General provisions governing disclosure of discovery.</bold></catline><sectionText lineno="28"><tab/><bold>(a)  Disclosure.</bold>  This rule applies unless changed or supplemented by a rule governing <ln numlevel="1" lineno="29" slineno="1-4"/>disclosure and discovery in a practice area.<eol numlevel="1" lineno="30" slineno="1-5" display="tab"/><para/><bold>(1)  Initial disclosures.</bold>  Except in cases exempt under paragraph (a)(3), a party must, <ln numlevel="1" lineno="31" slineno="1-6"/>without waiting for a discovery request, serve on the other parties:<eol numlevel="1" lineno="32" slineno="1-7" display="tab"/><para/><tab/>(A)  the name and, if known, the address and telephone number of:<eol numlevel="1" lineno="33" slineno="1-8" display="tab"/><para/><tab/><tab/>(i)  each individual likely to have discoverable information supporting its claims <ln numlevel="1" lineno="34" slineno="1-9"/>or defenses, unless solely for impeachment, identifying the subjects of the information; and<eol numlevel="1" lineno="35" slineno="1-10" display="tab"/><para/><tab/><tab/>(ii)  each fact witness the party may call in its case-in-chief and, except for an <ln numlevel="1" lineno="36" slineno="1-11"/>adverse party, a summary of the expected testimony;<eol numlevel="1" lineno="37" slineno="1-12" display="tab"/><para/><tab/>(B)  a copy of all documents, data compilations, electronically stored information, <ln numlevel="1" lineno="38" slineno="1-13"/>and tangible things in the possession or control of the party that the party may offer in its <ln numlevel="1" lineno="39" slineno="1-14"/>case-in-chief, except charts, summaries, and demonstrative exhibits that have not yet been <ln numlevel="1" lineno="40" slineno="1-15"/>prepared and must be disclosed in accordance with paragraph (a)(5);<eol numlevel="1" lineno="41" slineno="1-16" display="tab"/><para/><tab/>(C)  a computation of any damages claimed and a copy of all discoverable documents <ln numlevel="1" lineno="42" slineno="1-17"/>or evidentiary material on which such computation is based, including materials about the <ln numlevel="1" lineno="43" slineno="1-18"/>nature and extent of injuries suffered;<eol numlevel="1" lineno="44" slineno="1-19" display="tab"/><para/><tab/>(D)  a copy of any agreement under which any person may be liable to satisfy part or <ln numlevel="1" lineno="45" slineno="1-20"/>all of a judgment or to indemnify or reimburse for payments made to satisfy the judgment; and<eol numlevel="1" lineno="46" slineno="1-21" display="tab"/><para/><tab/>(E)  a copy of all documents to which a party refers in its pleadings.<eol numlevel="1" lineno="47" slineno="1-22" display="tab"/><para/><bold>(2)  Timing of initial disclosures.</bold>  The disclosures required by paragraph (a)(1) must be <ln numlevel="1" lineno="48" slineno="1-23"/>served on the other parties:<eol numlevel="1" lineno="49" slineno="1-24" display="tab"/><para/><tab/>(A)  by a plaintiff within 14 days after the filing of the first answer to that plaintiff's <ln numlevel="1" lineno="50" slineno="1-25"/>complaint; and<eol numlevel="1" lineno="51" slineno="1-26" display="tab"/><para/><tab/>(B)  by a defendant within 42 days after the filing of that defendant's first answer to <ln numlevel="1" lineno="52" slineno="1-27"/>the complaint.<eol numlevel="1" lineno="53" slineno="1-28" display="tab"/><para/><bold>(3)  Exemptions.</bold><eol numlevel="1" lineno="54" slineno="1-29" display="tab"/><para/><tab/>(A)  Unless otherwise ordered by the court or agreed to by the parties, the <ln numlevel="1" lineno="55" slineno="1-30"/>requirements of paragraph (a)(1) do not apply to actions:<eol numlevel="1" lineno="56" slineno="1-31" display="tab"/><para/><tab/><tab/>(i)  for judicial review of adjudicative proceedings or rule making proceedings of <ln numlevel="1" lineno="57" slineno="1-32"/>an administrative agency;<eol numlevel="1" lineno="58" slineno="1-33" display="tab"/><para/><tab/><tab/>(ii)  governed by Rule 65B or Rule 65C;<eol numlevel="1" lineno="59" slineno="1-34" display="tab"/><para/><tab/><tab/>(iii)  to enforce an arbitration award;<amend anum="0" ea="amend" pairid="7" groupid="8" style="1" owner="jchristopherson" level="1" amendtag="both"> or</amend> <eol numlevel="1" lineno="60" slineno="1-35" display="tab"/><para/><tab/><tab/>(iv)  for water rights general adjudication under <amend anum="0" ea="amend" pairid="8" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both">Utah Code </amend>Title 73, Chapter 4, <ln numlevel="1" lineno="61" slineno="1-36"/>Determination of Water Rights.<eol numlevel="1" lineno="62" slineno="1-37" display="tab"/><para/><tab/>(B)  In an exempt action, the matters subject to disclosure under paragraph (a)(1) are <ln numlevel="1" lineno="63" slineno="1-38"/>subject to discovery under paragraph (b).<eol numlevel="1" lineno="64" slineno="1-39" display="tab"/><para/><bold>(4)  Expert testimony.</bold><eol numlevel="1" lineno="65" slineno="1-40" display="tab"/><para/><tab/><bold>(A)  Disclosure of retained expert testimony.</bold> A party must, without waiting for a <ln numlevel="1" lineno="66" slineno="1-41"/>discovery request, serve on the other parties the following information regarding any person <ln numlevel="1" lineno="67" slineno="1-42"/>who may be used at trial to present evidence under Rule 702 of the Utah Rules of Evidence <ln numlevel="1" lineno="68" slineno="1-43"/>and who is retained or specially employed to provide expert testimony in the case or whose <ln numlevel="1" lineno="69" slineno="1-44"/>duties as an employee of the party regularly involve giving expert testimony: (i) the expert's <ln numlevel="1" lineno="70" slineno="1-45"/>name and qualifications, including a list of all publications authored within the preceding 10 <ln numlevel="1" lineno="71" slineno="1-46"/>years, and a list of any other cases in which the expert has testified as an expert at trial or by <ln numlevel="1" lineno="72" slineno="1-47"/>deposition within the preceding four years, (ii) a brief summary of the opinions to which the <ln numlevel="1" lineno="73" slineno="1-48"/>witness is expected to testify, (iii) the facts, data, and other information specific to the case that <ln numlevel="1" lineno="74" slineno="1-49"/>will be relied upon by the witness in forming those opinions, and (iv) the compensation to be <ln numlevel="1" lineno="75" slineno="1-50"/>paid for the witness's study and testimony.<eol numlevel="1" lineno="76" slineno="1-51" display="tab"/><para/><tab/><bold>(B)  Limits on expert discovery.</bold> Further discovery may be obtained from an expert <ln numlevel="1" lineno="77" slineno="1-52"/>witness either by deposition or by written report. A deposition must not exceed four hours and <ln numlevel="1" lineno="78" slineno="1-53"/>the party taking the deposition must pay the expert's reasonable hourly fees for attendance at <ln numlevel="1" lineno="79" slineno="1-54"/>the deposition. A report must be signed by the expert and must contain a complete statement of <ln numlevel="1" lineno="80" slineno="1-55"/>all opinions the expert will offer at trial and the basis and reasons for them. Such an expert <ln numlevel="1" lineno="81" slineno="1-56"/>may not testify in a party's case-in-chief concerning any matter not fairly disclosed in the <ln numlevel="1" lineno="82" slineno="1-57"/>report. The party offering the expert must pay the costs for the report.<eol numlevel="1" lineno="83" slineno="1-58" display="tab"/><para/><tab/><bold>(C)  Timing for expert discovery.</bold><eol numlevel="1" lineno="84" slineno="1-59" display="tab"/><para/><tab/><tab/>(i)  The party who bears the burden of proof on the issue for which expert <ln numlevel="1" lineno="85" slineno="1-60"/>testimony is offered must serve on the other parties the information required by paragraph <ln numlevel="1" lineno="86" slineno="1-61"/>(a)(4)(A) within 14 days after the close of fact discovery. Within 14 days thereafter, the party <ln numlevel="1" lineno="87" slineno="1-62"/>opposing the expert may serve notice electing either a deposition of the expert pursuant to <ln numlevel="1" lineno="88" slineno="1-63"/>paragraph (a)(4)(B) and Rule 30, or a written report pursuant to paragraph (a)(4)(B). The <ln numlevel="1" lineno="89" slineno="1-64"/>deposition must occur, or the report must be served on the other parties, within 42 days after <ln numlevel="1" lineno="90" slineno="1-65"/>the election is served on the other parties. If no election is served on the other parties, then no <ln numlevel="1" lineno="91" slineno="1-66"/>further discovery of the expert must be permitted.<eol numlevel="1" lineno="92" slineno="1-67" display="tab"/><para/><tab/><tab/>(ii)  The party who does not bear the burden of proof on the issue for which expert <ln numlevel="1" lineno="93" slineno="1-68"/>testimony is offered must serve on the other parties the information required by paragraph <ln numlevel="1" lineno="94" slineno="1-69"/>(a)(4)(A) within 14 days after the later of (A) the date on which the disclosure under paragraph <ln numlevel="1" lineno="95" slineno="1-70"/>(a)(4)(C)(i) is due, or (B) service of the written report or the taking of the expert's deposition <ln numlevel="1" lineno="96" slineno="1-71"/>pursuant to paragraph (a)(4)(C)(i). Within 14 days thereafter, the party opposing the expert <ln numlevel="1" lineno="97" slineno="1-72"/>may serve notice electing either a deposition of the expert pursuant to paragraph (a)(4)(B) and <ln numlevel="1" lineno="98" slineno="1-73"/>Rule 30, or a written report pursuant to paragraph (a)(4)(B). The deposition must occur, or the <ln numlevel="1" lineno="99" slineno="1-74"/>report must be served on the other parties, within 42 days after the election is served on the <ln numlevel="1" lineno="100" slineno="1-75"/>other parties. If no election is served on the other parties, then no further discovery of the <ln numlevel="1" lineno="101" slineno="1-76"/>expert must be permitted.<eol numlevel="1" lineno="102" slineno="1-77" display="tab"/><para/><tab/><tab/>(iii)  If the party who bears the burden of proof on an issue wants to designate <ln numlevel="1" lineno="103" slineno="1-78"/>rebuttal expert witnesses, it must serve on the other parties the information required by <ln numlevel="1" lineno="104" slineno="1-79"/>paragraph (a)(4)(A) within 14 days after the later of (A) the date on which the election under <ln numlevel="1" lineno="105" slineno="1-80"/>paragraph (a)(4)(C)(ii) is due or (B) service of the written report or the taking of the expert's <ln numlevel="1" lineno="106" slineno="1-81"/>deposition pursuant to paragraph (a)(4)(C)(ii). Within 14 days thereafter, the party opposing <ln numlevel="1" lineno="107" slineno="1-82"/>the expert may serve notice electing either a deposition of the expert pursuant to paragraph <ln numlevel="1" lineno="108" slineno="1-83"/>(a)(4)(B) and Rule 30, or a written report pursuant to paragraph (a)(4)(B). The deposition must <ln numlevel="1" lineno="109" slineno="1-84"/>occur, or the report must be served on the other parties, within 42 days after the election is <ln numlevel="1" lineno="110" slineno="1-85"/>served on the other parties. If no election is served on the other parties, then no further <ln numlevel="1" lineno="111" slineno="1-86"/>discovery of the expert must be permitted. The court may preclude an expert disclosed only as <ln numlevel="1" lineno="112" slineno="1-87"/>a rebuttal expert from testifying in the case in chief.<eol numlevel="1" lineno="113" slineno="1-88" display="tab"/><para/><tab/><bold>(D)  Multiparty actions.</bold>  In multiparty actions, all parties opposing the expert must <ln numlevel="1" lineno="114" slineno="1-89"/>agree on either a report or a deposition. If all parties opposing the expert do not agree, then <ln numlevel="1" lineno="115" slineno="1-90"/>further discovery of the expert may be obtained only by deposition pursuant to paragraph <ln numlevel="1" lineno="116" slineno="1-91"/>(a)(4)(B) and Rule 30.<eol numlevel="1" lineno="117" slineno="1-92" display="tab"/><para/><tab/><bold>(E)  Summary of non-retained expert testimony.</bold>  If a party intends to present <ln numlevel="1" lineno="118" slineno="1-93"/>evidence at trial under Rule 702 of the Utah Rules of Evidence from any person other than an <ln numlevel="1" lineno="119" slineno="1-94"/>expert witness who is retained or specially employed to provide testimony in the case or a <ln numlevel="1" lineno="120" slineno="1-95"/>person whose duties as an employee of the party regularly involve giving expert testimony, <ln numlevel="1" lineno="121" slineno="1-96"/>that party must serve on the other parties a written summary of the facts and opinions to which <ln numlevel="1" lineno="122" slineno="1-97"/>the witness is expected to testify in accordance with the deadlines set forth in paragraph <ln numlevel="1" lineno="123" slineno="1-98"/>(a)(4)(C). Such a witness cannot be required to provide a report pursuant to paragraph <ln numlevel="1" lineno="124" slineno="1-99"/>(a)(4)(B).  A deposition of such a witness may not exceed four hours and, unless manifest <ln numlevel="1" lineno="125" slineno="1-100"/>injustice would result, the party taking the deposition must pay the expert's reasonable hourly <ln numlevel="1" lineno="126" slineno="1-101"/>fees for attendance at the deposition.<eol numlevel="1" lineno="127" slineno="1-102" display="tab"/><para/><bold>(5)  Pretrial disclosures.</bold><eol numlevel="1" lineno="128" slineno="1-103" display="tab"/><para/><tab/>(A)  A party must, without waiting for a discovery request, serve on the other parties:<eol numlevel="1" lineno="129" slineno="1-104" display="tab"/><para/><tab/><tab/>(i)  the name and, if not previously provided, the address and telephone number of <ln numlevel="1" lineno="130" slineno="1-105"/>each witness, unless solely for impeachment, separately identifying witnesses the party will <ln numlevel="1" lineno="131" slineno="1-106"/>call and witnesses the party may call;<eol numlevel="1" lineno="132" slineno="1-107" display="tab"/><para/><tab/><tab/>(ii)  the name of witnesses whose testimony is expected to be presented by <ln numlevel="1" lineno="133" slineno="1-108"/>transcript of a deposition;<eol numlevel="1" lineno="134" slineno="1-109" display="tab"/><para/><tab/><tab/>(iii)  designations of the proposed deposition testimony; and<eol numlevel="1" lineno="135" slineno="1-110" display="tab"/><para/><tab/><tab/>(iv)  a copy of each exhibit, including charts, summaries, and demonstrative <ln numlevel="1" lineno="136" slineno="1-111"/>exhibits, unless solely for impeachment, separately identifying those which the party will offer <ln numlevel="1" lineno="137" slineno="1-112"/>and those which the party may offer.<eol numlevel="1" lineno="138" slineno="1-113" display="tab"/><para/><tab/>(B)  Disclosure required by paragraph (a)(5)(A) must be served on the other parties at <ln numlevel="1" lineno="139" slineno="1-114"/>least 28 days before trial. Disclosures required by paragraph (a)(5)(A)(i) and (a)(5)(A)(ii) must <ln numlevel="1" lineno="140" slineno="1-115"/>also be filed on the date that they are served.  At least 14 days before trial, a party must serve <ln numlevel="1" lineno="141" slineno="1-116"/>any counter designations of deposition testimony and any objections and grounds for the <ln numlevel="1" lineno="142" slineno="1-117"/>objections to the use of any deposition, witness, or exhibit if the grounds for the objection are <ln numlevel="1" lineno="143" slineno="1-118"/>apparent before trial. Other than objections under Rules 402 and 403 of the Utah Rules of <ln numlevel="1" lineno="144" slineno="1-119"/>Evidence, other objections not listed are waived unless excused by the court for good cause.<eol numlevel="1" lineno="145" slineno="1-120" display="tab"/><para/><bold>(6)  Form of disclosure and discovery production.</bold>  Rule 34 governs the form in which all <ln numlevel="1" lineno="146" slineno="1-121"/>documents, data compilations, electronically stored information, tangible things, and <ln numlevel="1" lineno="147" slineno="1-122"/>evidentiary material should be produced under this Rule.<eol numlevel="1" lineno="148" slineno="1-123" display="tab"/><bold>(b)  Discovery scope.</bold><eol numlevel="1" lineno="149" slineno="1-124" display="tab"/><para/><bold>(1)  In general.</bold>  Parties may discover any matter, not privileged, which is relevant to the <ln numlevel="1" lineno="150" slineno="1-125"/>claim or defense of any party if the discovery satisfies the standards of proportionality set forth <ln numlevel="1" lineno="151" slineno="1-126"/>below.<eol numlevel="1" lineno="152" slineno="1-127" display="tab"/><para/><bold>(2)  Privileged matters.</bold><eol numlevel="1" lineno="153" slineno="1-128" display="tab"/><para/><tab/>(A)  Privileged matters that are not discoverable or admissible in any proceeding of <ln numlevel="1" lineno="154" slineno="1-129"/>any kind or character include:<eol numlevel="1" lineno="155" slineno="1-130" display="tab"/><para/><tab/><tab/>(i) all information in any form provided during and created specifically as part of a <ln numlevel="1" lineno="156" slineno="1-131"/>request for an investigation, the investigation, findings, or conclusions of peer review, care <ln numlevel="1" lineno="157" slineno="1-132"/>review, or quality assurance processes of any organization of health care providers as defined <ln numlevel="1" lineno="158" slineno="1-133"/>in Utah Code Title 78B, Chapter 3, Part 4, Utah Health Care Malpractice Act, for the purpose <ln numlevel="1" lineno="159" slineno="1-134"/>of evaluating care provided to reduce morbidity and mortality or to improve the quality of <ln numlevel="1" lineno="160" slineno="1-135"/>medical care, or for the purpose of peer review of the ethics, competence, or professional <ln numlevel="1" lineno="161" slineno="1-136"/>conduct of any health care provider; and<eol numlevel="1" lineno="162" slineno="1-137" display="tab"/><para/><tab/><tab/>(ii)  except as provided in paragraph (b)(2)(C), (D), or (E), all communications, <ln numlevel="1" lineno="163" slineno="1-138"/>materials, and information in any form specifically created for or during a medical candor <ln numlevel="1" lineno="164" slineno="1-139"/>process under Utah Code Title 78B, Chapter 3, Part 4a, Utah Medical Candor Act, including <ln numlevel="1" lineno="165" slineno="1-140"/>any findings or conclusions from the investigation and any offer of compensation.<eol numlevel="1" lineno="166" slineno="1-141" display="tab"/><para/><tab/>(B)  Disclosure or use in a medical candor process of any communication, material, <ln numlevel="1" lineno="167" slineno="1-142"/>or information in any form that contains any information described in paragraph (b)(2)(A)(i)  <ln numlevel="1" lineno="168" slineno="1-143"/>does not waive any privilege or protection against admissibility or discovery of the <ln numlevel="1" lineno="169" slineno="1-144"/>information under paragraph (b)(2)(A)(i).<eol numlevel="1" lineno="170" slineno="1-145" display="tab"/><para/><tab/>(C)  Any communication, material, or information in any form that is made or <ln numlevel="1" lineno="171" slineno="1-146"/>provided in the ordinary course of business, including a medical record or a business record, <ln numlevel="1" lineno="172" slineno="1-147"/>that is otherwise discoverable or admissible and is not created for or during a medical candor <ln numlevel="1" lineno="173" slineno="1-148"/>process is not privileged by the use or disclosure of the communication, material, or <ln numlevel="1" lineno="174" slineno="1-149"/>information during a medical candor process.<eol numlevel="1" lineno="175" slineno="1-150" display="tab"/><para/><tab/>(D) (i)  Any information that is required to be documented in a patient's medical <ln numlevel="1" lineno="176" slineno="1-151"/>record under state or federal law is not privileged by the use or disclosure of the information <ln numlevel="1" lineno="177" slineno="1-152"/>during a medical candor process.<eol numlevel="1" lineno="178" slineno="1-153" display="tab"/><para/><tab/><tab/>(ii)  Information described in paragraph (b)(2)(D)(i) does not include an <ln numlevel="1" lineno="179" slineno="1-154"/>individual's mental impressions, conclusions, or opinions that are formed outside the course <ln numlevel="1" lineno="180" slineno="1-155"/>and scope of the patient's care and treatment and are used or disclosed in a medical candor <ln numlevel="1" lineno="181" slineno="1-156"/>process.<eol numlevel="1" lineno="182" slineno="1-157" display="tab"/><para/><tab/>(E) (i)  Any communication, material, or information in any form that is provided to <ln numlevel="1" lineno="183" slineno="1-158"/>an affected party before the affected party's written agreement to participate in a medical <ln numlevel="1" lineno="184" slineno="1-159"/>candor process is not privileged by the use or disclosure of the communication, material, or <ln numlevel="1" lineno="185" slineno="1-160"/>information during a medical candor process.<eol numlevel="1" lineno="186" slineno="1-161" display="tab"/><para/><tab/><tab/>(ii)  Any communication, material, or information described in paragraph <ln numlevel="1" lineno="187" slineno="1-162"/>(b)(2)(E)(i) does not include a written notice described in Utah Code section <xref depth="3" refnumber="78B-3-452">78B-3-452</xref>.<eol numlevel="1" lineno="188" slineno="1-163" display="tab"/><para/><tab/>(F)  The terms defined in Utah Code section <xref depth="3" refnumber="78B-3-450">78B-3-450</xref> apply to paragraphs <ln numlevel="1" lineno="189" slineno="1-164"/>(b)(2)(A)(ii), (B), (C), (D), and (E).<eol numlevel="1" lineno="190" slineno="1-165" display="tab"/><para/><tab/>(G)  Nothing in this paragraph (b)(2) shall prevent a party from raising any other <ln numlevel="1" lineno="191" slineno="1-166"/>privileges provided by law or rule as to the admissibility or discovery of any communication, <ln numlevel="1" lineno="192" slineno="1-167"/>information, or material described in paragraph (b)(2)(A), (B), (C), (D), or (E).<eol numlevel="1" lineno="193" slineno="1-168" display="tab"/><para/><bold>(3) Proportionality.</bold>  Discovery and discovery requests are proportional if:<eol numlevel="1" lineno="194" slineno="1-169" display="tab"/><para/><tab/>(A)  the discovery is reasonable, considering the needs of the case, the amount in <ln numlevel="1" lineno="195" slineno="1-170"/>controversy, the complexity of the case, the parties' resources, the importance of the issues, <ln numlevel="1" lineno="196" slineno="1-171"/>and the importance of the discovery in resolving the issues;<eol numlevel="1" lineno="197" slineno="1-172" display="tab"/><para/><tab/>(B)  the likely benefits of the proposed discovery outweigh the burden or expense;<eol numlevel="1" lineno="198" slineno="1-173" display="tab"/><para/><tab/>(C)  the discovery is consistent with the overall case management and will further the <ln numlevel="1" lineno="199" slineno="1-174"/>just, speedy, and inexpensive determination of the case;<eol numlevel="1" lineno="200" slineno="1-175" display="tab"/><para/><tab/>(D)  the discovery is not unreasonably cumulative or duplicative;<eol numlevel="1" lineno="201" slineno="1-176" display="tab"/><para/><tab/>(E)  the information cannot be obtained from another source that is more convenient, <ln numlevel="1" lineno="202" slineno="1-177"/>less burdensome, or less expensive; and<eol numlevel="1" lineno="203" slineno="1-178" display="tab"/><para/><tab/>(F)  the party seeking discovery has not had sufficient opportunity to obtain the <ln numlevel="1" lineno="204" slineno="1-179"/>information by discovery or otherwise, taking into account the parties' relative access to the <ln numlevel="1" lineno="205" slineno="1-180"/>information.<eol numlevel="1" lineno="206" slineno="1-181" display="tab"/><para/><bold>(4)  Burden.</bold>  The party seeking discovery always has the burden of showing <ln numlevel="1" lineno="207" slineno="1-182"/>proportionality and relevance. To ensure proportionality, the court may enter orders under <ln numlevel="1" lineno="208" slineno="1-183"/>Rule 37.<eol numlevel="1" lineno="209" slineno="1-184" display="tab"/><para/><bold>(5)  Electronically stored information.</bold>  A party claiming that electronically stored <ln numlevel="1" lineno="210" slineno="1-185"/>information is not reasonably accessible because of undue burden or cost must describe the <ln numlevel="1" lineno="211" slineno="1-186"/>source of the electronically stored information, the nature and extent of the burden, the nature <ln numlevel="1" lineno="212" slineno="1-187"/>of the information not provided, and any other information that will enable other parties to <ln numlevel="1" lineno="213" slineno="1-188"/>evaluate the claim.<eol numlevel="1" lineno="214" slineno="1-189" display="tab"/><para/><bold>(6)  Trial preparation materials.</bold>  A party may obtain otherwise discoverable documents <ln numlevel="1" lineno="215" slineno="1-190"/>and tangible things prepared in anticipation of litigation or for trial by or for another party or <ln numlevel="1" lineno="216" slineno="1-191"/>by or for that other party's representative (including the party's attorney, consultant, surety, <ln numlevel="1" lineno="217" slineno="1-192"/>indemnitor, insurer, or agent) only upon a showing that the party seeking discovery has <ln numlevel="1" lineno="218" slineno="1-193"/>substantial need of the materials and that the party is unable without undue hardship to obtain <ln numlevel="1" lineno="219" slineno="1-194"/>substantially equivalent materials by other means. In ordering discovery of such materials, the <ln numlevel="1" lineno="220" slineno="1-195"/>court must protect against disclosure of the mental impressions, conclusions, opinions, or legal <ln numlevel="1" lineno="221" slineno="1-196"/>theories of an attorney or other representative of a party.<eol numlevel="1" lineno="222" slineno="1-197" display="tab"/><para/><bold>(7)  Statement previously made about the action. </bold> A party may obtain without the <ln numlevel="1" lineno="223" slineno="1-198"/>showing required in paragraph<amend anum="0" ea="amend" pairid="9" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both"> </amend>(b)(5) a statement concerning the action or its subject matter <ln numlevel="1" lineno="224" slineno="1-199"/>previously made by that party. Upon request, a person not a party may obtain without the <ln numlevel="1" lineno="225" slineno="1-200"/>required showing a statement about the action or its subject matter previously made by that <ln numlevel="1" lineno="226" slineno="1-201"/>person. If the request is refused, the person may move for a court order under Rule 37. A <ln numlevel="1" lineno="227" slineno="1-202"/>statement previously made is<amend anum="0" ea="amend" pairid="10" groupid="11" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> (A) a written statement signed or approved by the person <ln numlevel="1" lineno="228" slineno="1-203"/>making it<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="14" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> or (B) a stenographic, mechanical, electronic, or other recording, or a <ln numlevel="1" lineno="229" slineno="1-204"/>transcription thereof, which is a substantially verbatim recital of an oral statement by the <ln numlevel="1" lineno="230" slineno="1-205"/>person making it and contemporaneously recorded.<eol numlevel="1" lineno="231" slineno="1-206" display="tab"/><para/><bold>(8)  Trial preparation; experts.</bold><eol numlevel="1" lineno="232" slineno="1-207" display="tab"/><para/><tab/><bold>(A)  Trial-preparation protection for draft reports or disclosures.</bold>  Paragraph (b)(6) <ln numlevel="1" lineno="233" slineno="1-208"/>protects drafts of any report or disclosure required under paragraph (a)(4), regardless of the <ln numlevel="1" lineno="234" slineno="1-209"/>form in which the draft is recorded.<eol numlevel="1" lineno="235" slineno="1-210" display="tab"/><para/><tab/><bold>(B)  Trial-preparation protection for communications between a party's attorney and <ln numlevel="1" lineno="236" slineno="1-211"/>expert witnesses.</bold>  Paragraph (b)(6) protects communications between the party's attorney and <ln numlevel="1" lineno="237" slineno="1-212"/>any witness required to provide disclosures under paragraph (a)(4), regardless of the form of <ln numlevel="1" lineno="238" slineno="1-213"/>the communications, except to the extent that the communications:<eol numlevel="1" lineno="239" slineno="1-214" display="tab"/><para/><tab/><tab/>(i)  relate to compensation for the expert's study or testimony;<eol numlevel="1" lineno="240" slineno="1-215" display="tab"/><para/><tab/><tab/>(ii)  identify facts or data that the party's attorney provided and that the expert <ln numlevel="1" lineno="241" slineno="1-216"/>considered in forming the opinions to be expressed; or<eol numlevel="1" lineno="242" slineno="1-217" display="tab"/><para/><tab/><tab/>(iii)  identify assumptions that the party's attorney provided and that the expert <ln numlevel="1" lineno="243" slineno="1-218"/>relied on in forming the opinions to be expressed.<eol numlevel="1" lineno="244" slineno="1-219" display="tab"/><para/><tab/><bold>(C)  Expert employed only for trial preparation.</bold>  Ordinarily, a party may not, by <ln numlevel="1" lineno="245" slineno="1-220"/>interrogatories or otherwise, discover facts known or opinions held by an expert who has been <ln numlevel="1" lineno="246" slineno="1-221"/>retained or specially employed by another party in anticipation of litigation or to prepare for <ln numlevel="1" lineno="247" slineno="1-222"/>trial and who is not expected to be called as a witness at trial. A party may do so only:<eol numlevel="1" lineno="248" slineno="1-223" display="tab"/><para/><tab/><tab/>(i)  as provided in Rule 35(b); or<eol numlevel="1" lineno="249" slineno="1-224" display="tab"/><para/><tab/><tab/>(ii)  on showing exceptional circumstances under which it is impracticable for the <ln numlevel="1" lineno="250" slineno="1-225"/>party to obtain facts or opinions on the same subject by other means.<eol numlevel="1" lineno="251" slineno="1-226" display="tab"/><para/><bold>(9)  Claims of privilege or protection of trial preparation materials.</bold><eol numlevel="1" lineno="252" slineno="1-227" display="tab"/><para/><tab/><bold>(A)  Information withheld.</bold>  If a party withholds discoverable information by claiming <ln numlevel="1" lineno="253" slineno="1-228"/>that it is privileged or prepared in anticipation of litigation or for trial, the party must make the <ln numlevel="1" lineno="254" slineno="1-229"/>claim expressly and must describe the nature of the documents, communications, or things not <ln numlevel="1" lineno="255" slineno="1-230"/>produced in a manner that, without revealing the information itself, will enable other parties to <ln numlevel="1" lineno="256" slineno="1-231"/>evaluate the claim.<eol numlevel="1" lineno="257" slineno="1-232" display="tab"/><para/><tab/><bold>(B)  Information produced.</bold>  If a party produces information that the party claims is <ln numlevel="1" lineno="258" slineno="1-233"/>privileged or prepared in anticipation of litigation or for trial, the producing party may notify <ln numlevel="1" lineno="259" slineno="1-234"/>any receiving party of the claim and the basis for it. After being notified, a receiving party <ln numlevel="1" lineno="260" slineno="1-235"/>must promptly return, sequester, or destroy the specified information and any copies it has and <ln numlevel="1" lineno="261" slineno="1-236"/>may not use or disclose the information until the claim is resolved. A receiving party may <ln numlevel="1" lineno="262" slineno="1-237"/>promptly present the information to the court under seal for a determination of the claim. If the <ln numlevel="1" lineno="263" slineno="1-238"/>receiving party disclosed the information before being notified, it must take reasonable steps to <ln numlevel="1" lineno="264" slineno="1-239"/>retrieve it. The producing party must preserve the information until the claim is resolved.<amend anum="0" ea="amend" pairid="0" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="265" slineno="1-240" display="tab"/><bold>(C)</bold> <bold>Information disclosed in a legislative audit.</bold> If a party is an entity that is subject to an <ln numlevel="1" lineno="266" slineno="1-241"/>audit by the legislative auditor general under Utah Constitution, Article VI, Section 33, and <ln numlevel="1" lineno="267" slineno="1-242"/>information that is privileged or prepared in anticipation of litigation or for trial is disclosed to <ln numlevel="1" lineno="268" slineno="1-243"/>the legislative auditor general or an arbitrator as described in Utah Code section <xref depth="3" refnumber="36-12-15">36-12-15</xref>, the <ln numlevel="1" lineno="269" slineno="1-244"/>disclosure to the legislative auditor general or the arbitrator does not make the information <ln numlevel="1" lineno="270" slineno="1-245"/>discoverable or prevent the party from claiming that the information is privileged and prepared <ln numlevel="1" lineno="271" slineno="1-246"/>in anticipation of litigation or for trial.</amend><eol numlevel="1" lineno="272" slineno="1-247" display="tab"/><bold>(c)  Methods, sequence, and timing of discovery; tiers; limits on standard discovery; <ln numlevel="1" lineno="273" slineno="1-248"/>extraordinary discovery.</bold><eol numlevel="1" lineno="274" slineno="1-249" display="tab"/><para/><bold>(1)  Methods of discovery.</bold>  Parties may obtain discovery by one or more of the <ln numlevel="1" lineno="275" slineno="1-250"/>following methods: depositions upon oral examination or written questions; written <ln numlevel="1" lineno="276" slineno="1-251"/>interrogatories; production of documents or things or permission to enter upon land or other <ln numlevel="1" lineno="277" slineno="1-252"/>property, for inspection and other purposes; physical and mental examinations; requests for <ln numlevel="1" lineno="278" slineno="1-253"/>admission; and subpoenas other than for a court hearing or trial.<eol numlevel="1" lineno="279" slineno="1-254" display="tab"/><para/><bold>(2)  Sequence and timing of discovery.</bold>  Methods of discovery may be used in any <ln numlevel="1" lineno="280" slineno="1-255"/>sequence, and the fact that a party is conducting discovery must not delay any other party's <ln numlevel="1" lineno="281" slineno="1-256"/>discovery. Except for cases exempt under paragraph (a)(3), a party may not seek discovery <ln numlevel="1" lineno="282" slineno="1-257"/>from any source before that party's initial disclosure obligations are satisfied.<eol numlevel="1" lineno="283" slineno="1-258" display="tab"/><para/><bold>(3)  Definition of tiers for standard discovery.</bold>  Actions claiming $50,000 or less in <ln numlevel="1" lineno="284" slineno="1-259"/>damages are permitted standard discovery as described for Tier 1. Actions claiming more than <ln numlevel="1" lineno="285" slineno="1-260"/>$50,000 and less than $300,000 in damages are permitted standard discovery as described for <ln numlevel="1" lineno="286" slineno="1-261"/>Tier 2. Actions claiming $300,000 or more in damages are permitted standard discovery as <ln numlevel="1" lineno="287" slineno="1-262"/>described for Tier 3. Absent an accompanying damage claim for more than $300,000, actions <ln numlevel="1" lineno="288" slineno="1-263"/>claiming non-monetary relief are permitted standard discovery as described for Tier 2. <ln numlevel="1" lineno="289" slineno="1-264"/>Domestic relations actions are permitted standard discovery as described for Tier 4.<eol numlevel="1" lineno="290" slineno="1-265" display="tab"/><para/><bold>(4)  Definition of damages.</bold>  For purposes of determining standard discovery, the amount <ln numlevel="1" lineno="291" slineno="1-266"/>of damages includes the total of all monetary damages sought (without duplication for <ln numlevel="1" lineno="292" slineno="1-267"/>alternative theories) by all parties in all claims for relief in the original pleadings.<eol numlevel="1" lineno="293" slineno="1-268" display="tab"/><para/><bold>(5)  Limits on standard fact discovery.</bold>  Standard fact discovery per side (plaintiffs <ln numlevel="1" lineno="294" slineno="1-269"/>collectively, defendants collectively, and third-party defendants collectively) in each tier is as <ln numlevel="1" lineno="295" slineno="1-270"/>follows. disclosure or response by an organization; <ln numlevel="1" lineno="315" slineno="1-290"/>failure to disclose; initial and supplemental disclosures and responses.</bold><eol numlevel="1" lineno="316" slineno="1-291" display="tab"/><para/>(1)  A party must make disclosures and responses to discovery based on the information <ln numlevel="1" lineno="317" slineno="1-292"/>then known or reasonably available to the party.<eol numlevel="1" lineno="318" slineno="1-293" display="tab"/><para/>(2)  If the party providing disclosure or responding to discovery is a corporation, <ln numlevel="1" lineno="319" slineno="1-294"/>partnership, association, or governmental agency, the party must act through one or more <ln numlevel="1" lineno="320" slineno="1-295"/>officers, directors, managing agents, or other persons, who must make disclosures and <ln numlevel="1" lineno="321" slineno="1-296"/>responses to discovery based on the information then known or reasonably available to the <ln numlevel="1" lineno="322" slineno="1-297"/>party.<eol numlevel="1" lineno="323" slineno="1-298" display="tab"/><para/>(3)  A party is not excused from making disclosures or responses because the party has <ln numlevel="1" lineno="324" slineno="1-299"/>not completed investigating the case, the party challenges the sufficiency of another party's <ln numlevel="1" lineno="325" slineno="1-300"/>disclosures or responses, or another party has not made disclosures or responses.<eol numlevel="1" lineno="326" slineno="1-301" display="tab"/><para/>(4)  If a party fails to disclose or to supplement timely a disclosure or response to <ln numlevel="1" lineno="327" slineno="1-302"/>discovery, that party may not use the undisclosed witness, document, or material at any <ln numlevel="1" lineno="328" slineno="1-303"/>hearing or trial unless the failure is harmless or the party shows good cause for the failure.<eol numlevel="1" lineno="329" slineno="1-304" display="tab"/><para/>(5)  If a party learns that a disclosure or response is incomplete or incorrect in some <ln numlevel="1" lineno="330" slineno="1-305"/>important way, the party must timely serve on the other parties the additional or correct <ln numlevel="1" lineno="331" slineno="1-306"/>information if it has not been made known to the other parties. The supplemental disclosure or <ln numlevel="1" lineno="332" slineno="1-307"/>response must state why the additional or correct information was not previously provided.<eol numlevel="1" lineno="333" slineno="1-308" display="tab"/><bold>(e)  Signing discovery requests, responses, and objections.</bold>  Every disclosure, request for <ln numlevel="1" lineno="334" slineno="1-309"/>discovery, response to a request for discovery, and objection to a request for discovery must be <ln numlevel="1" lineno="335" slineno="1-310"/>in writing and signed by at least one attorney of record or by the party if the party is not <ln numlevel="1" lineno="336" slineno="1-311"/>represented. The signature of the attorney or party is a certification under Rule 11. If a request <ln numlevel="1" lineno="337" slineno="1-312"/>or response is not signed, the receiving party does not need to take any action with respect to <ln numlevel="1" lineno="338" slineno="1-313"/>it. level="1" amendtag="both"><eol numlevel="1" lineno="354" slineno="2-11" display="tab"/><para/><bold>(3)</bold> If a party is an entity that is subject to an audit by the legislative auditor general <ln numlevel="1" lineno="355" slineno="2-12"/>under Utah Constitution, Article VI, Section 33, and information that is privileged under Rule <ln numlevel="1" lineno="356" slineno="2-13"/>504 is disclosed to the legislative auditor general or an arbitrator as described in Utah Code <ln numlevel="1" lineno="357" slineno="2-14"/>section 36-12-15, the disclosure to the legislative auditor general or the arbitrator does not <ln numlevel="1" lineno="358" slineno="2-15"/>waive the privilege under paragraph (a)(1).</amend><eol numlevel="1" lineno="359" slineno="2-16" display="tab"/><bold>(b) Inadmissibility of Disclosed Information.</bold> Evidence of a statement or other disclosure of <ln numlevel="1" lineno="360" slineno="2-17"/>privileged matter is not admissible against the holder of the privilege if disclosure was <ln numlevel="1" lineno="361" slineno="2-18"/>compelled erroneously or made without opportunity to claim the privilege.<eol numlevel="1" lineno="362" slineno="2-19" display="tab"/><bold>(c) Comment or Inference Not Permitted.</bold> The claim of privilege, whether in the present <ln numlevel="1" lineno="363" slineno="2-20"/>proceeding or upon a prior occasion, is not a proper subject of comment by judge or counsel. <ln numlevel="1" lineno="364" slineno="2-21"/>No inference may be drawn from any claim of privilege.<eol numlevel="1" lineno="365" slineno="2-22" display="tab"/><bold>(d) Claiming Privilege Without the Jury's Knowledge.</bold> To the extent practicable, jury cases <ln numlevel="1" lineno="366" slineno="2-23"/>shall be conducted to allow claims of privilege to be made without the jury's knowledge.<eol numlevel="1" lineno="367" slineno="2-24" display="tab"/><bold>(e) Jury Instruction.</bold> Upon request, any party against whom the jury might draw an adverse <ln numlevel="1" lineno="368" slineno="2-25"/>inference from the claim of privilege is entitled to a jury instruction that no inference may be <ln numlevel="1" lineno="369" slineno="2-26"/>drawn from that claim of privilege.<eol numlevel="1" lineno="370" slineno="2-27" display="tab"/><bold>(f) Privilege Against Self-Incrimination in Civil Cases.</bold> In a civil case, the provisions of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="371" slineno="2-28"/>paragraph (c)-(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="20" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">paragraphs (c) through (e)</amend> do not apply when the privilege against <ln numlevel="1" lineno="372"
