Injunctions.</bold></catline><sectionText lineno="23"><para/>(a) <bold>Preliminary injunctions.</bold><eol numlevel="1" lineno="24" slineno="1-4" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="50" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(1) <bold>Notice.</bold> No preliminary injunction shall be issued without notice to the adverse <ln numlevel="1" lineno="25" slineno="1-5"/>party.<eol numlevel="1" lineno="26" slineno="1-6" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="52" groupid="51" style="2" owner="jchristopherson" level="1" deltag="both">(a)</amend><amendoutend style="2"/>(2) <bold>Consolidation of hearing.</bold> Before or after the commencement of the hearing of <ln numlevel="1" lineno="27" slineno="1-7"/>an application for a preliminary injunction, the court may order the trial of the action on the <ln numlevel="1" lineno="28" slineno="1-8"/>merits to be advanced and consolidated with the hearing of the application. Even when this <ln numlevel="1" lineno="29" slineno="1-9"/>consolidation is not ordered, any evidence received upon an application for a preliminary <ln numlevel="1" lineno="30" slineno="1-10"/>injunction which would be admissible at the trial on the merits becomes part of the trial record <ln numlevel="1" lineno="31" slineno="1-11"/>and need not be repeated at the trial. This <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="jchristopherson" level="1" deltag="both">subdivision</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">paragraph</amend> (a)(2) shall be so construed <ln numlevel="1" lineno="32" slineno="1-12"/>and applied as to save to the parties any rights they may have to trial by jury.<eol numlevel="1" lineno="33" slineno="1-13" display="tab"/>(b) <bold>Temporary restraining orders.</bold><eol numlevel="1" lineno="34" slineno="1-14" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="17" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(1) <bold>Notice.</bold> No temporary restraining order shall be granted without notice to the <ln numlevel="1" lineno="35" slineno="1-15"/>adverse party or that party's attorney unless<amend anum="0" ea="amend" pairid="17" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="both">:</amend> <amend anum="0" ea="amend" pairid="53" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="36" slineno="1-16" display="tab"/><para/><tab/><tab/></amend>(A) it clearly appears from specific facts shown by affidavit or by the verified <ln numlevel="1" lineno="37" slineno="1-17"/>complaint that immediate and irreparable injury, loss, or damage will result to the applicant <ln numlevel="1" lineno="38" slineno="1-18"/>before the adverse party or that party's attorney can be heard in opposition<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="56" style="2" owner="jchristopherson" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="56" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">;</amend> and <amend anum="0" ea="amend" pairid="55" groupid="54" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="39" slineno="1-19" display="tab"/><para/><tab/><tab/></amend>(B) the applicant or the applicant's attorney certifies to the court in writing as to <ln numlevel="1" lineno="40" slineno="1-20"/>the efforts, if any, that have been made to give notice and the reasons supporting the claim that <ln numlevel="1" lineno="41" slineno="1-21"/>notice should not be required.<eol numlevel="1" lineno="42" slineno="1-22" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(2) <bold>Form of order.</bold> Every temporary restraining order shall be endorsed with the date <ln numlevel="1" lineno="43" slineno="1-23"/>and hour of issuance and shall be filed forthwith in the clerk's office and entered of record. The <ln numlevel="1" lineno="44" slineno="1-24"/>order shall define the injury and state why it is irreparable. The order shall expire by its terms <ln numlevel="1" lineno="45" slineno="1-25"/>within such time after entry, not to exceed 14 days, as the court fixes, unless within the time so <ln numlevel="1" lineno="46" slineno="1-26"/>fixed the order, for good cause shown, is extended for a like period or unless the party against <ln numlevel="1" lineno="47" slineno="1-27"/>whom the order is directed consents that it may be extended for a longer period. The reasons <ln numlevel="1" lineno="48" slineno="1-28"/>for the extension shall be entered of record.<eol numlevel="1" lineno="49" slineno="1-29" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="20" groupid="19" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(3) <bold>Priority of hearing.</bold> If a temporary restraining order is granted, the motion for a <ln numlevel="1" lineno="50" slineno="1-30"/>preliminary injunction shall be scheduled for hearing at the earliest possible time and takes <ln numlevel="1" lineno="51" slineno="1-31"/>precedence over all other civil matters except older matters of the same character. When the <ln numlevel="1" lineno="52" slineno="1-32"/>motion comes on for hearing, the party who obtained the temporary restraining order shall <ln numlevel="1" lineno="53" slineno="1-33"/>have the burden to show entitlement to a preliminary injunction; if the party does not do so, the <ln numlevel="1" lineno="54" slineno="1-34"/>court shall dissolve the temporary restraining order.<eol numlevel="1" lineno="55" slineno="1-35" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="20" style="2" owner="jchristopherson" level="1" deltag="both">(b)</amend><amendoutend style="2"/>(4) <bold>Dissolution or modification.</bold> On 48 hours' notice to the party who obtained the <ln numlevel="1" lineno="56" slineno="1-36"/>temporary restraining order without notice, or on such shorter notice to that party as the court <ln numlevel="1" lineno="57" slineno="1-37"/>may prescribe, the adverse party may appear and move its dissolution or modification. In that <ln numlevel="1" lineno="58" slineno="1-38"/>event the court shall proceed to hear and determine the motion as expeditiously as the ends of <ln numlevel="1" lineno="59" slineno="1-39"/>justice require.<amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="both"><eol numlevel="1" lineno="60" slineno="1-40" display="tab"/><bold>(c) Filing requirements for a temporary restraining order or preliminary injunction of a state <ln numlevel="1" lineno="61" slineno="1-41"/>law.</bold><eol numlevel="1" lineno="62" slineno="1-42" display="tab"/><para/>(1) <bold>Definition.</bold> As used in this paragraph (c), "state law" means a state statute, a <ln numlevel="1" lineno="63" slineno="1-43"/>proposed amendment to the Utah Constitution, or any other legislation passed by the <ln numlevel="1" lineno="64" slineno="1-44"/>Legislature.<eol numlevel="1" lineno="65" slineno="1-45" display="tab"/><para/><bold/>(2) <bold>Temporary restraining order for a state law with delayed implementation</bold>.<eol numlevel="1" lineno="66" slineno="1-46" display="tab"/><para/><tab/>(A) An applicant must file a motion for a temporary restraining order at least 45 days <ln numlevel="1" lineno="67" slineno="1-47"/>before a state law takes effect if:<eol numlevel="1" lineno="68" slineno="1-48" display="tab"/><para/><tab/><tab/>(i) the state law takes effect more than 60 days after the day on which the <ln numlevel="1" lineno="69" slineno="1-49"/>Legislature adjourns sine die from the general or special session in which the Legislature <ln numlevel="1" lineno="70" slineno="1-50"/>passed the state law;<eol numlevel="1" lineno="71" slineno="1-51" display="tab"/><para/><tab/><tab/>(ii) the applicant is challenging the constitutionality of the state law; and<eol numlevel="1" lineno="72" slineno="1-52" display="tab"/><para/><tab/><tab/>(iii) the applicant seeks to enjoin the execution or enforcement of the state law <ln numlevel="1" lineno="73" slineno="1-53"/>before the state law becomes effective.<eol numlevel="1" lineno="74" slineno="1-54" display="tab"/><para/><tab/>(B) If an applicant fails to bring a motion for a temporary restraining order under <ln numlevel="1" lineno="75" slineno="1-55"/>paragraph (c)(3)(A) before the 45-day requirement, the applicant may not bring a motion for a <ln numlevel="1" lineno="76" slineno="1-56"/>temporary restraining order to enjoin the execution or enforcement of the state law until the <ln numlevel="1" lineno="77" slineno="1-57"/>state law has been in effect for at least 90 days.<eol numlevel="1" lineno="78" slineno="1-58" display="tab"/><para/><tab/>(C) <bold/>This paragraph (c)(2) does not preclude an applicant from bringing a motion for a <ln numlevel="1" lineno="79" slineno="1-59"/>preliminary injunction to enjoin the execution or enforcement of a state law that takes effect <ln numlevel="1" lineno="80" slineno="1-60"/>more than 60 days after the day on which the Legislature adjourns sine die from the general or <ln numlevel="1" lineno="81" slineno="1-61"/>special session in which the Legislature passed the state law.<eol numlevel="1" lineno="82" slineno="1-62" display="tab"/><para/>(3) <bold>Response to motion for temporary restraining order or preliminary injunction.</bold> <ln numlevel="1" lineno="83" slineno="1-63"/>Notwithstanding the filing deadline for a response to a motion under Rule 7 of the Utah Rules <ln numlevel="1" lineno="84" slineno="1-64"/>of Civil Procedure, an adverse party must file a response to a motion for a temporary <ln numlevel="1" lineno="85" slineno="1-65"/>restraining order or preliminary injunction within 28 days after a motion is filed if:<eol numlevel="1" lineno="86" slineno="1-66" display="tab"/><para/><tab/>(A) the applicant is challenging the constitutionality of the state law; and<eol numlevel="1" lineno="87" slineno="1-67" display="tab"/><para/><tab/>(B) the applicant seeks to enjoin the execution or enforcement of the state law before <ln numlevel="1" lineno="88" slineno="1-68"/>the state law becomes effective.</amend><eol numlevel="1" lineno="89" slineno="1-69" display="tab"/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(d)</amend> <bold>Security.</bold><eol numlevel="1" lineno="90" slineno="1-70" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="21" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(1) <bold>Requirement.</bold> The court shall condition issuance of the order or injunction on the <ln numlevel="1" lineno="91" slineno="1-71"/>giving of security by the applicant, in such sum and form as the court deems proper, unless it <ln numlevel="1" lineno="92" slineno="1-72"/>appears that none of the parties will incur or suffer costs, attorney fees or damage as the result <ln numlevel="1" lineno="93" slineno="1-73"/>of any wrongful order or injunction, or unless there exists some other substantial reason for <ln numlevel="1" lineno="94" slineno="1-74"/>dispensing with the requirement of security. No such security shall be required of the United <ln numlevel="1" lineno="95" slineno="1-75"/>States, the State of Utah, or of an officer, agency, or subdivision of either; nor shall it be <ln numlevel="1" lineno="96" slineno="1-76"/>required when it is prohibited by law.<eol numlevel="1" lineno="97" slineno="1-77" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(2) <bold>Amount not a limitation.</bold> The amount of security shall not establish or limit the <ln numlevel="1" lineno="98" slineno="1-78"/>amount of costs, including reasonable attorney fees incurred in connection with the restraining <ln numlevel="1" lineno="99" slineno="1-79"/>order or preliminary injunction, or damages that may be awarded to a party who is found to <ln numlevel="1" lineno="100" slineno="1-80"/>have been wrongfully restrained or enjoined.<eol numlevel="1" lineno="101" slineno="1-81" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="24" groupid="23" style="2" owner="jchristopherson" level="1" deltag="both">(c)</amend><amendoutend style="2"/>(3) <bold>Jurisdiction over surety.</bold> A surety upon a bond or undertaking under this rule <ln numlevel="1" lineno="102" slineno="1-82"/>submits to the jurisdiction of the court and irrevocably appoints the clerk of the court as agent <ln numlevel="1" lineno="103" slineno="1-83"/>upon whom any papers affecting the surety's liability on the bond or undertaking may be <ln numlevel="1" lineno="104" slineno="1-84"/>served. The surety's liability may be enforced on motion without the necessity of an <ln numlevel="1" lineno="105" slineno="1-85"/>independent action. The motion and such notice of the motion as the court prescribes may be <ln numlevel="1" lineno="106" slineno="1-86"/>served on the clerk of the court who shall forthwith mail copies to the persons giving the <ln numlevel="1" lineno="107" slineno="1-87"/>security if their addresses are known.<eol numlevel="1" lineno="108" slineno="1-88" display="tab"/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="45" groupid="44" style="2" owner="jchristopherson" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(e)</amend> <bold>Form and scope.</bold> Every restraining order and order granting an injunction shall set <ln numlevel="1" lineno="109" slineno="1-89"/>forth the reasons for its issuance. It shall be specific in terms and shall describe in reasonable <ln numlevel="1" lineno="110" slineno="1-90"/>detail, and not by reference to the complaint or other document, the act or acts sought to be <ln numlevel="1" lineno="111" slineno="1-91"/>restrained. It shall be binding only upon the parties to the action, their officers, agents, <ln numlevel="1" lineno="112" slineno="1-92"/>servants, employees, and attorneys, and upon those persons in active concert or participation <ln numlevel="1" lineno="113" slineno="1-93"/>with them who receive notice, in person or through counsel, or otherwise, of the order. If a <ln numlevel="1" lineno="114" slineno="1-94"/>restraining order is granted without notice to the party restrained, it shall state the reasons <ln numlevel="1" lineno="115" slineno="1-95"/>justifying the court's decision to proceed without notice.<eol numlevel="1" lineno="116" slineno="1-96" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="60" groupid="59" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="59" groupid="58" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(f)</amend> <bold>Grounds.</bold> A restraining order or preliminary injunction may issue only upon a <ln numlevel="1" lineno="117" slineno="1-97"/>showing by the applicant that:<eol numlevel="1" lineno="118" slineno="1-98" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="24" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/>(1) there is a substantial likelihood that the applicant will prevail on the merits of <ln numlevel="1" lineno="119" slineno="1-99"/>the underlying claim:<eol numlevel="1" lineno="120" slineno="1-100" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="25" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/>(2) the applicant will suffer irreparable harm unless the order or injunction issues;<eol numlevel="1" lineno="121" slineno="1-101" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="27" groupid="26" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/>(3) the threatened injury to the applicant outweighs whatever damage the proposed <ln numlevel="1" lineno="122" slineno="1-102"/>order or injunction may cause the party restrained or enjoined; and<eol numlevel="1" lineno="123" slineno="1-103" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="28" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/>(4) the order or injunction, if issued, would not be adverse to the public interest.<eol numlevel="1" lineno="124" slineno="1-104" display="tab"/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="46" groupid="45" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="39" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(g)</amend> <bold>Motion for reconsideration.</bold><eol numlevel="1" lineno="125" slineno="1-105" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="29" groupid="28" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/>(1) A party enjoined or restrained by a restraining order or a preliminary injunction <ln numlevel="1" lineno="126" slineno="1-106"/>on February 14, 2023, may move the court to reconsider whether the order or injunction <ln numlevel="1" lineno="127" slineno="1-107"/>should remain in effect if the order or injunction:<eol numlevel="1" lineno="128" slineno="1-108" display="tab"/><para/><tab/>(A) is in writing;<eol numlevel="1" lineno="129" slineno="1-109" display="tab"/><para/><tab/>(B) is restraining or enjoining the enforcement of a law; and<eol numlevel="1" lineno="130" slineno="1-110" display="tab"/><para/><tab/>(C) explicitly states that the court granted the order or injunction on the ground that <ln numlevel="1" lineno="131" slineno="1-111"/>the case presented serious issues on the merits which should be the subject of further litigation.<eol numlevel="1" lineno="132" slineno="1-112" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="30" groupid="29" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/>(2) A motion for reconsideration under this paragraph <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="46" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="41" groupid="40" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(g)</amend> may be filed at any <ln numlevel="1" lineno="133" slineno="1-113"/>time before the final determination of the case.<eol numlevel="1" lineno="134" slineno="1-114" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="30" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/>(3) Upon a motion for reconsideration, the court must determine whether the <ln numlevel="1" lineno="135" slineno="1-115"/>issuance of the restraining order or preliminary injunction meets the requirements in paragraph <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="48" groupid="47" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="136" slineno="1-116"/>(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="42" groupid="41" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(f)</amend> regardless of the requirements for the issuance of the order or injunction on the day on <ln numlevel="1" lineno="137" slineno="1-117"/>which the order or injunction was issued.<eol numlevel="1" lineno="138" slineno="1-118" display="tab"/><para/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="31" style="2" owner="jchristopherson" level="1" deltag="both">(f)</amend><amendoutend style="2"/>(4) If the court determines that the issuance of the restraining order or preliminary <ln numlevel="1" lineno="139" slineno="1-119"/>injunction does not meet the requirements of paragraph <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="49" groupid="48" style="2" owner="jchristopherson" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(f)</amend>, the court must terminate the <ln numlevel="1" lineno="140" slineno="1-120"/>order or injunction.<eol numlevel="1" lineno="141" slineno="1-121" display="tab"/><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="50" groupid="49" style="2" owner="jchristopherson" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="43" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(h)</amend> <bold>Domestic relations cases.</bold> Nothing in this rule shall be construed to limit the <ln numlevel="1" lineno="142" slineno="1-122"/>equitable powers of the courts in domestic relations cases.</sectionText></section></bsec><bsec buid="2" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="143" slineno="2-1" sn="2"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="143">Section 2.  <bold>Effective date.</bold></secline><sectionText lineno="144"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both"><tab/>As provided in Utah Constitution, Article VIII, Section 4, this resolution takes effect <ln numlevel="1" lineno="145" slineno="2-3"/>upon a two-thirds vote of all members elected to each house.</amend></sectionText></section></bsec></bdy><foot><rev/></foot></leg>
