Funding for charter schools.</bold></catline><subsection ssid="1-1-1" dnum="1-o" numlevel="1" lineno="37" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Except as described in Section <xref depth="3" refnumber="53F-2-302" start="0">53F-2-302</xref>, a charter school shall receive state funds, as <ln numlevel="1" lineno="38" slineno="1-4"/>applicable, on the same basis as a school district receives funds.</subsection><subsection ssid="1-1-2" dnum="2-o" numlevel="1" lineno="39" slineno="1-5" level="1" space="false"><display>(2)</display><subsection ssid="1-1-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As described in Section <xref depth="3" refnumber="53F-2-703" start="0">53F-2-703</xref>, the state board shall distribute charter school <ln numlevel="1" lineno="40" slineno="1-6"/>levy per pupil revenues to charter schools.</subsection><subsection ssid="1-1-4" dnum="b-o" numlevel="1" lineno="41" slineno="1-7" level="2"><display>(b)</display>As described in Section <xref depth="3" refnumber="53F-2-704" start="0">53F-2-704</xref>, and subject to future budget constraints, the <ln numlevel="1" lineno="42" slineno="1-8"/>Legislature shall provide an appropriation for charter schools for each charter school <ln numlevel="1" lineno="43" slineno="1-9"/>student enrolled on October 1 to supplement the allocation of charter school levy per <ln numlevel="1" lineno="44" slineno="1-10"/>pupil revenues described in Subsection <xref depth="4" refnumber="53F-2-702(2)(a)" start="0">(2)(a)</xref>.</subsection></subsection><subsection ssid="1-19" dnum="_-o:3-i" numlevel="1" lineno="45" slineno="1-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning in fiscal year 2027, the Legislature shall add to the appropriation described in <ln numlevel="1" lineno="46" slineno="1-12"/>Subsection (2)(b) an amount equal to the administrative funding provided to the State <ln numlevel="1" lineno="47" slineno="1-13"/>Charter School Board for fiscal year 2026, to be distributed to charter schools through <ln numlevel="1" lineno="48" slineno="1-14"/>the per pupil allocation.</amend></subsection><subsection ssid="1-1-5" dnum="3-o:4-i" numlevel="1" lineno="49" slineno="1-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1005" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>Charter schools are eligible to receive federal funds if they meet all applicable <ln numlevel="1" lineno="50" slineno="1-16"/>federal requirements and comply with relevant federal regulations.</subsection><subsection ssid="1-1-6" dnum="4-o:5-i" numlevel="1" lineno="51" slineno="1-17" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>The state board shall distribute funds for charter school students directly to the <ln numlevel="1" lineno="52" slineno="1-18"/>charter school.</subsection><subsection ssid="1-1-7" dnum="5-o:6-i" numlevel="1" lineno="53" slineno="1-19" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1007" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="1-1-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Notwithstanding Subsection <xref depth="4" refnumber="53F-2-702(1)" start="0">(1)</xref>, a charter school is not eligible to receive <ln numlevel="1" lineno="54" slineno="1-20"/>state transportation funding.</subsection><subsection ssid="1-1-9" dnum="b-o" numlevel="1" lineno="55" slineno="1-21" level="2"><display>(b)</display>The state board shall also adopt rules relating to the transportation of students to and <ln numlevel="1" lineno="56" slineno="1-22"/>from charter schools, taking into account Sections <xref depth="3" refnumber="53F-2-403" start="0">53F-2-403</xref> and <xref depth="3" refnumber="53G-6-405" start="0">53G-6-405</xref>.</subsection><subsection ssid="1-1-10" dnum="c-o" numlevel="1" lineno="57" slineno="1-23" level="2"><display>(c)</display>A charter school governing board may provide transportation through an agreement <ln numlevel="1" lineno="58" slineno="1-24"/>or contract with the local school board, a private provider, or parents.</subsection></subsection><subsection ssid="1-1-11" dnum="6-o:7-i" numlevel="1" lineno="59" slineno="1-25" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1011" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1012" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="1-1-12" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="1-1-13" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>In accordance with Section <xref depth="3" refnumber="53F-2-705" start="0">53F-2-705</xref>, the State Charter School Board <ln numlevel="1" lineno="60" slineno="1-26"/>may allocate grants for start-up costs to charter schools from money appropriated <ln numlevel="1" lineno="61" slineno="1-27"/>for charter school start-up costs.</subsection><subsection ssid="1-1-14" dnum="ii-o" numlevel="1" lineno="62" slineno="1-28" level="3" tab="1"><display>(ii)</display>The charter school governing board of a charter school that receives money from <ln numlevel="1" lineno="63" slineno="1-29"/>a grant under Section <xref depth="3" refnumber="53F-2-705" start="0">53F-2-705</xref> shall use the grant for expenses for planning and <ln numlevel="1" lineno="64" slineno="1-30"/>implementation of the charter school.</subsection></subsection><subsection ssid="1-1-15" dnum="b-o" numlevel="1" lineno="65" slineno="1-31" level="2"><display>(b)</display>The state board shall coordinate the distribution of federal money appropriated to <ln numlevel="1" lineno="66" slineno="1-32"/>help fund costs for establishing and maintaining charter schools within the state.</subsection></subsection><subsection ssid="1-1-16" dnum="7-o:8-i" numlevel="1" lineno="67" slineno="1-33" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(8)</amend></display><subsection ssid="1-1-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A charter school may receive, hold, manage and use any devise, bequest, <ln numlevel="1" lineno="68" slineno="1-34"/>grant, endowment, gift, or donation of any property made to the school for any of the <ln numlevel="1" lineno="69" slineno="1-35"/>purposes of <xref depth="1" refnumber="53G-5" start="0">Title 53G, Chapter 5, Charter Schools</xref>, or related provisions.</subsection><subsection ssid="1-1-18" dnum="b-o" numlevel="1" lineno="70" slineno="1-36" level="2"><display>(b)</display>It is unlawful for any person affiliated with a charter school to demand or request any <ln numlevel="1" lineno="71" slineno="1-37"/>gift, donation, or contribution from a parent, teacher, employee, or other person <ln numlevel="1" lineno="72" slineno="1-38"/>affiliated with the charter school as a condition for employment or enrollment at the <ln numlevel="1" lineno="73" slineno="1-39"/>school or continued attendance at the school.</subsection></subsection></section></bsec><bsec buid="3" num="53G-5-202" type="amend" src="code" uid="C53G-5-S202_2025070120250701" sort="53G05 02020020250701" numlevel="1" lineno="74" slineno="2-1" sn="2"><section number="53G-5-202" numlevel="1" lineno="75" slineno="2-2" type="amend"><secline lineno="74">Section 2, Section <bold>53G-5-202</bold> is amended to read:</secline><catline lineno="75"><bold>53G-5-202. Status and powers of State Charter School Board.</bold></catline><subsection ssid="3-3-1" dnum="1-o" numlevel="1" lineno="76" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The State Charter School Board may:<subsection ssid="3-3-2" dnum="a-o" numlevel="1" lineno="77" slineno="2-4" level="2"><display>(a)</display>enter into contracts;</subsection><subsection ssid="3-3-3" dnum="b-o" numlevel="1" lineno="78" slineno="2-5" level="2"><display>(b)</display>sue and be sued; and</subsection><subsection ssid="3-3-4" dnum="c-o" numlevel="1" lineno="79" slineno="2-6" level="2" space="false"><display>(c)</display><subsection ssid="3-3-5" dnum="i-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="3" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/></display>at the discretion of the charter school, provide administrative services to, or <ln numlevel="1" lineno="80" slineno="2-7"/>perform other school functions for, charter schools authorized by the State Charter <ln numlevel="1" lineno="81" slineno="2-8"/>School Board<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">; and</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="31" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="3-3-6" dnum="ii-o:_-i" numlevel="1" lineno="82" slineno="2-9" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="6" groupid="4" style="2" owner="jchristopherson" level="1" deltag="end">charge fees for the provision of services or functions.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="3-11" dnum="_-o:2-i" numlevel="1" lineno="83" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="end">The State Charter School Board shall:</amend><subsection ssid="3-14" dnum="_-o:a-i" numlevel="1" lineno="84" slineno="2-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="end">beginning July 1, 2026, charge fees to a charter school for authorization and <ln numlevel="1" lineno="85" slineno="2-12"/>oversight services; and</amend></subsection><subsection ssid="3-13" dnum="_-o:b-i" numlevel="1" lineno="86" slineno="2-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="end">before May 1, 2026, establish policies and procedures for the fee collection and use <ln numlevel="1" lineno="87" slineno="2-14"/>required in Subsection <xref refnumber="53G-5-202(2)(a)" depth="4">(2)(a)</xref>.</amend></subsection></subsection><subsection ssid="3-3-7" dnum="2-o:3-i" numlevel="1" lineno="88" slineno="2-15" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="i" level="1" amendtag="both" space="true">(3)</amend></display>The state board shall:<subsection ssid="3-3-8" dnum="a-o" numlevel="1" lineno="89" slineno="2-16" level="2"><display>(a)</display>approve the State Charter School Board's annual budget; and</subsection><subsection ssid="3-3-9" dnum="b-o" numlevel="1" lineno="90" slineno="2-17" level="2"><display>(b)</display>otherwise grant autonomy to the State Charter School Board to manage the State <ln numlevel="1" lineno="91" slineno="2-18"/>Charter School Board's budget.</subsection></subsection></section></bsec><bsec buid="4" num="53G-5-205" type="amend" src="code" uid="C53G-5-S205_2025070120250701" sort="53G05 02050020250701" numlevel="1" lineno="92" slineno="3-1" sn="3"><section number="53G-5-205" numlevel="1" lineno="93" slineno="3-2" type="amend"><secline lineno="92">Section 3, Section <bold>53G-5-205</bold> is amended to read:</secline><catline lineno="93"><bold>53G-5-205. Charter school authorizers -- Power and duties -- Charter <ln numlevel="1" lineno="94" slineno="3-3"/>application minimum standard.</bold></catline><subsection ssid="4-4-1" dnum="1-o" numlevel="1" lineno="95" slineno="3-4" level="1" placement="noreturn"><display>(1)</display>The following entities are eligible to authorize charter schools:<subsection ssid="4-4-2" dnum="a-o" numlevel="1" lineno="96" slineno="3-5" level="2"><display>(a)</display>the State Charter School Board;</subsection><subsection ssid="4-4-3" dnum="b-o" numlevel="1" lineno="97" slineno="3-6" level="2"><display>(b)</display>a local school board; or</subsection><subsection ssid="4-4-4" dnum="c-o" numlevel="1" lineno="98" slineno="3-7" level="2"><display>(c)</display>an institution of higher education board of trustees, as that term is defined in Section <xref depth="3" refnumber="53G-5-102"><ln numlevel="1" lineno="99" slineno="3-8"/>53G-5-102</xref>.</subsection></subsection><subsection ssid="4-4-5" dnum="2-o" numlevel="1" lineno="100" slineno="3-9" level="1"><display>(2)</display>A charter school authorizer shall:<subsection ssid="4-4-6" dnum="a-o" numlevel="1" lineno="101" slineno="3-10" level="2"><display>(a)</display>authorize and promote the establishment of charter schools;</subsection><subsection ssid="4-4-7" dnum="b-o" numlevel="1" lineno="102" slineno="3-11" level="2"><display>(b)</display>before an application for charter school authorization is submitted to a charter school <ln numlevel="1" lineno="103" slineno="3-12"/>authorizer, review and evaluate the proposal to support and strengthen the charter <ln numlevel="1" lineno="104" slineno="3-13"/>school authorization proposal;</subsection><subsection ssid="4-4-8" dnum="c-o" numlevel="1" lineno="105" slineno="3-14" level="2"><display>(c)</display>review and evaluate the performance of charter schools authorized by the authorizer <ln numlevel="1" lineno="106" slineno="3-15"/>and hold a charter school accountable for the performance measures established in <ln numlevel="1" lineno="107" slineno="3-16"/>the charter school's charter agreement;</subsection><subsection ssid="4-4-9" dnum="d-o" numlevel="1" lineno="108" slineno="3-17" level="2"><display>(d)</display>assist charter schools in understanding and carrying out the charter school's charter <ln numlevel="1" lineno="109" slineno="3-18"/>obligations; and</subsection><subsection ssid="4-4-10" dnum="e-o" numlevel="1" lineno="110" slineno="3-19" level="2"><display>(e)</display>provide technical support to charter schools and persons seeking to establish charter <ln numlevel="1" lineno="111" slineno="3-20"/>schools by:<subsection ssid="4-4-11" dnum="i-o" numlevel="1" lineno="112" slineno="3-21" level="3"><display>(i)</display>identifying and promoting successful charter school models;</subsection><subsection ssid="4-4-12" dnum="ii-o" numlevel="1" lineno="113" slineno="3-22" level="3"><display>(ii)</display>facilitating the application and approval process for charter school authorization; <ln numlevel="1" lineno="114" slineno="3-23"/>or</subsection><subsection ssid="4-4-13" dnum="iii-o" numlevel="1" lineno="115" slineno="3-24" level="3"><display>(iii)</display>directing charter schools and persons seeking to establish charter schools to <ln numlevel="1" lineno="116" slineno="3-25"/>sources of funding and support.</subsection></subsection></subsection><subsection ssid="4-32" dnum="_-o:3-i" numlevel="1" lineno="117" slineno="3-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">Beginning on July 1, 2026, an authorizer shall charge fees for authorization and <ln numlevel="1" lineno="118" slineno="3-27"/>oversight services. </amend></subsection><subsection ssid="4-4-14" dnum="3-o:4-i" numlevel="1" lineno="119" slineno="3-28" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1046" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>A charter school authorizer may:<subsection ssid="4-4-15" dnum="a-o" numlevel="1" lineno="120" slineno="3-29" level="2"><display>(a)</display>make recommendations to the Legislature on legislation pertaining to charter schools;</subsection><subsection ssid="4-4-16" dnum="b-o" numlevel="1" lineno="121" slineno="3-30" level="2"><display>(b)</display>make recommendations to the state board on charter school rules and charter school <ln numlevel="1" lineno="122" slineno="3-31"/>funding; or</subsection><subsection ssid="4-4-17" dnum="c-o" numlevel="1" lineno="123" slineno="3-32" level="2"><display>(c)</display>provide technical support, as requested, to another charter school authorizer relating <ln numlevel="1" lineno="124" slineno="3-33"/>to charter schools.</subsection></subsection><subsection ssid="4-4-18" dnum="4-o:5-i" numlevel="1" lineno="125" slineno="3-34" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1049" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1050" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display>Within 60 days after the day on which an authorizer approves an application for a <ln numlevel="1" lineno="126" slineno="3-35"/>new charter school, the state board may direct an authorizer to do the following if the <ln numlevel="1" lineno="127" slineno="3-36"/>authorizer or charter school applicant failed to follow statutory or state board rule <ln numlevel="1" lineno="128" slineno="3-37"/>requirements made in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="129" slineno="3-38"/>Rulemaking Act:<subsection ssid="4-4-19" dnum="a-o" numlevel="1" lineno="130" slineno="3-39" level="2"><display>(a)</display>reconsider the authorizer's approval of an application for a new charter school; and</subsection><subsection ssid="4-4-20" dnum="b-o" numlevel="1" lineno="131" slineno="3-40" level="2"><display>(b)</display>correct deficiencies in the charter school application or authorizer's application <ln numlevel="1" lineno="132" slineno="3-41"/>process as described in statute or state board rule, made in accordance with Title <ln numlevel="1" lineno="133" slineno="3-42"/>63G, Chapter 3, Utah Administrative Rulemaking Act, before approving the new <ln numlevel="1" lineno="134" slineno="3-43"/>application.</subsection></subsection><subsection ssid="4-4-21" dnum="5-o:6-i" numlevel="1" lineno="135" slineno="3-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1052" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1053" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>The state board shall, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="136" slineno="3-45"/>Rulemaking Act, make rules establishing minimum standards that a charter school <ln numlevel="1" lineno="137" slineno="3-46"/>authorizer is required to apply when<amend anum="0" ea="amend" pairid="178" groupid="138" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>evaluating a charter school application.</subsection><subsection ssid="4-4-22" dnum="6-o:7-i" numlevel="1" lineno="138" slineno="3-47" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1053" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1054" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>The minimum standards described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(6)</amend> shall include:<subsection ssid="4-4-23" dnum="a-o" numlevel="1" lineno="139" slineno="3-48" level="2"><display>(a)</display>reasonable consequences for an authorizer that fails to comply with statute or state <ln numlevel="1" lineno="140" slineno="3-49"/>board rule;</subsection><subsection ssid="4-4-24" dnum="b-o" numlevel="1" lineno="141" slineno="3-50" level="2"><display>(b)</display>a process for an authorizer to review:<subsection ssid="4-4-25" dnum="i-o" numlevel="1" lineno="142" slineno="3-51" level="3"><display>(i)</display>the skill and expertise of a proposed charter school's governing board; and</subsection><subsection ssid="4-4-26" dnum="ii-o" numlevel="1" lineno="143" slineno="3-52" level="3"><display>(ii)</display>the functioning operation of the charter school governing board of an authorized <ln numlevel="1" lineno="144" slineno="3-53"/>charter school;</subsection></subsection><subsection ssid="4-4-27" dnum="c-o" numlevel="1" lineno="145" slineno="3-54" level="2"><display>(c)</display>a process for an authorizer to review the financial viability of a proposed charter <ln numlevel="1" lineno="146" slineno="3-55"/>school and of an authorized charter school;</subsection><subsection ssid="4-4-28" dnum="d-o" numlevel="1" lineno="147" slineno="3-56" level="2"><display>(d)</display>a process to evaluate:<subsection ssid="4-4-29" dnum="i-o" numlevel="1" lineno="148" slineno="3-57" level="3"><display>(i)</display>how well an authorizer's authorized charter school complies with the charter <ln numlevel="1" lineno="149" slineno="3-58"/>school's charter agreement;</subsection><subsection ssid="4-4-30" dnum="ii-o" numlevel="1" lineno="150" slineno="3-59" level="3"><display>(ii)</display>whether an authorizer's authorized charter school maintains reasonable academic <ln numlevel="1" lineno="151" slineno="3-60"/>and education standards; and</subsection><subsection ssid="4-4-31" dnum="iii-o" numlevel="1" lineno="152" slineno="3-61" level="3"><display>(iii)</display>standards that an authorizer is required to meet to demonstrate the authorizer's <ln numlevel="1" lineno="153" slineno="3-62"/>capacity to oversee and evaluate the charter schools the authorizer authorizes.</subsection></subsection></subsection></section></bsec><bsec buid="6" num="53G-5-206" type="enact" src="code" uid="C53G-5-S206_2025070120250701" sort="53G05 02060020250701" numlevel="1" lineno="154" slineno="4-1" sn="4"><section numlevel="1" lineno="155" slineno="4-2" number="53G-5-206" type="enact"><secline lineno="154">Section 4, Section <bold>53G-5-206</bold> is enacted to read:</secline><catline lineno="155"><bold>53G-5-206. Charter school authorizer transfers.</bold></catline><subsection ssid="6-2" dnum="_-o:1-i" numlevel="1" lineno="156" slineno="4-3" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1063" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="end">A charter school may transfer from one approved authorizer to another approved <ln numlevel="1" lineno="157" slineno="4-4"/>authorizer.</amend></subsection><subsection ssid="6-3" dnum="_-o:2-i" numlevel="1" lineno="158" slineno="4-5" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1064" style="1" owner="i" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">A charter school seeking to transfer to another approved authorizer:</amend><subsection ssid="6-4" dnum="_-o:a-i" numlevel="1" lineno="159" slineno="4-6" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1065" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="end">shall submit a transfer request to the proposed new authorizer;</amend></subsection><subsection ssid="6-5" dnum="_-o:b-i" numlevel="1" lineno="160" slineno="4-7" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1066" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">may maintain confidentiality regarding transfer exploration; and</amend></subsection><subsection ssid="6-6" dnum="_-o:c-i" numlevel="1" lineno="161" slineno="4-8" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1067" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">shall notify the charter school's current authorizer after receiving preliminary <ln numlevel="1" lineno="162" slineno="4-9"/>approval from the proposed new authorizer.</amend></subsection></subsection><subsection ssid="6-7" dnum="_-o:3-i" numlevel="1" lineno="163" slineno="4-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1068" style="1" owner="i" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">An authorizer may not:</amend><subsection ssid="6-8" dnum="_-o:a-i" numlevel="1" lineno="164" slineno="4-11" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1069" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="end">retaliate against a charter school for exploring or requesting transfer; or</amend></subsection><subsection ssid="6-9" dnum="_-o:b-i" numlevel="1" lineno="165" slineno="4-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1070" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">restrict a charter school's operations based on transfer-related activities.</amend></subsection></subsection><subsection ssid="6-10" dnum="_-o:4-i" numlevel="1" lineno="166" slineno="4-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="i" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="167" slineno="4-14"/>state board shall establish rules governing:</amend><subsection ssid="6-11" dnum="_-o:a-i" numlevel="1" lineno="168" slineno="4-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1072" style="1" owner="i" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="end">authorizer transfer request procedures;</amend></subsection><subsection ssid="6-12" dnum="_-o:b-i" numlevel="1" lineno="169" slineno="4-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1073" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">timeline requirements;</amend></subsection><subsection ssid="6-13" dnum="_-o:c-i" numlevel="1" lineno="170" slineno="4-17" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="30" style="1" owner="jchristopherson" level="1" amendtag="end">transfer approval criteria; and</amend></subsection><subsection ssid="6-14" dnum="_-o:d-i" numlevel="1" lineno="171" slineno="4-18" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="45" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">the authorizer transition processes for an approved transfer.</amend></subsection></subsection><subsection ssid="6-15" dnum="_-o:5-i" numlevel="1" lineno="172" slineno="4-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><subsection ssid="6-17" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="i" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="37" style="1" owner="jchristopherson" level="1" amendtag="end">Upon transfer approval, the transferring charter school may maintain the charter <ln numlevel="1" lineno="173" slineno="4-20"/>school's current charter agreement terms unless both parties agree to modifications.</amend></subsection><subsection ssid="6-18" dnum="_-o:b-i" numlevel="1" lineno="174" slineno="4-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="46" style="1" owner="jchristopherson" level="1" amendtag="end">The originating authorizer shall ensure continuity of oversight for the transferring <ln numlevel="1" lineno="175" slineno="4-22"/>charter school during the charter school's transition.</amend></subsection></subsection></section></bsec><bsec buid="8" num="53G-5-304" type="amend" src="code" uid="C53G-5-S304_2025070120250701" sort="53G05 03040020250701" numlevel="1" lineno="176" slineno="5-1" sn="5"><section number="53G-5-304" numlevel="1" lineno="177" slineno="5-2" type="amend"><secline lineno="176">Section 5, Section <bold>53G-5-304</bold> is amended to read:</secline><catline lineno="177"><bold>53G-5-304. Charter schools authorized by the State Charter School Board -- <ln numlevel="1" lineno="178" slineno="5-3"/>Application process -- Prohibited basis of application denial.</bold></catline><subsection ssid="8-8-1" dnum="1-o" numlevel="1" lineno="179" slineno="5-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="8-8-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An applicant seeking authorization of a charter school from the State Charter <ln numlevel="1" lineno="180" slineno="5-5"/>School Board shall provide a copy of the application to the local school board of the <ln numlevel="1" lineno="181" slineno="5-6"/>school district in which the proposed charter school will be located either before or at <ln numlevel="1" lineno="182" slineno="5-7"/>the same time as the applicant files the charter school application with the State <ln numlevel="1" lineno="183" slineno="5-8"/>Charter School Board.</subsection><subsection ssid="8-8-3" dnum="b-o" numlevel="1" lineno="184" slineno="5-9" level="2"><display>(b)</display>The local school board may review the application and may offer suggestions or <ln numlevel="1" lineno="185" slineno="5-10"/>recommendations to the applicant or the State Charter School Board before taking <ln numlevel="1" lineno="186" slineno="5-11"/>action on the application.</subsection><subsection ssid="8-8-4" dnum="c-o" numlevel="1" lineno="187" slineno="5-12" level="2"><display>(c)</display>The State Charter School Board shall give due consideration to suggestions or <ln numlevel="1" lineno="188" slineno="5-13"/>recommendations made by the local school board under Subsection (1)(b).</subsection><subsection ssid="8-8-5" dnum="d-o" numlevel="1" lineno="189" slineno="5-14" level="2"><display>(d)</display>The  State Charter School Board shall review and, by majority vote, either approve <ln numlevel="1" lineno="190" slineno="5-15"/>or deny the application.</subsection><subsection ssid="8-8-6" dnum="e-o" numlevel="1" lineno="191" slineno="5-16" level="2"><display>(e)</display>A charter school application may not be denied on the basis that the establishment of <ln numlevel="1" lineno="192" slineno="5-17"/>the charter school will have any or all of the following impacts on a public school, <ln numlevel="1" lineno="193" slineno="5-18"/>including another charter school:<subsection ssid="8-8-7" dnum="i-o" numlevel="1" lineno="194" slineno="5-19" level="3"><display>(i)</display>an enrollment decline;</subsection><subsection ssid="8-8-8" dnum="ii-o" numlevel="1" lineno="195" slineno="5-20" level="3"><display>(ii)</display>a decrease in funding; or</subsection><subsection ssid="8-8-9" dnum="iii-o" numlevel="1" lineno="196" slineno="5-21" level="3"><display>(iii)</display>a modification of programs or services.</subsection></subsection></subsection><subsection ssid="8-8-10" dnum="2-o" numlevel="1" lineno="197" slineno="5-22" level="1"><display>(2)</display>The state board shall, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="198" slineno="5-23"/>Rulemaking Act, make a rule providing a timeline for the opening of a charter school <ln numlevel="1" lineno="199" slineno="5-24"/>following the approval of a charter school application by the State Charter School Board.</subsection><subsection ssid="8-8-11" dnum="3-o" numlevel="1" lineno="200" slineno="5-25" level="1"><display>(3)</display>After approval of a charter school application and in accordance with Section <xref depth="3" refnumber="53G-5-303">53G-5-303</xref>, <ln numlevel="1" lineno="201" slineno="5-26"/>the applicant and the State Charter School Board shall set forth the terms and conditions <ln numlevel="1" lineno="202" slineno="5-27"/>for the operation of the charter school in a written charter agreement.</subsection><subsection ssid="8-8-12" dnum="4-o" numlevel="1" lineno="203" slineno="5-28" level="1"><display>(4)</display>The State Charter School Board shall, in accordance with state board rules, establish <ln numlevel="1" lineno="204" slineno="5-29"/>and make public the State Charter School Board's:<subsection ssid="8-8-13" dnum="a-o" numlevel="1" lineno="205" slineno="5-30" level="2"><display>(a)</display>application requirements, in accordance with Section <xref depth="3" refnumber="53G-5-302">53G-5-302</xref>;</subsection><subsection ssid="8-8-14" dnum="b-o" numlevel="1" lineno="206" slineno="5-31" level="2"><display>(b)</display>application process, including timelines, in accordance with this section; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="8-8-15" dnum="c-o" numlevel="1" lineno="207" slineno="5-32" level="2"><display>(c)</display>minimum academic, governance, operational, and financial standards<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="8-16" dnum="_-o:d-i" numlevel="1" lineno="208" slineno="5-33" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for collecting and using fees as described in Section <xref depth="3" refnumber="53G-5-205">53G-5-205</xref>.</amend></subsection></subsection></section></bsec><bsec buid="9" num="53G-5-305" type="amend" src="code" uid="C53G-5-S305_2025070120250701" sort="53G05 03050020250701" numlevel="1" lineno="209" slineno="6-1" sn="6"><section number="53G-5-305" numlevel="1" lineno="210" slineno="6-2" type="amend"><secline lineno="209">Section 6, Section <bold>53G-5-305</bold> is amended to read:</secline><catline lineno="210"><bold>53G-5-305. Charters authorized by local school boards -- Application process -- <ln numlevel="1" lineno="211" slineno="6-3"/>Local school board responsibilities.</bold></catline><subsection ssid="9-9-1" dnum="1-o" numlevel="1" lineno="212" slineno="6-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="9-9-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An applicant identified in Section <xref depth="3" refnumber="53G-5-302">53G-5-302</xref> may submit an application to a local <ln numlevel="1" lineno="213" slineno="6-5"/>school board to establish and operate a charter school within the geographical <ln numlevel="1" lineno="214" slineno="6-6"/>boundaries of the school district administered by the local school board.</subsection><subsection ssid="9-9-3" dnum="b-o" numlevel="1" lineno="215" slineno="6-7" level="2" space="false"><display>(b)</display><subsection ssid="9-9-4" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The principal, teachers, or parents of students at an existing public school may <ln numlevel="1" lineno="216" slineno="6-8"/>submit an application to the local school board to convert the school or a portion <ln numlevel="1" lineno="217" slineno="6-9"/>of the school to charter status.<subsection ssid="9-9-5" dnum="A-o" numlevel="1" lineno="218" slineno="6-10" level="4" tab="1"><display>(A)</display>If the entire school is applying for charter status, at least two-thirds of the <ln numlevel="1" lineno="219" slineno="6-11"/>licensed educators employed at the school and at least two-thirds of the parents <ln numlevel="1" lineno="220" slineno="6-12"/>of students enrolled at the school shall sign a petition approving the application <ln numlevel="1" lineno="221" slineno="6-13"/>before submission to the charter school authorizer.</subsection><subsection ssid="9-9-6" dnum="B-o" numlevel="1" lineno="222" slineno="6-14" level="4" tab="1"><display>(B)</display>If only a portion of the school is applying for charter status, a simple majority <ln numlevel="1" lineno="223" slineno="6-15"/>of the licensed educators employed at the school and a simple majority of the <ln numlevel="1" lineno="224" slineno="6-16"/>parents of students enrolled at the school shall sign a petition approving the <ln numlevel="1" lineno="225" slineno="6-17"/>application before submission to the charter school authorizer.</subsection></subsection><subsection ssid="9-9-7" dnum="ii-o" numlevel="1" lineno="226" slineno="6-18" level="3"><display>(ii)</display>The local school board may not approve an application submitted under <ln numlevel="1" lineno="227" slineno="6-19"/>Subsection (1)(b)(i) unless the local school board determines that:<subsection ssid="9-9-8" dnum="A-o" numlevel="1" lineno="228" slineno="6-20" level="4"><display>(A)</display>students opting not to attend the proposed converted school would have access <ln numlevel="1" lineno="229" slineno="6-21"/>to a comparable public education alternative; and</subsection><subsection ssid="9-9-9" dnum="B-o" numlevel="1" lineno="230" slineno="6-22" level="4"><display>(B)</display>current teachers who choose not to teach at the converted charter school or <ln numlevel="1" lineno="231" slineno="6-23"/>who are not retained by the school at the time of conversion would receive a <ln numlevel="1" lineno="232" slineno="6-24"/>first preference for transfer to open teaching positions for which the teachers <ln numlevel="1" lineno="233" slineno="6-25"/>qualify within the school district, and, if no positions are open, contract <ln numlevel="1" lineno="234" slineno="6-26"/>provisions or local school board policy regarding reduction in staff would <ln numlevel="1" lineno="235" slineno="6-27"/>apply.</subsection></subsection></subsection></subsection><subsection ssid="9-9-10" dnum="2-o" numlevel="1" lineno="236" slineno="6-28" level="1" space="false"><display>(2)</display><subsection ssid="9-9-11" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An existing public school that converts to charter status under a charter granted by <ln numlevel="1" lineno="237" slineno="6-29"/>a local school board may:<subsection ssid="9-9-12" dnum="i-o" numlevel="1" lineno="238" slineno="6-30" level="3" tab="1"><display>(i)</display>continue to receive the same services from the school district that the school <ln numlevel="1" lineno="239" slineno="6-31"/>received before the charter school's conversion; or</subsection><subsection ssid="9-9-13" dnum="ii-o" numlevel="1" lineno="240" slineno="6-32" level="3" tab="1"><display>(ii)</display>contract out for some or all of the services with other public or private providers.</subsection></subsection><subsection ssid="9-9-14" dnum="b-o" numlevel="1" lineno="241" slineno="6-33" level="2"><display>(b)</display>Any other charter school authorized by a local school board may contract with the <ln numlevel="1" lineno="242" slineno="6-34"/>local school board to receive some or all of the services referred to in Subsection <ln numlevel="1" lineno="243" slineno="6-35"/>(2)(a).</subsection><subsection ssid="9-9-15" dnum="c-o" numlevel="1" lineno="244" slineno="6-36" level="2"><display>(c)</display>Except as specified in a charter agreement, local school board assets do not transfer <ln numlevel="1" lineno="245" slineno="6-37"/>to an existing public school that converts to charter status under a charter granted by <ln numlevel="1" lineno="246" slineno="6-38"/>a local school board under this section.</subsection></subsection><subsection ssid="9-9-16" dnum="3-o" numlevel="1" lineno="247" slineno="6-39" level="1" space="false"><display>(3)</display><subsection ssid="9-9-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board that receives an application for a charter school under this <ln numlevel="1" lineno="248" slineno="6-40"/>section shall, within 45 days, either accept or reject the application.</subsection><subsection ssid="9-9-18" dnum="b-o" numlevel="1" lineno="249" slineno="6-41" level="2"><display>(b)</display>If the local school board rejects the application, the local school board shall notify <ln numlevel="1" lineno="250" slineno="6-42"/>the applicant in writing of the reason for the rejection.</subsection><subsection ssid="9-9-19" dnum="c-o" numlevel="1" lineno="251" slineno="6-43" level="2"><display>(c)</display>The applicant may submit a revised application for reconsideration by the local <ln numlevel="1" lineno="252" slineno="6-44"/>school board.</subsection><subsection ssid="9-9-20" dnum="d-o" numlevel="1" lineno="253" slineno="6-45" level="2"><display>(d)</display>If the local school board refuses to authorize the applicant, the applicant may seek a <ln numlevel="1" lineno="254" slineno="6-46"/>charter from another authorizer.</subsection></subsection><subsection ssid="9-9-21" dnum="4-o" numlevel="1" lineno="255" slineno="6-47" level="1"><display>(4)</display>The state board shall make a rule providing for a timeline for the opening of a charter <ln numlevel="1" lineno="256" slineno="6-48"/>school following the approval of a charter school application by a local school board.</subsection><subsection ssid="9-9-22" dnum="5-o" numlevel="1" lineno="257" slineno="6-49" level="1"><display>(5)</display>After approval of a charter school application and in accordance with Section <xref depth="3" refnumber="53G-5-303">53G-5-303</xref>, <ln numlevel="1" lineno="258" slineno="6-50"/>the applicant and the local school board shall set forth the terms and conditions for the <ln numlevel="1" lineno="259" slineno="6-51"/>operation of the charter school in a written charter agreement.</subsection><subsection ssid="9-9-23" dnum="6-o" numlevel="1" lineno="260" slineno="6-52" level="1"><display>(6)</display>A local school board may terminate a charter school the local school board authorizes in <ln numlevel="1" lineno="261" slineno="6-53"/>accordance with Sections <xref depth="3" refnumber="53G-5-501">53G-5-501</xref> and <xref depth="3" refnumber="53G-5-503">53G-5-503</xref>.</subsection><subsection ssid="9-9-24" dnum="7-o" numlevel="1" lineno="262" slineno="6-54" level="1"><display>(7)</display>In addition to the exemptions described in Sections <xref depth="3" refnumber="53G-5-405">53G-5-405</xref>, <xref depth="3" refnumber="53G-7-202">53G-7-202</xref>, and <xref depth="3" refnumber="53G-5-407"><ln numlevel="1" lineno="263" slineno="6-55"/>53G-5-407</xref>, a charter school authorized by a local school board is:<subsection ssid="9-9-25" dnum="a-o" numlevel="1" lineno="264" slineno="6-56" level="2"><display>(a)</display>not required to separately submit a report or information required under this public <ln numlevel="1" lineno="265" slineno="6-57"/>education code to the state board if the information is included in a report or <ln numlevel="1" lineno="266" slineno="6-58"/>information that is submitted by the local school board or school district; and</subsection><subsection ssid="9-9-26" dnum="b-o" numlevel="1" lineno="267" slineno="6-59" level="2"><display>(b)</display>exempt from the requirement under Section <xref depth="3" refnumber="53G-5-404">53G-5-404</xref> that a charter school shall be <ln numlevel="1" lineno="268" slineno="6-60"/>organized and managed under Title 16, Chapter 6a, Utah Revised Nonprofit <ln numlevel="1" lineno="269" slineno="6-61"/>Corporation Act.</subsection></subsection><subsection ssid="9-9-27" dnum="8-o" numlevel="1" lineno="270" slineno="6-62" level="1"><display>(8)</display>Before a local school board accepts a charter school application, the local school board <ln numlevel="1" lineno="271" slineno="6-63"/>shall, in accordance with state board rules, establish and make public the local school <ln numlevel="1" lineno="272" slineno="6-64"/>board's:<subsection ssid="9-9-28" dnum="a-o" numlevel="1" lineno="273" slineno="6-65" level="2"><display>(a)</display>application requirements, in accordance with Section <xref depth="3" refnumber="53G-5-302">53G-5-302</xref>;</subsection><subsection ssid="9-9-29" dnum="b-o" numlevel="1" lineno="274" slineno="6-66" level="2"><display>(b)</display>application process, including timelines, in accordance with this section; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="9-9-30" dnum="c-o" numlevel="1" lineno="275" slineno="6-67" level="2"><display>(c)</display>minimum academic, governance, operational, and financial standards<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="9-31" dnum="_-o:d-i" numlevel="1" lineno="276" slineno="6-68" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="i" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">procedures for collecting and using fees as described in Section <xref depth="3" refnumber="53G-5-205">53G-5-205</xref>.</amend></subsection></subsection></section></bsec><bsec buid="10" num="53G-5-306" type="amend" src="code" uid="C53G-5-S306_2025070120250701" sort="53G05 03060020250701" numlevel="1" lineno="277" slineno="7-1" sn="7"><section number="53G-5-306" numlevel="1" lineno="278" slineno="7-2" type="amend"><secline lineno="277">Section 7, Section <bold>53G-5-306</bold> is amended to read:</secline><catline lineno="278"><bold>53G-5-306. Charter schools authorized by a board of trustees of a higher <ln numlevel="1" lineno="279" slineno="7-3"/>education institution -- Application process -- Board of trustees responsibilities.</bold></catline><subsection ssid="10-10-1" dnum="1-o" numlevel="1" lineno="280" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>Except as provided in Subsection (6), an applicant identified in Section <xref depth="3" refnumber="53G-5-302">53G-5-302</xref> may <ln numlevel="1" lineno="281" slineno="7-5"/>enter into an agreement with an institution of higher education board of trustees <ln numlevel="1" lineno="282" slineno="7-6"/>authorizing the applicant to establish and operate a charter school.</subsection><subsection ssid="10-10-2" dnum="2-o" numlevel="1" lineno="283" slineno="7-7" level="1" space="false"><display>(2)</display><subsection ssid="10-10-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An applicant applying for authorization from a board of trustees to establish and <ln numlevel="1" lineno="284" slineno="7-8"/>operate a charter school shall provide a copy of the application to the local school <ln numlevel="1" lineno="285" slineno="7-9"/>board of the school district in which the proposed charter school will be located <ln numlevel="1" lineno="286" slineno="7-10"/>either before or at the same time the applicant files the application with the board of <ln numlevel="1" lineno="287" slineno="7-11"/>trustees.</subsection><subsection ssid="10-10-4" dnum="b-o" numlevel="1" lineno="288" slineno="7-12" level="2"><display>(b)</display>The local school board may review the application and offer suggestions or <ln numlevel="1" lineno="289" slineno="7-13"/>recommendations to the applicant or the board of trustees before acting on the <ln numlevel="1" lineno="290" slineno="7-14"/>application.</subsection><subsection ssid="10-10-5" dnum="c-o" numlevel="1" lineno="291" slineno="7-15" level="2"><display>(c)</display>The board of trustees shall give due consideration to suggestions or <ln numlevel="1" lineno="292" slineno="7-16"/>recommendations made by the local school board under Subsection (2)(b).</subsection></subsection><subsection ssid="10-10-6" dnum="3-o" numlevel="1" lineno="293" slineno="7-17" level="1"><display>(3)</display>The state board shall make a rule providing a timeline for the opening of a charter <ln numlevel="1" lineno="294" slineno="7-18"/>school following the approval of a charter school application by a board of trustees.</subsection><subsection ssid="10-10-7" dnum="4-o" numlevel="1" lineno="295" slineno="7-19" level="1"><display>(4)</display>After approval of a charter school application, the applicant and the board of trustees <ln numlevel="1" lineno="296" slineno="7-20"/>shall set forth the terms and conditions for the operation of the charter school in a <ln numlevel="1" lineno="297" slineno="7-21"/>written charter agreement.</subsection><subsection ssid="10-10-8" dnum="5-o:_-i" numlevel="1" lineno="298" slineno="7-22" ea="erase" anum="0" owner="jchristopherson" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1133" style="2" owner="o" level="1" deltag="start">(5)</amend></display><subsection ssid="10-10-9" dnum="a-o:_-i" ea="erase" anum="0" owner="jchristopherson" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1134" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="15" groupid="8" style="2" owner="jchristopherson" level="1" deltag="end">The school's charter agreement may include a provision that the charter school <ln numlevel="1" lineno="299" slineno="7-23"/>pay an annual fee for the board of trustees' costs in providing oversight of, and <ln numlevel="1" lineno="300" slineno="7-24"/>technical support to, the charter school in accordance with Section <xref depth="3" refnumber="53G-5-205">53G-5-205</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="10-10-10" dnum="b-o:_-i" numlevel="1" lineno="301" slineno="7-25" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1135" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="11" style="2" owner="jchristopherson" level="1" deltag="end">In the first two years that a charter school is in operation, an annual fee described in <ln numlevel="1" lineno="302" slineno="7-26"/>Subsection (5)(a) may not exceed the product of 3% of the revenue the charter school <ln numlevel="1" lineno="303" slineno="7-27"/>receives from the state in the current fiscal year.</amend><amendoutend style="2"/></subsection><subsection ssid="10-10-11" dnum="c-o:_-i" numlevel="1" lineno="304" slineno="7-28" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1136" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="12" style="2" owner="jchristopherson" level="1" deltag="end">Beginning with the third year that a charter school is in operation, an annual fee <ln numlevel="1" lineno="305" slineno="7-29"/>described in Subsection (5)(a) may not exceed the product of 1% of the revenue a <ln numlevel="1" lineno="306" slineno="7-30"/>charter school receives from the state in the current fiscal year.</amend><amendoutend style="2"/></subsection><subsection ssid="10-10-12" dnum="d-o:_-i" numlevel="1" lineno="307" slineno="7-31" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1137" style="2" owner="o" level="1" deltag="start">(d)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="13" style="2" owner="jchristopherson" level="1" deltag="end">An annual fee described in Subsection (5)(a) shall be:</amend><amendoutend style="2"/><subsection ssid="10-10-13" dnum="i-o:_-i" numlevel="1" lineno="308" slineno="7-32" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1138" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="21" groupid="14" style="2" owner="jchristopherson" level="1" deltag="end">paid to the board of trustees; and</amend><amendoutend style="2"/></subsection><subsection ssid="10-10-14" dnum="ii-o:_-i" numlevel="1" lineno="309" slineno="7-33" ea="erase" anum="0" owner="jchristopherson" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1139" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="22" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">expended as directed by the board of trustees.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="10-33" dnum="_-o:5-i" numlevel="1" lineno="310" slineno="7-34" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="i" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">A board of trustees shall establish procedures for collecting and using fees as described <ln numlevel="1" lineno="311" slineno="7-35"/>in Section <xref depth="3" refnumber="53G-5-205">53G-5-205</xref>.</amend></subsection><subsection ssid="10-10-15" dnum="6-o" numlevel="1" lineno="312" slineno="7-36" level="1" space="false"><display>(6)</display><subsection ssid="10-10-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In addition to complying with the requirements of this section, a technical college <ln numlevel="1" lineno="313" slineno="7-37"/>board of trustees, as defined in Section <xref depth="3" refnumber="53B-2a-108">53B-2a-108</xref>, shall obtain the approval of the <ln numlevel="1" lineno="314" slineno="7-38"/>Utah Board of Higher Education before entering into an agreement to establish and <ln numlevel="1" lineno="315" slineno="7-39"/>operate a charter school.</subsection><subsection ssid="10-10-17" dnum="b-o" numlevel="1" lineno="316" slineno="7-40" level="2"><display>(b)</display>If a technical college board of trustees approves an application to establish and <ln numlevel="1" lineno="317" slineno="7-41"/>operate a charter school, the technical college board of trustees shall submit the <ln numlevel="1" lineno="318" slineno="7-42"/>application to the Utah Board of Higher Education.</subsection><subsection ssid="10-10-18" dnum="c-o" numlevel="1" lineno="319" slineno="7-43" level="2"><display>(c)</display>The Utah Board of Higher Education shall, by majority vote, within 60 days of <ln numlevel="1" lineno="320" slineno="7-44"/>receipt of an application described in Subsection (6)(b), approve or deny the <ln numlevel="1" lineno="321" slineno="7-45"/>application.</subsection><subsection ssid="10-10-19" dnum="d-o" numlevel="1" lineno="322" slineno="7-46" level="2"><display>(d)</display>The Utah Board of Higher Education may deny an application approved by a <ln numlevel="1" lineno="323" slineno="7-47"/>technical college board of trustees if the proposed charter school does not accomplish <ln numlevel="1" lineno="324" slineno="7-48"/>a purpose of charter schools as provided in Section <xref depth="3" refnumber="53G-5-104">53G-5-104</xref>.</subsection><subsection ssid="10-10-20" dnum="e-o" numlevel="1" lineno="325" slineno="7-49" level="2"><display>(e)</display>A charter school application may not be denied on the basis that the establishment of <ln numlevel="1" lineno="326" slineno="7-50"/>the charter school will have any or all of the following impacts on a public school, <ln numlevel="1" lineno="327" slineno="7-51"/>including another charter school:<subsection ssid="10-10-21" dnum="i-o" numlevel="1" lineno="328" slineno="7-52" level="3"><display>(i)</display>an enrollment decline;</subsection><subsection ssid="10-10-22" dnum="ii-o" numlevel="1" lineno="329" slineno="7-53" level="3"><display>(ii)</display>a decrease in funding; or</subsection><subsection ssid="10-10-23" dnum="iii-o" numlevel="1" lineno="330" slineno="7-54" level="3"><display>(iii)</display>a modification of programs or services.</subsection></subsection></subsection><subsection ssid="10-10-24" dnum="7-o" numlevel="1" lineno="331" slineno="7-55" level="1" space="false"><display>(7)</display><subsection ssid="10-10-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to the requirements of this chapter and other related provisions, a <ln numlevel="1" lineno="332" slineno="7-56"/>technical college board of trustees may establish:<subsection ssid="10-10-26" dnum="i-o" numlevel="1" lineno="333" slineno="7-57" level="3" tab="1"><display>(i)</display>procedures for submitting applications to establish and operate a charter school; or</subsection><subsection ssid="10-10-27" dnum="ii-o" numlevel="1" lineno="334" slineno="7-58" level="3" tab="1"><display>(ii)</display>criteria for approval of an application to establish and operate a charter school.</subsection></subsection><subsection ssid="10-10-28" dnum="b-o" numlevel="1" lineno="335" slineno="7-59" level="2"><display>(b)</display>The Utah Board of Higher Education may not establish policy governing the <ln numlevel="1" lineno="336" slineno="7-60"/>procedures or criteria described in Subsection (7)(a).</subsection></subsection><subsection ssid="10-10-29" dnum="8-o" numlevel="1" lineno="337" slineno="7-61" level="1"><display>(8)</display>Before a technical college board of trustees accepts a charter school application, the <ln numlevel="1" lineno="338" slineno="7-62"/>technical college board of trustees shall, in accordance with state board rules, establish <ln numlevel="1" lineno="339" slineno="7-63"/>and make public:<subsection ssid="10-10-30" dnum="a-o" numlevel="1" lineno="340" slineno="7-64" level="2"><display>(a)</display>application requirements, in accordance with Section <xref depth="3" refnumber="53G-5-302">53G-5-302</xref>;</subsection><subsection ssid="10-10-31" dnum="b-o" numlevel="1" lineno="341" slineno="7-65" level="2"><display>(b)</display>the application process, including timelines, in accordance with this section; and</subsection><subsection ssid="10-10-32" dnum="c-o" numlevel="1" lineno="342" slineno="7-66" level="2"><display>(c)</display>minimum academic, governance, operational, and financial standards.</subsection></subsection></section></bsec><bsec buid="13" num="53G-5-501" type="amend" src="code" uid="C53G-5-S501_2025070120250701" sort="53G05 05010020250701" numlevel="1" lineno="343" slineno="8-1" sn="8"><section number="53G-5-501" numlevel="1" lineno="344" slineno="8-2" type="amend"><secline lineno="343">Section 8, Section <bold>53G-5-501</bold> is amended to read:</secline><catline lineno="344"><bold>53G-5-501. Noncompliance -- Rulemaking.</bold></catline><subsection ssid="13-13-1" dnum="1-o" numlevel="1" lineno="345" slineno="8-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="13-13-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a charter school is found to be materially out of compliance with the <ln numlevel="1" lineno="346" slineno="8-4"/>requirements of Section <xref depth="3" refnumber="53G-5-404">53G-5-404</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both"> or </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">, </amend>the school's charter agreement, <amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="jchristopherson" level="1" amendtag="both">or fee <ln numlevel="1" lineno="347" slineno="8-5"/>payment obligations, </amend>the charter school authorizer shall provide written notice of the <ln numlevel="1" lineno="348" slineno="8-6"/>reason for the charter school's noncompliance and a reasonable time to remedy the <ln numlevel="1" lineno="349" slineno="8-7"/>deficiency, except as otherwise provided in Subsection <xref depth="3" refnumber="53G-5-503">53G-5-503</xref>(4), to:<subsection ssid="13-13-3" dnum="i-o" numlevel="1" lineno="350" slineno="8-8" level="3" tab="1"><display>(i)</display>the charter school governing board; and</subsection><subsection ssid="13-13-4" dnum="ii-o" numlevel="1" lineno="351" slineno="8-9" level="3" tab="1"><display>(ii)</display>if the charter school is a qualifying charter school with outstanding bonds issued <ln numlevel="1" lineno="352" slineno="8-10"/>in accordance with Part 6, Charter School Credit Enhancement Program, the Utah <ln numlevel="1" lineno="353" slineno="8-11"/>Charter School Finance Authority.</subsection></subsection><subsection ssid="13-13-5" dnum="b-o" numlevel="1" lineno="354" slineno="8-12" level="2"><display>(b)</display>The notice described in Subsection <xref tempid="709" depth="4" refnumber="53G-5-501(1)(a)">(1)(a)</xref> shall state that the charter school governing <ln numlevel="1" lineno="355" slineno="8-13"/>board may request an informal review before the charter school's authorizer to <ln numlevel="1" lineno="356" slineno="8-14"/>present evidence related to the deficiency.</subsection><subsection ssid="13-13-6" dnum="c-o" numlevel="1" lineno="357" slineno="8-15" level="2"><display>(c)</display>The charter school authorizer shall:<subsection ssid="13-13-7" dnum="i-o" numlevel="1" lineno="358" slineno="8-16" level="3"><display>(i)</display>review the evidence within a reasonable time to determine if the charter school has <ln numlevel="1" lineno="359" slineno="8-17"/>remedied the noncompliance or if the circumstances necessitate additional time <ln numlevel="1" lineno="360" slineno="8-18"/>for the charter school authorizer to remedy the deficiency; and</subsection><subsection ssid="13-13-8" dnum="ii-o" numlevel="1" lineno="361" slineno="8-19" level="3"><display>(ii)</display>if the charter school authorizer determines that circumstances necessitate <ln numlevel="1" lineno="362" slineno="8-20"/>additional time to remedy the noncompliance, establish a deadline to remedy the <ln numlevel="1" lineno="363" slineno="8-21"/>noncompliance.</subsection></subsection></subsection><subsection ssid="13-13-9" dnum="2-o" numlevel="1" lineno="364" slineno="8-22" level="1" space="false"><display>(2)</display><subsection ssid="13-13-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the charter school does not remedy the material deficiency within the <ln numlevel="1" lineno="365" slineno="8-23"/>established timeline, the authorizer may:<subsection ssid="13-13-11" dnum="i-o" numlevel="1" lineno="366" slineno="8-24" level="3" tab="1"><display>(i)</display>subject to the requirements of Subsection (4), take one or more of the following <ln numlevel="1" lineno="367" slineno="8-25"/>actions:<subsection ssid="13-13-12" dnum="A-o" numlevel="1" lineno="368" slineno="8-26" level="4"><display>(A)</display>remove a charter school director or finance officer;</subsection><subsection ssid="13-13-13" dnum="B-o" numlevel="1" lineno="369" slineno="8-27" level="4"><display>(B)</display>remove a charter school governing board member;</subsection><subsection ssid="13-13-14" dnum="C-o" numlevel="1" lineno="370" slineno="8-28" level="4"><display>(C)</display>appoint an interim director, mentor, or finance officer to work with the charter <ln numlevel="1" lineno="371" slineno="8-29"/>school; or</subsection><subsection ssid="13-13-15" dnum="D-o" numlevel="1" lineno="372" slineno="8-30" level="4"><display>(D)</display>appoint a governing board member;</subsection></subsection><subsection ssid="13-13-16" dnum="ii-o" numlevel="1" lineno="373" slineno="8-31" level="3" tab="1"><display>(ii)</display>subject to the requirements of Section <xref depth="3" refnumber="53G-5-503">53G-5-503</xref>, terminate the school's charter <ln numlevel="1" lineno="374" slineno="8-32"/>agreement; or</subsection><subsection ssid="13-13-17" dnum="iii-o" numlevel="1" lineno="375" slineno="8-33" level="3" tab="1"><display>(iii)</display>transfer operation and control of the charter school to a high performing charter <ln numlevel="1" lineno="376" slineno="8-34"/>school, as defined in Section <xref depth="3" refnumber="53G-5-502">53G-5-502</xref>, including reconstituting the governing <ln numlevel="1" lineno="377" slineno="8-35"/>board to effectuate the transfer.</subsection></subsection><subsection ssid="13-13-18" dnum="b-o" numlevel="1" lineno="378" slineno="8-36" level="2"><display>(b)</display>The authorizer may prohibit the charter school governing board from removing an <ln numlevel="1" lineno="379" slineno="8-37"/>appointment made under Subsection (2)(a)(i), for a period of up to one year after the <ln numlevel="1" lineno="380" slineno="8-38"/>date of the appointment.</subsection></subsection><subsection ssid="13-13-19" dnum="3-o" numlevel="1" lineno="381" slineno="8-39" level="1"><display>(3)</display>The costs of an interim director, mentor, or finance officer appointed under Subsection <ln numlevel="1" lineno="382" slineno="8-40"/>(2)(a) shall be paid from the funds of the charter school for which the interim director, <ln numlevel="1" lineno="383" slineno="8-41"/>mentor, or finance officer is working, unless the authorizer chooses to pay all or some of <ln numlevel="1" lineno="384" slineno="8-42"/>the costs.</subsection><subsection ssid="13-13-20" dnum="4-o" numlevel="1" lineno="385" slineno="8-43" level="1"><display>(4)</display>The authorizer shall notify the Utah Charter School Finance Authority before the <ln numlevel="1" lineno="386" slineno="8-44"/>authorizer takes an action described in Subsection (2)(a)(i) if the charter school is a <ln numlevel="1" lineno="387" slineno="8-45"/>qualifying charter school with outstanding bonds issued in accordance with Part 6, <ln numlevel="1" lineno="388" slineno="8-46"/>Charter School Credit Enhancement Program.</subsection><subsection ssid="13-13-21" dnum="5-o" numlevel="1" lineno="389" slineno="8-47" level="1"><display>(5)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="390" slineno="8-48"/>state board shall make rules:<subsection ssid="13-13-22" dnum="a-o" numlevel="1" lineno="391" slineno="8-49" level="2"><display>(a)</display>specifying the timeline for remedying deficiencies under Subsection (1); and</subsection><subsection ssid="13-13-23" dnum="b-o" numlevel="1" lineno="392" slineno="8-50" level="2"><display>(b)</display>ensuring compliance with the charter school's approved charter agreement.</subsection></subsection><subsection ssid="13-13-24" dnum="6-o" numlevel="1" lineno="393" slineno="8-51" level="1" space="false"><display>(6)</display><subsection ssid="13-13-25" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="13-13-26" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>An authorizer may petition a court with jurisdiction under Title 78A, <ln numlevel="1" lineno="394" slineno="8-52"/>Judiciary and Judicial Administration, to appoint a receiver.</subsection><subsection ssid="13-13-27" dnum="ii-o" numlevel="1" lineno="395" slineno="8-53" level="3" tab="1"><display>(ii)</display>Notwithstanding Title 78B, Chapter 3a, Venue for Civil Actions, the authorizer <ln numlevel="1" lineno="396" slineno="8-54"/>shall bring a petition described in Subsection (6)(a)(i) in the county in which a <ln numlevel="1" lineno="397" slineno="8-55"/>charter school is located or incorporated if the action is brought in the district <ln numlevel="1" lineno="398" slineno="8-56"/>court.</subsection></subsection><subsection ssid="13-13-28" dnum="b-o" numlevel="1" lineno="399" slineno="8-57" level="2"><display>(b)</display>The court may appoint a receiver if the authorizer establishes that the charter school:<subsection ssid="13-13-29" dnum="i-o" numlevel="1" lineno="400" slineno="8-58" level="3"><display>(i)</display>is subject to closure under Section <xref depth="3" refnumber="53G-5-503">53G-5-503</xref>; and</subsection><subsection ssid="13-13-30" dnum="ii-o" numlevel="1" lineno="401" slineno="8-59" level="3" space="false"><display>(ii)</display><subsection ssid="13-13-31" dnum="A-o" level="4" placement="sameline"><display>(A)</display>has disposed, or there is a demonstrated risk that the charter school will <ln numlevel="1" lineno="402" slineno="8-60"/>dispose, of the charter school's assets in violation of Section <xref depth="3" refnumber="53G-5-403">53G-5-403</xref>; or</subsection><subsection ssid="13-13-32" dnum="B-o" numlevel="1" lineno="403" slineno="8-61" level="4"><display>(B)</display>cannot, or there is a demonstrated risk that the charter school will not, make <ln numlevel="1" lineno="404" slineno="8-62"/>repayment of amounts owed to the federal government or the state.</subsection></subsection></subsection><subsection ssid="13-13-33" dnum="c-o" numlevel="1" lineno="405" slineno="8-63" level="2"><display>(c)</display>The court shall describe the powers and duties of the receiver in the court's <ln numlevel="1" lineno="406" slineno="8-64"/>appointing order, and may amend the order from time to time.</subsection><subsection ssid="13-13-34" dnum="d-o" numlevel="1" lineno="407" slineno="8-65" level="2"><display>(d)</display>Among other duties ordered by the court, the receiver shall:<subsection ssid="13-13-35" dnum="i-o" numlevel="1" lineno="408" slineno="8-66" level="3"><display>(i)</display>ensure the protection of the charter school's assets;</subsection><subsection ssid="13-13-36" dnum="ii-o" numlevel="1" lineno="409" slineno="8-67" level="3"><display>(ii)</display>preserve money owed to creditors; and</subsection><subsection ssid="13-13-37" dnum="iii-o" numlevel="1" lineno="410" slineno="8-68" level="3"><display>(iii)</display>if requested by the authorizer, carry out charter school closure procedures <ln numlevel="1" lineno="411" slineno="8-69"/>described in Section <xref depth="3" refnumber="53G-5-504">53G-5-504</xref>, and state board rules, as directed by the <ln numlevel="1" lineno="412" slineno="8-70"/>authorizer.</subsection></subsection><subsection ssid="13-13-38" dnum="e-o" numlevel="1" lineno="413" slineno="8-71" level="2"><display>(e)</display>If the authorizer does not request, or the court does not appoint, a receiver:<subsection ssid="13-13-39" dnum="i-o" numlevel="1" lineno="414" slineno="8-72" level="3"><display>(i)</display>the authorizer may reconstitute the governing board of a charter school; or</subsection><subsection ssid="13-13-40" dnum="ii-o" numlevel="1" lineno="415" slineno="8-73" level="3"><display>(ii)</display>if a new governing board cannot be reconstituted, the authorizer shall complete <ln numlevel="1" lineno="416" slineno="8-74"/>the closure procedures described in Section <xref depth="3" refnumber="53G-5-504">53G-5-504</xref>, including liquidation and <ln numlevel="1" lineno="417" slineno="8-75"/>assignment of assets, and payment of liabilities and obligations in accordance with<amend anum="0" ea="amend" pairid="9" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend><ln numlevel="1" lineno="418" slineno="8-76"/>Section <xref depth="3" refnumber="53G-5-504">53G-5-504</xref> and state board rule.</subsection></subsection><subsection ssid="13-13-41" dnum="f-o" numlevel="1" lineno="419" slineno="8-77" level="2"><display>(f)</display>For a qualifying charter school with outstanding bonds issued in accordance with Part <ln numlevel="1" lineno="420" slineno="8-78"/>6, Charter School Credit Enhancement Program, an authorizer shall obtain the <ln numlevel="1" lineno="421" slineno="8-79"/>consent of the Utah Charter School Finance Authority before the authorizer takes the <ln numlevel="1" lineno="422" slineno="8-80"/>following actions:<subsection ssid="13-13-42" dnum="i-o" numlevel="1" lineno="423" slineno="8-81" level="3"><display>(i)</display>petitions a court to appoint a receiver, as described in Subsection (6)(a);</subsection><subsection ssid="13-13-43" dnum="ii-o" numlevel="1" lineno="424" slineno="8-82" level="3"><display>(ii)</display>reconstitutes the governing board, as described in Subsection (6)(e)(i); or</subsection><subsection ssid="13-13-44" dnum="iii-o" numlevel="1" lineno="425" slineno="8-83" level="3"><display>(iii)</display>carries out closure procedures, as described in Subsection (6)(e)(ii).</subsection></subsection></subsection></section></bsec><bsec buid="14" num="53G-5-502" type="amend" src="code" uid="C53G-5-S502_2025070120250701" sort="53G05 05020020250701" numlevel="1" lineno="426" slineno="9-1" sn="9"><section number="53G-5-502" numlevel="1" lineno="427" slineno="9-2" type="amend"><secline lineno="426">Section 9, Section <bold>53G-5-502</bold> is amended to read:</secline><catline lineno="427"><bold>53G-5-502. Voluntary school improvement and transfer processes.</bold></catline><subsection ssid="14-14-1" dnum="1-o" numlevel="1" lineno="428" slineno="9-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="14-14-2" dnum="a-o" numlevel="1" lineno="429" slineno="9-4" level="2"><display>(a)</display>"High performing charter school" means a charter school that:<subsection ssid="14-14-3" dnum="i-o" numlevel="1" lineno="430" slineno="9-5" level="3"><display>(i)</display>satisfies all requirements of state law and state board rules;</subsection><subsection ssid="14-14-4" dnum="ii-o" numlevel="1" lineno="431" slineno="9-6" level="3"><display>(ii)</display>has operated for at least three years meeting the terms of the school's charter <ln numlevel="1" lineno="432" slineno="9-7"/>agreement; and</subsection><subsection ssid="14-14-5" dnum="iii-o" numlevel="1" lineno="433" slineno="9-8" level="3"><display>(iii)</display>is in good standing with the charter school's authorizer.</subsection></subsection><subsection ssid="14-14-6" dnum="b-o" numlevel="1" lineno="434" slineno="9-9" level="2"><display>(b)</display>"Low performing charter school" means a charter school that is designated a low <ln numlevel="1" lineno="435" slineno="9-10"/>performing school, as that term is defined in Section <xref depth="3" refnumber="53E-5-301">53E-5-301</xref>.</subsection><subsection ssid="14-14-7" dnum="c-o" numlevel="1" lineno="436" slineno="9-11" level="2"><display>(c)</display>"School turnaround plan" means the same as that term is defined in Section <xref depth="3" refnumber="53E-5-301"><ln numlevel="1" lineno="437" slineno="9-12"/>53E-5-301</xref>.</subsection></subsection><subsection ssid="14-14-8" dnum="2-o" numlevel="1" lineno="438" slineno="9-13" level="1" space="false"><display>(2)</display><subsection ssid="14-14-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection (2)(b), a charter school governing board may voluntarily <ln numlevel="1" lineno="439" slineno="9-14"/>request the charter school's authorizer to place the charter school, including a low <ln numlevel="1" lineno="440" slineno="9-15"/>performing charter school that has a school turnaround plan, in a school improvement <ln numlevel="1" lineno="441" slineno="9-16"/>process.</subsection><subsection ssid="14-14-10" dnum="b-o" numlevel="1" lineno="442" slineno="9-17" level="2"><display>(b)</display>A charter school governing board shall provide notice and a hearing on the charter <ln numlevel="1" lineno="443" slineno="9-18"/>school governing board's intent to make a request under Subsection (2)(a) to parents <ln numlevel="1" lineno="444" slineno="9-19"/>of students enrolled in the charter school.</subsection></subsection><subsection ssid="14-14-11" dnum="3-o" numlevel="1" lineno="445" slineno="9-20" level="1"><display>(3)</display>An authorizer may grant a charter school governing board's request to be placed in a <ln numlevel="1" lineno="446" slineno="9-21"/>school improvement process if the charter school governing board has provided notice <ln numlevel="1" lineno="447" slineno="9-22"/>and a hearing under Subsection (2)(b).</subsection><subsection ssid="14-14-12" dnum="4-o" numlevel="1" lineno="448" slineno="9-23" level="1"><display>(4)</display>An authorizer that has entered into a school improvement process with a charter school <ln numlevel="1" lineno="449" slineno="9-24"/>governing board shall:<subsection ssid="14-14-13" dnum="a-o" numlevel="1" lineno="450" slineno="9-25" level="2"><display>(a)</display>enter into a contract with the charter school governing board on the terms of the <ln numlevel="1" lineno="451" slineno="9-26"/>school improvement process;</subsection><subsection ssid="14-14-14" dnum="b-o" numlevel="1" lineno="452" slineno="9-27" level="2"><display>(b)</display>notify the state board that the authorizer has entered into a school improvement <ln numlevel="1" lineno="453" slineno="9-28"/>process with the charter school governing board;</subsection><subsection ssid="14-14-15" dnum="c-o" numlevel="1" lineno="454" slineno="9-29" level="2"><display>(c)</display>make a report to a committee of the state board regarding the school improvement <ln numlevel="1" lineno="455" slineno="9-30"/>process; and</subsection><subsection ssid="14-14-16" dnum="d-o" numlevel="1" lineno="456" slineno="9-31" level="2"><display>(d)</display>notify the Utah Charter School Finance Authority that the authorizer has entered into <ln numlevel="1" lineno="457" slineno="9-32"/>a school improvement process with the charter school governing board if the charter <ln numlevel="1" lineno="458" slineno="9-33"/>school is a qualifying charter school with outstanding bonds issued in accordance <ln numlevel="1" lineno="459" slineno="9-34"/>with Part 6, Charter School Credit Enhancement Program.</subsection></subsection><subsection ssid="14-14-17" dnum="5-o" numlevel="1" lineno="460" slineno="9-35" level="1"><display>(5)</display>Upon notification under Subsection (4)(b), and after the report described in Subsection <ln numlevel="1" lineno="461" slineno="9-36"/>(4)(c), the state board shall notify charter schools and the school district in which the <ln numlevel="1" lineno="462" slineno="9-37"/>charter school is located that the charter school governing board has entered into a <ln numlevel="1" lineno="463" slineno="9-38"/>school improvement process with the charter school's authorizer.</subsection><subsection ssid="14-14-18" dnum="6-o" numlevel="1" lineno="464" slineno="9-39" level="1"><display>(6)</display>A high performing charter school or the school district in which the charter school is <ln numlevel="1" lineno="465" slineno="9-40"/>located may apply to the charter school governing board to assume operation and control <ln numlevel="1" lineno="466" slineno="9-41"/>of the charter school that has been placed in a school improvement process.</subsection><subsection ssid="14-14-19" dnum="7-o" numlevel="1" lineno="467" slineno="9-42" level="1"><display>(7)</display>A charter school governing board that has entered into a school improvement process <ln numlevel="1" lineno="468" slineno="9-43"/>shall review applications submitted under Subsection (6) and submit a proposal to the <ln numlevel="1" lineno="469" slineno="9-44"/>charter school's authorizer to:<subsection ssid="14-14-20" dnum="a-o" numlevel="1" lineno="470" slineno="9-45" level="2"><display>(a)</display>terminate the school's charter, notwithstanding the requirements of Section <xref depth="3" refnumber="53G-5-503"><ln numlevel="1" lineno="471" slineno="9-46"/>53G-5-503</xref>; and</subsection><subsection ssid="14-14-21" dnum="b-o" numlevel="1" lineno="472" slineno="9-47" level="2"><display>(b)</display>transfer operation and control of the charter school to:<subsection ssid="14-14-22" dnum="i-o" numlevel="1" lineno="473" slineno="9-48" level="3"><display>(i)</display>the school district in which the charter school is located;</subsection><subsection ssid="14-14-23" dnum="ii-o" numlevel="1" lineno="474" slineno="9-49" level="3"><display>(ii)</display>the governing board of another charter school;</subsection><subsection ssid="14-14-24" dnum="iii-o" numlevel="1" lineno="475" slineno="9-50" level="3"><display>(iii)</display>a private management company; or</subsection><subsection ssid="14-14-25" dnum="iv-o" numlevel="1" lineno="476" slineno="9-51" level="3"><display>(iv)</display>the governing board of a nonprofit corporation.</subsection></subsection></subsection><subsection ssid="14-47" dnum="_-o:8-i" numlevel="1" lineno="477" slineno="9-52" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="i" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="end">A transfer of a charter school under this section shall not affect the school's fee <ln numlevel="1" lineno="478" slineno="9-53"/>obligations under Section <xref depth="3" refnumber="53G-5-205">53G-5-205</xref>.</amend></subsection><subsection ssid="14-14-26" dnum="8-o:9-i" numlevel="1" lineno="479" slineno="9-54" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1229" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1230" style="1" owner="i" level="1" amendtag="both" space="true">(9)</amend></display>A charter school governing board that has not entered into a school improvement <ln numlevel="1" lineno="480" slineno="9-55"/>process may voluntarily provide a proposal to the authorizer for consideration of <ln numlevel="1" lineno="481" slineno="9-56"/>transferring operation and control of the charter school to:<subsection ssid="14-14-27" dnum="a-o" lineno="483" slineno="9-58" level="2"><display>(b)</display>the governing board of another charter school;</subsection><subsection ssid="14-14-29" dnum="c-o" numlevel="1" lineno="484" slineno="9-59" level="2"><display>(c)</display>a private management company; or</subsection><subsection ssid="14-14-30" dnum="d-o" numlevel="1" lineno="485" slineno="9-60" level="2"><display>(d)</display>the governing board of a nonprofit corporation.</subsection></subsection><subsection ssid="14-14-31" dnum="9-o:10-i" numlevel="1" lineno="486" slineno="9-61" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1234" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1235" style="1" owner="i" level="1" amendtag="both" space="true">(10)</amend></display>Except as provided in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="15" style="1" owner="jchristopherson" level="1" amendtag="both" numlevel="1" lineno="487" slineno="9-62"/>an authorizer may:<subsection ssid="14-14-32" dnum="a-o" numlevel="1" lineno="488" slineno="9-63" level="2"><display>(a)</display>approve a charter school governing board's proposal under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="18" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)</amend>; or</subsection><subsection ssid="14-14-33" dnum="b-o" numlevel="1" lineno="489" slineno="9-64" level="2" space="false"><display>(b)</display><subsection ssid="14-14-34" dnum="i-o" level="3" placement="sameline"><display>(i)</display>deny a charter school governing board's proposal under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="19" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)</amend>; and</subsection><subsection ssid="14-14-35" dnum="ii-o" numlevel="1" lineno="490" slineno="9-65" level="3" space="false"><display>(ii)</display><subsection ssid="14-14-36" dnum="A-o" level="4" placement="sameline"><display>(A)</display>terminate the school's charter agreement in accordance with Section <xref depth="3" refnumber="53G-5-503"><ln numlevel="1" lineno="491" slineno="9-66"/>53G-5-503</xref>;</subsection><subsection ssid="14-14-37" dnum="B-o" numlevel="1" lineno="492" slineno="9-67" level="4"><display>(B)</display>allow the charter school governing board to submit a revised proposal; or</subsection><subsection ssid="14-14-38" dnum="C-o" numlevel="1" lineno="493" slineno="9-68" level="4"><display>(C)</display>take no action.</subsection></subsection></subsection></subsection><subsection ssid="14-14-39" dnum="10-o:11-i" numlevel="1" lineno="494" slineno="9-69" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1242" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1243" style="1" owner="i" level="1" amendtag="both" space="true">(11)</amend></display>An authorizer may not take an action under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="19" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(10)</amend> for a qualifying <ln numlevel="1" lineno="495" slineno="9-70"/>charter school with outstanding bonds issued in accordance with Part 6, Charter School <ln numlevel="1" lineno="496" slineno="9-71"/>Credit Enhancement Program, without mutual agreement of the Utah Charter School <ln numlevel="1" lineno="497" slineno="9-72"/>Finance Authority and the authorizer.</subsection><subsection ssid="14-14-40" dnum="11-o:12-i" numlevel="1" lineno="498" slineno="9-73" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1243" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1244" style="1" owner="i" level="1" amendtag="both" space="true">(12)</amend></display><subsection ssid="14-14-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An authorizer that intends to transfer operation and control of a charter <ln numlevel="1" lineno="499" slineno="9-74"/>school as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="32" style="2" owner="jchristopherson" level="1" deltag="both">(7)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b)</amend> shall request approval from the state <ln numlevel="1" lineno="500" slineno="9-75"/>board.</subsection><subsection ssid="14-14-42" dnum="b-o" numlevel="1" lineno="501" slineno="9-76" level="2" space="false"><display>(b)</display><subsection ssid="14-14-43" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state board shall consider an authorizer's request under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="33" style="2" owner="jchristopherson" level="1" deltag="both">(11)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="21" style="1" owner="jchristopherson" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="502" slineno="9-77"/>(12)(a)</amend> within 30 days of receiving the request.</subsection><subsection ssid="14-14-44" dnum="ii-o" numlevel="1" lineno="503" slineno="9-78" level="3"><display>(ii)</display>If the state board denies an authorizer's request under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">(11)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="23" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(12)(a)</amend>, <ln numlevel="1" lineno="504" slineno="9-79"/>the authorizer may not transfer operation and control of the charter school as <ln numlevel="1" lineno="505" slineno="9-80"/>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="36" groupid="35" style="2" owner="jchristopherson" level="1" deltag="both">(7)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b)</amend>.</subsection><subsection ssid="14-14-45" dnum="iii-o" numlevel="1" lineno="506" slineno="9-81" level="3"><display>(iii)</display>If the state board does not take action on an authorizer's request under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="36" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="507" slineno="9-82"/>(11)(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="25" groupid="24" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(12)(a)</amend> within 30 days of receiving the request, an authorizer may proceed <ln numlevel="1" lineno="508" slineno="9-83"/>to transfer operation and control of the charter school as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="37" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="509" slineno="9-84"/>(7)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="26" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b)</amend>.</subsection></subsection></subsection><subsection ssid="14-14-46" dnum="12-o:13-i" numlevel="1" lineno="510" slineno="9-85" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1249" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1250" style="1" owner="i" level="1" amendtag="both" space="true">(13)</amend></display>If operation and control of a low performing charter school that has a school <ln numlevel="1" lineno="511" slineno="9-86"/>turnaround plan is transferred to a high performing charter school as described in <ln numlevel="1" lineno="512" slineno="9-87"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="38" style="2" owner="jchristopherson" level="1" deltag="both">(7)(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="27" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(8)(b)</amend>, the low performing charter school shall complete the <ln numlevel="1" lineno="513" slineno="9-88"/>requirements of the school turnaround plan and any other requirements imposed by the <ln numlevel="1" lineno="514" slineno="9-89"/>authorizer for school improvement.</subsection></section></bsec><bsec buid="15" num="53G-5-503" type="amend" src="code" uid="C53G-5-S503_2025070120250701" sort="53G05 05030020250701" numlevel="1" lineno="515" slineno="10-1" sn="10"><section number="53G-5-503" numlevel="1" lineno="516" slineno="10-2" type="amend"><secline lineno="515">Section 10, Section <bold>53G-5-503</bold> is amended to read:</secline><catline lineno="516"><bold>53G-5-503. Termination of a charter agreement.</bold></catline><subsection ssid="15-15-1" dnum="1-o" numlevel="1" lineno="517" slineno="10-3" level="1" placement="noreturn"><display>(1)</display>Subject to the requirements of Subsection (3), a charter school authorizer may terminate <ln numlevel="1" lineno="518" slineno="10-4"/>a school's charter agreement for any of the following reasons:<subsection ssid="15-15-2" dnum="a-o" numlevel="1" lineno="519" slineno="10-5" level="2"><display>(a)</display>failure of the charter school to meet the requirements stated in the charter agreement;</subsection><subsection ssid="15-15-3" dnum="b-o" numlevel="1" lineno="520" slineno="10-6" level="2"><display>(b)</display>failure to meet generally accepted standards of fiscal management;</subsection><subsection ssid="15-15-4" dnum="c-o" numlevel="1" lineno="521" slineno="10-7" level="2" space="false"><display>(c)</display><subsection ssid="15-15-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>designation as a low performing school under Title 53E, Chapter 5, Part 3, <ln numlevel="1" lineno="522" slineno="10-8"/>School Improvement and Leadership Development; and</subsection><subsection ssid="15-15-6" dnum="ii-o" numlevel="1" lineno="523" slineno="10-9" level="3"><display>(ii)</display>failure to improve the school's performance under the conditions described in <ln numlevel="1" lineno="524" slineno="10-10"/>Title 53E, Chapter 5, Part 3, School Improvement and Leadership Development;</subsection></subsection><subsection ssid="15-15-7" dnum="d-o" numlevel="1" lineno="525" slineno="10-11" level="2"><display>(d)</display>violation of requirements under this chapter or another law; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">or</amend><amendoutend style="2"/></subsection><subsection ssid="15-36" dnum="_-o:e-i" numlevel="1" lineno="526" slineno="10-12" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1257" style="1" owner="i" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="jchristopherson" level="1" amendtag="end">failure to pay required authorizer fees; or</amend></subsection><subsection ssid="15-15-8" dnum="e-o:f-i" numlevel="1" lineno="527" slineno="10-13" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1258" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1259" style="1" owner="i" level="1" amendtag="both" space="true">(f)</amend></display>other good cause shown.</subsection></subsection><subsection ssid="15-15-9" dnum="2-o" numlevel="1" lineno="528" slineno="10-14" level="1" space="false"><display>(2)</display><subsection ssid="15-15-10" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The authorizer shall notify the following of the proposed termination in writing, <ln numlevel="1" lineno="529" slineno="10-15"/>state the grounds for the termination, and stipulate that the charter school governing <ln numlevel="1" lineno="530" slineno="10-16"/>board may request an informal hearing before the authorizer:<subsection ssid="15-15-11" dnum="i-o" numlevel="1" lineno="531" slineno="10-17" level="3" tab="1"><display>(i)</display>the charter school governing board; and</subsection><subsection ssid="15-15-12" dnum="ii-o" numlevel="1" lineno="532" slineno="10-18" level="3" tab="1"><display>(ii)</display>if the charter school is a qualifying charter school with outstanding bonds issued <ln numlevel="1" lineno="533" slineno="10-19"/>in accordance with Part 6, Charter School Credit Enhancement Program, the Utah <ln numlevel="1" lineno="534" slineno="10-20"/>Charter School Finance Authority.</subsection></subsection><subsection ssid="15-15-13" dnum="b-o" numlevel="1" lineno="535" slineno="10-21" level="2"><display>(b)</display>Except as provided in Subsection (2)(e), the authorizer shall conduct the hearing in <ln numlevel="1" lineno="536" slineno="10-22"/>accordance with Title 63G, Chapter 4, Administrative Procedures Act, within 30 days <ln numlevel="1" lineno="537" slineno="10-23"/>after the day a written request under Subsection (2)(a) is received.</subsection><subsection ssid="15-15-14" dnum="c-o" numlevel="1" lineno="538" slineno="10-24" level="2"><display>(c)</display>If the authorizer, by majority vote, approves a motion to terminate a charter school, <ln numlevel="1" lineno="539" slineno="10-25"/>the charter school governing board may appeal the decision to the state board.</subsection><subsection ssid="15-15-15" dnum="d-o" numlevel="1" lineno="540" slineno="10-26" level="2" space="false"><display>(d)</display><subsection ssid="15-15-16" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state board shall hear an appeal of a termination made in accordance with <ln numlevel="1" lineno="541" slineno="10-27"/>Subsection (2)(c).</subsection><subsection ssid="15-15-17" dnum="ii-o" numlevel="1" lineno="542" slineno="10-28" level="3"><display>(ii)</display>The state board's action is final action subject to judicial review.</subsection></subsection><subsection ssid="15-15-18" dnum="e-o" numlevel="1" lineno="543" slineno="10-29" level="2" space="false"><display>(e)</display><subsection ssid="15-15-19" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the authorizer proposes to terminate the charter agreement of a qualifying <ln numlevel="1" lineno="544" slineno="10-30"/>charter school with outstanding bonds issued in accordance with Part 6, Charter <ln numlevel="1" lineno="545" slineno="10-31"/>School Credit Enhancement Program, the authorizer shall conduct a hearing <ln numlevel="1" lineno="546" slineno="10-32"/>described in Subsection (2)(b) 120 days or more after notifying the following of <ln numlevel="1" lineno="547" slineno="10-33"/>the proposed termination:<subsection ssid="15-15-20" dnum="A-o" numlevel="1" lineno="548" slineno="10-34" level="4" tab="1"><display>(A)</display>the charter school governing board of the qualifying charter school; and</subsection><subsection ssid="15-15-21" dnum="B-o" numlevel="1" lineno="549" slineno="10-35" level="4" tab="1"><display>(B)</display>the Utah Charter School Finance Authority.</subsection></subsection><subsection ssid="15-15-22" dnum="ii-o" numlevel="1" lineno="550" slineno="10-36" level="3"><display>(ii)</display>Before the hearing described in Subsection (2)(e)(i), the Utah Charter School <ln numlevel="1" lineno="551" slineno="10-37"/>Finance Authority shall meet with the authorizer to determine whether the <ln numlevel="1" lineno="552" slineno="10-38"/>deficiency may be remedied in lieu of termination of the qualifying charter <ln numlevel="1" lineno="553" slineno="10-39"/>school's charter agreement.</subsection></subsection></subsection><subsection ssid="15-15-23" dnum="3-o" numlevel="1" lineno="554" slineno="10-40" level="1"><display>(3)</display>An authorizer may not terminate the charter agreement of a qualifying charter school <ln numlevel="1" lineno="555" slineno="10-41"/>with outstanding bonds issued in accordance with Part 6, Charter School Credit <ln numlevel="1" lineno="556" slineno="10-42"/>Enhancement Program, without mutual agreement of the Utah Charter School Finance <ln numlevel="1" lineno="557" slineno="10-43"/>Authority and the authorizer.</subsection><subsection ssid="15-15-24" dnum="4-o" numlevel="1" lineno="558" slineno="10-44" level="1" space="false"><display>(4)</display><subsection ssid="15-15-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="559" slineno="10-45"/>the state board shall make rules that require a charter school to report any threats to <ln numlevel="1" lineno="560" slineno="10-46"/>the health, safety, or welfare of the charter school's students to the State Charter <ln numlevel="1" lineno="561" slineno="10-47"/>School Board in a timely manner.</subsection><subsection ssid="15-15-26" dnum="b-o" numlevel="1" lineno="562" slineno="10-48" level="2"><display>(b)</display>The rules under Subsection (4)(a) shall also require the charter school report to <ln numlevel="1" lineno="563" slineno="10-49"/>include what steps the charter school has taken to remedy the threat.</subsection></subsection><subsection ssid="15-15-27" dnum="5-o" numlevel="1" lineno="564" slineno="10-50" level="1"><display>(5)</display>Subject to the requirements of Subsection (3), the authorizer may terminate a charter <ln numlevel="1" lineno="565" slineno="10-51"/>agreement immediately if good cause has been shown or if the health, safety, or welfare <ln numlevel="1" lineno="566" slineno="10-52"/>of the students at the charter school is threatened.</subsection><subsection ssid="15-15-28" dnum="6-o" numlevel="1" lineno="567" slineno="10-53" level="1"><display>(6)</display>If a charter agreement is terminated, the following entities may apply to the charter <ln numlevel="1" lineno="568" slineno="10-54"/>school's authorizer to assume operation of the school:<subsection ssid="15-15-29" dnum="a-o" numlevel="1" lineno="569" slineno="10-55" level="2"><display>(a)</display>the school district where the charter school is located;</subsection><subsection ssid="15-15-30" dnum="b-o" numlevel="1" lineno="570" slineno="10-56" level="2"><display>(b)</display>the charter school governing board of another charter school;</subsection><subsection ssid="15-15-31" dnum="c-o" numlevel="1" lineno="571" slineno="10-57" level="2"><display>(c)</display>a private management company; or</subsection><subsection ssid="15-15-32" dnum="d-o" numlevel="1" lineno="572" slineno="10-58" level="2"><display>(d)</display>the governing board of a nonprofit corporation.</subsection></subsection><subsection ssid="15-15-33" dnum="7-o" numlevel="1" lineno="573" slineno="10-59" level="1" space="false"><display>(7)</display><subsection ssid="15-15-34" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a charter agreement is terminated, a student who attended the school may apply <ln numlevel="1" lineno="574" slineno="10-60"/>to and shall be enrolled in another public school under the enrollment provisions in <ln numlevel="1" lineno="575" slineno="10-61"/>accordance with Chapter 6, Part 3, School District Residency, subject to space <ln numlevel="1" lineno="576" slineno="10-62"/>availability.</subsection><subsection ssid="15-15-35" dnum="b-o" numlevel="1" lineno="577" slineno="10-63" level="2"><display>(b)</display>Normal application deadlines shall be disregarded under Subsection (7)(a).</subsection></subsection></section></bsec><bsec buid="16" num="53G-5-504" type="amend" src="code" uid="C53G-5-S504_2025070120250701" sort="53G05 05040020250701" numlevel="1" lineno="578" slineno="11-1" sn="11"><section number="53G-5-504" numlevel="1" lineno="579" slineno="11-2" type="amend"><secline lineno="578">Section 11, Section <bold>53G-5-504</bold> is amended to read:</secline><catline lineno="579"><bold>53G-5-504. Charter school closure.</bold></catline><subsection ssid="16-16-1" dnum="1-o" numlevel="1" lineno="580" slineno="11-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "receiving charter school" means a charter school that an <ln numlevel="1" lineno="581" slineno="11-4"/>authorizer permits under Subsection (12)(a), to accept enrollment applications from <ln numlevel="1" lineno="582" slineno="11-5"/>students of a closing charter school.</subsection><subsection ssid="16-16-2" dnum="2-o" numlevel="1" lineno="583" slineno="11-6" level="1"><display>(2)</display>If a charter school is closed for any reason, including the termination of a charter <ln numlevel="1" lineno="584" slineno="11-7"/>agreement in accordance with Section <xref depth="3" refnumber="53G-5-503">53G-5-503</xref> or the conversion of a charter school <ln numlevel="1" lineno="585" slineno="11-8"/>to a private school, the provisions of this section apply.</subsection><subsection ssid="16-16-3" dnum="3-o" numlevel="1" lineno="586" slineno="11-9" level="1"><display>(3)</display>A decision to close a charter school is made:<subsection ssid="16-16-4" dnum="a-o" numlevel="1" lineno="587" slineno="11-10" level="2"><display>(a)</display>when a charter school authorizer approves a motion to terminate described in Section <xref depth="3" refnumber="53G-5-503"><ln numlevel="1" lineno="588" slineno="11-11"/>53G-5-503</xref>;</subsection><subsection ssid="16-16-5" dnum="b-o" numlevel="1" lineno="589" slineno="11-12" level="2"><display>(b)</display>when the state board takes final action described in Section <xref depth="3" refnumber="53G-5-503">53G-5-503</xref>; or</subsection><subsection ssid="16-16-6" dnum="c-o" numlevel="1" lineno="590" slineno="11-13" level="2"><display>(c)</display>when a charter school provides notice to the charter school's authorizer that the <ln numlevel="1" lineno="591" slineno="11-14"/>charter school is relinquishing the charter school's charter.</subsection></subsection><subsection ssid="16-16-7" dnum="4-o" numlevel="1" lineno="592" slineno="11-15" level="1" space="false"><display>(4)</display><subsection ssid="16-16-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>No later than 10 days after the day on which a decision to close a charter school is <ln numlevel="1" lineno="593" slineno="11-16"/>made, the charter school shall:<subsection ssid="16-16-9" dnum="i-o" numlevel="1" lineno="594" slineno="11-17" level="3" tab="1"><display>(i)</display>provide notice to the following, in writing, of the decision:<subsection ssid="16-16-10" dnum="A-o" numlevel="1" lineno="595" slineno="11-18" level="4"><display>(A)</display>if the charter school made the decision to close, the charter school's authorizer;</subsection><subsection ssid="16-16-11" dnum="B-o" numlevel="1" lineno="596" slineno="11-19" level="4"><display>(B)</display>if the state board did not make the decision to close, the state board;</subsection><subsection ssid="16-16-12" dnum="C-o" numlevel="1" lineno="597" slineno="11-20" level="4"><display>(C)</display>parents of students enrolled at the charter school;</subsection><subsection ssid="16-16-13" dnum="D-o" numlevel="1" lineno="598" slineno="11-21" level="4"><display>(D)</display>the charter school's creditors;</subsection><subsection ssid="16-16-14" dnum="E-o" numlevel="1" lineno="599" slineno="11-22" level="4"><display>(E)</display>the charter school's lease holders;</subsection><subsection ssid="16-16-15" dnum="F-o" numlevel="1" lineno="600" slineno="11-23" level="4"><display>(F)</display>the charter school's bond issuers;</subsection><subsection ssid="16-16-16" dnum="G-o" numlevel="1" lineno="601" slineno="11-24" level="4"><display>(G)</display>other entities that may have a claim to the charter school's assets;</subsection><subsection ssid="16-16-17" dnum="H-o" numlevel="1" lineno="602" slineno="11-25" level="4"><display>(H)</display>the school district in which the charter school is located and other charter <ln numlevel="1" lineno="603" slineno="11-26"/>schools located in that school district; and</subsection><subsection ssid="16-16-18" dnum="I-o" numlevel="1" lineno="604" slineno="11-27" level="4"><display>(I)</display>any other person that the charter school determines to be appropriate; and</subsection></subsection><subsection ssid="16-16-19" dnum="ii-o" numlevel="1" lineno="605" slineno="11-28" level="3" tab="1"><display>(ii)</display>publish notice of the decision for the school district in which the charter school is <ln numlevel="1" lineno="606" slineno="11-29"/>located, as a class A notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least 30 days.</subsection></subsection><subsection ssid="16-16-20" dnum="b-o" numlevel="1" lineno="607" slineno="11-30" level="2"><display>(b)</display>The notice described in Subsection (4)(a) shall include:<subsection ssid="16-16-21" dnum="i-o" numlevel="1" lineno="608" slineno="11-31" level="3"><display>(i)</display>the proposed date of the charter school closure;</subsection><subsection ssid="16-16-22" dnum="ii-o" numlevel="1" lineno="609" slineno="11-32" level="3"><display>(ii)</display>the charter school's plans to help students identify and transition into a new <ln numlevel="1" lineno="610" slineno="11-33"/>school; and</subsection><subsection ssid="16-16-23" dnum="iii-o" numlevel="1" lineno="611" slineno="11-34" level="3"><display>(iii)</display>contact information for the charter school during the transition.</subsection></subsection></subsection><subsection ssid="16-16-24" dnum="5-o" numlevel="1" lineno="612" slineno="11-35" level="1"><display>(5)</display>No later than 10 days after the day on which a decision to close a charter school is <ln numlevel="1" lineno="613" slineno="11-36"/>made, the closing charter school shall:<subsection ssid="16-16-25" dnum="a-o" numlevel="1" lineno="614" slineno="11-37" level="2"><display>(a)</display>designate a custodian for the protection of student files and school business records;</subsection><subsection ssid="16-16-26" dnum="b-o" numlevel="1" lineno="615" slineno="11-38" level="2"><display>(b)</display>designate a base of operation that will be maintained throughout the charter school <ln numlevel="1" lineno="616" slineno="11-39"/>closing, including:<subsection ssid="16-16-27" dnum="i-o" numlevel="1" lineno="617" slineno="11-40" level="3"><display>(i)</display>an office;</subsection><subsection ssid="16-16-28" dnum="ii-o" numlevel="1" lineno="618" slineno="11-41" level="3"><display>(ii)</display>hours of operation;</subsection><subsection ssid="16-16-29" dnum="iii-o" numlevel="1" lineno="619" slineno="11-42" level="3"><display>(iii)</display>operational telephone service with voice messaging stating the hours of <ln numlevel="1" lineno="620" slineno="11-43"/>operation; and</subsection><subsection ssid="16-16-30" dnum="iv-o" numlevel="1" lineno="621" slineno="11-44" level="3"><display>(iv)</display>a designated individual to respond to questions or requests during the hours of <ln numlevel="1" lineno="622" slineno="11-45"/>operation;</subsection></subsection><subsection ssid="16-16-31" dnum="c-o" numlevel="1" lineno="623" slineno="11-46" level="2"><display>(c)</display>assure that the charter school will maintain private insurance coverage or risk <ln numlevel="1" lineno="624" slineno="11-47"/>management coverage for covered claims that arise before closure, throughout the <ln numlevel="1" lineno="625" slineno="11-48"/>transition to closure and for a period following closure of the charter school as <ln numlevel="1" lineno="626" slineno="11-49"/>specified by the charter school's authorizer;</subsection><subsection ssid="16-16-32" dnum="d-o" numlevel="1" lineno="627" slineno="11-50" level="2"><display>(d)</display>assure that the charter school will complete by the set deadlines for all fiscal years in <ln numlevel="1" lineno="628" slineno="11-51"/>which funds are received or expended by the charter school a financial audit and any <ln numlevel="1" lineno="629" slineno="11-52"/>other procedure required by state board rule;</subsection><subsection ssid="16-16-33" dnum="e-o" numlevel="1" lineno="630" slineno="11-53" level="2"><display>(e)</display>inventory all assets of the charter school; and</subsection><subsection ssid="16-16-34" dnum="f-o" numlevel="1" lineno="631" slineno="11-54" level="2"><display>(f)</display>list all creditors of the charter school and specifically identify secured creditors and <ln numlevel="1" lineno="632" slineno="11-55"/>assets that are security interests.</subsection></subsection><subsection ssid="16-16-35" dnum="6-o" numlevel="1" lineno="633" slineno="11-56" level="1"><display>(6)</display>The closing charter school's authorizer shall oversee the closing charter school's <ln numlevel="1" lineno="634" slineno="11-57"/>compliance with Subsection (5).</subsection><subsection ssid="16-16-36" dnum="7-o" numlevel="1" lineno="635" slineno="11-58" level="1" space="false"><display>(7)</display><subsection ssid="16-16-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Unless a different order is determined by a bankruptcy court under 11 U.S.C. Sec. <ln numlevel="1" lineno="636" slineno="11-59"/>1001 et seq., a closing charter school shall distribute the assets of the closing charter <ln numlevel="1" lineno="637" slineno="11-60"/>school in the following order:<subsection ssid="16-16-38" dnum="i-o" numlevel="1" lineno="638" slineno="11-61" level="3" tab="1"><display>(i)</display>return assets donated by a private donor to the private donor if:<subsection ssid="16-16-39" dnum="A-o" numlevel="1" lineno="639" slineno="11-62" level="4"><display>(A)</display>the assets were donated for a specific purpose;</subsection><subsection ssid="16-16-40" dnum="B-o" numlevel="1" lineno="640" slineno="11-63" level="4"><display>(B)</display>the private donor restricted use of the assets to only that specific purpose; and</subsection><subsection ssid="16-16-41" dnum="C-o" numlevel="1" lineno="641" slineno="11-64" level="4"><display>(C)</display>the closing charter school has assets that have not been used for the specific <ln numlevel="1" lineno="642" slineno="11-65"/>purpose;</subsection></subsection><subsection ssid="16-16-42" dnum="ii-o" numlevel="1" lineno="643" slineno="11-66" level="3" tab="1"><display>(ii)</display>distribute assets to satisfy outstanding payroll obligations for employees of the <ln numlevel="1" lineno="644" slineno="11-67"/>closing charter school;</subsection><subsection ssid="16-16-43" dnum="iii-o" numlevel="1" lineno="645" slineno="11-68" level="3" tab="1"><display>(iii)</display>distribute assets to creditors of the closing charter school; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="jchristopherson" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="16-72" dnum="_-o:iv-i" numlevel="1" lineno="646" slineno="11-69" ea="amend" anum="0" owner="jchristopherson" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1329" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="end">distribute assets to satisfy any outstanding authorizer fees; and</amend></subsection><subsection ssid="16-16-44" dnum="iv-o:v-i" numlevel="1" lineno="647" slineno="11-70" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1330" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1331" style="1" owner="i" level="1" amendtag="both" space="true">(v)</amend></display>distribute assets to satisfy any outstanding liability or obligation to the state <ln numlevel="1" lineno="648" slineno="11-71"/>board, state, or federal government.</subsection></subsection><subsection ssid="16-16-45" dnum="b-o" numlevel="1" lineno="649" slineno="11-72" level="2"><display>(b)</display>A closing charter school shall return any assets remaining, after all liabilities and <ln numlevel="1" lineno="650" slineno="11-73"/>obligations of the closing charter school are paid or discharged consistent with <ln numlevel="1" lineno="651" slineno="11-74"/>Subsection (7)(a), to the closing charter school's authorizer.</subsection><subsection ssid="16-16-46" dnum="c-o" numlevel="1" lineno="652" slineno="11-75" level="2"><display>(c)</display>Upon receipt of the assets under Subsection (7)(b), the closing charter school's <ln numlevel="1" lineno="653" slineno="11-76"/>authorizer shall:<subsection ssid="16-16-47" dnum="i-o" numlevel="1" lineno="654" slineno="11-77" level="3"><display>(i)</display>liquidate assets at fair market value; or</subsection><subsection ssid="16-16-48" dnum="ii-o" numlevel="1" lineno="655" slineno="11-78" level="3"><display>(ii)</display>assign the assets to another public school.</subsection></subsection><subsection ssid="16-16-49" dnum="d-o" numlevel="1" lineno="656" slineno="11-79" level="2"><display>(d)</display>The closing charter school's authorizer shall oversee liquidation of assets and <ln numlevel="1" lineno="657" slineno="11-80"/>payment of liabilities and obligations in accordance with this section, Sections <xref depth="3" refnumber="53F-9-307"><ln numlevel="1" lineno="658" slineno="11-81"/>53F-9-307</xref> and <xref depth="3" refnumber="53G-5-501">53G-5-501</xref>, and state board rule.</subsection></subsection><subsection ssid="16-16-50" dnum="8-o" numlevel="1" lineno="659" slineno="11-82" level="1"><display>(8)</display>The closing charter school shall:<subsection ssid="16-16-51" dnum="a-o" numlevel="1" lineno="660" slineno="11-83" level="2"><display>(a)</display>comply with all state and federal reporting requirements; and</subsection><subsection ssid="16-16-52" dnum="b-o" numlevel="1" lineno="661" slineno="11-84" level="2"><display>(b)</display>submit all documentation and complete all state and federal reports required by the <ln numlevel="1" lineno="662" slineno="11-85"/>closing charter school's authorizer or the state board, including documents to verify <ln numlevel="1" lineno="663" slineno="11-86"/>the closing charter school's compliance with procedural requirements and satisfaction <ln numlevel="1" lineno="664" slineno="11-87"/>of all financial issues.</subsection></subsection><subsection ssid="16-16-53" dnum="9-o" numlevel="1" lineno="665" slineno="11-88" level="1"><display>(9)</display>When the closing charter school's financial affairs are closed out and dissolution is <ln numlevel="1" lineno="666" slineno="11-89"/>complete, the authorizer shall ensure that a final audit of the charter school is completed.</subsection><subsection ssid="16-16-54" dnum="10-o" numlevel="1" lineno="667" slineno="11-90" level="1"><display>(10)</display>The state board shall, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="668" slineno="11-91"/>Rulemaking Act, and after considering suggestions from charter school authorizers, <ln numlevel="1" lineno="669" slineno="11-92"/>make rules that:<subsection ssid="16-16-55" dnum="a-o" numlevel="1" lineno="670" slineno="11-93" level="2"><display>(a)</display>provide additional closure procedures for charter schools; and</subsection><subsection ssid="16-16-56" dnum="b-o" numlevel="1" lineno="671" slineno="11-94" level="2"><display>(b)</display>establish a charter school closure process.</subsection></subsection><subsection ssid="16-16-57" dnum="11-o" numlevel="1" lineno="672" slineno="11-95" level="1" space="false"><display>(11)</display><subsection ssid="16-16-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon termination of the charter school's charter agreement:<subsection ssid="16-16-59" dnum="i-o" numlevel="1" lineno="673" slineno="11-96" level="3" tab="1"><display>(i)</display>notwithstanding provisions of Title 16, Chapter 6a, Part 14, Dissolution, the <ln numlevel="1" lineno="674" slineno="11-97"/>nonprofit corporation under which the charter school is organized and managed <ln numlevel="1" lineno="675" slineno="11-98"/>may be unilaterally dissolved by the authorizer; and</subsection><subsection ssid="16-16-60" dnum="ii-o" numlevel="1" lineno="676" slineno="11-99" level="3" tab="1"><display>(ii)</display>the net assets of the charter school shall revert to the authorizer as described in <ln numlevel="1" lineno="677" slineno="11-100"/>Subsection (7).</subsection></subsection><subsection ssid="16-16-61" dnum="b-o" numlevel="1" lineno="678" slineno="11-101" level="2"><display>(b)</display>The charter school and the authorizer shall mutually agree in writing on the effective <ln numlevel="1" lineno="679" slineno="11-102"/>date and time of the dissolution described in Subsection (11)(a).</subsection><subsection ssid="16-16-62" dnum="c-o" numlevel="1" lineno="680" slineno="11-103" level="2"><display>(c)</display>The effective date and time of dissolution described in Subsection (11)(b) may not <ln numlevel="1" lineno="681" slineno="11-104"/>exceed five years after the date of the termination of the charter agreement.</subsection></subsection><subsection ssid="16-16-63" dnum="12-o" numlevel="1" lineno="682" slineno="11-105" level="1"><display>(12)</display>Notwithstanding the provisions of Chapter 6, Part 5, Charter School Enrollment:<subsection ssid="16-16-64" dnum="a-o" numlevel="1" lineno="683" slineno="11-106" level="2"><display>(a)</display>an authorizer may permit a specified number of students from a closing charter <ln numlevel="1" lineno="684" slineno="11-107"/>school to be enrolled in another charter school, if the receiving charter school:<subsection ssid="16-16-65" dnum="i-o" numlevel="1" lineno="685" slineno="11-108" level="3" space="false"><display>(i)</display><subsection ssid="16-16-66" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is authorized by the same authorizer as the closing charter school; or</subsection><subsection ssid="16-16-67" dnum="B-o" numlevel="1" lineno="686" slineno="11-109" level="4"><display>(B)</display>is authorized by a different authorizer and the authorizer of the receiving <ln numlevel="1" lineno="687" slineno="11-110"/>charter school approves the increase in enrollment; and</subsection></subsection><subsection ssid="16-16-68" dnum="ii-o" numlevel="1" lineno="688" slineno="11-111" level="3"><display>(ii)</display>agrees to accept enrollment applications from students of the closing charter <ln numlevel="1" lineno="689" slineno="11-112"/>school;</subsection></subsection><subsection ssid="16-16-69" dnum="b-o" numlevel="1" lineno="690" slineno="11-113" level="2"><display>(b)</display>a receiving charter school shall give new enrollment preference to applications from <ln numlevel="1" lineno="691" slineno="11-114"/>students of the closing charter school in the first school year in which the closing <ln numlevel="1" lineno="692" slineno="11-115"/>charter school is not operational; and</subsection><subsection ssid="16-16-70" dnum="c-o" numlevel="1" lineno="693" slineno="11-116" level="2"><display>(c)</display>a receiving charter school's enrollment capacity is increased by the number of <ln numlevel="1" lineno="694" slineno="11-117"/>students enrolled in the receiving charter school from the closing charter school <ln numlevel="1" lineno="695" slineno="11-118"/>under this Subsection (12).</subsection></subsection><subsection ssid="16-16-71" dnum="13-o" numlevel="1" lineno="696" slineno="11-119" level="1"><display>(13)</display>A member of the governing board or staff of the receiving charter school that is also a <ln numlevel="1" lineno="697" slineno="11-120"/>member of the governing board of the receiving charter school's authorizer, shall recuse <ln numlevel="1" lineno="698" slineno="11-121"/>oneself from a decision regarding the enrollment of students from a closing charter <ln numlevel="1" lineno="699" slineno="11-122"/>school as described in Subsection (12).</subsection></section></bsec><bsec buid="17" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="700" slineno="12-1" sn="12"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="700">Section 12.  <bold>Effective Date.</bold></secline><sectionText lineno="701"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2025">July 1, 2025</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-26-25 11:41 AM</tm></rev></foot></leg>
