</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill modifies provisions of the Government Records Access and Management Act.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that the government records ombudsman shall provide resources and services <ln numlevel="1" lineno="9" slineno="0-9"/>related to a fee dispute in relation to a records request;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">modifies provisions regulating costs chargeable by a governmental entity for employee <ln numlevel="1" lineno="11" slineno="0-11"/>time in processing a records request under the Government Records Access and <ln numlevel="1" lineno="12" slineno="0-12"/>Management Act;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">adds provisions to regulate the disclosure of records and fee information regarding <ln numlevel="1" lineno="14" slineno="0-14"/>work-related contact information for an employee of a local education agency;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">requires a governmental entity to provide an itemized estimate of costs and fees expected <ln numlevel="1" lineno="16" slineno="0-16"/>to be incurred before the governmental entity begins to process a request or requires <ln numlevel="1" lineno="17" slineno="0-17"/>payment or deposit when fees are expected to exceed a certain amount;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">modifies provisions of the Government Records Access and Management Act to make an <ln numlevel="1" lineno="19" slineno="0-19"/>appeal to a chief administrative officer an optional process for appealing an estimate of <ln numlevel="1" lineno="20" slineno="0-20"/>fees that exceeds a certain amount;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">provides that a State Records Committee review of an agency access denial, fee waiver <ln numlevel="1" lineno="22" slineno="0-22"/>denial, or fee estimate dispute is de novo;</hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">requires a political subdivision to permit an optional appeal of an estimate of fees that <ln numlevel="1" lineno="24" slineno="0-24"/>exceeds a certain amount directly to the State Records Committee;</hl><hl numlevel="1" lineno="25" slineno="0-25" level="1">modifies existing procedures; and</hl><hl numlevel="1" lineno="26" slineno="0-26" level="1">makes conforming changes and style corrections.</hl></hp><moni numlevel="1" lineno="27" slineno="0-27" display="none">Money num="63A-12-111" type="amend" src="code" uid="C63A-12-S111_2025050720250507" sort="63A12 01110020250507" numlevel="1" lineno="44" slineno="1-1" sn="1"><section number="63A-12-111" numlevel="1" lineno="45" slineno="1-2" type="amend"><secline lineno="44">Section 1, Section <bold>63A-12-111</bold> is amended to read:</secline><catline lineno="45"><bold>63A-12-111. Government records ombudsman.</bold></catline><subsection ssid="29-null-1" dnum="1-o" numlevel="1" lineno="46" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="29-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The director of the division shall appoint a government records ombudsman.</subsection><subsection ssid="29-null-3" dnum="b-o" numlevel="1" lineno="47" slineno="1-4" level="2"><display>(b)</display>The government records ombudsman may not be a member of the State Records <ln numlevel="1" lineno="48" slineno="1-5"/>Committee created in Section <xref depth="3" refnumber="63G-2-501">63G-2-501</xref>.</subsection></subsection><subsection ssid="29-null-4" dnum="2-o" numlevel="1" lineno="49" slineno="1-6" level="1" space="false"><display>(2)</display><subsection ssid="29-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The government records ombudsman shall:<subsection ssid="29-null-6" dnum="i-o" numlevel="1" lineno="50" slineno="1-7" level="3" tab="1"><display>(i)</display>be familiar with the provisions of Title 63G, Chapter 2, Government Records <ln numlevel="1" lineno="51" slineno="1-8"/>Access and Management Act;</subsection><subsection ssid="29-null-7" dnum="ii-o" numlevel="1" lineno="52" slineno="1-9" level="3" tab="1"><display>(ii)</display>serve as a resource for a person who is making or responding to a records request<amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="53" slineno="1-10"/>a fee dispute in relation to a records request,</amend> or filing an appeal relating to a <ln numlevel="1" lineno="54" slineno="1-11"/>records request;</subsection><subsection ssid="29-null-8" dnum="iii-o" numlevel="1" lineno="55" slineno="1-12" level="3" tab="1"><display>(iii)</display>upon a request from a requester or responder, and with the consent of both the <ln numlevel="1" lineno="56" slineno="1-13"/>requester and responder, mediate a dispute between a requester and responder, <ln numlevel="1" lineno="57" slineno="1-14"/>including a dispute between a requester and a governmental entity regarding the <ln numlevel="1" lineno="58" slineno="1-15"/>governmental entity's access denial, as defined in Section <xref depth="3" refnumber="63G-2-400.5">63G-2-400.5</xref>; and</subsection><subsection ssid="29-null-9" dnum="iv-o" numlevel="1" lineno="59" slineno="1-16" level="3" tab="1"><display>(iv)</display>on an annual basis, electronically transmit a written report to the Government <ln numlevel="1" lineno="60" slineno="1-17"/>Operations Interim Committee on the work performed by the government records <ln numlevel="1" lineno="61" slineno="1-18"/>ombudsman during the previous year.</subsection></subsection><subsection ssid="29-null-10" dnum="b-o" numlevel="1" lineno="62" slineno="1-19" level="2" space="false"><display>(b)</display><subsection ssid="29-null-11" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Before the conclusion of a mediation under Subsection (2)(a)(iii), a requester or <ln numlevel="1" lineno="63" slineno="1-20"/>responder may withdraw consent for the mediation.</subsection><subsection ssid="29-null-12" dnum="ii-o" numlevel="1" lineno="64" slineno="1-21" level="3"><display>(ii)</display>If a requester or responder withdraws consent under Subsection (2)(b)(i), the <ln numlevel="1" lineno="65" slineno="1-22"/>government records ombudsman shall certify, as provided in Subsection (4)(a)(ii), <ln numlevel="1" lineno="66" slineno="1-23"/>that the mediation was not concluded because of a lack of the required consent.</subsection></subsection></subsection><subsection ssid="29-null-13" dnum="3-o" numlevel="1" lineno="67" slineno="1-24" level="1"><display>(3)</display>The government records ombudsman may not testify, or be compelled to testify, before <ln numlevel="1" lineno="68" slineno="1-25"/>the State Records Committee created in Section <xref depth="3" refnumber="63G-2-501">63G-2-501</xref>, another administrative <ln numlevel="1" lineno="69" slineno="1-26"/>body, or a court regarding a matter that the government records ombudsman provided <ln numlevel="1" lineno="70" slineno="1-27"/>services in relation to under this section.</subsection><subsection ssid="29-null-14" dnum="4-o" numlevel="1" lineno="71" slineno="1-28" level="1"><display>(4)</display>Upon the conclusion of a mediation under Subsection (2)(a)(iii) or upon the government <ln numlevel="1" lineno="72" slineno="1-29"/>records ombudsman's determination that the required consent for the mediation is <ln numlevel="1" lineno="73" slineno="1-30"/>lacking, the government records ombudsman shall:<subsection ssid="29-null-15" dnum="a-o" numlevel="1" lineno="74" slineno="1-31" level="2"><display>(a)</display>certify in writing that the mediation:<subsection ssid="29-null-16" dnum="i-o" numlevel="1" lineno="75" slineno="1-32" level="3"><display>(i)</display>is concluded; or</subsection><subsection ssid="29-null-17" dnum="ii-o" numlevel="1" lineno="76" slineno="1-33" level="3"><display>(ii)</display>did not take place or was not concluded because of a lack of the required consent; <ln numlevel="1" lineno="77" slineno="1-34"/>and</subsection></subsection><subsection ssid="29-null-18" dnum="b-o" numlevel="1" lineno="78" slineno="1-35" level="2"><display>(b)</display>provide a copy of the written certification to the requester and the responder.</subsection></subsection></section></bsec><bsec buid="27" num="63G-2-201" type="amend" src="code" uid="C63G-2-S201_2025050720250507" sort="63G02 02010020250507" numlevel="1" lineno="79" slineno="2-1" sn="2"><section number="63G-2-201" numlevel="1" lineno="80" slineno="2-2" type="amend"><secline lineno="79">Section 2, Section <bold>63G-2-201</bold> is amended to read:</secline><catline lineno="80"><bold>63G-2-201. Provisions relating to records -- Public records -- Private, controlled, <ln numlevel="1" lineno="81" slineno="2-3"/>protected, and other restricted records -- Disclosure and nondisclosure of records -- <ln numlevel="1" lineno="82" slineno="2-4"/>Certified copy of record -- Limits on obligation to respond to record request.</bold></catline><subsection ssid="27-27-1" dnum="1-o" numlevel="1" lineno="83" slineno="2-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="27-27-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="63G-2-201(1)(b)" start="0">(1)(b)</xref>, a person has the right to inspect a public <ln numlevel="1" lineno="84" slineno="2-6"/>record free of charge, and the right to take a copy of a public record during normal <ln numlevel="1" lineno="85" slineno="2-7"/>working hours, subject to Sections <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref> and <xref depth="3" refnumber="63G-2-204" start="0">63G-2-204</xref>.</subsection><subsection ssid="27-27-3" dnum="b-o" numlevel="1" lineno="86" slineno="2-8" level="2"><display>(b)</display>A right under Subsection <xref depth="4" refnumber="63G-2-201(1)(a)" start="0">(1)(a)</xref> does not apply with respect to a record:<subsection ssid="27-27-4" dnum="i-o" numlevel="1" lineno="87" slineno="2-9" level="3"><display>(i)</display>a copy of which the governmental entity has already provided to the person;</subsection><subsection ssid="27-27-5" dnum="ii-o" numlevel="1" lineno="88" slineno="2-10" level="3"><display>(ii)</display>that is the subject of a records request that the governmental entity is not required <ln numlevel="1" lineno="89" slineno="2-11"/>to fill under Subsection <xref depth="4" refnumber="63G-2-201(7)(a)(v)" start="0">(7)(a)(v)</xref>; or</subsection><subsection ssid="27-27-6" dnum="iii-o" numlevel="1" lineno="90" slineno="2-12" level="3" space="false"><display>(iii)</display><subsection ssid="27-27-7" dnum="A-o" level="4" placement="sameline"><display>(A)</display>that is accessible only by a computer or other electronic device owned or <ln numlevel="1" lineno="91" slineno="2-13"/>controlled by the governmental entity;</subsection><subsection ssid="27-27-8" dnum="B-o" numlevel="1" lineno="92" slineno="2-14" level="4"><display>(B)</display>that is part of an electronic file that also contains a record that is private, <ln numlevel="1" lineno="93" slineno="2-15"/>controlled, or protected; and</subsection><subsection ssid="27-27-9" dnum="C-o" numlevel="1" lineno="94" slineno="2-16" level="4"><display>(C)</display>that the governmental entity cannot readily segregate from the part of the <ln numlevel="1" lineno="95" slineno="2-17"/>electronic file that contains a private, controlled, or protected record.</subsection></subsection></subsection></subsection><subsection ssid="27-27-10" dnum="2-o" numlevel="1" lineno="96" slineno="2-18" level="1"><display>(2)</display>A record is public unless otherwise expressly provided by statute.</subsection><subsection ssid="27-27-11" dnum="3-o" numlevel="1" lineno="97" slineno="2-19" level="1"><display>(3)</display>The following records are not public:<subsection ssid="27-27-12" dnum="a-o" numlevel="1" lineno="98" slineno="2-20" level="2"><display>(a)</display>a record that is private, controlled, or protected under Sections <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>, <xref depth="3" refnumber="63G-2-304" start="0"><ln numlevel="1" lineno="99" slineno="2-21"/>63G-2-304</xref>, and <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref>; and</subsection><subsection ssid="27-27-13" dnum="b-o" numlevel="1" lineno="100" slineno="2-22" level="2"><display>(b)</display>a record to which access is restricted pursuant to court rule, another state statute, <ln numlevel="1" lineno="101" slineno="2-23"/>federal statute, or federal regulation, including records for which access is governed <ln numlevel="1" lineno="102" slineno="2-24"/>or restricted as a condition of participation in a state or federal program or for <ln numlevel="1" lineno="103" slineno="2-25"/>receiving state or federal funds.</subsection></subsection><subsection ssid="27-27-14" dnum="4-o" numlevel="1" lineno="104" slineno="2-26" level="1"><display>(4)</display>Only a record specified in Section <xref depth="3" refnumber="63G-2-302" start="0">63G-2-302</xref>, <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>, <xref depth="3" refnumber="63G-2-304" start="0">63G-2-304</xref>, or <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref> <ln numlevel="1" lineno="105" slineno="2-27"/>may be classified private, controlled, or protected.</subsection><subsection ssid="27-27-15" dnum="5-o" numlevel="1" lineno="106" slineno="2-28" level="1" space="false"><display>(5)</display><subsection ssid="27-27-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may not disclose a record that is private, controlled, or <ln numlevel="1" lineno="107" slineno="2-29"/>protected to any person except as provided in Subsection <xref depth="4" refnumber="63G-2-201(5)(b)" start="0">(5)(b)</xref>, Subsection <xref depth="4" refnumber="63G-2-201(5)(c)" start="0">(5)(c)</xref>, <ln numlevel="1" lineno="108" slineno="2-30"/>Section <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref>, <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref>, or <xref depth="3" refnumber="63G-2-303" start="0">63G-2-303</xref>.</subsection><subsection ssid="27-27-17" dnum="b-o" numlevel="1" lineno="109" slineno="2-31" level="2"><display>(b)</display>A governmental entity may disclose a record that is private under Subsection <xref depth="4" refnumber="63G-2-302(2)" start="0"><ln numlevel="1" lineno="110" slineno="2-32"/>63G-2-302(2)</xref> or protected under Section <xref depth="3" refnumber="63G-2-305" start="0">63G-2-305</xref> to persons other than those <ln numlevel="1" lineno="111" slineno="2-33"/>specified in Section <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref> or <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref> if the head of a governmental entity, or <ln numlevel="1" lineno="112" slineno="2-34"/>a designee, determines that:<subsection ssid="27-27-18" dnum="i-o" numlevel="1" lineno="113" slineno="2-35" level="3"><display>(i)</display>there is no interest in restricting access to the record; or</subsection><subsection ssid="27-27-19" dnum="ii-o" numlevel="1" lineno="114" slineno="2-36" level="3"><display>(ii)</display>the interests favoring access are greater than or equal to the interest favoring <ln numlevel="1" lineno="115" slineno="2-37"/>restriction of access.</subsection></subsection><subsection ssid="27-27-20" dnum="c-o" numlevel="1" lineno="116" slineno="2-38" level="2"><display>(c)</display>In addition to the disclosure under Subsection <xref depth="4" refnumber="63G-2-201(5)(b)" start="0">(5)(b)</xref>, a governmental entity may <ln numlevel="1" lineno="117" slineno="2-39"/>disclose a record that is protected under Subsection <xref depth="4" refnumber="63G-2-305(51)" start="0">63G-2-305(51)</xref> if:<subsection ssid="27-27-21" dnum="i-o" numlevel="1" lineno="118" slineno="2-40" level="3"><display>(i)</display>the head of the governmental entity, or a designee, determines that the disclosure:<subsection ssid="27-27-22" dnum="A-o" numlevel="1" lineno="119" slineno="2-41" level="4"><display>(A)</display>is mutually beneficial to:<subsection ssid="27-27-23" dnum="I-o" numlevel="1" lineno="120" slineno="2-42" level="5"><display>(I)</display>the subject of the record;</subsection><subsection ssid="27-27-24" dnum="II-o" numlevel="1" lineno="121" slineno="2-43" level="5"><display>(II)</display>the governmental entity; and</subsection><subsection ssid="27-27-25" dnum="III-o" numlevel="1" lineno="122" slineno="2-44" level="5"><display>(III)</display>the public; and</subsection></subsection><subsection ssid="27-27-26" dnum="B-o" numlevel="1" lineno="123" slineno="2-45" level="4"><display>(B)</display>serves a public purpose related to:<subsection ssid="27-27-27" dnum="I-o" numlevel="1" lineno="124" slineno="2-46" level="5"><display>(I)</display>public safety; or</subsection><subsection ssid="27-27-28" dnum="II-o" numlevel="1" lineno="125" slineno="2-47" level="5"><display>(II)</display>consumer protection; and</subsection></subsection></subsection><subsection ssid="27-27-29" dnum="ii-o" numlevel="1" lineno="126" slineno="2-48" level="3"><display>(ii)</display>the person who receives the record from the governmental entity agrees not to use <ln numlevel="1" lineno="127" slineno="2-49"/>or allow the use of the record for advertising or solicitation purposes.</subsection></subsection></subsection><subsection ssid="27-27-30" dnum="6-o" numlevel="1" lineno="128" slineno="2-50" level="1"><display>(6)</display>A governmental entity shall provide a person with a certified copy of a record if:<subsection ssid="27-27-31" dnum="a-o" numlevel="1" lineno="129" slineno="2-51" level="2"><display>(a)</display>the person requesting the record has a right to inspect it;</subsection><subsection ssid="27-27-32" dnum="b-o" numlevel="1" lineno="130" slineno="2-52" level="2"><display>(b)</display>the person identifies the record with reasonable specificity; and</subsection><subsection ssid="27-27-33" dnum="c-o" numlevel="1" lineno="131" slineno="2-53" level="2"><display>(c)</display>the person pays the lawful fees.</subsection></subsection><subsection ssid="27-27-34" dnum="7-o" numlevel="1" lineno="132" slineno="2-54" level="1" space="false"><display>(7)</display><subsection ssid="27-27-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In response to a request, a governmental entity is not required to:<subsection ssid="27-27-36" dnum="i-o" numlevel="1" lineno="133" slineno="2-55" level="3" tab="1"><display>(i)</display>create a record;</subsection><subsection ssid="27-27-37" dnum="ii-o" numlevel="1" lineno="134" slineno="2-56" level="3" tab="1"><display>(ii)</display>compile, format, manipulate, package, summarize, or tailor information;</subsection><subsection ssid="27-27-38" dnum="iii-o" numlevel="1" lineno="135" slineno="2-57" level="3" tab="1"><display>(iii)</display>provide a record in a particular format, medium, or program not currently <ln numlevel="1" lineno="136" slineno="2-58"/>maintained by the governmental entity;</subsection><subsection ssid="27-27-39" dnum="iv-o" numlevel="1" lineno="137" slineno="2-59" level="3" tab="1"><display>(iv)</display>fulfill a person's records request if the request unreasonably duplicates prior <ln numlevel="1" lineno="138" slineno="2-60"/>records requests from that person;</subsection><subsection ssid="27-27-40" dnum="v-o" numlevel="1" lineno="139" slineno="2-61" level="3" tab="1"><display>(v)</display>fill a person's records request if:<subsection ssid="27-27-41" dnum="A-o" numlevel="1" lineno="140" slineno="2-62" level="4"><display>(A)</display>the record requested is:<subsection ssid="27-27-42" dnum="I-o" numlevel="1" lineno="141" slineno="2-63" level="5"><display>(I)</display>publicly accessible online; or</subsection><subsection ssid="27-27-43" dnum="II-o" numlevel="1" lineno="142" slineno="2-64" level="5"><display>(II)</display>included in a public publication or product produced by the governmental <ln numlevel="1" lineno="143" slineno="2-65"/>entity receiving the request; and</subsection></subsection><subsection ssid="27-27-44" dnum="B-o" numlevel="1" lineno="144" slineno="2-66" level="4"><display>(B)</display>the governmental entity:<subsection ssid="27-27-45" dnum="I-o" numlevel="1" lineno="145" slineno="2-67" level="5"><display>(I)</display>specifies to the person requesting the record where the record is accessible <ln numlevel="1" lineno="146" slineno="2-68"/>online; or</subsection><subsection ssid="27-27-46" dnum="II-o" numlevel="1" lineno="147" slineno="2-69" level="5"><display>(II)</display>provides the person requesting the record with the public publication or <ln numlevel="1" lineno="148" slineno="2-70"/>product and specifies where the record can be found in the public <ln numlevel="1" lineno="149" slineno="2-71"/>publication or product; or</subsection></subsection></subsection><subsection ssid="27-27-47" dnum="vi-o" numlevel="1" lineno="150" slineno="2-72" level="3" tab="1"><display>(vi)</display>fulfill a person's records request if:<subsection ssid="27-27-48" dnum="A-o" numlevel="1" lineno="151" slineno="2-73" level="4"><display>(A)</display>the person has been determined under Section <xref depth="3" refnumber="63G-2-209" start="0">63G-2-209</xref> to be a vexatious <ln numlevel="1" lineno="152" slineno="2-74"/>requester;</subsection><subsection ssid="27-27-49" dnum="B-o" numlevel="1" lineno="153" slineno="2-75" level="4"><display>(B)</display>the State Records Committee order determining the person to be a vexatious <ln numlevel="1" lineno="154" slineno="2-76"/>requester provides that the governmental entity is not required to fulfill a <ln numlevel="1" lineno="155" slineno="2-77"/>request from the person for a period of time; and</subsection><subsection ssid="27-27-50" dnum="C-o" numlevel="1" lineno="156" slineno="2-78" level="4"><display>(C)</display>the period of time described in Subsection <xref depth="4" refnumber="63G-2-201(7)(a)(vi)(B)" start="0">(7)(a)(vi)(B)</xref> has not expired.</subsection></subsection></subsection><subsection ssid="27-27-51" dnum="b-o" numlevel="1" lineno="157" slineno="2-79" level="2"><display>(b)</display>A governmental entity shall conduct a reasonable search for a requested record.</subsection></subsection><subsection ssid="27-27-52" dnum="8-o" numlevel="1" lineno="158" slineno="2-80" level="1" space="false"><display>(8)</display><subsection ssid="27-27-53" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Although not required to do so, a governmental entity may, upon request from the <ln numlevel="1" lineno="159" slineno="2-81"/>person who submitted the records request, compile, format, manipulate, package, <ln numlevel="1" lineno="160" slineno="2-82"/>summarize, or tailor information or provide a record in a format, medium, or program <ln numlevel="1" lineno="161" slineno="2-83"/>not currently maintained by the governmental entity.</subsection><subsection ssid="27-27-54" dnum="b-o" numlevel="1" lineno="162" slineno="2-84" level="2"><display>(b)</display>In determining whether to fulfill a request described in Subsection <xref depth="4" refnumber="63G-2-201(8)(a)" start="0">(8)(a)</xref>, a <ln numlevel="1" lineno="163" slineno="2-85"/>governmental entity may consider whether the governmental entity is able to fulfill <ln numlevel="1" lineno="164" slineno="2-86"/>the request without unreasonably interfering with the governmental entity's duties <ln numlevel="1" lineno="165" slineno="2-87"/>and responsibilities.</subsection><subsection ssid="27-27-55" dnum="c-o" numlevel="1" lineno="166" slineno="2-88" level="2"><display>(c)</display>A governmental entity may require a person who makes a request under Subsection <xref depth="4" refnumber="63G-2-201(8)(a)" start="0"><ln numlevel="1" lineno="167" slineno="2-89"/>(8)(a)</xref> to pay the governmental entity, in accordance with Section <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref>, for <ln numlevel="1" lineno="168" slineno="2-90"/>providing the information or record as requested.</subsection></subsection><subsection ssid="27-27-56" dnum="9-o" numlevel="1" lineno="169" slineno="2-91" level="1" space="false"><display>(9)</display><subsection ssid="27-27-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding any other provision of this chapter, and subject to Subsection <xref depth="4" refnumber="63G-2-201(9)(b)" start="0"><ln numlevel="1" lineno="170" slineno="2-92"/>(9)(b)</xref>, a governmental entity is not required to respond to, or provide a record in <ln numlevel="1" lineno="171" slineno="2-93"/>response to, a record request if the request is submitted by or in behalf of an <ln numlevel="1" lineno="172" slineno="2-94"/>individual who is confined in a jail or other correctional facility following the <ln numlevel="1" lineno="173" slineno="2-95"/>individual's conviction.</subsection><subsection ssid="27-27-58" dnum="b-o" numlevel="1" lineno="174" slineno="2-96" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref> does not apply to:<subsection ssid="27-27-59" dnum="i-o" numlevel="1" lineno="175" slineno="2-97" level="3"><display>(i)</display>the first five record requests submitted to the governmental entity by or in behalf <ln numlevel="1" lineno="176" slineno="2-98"/>of an individual described in Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref> during any calendar year <ln numlevel="1" lineno="177" slineno="2-99"/>requesting only a record that contains a specific reference to the individual; or</subsection><subsection ssid="27-27-60" dnum="ii-o" numlevel="1" lineno="178" slineno="2-100" level="3"><display>(ii)</display>a record request that is submitted by an attorney of an individual described in <ln numlevel="1" lineno="179" slineno="2-101"/>Subsection <xref depth="4" refnumber="63G-2-201(9)(a)" start="0">(9)(a)</xref>.</subsection></subsection></subsection><subsection ssid="27-27-61" dnum="10-o" numlevel="1" lineno="180" slineno="2-102" level="1" space="false"><display>(10)</display><subsection ssid="27-27-62" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may allow a person requesting more than 50 pages of <ln numlevel="1" lineno="181" slineno="2-103"/>records to copy the records if:<subsection ssid="27-27-63" dnum="i-o" numlevel="1" lineno="182" slineno="2-104" level="3" tab="1"><display>(i)</display>the records are contained in files that do not contain records that are exempt from <ln numlevel="1" lineno="183" slineno="2-105"/>disclosure, or the records may be segregated to remove private, protected, or <ln numlevel="1" lineno="184" slineno="2-106"/>controlled information from disclosure; and</subsection><subsection ssid="27-27-64" dnum="ii-o" numlevel="1" lineno="185" slineno="2-107" level="3" tab="1"><display>(ii)</display>the governmental entity provides reasonable safeguards to protect the public from <ln numlevel="1" lineno="186" slineno="2-108"/>the potential for loss of a public record.</subsection></subsection><subsection ssid="27-27-65" dnum="b-o" numlevel="1" lineno="187" slineno="2-109" level="2"><display>(b)</display>If the requirements of Subsection <xref depth="4" refnumber="63G-2-201(10)(a)" start="0">(10)(a)</xref> are met, the governmental entity may:<subsection ssid="27-27-66" dnum="i-o" numlevel="1" lineno="188" slineno="2-110" level="3"><display>(i)</display>provide the requester with the facilities for copying the requested records and <ln numlevel="1" lineno="189" slineno="2-111"/>require that the requester make the copies; or</subsection><subsection ssid="27-27-67" dnum="ii-o" numlevel="1" lineno="190" slineno="2-112" level="3"><display>(ii)</display>allow the requester to provide the requester's own copying facilities and personnel <ln numlevel="1" lineno="191" slineno="2-113"/>to make the copies at the governmental entity's offices and waive the fees for <ln numlevel="1" lineno="192" slineno="2-114"/>copying the records.</subsection></subsection></subsection><subsection ssid="27-27-68" dnum="11-o" numlevel="1" lineno="193" slineno="2-115" level="1" space="false"><display>(11)</display><subsection ssid="27-27-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity that owns an intellectual property right and that offers the <ln numlevel="1" lineno="194" slineno="2-116"/>intellectual property right for sale or license may control by ordinance or policy the <ln numlevel="1" lineno="195" slineno="2-117"/>duplication and distribution of the material based on terms the governmental entity <ln numlevel="1" lineno="196" slineno="2-118"/>considers to be in the public interest.</subsection><subsection ssid="27-27-70" dnum="b-o" numlevel="1" lineno="197" slineno="2-119" level="2"><display>(b)</display>Nothing in this chapter shall be construed to limit or impair the rights or protections <ln numlevel="1" lineno="198" slineno="2-120"/>granted to the governmental entity under federal copyright or patent law as a result of <ln numlevel="1" lineno="199" slineno="2-121"/>its ownership of the intellectual property right.</subsection></subsection><subsection ssid="27-27-71" dnum="12-o" numlevel="1" lineno="200" slineno="2-122" level="1"><display>(12)</display>A governmental entity may not use the physical form, electronic or otherwise, in <ln numlevel="1" lineno="201" slineno="2-123"/>which a record is stored to deny, or unreasonably hinder the rights of a person to inspect <ln numlevel="1" lineno="202" slineno="2-124"/>and receive a copy of a record under this chapter.</subsection><subsection ssid="27-27-72" dnum="13-o" numlevel="1" lineno="203" slineno="2-125" level="1"><display>(13)</display>Subject to the requirements of Subsection <xref depth="4" refnumber="63G-2-201(7)" start="0">(7)</xref>, a governmental entity shall provide <ln numlevel="1" lineno="204" slineno="2-126"/>access to an electronic copy of a record in lieu of providing access to its paper <ln numlevel="1" lineno="205" slineno="2-127"/>equivalent if:<subsection ssid="27-27-73" dnum="a-o" numlevel="1" lineno="206" slineno="2-128" level="2"><display>(a)</display>the person making the request requests or states a preference for an electronic copy;</subsection><subsection ssid="27-27-74" dnum="b-o" numlevel="1" lineno="207" slineno="2-129" level="2"><display>(b)</display>the governmental entity currently maintains the record in an electronic format that is <ln numlevel="1" lineno="208" slineno="2-130"/>reproducible and may be provided without reformatting or conversion; and</subsection><subsection ssid="27-27-75" dnum="c-o" numlevel="1" lineno="209" slineno="2-131" level="2"><display>(c)</display>the electronic copy of the record:<subsection ssid="27-27-76" dnum="i-o" numlevel="1" lineno="210" slineno="2-132" level="3"><display>(i)</display>does not disclose other records that are exempt from disclosure; or</subsection><subsection ssid="27-27-77" dnum="ii-o" numlevel="1" lineno="211" slineno="2-133" level="3"><display>(ii)</display>may be segregated to protect private, protected, or controlled information from <ln numlevel="1" lineno="212" slineno="2-134"/>disclosure without the undue expenditure of public resources or funds.</subsection></subsection></subsection><subsection ssid="27-27-78" dnum="14-o" numlevel="1" lineno="213" slineno="2-135" level="1"><display>(14)</display>In determining whether a record is properly classified as private under Subsection <xref depth="4" refnumber="63G-2-302(2)(d)" start="0"><ln numlevel="1" lineno="214" slineno="2-136"/>63G-2-302(2)(d)</xref>, the governmental entity, State Records Committee, local appeals <ln numlevel="1" lineno="215" slineno="2-137"/>board, or court shall consider and weigh:<subsection ssid="27-27-79" dnum="a-o" numlevel="1" lineno="216" slineno="2-138" level="2"><display>(a)</display>any personal privacy interests, including those in images, that would be affected by <ln numlevel="1" lineno="217" slineno="2-139"/>disclosure of the records in question; and</subsection><subsection ssid="27-27-80" dnum="b-o" numlevel="1" lineno="218" slineno="2-140" level="2"><display>(b)</display>any public interests served by disclosure.</subsection></subsection><subsection ssid="27-81" dnum="_-o:15-i" numlevel="1" lineno="219" slineno="2-141" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="i" level="1" amendtag="start">(15)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">A request for the work-related contact information of an employee of a local education <ln numlevel="1" lineno="220" slineno="2-142"/>agency shall be provided only according to the requirements of Section <xref depth="3" refnumber="53G-10-207">53G-10-207</xref>.</amend></subsection></section></bsec><bsec buid="22" num="63G-2-202" type="amend" src="code" uid="C63G-2-S202_2025050720250507" sort="63G02 02020020250507" numlevel="1" lineno="221" slineno="3-1" sn="3"><section number="63G-2-202" numlevel="1" lineno="222" slineno="3-2" type="amend"><secline lineno="221">Section 3, Section <bold>63G-2-202</bold> is amended to read:</secline><catline lineno="222"><bold>63G-2-202. Access to private, controlled, and protected documents.</bold></catline><subsection ssid="22-22-1" dnum="1-o" numlevel="1" lineno="223" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection (11)(a), a governmental entity:<subsection ssid="22-22-2" dnum="a-o" numlevel="1" lineno="224" slineno="3-4" level="2"><display>(a)</display>shall, upon request, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>disclose a private record to:<subsection ssid="22-22-3" dnum="i-o" numlevel="1" lineno="225" slineno="3-5" level="3"><display>(i)</display>the subject of the record;</subsection><subsection ssid="22-22-4" dnum="ii-o" numlevel="1" lineno="226" slineno="3-6" level="3"><display>(ii)</display>the parent or legal guardian of an unemancipated minor who is the subject of the <ln numlevel="1" lineno="227" slineno="3-7"/>record;</subsection><subsection ssid="22-22-5" dnum="iii-o" numlevel="1" lineno="228" slineno="3-8" level="3"><display>(iii)</display>the legal guardian of a legally incapacitated individual who is the subject of the <ln numlevel="1" lineno="229" slineno="3-9"/>record;</subsection><subsection ssid="22-22-6" dnum="iv-o" numlevel="1" lineno="230" slineno="3-10" level="3"><display>(iv)</display>any other individual who:<subsection ssid="22-22-7" dnum="A-o" numlevel="1" lineno="231" slineno="3-11" level="4"><display>(A)</display>has a power of attorney from the subject of the record;</subsection><subsection ssid="22-22-8" dnum="B-o" numlevel="1" lineno="232" slineno="3-12" level="4"><display>(B)</display>submits a notarized release from the subject of the record or the individual's <ln numlevel="1" lineno="233" slineno="3-13"/>legal representative dated no more than 90 days before the date the request is <ln numlevel="1" lineno="234" slineno="3-14"/>made; or</subsection><subsection ssid="22-22-9" dnum="C-o" numlevel="1" lineno="235" slineno="3-15" level="4"><display>(C)</display>if the record is a medical record described in Subsection <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>(1)(b), is a <ln numlevel="1" lineno="236" slineno="3-16"/>health care provider, as defined in Section <xref depth="3" refnumber="26B-8-501">26B-8-501</xref>, if releasing the record or <ln numlevel="1" lineno="237" slineno="3-17"/>information in the record is consistent with normal professional practice and <ln numlevel="1" lineno="238" slineno="3-18"/>medical ethics; or</subsection></subsection><subsection ssid="22-22-10" dnum="v-o" numlevel="1" lineno="239" slineno="3-19" level="3"><display>(v)</display>any person to whom the record must be provided pursuant to:<subsection ssid="22-22-11" dnum="A-o" numlevel="1" lineno="240" slineno="3-20" level="4"><display>(A)</display>court order as provided in Subsection (7); or</subsection><subsection ssid="22-22-12" dnum="B-o" numlevel="1" lineno="241" slineno="3-21" level="4"><display>(B)</display>a legislative subpoena as provided in Title 36, Chapter 14, Legislative <ln numlevel="1" lineno="242" slineno="3-22"/>Subpoena Powers; and</subsection></subsection></subsection><subsection ssid="22-22-13" dnum="b-o" numlevel="1" lineno="243" slineno="3-23" level="2"><display>(b)</display>may disclose a private record described in Subsections <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>(1)(j) through (m), <ln numlevel="1" lineno="244" slineno="3-24"/>without complying with Section <xref depth="3" refnumber="63G-2-206">63G-2-206</xref>, to another governmental entity for a <ln numlevel="1" lineno="245" slineno="3-25"/>purpose related to:<subsection ssid="22-22-14" dnum="i-o" numlevel="1" lineno="246" slineno="3-26" level="3"><display>(i)</display>voter registration; or</subsection><subsection ssid="22-22-15" dnum="ii-o" numlevel="1" lineno="247" slineno="3-27" level="3"><display>(ii)</display>the administration of an election.</subsection></subsection></subsection><subsection ssid="22-22-16" dnum="2-o" numlevel="1" lineno="248" slineno="3-28" level="1" space="false"><display>(2)</display><subsection ssid="22-22-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon request, a governmental entity shall disclose a controlled record to:<subsection ssid="22-22-18" dnum="i-o" numlevel="1" lineno="249" slineno="3-29" level="3" tab="1"><display>(i)</display>a physician, physician assistant, psychologist, certified social worker, insurance <ln numlevel="1" lineno="250" slineno="3-30"/>provider or producer, or a government public health agency upon submission of:<subsection ssid="22-22-19" dnum="A-o" numlevel="1" lineno="251" slineno="3-31" level="4"><display>(A)</display>a release from the subject of the record that is dated no more than 90 days <ln numlevel="1" lineno="252" slineno="3-32"/>prior to the date the request is made; and</subsection><subsection ssid="22-22-20" dnum="B-o" numlevel="1" lineno="253" slineno="3-33" level="4"><display>(B)</display>a signed acknowledgment of the terms of disclosure of controlled information <ln numlevel="1" lineno="254" slineno="3-34"/>as provided by Subsection (2)(b); and</subsection></subsection><subsection ssid="22-22-21" dnum="ii-o" numlevel="1" lineno="255" slineno="3-35" level="3" tab="1"><display>(ii)</display>any person to whom the record must be disclosed pursuant to:<subsection ssid="22-22-22" dnum="A-o" numlevel="1" lineno="256" slineno="3-36" level="4"><display>(A)</display>a court order as provided in Subsection (7); or</subsection><subsection ssid="22-22-23" dnum="B-o" numlevel="1" lineno="257" slineno="3-37" level="4"><display>(B)</display>a legislative subpoena as provided in Title 36, Chapter 14, Legislative <ln numlevel="1" lineno="258" slineno="3-38"/>Subpoena Powers.</subsection></subsection></subsection><subsection ssid="22-22-24" dnum="b-o" numlevel="1" lineno="259" slineno="3-39" level="2"><display>(b)</display>A person who receives a record from a governmental entity in accordance with <ln numlevel="1" lineno="260" slineno="3-40"/>Subsection (2)(a)(i) may not disclose controlled information from that record to any <ln numlevel="1" lineno="261" slineno="3-41"/>person, including the subject of the record.</subsection></subsection><subsection ssid="22-22-25" dnum="3-o" numlevel="1" lineno="262" slineno="3-42" level="1"><display>(3)</display>If there is more than one subject of a private or controlled record, the portion of the <ln numlevel="1" lineno="263" slineno="3-43"/>record that pertains to another subject shall be segregated from the portion that the <ln numlevel="1" lineno="264" slineno="3-44"/>requester is entitled to inspect.</subsection><subsection ssid="22-22-26" dnum="4-o" numlevel="1" lineno="265" slineno="3-45" level="1"><display>(4)</display>Upon request, and except as provided in Subsection (11)(b), a governmental entity shall <ln numlevel="1" lineno="266" slineno="3-46"/>disclose a protected record to:<subsection ssid="22-22-27" dnum="a-o" numlevel="1" lineno="267" slineno="3-47" level="2"><display>(a)</display>the person that submitted the record;</subsection><subsection ssid="22-22-28" dnum="b-o" numlevel="1" lineno="268" slineno="3-48" level="2"><display>(b)</display>any other individual who:<subsection ssid="22-22-29" dnum="i-o" numlevel="1" lineno="269" slineno="3-49" level="3"><display>(i)</display>has a power of attorney from all persons, governmental entities, or political <ln numlevel="1" lineno="270" slineno="3-50"/>subdivisions whose interests were sought to be protected by the protected <ln numlevel="1" lineno="271" slineno="3-51"/>classification; or</subsection><subsection ssid="22-22-30" dnum="ii-o" numlevel="1" lineno="272" slineno="3-52" level="3"><display>(ii)</display>submits a notarized release from all persons, governmental entities, or political <ln numlevel="1" lineno="273" slineno="3-53"/>subdivisions whose interests were sought to be protected by the protected <ln numlevel="1" lineno="274" slineno="3-54"/>classification or from their legal representatives dated no more than 90 days prior <ln numlevel="1" lineno="275" slineno="3-55"/>to the date the request is made;</subsection></subsection><subsection ssid="22-22-31" dnum="c-o" numlevel="1" lineno="276" slineno="3-56" level="2"><display>(c)</display>any person to whom the record must be provided pursuant to:<subsection ssid="22-22-32" dnum="i-o" numlevel="1" lineno="277" slineno="3-57" level="3"><display>(i)</display>a court order as provided in Subsection (7); or</subsection><subsection ssid="22-22-33" dnum="ii-o" numlevel="1" lineno="278" slineno="3-58" level="3"><display>(ii)</display>a legislative subpoena as provided in Title 36, Chapter 14, Legislative Subpoena <ln numlevel="1" lineno="279" slineno="3-59"/>Powers; or</subsection></subsection><subsection ssid="22-22-34" dnum="d-o" numlevel="1" lineno="280" slineno="3-60" level="2"><display>(d)</display>the owner of a mobile home park, subject to the conditions of Subsection <xref depth="3" refnumber="41-1a-116">41-1a-116</xref><ln numlevel="1" lineno="281" slineno="3-61"/>(5).</subsection></subsection><subsection ssid="22-22-35" dnum="5-o" numlevel="1" lineno="282" slineno="3-62" level="1"><display>(5)</display>Except as provided in Subsection (1)(b), a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/>governmental entity may disclose a <ln numlevel="1" lineno="283" slineno="3-63"/>private, controlled, or protected record to another governmental entity, political <ln numlevel="1" lineno="284" slineno="3-64"/>subdivision, state, the United States, or a foreign government only as provided by <ln numlevel="1" lineno="285" slineno="3-65"/>Section <xref depth="3" refnumber="63G-2-206">63G-2-206</xref>.</subsection><subsection ssid="22-22-36" dnum="6-o" numlevel="1" lineno="286" slineno="3-66" level="1"><display>(6)</display>Before releasing a private, controlled, or protected record, the governmental entity shall <ln numlevel="1" lineno="287" slineno="3-67"/>obtain evidence of the requester's identity.</subsection><subsection ssid="22-22-37" dnum="7-o" numlevel="1" lineno="288" slineno="3-68" level="1"><display>(7)</display>A governmental entity shall disclose a record pursuant to the terms of a court order <ln numlevel="1" lineno="289" slineno="3-69"/>signed by a judge from a court of competent jurisdiction, provided that:<subsection ssid="22-22-38" dnum="a-o" numlevel="1" lineno="290" slineno="3-70" level="2"><display>(a)</display>the record deals with a matter in controversy over which the court has jurisdiction;</subsection><subsection ssid="22-22-39" dnum="b-o" numlevel="1" lineno="291" slineno="3-71" level="2"><display>(b)</display>the court has considered the merits of the request for access to the record;</subsection><subsection ssid="22-22-40" dnum="c-o" numlevel="1" lineno="292" slineno="3-72" level="2"><display>(c)</display>the court has considered and, where appropriate, limited the requester's use and <ln numlevel="1" lineno="293" slineno="3-73"/>further disclosure of the record in order to protect:<subsection ssid="22-22-41" dnum="i-o" numlevel="1" lineno="294" slineno="3-74" level="3"><display>(i)</display>privacy interests in the case of private or controlled records;</subsection><subsection ssid="22-22-42" dnum="ii-o" numlevel="1" lineno="295" slineno="3-75" level="3"><display>(ii)</display>business confidentiality interests in the case of records protected under <ln numlevel="1" lineno="296" slineno="3-76"/>Subsection <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>(1), (2), (40)(a)(ii), or (40)(a)(vi); and</subsection><subsection ssid="22-22-43" dnum="iii-o" numlevel="1" lineno="297" slineno="3-77" level="3"><display>(iii)</display>privacy interests or the public interest in the case of other protected records;</subsection></subsection><subsection ssid="22-22-44" dnum="d-o" numlevel="1" lineno="298" slineno="3-78" level="2"><display>(d)</display>to the extent the record is properly classified private, controlled, or protected, the <ln numlevel="1" lineno="299" slineno="3-79"/>interests favoring access, considering limitations thereon, are greater than or equal to <ln numlevel="1" lineno="300" slineno="3-80"/>the interests favoring restriction of access; and</subsection><subsection ssid="22-22-45" dnum="e-o" numlevel="1" lineno="301" slineno="3-81" level="2"><display>(e)</display>where access is restricted by a rule, statute, or regulation referred to in Subsection <xref depth="3" refnumber="63G-2-201"><ln numlevel="1" lineno="302" slineno="3-82"/>63G-2-201</xref>(3)(b), the court has authority independent of this chapter to order <ln numlevel="1" lineno="303" slineno="3-83"/>disclosure.</subsection></subsection><subsection ssid="22-22-46" dnum="8-o" numlevel="1" lineno="304" slineno="3-84" level="1" space="false"><display>(8)</display><subsection ssid="22-22-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (8)(d), a governmental entity may disclose or <ln numlevel="1" lineno="305" slineno="3-85"/>authorize disclosure of private or controlled records for research purposes if the <ln numlevel="1" lineno="306" slineno="3-86"/>governmental entity:<subsection ssid="22-22-48" dnum="i-o" numlevel="1" lineno="307" slineno="3-87" level="3" tab="1"><display>(i)</display>determines that the research purpose cannot reasonably be accomplished without <ln numlevel="1" lineno="308" slineno="3-88"/>use or disclosure of the information to the researcher in individually identifiable <ln numlevel="1" lineno="309" slineno="3-89"/>form;</subsection><subsection ssid="22-22-49" dnum="ii-o" numlevel="1" lineno="310" slineno="3-90" level="3" tab="1"><display>(ii)</display>determines that:<subsection ssid="22-22-50" dnum="A-o" numlevel="1" lineno="311" slineno="3-91" level="4"><display>(A)</display>the proposed research is bona fide; and</subsection><subsection ssid="22-22-51" dnum="B-o" numlevel="1" lineno="312" slineno="3-92" level="4"><display>(B)</display>the value of the research is greater than or equal to the infringement upon <ln numlevel="1" lineno="313" slineno="3-93"/>personal privacy;</subsection></subsection><subsection ssid="22-22-52" dnum="iii-o" numlevel="1" lineno="314" slineno="3-94" level="3" tab="1" space="false"><display>(iii)</display><subsection ssid="22-22-53" dnum="A-o" level="4" placement="sameline"><display>(A)</display>requires the researcher to assure the integrity, confidentiality, and security <ln numlevel="1" lineno="315" slineno="3-95"/>of the records; and</subsection><subsection ssid="22-22-54" dnum="B-o" numlevel="1" lineno="316" slineno="3-96" level="4"><display>(B)</display>requires the removal or destruction of the individual identifiers associated <ln numlevel="1" lineno="317" slineno="3-97"/>with the records as soon as the purpose of the research project has been <ln numlevel="1" lineno="318" slineno="3-98"/>accomplished;</subsection></subsection><subsection ssid="22-22-55" dnum="iv-o" numlevel="1" lineno="319" slineno="3-99" level="3" tab="1"><display>(iv)</display>prohibits the researcher from:<subsection ssid="22-22-56" dnum="A-o" numlevel="1" lineno="320" slineno="3-100" level="4"><display>(A)</display>disclosing the record in individually identifiable form, except as provided in <ln numlevel="1" lineno="321" slineno="3-101"/>Subsection (8)(b); or</subsection><subsection ssid="22-22-57" dnum="B-o" numlevel="1" lineno="322" slineno="3-102" level="4"><display>(B)</display>using the record for purposes other than the research approved by the <ln numlevel="1" lineno="323" slineno="3-103"/>governmental entity; and</subsection></subsection><subsection ssid="22-22-58" dnum="v-o" numlevel="1" lineno="324" slineno="3-104" level="3" tab="1"><display>(v)</display>secures from the researcher a written statement of the researcher's understanding <ln numlevel="1" lineno="325" slineno="3-105"/>of and agreement to the conditions of this Subsection (8) and the researcher's <ln numlevel="1" lineno="326" slineno="3-106"/>understanding that violation of the terms of this Subsection (8) may subject the <ln numlevel="1" lineno="327" slineno="3-107"/>researcher to criminal prosecution under Section <xref depth="3" refnumber="63G-2-801">63G-2-801</xref>.</subsection></subsection><subsection ssid="22-22-59" dnum="b-o" numlevel="1" lineno="328" slineno="3-108" level="2"><display>(b)</display>A researcher may disclose a record in individually identifiable form if the record is <ln numlevel="1" lineno="329" slineno="3-109"/>disclosed for the purpose of auditing or evaluating the research program and no <ln numlevel="1" lineno="330" slineno="3-110"/>subsequent use or disclosure of the record in individually identifiable form will be <ln numlevel="1" lineno="331" slineno="3-111"/>made by the auditor or evaluator except as provided by this section.</subsection><subsection ssid="22-22-60" dnum="c-o" numlevel="1" lineno="332" slineno="3-112" level="2"><display>(c)</display>A governmental entity may require indemnification as a condition of permitting <ln numlevel="1" lineno="333" slineno="3-113"/>research under this Subsection (8).</subsection><subsection ssid="22-22-61" dnum="d-o" numlevel="1" lineno="334" slineno="3-114" level="2"><display>(d)</display>A governmental entity may not disclose or authorize disclosure of a private record <ln numlevel="1" lineno="335" slineno="3-115"/>for research purposes as described in this Subsection (8) if the private record is a <ln numlevel="1" lineno="336" slineno="3-116"/>record described in Subsection <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>(1)(w).</subsection></subsection><subsection ssid="22-22-62" dnum="9-o" numlevel="1" lineno="337" slineno="3-117" level="1" space="false"><display>(9)</display><subsection ssid="22-22-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Under Subsections <xref depth="3" refnumber="63G-2-201">63G-2-201</xref>(5)(b) and <xref depth="3" refnumber="63G-2-401">63G-2-401</xref>(6), a governmental entity <ln numlevel="1" lineno="338" slineno="3-118"/>may disclose to persons other than those specified in this section records that are:<subsection ssid="22-22-64" dnum="i-o" numlevel="1" lineno="339" slineno="3-119" level="3" tab="1"><display>(i)</display>private under Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>; or</subsection><subsection ssid="22-22-65" dnum="ii-o" numlevel="1" lineno="340" slineno="3-120" level="3" tab="1"><display>(ii)</display>protected under Section <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>, subject to Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref> if a claim for <ln numlevel="1" lineno="341" slineno="3-121"/>business confidentiality has been made under Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>.</subsection></subsection><subsection ssid="22-22-66" dnum="b-o" numlevel="1" lineno="342" slineno="3-122" level="2"><display>(b)</display>Under Subsection <xref depth="3" refnumber="63G-2-403">63G-2-403</xref>(11)(b), the State Records Committee may require the <ln numlevel="1" lineno="343" slineno="3-123"/>disclosure to persons other than those specified in this section of records that are:<subsection ssid="22-22-67" dnum="i-o" numlevel="1" lineno="344" slineno="3-124" level="3"><display>(i)</display>private under Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>;</subsection><subsection ssid="22-22-68" dnum="ii-o" numlevel="1" lineno="345" slineno="3-125" level="3"><display>(ii)</display>controlled under Section <xref depth="3" refnumber="63G-2-304">63G-2-304</xref>; or</subsection><subsection ssid="22-22-69" dnum="iii-o" numlevel="1" lineno="346" slineno="3-126" level="3"><display>(iii)</display>protected under Section <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>, subject to Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref> if a claim for <ln numlevel="1" lineno="347" slineno="3-127"/>business confidentiality has been made under Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>.</subsection></subsection><subsection ssid="22-22-70" dnum="c-o" numlevel="1" lineno="348" slineno="3-128" level="2"><display>(c)</display>Under Subsection <xref depth="3" refnumber="63G-2-404">63G-2-404</xref>(7), the court may require the disclosure of records that <ln numlevel="1" lineno="349" slineno="3-129"/>are private under Section <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>, controlled under Section <xref depth="3" refnumber="63G-2-304">63G-2-304</xref>, or <ln numlevel="1" lineno="350" slineno="3-130"/>protected under Section <xref depth="3" refnumber="63G-2-305">63G-2-305</xref> to persons other than those specified in this <ln numlevel="1" lineno="351" slineno="3-131"/>section.</subsection></subsection><subsection ssid="22-22-71" dnum="10-o" numlevel="1" lineno="352" slineno="3-132" level="1" space="false"><display>(10)</display><subsection ssid="22-22-72" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A private record described in Subsection <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>(2)(f) may only be disclosed <ln numlevel="1" lineno="353" slineno="3-133"/>as provided in Subsection (1)(a)(v).</subsection><subsection ssid="22-22-73" dnum="b-o" numlevel="1" lineno="354" slineno="3-134" level="2"><display>(b)</display>A protected record described in Subsection <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>(43) may only be disclosed as <ln numlevel="1" lineno="355" slineno="3-135"/>provided in Subsection (4)(c) or Section <xref depth="3" refnumber="26B-6-212">26B-6-212</xref>.</subsection></subsection><subsection ssid="22-22-74" dnum="11-o" numlevel="1" lineno="356" slineno="3-136" level="1" space="false"><display>(11)</display><subsection ssid="22-22-75" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A private, protected, or controlled record described in Section <xref depth="3" refnumber="26B-1-506">26B-1-506</xref> shall <ln numlevel="1" lineno="357" slineno="3-137"/>be disclosed as required under:<subsection ssid="22-22-76" dnum="i-o" numlevel="1" lineno="358" slineno="3-138" level="3" tab="1"><display>(i)</display>Subsections <xref depth="3" refnumber="26B-1-506">26B-1-506</xref>(1)(b)<amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>and (2); and</subsection><subsection ssid="22-22-77" dnum="ii-o" numlevel="1" lineno="359" slineno="3-139" level="3" tab="1"><display>(ii)</display>Subsections <xref depth="3" refnumber="26B-1-507">26B-1-507</xref>(1) and (6).</subsection></subsection><subsection ssid="22-22-78" dnum="b-o" numlevel="1" lineno="360" slineno="3-140" level="2"><display>(b)</display>A record disclosed under Subsection (11)(a) shall retain its character as private, <ln numlevel="1" lineno="361" slineno="3-141"/>protected, or controlled.</subsection></subsection></section></bsec><bsec buid="3" num="63G-2-203" type="amend" src="code" uid="C63G-2-S203_2025050720250507" sort="63G02 02030020250507" numlevel="1" lineno="362" slineno="4-1" sn="4"><section number="63G-2-203" numlevel="1" lineno="363" slineno="4-2" type="amend"><secline lineno="362">Section 4, Section <bold>63G-2-203</bold> is amended to read:</secline><catline lineno="363"><bold>63G-2-203. Fees.</bold></catline><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="364" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="3-3-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="63G-2-203(5)" start="0">(5)</xref>, a governmental entity may charge a reasonable fee to <ln numlevel="1" lineno="365" slineno="4-4"/>cover the governmental entity's actual cost of providing a record. </subsection><subsection ssid="3-3-3" dnum="b-o" numlevel="1" lineno="366" slineno="4-5" level="2"><display>(b)</display>A fee under Subsection <xref depth="4" refnumber="63G-2-203(1)(a)" start="0">(1)(a)</xref> shall be approved by the governmental entity's <ln numlevel="1" lineno="367" slineno="4-6"/>executive officer.</subsection></subsection><subsection ssid="3-3-4" dnum="2-o" numlevel="1" lineno="368" slineno="4-7" level="1" space="false"><display>(2)</display><subsection ssid="3-3-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a governmental entity compiles a record in a form other than that normally <ln numlevel="1" lineno="369" slineno="4-8"/>maintained by the governmental entity, the actual costs under this section may <ln numlevel="1" lineno="370" slineno="4-9"/>include the following:<subsection ssid="3-3-6" dnum="i-o" numlevel="1" lineno="371" slineno="4-10" level="3" tab="1"><display>(i)</display>the cost of staff time for compiling, formatting, manipulating, packaging, <ln numlevel="1" lineno="372" slineno="4-11"/>summarizing, or tailoring the record either into an organization or media to meet <ln numlevel="1" lineno="373" slineno="4-12"/>the person's request;</subsection><subsection ssid="3-3-7" dnum="ii-o" numlevel="1" lineno="374" slineno="4-13" level="3" tab="1"><display>(ii)</display>the cost of staff time for search, retrieval, and other direct administrative costs for <ln numlevel="1" lineno="375" slineno="4-14"/>complying with a request; and</subsection><subsection ssid="3-3-8" dnum="iii-o" numlevel="1" lineno="376" slineno="4-15" level="3" tab="1"><display>(iii)</display>in the case of fees for a record that is the result of computer output other than <ln numlevel="1" lineno="377" slineno="4-16"/>word processing, the actual incremental cost of providing the electronic services <ln numlevel="1" lineno="378" slineno="4-17"/>and products together with a reasonable portion of the costs associated with <ln numlevel="1" lineno="379" slineno="4-18"/>formatting or interfacing the information for particular users, and the <ln numlevel="1" lineno="380" slineno="4-19"/>administrative costs as set forth in Subsections <xref depth="4" refnumber="63G-2-203(2)(a)(i)" start="0">(2)(a)(i)</xref> and <xref depth="4" refnumber="63G-2-203(2)(a)(ii)" start="0">(ii)</xref>.</subsection></subsection><subsection ssid="3-3-9" dnum="b-o" numlevel="1" lineno="381" slineno="4-20" level="2"><display>(b)</display>An hourly charge under Subsection <xref depth="4" refnumber="63G-2-203(2)(a)" start="0">(2)(a)</xref> may not exceed the salary of the lowest <ln numlevel="1" lineno="382" slineno="4-21"/>paid employee who, in the discretion of the custodian of records, has the necessary <ln numlevel="1" lineno="383" slineno="4-22"/>skill and training to perform the request.</subsection></subsection><subsection ssid="3-3-10" dnum="3-o" numlevel="1" lineno="384" slineno="4-23" level="1" space="false"><display>(3)</display><subsection ssid="3-3-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Fees shall be established as <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">provided in this Subsection <xref depth="4" refnumber="63G-2-203(3)" start="0">(3)</xref>.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">follows:</amend><subsection ssid="3-3-12" dnum="b-o:i-i" numlevel="1" lineno="385" slineno="4-24" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1188" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>A governmental entity with fees established by the Legislature:<subsection ssid="3-3-13" dnum="i-o:A-i" numlevel="1" lineno="386" slineno="4-25" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1189" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>shall establish the fees defined in Subsection <xref depth="4" refnumber="63G-2-203(2)" start="0">(2)</xref>, or other actual costs <ln numlevel="1" lineno="387" slineno="4-26"/>associated with this section through the budget process; and</subsection><subsection ssid="3-3-14" dnum="ii-o:B-i" numlevel="1" lineno="388" slineno="4-27" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1190" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1" amendtag="both" space="true">(B)</amend></display>may use the procedures of Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref> to set fees until the <ln numlevel="1" lineno="389" slineno="4-28"/>Legislature establishes fees through the budget process.</subsection></subsection><subsection ssid="3-3-15" dnum="c-o:ii-i" numlevel="1" lineno="390" slineno="4-29" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1191" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>Political subdivisions shall establish fees by ordinance or written formal <ln numlevel="1" lineno="391" slineno="4-30"/>policy adopted by the governing body.</subsection><subsection ssid="3-3-16" dnum="d-o:iii-i" numlevel="1" lineno="392" slineno="4-31" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1192" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>The judiciary shall establish fees by rules of the judicial council.</subsection><subsection ssid="3-58" dnum="_-o:iv-i" numlevel="1" lineno="393" slineno="4-32" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1193" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="35" style="1" owner="jchristopherson" level="1" amendtag="end">Any fee, or portion of a fee, that is charged for an employee's time incurred in the <ln numlevel="1" lineno="394" slineno="4-33"/>production of documents, with the exception of costs charged specifically for <ln numlevel="1" lineno="395" slineno="4-34"/>compiling a record in an alternative form as provided under Subsection <xref refnumber="63G-2-203(2)(a)" depth="4">(2)(a)</xref>, <ln numlevel="1" lineno="396" slineno="4-35"/>shall be charged at an hourly rate that is no greater than the actual hourly pay of <ln numlevel="1" lineno="397" slineno="4-36"/>the employee performing the work.</amend></subsection></subsection><subsection ssid="3-53" dnum="_-o:b-i" numlevel="1" lineno="398" slineno="4-37" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">Excluding a law enforcement agency as defined in Section 50-1-102, if fees are <ln numlevel="1" lineno="399" slineno="4-38"/>expected to exceed $50:</amend><subsection ssid="3-60" dnum="_-o:i-i" numlevel="1" lineno="400" slineno="4-39" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1195" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">a governmental entity shall provide an itemized estimate for the expected costs <ln numlevel="1" lineno="401" slineno="4-40"/>before beginning to process a request; and</amend></subsection><subsection ssid="3-61" dnum="_-o:ii-i" numlevel="1" lineno="402" slineno="4-41" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1196" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">a governmental entity may not collect or require any fee or deposit before <ln numlevel="1" lineno="403" slineno="4-42"/>providing the itemized estimate.</amend></subsection></subsection><subsection ssid="3-62" dnum="_-o:c-i" numlevel="1" lineno="404" slineno="4-43" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="end">Excluding a law enforcement agency as defined in Section 50-1-102, if fees are <ln numlevel="1" lineno="405" slineno="4-44"/>expected to exceed $500, in addition to the requirements of Subsection (3)(b), the <ln numlevel="1" lineno="406" slineno="4-45"/>itemized estimate shall include, for any costs expected to be charged for employee <ln numlevel="1" lineno="407" slineno="4-46"/>work time, a listing of the job description of each employee expected to perform <ln numlevel="1" lineno="408" slineno="4-47"/>work in processing the request, the number of hours expected to be charged on behalf <ln numlevel="1" lineno="409" slineno="4-48"/>of each employee's work, and the hourly rate charged for each employee.</amend></subsection></subsection><subsection ssid="3-3-17" dnum="4-o" numlevel="1" lineno="410" slineno="4-49" level="1"><display>(4)</display>A governmental entity may fulfill a record request without charge and is encouraged to <ln numlevel="1" lineno="411" slineno="4-50"/>do so if it determines that:<subsection ssid="3-3-18" dnum="a-o" numlevel="1" lineno="412" slineno="4-51" level="2"><display>(a)</display>releasing the record primarily benefits the public rather than a person;</subsection><subsection ssid="3-3-19" dnum="b-o" numlevel="1" lineno="413" slineno="4-52" level="2"><display>(b)</display>the individual requesting the record is the subject of the record, or an individual <ln numlevel="1" lineno="414" slineno="4-53"/>specified in Subsection <xref depth="4" refnumber="63G-2-202(1)" start="0">63G-2-202(1)</xref> or <xref depth="4" refnumber="63G-2-202(2)" start="0">(2)</xref>; or</subsection><subsection ssid="3-3-20" dnum="c-o" numlevel="1" lineno="415" slineno="4-54" level="2"><display>(c)</display>the requester's legal rights are directly implicated by the information in the record, <ln numlevel="1" lineno="416" slineno="4-55"/>and the requester is impecunious.</subsection></subsection><subsection ssid="3-3-21" dnum="5-o" numlevel="1" lineno="417" slineno="4-56" level="1" space="false"><display>(5)</display><subsection ssid="3-3-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="63G-2-203(5)" start="0">(5)</xref>, "media representative":<subsection ssid="3-3-23" dnum="i-o" numlevel="1" lineno="418" slineno="4-57" level="3" tab="1"><display>(i)</display>means a person who requests a record to obtain information for a story or report <ln numlevel="1" lineno="419" slineno="4-58"/>for publication or broadcast to the general public; and</subsection><subsection ssid="3-3-24" dnum="ii-o" numlevel="1" lineno="420" slineno="4-59" level="3" tab="1"><display>(ii)</display>does not include a person who requests a record to obtain information for a blog, <ln numlevel="1" lineno="421" slineno="4-60"/>podcast, social media account, or other means of mass communication generally <ln numlevel="1" lineno="422" slineno="4-61"/>available to a member of the public.</subsection></subsection><subsection ssid="3-3-25" dnum="b-o" numlevel="1" lineno="423" slineno="4-62" level="2"><display>(b)</display>A governmental entity may not charge a fee for:<subsection ssid="3-3-26" dnum="i-o" numlevel="1" lineno="424" slineno="4-63" level="3"><display>(i)</display>reviewing a record to determine whether it is subject to disclosure, except as <ln numlevel="1" lineno="425" slineno="4-64"/>permitted by Subsection <xref depth="4" refnumber="63G-2-203(2)(a)(ii)" start="0">(2)(a)(ii)</xref>;</subsection><subsection ssid="3-3-27" dnum="ii-o" numlevel="1" lineno="426" slineno="4-65" level="3"><display>(ii)</display>inspecting a record; or</subsection><subsection ssid="3-3-28" dnum="iii-o" numlevel="1" lineno="427" slineno="4-66" level="3"><display>(iii)</display>the first quarter hour of staff time spent in responding to a request under Section <xref depth="3" refnumber="63G-2-204" start="0"><ln numlevel="1" lineno="428" slineno="4-67"/>63G-2-204</xref>.</subsection></subsection><subsection ssid="3-3-29" dnum="c-o" numlevel="1" lineno="429" slineno="4-68" level="2"><display>(c)</display>Notwithstanding Subsection <xref depth="4" refnumber="63G-2-203(5)(b)(iii)" start="0">(5)(b)(iii)</xref>, a governmental entity is not prevented from <ln numlevel="1" lineno="430" slineno="4-69"/>charging a fee for the first quarter hour of staff time spent in responding to a request <ln numlevel="1" lineno="431" slineno="4-70"/>under Section <xref depth="3" refnumber="63G-2-204" start="0">63G-2-204</xref> if the person who submits the request:<subsection ssid="3-3-30" dnum="i-o" numlevel="1" lineno="432" slineno="4-71" level="3"><display>(i)</display>is not a Utah media representative; and</subsection><subsection ssid="3-3-31" dnum="ii-o" numlevel="1" lineno="433" slineno="4-72" level="3"><display>(ii)</display>previously submitted a separate request within the 10-day period immediately <ln numlevel="1" lineno="434" slineno="4-73"/>before the date of the request to which the governmental entity is responding.</subsection></subsection></subsection><subsection ssid="3-3-32" dnum="6-o" numlevel="1" lineno="435" slineno="4-74" level="1" space="false"><display>(6)</display><subsection ssid="3-3-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A person who believes that there has been an unreasonable denial of a fee waiver <ln numlevel="1" lineno="436" slineno="4-75"/>under Subsection <xref depth="4" refnumber="63G-2-203(4)" start="0">(4)</xref> may appeal the denial in the same manner as a person appeals <ln numlevel="1" lineno="437" slineno="4-76"/>when inspection of a public record is denied under Section <xref depth="3" refnumber="63G-2-205" start="0">63G-2-205</xref>.</subsection><subsection ssid="3-3-34" dnum="b-o" numlevel="1" lineno="438" slineno="4-77" level="2"><display>(b)</display>The adjudicative body hearing the appeal:<subsection ssid="3-3-35" dnum="i-o" numlevel="1" lineno="439" slineno="4-78" level="3"><display>(i)</display>shall review the fee waiver de novo, but shall review and consider the <ln numlevel="1" lineno="440" slineno="4-79"/>governmental entity's denial of the fee waiver and any determination under <ln numlevel="1" lineno="441" slineno="4-80"/>Subsection <xref depth="4" refnumber="63G-2-203(4)" start="0">(4)</xref>; and</subsection><subsection ssid="3-3-36" dnum="ii-o" numlevel="1" lineno="442" slineno="4-81" level="3"><display>(ii)</display>has the same authority when a fee waiver or reduction is denied as it has when the <ln numlevel="1" lineno="443" slineno="4-82"/>inspection of a public record is denied.</subsection></subsection></subsection><subsection ssid="3-3-37" dnum="7-o" numlevel="1" lineno="444" slineno="4-83" level="1" space="false"><display>(7)</display><subsection ssid="3-3-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>All fees received under this section by a governmental entity subject to Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="57" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-203(3)(b)" start="0"><ln numlevel="1" lineno="445" slineno="4-84"/>(3)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(a)(i)</amend> shall be retained by the governmental entity as a dedicated credit.</subsection><subsection ssid="3-3-39" dnum="b-o" numlevel="1" lineno="446" slineno="4-85" level="2"><display>(b)</display>Those funds shall be used to recover the actual cost and expenses incurred by the <ln numlevel="1" lineno="447" slineno="4-86"/>governmental entity in providing the requested record or record series.</subsection></subsection><subsection ssid="3-3-40" dnum="8-o" numlevel="1" lineno="448" slineno="4-87" level="1" space="false"><display>(8)</display><subsection ssid="3-3-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity may require payment of past fees and future estimated fees <ln numlevel="1" lineno="449" slineno="4-88"/>before beginning to process a request if:<subsection ssid="3-3-42" dnum="i-o" numlevel="1" lineno="450" slineno="4-89" level="3" tab="1"><display>(i)</display>fees are expected to exceed $50; or</subsection><subsection ssid="3-3-43" dnum="ii-o" numlevel="1" lineno="451" slineno="4-90" level="3" tab="1"><display>(ii)</display>the requester has not paid fees from previous requests.</subsection></subsection><subsection ssid="3-3-44" dnum="b-o" numlevel="1" lineno="452" slineno="4-91" level="2"><display>(b)</display>Any prepaid amount in excess of fees due shall be returned to the requester.</subsection></subsection><subsection ssid="3-3-45" dnum="9-o" numlevel="1" lineno="453" slineno="4-92" level="1"><display>(9)</display>This section does not alter, repeal, or reduce fees established by other statutes or <ln numlevel="1" lineno="454" slineno="4-93"/>legislative acts.</subsection><subsection ssid="3-3-46" dnum="10-o" numlevel="1" lineno="455" slineno="4-94" level="1" space="false"><display>(10)</display><subsection ssid="3-3-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="58" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="63G-2-203(3)(c)" start="0">(3)(c)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="74" groupid="56" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)(a)(ii)</amend>, fees for voter registration records <ln numlevel="1" lineno="456" slineno="4-95"/>shall be set as provided in this Subsection <xref depth="4" refnumber="63G-2-203(10)" start="0">(10)</xref>.</subsection><subsection ssid="3-3-48" dnum="b-o" numlevel="1" lineno="457" slineno="4-96" level="2"><display>(b)</display>The lieutenant governor shall:<subsection ssid="3-3-49" dnum="i-o" numlevel="1" lineno="458" slineno="4-97" level="3"><display>(i)</display>after consultation with county clerks, establish uniform fees for voter registration <ln numlevel="1" lineno="459" slineno="4-98"/>and voter history records that meet the requirements of this section; and</subsection><subsection ssid="3-3-50" dnum="ii-o" numlevel="1" lineno="460" slineno="4-99" level="3"><display>(ii)</display>obtain legislative approval of those fees by following the procedures and <ln numlevel="1" lineno="461" slineno="4-100"/>requirements of Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>.</subsection></subsection></subsection><subsection ssid="3-64" dnum="_-o:11-i" numlevel="1" lineno="462" slineno="4-101" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">If fees are charged for providing a local education agency employee's work-related <ln numlevel="1" lineno="463" slineno="4-102"/>contact information, a governmental entity shall comply with the requirements of <ln numlevel="1" lineno="464" slineno="4-103"/>Section <xref depth="3" refnumber="53G-10-207">53G-10-207</xref>.</amend></subsection></section></bsec><bsec buid="10" num="63G-2-401" type="amend" src="code" uid="C63G-2-S401_2025050720250507" sort="63G02 04010020250507" numlevel="1" lineno="465" slineno="5-1" sn="5"><section number="63G-2-401" numlevel="1" lineno="466" slineno="5-2" type="amend"><secline lineno="465">Section 5, Section <bold>63G-2-401</bold> is amended to read:</secline><catline lineno="466"><bold>63G-2-401.  Appeal to chief administrative officer -- Appeal of fee estimate <ln numlevel="1" lineno="467" slineno="5-3"/>directly to records committee -- Notice of the decision of the appeal.</bold></catline><subsection ssid="10-10-1" dnum="1-o" numlevel="1" lineno="468" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="10-10-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A requester or interested party may appeal an access denial<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="198" groupid="149" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="196" groupid="147" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> the denial of a fee <ln numlevel="1" lineno="469" slineno="5-5"/>waiver under Subsection <xref depth="3" refnumber="63G-2-203">63G-2-203</xref>(4)<amend anum="0" ea="amend" pairid="197" groupid="148" style="1" owner="jchristopherson" level="1" amendtag="both">, or an estimate of a fee amount under <ln numlevel="1" lineno="470" slineno="5-6"/>Subsection <xref refnumber="63G-2-203(3)" depth="4">63G-2-203(3)</xref></amend> to the chief administrative officer of the governmental <ln numlevel="1" lineno="471" slineno="5-7"/>entity by filing a notice of appeal with the chief administrative officer within 30 days <ln numlevel="1" lineno="472" slineno="5-8"/>after:<subsection ssid="10-10-3" dnum="i-o" numlevel="1" lineno="473" slineno="5-9" level="3" tab="1"><display>(i)</display>for an access denial:<subsection ssid="10-10-4" dnum="A-o" numlevel="1" lineno="474" slineno="5-10" level="4"><display>(A)</display>the governmental entity sends a notice of denial under Section <xref depth="3" refnumber="63G-2-205">63G-2-205</xref>, if <ln numlevel="1" lineno="475" slineno="5-11"/>the governmental entity denies a record request under Subsection <xref depth="3" refnumber="63G-2-205">63G-2-205</xref><ln numlevel="1" lineno="476" slineno="5-12"/>(1); or</subsection><subsection ssid="10-10-5" dnum="B-o" numlevel="1" lineno="477" slineno="5-13" level="4"><display>(B)</display>the record request is considered denied under Subsection <xref depth="3" refnumber="63G-2-204">63G-2-204</xref>(9), if that <ln numlevel="1" lineno="478" slineno="5-14"/>subsection applies; or</subsection></subsection><subsection ssid="10-10-6" dnum="ii-o" numlevel="1" lineno="479" slineno="5-15" level="3" tab="1"><display>(ii)</display>for a denial of a fee waiver, the date the governmental entity notifies the requester <ln numlevel="1" lineno="480" slineno="5-16"/>that the fee waiver is denied.</subsection></subsection><subsection ssid="10-10-7" dnum="b-o" numlevel="1" lineno="481" slineno="5-17" level="2"><display>(b)</display>If a governmental entity claims extraordinary circumstances and specifies the date <ln numlevel="1" lineno="482" slineno="5-18"/>when the records will be available under Subsection <xref depth="3" refnumber="63G-2-204">63G-2-204</xref>(4), and, if the <ln numlevel="1" lineno="483" slineno="5-19"/>requester believes the extraordinary circumstances do not exist or that the date <ln numlevel="1" lineno="484" slineno="5-20"/>specified is unreasonable, the requester may appeal the governmental entity's claim <ln numlevel="1" lineno="485" slineno="5-21"/>of extraordinary circumstances or date for compliance to the chief administrative <ln numlevel="1" lineno="486" slineno="5-22"/>officer by filing a notice of appeal with the chief administrative officer within 30 <ln numlevel="1" lineno="487" slineno="5-23"/>days after notification of a claim of extraordinary circumstances by the governmental <ln numlevel="1" lineno="488" slineno="5-24"/>entity, despite the lack of a "determination" or its equivalent under Subsection <xref depth="3" refnumber="63G-2-204"><ln numlevel="1" lineno="489" slineno="5-25"/>63G-2-204</xref>(9).</subsection><subsection ssid="10-50" dnum="_-o:c-i" numlevel="1" lineno="490" slineno="5-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="191" groupid="142" style="1" owner="jchristopherson" level="1" amendtag="end">As an alternative to the appeal permitted under Subsection <xref refnumber="63G-2-401(1)(a)" depth="4">(1)(a)</xref>, a requester or <ln numlevel="1" lineno="491" slineno="5-27"/>interested party may appeal the governmental entity's estimate of a fee amount under <ln numlevel="1" lineno="492" slineno="5-28"/>Subsection <xref refnumber="63G-2-203(3)" depth="4">63G-2-203(3)</xref> directly to the records committee as provided under Section <xref depth="3" refnumber="63G-2-403"><ln numlevel="1" lineno="493" slineno="5-29"/>63G-2-403</xref> if the estimated fee amount exceeds $500.</amend></subsection></subsection><subsection ssid="10-10-8" dnum="2-o" numlevel="1" lineno="494" slineno="5-30" level="1"><display>(2)</display>A notice of appeal shall contain:<subsection ssid="10-10-9" dnum="a-o" numlevel="1" lineno="495" slineno="5-31" level="2"><display>(a)</display>the name, mailing address, and daytime telephone number of the requester or <ln numlevel="1" lineno="496" slineno="5-32"/>interested party; and</subsection><subsection ssid="10-10-10" dnum="b-o" numlevel="1" lineno="497" slineno="5-33" level="2"><display>(b)</display>the relief sought.</subsection></subsection><subsection ssid="10-10-11" dnum="3-o" numlevel="1" lineno="498" slineno="5-34" level="1"><display>(3)</display>The requester or interested party may file a short statement of facts, reasons, and legal <ln numlevel="1" lineno="499" slineno="5-35"/>authority in support of the appeal.</subsection><subsection ssid="10-10-12" dnum="4-o" numlevel="1" lineno="500" slineno="5-36" level="1" space="false"><display>(4)</display><subsection ssid="10-10-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the appeal involves a record that is the subject of a business confidentiality <ln numlevel="1" lineno="501" slineno="5-37"/>claim under Section <xref depth="3" refnumber="63G-2-309">63G-2-309</xref>, the chief administrative officer shall:<subsection ssid="10-10-14" dnum="i-o" numlevel="1" lineno="502" slineno="5-38" level="3" tab="1"><display>(i)</display>send notice of the appeal to the business confidentiality claimant within three <ln numlevel="1" lineno="503" slineno="5-39"/>business days after receiving notice, except that if notice under this section must <ln numlevel="1" lineno="504" slineno="5-40"/>be given to more than 35 persons, it shall be given as soon as reasonably possible; <ln numlevel="1" lineno="505" slineno="5-41"/>and</subsection><subsection ssid="10-10-15" dnum="ii-o" numlevel="1" lineno="506" slineno="5-42" level="3" tab="1"><display>(ii)</display>send notice of the business confidentiality claim and the schedule for the chief <ln numlevel="1" lineno="507" slineno="5-43"/>administrative officer's determination to the requester or interested party within <ln numlevel="1" lineno="508" slineno="5-44"/>three business days after receiving notice of the appeal.</subsection></subsection><subsection ssid="10-10-16" dnum="b-o" numlevel="1" lineno="509" slineno="5-45" level="2"><display>(b)</display>The business confidentiality claimant shall have seven business days after notice is <ln numlevel="1" lineno="510" slineno="5-46"/>sent by the administrative officer to submit further support for the claim of business <ln numlevel="1" lineno="511" slineno="5-47"/>confidentiality.</subsection></subsection><subsection ssid="10-10-17" dnum="5-o" numlevel="1" lineno="512" slineno="5-48" level="1" space="false"><display>(5)</display><subsection ssid="10-10-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The chief administrative officer shall make a decision on the appeal within:<subsection ssid="10-10-19" dnum="i-o" numlevel="1" lineno="513" slineno="5-49" level="3" tab="1" space="false"><display>(i)</display><subsection ssid="10-10-20" dnum="A-o" level="4" placement="sameline"><display>(A)</display>10 business days after the chief administrative officer's receipt of the notice <ln numlevel="1" lineno="514" slineno="5-50"/>of appeal; or</subsection><subsection ssid="10-10-21" dnum="B-o" numlevel="1" lineno="515" slineno="5-51" level="4"><display>(B)</display>five business days after the chief administrative officer's receipt of the notice <ln numlevel="1" lineno="516" slineno="5-52"/>of appeal, if the requester or interested party demonstrates that an expedited <ln numlevel="1" lineno="517" slineno="5-53"/>decision benefits the public rather than the requester or interested party; or</subsection></subsection><subsection ssid="10-10-22" dnum="ii-o" numlevel="1" lineno="518" slineno="5-54" level="3" tab="1"><display>(ii)</display>12 business days after the governmental entity sends the notice of appeal to a <ln numlevel="1" lineno="519" slineno="5-55"/>person who submitted a claim of business confidentiality.</subsection></subsection><subsection ssid="10-10-23" dnum="b-o" numlevel="1" lineno="520" slineno="5-56" level="2" space="false"><display>(b)</display><subsection ssid="10-10-24" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the chief administrative officer fails to make a decision on an appeal of an <ln numlevel="1" lineno="521" slineno="5-57"/>access denial within the time specified in Subsection (5)(a), the failure is the <ln numlevel="1" lineno="522" slineno="5-58"/>equivalent of a decision affirming the access denial.</subsection><subsection ssid="10-10-25" dnum="ii-o" numlevel="1" lineno="523" slineno="5-59" level="3"><display>(ii)</display>If the chief administrative officer fails to make a decision on an appeal under <ln numlevel="1" lineno="524" slineno="5-60"/>Subsection (1)(b) within the time specified in Subsection (5)(a), the failure is the <ln numlevel="1" lineno="525" slineno="5-61"/>equivalent of a decision affirming the claim of extraordinary circumstances or the <ln numlevel="1" lineno="526" slineno="5-62"/>reasonableness of the date specified when the records will be available.</subsection></subsection><subsection ssid="10-10-26" dnum="c-o" numlevel="1" lineno="527" slineno="5-63" level="2"><display>(c)</display>The provisions of this section notwithstanding, the parties participating in the <ln numlevel="1" lineno="528" slineno="5-64"/>proceeding may, by agreement, extend the time periods specified in this section.</subsection></subsection><subsection ssid="10-10-27" dnum="6-o" numlevel="1" lineno="529" slineno="5-65" level="1"><display>(6)</display>Except as provided in Section <xref depth="3" refnumber="63G-2-406">63G-2-406</xref>, the chief administrative officer may, upon <ln numlevel="1" lineno="530" slineno="5-66"/>consideration and weighing of the various interests and public policies pertinent to the <ln numlevel="1" lineno="531" slineno="5-67"/>classification and disclosure or nondisclosure, order the disclosure of information <ln numlevel="1" lineno="532" slineno="5-68"/>properly classified as private under Subsection <xref depth="3" refnumber="63G-2-302">63G-2-302</xref>(2) or protected under Section <xref depth="3" refnumber="63G-2-305"><ln numlevel="1" lineno="533" slineno="5-69"/>63G-2-305</xref> if the interests favoring access are greater than or equal to the interests <ln numlevel="1" lineno="534" slineno="5-70"/>favoring restriction of access.</subsection><subsection ssid="10-10-28" dnum="7-o" numlevel="1" lineno="535" slineno="5-71" level="1" space="false"><display>(7)</display><subsection ssid="10-10-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governmental entity shall send written notice of the chief administrative <ln numlevel="1" lineno="536" slineno="5-72"/>officer's decision to all participants.</subsection><subsection ssid="10-10-30" dnum="b-o" numlevel="1" lineno="537" slineno="5-73" level="2"><display>(b)</display>If the chief administrative officer's decision is to affirm the access denial in whole or <ln numlevel="1" lineno="538" slineno="5-74"/>in part or to affirm the fee waiver denial, the notice under Subsection (7)(a) shall <ln numlevel="1" lineno="539" slineno="5-75"/>include:<subsection ssid="10-10-31" dnum="i-o" numlevel="1" lineno="540" slineno="5-76" level="3"><display>(i)</display>a statement that the requester has a right under Section <xref depth="3" refnumber="63A-12-111">63A-12-111</xref> to request the <ln numlevel="1" lineno="541" slineno="5-77"/>government records ombudsman to mediate the dispute between the requester and <ln numlevel="1" lineno="542" slineno="5-78"/>the governmental entity concerning the access denial or the fee waiver denial;</subsection><subsection ssid="10-10-32" dnum="ii-o" numlevel="1" lineno="543" slineno="5-79" level="3"><display>(ii)</display>a statement that the requester or interested party has the right to appeal the <ln numlevel="1" lineno="544" slineno="5-80"/>decision, as provided in Section <xref depth="3" refnumber="63G-2-402">63G-2-402</xref>, to:<subsection ssid="10-10-33" dnum="A-o" numlevel="1" lineno="545" slineno="5-81" level="4"><display>(A)</display>the State Records Committee or district court; or</subsection><subsection ssid="10-10-34" dnum="B-o" numlevel="1" lineno="546" slineno="5-82" level="4"><display>(B)</display>the local appeals board, if the governmental entity is a political subdivision <ln numlevel="1" lineno="547" slineno="5-83"/>and the governmental entity has established a local appeals board;</subsection></subsection><subsection ssid="10-10-35" dnum="iii-o" numlevel="1" lineno="548" slineno="5-84" level="3"><display>(iii)</display>the time limits for filing an appeal described in Subsection (7)(b)(ii), including <ln numlevel="1" lineno="549" slineno="5-85"/>an explanation of a suspension of the time limits, as provided in Subsections <xref depth="3" refnumber="63G-2-403"><ln numlevel="1" lineno="550" slineno="5-86"/>63G-2-403</xref>(1)(c) and <xref depth="3" refnumber="63G-2-404">63G-2-404</xref>(1)(b), for a requester if the requester seeks <ln numlevel="1" lineno="551" slineno="5-87"/>mediation under Section <xref depth="3" refnumber="63A-12-111">63A-12-111</xref>; and</subsection><subsection ssid="10-10-36" dnum="iv-o" numlevel="1" lineno="552" slineno="5-88" level="3"><display>(iv)</display>the name and business address of:<subsection ssid="10-10-37" dnum="A-o" numlevel="1" lineno="553" slineno="5-89" level="4"><display>(A)</display>the executive secretary of the State Records Committee; </subsection><subsection ssid="10-10-38" dnum="B-o" numlevel="1" lineno="554" slineno="5-90" level="4"><display>(B)</display>the individual designated as the contact individual for the appeals board, if the <ln numlevel="1" lineno="555" slineno="5-91"/>governmental entity is a political subdivision that has established an appeals <ln numlevel="1" lineno="556" slineno="5-92"/>board under Subsection <xref depth="3" refnumber="63G-2-701">63G-2-701</xref>(5)(c); and</subsection><subsection ssid="10-10-39" dnum="C-o" numlevel="1" lineno="557" slineno="5-93" level="4"><display>(C)</display>the government records ombudsman.</subsection></subsection></subsection></subsection><subsection ssid="10-10-40" dnum="8-o" numlevel="1" lineno="558" slineno="5-94" level="1"><display>(8)</display>A person aggrieved by a governmental entity's classification or designation <ln numlevel="1" lineno="559" slineno="5-95"/>determination under this chapter, but who is not requesting access to the records, may <ln numlevel="1" lineno="560" slineno="5-96"/>appeal that determination using the procedures provided in this section.  If a <ln numlevel="1" lineno="561" slineno="5-97"/>nonrequester is the only appellant, the procedures provided in this section shall apply, <ln numlevel="1" lineno="562" slineno="5-98"/>except that the decision on the appeal shall be made within 30 days after receiving the <ln numlevel="1" lineno="563" slineno="5-99"/>notice of appeal.</subsection><subsection ssid="10-10-41" dnum="9-o" numlevel="1" lineno="564" slineno="5-100" level="1"><display>(9)</display>The duties of the chief administrative officer under this section may be delegated.</subsection></section></bsec><bsec buid="7" num="63G-2-402" type="amend" src="code" uid="C63G-2-S402_2025050720250507" sort="63G02 04020020250507" numlevel="1" lineno="565" slineno="6-1" sn="6"><section number="63G-2-402" numlevel="1" lineno="566" slineno="6-2" type="amend"><secline lineno="565">Section 6, Section <bold>63G-2-402</bold> is amended to read:</secline><catline lineno="566"><bold>63G-2-402. Appealing a decision of a chief administrative officer.</bold></catline><subsection ssid="7-7-1" dnum="1-o" numlevel="1" lineno="567" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>If the decision of the chief administrative officer of a governmental entity under Section <xref depth="3" refnumber="63G-2-401"><ln numlevel="1" lineno="568" slineno="6-4"/>63G-2-401</xref> is to affirm the denial of a record request<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> to affirm the denial of a fee <ln numlevel="1" lineno="569" slineno="6-5"/>waiver, <amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both">or to affirm the estimate of a fee amount, </amend>the requester may:<subsection ssid="7-7-2" dnum="a-o" numlevel="1" lineno="570" slineno="6-6" level="2" space="false"><display>(a)</display><subsection ssid="7-7-3" dnum="i-o" level="3" placement="sameline"><display>(i)</display>appeal the decision to the State Records Committee, as provided in Section <xref depth="3" refnumber="63G-2-403"><ln numlevel="1" lineno="571" slineno="6-7"/>63G-2-403</xref>; or</subsection><subsection ssid="7-7-4" dnum="ii-o" numlevel="1" lineno="572" slineno="6-8" level="3"><display>(ii)</display>petition for judicial review of the decision in district court, as provided in Section <xref depth="3" refnumber="63G-2-404"><ln numlevel="1" lineno="573" slineno="6-9"/>63G-2-404</xref>; </subsection></subsection><subsection ssid="7-7-5" dnum="b-o" numlevel="1" lineno="574" slineno="6-10" level="2"><display>(b)</display>seek mediation of the access denial<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> fee waiver denial<amend anum="0" ea="amend" pairid="8" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">, or fee amount affirmation</amend> <ln numlevel="1" lineno="575" slineno="6-11"/>under Subsection <xref depth="3" refnumber="63A-12-111">63A-12-111</xref>(2)(c); or</subsection><subsection ssid="7-7-6" dnum="c-o" numlevel="1" lineno="576" slineno="6-12" level="2"><display>(c)</display>appeal the decision to the local appeals board if:<subsection ssid="7-7-7" dnum="i-o" numlevel="1" lineno="577" slineno="6-13" level="3"><display>(i)</display>the decision is of a chief administrative officer of a governmental entity that is a <ln numlevel="1" lineno="578" slineno="6-14"/>political subdivision; and</subsection><subsection ssid="7-7-8" dnum="ii-o" numlevel="1" lineno="579" slineno="6-15" level="3"><display>(ii)</display>the political subdivision has established a local appeals board.</subsection></subsection></subsection><subsection ssid="7-7-9" dnum="2-o" numlevel="1" lineno="580" slineno="6-16" level="1"><display>(2)</display>A requester who appeals a chief administrative officer's decision to the State Records <ln numlevel="1" lineno="581" slineno="6-17"/>Committee or a local appeals board does not lose or waive the right to seek judicial <ln numlevel="1" lineno="582" slineno="6-18"/>review of the decision of the State Records Committee or local appeals board.</subsection><subsection ssid="7-7-10" dnum="3-o" numlevel="1" lineno="583" slineno="6-19" level="1"><display>(3)</display>As provided in Section <xref depth="3" refnumber="63G-2-403">63G-2-403</xref>, an interested party may appeal to the State Records <ln numlevel="1" lineno="584" slineno="6-20"/>Committee a chief administrative officer's decision under Section <xref depth="3" refnumber="63G-2-401">63G-2-401</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"> affirming <ln numlevel="1" lineno="585" slineno="6-21"/>an access denial</amend><amendoutend style="2"/>.</subsection></section></bsec><bsec buid="12" num="63G-2-403" type="amend" src="code" uid="C63G-2-S403_2025050720250507" sort="63G02 04030020250507" numlevel="1" lineno="586" slineno="7-1" sn="7"><section number="63G-2-403" numlevel="1" lineno="587" slineno="7-2" type="amend"><secline lineno="586">Section 7, Section <bold>63G-2-403</bold> is amended to read:</secline><catline lineno="587"><bold>63G-2-403. Appeals to the State Records Committee.</bold></catline><subsection ssid="12-12-1" dnum="1-o" numlevel="1" lineno="588" slineno="7-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="12-12-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A records committee appellant appeals to the State Records Committee by filing a <ln numlevel="1" lineno="589" slineno="7-4"/>notice of appeal with the executive secretary of the State Records Committee no later <ln numlevel="1" lineno="590" slineno="7-5"/>than 30 days after the date of issuance of the decision being appealed.</subsection><subsection ssid="12-12-3" dnum="b-o" numlevel="1" lineno="591" slineno="7-6" level="2"><display>(b)</display>Notwithstanding Subsection (1)(a), a requester may file a notice of appeal with the <ln numlevel="1" lineno="592" slineno="7-7"/>executive secretary of the State Records Committee no later than 45 days after the <ln numlevel="1" lineno="593" slineno="7-8"/>day on which the record request is made if:<subsection ssid="12-12-4" dnum="i-o" numlevel="1" lineno="594" slineno="7-9" level="3"><display>(i)</display>the circumstances described in Subsection <xref depth="3" refnumber="63G-2-401">63G-2-401</xref>(1)(b) occur; and</subsection><subsection ssid="12-12-5" dnum="ii-o" numlevel="1" lineno="595" slineno="7-10" level="3"><display>(ii)</display>the chief administrative officer fails to make a decision under Section <xref depth="3" refnumber="63G-2-401">63G-2-401</xref>.</subsection></subsection><subsection ssid="12-12-6" dnum="c-o" numlevel="1" lineno="596" slineno="7-11" level="2"><display>(c)</display>The time for a requester to file a notice of appeal under Subsection (1)(a) or (b) is <ln numlevel="1" lineno="597" slineno="7-12"/>suspended for the period of time that:<subsection ssid="12-12-7" dnum="i-o" numlevel="1" lineno="598" slineno="7-13" level="3"><display>(i)</display>begins the date the requester submits a request under Section <xref depth="3" refnumber="63A-12-111">63A-12-111</xref> for the <ln numlevel="1" lineno="599" slineno="7-14"/>government records ombudsman to mediate the dispute between the requester and <ln numlevel="1" lineno="600" slineno="7-15"/>the governmental entity; and</subsection><subsection ssid="12-12-8" dnum="ii-o" numlevel="1" lineno="601" slineno="7-16" level="3"><display>(ii)</display>ends the earlier of the following dates:<subsection ssid="12-12-9" dnum="A-o" numlevel="1" lineno="602" slineno="7-17" level="4"><display>(A)</display>the date that the government records ombudsman certifies in writing that the <ln numlevel="1" lineno="603" slineno="7-18"/>mediation is concluded; or</subsection><subsection ssid="12-12-10" dnum="B-o" numlevel="1" lineno="604" slineno="7-19" level="4"><display>(B)</display>the date that the government records ombudsman certifies in writing that the <ln numlevel="1" lineno="605" slineno="7-20"/>mediation did not occur or was not concluded because of a lack of the required <ln numlevel="1" lineno="606" slineno="7-21"/>consent.</subsection></subsection></subsection></subsection><subsection ssid="12-12-11" dnum="2-o" numlevel="1" lineno="607" slineno="7-22" level="1"><display>(2)</display>The notice of appeal shall:<subsection ssid="12-12-12" dnum="a-o" numlevel="1" lineno="608" slineno="7-23" level="2"><display>(a)</display>contain the name, mailing address, and daytime telephone number of the records <ln numlevel="1" lineno="609" slineno="7-24"/>committee appellant;</subsection><subsection ssid="12-12-13" dnum="b-o" numlevel="1" lineno="610" slineno="7-25" level="2"><display>(b)</display>be accompanied by a copy of the decision being appealed; and</subsection><subsection ssid="12-12-14" dnum="c-o" numlevel="1" lineno="611" slineno="7-26" level="2"><display>(c)</display>state the relief sought.</subsection></subsection><subsection ssid="12-12-15" dnum="3-o" numlevel="1" lineno="612" slineno="7-27" level="1"><display>(3)</display>The records committee appellant:<subsection ssid="12-12-16" dnum="a-o" numlevel="1" lineno="613" slineno="7-28" level="2"><display>(a)</display>shall, on the day on which the notice of appeal is filed with the State Records <ln numlevel="1" lineno="614" slineno="7-29"/>Committee, serve a copy of the notice of appeal on:<subsection ssid="12-12-17" dnum="i-o" numlevel="1" lineno="615" slineno="7-30" level="3"><display>(i)</display>the governmental entity whose access denial<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="68" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="47" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> fee waiver denial<amend anum="0" ea="amend" pairid="66" groupid="48" style="1" owner="jchristopherson" level="1" amendtag="both">, or fee amount <ln numlevel="1" lineno="616" slineno="7-31"/>estimate</amend> is the subject of the appeal, if the records committee appellant is a <ln numlevel="1" lineno="617" slineno="7-32"/>requester or interested party; or</subsection><subsection ssid="12-12-18" dnum="ii-o" numlevel="1" lineno="618" slineno="7-33" level="3"><display>(ii)</display>the requester or interested party who is a party to the local appeals board <ln numlevel="1" lineno="619" slineno="7-34"/>proceeding that resulted in the decision that the political subdivision is appealing <ln numlevel="1" lineno="620" slineno="7-35"/>to the committee, if the records committee appellant is a political subdivision; and</subsection></subsection><subsection ssid="12-12-19" dnum="b-o" numlevel="1" lineno="621" slineno="7-36" level="2"><display>(b)</display>may file a short statement of facts, reasons, and legal authority in support of the <ln numlevel="1" lineno="622" slineno="7-37"/>appeal.</subsection></subsection><subsection ssid="12-12-20" dnum="4-o" numlevel="1" lineno="623" slineno="7-38" level="1" space="false"><display>(4)</display><subsection ssid="12-12-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsections (4)(b) and (c), no later than seven business <ln numlevel="1" lineno="624" slineno="7-39"/>days after receiving a notice of appeal, the executive secretary of the State Records <ln numlevel="1" lineno="625" slineno="7-40"/>Committee shall:<subsection ssid="12-12-22" dnum="i-o" numlevel="1" lineno="626" slineno="7-41" level="3" tab="1"><display>(i)</display>schedule a hearing for the State Records Committee to discuss the appeal at the <ln numlevel="1" lineno="627" slineno="7-42"/>next regularly scheduled committee meeting falling at least 16 days after the date <ln numlevel="1" lineno="628" slineno="7-43"/>the notice of appeal is filed but no longer than 64 calendar days after the date the <ln numlevel="1" lineno="629" slineno="7-44"/>notice of appeal was filed except that the committee may schedule an expedited <ln numlevel="1" lineno="630" slineno="7-45"/>hearing upon application of the records committee appellant and good cause <ln numlevel="1" lineno="631" slineno="7-46"/>shown;</subsection><subsection ssid="12-12-23" dnum="ii-o" numlevel="1" lineno="632" slineno="7-47" level="3" tab="1"><display>(ii)</display>send a copy of the notice of hearing to the records committee appellant; and</subsection><subsection ssid="12-12-24" dnum="iii-o" numlevel="1" lineno="633" slineno="7-48" level="3" tab="1"><display>(iii)</display>send a copy of the notice of appeal, supporting statement, and a notice of hearing <ln numlevel="1" lineno="634" slineno="7-49"/>to:<subsection ssid="12-12-25" dnum="A-o" numlevel="1" lineno="635" slineno="7-50" level="4"><display>(A)</display>each member of the State Records Committee;</subsection><subsection ssid="12-12-26" dnum="B-o" numlevel="1" lineno="636" slineno="7-51" level="4"><display>(B)</display>the records officer and the chief administrative officer of the governmental <ln numlevel="1" lineno="637" slineno="7-52"/>entity whose access denial<amend anum="0" ea="amend" pairid="67" groupid="49" style="1" owner="jchristopherson" level="1" amendtag="both"> or fee dispute</amend> is the subject of the appeal, if the <ln numlevel="1" lineno="638" slineno="7-53"/>records committee appellant is a requester or interested party;</subsection><subsection ssid="12-12-27" dnum="C-o" numlevel="1" lineno="639" slineno="7-54" level="4"><display>(C)</display>any person who made a business confidentiality claim under Section <xref depth="3" refnumber="63G-2-309"><ln numlevel="1" lineno="640" slineno="7-55"/>63G-2-309</xref> for a record that is the subject of the appeal; and</subsection><subsection ssid="12-12-28" dnum="D-o" numlevel="1" lineno="641" slineno="7-56" level="4"><display>(D)</display><amend anum="0" ea="amend" pairid="60" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both">if the appeal is of a chief administrative officer's decision affirming an access <ln numlevel="1" lineno="642" slineno="7-57"/>denial, </amend>all persons who participated in the proceedings before the governmental <ln numlevel="1" lineno="643" slineno="7-58"/>entity's chief administrative officer<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="61" groupid="43" style="2" owner="jchristopherson" level="1" deltag="both">, if the appeal is of the chief administrative <ln numlevel="1" lineno="644" slineno="7-59"/>officer's decision affirming an access denial</amend><amendoutend style="2"/>.</subsection></subsection></subsection><subsection ssid="12-12-29" dnum="b-o" numlevel="1" lineno="645" slineno="7-60" level="2" space="false"><display>(b)</display><subsection ssid="12-12-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The executive secretary of the State Records Committee may decline to <ln numlevel="1" lineno="646" slineno="7-61"/>schedule a hearing if the record series that is the subject of the appeal has been <ln numlevel="1" lineno="647" slineno="7-62"/>found by the committee in a previous hearing involving the same governmental <ln numlevel="1" lineno="648" slineno="7-63"/>entity to be appropriately classified as private, controlled, or protected.</subsection><subsection ssid="12-12-31" dnum="ii-o" numlevel="1" lineno="649" slineno="7-64" level="3" space="false"><display>(ii)</display><subsection ssid="12-12-32" dnum="A-o" level="4" placement="sameline"><display>(A)</display>If the executive secretary of the State Records Committee declines to <ln numlevel="1" lineno="650" slineno="7-65"/>schedule a hearing, the executive secretary shall send a notice to the records <ln numlevel="1" lineno="651" slineno="7-66"/>committee appellant indicating that the request for hearing has been denied and <ln numlevel="1" lineno="652" slineno="7-67"/>the reason for the denial.</subsection><subsection ssid="12-12-33" dnum="B-o" numlevel="1" lineno="653" slineno="7-68" level="4"><display>(B)</display>The State Records Committee shall make rules to implement this section as <ln numlevel="1" lineno="654" slineno="7-69"/>provided by Title 63G, Chapter 3, Utah Administrative Rulemaking Act.</subsection></subsection></subsection><subsection ssid="12-12-34" dnum="c-o" numlevel="1" lineno="655" slineno="7-70" level="2"><display>(c)</display>The executive secretary of the State Records Committee may schedule a hearing on <ln numlevel="1" lineno="656" slineno="7-71"/>an appeal to the State Records Committee at a regularly scheduled State Records <ln numlevel="1" lineno="657" slineno="7-72"/>Committee meeting that is later than the period described in Subsection (4)(a)(i) if <ln numlevel="1" lineno="658" slineno="7-73"/>that committee meeting is the first regularly scheduled State Records Committee <ln numlevel="1" lineno="659" slineno="7-74"/>meeting at which there are fewer than 10 appeals scheduled to be heard.</subsection></subsection><subsection ssid="12-12-35" dnum="5-o" numlevel="1" lineno="660" slineno="7-75" level="1" space="false"><display>(5)</display><subsection ssid="12-12-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>No later than five business days before the hearing, a governmental entity shall <ln numlevel="1" lineno="661" slineno="7-76"/>submit to the executive secretary of the State Records Committee a written statement <ln numlevel="1" lineno="662" slineno="7-77"/>of facts, reasons, and legal authority in support of the governmental entity's position.</subsection><subsection ssid="12-12-37" dnum="b-o" numlevel="1" lineno="663" slineno="7-78" level="2"><display>(b)</display>The governmental entity shall send a copy of the written statement by first class <ln numlevel="1" lineno="664" slineno="7-79"/>mail, postage prepaid, to the requester or interested party involved in the appeal.  The <ln numlevel="1" lineno="665" slineno="7-80"/>executive secretary shall forward a copy of the written statement to each member of <ln numlevel="1" lineno="666" slineno="7-81"/>the State Records Committee.</subsection></subsection><subsection ssid="12-12-38" dnum="6-o" numlevel="1" lineno="667" slineno="7-82" level="1" space="false"><display>(6)</display><subsection ssid="12-12-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>No later than 10 business days after the day on which the executive secretary <ln numlevel="1" lineno="668" slineno="7-83"/>sends the notice of appeal, a person whose legal interests may be substantially <ln numlevel="1" lineno="669" slineno="7-84"/>affected by the proceeding may file a request for intervention with the State Records <ln numlevel="1" lineno="670" slineno="7-85"/>Committee.</subsection><subsection ssid="12-12-40" dnum="b-o" numlevel="1" lineno="671" slineno="7-86" level="2"><display>(b)</display>Any written statement of facts, reasons, and legal authority in support of the <ln numlevel="1" lineno="672" slineno="7-87"/>intervener's position shall be filed with the request for intervention.</subsection><subsection ssid="12-12-41" dnum="c-o" numlevel="1" lineno="673" slineno="7-88" level="2"><display>(c)</display>The person seeking intervention shall provide copies of the statement described in <ln numlevel="1" lineno="674" slineno="7-89"/>Subsection (6)(b) to all parties to the proceedings before the State Records <ln numlevel="1" lineno="675" slineno="7-90"/>Committee.</subsection></subsection><subsection ssid="12-12-42" dnum="7-o" numlevel="1" lineno="676" slineno="7-91" level="1"><display>(7)</display>The State Records Committee shall hold a hearing within the period of time described in <ln numlevel="1" lineno="677" slineno="7-92"/>Subsection (4).</subsection><subsection ssid="12-12-43" dnum="8-o" numlevel="1" lineno="678" slineno="7-93" level="1"><display>(8)</display>At the hearing, the State Records Committee shall allow the parties to testify, present <ln numlevel="1" lineno="679" slineno="7-94"/>evidence, and comment on the issues.  The committee may allow other interested <ln numlevel="1" lineno="680" slineno="7-95"/>persons to comment on the issues.</subsection><subsection ssid="12-12-44" dnum="9-o" numlevel="1" lineno="681" slineno="7-96" level="1" space="false"><display>(9)</display><subsection ssid="12-12-45" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="12-12-46" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>The State Records Committee:<subsection ssid="12-12-47" dnum="A-o" numlevel="1" lineno="682" slineno="7-97" level="4" tab="2"><display>(A)</display>may review the disputed records; and</subsection><subsection ssid="12-12-48" dnum="B-o" numlevel="1" lineno="683" slineno="7-98" level="4" tab="2"><display>(B)</display>shall review the disputed records, if the committee is weighing the various <ln numlevel="1" lineno="684" slineno="7-99"/>interests under Subsection (11).</subsection></subsection><subsection ssid="12-12-49" dnum="ii-o" numlevel="1" lineno="685" slineno="7-100" level="3" tab="1"><display>(ii)</display>A review of the disputed records under Subsection (9)(a)(i) shall be in camera.</subsection></subsection><subsection ssid="12-12-50" dnum="b-o" numlevel="1" lineno="686" slineno="7-101" level="2"><display>(b)</display>Members of the State Records Committee may not disclose any information or <ln numlevel="1" lineno="687" slineno="7-102"/>record reviewed by the committee in camera unless the disclosure is otherwise <ln numlevel="1" lineno="688" slineno="7-103"/>authorized by this chapter.</subsection></subsection><subsection ssid="12-12-51" dnum="10-o" numlevel="1" lineno="689" slineno="7-104" level="1" space="false"><display>(10)</display><subsection ssid="12-12-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Discovery is prohibited, but the State Records Committee may issue subpoenas <ln numlevel="1" lineno="690" slineno="7-105"/>or other orders to compel production of necessary evidence.</subsection><subsection ssid="12-12-53" dnum="b-o" numlevel="1" lineno="691" slineno="7-106" level="2"><display>(b)</display>When the subject of a State Records Committee subpoena disobeys or fails to <ln numlevel="1" lineno="692" slineno="7-107"/>comply with the subpoena, the committee may file a motion for an order to compel <ln numlevel="1" lineno="693" slineno="7-108"/>obedience to the subpoena with the district court.</subsection><subsection ssid="12-12-54" dnum="c-o" numlevel="1" lineno="694" slineno="7-109" level="2" space="false"><display>(c)</display><subsection ssid="12-12-55" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The State Records Committee's review shall be de novo, if the appeal is<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both"> an <ln numlevel="1" lineno="695" slineno="7-110"/>appeal </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="29" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="12-86" dnum="_-o:A-i" numlevel="1" lineno="696" slineno="7-111" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1340" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">from an access denial, a fee waiver denial under Section <xref depth="3" refnumber="63G-2-203">63G-2-203</xref>, or an <ln numlevel="1" lineno="697" slineno="7-112"/>estimate of a fee amount under Subsection <xref depth="4" refnumber="63G-2-203(3)">63G-2-203(3)</xref>; or</amend></subsection><subsection ssid="12-88" dnum="_-o:B-i" numlevel="1" lineno="698" slineno="7-113" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1341" style="1" owner="i" level="1" amendtag="both">(B)</amend></display>from a decision of a chief administrative officer:<subsection ssid="12-12-56" dnum="A-o:I-i" numlevel="1" lineno="699" slineno="7-114" level="5"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1342" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1343" style="1" owner="i" level="1" amendtag="both" space="true">(I)</amend></display>issued under Section <xref depth="3" refnumber="63G-2-401">63G-2-401</xref>; or</subsection><subsection ssid="12-12-57" dnum="B-o:II-i" numlevel="1" lineno="700" slineno="7-115" level="5"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1343" style="2" owner="o" level="1" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1344" style="1" owner="i" level="1" amendtag="both" space="true">(II)</amend></display>issued by a chief administrative officer of a political subdivision that <ln numlevel="1" lineno="701" slineno="7-116"/>has not established a local appeals board.</subsection></subsection></subsection><subsection ssid="12-12-58" dnum="ii-o" numlevel="1" lineno="702" slineno="7-117" level="3"><display>(ii)</display>For an appeal from a decision of a local appeals board, the State Records <ln numlevel="1" lineno="703" slineno="7-118"/>Committee shall review and consider the decision of the local appeals board.</subsection></subsection></subsection><subsection ssid="12-12-59" dnum="11-o" numlevel="1" lineno="704" slineno="7-119" level="1" space="false"><display>(11)</display><subsection ssid="12-12-60" dnum="a-o" level="2" placement="sameline"><display>(a)</display>No later than seven business days after the hearing, the State Records Committee <ln numlevel="1" lineno="705" slineno="7-120"/>shall issue a signed order:<subsection ssid="12-12-61" dnum="i-o" numlevel="1" lineno="706" slineno="7-121" level="3" tab="1"><display>(i)</display>granting the relief sought, in whole or in part;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="12-89" dnum="_-o:ii-i" numlevel="1" lineno="707" slineno="7-122" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1348" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="end">in relation to a fee estimate dispute:</amend><subsection ssid="12-90" dnum="_-o:A-i" numlevel="1" lineno="708" slineno="7-123" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1349" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="59" style="1" owner="jchristopherson" level="1" amendtag="end">affirming the amount of a fee estimate;</amend></subsection><subsection ssid="12-91" dnum="_-o:B-i" numlevel="1" lineno="709" slineno="7-124" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1350" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="64" style="1" owner="jchristopherson" level="1" amendtag="end">ordering a different fee amount; or</amend></subsection><subsection ssid="12-92" dnum="_-o:C-i" numlevel="1" lineno="710" slineno="7-125" ea="amend" anum="0" owner="jchristopherson" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1351" style="1" owner="i" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="90" groupid="68" style="1" owner="jchristopherson" level="1" amendtag="end">ordering a governmental entity to re-estimate a fee using specific fee estimate <ln numlevel="1" lineno="711" slineno="7-126"/>procedures or guidelines, which may or may not include an order stating the <ln numlevel="1" lineno="712" slineno="7-127"/>range of fee amounts acceptable to the State Records Committee in the matter; <ln numlevel="1" lineno="713" slineno="7-128"/>or</amend></subsection></subsection><subsection ssid="12-12-62" dnum="ii-o:iii-i" numlevel="1" lineno="714" slineno="7-129" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1352" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1353" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>upholding the governmental entity's access denial<amend anum="0" ea="amend" pairid="80" groupid="60" style="1" owner="jchristopherson" level="1" amendtag="both">, fee waiver denial</amend>, <amend anum="0" ea="amend" pairid="92" groupid="70" style="1" owner="jchristopherson" level="1" amendtag="both">or <ln numlevel="1" lineno="715" slineno="7-130"/>estimate of a fee amount, </amend>in whole or in part.</subsection></subsection><subsection ssid="12-12-63" dnum="b-o" numlevel="1" lineno="716" slineno="7-131" level="2"><display>(b)</display>Except as provided in Section <xref depth="3" refnumber="63G-2-406">63G-2-406</xref>, the State Records Committee may, upon <ln numlevel="1" lineno="717" slineno="7-132"/>consideration and weighing of the various interests and public policies pertinent to <ln numlevel="1" lineno="718" slineno="7-133"/>the classification and disclosure or nondisclosure, order the disclosure of information <ln numlevel="1" lineno="719" slineno="7-134"/>properly classified as private, controlled, or protected if the public interest favoring <ln numlevel="1" lineno="720" slineno="7-135"/>access is greater than or equal to the interest favoring restriction of access.</subsection><subsection ssid="12-12-64" dnum="c-o" numlevel="1" lineno="721" slineno="7-136" level="2"><display>(c)</display>In making a determination under Subsection (11)(b), the State Records Committee <ln numlevel="1" lineno="722" slineno="7-137"/>shall consider and, where appropriate, limit the requester's or interested party's use <ln numlevel="1" lineno="723" slineno="7-138"/>and further disclosure of the record in order to protect:<subsection ssid="12-12-65" dnum="i-o" numlevel="1" lineno="724" slineno="7-139" level="3"><display>(i)</display>privacy interests in the case of a private or controlled record;</subsection><subsection ssid="12-12-66" dnum="ii-o" numlevel="1" lineno="725" slineno="7-140" level="3"><display>(ii)</display>business confidentiality interests in the case of a record protected under <ln numlevel="1" lineno="726" slineno="7-141"/>Subsection <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>(1), (2), (40)(a)(ii), or (40)(a)(vi); and</subsection><subsection ssid="12-12-67" dnum="iii-o" numlevel="1" lineno="727" slineno="7-142" level="3"><display>(iii)</display>privacy interests or the public interest in the case of other protected records.</subsection></subsection></subsection><subsection ssid="12-12-68" dnum="12-o" numlevel="1" lineno="728" slineno="7-143" level="1"><display>(12)</display>The order of the State Records Committee shall include:<subsection ssid="12-12-69" dnum="a-o" numlevel="1" lineno="729" slineno="7-144" level="2"><display>(a)</display>a statement of reasons for the decision, including citations to this chapter, court rule <ln numlevel="1" lineno="730" slineno="7-145"/>or order, another state statute, federal statute, or federal regulation that governs <ln numlevel="1" lineno="731" slineno="7-146"/>disclosure of the record, if the citations do not disclose private, controlled, or <ln numlevel="1" lineno="732" slineno="7-147"/>protected information;</subsection><subsection ssid="12-12-70" dnum="b-o" numlevel="1" lineno="733" slineno="7-148" level="2"><display>(b)</display>a description of the record or portions of the record to which access was ordered or <ln numlevel="1" lineno="734" slineno="7-149"/>denied, if the description does not disclose private, controlled, or protected <ln numlevel="1" lineno="735" slineno="7-150"/>information or information exempt from disclosure under Subsection <xref depth="3" refnumber="63G-2-201">63G-2-201</xref><ln numlevel="1" lineno="736" slineno="7-151"/>(3)(b);</subsection><subsection ssid="12-12-71" dnum="c-o" numlevel="1" lineno="737" slineno="7-152" level="2"><display>(c)</display>a statement that any party to the proceeding before the State Records Committee may <ln numlevel="1" lineno="738" slineno="7-153"/>appeal the committee's decision to district court; and</subsection><subsection ssid="12-12-72" dnum="d-o" numlevel="1" lineno="739" slineno="7-154" level="2"><display>(d)</display>a brief summary of the appeals process, the time limits for filing an appeal, and a <ln numlevel="1" lineno="740" slineno="7-155"/>notice that in order to protect its rights on appeal, the party may wish to seek advice <ln numlevel="1" lineno="741" slineno="7-156"/>from an attorney.</subsection></subsection><subsection ssid="12-12-73" dnum="13-o" numlevel="1" lineno="742" slineno="7-157" level="1"><display>(13)</display>If the State Records Committee fails to issue a decision within 73 calendar days of the <ln numlevel="1" lineno="743" slineno="7-158"/>filing of the notice of appeal, that failure is the equivalent of an order denying the <ln numlevel="1" lineno="744" slineno="7-159"/>appeal. A records committee appellant shall notify the State Records Committee in <ln numlevel="1" lineno="745" slineno="7-160"/>writing if the records committee appellant considers the appeal denied.</subsection><subsection ssid="12-12-74" dnum="14-o" numlevel="1" lineno="746" slineno="7-161" level="1"><display>(14)</display>A party to a proceeding before the State Records Committee may seek judicial review <ln numlevel="1" lineno="747" slineno="7-162"/>in district court of a State Records Committee order by filing a petition for review of the <ln numlevel="1" lineno="748" slineno="7-163"/>order as provided in Section <xref depth="3" refnumber="63G-2-404">63G-2-404</xref>.</subsection><subsection ssid="12-12-75" dnum="15-o" numlevel="1" lineno="749" slineno="7-164" level="1" space="false"><display>(15)</display><subsection ssid="12-12-76" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless a notice of intent to appeal is filed under Subsection (15)(b), each party to <ln numlevel="1" lineno="750" slineno="7-165"/>the proceeding shall comply with the order of the State Records Committee.</subsection><subsection ssid="12-12-77" dnum="b-o" numlevel="1" lineno="751" slineno="7-166" level="2"><display>(b)</display>If a party disagrees with the order of the State Records Committee, that party may <ln numlevel="1" lineno="752" slineno="7-167"/>file a notice of intent to appeal the order.</subsection><subsection ssid="12-12-78" dnum="c-o" numlevel="1" lineno="753" slineno="7-168" level="2"><display>(c)</display>If the State Records Committee orders the governmental entity to produce a record <ln numlevel="1" lineno="754" slineno="7-169"/>and no appeal is filed, or if, as a result of the appeal, the governmental entity is <ln numlevel="1" lineno="755" slineno="7-170"/>required to produce a record, the governmental entity shall:<subsection ssid="12-12-79" dnum="i-o" numlevel="1" lineno="756" slineno="7-171" level="3"><display>(i)</display>produce the record; and</subsection><subsection ssid="12-12-80" dnum="ii-o" numlevel="1" lineno="757" slineno="7-172" level="3"><display>(ii)</display>file a notice of compliance with the committee.</subsection></subsection><subsection ssid="12-12-81" dnum="d-o" numlevel="1" lineno="758" slineno="7-173" level="2" space="false"><display>(d)</display><subsection ssid="12-12-82" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the governmental entity that is ordered to produce a record fails to file a <ln numlevel="1" lineno="759" slineno="7-174"/>notice of compliance or a notice of intent to appeal, the State Records Committee <ln numlevel="1" lineno="760" slineno="7-175"/>may do either or both of the following:<subsection ssid="12-12-83" dnum="A-o" numlevel="1" lineno="761" slineno="7-176" level="4" tab="1"><display>(A)</display>impose a civil penalty of up to $500 for each day of continuing <ln numlevel="1" lineno="762" slineno="7-177"/>noncompliance; or</subsection><subsection ssid="12-12-84" dnum="B-o" numlevel="1" lineno="763" slineno="7-178" level="4" tab="1"><display>(B)</display>send written notice of the governmental entity's noncompliance to the <ln numlevel="1" lineno="764" slineno="7-179"/>governor.</subsection></subsection><subsection ssid="12-12-85" dnum="ii-o" numlevel="1" lineno="765" slineno="7-180" level="3"><display>(ii)</display>In imposing a civil penalty, the State Records Committee shall consider the <ln numlevel="1" lineno="766" slineno="7-181"/>gravity and circumstances of the violation, including whether the failure to <ln numlevel="1" lineno="767" slineno="7-182"/>comply was due to neglect or was willful or intentional.</subsection></subsection></subsection></section></bsec><bsec buid="24" num="63G-2-404" type="amend" src="code" uid="C63G-2-S404_2025050720250507" sort="63G02 04040020250507" numlevel="1" lineno="768" slineno="8-1" sn="8"><section number="63G-2-404" numlevel="1" lineno="769" slineno="8-2" type="amend"><secline lineno="768">Section 8, Section <bold>63G-2-404</bold> is amended to read:</secline><catline lineno="769"><bold>63G-2-404. Judicial review.</bold></catline><subsection ssid="24-24-1" dnum="1-o" numlevel="1" lineno="770" slineno="8-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="24-24-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A petition for judicial review of an order or decision, as allowed under this part, in <ln numlevel="1" lineno="771" slineno="8-4"/>Section <xref depth="3" refnumber="63G-2-209">63G-2-209</xref>, or in Subsection <xref depth="3" refnumber="63G-2-701">63G-2-701</xref>(6)(a)(ii), shall be filed no later than <ln numlevel="1" lineno="772" slineno="8-5"/>30 days after the date of the order or decision, subject to Subsection (1)(b).</subsection><subsection ssid="24-24-3" dnum="b-o" numlevel="1" lineno="773" slineno="8-6" level="2"><display>(b)</display>The time for a requester to file a petition for judicial review under Subsection (1)(a) <ln numlevel="1" lineno="774" slineno="8-7"/>is suspended for the period of time that:<subsection ssid="24-24-4" dnum="i-o" numlevel="1" lineno="775" slineno="8-8" level="3"><display>(i)</display>begins the date the requester submits a request under Section <xref depth="3" refnumber="63A-12-111">63A-12-111</xref> for the <ln numlevel="1" lineno="776" slineno="8-9"/>government records ombudsman to mediate the dispute between the requester and <ln numlevel="1" lineno="777" slineno="8-10"/>the governmental entity; and</subsection><subsection ssid="24-24-5" dnum="ii-o" numlevel="1" lineno="778" slineno="8-11" level="3"><display>(ii)</display>ends the earlier of the following dates:<subsection ssid="24-24-6" dnum="A-o" numlevel="1" lineno="779" slineno="8-12" level="4"><display>(A)</display>the date that the government records ombudsman certifies in writing that the <ln numlevel="1" lineno="780" slineno="8-13"/>mediation is concluded; or</subsection><subsection ssid="24-24-7" dnum="B-o" numlevel="1" lineno="781" slineno="8-14" level="4"><display>(B)</display>the date that the government records ombudsman certifies in writing that the <ln numlevel="1" lineno="782" slineno="8-15"/>mediation did not occur or was not concluded because of a lack of the required <ln numlevel="1" lineno="783" slineno="8-16"/>consent.</subsection></subsection></subsection></subsection><subsection ssid="24-24-8" dnum="2-o" numlevel="1" lineno="784" slineno="8-17" level="1" space="false"><display>(2)</display><subsection ssid="24-24-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A petition for judicial review is a complaint governed by the Utah Rules of Civil <ln numlevel="1" lineno="785" slineno="8-18"/>Procedure and shall contain:<subsection ssid="24-24-10" dnum="i-o" numlevel="1" lineno="786" slineno="8-19" level="3" tab="1"><display>(i)</display>the petitioner's name and mailing address;</subsection><subsection ssid="24-34" dnum="_-o:ii-i" numlevel="1" lineno="787" slineno="8-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1386" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="end">a statement identifying the order or decision that the petitioner is appealing;</amend></subsection><subsection ssid="24-24-11" dnum="ii-o:iii-i" numlevel="1" lineno="788" slineno="8-21" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1387" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1388" style="1" owner="i" level="1" amendtag="both" space="true">(iii)</amend></display>a copy of the State Records Committee order from which the appeal is <ln numlevel="1" lineno="789" slineno="8-22"/>taken, if the petitioner is seeking judicial review of an order of the State Records <ln numlevel="1" lineno="790" slineno="8-23"/>Committee;</subsection><subsection ssid="24-24-12" dnum="iii-o:iv-i" numlevel="1" lineno="791" slineno="8-24" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1388" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1389" style="1" owner="i" level="1" amendtag="both" space="true">(iv)</amend></display>the name and mailing address of the governmental entity that issued the <ln numlevel="1" lineno="792" slineno="8-25"/>initial determination with a copy of that determination;</subsection><subsection ssid="24-24-13" dnum="iv-o:v-i" numlevel="1" lineno="793" slineno="8-26" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1389" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1390" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>a request for relief specifying the type and extent of relief requested; and</subsection><subsection ssid="24-24-14" dnum="v-o:vi-i" numlevel="1" lineno="794" slineno="8-27" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1390" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1391" style="1" owner="i" level="1" amendtag="both" space="true">(vi)</amend></display>a statement of the reasons why the petitioner is entitled to relief.</subsection></subsection><subsection ssid="24-24-15" dnum="b-o" numlevel="1" lineno="795" slineno="8-28" level="2"><display>(b)</display>Except in exceptional circumstances, a petition for judicial review may not raise an <ln numlevel="1" lineno="796" slineno="8-29"/>issue that was not raised in the underlying appeal and order.</subsection></subsection><subsection ssid="24-24-16" dnum="3-o" numlevel="1" lineno="797" slineno="8-30" level="1"><display>(3)</display>If the appeal is based on the denial of access to a protected record based on a claim of <ln numlevel="1" lineno="798" slineno="8-31"/>business confidentiality, the court shall allow the claimant of business confidentiality to <ln numlevel="1" lineno="799" slineno="8-32"/>provide to the court the reasons for the claim of business confidentiality.</subsection><subsection ssid="24-24-17" dnum="4-o" numlevel="1" lineno="800" slineno="8-33" level="1"><display>(4)</display>All additional pleadings and proceedings in the district court are governed by the Utah <ln numlevel="1" lineno="801" slineno="8-34"/>Rules of Civil Procedure.</subsection><subsection ssid="24-24-18" dnum="5-o" numlevel="1" lineno="802" slineno="8-35" level="1"><display>(5)</display>The district court may review the disputed records.  The review shall be in camera.</subsection><subsection ssid="24-24-19" dnum="6-o" numlevel="1" lineno="803" slineno="8-36" level="1" space="false"><display>(6)</display><subsection ssid="24-24-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court shall:<subsection ssid="24-24-21" dnum="i-o" numlevel="1" lineno="804" slineno="8-37" level="3" tab="1"><display>(i)</display>make the court's decision de novo, but, for a petition seeking judicial review of a <ln numlevel="1" lineno="805" slineno="8-38"/>State Records Committee order, allow introduction of evidence presented to the <ln numlevel="1" lineno="806" slineno="8-39"/>State Records Committee;</subsection><subsection ssid="24-24-22" dnum="ii-o" numlevel="1" lineno="807" slineno="8-40" level="3" tab="1"><display>(ii)</display>determine all questions of fact and law without a jury; and</subsection><subsection ssid="24-24-23" dnum="iii-o" numlevel="1" lineno="808" slineno="8-41" level="3" tab="1"><display>(iii)</display>decide the issue at the earliest practical opportunity.</subsection></subsection><subsection ssid="24-24-24" dnum="b-o" numlevel="1" lineno="809" slineno="8-42" level="2"><display>(b)</display>A court may remand a petition for judicial review to the State Records Committee if:<subsection ssid="24-24-25" dnum="i-o" numlevel="1" lineno="810" slineno="8-43" level="3"><display>(i)</display>the remand is to allow the State Records Committee to decide an issue that:<subsection ssid="24-24-26" dnum="A-o" numlevel="1" lineno="811" slineno="8-44" level="4"><display>(A)</display>involves access to a record; and</subsection><subsection ssid="24-24-27" dnum="B-o" numlevel="1" lineno="812" slineno="8-45" level="4"><display>(B)</display>the State Records Committee has not previously addressed in the proceeding <ln numlevel="1" lineno="813" slineno="8-46"/>that led to the petition for judicial review; and</subsection></subsection><subsection ssid="24-24-28" dnum="ii-o" numlevel="1" lineno="814" slineno="8-47" level="3"><display>(ii)</display>the court determines that remanding to the State Records Committee is in the best <ln numlevel="1" lineno="815" slineno="8-48"/>interests of justice.</subsection></subsection></subsection><subsection ssid="24-24-29" dnum="7-o" numlevel="1" lineno="816" slineno="8-49" level="1" space="false"><display>(7)</display><subsection ssid="24-24-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Section <xref depth="3" refnumber="63G-2-406">63G-2-406</xref>, the court may, upon consideration and <ln numlevel="1" lineno="817" slineno="8-50"/>weighing of the various interests and public policies pertinent to the classification <ln numlevel="1" lineno="818" slineno="8-51"/>and disclosure or nondisclosure, order the disclosure of information properly <ln numlevel="1" lineno="819" slineno="8-52"/>classified as private, controlled, or protected if the interest favoring access is greater <ln numlevel="1" lineno="820" slineno="8-53"/>than or equal to the interest favoring restriction of access.</subsection><subsection ssid="24-24-31" dnum="b-o" numlevel="1" lineno="821" slineno="8-54" level="2"><display>(b)</display>The court shall consider and, where appropriate, limit the requester's use and further <ln numlevel="1" lineno="822" slineno="8-55"/>disclosure of the record in order to protect privacy interests in the case of private or <ln numlevel="1" lineno="823" slineno="8-56"/>controlled records, business confidentiality interests in the case of records protected <ln numlevel="1" lineno="824" slineno="8-57"/>under Subsections <xref depth="3" refnumber="63G-2-305">63G-2-305</xref>(1) and (2), and privacy interests or the public interest <ln numlevel="1" lineno="825" slineno="8-58"/>in the case of other protected records.</subsection></subsection></section></bsec><bsec buid="20" num="63G-2-701" type="amend" src="code" uid="C63G-2-S701_2025050720250507" sort="63G02 07010020250507" numlevel="1" lineno="826" slineno="9-1" sn="9"><section number="63G-2-701" numlevel="1" lineno="827" slineno="9-2" type="amend"><secline lineno="826">Section 9, Section <bold>63G-2-701</bold> is amended to read:</secline><catline lineno="827"><bold>63G-2-701. Political subdivisions may adopt ordinances in compliance with <ln numlevel="1" lineno="828" slineno="9-3"/>chapter -- Appeal process.</bold></catline><subsection ssid="20-20-1" dnum="1-o" numlevel="1" lineno="829" slineno="9-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="20-20-2" dnum="a-o" numlevel="1" lineno="830" slineno="9-5" level="2"><display>(a)</display>"Access denial" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection><subsection ssid="20-20-3" dnum="b-o" numlevel="1" lineno="831" slineno="9-6" level="2"><display>(b)</display>"Interested party" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection><subsection ssid="20-20-4" dnum="c-o" numlevel="1" lineno="832" slineno="9-7" level="2"><display>(c)</display>"Requester" means the same as that term is defined in Section <xref depth="3" refnumber="63G-2-400.5" start="0">63G-2-400.5</xref>.</subsection></subsection><subsection ssid="20-20-5" dnum="2-o" numlevel="1" lineno="833" slineno="9-8" level="1" space="false"><display>(2)</display><subsection ssid="20-20-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each political subdivision may adopt an ordinance or a policy applicable <ln numlevel="1" lineno="834" slineno="9-9"/>throughout its jurisdiction relating to information practices including classification, <ln numlevel="1" lineno="835" slineno="9-10"/>designation, access, denials, segregation, appeals, management, retention, and <ln numlevel="1" lineno="836" slineno="9-11"/>amendment of records.</subsection><subsection ssid="20-20-7" dnum="b-o" numlevel="1" lineno="837" slineno="9-12" level="2"><display>(b)</display>The ordinance or policy shall comply with the criteria set forth in this section.</subsection><subsection ssid="20-20-8" dnum="c-o" numlevel="1" lineno="838" slineno="9-13" level="2"><display>(c)</display>If any political subdivision does not adopt and maintain an ordinance or policy, then <ln numlevel="1" lineno="839" slineno="9-14"/>that political subdivision is subject to this chapter.</subsection><subsection ssid="20-20-9" dnum="d-o" numlevel="1" lineno="840" slineno="9-15" level="2"><display>(d)</display>Notwithstanding the adoption of an ordinance or policy, each political subdivision is <ln numlevel="1" lineno="841" slineno="9-16"/>subject to <xref depth="2" refnumber="63G-2-1" start="2">Part 1, General Provisions</xref>, <xref depth="2" refnumber="63G-2-3" start="2">Part 3, Classification</xref>, and Sections <xref depth="3" refnumber="63A-12-105" start="0">63A-12-105</xref>, <xref depth="3" refnumber="63A-12-107" start="0"><ln numlevel="1" lineno="842" slineno="9-17"/>63A-12-107</xref>, <xref depth="3" refnumber="63G-2-201" start="0">63G-2-201</xref>, <xref depth="3" refnumber="63G-2-202" start="0">63G-2-202</xref>, <xref depth="3" refnumber="63G-2-205" start="0">63G-2-205</xref>, <xref depth="3" refnumber="63G-2-206" start="0">63G-2-206</xref>, <xref depth="3" refnumber="63G-2-601" start="0">63G-2-601</xref>, and <xref depth="3" refnumber="63G-2-602" start="0"><ln numlevel="1" lineno="843" slineno="9-18"/>63G-2-602</xref>.</subsection><subsection ssid="20-20-10" dnum="e-o" numlevel="1" lineno="844" slineno="9-19" level="2"><display>(e)</display>Every ordinance, policy, or amendment to the ordinance or policy shall be filed with <ln numlevel="1" lineno="845" slineno="9-20"/>the state archives no later than 30 days after its effective date.</subsection><subsection ssid="20-20-11" dnum="f-o" numlevel="1" lineno="846" slineno="9-21" level="2"><display>(f)</display>The political subdivision shall also report to the state archives all retention schedules, <ln numlevel="1" lineno="847" slineno="9-22"/>and all designations and classifications applied to record series maintained by the <ln numlevel="1" lineno="848" slineno="9-23"/>political subdivision.</subsection><subsection ssid="20-20-12" dnum="g-o" numlevel="1" lineno="849" slineno="9-24" level="2"><display>(g)</display>The report required by Subsection <xref depth="4" refnumber="63G-2-701(2)(f)" start="0">(2)(f)</xref> is notification to state archives of the <ln numlevel="1" lineno="850" slineno="9-25"/>political subdivision's retention schedules, designations, and classifications.  The <ln numlevel="1" lineno="851" slineno="9-26"/>report is not subject to approval by state archives.  If state archives determines that a <ln numlevel="1" lineno="852" slineno="9-27"/>different retention schedule is needed for state purposes, state archives shall notify <ln numlevel="1" lineno="853" slineno="9-28"/>the political subdivision of the state's retention schedule for the records and shall <ln numlevel="1" lineno="854" slineno="9-29"/>maintain the records if requested to do so under Subsection <xref depth="4" refnumber="63A-12-105(2)" start="0">63A-12-105(2)</xref>.</subsection></subsection><subsection ssid="20-20-13" dnum="3-o" numlevel="1" lineno="855" slineno="9-30" level="1"><display>(3)</display>Each ordinance or policy relating to information practices shall:<subsection ssid="20-20-14" dnum="a-o" numlevel="1" lineno="856" slineno="9-31" level="2"><display>(a)</display>provide standards for the classification and designation of the records of the political <ln numlevel="1" lineno="857" slineno="9-32"/>subdivision as public, private, controlled, or protected in accordance with <xref depth="2" refnumber="63G-2-3" start="2">Part 3, <ln numlevel="1" lineno="858" slineno="9-33"/>Classification</xref>;</subsection><subsection ssid="20-20-15" dnum="b-o" numlevel="1" lineno="859" slineno="9-34" level="2"><display>(b)</display>require the classification of the records of the political subdivision in accordance <ln numlevel="1" lineno="860" slineno="9-35"/>with those standards;</subsection><subsection ssid="20-20-16" dnum="c-o" numlevel="1" lineno="861" slineno="9-36" level="2"><display>(c)</display>provide guidelines for establishment of fees in accordance with Section <xref depth="3" refnumber="63G-2-203" start="0">63G-2-203</xref>; <ln numlevel="1" lineno="862" slineno="9-37"/>and</subsection><subsection ssid="20-20-17" dnum="d-o" numlevel="1" lineno="863" slineno="9-38" level="2"><display>(d)</display>provide standards for the management and retention of the records of the political <ln numlevel="1" lineno="864" slineno="9-39"/>subdivision comparable to Section <xref depth="3" refnumber="63A-12-103" start="0">63A-12-103</xref>.</subsection></subsection><subsection ssid="20-20-18" dnum="4-o" numlevel="1" lineno="865" slineno="9-40" level="1" space="false"><display>(4)</display><subsection ssid="20-20-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each ordinance or policy shall establish access criteria, procedures, and response <ln numlevel="1" lineno="866" slineno="9-41"/>times for requests to inspect, obtain, or amend records of the political subdivision, <ln numlevel="1" lineno="867" slineno="9-42"/>and time limits for appeals consistent with this chapter.</subsection><subsection ssid="20-20-20" dnum="b-o" numlevel="1" lineno="868" slineno="9-43" level="2"><display>(b)</display>In establishing response times for access requests and time limits for appeals, the <ln numlevel="1" lineno="869" slineno="9-44"/>political subdivision may establish reasonable time frames different than those set out <ln numlevel="1" lineno="870" slineno="9-45"/>in Section <xref depth="3" refnumber="63G-2-204" start="0">63G-2-204</xref> and <xref depth="2" refnumber="63G-2-4" start="2">Part 4, Appeals</xref>, if it determines that the resources of the <ln numlevel="1" lineno="871" slineno="9-46"/>political subdivision are insufficient to meet the requirements of those sections.</subsection></subsection><subsection ssid="20-20-21" dnum="5-o" numlevel="1" lineno="872" slineno="9-47" level="1" space="false"><display>(5)</display><subsection ssid="20-20-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A political subdivision shall establish an appeals process for persons aggrieved by <ln numlevel="1" lineno="873" slineno="9-48"/>classification, designation, <amend anum="0" ea="amend" pairid="84" groupid="73" style="1" owner="jchristopherson" level="1" amendtag="both">fee disputes, </amend>or access decisions.</subsection><subsection ssid="20-20-23" dnum="b-o" numlevel="1" lineno="874" slineno="9-49" level="2"><display>(b)</display>A political subdivision's appeals process shall include<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="92" groupid="80" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="90" groupid="78" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="20-48" dnum="_-o:i-i" numlevel="1" lineno="875" slineno="9-50" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1431" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>a process for a requester or interested party to appeal an access denial<amend anum="0" ea="amend" pairid="103" groupid="90" style="1" owner="jchristopherson" level="1" amendtag="both">, fee waiver <ln numlevel="1" lineno="876" slineno="9-51"/>denial, or an estimate of a fee amount</amend> to a person designated by the political <ln numlevel="1" lineno="877" slineno="9-52"/>subdivision as the chief administrative officer for purposes of an appeal under <ln numlevel="1" lineno="878" slineno="9-53"/>Section <xref depth="3" refnumber="63G-2-401" start="0">63G-2-401</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="94" groupid="82" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="100" groupid="87" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="20-49" dnum="_-o:ii-i" numlevel="1" lineno="879" slineno="9-54" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1432" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="104" groupid="91" style="1" owner="jchristopherson" level="1" amendtag="end">a process for a requester or interested party to optionally appeal an estimate of a <ln numlevel="1" lineno="880" slineno="9-55"/>fee amount directly to the State Records Committee if the estimated fee amount <ln numlevel="1" lineno="881" slineno="9-56"/>exceeds $500.</amend></subsection></subsection><subsection ssid="20-20-24" dnum="c-o" numlevel="1" lineno="882" slineno="9-57" level="2" space="false"><display>(c)</display><subsection ssid="20-20-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A political subdivision may establish an appeals board <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">to decide</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">for the <ln numlevel="1" lineno="883" slineno="9-58"/>purpose of hearing</amend> an appeal of a decision of<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="54" style="2" owner="jchristopherson" level="1" deltag="both"> </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="61" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">:</amend><subsection ssid="20-44" dnum="_-o:A-i" numlevel="1" lineno="884" slineno="9-59" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1435" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="51" style="1" owner="jchristopherson" level="1" amendtag="end">an access denial, fee waiver denial, or estimate of a fee amount; or</amend></subsection><subsection ssid="20-45" dnum="_-o:B-i" numlevel="1" lineno="885" slineno="9-60" ea="amend" anum="0" owner="jchristopherson" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1436" style="1" owner="i" level="1" amendtag="both">(B)</amend></display>the chief administrative officer affirming an access denial.</subsection></subsection><subsection ssid="20-20-26" dnum="ii-o" numlevel="1" lineno="886" slineno="9-61" level="3"><display>(ii)</display>An appeals board established by a political subdivision shall be composed of <ln numlevel="1" lineno="887" slineno="9-62"/>three members:<subsection ssid="20-20-27" dnum="A-o" numlevel="1" lineno="888" slineno="9-63" level="4"><display>(A)</display>one of whom shall be an employee of the political subdivision; and</subsection><subsection ssid="20-20-28" dnum="B-o" numlevel="1" lineno="889" slineno="9-64" level="4"><display>(B)</display>two of whom shall be members of the public who are not employed by or <ln numlevel="1" lineno="890" slineno="9-65"/>officials of a governmental entity, at least one of whom shall have professional <ln numlevel="1" lineno="891" slineno="9-66"/>experience with requesting or managing records.</subsection></subsection><subsection ssid="20-20-29" dnum="iii-o" numlevel="1" lineno="892" slineno="9-67" level="3"><display>(iii)</display>If a political subdivision establishes an appeals board, any appeal of a decision of <ln numlevel="1" lineno="893" slineno="9-68"/>a chief administrative officer shall be made to the appeals board<amend anum="0" ea="amend" pairid="76" groupid="65" style="1" owner="jchristopherson" level="1" amendtag="both">, expect that an <ln numlevel="1" lineno="894" slineno="9-69"/>appeal of an estimate of a fee amount may be appealed directly to the State <ln numlevel="1" lineno="895" slineno="9-70"/>Records Committee as required by Subsection <xref tempid="272" depth="4" refnumber="63G-2-701(5)(b)(ii)">(5)(b)(ii)</xref> if the estimated fee <ln numlevel="1" lineno="896" slineno="9-71"/>amount exceeds $500</amend>.</subsection><subsection ssid="20-20-30" dnum="iv-o" numlevel="1" lineno="897" slineno="9-72" level="3"><display>(iv)</display>If a political subdivision does not establish an appeals board, the political <ln numlevel="1" lineno="898" slineno="9-73"/>subdivision's appeals process shall provide for an appeal of a chief administrative <ln numlevel="1" lineno="899" slineno="9-74"/>officer's decision to the State Records Committee, as provided in Section <xref depth="3" refnumber="63G-2-403" start="0"><ln numlevel="1" lineno="900" slineno="9-75"/>63G-2-403</xref>.</subsection></subsection></subsection><subsection ssid="20-20-31" dnum="6-o" numlevel="1" lineno="901" slineno="9-76" level="1" space="false"><display>(6)</display><subsection ssid="20-20-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A political subdivision or requester may appeal an appeals board decision:<subsection ssid="20-20-33" dnum="i-o" numlevel="1" lineno="902" slineno="9-77" level="3" tab="1"><display>(i)</display>to the State Records Committee, as provided in Section <xref depth="3" refnumber="63G-2-403" start="0">63G-2-403</xref>; or</subsection><subsection ssid="20-20-34" dnum="ii-o" numlevel="1" lineno="903" slineno="9-78" level="3" tab="1"><display>(ii)</display>by filing a petition for judicial review with the district court.</subsection></subsection><subsection ssid="20-20-35" dnum="b-o" numlevel="1" lineno="904" slineno="9-79" level="2"><display>(b)</display>The contents of a petition for judicial review under Subsection <xref depth="4" refnumber="63G-2-701(6)(a)(ii)" start="0">(6)(a)(ii)</xref> and the <ln numlevel="1" lineno="905" slineno="9-80"/>conduct of the proceeding shall be in accordance with Sections <xref depth="3" refnumber="63G-2-402" start="0">63G-2-402</xref> and <xref depth="3" refnumber="63G-2-404" start="0"><ln numlevel="1" lineno="906" slineno="9-81"/>63G-2-404</xref>.</subsection><subsection ssid="20-20-36" dnum="c-o" numlevel="1" lineno="907" slineno="9-82" level="2"><display>(c)</display>A person who appeals an appeals board decision to the State Records Committee <ln numlevel="1" lineno="908" slineno="9-83"/>does not lose or waive the right to seek judicial review of the decision of the State <ln numlevel="1" lineno="909" slineno="9-84"/>Records Committee.</subsection></subsection><subsection ssid="20-20-37" dnum="7-o" numlevel="1" lineno="910" slineno="9-85" level="1"><display>(7)</display>Any political subdivision that adopts an ordinance or policy under Subsection <xref depth="4" refnumber="63G-2-701(1)" start="0">(1)</xref> shall <ln numlevel="1" lineno="911" slineno="9-86"/>forward to state archives a copy and summary description of the ordinance or policy.</subsection></section></bsec><bsec buid="33" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="912" slineno="10-1" sn="10"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="912">Section 10.  <bold>Effective Date.</bold></secline><sectionText lineno="913"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-23-25 9:17 PM</tm></rev></foot></leg>
