Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This rules resolution modifies Senate processes and procedures. </gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This resolution:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">clarifies the duties of the secretary of the Senate related to technical corrections to <ln numlevel="1" lineno="10" slineno="0-10"/>legislation;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">repeals outdated language related to the daily order of business;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">modifies procedures for obtaining a citation;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">clarifies which legislation the Senate may pass without receiving a favorable <ln numlevel="1" lineno="20" slineno="0-20"/>recommendation from a Senate standing committee;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">modifies the circumstances under which a standing committee may recommend <ln numlevel="1" lineno="22" slineno="0-22"/>legislation for the consent calendar;  </hl><hl numlevel="1" lineno="23" slineno="0-23" level="1">provides an exception during a special session to the prohibition on legislation being read <ln numlevel="1" lineno="24" slineno="0-24"/>a third time until at least the day after it is placed on the third reading calendar;</hl><hl numlevel="1" lineno="25" slineno="0-25" level="1">addresses procedures related to Duties of the secretary of the Senate.</bold></catline><sectionText lineno="72"><para/>Subject to the chief of staff's direction, the secretary of the Senate shall perform the <ln numlevel="1" and</subsection><subsection ssid="15-15-11" dnum="iii-o" numlevel="1" lineno="229" slineno="8-27" level="3" tab="1"><display>(iii)</display>if the guest is an adult, the guest complies with <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="39" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">rules and Senate Handbook <ln numlevel="1" lineno="230" slineno="8-28"/>policies that relate to dress requirements</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="37" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subsection (2)</amend>.</subsection></subsection><subsection ssid="15-15-12" dnum="b-o" numlevel="1" lineno="231" slineno="8-29" level="2"><display>(b)</display>A senator who believes that a guest is intruding on desk space, is impeding staff <ln numlevel="1" lineno="232" slineno="8-30"/>work, or is distracting from the work of the Senate may communicate the senator's <ln numlevel="1" lineno="233" slineno="8-31"/>objection to the senator who has invited the guest, or through the majority leader, the <ln numlevel="1" lineno="234" slineno="8-32"/>minority leader, or the president of the Senate.</subsection></subsection></section></bsec><bsec buid="36" num="SR2-4-107" type="enact" src="rule" uid="SR2-4-S107_1800010118000101" sort="S02 04 01070018000101" numlevel="1" lineno="235" slineno="9-1" sn="9"><section numlevel="1" lineno="236" slineno="9-2" number="SR2-4-107" type="enact"><secline lineno="235">Section 9. <bold>SR2-4-107</bold> is enacted to read:</secline><catline lineno="236"><bold>SR2-4-107. Consideration of bills.</bold></catline><subsection ssid="18-18-1" dnum="1-o" numlevel="1" lineno="325" slineno="14-3" level="1" placement="noreturn"><display>(1)</display>Except for the 1st, 43rd, 44th, and 45th day of the annual general session, <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both">or any day <ln numlevel="1" lineno="326" slineno="14-4"/>during a special session, </amend>legislation may not be read for the third time until at least the <ln numlevel="1" lineno="327" slineno="14-5"/>day after it is placed on the third reading calendar.</subsection><subsection ssid="18-18-2" dnum="2-o" numlevel="1" lineno="328" slineno="14-6" level="1"><display>(2)</display>Legislation on the third reading calendar shall be considered in the order that it appears <ln numlevel="1" lineno="329" slineno="14-7"/>on the calendar unless a constitutional majority vote of the members of the Senate <ln numlevel="1" lineno="330" slineno="14-8"/>directs other action.</subsection></section></bsec><bsec buid="35" num="SR4-4-101" type="enact" src="rule" uid="SR4-4-S101_1800010118000101" sort="S04 04 01010018000101" numlevel="1" lineno="331" slineno="15-1" sn="15"><section numlevel="1" lineno="333" slineno="15-3" number="SR4-4-101" type="enact"><secline lineno="331">Section 15. <bold>SR4-4-101</bold> is enacted to read:</secline><headpart number="SR4-4-1" numlevel="1" lineno="332" slineno="15-2">1. and</amend><amendoutend style="2"/></subsection><subsection ssid="31-31-3" dnum="b-o:_-i" numlevel="1" lineno="416" slineno="19-9" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1186" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="18" groupid="15" style="2" owner="jchristopherson" level="1" deltag="end">place the legislation on the consent calendar.</amend><amendoutend style="2"/></subsection><subsection ssid="31-24" dnum="_-o:1-i" numlevel="1" lineno="417" slineno="19-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1187" style="1" owner="i" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="33" style="1" owner="jchristopherson" level="1" amendtag="end">As used in this rule, "legislative day" means the same as that term is defined in <xref depth="3" refnumber="SR4-9-101"><ln numlevel="1" lineno="418" slineno="19-11"/>SR4-9-101</xref>.</amend></subsection></subsection><subsection ssid="31-31-4" dnum="2-o" numlevel="1" lineno="419" slineno="19-12" level="1"><display>(2)</display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="jchristopherson" level="1" amendtag="both">Subject to Subsection <xref tempid="286" depth="4" refnumber="SR4-4-301(3)(b)">(3)(b)</xref>, legislation shall remain on the consent calendar for two <ln numlevel="1" lineno="420" slineno="19-13"/>legislative days after the day on which the legislation is placed on the consent calendar <ln numlevel="1" lineno="421" slineno="19-14"/>under <xref depth="3" refnumber="SR4-4-201">SR4-4-201</xref>.</amend></subsection><subsection ssid="31-23" dnum="_-o:3-i" numlevel="1" lineno="422" slineno="19-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1189" style="1" owner="i" level="1" amendtag="both">(3)</amend></display><subsection ssid="31-31-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Whenever the consent calendar contains legislation, the presiding officer shall <ln numlevel="1" lineno="423" slineno="19-16"/>inform the Senate each day that:<subsection ssid="31-31-6" dnum="i-o" numlevel="1" lineno="424" slineno="19-17" level="3" tab="1"><display>(i)</display>there are items on the consent calendar; and</subsection><subsection ssid="31-31-7" dnum="ii-o" numlevel="1" lineno="425" slineno="19-18" level="3" tab="1"><display>(ii)</display>if any senator objects to any legislation on the consent calendar, three or more <ln numlevel="1" lineno="426" slineno="19-19"/>senators may move the legislation to the second reading calendar by notifying the <ln numlevel="1" lineno="427" slineno="19-20"/>presiding officer verbally or in writing.</subsection></subsection><subsection ssid="31-31-8" dnum="b-o" numlevel="1" lineno="428" slineno="19-21" level="2"><display>(b)</display>If the presiding officer receives requests to move legislation from the consent <ln numlevel="1" lineno="429" slineno="19-22"/>calendar to the second reading calendar from three or more senators, the secretary <ln numlevel="1" lineno="430" slineno="19-23"/>shall:<subsection ssid="31-31-9" dnum="i-o" numlevel="1" lineno="431" slineno="19-24" level="3"><display>(i)</display>remove the legislation from the consent calendar; and</subsection><subsection ssid="31-31-10" dnum="ii-o" numlevel="1" lineno="432" slineno="19-25" level="3"><display>(ii)</display>place the legislation at the bottom of the second reading calendar.</subsection></subsection></subsection><subsection ssid="31-31-11" dnum="3-o:4-i" numlevel="1" lineno="433" slineno="19-26" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1196" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1197" style="1" owner="i" level="1" amendtag="both" space="true">(4)</amend></display>If<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="40" groupid="34" style="2" owner="jchristopherson" level="1" deltag="both">, after three days during which the Senate has floor time,</amend><amendoutend style="2"/> no more than two <ln numlevel="1" lineno="434" slineno="19-27"/>members have registered objections to the legislation<amend anum="0" ea="amend" pairid="24" groupid="20" style="1" owner="jchristopherson" level="1" amendtag="both"> during the time period described in <ln numlevel="1" lineno="435" slineno="19-28"/>Subsection <xref tempid="228" depth="4" refnumber="SR4-4-301(2)">(2)</xref></amend>, the legislation shall be:<subsection ssid="31-31-12" dnum="a-o" numlevel="1" lineno="436" slineno="19-29" level="2"><display>(a)</display>read the third time;</subsection><subsection ssid="31-31-13" dnum="b-o" numlevel="1" lineno="437" slineno="19-30" level="2"><display>(b)</display>placed before the Senate; and</subsection><subsection ssid="31-31-14" dnum="c-o" numlevel="1" lineno="438" slineno="19-31" level="2"><display>(c)</display>considered for final passage.</subsection></subsection><subsection ssid="31-31-15" dnum="4-o:5-i" numlevel="1" lineno="439" slineno="19-32" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1200" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1201" style="1" owner="i" level="1" amendtag="both" space="true">(5)</amend></display><subsection ssid="31-31-16" dnum="a-o" level="2" placement="sameline" format="full"><display>(a)</display>The presiding officer shall pose the question on each consent calendar bill in the <ln numlevel="1" lineno="440" slineno="19-33"/>following form:<eol numlevel="1" lineno="441" slineno="19-34"/><para/>"The presiding officer has determined that a quorum is present.<eol numlevel="1" lineno="442" slineno="19-35"/><para/>Those who favor the question say, 'aye.'<eol numlevel="1" lineno="443" slineno="19-36"/><para/>Does the chair hear a single dissenting nay to the question?"</subsection><subsection ssid="31-31-17" dnum="b-o" numlevel="1" lineno="444" slineno="19-37" level="2"><display>(b)</display>If the presiding officer hears no nays to the question<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="26" groupid="22" style="2" owner="jchristopherson" level="1" deltag="both">, a unanimous vote of the <ln numlevel="1" lineno="445" slineno="19-38"/>senators present shall be recorded in favor of the legislation.</amend><amendoutend style="2"/><subsection ssid="31-31-18" dnum="c-o:_-i" numlevel="1" lineno="446" slineno="19-39" ea="erase" anum="0" owner="jchristopherson" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1203" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="41" groupid="35" style="2" owner="jchristopherson" level="1" deltag="end">If the presiding officer hears any nays to the question,</amend><amendoutend style="2"/> a roll call vote shall be taken <ln numlevel="1" lineno="447" slineno="19-40"/>immediately.</subsection></subsection></subsection><subsection ssid="31-31-19" dnum="5-o:6-i" numlevel="1" lineno="448" slineno="19-41" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1204" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1205" style="1" owner="i" level="1" amendtag="both" space="true">(6)</amend></display>Notwithstanding the requirements of Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="27" style="2" owner="jchristopherson" level="1" deltag="both"><xref depth="4" refnumber="SR4-4-301(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="26" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">(5)</amend>, any senator may, before <ln numlevel="1" lineno="449" slineno="19-42"/>the roll call vote is taken, make a motion to remove the bill from the consent calendar <ln numlevel="1" lineno="450" slineno="19-43"/>and place it on the bottom of the third reading calendar.</subsection><subsection ssid="31-31-20" dnum="6-o:7-i" numlevel="1" lineno="451" slineno="19-44" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1205" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1206" style="1" owner="i" level="1" amendtag="both" space="true">(7)</amend></display>Nothing in this rule prevents a senator from challenging the ruling of the chair or <ln numlevel="1" lineno="452" slineno="19-45"/>asking for a vote on any question.</subsection></section></bsec><bsec buid="30" num="SR4-4-401" type="renumamend" src="rule" uid="SR4-4-S501_1800010118000101" sort="S04 04 05010018000101" newnum="SR4-4-501" numlevel="1" lineno="453" slineno="20-1" rlineno="454" sn="20"><section number="SR4-4-401" numlevel="1" lineno="456" slineno="20-4" type="renumamend" newnum="SR4-4-501"><secline lineno="453">Section 20. <bold>SR4-4-501</bold>, which is renumbered from Section SR4-4-401 is renumbered <ln lineno="454"/>and amended to read:</secline><headpart number="SR4-4-5" numlevel="1" lineno="455" slineno="20-3">5. Concurrence calendar.</bold></catline><subsection ssid="30-30-1" dnum="1-o" numlevel="1" lineno="457" slineno="20-5" level="1" placement="noreturn"><display>(1)</display>After the secretary of the Senate or the secretary's designee reads the transmittal letter <ln numlevel="1" lineno="458" slineno="20-6"/>from the House informing the Senate that the House has amended or substituted <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">a piece <ln numlevel="1" lineno="459" slineno="20-7"/>of </amend><amendoutend style="2"/>Senate legislation, the presiding officer shall place the legislation on the concurrence <ln numlevel="1" lineno="460" slineno="20-8"/>calendar.</subsection><subsection ssid="30-30-2" dnum="2-o" numlevel="1" lineno="461" slineno="20-9" level="1" space="false"><display>(2)</display><subsection ssid="30-30-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>During the first <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">43</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="3" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">42</amend> days of the annual general session, the legislation shall <ln numlevel="1" lineno="462" slineno="20-10"/>remain on the concurrence calendar over at least one night before the Senate may <ln numlevel="1" lineno="463" slineno="20-11"/>consider the question of concurrence.</subsection><subsection ssid="30-30-4" dnum="b-o" numlevel="1" lineno="464" slineno="20-12" level="2"><display>(b)</display>During the last <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="7" style="2" owner="jchristopherson" level="1" deltag="both">two</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">three</amend> days of the annual general session and during any special <ln numlevel="1" lineno="465" slineno="20-13"/>session, the Senate may consider legislation for concurrence after the Senate has been <ln numlevel="1" lineno="466" slineno="20-14"/>given a reasonable time to review the House changes.</subsection></subsection><subsection ssid="30-30-5" dnum="3-o" numlevel="1" lineno="467" slineno="20-15" level="1" space="false"><display>(3)</display><subsection ssid="30-30-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When presenting legislation to the Senate for concurrence, the presiding officer <ln numlevel="1" lineno="468" slineno="20-16"/>shall ask the sponsor of the legislation for a motion.</subsection><subsection ssid="30-30-7" dnum="b-o" numlevel="1" lineno="469" slineno="20-17" level="2"><display>(b)</display>The sponsor of the legislation may move to either:<subsection ssid="30-30-8" dnum="i-o" numlevel="1" lineno="470" slineno="20-18" level="3"><display>(i)</display>concur with the House amendments; or</subsection><subsection ssid="30-30-9" dnum="ii-o" numlevel="1" lineno="471" slineno="20-19" level="3"><display>(ii)</display>refuse to concur with the House amendments and ask the House to recede from <ln numlevel="1" lineno="472" slineno="20-20"/>their amendments.</subsection></subsection><subsection ssid="30-30-10" dnum="c-o" numlevel="1" lineno="473" slineno="20-21" level="2"><display>(c)</display>If a motion to concur with the House amendments passes by majority vote, the <ln numlevel="1" lineno="474" slineno="20-22"/>presiding officer shall:<subsection ssid="30-30-11" dnum="i-o" numlevel="1" lineno="475" slineno="20-23" level="3"><display>(i)</display>pose the question: "This bill (resolution) has been read three times. or</subsection><subsection ssid="24-24-14" dnum="xii-o" numlevel="1" lineno="520" slineno="23-17" level="3" tab="1"><display>(xii)</display>to amend, which is debatable.</subsection></subsection><subsection ssid="24-24-15" dnum="b-o" numlevel="1" lineno="521" slineno="23-18" level="2"><display>(b)</display>Points of order and appeals of the decision of the presiding officer are not motions <ln numlevel="1" lineno="522" slineno="23-19"/>and are always in order.</subsection><subsection ssid="24-24-16" dnum="c-o" numlevel="1" lineno="523" slineno="23-20" level="2"><display>(c)</display>The presiding officer shall grant priority to the motions listed in Subsection <xref depth="4" refnumber="SR4-6-109(1)(a)" start="0">(1)(a)</xref> <ln numlevel="1" lineno="524" slineno="23-21"/>according to the order in which they are listed in that rule.</subsection></subsection><subsection ssid="24-24-17" dnum="2-o" numlevel="1" lineno="525" slineno="23-22" level="1"><display>(2)</display>A senator may not make, and the presiding officer may not accept, a motion for the <ln numlevel="1" lineno="526" slineno="23-23"/>previous question, which is a call for an end to debate and a vote on the matter under <ln numlevel="1" lineno="527" slineno="23-24"/>discussion.</subsection><subsection ssid="24-24-18" dnum="3-o" numlevel="1" lineno="528" slineno="23-25" level="1"><display>(3)</display>If a motion to postpone <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="10" style="2" owner="jchristopherson" level="1" deltag="both">a piece of </amend><amendoutend style="2"/>legislation to a <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="jchristopherson" level="1" deltag="both">day</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">time</amend> certain or a motion to refer <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both"><ln numlevel="1" lineno="529" slineno="23-26"/>a piece of </amend><amendoutend style="2"/>legislation to a committee is defeated, a senator may not make the same <ln numlevel="1" lineno="530" slineno="23-27"/>motion on the same <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="jchristopherson" level="1" deltag="both">piece of </amend><amendoutend style="2"/>legislation during the same reading of the legislation.</subsection><subsection ssid="24-24-19" dnum="4-o" numlevel="1" lineno="531" slineno="23-28" level="1"><display>(4)</display>When a motion to refer to committee, to postpone indefinitely, to postpone to a time <ln numlevel="1" lineno="532" slineno="23-29"/>certain, or to table is made, the presiding officer may not allow consideration of <ln numlevel="1" lineno="533" slineno="23-30"/>amendments or debate on the main question.</subsection></section></bsec><bsec buid="25" num="SR4-7-101" type="amend" src="rule" uid="SR4-7-S101_1800010118000101" sort="S04 07 01010018000101" numlevel="1" lineno="534" slineno="24-1" sn="24"><section number="SR4-7-101" numlevel="1" lineno="535" slineno="24-2" type="amend"><secline lineno="534">Section 24. <bold>SR4-7-101</bold> is amended to read:</secline><catline lineno="535"><bold>SR4-7-101. Definitions.</bold></catline><sectionText lineno="536"><para/>As used in this chapter:</sectionText><subsection ssid="25-25-1" dnum="1-o" numlevel="1" lineno="537" slineno="24-4" level="1"><display>(1)</display>"Roll call vote" means a verbal voting process where:<subsection ssid="25-25-2" dnum="a-o" numlevel="1" lineno="538" slineno="24-5" level="2"><display>(a)</display>the secretary of the Senate or the secretary's designee verbally calls the name of each <ln numlevel="1" lineno="539" slineno="24-6"/>senator alphabetically, except the president, who is called last;</subsection><subsection ssid="25-25-3" dnum="b-o" numlevel="1" lineno="540" slineno="24-7" level="2"><display>(b)</display>each senator present votes "aye" or "nay" when the senator's name is called;</subsection><subsection ssid="25-25-4" dnum="c-o" numlevel="1" lineno="541" slineno="24-8" level="2"><display>(c)</display>the secretary of the Senate or the secretary's designee:<subsection ssid="25-25-5" dnum="i-o" numlevel="1" lineno="542" slineno="24-9" level="3"><display>(i)</display>tallies the vote;</subsection><subsection ssid="25-25-6" dnum="ii-o" numlevel="1" lineno="543" slineno="24-10" level="3"><display>(ii)</display>records those senators who are absent<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="0" groupid="0" style="2" owner="jchristopherson" level="1" deltag="both"> or not voting</amend><amendoutend style="2"/>; and</subsection><subsection ssid="25-25-7" dnum="iii-o" numlevel="1" lineno="544" slineno="24-11" level="3"><display>(iii)</display>gives a copy of the tally to the presiding officer; and</subsection></subsection><subsection ssid="25-25-8" dnum="d-o" numlevel="1" lineno="545" slineno="24-12" level="2"><display>(d)</display>the presiding officer announces the result of the vote.</subsection></subsection><subsection ssid="25-25-9" dnum="2-o" numlevel="1" lineno="546" slineno="24-13" level="1"><display>(2)</display>"Voice vote" means a verbal voting process where the presiding officer:<subsection ssid="25-25-10" dnum="a-o" numlevel="1" lineno="547" slineno="24-14" level="2"><display>(a)</display>poses the question to be voted upon in this form: "Those in favor (of the question) <ln numlevel="1" lineno="548" slineno="24-15"/>say 'aye'." and "Those opposed say 'nay'."; and</subsection><subsection ssid="25-25-11" dnum="b-o" numlevel="1" lineno="549" slineno="24-16" level="2"><display>(b)</display>based upon the senator's responses, announces that the question either passed or <ln numlevel="1" lineno="550" slineno="24-17"/>failed.</subsection></subsection></section></bsec><bsec buid="26" num="SR4-7-103" type="amend" src="rule" uid="SR4-7-S103_1800010118000101" sort="S04 07 01030018000101" numlevel="1" lineno="551" slineno="25-1" sn="25"><section number="SR4-7-103" numlevel="1" lineno="552" slineno="25-2" type="amend"><secline lineno="551">Section 25. <bold>SR4-7-103</bold> is amended to read:</secline><catline lineno="552"><bold>SR4-7-103. Senators present required to vote.</bold></catline><subsection ssid="26-26-1" dnum="1-o" numlevel="1" lineno="553" slineno="25-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="26-26-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A senator present within the Senate chamber when a vote is being taken shall vote.</subsection><subsection ssid="26-26-3" dnum="b-o" numlevel="1" lineno="554" slineno="25-4" level="2"><display>(b)</display>A senator shall vote within the time limit fixed by the presiding officer.</subsection><subsection ssid="26-26-4" dnum="c-o" numlevel="1" lineno="555" slineno="25-5" level="2"><display>(c)</display>Immediately before a roll call vote or when casting a roll call vote, a senator may, <ln numlevel="1" lineno="556" slineno="25-6"/>upon recognition by the presiding officer, make a brief statement explaining any <ln numlevel="1" lineno="557" slineno="25-7"/>conflict of interest.</subsection><subsection ssid="26-26-5" dnum="d-o" numlevel="1" lineno="558" slineno="25-8" level="2"><display>(d)</display>With the permission of the presiding officer, a senator may briefly explain <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="11" style="2" owner="jchristopherson" level="1" deltag="both">a</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="9" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">the <ln numlevel="1" lineno="559" slineno="25-9"/>senator's</amend> vote.</subsection></subsection><subsection ssid="26-26-6" dnum="2-o" numlevel="1" lineno="560" slineno="25-10" level="1" space="false"><display>(2)</display><subsection ssid="26-26-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="jchristopherson" level="1" deltag="both">A </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Except as provided Joint Rules, Title 1, Chapter 4, Part 4, Electronic <ln numlevel="1" lineno="561" slineno="25-11"/>Meetings, a </amend>senator may not vote on<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="12" style="2" owner="jchristopherson" level="1" deltag="both"> a piece of</amend><amendoutend style="2"/> legislation or <amend anum="0" ea="amend" pairid="9" groupid="10" style="1" owner="jchristopherson" level="1" amendtag="both">a </amend>motion unless the <ln numlevel="1" lineno="562" slineno="25-12"/>senator is present in the Senate chamber.</subsection><subsection ssid="26-26-8" dnum="b-o" numlevel="1" lineno="563" slineno="25-13" level="2"><display>(b)</display>If the vote is a roll call vote or division, a senator entering the chamber after the <ln numlevel="1" lineno="564" slineno="25-14"/>question is posed and before the presiding officer announces the result, may have the <ln numlevel="1" lineno="565" slineno="25-15"/>question stated and vote.</subsection></subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="false" numlevel="1" lineno="566" slineno="26-1" sn="26"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="566">Section 26.  <bold>Effective Date.</bold></secline><sectionText lineno="567"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This resolution takes effect upon a successful vote for final passage.</amend></sectionText></section></bsec></bdy><foot><rev><tm>1-30-25 6:03 PM</tm></rev></foot></leg>
