Gwynn</sponsorhead><otherSponsorhead>Senate Sponsor: Brady Brammer</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends the Governmental Immunity Act of Utah.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">defines terms; </hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">provides that a governmental entity and the governmental entity's employees are immune <ln numlevel="1" lineno="10" slineno="0-10"/>from suit for engaging in the following activities: <hl numlevel="1" lineno="11" slineno="0-11" level="2">responding to a disaster or potential disaster; or</hl><hl numlevel="1" lineno="12" slineno="0-12" level="2">if the employee is a first responder, providing emergency medical services;</hl></hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">clarifies that immunity from suit for providing emergency medical services is not limited <ln numlevel="1" lineno="14" slineno="0-14"/>to providing medical services resulting from emergencies of a certain type; and </hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">makes technical and conforming changes.</hl></hp><moni numlevel="1" lineno="16" slineno="0-16" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="17">None</moniNone><oc numlevel="1" lineno="18" slineno="0-18">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="19" slineno="0-19">This bill provides a special effective date.</ocl><ocl type="retro" sort="7" numlevel="1" lineno="20" slineno="0-20">This bill provides retrospective operation.</ocl></oc><sa numlevel="1" lineno="21" slineno="0-21">Utah Code Sections Affected:<saamd numlevel="1" lineno="22" slineno="0-22"><snhead>AMENDS:</snhead><sn num="63G-7-102" src="code" uid="C63G-7-S102_1800010118000101" buid="8" sort="63G07 01020018000101" numlevel="1" lineno="23" slineno="0-23"><bold>63G-7-102</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 9</sn><sn num="63G-7-201" src="code" uid="C63G-7-S201_1800010118000101" buid="17" sort="63G07 02010018000101" numlevel="1" lineno="24" slineno="0-24"><bold>63G-7-201</bold>, as last amended by Laws of Utah 2025, First Special Session, Chapter 15</sn><sn num="63H-1-209" src="code" uid="C63H-1-S209_1800010118000101" buid="5" sort="63H01 02090018000101" numlevel="1" lineno="25" slineno="0-25"><bold>63H-1-209</bold>, as enacted by Laws of Utah 2023, Chapter 12</sn></saamd></sa></lt><enacthead lineno="26"/><enact numlevel="1" lineno="27" slineno="0-27">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="8" num="63G-7-102" type="amend" src="code" uid="C63G-7-S102_1800010118000101" sort="63G07 01020018000101" numlevel="1" lineno="28" slineno="1-1" sn="1"><section number="63G-7-102" numlevel="1" lineno="29" slineno="1-2" type="amend"><secline lineno="28">Section 1. Section <bold>63G-7-102</bold> is amended to read:</secline><catline lineno="29"><bold>63G-7-102<parens/>. Definitions.</bold></catline><sectionText lineno="30"><tab/>As used in this chapter:</sectionText><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="31" slineno="1-4" level="1"><display>(1)</display>"Arises out of or in connection with, or results from," when used to describe the <ln numlevel="1" lineno="32" slineno="1-5"/>relationship between conduct or a condition and an injury, means that:<subsection ssid="8-null-2" dnum="a-o" numlevel="1" lineno="33" slineno="1-6" level="2"><display>(a)</display>there is some causal relationship between the conduct or condition and the injury;</subsection><subsection ssid="8-null-3" dnum="b-o" numlevel="1" lineno="34" slineno="1-7" level="2"><display>(b)</display>the causal relationship is more than any causal connection but less than proximate <ln numlevel="1" lineno="35" slineno="1-8"/>cause; and</subsection><subsection ssid="8-null-4" dnum="c-o" numlevel="1" lineno="36" slineno="1-9" level="2"><display>(c)</display>the causal relationship is sufficient to conclude that the injury originates with, flows <ln numlevel="1" lineno="37" slineno="1-10"/>from, or is incident to the conduct or condition.</subsection></subsection><subsection ssid="8-null-5" dnum="2-o" numlevel="1" lineno="38" slineno="1-11" level="1"><display>(2)</display>"Claim" means any asserted demand for or cause of action for money or damages, <ln numlevel="1" lineno="39" slineno="1-12"/>whether arising under the common law, under state constitutional provisions, or under <ln numlevel="1" lineno="40" slineno="1-13"/>state statutes, against a governmental entity or against an employee in the employee's <ln numlevel="1" lineno="41" slineno="1-14"/>personal capacity.</subsection><subsection ssid="8-33" dnum="_-o:3-e" numlevel="1" lineno="42" slineno="1-15" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="end">"Emergency medical services" means the same as that term is defined in Section <xref depth="3" refnumber="53-2d-101"><ln numlevel="1" lineno="43" slineno="1-16"/>53-2d-101</xref>.</amend></subsection><subsection ssid="8-null-6" dnum="3-o:4-e" numlevel="1" lineno="44" slineno="1-17" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1006" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1007" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display><subsection ssid="8-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Employee" includes:<subsection ssid="8-null-8" dnum="i-o" numlevel="1" lineno="45" slineno="1-18" level="3" tab="1"><display>(i)</display>a governmental entity's officers, employees, servants, trustees, or commissioners;</subsection><subsection ssid="8-null-9" dnum="ii-o" numlevel="1" lineno="46" slineno="1-19" level="3" tab="1"><display>(ii)</display>a member of a governing body;</subsection><subsection ssid="8-null-10" dnum="iii-o" numlevel="1" lineno="47" slineno="1-20" level="3" tab="1"><display>(iii)</display>a member of a government entity board;</subsection><subsection ssid="8-null-11" dnum="iv-o" numlevel="1" lineno="48" slineno="1-21" level="3" tab="1"><display>(iv)</display>a member of a government entity commission;</subsection><subsection ssid="8-null-12" dnum="v-o" numlevel="1" lineno="49" slineno="1-22" level="3" tab="1"><display>(v)</display>members of an advisory body, officers, and employees of a Children's Justice <ln numlevel="1" lineno="50" slineno="1-23"/>Center created in accordance with Section <xref depth="3" refnumber="67-5b-102" start="0">67-5b-102</xref>;</subsection><subsection ssid="8-null-13" dnum="vi-o" numlevel="1" lineno="51" slineno="1-24" level="3" tab="1"><display>(vi)</display>a student holding a license issued by the State Board of Education;</subsection><subsection ssid="8-null-14" dnum="vii-o" numlevel="1" lineno="52" slineno="1-25" level="3" tab="1"><display>(vii)</display>an educational aide;</subsection><subsection ssid="8-null-15" dnum="viii-o" numlevel="1" lineno="53" slineno="1-26" level="3" tab="1"><display>(viii)</display>a student engaged in an internship under Section <xref depth="3" refnumber="53H-3-1002">53H-3-1002</xref> or <xref depth="3" refnumber="53G-7-902" start="0">53G-7-902</xref>;</subsection><subsection ssid="8-null-16" dnum="ix-o" numlevel="1" lineno="54" slineno="1-27" level="3" tab="1"><display>(ix)</display>a volunteer, as defined in Section <xref depth="3" refnumber="67-20-2" start="0">67-20-2</xref>; and</subsection><subsection ssid="8-null-17" dnum="x-o" numlevel="1" lineno="55" slineno="1-28" level="3" tab="1"><display>(x)</display>a tutor.</subsection></subsection><subsection ssid="8-null-18" dnum="b-o" numlevel="1" lineno="56" slineno="1-29" level="2"><display>(b)</display>"Employee" includes all of the positions identified in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="9" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="63G-7-102(3)(a)" start="0">(3)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">(4)(a)</amend>, <ln numlevel="1" lineno="57" slineno="1-30"/>whether or not the individual holding that position receives compensation.</subsection><subsection ssid="8-null-19" dnum="c-o" numlevel="1" lineno="58" slineno="1-31" level="2"><display>(c)</display>"Employee" does not include an independent contractor.</subsection></subsection><subsection ssid="8-34" dnum="_-o:5-e" numlevel="1" lineno="59" slineno="1-32" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="admin" level="1" amendtag="end">"First responder" means the same as that term is defined in Section <xref depth="3" refnumber="34A-2-102">34A-2-102</xref>.</amend></subsection><subsection ssid="8-null-20" dnum="4-o:6-e" numlevel="1" lineno="60" slineno="1-33" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>"Governmental entity" means:<subsection ssid="8-null-21" dnum="a-o" numlevel="1" lineno="61" slineno="1-34" level="2"><display>(a)</display>the state and its political subdivisions; and</subsection><subsection ssid="8-null-22" dnum="b-o" numlevel="1" lineno="62" slineno="1-35" level="2"><display>(b)</display>a law enforcement agency, as defined in Section <xref depth="3" refnumber="53-1-102" start="0">53-1-102</xref>, that employs one or more <ln numlevel="1" lineno="63" slineno="1-36"/>law enforcement officers, as defined in Section <xref depth="3" refnumber="53-13-103" start="0">53-13-103</xref>.</subsection></subsection><subsection ssid="8-null-23" dnum="5-o:7-e" numlevel="1" lineno="64" slineno="1-37" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1024" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1025" style="1" owner="e" level="1" amendtag="both" space="true">(7)</amend></display><subsection ssid="8-null-24" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Governmental function" means each activity, undertaking, or operation of a <ln numlevel="1" lineno="65" slineno="1-38"/>governmental entity.</subsection><subsection ssid="8-null-25" dnum="b-o" numlevel="1" lineno="66" slineno="1-39" level="2"><display>(b)</display>"Governmental function" includes each activity, undertaking, or operation performed <ln numlevel="1" lineno="67" slineno="1-40"/>by a department, agency, employee, agent, or officer of a governmental entity.</subsection><subsection ssid="8-null-26" dnum="c-o" numlevel="1" lineno="68" slineno="1-41" level="2"><display>(c)</display>"Governmental function" includes a governmental entity's failure to act.</subsection></subsection><subsection ssid="8-null-27" dnum="6-o:8-e" numlevel="1" lineno="69" slineno="1-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="e" level="1" amendtag="both" space="true">(8)</amend></display>"Injury" means death, injury to a person, damage to or loss of property, or any other <ln numlevel="1" lineno="70" slineno="1-43"/>injury that a person may suffer to the person or estate, that would be actionable if <ln numlevel="1" lineno="71" slineno="1-44"/>inflicted by a private person or the private person's agent.</subsection><subsection ssid="8-null-28" dnum="7-o:9-e" numlevel="1" lineno="72" slineno="1-45" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="e" level="1" amendtag="both" space="true">(9)</amend></display>"Personal injury" means an injury of any kind other than property damage.</subsection><subsection ssid="8-null-29" dnum="8-o:10-e" numlevel="1" lineno="73" slineno="1-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1030" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1031" style="1" owner="e" level="1" amendtag="both" space="true">(10)</amend></display>"Political subdivision" means any county, city, town, school district, community <ln numlevel="1" lineno="74" slineno="1-47"/>reinvestment agency, special improvement or taxing district, special district, special <ln numlevel="1" lineno="75" slineno="1-48"/>service district, an entity created by an interlocal agreement adopted under <xref depth="1" refnumber="11-13" start="0">Title 11, <ln numlevel="1" lineno="76" slineno="1-49"/>Chapter 13, Interlocal Cooperation Act</xref>, or other governmental subdivision or public <ln numlevel="1" lineno="77" slineno="1-50"/>corporation.</subsection><subsection ssid="8-null-30" dnum="9-o:11-e" numlevel="1" lineno="78" slineno="1-51" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1031" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1032" style="1" owner="e" level="1" amendtag="both" space="true">(11)</amend></display>"Property damage" means injury to, or loss of, any right, title, estate, or interest in <ln numlevel="1" lineno="79" slineno="1-52"/>real or personal property.</subsection><subsection ssid="8-null-31" dnum="10-o:12-e" numlevel="1" lineno="80" slineno="1-53" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1033" style="1" owner="e" level="1" amendtag="both" space="true">(12)</amend></display>"State" means the state of Utah, and includes each office, department, division, <ln numlevel="1" lineno="81" slineno="1-54"/>agency, authority, commission, board, institution, hospital, college, university, <ln numlevel="1" lineno="82" slineno="1-55"/>Children's Justice Center, or other instrumentality of the state.</subsection><subsection ssid="8-null-32" dnum="11-o:13-e" numlevel="1" lineno="83" slineno="1-56" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="e" level="1" amendtag="both" space="true">(13)</amend></display>"Willful misconduct" means the intentional doing of a wrongful act, or the <ln numlevel="1" lineno="84" slineno="1-57"/>wrongful failure to act, without just cause or excuse, where the actor is aware that the <ln numlevel="1" lineno="85" slineno="1-58"/>actor's conduct will probably result in injury.</subsection></section></bsec><bsec buid="17" num="63G-7-201" type="amend" src="code" uid="C63G-7-S201_1800010118000101" sort="63G07 02010018000101" numlevel="1" lineno="86" slineno="2-1" sn="2"><section number="63G-7-201" numlevel="1" lineno="87" slineno="2-2" type="amend"><secline lineno="86">Section 2. Section <bold>63G-7-201</bold> is amended to read:</secline><catline lineno="87"><bold>63G-7-201<parens/>. Immunity of governmental entities and employees from suit.</bold></catline><subsection ssid="17-null-1" dnum="1-o" numlevel="1" lineno="88" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>Except as otherwise provided in this chapter, each governmental entity and each <ln numlevel="1" lineno="89" slineno="2-4"/>employee of a governmental entity are immune from suit for any injury that results from <ln numlevel="1" lineno="90" slineno="2-5"/>the exercise of a governmental function.</subsection><subsection ssid="17-null-2" dnum="2-o" numlevel="1" lineno="91" slineno="2-6" level="1"><display>(2)</display>Notwithstanding the waiver of immunity provisions of Section <xref depth="3" refnumber="63G-7-301" start="0">63G-7-301</xref>, a <ln numlevel="1" lineno="92" slineno="2-7"/>governmental entity, its officers, and its employees are immune from suit:<subsection ssid="17-null-3" dnum="a-o" numlevel="1" lineno="93" slineno="2-8" level="2"><display>(a)</display>as provided in Section <xref depth="3" refnumber="78B-4-517" start="0">78B-4-517</xref>; and</subsection><subsection ssid="17-null-4" dnum="b-o" numlevel="1" lineno="94" slineno="2-9" level="2"><display>(b)</display>for any injury or damage resulting from the implementation of or the failure to <ln numlevel="1" lineno="95" slineno="2-10"/>implement measures to:<subsection ssid="17-null-5" dnum="i-o" numlevel="1" lineno="96" slineno="2-11" level="3"><display>(i)</display>control the causes of epidemic and communicable diseases and other conditions <ln numlevel="1" lineno="97" slineno="2-12"/>significantly affecting the public health or necessary to protect the public health as <ln numlevel="1" lineno="98" slineno="2-13"/>set out in <xref depth="1" refnumber="26A-1" start="0">Title 26A, Chapter 1, Local Health Departments</xref>;</subsection><subsection ssid="17-null-6" dnum="ii-o" numlevel="1" lineno="99" slineno="2-14" level="3"><display>(ii)</display>investigate and control suspected bioterrorism and disease as set out in Sections <xref depth="3" refnumber="26B-7-316" start="0"><ln numlevel="1" lineno="100" slineno="2-15"/>26B-7-316</xref> through <xref depth="3" refnumber="26B-7-324" start="0">26B-7-324</xref>;</subsection><subsection ssid="17-null-7" dnum="iii-o" numlevel="1" lineno="101" slineno="2-16" level="3"><display>(iii)</display>respond to a national, state, or local emergency, a public health emergency as <ln numlevel="1" lineno="102" slineno="2-17"/>defined in Section <xref depth="3" refnumber="26B-7-301" start="0">26B-7-301</xref>, or a declaration by the President of the United <ln numlevel="1" lineno="103" slineno="2-18"/>States or other federal official requesting public health related activities, including <ln numlevel="1" lineno="104" slineno="2-19"/>the use, provision, operation, and management of:<subsection ssid="17-null-8" dnum="A-o" numlevel="1" lineno="105" slineno="2-20" level="4"><display>(A)</display>an emergency shelter;</subsection><subsection ssid="17-null-9" dnum="B-o" numlevel="1" lineno="106" slineno="2-21" level="4"><display>(B)</display>housing;</subsection><subsection ssid="17-null-10" dnum="C-o" numlevel="1" lineno="107" slineno="2-22" level="4"><display>(C)</display>a staging place; or</subsection><subsection ssid="17-null-11" dnum="D-o" numlevel="1" lineno="108" slineno="2-23" level="4"><display>(D)</display>a medical facility; and</subsection></subsection><subsection ssid="17-null-12" dnum="iv-o" numlevel="1" lineno="109" slineno="2-24" level="3"><display>(iv)</display>adopt methods or measures, in accordance with Section <xref depth="3" refnumber="26B-1-202" start="0">26B-1-202</xref>, for health <ln numlevel="1" lineno="110" slineno="2-25"/>care providers, public health entities, and health care insurers to coordinate among <ln numlevel="1" lineno="111" slineno="2-26"/>themselves to verify the identity of the individuals they serve.</subsection></subsection></subsection><subsection ssid="17-null-13" dnum="3-o" numlevel="1" lineno="112" slineno="2-27" level="1" space="false"><display>(3)</display><subsection ssid="17-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="113" slineno="2-28"/>immunity is not waived, for any injury if the injury arises out of or in connection <ln numlevel="1" lineno="114" slineno="2-29"/>with, or results from:<subsection ssid="17-null-15" dnum="i-o" numlevel="1" lineno="115" slineno="2-30" level="3" tab="1"><display>(i)</display>a latent dangerous or latent defective condition of:<subsection ssid="17-null-16" dnum="A-o" numlevel="1" lineno="116" slineno="2-31" level="4"><display>(A)</display>any highway, road, street, alley, crosswalk, sidewalk, culvert, tunnel, bridge, <ln numlevel="1" lineno="117" slineno="2-32"/>or viaduct; or</subsection><subsection ssid="17-null-17" dnum="B-o" numlevel="1" lineno="118" slineno="2-33" level="4"><display>(B)</display>another structure located on any of the items listed in this Subsection <xref depth="4" refnumber="63G-7-201(3)(a)(i)" start="0">(3)(a)(i)</xref>; <ln numlevel="1" lineno="119" slineno="2-34"/>or</subsection></subsection><subsection ssid="17-null-18" dnum="ii-o" numlevel="1" lineno="120" slineno="2-35" level="3" tab="1"><display>(ii)</display>a latent dangerous or latent defective condition of any public building, structure, <ln numlevel="1" lineno="121" slineno="2-36"/>dam, reservoir, or other public improvement.</subsection></subsection><subsection ssid="17-null-19" dnum="b-o" numlevel="1" lineno="122" slineno="2-37" level="2" space="false"><display>(b)</display><subsection ssid="17-null-20" dnum="i-o" level="3" placement="sameline"><display>(i)</display>As used in this Subsection <xref depth="4" refnumber="63G-7-201(3)(b)" start="0">(3)(b)</xref>:<subsection ssid="17-null-21" dnum="A-o" numlevel="1" lineno="123" slineno="2-38" level="4" tab="1"><display>(A)</display>"Contaminated land" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0"><ln numlevel="1" lineno="124" slineno="2-39"/>11-58-102</xref>.</subsection><subsection ssid="17-null-22" dnum="B-o" numlevel="1" lineno="125" slineno="2-40" level="4" tab="1"><display>(B)</display>"Contamination" means the condition of land that results from the placement, <ln numlevel="1" lineno="126" slineno="2-41"/>disposal, or release of hazardous matter on, in, or under the land, including any <ln numlevel="1" lineno="127" slineno="2-42"/>seeping or escaping of the hazardous matter from the land.</subsection><subsection ssid="17-null-23" dnum="C-o" numlevel="1" lineno="128" slineno="2-43" level="4" tab="1"><display>(C)</display>"Damage" means any property damage, personal injury, or other injury or any <ln numlevel="1" lineno="129" slineno="2-44"/>loss of any kind, however denominated.</subsection><subsection ssid="17-null-24" dnum="D-o" numlevel="1" lineno="130" slineno="2-45" level="4" tab="1"><display>(D)</display>"Environmentally compliant" means, as applicable, obtaining a certificate of <ln numlevel="1" lineno="131" slineno="2-46"/>completion from the Department of Environmental Quality under Section <xref depth="3" refnumber="19-8-111" start="0"><ln numlevel="1" lineno="132" slineno="2-47"/>19-8-111</xref> following participation in a voluntary cleanup under <xref depth="1" refnumber="19-8" start="0">Title 19, Chapter <ln numlevel="1" lineno="133" slineno="2-48"/>8, Voluntary Cleanup Program</xref>, obtaining an administrative letter from the <ln numlevel="1" lineno="134" slineno="2-49"/>Department of Environmental Quality for a discrete phase of a voluntary <ln numlevel="1" lineno="135" slineno="2-50"/>cleanup that is conducted under a remedial action plan as defined in Section <xref depth="3" refnumber="11-58-605" start="0"><ln numlevel="1" lineno="136" slineno="2-51"/>11-58-605</xref>, or complying with the terms of an environmental covenant, as <ln numlevel="1" lineno="137" slineno="2-52"/>defined in Section <xref depth="3" refnumber="57-25-102" start="0">57-25-102</xref>, signed by an agency, as defined in Section <xref depth="3" refnumber="57-25-102" start="0"><ln numlevel="1" lineno="138" slineno="2-53"/>57-25-102</xref>, and duly recorded in the office of the recorder of the county in <ln numlevel="1" lineno="139" slineno="2-54"/>which the contaminated land is located.</subsection><subsection ssid="17-null-25" dnum="E-o" numlevel="1" lineno="140" slineno="2-55" level="4" tab="1"><display>(E)</display>"Government owner" means a governmental entity, including an independent <ln numlevel="1" lineno="141" slineno="2-56"/>entity, as defined in Section <xref depth="3" refnumber="63E-1-102" start="0">63E-1-102</xref>, that acquires an ownership interest in <ln numlevel="1" lineno="142" slineno="2-57"/>land that was contaminated land before the governmental entity or independent <ln numlevel="1" lineno="143" slineno="2-58"/>entity acquired an ownership interest in the land.</subsection><subsection ssid="17-null-26" dnum="F-o" numlevel="1" lineno="144" slineno="2-59" level="4" tab="1"><display>(F)</display>"Hazardous matter" means hazardous materials, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>,  <ln numlevel="1" lineno="145" slineno="2-60"/>hazardous substances, as defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>, or landfill material, as <ln numlevel="1" lineno="146" slineno="2-61"/>defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection><subsection ssid="17-null-27" dnum="G-o" numlevel="1" lineno="147" slineno="2-62" level="4" tab="1"><display>(G)</display>"Remediation" means the same as that term is defined in Section <xref depth="3" refnumber="11-58-102" start="0">11-58-102</xref>.</subsection></subsection><subsection ssid="17-null-28" dnum="ii-o" numlevel="1" lineno="148" slineno="2-63" level="3" space="false"><display>(ii)</display><subsection ssid="17-null-29" dnum="A-o" level="4" placement="sameline"><display>(A)</display>A government owner and the government owner's officers and employees <ln numlevel="1" lineno="149" slineno="2-64"/>are immune from suit, and immunity is not waived, for any claim for damage <ln numlevel="1" lineno="150" slineno="2-65"/>that arises out of or in connection with, or results from, contamination of <ln numlevel="1" lineno="151" slineno="2-66"/>contaminated land.</subsection><subsection ssid="17-null-30" dnum="B-o" numlevel="1" lineno="152" slineno="2-67" level="4"><display>(B)</display>A government owner's ownership of contaminated land may not be the basis <ln numlevel="1" lineno="153" slineno="2-68"/>of a claim against the government owner for damage that arises out of or in <ln numlevel="1" lineno="154" slineno="2-69"/>connection with, or results from, contamination of contaminated land.</subsection></subsection><subsection ssid="17-null-31" dnum="iii-o" numlevel="1" lineno="155" slineno="2-70" level="3"><display>(iii)</display>Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)" start="0">(3)(b)(ii)</xref> does not limit or affect:<subsection ssid="17-null-32" dnum="A-o" numlevel="1" lineno="156" slineno="2-71" level="4"><display>(A)</display>the liability of a person that placed, disposed of, or released hazardous matter <ln numlevel="1" lineno="157" slineno="2-72"/>on, in, or under the land; or</subsection><subsection ssid="17-null-33" dnum="B-o" numlevel="1" lineno="158" slineno="2-73" level="4"><display>(B)</display>a worker compensation claim of an employee of an entity that conducts work <ln numlevel="1" lineno="159" slineno="2-74"/>on or related to contaminated land.</subsection></subsection><subsection ssid="17-null-34" dnum="iv-o" numlevel="1" lineno="160" slineno="2-75" level="3"><display>(iv)</display>Immunity under Subsection <xref depth="4" refnumber="63G-7-201(3)(b)(ii)(A)" start="0">(3)(b)(ii)(A)</xref> is not affected by a government owner's <ln numlevel="1" lineno="161" slineno="2-76"/>remediation of contaminated land if the government owner is environmentally <ln numlevel="1" lineno="162" slineno="2-77"/>compliant.</subsection></subsection></subsection><subsection ssid="17-null-35" dnum="4-o" numlevel="1" lineno="163" slineno="2-78" level="1"><display>(4)</display>A governmental entity, its officers, and its employees are immune from suit, and <ln numlevel="1" lineno="164" slineno="2-79"/>immunity is not waived, for any injury proximately caused by a negligent act or <ln numlevel="1" lineno="165" slineno="2-80"/>omission of an employee committed within the scope of employment, if the injury arises <ln numlevel="1" lineno="166" slineno="2-81"/>out of or in connection with, or results from:<subsection ssid="17-null-36" dnum="a-o" numlevel="1" lineno="167" slineno="2-82" level="2"><display>(a)</display>the exercise or performance, or the failure to exercise or perform, a discretionary <ln numlevel="1" lineno="168" slineno="2-83"/>function, whether or not the discretion is abused;</subsection><subsection ssid="17-null-37" dnum="b-o" numlevel="1" lineno="169" slineno="2-84" level="2"><display>(b)</display>except as provided in Subsections <xref depth="4" refnumber="63G-7-301(2)(j)" start="0">63G-7-301(2)(j)</xref>, <xref depth="4" refnumber="63G-7-301(3)" start="0">(3)</xref>, and <xref depth="4" refnumber="63G-7-301(4)" start="0">(4)</xref>, assault, battery, <ln numlevel="1" lineno="170" slineno="2-85"/>false imprisonment, false arrest, malicious prosecution, intentional trespass, abuse of <ln numlevel="1" lineno="171" slineno="2-86"/>process, libel, slander, deceit, interference with contract rights, infliction of mental <ln numlevel="1" lineno="172" slineno="2-87"/>anguish, or violation of civil rights;</subsection><subsection ssid="17-null-38" dnum="c-o" numlevel="1" lineno="173" slineno="2-88" level="2"><display>(c)</display>the issuance, denial, suspension, or revocation of, or the failure or refusal to issue, <ln numlevel="1" lineno="174" slineno="2-89"/>deny, suspend, or revoke, any permit, license, certificate, approval, order, or similar <ln numlevel="1" lineno="175" slineno="2-90"/>authorization;</subsection><subsection ssid="17-null-39" dnum="d-o" numlevel="1" lineno="176" slineno="2-91" level="2"><display>(d)</display>a failure to make an inspection or making an inadequate or negligent inspection;</subsection><subsection ssid="17-null-40" dnum="e-o" numlevel="1" lineno="177" slineno="2-92" level="2"><display>(e)</display>the institution or prosecution of any judicial or administrative proceeding, even if <ln numlevel="1" lineno="178" slineno="2-93"/>malicious or without probable cause;</subsection><subsection ssid="17-null-41" dnum="f-o" numlevel="1" lineno="179" slineno="2-94" level="2"><display>(f)</display>a misrepresentation by an employee whether or not the misrepresentation is negligent <ln numlevel="1" lineno="180" slineno="2-95"/>or intentional;</subsection><subsection ssid="17-null-42" dnum="g-o" numlevel="1" lineno="181" slineno="2-96" level="2"><display>(g)</display>a riot, unlawful assembly, public demonstration, mob violence, or civil disturbance;</subsection><subsection ssid="17-null-43" dnum="h-o" numlevel="1" lineno="182" slineno="2-97" level="2"><display>(h)</display>the collection or assessment of taxes;</subsection><subsection ssid="17-null-44" dnum="i-o" numlevel="1" lineno="183" slineno="2-98" level="2"><display>(i)</display>an activity of the Utah National Guard;</subsection><subsection ssid="17-null-45" dnum="j-o" numlevel="1" lineno="184" slineno="2-99" level="2"><display>(j)</display>the incarceration of a person in a state prison, county or city jail, or other place of <ln numlevel="1" lineno="185" slineno="2-100"/>legal confinement;</subsection><subsection ssid="17-null-46" dnum="k-o" numlevel="1" lineno="186" slineno="2-101" level="2"><display>(k)</display>a natural condition on publicly owned or controlled land;</subsection><subsection ssid="17-null-47" dnum="l-o" numlevel="1" lineno="187" slineno="2-102" level="2"><display>(l)</display>a condition existing in connection with an abandoned mine or mining operation;</subsection><subsection ssid="17-null-48" dnum="m-o" numlevel="1" lineno="188" slineno="2-103" level="2"><display>(m)</display>an activity authorized by the School and Institutional Trust Lands Administration or <ln numlevel="1" lineno="189" slineno="2-104"/>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="17-null-49" dnum="n-o" numlevel="1" lineno="190" slineno="2-105" level="2"><display>(n)</display>the operation or existence of a trail that is along a water facility, as defined in Section <xref depth="3" refnumber="73-1-8" start="0"><ln numlevel="1" lineno="191" slineno="2-106"/>73-1-8</xref>, stream, or river, regardless of ownership or operation of the water facility, <ln numlevel="1" lineno="192" slineno="2-107"/>stream, or river, if:<subsection ssid="17-null-50" dnum="i-o" numlevel="1" lineno="193" slineno="2-108" level="3"><display>(i)</display>the trail is designated under a general plan adopted by a municipality under <ln numlevel="1" lineno="194" slineno="2-109"/>Section <xref depth="3" refnumber="10-20-401">10-20-401</xref> or by a county under Section <xref depth="3" refnumber="17-79-401">17-79-401</xref>;</subsection><subsection ssid="17-null-51" dnum="ii-o" numlevel="1" lineno="195" slineno="2-110" level="3"><display>(ii)</display>the trail right-of-way or the right-of-way where the trail is located is open to <ln numlevel="1" lineno="196" slineno="2-111"/>public use as evidenced by a written agreement between:<subsection ssid="17-null-52" dnum="A-o" numlevel="1" lineno="197" slineno="2-112" level="4"><display>(A)</display>the owner or operator of the trail right-of-way or of the right-of-way where the <ln numlevel="1" lineno="198" slineno="2-113"/>trail is located; and</subsection><subsection ssid="17-null-53" dnum="B-o" numlevel="1" lineno="199" slineno="2-114" level="4"><display>(B)</display>the municipality or county where the trail is located; and</subsection></subsection><subsection ssid="17-null-54" dnum="iii-o" numlevel="1" lineno="200" slineno="2-115" level="3"><display>(iii)</display>the written agreement:<subsection ssid="17-null-55" dnum="A-o" numlevel="1" lineno="201" slineno="2-116" level="4"><display>(A)</display>contains a plan for operation and maintenance of the trail; and</subsection><subsection ssid="17-null-56" dnum="B-o" numlevel="1" lineno="202" slineno="2-117" level="4"><display>(B)</display>provides that an owner or operator of the trail right-of-way or of the <ln numlevel="1" lineno="203" slineno="2-118"/>right-of-way where the trail is located has, at a minimum, the same level of <ln numlevel="1" lineno="204" slineno="2-119"/>immunity from suit as the governmental entity in connection with or resulting <ln numlevel="1" lineno="205" slineno="2-120"/>from the use of the trail;</subsection></subsection></subsection><subsection ssid="17-null-57" dnum="o-o" numlevel="1" lineno="206" slineno="2-121" level="2"><display>(o)</display>research or implementation of cloud management or seeding for the clearing of fog;</subsection><subsection ssid="17-null-58" dnum="p-o" numlevel="1" lineno="207" slineno="2-122" level="2"><display>(p)</display>the management of flood waters, earthquakes, or natural disasters;</subsection><subsection ssid="17-null-59" dnum="q-o" numlevel="1" lineno="208" slineno="2-123" level="2"><display>(q)</display>the construction, repair, or operation of flood or storm systems;</subsection><subsection ssid="17-null-60" dnum="r-o" numlevel="1" lineno="209" slineno="2-124" level="2"><display>(r)</display>the operation of an emergency vehicle, while being driven in accordance with the <ln numlevel="1" lineno="210" slineno="2-125"/>requirements of Section <xref depth="3" refnumber="41-6a-212" start="0">41-6a-212</xref>;</subsection><subsection ssid="17-null-61" dnum="s-o" numlevel="1" lineno="211" slineno="2-126" level="2"><display>(s)</display>the activity of:<subsection ssid="17-null-62" dnum="i-o:_-e" numlevel="1" lineno="212" slineno="2-127" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1095" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="14" groupid="10" style="2" owner="admin" level="1" deltag="end">providing emergency medical assistance;</amend><amendoutend style="2"/></subsection><subsection ssid="17-null-63" dnum="ii-o:i-e" numlevel="1" lineno="213" slineno="2-128" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1096" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1097" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>fighting fire;</subsection><subsection ssid="17-null-64" dnum="iii-o:ii-e" numlevel="1" lineno="214" slineno="2-129" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1097" style="2" owner="o" level="1" deltag="both">(iii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1098" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>regulating, mitigating, or handling hazardous materials or hazardous wastes;</subsection><subsection ssid="17-null-65" dnum="iv-o:iii-e" numlevel="1" lineno="215" slineno="2-130" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1098" style="2" owner="o" level="1" deltag="both">(iv)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1099" style="1" owner="e" level="1" amendtag="both" space="true">(iii)</amend></display>an emergency evacuation;</subsection><subsection ssid="17-null-66" dnum="v-o:iv-e" numlevel="1" lineno="216" slineno="2-131" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1099" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1100" style="1" owner="e" level="1" amendtag="both" space="true">(iv)</amend></display>transporting or removing an injured person to a place where emergency <ln numlevel="1" lineno="217" slineno="2-132"/>medical assistance can be rendered or where the person can be transported by a <ln numlevel="1" lineno="218" slineno="2-133"/>licensed ambulance service; or</subsection><subsection ssid="17-null-67" dnum="vi-o:v-e" numlevel="1" lineno="219" slineno="2-134" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1100" style="2" owner="o" level="1" deltag="both">(vi)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1101" style="1" owner="e" level="1" amendtag="both" space="true">(v)</amend></display>intervening during a dam emergency;</subsection></subsection><subsection ssid="17-81" dnum="_-o:t-e" numlevel="1" lineno="220" slineno="2-135" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="e" level="1" amendtag="start">(t)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="admin" level="1" amendtag="end">responding to a disaster or potential disaster;</amend></subsection><subsection ssid="17-82" dnum="_-o:u-e" numlevel="1" lineno="221" slineno="2-136" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="start">(u)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="admin" level="1" amendtag="end">a first responder providing emergency medical services;</amend></subsection><subsection ssid="17-null-68" dnum="t-o:v-e" numlevel="1" lineno="222" slineno="2-137" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1103" style="2" owner="o" level="1" deltag="both">(t)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1104" style="1" owner="e" level="1" amendtag="both" space="true">(v)</amend></display>the exercise or performance, or the failure to exercise or perform, any function in <ln numlevel="1" lineno="223" slineno="2-138"/>accordance with <xref depth="1" refnumber="73-10" start="0">Title 73, Chapter 10, Board of Water Resources - Division of Water <ln numlevel="1" lineno="224" slineno="2-139"/>Resources</xref>;</subsection><subsection ssid="17-null-69" dnum="u-o:w-e" numlevel="1" lineno="225" slineno="2-140" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1104" style="2" owner="o" level="1" deltag="both">(u)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1105" style="1" owner="e" level="1" amendtag="both" space="true">(w)</amend></display>an unauthorized access to government records, data, or electronic information <ln numlevel="1" lineno="226" slineno="2-141"/>systems by any person or entity;</subsection><subsection ssid="17-null-70" dnum="v-o:x-e" numlevel="1" lineno="227" slineno="2-142" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="both">(v)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="both" space="true">(x)</amend></display>an activity of wildlife, as defined in Section <xref depth="3" refnumber="23A-1-101" start="0">23A-1-101</xref>, that arises during the <ln numlevel="1" lineno="228" slineno="2-143"/>use of a public or private road;</subsection><subsection ssid="17-null-71" dnum="w-o:y-e" numlevel="1" lineno="229" slineno="2-144" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1106" style="2" owner="o" level="1" deltag="both">(w)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="both" space="true">(y)</amend></display>a communication between employees of one or more law enforcement agencies <ln numlevel="1" lineno="230" slineno="2-145"/>related to the employment, disciplinary history, character, professional competence, <ln numlevel="1" lineno="231" slineno="2-146"/>or physical or mental health of a peace officer, or a former, current, or prospective <ln numlevel="1" lineno="232" slineno="2-147"/>employee of a law enforcement agency, including any communication made in <ln numlevel="1" lineno="233" slineno="2-148"/>accordance with Section <xref depth="3" refnumber="53-14-103" start="0">53-14-103</xref>; or</subsection><subsection ssid="17-null-72" dnum="x-o:z-e" numlevel="1" lineno="234" slineno="2-149" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1107" style="2" owner="o" level="1" deltag="both">(x)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="both" space="true">(z)</amend></display>providing or failing to provide information under Section <xref depth="3" refnumber="53-27-102" start="0">53-27-102</xref> or <ln numlevel="1" lineno="235" slineno="2-150"/>Subsection <xref depth="4" refnumber="41-1a-213(6)" start="0">41-1a-213(6)</xref>, <xref depth="4" refnumber="41-1a-213(7)" start="0">(7)</xref>, or <xref depth="4" refnumber="41-1a-213(8)" start="0">(8)</xref>, <xref depth="4" refnumber="53-3-207(4)" start="0">53-3-207(4)</xref>, or <xref depth="4" refnumber="53-3-805(5)" start="0">53-3-805(5)</xref>.</subsection></subsection><subsection ssid="17-null-73" dnum="5-o" numlevel="1" lineno="236" slineno="2-151" level="1"><display>(5)</display>The following are immune from suit, and immunity is not waived for an action or <ln numlevel="1" lineno="237" slineno="2-152"/>failure to act within the scope of duties or employment, if the injury arises out of, in <ln numlevel="1" lineno="238" slineno="2-153"/>connection with, or results from the implementation of Section <xref depth="3" refnumber="17E-7-401">17E-7-401</xref> to the extent <ln numlevel="1" lineno="239" slineno="2-154"/>it addresses evaluating and classifying high risk wildland urban interface property, <ln numlevel="1" lineno="240" slineno="2-155"/>Section <xref depth="3" refnumber="31A-22-1310">31A-22-1310</xref>, or Title 65A, Chapter 8, Part 4, Wildland Urban Interface <ln numlevel="1" lineno="241" slineno="2-156"/>Property:<subsection ssid="17-null-74" dnum="a-o" numlevel="1" lineno="242" slineno="2-157" level="2"><display>(a)</display>the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="17-null-75" dnum="b-o" numlevel="1" lineno="243" slineno="2-158" level="2"><display>(b)</display>an officer, employee, or consultant of the Division of Forestry, Fire, and State Lands;</subsection><subsection ssid="17-null-76" dnum="c-o" numlevel="1" lineno="244" slineno="2-159" level="2"><display>(c)</display>a county;</subsection><subsection ssid="17-null-77" dnum="d-o" numlevel="1" lineno="245" slineno="2-160" level="2"><display>(d)</display>a wildland urban interface coordinator, as defined in Section <xref depth="3" refnumber="65A-8-401">65A-8-401</xref>;</subsection><subsection ssid="17-null-78" dnum="e-o" numlevel="1" lineno="246" slineno="2-161" level="2"><display>(e)</display>the Insurance Department; or</subsection><subsection ssid="17-null-79" dnum="f-o" numlevel="1" lineno="247" slineno="2-162" level="2"><display>(f)</display>an officer, employee, or consultant of the Insurance Department.</subsection></subsection></section></bsec><bsec buid="5" num="63H-1-209" type="amend" src="code" uid="C63H-1-S209_1800010118000101" sort="63H01 02090018000101" numlevel="1" lineno="248" slineno="3-1" sn="3"><section number="63H-1-209" numlevel="1" lineno="249" slineno="3-2" type="amend"><secline lineno="248">Section 3. Section <bold>63H-1-209</bold> is amended to read:</secline><catline lineno="249"><bold>63H-1-209<parens/>. Immunity from contaminated property claims.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="250" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="251" slineno="3-4" level="2"><display>(a)</display>"Agency" means the same as that term is defined in Section <xref depth="3" refnumber="57-25-102" start="0">57-25-102</xref>.</subsection><subsection ssid="5-null-3" dnum="b-o" numlevel="1" lineno="252" slineno="3-5" level="2"><display>(b)</display>"Claim" means an action, suit, claim, demand, allegation, or cause of action, whether <ln numlevel="1" lineno="253" slineno="3-6"/>grounded in law or equity, made in a court of competent jurisdiction, mediation, <ln numlevel="1" lineno="254" slineno="3-7"/>arbitration, before a regulatory body, or in another dispute resolution forum.</subsection><subsection ssid="5-null-4" dnum="c-o" numlevel="1" lineno="255" slineno="3-8" level="2"><display>(c)</display>"Contaminated property" means real property in a project area that is:<subsection ssid="5-null-5" dnum="i-o" numlevel="1" lineno="256" slineno="3-9" level="3"><display>(i)</display>affected by historical contamination; and</subsection><subsection ssid="5-null-6" dnum="ii-o" numlevel="1" lineno="257" slineno="3-10" level="3"><display>(ii)</display>owned by a governmental entity.</subsection></subsection><subsection ssid="5-null-7" dnum="d-o" numlevel="1" lineno="258" slineno="3-11" level="2"><display>(d)</display>"Environmental covenant" means the same as that term is defined in Section <xref depth="3" refnumber="57-25-102" start="0"><ln numlevel="1" lineno="259" slineno="3-12"/>57-25-102</xref>.</subsection><subsection ssid="5-null-8" dnum="e-o" numlevel="1" lineno="260" slineno="3-13" level="2"><display>(e)</display>"Governmental entity" means the same as that term is defined in Section <xref depth="3" refnumber="63G-7-102" start="0">63G-7-102</xref>.</subsection><subsection ssid="5-null-9" dnum="f-o" numlevel="1" lineno="261" slineno="3-14" level="2"><display>(f)</display>"Hazardous materials" means the same as that term is defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>.</subsection><subsection ssid="5-null-10" dnum="g-o" numlevel="1" lineno="262" slineno="3-15" level="2"><display>(g)</display>"Hazardous substances" means the same as that term is defined in Section <xref depth="3" refnumber="19-6-302" start="0">19-6-302</xref>.</subsection><subsection ssid="5-null-11" dnum="h-o" numlevel="1" lineno="263" slineno="3-16" level="2"><display>(h)</display>"Historical contamination" means the placement, disposal, or release of hazardous <ln numlevel="1" lineno="264" slineno="3-17"/>materials or hazardous substances onto, into, under, or in a way that affects real <ln numlevel="1" lineno="265" slineno="3-18"/>property, and which placement, disposal, or release of hazardous materials or <ln numlevel="1" lineno="266" slineno="3-19"/>hazardous substances occurred prior to ownership of the real property by a <ln numlevel="1" lineno="267" slineno="3-20"/>governmental entity.</subsection><subsection ssid="5-null-12" dnum="i-o" numlevel="1" lineno="268" slineno="3-21" level="2"><display>(i)</display>"Ownership," "own," "owned," "owns," or "acquires" means to have an ownership or <ln numlevel="1" lineno="269" slineno="3-22"/>other established interest in real property, including holding title to, leasing, <ln numlevel="1" lineno="270" slineno="3-23"/>operating on, or maintaining real property.</subsection></subsection><subsection ssid="5-null-13" dnum="2-o" numlevel="1" lineno="271" slineno="3-24" level="1"><display>(2)</display>In addition to the liability protection provided by Subsections <xref depth="4" refnumber="63G-7-201(4)(l)" start="0">63G-7-201(4)(l)</xref> and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="63G-7-201(4)(s)(iii)" start="0"><ln numlevel="1" lineno="272" slineno="3-25"/>63G-7-201(4)(s)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="4" refnumber="63G-7-201(4)(s)(ii)">63G-7-201(4)(s)(ii)</xref></amend> and the other provisions of <xref depth="1" refnumber="63G-7" start="0">Title 63G, Chapter <ln numlevel="1" lineno="273" slineno="3-26"/>7, Governmental Immunity Act of Utah</xref>, the protections of Subsection <xref depth="4" refnumber="63H-1-209(3)" start="0">(3)</xref> apply to a <ln numlevel="1" lineno="274" slineno="3-27"/>governmental entity that owns or approves the use of contaminated property.</subsection><subsection ssid="5-null-14" dnum="3-o" numlevel="1" lineno="275" slineno="3-28" level="1" space="false"><display>(3)</display><subsection ssid="5-null-15" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Ownership of contaminated property by a governmental entity, or a governmental <ln numlevel="1" lineno="276" slineno="3-29"/>entity's approval of the use of contaminated property does not subject a governmental <ln numlevel="1" lineno="277" slineno="3-30"/>entity, its agents, or its officers or employees to any liability for or related to a claim <ln numlevel="1" lineno="278" slineno="3-31"/>arising from, proximately caused by, or related to historical contamination.</subsection><subsection ssid="5-null-16" dnum="b-o" numlevel="1" lineno="279" slineno="3-32" level="2"><display>(b)</display>No governmental entity waives immunity from suit or liability by this section.</subsection><subsection ssid="5-null-17" dnum="c-o" numlevel="1" lineno="280" slineno="3-33" level="2"><display>(c)</display>A claim made against a governmental entity, its agents, or its officers or employees <ln numlevel="1" lineno="281" slineno="3-34"/>in violation of this section shall subject the claimant to the payment of double the <ln numlevel="1" lineno="282" slineno="3-35"/>attorney fees and costs incurred by the governmental entity related to the claim.</subsection><subsection ssid="5-null-18" dnum="d-o" numlevel="1" lineno="283" slineno="3-36" level="2"><display>(d)</display>This Subsection <xref depth="4" refnumber="63H-1-209(3)" start="0">(3)</xref> does not limit or alter:<subsection ssid="5-null-19" dnum="i-o" numlevel="1" lineno="284" slineno="3-37" level="3"><display>(i)</display>claims against or the liability of the party that placed, disposed of, or released the <ln numlevel="1" lineno="285" slineno="3-38"/>hazardous materials or hazardous substances onto, into, under, or in a way that <ln numlevel="1" lineno="286" slineno="3-39"/>affects contaminated property; or</subsection><subsection ssid="5-null-20" dnum="ii-o" numlevel="1" lineno="287" slineno="3-40" level="3"><display>(ii)</display>a workers' compensation claim made by an employee of an entity that works on <ln numlevel="1" lineno="288" slineno="3-41"/>contaminated property or conducts work related to contaminated property.</subsection></subsection></subsection><subsection ssid="5-null-21" dnum="4-o" numlevel="1" lineno="289" slineno="3-42" level="1"><display>(4)</display>If a governmental entity that owns contaminated property develops the contaminated <ln numlevel="1" lineno="290" slineno="3-43"/>property for public or governmental purposes, including recreation, government offices, <ln numlevel="1" lineno="291" slineno="3-44"/>parking, or related uses, then Subsection <xref depth="4" refnumber="63H-1-209(3)" start="0">(3)</xref> extends to that governmental entity, <ln numlevel="1" lineno="292" slineno="3-45"/>regardless of whether the governmental entity had a role in approving use of the <ln numlevel="1" lineno="293" slineno="3-46"/>contaminated property, if the governmental entity:<subsection ssid="5-null-22" dnum="a-o" numlevel="1" lineno="294" slineno="3-47" level="2"><display>(a)</display>obtains a certificate of completion from the Utah Department of Environmental <ln numlevel="1" lineno="295" slineno="3-48"/>Quality following participation in the voluntary cleanup program, as set forth in <ln numlevel="1" lineno="296" slineno="3-49"/>Section <xref depth="3" refnumber="19-8-111" start="0">19-8-111</xref>; or</subsection><subsection ssid="5-null-23" dnum="b-o" numlevel="1" lineno="297" slineno="3-50" level="2"><display>(b)</display>complies with the terms of an environmental covenant signed by an agency and <ln numlevel="1" lineno="298" slineno="3-51"/>properly recorded in the county records against the property.</subsection></subsection></section></bsec><bsec buid="23" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="299" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="299">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="300"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="23-1" dnum="_-o:1-e" numlevel="1" lineno="301" slineno="4-3" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" m-anum="0" m-ea="amend" m-pairid="6" m-groupid="5" m-style="1" m-owner="admin" m-level="1" amendtag="end">except as provided in Subsection (2), <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>; or</amend></subsection><subsection ssid="23-2" dnum="_-o:2-e" numlevel="1" lineno="302" slineno="4-4" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="admin" level="1" amendtag="end">if approved by two-thirds of all members elected to each house:</amend><subsection ssid="23-3" dnum="_-o:a-e" numlevel="1" lineno="303" slineno="4-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">upon approval by the governor;</amend></subsection><subsection ssid="23-4" dnum="_-o:b-e" numlevel="1" lineno="304" slineno="4-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="admin" level="1" amendtag="end">without the governor's signature, the day following the constitutional time limit of <ln numlevel="1" lineno="305" slineno="4-7"/>Utah Constitution, Article VII, Section 8; or</amend></subsection><subsection ssid="23-5" dnum="_-o:c-e" numlevel="1" lineno="306" slineno="4-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="18" groupid="13" style="1" owner="admin" level="1" amendtag="end">in the case of a veto, the date of veto override.</amend></subsection></subsection></section></bsec><bsec buid="22" type="uncod" untype="retro" src="uncod"
