Section <bold>10-3-1012</bold> is amended to read:</secline><catline lineno="23"><bold>10-3-1012<parens/>. Suspension or discharge by department head -- Appeal to <ln numlevel="1" lineno="24" slineno="1-3"/>commission -- Hearing and decision.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="25" slineno="1-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-10" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="i" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="25" groupid="18" style="2" owner="jchristopherson" level="1" deltag="both">All</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="24" groupid="17" style="1" owner="jchristopherson" level="1" amendtag="both" space="true">Subject to Subsection <xref refnumber="1-11">(1)(b)</xref>, all</amend> persons in the classified civil service may be <ln numlevel="1" lineno="26" slineno="1-5"/>suspended as provided in Section <xref depth="3" refnumber="10-3-912" start="0">10-3-912</xref>, or removed from office or employment <ln numlevel="1" lineno="27" slineno="1-6"/>by the head of the department for misconduct, incompetency, failure to perform <ln numlevel="1" lineno="28" slineno="1-7"/>duties, or failure to observe properly the rules of the department, but subject to appeal <ln numlevel="1" lineno="29" slineno="1-8"/>by the suspended or discharged person to the civil service commission.</subsection><subsection ssid="1-11" dnum="_-o:b-i" numlevel="1" lineno="30" slineno="1-9" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="jchristopherson" level="1" amendtag="end">Before a law enforcement officer, as that term is defined in Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>, who <ln numlevel="1" lineno="31" slineno="1-10"/>is in the classified civil service may be suspended for more than two days, demoted, <ln numlevel="1" lineno="32" slineno="1-11"/>or removed from employment under Subsection <xref refnumber="1-10">(1)(a)</xref>, the law enforcement officer's <ln numlevel="1" lineno="33" slineno="1-12"/>employing agency shall, at a minimum:</amend><subsection ssid="1-27" dnum="_-o:i-i" numlevel="1" lineno="34" slineno="1-13" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="101" groupid="75" style="1" owner="jchristopherson" level="1" amendtag="end">notify the law enforcement officer of the allegations of wrongdoing that the <ln numlevel="1" lineno="35" slineno="1-14"/>employing agency believes may support a disciplinary action of suspension for <ln numlevel="1" lineno="36" slineno="1-15"/>more than two days, demotion, or removal;</amend></subsection><subsection ssid="1-29" dnum="_-o:ii-i" numlevel="1" lineno="37" slineno="1-16" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="81" style="1" owner="jchristopherson" level="1" amendtag="end">give the law enforcement officer no less than two business days after the day on <ln numlevel="1" lineno="38" slineno="1-17"/>which the notification described in Subsection <xref depth="4" refnumber="10-3-1012(1)(b)(i)">(1)(b)(i)</xref> is provided to submit a <ln numlevel="1" lineno="39" slineno="1-18"/>written reply to the agency head or the agency head's designated representative;</amend></subsection><subsection ssid="1-16" dnum="_-o:iii-i" numlevel="1" lineno="40" slineno="1-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="55" groupid="42" style="1" owner="jchristopherson" level="1" amendtag="end">have the agency head, or the agency head's designated representative, consider <ln numlevel="1" lineno="41" slineno="1-20"/>any written reply submitted by the law enforcement officer; and</amend></subsection><subsection ssid="1-17" dnum="_-o:iv-i" numlevel="1" lineno="42" slineno="1-21" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="45" style="1" owner="jchristopherson" level="1" amendtag="end">give the law enforcement officer an opportunity to be heard by the agency head <ln numlevel="1" lineno="43" slineno="1-22"/>or the agency head's designated representative.</amend></subsection></subsection><subsection ssid="1-19" dnum="_-o:c-i" numlevel="1" lineno="44" slineno="1-23" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="55" style="1" owner="jchristopherson" level="1" amendtag="end">The provisions of Subsection <xref refnumber="1-11">(1)(b)</xref> do not limit or alter the rights under this part of:</amend><subsection ssid="1-25" dnum="_-o:i-i" numlevel="1" lineno="45" slineno="1-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="96" groupid="71" style="1" owner="jchristopherson" level="1" amendtag="end">an employee in the classified civil service who is not a law enforcement officer; or</amend></subsection><subsection ssid="1-24" dnum="_-o:ii-i" numlevel="1" lineno="46" slineno="1-25" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="67" style="1" owner="jchristopherson" level="1" amendtag="end">a law enforcement officer in a municipality that provides, by adopted policy, <ln numlevel="1" lineno="47" slineno="1-26"/>procedures that are more protective for the law enforcement officer than the <ln numlevel="1" lineno="48" slineno="1-27"/>procedures described in Subsection <xref refnumber="1-11">(1)(b)</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="49" slineno="1-28" level="1"><display>(2)</display>Any person suspended or discharged <amend anum="0" ea="amend" pairid="67" groupid="52" style="1" owner="jchristopherson" level="1" amendtag="both">under Subsection <xref refnumber="1-null-1">(1)</xref> </amend>may, within five days from <ln numlevel="1" lineno="50" slineno="1-29"/>the issuance by the head of the department of the order of suspension or discharge, <ln numlevel="1" lineno="51" slineno="1-30"/>appeal to the civil service commission, which shall fully hear and determine the matter.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="52" slineno="1-31" level="1"><display>(3)</display>The suspended or discharged person shall be entitled to appear in person and to have <ln numlevel="1" lineno="53" slineno="1-32"/>counsel and a public hearing.</subsection><subsection ssid="1-null-4" dnum="4-o" numlevel="1" lineno="54" slineno="1-33" level="1"><display>(4)</display>The finding and decision of the civil service commission upon the hearing shall be <ln numlevel="1" lineno="55" slineno="1-34"/>certified to the head of the department from whose order the appeal is taken, and shall be <ln numlevel="1" lineno="56" slineno="1-35"/>final and immediately enforced by the head.</subsection></section></bsec><bsec buid="5" num="10-3-1106" type="amend" src="code" uid="C10-3-S1106_2026050620260506" sort="10 03 11060020260506" numlevel="1" lineno="57" slineno="2-1" sn="2"><section number="10-3-1106" numlevel="1" lineno="58" slineno="2-2" type="amend"><secline lineno="57">Section 2. Section <bold>10-3-1106</bold> is amended to read:</secline><catline lineno="58"><bold>10-3-1106<parens/>. Discharge, suspension without pay, or involuntary transfer -- <ln numlevel="1" lineno="59" slineno="2-3"/>Appeals -- Board -- Procedure.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="60" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="5-47" dnum="_-o:a-i" ea="amend" anum="0" owner="jchristopherson" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="i" level="1" amendtag="both">(a)</amend></display>An employee to which Section <xref depth="3" refnumber="10-3-1105" start="0">10-3-1105</xref> applies may not be discharged, <ln numlevel="1" lineno="61" slineno="2-5"/>suspended without pay, or involuntarily transferred to a position with less <ln numlevel="1" lineno="62" slineno="2-6"/>remuneration:<subsection ssid="5-null-2" dnum="a-o:i-i" numlevel="1" lineno="63" slineno="2-7" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="i" level="1" amendtag="both" space="true">(i)</amend></display>because of the employee's politics or religious belief; or</subsection><subsection ssid="5-null-3" dnum="b-o:ii-i" numlevel="1" lineno="64" slineno="2-8" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="both" space="true">(ii)</amend></display>incident to, or through changes, either in the elective officers, governing <ln numlevel="1" lineno="65" slineno="2-9"/>body, or heads of departments.</subsection></subsection><subsection ssid="5-48" dnum="_-o:b-i" numlevel="1" lineno="66" slineno="2-10" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="i" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="jchristopherson" level="1" endid="60" base="true">Before an employee who is a law enforcement officer, as that term is defined in <ln numlevel="1" lineno="67" slineno="2-11"/>Section <xref depth="3" refnumber="53-13-103">53-13-103</xref>, to which Subsection <xref tempid="953">10-3-1105(1)(a)</xref> applies may be discharged, <ln numlevel="1" lineno="68" slineno="2-12"/>suspended without pay for more than two days, or involuntarily transferred to a <ln numlevel="1" lineno="69" slineno="2-13"/>position with less remuneration</amend><houseStart display="true"/><houseCommitteeStart/><amend anum="-1" ea="amend" pairid="58" groupid="44" style="A" owner="HC" level="1" hctag="both"> due to disciplinary reasons</amend><houseCommitteeEnd/><houseEnd display="true"/><amend anum="0" ea="amend" pairid="60" groupid="46" style="1" owner="jchristopherson" level="1" base="true" amendtag="end">, the law <ln numlevel="2" lineno="69a" slineno="2-13a"/>enforcement officer's employing agency <ln numlevel="1" lineno="70" slineno="2-14"/>shall, at a minimum:</amend><subsection ssid="5-50" dnum="_-o:i-i" numlevel="1" lineno="71" slineno="2-15" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="jchristopherson" level="1" endid="61" base="true">notify the law enforcement officer of the allegations of wrongdoing that the <ln numlevel="1" lineno="72" slineno="2-16"/>employing agency believes may support a disciplinary action of discharge, <ln numlevel="1" lineno="73" slineno="2-17"/>suspension of more than two days without pay, or involuntary transfer to a <ln numlevel="1" lineno="74" slineno="2-18"/>position with less remuneration</amend><houseStart display="true"/><houseCommitteeStart/><amend anum="-1" ea="amend" pairid="59" groupid="45" style="A" owner="HC" level="1" hctag="both"> due to disciplinary reasons</amend><houseCommitteeEnd/><houseEnd display="true"/><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="jchristopherson" level="1" base="true" amendtag="end">;</amend></subsection><subsection ssid="5-51" dnum="_-o:ii-i" numlevel="1" lineno="75" slineno="2-19" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="jchristopherson" level="1" amendtag="end">give the law enforcement officer no less than two business days after the day on <ln numlevel="1" lineno="76" slineno="2-20"/>which the notification described in Subsection <xref depth="4" refnumber="10-3-1106(1)(b)(i)">(1)(b)(i)</xref> is provided to submit a <ln numlevel="1" lineno="77" slineno="2-21"/>written reply to the agency head or the agency head's designated representative;</amend></subsection><subsection ssid="5-52" dnum="_-o:iii-i" numlevel="1" lineno="78" slineno="2-22" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="i" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="jchristopherson" level="1" amendtag="end">have the agency head, or the agency head's designated representative, consider <ln numlevel="1" lineno="79" slineno="2-23"/>any written reply submitted by the law enforcement officer; and</amend></subsection><subsection ssid="5-53" dnum="_-o:iv-i" numlevel="1" lineno="80" slineno="2-24" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="i" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="jchristopherson" level="1" amendtag="end">give the law enforcement officer an opportunity to be heard by the agency head <ln numlevel="1" lineno="81" slineno="2-25"/>or the agency head's designated representative.</amend></subsection></subsection><subsection ssid="5-55" dnum="_-o:c-i" numlevel="1" lineno="82" slineno="2-26" ea="amend" anum="0" owner="jchristopherson" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="i" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="38" groupid="28" style="1" owner="jchristopherson" level="1" amendtag="end">The provisions of Subsection <xref depth="4" refnumber="10-3-1106(1)(b)">(1)(b)</xref> do not limit or alter the rights under this part of:</amend><subsection ssid="5-56" dnum="_-o:i-i" numlevel="1" lineno="83" slineno="2-27" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="i" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="43" groupid="32" style="1" owner="jchristopherson" level="1" amendtag="end">an employee to which Section <xref depth="3" refnumber="10-3-1105">10-3-1105</xref> applies who is not a law enforcement <ln numlevel="1" lineno="84" slineno="2-28"/>officer; or</amend></subsection><subsection ssid="5-58" dnum="_-o:ii-i" numlevel="1" lineno="85" slineno="2-29" ea="amend" anum="0" owner="jchristopherson" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="i" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="38" style="1" owner="jchristopherson" level="1" amendtag="end">a law enforcement officer in a municipality that provides, by adopted policy, <ln numlevel="1" lineno="86" slineno="2-30"/>procedures that are more protective for the law enforcement officer than the <ln numlevel="1" lineno="87" slineno="2-31"/>procedures described in Subsection <xref depth="4" refnumber="10-3-1106(1)(b)">(1)(b)</xref>.</amend></subsection></subsection></subsection><subsection ssid="5-null-4" dnum="2-o" numlevel="1" lineno="88" slineno="2-32" level="1" space="false"><display>(2)</display><subsection ssid="5-null-5" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If<amend anum="0" ea="amend" pairid="32" groupid="23" style="1" owner="jchristopherson" level="1" amendtag="both">, after the requirements of Subsections <xref depth="4" refnumber="10-3-1106(1)(a)">(1)(a)</xref> and <xref depth="4" refnumber="10-3-1106(b)">(b)</xref> have been met,</amend> an <ln numlevel="1" lineno="89" slineno="2-33"/>employee other than an employee described in Subsection <xref depth="4" refnumber="10-3-1105(2)" start="0">10-3-1105(2)</xref><amend anum="0" ea="amend" pairid="34" groupid="25" style="1" owner="jchristopherson" level="1" amendtag="both">,</amend> is <ln numlevel="1" lineno="90" slineno="2-34"/>discharged, suspended for more than two days without pay, or involuntarily <ln numlevel="1" lineno="91" slineno="2-35"/>transferred from one position to another with less remuneration for any disciplinary <ln numlevel="1" lineno="92" slineno="2-36"/>reason, the employee may, subject to Subsection <xref depth="4" refnumber="10-3-1106(2)(b)" start="0">(2)(b)</xref>, appeal the final decision to <ln numlevel="1" lineno="93" slineno="2-37"/>discharge, suspend without pay, or involuntarily transfer to an appeal board or <ln numlevel="1" lineno="94" slineno="2-38"/>hearing officer established under Subsection <xref depth="4" refnumber="10-3-1106(7)" start="0">(7)</xref>.</subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="95" slineno="2-39" level="2"><display>(b)</display>If the municipality provides an internal grievance procedure, the employee shall <ln numlevel="1" lineno="96" slineno="2-40"/>exhaust the employee's rights under that grievance procedure before appealing to the <ln numlevel="1" lineno="97" slineno="2-41"/>appeal board or hearing officer.</subsection></subsection><subsection ssid="5-null-7" dnum="3-o" numlevel="1" lineno="98" slineno="2-42" level="1" space="false"><display>(3)</display><subsection ssid="5-null-8" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each appeal under Subsection <xref depth="4" refnumber="10-3-1106(2)" start="0">(2)</xref> shall be taken by filing written notice of the <ln numlevel="1" lineno="99" slineno="2-43"/>appeal with the municipal recorder in accordance with procedures established by a <ln numlevel="1" lineno="100" slineno="2-44"/>municipality within 10 calendar days after:<subsection ssid="5-null-9" dnum="i-o" numlevel="1" lineno="101" slineno="2-45" level="3" tab="1"><display>(i)</display>if the municipality provides an internal grievance procedure, the employee <ln numlevel="1" lineno="102" slineno="2-46"/>receives notice of the final disposition of the municipality's internal grievance <ln numlevel="1" lineno="103" slineno="2-47"/>procedure; or</subsection><subsection ssid="5-null-10" dnum="ii-o" numlevel="1" lineno="104" slineno="2-48" level="3" tab="1"><display>(ii)</display>if the municipality does not provide an internal grievance procedure, the <ln numlevel="1" lineno="105" slineno="2-49"/>discharge, suspension, or involuntary transfer.</subsection></subsection><subsection ssid="5-null-11" dnum="b-o" numlevel="1" lineno="106" slineno="2-50" level="2" space="false"><display>(b)</display><subsection ssid="5-null-12" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Upon the filing of an appeal under Subsection <xref depth="4" refnumber="10-3-1106(3)(a)" start="0">(3)(a)</xref>, the municipal recorder <ln numlevel="1" lineno="107" slineno="2-51"/>shall refer a copy of a properly filed appeal to the appeal board or hearing officer <ln numlevel="1" lineno="108" slineno="2-52"/>described in Subsection <xref depth="4" refnumber="10-3-1106(7)" start="0">(7)</xref>.</subsection><subsection ssid="5-null-13" dnum="ii-o" numlevel="1" lineno="109" slineno="2-53" level="3"><display>(ii)</display>Upon receipt of the referral from the municipal recorder, the appeal board or <ln numlevel="1" lineno="110" slineno="2-54"/>hearing officer shall schedule a hearing to take and receive evidence and fully hear <ln numlevel="1" lineno="111" slineno="2-55"/>and determine the matter which relates to the reason for the discharge, suspension, <ln numlevel="1" lineno="112" slineno="2-56"/>or transfer.</subsection></subsection></subsection><subsection ssid="5-null-14" dnum="4-o" numlevel="1" lineno="113" slineno="2-57" level="1" space="false"><display>(4)</display><subsection ssid="5-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An employee who is the subject of the discharge, suspension, or transfer may:<subsection ssid="5-null-16" dnum="i-o" numlevel="1" lineno="114" slineno="2-58" level="3" tab="1"><display>(i)</display>appear in person and be represented by counsel;</subsection><subsection ssid="5-null-17" dnum="ii-o" numlevel="1" lineno="115" slineno="2-59" level="3" tab="1"><display>(ii)</display>have a hearing open to the public;</subsection><subsection ssid="5-null-18" dnum="iii-o" numlevel="1" lineno="116" slineno="2-60" level="3" tab="1"><display>(iii)</display>confront the witness whose testimony is to be considered; and</subsection><subsection ssid="5-null-19" dnum="iv-o" numlevel="1" lineno="117" slineno="2-61" level="3" tab="1"><display>(iv)</display>examine the evidence to be considered by the appeal board.</subsection></subsection><subsection ssid="5-null-20" dnum="b-o" numlevel="1" lineno="118" slineno="2-62" level="2"><display>(b)</display>An employee or the municipality may request the hearing described in Subsection <xref depth="4" refnumber="10-3-1106(4)(a)(ii)" start="0"><ln numlevel="1" lineno="119" slineno="2-63"/>(4)(a)(ii)</xref>.</subsection></subsection><subsection ssid="5-null-21" dnum="5-o" numlevel="1" lineno="120" slineno="2-64" level="1" space="false"><display>(5)</display><subsection ssid="5-null-22" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="5-null-23" dnum="i-o" level="3" tab="1" placement="sameline"><display>(i)</display>A decision of the appeal board shall be by secret ballot.</subsection><subsection ssid="5-null-24" dnum="ii-o" numlevel="1" lineno="121" slineno="2-65" level="3" tab="1"><display>(ii)</display>The appeal board or the hearing officer shall certify a decision by the appeal <ln numlevel="1" lineno="122" slineno="2-66"/>board or hearing officer, respectively, with the recorder no later than 15 days after <ln numlevel="1" lineno="123" slineno="2-67"/>the day on which the hearing is held, except as provided in Subsection <xref depth="4" refnumber="10-3-1106(5)(a)(iii)" start="0">(5)(a)(iii)</xref>.</subsection><subsection ssid="5-null-25" dnum="iii-o" numlevel="1" lineno="124" slineno="2-68" level="3" tab="1"><display>(iii)</display>For good cause, the appeal board or hearing officer may extend the 15-day <ln numlevel="1" lineno="125" slineno="2-69"/>period under Subsection <xref depth="4" refnumber="10-3-1106(5)(a)(ii)" start="0">(5)(a)(ii)</xref> to a maximum of 60 calendar days, if the <ln numlevel="1" lineno="126" slineno="2-70"/>employee and municipality both consent.</subsection></subsection><subsection ssid="5-null-26" dnum="b-o" numlevel="1" lineno="127" slineno="2-71" level="2"><display>(b)</display>If the appeal board or hearing officer finds in favor of the employee, the appeal board <ln numlevel="1" lineno="128" slineno="2-72"/>or hearing officer shall provide that the employee shall receive:<subsection ssid="5-null-27" dnum="i-o" numlevel="1" lineno="129" slineno="2-73" level="3"><display>(i)</display>the employee's salary for the period of time during which the employee is <ln numlevel="1" lineno="130" slineno="2-74"/>discharged or suspended without pay less any amounts the employee earned from <ln numlevel="1" lineno="131" slineno="2-75"/>other employment during this period of time; or</subsection><subsection ssid="5-null-28" dnum="ii-o" numlevel="1" lineno="132" slineno="2-76" level="3"><display>(ii)</display>any deficiency in salary for the period during which the employee was transferred <ln numlevel="1" lineno="133" slineno="2-77"/>to a position of less remuneration.</subsection></subsection></subsection><subsection ssid="5-null-29" dnum="6-o" numlevel="1" lineno="134" slineno="2-78" level="1" space="false"><display>(6)</display><subsection ssid="5-null-30" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A final action or order of the appeal board or hearing officer may be reviewed by <ln numlevel="1" lineno="135" slineno="2-79"/>the Court of Appeals by filing with that court a petition for review.</subsection><subsection ssid="5-null-31" dnum="b-o" numlevel="1" lineno="136" slineno="2-80" level="2"><display>(b)</display>A petition under Subsection <xref depth="4" refnumber="10-3-1106(6)(a)" start="0">(6)(a)</xref> shall be filed within 30 days after the issuance of <ln numlevel="1" lineno="137" slineno="2-81"/>the final action or order of the appeal board or hearing officer.</subsection><subsection ssid="5-null-32" dnum="c-o" numlevel="1" lineno="138" slineno="2-82" level="2"><display>(c)</display>The Court of Appeals' review shall be:<subsection ssid="5-null-33" dnum="i-o" numlevel="1" lineno="139" slineno="2-83" level="3"><display>(i)</display>on the record of the appeal board or hearing officer; and</subsection><subsection ssid="5-null-34" dnum="ii-o" numlevel="1" lineno="140" slineno="2-84" level="3"><display>(ii)</display>for the purpose of determining if the appeal board or hearing officer abused its <ln numlevel="1" lineno="141" slineno="2-85"/>discretion or exceeded its authority.</subsection></subsection></subsection><subsection ssid="5-null-35" dnum="7-o" numlevel="1" lineno="142" slineno="2-86" level="1" space="false"><display>(7)</display><subsection ssid="5-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The method and manner of choosing a hearing officer or the members of the <ln numlevel="1" lineno="143" slineno="2-87"/>appeal board, the number of members, the designation of a hearing officer's or appeal <ln numlevel="1" lineno="144" slineno="2-88"/>board member's term of office, and the procedure for conducting an appeal and the <ln numlevel="1" lineno="145" slineno="2-89"/>standard of review shall be prescribed by the governing body of each municipality by <ln numlevel="1" lineno="146" slineno="2-90"/>ordinance.</subsection><subsection ssid="5-null-37" dnum="b-o" numlevel="1" lineno="147" slineno="2-91" level="2"><display>(b)</display>For a municipality operating under a form of government other than a council-mayor <ln numlevel="1" lineno="148" slineno="2-92"/>form under <xref depth="2" refnumber="10-3b-2" start="1">Chapter 3b, Part 2, Council-Mayor Form of Municipal Government</xref>, an <ln numlevel="1" lineno="149" slineno="2-93"/>ordinance adopted under Subsection <xref depth="4" refnumber="10-3-1106(7)(a)" start="0">(7)(a)</xref> may provide that the governing body of <ln numlevel="1" lineno="150" slineno="2-94"/>the municipality shall serve as the appeal board.</subsection></subsection><subsection ssid="5-null-38" dnum="8-o" numlevel="1" lineno="151" slineno="2-95" level="1"><display>(8)</display>This section does not apply to an employee:<subsection ssid="5-null-39" dnum="a-o" numlevel="1" lineno="152" slineno="2-96" level="2"><display>(a)</display>described in Subsection <xref depth="4" refnumber="10-3-1105(2)" start="0">10-3-1105(2)</xref>; or</subsection><subsection ssid="5-null-40" dnum="b-o" numlevel="1" lineno="153" slineno="2-97" level="2"><display>(b)</display>discharged or transferred to a position with less remuneration if the discharge or <ln numlevel="1" lineno="154" slineno="2-98"/>transfer is the result of a layoff, reorganization, or other non-disciplinary reason.</subsection></subsection></section></bsec><bsec buid="67" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="155" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="155">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="156"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="jchristopherson" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-12-26 10:19 AM</tm></rev></foot></leg>
