Section 1, Section 41-1a-233 is enacted to read:41-1a-233. Conditional registration for new commercial motor vehicles.(1)As used in this part:(a)"Manufacturer's statement of origin" means a statement or certificate from the motor vehicle manufacturer that shows:(i)the date of sale from the manufacturer to the first purchaser;(ii)the name of the first purchaser;(iii)a description of the motor vehicle, including the year, make, model, and vehicle identification number; and(iv)a certification that the motor vehicle was new when sold to the first purchaser.(b)"Passenger rental car establishment" means an establishment described in NAICS subsector 532111 of the 2022 North American Industry Classification System of the federal Executive Office of the President, Office of Management and Budget.(c)"Qualified identification number inspector" means the same as it is described in Section 41-1a-802.(2)The division may issue a conditional registration for a new motor vehicle that is a commercial vehicle if:(a)the owner:(i)is a passenger rental car establishment;(ii)has not received a manufacturer statement of origin;(iii)is entitled to a manufacturer statement of origin;(iv)has physical possession of the vehicle; and(v)has paid all applicable taxes and fees for the vehicle; and(b)a qualified identification number inspector has:(i)physically inspected the identification number of the motor vehicle; and(ii)made a record of the identification number inspection on a form approved by the division.(3)(a)A conditional registration issued under Subsection (2) shall be in effect for a period of 12 months beginning with the first day of the calendar month of registration and does not expire until the last day of the same month in the following year.(b)An owner of a vehicle with a conditional registration may not renew the registration until a Utah title is obtained for the vehicle.(c)A vehicle with a conditional registration under this section may not be sold or transferred without first obtaining a Utah title.(4)A vehicle with a conditional registration under this section does not qualify for the alternative special registration card and registration decal described in Section 41-1a-232.(5)A commercial vehicle that is issued a conditional registration as provided in this section is subject to the same fees that would apply to the commercial vehicle if the registration was not a conditional registration.(6)A person shall submit a request for a conditional registration in a form prescribed by the division.
