Winterton</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to the incorporation of a preliminary municipality.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">provides that:<hl numlevel="1" lineno="9" slineno="0-9" level="2">a person may not apply to incorporate an area as a preliminary municipality after <ln numlevel="1" lineno="10" slineno="0-10"/>February 15, 2025;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="2">a person who applies to incorporate an area as a preliminary municipality by filing a <ln numlevel="1" lineno="12" slineno="0-12"/>feasibility request on or before February 15, 2025, may proceed in accordance with <ln numlevel="1" lineno="13" slineno="0-13"/>Title 10, Chapter 2a, Part 5, Incorporation of a Preliminary Municipality, after <ln numlevel="1" lineno="14" slineno="0-14"/>February 15, 2025;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="2">a preliminary municipality may not annex an unincorporated area; and</hl><hl numlevel="1" lineno="16" slineno="0-16" level="2">a municipality may not annex an area if the area was included in a feasibility request <ln numlevel="1" lineno="17" slineno="0-17"/>to incorporate the area into a preliminary municipality; and</hl></hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">requires:<hl numlevel="1" lineno="19" slineno="0-19" level="2">a proposed preliminary municipality to agree that initial landowners will fully <ln numlevel="1" lineno="20" slineno="0-20"/>compensate the county for damages to county property or infrastructure before the <ln numlevel="1" lineno="21" slineno="0-21"/>preliminary municipality can transition into a town;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="2">a preliminary municipality located in the fourth through sixth class to comply with <ln numlevel="1" lineno="23" slineno="0-23"/>terms, conditions, or restrictions that were established in a development agreement <ln numlevel="1" lineno="24" slineno="0-24"/>between the initial landowners and the county before the feasibility request was filed; Annexation -- Limitations.</bold></catline><subsection ssid="47-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="1-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="47-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A contiguous, unincorporated area that is contiguous to a municipality may be <ln numlevel="1" lineno="50" slineno="1-4"/>annexed to the municipality as provided in this part.</subsection><subsection ssid="47-null-3" dnum="b-o" numlevel="1" lineno="51" slineno="1-5" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2-402(1)" start="0">(1)</xref>(c), an unincorporated area may not be annexed <ln numlevel="1" lineno="52" slineno="1-6"/>to a municipality unless:<subsection ssid="47-null-4" dnum="i-o" numlevel="1" lineno="53" slineno="1-7" level="3"><display>(i)</display>the unincorporated area is a contiguous area;</subsection><subsection ssid="47-null-5" dnum="ii-o" numlevel="1" lineno="54" slineno="1-8" level="3"><display>(ii)</display>the unincorporated area is contiguous to the municipality;</subsection><subsection ssid="47-null-6" dnum="iii-o" numlevel="1" lineno="55" slineno="1-9" level="3"><display>(iii)</display>annexation will not leave or create an unincorporated island or unincorporated <ln numlevel="1" lineno="56" slineno="1-10"/>peninsula:<subsection ssid="47-null-7" dnum="A-o" numlevel="1" lineno="57" slineno="1-11" level="4"><display>(A)</display>except as provided in Subsection <xref depth="4" refnumber="10-2-418(3)" start="0">10-2-418(3)</xref>;</subsection><subsection ssid="47-null-8" dnum="B-o" numlevel="1" lineno="58" slineno="1-12" level="4"><display>(B)</display>except where an unincorporated island or peninsula existed before the <ln numlevel="1" lineno="59" slineno="1-13"/>annexation, if the annexation will reduce the size of the unincorporated island <ln numlevel="1" lineno="60" slineno="1-14"/>or peninsula; or</subsection><subsection ssid="47-null-9" dnum="C-o" numlevel="1" lineno="61" slineno="1-15" level="4"><display>(C)</display>unless the county and municipality have otherwise agreed; and</subsection></subsection><subsection ssid="47-null-10" dnum="iv-o" numlevel="1" lineno="62" slineno="1-16" level="3"><display>(iv)</display>for an area located in a specified county, the area is within the proposed annexing <ln numlevel="1" lineno="63" slineno="1-17"/>municipality's expansion area.</subsection></subsection><subsection ssid="47-null-11" dnum="c-o" numlevel="1" lineno="64" slineno="1-18" level="2"><display>(c)</display>A municipality may annex an unincorporated area within a specified county that does <ln numlevel="1" lineno="65" slineno="1-19"/>not meet the requirements of Subsection <xref depth="4" refnumber="10-2-402(1)(b)" start="0">(1)(b)</xref>, leaving or creating an unincorporated <ln numlevel="1" lineno="66" slineno="1-20"/>island or unincorporated peninsula, if:<subsection ssid="47-null-12" dnum="i-o" numlevel="1" lineno="67" slineno="1-21" level="3"><display>(i)</display>the area is within the annexing municipality's expansion area;</subsection><subsection ssid="47-null-13" dnum="ii-o" numlevel="1" lineno="68" slineno="1-22" level="3"><display>(ii)</display>the specified county in which the area is located and the annexing municipality <ln numlevel="1" lineno="69" slineno="1-23"/>agree to the annexation;</subsection><subsection ssid="47-null-14" dnum="iii-o" numlevel="1" lineno="70" slineno="1-24" level="3"><display>(iii)</display>the area is not within the area of another municipality's annexation policy plan, <ln numlevel="1" lineno="71" slineno="1-25"/>unless the other municipality agrees to the annexation; and</subsection><subsection ssid="47-null-15" dnum="iv-o" numlevel="1" lineno="72" slineno="1-26" level="3"><display>(iv)</display>the annexation is for the purpose of providing municipal services to the area.</subsection></subsection></subsection><subsection ssid="47-null-16" dnum="2-o" numlevel="1" lineno="73" slineno="1-27" level="1"><display>(2)</display>Except as provided in Section <xref depth="3" refnumber="10-2-418" start="0">10-2-418</xref>, a municipality may not annex an <ln numlevel="1" lineno="74" slineno="1-28"/>unincorporated area unless a petition under Section <xref depth="3" refnumber="10-2-403" start="0">10-2-403</xref> is filed requesting <ln numlevel="1" lineno="75" slineno="1-29"/>annexation.</subsection><subsection ssid="47-null-17" dnum="3-o" numlevel="1" lineno="76" slineno="1-30" level="1" space="false"><display>(3)</display><subsection ssid="47-null-18" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An annexation under this part may not include part of a parcel of real property and <ln numlevel="1" lineno="77" slineno="1-31"/>exclude part of that same parcel unless the owner of that parcel has signed the <ln numlevel="1" lineno="78" slineno="1-32"/>annexation petition under Section <xref depth="3" refnumber="10-2-403" start="0">10-2-403</xref>.</subsection><subsection ssid="47-null-19" dnum="b-o" numlevel="1" lineno="79" slineno="1-33" level="2"><display>(b)</display>A piece of real property that has more than one parcel number is considered to be a <ln numlevel="1" lineno="80" slineno="1-34"/>single parcel for purposes of Subsection <xref depth="4" refnumber="10-2-402(3)(a)" start="0">(3)(a)</xref> if owned by the same owner.</subsection></subsection><subsection ssid="47-null-20" dnum="4-o" numlevel="1" lineno="81" slineno="1-35" level="1"><display>(4)</display>A municipality may not annex an unincorporated area in a specified county for the sole <ln numlevel="1" lineno="82" slineno="1-36"/>purpose of acquiring municipal revenue or to retard the capacity of another municipality <ln numlevel="1" lineno="83" slineno="1-37"/>to annex the same or a related area unless the municipality has the ability and intent to <ln numlevel="1" lineno="84" slineno="1-38"/>benefit the annexed area by providing municipal services to the annexed area.</subsection><subsection ssid="47-null-21" dnum="5-o" numlevel="1" lineno="85" slineno="1-39" level="1" space="false"><display>(5)</display><subsection ssid="47-null-22" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this subsection, "expansion area urban development" means:<subsection ssid="47-null-23" dnum="i-o" numlevel="1" lineno="86" slineno="1-40" level="3" tab="1"><display>(i)</display>for a specified county, urban development within a city or town's expansion area; <ln numlevel="1" lineno="87" slineno="1-41"/>or</subsection><subsection ssid="47-null-24" dnum="ii-o" numlevel="1" lineno="88" slineno="1-42" level="3" tab="1"><display>(ii)</display>for a county of the first class, urban development within a city or town's <ln numlevel="1" lineno="89" slineno="1-43"/>expansion area that:<subsection ssid="47-null-25" dnum="A-o" numlevel="1" lineno="90" slineno="1-44" level="4"><display>(A)</display>consists of 50 or more acres;</subsection><subsection ssid="47-null-26" dnum="B-o" numlevel="1" lineno="91" slineno="1-45" level="4"><display>(B)</display>requires the county to change the zoning designation of the land on which the <ln numlevel="1" lineno="92" slineno="1-46"/>urban development is located; and</subsection><subsection ssid="47-null-27" dnum="C-o" numlevel="1" lineno="93" slineno="1-47" level="4"><display>(C)</display>does not include commercial or industrial development that is located within a <ln numlevel="1" lineno="94" slineno="1-48"/>mining protection area as defined in Section <xref depth="3" refnumber="17-41-101" start="0">17-41-101</xref>, regardless of whether <ln numlevel="1" lineno="95" slineno="1-49"/>the commercial or industrial development is for a mining use as defined in <ln numlevel="1" lineno="96" slineno="1-50"/>Section <xref depth="3" refnumber="17-41-101" start="0">17-41-101</xref>.</subsection></subsection></subsection><subsection ssid="47-null-28" dnum="b-o" numlevel="1" lineno="97" slineno="1-51" level="2"><display>(b)</display>A county legislative body may not approve expansion area urban development <ln numlevel="1" lineno="98" slineno="1-52"/>unless:<subsection ssid="47-null-29" dnum="i-o" numlevel="1" lineno="99" slineno="1-53" level="3"><display>(i)</display>the county notifies the city or town of the proposed development; and</subsection><subsection ssid="47-null-30" dnum="ii-o" numlevel="1" lineno="100" slineno="1-54" level="3" space="false"><display>(ii)</display><subsection ssid="47-null-31" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the city or town consents in writing to the development;</subsection><subsection ssid="47-null-32" dnum="B-o" numlevel="1" lineno="101" slineno="1-55" level="4"><display>(B)</display>within 90 days after the county's notification of the proposed development, the <ln numlevel="1" lineno="102" slineno="1-56"/>city or town submits to the county a written objection to the county's approval <ln numlevel="1" lineno="103" slineno="1-57"/>of the proposed development and the county responds in writing to the city or <ln numlevel="1" lineno="104" slineno="1-58"/>town's objection; or</subsection><subsection ssid="47-null-33" dnum="C-o" numlevel="1" lineno="105" slineno="1-59" level="4"><display>(C)</display>the city or town fails to respond to the county's notification of the proposed <ln numlevel="1" lineno="106" slineno="1-60"/>development within 90 days after the day on which the county provides the <ln numlevel="1" lineno="107" slineno="1-61"/>notice.</subsection></subsection></subsection></subsection><subsection ssid="47-null-34" dnum="6-o" numlevel="1" lineno="108" slineno="1-62" level="1" space="false"><display>(6)</display><subsection ssid="47-null-35" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="10-2-402(6)" start="0">(6)</xref>, "airport" means an area that the Federal Aviation <ln numlevel="1" lineno="109" slineno="1-63"/>Administration has, by a record of decision, approved for the construction or <ln numlevel="1" lineno="110" slineno="1-64"/>operation of a Class I, II, or III commercial service airport, as designated by the <ln numlevel="1" lineno="111" slineno="1-65"/>Federal Aviation Administration in 14 C.F.R. <ext_ref depth="2" refnumber="10-2-139" start="2" type="Code of Federal Regulations">Part 139</ext_ref>.</subsection><subsection ssid="47-null-36" dnum="b-o" numlevel="1" lineno="112" slineno="1-66" level="2"><display>(b)</display>A municipality may not annex an unincorporated area within 5,000 feet of the center <ln numlevel="1" lineno="113" slineno="1-67"/>line of any runway of an airport operated or to be constructed and operated by <ln numlevel="1" lineno="114" slineno="1-68"/>another municipality unless the legislative body of the other municipality adopts a <ln numlevel="1" lineno="115" slineno="1-69"/>resolution consenting to the annexation.</subsection><subsection ssid="47-null-37" dnum="c-o" numlevel="1" lineno="116" slineno="1-70" level="2"><display>(c)</display>A municipality that operates or intends to construct and operate an airport and does <ln numlevel="1" lineno="117" slineno="1-71"/>not adopt a resolution consenting to the annexation of an area described in Subsection <xref depth="4" refnumber="10-2-402(6)(b)" start="0"><ln numlevel="1" lineno="118" slineno="1-72"/>(6)(b)</xref> may not deny an annexation petition proposing the annexation of that same <ln numlevel="1" lineno="119" slineno="1-73"/>area to that municipality.</subsection></subsection><subsection ssid="47-null-38" dnum="7-o" numlevel="1" lineno="120" slineno="1-74" level="1" space="false"><display>(7)</display><subsection ssid="47-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="10-2-402(7)" start="0">(7)</xref>, "project area" means a project area as defined in <ln numlevel="1" lineno="121" slineno="1-75"/>Section <xref depth="3" refnumber="63H-1-102" start="0">63H-1-102</xref> that is in a project area plan as defined in Section <xref depth="3" refnumber="63H-1-102" start="0">63H-1-102</xref> <ln numlevel="1" lineno="122" slineno="1-76"/>adopted by the Military Installation Development Authority under <xref depth="1" refnumber="63H-1" start="0">Title 63H, Chapter <ln numlevel="1" lineno="123" slineno="1-77"/>1, Military Installation Development Authority Act</xref>.</subsection><subsection ssid="47-null-40" dnum="b-o" numlevel="1" lineno="124" slineno="1-78" level="2"><display>(b)</display>A municipality may not annex an unincorporated area located within a project area <ln numlevel="1" lineno="125" slineno="1-79"/>without the authority's approval.</subsection><subsection ssid="47-null-41" dnum="c-o" numlevel="1" lineno="126" slineno="1-80" level="2" space="false"><display>(c)</display><subsection ssid="47-null-42" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Except as provided in Subsection <xref depth="4" refnumber="10-2-402(7)(c)(ii)" start="0">(7)(c)(ii)</xref>, the Military Installation <ln numlevel="1" lineno="127" slineno="1-81"/>Development Authority may petition for annexation of the following areas to a <ln numlevel="1" lineno="128" slineno="1-82"/>municipality as if the Military Installation Development Authority was the sole <ln numlevel="1" lineno="129" slineno="1-83"/>private property owner within the area:<subsection ssid="47-null-43" dnum="A-o" numlevel="1" lineno="130" slineno="1-84" level="4" tab="1"><display>(A)</display>an area within a project area;</subsection><subsection ssid="47-null-44" dnum="B-o" numlevel="1" lineno="131" slineno="1-85" level="4" tab="1"><display>(B)</display>an area that is contiguous to a project area and within the boundaries of a <ln numlevel="1" lineno="132" slineno="1-86"/>military installation;</subsection><subsection ssid="47-null-45" dnum="C-o" numlevel="1" lineno="133" slineno="1-87" level="4" tab="1"><display>(C)</display>an area owned by the Military Installation Development Authority; and</subsection><subsection ssid="47-null-46" dnum="D-o" numlevel="1" lineno="134" slineno="1-88" level="4" tab="1"><display>(D)</display>an area that is contiguous to an area owned by the Military Installation <ln numlevel="1" lineno="135" slineno="1-89"/>Development Authority that the Military Installation Development Authority <ln numlevel="1" lineno="136" slineno="1-90"/>plans to add to an existing project area.</subsection></subsection><subsection ssid="47-null-47" dnum="ii-o" numlevel="1" lineno="137" slineno="1-91" level="3"><display>(ii)</display>If any portion of an area annexed under a petition for annexation filed by the <ln numlevel="1" lineno="138" slineno="1-92"/>Military Installation Development Authority is located in a specified county:<subsection ssid="47-null-48" dnum="A-o" numlevel="1" lineno="139" slineno="1-93" level="4"><display>(A)</display>the annexation process shall follow the requirements for a specified county; <ln numlevel="1" lineno="140" slineno="1-94"/>and</subsection><subsection ssid="47-null-49" apply.</subsection></subsection></subsection></subsection><subsection ssid="47-null-50" dnum="8-o" numlevel="1" lineno="142" slineno="1-96" level="1"><display>(8)</display>A municipality may not annex an unincorporated area if:<subsection ssid="47-null-51" dnum="a-o" numlevel="1" lineno="143" slineno="1-97" level="2" space="false"><display>(a)</display><subsection ssid="47-55" dnum="_-o:i-i" ea="amend" anum="0" owner="ahaskell" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="i" level="1" amendtag="both">(i)</amend></display>the area is proposed for incorporation in<amend anum="0" ea="amend" pairid="21" groupid="17" style="1" owner="ahaskell" level="1" amendtag="both">:</amend><subsection ssid="47-null-52" dnum="i-o:A-i" numlevel="1" lineno="144" slineno="1-98" level="4" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(A)</amend></display>a feasibility study conducted under Section <xref depth="3" refnumber="10-2a-205" start="0">10-2a-205</xref><amend anum="0" ea="amend" pairid="23" groupid="19" style="1" owner="ahaskell" level="1" amendtag="both">;</amend> deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1055" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>the county clerk completes the second public hearing on the proposed <ln numlevel="1" lineno="147" slineno="1-101"/>incorporation under Subsection <xref depth="4" refnumber="10-2a-207(4)" level="3"><display><amend anum="0" ea="amend" pairid="1061" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="60" groupid="48" style="1" owner="ahaskell" level="1" amendtag="end">proceed in accordance with this part after February 15, 2025.</amend></subsection></subsection></subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="163" slineno="2-14" level="1"><display>(2)</display>Subject to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="63" groupid="51" style="2" owner="ahaskell" level="1" deltag="both">Subsection</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="50" style="1" owner="ahaskell" level="1" amendtag="both" space="true">Subsections <xref refnumber="10-2a-502(1)" depth="4">(1)</xref> and</amend> (6), a person may file a feasibility request in <ln numlevel="1" lineno="164" slineno="2-15"/>relation to an area that the person seeks to incorporate as a preliminary municipality if:<subsection ssid="2-null-3" dnum="a-o" numlevel="1" lineno="165" slineno="2-16" level="2"><display>(a)</display>the area is contiguous;</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="166" slineno="2-17" level="2"><display>(b)</display>no part of the area is within a county of the first class or second class;</subsection><subsection ssid="2-null-5" dnum="c-o" numlevel="1" lineno="167" slineno="2-18" level="2"><display>(c)</display>no part of the area is within, or within .25 miles of, a municipality;</subsection><subsection ssid="2-null-6" dnum="d-o" numlevel="1" lineno="168" slineno="2-19" level="2"><display>(d)</display>on the day on which the person files the feasibility request:<subsection ssid="2-null-7" dnum="i-o" numlevel="1" lineno="169" slineno="2-20" level="3"><display>(i)</display>the area is owned by no more than three persons, all of whom consent to <ln numlevel="1" lineno="170" slineno="2-21"/>incorporation as a preliminary municipality; and</subsection><subsection ssid="2-null-8" dnum="ii-o" numlevel="1" lineno="171" slineno="2-22" level="3"><display>(ii)</display>at least 50% of the area is undeveloped;</subsection></subsection><subsection ssid="2-null-9" dnum="e-o" numlevel="1" lineno="172" slineno="2-23" level="2"><display>(e)</display>the persons who sign the feasibility request intend to develop the area to the point <ln numlevel="1" lineno="173" slineno="2-24"/>that:<subsection ssid="2-null-10" dnum="i-o" numlevel="1" lineno="174" slineno="2-25" level="3"><display>(i)</display>at least 100 individuals reside in the area;</subsection><subsection ssid="2-null-11" dnum="ii-o" numlevel="1" lineno="175" slineno="2-26" level="3"><display>(ii)</display>the area will have an average population density of no less than seven individuals <ln numlevel="1" lineno="176" slineno="2-27"/>per square mile, unless:<subsection ssid="2-null-12" dnum="A-o" numlevel="1" lineno="177" slineno="2-28" level="4"><display>(A)</display>a population density of less than seven individuals per square mile is <ln numlevel="1" lineno="178" slineno="2-29"/>necessary in order to connect separate areas that share a demonstrable <ln numlevel="1" lineno="179" slineno="2-30"/>community interest; and</subsection><subsection ssid="2-null-13" dnum="B-o" numlevel="1" lineno="180" slineno="2-31" level="4"><display>(B)</display>the average population of the area has a population density of no less than <ln numlevel="1" lineno="181" slineno="2-32"/>seven individuals per square mile if the land necessary to connect the separate <ln numlevel="1" lineno="182" slineno="2-33"/>areas described in Subsection (2)(e)(ii)(A) is not included in the calculation; <ln numlevel="1" lineno="183" slineno="2-34"/>and</subsection></subsection><subsection ssid="2-null-14" dnum="iii-o" numlevel="1" lineno="184" slineno="2-35" level="3"><display>(iii)</display>at least 10% of the housing in the preliminary municipality is affordable housing;</subsection></subsection><subsection ssid="2-null-15" dnum="f-o" numlevel="1" lineno="185" slineno="2-36" level="2"><display>(f)</display>the area does not include land owned by the United States government unless:<subsection ssid="2-null-16" dnum="i-o" numlevel="1" lineno="186" slineno="2-37" level="3"><display>(i)</display>the area, including the land owned by the United States government, is <ln numlevel="1" lineno="187" slineno="2-38"/>contiguous; and</subsection><subsection ssid="2-null-17" dnum="ii-o" numlevel="1" lineno="188" slineno="2-39" level="3" space="false"><display>(ii)</display><subsection ssid="2-null-18" dnum="A-o" level="4" placement="sameline"><display>(A)</display>incorporating the land is necessary to connect separate areas that share a <ln numlevel="1" lineno="189" slineno="2-40"/>demonstrable community interest; or</subsection><subsection ssid="2-null-19" dnum="B-o" numlevel="1" lineno="190" slineno="2-41" level="4"><display>(B)</display>excluding the land from the area would create an unincorporated island within <ln numlevel="1" lineno="191" slineno="2-42"/>the proposed preliminary municipality;</subsection></subsection></subsection><subsection ssid="2-null-20" dnum="g-o" numlevel="1" lineno="192" slineno="2-43" level="2"><display>(g)</display>the area is entirely within one county; and</subsection><subsection ssid="2-null-21" dnum="h-o" numlevel="1" lineno="193" slineno="2-44" level="2"><display>(h)</display>the feasibility request complies with Subsection (3).</subsection></subsection><subsection ssid="2-null-22" dnum="3-o" numlevel="1" lineno="194" slineno="2-45" level="1" space="false"><display>(3)</display><subsection ssid="2-null-23" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A proposed preliminary municipality area may not include all or part of a pending <ln numlevel="1" lineno="195" slineno="2-46"/>annexation area, unless:<subsection ssid="2-null-24" dnum="i-o" numlevel="1" lineno="196" slineno="2-47" level="3" tab="1"><display>(i)</display>the portion of the pending annexation area included in the proposed preliminary <ln numlevel="1" lineno="197" slineno="2-48"/>municipality area does not exceed 20% of the proposed preliminary municipality <ln numlevel="1" lineno="198" slineno="2-49"/>area; and</subsection><subsection ssid="2-null-25" dnum="ii-o" numlevel="1" lineno="199" slineno="2-50" level="3" tab="1"><display>(ii)</display>the feasibility request would comply with the requirements of this section <ln numlevel="1" lineno="200" slineno="2-51"/>regardless of whether the portion of the pending annexation area included in the <ln numlevel="1" lineno="201" slineno="2-52"/>proposed preliminary municipality area is excluded from, or remains included in, <ln numlevel="1" lineno="202" slineno="2-53"/>the proposed preliminary municipality area.</subsection></subsection><subsection ssid="2-null-26" dnum="b-o" numlevel="1" lineno="203" slineno="2-54" level="2"><display>(b)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="204" slineno="2-55"/>is the subject of a completed feasibility study or supplemental feasibility study that <ln numlevel="1" lineno="205" slineno="2-56"/>qualifies to proceed under Subsection <xref depth="3" refnumber="10-2a-205">10-2a-205</xref>(5)(a), unless:<subsection ssid="2-null-27" dnum="i-o" numlevel="1" lineno="206" slineno="2-57" level="3"><display>(i)</display>the proposed incorporation that is the subject of the completed feasibility study or <ln numlevel="1" lineno="207" slineno="2-58"/>supplemental feasibility study has been defeated by the voters at an election under <ln numlevel="1" lineno="208" slineno="2-59"/>Section <xref depth="3" refnumber="10-2a-210">10-2a-210</xref>; or</subsection><subsection ssid="2-null-28" dnum="ii-o" numlevel="1" lineno="209" slineno="2-60" level="3"><display>(ii)</display>the time described in Subsection <xref depth="3" refnumber="10-2a-208">10-2a-208</xref>(1) for filing an incorporation petition <ln numlevel="1" lineno="210" slineno="2-61"/>based on the completed feasibility study or supplemental feasibility study has <ln numlevel="1" lineno="211" slineno="2-62"/>elapsed without the sponsors filing an incorporation petition under Section <xref depth="3" refnumber="10-2a-208"><ln numlevel="1" lineno="212" slineno="2-63"/>10-2a-208</xref>.</subsection></subsection><subsection ssid="2-null-29" dnum="c-o" numlevel="1" lineno="213" slineno="2-64" level="2"><display>(c)</display>A proposed preliminary municipality area may not include all or part of an area that <ln numlevel="1" lineno="214" slineno="2-65"/>is the subject of a completed feasibility study or supplemental feasibility study whose <ln numlevel="1" lineno="215" slineno="2-66"/>results comply with Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref>(4), unless the time described in Subsection <xref depth="3" refnumber="10-2a-507"><ln numlevel="1" lineno="216" slineno="2-67"/>10-2a-507</xref>(1) for filing a petition for incorporation based on the completed feasibility <ln numlevel="1" lineno="217" slineno="2-68"/>study or supplemental feasibility study has elapsed without the sponsors filing a <ln numlevel="1" lineno="218" slineno="2-69"/>petition for incorporation under Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>.</subsection></subsection><subsection ssid="2-null-30" dnum="4-o" numlevel="1" lineno="219" slineno="2-70" level="1"><display>(4)</display>Except as provided in Section <xref depth="3" refnumber="10-2a-505">10-2a-505</xref>, the lieutenant governor shall consider each <ln numlevel="1" lineno="220" slineno="2-71"/>feasibility request that includes an area described in Subsection (3)(a) as if the request <ln numlevel="1" lineno="221" slineno="2-72"/>does not include the area described in Subsection (3)(a).</subsection><subsection ssid="2-null-31" dnum="5-o" numlevel="1" lineno="222" slineno="2-73" level="1"><display>(5)</display>A person who files a feasibility request under this section shall file the feasibility <ln numlevel="1" lineno="223" slineno="2-74"/>request with the lieutenant governor, including in the feasibility request:<subsection ssid="2-null-32" dnum="a-o" numlevel="1" lineno="224" slineno="2-75" level="2"><display>(a)</display>the signatures of all owners of real property included in the proposed preliminary <ln numlevel="1" lineno="225" slineno="2-76"/>municipality area, showing that the owners consent to including the real property in <ln numlevel="1" lineno="226" slineno="2-77"/>the proposed preliminary municipality area;</subsection><subsection ssid="2-null-33" dnum="b-o" numlevel="1" lineno="227" slineno="2-78" level="2"><display>(b)</display>the name, address, and phone number of each owner signing the feasibility request;</subsection><subsection ssid="2-null-34" dnum="c-o" numlevel="1" lineno="228" slineno="2-79" level="2"><display>(c)</display>a designation of one individual who signs the feasibility request as the primary <ln numlevel="1" lineno="229" slineno="2-80"/>sponsor contact for the feasibility request;</subsection><subsection ssid="2-null-35" dnum="d-o" numlevel="1" lineno="230" slineno="2-81" level="2"><display>(d)</display>a description of the proposed preliminary municipality area;</subsection><subsection ssid="2-null-36" dnum="e-o" numlevel="1" lineno="231" slineno="2-82" level="2"><display>(e)</display>an accurate map or plat, prepared by a licensed surveyor, showing:<subsection ssid="2-null-37" dnum="i-o" numlevel="1" lineno="232" slineno="2-83" level="3"><display>(i)</display>a legal description of the boundaries of the proposed preliminary municipality area <ln numlevel="1" lineno="233" slineno="2-84"/>and each phase of the proposed preliminary municipality area;</subsection><subsection ssid="2-null-38" dnum="ii-o" numlevel="1" lineno="234" slineno="2-85" level="3"><display>(ii)</display>all development planned for the proposed preliminary municipality area; and</subsection><subsection ssid="2-null-39" dnum="iii-o" numlevel="1" lineno="235" slineno="2-86" level="3"><display>(iii)</display>that the first phase of the proposed preliminary municipality area is projected to <ln numlevel="1" lineno="236" slineno="2-87"/>have at least 100 residents when completed; and</subsection></subsection><subsection ssid="2-null-40" dnum="f-o" numlevel="1" lineno="237" slineno="2-88" level="2"><display>(f)</display>a request that the lieutenant governor commission a study to determine the feasibility <ln numlevel="1" lineno="238" slineno="2-89"/>of incorporating the area as a preliminary municipality.</subsection></subsection><subsection ssid="2-null-41" dnum="6-o" numlevel="1" lineno="239" slineno="2-90" level="1" space="false"><display>(6)</display><subsection ssid="2-null-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The provisions of this part, providing for the incorporation of a preliminary <ln numlevel="1" lineno="240" slineno="2-91"/>municipality, is a pilot project that ends on January 1, 2031.</subsection><subsection ssid="2-null-43" dnum="b-o" numlevel="1" lineno="241" slineno="2-92" level="2"><display>(b)</display>Except as provided in Subsection (7), a person may not file a feasibility request <ln numlevel="1" lineno="242" slineno="2-93"/>under this part in a calendar year during which two or more requests have already <ln numlevel="1" lineno="243" slineno="2-94"/>been filed in the state.</subsection></subsection><subsection ssid="2-null-44" dnum="7-o" numlevel="1" lineno="244" slineno="2-95" level="1"><display>(7)</display>A feasibility request does not count towards the limit described in Subsection (6)(b) if:<subsection ssid="2-null-45" dnum="a-o" numlevel="1" lineno="245" slineno="2-96" level="2"><display>(a)</display>the sponsors who file the request withdraw the request;</subsection><subsection ssid="2-null-46" dnum="b-o" numlevel="1" lineno="246" slineno="2-97" level="2"><display>(b)</display>the lieutenant governor rejects the feasibility request under Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(4) <ln numlevel="1" lineno="247" slineno="2-98"/>or (5)(b), and the sponsors:<subsection ssid="2-null-47" dnum="i-o" numlevel="1" lineno="248" slineno="2-99" level="3"><display>(i)</display>do not timely amend the feasibility request under Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(7)(b); or</subsection><subsection ssid="2-null-48" dnum="ii-o" numlevel="1" lineno="249" slineno="2-100" level="3"><display>(ii)</display>are prohibited from amending the feasibility request under Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref><ln numlevel="1" lineno="250" slineno="2-101"/>(7)(c); or</subsection></subsection><subsection ssid="2-null-49" dnum="c-o" numlevel="1" lineno="251" slineno="2-102" level="2"><display>(c)</display>the process to incorporate is prohibited from proceeding under Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref><ln numlevel="1" lineno="252" slineno="2-103"/>(5)(a) and the sponsors:<subsection ssid="2-null-50" dnum="i-o" numlevel="1" lineno="253" slineno="2-104" level="3"><display>(i)</display>do not timely file a modified feasibility request under Subsection <xref depth="3" refnumber="10-2a-505">10-2a-505</xref><ln numlevel="1" lineno="254" slineno="2-105"/>(1)(b)(i); or</subsection><subsection ssid="2-null-51" dnum="ii-o" numlevel="1" lineno="255" slineno="2-106" level="3"><display>(ii)</display>are prohibited from filing a modified feasibility request under Subsection <xref depth="3" refnumber="10-2a-505"><ln numlevel="1" lineno="256" slineno="2-107"/>10-2a-505</xref>(3).</subsection></subsection></subsection></section></bsec><bsec buid="6" num="10-2a-505" type="amend" src="code" modify the request to alter the <ln numlevel="1" lineno="261" slineno="3-5"/>boundaries of the proposed preliminary municipality area and refile the modified <ln numlevel="1" lineno="262" slineno="3-6"/>feasibility request with the lieutenant governor if:<subsection ssid="6-null-3" dnum="i-o" numlevel="1" lineno="263" slineno="3-7" level="3" tab="1"><display>(i)</display>the results of the feasibility study do not comply with Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref>(5)(a); <ln numlevel="1" lineno="264" slineno="3-8"/>or</subsection><subsection ssid="6-null-4" dnum="ii-o" numlevel="1" lineno="265" slineno="3-9" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="6-null-5" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the feasibility request complies with Subsection <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>(3)(a);</subsection><subsection ssid="6-null-6" dnum="B-o" numlevel="1" lineno="266" slineno="3-10" level="4"><display>(B)</display>the annexation petition described in Subsection <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>(3)(a) that proposed <ln numlevel="1" lineno="267" slineno="3-11"/>the annexation of an area that is part of the proposed preliminary municipality <ln numlevel="1" lineno="268" slineno="3-12"/>area has been denied; and</subsection><subsection ssid="6-null-7" dnum="C-o" numlevel="1" lineno="269" slineno="3-13" level="4"><display>(C)</display>a petition for incorporation described in Section <xref depth="3" refnumber="10-2a-507">10-2a-507</xref>, based on the <ln numlevel="1" lineno="270" slineno="3-14"/>feasibility request, has not been filed.</subsection></subsection></subsection><subsection ssid="6-null-8" dnum="b-o" numlevel="1" lineno="271" slineno="3-15" level="2" space="false"><display>(b)</display><subsection ssid="6-null-9" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The sponsors of a feasibility request may not file a modified request under <ln numlevel="1" lineno="272" slineno="3-16"/>Subsection (1)(a)(i) more than 90 days after the day on which the feasibility <ln numlevel="1" lineno="273" slineno="3-17"/>consultant submits the final results of the feasibility study under Subsection <xref depth="3" refnumber="10-2a-504"><ln numlevel="1" lineno="274" slineno="3-18"/>10-2a-504</xref>(2)(c)(iii).</subsection><subsection ssid="6-null-10" dnum="ii-o" numlevel="1" lineno="275" slineno="3-19" level="3"><display>(ii)</display>The sponsors of a feasibility request may not file a modified request under <ln numlevel="1" lineno="276" slineno="3-20"/>Subsection (1)(a)(ii) more than 18 months after filing the original feasibility <ln numlevel="1" lineno="277" slineno="3-21"/>request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>.</subsection></subsection><subsection ssid="6-null-11" dnum="c-o" numlevel="1" lineno="278" slineno="3-22" level="2"><display>(c)</display>A modified feasibility request under Subsection (1)(a) shall comply with Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="10-2a-502"><ln numlevel="1" lineno="279" slineno="3-23"/>10-2a-502</xref>(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="10-2a-502(2)" depth="4">10-2a-502(2)</xref></amend> through (4).</subsection><subsection ssid="6-null-12" dnum="d-o" numlevel="1" lineno="280" slineno="3-24" level="2"><display>(d)</display>Within 20 days after the day on which the lieutenant governor receives the modified <ln numlevel="1" lineno="281" slineno="3-25"/>request, the lieutenant governor shall follow the same procedure described in <ln numlevel="1" lineno="282" slineno="3-26"/>Subsections <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(1) through (4) for the modified feasibility request as for an <ln numlevel="1" lineno="283" slineno="3-27"/>original feasibility request.</subsection></subsection><subsection ssid="6-null-13" dnum="2-o" numlevel="1" lineno="284" slineno="3-28" level="1"><display>(2)</display>The timely filing of a modified feasibility request under Subsection (1) gives the <ln numlevel="1" lineno="285" slineno="3-29"/>modified feasibility request the same processing priority under Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(6) <ln numlevel="1" lineno="286" slineno="3-30"/>as the original feasibility request.</subsection><subsection ssid="6-null-14" dnum="3-o" numlevel="1" lineno="287" slineno="3-31" level="1"><display>(3)</display>The sponsors of a feasibility request may not file a modified feasibility request under <ln numlevel="1" lineno="288" slineno="3-32"/>Subsection (1)(a)(i) more than once.</subsection><subsection ssid="6-null-15" dnum="4-o" numlevel="1" lineno="289" slineno="3-33" level="1"><display>(4)</display>Within 10 days after the day on which the county clerk receives a modified feasibility <ln numlevel="1" lineno="290" slineno="3-34"/>request under Subsection (1)(a) that relates to a request for which a feasibility study has <ln numlevel="1" lineno="291" slineno="3-35"/>already been completed, the lieutenant governor shall commission the feasibility <ln numlevel="1" lineno="292" slineno="3-36"/>consultant who conducted the feasibility study to conduct a supplemental feasibility <ln numlevel="1" lineno="293" slineno="3-37"/>study that accounts for the modified feasibility request.</subsection><subsection ssid="6-null-16" dnum="5-o" numlevel="1" lineno="294" slineno="3-38" level="1"><display>(5)</display>The lieutenant governor shall require the feasibility consultant to:<subsection ssid="6-null-17" dnum="a-o" numlevel="1" lineno="295" slineno="3-39" level="2"><display>(a)</display>submit a draft of the supplemental feasibility study to each applicable person with <ln numlevel="1" lineno="296" slineno="3-40"/>whom the feasibility consultant is required to consult under Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref><ln numlevel="1" lineno="297" slineno="3-41"/>(3)(c) within 30 days after the day on which the feasibility consultant is engaged to <ln numlevel="1" lineno="298" slineno="3-42"/>conduct the supplemental study;</subsection><subsection ssid="6-null-18" dnum="b-o" numlevel="1" lineno="299" slineno="3-43" level="2"><display>(b)</display>allow each person to whom the consultant provided a draft under Subsection (5)(a) to <ln numlevel="1" lineno="300" slineno="3-44"/>review and provide comment on the draft; and</subsection><subsection ssid="6-null-19" dnum="c-o" numlevel="1" lineno="301" slineno="3-45" level="2"><display>(c)</display>submit a completed supplemental feasibility study, to the following within 45 days <ln numlevel="1" lineno="302" slineno="3-46"/>after the day on which the feasibility consultant is engaged to conduct the feasibility <ln numlevel="1" lineno="303" slineno="3-47"/>study:<subsection ssid="6-null-20" dnum="i-o" numlevel="1" lineno="304" slineno="3-48" level="3"><display>(i)</display>the lieutenant governor;</subsection><subsection ssid="6-null-21" dnum="ii-o" numlevel="1" lineno="305" slineno="3-49" level="3"><display>(ii)</display>the county legislative body of the county in which the incorporation is proposed;</subsection><subsection ssid="6-null-22" dnum="iii-o" numlevel="1" lineno="306" slineno="3-50" level="3"><display>(iii)</display>the primary sponsor contact; and</subsection><subsection ssid="6-null-23" dnum="iv-o" numlevel="1" lineno="307" slineno="3-51" level="3"><display>(iv)</display>each person to whom the consultant provided a draft under Subsection (5)(a).</subsection></subsection></subsection><subsection ssid="6-null-24" dnum="6-o" numlevel="1" lineno="308" slineno="3-52" level="1" space="false"><display>(6)</display><subsection ssid="6-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsections (3) and (6)(b), if the results of the supplemental feasibility <ln numlevel="1" lineno="309" slineno="3-53"/>study do not comply with Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref>(4), the sponsors may further modify <ln numlevel="1" lineno="310" slineno="3-54"/>the request in accordance with Subsection (1).</subsection><subsection ssid="6-null-26" dnum="b-o" numlevel="1" lineno="311" slineno="3-55" level="2"><display>(b)</display>Subsections (1)(d), (4), and (5) apply to a modified feasibility request described in <ln numlevel="1" lineno="312" slineno="3-56"/>Subsection (6)(a).</subsection><subsection ssid="6-null-27" dnum="c-o" numlevel="1" lineno="313" slineno="3-57" level="2"><display>(c)</display>The lieutenant governor shall consider a modified feasibility request described in <ln numlevel="1" lineno="314" slineno="3-58"/>Subsection (6)(a) as an original feasibility request for purposes of determining the <ln numlevel="1" lineno="315" slineno="3-59"/>modified feasibility request's processing priority under Subsection <xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(6).</subsection></subsection></section></bsec><bsec buid="18" num="10-2a-507" type="amend" src="code" uid="C10-2a-S507_2025050720250507" sort="10 02a05070020250507" numlevel="1" lineno="316" slineno="4-1" sn="4"><section number="10-2a-507" numlevel="1" lineno="317" slineno="4-2" type="amend"><secline lineno="316">Section 4, Section <bold>10-2a-507</bold> is amended to read:</secline><catline lineno="317"><bold>10-2a-507 (Effective 05/07/25) (Applies beginning 02/15/25) (Repealed 01/01/31). <ln numlevel="1" lineno="318" slineno="4-3"/>Petition for incorporation -- Requirements and form.</bold></catline><subsection ssid="18-null-1" dnum="1-o" numlevel="1" lineno="319" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>At any time within one year after the day on which the lieutenant governor completes <ln numlevel="1" lineno="320" slineno="4-5"/>the public hearings required under Section <xref depth="3" refnumber="10-2a-506">10-2a-506</xref>, the owners of the property who <ln numlevel="1" lineno="321" slineno="4-6"/>filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref> for the proposed preliminary <ln numlevel="1" lineno="322" slineno="4-7"/>municipality area may proceed with the incorporation process by filing a petition for <ln numlevel="1" lineno="323" slineno="4-8"/>incorporation of the proposed preliminary municipality that:<subsection ssid="18-null-2" dnum="a-o" numlevel="1" lineno="324" slineno="4-9" level="2"><display>(a)</display>includes the typed or printed name, signature, address, and phone number of the <ln numlevel="1" lineno="325" slineno="4-10"/>initial landowners;</subsection><subsection ssid="18-null-3" dnum="b-o" numlevel="1" lineno="326" slineno="4-11" level="2"><display>(b)</display>describes the proposed preliminary municipality area, as described in the feasibility <ln numlevel="1" lineno="327" slineno="4-12"/>request or the modified feasibility request;</subsection><subsection ssid="18-null-4" dnum="c-o" numlevel="1" lineno="328" slineno="4-13" level="2"><display>(c)</display>demonstrates compliance with Subsection <xref depth="3" refnumber="10-2a-504">10-2a-504</xref>(4);</subsection><subsection ssid="18-null-5" dnum="d-o" numlevel="1" lineno="329" slineno="4-14" level="2"><display>(d)</display>states the proposed name for the proposed preliminary municipality;</subsection><subsection ssid="18-null-6" dnum="e-o" numlevel="1" lineno="330" slineno="4-15" level="2"><display>(e)</display>designates the primary sponsor contact for the proposed preliminary municipality;</subsection><subsection ssid="18-null-7" dnum="f-o" numlevel="1" lineno="331" slineno="4-16" level="2"><display>(f)</display>designates the board chair and three of the four board members who will serve as a <ln numlevel="1" lineno="332" slineno="4-17"/>five member council form of government for the preliminary municipality, described <ln numlevel="1" lineno="333" slineno="4-18"/>in Section <xref depth="3" refnumber="10-3b-402">10-3b-402</xref>, for the preliminary municipality;</subsection><subsection ssid="18-null-8" dnum="g-o" numlevel="1" lineno="334" slineno="4-19" level="2"><display>(g)</display>is accompanied by an accurate map or plat, prepared by a licensed surveyor, showing:<subsection ssid="18-null-9" dnum="i-o" numlevel="1" lineno="335" slineno="4-20" level="3"><display>(i)</display>the boundaries of the proposed preliminary municipality;</subsection><subsection ssid="18-null-10" dnum="ii-o" numlevel="1" lineno="336" slineno="4-21" level="3"><display>(ii)</display>a single development plan for the proposed municipality, depicting each phase of <ln numlevel="1" lineno="337" slineno="4-22"/>the development;</subsection></subsection><subsection ssid="18-null-11" dnum="h-o" numlevel="1" lineno="338" slineno="4-23" level="2"><display>(h)</display>is accompanied by a bond, cash deposit, or letter of credit that:<subsection ssid="18-null-12" dnum="i-o" numlevel="1" lineno="339" slineno="4-24" level="3"><display>(i)</display>is posted by the initial landowners;</subsection><subsection ssid="18-null-13" dnum="ii-o" numlevel="1" lineno="340" slineno="4-25" level="3"><display>(ii)</display>is in favor of the proposed preliminary municipality, to guarantee that the initial <ln numlevel="1" lineno="341" slineno="4-26"/>landowners will complete the system infrastructure no later than six years after the <ln numlevel="1" lineno="342" slineno="4-27"/>day on which the initial landowners file the petition for incorporation described in <ln numlevel="1" lineno="343" slineno="4-28"/>this section; and</subsection><subsection ssid="18-null-14" dnum="iii-o" numlevel="1" lineno="344" slineno="4-29" level="3"><display>(iii)</display>will be refunded to the initial landowners in percentages that reflect the progress <ln numlevel="1" lineno="345" slineno="4-30"/>toward completing the system infrastructure;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="45" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="18-null-15" dnum="i-o" numlevel="1" lineno="346" slineno="4-31" level="2"><display>(i)</display>is accompanied by payment in full, from the initial landowners, of the costs incurred <ln numlevel="1" lineno="347" slineno="4-32"/>by the lieutenant governor for the feasibility study, the public notices, the hearings, <ln numlevel="1" lineno="348" slineno="4-33"/>and the other expenses incurred by the lieutenant governor to comply with the <ln numlevel="1" lineno="349" slineno="4-34"/>requirements of this part in relation to the proposed preliminary municipality<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="ahaskell" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="18-23" dnum="_-o:j-i" numlevel="1" lineno="350" slineno="4-35" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="i" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">is accompanied by an agreement by the initial landowners that, before the preliminary <ln numlevel="1" lineno="351" slineno="4-36"/>municipality can transition into a town, the county will be fully compensated for any <ln numlevel="1" lineno="352" slineno="4-37"/>damages to county property or infrastructure that are directly attributable to <ln numlevel="1" lineno="353" slineno="4-38"/>development of the area.</amend></subsection></subsection><subsection ssid="18-null-16" dnum="2-o" numlevel="1" lineno="354" slineno="4-39" level="1"><display>(2)</display>If, within six years after the day on which the initial landowners file a petition for <ln numlevel="1" lineno="355" slineno="4-40"/>incorporation under Subsection (1), the system infrastructure for the preliminary <ln numlevel="1" lineno="356" slineno="4-41"/>municipality is not completed, the portion of the bond, cash deposit, or letter of credit <ln numlevel="1" lineno="357" slineno="4-42"/>described in Subsection (1)(h) that has not been refunded to the initial landowners shall <ln numlevel="1" lineno="358" slineno="4-43"/>forfeit to the preliminary municipality.</subsection><subsection ssid="18-null-17" dnum="3-o" numlevel="1" lineno="359" slineno="4-44" level="1"><display>(3)</display>If, within four years after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="360" slineno="4-45"/>is issued for the development described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="43" style="2" owner="ahaskell" level="1" deltag="start"><xref depth="3" refnumber="10-2a-503">10-2a-503</xref></amend><amend anum="0" ea="erase" pairid="52" groupid="44" style="2" owner="ahaskell" level="1" deltag="end">(5)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="49" groupid="41" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref refnumber="10-2a-502(5)(e)" depth="4">10-2a-502(5)(e)</xref></amend>, <ln numlevel="1" lineno="361" slineno="4-46"/>or six years after the day on which the initial landowners file a petition for incorporation <ln numlevel="1" lineno="362" slineno="4-47"/>under Subsection (1), the preliminary municipality has not transitioned to a town:<subsection ssid="18-null-18" dnum="a-o" numlevel="1" lineno="363" slineno="4-48" level="2"><display>(a)</display>the lieutenant governor shall issue a certificate dissolving the preliminary <ln numlevel="1" lineno="364" slineno="4-49"/>municipality;</subsection><subsection ssid="18-null-19" dnum="b-o" numlevel="1" lineno="365" slineno="4-50" level="2"><display>(b)</display>all roads and infrastructure within the preliminary municipality revert to the county <ln numlevel="1" lineno="366" slineno="4-51"/>in which the preliminary municipality is located;</subsection><subsection ssid="18-null-20" dnum="c-o" numlevel="1" lineno="367" slineno="4-52" level="2"><display>(c)</display>the area within the proposed municipality falls under the jurisdiction of the county <ln numlevel="1" lineno="368" slineno="4-53"/>and is no longer incorporated; and</subsection><subsection ssid="18-null-21" dnum="d-o" numlevel="1" lineno="369" slineno="4-54" level="2"><display>(d)</display>the initial landowners are liable to the county for damages caused to the county due <ln numlevel="1" lineno="370" slineno="4-55"/>to the dissolution of the preliminary municipality.</subsection></subsection></section></bsec><bsec buid="14" num="10-2a-509" type="amend" src="code" uid="C10-2a-S509_2025050720250507" sort="10 02a05090020250507" numlevel="1" lineno="371" slineno="5-1" sn="5"><section number="10-2a-509" numlevel="1" lineno="372" slineno="5-2" type="amend"><secline lineno="371">Section 5, Section <bold>10-2a-509</bold> is amended to read:</secline><catline lineno="372"><bold>10-2a-509 (Effective 05/07/25) (Applies beginning 02/15/25) (Repealed 01/01/31). <ln numlevel="1" lineno="373" slineno="5-3"/>Governance of preliminary municipality -- Utilities -- Road maintenance. </bold></catline><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="374" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="14-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 30 days after the day on which the lieutenant governor issues a certificate <ln numlevel="1" lineno="375" slineno="5-5"/>of incorporation described in Subsection <xref depth="3" refnumber="10-2a-508">10-2a-508</xref>(1)(b)(i), the county in which the <ln numlevel="1" lineno="376" slineno="5-6"/>preliminary municipality is located shall appoint one board member for the <ln numlevel="1" lineno="377" slineno="5-7"/>preliminary municipality.</subsection><subsection ssid="14-null-3" dnum="b-o" numlevel="1" lineno="378" slineno="5-8" level="2"><display>(b)</display>If the county fails to timely comply with Subsection (1)(a), the board chair and the <ln numlevel="1" lineno="379" slineno="5-9"/>three board members appointed under Subsection <xref depth="3" refnumber="10-2a-508">10-2a-508</xref>(1)(b)(i) shall, by <ln numlevel="1" lineno="380" slineno="5-10"/>majority vote, appoint the final board member.</subsection></subsection><subsection ssid="14-null-4" dnum="2-o" numlevel="1" lineno="381" slineno="5-11" level="1"><display>(2)</display>The board chair and board members, described in Subsection (1), of a preliminary <ln numlevel="1" lineno="382" slineno="5-12"/>municipality:<subsection ssid="14-null-5" dnum="a-o" numlevel="1" lineno="383" slineno="5-13" level="2"><display>(a)</display>are not required to be residents of the preliminary municipality; and</subsection><subsection ssid="14-null-6" dnum="b-o" numlevel="1" lineno="384" slineno="5-14" level="2"><display>(b)</display>shall serve as the board for the preliminary municipality until replaced by election <ln numlevel="1" lineno="385" slineno="5-15"/>under Section <xref depth="3" refnumber="10-2a-510">10-2a-510</xref>.</subsection></subsection><subsection ssid="14-null-7" dnum="3-o" numlevel="1" lineno="386" slineno="5-16" level="1" space="false"><display>(3)</display><subsection ssid="14-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Within 14 days after the day on which the first residential certificate of occupancy <ln numlevel="1" lineno="387" slineno="5-17"/>is issued for the development described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="31" style="2" owner="ahaskell" level="1" deltag="both"><xref depth="3" refnumber="10-2a-503">10-2a-503</xref>(5)(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="30" style="1" owner="ahaskell" level="1" amendtag="both" space="true"><xref depth="4" refnumber="10-2a-502(5)(e)"><ln numlevel="1" lineno="388" slineno="5-18"/>10-2a-502(5)(e)</xref></amend>, the engineer described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="26" style="2" owner="ahaskell" level="1" deltag="both"><xref refnumber="10-2a-509(6)" depth="4">10-2a-509(6)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="25" style="1" owner="ahaskell" level="1" amendtag="both" space="true">(8)</amend>, shall notify <ln numlevel="1" lineno="389" slineno="5-19"/>the county and the lieutenant governor, in writing:<subsection ssid="14-null-9" dnum="i-o" numlevel="1" lineno="390" slineno="5-20" level="3" tab="1"><display>(i)</display>that the first residential certificate of occupancy has been issued for the <ln numlevel="1" lineno="391" slineno="5-21"/>preliminary municipality;</subsection><subsection ssid="14-null-10" dnum="ii-o" numlevel="1" lineno="392" slineno="5-22" level="3" tab="1"><display>(ii)</display>of the date on which the first residential certificate of occupancy was issued; and</subsection><subsection ssid="14-null-11" dnum="iii-o" numlevel="1" lineno="393" slineno="5-23" level="3" tab="1"><display>(iii)</display>of the physical address for which the first residential certificate of occupancy <ln numlevel="1" lineno="394" slineno="5-24"/>was issued.</subsection></subsection><subsection ssid="14-null-12" dnum="b-o" numlevel="1" lineno="395" slineno="5-25" level="2"><display>(b)</display>No later than the next municipal general election, or regular general election, that is <ln numlevel="1" lineno="396" slineno="5-26"/>at least 30 days after the date described in Subsection (3)(a)(ii), the initial landowners <ln numlevel="1" lineno="397" slineno="5-27"/>shall:<subsection ssid="14-null-13" dnum="i-o" numlevel="1" lineno="398" slineno="5-28" level="3"><display>(i)</display>replace the board chair or a board member with an individual who is a resident of <ln numlevel="1" lineno="399" slineno="5-29"/>the preliminary municipality; and</subsection><subsection ssid="14-null-14" dnum="ii-o" numlevel="1" lineno="400" slineno="5-30" level="3"><display>(ii)</display>notify the county and the lieutenant governor of the appointment, in writing.</subsection></subsection></subsection><subsection ssid="14-null-15" dnum="4-o" numlevel="1" lineno="401" slineno="5-31" level="1" space="false"><display>(4)</display><subsection ssid="14-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection (4)(b), a preliminary municipality has all the powers and <ln numlevel="1" lineno="402" slineno="5-32"/>duties of a municipality.</subsection><subsection ssid="14-null-17" dnum="b-o" numlevel="1" lineno="403" slineno="5-33" level="2"><display>(b)</display>A preliminary municipality:<subsection ssid="14-null-18" dnum="i-o" numlevel="1" lineno="404" slineno="5-34" level="3"><display>(i)</display>may not impose a tax;</subsection><subsection ssid="14-null-19" dnum="ii-o" numlevel="1" lineno="405" slineno="5-35" level="3"><display>(ii)</display>may enter into an interlocal agreement with a special district to provide utility <ln numlevel="1" lineno="406" slineno="5-36"/>services to the preliminary municipality;</subsection><subsection ssid="14-null-20" dnum="iii-o" numlevel="1" lineno="407" slineno="5-37" level="3"><display>(iii)</display>has the same authority as another municipality to make decisions regarding <ln numlevel="1" lineno="408" slineno="5-38"/>zoning and land use;</subsection><subsection ssid="14-null-21" dnum="iv-o" numlevel="1" lineno="409" slineno="5-39" level="3"><display>(iv)</display>may not receive an allocation of sales tax or gas tax;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="23" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="14-null-22" dnum="v-o" numlevel="1" lineno="410" slineno="5-40" level="3"><display>(v)</display>may not exercise eminent domain authority<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="14-37" dnum="_-o:vi-i" numlevel="1" lineno="411" slineno="5-41" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="i" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="32" style="1" owner="ahaskell" level="1" amendtag="end">may not annex an unincorporated area under Chapter 2, Part 4, Annexation; and</amend></subsection><subsection ssid="14-32" dnum="_-o:vii-i" numlevel="1" lineno="412" slineno="5-42" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="i" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="ahaskell" level="1" amendtag="end">if the preliminary municipality is located in a county of the fourth, fifth, or sixth <ln numlevel="1" lineno="413" slineno="5-43"/>class:</amend><subsection ssid="14-42" dnum="_-o:A-i" numlevel="1" lineno="414" slineno="5-44" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="i" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="45" style="1" owner="ahaskell" level="1" amendtag="end">shall comply with terms, conditions, or restrictions that were established in a <ln numlevel="1" lineno="415" slineno="5-45"/>development agreement between the initial landowners and the county before <ln numlevel="1" lineno="416" slineno="5-46"/>the feasibility request was filed; and</amend></subsection><subsection ssid="14-35" dnum="_-o:B-i" numlevel="1" lineno="417" slineno="5-47" ea="amend" anum="0" owner="ahaskell" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1186" style="1" owner="i" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="28" groupid="22" style="1" owner="ahaskell" level="1" amendtag="end">may not modify or terminate any terms, conditions, or restrictions described in <ln numlevel="1" lineno="418" slineno="5-48"/>Subsection (4)(b)(vii)(A) without the county's approval.</amend></subsection></subsection></subsection></subsection><subsection ssid="14-null-23" dnum="5-o" numlevel="1" lineno="419" slineno="5-49" level="1"><display>(5)</display>As needed, the county shall provide all services and utility connections to the <ln numlevel="1" lineno="420" slineno="5-50"/>preliminary municipality that the county provides other areas in the county if the <ln numlevel="1" lineno="421" slineno="5-51"/>preliminary municipality:<subsection ssid="14-null-24" dnum="a-o" numlevel="1" lineno="422" slineno="5-52" level="2"><display>(a)</display>pays the uniformly assessed rates for the services and utilities and reasonable <ln numlevel="1" lineno="423" slineno="5-53"/>connection fees; and</subsection><subsection ssid="14-null-25" dnum="b-o" numlevel="1" lineno="424" slineno="5-54" level="2"><display>(b)</display>complies with the county's established regulations and specifications for the <ln numlevel="1" lineno="425" slineno="5-55"/>construction and connection of the local improvements.</subsection></subsection><subsection ssid="14-38" dnum="_-o:6-i" numlevel="1" lineno="426" slineno="5-56" ea="amend" anum="0" owner="ahaskell" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1190" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><subsection ssid="14-39" dnum="_-o:a-i" ea="amend" anum="0" owner="ahaskell" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1191" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="34" style="1" owner="ahaskell" level="1" amendtag="end">The preliminary municipality shall ensure that the preliminary municipality's <ln numlevel="1" lineno="427" slineno="5-57"/>system infrastructure complies with county standards for that infrastructure.</amend></subsection><subsection ssid="14-40" dnum="_-o:b-i" numlevel="1" lineno="428" slineno="5-58" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1192" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="41" style="1" owner="ahaskell" level="1" amendtag="end">The county may inspect a preliminary municipality's system infrastructure to verify <ln numlevel="1" lineno="429" slineno="5-59"/>compliance with county standards for that infrastructure.</amend></subsection></subsection><subsection ssid="14-null-26" dnum="6-o:7-i" numlevel="1" lineno="430" slineno="5-60" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1193" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1194" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The preliminary municipality shall maintain and repair any roadway that, on the <ln numlevel="1" lineno="431" slineno="5-61"/>day on which the individual filed the feasibility request under Section <xref depth="3" refnumber="10-2a-502">10-2a-502</xref>:<subsection ssid="14-null-27" dnum="a-o" numlevel="1" lineno="432" slineno="5-62" level="2"><display>(a)</display>existed within the preliminary municipality;</subsection><subsection ssid="14-null-28" dnum="b-o" numlevel="1" lineno="433" slineno="5-63" level="2"><display>(b)</display>was within a public right of way that abuts the preliminary municipality; or</subsection><subsection ssid="14-null-29" dnum="c-o" numlevel="1" lineno="434" slineno="5-64" level="2"><display>(c)</display>was within 1/2 mile of the preliminary municipality and connected to, or was <ln numlevel="1" lineno="435" slineno="5-65"/>proposed in the feasibility request to be connected to, the preliminary municipality.</subsection></subsection><subsection ssid="14-null-30" dnum="7-o:8-i" numlevel="1" lineno="436" slineno="5-66" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1197" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1198" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display>Before the preliminary municipality submits a petition to transition to a town, the <ln numlevel="1" lineno="437" slineno="5-67"/>preliminary municipality shall select an independent third-party engineer to review and <ln numlevel="1" lineno="438" slineno="5-68"/>approve all building permit applications within the preliminary municipality to ensure <ln numlevel="1" lineno="439" slineno="5-69"/>compliance with the law.</subsection><subsection ssid="14-null-31" dnum="8-o:9-i" numlevel="1" lineno="440" slineno="5-70" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1198" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1199" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>Chapter 2, Classification, Boundaries, Consolidation, and Dissolution of <ln numlevel="1" lineno="441" slineno="5-71"/>Municipalities, does not apply to a preliminary municipality.</subsection></section></bsec><bsec buid="10" num="10-2a-510" type="amend" src="code" uid="C10-2a-S510_2025050720250507" sort="10 02a05100020250507" numlevel="1" lineno="442" slineno="6-1" sn="6"><section number="10-2a-510" numlevel="1" lineno="443" slineno="6-2" type="amend"><secline lineno="442">Section 6, Section <bold>10-2a-510</bold> is amended to read:</secline><catline lineno="443"><bold>10-2a-510 (Effective 05/07/25) (Applies beginning 02/15/25) (Repealed 01/01/31). <ln numlevel="1" lineno="444" slineno="6-3"/>Transitioning from a preliminary municipality to a town -- Petition -- Election of officers.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="445" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>Within 30 days after the day on which the population of a preliminary municipality <ln numlevel="1" lineno="446" slineno="6-5"/>exceeds 99 people, a person who filed the application to incorporate as a preliminary <ln numlevel="1" lineno="447" slineno="6-6"/>municipality or a resident of the preliminary municipality shall file with the lieutenant <ln numlevel="1" lineno="448" slineno="6-7"/>governor a petition to transition the preliminary municipality into a town.</subsection><subsection ssid="10-null-2" dnum="2-o" numlevel="1" lineno="449" slineno="6-8" level="1"><display>(2)</display>A petition to transition a preliminary municipality into a town shall include:<subsection ssid="10-null-3" dnum="a-o" numlevel="1" lineno="450" slineno="6-9" level="2"><display>(a)</display>a request that the lieutenant governor certify the transition of the preliminary <ln numlevel="1" lineno="451" slineno="6-10"/>municipality to, and the incorporation of the preliminary municipality as, a town;</subsection><subsection ssid="10-null-4" dnum="b-o" numlevel="1" lineno="452" slineno="6-11" level="2"><display>(b)</display>the name, address, and phone number of the person filing the request;</subsection><subsection ssid="10-null-5" dnum="c-o" numlevel="1" lineno="453" slineno="6-12" level="2"><display>(c)</display>the map or plat of the preliminary municipality;</subsection><subsection ssid="10-null-6" dnum="d-o" numlevel="1" lineno="454" slineno="6-13" level="2"><display>(d)</display>a legal description of the boundaries of the preliminary municipality;</subsection><subsection ssid="10-null-7" dnum="e-o" numlevel="1" lineno="455" slineno="6-14" level="2"><display>(e)</display>information regarding the preliminary municipality, including:<subsection ssid="10-null-8" dnum="i-o" numlevel="1" lineno="456" slineno="6-15" level="3"><display>(i)</display>the number of residences in the preliminary municipality;</subsection><subsection ssid="10-null-9" dnum="ii-o" numlevel="1" lineno="457" slineno="6-16" level="3"><display>(ii)</display>the population of the preliminary municipality;</subsection><subsection ssid="10-null-10" dnum="iii-o" numlevel="1" lineno="458" slineno="6-17" level="3"><display>(iii)</display>the number of adults and the number of children who reside in the preliminary <ln numlevel="1" lineno="459" slineno="6-18"/>municipality; and</subsection><subsection ssid="10-null-11" dnum="iv-o" numlevel="1" lineno="460" slineno="6-19" level="3"><display>(iv)</display>information regarding the providers of municipal services and emergency <ln numlevel="1" lineno="461" slineno="6-20"/>services to the preliminary municipality;</subsection></subsection><subsection ssid="10-null-12" dnum="f-o" numlevel="1" lineno="462" slineno="6-21" level="2"><display>(f)</display>the proposed name for the town;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="ahaskell" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="10-null-13" dnum="g-o" numlevel="1" lineno="463" slineno="6-22" level="2"><display>(g)</display>a signature sheet containing the names, addresses, and signatures of a majority of the <ln numlevel="1" lineno="464" slineno="6-23"/>adult residents of the preliminary municipality, supporting the proposed name for the <ln numlevel="1" lineno="465" slineno="6-24"/>town<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="8" style="2" owner="ahaskell" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="ahaskell" level="1" amendtag="both" space="true">;</amend></subsection><subsection ssid="10-61" dnum="_-o:h-i" numlevel="1" lineno="466" slineno="6-25" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="i" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="ahaskell" level="1" amendtag="end">certification that:</amend><subsection ssid="10-63" dnum="_-o:i-i" numlevel="1" lineno="467" slineno="6-26" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1213" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="ahaskell" level="1" amendtag="end">all damages to county property or infrastructure resulting from development of the <ln numlevel="1" lineno="468" slineno="6-27"/>area have been assessed and paid in full; or</amend></subsection><subsection ssid="10-62" dnum="_-o:ii-i" numlevel="1" lineno="469" slineno="6-28" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1214" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="ahaskell" level="1" amendtag="end">no damages described in Subsection <xref tempid="593" depth="4" refnumber="10-2a-510(2)(h)(i)">(2)(h)(i)</xref> exist; and</amend></subsection></subsection><subsection ssid="10-64" dnum="_-o:i-i" numlevel="1" lineno="470" slineno="6-29" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1215" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="ahaskell" level="1" amendtag="end">an agreement by the initial landowners to accept liability for any damages to county <ln numlevel="1" lineno="471" slineno="6-30"/>property or infrastructure that:</amend><subsection ssid="10-65" dnum="_-o:i-i" numlevel="1" lineno="472" slineno="6-31" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1216" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="24" style="1" owner="ahaskell" level="1" amendtag="end">occurred before the preliminary municipality's transition into a town but are <ln numlevel="1" lineno="473" slineno="6-32"/>discovered after the transition; and</amend></subsection><subsection ssid="10-66" dnum="_-o:ii-i" numlevel="1" lineno="474" slineno="6-33" ea="amend" anum="0" owner="ahaskell" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="28" style="1" owner="ahaskell" level="1" amendtag="end">are directly attributable to development of the area.</amend></subsection></subsection></subsection><subsection ssid="10-null-14" dnum="3-o" numlevel="1" lineno="475" slineno="6-34" level="1"><display>(3)</display>Within 30 days after the day on which a person files a petition to transition a <ln numlevel="1" lineno="476" slineno="6-35"/>preliminary municipality into a town, the lieutenant governor shall:<subsection ssid="10-null-15" dnum="a-o" numlevel="1" lineno="477" slineno="6-36" level="2"><display>(a)</display>determine whether the preliminary municipality has a population of more than 99 <ln numlevel="1" lineno="478" slineno="6-37"/>people;</subsection><subsection ssid="10-null-16" dnum="b-o" numlevel="1" lineno="479" slineno="6-38" level="2"><display>(b)</display>examine the petition to determine whether the petition complies with Subsection (2);</subsection><subsection ssid="10-null-17" dnum="c-o" numlevel="1" lineno="480" slineno="6-39" level="2"><display>(c)</display>if the lieutenant governor determines that the preliminary municipality has a <ln numlevel="1" lineno="481" slineno="6-40"/>population of more than 99 people and that the petition complies with Subsection (2), <ln numlevel="1" lineno="482" slineno="6-41"/>proceed to transition the preliminary municipality as a town in accordance with <ln numlevel="1" lineno="483" slineno="6-42"/>Subsection (4);</subsection><subsection ssid="10-null-18" dnum="d-o" numlevel="1" lineno="484" slineno="6-43" level="2"><display>(d)</display>if the lieutenant governor determines that the preliminary municipality has a <ln numlevel="1" lineno="485" slineno="6-44"/>population of less than 100 people, deny the petition, inform the person who filed the <ln numlevel="1" lineno="486" slineno="6-45"/>petition of the determination, and request that the person refile the petition when the <ln numlevel="1" lineno="487" slineno="6-46"/>population exceeds 99 people; and</subsection><subsection ssid="10-null-19" dnum="e-o" numlevel="1" lineno="488" slineno="6-47" level="2"><display>(e)</display>if the lieutenant governor determines that the petition fails to comply with Subsection <ln numlevel="1" lineno="489" slineno="6-48"/>(2), deny the petition, inform the person who filed the petition of the denial and the <ln numlevel="1" lineno="490" slineno="6-49"/>reason for the denial, and request that the person correct and refile the petition.</subsection></subsection><subsection ssid="10-null-20" dnum="4-o" numlevel="1" lineno="491" slineno="6-50" level="1"><display>(4)</display>After making the determination described in Subsection (3)(c), the lieutenant governor <ln numlevel="1" lineno="492" slineno="6-51"/>shall:<subsection ssid="10-null-21" dnum="a-o" numlevel="1" lineno="493" slineno="6-52" level="2"><display>(a)</display>inform the person who filed the petition of the determination;</subsection><subsection ssid="10-null-22" dnum="b-o" numlevel="1" lineno="494" slineno="6-53" level="2"><display>(b)</display>inform the county in which the preliminary municipality is located of the <ln numlevel="1" lineno="495" slineno="6-54"/>determination; and</subsection><subsection ssid="10-null-23" dnum="c-o" numlevel="1" lineno="496" slineno="6-55" level="2"><display>(c)</display>direct the county to conduct an election for mayor and city council of the future <ln numlevel="1" lineno="497" slineno="6-56"/>town, to be held on the date of the next regular general election described in Section <xref depth="3" refnumber="20A-1-201"><ln numlevel="1" lineno="498" slineno="6-57"/>20A-1-201</xref>, or the next municipal general election described in Section <xref depth="3" refnumber="20A-1-202">20A-1-202</xref>, <ln numlevel="1" lineno="499" slineno="6-58"/>that is at least 65 days after the day on which the lieutenant governor directs the <ln numlevel="1" lineno="500" slineno="6-59"/>county to hold the election.</subsection></subsection><subsection ssid="10-null-24" dnum="5-o" numlevel="1" lineno="501" slineno="6-60" level="1"><display>(5)</display>The county shall:<subsection ssid="10-null-25" dnum="a-o" numlevel="1" lineno="502" slineno="6-61" level="2"><display>(a)</display>comply with the direction given by the lieutenant governor under Subsection (4)(c);</subsection><subsection ssid="10-null-26" dnum="b-o" numlevel="1" lineno="503" slineno="6-62" level="2"><display>(b)</display>determine the initial terms of the mayor and municipal council members to ensure <ln numlevel="1" lineno="504" slineno="6-63"/>that:<subsection ssid="10-null-27" dnum="i-o" numlevel="1" lineno="505" slineno="6-64" level="3"><display>(i)</display>the mayor and two of the municipal county members are elected in the next <ln numlevel="1" lineno="506" slineno="6-65"/>municipal general election;</subsection><subsection ssid="10-null-28" dnum="ii-o" numlevel="1" lineno="507" slineno="6-66" level="3"><display>(ii)</display>the remaining municipal council members are elected at elections that result in <ln numlevel="1" lineno="508" slineno="6-67"/>the staggering of council member terms; and</subsection><subsection ssid="10-null-29" dnum="iii-o" numlevel="1" lineno="509" slineno="6-68" level="3"><display>(iii)</display>the council members who receive the highest number of votes are assigned the <ln numlevel="1" lineno="510" slineno="6-69"/>longer initial terms; and</subsection></subsection><subsection ssid="10-null-30" dnum="c-o" numlevel="1" lineno="511" slineno="6-70" level="2"><display>(c)</display>provide notice of the election for the preliminary municipality as a class B notice <ln numlevel="1" lineno="512" slineno="6-71"/>under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least three weeks before the day of the election.</subsection></subsection><subsection ssid="10-null-31" dnum="6-o" numlevel="1" lineno="513" slineno="6-72" level="1"><display>(6)</display>The notice described in Subsection (5)(c) shall include:<subsection ssid="10-null-32" dnum="a-o" numlevel="1" lineno="514" slineno="6-73" level="2"><display>(a)</display>a statement of the contents of the petition to transition the preliminary municipality <ln numlevel="1" lineno="515" slineno="6-74"/>to a town;</subsection><subsection ssid="10-null-33" dnum="b-o" numlevel="1" lineno="516" slineno="6-75" level="2"><display>(b)</display>a description of the area to be incorporated as a town;</subsection><subsection ssid="10-null-34" dnum="c-o" numlevel="1" lineno="517" slineno="6-76" level="2"><display>(c)</display>the name of the town;</subsection><subsection ssid="10-null-35" dnum="d-o" numlevel="1" lineno="518" slineno="6-77" level="2"><display>(d)</display>information about the deadline for an individual to file a declaration of candidacy to <ln numlevel="1" lineno="519" slineno="6-78"/>become a candidate for mayor or municipal council;</subsection><subsection ssid="10-null-36" dnum="e-o" numlevel="1" lineno="520" slineno="6-79" level="2"><display>(e)</display>information about the initial terms of office;</subsection><subsection ssid="10-null-37" dnum="f-o" numlevel="1" lineno="521" slineno="6-80" level="2"><display>(f)</display>a statement of the date and time of the election and the location of polling places; and</subsection><subsection ssid="10-null-38" dnum="g-o" numlevel="1" lineno="522" slineno="6-81" level="2"><display>(g)</display>a statement that the purpose of the election is to elect a mayor and a council to <ln numlevel="1" lineno="523" slineno="6-82"/>govern the town upon the town's incorporation.</subsection></subsection><subsection ssid="10-null-39" dnum="7-o" numlevel="1" lineno="524" slineno="6-83" level="1" space="false"><display>(7)</display><subsection ssid="10-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the notice described in Subsection (6), the county clerk shall publish <ln numlevel="1" lineno="525" slineno="6-84"/>and distribute, before the election is held, a voter information pamphlet:<subsection ssid="10-null-41" dnum="i-o" numlevel="1" lineno="526" slineno="6-85" level="3" tab="1"><display>(i)</display>in accordance with the procedures and requirements of Section <xref depth="3" refnumber="20A-7-402">20A-7-402</xref>;</subsection><subsection ssid="10-null-42" dnum="ii-o" numlevel="1" lineno="527" slineno="6-86" level="3" tab="1"><display>(ii)</display>in consultation with the lieutenant governor; and</subsection><subsection ssid="10-null-43" dnum="iii-o" numlevel="1" lineno="528" slineno="6-87" level="3" tab="1"><display>(iii)</display>in a manner that the county clerk determines is adequate.</subsection></subsection><subsection ssid="10-null-44" dnum="b-o" numlevel="1" lineno="529" slineno="6-88" level="2"><display>(b)</display>The voter information pamphlet described in Subsection (7)(a):<subsection ssid="10-null-45" dnum="i-o" numlevel="1" lineno="530" slineno="6-89" level="3"><display>(i)</display>shall inform the public of the election and the purpose of the election; and</subsection><subsection ssid="10-null-46" dnum="ii-o" numlevel="1" lineno="531" slineno="6-90" level="3"><display>(ii)</display>may include additional information regarding the election of the elected officials <ln numlevel="1" lineno="532" slineno="6-91"/>and the incorporation of the town.</subsection></subsection></subsection><subsection ssid="10-null-47" dnum="8-o" numlevel="1" lineno="533" slineno="6-92" level="1"><display>(8)</display>An individual may not vote in the election described in this section unless the individual <ln numlevel="1" lineno="534" slineno="6-93"/>is a registered voter who is a resident, as defined in Section <xref depth="3" refnumber="20A-1-102">20A-1-102</xref>, within the <ln numlevel="1" lineno="535" slineno="6-94"/>boundaries of the preliminary municipality.</subsection><subsection ssid="10-null-48" dnum="9-o" numlevel="1" lineno="536" slineno="6-95" level="1"><display>(9)</display>The town, incorporated under Subsection (10)(b), shall pay to the county the cost of <ln numlevel="1" lineno="537" slineno="6-96"/>running the election described in this section.</subsection><subsection ssid="10-null-49" dnum="10-o" numlevel="1" lineno="538" slineno="6-97" level="1"><display>(10)</display>On the day after the day on which the canvass for the election is completed:<subsection ssid="10-null-50" dnum="a-o" numlevel="1" lineno="539" slineno="6-98" level="2"><display>(a)</display>the elected mayor and council members shall take office and replace the board chair <ln numlevel="1" lineno="540" slineno="6-99"/>and board members of the preliminary municipality;</subsection><subsection ssid="10-null-51" dnum="b-o" numlevel="1" lineno="541" slineno="6-100" level="2"><display>(b)</display>the lieutenant governor shall issue a certification that the preliminary municipality <ln numlevel="1" lineno="542" slineno="6-101"/>has transitioned to, and is incorporated as, a town; and</subsection><subsection ssid="10-null-52" dnum="c-o" numlevel="1" lineno="543" slineno="6-102" level="2"><display>(c)</display>subject to Subsection (14), the town holds all authority and power of a town.</subsection></subsection><subsection ssid="10-null-53" dnum="11-o" numlevel="1" lineno="544" slineno="6-103" level="1"><display>(11)</display>The former mayor and council members for the preliminary municipality shall assist <ln numlevel="1" lineno="545" slineno="6-104"/>the newly-elected mayor of the town and the newly-elected council members of the <ln numlevel="1" lineno="546" slineno="6-105"/>town with the transition to a town and the transfer of power to the elected government of <ln numlevel="1" lineno="547" slineno="6-106"/>the town.</subsection><subsection ssid="10-null-54" dnum="12-o" numlevel="1" lineno="548" slineno="6-107" level="1"><display>(12)</display>The initial government of a town incorporated under this section is the five member <ln numlevel="1" lineno="549" slineno="6-108"/>council form of government described in Chapter 3b, Part 4, Five-Member Council <ln numlevel="1" lineno="550" slineno="6-109"/>Form of Municipal Government, with the mayor and counsel members elected at large.</subsection><subsection ssid="10-null-55" dnum="13-o" numlevel="1" lineno="551" slineno="6-110" level="1"><display>(13)</display>Within 30 days after the day on which the mayor takes office under Subsection (10)(a), <ln numlevel="1" lineno="552" slineno="6-111"/>the mayor shall record the certification described in Subsection (10)(b), and a copy of <ln numlevel="1" lineno="553" slineno="6-112"/>the plat for the municipality, with the county recorder.</subsection><subsection ssid="10-null-56" dnum="14-o" numlevel="1" lineno="554" slineno="6-113" level="1"><display>(14)</display>Until the mayor complies with Subsection (13), the municipality may not:<subsection ssid="10-null-57" dnum="a-o" numlevel="1" lineno="555" slineno="6-114" level="2"><display>(a)</display>levy or collect a property tax on property within the municipality;</subsection><subsection ssid="10-null-58" dnum="b-o" numlevel="1" lineno="556" slineno="6-115" level="2"><display>(b)</display>levy or collect an assessment on property within the municipality; or</subsection><subsection ssid="10-null-59" dnum="c-o" numlevel="1" lineno="557" slineno="6-116" level="2"><display>(c)</display>charge or collect a fee for a service provided to property within the municipality.</subsection></subsection><subsection ssid="10-null-60" dnum="15-o" numlevel="1" lineno="558" slineno="6-117" level="1"><display>(15)</display>Section <xref depth="3" refnumber="10-2a-220">10-2a-220</xref> applies to a town incorporated under this
