Membership Council established -- Members -- Chair -- Duties -- <ln numlevel="1" lineno="30" slineno="1-3"/>Expenses and per diem.</bold></catline><subsection ssid="7-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-4" level="1" placement="noreturn"><display>(1)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">There is established a </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">A </amend>Membership Council <amend anum="0" ea="amend" pairid="10" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">is established </amend>to perform the duties <ln numlevel="1" lineno="32" slineno="1-5"/>under Subsection <xref depth="4" refnumber="49-11-205(5)" start="0">(5)</xref>.</subsection><subsection ssid="7-2" dnum="2-o" numlevel="1" lineno="33" slineno="1-6" level="1"><display>(2)</display>The Membership Council shall be composed of 15 council members selected as follows:<subsection ssid="7-3" dnum="a-o" numlevel="1" lineno="34" slineno="1-7" level="2"><display>(a)</display>three council members shall be school employees selected by the governing board of <ln numlevel="1" lineno="35" slineno="1-8"/>an association representative of a majority of school employees who are members of <ln numlevel="1" lineno="36" slineno="1-9"/>a system administered by the board;</subsection><subsection ssid="7-4" dnum="b-o" numlevel="1" lineno="37" slineno="1-10" level="2"><display>(b)</display>one council member shall be <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support <ln numlevel="1" lineno="38" slineno="1-11"/>professional</amend> selected by the governing board of the association representative of a <ln numlevel="1" lineno="39" slineno="1-12"/>majority of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">classified school employees</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">education support professionals</amend> who are <ln numlevel="1" lineno="40" slineno="1-13"/>members of a system administered by the board;</subsection><subsection ssid="7-5" dnum="c-o" numlevel="1" lineno="41" slineno="1-14" level="2"><display>(c)</display>two council members shall be public employees selected by the governing board of <ln numlevel="1" lineno="42" slineno="1-15"/>the association representative of a majority of the public employees who are <ln numlevel="1" lineno="43" slineno="1-16"/>members of a system administered by the board;</subsection><subsection ssid="7-6" dnum="d-o" numlevel="1" lineno="44" slineno="1-17" level="2"><display>(d)</display>one council member shall be a municipal officer or employee selected by the <ln numlevel="1" lineno="45" slineno="1-18"/>governing board of the association representative of a majority of the municipalities <ln numlevel="1" lineno="46" slineno="1-19"/>who participate in a system administered by the board;</subsection><subsection ssid="7-7" dnum="e-o" numlevel="1" lineno="47" slineno="1-20" level="2"><display>(e)</display>one council member shall be a county officer or employee selected by the governing <ln numlevel="1" lineno="48" slineno="1-21"/>board of the association representative of a majority of counties who participate in a <ln numlevel="1" lineno="49" slineno="1-22"/>system administered by the board;</subsection><subsection ssid="7-8" dnum="f-o" numlevel="1" lineno="50" slineno="1-23" level="2"><display>(f)</display>one council member shall be a representative of members of the Judges' <ln numlevel="1" lineno="51" slineno="1-24"/>Noncontributory Retirement System selected by the Judicial Council;</subsection><subsection ssid="7-9" dnum="g-o" numlevel="1" lineno="52" slineno="1-25" level="2"><display>(g)</display>one council member shall be a representative of members of the Public Safety <ln numlevel="1" lineno="53" slineno="1-26"/>Retirement Systems selected by the governing board of the association representative <ln numlevel="1" lineno="54" slineno="1-27"/>of the majority of peace officers who are members of the Public Safety Retirement <ln numlevel="1" lineno="55" slineno="1-28"/>Systems;</subsection><subsection ssid="7-10" dnum="h-o" numlevel="1" lineno="56" slineno="1-29" level="2"><display>(h)</display>one council member shall be a representative of members of the Firefighters' <ln numlevel="1" lineno="57" slineno="1-30"/>Retirement System selected by the governing board of the association representative <ln numlevel="1" lineno="58" slineno="1-31"/>of the majority of paid professional firefighters who are members of the Firefighters' <ln numlevel="1" lineno="59" slineno="1-32"/>Retirement System;</subsection><subsection ssid="7-11" dnum="i-o" numlevel="1" lineno="60" slineno="1-33" level="2"><display>(i)</display>one council member shall be a retiree selected by the governing board of the <ln numlevel="1" lineno="61" slineno="1-34"/>association representing the largest number of retirees, who are not public education <ln numlevel="1" lineno="62" slineno="1-35"/>retirees, from the Public Employees' Contributory, Public Employees' <ln numlevel="1" lineno="63" slineno="1-36"/>Noncontributory, and New Public Employees' Tier II Contributory Retirement <ln numlevel="1" lineno="64" slineno="1-37"/>Systems;</subsection><subsection ssid="7-12" dnum="j-o" numlevel="1" lineno="65" slineno="1-38" level="2"><display>(j)</display>one council member shall be a retiree selected by the governing board of the <ln numlevel="1" lineno="66" slineno="1-39"/>association representing the largest number of public education retirees;</subsection><subsection ssid="7-13" dnum="k-o" numlevel="1" lineno="67" slineno="1-40" level="2"><display>(k)</display>one council member shall be a school business official selected by the governing <ln numlevel="1" lineno="68" slineno="1-41"/>board of the association representative of a majority of the school business officials <ln numlevel="1" lineno="69" slineno="1-42"/>from public education employers who participate in a system administered by the <ln numlevel="1" lineno="70" slineno="1-43"/>board; and</subsection><subsection ssid="7-14" dnum="l-o" numlevel="1" lineno="71" slineno="1-44" level="2"><display>(l)</display>one council member shall be a special district officer or employee selected by the <ln numlevel="1" lineno="72" slineno="1-45"/>governing board of the association representing the largest number of special service <ln numlevel="1" lineno="73" slineno="1-46"/>districts and special districts who participate in a system administered by the board.</subsection></subsection><subsection ssid="7-15" dnum="3-o" numlevel="1" lineno="74" slineno="1-47" level="1" space="false"><display>(3)</display><subsection ssid="7-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each entity granted authority to select council members under Subsection <xref depth="4" refnumber="49-11-205(2)" start="0">(2)</xref><ln numlevel="1" lineno="75" slineno="1-48"/> may also revoke the selection at any time.</subsection><subsection ssid="7-17" dnum="b-o" numlevel="1" lineno="76" slineno="1-49" level="2"><display>(b)</display>Each term on the council shall be for a period of four years, subject to Subsection <xref depth="4" refnumber="49-11-205(3)(a)" start="0"><ln numlevel="1" lineno="77" slineno="1-50"/>(3)(a)</xref>.</subsection><subsection ssid="7-18" dnum="c-o" numlevel="1" lineno="78" slineno="1-51" level="2"><display>(c)</display>Each term begins on July 1 and expires on June 30.</subsection><subsection ssid="7-19" dnum="d-o" numlevel="1" lineno="79" slineno="1-52" level="2"><display>(d)</display>When a vacancy occurs on the council for any reason, the replacement shall be <ln numlevel="1" lineno="80" slineno="1-53"/>selected for the remainder of the unexpired term.</subsection></subsection><subsection ssid="7-20" dnum="4-o" numlevel="1" lineno="81" slineno="1-54" level="1"><display>(4)</display>The council shall annually designate one council member as chair.</subsection><subsection ssid="7-21" dnum="5-o" numlevel="1" lineno="82" slineno="1-55" level="1"><display>(5)</display>The council shall:<subsection ssid="7-22" dnum="a-o" numlevel="1" lineno="83" slineno="1-56" level="2"><display>(a)</display>recommend to the board and to the Legislature benefits and policies for members of <ln numlevel="1" lineno="84" slineno="1-57"/>any system or plan administered by the board;</subsection><subsection ssid="7-23" dnum="b-o" numlevel="1" lineno="85" slineno="1-58" level="2"><display>(b)</display>recommend procedures and practices to improve the administration of the systems <ln numlevel="1" lineno="86" slineno="1-59"/>and plans and the public employee relations responsibilities of the board and office;</subsection><subsection ssid="7-24" dnum="c-o" numlevel="1" lineno="87" slineno="1-60" level="2"><display>(c)</display>examine the record of all decisions affecting retirement benefits made by a hearing <ln numlevel="1" lineno="88" slineno="1-61"/>officer under Section <xref depth="3" refnumber="49-11-613" start="0">49-11-613</xref>;</subsection><subsection ssid="7-25" dnum="d-o" numlevel="1" lineno="89" slineno="1-62" level="2"><display>(d)</display>submit nominations to the board for the position of executive director if that position <ln numlevel="1" lineno="90" slineno="1-63"/>is vacant;</subsection><subsection ssid="7-26" dnum="e-o" numlevel="1" lineno="91" slineno="1-64" level="2"><display>(e)</display>advise and counsel with the board and the director on policies affecting members of <ln numlevel="1" lineno="92" slineno="1-65"/>the various systems administered by the office; and</subsection><subsection ssid="7-27" dnum="f-o" numlevel="1" lineno="93" slineno="1-66" level="2"><display>(f)</display>perform other duties assigned to it by the board.</subsection></subsection><subsection ssid="7-28" dnum="6-o" numlevel="1" lineno="94" slineno="1-67" level="1"><display>(6)</display>A member of the council may not receive compensation or benefits for the member's <ln numlevel="1" lineno="95" slineno="1-68"/>service, but may receive per diem and travel expenses in accordance with:<subsection ssid="7-29" dnum="a-o" numlevel="1" lineno="96" slineno="1-69" level="2"><display>(a)</display>Section <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref>;</subsection><subsection ssid="7-30" dnum="b-o" numlevel="1" lineno="97" slineno="1-70" level="2"><display>(b)</display>Section <xref depth="3" refnumber="63A-3-107" start="0">63A-3-107</xref>; and</subsection><subsection ssid="7-31" dnum="c-o" numlevel="1" lineno="98" slineno="1-71" level="2"><display>(c)</display>rules made by the Division of Finance pursuant to Sections <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107" start="0"><ln numlevel="1" lineno="99" slineno="1-72"/>63A-3-107</xref>.</subsection></subsection></section></bsec><bsec buid="9" type="amend" src="code" num="49-12-102" uid="C49-12-S102_2025050720250507" sort="49 12 01020020250507" numlevel="1" lineno="100" slineno="2-1" sn="2"><section number="49-12-102" numlevel="1" lineno="101" slineno="2-2" type="amend"><secline lineno="100">Section 2, Section <bold>49-12-102</bold> is amended to read:</secline><catline lineno="101"><bold>49-12-102. Definitions.</bold></catline><sectionText lineno="102"><tab/>As used in this chapter:</sectionText><subsection ssid="9-1" dnum="1-o" numlevel="1" lineno="103" slineno="2-4" level="1" space="false"><display>(1)</display><subsection ssid="9-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Benefits normally provided" means a benefit offered by an employer, including:<subsection ssid="9-3" dnum="i-o" numlevel="1" lineno="104" slineno="2-5" level="3" tab="1"><display>(i)</display>a leave benefit of any kind;</subsection><subsection ssid="9-4" dnum="ii-o" numlevel="1" lineno="105" slineno="2-6" level="3" tab="1"><display>(ii)</display>insurance coverage of any kind if the employer pays some or all of the premium <ln numlevel="1" lineno="106" slineno="2-7"/>for the coverage;</subsection><subsection ssid="9-5" dnum="iii-o" numlevel="1" lineno="107" slineno="2-8" level="3" tab="1"><display>(iii)</display>employer contributions to a health savings account, health reimbursement <ln numlevel="1" lineno="108" slineno="2-9"/>account, health reimbursement arrangement, or medical expense reimbursement <ln numlevel="1" lineno="109" slineno="2-10"/>plan; and</subsection><subsection ssid="9-6" dnum="iv-o" numlevel="1" lineno="110" slineno="2-11" level="3" tab="1"><display>(iv)</display>a retirement benefit of any kind if the employer pays some or all of the cost of <ln numlevel="1" lineno="111" slineno="2-12"/>the benefit.</subsection></subsection><subsection ssid="9-7" dnum="b-o" numlevel="1" lineno="112" slineno="2-13" level="2"><display>(b)</display>"Benefits normally provided" does not include:<subsection ssid="9-8" dnum="i-o" numlevel="1" lineno="113" slineno="2-14" level="3"><display>(i)</display>a payment for social security;</subsection><subsection ssid="9-9" dnum="ii-o" numlevel="1" lineno="114" slineno="2-15" level="3"><display>(ii)</display>workers' compensation insurance;</subsection><subsection ssid="9-10" dnum="iii-o" numlevel="1" lineno="115" slineno="2-16" level="3"><display>(iii)</display>unemployment insurance;</subsection><subsection ssid="9-11" dnum="iv-o" numlevel="1" lineno="116" slineno="2-17" level="3"><display>(iv)</display>a payment for Medicare;</subsection><subsection ssid="9-12" dnum="v-o" numlevel="1" lineno="117" slineno="2-18" level="3"><display>(v)</display>a payment or insurance required by federal or state law that is similar to a <ln numlevel="1" lineno="118" slineno="2-19"/>payment or insurance listed in Subsection <xref depth="4" refnumber="49-12-102(1)(b)(i)" start="0">(1)(b)(i)</xref>, <xref depth="4" refnumber="49-12-102(1)(b)(ii)" start="0">(ii)</xref>, <xref depth="4" refnumber="49-12-102(1)(b)(iii)" start="0">(iii)</xref>, or <xref depth="4" refnumber="49-12-102(1)(b)(iv)" start="0">(iv)</xref>;</subsection><subsection ssid="9-13" dnum="vi-o" numlevel="1" lineno="119" slineno="2-20" level="3"><display>(vi)</display>any other benefit that state or federal law requires an employer to provide an <ln numlevel="1" lineno="120" slineno="2-21"/>employee who would not otherwise be eligible to receive the benefit; or</subsection><subsection ssid="9-14" dnum="vii-o" numlevel="1" lineno="121" slineno="2-22" level="3"><display>(vii)</display>any benefit that an employer provides an employee in order to avoid a penalty or <ln numlevel="1" lineno="122" slineno="2-23"/>tax under the Patient Protection and Affordable Care Act, Pub. L. No. 111-148 <ln numlevel="1" lineno="123" slineno="2-24"/>and the Health Care Education Reconciliation Act of 2010, Pub. L. No. 111-152, <ln numlevel="1" lineno="124" slineno="2-25"/>and related federal regulations, including a penalty imposed by Internal Revenue <ln numlevel="1" lineno="125" slineno="2-26"/>Code, Section 4980H.</subsection></subsection></subsection><subsection ssid="9-15" dnum="2-o" numlevel="1" lineno="126" slineno="2-27" level="1" space="false"><display>(2)</display><subsection ssid="9-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Compensation" means the total amount of payments made by a participating <ln numlevel="1" lineno="127" slineno="2-28"/>employer to a member of this system for services rendered to the participating <ln numlevel="1" lineno="128" slineno="2-29"/>employer, including:<subsection ssid="9-17" dnum="i-o" numlevel="1" lineno="129" slineno="2-30" level="3" tab="1"><display>(i)</display>bonuses;</subsection><subsection ssid="9-18" dnum="ii-o" numlevel="1" lineno="130" slineno="2-31" level="3" tab="1"><display>(ii)</display>cost-of-living adjustments;</subsection><subsection ssid="9-19" dnum="iii-o" numlevel="1" lineno="131" slineno="2-32" level="3" tab="1"><display>(iii)</display>other payments currently includable in gross income and that are subject to social <ln numlevel="1" lineno="132" slineno="2-33"/>security deductions, including any payments in excess of the maximum amount <ln numlevel="1" lineno="133" slineno="2-34"/>subject to deduction under social security law;</subsection><subsection ssid="9-20" dnum="iv-o" numlevel="1" lineno="134" slineno="2-35" level="3" tab="1"><display>(iv)</display>amounts that the member authorizes to be deducted or reduced for salary deferral <ln numlevel="1" lineno="135" slineno="2-36"/>or other benefits authorized by federal law; and</subsection><subsection ssid="9-21" dnum="v-o" numlevel="1" lineno="136" slineno="2-37" level="3" tab="1"><display>(v)</display>member contributions.</subsection></subsection><subsection ssid="9-22" dnum="b-o" numlevel="1" lineno="137" slineno="2-38" level="2"><display>(b)</display>"Compensation" for purposes of this chapter may not exceed the amount allowed <ln numlevel="1" lineno="138" slineno="2-39"/>under Internal Revenue Code, Section 401(a)(17).</subsection><subsection ssid="9-23" dnum="c-o" numlevel="1" lineno="139" slineno="2-40" level="2"><display>(c)</display>"Compensation" does not include:<subsection ssid="9-24" dnum="i-o" numlevel="1" lineno="140" slineno="2-41" level="3"><display>(i)</display>the monetary value of remuneration paid in kind, including a residence or use of <ln numlevel="1" lineno="141" slineno="2-42"/>equipment;</subsection><subsection ssid="9-25" dnum="ii-o" numlevel="1" lineno="142" slineno="2-43" level="3"><display>(ii)</display>the cost of any employment benefits paid for by the participating employer;</subsection><subsection ssid="9-26" dnum="iii-o" numlevel="1" lineno="143" slineno="2-44" level="3"><display>(iii)</display>compensation paid to a temporary employee, an exempt employee, or an <ln numlevel="1" lineno="144" slineno="2-45"/>employee otherwise ineligible for service credit;</subsection><subsection ssid="9-27" dnum="iv-o" numlevel="1" lineno="145" slineno="2-46" level="3"><display>(iv)</display>any payments upon termination, including accumulated vacation, sick leave <ln numlevel="1" lineno="146" slineno="2-47"/>payments, severance payments, compensatory time payments, or any other special <ln numlevel="1" lineno="147" slineno="2-48"/>payments;</subsection><subsection ssid="9-28" dnum="v-o" numlevel="1" lineno="148" slineno="2-49" level="3"><display>(v)</display>any allowances or payments to a member for costs or expenses paid by the <ln numlevel="1" lineno="149" slineno="2-50"/>participating employer, including automobile costs, uniform costs, travel costs, <ln numlevel="1" lineno="150" slineno="2-51"/>tuition costs, housing costs, insurance costs, equipment costs, and dependent care <ln numlevel="1" lineno="151" slineno="2-52"/>costs; or</subsection><subsection ssid="9-29" dnum="vi-o" numlevel="1" lineno="152" slineno="2-53" level="3"><display>(vi)</display>a teacher salary bonus described in Section <xref depth="3" refnumber="53F-2-513" start="0">53F-2-513</xref>.</subsection></subsection><subsection ssid="9-30" dnum="d-o" numlevel="1" lineno="153" slineno="2-54" level="2"><display>(d)</display>The executive director may determine if a payment not listed under this Subsection <xref depth="4" refnumber="49-12-102(2)" start="0"><ln numlevel="1" lineno="154" slineno="2-55"/>(2)</xref> falls within the definition of compensation.</subsection></subsection><subsection ssid="9-31" dnum="3-o" numlevel="1" lineno="155" slineno="2-56" level="1" space="false"><display>(3)</display><subsection ssid="9-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Final average salary" means the amount calculated by averaging the highest five <ln numlevel="1" lineno="156" slineno="2-57"/>years of annual compensation preceding retirement subject to Subsections <xref depth="4" refnumber="49-12-102(3)(b)" start="0">(3)(b)</xref>, <xref depth="4" refnumber="49-12-102(3)(c)" start="0">(c)</xref>, <xref depth="4" refnumber="49-12-102(3)(d)" start="0"><ln numlevel="1" lineno="157" slineno="2-58"/>(d)</xref>, <xref depth="4" refnumber="49-12-102(3)(e)" start="0">(e)</xref>, and <xref depth="4" refnumber="49-12-102(3)(f)" start="0">(f)</xref>.</subsection><subsection ssid="9-33" dnum="b-o" numlevel="1" lineno="158" slineno="2-59" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="49-12-102(3)(c)" start="0">(3)(c)</xref>, the percentage increase in annual <ln numlevel="1" lineno="159" slineno="2-60"/>compensation in any one of the years used may not exceed the previous year's <ln numlevel="1" lineno="160" slineno="2-61"/>compensation by more than 10% plus a cost-of-living adjustment equal to the <ln numlevel="1" lineno="161" slineno="2-62"/>decrease in the purchasing power of the dollar during the previous year, as measured <ln numlevel="1" lineno="162" slineno="2-63"/>by a United States Bureau of Labor Statistics Consumer Price Index average as <ln numlevel="1" lineno="163" slineno="2-64"/>determined by the board.</subsection><subsection ssid="9-34" dnum="c-o" numlevel="1" lineno="164" slineno="2-65" level="2"><display>(c)</display>In cases where the participating employer provides acceptable documentation to the <ln numlevel="1" lineno="165" slineno="2-66"/>office, the limitation in Subsection <xref depth="4" refnumber="49-12-102(3)(b)" start="0">(3)(b)</xref> may be exceeded if:<subsection ssid="9-35" dnum="i-o" numlevel="1" lineno="166" slineno="2-67" level="3"><display>(i)</display>the member has transferred from another agency; or</subsection><subsection ssid="9-36" dnum="ii-o" numlevel="1" lineno="167" slineno="2-68" level="3"><display>(ii)</display>the member has been promoted to a new position.</subsection></subsection><subsection ssid="9-37" dnum="d-o" numlevel="1" lineno="168" slineno="2-69" level="2"><display>(d)</display>If the member retires more than six months from the date of termination of <ln numlevel="1" lineno="169" slineno="2-70"/>employment, the member is considered to have been in service at the member's last <ln numlevel="1" lineno="170" slineno="2-71"/>rate of pay from the date of the termination of employment to the effective date of <ln numlevel="1" lineno="171" slineno="2-72"/>retirement for purposes of computing the member's final average salary only.</subsection><subsection ssid="9-38" dnum="e-o" numlevel="1" lineno="172" slineno="2-73" level="2"><display>(e)</display>If the member has less than five years of service credit in this system, final average <ln numlevel="1" lineno="173" slineno="2-74"/>salary means the average annual compensation paid to the member during the full <ln numlevel="1" lineno="174" slineno="2-75"/>period of service credit.</subsection><subsection ssid="9-39" dnum="f-o" numlevel="1" lineno="175" slineno="2-76" level="2"><display>(f)</display>The annual compensation used to calculate final average salary shall be based on a <ln numlevel="1" lineno="176" slineno="2-77"/>period, as determined by the board, consistent with the period used to determine <ln numlevel="1" lineno="177" slineno="2-78"/>years of service credit in accordance with Subsection <xref depth="4" refnumber="49-12-102(7)" start="0">(7)</xref>.</subsection></subsection><subsection ssid="9-40" dnum="4-o" numlevel="1" lineno="178" slineno="2-79" level="1"><display>(4)</display>"Participating employer" means an employer that meets the participation requirements <ln numlevel="1" lineno="179" slineno="2-80"/>of Sections <xref depth="3" refnumber="49-12-201" start="0">49-12-201</xref> and <xref depth="3" refnumber="49-12-202" start="0">49-12-202</xref>.</subsection><subsection ssid="9-41" dnum="5-o" numlevel="1" lineno="180" slineno="2-81" level="1" space="false"><display>(5)</display><subsection ssid="9-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Regular full-time employee" means an employee:<subsection ssid="9-43" dnum="i-o" numlevel="1" lineno="181" slineno="2-82" level="3" tab="1"><display>(i)</display>whose term of employment for a participating employer contemplates continued <ln numlevel="1" lineno="182" slineno="2-83"/>employment during a fiscal or calendar year;</subsection><subsection ssid="9-44" dnum="ii-o" numlevel="1" lineno="183" slineno="2-84" level="3" tab="1"><display>(ii)</display>whose employment normally requires an average of 20 hours or more per week, <ln numlevel="1" lineno="184" slineno="2-85"/>except as modified by the board; and</subsection><subsection ssid="9-45" dnum="iii-o" numlevel="1" lineno="185" slineno="2-86" level="3" tab="1"><display>(iii)</display>who receives benefits normally provided by the participating employer.</subsection></subsection><subsection ssid="9-46" dnum="b-o" numlevel="1" lineno="186" slineno="2-87" level="2"><display>(b)</display>"Regular full-time employee" includes:<subsection ssid="9-47" dnum="i-o" numlevel="1" lineno="187" slineno="2-88" level="3"><display>(i)</display>a teacher whose term of employment for a participating employer contemplates <ln numlevel="1" lineno="188" slineno="2-89"/>continued employment during a school year and who teaches half-time or more;</subsection><subsection ssid="9-48" dnum="ii-o" numlevel="1" lineno="189" slineno="2-90" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend>:<subsection ssid="9-49" dnum="A-o" numlevel="1" lineno="190" slineno="2-91" level="4"><display>(A)</display>who is hired before July 1, 2013; and</subsection><subsection ssid="9-50" dnum="B-o" numlevel="1" lineno="191" slineno="2-92" level="4"><display>(B)</display>whose employment normally requires an average of 20 hours per week or <ln numlevel="1" lineno="192" slineno="2-93"/>more for a participating employer, regardless of benefits provided;</subsection></subsection><subsection ssid="9-51" dnum="iii-o" numlevel="1" lineno="193" slineno="2-94" level="3"><display>(iii)</display>an officer, elective or appointive, who earns $500 or more per month, indexed as <ln numlevel="1" lineno="194" slineno="2-95"/>of January 1, 1990, as provided in Section <xref depth="3" refnumber="49-12-407" start="0">49-12-407</xref>;</subsection><subsection ssid="9-52" dnum="iv-o" numlevel="1" lineno="195" slineno="2-96" level="3"><display>(iv)</display>a faculty member or employee of an institution of higher education who is <ln numlevel="1" lineno="196" slineno="2-97"/>considered full-time by that institution of higher education; and</subsection><subsection ssid="9-53" dnum="v-o" numlevel="1" lineno="197" slineno="2-98" level="3"><display>(v)</display>an individual who otherwise meets the definition of this Subsection <xref depth="4" refnumber="49-12-102(5)" start="0">(5)</xref> who <ln numlevel="1" lineno="198" slineno="2-99"/>performs services for a participating employer through a professional employer <ln numlevel="1" lineno="199" slineno="2-100"/>organization or similar arrangement.</subsection></subsection><subsection ssid="9-54" dnum="c-o" numlevel="1" lineno="200" slineno="2-101" level="2"><display>(c)</display>"Regular full-time employee" does not include <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="201" slineno="2-102"/>education support professional</amend>:<subsection ssid="9-55" dnum="i-o" numlevel="1" lineno="202" slineno="2-103" level="3" space="false"><display>(i)</display><subsection ssid="9-56" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is hired on or after July 1, 2013; and</subsection><subsection ssid="9-57" dnum="B-o" numlevel="1" lineno="203" slineno="2-104" level="4"><display>(B)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="204" slineno="2-105"/>employer even if the employment normally requires an average of 20 hours per <ln numlevel="1" lineno="205" slineno="2-106"/>week or more for a participating employer;</subsection></subsection><subsection ssid="9-58" dnum="ii-o" numlevel="1" lineno="206" slineno="2-107" level="3" space="false"><display>(ii)</display><subsection ssid="9-59" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is hired before July 1, 2013;</subsection><subsection ssid="9-60" dnum="B-o" numlevel="1" lineno="207" slineno="2-108" level="4"><display>(B)</display>who did not qualify as a regular full-time employee before July 1, 2013;</subsection><subsection ssid="9-61" dnum="C-o" numlevel="1" lineno="208" slineno="2-109" level="4"><display>(C)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="209" slineno="2-110"/>employer; and</subsection><subsection ssid="9-62" dnum="D-o" numlevel="1" lineno="210" slineno="2-111" level="4"><display>(D)</display>whose employment hours are increased on or after July 1, 2013, to require an <ln numlevel="1" lineno="211" slineno="2-112"/>average of 20 hours per week or more for a participating employer; or</subsection></subsection><subsection ssid="9-63" dnum="iii-o" numlevel="1" lineno="212" slineno="2-113" level="3"><display>(iii)</display>who is a person working on a contract:<subsection ssid="9-64" dnum="A-o" numlevel="1" lineno="213" slineno="2-114" level="4"><display>(A)</display>for the purposes of vocational rehabilitation and the employment and training <ln numlevel="1" lineno="214" slineno="2-115"/>of people with significant disabilities; and</subsection><subsection ssid="9-65" dnum="B-o" numlevel="1" lineno="215" slineno="2-116" level="4"><display>(B)</display>that has been set aside from procurement requirements by the state pursuant to <ln numlevel="1" lineno="216" slineno="2-117"/>Section <xref depth="3" refnumber="63G-6a-805" start="0">63G-6a-805</xref> or the federal government pursuant to 41 U.S.C. Sec. 8501 <ln numlevel="1" lineno="217" slineno="2-118"/>et seq.</subsection></subsection></subsection></subsection><subsection ssid="9-66" dnum="6-o" numlevel="1" lineno="218" slineno="2-119" level="1"><display>(6)</display>"System" means the Public Employees' Contributory Retirement System created under <ln numlevel="1" lineno="219" slineno="2-120"/>this chapter.</subsection><subsection ssid="9-67" dnum="7-o" numlevel="1" lineno="220" slineno="2-121" level="1"><display>(7)</display>"Years of service credit" means:<subsection ssid="9-68" dnum="a-o" numlevel="1" lineno="221" slineno="2-122" level="2"><display>(a)</display>a period consisting of 12 full months as determined by the board;</subsection><subsection ssid="9-69" dnum="b-o" numlevel="1" lineno="222" slineno="2-123" level="2"><display>(b)</display>a period determined by the board, whether consecutive or not, during which a regular <ln numlevel="1" lineno="223" slineno="2-124"/>full-time employee performed services for a participating employer, including any <ln numlevel="1" lineno="224" slineno="2-125"/>time the regular full-time employee was absent on a paid leave of absence granted by <ln numlevel="1" lineno="225" slineno="2-126"/>a participating employer or was absent in the service of the United States government <ln numlevel="1" lineno="226" slineno="2-127"/>on military duty as provided by this chapter; or</subsection><subsection ssid="9-70" dnum="c-o" numlevel="1" lineno="227" slineno="2-128" level="2"><display>(c)</display>the regular school year consisting of not less than eight months of full-time service <ln numlevel="1" lineno="228" slineno="2-129"/>for a regular full-time employee of an educational institution.</subsection></subsection></section></bsec><bsec buid="8" type="amend" src="code" num="49-13-102" uid="C49-13-S102_2025050720250507" sort="49 13 01020020250507" numlevel="1" lineno="229" slineno="3-1" sn="3"><section number="49-13-102" numlevel="1" lineno="230" slineno="3-2" type="amend"><secline lineno="229">Section 3, Section <bold>49-13-102</bold> is amended to read:</secline><catline lineno="230"><bold>49-13-102. Definitions.</bold></catline><sectionText lineno="231"><tab/>As used in this chapter:</sectionText><subsection ssid="8-1" dnum="1-o" numlevel="1" lineno="232" slineno="3-4" level="1"><display>(1)</display>"Benefits normally provided" means the same as that term is defined in Section <xref depth="3" refnumber="49-12-102" start="0"><ln numlevel="1" lineno="233" slineno="3-5"/>49-12-102</xref>.</subsection><subsection ssid="8-2" dnum="2-o" numlevel="1" lineno="234" slineno="3-6" level="1" space="false"><display>(2)</display><subsection ssid="8-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Compensation" means the total amount of payments made by a participating <ln numlevel="1" lineno="235" slineno="3-7"/>employer to a member of this system for services rendered to the participating <ln numlevel="1" lineno="236" slineno="3-8"/>employer, including:<subsection ssid="8-4" dnum="i-o" numlevel="1" lineno="237" slineno="3-9" level="3" tab="1"><display>(i)</display>bonuses;</subsection><subsection ssid="8-5" dnum="ii-o" numlevel="1" lineno="238" slineno="3-10" level="3" tab="1"><display>(ii)</display>cost-of-living adjustments;</subsection><subsection ssid="8-6" dnum="iii-o" numlevel="1" lineno="239" slineno="3-11" level="3" tab="1"><display>(iii)</display>other payments currently includable in gross income and that are subject to social <ln numlevel="1" lineno="240" slineno="3-12"/>security deductions, including any payments in excess of the maximum amount <ln numlevel="1" lineno="241" slineno="3-13"/>subject to deduction under social security law; and</subsection><subsection ssid="8-7" dnum="iv-o" numlevel="1" lineno="242" slineno="3-14" level="3" tab="1"><display>(iv)</display>amounts that the member authorizes to be deducted or reduced for salary deferral <ln numlevel="1" lineno="243" slineno="3-15"/>or other benefits authorized by federal law.</subsection></subsection><subsection ssid="8-8" dnum="b-o" numlevel="1" lineno="244" slineno="3-16" level="2"><display>(b)</display>"Compensation" for purposes of this chapter may not exceed the amount allowed <ln numlevel="1" lineno="245" slineno="3-17"/>under Internal Revenue Code, Section 401(a)(17).</subsection><subsection ssid="8-9" dnum="c-o" numlevel="1" lineno="246" slineno="3-18" level="2"><display>(c)</display>"Compensation" does not include:<subsection ssid="8-10" dnum="i-o" numlevel="1" lineno="247" slineno="3-19" level="3"><display>(i)</display>the monetary value of remuneration paid in kind, including a residence or use of <ln numlevel="1" lineno="248" slineno="3-20"/>equipment;</subsection><subsection ssid="8-11" dnum="ii-o" numlevel="1" lineno="249" slineno="3-21" level="3"><display>(ii)</display>the cost of any employment benefits paid for by the participating employer;</subsection><subsection ssid="8-12" dnum="iii-o" numlevel="1" lineno="250" slineno="3-22" level="3"><display>(iii)</display>compensation paid to a temporary employee, an exempt employee, or an <ln numlevel="1" lineno="251" slineno="3-23"/>employee otherwise ineligible for service credit;</subsection><subsection ssid="8-13" dnum="iv-o" numlevel="1" lineno="252" slineno="3-24" level="3"><display>(iv)</display>any payments upon termination, including accumulated vacation, sick leave <ln numlevel="1" lineno="253" slineno="3-25"/>payments, severance payments, compensatory time payments, or any other special <ln numlevel="1" lineno="254" slineno="3-26"/>payments;</subsection><subsection ssid="8-14" dnum="v-o" numlevel="1" lineno="255" slineno="3-27" level="3"><display>(v)</display>any allowances or payments to a member for costs or expenses paid by the <ln numlevel="1" lineno="256" slineno="3-28"/>participating employer, including automobile costs, uniform costs, travel costs, <ln numlevel="1" lineno="257" slineno="3-29"/>tuition costs, housing costs, insurance costs, equipment costs, and dependent care <ln numlevel="1" lineno="258" slineno="3-30"/>costs; or</subsection><subsection ssid="8-22" dnum="ii-o" numlevel="1" lineno="274" slineno="3-46" level="3"><display>(ii)</display>the member has been promoted to a new position.</subsection></subsection><subsection ssid="8-23" dnum="d-o" numlevel="1" lineno="275" slineno="3-47" level="2"><display>(d)</display>If the member retires more than six months from the date of termination of <ln numlevel="1" lineno="276" slineno="3-48"/>employment and for purposes of computing the member's final average salary only, <ln numlevel="1" lineno="277" slineno="3-49"/>the member is considered to have been in service at the member's last rate of pay <ln numlevel="1" lineno="278" slineno="3-50"/>from the date of the termination of employment to the effective date of retirement.</subsection><subsection ssid="8-24" dnum="e-o" numlevel="1" lineno="279" slineno="3-51" level="2"><display>(e)</display>The annual compensation used to calculate final average salary shall be based on a <ln numlevel="1" lineno="280" slineno="3-52"/>period, as determined by the board, consistent with the period used to determine <ln numlevel="1" lineno="281" slineno="3-53"/>years of service credit in accordance with Subsection <xref depth="4" refnumber="49-13-102(7)" start="0">(7)</xref>.</subsection></subsection><subsection ssid="8-25" dnum="4-o" numlevel="1" lineno="282" slineno="3-54" level="1"><display>(4)</display>"Participating employer" means an employer that meets the participation requirements <ln numlevel="1" lineno="283" slineno="3-55"/>of Sections <xref depth="3" refnumber="49-13-201" start="0">49-13-201</xref> and <xref depth="3" refnumber="49-13-202" start="0">49-13-202</xref>.</subsection><subsection ssid="8-26" dnum="5-o" numlevel="1" lineno="284" slineno="3-56" level="1" space="false"><display>(5)</display><subsection ssid="8-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Regular full-time employee" means an employee:<subsection ssid="8-28" dnum="i-o" numlevel="1" lineno="285" slineno="3-57" level="3" tab="1"><display>(i)</display>whose term of employment for a participating employer contemplates continued <ln numlevel="1" lineno="286" slineno="3-58"/>employment during a fiscal or calendar year;</subsection><subsection ssid="8-29" dnum="ii-o" numlevel="1" lineno="287" slineno="3-59" level="3" tab="1"><display>(ii)</display>whose employment normally requires an average of 20 hours or more per week, <ln numlevel="1" lineno="288" slineno="3-60"/>except as modified by the board; and</subsection><subsection ssid="8-30" dnum="iii-o" numlevel="1" lineno="289" slineno="3-61" level="3" tab="1"><display>(iii)</display>who receives benefits normally provided by the participating employer.</subsection></subsection><subsection ssid="8-31" dnum="b-o" numlevel="1" lineno="290" slineno="3-62" level="2"><display>(b)</display>"Regular full-time employee" includes:<subsection ssid="8-32" dnum="i-o" numlevel="1" lineno="291" slineno="3-63" level="3"><display>(i)</display>a teacher whose term of employment for a participating employer contemplates <ln numlevel="1" lineno="292" slineno="3-64"/>continued employment during a school year and who teaches half time or more;</subsection><subsection ssid="8-33" dnum="ii-o" numlevel="1" lineno="293" slineno="3-65" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend>:<subsection ssid="8-34" dnum="A-o" numlevel="1" lineno="294" slineno="3-66" level="4"><display>(A)</display>who is hired before July 1, 2013; and</subsection><subsection ssid="8-35" dnum="B-o" numlevel="1" lineno="295" slineno="3-67" level="4"><display>(B)</display>whose employment normally requires an average of 20 hours per week or <ln numlevel="1" lineno="296" slineno="3-68"/>more for a participating employer, regardless of benefits provided;</subsection></subsection><subsection ssid="8-36" dnum="iii-o" numlevel="1" lineno="297" slineno="3-69" level="3"><display>(iii)</display>an officer, elective or appointive, who earns $500 or more per month, indexed as <ln numlevel="1" lineno="298" slineno="3-70"/>of January 1, 1990, as provided in Section <xref depth="3" refnumber="49-13-407" start="0">49-13-407</xref>;</subsection><subsection ssid="8-37" dnum="iv-o" numlevel="1" lineno="299" slineno="3-71" level="3"><display>(iv)</display>a faculty member or employee of an institution of higher education who is <ln numlevel="1" lineno="300" slineno="3-72"/>considered full time by that institution of higher education; and</subsection><subsection ssid="8-38" dnum="v-o" numlevel="1" lineno="301" slineno="3-73" level="3"><display>(v)</display>an individual who otherwise meets the definition of this Subsection <xref depth="4" refnumber="49-13-102(5)" start="0">(5)</xref> who <ln numlevel="1" lineno="302" slineno="3-74"/>performs services for a participating employer through a professional employer <ln numlevel="1" lineno="303" slineno="3-75"/>organization or similar arrangement.</subsection></subsection><subsection ssid="8-39" dnum="c-o" numlevel="1" lineno="304" slineno="3-76" level="2"><display>(c)</display>"Regular full-time employee" does not include <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="305" slineno="3-77"/>education support professional</amend>:<subsection ssid="8-40" dnum="i-o" numlevel="1" lineno="306" slineno="3-78" level="3" space="false"><display>(i)</display><subsection ssid="8-41" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is hired on or after July 1, 2013; and</subsection><subsection ssid="8-42" dnum="B-o" numlevel="1" lineno="307" slineno="3-79" level="4"><display>(B)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="308" slineno="3-80"/>employer even if the employment normally requires an average of 20 hours per <ln numlevel="1" lineno="309" slineno="3-81"/>week or more for a participating employer;</subsection></subsection><subsection ssid="8-43" dnum="ii-o" numlevel="1" lineno="310" slineno="3-82" level="3" space="false"><display>(ii)</display><subsection ssid="8-44" dnum="A-o" level="4" placement="sameline"><display>(A)</display>who is hired before July 1, 2013;</subsection><subsection ssid="8-45" dnum="B-o" numlevel="1" lineno="311" slineno="3-83" level="4"><display>(B)</display>who did not qualify as a regular full-time employee before July 1, 2013;</subsection><subsection ssid="8-46" dnum="C-o" numlevel="1" lineno="312" slineno="3-84" level="4"><display>(C)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="313" slineno="3-85"/>employer; and</subsection><subsection ssid="8-47" dnum="D-o" numlevel="1" lineno="314" slineno="3-86" level="4"><display>(D)</display>whose employment hours are increased on or after July 1, 2013, to require an <ln numlevel="1" lineno="315" slineno="3-87"/>average of 20 hours per week or more for a participating employer; or</subsection></subsection><subsection ssid="8-48" dnum="iii-o" numlevel="1" lineno="316" slineno="3-88" level="3"><display>(iii)</display>who is a person working on a contract:<subsection ssid="8-49" dnum="A-o" numlevel="1" lineno="317" slineno="3-89" level="4"><display>(A)</display>for the purposes of vocational rehabilitation and the employment and training <ln numlevel="1" lineno="318" slineno="3-90"/>of people with significant disabilities; and</subsection><subsection ssid="8-50" dnum="B-o" numlevel="1" lineno="319" slineno="3-91" level="4"><display>(B)</display>that has been set aside from procurement requirements by the state pursuant to <ln numlevel="1" lineno="320" slineno="3-92"/>Section <xref depth="3" refnumber="63G-6a-805" start="0">63G-6a-805</xref> or the federal government pursuant to 41 U.S.C. Sec. 8501 <ln numlevel="1" lineno="321" slineno="3-93"/>et seq.</subsection></subsection></subsection></subsection><subsection ssid="8-51" dnum="6-o" numlevel="1" lineno="322" slineno="3-94" level="1"><display>(6)</display>"System" means the Public Employees' Noncontributory Retirement System.</subsection><subsection ssid="8-52" dnum="7-o" numlevel="1" lineno="323" slineno="3-95" level="1"><display>(7)</display>"Years of service credit" means:<subsection ssid="8-53" dnum="a-o" numlevel="1" lineno="324" slineno="3-96" level="2"><display>(a)</display>a period consisting of 12 full months as determined by the board;</subsection><subsection ssid="8-54" dnum="b-o" numlevel="1" lineno="325" slineno="3-97" level="2"><display>(b)</display>a period determined by the board, whether consecutive or not, during which a regular <ln numlevel="1" lineno="326" slineno="3-98"/>full-time employee performed services for a participating employer, including any <ln numlevel="1" lineno="327" slineno="3-99"/>time the regular full-time employee was absent on a paid leave of absence granted by <ln numlevel="1" lineno="328" slineno="3-100"/>a participating employer or was absent in the service of the United States government <ln numlevel="1" lineno="329" slineno="3-101"/>on military duty as provided by this chapter; or</subsection><subsection ssid="8-55" dnum="c-o" numlevel="1" lineno="330" slineno="3-102" level="2"><display>(c)</display>the regular school year consisting of not less than eight months of full-time service <ln numlevel="1" lineno="331" slineno="3-103"/>for a regular full-time employee of an educational institution.</subsection></subsection></section></bsec><bsec buid="6" type="amend" src="code" num="49-22-102" uid="C49-22-S102_2025050720250507" sort="49 22 01020020250507" numlevel="1" lineno="332" slineno="4-1" sn="4"><section number="49-22-102" numlevel="1" lineno="333" slineno="4-2" type="amend"><secline lineno="332">Section 4, Section <bold>49-22-102</bold> is amended to read:</secline><catline lineno="333"><bold>49-22-102. Definitions.</bold></catline><sectionText lineno="334"><tab/>As used in this chapter:</sectionText><subsection ssid="6-1" dnum="1-o" numlevel="1" lineno="335" slineno="4-4" level="1"><display>(1)</display>"Benefits normally provided" means the same as that term is defined in Section <xref depth="3" refnumber="49-12-102" start="0"><ln numlevel="1" lineno="336" slineno="4-5"/>49-12-102</xref>.</subsection><subsection ssid="6-2" dnum="2-o" numlevel="1" lineno="337" slineno="4-6" level="1" space="false"><display>(2)</display><subsection ssid="6-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Compensation" means the total amount of payments made by a participating <ln numlevel="1" lineno="338" slineno="4-7"/>employer to a member of this system for services rendered to the participating <ln numlevel="1" lineno="339" slineno="4-8"/>employer, including:<subsection ssid="6-4" dnum="i-o" numlevel="1" lineno="340" slineno="4-9" level="3" tab="1"><display>(i)</display>bonuses;</subsection><subsection ssid="6-5" dnum="ii-o" numlevel="1" lineno="341" slineno="4-10" level="3" tab="1"><display>(ii)</display>cost-of-living adjustments;</subsection><subsection ssid="6-6" dnum="iii-o" numlevel="1" lineno="342" slineno="4-11" level="3" tab="1"><display>(iii)</display>other payments currently includable in gross income and that are subject to social <ln numlevel="1" lineno="343" slineno="4-12"/>security deductions, including any payments in excess of the maximum amount <ln numlevel="1" lineno="344" slineno="4-13"/>subject to deduction under social security law;</subsection><subsection ssid="6-7" dnum="iv-o" numlevel="1" lineno="345" slineno="4-14" level="3" tab="1"><display>(iv)</display>amounts that the member authorizes to be deducted or reduced for salary deferral <ln numlevel="1" lineno="346" slineno="4-15"/>or other benefits authorized by federal law; and</subsection><subsection ssid="6-8" dnum="v-o" numlevel="1" lineno="347" slineno="4-16" level="3" tab="1"><display>(v)</display>member contributions.</subsection></subsection><subsection ssid="6-9" dnum="b-o" numlevel="1" lineno="348" slineno="4-17" level="2"><display>(b)</display>"Compensation" for purposes of this chapter may not exceed the amount allowed <ln numlevel="1" lineno="349" slineno="4-18"/>under Internal Revenue Code, Section 401(a)(17).</subsection><subsection ssid="6-10" dnum="c-o" numlevel="1" lineno="350" slineno="4-19" level="2"><display>(c)</display>"Compensation" does not include:<subsection ssid="6-11" dnum="i-o" numlevel="1" lineno="351" slineno="4-20" level="3"><display>(i)</display>the monetary value of remuneration paid in kind, including a residence or use of <ln numlevel="1" lineno="352" slineno="4-21"/>equipment;</subsection><subsection ssid="6-12" dnum="ii-o" numlevel="1" lineno="353" slineno="4-22" level="3"><display>(ii)</display>the cost of any employment benefits paid for by the participating employer;</subsection><subsection ssid="6-13" dnum="iii-o" numlevel="1" lineno="354" slineno="4-23" level="3"><display>(iii)</display>compensation paid to a temporary employee or an employee otherwise ineligible <ln numlevel="1" lineno="355" slineno="4-24"/>for service credit;</subsection><subsection ssid="6-14" dnum="iv-o" numlevel="1" lineno="356" slineno="4-25" level="3"><display>(iv)</display>any payments upon termination, including accumulated vacation, sick leave <ln numlevel="1" lineno="357" slineno="4-26"/>payments, severance payments, compensatory time payments, or any other special <ln numlevel="1" lineno="358" slineno="4-27"/>payments;</subsection><subsection ssid="6-15" dnum="v-o" numlevel="1" lineno="359" slineno="4-28" level="3"><display>(v)</display>any allowances or payments to a member for costs or expenses paid by the <ln numlevel="1" lineno="360" slineno="4-29"/>participating employer, including automobile costs, uniform costs, travel costs, <ln numlevel="1" lineno="361" slineno="4-30"/>tuition costs, housing costs, insurance costs, equipment costs, and dependent care <ln numlevel="1" lineno="362" slineno="4-31"/>costs; or</subsection><subsection ssid="6-16" dnum="vi-o" numlevel="1" lineno="363" slineno="4-32" level="3"><display>(vi)</display>a teacher salary bonus described in Section <xref depth="3" refnumber="53F-2-513" start="0">53F-2-513</xref>.</subsection></subsection><subsection ssid="6-17" dnum="d-o" numlevel="1" lineno="364" slineno="4-33" level="2"><display>(d)</display>The executive director may determine if a payment not listed under this Subsection <xref depth="4" refnumber="49-22-102(2)" start="0"><ln numlevel="1" lineno="365" slineno="4-34"/>(2)</xref> falls within the definition of compensation.</subsection></subsection><subsection ssid="6-18" dnum="3-o" numlevel="1" lineno="366" slineno="4-35" level="1"><display>(3)</display>"Corresponding Tier I system" means the system or plan that would have covered the <ln numlevel="1" lineno="367" slineno="4-36"/>member if the member had initially entered employment before July 1, 2011.</subsection><subsection ssid="6-19" dnum="4-o" numlevel="1" lineno="368" slineno="4-37" level="1" space="false"><display>(4)</display><subsection ssid="6-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Final average salary" means the amount calculated by averaging the highest five <ln numlevel="1" lineno="369" slineno="4-38"/>years of annual compensation preceding retirement subject to Subsections <xref depth="4" refnumber="49-22-102(4)(b)" start="0">(4)(b)</xref>, <xref depth="4" refnumber="49-22-102(4)(c)" start="0">(c)</xref>, <xref depth="4" refnumber="49-22-102(4)(d)" start="0"><ln numlevel="1" lineno="370" slineno="4-39"/>(d)</xref>, <xref depth="4" refnumber="49-22-102(4)(e)" start="0">(e)</xref>, and <xref depth="4" refnumber="49-22-102(4)(f)" start="0">(f)</xref>.</subsection><subsection ssid="6-21" dnum="b-o" numlevel="1" lineno="371" slineno="4-40" level="2"><display>(b)</display>Except as provided in Subsection <xref depth="4" refnumber="49-22-102(4)(c)" start="0">(4)(c)</xref>, the percentage increase in annual <ln numlevel="1" lineno="372" slineno="4-41"/>compensation in any one of the years used may not exceed the previous year's <ln numlevel="1" lineno="373" slineno="4-42"/>compensation by more than 10% plus a cost-of-living adjustment equal to the <ln numlevel="1" lineno="374" slineno="4-43"/>decrease in the purchasing power of the dollar during the previous year, as measured <ln numlevel="1" lineno="375" slineno="4-44"/>by a United States Bureau of Labor Statistics Consumer Price Index average as <ln numlevel="1" lineno="376" slineno="4-45"/>determined by the board.</subsection><subsection ssid="6-22" dnum="c-o" numlevel="1" lineno="377" slineno="4-46" level="2"><display>(c)</display>In cases where the participating employer provides acceptable documentation to the <ln numlevel="1" lineno="378" slineno="4-47"/>office, the limitation in Subsection <xref depth="4" refnumber="49-22-102(4)(b)" start="0">(4)(b)</xref> may be exceeded if:<subsection ssid="6-23" dnum="i-o" numlevel="1" lineno="379" slineno="4-48" level="3"><display>(i)</display>the member has transferred from another agency; or</subsection><subsection ssid="6-24" dnum="ii-o" numlevel="1" lineno="380" slineno="4-49" level="3"><display>(ii)</display>the member has been promoted to a new position.</subsection></subsection><subsection ssid="6-25" dnum="d-o" numlevel="1" lineno="381" slineno="4-50" level="2"><display>(d)</display>If the member retires more than six months from the date of termination of <ln numlevel="1" lineno="382" slineno="4-51"/>employment, the member is considered to have been in service at the member's last <ln numlevel="1" lineno="383" slineno="4-52"/>rate of pay from the date of the termination of employment to the effective date of <ln numlevel="1" lineno="384" slineno="4-53"/>retirement for purposes of computing the member's final average salary only.</subsection><subsection ssid="6-26" dnum="e-o" numlevel="1" lineno="385" slineno="4-54" level="2"><display>(e)</display>If the member has less than five years of service credit in this system, final average <ln numlevel="1" lineno="386" slineno="4-55"/>salary means the average annual compensation paid to the member during the full <ln numlevel="1" lineno="387" slineno="4-56"/>period of service credit.</subsection><subsection ssid="6-27" dnum="f-o" numlevel="1" lineno="388" slineno="4-57" level="2"><display>(f)</display>The annual compensation used to calculate final average salary shall be based on a <ln numlevel="1" lineno="389" slineno="4-58"/>period, as determined by the board, consistent with the period used to determine <ln numlevel="1" lineno="390" slineno="4-59"/>years of service credit in accordance with Subsection <xref depth="4" refnumber="49-22-102(8)" start="0">(8)</xref>.</subsection></subsection><subsection ssid="6-28" dnum="5-o" numlevel="1" lineno="391" slineno="4-60" level="1"><display>(5)</display>"Participating employer" means an employer that meets the participation requirements <ln numlevel="1" lineno="392" slineno="4-61"/>of:<subsection ssid="6-29" dnum="a-o" numlevel="1" lineno="393" slineno="4-62" level="2"><display>(a)</display>Sections <xref depth="3" refnumber="49-12-201" start="0">49-12-201</xref> and <xref depth="3" refnumber="49-12-202" start="0">49-12-202</xref>;</subsection><subsection ssid="6-30" dnum="b-o" numlevel="1" lineno="394" slineno="4-63" level="2"><display>(b)</display>Sections <xref depth="3" refnumber="49-13-201" start="0">49-13-201</xref> and <xref depth="3" refnumber="49-13-202" start="0">49-13-202</xref>;</subsection><subsection ssid="6-31" dnum="c-o" numlevel="1" lineno="395" slineno="4-64" level="2"><display>(c)</display>Section <xref depth="3" refnumber="49-19-201" start="0">49-19-201</xref>; or</subsection><subsection ssid="6-32" dnum="d-o" numlevel="1" lineno="396" slineno="4-65" level="2"><display>(d)</display>Section <xref depth="3" refnumber="49-22-201" start="0">49-22-201</xref> or <xref depth="3" refnumber="49-22-202" start="0">49-22-202</xref>.</subsection></subsection><subsection ssid="6-33" dnum="6-o" numlevel="1" lineno="397" slineno="4-66" level="1" space="false"><display>(6)</display><subsection ssid="6-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Regular full-time employee" means an employee:<subsection ssid="6-35" dnum="i-o" numlevel="1" lineno="398" slineno="4-67" level="3" tab="1"><display>(i)</display>whose term of employment for a participating employer contemplates continued <ln numlevel="1" lineno="399" slineno="4-68"/>employment during a fiscal or calendar year;</subsection><subsection ssid="6-36" dnum="ii-o" numlevel="1" lineno="400" slineno="4-69" level="3" tab="1"><display>(ii)</display>whose employment normally requires an average of 20 hours or more per week, <ln numlevel="1" lineno="401" slineno="4-70"/>except as modified by the board; and</subsection><subsection ssid="6-37" dnum="iii-o" numlevel="1" lineno="402" slineno="4-71" level="3" tab="1"><display>(iii)</display>who receives benefits normally provided by the participating employer.</subsection></subsection><subsection ssid="6-38" dnum="b-o" numlevel="1" lineno="403" slineno="4-72" level="2"><display>(b)</display>"Regular full-time employee" includes:<subsection ssid="6-39" dnum="i-o" numlevel="1" lineno="404" slineno="4-73" level="3"><display>(i)</display>a teacher whose term of employment for a participating employer contemplates <ln numlevel="1" lineno="405" slineno="4-74"/>continued employment during a school year and who teaches half time or more;</subsection><subsection ssid="6-40" dnum="ii-o" numlevel="1" lineno="406" slineno="4-75" level="3"><display>(ii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend>:<subsection ssid="6-41" dnum="A-o" numlevel="1" lineno="407" slineno="4-76" level="4"><display>(A)</display>who is hired before July 1, 2013; and</subsection><subsection ssid="6-42" dnum="B-o" numlevel="1" lineno="408" slineno="4-77" level="4"><display>(B)</display>whose employment normally requires an average of 20 hours per week or <ln numlevel="1" lineno="409" slineno="4-78"/>more for a participating employer, regardless of benefits provided;</subsection></subsection><subsection ssid="6-43" dnum="iii-o" numlevel="1" lineno="410" slineno="4-79" level="3"><display>(iii)</display>an appointive officer whose appointed position is full time as certified by the <ln numlevel="1" lineno="411" slineno="4-80"/>participating employer;</subsection><subsection ssid="6-44" dnum="iv-o" numlevel="1" lineno="412" slineno="4-81" level="3"><display>(iv)</display>the governor, the lieutenant governor, the state auditor, the state treasurer, the <ln numlevel="1" lineno="413" slineno="4-82"/>attorney general, and a state legislator;</subsection><subsection ssid="6-45" dnum="v-o" numlevel="1" lineno="414" slineno="4-83" level="3"><display>(v)</display>an elected official not included under Subsection <xref depth="4" refnumber="49-22-102(6)(b)(iv)" start="0">(6)(b)(iv)</xref> whose elected position <ln numlevel="1" lineno="415" slineno="4-84"/>is full time as certified by the participating employer;</subsection><subsection ssid="6-46" dnum="vi-o" numlevel="1" lineno="416" slineno="4-85" level="3"><display>(vi)</display>a faculty member or employee of an institution of higher education who is <ln numlevel="1" lineno="417" slineno="4-86"/>considered full time by that institution of higher education; and</subsection><subsection ssid="6-47" dnum="vii-o" numlevel="1" lineno="418" slineno="4-87" level="3"><display>(vii)</display>an individual who otherwise meets the definition of this Subsection <xref depth="4" refnumber="49-22-102(6)" start="0">(6)</xref> who <ln numlevel="1" lineno="419" slineno="4-88"/>performs services for a participating employer through a professional employer <ln numlevel="1" lineno="420" slineno="4-89"/>organization or similar arrangement.</subsection></subsection><subsection ssid="6-48" dnum="c-o" numlevel="1" lineno="421" slineno="4-90" level="2"><display>(c)</display>"Regular full-time employee" does not include:<subsection ssid="6-49" dnum="i-o" numlevel="1" lineno="422" slineno="4-91" level="3"><display>(i)</display>a firefighter service employee as defined in Section <xref depth="3" refnumber="49-23-102" start="0">49-23-102</xref>;</subsection><subsection ssid="6-50" dnum="ii-o" numlevel="1" lineno="423" slineno="4-92" level="3"><display>(ii)</display>a public safety service employee as defined in Section <xref depth="3" refnumber="49-23-102" start="0">49-23-102</xref>;</subsection><subsection ssid="6-51" dnum="iii-o" numlevel="1" lineno="424" slineno="4-93" level="3"><display>(iii)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend>:<subsection ssid="6-52" dnum="A-o" numlevel="1" lineno="425" slineno="4-94" level="4"><display>(A)</display>who is hired on or after July 1, 2013; and</subsection><subsection ssid="6-53" dnum="B-o" numlevel="1" lineno="426" slineno="4-95" level="4"><display>(B)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="427" slineno="4-96"/>employer even if the employment normally requires an average of 20 hours per <ln numlevel="1" lineno="428" slineno="4-97"/>week or more for a participating employer;</subsection></subsection><subsection ssid="6-54" dnum="iv-o" numlevel="1" lineno="429" slineno="4-98" level="3"><display>(iv)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend>:<subsection ssid="6-55" dnum="A-o" numlevel="1" lineno="430" slineno="4-99" level="4"><display>(A)</display>who is hired before July 1, 2013;</subsection><subsection ssid="6-56" dnum="B-o" numlevel="1" lineno="431" slineno="4-100" level="4"><display>(B)</display>who did not qualify as a regular full-time employee before July 1, 2013;</subsection><subsection ssid="6-57" dnum="C-o" numlevel="1" lineno="432" slineno="4-101" level="4"><display>(C)</display>who does not receive benefits normally provided by the participating <ln numlevel="1" lineno="433" slineno="4-102"/>employer; and</subsection><subsection ssid="6-58" dnum="D-o" numlevel="1" lineno="434" slineno="4-103" level="4"><display>(D)</display>whose employment hours are increased on or after July 1, 2013, to require an <ln numlevel="1" lineno="435" slineno="4-104"/>average of 20 hours per week or more for a participating employer; or</subsection><subsection ssid="6-59" dnum="E-o" numlevel="1" lineno="436" slineno="4-105" level="4"><display>(E)</display>who is a person working on a contract:<subsection ssid="6-60" dnum="I-o" numlevel="1" lineno="437" slineno="4-106" level="5"><display>(I)</display>for the purposes of vocational rehabilitation and the employment and <ln numlevel="1" lineno="438" slineno="4-107"/>training of people with significant disabilities; and</subsection><subsection ssid="6-61" dnum="II-o" numlevel="1" lineno="439" slineno="4-108" level="5"><display>(II)</display>that has been set aside from procurement requirements by the state <ln numlevel="1" lineno="440" slineno="4-109"/>pursuant to Section <xref depth="3" refnumber="63G-6a-805" start="0">63G-6a-805</xref> or the federal government pursuant to 41 <ln numlevel="1" lineno="441" slineno="4-110"/>U.S.C. Sec. 8501 et seq.</subsection></subsection></subsection></subsection></subsection><subsection ssid="6-62" dnum="7-o" numlevel="1" lineno="442" slineno="4-111" level="1"><display>(7)</display>"System" means the New Public Employees' Tier II Contributory Retirement System <ln numlevel="1" lineno="443" slineno="4-112"/>created under this chapter.</subsection><subsection ssid="6-63" dnum="8-o" numlevel="1" lineno="444" slineno="4-113" level="1"><display>(8)</display>"Years of service credit" means:<subsection ssid="6-64" dnum="a-o" numlevel="1" lineno="445" slineno="4-114" level="2"><display>(a)</display>a period consisting of 12 full months as determined by the board;</subsection><subsection ssid="6-65" dnum="b-o" numlevel="1" lineno="446" slineno="4-115" level="2"><display>(b)</display>a period determined by the board, whether consecutive or not, during which a regular <ln numlevel="1" lineno="447" slineno="4-116"/>full-time employee performed services for a participating employer, including any <ln numlevel="1" lineno="448" slineno="4-117"/>time the regular full-time employee was absent on a paid leave of absence granted by <ln numlevel="1" lineno="449" slineno="4-118"/>a participating employer or was absent in the service of the United States government <ln numlevel="1" lineno="450" slineno="4-119"/>on military duty as provided by this chapter; or</subsection><subsection ssid="6-66" dnum="c-o" numlevel="1" lineno="451" slineno="4-120" level="2"><display>(c)</display>the regular school year consisting of not less than eight months of full-time service <ln numlevel="1" lineno="452" slineno="4-121"/>for a regular full-time employee of an educational institution.</subsection></subsection></section></bsec><bsec buid="1" type="amend" src="code" num="53E-1-203" uid="C53E-1-S203_2025050720250507" sort="53E01 02030020250507" numlevel="1" lineno="453" slineno="5-1" sn="5"><section number="53E-1-203" numlevel="1" lineno="454" slineno="5-2" type="amend"><secline lineno="453">Section 5, Section <bold>53E-1-203</bold> is amended to read:</secline><catline lineno="454"><bold>53E-1-203. State Superintendent's Annual Report.</bold></catline><subsection ssid="1-1" dnum="1-o" numlevel="1" lineno="455" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>The state board shall prepare and submit to the governor, the Education Interim <ln numlevel="1" lineno="456" slineno="5-4"/>Committee, and the Public Education Appropriations Subcommittee, by January 15 of <ln numlevel="1" lineno="457" slineno="5-5"/>each year, an annual written report known as the State Superintendent's Annual Report <ln numlevel="1" lineno="458" slineno="5-6"/>that includes:<subsection ssid="1-2" dnum="a-o" numlevel="1" lineno="459" slineno="5-7" level="2"><display>(a)</display>the operations, activities, programs, and services of the state board;</subsection><subsection ssid="1-3" dnum="b-o" numlevel="1" lineno="460" slineno="5-8" level="2"><display>(b)</display>subject to Subsection (4)(b), all reports listed in Subsection (4)(a); and</subsection><subsection ssid="1-4" dnum="c-o" numlevel="1" lineno="461" slineno="5-9" level="2"><display>(c)</display>data on the general condition of the schools with recommendations considered <ln numlevel="1" lineno="462" slineno="5-10"/>desirable for specific programs, including:<subsection ssid="1-5" dnum="i-o" numlevel="1" lineno="463" slineno="5-11" level="3"><display>(i)</display>a complete statement of fund balances;</subsection><subsection ssid="1-6" dnum="ii-o" numlevel="1" lineno="464" slineno="5-12" level="3"><display>(ii)</display>a complete statement of revenues by fund and source;</subsection><subsection ssid="1-7" dnum="iii-o" numlevel="1" lineno="465" slineno="5-13" level="3"><display>(iii)</display>a complete statement of adjusted expenditures by fund, the status of bonded <ln numlevel="1" lineno="466" slineno="5-14"/>indebtedness, the cost of new school plants, and school levies;</subsection><subsection ssid="1-8" dnum="iv-o" numlevel="1" lineno="467" slineno="5-15" level="3"><display>(iv)</display>a complete statement of state funds allocated to each school district and charter <ln numlevel="1" lineno="468" slineno="5-16"/>school by source, including supplemental appropriations, and a complete <ln numlevel="1" lineno="469" slineno="5-17"/>statement of expenditures by each school district and charter school, including <ln numlevel="1" lineno="470" slineno="5-18"/>supplemental appropriations, by function and object as outlined in the United <ln numlevel="1" lineno="471" slineno="5-19"/>States Department of Education publication "Financial Accounting for Local and <ln numlevel="1" lineno="472" slineno="5-20"/>State School Systems";</subsection><subsection ssid="1-9" dnum="v-o" numlevel="1" lineno="473" slineno="5-21" level="3"><display>(v)</display>a statement that includes data on:<subsection ssid="1-10" dnum="A-o" numlevel="1" lineno="474" slineno="5-22" level="4"><display>(A)</display>fall enrollments;</subsection><subsection ssid="1-11" dnum="B-o" numlevel="1" lineno="475" slineno="5-23" level="4"><display>(B)</display>average membership;</subsection><subsection ssid="1-12" dnum="C-o" numlevel="1" lineno="476" slineno="5-24" level="4"><display>(C)</display>high school graduates;</subsection><subsection ssid="1-13" dnum="D-o" numlevel="1" lineno="477" slineno="5-25" level="4"><display>(D)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">licensed and classified employees</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">all employees</amend>, including data reported by <ln numlevel="1" lineno="478" slineno="5-26"/>school districts on educator ratings described in Section <xref depth="3" refnumber="53G-11-511">53G-11-511</xref>;</subsection><subsection ssid="1-14" dnum="E-o" numlevel="1" lineno="479" slineno="5-27" level="4"><display>(E)</display>pupil-teacher ratios;</subsection><subsection ssid="1-15" dnum="F-o" numlevel="1" lineno="480" slineno="5-28" level="4"><display>(F)</display>average class sizes;</subsection><subsection ssid="1-16" dnum="G-o" numlevel="1" lineno="481" slineno="5-29" level="4"><display>(G)</display>average salaries;</subsection><subsection ssid="1-17" dnum="H-o" numlevel="1" lineno="482" slineno="5-30" level="4"><display>(H)</display>applicable private school data; and</subsection><subsection ssid="1-18" dnum="I-o" numlevel="1" lineno="483" slineno="5-31" level="4"><display>(I)</display>data from statewide assessments described in Section <xref depth="3" refnumber="53E-4-301">53E-4-301</xref> for each <ln numlevel="1" lineno="484" slineno="5-32"/>school and school district;</subsection></subsection><subsection ssid="1-19" dnum="vi-o" numlevel="1" lineno="485" slineno="5-33" level="3"><display>(vi)</display>statistical information for each school district and charter school regarding:<subsection ssid="1-20" dnum="A-o" numlevel="1" lineno="486" slineno="5-34" level="4"><display>(A)</display>student attendance by grade level;</subsection><subsection ssid="1-21" dnum="B-o" numlevel="1" lineno="487" slineno="5-35" level="4"><display>(B)</display>the percentage of students chronically absent;</subsection><subsection ssid="1-22" dnum="C-o" numlevel="1" lineno="488" slineno="5-36" level="4"><display>(C)</display>the percentage of student excused absences; and</subsection><subsection ssid="1-23" dnum="D-o" numlevel="1" lineno="489" slineno="5-37" level="4"><display>(D)</display>the percentage of student unexcused absences;</subsection></subsection><subsection ssid="1-24" dnum="vii-o" numlevel="1" lineno="490" slineno="5-38" level="3"><display>(vii)</display>statistical information regarding incidents of delinquent activity in the schools, <ln numlevel="1" lineno="491" slineno="5-39"/>at school-related activities, on school buses, and at school bus stops; and</subsection><subsection ssid="1-25" dnum="viii-o" numlevel="1" lineno="492" slineno="5-40" level="3"><display>(viii)</display>other statistical and financial information about the school system that the state <ln numlevel="1" lineno="493" slineno="5-41"/>superintendent considers pertinent.</subsection></subsection></subsection><subsection ssid="1-26" dnum="2-o" numlevel="1" lineno="494" slineno="5-42" level="1" space="false"><display>(2)</display><subsection ssid="1-27" dnum="a-o" level="2" placement="sameline"><display>(a)</display>For the purposes of Subsection (1)(c)(v):<subsection ssid="1-28" dnum="i-o" numlevel="1" lineno="495" slineno="5-43" level="3" tab="1"><display>(i)</display>the pupil-teacher ratio for a school shall be calculated by dividing the number of <ln numlevel="1" lineno="496" slineno="5-44"/>students enrolled in a school by the number of full-time equivalent teachers <ln numlevel="1" lineno="497" slineno="5-45"/>assigned to the school, including regular classroom teachers, school-based <ln numlevel="1" lineno="498" slineno="5-46"/>specialists, and special education teachers;</subsection><subsection ssid="1-29" dnum="ii-o" numlevel="1" lineno="499" slineno="5-47" level="3" tab="1"><display>(ii)</display>the pupil-teacher ratio for a school district shall be the median pupil-teacher ratio <ln numlevel="1" lineno="500" slineno="5-48"/>of the schools within a school district;</subsection><subsection ssid="1-30" dnum="iii-o" numlevel="1" lineno="501" slineno="5-49" level="3" tab="1"><display>(iii)</display>the pupil-teacher ratio for charter schools aggregated shall be the median <ln numlevel="1" lineno="502" slineno="5-50"/>pupil-teacher ratio of charter schools in the state; and</subsection><subsection ssid="1-31" dnum="iv-o" numlevel="1" lineno="503" slineno="5-51" level="3" tab="1"><display>(iv)</display>the pupil-teacher ratio for the state's public schools aggregated shall be the <ln numlevel="1" lineno="504" slineno="5-52"/>median pupil-teacher ratio of public schools in the state.</subsection></subsection><subsection ssid="1-32" dnum="b-o" numlevel="1" lineno="505" slineno="5-53" level="2"><display>(b)</display>The report shall:<subsection ssid="1-33" dnum="i-o" numlevel="1" lineno="506" slineno="5-54" level="3"><display>(i)</display>include the pupil-teacher ratio for:<subsection ssid="1-34" dnum="A-o" numlevel="1" lineno="507" slineno="5-55" level="4"><display>(A)</display>each school district;</subsection><subsection ssid="1-35" dnum="B-o" numlevel="1" lineno="508" slineno="5-56" level="4"><display>(B)</display>the charter schools aggregated; and</subsection><subsection ssid="1-36" dnum="C-o" numlevel="1" lineno="509" slineno="5-57" level="4"><display>(C)</display>the state's public schools aggregated; and</subsection></subsection><subsection ssid="1-37" dnum="ii-o" numlevel="1" lineno="510" slineno="5-58" level="3"><display>(ii)</display>identify a website where pupil-teacher ratios for each school in the state may be <ln numlevel="1" lineno="511" slineno="5-59"/>accessed.</subsection></subsection></subsection><subsection ssid="1-38" dnum="3-o" numlevel="1" lineno="512" slineno="5-60" level="1"><display>(3)</display>For each operation, activity, program, or service provided by the state board, the annual <ln numlevel="1" lineno="513" slineno="5-61"/>report shall include:<subsection ssid="1-39" dnum="a-o" numlevel="1" lineno="514" slineno="5-62" level="2"><display>(a)</display>a description of the operation, activity, program, or service;</subsection><subsection ssid="1-40" dnum="b-o" numlevel="1" lineno="515" slineno="5-63" level="2"><display>(b)</display>data and metrics:<subsection ssid="1-41" dnum="i-o" numlevel="1" lineno="516" slineno="5-64" level="3"><display>(i)</display>selected and used by the state board to measure progress, performance, <ln numlevel="1" lineno="517" slineno="5-65"/>effectiveness, and scope of the operation, activity, program, or service, including <ln numlevel="1" lineno="518" slineno="5-66"/>summary data; and</subsection><subsection ssid="1-42" dnum="ii-o" numlevel="1" lineno="519" slineno="5-67" level="3"><display>(ii)</display>that are consistent and comparable for each state operation, activity, program, or <ln numlevel="1" lineno="520" slineno="5-68"/>service;</subsection></subsection><subsection ssid="1-43" dnum="c-o" numlevel="1" lineno="521" slineno="5-69" level="2"><display>(c)</display>budget data, including the amount and source of funding, expenses, and allocation of <ln numlevel="1" lineno="522" slineno="5-70"/>full-time employees for the operation, activity, program, or service;</subsection><subsection ssid="1-44" dnum="d-o" numlevel="1" lineno="523" slineno="5-71" level="2"><display>(d)</display>historical data from previous years for comparison with data reported under <ln numlevel="1" lineno="524" slineno="5-72"/>Subsections (3)(b) and (c);</subsection><subsection ssid="1-45" dnum="e-o" numlevel="1" lineno="525" slineno="5-73" level="2"><display>(e)</display>goals, challenges, and achievements related to the operation, activity, program, or <ln numlevel="1" lineno="526" slineno="5-74"/>service;</subsection><subsection ssid="1-46" dnum="f-o" numlevel="1" lineno="527" slineno="5-75" level="2"><display>(f)</display>relevant federal and state statutory references and requirements;</subsection><subsection ssid="1-47" dnum="g-o" numlevel="1" lineno="528" slineno="5-76" level="2"><display>(g)</display>contact information of officials knowledgeable and responsible for each operation, <ln numlevel="1" lineno="529" slineno="5-77"/>activity, program, or service; and</subsection><subsection ssid="1-48" dnum="h-o" numlevel="1" lineno="530" slineno="5-78" level="2"><display>(h)</display>other information determined by the state board that:<subsection ssid="1-49" dnum="i-o" numlevel="1" lineno="531" slineno="5-79" level="3"><display>(i)</display>may be needed, useful, or of historical significance; or</subsection><subsection ssid="1-50" dnum="ii-o" numlevel="1" lineno="532" slineno="5-80" level="3"><display>(ii)</display>promotes accountability and transparency for each operation, activity, program, <ln numlevel="1" lineno="533" slineno="5-81"/>or service with the public and elected officials.</subsection></subsection></subsection><subsection ssid="1-51" dnum="4-o" numlevel="1" lineno="534" slineno="5-82" level="1" space="false"><display>(4)</display><subsection ssid="1-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection (4)(b), the annual report shall also include:<subsection ssid="1-53" dnum="i-o" numlevel="1" lineno="535" slineno="5-83" level="3" tab="1"><display>(i)</display>the report described in Section <xref depth="3" refnumber="53E-3-507">53E-3-507</xref> by the state board on career and <ln numlevel="1" lineno="536" slineno="5-84"/>technical education needs and program access;</subsection><subsection ssid="1-54" dnum="ii-o" numlevel="1" lineno="537" slineno="5-85" level="3" tab="1"><display>(ii)</display>the report described in Section <xref depth="3" refnumber="53E-3-515">53E-3-515</xref> by the state board on the Hospitality <ln numlevel="1" lineno="538" slineno="5-86"/>and Tourism Management Career and Technical Education Pilot Program;</subsection><subsection ssid="1-55" dnum="iii-o" numlevel="1" lineno="539" slineno="5-87" level="3" tab="1"><display>(iii)</display>the report described in Section <xref depth="3" refnumber="53E-3-516">53E-3-516</xref> by the state board on certain incidents <ln numlevel="1" lineno="540" slineno="5-88"/>that occur on school grounds;</subsection><subsection ssid="1-56" dnum="iv-o" numlevel="1" lineno="541" slineno="5-89" level="3" tab="1"><display>(iv)</display>the report described in Section <xref depth="3" refnumber="53E-4-202">53E-4-202</xref> by the state board on the development <ln numlevel="1" lineno="542" slineno="5-90"/>and implementation of the core standards for Utah public schools;</subsection><subsection ssid="1-57" dnum="v-o" numlevel="1" lineno="543" slineno="5-91" level="3" tab="1"><display>(v)</display>the report described in Section <xref depth="3" refnumber="53E-5-310">53E-5-310</xref> by the state board on school turnaround <ln numlevel="1" lineno="544" slineno="5-92"/>and leadership development;</subsection><subsection ssid="1-58" dnum="vi-o" numlevel="1" lineno="545" slineno="5-93" level="3" tab="1"><display>(vi)</display>the report described in Section <xref depth="3" refnumber="53E-10-308">53E-10-308</xref> by the state board and Utah Board of <ln numlevel="1" lineno="546" slineno="5-94"/>Higher Education on student participation in the concurrent enrollment program;</subsection><subsection ssid="1-59" dnum="vii-o" numlevel="1" lineno="547" slineno="5-95" level="3" tab="1"><display>(vii)</display>the report described in Section <xref depth="3" refnumber="53F-5-506">53F-5-506</xref> by the state board on information <ln numlevel="1" lineno="548" slineno="5-96"/>related to personalized, competency-based learning; and</subsection><subsection ssid="1-60" dnum="viii-o" numlevel="1" lineno="549" slineno="5-97" level="3" tab="1"><display>(viii)</display>the report described in Section <xref depth="3" refnumber="53G-9-802">53G-9-802</xref> by the state board on dropout <ln numlevel="1" lineno="550" slineno="5-98"/>prevention and recovery services.</subsection></subsection><subsection ssid="1-61" dnum="b-o" numlevel="1" lineno="551" slineno="5-99" level="2"><display>(b)</display>The Education Interim Committee or the Public Education Appropriations <ln numlevel="1" lineno="552" slineno="5-100"/>Subcommittee may request a report described in Subsection (4)(a) to be reported <ln numlevel="1" lineno="553" slineno="5-101"/>separately from the State Superintendent's Annual Report.</subsection></subsection><subsection ssid="1-62" dnum="5-o" numlevel="1" lineno="554" slineno="5-102" level="1"><display>(5)</display>The annual report shall be designed to provide clear, accurate, and accessible <ln numlevel="1" lineno="555" slineno="5-103"/>information to the public, the governor, and the Legislature.</subsection><subsection ssid="1-63" dnum="6-o" numlevel="1" lineno="556" slineno="5-104" level="1"><display>(6)</display>The state board shall:<subsection ssid="1-64" dnum="a-o" numlevel="1" lineno="557" slineno="5-105" level="2"><display>(a)</display>submit the annual report in accordance with Section <xref depth="3" refnumber="68-3-14">68-3-14</xref>; and</subsection><subsection ssid="1-65" dnum="b-o" numlevel="1" lineno="558" slineno="5-106" level="2"><display>(b)</display>make the annual report, and previous annual reports, accessible to the public by <ln numlevel="1" lineno="559" slineno="5-107"/>placing a link to the reports on the state board's website.</subsection></subsection><subsection ssid="1-66" dnum="7-o" numlevel="1" lineno="560" slineno="5-108" level="1" space="false"><display>(7)</display><subsection ssid="1-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon request of the Education Interim Committee or Public Education <ln numlevel="1" lineno="561" slineno="5-109"/>Appropriations Subcommittee, the state board shall present the State Superintendent's <ln numlevel="1" lineno="562" slineno="5-110"/>Annual Report to either committee.</subsection><subsection ssid="1-68" dnum="b-o" numlevel="1" lineno="563" slineno="5-111" level="2"><display>(b)</display>After submitting the State Superintendent's Annual Report in accordance with this <ln numlevel="1" lineno="564" slineno="5-112"/>section, the state board may supplement the report at a later time with updated data, <ln numlevel="1" lineno="565" slineno="5-113"/>information, or other materials as necessary or upon request by the governor, the <ln numlevel="1" lineno="566" slineno="5-114"/>Education Interim Committee, or the Public Education Appropriations Subcommittee.</subsection></subsection></section></bsec><bsec buid="3" type="amend" src="code" num="53G-10-402" uid="C53G-10-S402_2025050720250507" sort="53G10 04020020250507" style="" numlevel="1" lineno="567" slineno="6-1" sn="6"><section number="53G-10-402" numlevel="1" lineno="568" slineno="6-2" type="amend"><secline lineno="567">Section 6, Section <bold>53G-10-402</bold> is amended to read:</secline><catline lineno="568"><bold>53G-10-402. Instruction in health -- Parental consent requirements -- Conduct <ln numlevel="1" lineno="569" slineno="6-3"/>and speech of school employees and volunteers -- Political and religious doctrine <ln numlevel="1" lineno="570" slineno="6-4"/>prohibited. </bold></catline><subsection ssid="3-1" dnum="1-o" numlevel="1" lineno="571" slineno="6-5" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-2" dnum="a-o" numlevel="1" lineno="572" slineno="6-6" level="2"><display>(a)</display>"LEA governing board" means a local school board or charter school governing <ln numlevel="1" lineno="573" slineno="6-7"/>board.</subsection><subsection ssid="3-3" dnum="b-o" numlevel="1" lineno="574" slineno="6-8" level="2"><display>(b)</display>"Refusal skills" means instruction:<subsection ssid="3-4" dnum="i-o" numlevel="1" lineno="575" slineno="6-9" level="3"><display>(i)</display>in a student's ability to clearly and expressly refuse sexual advances by a minor or <ln numlevel="1" lineno="576" slineno="6-10"/>adult;</subsection><subsection ssid="3-5" dnum="ii-o" numlevel="1" lineno="577" slineno="6-11" level="3"><display>(ii)</display>in a student's obligation to stop the student's sexual advances if refused by another <ln numlevel="1" lineno="578" slineno="6-12"/>individual;</subsection><subsection ssid="3-6" dnum="iii-o" numlevel="1" lineno="579" slineno="6-13" level="3"><display>(iii)</display>informing a student of the student's right to report and seek counseling for <ln numlevel="1" lineno="580" slineno="6-14"/>unwanted sexual advances;</subsection><subsection ssid="3-7" dnum="iv-o" numlevel="1" lineno="581" slineno="6-15" level="3"><display>(iv)</display>in sexual harassment; and</subsection><subsection ssid="3-8" dnum="v-o" numlevel="1" lineno="582" slineno="6-16" level="3"><display>(v)</display>informing a student that a student may not consent to criminally prohibited <ln numlevel="1" lineno="583" slineno="6-17"/>activities or activities for which the student is legally prohibited from giving <ln numlevel="1" lineno="584" slineno="6-18"/>consent, including the electronic transmission of sexually explicit images by an <ln numlevel="1" lineno="585" slineno="6-19"/>individual of the individual or another.</subsection></subsection></subsection><subsection ssid="3-9" dnum="2-o" numlevel="1" lineno="586" slineno="6-20" level="1" space="false"><display>(2)</display><subsection ssid="3-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall establish curriculum requirements under Section <xref depth="3" refnumber="53E-3-501">53E-3-501</xref><ln numlevel="1" lineno="587" slineno="6-21"/> that include instruction in:<subsection ssid="3-11" dnum="i-o" numlevel="1" lineno="588" slineno="6-22" level="3" tab="1"><display>(i)</display>community and personal health;</subsection><subsection ssid="3-12" dnum="ii-o" numlevel="1" lineno="589" slineno="6-23" level="3" tab="1"><display>(ii)</display>physiology;</subsection><subsection ssid="3-13" dnum="iii-o" numlevel="1" lineno="590" slineno="6-24" level="3" tab="1"><display>(iii)</display>personal hygiene;</subsection><subsection ssid="3-14" dnum="iv-o" numlevel="1" lineno="591" slineno="6-25" level="3" tab="1"><display>(iv)</display>prevention of communicable disease;</subsection><subsection ssid="3-15" dnum="v-o" numlevel="1" lineno="592" slineno="6-26" level="3" tab="1"><display>(v)</display>refusal skills; and</subsection><subsection ssid="3-16" dnum="vi-o" numlevel="1" lineno="593" slineno="6-27" level="3" tab="1"><display>(vi)</display>the harmful effects of pornography.</subsection></subsection><subsection ssid="3-17" dnum="b-o" numlevel="1" lineno="594" slineno="6-28" level="2"><display>(b)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="595" slineno="6-29"/>state board shall make rules that, and instruction shall:<subsection ssid="3-18" dnum="i-o" numlevel="1" lineno="596" slineno="6-30" level="3"><display>(i)</display>stress the importance of abstinence from all sexual activity before marriage and <ln numlevel="1" lineno="597" slineno="6-31"/>fidelity after marriage as methods for preventing certain communicable diseases;</subsection><subsection ssid="3-19" dnum="ii-o" numlevel="1" lineno="598" slineno="6-32" level="3"><display>(ii)</display>stress personal skills that encourage individual choice of abstinence and fidelity;</subsection><subsection ssid="3-20" dnum="iii-o" numlevel="1" lineno="599" slineno="6-33" level="3"><display>(iii)</display>prohibit instruction in:<subsection ssid="3-21" dnum="A-o" numlevel="1" lineno="600" slineno="6-34" level="4"><display>(A)</display>the intricacies of intercourse, sexual stimulation, or erotic behavior;</subsection><subsection ssid="3-22" dnum="B-o" numlevel="1" lineno="601" slineno="6-35" level="4"><display>(B)</display>the advocacy of premarital or extramarital sexual activity; or</subsection><subsection ssid="3-23" dnum="C-o" numlevel="1" lineno="602" slineno="6-36" level="4"><display>(C)</display>the advocacy or encouragement of the use of contraceptive methods or <ln numlevel="1" lineno="603" slineno="6-37"/>devices; and</subsection></subsection><subsection ssid="3-24" dnum="iv-o" numlevel="1" lineno="604" slineno="6-38" level="3"><display>(iv)</display>except as provided in Subsection (2)(d), allow instruction to include information <ln numlevel="1" lineno="605" slineno="6-39"/>about contraceptive methods or devices that stresses effectiveness, limitations, <ln numlevel="1" lineno="606" slineno="6-40"/>risks, and information on state law applicable to minors obtaining contraceptive <ln numlevel="1" lineno="607" slineno="6-41"/>methods or devices.</subsection></subsection><subsection ssid="3-25" dnum="c-o" numlevel="1" lineno="608" slineno="6-42" level="2"><display>(c)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="609" slineno="6-43"/>state board shall make rules for an LEA governing board that adopts instructional <ln numlevel="1" lineno="610" slineno="6-44"/>materials under Subsection (2)(g)(ii) that:<subsection ssid="3-26" dnum="i-o" numlevel="1" lineno="611" slineno="6-45" level="3"><display>(i)</display>require the LEA governing board to report on the materials selected and the LEA <ln numlevel="1" lineno="612" slineno="6-46"/>governing board's compliance with Subsection (2)(h); and</subsection><subsection ssid="3-27" dnum="ii-o" numlevel="1" lineno="613" slineno="6-47" level="3"><display>(ii)</display>provide for an appeal and review process of the LEA governing board's adoption <ln numlevel="1" lineno="614" slineno="6-48"/>of instructional materials.</subsection></subsection><subsection ssid="3-28" dnum="d-o" numlevel="1" lineno="615" slineno="6-49" level="2"><display>(d)</display>The state board may not require an LEA to teach or adopt instructional materials that <ln numlevel="1" lineno="616" slineno="6-50"/>include information on contraceptive methods or devices.</subsection><subsection ssid="3-29" dnum="e-o" numlevel="1" lineno="617" slineno="6-51" level="2" space="false"><display>(e)</display><subsection ssid="3-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>At no time may instruction be provided, including responses to spontaneous <ln numlevel="1" lineno="618" slineno="6-52"/>questions raised by students, regarding any means or methods that facilitate or <ln numlevel="1" lineno="619" slineno="6-53"/>encourage the violation of any state or federal criminal law by a minor or an adult.</subsection><subsection ssid="3-31" dnum="ii-o" numlevel="1" lineno="620" slineno="6-54" level="3"><display>(ii)</display>Subsection (2)(e)(i) does not preclude an instructor from responding to a <ln numlevel="1" lineno="621" slineno="6-55"/>spontaneous question as long as the response is consistent with the provisions of <ln numlevel="1" lineno="622" slineno="6-56"/>this section.</subsection></subsection><subsection ssid="3-32" dnum="f-o" numlevel="1" lineno="623" slineno="6-57" level="2"><display>(f)</display>The state board shall recommend instructional materials for use in the curricula <ln numlevel="1" lineno="624" slineno="6-58"/>required under Subsection (2)(a).</subsection><subsection ssid="3-33" dnum="g-o" numlevel="1" lineno="625" slineno="6-59" level="2"><display>(g)</display>An LEA governing board may choose to adopt:<subsection ssid="3-34" dnum="i-o" numlevel="1" lineno="626" slineno="6-60" level="3"><display>(i)</display>the instructional materials recommended under Subsection (2)(f); or</subsection><subsection ssid="3-35" dnum="ii-o" numlevel="1" lineno="627" slineno="6-61" level="3"><display>(ii)</display>other instructional materials in accordance with Subsection (2)(h).</subsection></subsection><subsection ssid="3-36" dnum="h-o" numlevel="1" lineno="628" slineno="6-62" level="2"><display>(h)</display>An LEA governing board that adopts instructional materials under Subsection <ln numlevel="1" lineno="629" slineno="6-63"/>(2)(g)(ii) shall:<subsection ssid="3-37" dnum="i-o" numlevel="1" lineno="630" slineno="6-64" level="3"><display>(i)</display>ensure that the materials comply with state law and board rules;</subsection><subsection ssid="3-38" dnum="ii-o" numlevel="1" lineno="631" slineno="6-65" level="3"><display>(ii)</display>base the adoption of the materials on the recommendations of the LEA governing <ln numlevel="1" lineno="632" slineno="6-66"/>board's Curriculum Materials Review Committee; </subsection><subsection ssid="3-39" dnum="iii-o" numlevel="1" lineno="633" slineno="6-67" level="3"><display>(iii)</display>adopt the instructional materials in an open and regular meeting of the LEA <ln numlevel="1" lineno="634" slineno="6-68"/>governing board for which prior notice is given to parents of students who attend <ln numlevel="1" lineno="635" slineno="6-69"/>the respective schools; and </subsection><subsection ssid="3-40" dnum="iv-o" numlevel="1" lineno="636" slineno="6-70" level="3"><display>(iv)</display>give parents an opportunity to express the parents' views and opinions on the <ln numlevel="1" lineno="637" slineno="6-71"/>materials at the meeting described in Subsection (2)(h)(iii).</subsection></subsection></subsection><subsection ssid="3-41" dnum="3-o" numlevel="1" lineno="638" slineno="6-72" level="1" space="false"><display>(3)</display><subsection ssid="3-42" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A student shall receive instruction in the courses described in Subsection (2) on at <ln numlevel="1" lineno="639" slineno="6-73"/>least two occasions during the period that begins with the beginning of grade 8 and <ln numlevel="1" lineno="640" slineno="6-74"/>the end of grade 12.</subsection><subsection ssid="3-43" dnum="b-o" numlevel="1" lineno="641" slineno="6-75" level="2"><display>(b)</display>At the request of the state board, the Department of Health and Human Services shall <ln numlevel="1" lineno="642" slineno="6-76"/>cooperate with the state board in developing programs to provide instruction in those <ln numlevel="1" lineno="643" slineno="6-77"/>areas.</subsection></subsection><subsection ssid="3-44" dnum="4-o" numlevel="1" lineno="644" slineno="6-78" level="1" space="false"><display>(4)</display><subsection ssid="3-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall adopt rules that:<subsection ssid="3-46" dnum="i-o" numlevel="1" lineno="645" slineno="6-79" level="3" tab="1"><display>(i)</display>provide that the parental consent requirements of Sections <xref depth="3" refnumber="76-7-322">76-7-322</xref> and <xref depth="3" refnumber="76-7-323">76-7-323</xref><ln numlevel="1" lineno="646" slineno="6-80"/> are complied with; and</subsection><subsection ssid="3-47" dnum="ii-o" numlevel="1" lineno="647" slineno="6-81" level="3" tab="1"><display>(ii)</display>require a student's parent to be notified in advance and have an opportunity to <ln numlevel="1" lineno="648" slineno="6-82"/>review the information for which parental consent is required under Sections <xref depth="3" refnumber="76-7-322"><ln numlevel="1" lineno="649" slineno="6-83"/>76-7-322</xref> and <xref depth="3" refnumber="76-7-323">76-7-323</xref>.</subsection></subsection><subsection ssid="3-48" dnum="b-o" numlevel="1" lineno="650" slineno="6-84" level="2"><display>(b)</display>The state board shall also provide procedures for disciplinary action for violation of <ln numlevel="1" lineno="651" slineno="6-85"/>Section <xref depth="3" refnumber="76-7-322">76-7-322</xref> or <xref depth="3" refnumber="76-7-323">76-7-323</xref>.</subsection></subsection><subsection ssid="3-49" dnum="5-o" numlevel="1" lineno="652" slineno="6-86" level="1" space="false"><display>(5)</display><subsection ssid="3-50" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In keeping with the requirements of Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>, and because school <ln numlevel="1" lineno="653" slineno="6-87"/>employees and volunteers serve as examples to students, school employees or <ln numlevel="1" lineno="654" slineno="6-88"/>volunteers acting in an official capacity may not support or encourage criminal <ln numlevel="1" lineno="655" slineno="6-89"/>conduct by students, teachers, or volunteers.</subsection><subsection ssid="3-51" dnum="b-o" numlevel="1" lineno="656" slineno="6-90" level="2"><display>(b)</display>To ensure the effective performance of school personnel, the limitations described in <ln numlevel="1" lineno="657" slineno="6-91"/>Subsection (5)(a) also apply to a school employee or volunteer acting outside of the <ln numlevel="1" lineno="658" slineno="6-92"/>school employee's or volunteer's official capacity if:<subsection ssid="3-52" dnum="i-o" numlevel="1" lineno="659" slineno="6-93" level="3"><display>(i)</display>the employee or volunteer knew or should have known that the employee's or <ln numlevel="1" lineno="660" slineno="6-94"/>volunteer's action could result in a material and substantial interference or <ln numlevel="1" lineno="661" slineno="6-95"/>disruption in the normal activities of the school; and</subsection><subsection ssid="3-53" dnum="ii-o" numlevel="1" lineno="662" slineno="6-96" level="3"><display>(ii)</display>that action does result in a material and substantial interference or disruption in <ln numlevel="1" lineno="663" slineno="6-97"/>the normal activities of the school.</subsection></subsection><subsection ssid="3-54" dnum="c-o" numlevel="1" lineno="664" slineno="6-98" level="2"><display>(c)</display>The state board or an LEA governing board may not allow training of school <ln numlevel="1" lineno="665" slineno="6-99"/>employees or volunteers that support or encourage criminal conduct.</subsection><subsection ssid="3-55" dnum="d-o" numlevel="1" lineno="666" slineno="6-100" level="2"><display>(d)</display>The state board shall adopt, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="667" slineno="6-101"/>Administrative Rulemaking Act, rules implementing this section.</subsection><subsection ssid="3-56" dnum="e-o" numlevel="1" lineno="668" slineno="6-102" level="2"><display>(e)</display>Nothing in this section limits the ability or authority of the state board or an LEA <ln numlevel="1" lineno="669" slineno="6-103"/>governing board to enact and enforce rules or take actions that are otherwise lawful, <ln numlevel="1" lineno="670" slineno="6-104"/>regarding an educator's, employee's, or volunteer's qualifications or behavior <ln numlevel="1" lineno="671" slineno="6-105"/>evidencing unfitness for duty.</subsection></subsection><subsection ssid="3-57" dnum="6-o" numlevel="1" lineno="672" slineno="6-106" level="1"><display>(6)</display>Except as provided in Section <xref depth="3" refnumber="53G-10-202">53G-10-202</xref>, political, atheistic, sectarian, religious, or <ln numlevel="1" lineno="673" slineno="6-107"/>denominational doctrine may not be taught in the public schools.</subsection><subsection ssid="3-58" dnum="7-o" numlevel="1" lineno="674" slineno="6-108" level="1" space="false"><display>(7)</display><subsection ssid="3-59" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An LEA governing board and an LEA governing board's employees shall <ln numlevel="1" lineno="675" slineno="6-109"/>cooperate and share responsibility in carrying out the purposes of this chapter.</subsection><subsection ssid="3-60" dnum="b-o" numlevel="1" lineno="676" slineno="6-110" level="2"><display>(b)</display>An LEA governing board shall provide appropriate professional development for the <ln numlevel="1" lineno="677" slineno="6-111"/>LEA governing board's teachers, counselors, and school administrators to enable the <ln numlevel="1" lineno="678" slineno="6-112"/>teachers, counselors, and school administrators to understand, protect, and properly <ln numlevel="1" lineno="679" slineno="6-113"/>instruct students in the values and character traits referred to in this section and <ln numlevel="1" lineno="680" slineno="6-114"/>Sections <xref depth="3" refnumber="53E-9-202">53E-9-202</xref>, <xref depth="3" refnumber="53E-9-203">53E-9-203</xref>, <xref depth="3" refnumber="53G-10-202">53G-10-202</xref>, <xref depth="3" refnumber="53G-10-203">53G-10-203</xref>, <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>, and <xref depth="3" refnumber="53G-10-205"><ln numlevel="1" lineno="681" slineno="6-115"/>53G-10-205</xref>, and distribute appropriate written materials on the values, character <ln numlevel="1" lineno="682" slineno="6-116"/>traits, and conduct to each individual receiving the professional development.</subsection><subsection ssid="3-61" dnum="c-o" numlevel="1" lineno="683" slineno="6-117" level="2"><display>(c)</display>An LEA governing board shall make the written materials described in Subsection <ln numlevel="1" lineno="684" slineno="6-118"/>(7)(b) available to <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="2" style="2" owner="jchristopherson" level="1" deltag="both">classified employees</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">education support professionals</amend>, students, <ln numlevel="1" lineno="685" slineno="6-119"/>and students' parents.</subsection><subsection ssid="3-62" dnum="d-o" numlevel="1" lineno="686" slineno="6-120" level="2"><display>(d)</display>In order to assist an LEA governing board in providing the professional development <ln numlevel="1" lineno="687" slineno="6-121"/>required under Subsection (7)(b), the state board shall, as appropriate, contract with a <ln numlevel="1" lineno="688" slineno="6-122"/>qualified individual or entity possessing expertise in the areas referred to in <ln numlevel="1" lineno="689" slineno="6-123"/>Subsection (7)(b) to develop and disseminate model teacher professional <ln numlevel="1" lineno="690" slineno="6-124"/>development programs that an LEA governing board may use to train the individuals <ln numlevel="1" lineno="691" slineno="6-125"/>referred to in Subsection (7)(b) to effectively teach the values and qualities of <ln numlevel="1" lineno="692" slineno="6-126"/>character referenced in Subsection (7)(b).</subsection><subsection ssid="3-63" dnum="e-o" numlevel="1" lineno="693" slineno="6-127" level="2"><display>(e)</display>In accordance with the provisions of Subsection (5)(c), professional development <ln numlevel="1" lineno="694" slineno="6-128"/>may not support or encourage criminal conduct.</subsection></subsection><subsection ssid="3-64" dnum="8-o" numlevel="1" lineno="695" slineno="6-129" level="1"><display>(8)</display>An LEA governing board shall review every two years:<subsection ssid="3-65" dnum="a-o" numlevel="1" lineno="696" slineno="6-130" level="2"><display>(a)</display>LEA governing board policies on instruction described in this section;</subsection><subsection ssid="3-66" dnum="b-o" numlevel="1" lineno="697" slineno="6-131" level="2"><display>(b)</display>for a local school board, data for each county that the school district is located in, or, <ln numlevel="1" lineno="698" slineno="6-132"/>for a charter school governing board, data for the county in which the charter school <ln numlevel="1" lineno="699" slineno="6-133"/>is located, on the following:<subsection ssid="3-67" dnum="i-o" numlevel="1" lineno="700" slineno="6-134" level="3"><display>(i)</display>teen pregnancy;</subsection><subsection ssid="3-68" dnum="ii-o" numlevel="1" lineno="701" slineno="6-135" level="3"><display>(ii)</display>child sexual abuse; and</subsection><subsection ssid="3-69" dnum="iii-o" numlevel="1" lineno="702" slineno="6-136" level="3"><display>(iii)</display>sexually transmitted diseases and sexually transmitted infections; and</subsection></subsection><subsection ssid="3-70" dnum="c-o" numlevel="1" lineno="703" slineno="6-137" level="2"><display>(c)</display>the number of pornography complaints or other instances reported within the <ln numlevel="1" lineno="704" slineno="6-138"/>jurisdiction of the LEA governing board.</subsection></subsection><subsection ssid="3-71" dnum="9-o" numlevel="1" lineno="705" slineno="6-139" level="1"><display>(9)</display>If any one or more provision, subsection, sentence, clause, phrase, or word of this <ln numlevel="1" lineno="706" slineno="6-140"/>section, or the application thereof to any person or circumstance, is found to be <ln numlevel="1" lineno="707" slineno="6-141"/>unconstitutional, the balance of this section shall be given effect without the invalid <ln numlevel="1" lineno="708" slineno="6-142"/>provision, subsection, sentence, clause, phrase, or word.</subsection></section></bsec><bsec buid="4" type="amend" src="code" num="53G-11-205" uid="C53G-11-S205_2025050720250507" sort="53G11 02050020250507" numlevel="1" lineno="709" slineno="7-1" sn="7"><section number="53G-11-205" numlevel="1" lineno="710" slineno="7-2" type="amend"><secline lineno="709">Section 7, Section <bold>53G-11-205</bold> is amended to read:</secline><catline lineno="710"><bold>53G-11-205. Education employee associations -- Equal participation -- <ln numlevel="1" lineno="711" slineno="7-3"/>Prohibition on endorsement or preferential treatment -- Naming of school breaks.</bold></catline><subsection ssid="4-1" dnum="1-o" numlevel="1" lineno="712" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="4-2" dnum="a-o" numlevel="1" lineno="713" slineno="7-5" level="2"><display>(a)</display>"Education employee association" includes teacher associations, teacher unions, <ln numlevel="1" lineno="714" slineno="7-6"/>teacher organizations, and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">classified education employees'</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">education support <ln numlevel="1" lineno="715" slineno="7-7"/>professionals'</amend> associations.</subsection><subsection ssid="4-3" dnum="b-o" numlevel="1" lineno="716" slineno="7-8" level="2"><display>(b)</display>"School" means a school district, a school in a school district, a charter school, or the <ln numlevel="1" lineno="717" slineno="7-9"/>state board and its employees.</subsection></subsection><subsection ssid="4-4" dnum="2-o" numlevel="1" lineno="718" slineno="7-10" level="1"><display>(2)</display>A school shall allow education employee associations equal access to the following <ln numlevel="1" lineno="719" slineno="7-11"/>activities:<subsection ssid="4-5" dnum="a-o" numlevel="1" lineno="720" slineno="7-12" level="2"><display>(a)</display>distribution of information in or access to teachers' or employees' physical or <ln numlevel="1" lineno="721" slineno="7-13"/>electronic mailboxes, including email accounts that are provided by the school; and</subsection><subsection ssid="4-6" dnum="b-o" numlevel="1" lineno="722" slineno="7-14" level="2"><display>(b)</display>membership solicitation activities at new teacher or employee orientation training or <ln numlevel="1" lineno="723" slineno="7-15"/>functions.</subsection></subsection><subsection ssid="4-7" dnum="3-o" numlevel="1" lineno="724" slineno="7-16" level="1"><display>(3)</display>If a school permits an education employee association to engage in any of the activities <ln numlevel="1" lineno="725" slineno="7-17"/>described in Subsection <xref depth="4" refnumber="53G-11-205(2)" start="0">(2)</xref>, the school shall permit all other education employee <ln numlevel="1" lineno="726" slineno="7-18"/>associations to engage in the activity on the same terms and conditions afforded to the <ln numlevel="1" lineno="727" slineno="7-19"/>education employee association.</subsection><subsection ssid="4-8" dnum="4-o" numlevel="1" lineno="728" slineno="7-20" level="1"><display>(4)</display>It is unlawful for a school to:<subsection ssid="4-9" dnum="a-o" numlevel="1" lineno="729" slineno="7-21" level="2"><display>(a)</display>establish or maintain structures, procedures, or policies that favor one education <ln numlevel="1" lineno="730" slineno="7-22"/>employee association over another or otherwise give preferential treatment to an <ln numlevel="1" lineno="731" slineno="7-23"/>education employee association; or</subsection><subsection ssid="4-10" dnum="b-o" numlevel="1" lineno="732" slineno="7-24" level="2"><display>(b)</display>explicitly or implicitly endorse any education employee association.</subsection></subsection><subsection ssid="4-11" dnum="5-o" numlevel="1" lineno="733" slineno="7-25" level="1"><display>(5)</display>A school's calendars and publications may not include or refer to the name of any <ln numlevel="1" lineno="734" slineno="7-26"/>education employee association in relation to any day or break in the school calendar.</subsection></section></bsec><bsec buid="5" type="amend" src="code" num="53G-11-519" uid="C53G-11-S519_2025050720250507" sort="53G11 05190020250507" numlevel="1" lineno="735" slineno="8-1" sn="8"><section number="53G-11-519" numlevel="1" lineno="736" slineno="8-2" type="amend"><secline lineno="735">Section 8, Section <bold>53G-11-519</bold> is amended to read:</secline><catline lineno="736"><bold>53G-11-519. Utah Recognizing Inspiring School Employees Award.</bold></catline><subsection ssid="5-1" dnum="1-o" numlevel="1" lineno="737" slineno="8-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="5-2" dnum="a-o" numlevel="1" lineno="738" slineno="8-4" level="2"><display>(a)</display>"Association" means the governing board of the association that represents a <ln numlevel="1" lineno="739" slineno="8-5"/>majority of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">classified school employees</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">education support professionals</amend> employed <ln numlevel="1" lineno="740" slineno="8-6"/>in the state.</subsection><subsection ssid="5-3" dnum="b-o" numlevel="1" lineno="741" slineno="8-7" level="2"><display>(b)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">"Classified school employee"</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">"Education support professional"</amend> means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">the same as <ln numlevel="1" lineno="742" slineno="8-8"/>that term is</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">a classified employee</amend> defined in the Recognizing Achievement in <ln numlevel="1" lineno="743" slineno="8-9"/>Classified School Employees Act, 20 U.S.C. Sec. 6682.</subsection><subsection ssid="5-4" dnum="c-o" numlevel="1" lineno="744" slineno="8-10" level="2"><display>(c)</display>"Eligible individual" means <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">a classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support <ln numlevel="1" lineno="745" slineno="8-11"/>professional</amend> who meets the eligibility requirements to be a nominee for the <ln numlevel="1" lineno="746" slineno="8-12"/>Recognizing Achievement in Classified School Employees Act, 20 U.S.C. Sec. 6681 <ln numlevel="1" lineno="747" slineno="8-13"/>et seq.</subsection></subsection><subsection ssid="5-5" dnum="2-o" numlevel="1" lineno="748" slineno="8-14" level="1" space="false"><display>(2)</display><subsection ssid="5-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with the Recognizing Achievement in Classified School <ln numlevel="1" lineno="749" slineno="8-15"/>Employees Act, 20 U.S.C. Sec. 6681 et seq., the governor shall annually nominate <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">a <ln numlevel="1" lineno="750" slineno="8-16"/>classified school employee</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="27" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">an education support professional</amend> for the Recognizing <ln numlevel="1" lineno="751" slineno="8-17"/>Inspiring School Employees Award Program.</subsection><subsection ssid="5-7" dnum="b-o" numlevel="1" lineno="752" slineno="8-18" level="2"><display>(b)</display>The governor shall consider submissions from the association in making the <ln numlevel="1" lineno="753" slineno="8-19"/>nomination described in Subsection (2)(a).</subsection><subsection ssid="5-8" dnum="c-o" numlevel="1" lineno="754" slineno="8-20" level="2"><display>(c)</display>The association shall submit a list of eligible individuals to the governor no later than <ln numlevel="1" lineno="755" slineno="8-21"/>September 1 each year.</subsection></subsection><subsection ssid="5-9" dnum="3-o" numlevel="1" lineno="756" slineno="8-22" level="1" space="false"><display>(3)</display><subsection ssid="5-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is created the Utah Recognizing Inspiring School Employees Award <ln numlevel="1" lineno="757" slineno="8-23"/>Program to recognize excellence exhibited by public school system employees <ln numlevel="1" lineno="758" slineno="8-24"/>providing services to students in pre-kindergarten through grade 12.</subsection><subsection ssid="5-11" dnum="b-o" numlevel="1" lineno="759" slineno="8-25" level="2"><display>(b)</display>The Utah Recognizing Inspiring School Employees Award shall be awarded to the <ln numlevel="1" lineno="760" slineno="8-26"/>governor's nominee for the federal Recognizing Inspiring School Employees Award <ln numlevel="1" lineno="761" slineno="8-27"/>Program under the Recognizing Achievement in Classified School Employees Act, <ln numlevel="1" lineno="762" slineno="8-28"/>20 U.S.C. Sec. 6681 et seq.</subsection></subsection></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="763" slineno="9-1" sn="9"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="763">Section 9.  <bold>Effective date.</bold></secline><sectionText lineno="764"><amend anum="0" ea="amend" pairid="10" groupid="-1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="bill" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-6-25 3:20 PM</tm></rev></foot></leg>
