Manufactured Housing Construction and Safety <ln numlevel="1" lineno="43" slineno="1-7"/>Standards Act, as issued by the Department of Housing and Urban Development and <ln numlevel="1" lineno="44" numlevel="1" lineno="70" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>Subject to the other provisions of this part, the following construction codes are <ln numlevel="1" lineno="71" slineno="2-5"/>incorporated by reference, and together with the amendments specified in Chapter 3, <ln numlevel="1" lineno="72" slineno="2-6"/>Statewide Amendments Incorporated as Part of State Construction Code, and Chapter 4, <ln numlevel="1" lineno="73" slineno="2-7"/>Local Amendments Incorporated as Part of State Construction Code, are the <ln numlevel="1" lineno="74" slineno="2-8"/>construction standards to be applied to building construction, alteration, remodeling, and <ln numlevel="1" lineno="75" slineno="2-9"/>repair, and in the regulation of building construction, alteration, remodeling, and repair <ln numlevel="1" lineno="76" slineno="2-10"/>in the state:<subsection ssid="2-null-23" dnum="a-o" numlevel="1" lineno="77" slineno="2-11" level="2"><display>(a)</display>the 2021 edition of the International Building Code, including Appendices C and J, <ln numlevel="1" lineno="78" slineno="2-12"/>issued by the International Code numlevel="1" lineno="107" slineno="2-41" level="2"><display>(o)</display>Modular Building Institute Standards 1200 and 1205, issued by the International <ln numlevel="1" lineno="108" slineno="2-42"/>Code Council, except as modified by provisions of this title governing modular units.</subsection></subsection><subsection ssid="2-null-38" dnum="2-o" numlevel="1" lineno="109" slineno="2-43" level="1"><display>(2)</display>Consistent with Title 65A, Chapter 8, Management of Forest Lands and Fire Control, <ln numlevel="1" lineno="110" slineno="2-44"/>the Legislature adopts the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="admin" level="1" deltag="both">2006</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="both" space="true">2024</amend> edition of the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="37" space="true">International <ln numlevel="1" lineno="111" slineno="2-45"/>Wildland-Urban</amend> Interface Code, issued by the International Code Council<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="admin" level="1" deltag="both">, with the <ln numlevel="1" lineno="112" slineno="2-46"/>alternatives or amendments approved by the Utah Division of Forestry, Fire, and State <ln numlevel="1" lineno="113" slineno="2-47"/>Lands, as a construction code that may be adopted by a local compliance agency by <ln numlevel="1" lineno="114" slineno="2-48"/>local ordinance or other similar action as a local amendment to the codes listed in this <ln numlevel="1" lineno="115" slineno="2-49"/>section</amend><amendoutend style="2"/>.</subsection><subsection ssid="2-null-39" dnum="3-o" numlevel="1" lineno="116" slineno="2-50" level="1"><display>(3)</display>The standards and guidelines described in Subsection <xref depth="4" refnumber="15A-2-103(1)(m)">(1)(m)</xref> apply only if:<subsection ssid="2-null-40" dnum="a-o" numlevel="1" lineno="117" slineno="2-51" level="2"><display>(a)</display>the owner of the historic property receives a government tax subsidy based on the <ln numlevel="1" lineno="118" slineno="2-52"/>property's status as a historic property;</subsection><subsection ssid="2-null-41" dnum="b-o" numlevel="1" lineno="119" slineno="2-53" level="2"><display>(b)</display>the historic property is wholly or partially funded by public money; or</subsection><subsection ssid="2-null-42" dnum="c-o" numlevel="1" lineno="120" slineno="2-54" level="2"><display>(c)</display>the historic property is owned by a government entity.</subsection></subsection></section></bsec><bsec buid="6" Wildland urban interface evaluation and fees.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="131" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="132" slineno="4-4" level="2"><display>(a)</display>"County officer" means the same as that term is defined in Section <xref depth="3" refnumber="17-66-101">17-66-101</xref>.</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="133" slineno="4-5" level="2"><display>(b)</display>"High risk wildland urban interface property" means the same as that term is defined <ln numlevel="1" lineno="134" slineno="4-6"/>in Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>.</subsection><subsection ssid="10-null-4" dnum="c-o" numlevel="1" lineno="135" slineno="4-7" level="2"><display>(c)</display>"Wildland urban interface" means the same as that term is defined in Section <xref depth="3" refnumber="65A-8-401"><ln numlevel="1" lineno="136" slineno="4-8"/>65A-8-401</xref>.</subsection><subsection ssid="10-null-5" dnum="d-o" numlevel="1" lineno="137" slineno="4-9" level="2"><display>(d)</display>"Wildland urban interface coordinator" means the same as that term is defined in <ln numlevel="1" lineno="138" slineno="4-10"/>Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>.</subsection></subsection><subsection ssid="10-null-6" dnum="2-o" numlevel="1" lineno="139" slineno="4-11" level="1"><display>(2)</display>If evaluation of high risk wildland urban interface property is assigned to a county under <ln numlevel="1" lineno="140" slineno="4-12"/>Section <xref depth="3" refnumber="65A-8-402">65A-8-402</xref>:<subsection ssid="10-null-7" dnum="a-o" numlevel="1" lineno="141" slineno="4-13" level="2"><display>(a)</display>the county shall enter into a cooperative agreement with the Division of Forestry, <ln numlevel="1" lineno="142" slineno="4-14"/>Fire, and State Lands, in accordance with Subsection <xref depth="4" refnumber="65A-8-203(2)(a)">65A-8-203(2)(a)</xref>, which <ln numlevel="1" lineno="143" slineno="4-15"/>agreement shall address compliance with this Subsection <xref depth="4" refnumber="17-16-22(2)">(2)</xref> for evaluation and <ln numlevel="1" lineno="144" slineno="4-16"/>classification of high risk wildland urban interface property; and</subsection><subsection ssid="10-null-8" dnum="b-o" numlevel="1" lineno="145" slineno="4-17" level="2"><display>(b)</display>a county officer shall require that a wildland urban interface coordinator representing <ln numlevel="1" lineno="146" slineno="4-18"/>the county annually evaluate high risk wildland urban interface property within the <ln numlevel="1" lineno="147" slineno="4-19"/>county in accordance with Section <xref depth="3" refnumber="65A-8-402">65A-8-402</xref>.</subsection></subsection><subsection ssid="10-null-9" dnum="3-o" numlevel="1" lineno="148" slineno="4-20" level="1"><display>(3)</display>Beginning <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">January 1, 2026</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">January 1, 2027</amend>, a county officer shall:<subsection ssid="10-null-10" dnum="a-o" numlevel="1" lineno="149" slineno="4-21" level="2"><display>(a)</display>annually assess a fee:<subsection ssid="10-null-11" dnum="i-o" numlevel="1" lineno="150" slineno="4-22" level="3"><display>(i)</display>against the property owner of high risk wildland urban interface property within <ln numlevel="1" lineno="151" slineno="4-23"/>the incorporated and unincorporated portions of the county; and</subsection><subsection ssid="10-null-12" dnum="ii-o" numlevel="1" lineno="152" slineno="4-24" level="3"><display>(ii)</display>in the amount set by the Division of Forestry, Fire, and State Lands under Section <xref depth="3" refnumber="65A-8-402"><ln numlevel="1" lineno="153" slineno="4-25"/>65A-8-402</xref>; and</subsection></subsection><subsection ssid="10-null-13" dnum="b-o" numlevel="1" lineno="154" slineno="4-26" level="2" space="false"><display>(b)</display><subsection ssid="10-null-14" dnum="i-o" level="3" placement="sameline"><display>(i)</display>after retaining a portion of the fee under Subsection <xref depth="4" refnumber="17-16-22(3)(b)(ii)">(3)(b)(ii)</xref>, transmit the fee <ln numlevel="1" lineno="155" slineno="4-27"/>assessed under Subsection <xref depth="4" refnumber="17-16-22(3)(a)">(3)(a)</xref> to the Division of Forestry, Fire, and State Lands <ln numlevel="1" lineno="156" slineno="4-28"/>for deposit into the Utah Wildfire Fund created in Section <xref depth="3" refnumber="65A-8-217">65A-8-217</xref>; and</subsection><subsection ssid="10-null-15" dnum="ii-o" numlevel="1" lineno="157" slineno="4-29" level="3"><display>(ii)</display>retain that portion of the fee assessed under Subsection <xref depth="4" refnumber="17-16-22(3)(a)">(3)(a)</xref> necessary to pay <ln numlevel="1" lineno="158" slineno="4-30"/>costs incurred by the county in implementing this section, which the county may <ln numlevel="1" lineno="159" slineno="4-31"/>include in the county's annual accounting of wildfire prevention, preparedness, <ln numlevel="1" lineno="160" slineno="4-32"/>mitigation actions, and associated costs for purposes of Subsection <xref depth="4" refnumber="65A-8-203(4)(c)"><ln numlevel="1" lineno="161" slineno="4-33"/>65A-8-203(4)(c)</xref>.</subsection></subsection></subsection><subsection ssid="10-null-16" dnum="4-o" numlevel="1" lineno="162" slineno="4-34" level="1"><display>(4)</display>A county may hold a political subdivision lien on high risk wildland urban interface <ln numlevel="1" lineno="163" slineno="4-35"/>property for a fee that is past due by following the procedures in Sections <xref depth="3" refnumber="17B-1-902">17B-1-902</xref> <ln numlevel="1" lineno="164" slineno="4-36"/>and <xref depth="3" refnumber="17B-1-902.1">17B-1-902.1</xref>, as if the county is a special district.</subsection></section></bsec><bsec buid="12" num="65A-8-203" type="amend" src="code" uid="C65A-8-S203_2026050620260506" sort="65A08 02030020260506" numlevel="1" lineno="165" slineno="5-1" sn="5"><section number="65A-8-203" numlevel="1" lineno="166" slineno="5-2" type="amend"><secline lineno="165">Section 5. Section <bold>65A-8-203</bold> is amended to read:</secline><catline lineno="166"><bold>65A-8-203<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Cooperative fire protection agreements.</bold></catline><subsection ssid="12-null-1" dnum="1-o" numlevel="1" lineno="167" slineno="5-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "eligible entity" means:<subsection ssid="12-null-2" dnum="a-o" numlevel="1" lineno="168" slineno="5-4" level="2"><display>(a)</display>a county, a municipality, or a special service district, special district, or service area <ln numlevel="1" lineno="169" slineno="5-5"/>with:<subsection ssid="12-null-3" dnum="i-o" numlevel="1" lineno="170" slineno="5-6" level="3"><display>(i)</display>wildland fire suppression responsibility as described in Section <xref depth="3" refnumber="11-7-1">11-7-1</xref>; and</subsection><subsection ssid="12-null-4" dnum="ii-o" numlevel="1" lineno="171" slineno="5-7" level="3"><display>(ii)</display>wildland fire suppression cost responsibility and taxing authority for a specific <ln numlevel="1" lineno="172" slineno="5-8"/>geographic jurisdiction; or</subsection></subsection><subsection ssid="12-null-5" dnum="b-o" numlevel="1" lineno="173" slineno="5-9" level="2"><display>(b)</display>upon approval by the director, a political subdivision established by a county, <ln numlevel="1" lineno="174" slineno="5-10"/>municipality, special service district, special district, or service area that is <ln numlevel="1" lineno="175" slineno="5-11"/>responsible for:<subsection ssid="12-null-6" dnum="i-o" numlevel="1" lineno="176" slineno="5-12" level="3"><display>(i)</display>providing wildland fire suppression services; and</subsection><subsection ssid="12-null-7" dnum="ii-o" numlevel="1" lineno="177" slineno="5-13" level="3"><display>(ii)</display>paying for the cost of wildland fire suppression services.</subsection></subsection></subsection><subsection ssid="12-null-8" dnum="2-o" numlevel="1" lineno="178" slineno="5-14" level="1" space="false"><display>(2)</display><subsection ssid="12-null-9" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The governing body of any eligible entity may enter into a cooperative agreement <ln numlevel="1" lineno="179" slineno="5-15"/>with the division to receive financial and wildfire management cooperation and <ln numlevel="1" lineno="180" slineno="5-16"/>assistance from the division, as described in this part.</subsection><subsection ssid="12-null-10" dnum="b-o" numlevel="1" lineno="181" slineno="5-17" level="2"><display>(b)</display>A cooperative agreement shall last for a term of no more than five years and be <ln numlevel="1" lineno="182" slineno="5-18"/>renewable if the eligible entity continues to meet the requirements of this chapter.</subsection></subsection><subsection ssid="12-null-11" dnum="3-o" numlevel="1" lineno="183" slineno="5-19" level="1" space="false"><display>(3)</display><subsection ssid="12-null-12" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state shall assume an eligible entity's cost of suppressing catastrophic wildfire <ln numlevel="1" lineno="184" slineno="5-20"/>as defined in the cooperative agreement if the eligible entity has entered into, and is <ln numlevel="1" lineno="185" slineno="5-21"/>in full compliance with, a cooperative agreement with the division, as described in <ln numlevel="1" lineno="186" slineno="5-22"/>this section.</subsection><subsection ssid="12-null-13" dnum="b-o" numlevel="1" lineno="187" slineno="5-23" level="2"><display>(b)</display>A county or municipality that is not covered by a cooperative agreement with the <ln numlevel="1" lineno="188" slineno="5-24"/>division, as described in this section, shall be responsible for wildland fire costs <ln numlevel="1" lineno="189" slineno="5-25"/>within the county or municipality's jurisdiction, as described in Section <xref depth="3" refnumber="65A-8-203.2">65A-8-203.2</xref>.</subsection></subsection><subsection ssid="12-null-14" dnum="4-o" numlevel="1" lineno="190" slineno="5-26" level="1"><display>(4)</display>To enter into a cooperative agreement with the division, the eligible entity shall:<subsection ssid="12-null-15" dnum="a-o" numlevel="1" lineno="191" slineno="5-27" level="2"><display>(a)</display>require that the fire department or equivalent fire service provider under contract <ln numlevel="1" lineno="192" slineno="5-28"/>with, or delegated by, the eligible entity on unincorporated land meet minimum <ln numlevel="1" lineno="193" slineno="5-29"/>standards for wildland fire training, certification, and suppression equipment based <ln numlevel="1" lineno="194" slineno="5-30"/>upon nationally accepted standards as specified by the division;</subsection><subsection ssid="12-null-16" dnum="b-o" numlevel="1" lineno="195" slineno="5-31" level="2"><display>(b)</display>invest in prevention, preparedness, and mitigation efforts, as agreed to with the <ln numlevel="1" lineno="196" slineno="5-32"/>division, that will reduce the eligible entity's risk of catastrophic wildfire;</subsection><subsection ssid="12-null-17" dnum="c-o" numlevel="1" lineno="197" slineno="5-33" level="2" space="false"><display>(c)</display><subsection ssid="12-null-18" dnum="i-o" level="3" placement="sameline"><display>(i)</display>file with the division an annual accounting of wildfire prevention, preparedness, <ln numlevel="1" lineno="198" slineno="5-34"/>mitigation actions, and associated costs;</subsection><subsection ssid="12-null-19" dnum="ii-o" numlevel="1" lineno="199" slineno="5-35" level="3"><display>(ii)</display>meet the eligibility entity's participation commitment by making direct payments <ln numlevel="1" lineno="200" slineno="5-36"/>to the division; or</subsection><subsection ssid="12-null-20" dnum="iii-o" numlevel="1" lineno="201" slineno="5-37" level="3"><display>(iii)</display>do a combination of Subsections <xref depth="4" refnumber="65A-8-203(4)(c)(i)">(4)(c)(i)</xref> and <xref depth="4" refnumber="65A-8-203(ii)">(ii)</xref>;</subsection></subsection><subsection ssid="12-null-21" dnum="d-o" numlevel="1" lineno="202" slineno="5-38" level="2"><display>(d)</display>return the financial statement described in Subsection <xref depth="4" refnumber="65A-8-203(6)">(6)</xref>, signed by the chief <ln numlevel="1" lineno="203" slineno="5-39"/>executive of the eligible entity, to the division on or before the date set by the <ln numlevel="1" lineno="204" slineno="5-40"/>division;</subsection><subsection ssid="12-null-22" dnum="e-o" numlevel="1" lineno="205" slineno="5-41" level="2"><display>(e)</display>if the eligible entity is a county, have a designated fire warden as described in <ln numlevel="1" lineno="206" slineno="5-42"/>Section <xref depth="3" refnumber="65A-8-209.1">65A-8-209.1</xref>;</subsection><subsection ssid="12-null-23" dnum="f-o" numlevel="1" lineno="207" slineno="5-43" level="2"><display>(f)</display>subject to Subsection <xref tempid="863" depth="4" refnumber="65A-8-203(9)">(9)</xref>, adopt and enforce the wildland urban interface building <ln numlevel="1" lineno="208" slineno="5-44"/>standards, as defined in Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>, if the eligible entity is a:<subsection ssid="12-null-24" dnum="i-o" numlevel="1" lineno="209" slineno="5-45" level="3"><display>(i)</display>county for purposes of an unincorporated area within the county; or</subsection><subsection ssid="12-null-25" dnum="ii-o" numlevel="1" lineno="210" slineno="5-46" level="3"><display>(ii)</display>municipality for an incorporated area within a county; and</subsection></subsection><subsection ssid="12-null-26" dnum="g-o" numlevel="1" lineno="211" slineno="5-47" level="2"><display>(g)</display>if the eligible entity is a county, comply with Section <xref depth="3" refnumber="17-16-22">17-16-22</xref>.</subsection></subsection><subsection ssid="12-null-27" dnum="5-o" numlevel="1" lineno="212" slineno="5-48" level="1" space="false"><display>(5)</display><subsection ssid="12-null-28" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state forester may execute a cooperative agreement with the eligible entity.</subsection><subsection ssid="12-null-29" dnum="b-o" numlevel="1" lineno="213" slineno="5-49" level="2"><display>(b)</display>The division shall make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="214" slineno="5-50"/>Administrative Rulemaking Act, governing the:<subsection ssid="12-null-30" dnum="i-o" numlevel="1" lineno="215" slineno="5-51" level="3"><display>(i)</display>cooperative agreements described in this section;</subsection><subsection ssid="12-null-31" dnum="ii-o" numlevel="1" lineno="216" slineno="5-52" level="3"><display>(ii)</display>manner in which an eligible entity shall provide proof of compliance with <ln numlevel="1" lineno="217" slineno="5-53"/>Subsection <xref depth="4" refnumber="65A-8-203(4)">(4)</xref>;</subsection><subsection ssid="12-null-32" dnum="iii-o" numlevel="1" lineno="218" slineno="5-54" level="3"><display>(iii)</display>manner by which the division may revoke a cooperative agreement if an eligible <ln numlevel="1" lineno="219" slineno="5-55"/>entity ceases to meet the requirements described in this section;</subsection><subsection ssid="12-null-33" dnum="iv-o" numlevel="1" lineno="220" slineno="5-56" level="3"><display>(iv)</display>accounting system for determining suppression costs;</subsection><subsection ssid="12-null-34" dnum="v-o" numlevel="1" lineno="221" slineno="5-57" level="3"><display>(v)</display>manner in which the division shall determine the eligible entity's participation <ln numlevel="1" lineno="222" slineno="5-58"/>commitment; and</subsection><subsection ssid="12-null-35" dnum="vi-o" numlevel="1" lineno="223" slineno="5-59" level="3"><display>(vi)</display>manner in which an eligible entity may appeal a division determination of <ln numlevel="1" lineno="224" slineno="5-60"/>participation commitment.</subsection></subsection></subsection><subsection ssid="12-null-36" dnum="6-o" numlevel="1" lineno="225" slineno="5-61" level="1" space="false"><display>(6)</display><subsection ssid="12-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall send a financial statement to each eligible entity participating in <ln numlevel="1" lineno="226" slineno="5-62"/>a cooperative agreement that details the eligible entity's participation commitment for <ln numlevel="1" lineno="227" slineno="5-63"/>the coming fiscal year, including the prevention, preparedness, and mitigation actions <ln numlevel="1" lineno="228" slineno="5-64"/>agreed to under Subsection <xref depth="4" refnumber="65A-8-203(4)(b)">(4)(b)</xref>.</subsection><subsection ssid="12-null-38" dnum="b-o" numlevel="1" lineno="229" slineno="5-65" level="2"><display>(b)</display>Each eligible entity participating in a cooperative agreement shall:<subsection ssid="12-null-39" dnum="i-o" numlevel="1" lineno="230" slineno="5-66" level="3"><display>(i)</display>have the chief executive of the eligible entity sign the financial statement, or the <ln numlevel="1" lineno="231" slineno="5-67"/>legislative body of the eligible entity approve the financial statement by <ln numlevel="1" lineno="232" slineno="5-68"/>resolution, confirming the eligible entity's participation for the upcoming year; and</subsection><subsection ssid="12-null-40" dnum="ii-o" numlevel="1" lineno="233" slineno="5-69" level="3"><display>(ii)</display>return the financial statement to the division, on or before a date set by the <ln numlevel="1" lineno="234" slineno="5-70"/>division.</subsection></subsection><subsection ssid="12-null-41" dnum="c-o" numlevel="1" lineno="235" slineno="5-71" level="2"><display>(c)</display>A financial statement shall be effective for one calendar year, beginning on the date <ln numlevel="1" lineno="236" slineno="5-72"/>set by the division, as described in Subsection <xref depth="4" refnumber="65A-8-203(6)(b)">(6)(b)</xref>.</subsection></subsection><subsection ssid="12-null-42" dnum="7-o" numlevel="1" lineno="237" slineno="5-73" level="1" space="false"><display>(7)</display><subsection ssid="12-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An eligible entity may revoke a cooperative agreement before the end of the <ln numlevel="1" lineno="238" slineno="5-74"/>cooperative agreement's term by:<subsection ssid="12-null-44" dnum="i-o" numlevel="1" lineno="239" slineno="5-75" level="3" tab="1"><display>(i)</display>informing the division, in writing, of the eligible entity's intention to revoke the <ln numlevel="1" lineno="240" slineno="5-76"/>cooperative agreement; or</subsection><subsection ssid="12-null-45" dnum="ii-o" numlevel="1" lineno="241" slineno="5-77" level="3" tab="1"><display>(ii)</display>failing to sign and return its annual financial statement, as described in <ln numlevel="1" lineno="242" slineno="5-78"/>Subsection <xref depth="4" refnumber="65A-8-203(6)(b)">(6)(b)</xref>, unless the director grants an extension.</subsection></subsection><subsection ssid="12-null-46" dnum="b-o" numlevel="1" lineno="243" slineno="5-79" level="2"><display>(b)</display>An eligible entity may not revoke a cooperative agreement before the end of the term <ln numlevel="1" lineno="244" slineno="5-80"/>of a signed annual financial statement, as described in Subsection <xref depth="4" refnumber="65A-8-203(6)(c)">(6)(c)</xref>.</subsection></subsection><subsection ssid="12-null-47" dnum="8-o" numlevel="1" lineno="245" slineno="5-81" level="1" space="false"><display>(8)</display><subsection ssid="12-null-48" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall develop and maintain a wildfire risk assessment mapping tool <ln numlevel="1" lineno="246" slineno="5-82"/>that is online and publicly accessible.</subsection><subsection ssid="12-null-49" dnum="b-o" numlevel="1" lineno="247" slineno="5-83" level="2"><display>(b)</display>The division shall analyze and establish by rule, made in accordance with Title 63G, <ln numlevel="1" lineno="248" slineno="5-84"/>Chapter 3, Utah Administrative Rulemaking Act, boundaries for high risk wildland <ln numlevel="1" lineno="249" slineno="5-85"/>urban interface property and what constitutes wildland urban interface property that <ln numlevel="1" lineno="250" slineno="5-86"/>is not high risk within the wildfire risk assessment mapping tool described in <ln numlevel="1" lineno="251" slineno="5-87"/>Subsection <xref depth="4" refnumber="65A-8-203(8)(a)">(8)(a)</xref>:<subsection ssid="12-null-50" dnum="i-o" numlevel="1" lineno="252" slineno="5-88" level="3"><display>(i)</display>using a scientific assessment; and</subsection><subsection ssid="12-null-51" dnum="ii-o" numlevel="1" lineno="253" slineno="5-89" level="3"><display>(ii)</display>that is focused on the risk to dwellings within the wildland urban interface area.</subsection></subsection><subsection ssid="12-null-52" dnum="c-o" numlevel="1" lineno="254" slineno="5-90" level="2"><display>(c)</display>With regard to the categories used within the wildfire risk assessment mapping tool <ln numlevel="1" lineno="255" slineno="5-91"/>described in Subsection <xref depth="4" refnumber="65A-8-203(8)(a)">(8)(a)</xref>, the division may adjust the assessment for <ln numlevel="1" lineno="256" slineno="5-92"/>participation commitments if the adjustment is based on the Consumer Price Index <ln numlevel="1" lineno="257" slineno="5-93"/>for All Urban Consumers as published by the Bureau of Labor Statistics of the <ln numlevel="1" lineno="258" slineno="5-94"/>United States Department of Labor, in accordance with a formula established by the <ln numlevel="1" lineno="259" slineno="5-95"/>division by rule made in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="260" slineno="5-96"/>Rulemaking Act.</subsection><subsection ssid="12-71" dnum="_-o:d-e" numlevel="1" lineno="261" slineno="5-97" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="65A-8-203(8)(a)">(8)(a)</xref>, the division shall:</amend><subsection ssid="12-67" dnum="_-o:i-e" numlevel="1" lineno="262" slineno="5-98" ea="amend" anum="0" owner="admin" style="1" level="3" space="false"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><subsection ssid="12-76" dnum="_-o:A-e" ea="amend" anum="0" owner="admin" style="1" level="4" placement="sameline"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="e" level="1">(A)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="admin" level="1" amendtag="end">for the wildfire risk assessment mapping tool that the division has adopted <ln numlevel="1" lineno="263" slineno="5-99"/>before the effective date of this section, provide a copy and explanation of the <ln numlevel="1" lineno="264" slineno="5-100"/>wildfire risk assessment mapping tool to each county on or before August 6, <ln numlevel="1" lineno="265" slineno="5-101"/>2026; and</amend></subsection><subsection ssid="12-73" dnum="_-o:B-e" numlevel="1" lineno="266" slineno="5-102" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="31" style="1" owner="admin" level="1" amendtag="end">for a wildfire risk assessment mapping tool that the division adopts on or after <ln numlevel="1" lineno="267" slineno="5-103"/>the effective date of this section which expands the boundary of the high risk <ln numlevel="1" lineno="268" slineno="5-104"/>wildland urban interface, provide a copy and explanation of the expansion of <ln numlevel="1" lineno="269" slineno="5-105"/>the boundary of the high risk wildland urban interface to each impacted county <ln numlevel="1" lineno="270" slineno="5-106"/>at least 60 days before adopting the change to the wildfire risk assessment <ln numlevel="1" lineno="271" slineno="5-107"/>mapping tool;</amend></subsection></subsection><subsection ssid="12-77" dnum="_-o:ii-e" numlevel="1" lineno="272" slineno="5-108" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="44" style="1" owner="admin" level="1" amendtag="end">give each impacted county 30 days after the day on which the division complies <ln numlevel="1" lineno="273" slineno="5-109"/>with Subsection <xref depth="4" refnumber="65A-8-203(8)(d)(i)">(8)(d)(i)</xref> to provide the division written recommended changes;</amend></subsection><subsection ssid="12-68" dnum="_-o:iii-e" numlevel="1" lineno="274" slineno="5-110" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="admin" level="1" amendtag="end">within 30 days after the day on which the division receives the impacted county's <ln numlevel="1" lineno="275" slineno="5-111"/>written recommended changes:</amend><subsection ssid="12-69" dnum="_-o:A-e" numlevel="1" lineno="276" slineno="5-112" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="16" style="1" owner="admin" level="1" amendtag="end">implement the impacted county's written recommended changes to the <ln numlevel="1" lineno="277" slineno="5-113"/>wildfire risk assessment mapping tool;</amend></subsection><subsection ssid="12-75" dnum="_-o:B-e" numlevel="1" lineno="278" slineno="5-114" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="39" style="1" owner="admin" level="1" amendtag="end">provide a written response to the impacted county justifying the division's <ln numlevel="1" lineno="279" slineno="5-115"/>modification of the county's written recommended changes to the wildfire risk <ln numlevel="1" lineno="280" slineno="5-116"/>assessment mapping tool; or</amend></subsection><subsection ssid="12-70" dnum="_-o:C-e" numlevel="1" lineno="281" slineno="5-117" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="admin" level="1" amendtag="end">provide a written response to the impacted county justifying the division's <ln numlevel="1" lineno="282" slineno="5-118"/>rejection of the impacted county's written recommended changes to the <ln numlevel="1" lineno="283" slineno="5-119"/>wildfire risk assessment mapping tool; and</amend></subsection></subsection><subsection ssid="12-79" dnum="_-o:iv-e" numlevel="1" lineno="284" slineno="5-120" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="75" groupid="48" style="1" owner="admin" level="1" amendtag="end">in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, <ln numlevel="1" lineno="285" slineno="5-121"/>make rules to administer and enforce this Subsection <xref depth="4" refnumber="65A-8-203(8)(d)">(8)(d)</xref>.</amend></subsection></subsection></subsection><subsection ssid="12-null-53" dnum="9-o" numlevel="1" lineno="286" slineno="5-122" level="1" space="false"><display>(9)</display><subsection ssid="12-null-54" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the state under Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref> adopts an edition of the Utah Wildland <ln numlevel="1" lineno="287" slineno="5-123"/>Urban Interface Code, issued by the International Code Council, with the alternatives <ln numlevel="1" lineno="288" slineno="5-124"/>or amendments approved by the division, as a wildland urban interface building <ln numlevel="1" lineno="289" slineno="5-125"/>standard that may be adopted by a local compliance agency:<subsection ssid="12-null-55" dnum="i-o" numlevel="1" lineno="290" slineno="5-126" level="3" tab="1"><display>(i)</display>for purposes of an unincorporated area within a county, the county shall adopt and <ln numlevel="1" lineno="291" slineno="5-127"/>enforce the wildland urban interface building standard described in this <ln numlevel="1" lineno="292" slineno="5-128"/>Subsection <xref depth="4" refnumber="65A-8-203(9)(a)">(9)(a)</xref>; and</subsection><subsection ssid="12-null-56" dnum="ii-o" numlevel="1" lineno="293" slineno="5-129" level="3" tab="1"><display>(ii)</display>for purposes of an incorporated area within a county, the relevant municipality <ln numlevel="1" lineno="294" slineno="5-130"/>shall adopt and enforce the wildland urban interface building standard described <ln numlevel="1" lineno="295" slineno="5-131"/>in this Subsection <xref refnumber="65A-8-203(9)(a)" depth="4">(9)(a)</xref>.</subsection></subsection><subsection ssid="12-null-57" dnum="b-o" numlevel="1" lineno="296" slineno="5-132" level="2"><display>(b)</display>If a county or municipality fails to comply with Subsections <xref refnumber="65A-8-203(4)(f)" depth="4">(4)(f)</xref> and <xref refnumber="65A-8-203(9)(a)" depth="4">(9)(a)</xref>, the <ln numlevel="1" lineno="297" slineno="5-133"/>division may choose to not pay costs of the county or municipality under a <ln numlevel="1" lineno="298" slineno="5-134"/>cooperative agreement executed under this section.</subsection><subsection ssid="12-null-58" dnum="c-o" numlevel="1" lineno="299" slineno="5-135" level="2" space="false"><display>(c)</display><subsection ssid="12-null-59" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If the state adopts a different wildland urban interface building standard than <ln numlevel="1" lineno="300" slineno="5-136"/>was previously adopted under Section <xref depth="3" refnumber="15A-2-103">15A-2-103</xref>, a county or municipality has <ln numlevel="1" lineno="301" slineno="5-137"/>two years from the date the state adopts the different wildland urban interface <ln numlevel="1" lineno="302" slineno="5-138"/>building standard to adopt the appropriate wildland urban interface building <ln numlevel="1" lineno="303" slineno="5-139"/>standard.</subsection><subsection ssid="12-null-60" dnum="ii-o" numlevel="1" lineno="304" slineno="5-140" level="3"><display>(ii)</display>If a county or municipality fails to adopt the appropriate wildland urban interface <ln numlevel="1" lineno="305" slineno="5-141"/>building standard within the time period described in Subsection <xref tempid="752" depth="4" refnumber="65A-8-203(9)(c)(i)">(9)(c)(i)</xref>, the <ln numlevel="1" lineno="306" slineno="5-142"/>division may choose to not pay costs of the county or municipality under a <ln numlevel="1" lineno="307" slineno="5-143"/>cooperative agreement executed under this section beginning two years from the <ln numlevel="1" lineno="308" slineno="5-144"/>day on which the state adopts the different wildland urban interface building <ln numlevel="1" lineno="309" slineno="5-145"/>standard and until such time as the county or municipality adopts the appropriate <ln numlevel="1" lineno="310" slineno="5-146"/>wildland urban interface building standard.</subsection></subsection></subsection><subsection ssid="12-null-61" dnum="10-o" numlevel="1" lineno="311" slineno="5-147" level="1" space="false"><display>(10)</display><subsection ssid="12-null-62" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division may by rule, made in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="312" slineno="5-148"/>Administrative Rulemaking Act, establish criteria for community wildfire <ln numlevel="1" lineno="313" slineno="5-149"/>preparedness plans addressing wildland urban interface. The criteria shall require <ln numlevel="1" lineno="314" slineno="5-150"/>action that is:<subsection ssid="12-null-63" dnum="i-o" numlevel="1" lineno="315" slineno="5-151" level="3" tab="1"><display>(i)</display>qualitative and quantitative; and</subsection><subsection ssid="12-null-64" dnum="ii-o" numlevel="1" lineno="316" slineno="5-152" level="3" tab="1"><display>(ii)</display>leads to reduced wildfire risk.</subsection></subsection><subsection ssid="12-null-65" dnum="b-o" numlevel="1" lineno="317" slineno="5-153" level="2"><display>(b)</display>An eligible entity shall agree to implement prevention, preparedness, and mitigation <ln numlevel="1" lineno="318" slineno="5-154"/>actions identified in a community wildfire preparedness plan addressing wildland <ln numlevel="1" lineno="319" slineno="5-155"/>urban interface that is approved by the division.</subsection></subsection></section></bsec><bsec buid="14" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="320" slineno="6-1" sn="6"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="320">Section 6.  <bold>Effective Date.</bold></secline><subsection ssid="14-1" dnum="_-o:1-e" numlevel="1" lineno="321" slineno="6-2" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="2" style="1" owner="admin" level="1" m-anum="0" m-ea="amend" m-pairid="5" m-groupid="4" m-style="1" m-owner="admin" m-level="1" amendtag="end">Except as provided in Subsection (2), this bill takes effect <effdate uid="code" date="1/1/2027">January 1, 2027</effdate>.</amend></subsection><subsection ssid="14-2" dnum="_-o:2-e" numlevel="1" lineno="322" slineno="6-3" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="admin" level="1" amendtag="end">The actions affecting the following sections take effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>:</amend><subsection ssid="14-3" dnum="_-o:a-e" numlevel="1" lineno="323" slineno="6-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="admin" level="1" amendtag="end">Section 17E-7-401<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>; and</amend></subsection><subsection ssid="14-4" dnum="_-o:b-e" numlevel="1" lineno="324" slineno="6-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="admin" level="1" amendtag="end">Section 65A-8-203<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>.</amend></subsection></subsection></section></bsec></bdy><foot><rev><tm>3-5-26 7:47 PM</tm></rev></foot></leg>
