Harper</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill makes changes related to the child protection ombudsman.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">allows the child protection ombudsman to receive a complaint with respect to a parent;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">requires the child protection ombudsman to:<hl numlevel="1" lineno="10" slineno="0-10" level="2">provide information about a parent's and child's rights on the child protection <ln numlevel="1" lineno="11" slineno="0-11"/>ombudsman's website; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">annually report to the Child Welfare Legislative Oversight Panel and the Health and <ln numlevel="1" lineno="13" slineno="0-13"/>Human Services Interim Committee;</hl></hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires a peace officer or child welfare caseworker who takes a child into protective <ln numlevel="1" lineno="15" slineno="0-15"/>custody to provide the child's parent or guardian with information about the child <ln numlevel="1" lineno="16" slineno="0-16"/>protection ombudsman; and</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="18" slineno="0-18" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="19">None</moniNone><oc numlevel="1" lineno="20" slineno="0-20">Other Special Clauses:</oc><ocNone lineno="21">None</ocNone><sa numlevel="1" lineno="22" slineno="0-22">Utah Code Sections Affected:<saamd numlevel="1" lineno="23" slineno="0-23"><snhead>AMENDS:</snhead><sn num="80-2-1104" src="code" uid="C80-2-S1104_2026050620260506" buid="10" sort="80 02 11040020260506" numlevel="1" lineno="24" slineno="0-24"><bold>80-2-1104</bold>, as last amended by Laws of Utah 2024, Chapter 250</sn><sn num="80-2a-203" src="code" uid="C80-2a-S203_2026050620260506" buid="24" sort="80 02a02030020260506" numlevel="1" lineno="25" slineno="0-25"><bold>80-2a-203</bold>, as renumbered and amended by Laws of Utah 2022, Chapter 334</sn></saamd></sa></lt><enacthead lineno="26"/><enact numlevel="1" lineno="27" slineno="0-27">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="10" num="80-2-1104" type="amend" src="code" uid="C80-2-S1104_2026050620260506" sort="80 02 11040020260506" numlevel="1" lineno="28" slineno="1-1" sn="1"><section number="80-2-1104" numlevel="1" lineno="29" slineno="1-2" type="amend"><secline lineno="28">Section 1. Section <bold>80-2-1104</bold> is amended to read:</secline><catline lineno="29"><bold>80-2-1104<parens/>. Child protection ombudsman -- Responsibility -- Authority -- Report.</bold></catline><subsection ssid="10-null-1" dnum="1-o" numlevel="1" lineno="30" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="10-null-2" dnum="a-o" numlevel="1" lineno="31" slineno="1-4" level="2"><display>(a)</display>"Complainant" means a person who initiates a complaint with the ombudsman.</subsection><subsection ssid="10-null-3" dnum="b-o" numlevel="1" lineno="32" slineno="1-5" level="2"><display>(b)</display>"Complaint" means a complaint regarding an act or omission by the division with <ln numlevel="1" lineno="33" slineno="1-6"/>respect to a particular child<amend anum="0" ea="amend" pairid="47" groupid="38" style="1" owner="admin" level="1" amendtag="both"> or parent</amend>.</subsection><subsection ssid="10-null-4" dnum="c-o" numlevel="1" lineno="34" slineno="1-7" level="2"><display>(c)</display>"Ombudsman" means the child protection ombudsman appointed under this section.</subsection></subsection><subsection ssid="10-null-5" dnum="2-o" numlevel="1" lineno="35" slineno="1-8" level="1" space="false"><display>(2)</display><subsection ssid="10-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is created within the department the position of child protection <ln numlevel="1" lineno="36" slineno="1-9"/>ombudsman. </subsection><subsection ssid="10-null-7" dnum="b-o" numlevel="1" lineno="37" slineno="1-10" level="2"><display>(b)</display>The executive director of the department shall:<subsection ssid="10-null-8" dnum="i-o" numlevel="1" lineno="38" slineno="1-11" level="3"><display>(i)</display>appoint an ombudsman who has:<subsection ssid="10-null-9" dnum="A-o" numlevel="1" lineno="39" slineno="1-12" level="4"><display>(A)</display>recognized executive and administrative capacity; and</subsection><subsection ssid="10-null-10" dnum="B-o" numlevel="1" lineno="40" slineno="1-13" level="4"><display>(B)</display>experience in child welfare, and in state laws and policies governing abused, <ln numlevel="1" lineno="41" slineno="1-14"/>neglected, and dependent children; and</subsection></subsection><subsection ssid="10-null-11" dnum="ii-o" numlevel="1" lineno="42" slineno="1-15" level="3"><display>(ii)</display>select the ombudsman solely with regard to qualifications and fitness to discharge <ln numlevel="1" lineno="43" slineno="1-16"/>the duties of the ombudsman.</subsection></subsection><subsection ssid="10-null-12" dnum="c-o" numlevel="1" lineno="44" slineno="1-17" level="2"><display>(c)</display>The ombudsman shall:<subsection ssid="10-null-13" dnum="i-o" numlevel="1" lineno="45" slineno="1-18" level="3"><display>(i)</display>serve at the pleasure of the executive director of the department; and</subsection><subsection ssid="10-null-14" dnum="ii-o" numlevel="1" lineno="46" slineno="1-19" level="3"><display>(ii)</display>devote full-time to the duties described in this section.</subsection></subsection></subsection><subsection ssid="10-null-15" dnum="3-o" numlevel="1" lineno="47" slineno="1-20" level="1"><display>(3)</display>The ombudsman shall:<subsection ssid="10-null-16" dnum="a-o" numlevel="1" lineno="48" slineno="1-21" level="2"><display>(a)</display>unless the ombudsman decides not to investigate the complaint, upon receipt of a <ln numlevel="1" lineno="49" slineno="1-22"/>complaint, investigate whether an act or omission of the division with respect to a <ln numlevel="1" lineno="50" slineno="1-23"/>particular child<amend anum="0" ea="amend" pairid="59" groupid="46" style="1" owner="admin" level="1" amendtag="both"> or parent</amend>:<subsection ssid="10-null-17" dnum="i-o" numlevel="1" lineno="51" slineno="1-24" level="3"><display>(i)</display>is contrary to statute, rule, or policy;</subsection><subsection ssid="10-null-18" dnum="ii-o" numlevel="1" lineno="52" slineno="1-25" level="3"><display>(ii)</display>places a child's health or safety at risk;</subsection><subsection ssid="10-null-19" dnum="iii-o" numlevel="1" lineno="53" slineno="1-26" level="3"><display>(iii)</display>is made without an adequate statement of reason; or</subsection><subsection ssid="10-null-20" dnum="iv-o" numlevel="1" lineno="54" slineno="1-27" level="3"><display>(iv)</display>is based on irrelevant, immaterial, or erroneous grounds;</subsection></subsection><subsection ssid="10-null-21" dnum="b-o" numlevel="1" lineno="55" slineno="1-28" level="2"><display>(b)</display>notify the complainant and the division of:<subsection ssid="10-null-22" dnum="i-o" numlevel="1" lineno="56" slineno="1-29" level="3"><display>(i)</display>the ombudsman's decision to investigate or not investigate the complaint; and</subsection><subsection ssid="10-null-23" dnum="ii-o" numlevel="1" lineno="57" slineno="1-30" level="3"><display>(ii)</display>if the ombudsman decides not to investigate the complaint, the reason for the <ln numlevel="1" lineno="58" slineno="1-31"/>decision;</subsection></subsection><subsection ssid="10-null-24" dnum="c-o" numlevel="1" lineno="59" slineno="1-32" level="2"><display>(c)</display>if the ombudsman finds that a person's act or omission violates state or federal <ln numlevel="1" lineno="60" slineno="1-33"/>criminal law, immediately report the finding to the appropriate county or district <ln numlevel="1" lineno="61" slineno="1-34"/>attorney or to the attorney general;</subsection><subsection ssid="10-null-25" dnum="d-o" numlevel="1" lineno="62" slineno="1-35" level="2"><display>(d)</display>immediately notify the division if the ombudsman finds that a child needs protective <ln numlevel="1" lineno="63" slineno="1-36"/>custody;</subsection><subsection ssid="10-null-26" dnum="e-o" numlevel="1" lineno="64" slineno="1-37" level="2"><display>(e)</display>prepare a written report of the findings and recommendations, if any, of each <ln numlevel="1" lineno="65" slineno="1-38"/>investigation;</subsection><subsection ssid="10-null-27" dnum="f-o" numlevel="1" lineno="66" slineno="1-39" level="2"><display>(f)</display>make recommendations to the division if the ombudsman finds that:<subsection ssid="10-null-28" dnum="i-o" numlevel="1" lineno="67" slineno="1-40" level="3"><display>(i)</display>a matter should be further considered by the division;</subsection><subsection ssid="10-null-29" dnum="ii-o" numlevel="1" lineno="68" slineno="1-41" level="3"><display>(ii)</display>an administrative act should be addressed, modified, or canceled;</subsection><subsection ssid="10-null-30" dnum="iii-o" numlevel="1" lineno="69" slineno="1-42" level="3"><display>(iii)</display>action should be taken by the division with regard to one of the division's <ln numlevel="1" lineno="70" slineno="1-43"/>employees; or</subsection><subsection ssid="10-null-31" dnum="iv-o" numlevel="1" lineno="71" slineno="1-44" level="3"><display>(iv)</display>any other action should be taken by the division;</subsection></subsection><subsection ssid="10-null-32" dnum="g-o" numlevel="1" lineno="72" slineno="1-45" level="2"><display>(g)</display>subject to<amend anum="0" ea="amend" pairid="64" groupid="50" style="1" owner="admin" level="1" amendtag="both"> this</amend> Subsection <xref depth="4" refnumber="80-2-1104(3)">(3)</xref>, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="73" slineno="1-46"/>Administrative Rulemaking Act, make rules that govern the following:<subsection ssid="10-null-33" dnum="i-o" numlevel="1" lineno="74" slineno="1-47" level="3"><display>(i)</display>receiving and processing a complaint;</subsection><subsection ssid="10-null-34" dnum="ii-o" numlevel="1" lineno="75" slineno="1-48" level="3"><display>(ii)</display>notifying a complainant and the division regarding a decision to investigate or to <ln numlevel="1" lineno="76" slineno="1-49"/>decline to investigate a complaint;</subsection><subsection ssid="10-null-35" dnum="iii-o" numlevel="1" lineno="77" slineno="1-50" level="3"><display>(iii)</display>prioritizing workload;</subsection><subsection ssid="10-null-36" dnum="iv-o" numlevel="1" lineno="78" slineno="1-51" level="3"><display>(iv)</display>maximum time within which an investigation is required to be completed;</subsection><subsection ssid="10-null-37" dnum="v-o" numlevel="1" lineno="79" slineno="1-52" level="3"><display>(v)</display>conducting an investigation;</subsection><subsection ssid="10-null-38" dnum="vi-o" numlevel="1" lineno="80" slineno="1-53" level="3"><display>(vi)</display>notifying a complainant and the division regarding the results of an investigation; <ln numlevel="1" lineno="81" slineno="1-54"/>and</subsection><subsection ssid="10-null-39" dnum="vii-o" numlevel="1" lineno="82" slineno="1-55" level="3"><display>(vii)</display>making recommendations based on the findings and results of investigations;</subsection></subsection><subsection ssid="10-null-40" dnum="h-o" numlevel="1" lineno="83" slineno="1-56" level="2"><display>(h)</display>within appropriations from the Legislature, employ staff as may be necessary to <ln numlevel="1" lineno="84" slineno="1-57"/>carry out the ombudsman's duties under this section;</subsection><subsection ssid="10-null-41" dnum="i-o" numlevel="1" lineno="85" slineno="1-58" level="2"><display>(i)</display>provide information regarding the role, duties, and functions of the ombudsman to <ln numlevel="1" lineno="86" slineno="1-59"/>public agencies, private entities, and individuals;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="50" groupid="41" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="10-77" dnum="_-o:j-e" numlevel="1" lineno="87" slineno="1-60" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="e" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="42" style="1" owner="admin" level="1" amendtag="end">provide on the ombudsman's website, in a form that is easily accessible, information <ln numlevel="1" lineno="88" slineno="1-61"/>about the fundamental rights of a parent and child and the responsibility of the state <ln numlevel="1" lineno="89" slineno="1-62"/>in a child welfare matter as described in Section <xref depth="3" refnumber="80-2a-201">80-2a-201</xref>; and</amend></subsection><subsection ssid="10-null-42" dnum="j-o:k-e" numlevel="1" lineno="90" slineno="1-63" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="both">(j)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1043" style="1" owner="e" level="1" amendtag="both" space="true">(k)</amend></display>as appropriate, make recommendations to the division regarding individual child <ln numlevel="1" lineno="91" slineno="1-64"/>welfare cases, and the rules, policies, and operations of the division.</subsection></subsection><subsection ssid="10-null-43" dnum="4-o" numlevel="1" lineno="92" slineno="1-65" level="1" space="false"><display>(4)</display><subsection ssid="10-null-44" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The ombudsman may:<subsection ssid="10-null-45" dnum="i-o" numlevel="1" lineno="93" slineno="1-66" level="3" tab="1"><display>(i)</display>decline to investigate a complaint or continue an investigation of a complaint;</subsection><subsection ssid="10-null-46" dnum="ii-o" numlevel="1" lineno="94" slineno="1-67" level="3" tab="1"><display>(ii)</display>conduct an investigation on the ombudsman's own initiative;</subsection><subsection ssid="10-null-47" dnum="iii-o" numlevel="1" lineno="95" slineno="1-68" level="3" tab="1"><display>(iii)</display>conduct further investigation upon the request of the complainant or upon the <ln numlevel="1" lineno="96" slineno="1-69"/>ombudsman's own initiative; and</subsection><subsection ssid="10-null-48" dnum="iv-o" numlevel="1" lineno="97" slineno="1-70" level="3" tab="1"><display>(iv)</display>advise a complainant to pursue administrative remedies or channels of a <ln numlevel="1" lineno="98" slineno="1-71"/>complaint before pursuing a complaint with the ombudsman.</subsection></subsection><subsection ssid="10-null-49" dnum="b-o" numlevel="1" lineno="99" slineno="1-72" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="80-2-1104(4)(a)(iv)">(4)(a)(iv)</xref> does not prevent a complainant from making a complaint <ln numlevel="1" lineno="100" slineno="1-73"/>directly to the ombudsman before pursuing an administrative remedy.</subsection></subsection><subsection ssid="10-null-50" dnum="5-o" numlevel="1" lineno="101" slineno="1-74" level="1" space="false"><display>(5)</display><subsection ssid="10-null-51" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A record of the ombudsman regarding an individual child welfare case shall be <ln numlevel="1" lineno="102" slineno="1-75"/>classified in accordance with federal law and Title 63G, Chapter 2, Government <ln numlevel="1" lineno="103" slineno="1-76"/>Records Access and Management Act. </subsection><subsection ssid="10-null-52" dnum="b-o" numlevel="1" lineno="104" slineno="1-77" level="2"><display>(b)</display>The ombudsman shall have access to all of the department's written and electronic <ln numlevel="1" lineno="105" slineno="1-78"/>records and databases, including those regarding individual child welfare cases.</subsection><subsection ssid="10-null-53" dnum="c-o" numlevel="1" lineno="106" slineno="1-79" level="2"><display>(c)</display>In accordance with Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="107" slineno="1-80"/>Management Act, all documents and information received by the ombudsman shall <ln numlevel="1" lineno="108" slineno="1-81"/>maintain the same classification that was designated by the department.</subsection></subsection><subsection ssid="10-54" dnum="_-o:6-e" numlevel="1" lineno="109" slineno="1-82" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="e" level="1" amendtag="start">(6)</amend></display><subsection ssid="10-55" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="admin" level="1" amendtag="end">On or before October 1 of each year, the ombudsman shall provide a written <ln numlevel="1" lineno="110" slineno="1-83"/>report to the Child Welfare Legislative Oversight Panel and the Health and Human <ln numlevel="1" lineno="111" slineno="1-84"/>Services Interim Committee.</amend></subsection><subsection ssid="10-56" dnum="_-o:b-e" numlevel="1" lineno="112" slineno="1-85" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="9" style="1" owner="admin" level="1" amendtag="end">The written report described in Subsection <xref depth="4" refnumber="80-2-1104(6)(a)">(6)(a)</xref> shall include:</amend><subsection ssid="10-57" dnum="_-o:i-e" numlevel="1" lineno="113" slineno="1-86" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="admin" level="1" amendtag="end">the total number of complaints filed with the ombudsman;</amend></subsection><subsection ssid="10-58" dnum="_-o:ii-e" numlevel="1" lineno="114" slineno="1-87" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="18" style="1" owner="admin" level="1" amendtag="end">the number of complaints the ombudsman investigated;</amend></subsection><subsection ssid="10-59" dnum="_-o:iii-e" numlevel="1" lineno="115" slineno="1-88" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="22" style="1" owner="admin" level="1" amendtag="end">reoccurring themes among complaints, if any; and</amend></subsection><subsection ssid="10-60" dnum="_-o:iv-e" numlevel="1" lineno="116" slineno="1-89" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="admin" level="1" amendtag="end">any recommendations regarding policies or procedures of the division or the <ln numlevel="1" lineno="117" slineno="1-90"/>position of the ombudsman.</amend></subsection></subsection></subsection></section></bsec><bsec buid="24" num="80-2a-203" type="amend" src="code" uid="C80-2a-S203_2026050620260506" sort="80 02a02030020260506" numlevel="1" lineno="118" slineno="2-1" sn="2"><section number="80-2a-203" numlevel="1" lineno="119" slineno="2-2" type="amend"><secline lineno="118">Section 2. Section <bold>80-2a-203</bold> is amended to read:</secline><catline lineno="119"><bold>80-2a-203<parens/>. Notice upon issuance of a warrant or removal of a child -- Locating <ln numlevel="1" lineno="120" slineno="2-3"/>noncustodial parent -- Information provided to parent, guardian, or responsible relative.</bold></catline><subsection ssid="24-null-1" dnum="1-o" numlevel="1" lineno="121" slineno="2-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="24-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A peace officer or child welfare caseworker who takes a child into protective <ln numlevel="1" lineno="122" slineno="2-5"/>custody under Subsection <xref depth="4" refnumber="80-2a-202(1)" start="0">80-2a-202(1)</xref>, shall immediately use reasonable efforts to <ln numlevel="1" lineno="123" slineno="2-6"/>locate and inform, through the most efficient means available, the child's parents, <ln numlevel="1" lineno="124" slineno="2-7"/>including a noncustodial parent, the child's guardian, or a responsible relative:<subsection ssid="24-null-3" dnum="i-o" numlevel="1" lineno="125" slineno="2-8" level="3" tab="1"><display>(i)</display>that the child is in protective custody;</subsection><subsection ssid="24-null-4" dnum="ii-o" numlevel="1" lineno="126" slineno="2-9" level="3" tab="1"><display>(ii)</display>the reason for removal and placement of the child in protective custody;</subsection><subsection ssid="24-null-5" dnum="iii-o" numlevel="1" lineno="127" slineno="2-10" level="3" tab="1"><display>(iii)</display>that the parent, guardian, or relative will be provided with information on:<subsection ssid="24-null-6" dnum="A-o" numlevel="1" lineno="128" slineno="2-11" level="4"><display>(A)</display>the parent's or guardian's procedural rights; and</subsection><subsection ssid="24-null-7" dnum="B-o" numlevel="1" lineno="129" slineno="2-12" level="4"><display>(B)</display>the preliminary stages of the investigation and shelter hearing;</subsection></subsection><subsection ssid="24-null-8" dnum="iv-o" numlevel="1" lineno="130" slineno="2-13" level="3" tab="1"><display>(iv)</display>of a telephone number where the parent or guardian may access further <ln numlevel="1" lineno="131" slineno="2-14"/>information;</subsection><subsection ssid="24-null-9" dnum="v-o" numlevel="1" lineno="132" slineno="2-15" level="3" tab="1"><display>(v)</display>that the child and the child's parent or guardian are entitled to have an attorney <ln numlevel="1" lineno="133" slineno="2-16"/>present at the shelter hearing;</subsection><subsection ssid="24-null-10" dnum="vi-o" numlevel="1" lineno="134" slineno="2-17" level="3" tab="1"><display>(vi)</display>that if the child's parent or guardian is an indigent individual and desires to have <ln numlevel="1" lineno="135" slineno="2-18"/>an attorney, one will be provided;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="10" groupid="9" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="24-null-11" dnum="vii-o" numlevel="1" lineno="136" slineno="2-19" level="3" tab="1"><display>(vii)</display>that resources are available to assist the child's parent or guardian, including:<subsection ssid="24-null-12" dnum="A-o" numlevel="1" lineno="137" slineno="2-20" level="4"><display>(A)</display>a parent advocate;</subsection><subsection ssid="24-null-13" dnum="B-o" numlevel="1" lineno="138" slineno="2-21" level="4"><display>(B)</display>a qualified attorney; or</subsection><subsection ssid="24-null-14" dnum="C-o" numlevel="1" lineno="139" slineno="2-22" level="4"><display>(C)</display>potential expert witnesses to testify on behalf of the child or the child's parent, <ln numlevel="1" lineno="140" slineno="2-23"/>guardian, or family<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="8" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="admin" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="24-48" dnum="_-o:viii-e" numlevel="1" lineno="141" slineno="2-24" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="e" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="admin" level="1" amendtag="end">that the child's parent or guardian may contact the child protection ombudsman <ln numlevel="1" lineno="142" slineno="2-25"/>created in Section <xref depth="3" refnumber="80-2-1104">80-2-1104</xref> for help accessing resources or navigating the child <ln numlevel="1" lineno="143" slineno="2-26"/>welfare system.</amend></subsection></subsection><subsection ssid="24-null-15" dnum="b-o" numlevel="1" lineno="144" slineno="2-27" level="2"><display>(b)</display>For purposes of locating and informing the noncustodial parent under Subsection <xref depth="4" refnumber="80-2a-203(1)(a)" start="0"><ln numlevel="1" lineno="145" slineno="2-28"/>(1)(a)</xref>, the division shall search for the noncustodial parent through the Federal Parent <ln numlevel="1" lineno="146" slineno="2-29"/>Locator Service if the division is unable to locate the noncustodial parent through <ln numlevel="1" lineno="147" slineno="2-30"/>other reasonable efforts.</subsection></subsection><subsection ssid="24-null-16" dnum="2-o" numlevel="1" lineno="148" slineno="2-31" level="1"><display>(2)</display>At the time that a child is taken into protective custody under Subsection <xref depth="4" refnumber="80-2a-202(2)" start="0">80-2a-202(2)</xref>, <ln numlevel="1" lineno="149" slineno="2-32"/>the division shall provide the child's parent or guardian an informational packet with:<subsection ssid="24-null-17" dnum="a-o" numlevel="1" lineno="150" slineno="2-33" level="2"><display>(a)</display>all of the information described in Subsection <xref depth="4" refnumber="80-2a-203(1)" start="0">(1)</xref>;</subsection><subsection ssid="24-null-18" dnum="b-o" numlevel="1" lineno="151" slineno="2-34" level="2"><display>(b)</display>information on the conditions under which a child may be released from protective <ln numlevel="1" lineno="152" slineno="2-35"/>custody;</subsection><subsection ssid="24-null-19" dnum="c-o" numlevel="1" lineno="153" slineno="2-36" level="2"><display>(c)</display>information on resources that are available to the parent or guardian, including:<subsection ssid="24-null-20" dnum="i-o" numlevel="1" lineno="154" slineno="2-37" level="3"><display>(i)</display>mental health resources;</subsection><subsection ssid="24-null-21" dnum="ii-o" numlevel="1" lineno="155" slineno="2-38" level="3"><display>(ii)</display>substance abuse resources; and</subsection><subsection ssid="24-null-22" dnum="iii-o" numlevel="1" lineno="156" slineno="2-39" level="3"><display>(iii)</display>parenting classes;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="24-50" dnum="_-o:d-e" numlevel="1" lineno="157" slineno="2-40" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="12" style="1" owner="admin" level="1" amendtag="end">the child protection ombudsman's website address; and</amend></subsection><subsection ssid="24-null-23" dnum="d-o:e-e" numlevel="1" lineno="158" slineno="2-41" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1085" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1086" style="1" owner="e" level="1" amendtag="both" space="true">(e)</amend></display>any other information considered relevant by the division.</subsection></subsection><subsection ssid="24-null-24" dnum="3-o" numlevel="1" lineno="159" slineno="2-42" level="1"><display>(3)</display>The division shall ensure the informational packet described in Subsection <xref depth="4" refnumber="80-2a-203(2)" start="0">(2)</xref> is:<subsection ssid="24-null-25" dnum="a-o" numlevel="1" lineno="160" slineno="2-43" level="2"><display>(a)</display>evaluated periodically for the effectiveness of the informational packet at conveying <ln numlevel="1" lineno="161" slineno="2-44"/>necessary information and revised accordingly;</subsection><subsection ssid="24-null-26" dnum="b-o" numlevel="1" lineno="162" slineno="2-45" level="2"><display>(b)</display>written in simple, easy-to-understand language;</subsection><subsection ssid="24-null-27" dnum="c-o" numlevel="1" lineno="163" slineno="2-46" level="2"><display>(c)</display>available in English and other languages as the division determines to be appropriate <ln numlevel="1" lineno="164" slineno="2-47"/>and necessary; and</subsection><subsection ssid="24-null-28" dnum="d-o" numlevel="1" lineno="165" slineno="2-48" level="2"><display>(d)</display>made available for distribution in:<subsection ssid="24-null-29" dnum="i-o" numlevel="1" lineno="166" slineno="2-49" level="3"><display>(i)</display>schools;</subsection><subsection ssid="24-null-30" dnum="ii-o" numlevel="1" lineno="167" slineno="2-50" level="3"><display>(ii)</display>health care facilities;</subsection><subsection ssid="24-null-31" dnum="iii-o" numlevel="1" lineno="168" slineno="2-51" level="3"><display>(iii)</display>local police and sheriff's offices;</subsection><subsection ssid="24-null-32" dnum="iv-o" numlevel="1" lineno="169" slineno="2-52" level="3"><display>(iv)</display>the offices of the division; and</subsection><subsection ssid="24-null-33" dnum="v-o" numlevel="1" lineno="170" slineno="2-53" level="3"><display>(v)</display>any other appropriate office within the department.</subsection></subsection></subsection><subsection ssid="24-null-34" dnum="4-o" numlevel="1" lineno="171" slineno="2-54" level="1"><display>(4)</display>If reasonable efforts are made by the peace officer or child welfare caseworker to notify <ln numlevel="1" lineno="172" slineno="2-55"/>the child's parent or guardian or a responsible relative under Subsection <xref depth="4" refnumber="80-2a-203(1)" start="0">(1)</xref>, failure to <ln numlevel="1" lineno="173" slineno="2-56"/>notify:<subsection ssid="24-null-35" dnum="a-o" numlevel="1" lineno="174" slineno="2-57" level="2"><display>(a)</display>shall be considered to be due to circumstances beyond the control of the peace officer <ln numlevel="1" lineno="175" slineno="2-58"/>or child welfare caseworker; and</subsection><subsection ssid="24-null-36" dnum="b-o" numlevel="1" lineno="176" slineno="2-59" level="2"><display>(b)</display>may not be construed to:<subsection ssid="24-null-37" dnum="i-o" numlevel="1" lineno="177" slineno="2-60" level="3"><display>(i)</display>permit a new defense to any juvenile or judicial proceeding; or</subsection><subsection ssid="24-null-38" dnum="ii-o" numlevel="1" lineno="178" slineno="2-61" level="3"><display>(ii)</display>interfere with any rights, procedures, or investigations provided for by this <ln numlevel="1" lineno="179" slineno="2-62"/>chapter, <xref depth="1" refnumber="80-3" start="1">Chapter 3, Abuse, Neglect, and Dependency Proceedings</xref>, or <xref depth="1" refnumber="80-4" start="1">Chapter 4, <ln numlevel="1" lineno="180" slineno="2-63"/>Termination and Restoration of Parental Rights</xref>.</subsection></subsection></subsection><subsection ssid="24-null-39" dnum="5-o" numlevel="1" lineno="181" slineno="2-64" level="1" space="false"><display>(5)</display><subsection ssid="24-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the juvenile court issues a warrant under Subsection <xref depth="4" refnumber="80-2a-202(6)" start="0">80-2a-202(6)</xref>, the division <ln numlevel="1" lineno="182" slineno="2-65"/>shall provide notice of the warrant to the child's parent or guardian who:<subsection ssid="24-null-41" dnum="i-o" numlevel="1" lineno="183" slineno="2-66" level="3" tab="1"><display>(i)</display>has a right to parent-time with the child; and</subsection><subsection ssid="24-null-42" dnum="ii-o" numlevel="1" lineno="184" slineno="2-67" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="24-null-43" dnum="A-o" level="4" placement="sameline"><display>(A)</display>is the child's primary caregiver; or</subsection><subsection ssid="24-null-44" dnum="B-o" numlevel="1" lineno="185" slineno="2-68" level="4"><display>(B)</display>has custody of the child when the warrant is sought.</subsection></subsection></subsection><subsection ssid="24-null-45" dnum="b-o" numlevel="1" lineno="186" slineno="2-69" level="2"><display>(b)</display>The division shall make a good faith effort to provide notice to the child's parent or <ln numlevel="1" lineno="187" slineno="2-70"/>guardian who:<subsection ssid="24-null-46" dnum="i-o" numlevel="1" lineno="188" slineno="2-71" level="3"><display>(i)</display>is not required to be notified under Subsection <xref depth="4" refnumber="80-2a-203(5)(a)" start="0">(5)(a)</xref>; and</subsection><subsection ssid="24-null-47" dnum="ii-o" numlevel="1" lineno="189" slineno="2-72" level="3"><display>(ii)</display>has a right to parent-time with the child.</subsection></subsection></subsection></section></bsec><bsec buid="31" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="190" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="190">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="191"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>2-9-26 10:37 AM</tm></rev></foot></leg>
