Definitions.</bold></catline><sectionText lineno="26"><tab/>As used in this part:</sectionText><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1"><display>(1)</display>"Abandonment" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both">any</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a</amend> knowing or intentional action or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">failure to act</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">inaction</amend>, <ln numlevel="1" lineno="28" slineno="1-5"/>including desertion, by a person acting as a caretaker for a vulnerable adult that leaves <ln numlevel="1" lineno="29" slineno="1-6"/>the vulnerable adult without the means or ability to obtain necessary food, clothing, <ln numlevel="1" lineno="30" slineno="1-7"/>shelter, or medical or other health care.</subsection><subsection ssid="1-1-2" dnum="2-o" numlevel="1" lineno="31" slineno="1-8" level="1"><display>(2)</display>"Abuse" means:<subsection ssid="1-1-3" dnum="a-o" numlevel="1" lineno="32" slineno="1-9" level="2"><display>(a)</display>knowingly<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">,</amend> intentionally<amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">, or recklessly</amend>:<subsection ssid="1-1-4" dnum="i-o" numlevel="1" lineno="33" slineno="1-10" level="3"><display>(i)</display>attempting to cause harm;</subsection><subsection ssid="1-1-5" dnum="ii-o" numlevel="1" lineno="34" slineno="1-11" level="3"><display>(ii)</display>causing harm;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both"> or</amend><amendoutend style="2"/></subsection><subsection ssid="1-1-6" dnum="iii-o" numlevel="1" lineno="35" slineno="1-12" level="3"><display>(iii)</display>placing another in fear of <amend anum="0" ea="amend" pairid="24" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both">imminent </amend>harm;</subsection><subsection ssid="1-76" dnum="_-o:iv-i" numlevel="1" lineno="36" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="end">causing physical injury by acts or omissions; or</amend></subsection><subsection ssid="1-77" dnum="_-o:v-i" numlevel="1" lineno="37" slineno="1-14" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">engaging in a pattern of neglect;</amend></subsection></subsection><subsection ssid="1-1-7" dnum="b-o" numlevel="1" lineno="38" slineno="1-15" level="2"><display>(b)</display>unreasonable or inappropriate use of physical restraint, medication, or isolation that<amend anum="0" ea="amend" pairid="181" groupid="146" style="1" owner="jchristopherson" level="1" amendtag="both">, <ln numlevel="1" lineno="39" slineno="1-16"/>unless the physical restraint, medication, or isolation furthers the health and safety of <ln numlevel="1" lineno="40" slineno="1-17"/>the vulnerable adult:</amend> <subsection ssid="1-78" dnum="_-o:i-i" numlevel="1" lineno="41" slineno="1-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>causes or is likely to cause harm to a vulnerable adult;</subsection><subsection ssid="1-79" dnum="_-o:ii-i" numlevel="1" lineno="42" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">conflicts with a physician's orders; or</amend></subsection><subsection ssid="1-80" dnum="_-o:iii-i" numlevel="1" lineno="43" slineno="1-20" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="34" style="1" owner="jchristopherson" level="1" amendtag="end">is used as an unauthorized substitute for treatment;</amend></subsection></subsection><subsection ssid="1-1-8" dnum="c-o" numlevel="1" lineno="44" slineno="1-21" level="2"><display>(c)</display>emotional or psychological abuse;</subsection><subsection ssid="1-1-9" dnum="d-o" numlevel="1" lineno="45" slineno="1-22" level="2"><display>(d)</display>a sexual offense as described in Title 76, Chapter 5, Offenses Against the Individual; <ln numlevel="1" lineno="46" slineno="1-23"/>or</subsection><subsection ssid="1-1-10" dnum="e-o" numlevel="1" lineno="47" slineno="1-24" level="2"><display>(e)</display>deprivation of life sustaining treatment, or medical or mental health treatment, except:<subsection ssid="1-1-11" dnum="i-o" numlevel="1" lineno="48" slineno="1-25" level="3"><display>(i)</display>as provided in Title 75A, Chapter 3, Health Care Decisions; or</subsection><subsection ssid="1-1-12" dnum="ii-o" numlevel="1" lineno="49" slineno="1-26" level="3"><display>(ii)</display>when informed consent<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">, as defined in Section <xref depth="3" refnumber="76-5-111">76-5-111</xref>,</amend><amendoutend style="2"/> has been obtained.</subsection></subsection></subsection><subsection ssid="1-1-13" dnum="3-o" numlevel="1" lineno="50" slineno="1-27" level="1"><display>(3)</display>"Adult" means an individual who is 18 years old or older.</subsection><subsection ssid="1-1-14" dnum="4-o" numlevel="1" lineno="51" slineno="1-28" level="1"><display>(4)</display>"Adult protection case file" means a record, stored in any format, contained in a case <ln numlevel="1" lineno="52" slineno="1-29"/>file maintained by Adult Protective Services.</subsection><subsection ssid="1-1-15" dnum="5-o" numlevel="1" lineno="53" slineno="1-30" level="1"><display>(5)</display>"Adult Protective Services" means the unit within the division responsible to investigate <ln numlevel="1" lineno="54" slineno="1-31"/>abuse, neglect, and exploitation of vulnerable adults and provide appropriate protective <ln numlevel="1" lineno="55" slineno="1-32"/>services.</subsection><subsection ssid="1-81" dnum="_-o:6-i" numlevel="1" lineno="56" slineno="1-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">"Capacity" means that an individual has sufficient understanding and memory to <ln numlevel="1" lineno="57" slineno="1-34"/>comprehend the individual's situation and the nature, purpose, and consequence of an act <ln numlevel="1" lineno="58" slineno="1-35"/>or transaction into which the individual enters or proposes to enter.</amend></subsection><subsection ssid="1-1-16" dnum="6-o:7-i" numlevel="1" lineno="59" slineno="1-36" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>"Capacity to consent" means the ability of an individual to understand and <ln numlevel="1" lineno="60" slineno="1-37"/>communicate regarding the nature and consequences of decisions relating to the <ln numlevel="1" lineno="61" slineno="1-38"/>individual, and relating to the individual's property and lifestyle, including a decision to <ln numlevel="1" lineno="62" slineno="1-39"/>accept or refuse services.</subsection><subsection ssid="1-1-17" dnum="7-o:8-i" numlevel="1" lineno="63" slineno="1-40" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>"Caretaker" means a person or public institution that is entrusted with or assumes <ln numlevel="1" lineno="64" slineno="1-41"/>the responsibility to provide a vulnerable adult with care, food, shelter, clothing, <ln numlevel="1" lineno="65" slineno="1-42"/>supervision, medical or other health care, resource management, or other necessities for <ln numlevel="1" lineno="66" slineno="1-43"/>pecuniary gain, by contract, or as a result of friendship, or who is otherwise in a position <ln numlevel="1" lineno="67" slineno="1-44"/>of trust and confidence with a vulnerable adult, including a relative, a household <ln numlevel="1" lineno="68" slineno="1-45"/>member, an attorney-in-fact, a neighbor, a person who is employed or who provides <ln numlevel="1" lineno="69" slineno="1-46"/>volunteer work, a court-appointed or voluntary guardian, or a person who contracts or is <ln numlevel="1" lineno="70" slineno="1-47"/>under court order to provide care.</subsection><subsection ssid="1-1-18" dnum="8-o:9-i" numlevel="1" lineno="71" slineno="1-48" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>"Counsel" means an attorney licensed to practice law in this state.</subsection><subsection ssid="1-1-19" dnum="9-o:10-i" numlevel="1" lineno="72" slineno="1-49" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>"Database" means the statewide database maintained by the division under <ln numlevel="1" lineno="73" slineno="1-50"/>Section <xref depth="3" refnumber="26B-6-210">26B-6-210</xref>.</subsection><subsection ssid="1-82" dnum="_-o:11-i" numlevel="1" lineno="74" slineno="1-51" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(11)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="end">"Decision-making ability" means an individual's capacity to receive, process, and <ln numlevel="1" lineno="75" slineno="1-52"/>understand information, to comprehend the individual's circumstances, and to <ln numlevel="1" lineno="76" slineno="1-53"/>understand the likely consequences of the individual's decisions.</amend></subsection><subsection ssid="1-1-20" dnum="10-o:12-i" numlevel="1" lineno="77" slineno="1-54" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1026" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display><subsection ssid="1-1-21" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Dependent adult" means an individual 18 years old or older, who has a <ln numlevel="1" lineno="78" slineno="1-55"/>physical or mental impairment that restricts the individual's ability to carry out <ln numlevel="1" lineno="79" slineno="1-56"/>normal activities or to protect the individual's rights.</subsection><subsection ssid="1-1-22" dnum="b-o" numlevel="1" lineno="80" slineno="1-57" level="2"><display>(b)</display>"Dependent adult" includes an individual who has physical or developmental <ln numlevel="1" lineno="81" slineno="1-58"/>disabilities or whose physical or mental capacity has substantially diminished <ln numlevel="1" lineno="82" slineno="1-59"/>because of age.</subsection></subsection><subsection ssid="1-1-23" dnum="11-o:13-i" numlevel="1" lineno="83" slineno="1-60" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>"Elder abuse" means abuse, neglect, or exploitation of an elder adult.</subsection><subsection ssid="1-1-24" dnum="12-o:14-i" numlevel="1" lineno="84" slineno="1-61" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>"Elder adult" means an individual 65 years old or older.</subsection><subsection ssid="1-1-25" dnum="13-o:15-i" numlevel="1" lineno="85" slineno="1-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1032" style="1" owner="i" level="1" amendtag="both" space="true">(15)</amend></display>"Emergency" means a circumstance in which a vulnerable adult is at an <ln numlevel="1" lineno="86" slineno="1-63"/>immediate risk of death, serious physical injury, or serious physical, emotional, or <ln numlevel="1" lineno="87" slineno="1-64"/>financial harm.</subsection><subsection ssid="1-1-26" dnum="14-o:16-i" numlevel="1" lineno="88" slineno="1-65" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1033" style="1" owner="i" level="1" amendtag="both" space="true">(16)</amend></display>"Emergency protective services" means measures taken by Adult Protective <ln numlevel="1" lineno="89" slineno="1-66"/>Services under time-limited, court-ordered authority for the purpose of remediating an <ln numlevel="1" lineno="90" slineno="1-67"/>emergency.</subsection><subsection ssid="1-1-27" dnum="15-o:17-i" numlevel="1" lineno="91" slineno="1-68" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(15)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="i" level="1" amendtag="both" space="true">(17)</amend></display><subsection ssid="1-1-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Emotional or psychological abuse" means knowing or intentional verbal <ln numlevel="1" lineno="92" slineno="1-69"/>or nonverbal conduct directed at a vulnerable adult that <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="58" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both">results in the vulnerable <ln numlevel="1" lineno="93" slineno="1-70"/>adult suffering</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="57" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">would cause a reasonable individual to suffer</amend> mental anguish, <ln numlevel="1" lineno="94" slineno="1-71"/>emotional distress, fear, humiliation, degradation, agitation, or confusion.</subsection><subsection ssid="1-1-29" dnum="b-o" numlevel="1" lineno="95" slineno="1-72" level="2"><display>(b)</display>"Emotional or psychological abuse" includes intimidating, threatening, isolating, <ln numlevel="1" lineno="96" slineno="1-73"/>coercing, or harassing.</subsection><subsection ssid="1-1-30" dnum="c-o" numlevel="1" lineno="97" slineno="1-74" level="2"><display>(c)</display>"Emotional or psychological abuse" does not include verbal or non-verbal conduct <ln numlevel="1" lineno="98" slineno="1-75"/>by a vulnerable adult who lacks the capacity to intentionally or knowingly:<subsection ssid="1-1-31" dnum="i-o" numlevel="1" lineno="99" slineno="1-76" level="3"><display>(i)</display>engage in the conduct; or</subsection><subsection ssid="1-1-32" dnum="ii-o" numlevel="1" lineno="100" slineno="1-77" level="3"><display>(ii)</display>cause mental anguish, emotional distress, fear, humiliation, degradation, <ln numlevel="1" lineno="101" slineno="1-78"/>agitation, or confusion.</subsection></subsection></subsection><subsection ssid="1-83" dnum="_-o:18-i" numlevel="1" lineno="102" slineno="1-79" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="i" level="1" amendtag="start">(18)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">"Endangerment" means an offense described in Section <xref depth="3" refnumber="76-5-112">76-5-112</xref> or <xref depth="3" refnumber="76-5-112.5">76-5-112.5</xref>.</amend></subsection><subsection ssid="1-1-33" dnum="16-o:19-i" numlevel="1" lineno="103" slineno="1-80" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1040" style="2" owner="o" level="1" deltag="both">(16)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1041" style="1" owner="i" level="1" amendtag="both" space="true">(19)</amend></display>"Exploitation" means an offense described in Section <xref depth="3" refnumber="76-5-111.3">76-5-111.3</xref>, <xref depth="3" refnumber="76-5-111.4">76-5-111.4</xref>, or <xref depth="3" refnumber="76-5b-202"><ln numlevel="1" lineno="104" slineno="1-81"/>76-5b-202</xref>.</subsection><subsection ssid="1-1-34" dnum="17-o:20-i" numlevel="1" lineno="105" slineno="1-82" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" space="true">(24)</amend></display><subsection ssid="1-1-38" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Isolation" means knowingly or intentionally preventing a vulnerable adult <ln numlevel="1" lineno="128" slineno="1-105"/>from having contact with another person, unless the restriction of personal rights is <ln numlevel="1" lineno="129" slineno="1-106"/>authorized by court order, by:<subsection ssid="1-1-39" dnum="i-o" numlevel="1" lineno="130" slineno="1-107" level="3" tab="1"><display>(i)</display>preventing the vulnerable adult from communicating, visiting, interacting, or <ln numlevel="1" lineno="131" slineno="1-108"/>initiating interaction with others, including receiving or inviting visitors, mail, or <ln numlevel="1" lineno="132" slineno="1-109"/>telephone calls, contrary to the expressed wishes of the vulnerable adult, or <ln numlevel="1" lineno="133" slineno="1-110"/>communicating to a visitor that the vulnerable adult is not present or does not <ln numlevel="1" lineno="134" slineno="1-111"/>want to meet with or talk to the visitor, knowing that communication to be false;</subsection><subsection ssid="1-1-40" dnum="ii-o" numlevel="1" lineno="135" slineno="1-112" level="3" tab="1"><display>(ii)</display>physically restraining the vulnerable adult in order to prevent the vulnerable adult <ln numlevel="1" lineno="136" slineno="1-113"/>from meeting with a visitor; or</subsection><subsection ssid="1-1-41" dnum="iii-o" numlevel="1" lineno="137" slineno="1-114" level="3" tab="1"><display>(iii)</display>making false or misleading statements to the vulnerable adult in order to induce <ln numlevel="1" lineno="138" slineno="1-115"/>the vulnerable adult to refuse to receive communication from visitors or other <ln numlevel="1" lineno="139" slineno="1-116"/>family members.</subsection></subsection><subsection ssid="1-1-42" dnum="b-o" numlevel="1" lineno="140" slineno="1-117" level="2"><display>(b)</display>"Isolation" does not include an act:<subsection ssid="1-1-43" dnum="i-o" numlevel="1" lineno="141" slineno="1-118" level="3"><display>(i)</display>intended in good faith to protect the physical or mental welfare of the vulnerable <ln numlevel="1" lineno="142" slineno="1-119"/>adult; or</subsection><subsection ssid="1-1-44" dnum="ii-o" numlevel="1" lineno="143" slineno="1-120" level="3"><display>(ii)</display>performed pursuant to the treatment plan or instructions of a physician or other <ln numlevel="1" lineno="144" slineno="1-121"/>professional advisor of the vulnerable adult.</subsection></subsection></subsection><subsection ssid="1-1-45" dnum="21-o:25-i" numlevel="1" lineno="145" slineno="1-122" deltag="both">(B)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>failure of a caretaker to provide protection from health and safety hazards or <ln numlevel="1" lineno="152" slineno="1-129"/>maltreatment;</subsection></subsection><subsection ssid="1-1-51" dnum="ii-o:b-i" numlevel="1" lineno="153" slineno="1-130" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend caretaker, without the vulnerable adult's informed <ln numlevel="1" lineno="156" slineno="1-133"/>consent, resulting in deprivation of food, water, medication, health care, shelter, <ln numlevel="1" lineno="157" slineno="1-134"/>cooling, heating, or other services necessary to maintain the vulnerable adult's well <ln numlevel="1" lineno="158" slineno="1-135"/>being;</subsection><subsection ssid="1-1-53" dnum="iv-o:d-i" numlevel="1" lineno="159" slineno="1-136" level="2" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1068" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="both" space="true">(d)</amend></display><amendoutstart or</subsection><subsection ssid="1-1-65" dnum="b-o" numlevel="1" lineno="191" slineno="1-168" level="2"><display>(b)</display>uses the person's role, relationship, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="168" groupid="134" style="2" owner="jchristopherson" level="1" deltag="both">or </amend><amendoutend style="2"/>power<amend anum="0" ea="amend" pairid="166" groupid="132" style="1" owner="jchristopherson" level="1" amendtag="both">, or trust</amend>:<subsection ssid="1-1-66" dnum="i-o" numlevel="1" lineno="192" slineno="1-169" level="3"><display>(i)</display>to exploit, or knowingly assist or cause another to exploit, the trust, dependency, <ln numlevel="1" lineno="193" slineno="1-170"/>or fear of a vulnerable adult; or</subsection><subsection ssid="1-1-67" dnum="ii-o" numlevel="1" lineno="194" slineno="1-171" level="3"><display>(ii)</display>to gain control deceptively over the decision making of the vulnerable adult.</subsection></subsection></subsection><subsection ssid="1-1-68" dnum="30-o:35-i" numlevel="1" lineno="195" slineno="1-172" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1089" style="2" owner="o" level="1" deltag="both">(30)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1090" style="1" owner="i" level="1" amendtag="both" space="true">(35)</amend></display>"Vulnerable adult" means an elder adult, or a dependent adult who has a mental <ln numlevel="1" lineno="196" slineno="1-173"/>or physical impairment which substantially affects that person's ability to:<subsection ssid="1-1-69" dnum="a-o" numlevel="1" lineno="197" slineno="1-174" level="2"><display>(a)</display>provide personal protection;</subsection><subsection ssid="1-1-70" dnum="b-o" numlevel="1" lineno="198" slineno="1-175" level="2"><display>(b)</display>provide necessities such as food, shelter, clothing, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="169" groupid="135" style="2" owner="jchristopherson" level="1" deltag="both">mental</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="167" groupid="133" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">medical</amend> or other health <ln numlevel="1" lineno="199" slineno="1-176"/>care;</subsection><subsection ssid="1-1-71" dnum="c-o" numlevel="1" lineno="200" slineno="1-177" level="2"><display>(c)</display>obtain services necessary for health, safety, or welfare;</subsection><subsection ssid="1-1-72" dnum="d-o" numlevel="1" lineno="201" slineno="1-178" level="2"><display>(d)</display>carry out the activities of daily living;</subsection><subsection ssid="1-1-73" dnum="e-o" numlevel="1" lineno="202" slineno="1-179" level="2"><display>(e)</display>manage the adult's own <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="171" groupid="137" style="2" owner="jchristopherson" level="1" deltag="both">financial </amend><amendoutend style="2"/>resources; or</subsection><subsection ssid="1-1-74" dnum="f-o" numlevel="1" lineno="203" slineno="1-180" level="2"><display>(f)</display>comprehend the nature and consequences of remaining in a situation of abuse, <ln numlevel="1" lineno="204" slineno="1-181"/>neglect, or exploitation.</subsection></subsection><subsection ssid="1-1-75" dnum="31-o:36-i" numlevel="1" lineno="205" slineno="1-182" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(31)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="i" level="1" amendtag="both" space="true">(36)</amend></display>"Without merit" means a finding that abuse, neglect, or exploitation did not <ln numlevel="1" lineno="206" slineno="1-183"/>occur.</subsection></section></bsec><bsec buid="3" num="26B-6-203" type="amend" src="code" uid="C26B-6-S203_2025050720250507" sort="26B06 02030020250507" numlevel="1" lineno="207" slineno="2-1" sn="2"><section number="26B-6-203" numlevel="1" lineno="208" slineno="2-2" type="amend"><secline lineno="207">Section 2, Section <bold>26B-6-203</bold> is amended to read:</secline><catline lineno="208"><bold>26B-6-203<parens/>. Powers and duties of Adult Protective Services.</bold></catline><sectionText lineno="209"><tab/>In addition to all other powers and duties that Adult Protective Services is given under <ln numlevel="1" lineno="210" slineno="2-4"/>this part, Adult Protective Services:</sectionText><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="211" slineno="2-5" level="1"><display>(1)</display>shall maintain an intake system for receiving and screening reports;</subsection><subsection ssid="3-3-2" dnum="2-o" numlevel="1" lineno="212" slineno="2-6" level="1"><display>(2)</display>shall investigate referrals that meet the intake criteria;</subsection><subsection ssid="3-3-3" dnum="3-o" numlevel="1" lineno="213" slineno="2-7" level="1"><display>(3)</display>shall conduct assessments of vulnerability and functional capacity as it relates to an <ln numlevel="1" lineno="214" slineno="2-8"/>allegation of abuse, neglect, or exploitation of an adult who is the subject of a report;</subsection><subsection ssid="3-3-4" dnum="4-o" numlevel="1" lineno="215" slineno="2-9" level="1"><display>(4)</display>shall perform assessments based on protective needs and risks for a vulnerable adult <ln numlevel="1" lineno="216" slineno="2-10"/>who is the subject of a report;</subsection><subsection ssid="3-3-5" dnum="5-o" numlevel="1" lineno="217" slineno="2-11" level="1"><display>(5)</display>may address any protective needs by making recommendations to and coordinating with <ln numlevel="1" lineno="218" slineno="2-12"/>the vulnerable adult or by making referrals to community resources;</subsection><subsection ssid="3-3-6" dnum="6-o" numlevel="1" lineno="219" slineno="2-13" level="1"><display>(6)</display>may provide short-term, limited services to a vulnerable adult when family or <ln numlevel="1" lineno="220" slineno="2-14"/>community resources are not available to provide for the protective needs of the <ln numlevel="1" lineno="221" slineno="2-15"/>vulnerable adult;</subsection><subsection ssid="3-3-7" dnum="7-o" numlevel="1" lineno="222" slineno="2-16" level="1"><display>(7)</display>shall have access to facilities licensed by, or contracted with, the department for the <ln numlevel="1" lineno="223" slineno="2-17"/>purpose of conducting investigations;</subsection><subsection ssid="3-3-8" dnum="8-o" numlevel="1" lineno="224" slineno="2-18" level="1"><display>(8)</display>shall be given access to, or provided with, written statements, documents, exhibits, and <ln numlevel="1" lineno="225" slineno="2-19"/>other items related to an investigation, including private, controlled, or protected <ln numlevel="1" lineno="226" slineno="2-20"/>medical or financial records of a vulnerable adult who is the subject of an investigation <ln numlevel="1" lineno="227" slineno="2-21"/>if:<subsection ssid="3-3-9" dnum="a-o" numlevel="1" lineno="228" slineno="2-22" level="2"><display>(a)</display>for a vulnerable adult who has the capacity to consent, the vulnerable adult signs a <ln numlevel="1" lineno="229" slineno="2-23"/>release of information; or</subsection><subsection ssid="3-3-10" dnum="b-o" numlevel="1" lineno="230" slineno="2-24" level="2"><display>(b)</display>an administrative subpoena is issued by Adult Protective Services:<subsection ssid="3-3-11" dnum="i-o" numlevel="1" lineno="231" slineno="2-25" level="3"><display>(i)</display>for a vulnerable adult who has limited capacity to consent;</subsection><subsection ssid="3-3-12" dnum="ii-o" numlevel="1" lineno="232" slineno="2-26" level="3"><display>(ii)</display>for a vulnerable adult whose legal guardian refuses to consent;</subsection><subsection ssid="3-3-13" dnum="iii-o" numlevel="1" lineno="233" slineno="2-27" level="3"><display>(iii)</display>to a custodian of records or other items for a vulnerable adult, if the custodian <ln numlevel="1" lineno="234" slineno="2-28"/>refuses to allow access to the records or items without a subpoena; or</subsection><subsection ssid="3-3-14" dnum="iv-o" numlevel="1" lineno="235" slineno="2-29" level="3"><display>(iv)</display>when the records or other items sought are reasonably necessary for Adult <ln numlevel="1" lineno="236" slineno="2-30"/>Protective Services to:<subsection ssid="3-3-15" dnum="A-o" numlevel="1" lineno="237" slineno="2-31" level="4"><display>(A)</display>investigate the alleged abuse, neglect, or exploitation of a vulnerable adult; or</subsection><subsection ssid="3-3-16" dnum="B-o" numlevel="1" lineno="238" slineno="2-32" level="4"><display>(B)</display>protect the vulnerable adult who may be the victim of abuse, neglect, or <ln numlevel="1" lineno="239" slineno="2-33"/>exploitation;</subsection></subsection></subsection></subsection><subsection ssid="3-3-17" dnum="9-o" numlevel="1" lineno="240" slineno="2-34" level="1"><display>(9)</display>may initiate proceedings in a court of competent jurisdiction to seek relief necessary to <ln numlevel="1" lineno="241" slineno="2-35"/>carry out the provisions of this chapter;</subsection><subsection ssid="3-23" dnum="_-o:10-i" numlevel="1" lineno="242" slineno="2-36" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="i" level="1" amendtag="start">(10)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">may make a supported finding of abuse, neglect, or exploitation of a vulnerable adult <ln numlevel="1" lineno="243" slineno="2-37"/>against an alleged perpetrator if documents subpoenaed or requested by Adult Protective <ln numlevel="1" lineno="244" slineno="2-38"/>Services are not provided by the alleged perpetrator;</amend></subsection><subsection ssid="3-3-18" dnum="10-o:11-i" numlevel="1" lineno="245" slineno="2-39" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1115" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1116" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>shall, subject to Section <xref depth="3" refnumber="26B-6-217" start="0">26B-6-217</xref>, provide emergency protective services;</subsection><subsection ssid="3-3-19" dnum="11-o:12-i" numlevel="1" lineno="246" slineno="2-40" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1116" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1117" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display>may require all persons, including family members of a vulnerable adult and any <ln numlevel="1" lineno="247" slineno="2-41"/>caretaker, to cooperate with Adult Protective Services in carrying out its duties under <ln numlevel="1" lineno="248" slineno="2-42"/>this chapter, including the provision of statements, documents, exhibits, and other items <ln numlevel="1" lineno="249" slineno="2-43"/>that assist Adult Protective Services in conducting investigations and providing <ln numlevel="1" lineno="250" slineno="2-44"/>protective services;</subsection><subsection ssid="3-3-20" dnum="12-o:13-i" numlevel="1" lineno="251" slineno="2-45" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1117" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1118" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>may require all officials, agencies, departments, and political subdivisions of the <ln numlevel="1" lineno="252" slineno="2-46"/>state to assist and cooperate within their jurisdictional power with the court, the division, <ln numlevel="1" lineno="253" slineno="2-47"/>and Adult Protective Services in furthering the purposes of this chapter;</subsection><subsection ssid="3-3-21" dnum="13-o:14-i" numlevel="1" lineno="254" slineno="2-48" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1118" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1119" style="1" owner="i" level="1" amendtag="both" space="true">(14)</amend></display>may conduct studies and compile data regarding abuse, neglect, and exploitation;
