Definitions.</bold></catline><sectionText lineno="26"><tab/>As used in this chapter:</sectionText><subsection ssid="5-5-1" dnum="1-o" numlevel="1" lineno="27" slineno="1-4" level="1"><display>(1)</display>"Alley" means a street or highway intended to provide access to the rear or side of lots <ln numlevel="1" lineno="28" slineno="1-5"/>or buildings in urban districts and not intended for through vehicular traffic.</subsection><subsection ssid="5-5-2" dnum="2-o" numlevel="1" lineno="29" slineno="1-6" level="1"><display>(2)</display>"All-terrain type I vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="5-5-3" dnum="3-o" numlevel="1" lineno="30" slineno="1-7" level="1"><display>(3)</display>"All-terrain type II vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="5-5-4" dnum="4-o" numlevel="1" lineno="31" slineno="1-8" level="1"><display>(4)</display>"All-terrain type III vehicle" means the same as that term is defined in Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="5-5-5" dnum="5-o" numlevel="1" lineno="32" slineno="1-9" level="1"><display>(5)</display>"Authorized emergency vehicle" includes:<subsection ssid="5-5-6" dnum="a-o" numlevel="1" lineno="33" slineno="1-10" level="2"><display>(a)</display>a fire department vehicle;</subsection><subsection ssid="5-5-7" dnum="b-o" numlevel="1" lineno="34" slineno="1-11" level="2"><display>(b)</display>a police vehicle;</subsection><subsection ssid="5-5-8" dnum="c-o" numlevel="1" lineno="35" slineno="1-12" level="2"><display>(c)</display>an ambulance; and</subsection><subsection ssid="5-5-9" dnum="d-o" numlevel="1" lineno="36" slineno="1-13" level="2"><display>(d)</display>other publicly or privately owned vehicles as designated by the commissioner of the <ln numlevel="1" lineno="37" slineno="1-14"/>Department of Public Safety.</subsection></subsection><subsection ssid="5-5-10" dnum="6-o" numlevel="1" lineno="38" slineno="1-15" level="1"><display>(6)</display>"Autocycle" means the same as that term is defined in Section <xref depth="3" refnumber="53-3-102">53-3-102</xref>.</subsection><subsection ssid="5-5-11" dnum="7-o" numlevel="1" lineno="39" slineno="1-16" level="1" space="false"><display>(7)</display><subsection ssid="5-5-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Bicycle" means a wheeled vehicle:<subsection ssid="5-5-13" dnum="i-o" numlevel="1" lineno="40" slineno="1-17" level="3" tab="1"><display>(i)</display>propelled by human power by feet or hands acting upon pedals or cranks;</subsection><subsection ssid="5-5-14" dnum="ii-o" numlevel="1" lineno="41" slineno="1-18" level="3" tab="1"><display>(ii)</display>with a seat or saddle designed for the use of the operator;</subsection><subsection ssid="5-5-15" dnum="iii-o" numlevel="1" lineno="42" slineno="1-19" level="3" tab="1"><display>(iii)</display>designed to be operated on the ground; and</subsection><subsection ssid="5-5-16" dnum="iv-o" numlevel="1" lineno="43" slineno="1-20" level="3" tab="1"><display>(iv)</display>whose wheels are not less than 14 inches in diameter.</subsection></subsection><subsection ssid="5-5-17" dnum="b-o" numlevel="1" lineno="44" slineno="1-21" level="2"><display>(b)</display>"Bicycle" includes an electric assisted bicycle.</subsection><subsection ssid="5-5-18" dnum="c-o" numlevel="1" lineno="45" slineno="1-22" level="2"><display>(c)</display>"Bicycle" does not include scooters and similar devices.</subsection></subsection><subsection ssid="5-5-19" dnum="8-o" numlevel="1" lineno="46" slineno="1-23" level="1" space="false"><display>(8)</display><subsection ssid="5-5-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Bus" means a motor vehicle:<subsection ssid="5-5-21" dnum="i-o" numlevel="1" lineno="47" slineno="1-24" level="3" tab="1"><display>(i)</display>designed for carrying more than 15 passengers and used for the transportation of <ln numlevel="1" lineno="48" slineno="1-25"/>persons; or</subsection><subsection ssid="5-5-22" dnum="ii-o" numlevel="1" lineno="49" slineno="1-26" level="3" tab="1"><display>(ii)</display>designed and used for the transportation of persons for compensation.</subsection></subsection><subsection ssid="5-5-23" dnum="b-o" numlevel="1" lineno="50" slineno="1-27" level="2"><display>(b)</display>"Bus" does not include a taxicab.</subsection></subsection><subsection ssid="5-5-24" dnum="9-o" numlevel="1" lineno="51" slineno="1-28" level="1" space="false"><display>(9)</display><subsection ssid="5-5-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Circular intersection" means an intersection that has an island, generally circular <ln numlevel="1" lineno="52" slineno="1-29"/>in design, located in the center of the intersection where traffic passes to the right of <ln numlevel="1" lineno="53" slineno="1-30"/>the island.</subsection><subsection ssid="5-5-26" dnum="b-o" numlevel="1" lineno="54" slineno="1-31" level="2"><display>(b)</display>"Circular intersection" includes:<subsection ssid="5-5-27" dnum="i-o" numlevel="1" lineno="55" slineno="1-32" level="3"><display>(i)</display>roundabouts;</subsection><subsection ssid="5-5-28" dnum="ii-o" numlevel="1" lineno="56" slineno="1-33" level="3"><display>(ii)</display>rotaries; and</subsection><subsection ssid="5-5-29" dnum="iii-o" numlevel="1" lineno="57" slineno="1-34" level="3"><display>(iii)</display>traffic circles.</subsection></subsection></subsection><subsection ssid="5-5-30" dnum="10-o" numlevel="1" lineno="58" slineno="1-35" level="1"><display>(10)</display>"Class 1 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="59" slineno="1-36"/>motor or electronics that:<subsection ssid="5-5-31" dnum="a-o" numlevel="1" lineno="60" slineno="1-37" level="2"><display>(a)</display>provides assistance only when the rider is pedaling; and</subsection><subsection ssid="5-5-32" dnum="b-o" numlevel="1" lineno="61" slineno="1-38" level="2"><display>(b)</display>ceases to provide assistance when the bicycle reaches the speed of 20 miles per hour.</subsection></subsection><subsection ssid="5-5-33" dnum="11-o" numlevel="1" lineno="62" slineno="1-39" level="1"><display>(11)</display>"Class 2 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="63" slineno="1-40"/>motor or electronics that:<subsection ssid="5-5-34" dnum="a-o" numlevel="1" lineno="64" slineno="1-41" level="2"><display>(a)</display>may be used exclusively to propel the bicycle; and</subsection><subsection ssid="5-5-35" dnum="b-o" numlevel="1" lineno="65" slineno="1-42" level="2"><display>(b)</display>is not capable of providing assistance when the bicycle reaches the speed of 20 miles <ln numlevel="1" lineno="66" slineno="1-43"/>per hour.</subsection></subsection><subsection ssid="5-5-36" dnum="12-o" numlevel="1" lineno="67" slineno="1-44" level="1"><display>(12)</display>"Class 3 electric assisted bicycle" means an electric assisted bicycle equipped with a <ln numlevel="1" lineno="68" slineno="1-45"/>motor or electronics that:<subsection ssid="5-5-37" dnum="a-o" numlevel="1" lineno="69" slineno="1-46" level="2"><display>(a)</display>provides assistance only when the rider is pedaling;</subsection><subsection ssid="5-5-38" dnum="b-o" numlevel="1" lineno="70" slineno="1-47" level="2"><display>(b)</display>ceases to provide assistance when the bicycle reaches the speed of 28 miles per hour; <ln numlevel="1" lineno="71" slineno="1-48"/>and</subsection><subsection ssid="5-5-39" dnum="c-o" numlevel="1" lineno="72" slineno="1-49" level="2"><display>(c)</display>is equipped with a speedometer.</subsection></subsection><subsection ssid="5-5-40" dnum="13-o" numlevel="1" lineno="73" slineno="1-50" level="1"><display>(13)</display>"Commissioner" means the commissioner of the Department of Public Safety.</subsection><subsection ssid="5-5-41" dnum="14-o" numlevel="1" lineno="74" slineno="1-51" level="1"><display>(14)</display>"Controlled-access highway" means a highway, street, or roadway:<subsection ssid="5-5-42" dnum="a-o" numlevel="1" lineno="75" slineno="1-52" level="2"><display>(a)</display>designed primarily for through traffic; and</subsection><subsection ssid="5-5-43" dnum="b-o" numlevel="1" lineno="76" slineno="1-53" level="2"><display>(b)</display>to or from which owners or occupants of abutting lands and other persons have no <ln numlevel="1" lineno="77" slineno="1-54"/>legal right of access, except at points as determined by the highway authority having <ln numlevel="1" lineno="78" slineno="1-55"/>jurisdiction over the highway, street, or roadway.</subsection></subsection><subsection ssid="5-5-44" dnum="15-o" numlevel="1" lineno="79" slineno="1-56" level="1"><display>(15)</display>"Crosswalk" means:<subsection ssid="5-5-45" dnum="a-o" numlevel="1" lineno="80" slineno="1-57" level="2"><display>(a)</display>that part of a roadway at an intersection included within the connections of the lateral <ln numlevel="1" lineno="81" slineno="1-58"/>lines of the sidewalks on opposite sides of the highway measured from:<subsection ssid="5-5-46" dnum="i-o" numlevel="1" lineno="82" slineno="1-59" level="3" space="false"><display>(i)</display><subsection ssid="5-5-47" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the curbs; or</subsection><subsection ssid="5-5-48" dnum="B-o" numlevel="1" lineno="83" slineno="1-60" level="4"><display>(B)</display>in the absence of curbs, from the edges of the traversable roadway; and</subsection></subsection><subsection ssid="5-5-49" dnum="ii-o" numlevel="1" lineno="84" slineno="1-61" level="3"><display>(ii)</display>in the absence of a sidewalk on one side of the roadway, that part of a roadway <ln numlevel="1" lineno="85" slineno="1-62"/>included within the extension of the lateral lines of the existing sidewalk at right <ln numlevel="1" lineno="86" slineno="1-63"/>angles to the centerline; or</subsection></subsection><subsection ssid="5-5-50" dnum="b-o" numlevel="1" lineno="87" slineno="1-64" level="2"><display>(b)</display>any portion of a roadway at an intersection or elsewhere distinctly indicated for <ln numlevel="1" lineno="88" slineno="1-65"/>pedestrian crossing by lines or other markings on the surface.</subsection></subsection><subsection ssid="5-5-51" dnum="16-o" numlevel="1" lineno="89" slineno="1-66" level="1"><display>(16)</display>"Department" means the Department of Public Safety.</subsection><subsection ssid="5-5-52" dnum="17-o" numlevel="1" lineno="90" slineno="1-67" level="1"><display>(17)</display>"Direct supervision" means oversight at a distance within which:<subsection ssid="5-5-53" dnum="a-o" numlevel="1" lineno="91" slineno="1-68" level="2"><display>(a)</display>visual contact is maintained; and</subsection><subsection ssid="5-5-54" dnum="b-o" numlevel="1" lineno="92" slineno="1-69" level="2"><display>(b)</display>advice and assistance can be given and received.</subsection></subsection><subsection ssid="5-5-55" dnum="18-o" numlevel="1" lineno="93" slineno="1-70" level="1"><display>(18)</display>"Divided highway" means a highway divided into two or more roadways by:<subsection ssid="5-5-56" dnum="a-o" numlevel="1" lineno="94" slineno="1-71" level="2"><display>(a)</display>an unpaved intervening space;</subsection><subsection ssid="5-5-57" dnum="b-o" numlevel="1" lineno="95" slineno="1-72" level="2"><display>(b)</display>a physical barrier; or</subsection><subsection ssid="5-5-58" dnum="c-o" numlevel="1" lineno="96" slineno="1-73" level="2"><display>(c)</display>a clearly indicated dividing section constructed to impede vehicular traffic.</subsection></subsection><subsection ssid="5-5-59" dnum="19-o" numlevel="1" lineno="97" slineno="1-74" level="1"><display>(19)</display>"Echelon formation" means the operation of two or more snowplows arranged <ln numlevel="1" lineno="98" slineno="1-75"/>side-by-side or diagonally across multiple lanes of traffic of a multi-lane highway to <ln numlevel="1" lineno="99" slineno="1-76"/>clear snow from two or more lanes at once.</subsection><subsection ssid="5-5-60" dnum="20-o" numlevel="1" lineno="100" slineno="1-77" level="1" space="false"><display>(20)</display><subsection ssid="5-5-61" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Electric assisted bicycle" means a bicycle with an electric motor that:<subsection ssid="5-5-62" dnum="i-o" numlevel="1" lineno="101" slineno="1-78" level="3" tab="1"><display>(i)</display>has a power output of not more than 750 watts;</subsection><subsection ssid="5-5-63" dnum="ii-o" numlevel="1" lineno="102" slineno="1-79" level="3" tab="1"><display>(ii)</display>has fully operable pedals;</subsection><subsection ssid="5-5-64" dnum="iii-o" numlevel="1" lineno="103" slineno="1-80" level="3" tab="1"><display>(iii)</display>has permanently affixed cranks that were installed at the time of the original <ln numlevel="1" lineno="104" slineno="1-81"/>manufacture;</subsection><subsection ssid="5-5-65" dnum="iv-o" numlevel="1" lineno="105" slineno="1-82" level="3" tab="1"><display>(iv)</display>is fully operable as a bicycle without the use of the electric motor; and</subsection><subsection ssid="5-5-66" dnum="v-o" numlevel="1" lineno="106" slineno="1-83" level="3" tab="1"><display>(v)</display>is one of the following:<subsection ssid="5-5-67" dnum="A-o" numlevel="1" lineno="107" slineno="1-84" level="4"><display>(A)</display>a class 1 electric assisted bicycle;</subsection><subsection ssid="5-5-68" dnum="B-o" numlevel="1" lineno="108" slineno="1-85" level="4"><display>(B)</display>a class 2 electric assisted bicycle;</subsection><subsection ssid="5-5-69" dnum="C-o" numlevel="1" lineno="109" slineno="1-86" level="4"><display>(C)</display>a class 3 electric assisted bicycle; or</subsection><subsection ssid="5-5-70" dnum="D-o" numlevel="1" lineno="110" slineno="1-87" level="4"><display>(D)</display>a programmable electric assisted bicycle.</subsection></subsection></subsection><subsection ssid="5-5-71" dnum="b-o" numlevel="1" lineno="111" slineno="1-88" level="2"><display>(b)</display>"Electric assisted bicycle" does not include:<subsection ssid="5-5-72" dnum="i-o" numlevel="1" lineno="112" slineno="1-89" level="3"><display>(i)</display>a moped;</subsection><subsection ssid="5-5-73" dnum="ii-o" numlevel="1" lineno="113" slineno="1-90" level="3"><display>(ii)</display>a motor assisted scooter;</subsection><subsection ssid="5-5-74" dnum="iii-o" numlevel="1" lineno="114" slineno="1-91" level="3"><display>(iii)</display>a motorcycle;</subsection><subsection ssid="5-5-75" dnum="iv-o" numlevel="1" lineno="115" slineno="1-92" level="3"><display>(iv)</display>a motor-driven cycle; or</subsection><subsection ssid="5-5-76" dnum="v-o" numlevel="1" lineno="116" slineno="1-93" level="3"><display>(v)</display>any other vehicle with less than four wheels that is designed, manufactured, <ln numlevel="1" lineno="117" slineno="1-94"/>intended, or advertised by the seller to have any of the following capabilities or <ln numlevel="1" lineno="118" slineno="1-95"/>features, or that is modifiable or is modified to have any of the following <ln numlevel="1" lineno="119" slineno="1-96"/>capabilities or features:<subsection ssid="5-5-77" dnum="A-o" numlevel="1" lineno="120" slineno="1-97" level="4"><display>(A)</display>has the ability to attain the speed of 20 miles per hour or greater on motor <ln numlevel="1" lineno="121" slineno="1-98"/>power alone;</subsection><subsection ssid="5-5-78" dnum="B-o" numlevel="1" lineno="122" slineno="1-99" level="4"><display>(B)</display>is equipped with a continuous rated motor power of 750 watts or greater;</subsection><subsection ssid="5-5-79" dnum="C-o" numlevel="1" lineno="123" slineno="1-100" level="4"><display>(C)</display>is equipped with foot pegs for the operator at the time of manufacture, or <ln numlevel="1" lineno="124" slineno="1-101"/>requires installation of a pedal kit to have operable pedals; or</subsection><subsection ssid="5-5-80" dnum="D-o" numlevel="1" lineno="125" slineno="1-102" level="4"><display>(D)</display>if equipped with multiple operating modes and a throttle, has one or more <ln numlevel="1" lineno="126" slineno="1-103"/>modes that exceed 20 miles per hour on motor power alone.</subsection></subsection></subsection></subsection><subsection ssid="5-5-81" dnum="21-o" numlevel="1" lineno="127" slineno="1-104" level="1" space="false"><display>(21)</display><subsection ssid="5-5-82" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Electric personal assistive mobility device" means a self-balancing device with:<subsection ssid="5-5-83" dnum="i-o" numlevel="1" lineno="128" slineno="1-105" level="3" tab="1"><display>(i)</display>two nontandem wheels in contact with the ground;</subsection><subsection ssid="5-5-84" dnum="ii-o" numlevel="1" lineno="129" slineno="1-106" level="3" tab="1"><display>(ii)</display>a system capable of steering and stopping the unit under typical operating <ln numlevel="1" lineno="130" slineno="1-107"/>conditions;</subsection><subsection ssid="5-5-85" dnum="iii-o" numlevel="1" lineno="131" slineno="1-108" level="3" tab="1"><display>(iii)</display>an electric propulsion system with average power of one horsepower or 750 <ln numlevel="1" lineno="132" slineno="1-109"/>watts;</subsection><subsection ssid="5-5-86" dnum="iv-o" numlevel="1" lineno="133" slineno="1-110" level="3" tab="1"><display>(iv)</display>a maximum speed capacity on a paved, level surface of 12.5 miles per hour; and</subsection><subsection ssid="5-5-87" dnum="v-o" numlevel="1" lineno="134" slineno="1-111" level="3" tab="1"><display>(v)</display>a deck design for a person to stand while operating the device.</subsection></subsection><subsection ssid="5-5-88" dnum="b-o" numlevel="1" lineno="135" slineno="1-112" level="2"><display>(b)</display>"Electric personal assistive mobility device" does not include a wheelchair.</subsection></subsection><subsection ssid="5-5-89" dnum="22-o" numlevel="1" lineno="136" slineno="1-113" level="1"><display>(22)</display>"Explosives" means a chemical compound or mechanical mixture commonly used or <ln numlevel="1" lineno="137" slineno="1-114"/>intended for the purpose of producing an explosion and that contains any oxidizing and <ln numlevel="1" lineno="138" slineno="1-115"/>combustive units or other ingredients in proportions, quantities, or packing so that an <ln numlevel="1" lineno="139" slineno="1-116"/>ignition by fire, friction, concussion, percussion, or detonator of any part of the <ln numlevel="1" lineno="140" slineno="1-117"/>compound or mixture may cause a sudden generation of highly heated gases, and the <ln numlevel="1" lineno="141" slineno="1-118"/>resultant gaseous pressures are capable of producing destructive effects on contiguous <ln numlevel="1" lineno="142" slineno="1-119"/>objects or of causing death or serious bodily injury.</subsection><subsection ssid="5-5-90" dnum="23-o" numlevel="1" lineno="143" slineno="1-120" level="1"><display>(23)</display>"Farm tractor" means a motor vehicle designed and used primarily as a farm <ln numlevel="1" lineno="144" slineno="1-121"/>implement, for drawing plows, mowing machines, and other implements of husbandry.</subsection><subsection ssid="5-5-91" dnum="24-o" numlevel="1" lineno="145" slineno="1-122" level="1"><display>(24)</display>"Flammable liquid" means a liquid that has a flashpoint of 100 degrees F. or less, as <ln numlevel="1" lineno="146" slineno="1-123"/>determined by a Tagliabue or equivalent closed-cup test device.</subsection><subsection ssid="5-5-92" dnum="25-o" numlevel="1" lineno="147" slineno="1-124" level="1"><display>(25)</display>"Freeway" means a controlled-access highway that is part of the interstate system as <ln numlevel="1" lineno="148" slineno="1-125"/>defined in Section <xref depth="3" refnumber="72-1-102">72-1-102</xref>.</subsection><subsection ssid="5-5-93" dnum="26-o" numlevel="1" lineno="149" slineno="1-126" level="1" space="false"><display>(26)</display><subsection ssid="5-5-94" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Golf cart" means a device that:<subsection ssid="5-5-95" dnum="i-o" numlevel="1" lineno="150" slineno="1-127" level="3" tab="1"><display>(i)</display>is designed for transportation by players on a golf course;</subsection><subsection ssid="5-5-96" dnum="ii-o" numlevel="1" lineno="151" slineno="1-128" level="3" tab="1"><display>(ii)</display>has not less than three wheels in contact with the ground;</subsection><subsection ssid="5-5-97" dnum="iii-o" numlevel="1" lineno="152" slineno="1-129" level="3" tab="1"><display>(iii)</display>has an unladen weight of less than 1,800 pounds;</subsection><subsection ssid="5-5-98" dnum="iv-o" numlevel="1" lineno="153" slineno="1-130" level="3" tab="1"><display>(iv)</display>is designed to operate at low speeds; and</subsection><subsection ssid="5-5-99" dnum="v-o" numlevel="1" lineno="154" slineno="1-131" level="3" tab="1"><display>(v)</display>is designed to carry not more than six persons including the driver.</subsection></subsection><subsection ssid="5-5-100" dnum="b-o" numlevel="1" lineno="155" slineno="1-132" level="2"><display>(b)</display>"Golf cart" does not include:<subsection ssid="5-5-101" dnum="i-o" numlevel="1" lineno="156" slineno="1-133" level="3"><display>(i)</display>a low-speed vehicle or an off-highway vehicle;</subsection><subsection ssid="5-5-102" dnum="ii-o" numlevel="1" lineno="157" slineno="1-134" level="3"><display>(ii)</display>a motorized wheelchair;</subsection><subsection ssid="5-5-103" dnum="iii-o" numlevel="1" lineno="158" slineno="1-135" level="3"><display>(iii)</display>an electric personal assistive mobility device;</subsection><subsection ssid="5-5-104" dnum="iv-o" numlevel="1" lineno="159" slineno="1-136" level="3"><display>(iv)</display>an electric assisted bicycle;</subsection><subsection ssid="5-5-105" dnum="v-o" numlevel="1" lineno="160" slineno="1-137" level="3"><display>(v)</display>a motor assisted scooter;</subsection><subsection ssid="5-5-106" dnum="vi-o" numlevel="1" lineno="161" slineno="1-138" level="3"><display>(vi)</display>a personal delivery device, as defined in Section <xref depth="3" refnumber="41-6a-1119">41-6a-1119</xref>; or</subsection><subsection ssid="5-5-107" dnum="vii-o" numlevel="1" lineno="162" slineno="1-139" level="3"><display>(vii)</display>a mobile carrier, as defined in Section <xref depth="3" refnumber="41-6a-1120">41-6a-1120</xref>.</subsection></subsection></subsection><subsection ssid="5-5-108" dnum="27-o" numlevel="1" lineno="163" slineno="1-140" level="1"><display>(27)</display>"Gore area" means the area delineated by two solid white lines that is between a <ln numlevel="1" lineno="164" slineno="1-141"/>continuing lane of a through roadway and a lane used to enter or exit the continuing lane <ln numlevel="1" lineno="165" slineno="1-142"/>including similar areas between merging or splitting highways.</subsection><subsection ssid="5-5-109" dnum="28-o" numlevel="1" lineno="166" slineno="1-143" level="1"><display>(28)</display>"Gross weight" means the weight of a vehicle without a load plus the weight of any <ln numlevel="1" lineno="167" slineno="1-144"/>load on the vehicle.</subsection><subsection ssid="5-5-110" dnum="29-o" numlevel="1" lineno="168" slineno="1-145" level="1"><display>(29)</display>"Hi-rail vehicle" means a roadway maintenance vehicle that is:<subsection ssid="5-5-111" dnum="a-o" numlevel="1" lineno="169" slineno="1-146" level="2"><display>(a)</display>manufactured to meet Federal Motor Vehicle Safety Standards; and</subsection><subsection ssid="5-5-112" dnum="b-o" numlevel="1" lineno="170" slineno="1-147" level="2"><display>(b)</display>equipped with retractable flanged wheels that allow the vehicle to travel on a <ln numlevel="1" lineno="171" slineno="1-148"/>highway or railroad tracks.</subsection></subsection><subsection ssid="5-5-113" dnum="30-o" numlevel="1" lineno="172" slineno="1-149" level="1"><display>(30)</display>"Highway" means the entire width between property lines of every way or place of any <ln numlevel="1" lineno="173" slineno="1-150"/>nature when any part of it is open to the use of the public as a matter of right for <ln numlevel="1" lineno="174" slineno="1-151"/>vehicular travel.</subsection><subsection ssid="5-5-114" dnum="31-o" numlevel="1" lineno="175" slineno="1-152" level="1"><display>(31)</display>"Highway authority" means the same as that term is defined in Section <xref depth="3" refnumber="72-1-102">72-1-102</xref>.</subsection><subsection ssid="5-5-115" dnum="32-o" numlevel="1" lineno="176" slineno="1-153" level="1" space="false"><display>(32)</display><subsection ssid="5-5-116" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Intersection" means the area embraced within the prolongation or connection of <ln numlevel="1" lineno="177" slineno="1-154"/>the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of <ln numlevel="1" lineno="178" slineno="1-155"/>two or more highways that join one another.</subsection><subsection ssid="5-5-117" dnum="b-o" numlevel="1" lineno="179" slineno="1-156" level="2"><display>(b)</display>Where a highway includes two roadways 30 feet or more apart:<subsection ssid="5-5-118" dnum="i-o" numlevel="1" lineno="180" slineno="1-157" level="3"><display>(i)</display>every crossing of each roadway of the divided highway by an intersecting <ln numlevel="1" lineno="181" slineno="1-158"/>highway is a separate intersection; and</subsection><subsection ssid="5-5-119" dnum="ii-o" numlevel="1" lineno="182" slineno="1-159" level="3"><display>(ii)</display>if the intersecting highway also includes two roadways 30 feet or more apart, then <ln numlevel="1" lineno="183" slineno="1-160"/>every crossing of two roadways of the highways is a separate intersection.</subsection></subsection><subsection ssid="5-5-120" dnum="c-o" numlevel="1" lineno="184" slineno="1-161" level="2"><display>(c)</display>"Intersection" does not include the junction of an alley with a street or highway.</subsection></subsection><subsection ssid="5-5-121" dnum="33-o" numlevel="1" lineno="185" slineno="1-162" level="1"><display>(33)</display>"Island" means an area between traffic lanes or at an intersection for control of vehicle <ln numlevel="1" lineno="186" slineno="1-163"/>movements or for pedestrian refuge designated by:<subsection ssid="5-5-122" dnum="a-o" numlevel="1" lineno="187" slineno="1-164" level="2"><display>(a)</display>pavement markings, which may include an area designated by two solid yellow lines <ln numlevel="1" lineno="188" slineno="1-165"/>surrounding the perimeter of the area;</subsection><subsection ssid="5-5-123" dnum="b-o" numlevel="1" lineno="189" slineno="1-166" level="2"><display>(b)</display>channelizing devices;</subsection><subsection ssid="5-5-124" dnum="c-o" numlevel="1" lineno="190" slineno="1-167" level="2"><display>(c)</display>curbs;</subsection><subsection ssid="5-5-125" dnum="d-o" numlevel="1" lineno="191" slineno="1-168" level="2"><display>(d)</display>pavement edges; or</subsection><subsection ssid="5-5-126" dnum="e-o" numlevel="1" lineno="192" slineno="1-169" level="2"><display>(e)</display>other devices.</subsection></subsection><subsection ssid="5-5-127" dnum="34-o" numlevel="1" lineno="193" slineno="1-170" level="1"><display>(34)</display>"Lane filtering" means, when operating a motorcycle other than an autocycle, the act <ln numlevel="1" lineno="194" slineno="1-171"/>of overtaking and passing another vehicle that is stopped in the same direction of travel <ln numlevel="1" lineno="195" slineno="1-172"/>in the same lane.</subsection><subsection ssid="5-5-128" dnum="35-o" numlevel="1" lineno="196" slineno="1-173" level="1"><display>(35)</display>"Law enforcement agency" means the same as that term is as defined in Section <xref depth="3" refnumber="53-1-102"><ln numlevel="1" lineno="197" slineno="1-174"/>53-1-102</xref>.</subsection><subsection ssid="5-5-129" dnum="36-o" numlevel="1" lineno="198" slineno="1-175" level="1"><display>(36)</display>"Limited access highway" means a highway:<subsection ssid="5-5-130" dnum="a-o" numlevel="1" lineno="199" slineno="1-176" level="2"><display>(a)</display>that is designated specifically for through traffic; and</subsection><subsection ssid="5-5-131" dnum="b-o" numlevel="1" lineno="200" slineno="1-177" level="2"><display>(b)</display>over, from, or to which neither owners nor occupants of abutting lands nor other <ln numlevel="1" lineno="201" slineno="1-178"/>persons have any right or easement, or have only a limited right or easement of <ln numlevel="1" lineno="202" slineno="1-179"/>access, light, air, or view.</subsection></subsection><subsection ssid="5-5-132" dnum="37-o" numlevel="1" lineno="203" slineno="1-180" level="1"><display>(37)</display>"Local highway authority" means the legislative, executive, or governing body of a <ln numlevel="1" lineno="204" slineno="1-181"/>county, municipal, or other local board or body having authority to enact laws relating to <ln numlevel="1" lineno="205" slineno="1-182"/>traffic under the constitution and laws of the state.</subsection><subsection ssid="5-5-133" dnum="38-o" numlevel="1" lineno="206" slineno="1-183" level="1" space="false"><display>(38)</display><subsection ssid="5-5-134" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Low-speed vehicle" means a four wheeled motor vehicle that:<subsection ssid="5-5-135" dnum="i-o" numlevel="1" lineno="207" slineno="1-184" level="3" tab="1"><display>(i)</display>is designed to be operated at speeds of not more than 25 miles per hour; and</subsection><subsection ssid="5-5-136" dnum="ii-o" numlevel="1" lineno="208" slineno="1-185" level="3" tab="1"><display>(ii)</display>has a capacity of not more than six passengers, including a conventional driver or <ln numlevel="1" lineno="209" slineno="1-186"/>fallback-ready user if on board the vehicle, as those terms are defined in Section <xref depth="3" refnumber="41-26-102.1"><ln numlevel="1" lineno="210" slineno="1-187"/>41-26-102.1</xref>.</subsection></subsection><subsection ssid="5-5-137" dnum="b-o" numlevel="1" lineno="211" slineno="1-188" level="2"><display>(b)</display>"Low-speed vehicle" does not include a golfcart or an off-highway vehicle.</subsection></subsection><subsection ssid="5-5-138" dnum="39-o" numlevel="1" lineno="212" slineno="1-189" level="1"><display>(39)</display>"Metal tire" means a tire, the surface of which in contact with the highway is wholly or <ln numlevel="1" lineno="213" slineno="1-190"/>partly of metal or other hard nonresilient material.</subsection><subsection ssid="5-5-139" dnum="40-o" numlevel="1" lineno="214" slineno="1-191" level="1" space="false"><display>(40)</display><subsection ssid="5-5-140" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Mini-motorcycle" means a motorcycle or motor-driven cycle that has a seat or <ln numlevel="1" lineno="215" slineno="1-192"/>saddle that is less than 24 inches from the ground as measured on a level surface with <ln numlevel="1" lineno="216" slineno="1-193"/>properly inflated tires.</subsection><subsection ssid="5-5-141" dnum="b-o" numlevel="1" lineno="217" slineno="1-194" level="2"><display>(b)</display>"Mini-motorcycle" does not include a moped or a motor assisted scooter.</subsection><subsection ssid="5-5-142" dnum="c-o" numlevel="1" lineno="218" slineno="1-195" level="2"><display>(c)</display>"Mini-motorcycle" does not include a motorcycle that is:<subsection ssid="5-5-143" dnum="i-o" numlevel="1" lineno="219" slineno="1-196" level="3"><display>(i)</display>designed for off-highway use; and</subsection><subsection ssid="5-5-144" dnum="ii-o" numlevel="1" lineno="220" slineno="1-197" level="3"><display>(ii)</display>registered as an off-highway vehicle under Section <xref depth="3" refnumber="41-22-3">41-22-3</xref>.</subsection></subsection></subsection><subsection ssid="5-5-145" dnum="41-o" numlevel="1" lineno="221" slineno="1-198" level="1"><display>(41)</display>"Mobile home" means:<subsection ssid="5-5-146" dnum="a-o" numlevel="1" lineno="222" slineno="1-199" level="2"><display>(a)</display>a trailer or semitrailer that is:<subsection ssid="5-5-147" dnum="i-o" numlevel="1" lineno="223" slineno="1-200" level="3"><display>(i)</display>designed, constructed, and equipped as a dwelling place, living abode, or sleeping <ln numlevel="1" lineno="224" slineno="1-201"/>place either permanently or temporarily; and</subsection><subsection ssid="5-5-148" dnum="ii-o" numlevel="1" lineno="225" slineno="1-202" level="3"><display>(ii)</display>equipped for use as a conveyance on streets and highways; or</subsection></subsection><subsection ssid="5-5-149" dnum="b-o" numlevel="1" lineno="226" slineno="1-203" level="2"><display>(b)</display>a trailer or a semitrailer whose chassis and exterior shell is designed and constructed <ln numlevel="1" lineno="227" slineno="1-204"/>for use as a mobile home, as defined in Subsection (41)(a), but that is instead used <ln numlevel="1" lineno="228" slineno="1-205"/>permanently or temporarily for:<subsection ssid="5-5-150" dnum="i-o" numlevel="1" lineno="229" slineno="1-206" level="3"><display>(i)</display>the advertising, sale, display, or promotion of merchandise or services; or</subsection><subsection ssid="5-5-151" dnum="ii-o" numlevel="1" lineno="230" slineno="1-207" level="3"><display>(ii)</display>any other commercial purpose except the transportation of property for hire or the <ln numlevel="1" lineno="231" slineno="1-208"/>transportation of property for distribution by a private carrier.</subsection></subsection></subsection><subsection ssid="5-5-152" dnum="42-o" numlevel="1" lineno="232" slineno="1-209" level="1"><display>(42)</display>"Mobility disability" means the inability of a person to use one or more of the person's <ln numlevel="1" lineno="233" slineno="1-210"/>extremities or difficulty with motor skills, that may include limitations with walking, <ln numlevel="1" lineno="234" slineno="1-211"/>grasping, or lifting an object, caused by a neuro-muscular, orthopedic, or other condition.</subsection><subsection ssid="5-5-153" dnum="43-o" numlevel="1" lineno="235" slineno="1-212" level="1" space="false"><display>(43)</display><subsection ssid="5-5-154" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Moped" means a motor-driven cycle having:<subsection ssid="5-5-155" dnum="i-o" numlevel="1" lineno="236" slineno="1-213" level="3" tab="1"><display>(i)</display>pedals to permit propulsion by human power; and</subsection><subsection ssid="5-5-156" dnum="ii-o" numlevel="1" lineno="237" slineno="1-214" level="3" tab="1"><display>(ii)</display>a motor that:<subsection ssid="5-5-157" dnum="A-o" numlevel="1" lineno="238" slineno="1-215" level="4"><display>(A)</display>produces not more than two brake horsepower; and</subsection><subsection ssid="5-5-158" dnum="B-o" numlevel="1" lineno="239" slineno="1-216" level="4"><display>(B)</display>is not capable of propelling the cycle at a speed in excess of 30 miles per hour <ln numlevel="1" lineno="240" slineno="1-217"/>on level ground.</subsection></subsection></subsection><subsection ssid="5-5-159" dnum="b-o" numlevel="1" lineno="241" slineno="1-218" level="2"><display>(b)</display>If an internal combustion engine is used, the displacement may not exceed 50 cubic <ln numlevel="1" lineno="242" slineno="1-219"/>centimeters and the moped shall have a power drive system that functions directly or <ln numlevel="1" lineno="243" slineno="1-220"/>automatically without clutching or shifting by the operator after the drive system is <ln numlevel="1" lineno="244" slineno="1-221"/>engaged.</subsection><subsection ssid="5-5-160" dnum="c-o" numlevel="1" lineno="245" slineno="1-222" level="2"><display>(c)</display>"Moped" does not include:<subsection ssid="5-5-161" dnum="i-o" numlevel="1" lineno="246" slineno="1-223" level="3"><display>(i)</display>an electric assisted bicycle; or</subsection><subsection ssid="5-5-162" dnum="ii-o" numlevel="1" lineno="247" slineno="1-224" level="3"><display>(ii)</display>a motor assisted scooter.</subsection></subsection></subsection><subsection ssid="5-5-163" dnum="44-o" numlevel="1" lineno="248" slineno="1-225" level="1" space="false"><display>(44)</display><subsection ssid="5-5-164" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Motor assisted scooter" means a self-propelled device with:<subsection ssid="5-5-165" dnum="i-o" numlevel="1" lineno="249" slineno="1-226" level="3" tab="1"><display>(i)</display>at least two wheels in contact with the ground;</subsection><subsection ssid="5-5-166" ssid="5-5-167" dnum="iii-o" numlevel="1" lineno="251" slineno="1-228" level="3" tab="1"><display>(iii)</display>an electric motor not exceeding 2,000 watts;</subsection><subsection ssid="5-5-168" dnum="iv-o" numlevel="1" lineno="252" slineno="1-229" level="3" tab="1"><display>(iv)</display>either:<subsection ssid="5-5-169" dnum="A-o" numlevel="1" lineno="253" slineno="1-230" level="4"><display>(A)</display>handlebars and a deck design for a person to stand while operating the device; <ln numlevel="1" lineno="254" slineno="1-231"/>or</subsection><subsection ssid="5-5-170" dnum="B-o" numlevel="1" lineno="255" slineno="1-232" level="4"><display>(B)</display>handlebars and a seat designed for a person to sit, straddle, or stand while <ln numlevel="1" lineno="256" slineno="1-233"/>operating the device;</subsection></subsection><subsection ssid="5-5-171" dnum="v-o" numlevel="1" lineno="257" slineno="1-234" level="3" tab="1"><display>(v)</display>a design for the ability to be propelled by human power alone; and</subsection><subsection ssid="5-5-172" dnum="vi-o" numlevel="1" lineno="258" slineno="1-235" level="3" tab="1"><display>(vi)</display>a maximum speed of 20 miles per hour on a paved level surface.</subsection></subsection><subsection ssid="5-5-173" dnum="b-o" numlevel="1" lineno="259" slineno="1-236" level="2"><display>(b)</display>"Motor assisted scooter" does not include:<subsection ssid="5-5-174" dnum="i-o" numlevel="1" lineno="260" slineno="1-237" level="3"><display>(i)</display>an electric assisted bicycle; or</subsection><subsection ssid="5-5-175" dnum="ii-o" numlevel="1" lineno="261" slineno="1-238" level="3"><display>(ii)</display>a motor-driven cycle.</subsection></subsection></subsection><subsection ssid="5-5-176" dnum="45-o" numlevel="1" lineno="262" slineno="1-239" level="1" space="false"><display>(45)</display><subsection ssid="5-5-177" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Motor vehicle" level="3"><display>(iv)</display>an electric assisted bicycle;</subsection><subsection ssid="5-5-183" dnum="v-o" numlevel="1" lineno="270" slineno="1-247" level="3"><display>(v)</display>a motor assisted scooter;</subsection><subsection ssid="5-5-184" dnum="vi-o" numlevel="1" lineno="271" slineno="1-248" level="3"><display>(vi)</display>a personal delivery device, as defined in Section <xref depth="3" refnumber="41-6a-1119">41-6a-1119</xref>; or</subsection><subsection ssid="5-5-185" dnum="vii-o" numlevel="1" lineno="272" slineno="1-249" level="3"><display>(vii)</display>a mobile carrier, as defined in Section <xref depth="3" refnumber="41-6a-1120">41-6a-1120</xref>.</subsection></subsection></subsection><subsection ssid="5-5-186" dnum="46-o" numlevel="1" lineno="273" slineno="1-250" level="1"><display>(48)</display>"Off-highway implement of husbandry" means the same as that term is defined under <ln numlevel="1" lineno="292" slineno="1-269"/>Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="5-5-198" dnum="49-o" numlevel="1" lineno="293" slineno="1-270" level="1"><display>(49)</display>"Off-highway vehicle" means the same as that term is defined under Section <xref depth="3" refnumber="41-22-2">41-22-2</xref>.</subsection><subsection ssid="5-5-199" dnum="50-o" numlevel="1" lineno="294" slineno="1-271" level="1"><display>(50)</display>"Operate" means the same as that term is defined in Section <xref depth="3" refnumber="41-1a-102">41-1a-102</xref>.</subsection><subsection ssid="5-5-200" dnum="51-o" numlevel="1" lineno="295" slineno="1-272" level="1"><display>(51)</display>"Operator" means:<subsection ssid="5-5-201" dnum="a-o" numlevel="1" lineno="296" slineno="1-273" level="2"><display>(a)</display>a human driver, as defined in Section <xref depth="3" refnumber="41-26-102.1">41-26-102.1</xref>, that operates a vehicle; or</subsection><subsection ssid="5-5-202" dnum="b-o" numlevel="1" lineno="297" slineno="1-274" level="2"><display>(b)</display>an automated driving system, as defined in Section <xref depth="3" refnumber="41-26-102.1">41-26-102.1</xref>, that operates a <ln numlevel="1" lineno="298" slineno="1-275"/>vehicle.</subsection></subsection><subsection ssid="5-5-203" dnum="52-o" numlevel="1" lineno="299" slineno="1-276" level="1"><display>(52)</display>"Other on-track equipment" means a railroad car, hi-rail vehicle, rolling stock, or other <ln numlevel="1" lineno="300" slineno="1-277"/>device operated, alone or coupled with another device, on stationary rails.</subsection><subsection ssid="5-5-204" dnum="53-o" numlevel="1" lineno="301" slineno="1-278" level="1" space="false"><display>(53)</display><subsection ssid="5-5-205" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Park" or "parking" means the standing of a vehicle, whether the vehicle is <ln numlevel="1" lineno="302" slineno="1-279"/>occupied or not.</subsection><subsection ssid="5-5-206" dnum="b-o" numlevel="1" lineno="303" slineno="1-280" level="2"><display>(b)</display>"Park" or "parking" does not include:<subsection ssid="5-5-207" dnum="i-o" numlevel="1" lineno="304" slineno="1-281" level="3"><display>(i)</display>the standing of a vehicle temporarily for the purpose of and while actually <ln numlevel="1" lineno="305" slineno="1-282"/>engaged in loading or unloading property or passengers; or</subsection><subsection ssid="5-5-208" dnum="ii-o" numlevel="1" lineno="306" slineno="1-283" level="3"><display>(ii)</display>a motor vehicle with an engaged automated driving system that has achieved a <ln numlevel="1" lineno="307" slineno="1-284"/>minimal risk condition, as those terms are defined in Section <xref depth="3" refnumber="41-26-102.1">41-26-102.1</xref>.</subsection></subsection></subsection><subsection ssid="5-5-209" dnum="54-o" numlevel="1" lineno="308" slineno="1-285" level="1"><display>(54)</display>"Peace officer" means a peace officer authorized under Title 53, Chapter 13, Peace <ln numlevel="1" lineno="309" slineno="1-286"/>Officer Classifications, to direct or regulate traffic or to make arrests for violations of <ln numlevel="1" lineno="310" slineno="1-287"/>traffic laws.</subsection><subsection ssid="5-5-210" dnum="55-o" numlevel="1" lineno="311" slineno="1-288" level="1"><display>(55)</display>"Pedestrian" means a person traveling:<subsection ssid="5-5-211" dnum="a-o" numlevel="1" lineno="312" slineno="1-289" level="2"><display>(a)</display>on foot; or</subsection><subsection ssid="5-5-212" dnum="b-o" numlevel="1" lineno="313" slineno="1-290" level="2"><display>(b)</display>in a wheelchair.</subsection></subsection><subsection ssid="5-5-213" dnum="56-o" numlevel="1" lineno="314" slineno="1-291" level="1"><display>(56)</display>"Pedestrian traffic-control signal" means a traffic-control signal used to regulate <ln numlevel="1" lineno="315" slineno="1-292"/>pedestrians.</subsection><subsection ssid="5-5-214" dnum="57-o" numlevel="1" lineno="316" slineno="1-293" level="1"><display>(57)</display>"Person" means a natural person, firm, copartnership, association, corporation, <ln numlevel="1" lineno="317" slineno="1-294"/>business trust, estate, trust, partnership, limited liability company, association, joint <ln numlevel="1" lineno="318" slineno="1-295"/>venture, governmental agency, public corporation, or any other legal or commercial <ln numlevel="1" lineno="319" slineno="1-296"/>entity.</subsection><subsection ssid="5-5-215" dnum="58-o" numlevel="1" lineno="320" slineno="1-297" level="1"><display>(58)</display>"Pole trailer" means a vehicle without motive power:<subsection ssid="5-5-216" dnum="a-o" numlevel="1" lineno="321" slineno="1-298" level="2"><display>(a)</display>designed to be drawn by another vehicle and attached to the towing vehicle by means <ln numlevel="1" lineno="322" slineno="1-299"/>of a reach, or pole, or by being boomed or otherwise secured to the towing vehicle; <ln numlevel="1" lineno="323" slineno="1-300"/>and</subsection><subsection ssid="5-5-217" dnum="b-o" numlevel="1" lineno="324" slineno="1-301" level="2"><display>(b)</display>that is ordinarily used for transporting long or irregular shaped loads including poles, <ln numlevel="1" lineno="325" slineno="1-302"/>pipes, or structural members generally capable of sustaining themselves as beams <ln numlevel="1" lineno="326" slineno="1-303"/>between the supporting connections.</subsection></subsection><subsection ssid="5-5-218" dnum="59-o" numlevel="1" lineno="327" slineno="1-304" level="1"><display>(59)</display>"Private road or driveway" means every way or place in private ownership and used <ln numlevel="1" lineno="328" slineno="1-305"/>for vehicular travel by the owner and those having express or implied permission from <ln numlevel="1" lineno="329" slineno="1-306"/>the owner, but not by other persons.</subsection><subsection ssid="5-5-219" dnum="60-o" numlevel="1" lineno="330" slineno="1-307" level="1"><display>(60)</display>"Programmable electric assisted bicycle" means an electric assisted bicycle with <ln numlevel="1" lineno="331" slineno="1-308"/>capability to switch or be programmed to function as a class 1 electric assisted bicycle, <ln numlevel="1" lineno="332" slineno="1-309"/>class 2 electric assisted bicycle, or class 3 electric assisted bicycle, provided that the <ln numlevel="1" lineno="333" slineno="1-310"/>electric assisted bicycle fully conforms with the respective requirements of each class of <ln numlevel="1" lineno="334" slineno="1-311"/>electric assisted bicycle when operated in that mode.</subsection><subsection ssid="5-5-220" dnum="61-o" numlevel="1" lineno="335" slineno="1-312" level="1"><display>(61)</display>"Railroad" means a carrier of persons or property upon cars operated on stationary rails.</subsection><subsection ssid="5-5-221" dnum="62-o" numlevel="1" lineno="336" slineno="1-313" level="1"><display>(62)</display>"Railroad sign or signal" means a sign, signal, or device erected by authority of a <ln numlevel="1" lineno="337" slineno="1-314"/>public body or official or by a railroad and intended to give notice of the presence of <ln numlevel="1" lineno="338" slineno="1-315"/>railroad tracks or the approach of a railroad train.</subsection><subsection ssid="5-5-222" dnum="63-o" numlevel="1" lineno="339" slineno="1-316" level="1"><display>(63)</display>"Railroad train" means a locomotive propelled by any form of energy, coupled with or <ln numlevel="1" lineno="340" slineno="1-317"/>operated without cars, and operated upon rails.</subsection><subsection ssid="5-5-223" dnum="64-o" numlevel="1" lineno="341" slineno="1-318" level="1"><display>(64)</display>"Restored-modified vehicle" means the same as the term defined in Section <xref depth="3" refnumber="41-1a-102">41-1a-102</xref>.</subsection><subsection ssid="5-5-224" dnum="65-o" numlevel="1" lineno="342" slineno="1-319" level="1"><display>(65)</display>"Right-of-way" means the right of one vehicle or pedestrian to proceed in a lawful <ln numlevel="1" lineno="343" slineno="1-320"/>manner in preference to another vehicle or pedestrian approaching under circumstances <ln numlevel="1" lineno="344" slineno="1-321"/>of direction, speed, and proximity that give rise to danger of collision unless one grants <ln numlevel="1" lineno="345" slineno="1-322"/>precedence to the other.</subsection><subsection ssid="5-5-225" dnum="66-o" numlevel="1" lineno="346" slineno="1-323" level="1" space="false"><display>(66)</display><subsection ssid="5-5-226" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Roadway" means that portion of highway improved, designed, or ordinarily <ln numlevel="1" lineno="347" slineno="1-324"/>used for vehicular travel.</subsection><subsection ssid="5-5-227" dnum="b-o" numlevel="1" lineno="348" slineno="1-325" level="2"><display>(b)</display>"Roadway" does not include the sidewalk, berm, or shoulder, even though any of <ln numlevel="1" lineno="349" slineno="1-326"/>them are used by persons riding bicycles or other human-powered vehicles.</subsection><subsection ssid="5-5-228" dnum="c-o" numlevel="1" lineno="350" slineno="1-327" level="2"><display>(c)</display>"Roadway" refers to any roadway separately but not to all roadways collectively, if a <ln numlevel="1" lineno="351" slineno="1-328"/>highway includes two or more separate roadways.</subsection></subsection><subsection ssid="5-5-229" dnum="67-o" numlevel="1" lineno="352" slineno="1-329" level="1"><display>(67)</display>"Safety zone" means the area or space officially set apart within a roadway for the <ln numlevel="1" lineno="353" slineno="1-330"/>exclusive use of pedestrians and that is protected, marked, or indicated by adequate <ln numlevel="1" lineno="354" slineno="1-331"/>signs as to be plainly visible at all times while set apart as a safety zone.</subsection><subsection ssid="5-5-230" dnum="68-o" numlevel="1" lineno="355" slineno="1-332" level="1" space="false"><display>(68)</display><subsection ssid="5-5-231" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"School bus" means a motor vehicle that:<subsection ssid="5-5-232" dnum="i-o" numlevel="1" lineno="356" slineno="1-333" level="3" tab="1"><display>(i)</display>complies with the color and identification requirements of the most recent edition <ln numlevel="1" lineno="357" slineno="1-334"/>of "Minimum Standards for School Buses"; and</subsection><subsection ssid="5-5-233" dnum="ii-o" numlevel="1" lineno="358" slineno="1-335" level="3" tab="1"><display>(ii)</display>is used to transport school children to or from school or school activities.</subsection></subsection><subsection ssid="5-5-234" dnum="b-o" numlevel="1" lineno="359" slineno="1-336" level="2"><display>(b)</display>"School bus" does not include a vehicle operated by a common carrier in <ln numlevel="1" lineno="360" slineno="1-337"/>transportation of school children to or from school or school activities.</subsection></subsection><subsection ssid="5-5-235" dnum="69-o" numlevel="1" lineno="361" slineno="1-338" level="1" space="false"><display>(69)</display><subsection ssid="5-5-236" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Semitrailer" means a vehicle with or without motive power:<subsection ssid="5-5-237" dnum="i-o" numlevel="1" lineno="362" slineno="1-339" level="3" tab="1"><display>(i)</display>designed for carrying persons or property and for being drawn by a motor vehicle; <ln numlevel="1" lineno="363" slineno="1-340"/>and</subsection><subsection ssid="5-5-238" dnum="ii-o" numlevel="1" lineno="364" slineno="1-341" level="3" tab="1"><display>(ii)</display>constructed so that some part of its weight and that of its load rests on or is <ln numlevel="1" lineno="365" slineno="1-342"/>carried by another vehicle.</subsection></subsection><subsection ssid="5-5-239" dnum="b-o" numlevel="1" lineno="366" slineno="1-343" level="2"><display>(b)</display>"Semitrailer" does not include a pole trailer.</subsection></subsection><subsection ssid="5-5-240" dnum="70-o" numlevel="1" lineno="367" slineno="1-344" level="1"><display>(70)</display>"Shoulder area" means:<subsection ssid="5-5-241" dnum="a-o" numlevel="1" lineno="368" slineno="1-345" level="2"><display>(a)</display>that area of the hard-surfaced highway separated from the roadway by a pavement <ln numlevel="1" lineno="369" slineno="1-346"/>edge line as established in the current approved "Manual on Uniform Traffic Control <ln numlevel="1" lineno="370" slineno="1-347"/>Devices"; or</subsection><subsection ssid="5-5-242" dnum="b-o" numlevel="1" lineno="371" slineno="1-348" level="2"><display>(b)</display>that portion of the road contiguous to the roadway for accommodation of stopped <ln numlevel="1" lineno="372" slineno="1-349"/>vehicles, for emergency use, and for lateral support.</subsection></subsection><subsection ssid="5-5-243" dnum="71-o" numlevel="1" lineno="373" slineno="1-350" level="1"><display>(71)</display>"Sidewalk" means that portion of a street between the curb lines, or the lateral lines of <ln numlevel="1" lineno="374" slineno="1-351"/>a roadway, and the adjacent property lines intended for the use of pedestrians.</subsection><subsection ssid="5-5-244" dnum="72-o" numlevel="1" lineno="375" slineno="1-352" level="1" space="false"><display>(72)</display><subsection ssid="5-5-245" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Soft-surface trail" means a marked trail surfaced with sand, rock, or dirt that is <ln numlevel="1" lineno="376" slineno="1-353"/>designated for the use of a bicycle.</subsection><subsection ssid="5-5-246" dnum="b-o" numlevel="1" lineno="377" slineno="1-354" level="2"><display>(b)</display>"Soft-surface trail" does not mean a trail:<subsection ssid="5-5-247" dnum="i-o" numlevel="1" lineno="378" slineno="1-355" level="3"><display>(i)</display>where the use of a motor vehicle or an electric assisted bicycle is prohibited by a <ln numlevel="1" lineno="379" slineno="1-356"/>federal law, regulation, or rule; or</subsection><subsection ssid="5-5-248" dnum="ii-o" numlevel="1" lineno="380" slineno="1-357" level="3"><display>(ii)</display>located in whole or in part on land granted to the state or a political subdivision <ln numlevel="1" lineno="381" slineno="1-358"/>subject to a conservation easement that prohibits the use of a motorized vehicle.</subsection></subsection></subsection><subsection ssid="5-5-249" dnum="73-o" numlevel="1" lineno="382" slineno="1-359" level="1"><display>(73)</display>"Solid rubber tire" means a tire of rubber or other resilient material that does not <ln numlevel="1" lineno="383" slineno="1-360"/>depend on compressed air for the support of the load.</subsection><subsection ssid="5-5-250" dnum="74-o" numlevel="1" lineno="384" slineno="1-361" level="1"><display>(74)</display>"Stand" or "standing" means the temporary halting of a vehicle, whether occupied or <ln numlevel="1" lineno="385" slineno="1-362"/>not, for the purpose of and while actually engaged in receiving or discharging <ln numlevel="1" lineno="386" slineno="1-363"/>passengers.</subsection><subsection ssid="5-5-251" dnum="75-o" numlevel="1" lineno="387" slineno="1-364" level="1"><display>(75)</display>"Stop" when required means complete cessation from movement.</subsection><subsection ssid="5-5-252" dnum="76-o" numlevel="1" lineno="388" slineno="1-365" level="1"><display>(76)</display>"Stop" or "stopping" when prohibited means any halting even momentarily of a <ln numlevel="1" lineno="389" slineno="1-366"/>vehicle, whether occupied or not, except when:<subsection ssid="5-5-253" dnum="a-o" numlevel="1" lineno="390" slineno="1-367" level="2"><display>(a)</display>necessary to avoid conflict with other traffic; or</subsection><subsection ssid="5-5-254" dnum="b-o" numlevel="1" lineno="391" slineno="1-368" level="2"><display>(b)</display>in compliance with the directions of a peace officer or traffic-control device.</subsection></subsection><subsection ssid="5-5-255" dnum="77-o" numlevel="1" lineno="392" slineno="1-369" level="1"><display>(77)</display>"Street-legal all-terrain vehicle" or "street-legal ATV" means an all-terrain type I <ln numlevel="1" lineno="393" slineno="1-370"/>vehicle, all-terrain type II vehicle, or all-terrain type III vehicle, that is modified to meet <ln numlevel="1" lineno="394" slineno="1-371"/>the requirements of Section <xref depth="3" refnumber="41-6a-1509">41-6a-1509</xref> to operate on highways in the state in <ln numlevel="1" lineno="395" slineno="1-372"/>accordance with Section <xref depth="3" refnumber="41-6a-1509">41-6a-1509</xref>.</subsection><subsection ssid="5-5-256" dnum="78-o" numlevel="1" lineno="396" slineno="1-373" level="1"><display>(78)</display>"Street-legal novel vehicle" means a vehicle registered as a novel vehicle under <ln numlevel="1" lineno="397" slineno="1-374"/>Section <xref depth="3" refnumber="41-27-201">41-27-201</xref> that is modified to meet the requirements of Section <xref depth="3" refnumber="41-6a-1509">41-6a-1509</xref> to <ln numlevel="1" lineno="398" slineno="1-375"/>operate on highways in the state in accordance<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="ahaskell" level="1" deltag="both"> with</amend><amendoutend style="2"/> with Section <xref depth="3" refnumber="41-6a-1509">41-6a-1509</xref>.</subsection><subsection ssid="5-5-257" dnum="79-o" numlevel="1" lineno="399" slineno="1-376" level="1"><display>(79)</display>"Tow truck operator" means the same as that term is defined in Section <xref depth="3" refnumber="72-9-102">72-9-102</xref>.</subsection><subsection ssid="5-5-258" dnum="80-o" numlevel="1" lineno="400" slineno="1-377" level="1"><display>(80)</display>"Tow truck motor carrier" means the same as that term is defined in Section <xref depth="3" refnumber="72-9-102">72-9-102</xref>.</subsection><subsection ssid="5-5-259" dnum="81-o" numlevel="1" lineno="401" slineno="1-378" level="1"><display>(81)</display>"Traffic" means pedestrians, ridden or herded animals, vehicles, and other <ln numlevel="1" lineno="402" slineno="1-379"/>conveyances either singly or together while using any highway for the purpose of travel.</subsection><subsection ssid="5-5-260" dnum="82-o" numlevel="1" lineno="403" slineno="1-380" level="1"><display>(82)</display>"Traffic signal preemption device" means an instrument or mechanism designed, <ln numlevel="1" lineno="404" slineno="1-381"/>intended, or used to interfere with the operation or cycle of a traffic-control signal.</subsection><subsection ssid="5-5-261" dnum="83-o" numlevel="1" lineno="405" slineno="1-382" level="1"><display>(83)</display>"Traffic-control device" means a sign, signal, marking, or device not inconsistent with <ln numlevel="1" lineno="406" slineno="1-383"/>this chapter placed or erected by a highway authority for the purpose of regulating, <ln numlevel="1" lineno="407" slineno="1-384"/>warning, or guiding traffic.</subsection><subsection ssid="5-5-262" dnum="84-o" numlevel="1" lineno="408" slineno="1-385" level="1"><display>(84)</display>"Traffic-control signal" means a device, whether manually, electrically, or <ln numlevel="1" lineno="409" slineno="1-386"/>mechanically operated, by which traffic is alternately directed to stop and permitted to <ln numlevel="1" lineno="410" slineno="1-387"/>proceed.</subsection><subsection ssid="5-5-263" dnum="85-o" numlevel="1" lineno="411" slineno="1-388" level="1" space="false"><display>(85)</display><subsection ssid="5-5-264" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Trailer" means a vehicle with or without motive power designed for carrying <ln numlevel="1" lineno="412" slineno="1-389"/>persons or property and for being drawn by a motor vehicle and constructed so that <ln numlevel="1" lineno="413" slineno="1-390"/>no part of its weight rests upon the towing vehicle.</subsection><subsection ssid="5-5-265" dnum="b-o" numlevel="1" lineno="414" slineno="1-391" level="2"><display>(b)</display>"Trailer" does not include a pole trailer.</subsection></subsection><subsection ssid="5-5-266" dnum="86-o" numlevel="1" lineno="415" slineno="1-392" level="1"><display>(86)</display>"Truck" means a motor vehicle designed, used, or maintained primarily for the <ln numlevel="1" lineno="416" slineno="1-393"/>transportation of property.</subsection><subsection ssid="5-5-267" dnum="87-o" numlevel="1" lineno="417" slineno="1-394" level="1"><display>(87)</display>"Truck tractor" means a motor vehicle:<subsection ssid="5-5-268" dnum="a-o" numlevel="1" lineno="418" slineno="1-395" level="2"><display>(a)</display>designed and used primarily for drawing other vehicles; and</subsection><subsection ssid="5-5-269" dnum="b-o" numlevel="1" lineno="419" slineno="1-396" level="2"><display>(b)</display>constructed to carry a part of the weight of the vehicle and load drawn by the truck <ln numlevel="1" lineno="420" slineno="1-397"/>tractor.</subsection></subsection><subsection ssid="5-5-270" dnum="88-o" numlevel="1" lineno="421" slineno="1-398" level="1"><display>(88)</display>"Two-way left turn lane" means a lane:<subsection ssid="5-5-271" dnum="a-o" numlevel="1" lineno="422" slineno="1-399" level="2"><display>(a)</display>provided for vehicle operators making left turns in either direction;</subsection><subsection ssid="5-5-272" dnum="b-o" numlevel="1" lineno="423" slineno="1-400" level="2"><display>(b)</display>that is not used for passing, overtaking, or through travel; and</subsection><subsection ssid="5-5-273" dnum="c-o" numlevel="1" lineno="424" slineno="1-401" level="2"><display>(c)</display>that has been indicated by a lane traffic-control device that may include lane <ln numlevel="1" lineno="425" slineno="1-402"/>markings.</subsection></subsection><subsection ssid="5-5-274" dnum="89-o" numlevel="1" lineno="426" slineno="1-403" level="1"><display>(89)</display>"Urban district" means the territory contiguous to and including any street, in which <ln numlevel="1" lineno="427" slineno="1-404"/>structures devoted to business, industry, or dwelling houses are situated at intervals of <ln numlevel="1" lineno="428" slineno="1-405"/>less than 100 feet, for a distance of a quarter of a mile or more.</subsection><subsection ssid="5-5-275" dnum="90-o" numlevel="1" lineno="429" slineno="1-406" level="1"><display>(90)</display>"Vehicle" means a device in, on, or by which a person or property is or may be <ln numlevel="1" lineno="430" slineno="1-407"/>transported or drawn on a highway, except a mobile carrier, as defined in Section <xref depth="3" refnumber="41-6a-1120"><ln numlevel="1" lineno="431" slineno="1-408"/>41-6a-1120</xref>, or a device used exclusively on stationary rails or tracks.</subsection></section></bsec><bsec buid="8" num="41-6a-1103" type="amend" src="code" uid="C41-6a-S1103_2025050720250507" sort="41 06a11030020250507" numlevel="1" lineno="432" slineno="2-1" sn="2"><section number="41-6a-1103" numlevel="1" lineno="433" slineno="2-2" type="amend"><secline lineno="432">Section 2, Section <bold>41-6a-1103</bold> is amended to read:</secline><catline lineno="433"><bold>41-6a-1103. and</amend></subsection><subsection ssid="10-31" dnum="_-o:b-i" numlevel="1" lineno="472" slineno="3-34" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1301" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="90" style="1" owner="ahaskell" level="1" amendtag="end">give an audible signal before overtaking and passing a pedestrian.</amend></subsection></subsection><subsection ssid="10-22" dnum="_-o:3-i" numlevel="1" lineno="473" slineno="3-35" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1302" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="53" style="1" owner="ahaskell" level="1" amendtag="end">An individual 18 years old or older may not operate a device described in Subsection <xref refnumber="41-6a-1106(1)" depth="4">(1)</xref> <ln numlevel="1" lineno="474" slineno="3-36"/>on a sidewalk, path, or trail, or across a roadway in a crosswalk, where prohibited by a <ln numlevel="1" lineno="475" slineno="3-37"/>traffic control device or ordinance.</amend></subsection><subsection ssid="10-23" dnum="_-o:4-i" numlevel="1" lineno="476" slineno="3-38" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1303" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="57" style="1" owner="ahaskell" level="1" amendtag="end">An individual may not operate a device described in Subsection <xref refnumber="41-6a-1106(1)" depth="4">(1)</xref> in a negligent <ln numlevel="1" lineno="477" slineno="3-39"/>manner so as to collide with:</amend><subsection ssid="10-33" dnum="_-o:a-i" numlevel="1" lineno="478" slineno="3-40" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1304" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="97" style="1" owner="ahaskell" level="1" amendtag="end">a pedestrian; or</amend></subsection><subsection ssid="10-34" dnum="_-o:b-i" numlevel="1" lineno="479" slineno="3-41" ea="amend" anum="0" owner="ahaskell" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1305" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="101" style="1" owner="ahaskell" level="1" amendtag="end">another device described in Subsection <xref refnumber="41-6a-1106(1)" depth="4">(1)</xref>.</amend></subsection></subsection><subsection ssid="10-37" dnum="_-o:5-i" numlevel="1" lineno="480" slineno="3-42" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1306" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="107" style="1" owner="ahaskell" level="1" amendtag="end">An individual may not operate a device described in Subsection <xref refnumber="10-15">(1)</xref> on a sidewalk, path, <ln numlevel="1" lineno="481" slineno="3-43"/>or trail, or across a driveway, or across a roadway in a crosswalk at a speed greater than <ln numlevel="1" lineno="482" slineno="3-44"/>is reasonable and prudent under the existing conditions, giving regard to actual and <ln numlevel="1" lineno="483" slineno="3-45"/>potential hazards.</amend></subsection><subsection ssid="10-27" dnum="_-o:6-i" numlevel="1" lineno="484" slineno="3-46" ea="amend" anum="0" owner="ahaskell" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1307" style="1" owner="i" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="100" groupid="73" style="1" owner="ahaskell" level="1" amendtag="end">Except as provided under Subsection <xref refnumber="41-6a-1106(2)" depth="4">(2)</xref>, an individual operating a device described in <ln numlevel="1" lineno="485" slineno="3-47"/>Subsection <xref refnumber="41-6a-1106(1)" depth="4">(1)</xref> on a sidewalk, path, trail, or across a roadway in a crosswalk, has all the <ln numlevel="1" lineno="486" slineno="3-48"/>rights and duties applicable to a pedestrian under the same circumstances.</amend></subsection></section></bsec><bsec buid="3" num="41-6a-1505" type="amend" src="code" uid="C41-6a-S1505_2025050720250507" sort="41 06a15050020250507" numlevel="1" lineno="487" slineno="4-1" sn="4"><section number="41-6a-1505" numlevel="1" lineno="488" slineno="4-2" type="amend"><secline lineno="487">Section 4, Section <bold>41-6a-1505</bold> is amended to read:</secline><catline lineno="488"><bold>41-6a-1505. Motorcycle or motor-driven cycle -- Protective headgear -- Closed <ln numlevel="1" lineno="489" slineno="4-3"/>cab excepted -- Electric assisted bicycles, motor assisted scooters, electric personal <ln numlevel="1" lineno="490" slineno="4-4"/>assistive mobility devices.</bold></catline><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="491" slineno="4-5" level="1" placement="noreturn"><display>(1)</display>A person under the age of 21 may not operate or ride any of the following on a highway <ln numlevel="1" lineno="492" slineno="4-6"/>unless the person is wearing protective headgear that complies with specifications <ln numlevel="1" lineno="493" slineno="4-7"/>adopted under Subsection <xref depth="4" refnumber="41-6a-1505(3)" start="0">(3)</xref>:<subsection ssid="3-3-2" dnum="a-o" numlevel="1" lineno="494" slineno="4-8" level="2"><display>(a)</display>a motorcycle;</subsection><subsection ssid="3-3-3" dnum="b-o" numlevel="1" lineno="495" slineno="4-9" level="2"><display>(b)</display>a motor-driven cycle;</subsection><subsection ssid="3-3-4" dnum="c-o" numlevel="1" lineno="496" slineno="4-10" level="2"><display>(c)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="ahaskell" level="1" deltag="both">a class 3 </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="ahaskell" level="1" amendtag="both" space="true">an </amend>electric assisted bicycle; or</subsection><subsection ssid="3-3-5" dnum="d-o" numlevel="1" lineno="497" slineno="4-11" level="2"><display>(d)</display>an autocycle that is not fully enclosed.</subsection></subsection><subsection ssid="3-3-6" dnum="2-o" numlevel="1" lineno="498" slineno="4-12" level="1"><display>(2)</display>This section does not apply to persons riding within an enclosed cab.</subsection><subsection ssid="3-3-7" dnum="3-o" numlevel="1" lineno="499" slineno="4-13" level="1"><display>(3)</display>The following standards and specifications for protective headgear are adopted:<subsection ssid="3-3-8" dnum="a-o" numlevel="1" lineno="500" slineno="4-14" level="2"><display>(a)</display>49 C.F.R. 571.218 related to protective headgear for motorcycles; and</subsection><subsection ssid="3-3-9" dnum="b-o" numlevel="1" lineno="501" slineno="4-15" level="2"><display>(b)</display>16 C.F.R. Part 1203 related to protective headgear for bicycles, motor assisted <ln numlevel="1" lineno="502" slineno="4-16"/>scooters, and electric personal assistive mobility devices.</subsection></subsection><subsection ssid="3-3-10" dnum="4-o" numlevel="1" lineno="503" slineno="4-17" level="1"><display>(4)</display>A court shall waive $8 of a fine charged to a person operating a vehicle described in <ln numlevel="1" lineno="504" slineno="4-18"/>Subsection <xref depth="4" refnumber="41-6a-1505(1)" start="0">(1)</xref> for a moving traffic violation if the person was:<subsection ssid="3-3-11" dnum="a-o" numlevel="1" lineno="505" slineno="4-19" level="2"><display>(a)</display>21 years of age or older at the time of operation; and</subsection><subsection ssid="3-3-12" dnum="b-o" numlevel="1" lineno="506" slineno="4-20" level="2"><display>(b)</display>wearing protective headgear that complies with the specifications adopted under <ln numlevel="1" lineno="507" slineno="4-21"/>Subsection <xref depth="4" refnumber="41-6a-1505(3)" start="0">(3)</xref> at the time of operation.</subsection></subsection><subsection ssid="3-3-13" dnum="5-o" numlevel="1" lineno="508" slineno="4-22" level="1"><display>(5)</display>The failure to wear protective headgear:<subsection ssid="3-3-14" dnum="a-o" numlevel="1" lineno="509" slineno="4-23" level="2"><display>(a)</display>does not constitute contributory or comparative negligence on the part of a person <ln numlevel="1" lineno="510" slineno="4-24"/>seeking recovery for injuries; and</subsection><subsection ssid="3-3-15" dnum="b-o" numlevel="1" lineno="511" slineno="4-25" level="2"><display>(b)</display>may not be introduced as evidence in any civil litigation on the issue of negligence, <ln numlevel="1" lineno="512" slineno="4-26"/>injuries, or the mitigation of damages.</subsection></subsection><subsection ssid="3-3-16" dnum="6-o" numlevel="1" lineno="513" slineno="4-27" level="1"><display>(6)</display>Notwithstanding Subsection <xref depth="4" refnumber="41-6a-1505(4)" start="0">(4)</xref>, a court may not waive $8 of a fine charged to a person <ln numlevel="1" lineno="514" slineno="4-28"/>operating a motorcycle or motor-driven cycle for a driving under the influence violation <ln numlevel="1" lineno="515" slineno="4-29"/>of Section <xref depth="3" refnumber="41-6a-502" start="0">41-6a-502</xref>.</subsection><subsection ssid="3-3-17" dnum="7-o" numlevel="1" lineno="516" slineno="4-30" level="1"><display>(7)</display>A violation of this section is an infraction.</subsection></section></bsec><bsec buid="11" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="517" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="517">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="518"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="ahaskell" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/7/2025">May 7, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-7-25 12:03 PM</tm></rev></foot></leg>
