concerning an individual if disclosure would constitute a clearly unwarranted invasion <ln numlevel="1" lineno="312" slineno="3-143"/>of personal privacy, or disclosure is not in the public interest;</subsection><subsection ssid="8-8-65" dnum="26-o" numlevel="1" lineno="313" slineno="3-144" level="1"><display>(26)</display>records that reveal the location of historic, prehistoric, paleontological, or biological <ln numlevel="1" lineno="314" slineno="3-145"/>resources that if known would jeopardize the security of those resources or of valuable <ln numlevel="1" lineno="315" slineno="3-146"/>historic, scientific, educational, or cultural information;</subsection><subsection ssid="8-8-66" dnum="27-o" numlevel="1" lineno="316" slineno="3-147" level="1"><display>(27)</display>records of independent state agencies if the disclosure of the records would conflict <ln numlevel="1" lineno="317" slineno="3-148"/>with the fiduciary obligations of the agency;</subsection><subsection ssid="8-8-67" dnum="28-o" numlevel="1" lineno="318" slineno="3-149" level="1"><display>(28)</display>records of an institution within the state system of higher education defined in Section <xref depth="3" refnumber="53B-1-102"><ln numlevel="1" lineno="319" slineno="3-150"/>53B-1-102</xref> regarding tenure evaluations, appointments, applications for admissions, <ln numlevel="1" lineno="320" slineno="3-151"/>retention decisions, and promotions, which could be properly discussed in a meeting <ln numlevel="1" lineno="321" slineno="3-152"/>closed in accordance with Title 52, Chapter 4, Open and Public Meetings Act, provided <ln numlevel="1" lineno="322" slineno="3-153"/>that records of the final decisions about tenure, appointments, retention, promotions, or <ln numlevel="1" lineno="323" slineno="3-154"/>those students admitted, may not be classified as protected under this section;</subsection><subsection ssid="8-8-68" dnum="29-o" numlevel="1" lineno="324" slineno="3-155" level="1"><display>(29)</display>records of the governor's office, including budget recommendations, legislative <ln numlevel="1" lineno="325" slineno="3-156"/>proposals, and policy statements, that if disclosed would reveal the governor's <ln numlevel="1" lineno="326" slineno="3-157"/>contemplated policies or contemplated courses of action before the governor has <ln numlevel="1" lineno="327" slineno="3-158"/>implemented or rejected those policies or courses of action or made them public;</subsection><subsection ssid="8-8-69" dnum="30-o" numlevel="1" lineno="328" slineno="3-159" level="1"><display>(30)</display>records of the Office of the Legislative Fiscal Analyst relating to budget analysis, <ln numlevel="1" lineno="329" slineno="3-160"/>revenue estimates, and fiscal notes of proposed legislation before issuance of the final <ln numlevel="1" lineno="330" slineno="3-161"/>recommendations in these areas;</subsection><subsection ssid="8-8-70" dnum="31-o" numlevel="1" lineno="331" slineno="3-162" level="1"><display>(31)</display>records provided by the United States or by a government entity outside the state that <ln numlevel="1" lineno="332" slineno="3-163"/>are given to the governmental entity with a requirement that they be managed as <ln numlevel="1" lineno="333" slineno="3-164"/>protected records if the providing entity certifies that the record would not be subject to <ln numlevel="1" lineno="334" slineno="3-165"/>public disclosure if retained by it;</subsection><subsection ssid="8-8-71" dnum="32-o" numlevel="1" lineno="335" slineno="3-166" level="1"><display>(32)</display>transcripts, minutes, recordings, or reports of the closed portion of a meeting of a <ln numlevel="1" lineno="336" slineno="3-167"/>public body except as provided in Section <xref depth="3" refnumber="52-4-206">52-4-206</xref>;</subsection><subsection ssid="8-8-72" dnum="33-o" numlevel="1" lineno="337" slineno="3-168" level="1"><display>(33)</display>records that would reveal the contents of settlement negotiations but not including final <ln numlevel="1" lineno="338" slineno="3-169"/>settlements or empirical data to the extent that they are not otherwise exempt from <ln numlevel="1" lineno="339" slineno="3-170"/>disclosure;</subsection><subsection ssid="8-8-73" dnum="34-o" numlevel="1" lineno="340" slineno="3-171" level="1"><display>(34)</display>memoranda prepared by staff and used in the decision-making process by an <ln numlevel="1" lineno="341" slineno="3-172"/>administrative law judge, a member of the Board of Pardons and Parole, or a member of <ln numlevel="1" lineno="342" slineno="3-173"/>any other body charged by law with performing a quasi-judicial function;</subsection><subsection ssid="8-8-74" dnum="35-o" numlevel="1" lineno="343" slineno="3-174" level="1"><display>(35)</display>records that would reveal negotiations regarding assistance or incentives offered by or <ln numlevel="1" lineno="344" slineno="3-175"/>requested from a governmental entity for the purpose of encouraging a person to expand <ln numlevel="1" lineno="345" slineno="3-176"/>or locate a business in Utah, but only if disclosure would result in actual economic harm <ln numlevel="1" lineno="346" slineno="3-177"/>to the person or place the governmental entity at a competitive disadvantage, but this <ln numlevel="1" lineno="347" slineno="3-178"/>section may not be used to restrict access to a record evidencing a final contract;</subsection><subsection ssid="8-8-75" dnum="36-o" numlevel="1" lineno="348" slineno="3-179" level="1"><display>(36)</display>materials to which access must be limited for purposes of securing or maintaining the <ln numlevel="1" lineno="349" slineno="3-180"/>governmental entity's proprietary protection of intellectual property rights including <ln numlevel="1" lineno="350" slineno="3-181"/>patents, copyrights, and trade secrets;</subsection><subsection ssid="8-8-76" dnum="37-o" numlevel="1" lineno="351" slineno="3-182" level="1"><display>(37)</display>the name of a donor or a prospective donor to a governmental entity, including an <ln numlevel="1" lineno="352" slineno="3-183"/>institution within the state system of higher education defined in Section <xref depth="3" refnumber="53B-1-102">53B-1-102</xref>, and <ln numlevel="1" lineno="353" slineno="3-184"/>other information concerning the donation that could reasonably be expected to reveal <ln numlevel="1" lineno="354" slineno="3-185"/>the identity of the donor, provided that:<subsection ssid="8-8-77" dnum="a-o" numlevel="1" lineno="355" slineno="3-186" level="2"><display>(a)</display>the donor requests anonymity in writing;</subsection><subsection ssid="8-8-78" dnum="b-o" numlevel="1" lineno="356" slineno="3-187" level="2"><display>(b)</display>any terms, conditions, restrictions, or privileges relating to the donation may not be <ln numlevel="1" lineno="357" slineno="3-188"/>classified protected by the governmental entity under this Subsection (37); and</subsection><subsection ssid="8-8-79" dnum="c-o" numlevel="1" lineno="358" slineno="3-189" level="2"><display>(c)</display>except for an institution within the state system of higher education defined in <ln numlevel="1" lineno="359" slineno="3-190"/>Section <xref depth="3" level="1"><display>(38)</display>accident reports, except as provided in Sections <xref depth="3" refnumber="41-6a-404">41-6a-404</xref>, <xref depth="3" refnumber="41-12a-202">41-12a-202</xref>, and refnumber="26B-2-709">26B-2-709</xref>:<subsection ssid="8-8-115" dnum="a-o" numlevel="1" lineno="422" slineno="3-253" level="2"><display>(a)</display>information or records held by the Department of Health and Human Services related <ln numlevel="1" lineno="423" slineno="3-254"/>to a complaint regarding a provider, program, or facility which the department is <ln numlevel="1" lineno="424" slineno="3-255"/>unable to substantiate; and</subsection><subsection ssid="8-8-116" dnum="b-o" numlevel="1" lineno="425" slineno="3-256" level="2"><display>(b)</display>information or records related to a complaint received by the Department of Health <ln numlevel="1" lineno="426" slineno="3-257"/>and Human Services from an anonymous complainant regarding a provider, program, <ln numlevel="1" lineno="427" slineno="3-258"/>or facility;</subsection></subsection><subsection ssid="8-8-117" dnum="51-o" numlevel="1" lineno="428" slineno="3-259" level="1"><display>(51)</display>unless otherwise classified as public under Section <xref depth="3" refnumber="63G-2-301">63G-2-301</xref> and except as provided <ln numlevel="1" lineno="429" slineno="3-260"/>under Section <xref depth="3" refnumber="41-1a-116">41-1a-116</xref>, an individual's home address, home telephone number, or <ln numlevel="1" lineno="430" slineno="3-261"/>personal mobile phone number, if:<subsection ssid="8-8-118" dnum="a-o" numlevel="1" lineno="431" slineno="3-262" level="2"><display>(a)</display>the individual is required to provide the information in order to comply with a law, <ln numlevel="1" lineno="432" slineno="3-263"/>ordinance, rule, or order of a government entity; and</subsection><subsection ssid="8-8-119" dnum="b-o" numlevel="1" lineno="433" slineno="3-264" system of higher education, as defined in Section <xref depth="3" refnumber="53B-1-102"><ln numlevel="1" lineno="448" slineno="3-279"/>53B-1-102</xref>; and</subsection><subsection ssid="8-8-128" dnum="b-o" numlevel="1" lineno="449" slineno="3-280" level="2"><display>(b)</display>conducted using animals;</subsection></subsection><subsection ssid="8-8-129" dnum="54-o" numlevel="1" lineno="450" depth="3" refnumber="73-10-33">73-10-33</xref>:<subsection ssid="8-8-134" dnum="a-o" numlevel="1" lineno="463" slineno="3-294" level="2"><display>(a)</display>a management plan for a water conveyance facility in the possession of the Division <ln numlevel="1" lineno="464" slineno="3-295"/>of Water Resources or the Board of Water Resources; or</subsection><subsection ssid="8-8-135" dnum="b-o" numlevel="1" lineno="465" slineno="3-296" level="2"><display>(b)</display>an outline of an emergency response plan in possession of the state or a county or <ln numlevel="1" lineno="466" slineno="3-297"/>municipality;</subsection></subsection><subsection ssid="8-8-136" dnum="59-o" numlevel="1" lineno="467" slineno="3-298" level="1"><display>(59)</display>the following records in the custody or control of the Office of Inspector General of <ln numlevel="1" lineno="468" slineno="3-299"/>Medicaid Services, created in Section <xref depth="3" relating to allegations of personal <ln numlevel="1" lineno="470" slineno="3-301"/>misconduct, gross mismanagement, or illegal activity of a person if the information <ln numlevel="1" lineno="471" slineno="3-302"/>or allegation cannot be corroborated by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="472" slineno="3-303"/>Services through other documents or evidence, and the records relating to the <ln numlevel="1" lineno="473" slineno="3-304"/>allegation are not relied upon by the Office of Inspector General of Medicaid <ln numlevel="1" lineno="474" slineno="3-312"/>protected;</subsection><subsection ssid="8-8-139" dnum="c-o" numlevel="1" lineno="482" slineno="3-313" level="2"><display>(c)</display>before the time that an investigation or audit is completed and the final investigation <ln numlevel="1" lineno="483" slineno="3-314"/>or final audit report is released, records or drafts circulated to a person who is not an <ln numlevel="1" lineno="484" slineno="3-315"/>employee or head of a governmental entity for the person's response or information;</subsection><subsection ssid="8-8-140" dnum="d-o" numlevel="1" lineno="485" slineno="3-316" level="2"><display>(d)</display>records that would disclose an outline or part of any investigation, audit survey plan, <ln numlevel="1" lineno="486" slineno="3-317"/>or audit program; or</subsection><subsection ssid="8-8-141" dnum="e-o" numlevel="1" lineno="487" slineno="3-318" level="2"><display>(e)</display>requests for an investigation or audit, if disclosure would risk circumvention of an <ln numlevel="1" lineno="488" slineno="3-319"/>investigation or audit;</subsection></subsection><subsection ssid="8-8-142" dnum="60-o" numlevel="1" lineno="489" slineno="3-320" inside a hospital or health care facility <ln numlevel="1" lineno="500" slineno="3-331"/>as those terms are defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, inside a clinic of a health care provider, <ln numlevel="1" lineno="501" slineno="3-332"/>as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>, or inside a human service program as that <ln numlevel="1" lineno="502" slineno="3-333"/>term is defined in Section <xref depth="3" refnumber="26B-2-101">26B-2-101</xref>, except for recordings that:<subsection ssid="8-8-147" dnum="a-o" numlevel="1" lineno="503" slineno="3-334" level="2"><display>(a)</display>depict the commission of an alleged crime;</subsection><subsection ssid="8-8-148" dnum="b-o" numlevel="1" lineno="504" slineno="3-335" level="2"><display>(b)</display>record any encounter between a law enforcement officer and a person that results in <ln numlevel="1" lineno="505" slineno="3-336"/>death or bodily injury, or includes an instance when an officer fires a weapon;</subsection><subsection ssid="8-8-149" dnum="c-o" numlevel="1" lineno="506" slineno="3-337" level="2"><display>(c)</display>record any encounter that is the subject of a complaint or a legal proceeding against a <ln numlevel="1" lineno="507" slineno="3-338"/>law enforcement officer or law enforcement agency;</subsection><subsection ssid="8-8-150" dnum="d-o" numlevel="1" lineno="508" slineno="3-339" level="2"><display>(d)</display>contain an officer involved critical incident as defined in Subsection <xref depth="3" refnumber="76-2-408">76-2-408</xref>(1)(f); <ln numlevel="1" lineno="509" slineno="3-340"/>or</subsection><subsection ssid="8-8-151" dnum="e-o" numlevel="1" lineno="510" slineno="3-341" level="2"><display>(e)</display>have been requested for reclassification as a public record by a subject or authorized <ln numlevel="1" lineno="511" slineno="3-342"/>agent of a subject featured in the recording;</subsection></subsection><subsection ssid="8-8-152" dnum="65-o" numlevel="1" lineno="512" slineno="3-343" level="1"><display>(65)</display>a record pertaining to the search process for a president of an institution of higher <ln numlevel="1" lineno="513" slineno="3-344"/>education described in Section <xref depth="3" refnumber="53B-2-102">53B-2-102</xref>, except for application materials for a publicly <ln numlevel="1" lineno="514" slineno="3-345"/>announced finalist;</subsection><subsection ssid="8-8-153" dnum="66-o" numlevel="1" lineno="515" slineno="3-346" level="1"><display>(66)</display>an audio recording that is:<subsection ssid="8-8-154" dnum="a-o" numlevel="1" lineno="516" slineno="3-347" level="2"><display>(a)</display>produced by an audio recording device that is used in conjunction with a device or <ln numlevel="1" lineno="517" slineno="3-348"/>piece of equipment designed or intended for resuscitating an individual or for treating <ln numlevel="1" lineno="518" slineno="3-349"/>an individual with a life-threatening condition;</subsection><subsection ssid="8-8-155" dnum="b-o" numlevel="1" lineno="519" slineno="3-350" level="2"><display>(b)</display>produced during an emergency event when an individual employed to provide law <ln numlevel="1" lineno="520" slineno="3-351"/>enforcement, fire protection, paramedic, emergency medical, or other first responder <ln numlevel="1" lineno="521" slineno="3-352"/>service:<subsection ssid="8-8-156" dnum="i-o" numlevel="1" lineno="522" slineno="3-353" level="3"><display>(i)</display>is responding to an individual needing resuscitation or with a life-threatening <ln numlevel="1" lineno="523" slineno="3-354"/>condition; and</subsection><subsection ssid="8-8-157" dnum="ii-o" numlevel="1" lineno="524" slineno="3-355" level="3"><display>(ii)</display>uses a device or piece of equipment designed or intended for resuscitating an <ln numlevel="1" lineno="525" slineno="3-356"/>individual or for treating an individual with a life-threatening condition; and</subsection></subsection><subsection ssid="8-8-158" dnum="c-o" numlevel="1" lineno="526" slineno="3-357" level="2"><display>(c)</display>intended and used for purposes of training emergency responders how to improve <ln numlevel="1" lineno="527" slineno="3-358"/>their response to an emergency situation;</subsection></subsection><subsection ssid="8-8-159" dnum="67-o" numlevel="1" lineno="528" slineno="3-359" level="1"><display>(67)</display>records submitted by or prepared in relation to an applicant seeking a recommendation <ln numlevel="1" lineno="529" slineno="3-360"/>by the Research and General Counsel Subcommittee, the Budget Subcommittee, or the <ln numlevel="1" lineno="530" slineno="3-361"/>Audit Subcommittee, established under Section <xref depth="3" refnumber="36-12-8">36-12-8</xref>, for an employment position <ln numlevel="1" lineno="531" extent disclosure is <ln numlevel="1" lineno="559" slineno="3-390"/>prohibited under Section <xref depth="3" refnumber="63G-26-103">63G-26-103</xref>;</subsection><subsection ssid="8-8-177" dnum="80-o" numlevel="1" lineno="560" slineno="3-391" level="1"><display>(80)</display>an image taken of an individual during the process of booking the individual into jail, <ln numlevel="1" lineno="561" slineno="3-392"/>unless:<subsection ssid="8-8-178" dnum="a-o" numlevel="1" lineno="562" slineno="3-393" level="2"><display>(a)</display>the individual is convicted of a criminal offense based upon the conduct for which <ln numlevel="1" lineno="563" slineno="3-394"/>the individual was incarcerated at the time the image was taken;</subsection><subsection ssid="8-8-179" dnum="b-o" numlevel="1" lineno="564" slineno="3-395" level="2"><display>(b)</display>a law enforcement agency releases or disseminates the image:<subsection ssid="8-8-180" dnum="i-o" numlevel="1" lineno="565" slineno="3-396" level="3"><display>(i)</display>after determining that  the individual is a fugitive or an imminent threat to an <ln numlevel="1" lineno="566" slineno="3-397"/>individual or to public safety and releasing or disseminating the image will assist <ln numlevel="1" lineno="567" slineno="3-398"/>in apprehending the individual or reducing or eliminating the threat; or</subsection><subsection ssid="8-8-181" dnum="ii-o" numlevel="1" lineno="568" slineno="3-399" level="3"><display>(ii)</display>to a potential witness or other individual with direct knowledge of events relevant <ln numlevel="1" lineno="569" slineno="3-400"/>to a criminal investigation or criminal proceeding for the purpose of identifying or <ln numlevel="1" lineno="570" slineno="3-401"/>locating an individual in connection with the criminal investigation or criminal <ln numlevel="1" lineno="571" slineno="3-402"/>proceeding;</subsection></subsection><subsection ssid="8-8-182" dnum="c-o" numlevel="1" lineno="572" slineno="3-403" level="2"><display>(c)</display>a judge orders the release or dissemination of the image based on a finding that the <ln numlevel="1" lineno="573" slineno="3-404"/>release or dissemination is in furtherance of a legitimate law enforcement interest; or</subsection><subsection ssid="8-8-183" dnum="d-o" numlevel="1" lineno="574" slineno="3-405" level="2"><display>(d)</display>the image is displayed to a person who is permitted to view the image under Section <xref depth="3" refnumber="17-22-30"><ln numlevel="1" lineno="575" slineno="3-406"/>17-22-30</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection></subsection><subsection ssid="8-8-184" dnum="81-o" numlevel="1" lineno="576" slineno="3-407" level="1"><display>(81)</display>a record:<subsection ssid="8-8-185" dnum="a-o" numlevel="1" lineno="577" slineno="3-408" level="2"><display>(a)</display>concerning an interstate claim to the use of waters in the Colorado River system;</subsection><subsection ssid="8-8-186" dnum="b-o" numlevel="1" lineno="578" slineno="3-409" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="579" slineno="3-410"/>representative from another state or the federal government as provided in Section <xref depth="3" refnumber="63M-14-205"><ln numlevel="1" lineno="580" slineno="3-411"/>63M-14-205</xref>; and</subsection><subsection ssid="8-8-187" dnum="c-o" numlevel="1" lineno="581" slineno="3-412" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="8-8-188" dnum="i-o" numlevel="1" lineno="582" slineno="3-413" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="583" slineno="3-414"/>Colorado River system;</subsection><subsection ssid="8-8-189" dnum="ii-o" numlevel="1" lineno="584" slineno="3-415" level="3"><display>(ii)</display>harm the ability of the Colorado River Authority of Utah or river commissioner to <ln numlevel="1" lineno="585" slineno="3-416"/>negotiate the best terms and conditions regarding the use of water in the Colorado <ln numlevel="1" lineno="586" slineno="3-417"/>River system; or</subsection><subsection ssid="8-8-190" dnum="iii-o" numlevel="1" lineno="587" slineno="3-418" level="3"><display>(iii)</display>give an advantage to another state or to the federal government in negotiations <ln numlevel="1" lineno="588" slineno="3-419"/>regarding the use of water in the Colorado River system;</subsection></subsection></subsection><subsection ssid="8-8-191" dnum="82-o" numlevel="1" lineno="589" slineno="3-420" level="1"><display>(82)</display>any part of an application described in Section <xref depth="3" refnumber="63N-16-201">63N-16-201</xref> that the Governor's Office <ln numlevel="1" lineno="590" slineno="3-421"/>of Economic Opportunity determines is nonpublic, confidential information that if <ln numlevel="1" lineno="591" slineno="3-422"/>disclosed would result in actual economic harm to the applicant, but this Subsection (82) <ln numlevel="1" lineno="592" slineno="3-423"/>may not be used to restrict access to a record evidencing a final contract or approval <ln numlevel="1" lineno="593" slineno="3-424"/>decision;</subsection><subsection ssid="8-8-192" dnum="83-o" numlevel="1" lineno="594" slineno="3-425" level="1"><display>(83)</display>the following records of a drinking water or wastewater facility:<subsection ssid="8-8-193" dnum="a-o" numlevel="1" lineno="595" slineno="3-426" level="2"><display>(a)</display>an engineering or architectural drawing of the drinking water or wastewater facility;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="ahaskell" level="1" deltag="both"> <ln numlevel="1" lineno="596" slineno="3-427"/>and</amend><amendoutend style="2"/></subsection><subsection ssid="8-8-194" dnum="b-o" numlevel="1" lineno="597" slineno="3-428" level="2"><display>(b)</display>except as provided in Section <xref depth="3" refnumber="63G-2-106">63G-2-106</xref>, a record detailing tools or processes the <ln numlevel="1" lineno="598" slineno="3-429"/>drinking water or wastewater facility uses to secure, or prohibit access to, the records <ln numlevel="1" lineno="599" slineno="3-430"/>described in Subsection (83)(a);<amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both"> and</amend></subsection><subsection ssid="8-214" dnum="_-o:c-i" numlevel="1" lineno="600" slineno="3-431" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1270" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">any record related to a security plan or incident report described in Section <xref depth="3" refnumber="19-4-116">19-4-116</xref>;</amend></subsection></subsection><subsection ssid="8-8-195" dnum="84-o" numlevel="1" lineno="601" slineno="3-432" level="1"><display>(84)</display>a statement that an employee of a governmental entity provides to the governmental <ln numlevel="1" lineno="602" slineno="3-433"/>entity as part of the governmental entity's personnel or administrative investigation into <ln numlevel="1" lineno="603" slineno="3-434"/>potential misconduct involving the employee if the governmental entity:<subsection ssid="8-8-196" dnum="a-o" numlevel="1" lineno="604" slineno="3-435" level="2"><display>(a)</display>requires the statement under threat of employment disciplinary action, including <ln numlevel="1" lineno="605" slineno="3-436"/>possible termination of employment, for the employee's refusal to provide the <ln numlevel="1" lineno="606" slineno="3-437"/>statement; and</subsection><subsection ssid="8-8-197" dnum="b-o" numlevel="1" lineno="607" slineno="3-438" level="2"><display>(b)</display>provides the employee assurance that the statement cannot be used against the <ln numlevel="1" lineno="608" slineno="3-439"/>employee in any criminal proceeding;</subsection></subsection><subsection ssid="8-8-198" dnum="85-o" numlevel="1" lineno="609" slineno="3-440" level="1"><display>(85)</display>any part of an application for a Utah Fits All Scholarship account described in Section <xref depth="3" refnumber="53F-6-402"><ln numlevel="1" lineno="610" slineno="3-441"/>53F-6-402</xref> or other information identifying a scholarship student as defined in Section <xref depth="3" refnumber="53F-6-401"><ln numlevel="1" lineno="611" slineno="3-442"/>53F-6-401</xref>; </subsection><subsection ssid="8-8-199" dnum="86-o" numlevel="1" lineno="612" slineno="3-443" level="1"><display>(86)</display>a record:<subsection ssid="8-8-200" dnum="a-o" numlevel="1" lineno="613" slineno="3-444" level="2"><display>(a)</display>concerning a claim to the use of waters in the Great Salt Lake;</subsection><subsection ssid="8-8-201" dnum="b-o" numlevel="1" lineno="614" slineno="3-445" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="615" slineno="3-446"/>person concerning the claim, including a representative from another state or the <ln numlevel="1" lineno="616" slineno="3-447"/>federal government; and</subsection><subsection ssid="8-8-202" dnum="c-o" numlevel="1" lineno="617" slineno="3-448" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="8-8-203" dnum="i-o" numlevel="1" lineno="618" slineno="3-449" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water in the <ln numlevel="1" lineno="619" slineno="3-450"/>Great Salt Lake;</subsection><subsection ssid="8-8-204" dnum="ii-o" numlevel="1" lineno="620" slineno="3-451" level="3"><display>(ii)</display>harm the ability of the Great Salt Lake commissioner to negotiate the best terms <ln numlevel="1" lineno="621" slineno="3-452"/>and conditions regarding the use of water in the Great Salt Lake; or</subsection><subsection ssid="8-8-205" dnum="iii-o" numlevel="1" lineno="622" slineno="3-453" level="3"><display>(iii)</display>give an advantage to another person including another state or to the federal <ln numlevel="1" lineno="623" slineno="3-454"/>government in negotiations regarding the use of water in the Great Salt Lake;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="8-8-206" dnum="87-o" numlevel="1" lineno="624" slineno="3-455" level="1"><display>(87)</display>a consumer complaint described in Section <xref depth="3" refnumber="13-2-11">13-2-11</xref>, unless the consumer complaint is <ln numlevel="1" lineno="625" slineno="3-456"/>reclassified as public as described in Subsection <xref depth="3" refnumber="13-2-11">13-2-11</xref>(4)<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="12" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="8-8-207" dnum="88-o" numlevel="1" lineno="626" slineno="3-457" level="1"><display>(88)</display>a record of the Utah water agent, appointed under Section <xref depth="3" refnumber="73-10g-702">73-10g-702</xref>:<subsection ssid="8-8-208" dnum="a-o" numlevel="1" lineno="627" slineno="3-458" level="2"><display>(a)</display>concerning a claim to the use of waters;</subsection><subsection ssid="8-8-209" dnum="b-o" numlevel="1" lineno="628" slineno="3-459" level="2"><display>(b)</display>relating to a judicial proceeding, administrative proceeding, or negotiation with a <ln numlevel="1" lineno="629" slineno="3-460"/>representative from another state, a tribe, the federal government, or other <ln numlevel="1" lineno="630" slineno="3-461"/>government entity as provided in Title 73, Chapter 10g, Part 6, Utah Water Agent; <ln numlevel="1" lineno="631" slineno="3-462"/>and</subsection><subsection ssid="8-8-210" dnum="c-o" numlevel="1" lineno="632" slineno="3-463" level="2"><display>(c)</display>the disclosure of which would:<subsection ssid="8-8-211" dnum="i-o" numlevel="1" lineno="633" slineno="3-464" level="3"><display>(i)</display>reveal a legal strategy relating to the state's claim to the use of the water;</subsection><subsection ssid="8-8-212" dnum="ii-o" numlevel="1" lineno="634" slineno="3-465" level="3"><display>(ii)</display>harm
