News media -- Discriminatory conduct.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="36" slineno="1-3" level="1" placement="noreturn"><display>(1)</display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both">As used in this rule, "discriminatory conduct" means the same as that term is defined in <ln numlevel="1" lineno="37" slineno="1-4"/>Legislative Management Committee Policy E -- Legislative Workplace Discrimination <ln numlevel="1" lineno="38" slineno="1-5"/>Prevention.</amend></subsection><subsection ssid="1-7" dnum="_-o:2-i" numlevel="1" lineno="39" slineno="1-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(2)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">Beginning on January 1, 2019, in</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">In</amend> order to obtain or maintain House or Senate press <ln numlevel="1" lineno="40" slineno="1-7"/>credentials, a member of the news media shall:<subsection ssid="1-1-2" dnum="a-o" numlevel="1" lineno="41" slineno="1-8" level="2"><display>(a)</display>on an annual basis, take online training provided by the Legislature on <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="15" style="2" owner="jchristopherson" level="1" deltag="both">unlawful <ln numlevel="1" lineno="42" slineno="1-9"/>harassment</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="13" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">discriminatory conduct</amend>; and</subsection><subsection ssid="1-1-3" dnum="b-o" numlevel="1" lineno="43" slineno="1-10" level="2"><display>(b)</display>sign a document indicating that the member has received a copy of, and agrees to <ln numlevel="1" lineno="44" slineno="1-11"/>abide by, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="17" groupid="16" style="2" owner="jchristopherson" level="1" deltag="both">the Legislature's policy on unlawful harassment</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Legislative Management <ln numlevel="1" lineno="45" slineno="1-12"/>Committee Policy E -- Legislative Workplace Discrimination Prevention</amend>.</subsection></subsection><subsection ssid="1-1-4" dnum="2-o:3-i" numlevel="1" lineno="46" slineno="1-13" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1004" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display><subsection ssid="1-1-5" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>A member of the news media is prohibited from engaging in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">unlawful <ln numlevel="1" lineno="47" slineno="1-14"/>harassment of</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">discriminatory conduct toward</amend> a member<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">, employee, or volunteer of <ln numlevel="1" lineno="48" slineno="1-15"/>the Legislature</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"> or legislative employee</amend>.</subsection></subsection><subsection ssid="1-1-6" dnum="b-o:4-i" numlevel="1" lineno="49" slineno="1-16" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>The Legislature may revoke a member of the media's press credentials, or take <ln numlevel="1" lineno="50" slineno="1-17"/>other remedial action, if the member of the media violates Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="JR1-4-301(2)(a)" start="0">(2)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="38" groupid="36" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(3)</amend> or <ln numlevel="1" lineno="51" slineno="1-18"/>otherwise violates <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">the Legislature's harassment policy</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Legislative Management <ln numlevel="1" lineno="52" slineno="1-19"/>Committee Policy E -- Legislative Workplace Discrimination Prevention</amend>.</subsection></section></bsec><bsec buid="10" num="JR3-2-302" type="amend" src="rule" uid="JR3-2-S302_1800010118000101" sort="J03 02 03020018000101" numlevel="1" lineno="53" slineno="2-1" sn="2"><section number="JR3-2-302" numlevel="1" lineno="54" slineno="2-2" type="amend"><secline lineno="53">Section 2. <bold>JR3-2-302</bold> is amended to read:</secline><catline lineno="54"><bold>JR3-2-302. General bill format requirements.</bold></catline><subsection ssid="2-2-1" dnum="1-o" numlevel="1" lineno="67" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>Each bill shall be typewritten or printed on paper 8-1/2 by 11 inches.</subsection><subsection ssid="2-2-2" dnum="2-o" numlevel="1" lineno="68" slineno="3-4" level="1" space="false"><display>(2)</display><subsection ssid="2-2-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a bill proposes to enact new law, all of the language proposed to be enacted <ln numlevel="1" lineno="69" slineno="3-5"/>by the bill shall be underlined.</subsection><subsection ssid="2-2-4" dnum="b-o" numlevel="1" lineno="70" slineno="3-6" level="2"><display>(b)</display>When a bill proposes to enact a statutory section of new law, all of the language in <ln numlevel="1" lineno="71" slineno="3-7"/>the entire section must be underlined.</subsection><subsection ssid="2-2-5" dnum="c-o" numlevel="1" lineno="72" slineno="3-8" level="2"><display>(c)</display>When a bill proposes to repeal an existing statutory section and reenact that statutory <ln numlevel="1" lineno="73" slineno="3-9"/>section using new language, the new language of the entire section shall be <ln numlevel="1" lineno="74" slineno="3-10"/>underlined.</subsection></subsection><subsection ssid="2-2-6" dnum="3-o" numlevel="1" lineno="75" slineno="3-11" level="1"><display>(3)</display>When a bill proposes to amend a statutory section without repealing the entire statutory <ln numlevel="1" lineno="76" slineno="3-12"/>section:<subsection ssid="2-2-7" dnum="a-o" numlevel="1" lineno="77" slineno="3-13" level="2"><display>(a)</display>all of the language to be repealed must appear <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">between brackets </amend><amendoutend style="2"/>with the letters <ln numlevel="1" lineno="78" slineno="3-14"/>struck through; and</subsection><subsection ssid="2-2-8" dnum="b-o" numlevel="1" lineno="79" slineno="3-15" level="2"><display>(b)</display>all of the new language proposed to be enacted by the bill must be underlined.</subsection></subsection><subsection ssid="2-2-9" dnum="4-o" numlevel="1" lineno="80" slineno="3-16" level="1"><display>(4)</display>When a bill proposes to repeal a statutory section, the statutory sections to be repealed <ln numlevel="1" lineno="81" slineno="3-17"/>shall be listed in the long title as required by these rules and listed by statutory section <ln numlevel="1" lineno="82" slineno="3-18"/>number and bold face at the end of the bill before any special clauses.</subsection></section></bsec><bsec buid="3" num="JR4-1-401" type="amend" src="rule" uid="JR4-1-S401_1800010118000101" sort="J04 01 04010018000101" numlevel="1" lineno="83" slineno="4-1" sn="4"><section number="JR4-1-401" numlevel="1" lineno="84" slineno="4-2" type="amend"><secline lineno="83">Section 4. <bold>JR4-1-401</bold> is amended to read:</secline><catline lineno="84"><bold>JR4-1-401. Identifying adopted amendments in context.</bold></catline><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="85" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>When a Senate committee or floor amendment is adopted in the Senate, the Senate <ln numlevel="1" lineno="86" slineno="4-4"/>amendment shall be noted in the legislation with additional spacing and markers <ln numlevel="1" lineno="87" slineno="4-5"/>indicating the beginning and ending of the adopted Senate amendment.</subsection><subsection ssid="3-3-2" dnum="2-o" numlevel="1" lineno="88" slineno="4-6" level="1"><display>(2)</display>When a House committee or floor amendment is adopted in the House, the House <ln numlevel="1" lineno="89" slineno="4-7"/>amendment shall be noted in the legislation with additional spacing and markers <ln numlevel="1" lineno="90" slineno="4-8"/>indicating the beginning and ending of the adopted House amendment.</subsection><subsection ssid="3-3-3" dnum="3-o" numlevel="1" lineno="91" slineno="4-9" level="1" space="false"><display>(3)</display><subsection ssid="3-3-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding <xref depth="3" refnumber="JR4-1-201" start="0">JR4-1-201</xref>, and except as provided in Subsection <xref depth="4" refnumber="JR4-1-401(3)(b)" start="0">(3)(b)</xref>, when <ln numlevel="1" lineno="92" slineno="4-10"/>an additional section from the Utah Code is added to a bill by amendment:<subsection ssid="3-3-5" dnum="i-o" numlevel="1" lineno="93" slineno="4-11" level="3" tab="1"><display>(i)</display>all of the language in the section that is to be repealed must appear <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">between <ln numlevel="1" lineno="94" slineno="4-12"/>brackets </amend><amendoutend style="2"/>with the letters struck through; and</subsection><subsection ssid="3-3-6" dnum="ii-o" numlevel="1" lineno="95" slineno="4-13" level="3" tab="1"><display>(ii)</display>all of the new language in the section that is proposed to be enacted by the bill <ln numlevel="1" lineno="96" slineno="4-14"/>must be underlined.</subsection></subsection><subsection ssid="3-3-7" dnum="b-o" numlevel="1" lineno="97" slineno="4-15" level="2"><display>(b)</display>If the additional section added to the bill by amendment is to be repealed, the text of <ln numlevel="1" lineno="98" slineno="4-16"/>the repealed section need not be included.</subsection></subsection></section></bsec><bsec buid="4" num="JR6-1-103" type="amend" src="rule" uid="JR6-1-S103_1800010118000101" sort="J06 01 01030018000101" numlevel="1" lineno="99" slineno="5-1" sn="5"><section number="JR6-1-103" numlevel="1" lineno="100" slineno="5-2" type="amend"><secline lineno="99">Section 5. <bold>JR6-1-103</bold> is amended to read:</secline><catline lineno="100"><bold>JR6-1-103. Receipt of campaign donations.</bold></catline><subsection ssid="4-4-1" dnum="1-o" numlevel="1" lineno="101" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this rule:<subsection ssid="4-4-2" dnum="a-o" numlevel="1" lineno="102" slineno="5-4" level="2"><display>(a)</display>"Campaign contribution" means cash or a negotiable instrument contributed for a <ln numlevel="1" lineno="103" slineno="5-5"/>political purpose to a campaigner.</subsection><subsection ssid="4-4-3" dnum="b-o" numlevel="1" lineno="104" slineno="5-6" level="2"><display>(b)</display>"Campaigner" means:<subsection ssid="4-4-4" dnum="i-o" numlevel="1" lineno="105" slineno="5-7" level="3"><display>(i)</display>a legislative office candidate;</subsection><subsection ssid="4-4-5" dnum="ii-o" numlevel="1" lineno="106" slineno="5-8" level="3"><display>(ii)</display>an individual who holds a legislative office;</subsection><subsection ssid="4-4-6" dnum="iii-o" numlevel="1" lineno="107" slineno="5-9" level="3"><display>(iii)</display>a personal campaign committee of a person described in Subsection (1)(b)(i) or <ln numlevel="1" lineno="108" slineno="5-10"/>(ii);</subsection><subsection ssid="4-4-7" dnum="iv-o" numlevel="1" lineno="109" slineno="5-11" level="3"><display>(iv)</display>a political action committee controlled by a person described in Subsection <ln numlevel="1" lineno="110" slineno="5-12"/>(1)(b)(i) or (ii); or</subsection><subsection ssid="4-4-8" dnum="v-o" numlevel="1" lineno="111" slineno="5-13" level="3"><display>(v)</display>a person acting on behalf of a person described in Subsections (1)(b)(i) through <ln numlevel="1" lineno="112" slineno="5-14"/>(iv).</subsection></subsection><subsection ssid="4-4-9" dnum="c-o" numlevel="1" lineno="113" slineno="5-15" level="2"><display>(c)</display>"Capitol hill" means the same as that term is defined in Utah Code Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="3" refnumber="36-5-1">36-5-1</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><xref depth="3" refnumber="63O-1-101"><ln numlevel="1" lineno="114" slineno="5-16"/>63O-1-101</xref></amend>.</subsection><subsection ssid="4-4-10" dnum="d-o" numlevel="1" lineno="115" slineno="5-17" level="2"><display>(d)</display>"Indirect campaign contribution" means a campaign contribution that is delivered to <ln numlevel="1" lineno="116" slineno="5-18"/>a campaigner:<subsection ssid="4-4-11" dnum="i-o" numlevel="1" lineno="117" slineno="5-19" level="3"><display>(i)</display>when the campaigner is not present; or</subsection><subsection ssid="4-4-12" dnum="ii-o" numlevel="1" lineno="118" slineno="5-20" level="3"><display>(ii)</display>via a third party or delivery service.</subsection></subsection><subsection ssid="4-4-13" dnum="e-o" numlevel="1" lineno="119" slineno="5-21" level="2"><display>(e)</display>"Political purpose" means the same as "political purposes" is defined in Utah Code <ln numlevel="1" lineno="120" slineno="5-22"/>Section <xref depth="3" refnumber="20A-11-101">20A-11-101</xref>.</subsection></subsection><subsection ssid="4-4-14" dnum="2-o" numlevel="1" lineno="121" slineno="5-23" level="1" space="false"><display>(2)</display><subsection ssid="4-4-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A campaigner may not accept receipt of a campaign contribution on capitol hill.</subsection><subsection ssid="4-4-16" dnum="b-o" numlevel="1" lineno="122" slineno="5-24" level="2"><display>(b)</display>A legislator who is in violation of this rule is subject to an ethics complaint <ln numlevel="1" lineno="123" slineno="5-25"/>regardless of whether the violation occurred while the legislator was a legislative <ln numlevel="1" lineno="124" slineno="5-26"/>office holder or a legislative office candidate.</subsection></subsection><subsection ssid="4-4-17" dnum="3-o" numlevel="1" lineno="125" slineno="5-27" level="1"><display>(3)</display>Notwithstanding Subsection (2), a campaigner shall not be considered to have accepted <ln numlevel="1" lineno="126" slineno="5-28"/>receipt of a campaign contribution if:<subsection ssid="4-4-18" dnum="a-o" numlevel="1" lineno="127" slineno="5-29" level="2"><display>(a)</display>the campaign contribution is an indirect campaign contribution; and</subsection><subsection ssid="4-4-19" dnum="b-o" numlevel="1" lineno="128" slineno="5-30" level="2"><display>(b)</display>the campaigner promptly:<subsection ssid="4-4-20" dnum="i-o" numlevel="1" lineno="129" slineno="5-31" level="3"><display>(i)</display>returns the campaign contribution to the donor; or</subsection><subsection ssid="4-4-21" dnum="ii-o" numlevel="1" lineno="130" slineno="5-32" level="3"><display>(ii)</display>refuses the campaign contribution in a written communication or other verifiable <ln numlevel="1" lineno="131" slineno="5-33"/>manner.</subsection></subsection></subsection></section></bsec><bsec buid="5" num="JR7-1-403" type="amend" src="rule" uid="JR7-1-S403_1800010118000101" sort="J07 01 04030018000101" numlevel="1" lineno="132" slineno="6-1" sn="6"><section number="JR7-1-403" numlevel="1" lineno="133" slineno="6-2" type="amend"><secline lineno="132">Section 6. <bold>JR7-1-403</bold> is amended to read:</secline><catline lineno="133"><bold>JR7-1-403. Review rules referred by Rules Review and General Oversight <ln numlevel="1" lineno="134" slineno="6-3"/>Committee.</bold></catline><sectionText lineno="135"><tab/>If a legislative committee receives an administrative rule for review from the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="136" slineno="6-5"/>Administrative Rules Review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Rules Review and General Oversight</amend> Committee, the legislative <ln numlevel="1" lineno="137" slineno="6-6"/>committee may:</sectionText><subsection ssid="5-5-1" dnum="1-o" numlevel="1" lineno="138" slineno="6-7" level="1"><display>(1)</display>review the administrative rule; and</subsection><subsection ssid="5-5-2" dnum="2-o" numlevel="1" lineno="139" slineno="6-8" level="1" space="false"><display>(2)</display><subsection ssid="5-5-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>recommend to the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">Administrative Rules Review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Rules Review and General <ln numlevel="1" lineno="140" slineno="6-9"/>Oversight</amend> Committee whether the Legislature should reauthorize the administrative <ln numlevel="1" lineno="141" slineno="6-10"/>rule; or</subsection><subsection ssid="5-5-4" dnum="b-o" numlevel="1" lineno="142" slineno="6-11" level="2"><display>(b)</display>decide whether to recommend any related statutory change to the Legislature.</subsection></subsection></section></bsec><bsec buid="6" num="JR7-1-405" type="amend" src="rule" uid="JR7-1-S405_1800010118000101" sort="J07 01 04050018000101" numlevel="1" lineno="143" slineno="7-1" sn="7"><section number="JR7-1-405" numlevel="1" lineno="144" slineno="7-2" type="amend"><secline lineno="143">Section 7. <bold>JR7-1-405</bold> is amended to read:</secline><catline lineno="144"><bold>JR7-1-405. Prohibited meeting times -- Exceptions.</bold></catline><subsection ssid="6-6-1" dnum="1-o" numlevel="1" lineno="145" slineno="7-3" level="1" placement="noreturn"><display>(1)</display>Except as provided in this rule, a legislative committee may not meet:<subsection ssid="6-6-2" dnum="a-o" numlevel="1" lineno="146" slineno="7-4" level="2"><display>(a)</display>while the Senate or the House of Representatives is in session; or</subsection><subsection ssid="6-6-3" dnum="b-o" numlevel="1" lineno="147" slineno="7-5" level="2"><display>(b)</display>during the period that begins on the first Thursday in December and ends the day <ln numlevel="1" lineno="148" slineno="7-6"/>after the day on which the Legislature adjourns the following calendar year's general <ln numlevel="1" lineno="149" slineno="7-7"/>session sine die.</subsection></subsection><subsection ssid="6-6-4" dnum="2-o" numlevel="1" lineno="150" slineno="7-8" level="1"><display>(2)</display>Subsection <xref depth="4" refnumber="JR7-1-405(1)" start="0">(1)</xref> does not apply to:<subsection ssid="6-6-5" dnum="a-o" numlevel="1" lineno="151" slineno="7-9" level="2"><display>(a)</display>the Legislative Management Committee and its subcommittees;</subsection><subsection ssid="6-6-6" dnum="b-o" numlevel="1" lineno="152" slineno="7-10" level="2"><display>(b)</display>the Senate or House Management Committee;</subsection><subsection ssid="6-6-7" dnum="c-o" numlevel="1" lineno="153" slineno="7-11" level="2"><display>(c)</display>the Senate or House Rules Committee;</subsection><subsection ssid="6-6-8" dnum="d-o" numlevel="1" lineno="154" slineno="7-12" level="2"><display>(d)</display>the Senate or House Legislative Expenses Oversight Committee;</subsection><subsection ssid="6-6-9" dnum="e-o" numlevel="1" lineno="155" slineno="7-13" level="2"><display>(e)</display>a senate confirmation committee;</subsection><subsection ssid="6-6-10" dnum="f-o" numlevel="1" lineno="156" slineno="7-14" level="2"><display>(f)</display>a meeting of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Administrative Rules Review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Rules Review and General Oversight</amend> <ln numlevel="1" lineno="157" slineno="7-15"/>Committee for the purpose of considering draft legislation reauthorizing agency rules <ln numlevel="1" lineno="158" slineno="7-16"/>in accordance with Utah Code Section <xref depth="3" refnumber="63G-3-502" start="0">63G-3-502</xref>; or</subsection><subsection ssid="6-6-11" dnum="g-o" numlevel="1" lineno="159" slineno="7-17" level="2"><display>(g)</display>the Legislative Process Committee.</subsection></subsection><subsection ssid="6-6-12" dnum="3-o" numlevel="1" lineno="160" slineno="7-18" level="1"><display>(3)</display>A meeting otherwise prohibited by this rule may be held if approved by:<subsection ssid="6-6-13" dnum="a-o" numlevel="1" lineno="161" slineno="7-19" level="2"><display>(a)</display>the president of the Senate and the speaker of the House of Representatives; or</subsection><subsection ssid="6-6-14" dnum="b-o" numlevel="1" lineno="162" slineno="7-20" level="2"><display>(b)</display>a majority vote of the Senate and a majority vote of the House of Representatives.</subsection></subsection><subsection ssid="6-6-15" dnum="4-o" numlevel="1" lineno="163" slineno="7-21" level="1"><display>(4)</display>Any action of a legislative committee that occurs during a meeting that violates this rule <ln numlevel="1" lineno="164" slineno="7-22"/>is invalid.</subsection></section></bsec><bsec buid="7" num="JR7-1-610" type="amend" src="rule" uid="JR7-1-S610_1800010118000101" sort="J07 01 06100018000101" numlevel="1" lineno="165" slineno="8-1" sn="8"><section number="JR7-1-610" numlevel="1" lineno="166" slineno="8-2" type="amend"><secline lineno="165">Section 8. <bold>JR7-1-610</bold> is amended to read:</secline><catline lineno="166"><bold>JR7-1-610. Committee bill files -- Effect of favorable recommendation -- <ln numlevel="1" lineno="167" slineno="8-3"/>Committee bill files without recommendation abandoned.</bold></catline><subsection ssid="7-7-1" dnum="1-o" numlevel="1" lineno="168" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>After an authorized legislative committee reviews draft legislation the authorized <ln numlevel="1" lineno="169" slineno="8-5"/>legislative committee may give the draft legislation a favorable recommendation.</subsection><subsection ssid="7-7-2" dnum="2-o" numlevel="1" lineno="170" slineno="8-6" level="1"><display>(2)</display>If an authorized legislative committee gives draft legislation a favorable <ln numlevel="1" lineno="171" slineno="8-7"/>recommendation, the Office of Legislative Research and General Counsel shall:<subsection ssid="7-7-3" dnum="a-o" numlevel="1" lineno="172" slineno="8-8" level="2"><display>(a)</display>attach a committee note to the committee bill, as required under <xref depth="3" refnumber="JR4-2-401">JR4-2-401</xref>; and</subsection><subsection ssid="7-7-4" dnum="b-o" numlevel="1" lineno="173" slineno="8-9" level="2"><display>(b)</display>assign the committee bill a bill number in accordance with <xref depth="3" refnumber="JR4-2-501">JR4-2-501</xref>.</subsection></subsection><subsection ssid="7-7-5" dnum="3-o" numlevel="1" lineno="174" slineno="8-10" level="1" space="false"><display>(3)</display><subsection ssid="7-7-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="JR7-1-610(3)(b)" start="0">(3)(b)</xref>, a committee bill file that does not <ln numlevel="1" lineno="175" slineno="8-11"/>receive a favorable recommendation at the committee's last scheduled meeting of the <ln numlevel="1" lineno="176" slineno="8-12"/>calendar year in which the committee bill file was opened is abandoned.</subsection><subsection ssid="7-7-7" dnum="b-o" numlevel="1" lineno="177" slineno="8-13" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="JR7-1-610(3)(a)" start="0">(3)(a)</xref> does not apply to a committee bill file opened by:<subsection ssid="7-7-8" dnum="i-o" numlevel="1" lineno="178" slineno="8-14" level="3"><display>(i)</display>the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">Administrative Rules Review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Rules Review and General Oversight</amend> <ln numlevel="1" lineno="179" slineno="8-15"/>Committee for the purpose of reauthorizing agency rules in accordance with Utah <ln numlevel="1" lineno="180" slineno="8-16"/>Code Section <xref depth="3" refnumber="63G-3-502" start="0">63G-3-502</xref>; or</subsection><subsection ssid="7-7-9" dnum="ii-o" numlevel="1" lineno="181" slineno="8-17" level="3"><display>(ii)</display>the Legislative Process Committee.</subsection></subsection></subsection><subsection ssid="7-7-10" dnum="4-o" numlevel="1" lineno="182" slineno="8-18" level="1" space="false"><display>(4)</display><subsection ssid="7-7-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Nothing in this rule prohibits a legislator from making a request for legislation in <ln numlevel="1" lineno="183" slineno="8-19"/>the legislator's name to sponsor legislation that was abandoned in accordance with <ln numlevel="1" lineno="184" slineno="8-20"/>Subsection <xref depth="4" refnumber="JR7-1-610(3)" start="0">(3)</xref>.</subsection><subsection ssid="7-7-12" dnum="b-o" numlevel="1" lineno="185" slineno="8-21" level="2"><display>(b)</display>A request for legislation described in Subsection <xref depth="4" refnumber="JR7-1-610(4)(a)" start="0">(4)(a)</xref> is subject to the drafting <ln numlevel="1" lineno="186" slineno="8-22"/>priority described in <xref depth="3" refnumber="JR4-2-102">JR4-2-102</xref>.</subsection></subsection></section></bsec><bsec buid="8" num="JR7-1-611" type="amend" src="rule" uid="JR7-1-S611_1800010118000101" sort="J07 01 06110018000101" numlevel="1" lineno="187" slineno="9-1" sn="9"><section number="JR7-1-611" numlevel="1" lineno="188" slineno="9-2" type="amend"><secline lineno="187">Section 9. <bold>JR7-1-611</bold> is amended to read:</secline><catline lineno="188"><bold>JR7-1-611. Assignment of committee bills -- Report on committee bills and study <ln numlevel="1" lineno="189" slineno="9-3"/>items.</bold></catline><subsection ssid="8-8-1" dnum="1-o" numlevel="1" lineno="190" slineno="9-4" level="1" placement="noreturn"><display>(1)</display>The chairs of each authorized legislative committee shall:<subsection ssid="8-8-2" dnum="a-o" numlevel="1" lineno="191" slineno="9-5" level="2"><display>(a)</display>no later than November 30, assign each of the authorized legislative committee's <ln numlevel="1" lineno="192" slineno="9-6"/>committee bills a chief sponsor and, at the chairs' election, a floor sponsor from the <ln numlevel="1" lineno="193" slineno="9-7"/>opposite chamber; and</subsection><subsection ssid="8-8-3" dnum="b-o" numlevel="1" lineno="194" slineno="9-8" level="2"><display>(b)</display>deliver to the Senate Rules Committee and the House Rules Committee a report that <ln numlevel="1" lineno="195" slineno="9-9"/>includes, for each of the authorized legislative committee's committee bills:<subsection ssid="8-8-4" dnum="i-o" numlevel="1" lineno="196" slineno="9-10" level="3"><display>(i)</display>the short title;</subsection><subsection ssid="8-8-5" dnum="ii-o" numlevel="1" lineno="197" slineno="9-11" level="3"><display>(ii)</display>the chief sponsor;</subsection><subsection ssid="8-8-6" dnum="iii-o" numlevel="1" lineno="198" slineno="9-12" level="3"><display>(iii)</display>the floor sponsor, if applicable; and</subsection><subsection ssid="8-8-7" dnum="iv-o" numlevel="1" lineno="199" slineno="9-13" level="3"><display>(iv)</display>how each member of the authorized legislative committee voted when the <ln numlevel="1" lineno="200" slineno="9-14"/>authorized legislative committee gave the committee bill a favorable <ln numlevel="1" lineno="201" slineno="9-15"/>recommendation, including whether a member was absent at the time of the vote.</subsection></subsection></subsection><subsection ssid="8-8-8" dnum="2-o" numlevel="1" lineno="202" slineno="9-16" level="1"><display>(2)</display>Notwithstanding Subsection (1), for a committee bill that was not a committee bill file, <ln numlevel="1" lineno="203" slineno="9-17"/>the sponsor of the request for legislation is the chief sponsor of the committee bill <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both">file </amend><amendoutend style="2"/><ln numlevel="1" lineno="204" slineno="9-18"/>unless the sponsor transfers the committee bill to another legislator.</subsection><subsection ssid="8-8-9" dnum="3-o" numlevel="1" lineno="205" slineno="9-19" level="1" space="false"><display>(3)</display><subsection ssid="8-8-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to the items described in Subsection (1), the chairs of each interim <ln numlevel="1" lineno="206" slineno="9-20"/>committee shall deliver to the Legislative Management Committee:<subsection ssid="8-8-11" dnum="i-o" numlevel="1" lineno="207" slineno="9-21" level="3" tab="1"><display>(i)</display>a copy of the report described in Subsection (1)(b); and</subsection><subsection ssid="8-8-12" dnum="ii-o" numlevel="1" lineno="208" slineno="9-22" level="3" tab="1"><display>(ii)</display>the disposition of each issue assigned to or studied by the interim committee <ln numlevel="1" lineno="209" slineno="9-23"/>during the preceding calendar year.</subsection></subsection><subsection ssid="8-8-13" dnum="b-o" numlevel="1" lineno="210" slineno="9-24" level="2" space="false"><display>(b)</display><subsection ssid="8-8-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The chairs of an interim committee shall comply with Subsection (3)(a) before <ln numlevel="1" lineno="211" slineno="9-25"/>the day on which the Legislative Management Committee meets in December.</subsection><subsection ssid="8-8-15" dnum="ii-o" numlevel="1" lineno="212" slineno="9-26" level="3"><display>(ii)</display>The chairs of an authorized legislative committee that is not an interim committee <ln numlevel="1" lineno="213" slineno="9-27"/>shall comply with Subsection (3)(a) as soon as practicable.</subsection></subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="214" slineno="10-1" sn="10"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="214">Section 10.  <bold>Effective Date.</bold></secline><sectionText lineno="215"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This resolution takes effect upon a successful vote for final passage.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-15-25 1:44 PM</tm></rev></foot></leg>
