Section <bold>53E-7-210</bold> is enacted to read:</secline><catline lineno="25"><bold>53E-7-210<parens/>. Boundary change notice requirement.</bold></catline><subsection ssid="1-1" dnum="_-o:1-e" numlevel="1" lineno="26" slineno="1-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="end">As used in this section:</amend><subsection ssid="1-29" dnum="_-o:a-e" numlevel="1" lineno="27" slineno="1-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="167" groupid="127" style="1" owner="admin" level="1" amendtag="end">"Boundary change" means any change to the geographic boundary or school <ln numlevel="1" lineno="28" slineno="1-5"/>assignment that affects the location of an eligible student's special class.</amend></subsection><subsection ssid="1-30" dnum="_-o:b-e" numlevel="1" lineno="29" slineno="1-6" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><subsection ssid="1-59" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="171" groupid="130" style="1" owner="admin" level="1" amendtag="end">"Special class" means a placement on the continuum of alternative placements <ln numlevel="1" lineno="30" slineno="1-7"/>under the Individuals with Disabilities Education Act, 20 U.S.C. Sec. 1400 et seq. <ln numlevel="1" lineno="31" slineno="1-8"/>where an eligible student receives specially designed instruction in a class <ln numlevel="1" lineno="32" slineno="1-9"/>designated only for a student with a disability.</amend></subsection><subsection ssid="1-60" dnum="_-o:ii-e" numlevel="1" lineno="33" slineno="1-10" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="204" style="1" owner="admin" level="1" amendtag="end">"Special class" does not mean a special enrollment program as that term is <ln numlevel="1" lineno="34" slineno="1-11"/>defined in Subsection <xref depth="4" refnumber="53G-4-402(24)">53G-4-402(24)</xref>.</amend></subsection></subsection></subsection><subsection ssid="1-2" dnum="_-o:2-e" numlevel="1" lineno="35" slineno="1-12" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><subsection ssid="1-61" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="admin" level="1" amendtag="end">If a boundary change will result in the relocation of an eligible student's special <ln numlevel="1" lineno="36" slineno="1-13"/>class, the LEA where the eligible student is enrolled shall send the parent of the <ln numlevel="1" lineno="37" slineno="1-14"/>eligible student written notice of the boundary change:</amend><subsection ssid="1-5" dnum="_-o:i-e" numlevel="1" lineno="38" slineno="1-15" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="16" style="1" owner="admin" level="1" amendtag="end">at least 30 days before the effective date of the boundary change;</amend></subsection><subsection ssid="1-58" dnum="_-o:ii-e" numlevel="1" lineno="39" slineno="1-16" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="268" groupid="199" style="1" owner="admin" level="1" amendtag="end">that includes, at minimum:</amend><subsection ssid="1-50" dnum="_-o:A-e" numlevel="1" lineno="40" slineno="1-17" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="239" groupid="179" style="1" owner="admin" level="1" amendtag="end">a description of the action, including the reason for the boundary change and <ln numlevel="1" lineno="41" slineno="1-18"/>how the boundary change will impact the eligible student;</amend></subsection><subsection ssid="1-51" dnum="_-o:B-e" numlevel="1" lineno="42" slineno="1-19" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="242" groupid="181" style="1" owner="admin" level="1" amendtag="end">the name and location of the new school or program site;</amend></subsection><subsection ssid="1-52" dnum="_-o:C-e" numlevel="1" lineno="43" slineno="1-20" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="245" groupid="183" style="1" owner="admin" level="1" amendtag="end">instructions on how the parent may obtain more information about the <ln numlevel="1" lineno="44" slineno="1-21"/>boundary change;</amend></subsection><subsection ssid="1-53" dnum="_-o:D-e" numlevel="1" lineno="45" slineno="1-22" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="e" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="248" groupid="185" style="1" owner="admin" level="1" amendtag="end">key dates and a timeline for implementation;</amend></subsection><subsection ssid="1-54" dnum="_-o:E-e" numlevel="1" lineno="46" slineno="1-23" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="e" level="1" amendtag="start">(E)</amend></display><amend anum="0" ea="amend" pairid="251" groupid="187" style="1" owner="admin" level="1" amendtag="end">information about the new school or program, including contact information <ln numlevel="1" lineno="47" slineno="1-24"/>for relevant staff;</amend></subsection><subsection ssid="1-55" dnum="_-o:F-e" numlevel="1" lineno="48" slineno="1-25" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="e" level="1" amendtag="start">(F)</amend></display><amend anum="0" ea="amend" pairid="254" groupid="189" style="1" owner="admin" level="1" amendtag="end">information about scheduling an IEP meeting and other transfer services <ln numlevel="1" lineno="49" slineno="1-26"/>available to the eligible student; and</amend></subsection><subsection ssid="1-56" dnum="_-o:G-e" numlevel="1" lineno="50" slineno="1-27" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="e" level="1" amendtag="start">(G)</amend></display><amend anum="0" ea="amend" pairid="257" groupid="191" style="1" owner="admin" level="1" amendtag="end">instructions on how the parent may obtain other logistical information <ln numlevel="1" lineno="51" slineno="1-28"/>relevant to the boundary change, including transportation arrangements; and</amend></subsection></subsection><subsection ssid="1-31" dnum="_-o:iii-e" numlevel="1" lineno="52" slineno="1-29" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="175" groupid="133" style="1" owner="admin" level="1" amendtag="end">through one or more of the following methods:</amend><subsection ssid="1-33" dnum="_-o:A-e" numlevel="1" lineno="53" slineno="1-30" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="182" groupid="139" style="1" owner="admin" level="1" amendtag="end">regular mail;</amend></subsection><subsection ssid="1-34" dnum="_-o:B-e" numlevel="1" lineno="54" slineno="1-31" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="185" groupid="141" style="1" owner="admin" level="1" amendtag="end">certified mail;</amend></subsection><subsection ssid="1-35" dnum="_-o:C-e" numlevel="1" lineno="55" slineno="1-32" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="188" groupid="143" style="1" owner="admin" level="1" amendtag="end">email; or</amend></subsection><subsection ssid="1-36" dnum="_-o:D-e" numlevel="1" lineno="56" slineno="1-33" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="191" groupid="145" style="1" owner="admin" level="1" amendtag="end">hand delivery.</amend></subsection></subsection></subsection><subsection ssid="1-62" dnum="_-o:b-e" numlevel="1" lineno="57" slineno="1-34" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="283" groupid="208" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53E-7-210(2)(a)">(2)(a)</xref>, an LEA is not required to notify a parent if the <ln numlevel="1" lineno="58" slineno="1-35"/>boundary change that results in the relocation of an eligible student's special class <ln numlevel="1" lineno="59" slineno="1-36"/>occurs due to compliance with Subsection <xref depth="4" refnumber="53G-4-402(24)">53G-4-402(24)</xref>.</amend></subsection></subsection><subsection ssid="1-57" dnum="_-o:3-e" numlevel="1" lineno="60" slineno="1-37" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="263" groupid="195" style="1" owner="admin" level="1" amendtag="end">Before implementing a boundary change that affects a special class an LEA shall:</amend><subsection ssid="1-9" dnum="_-o:a-e" numlevel="1" lineno="61" slineno="1-38" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="39" style="1" owner="admin" level="1" amendtag="end">provide a parent of an affected eligible student an opportunity to submit a written or <ln numlevel="1" lineno="62" slineno="1-39"/>verbal comment regarding the proposed boundary change; and</amend></subsection><subsection ssid="1-10" dnum="_-o:b-e" numlevel="1" lineno="63" slineno="1-40" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="48" style="1" owner="admin" level="1" amendtag="end">document and consider each comment the LEA receives before making a final <ln numlevel="1" lineno="64" slineno="1-41"/>decision.</amend></subsection></subsection></section></bsec><bsec buid="4" num="53G-4-402" type="amend" src="code" uid="C53G-4-S402_2026070120260701" sort="53G04 04020020260701" numlevel="1" lineno="65" slineno="2-1" sn="2"><section number="53G-4-402" numlevel="1" lineno="66" slineno="2-2" type="amend"><secline lineno="65">Section 2. Section <bold>53G-4-402</bold> is amended to read:</secline><catline lineno="66"><bold>53G-4-402<parens/>. Powers and duties generally.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="67" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>A local school board shall:<subsection ssid="4-null-2" dnum="a-o" numlevel="1" lineno="68" slineno="2-4" level="2"><display>(a)</display>implement the core standards for Utah public schools using instructional materials <ln numlevel="1" lineno="69" slineno="2-5"/>that best correlate to the core standards for Utah public schools and graduation <ln numlevel="1" lineno="70" slineno="2-6"/>requirements;</subsection><subsection ssid="4-null-3" dnum="b-o" numlevel="1" lineno="71" slineno="2-7" level="2"><display>(b)</display>administer tests, required by the state board, which measure the progress of each <ln numlevel="1" lineno="72" slineno="2-8"/>student, and coordinate with the state superintendent and state board to assess results <ln numlevel="1" lineno="73" slineno="2-9"/>and create plans to improve the student's progress, which shall be submitted to the <ln numlevel="1" lineno="74" slineno="2-10"/>state board for approval;</subsection><subsection ssid="4-null-4" dnum="c-o" numlevel="1" lineno="75" slineno="2-11" level="2"><display>(c)</display>use progress-based assessments as part of a plan to identify schools, teachers, and <ln numlevel="1" lineno="76" slineno="2-12"/>students that need remediation and determine the type and amount of federal, state, <ln numlevel="1" lineno="77" slineno="2-13"/>and local resources to implement remediation;</subsection><subsection ssid="4-null-5" dnum="d-o" numlevel="1" lineno="78" slineno="2-14" level="2"><display>(d)</display>for each grading period and for each course in which a student is enrolled, issue a <ln numlevel="1" lineno="79" slineno="2-15"/>grade or performance report to the student:<subsection ssid="4-null-6" dnum="i-o" numlevel="1" lineno="80" slineno="2-16" level="3"><display>(i)</display>that reflects the student's work, including the student's progress based on mastery, <ln numlevel="1" lineno="81" slineno="2-17"/>for the grading period; and</subsection><subsection ssid="4-null-7" dnum="ii-o" numlevel="1" lineno="82" slineno="2-18" level="3"><display>(ii)</display>in accordance with the local school board's adopted grading or performance <ln numlevel="1" lineno="83" slineno="2-19"/>standards and criteria;</subsection></subsection><subsection ssid="4-null-8" dnum="e-o" numlevel="1" lineno="84" slineno="2-20" level="2"><display>(e)</display>develop early warning systems for students or classes failing to make progress;</subsection><subsection ssid="4-null-9" dnum="f-o" numlevel="1" lineno="85" slineno="2-21" level="2"><display>(f)</display>work with the state board to establish a library of documented best practices, <ln numlevel="1" lineno="86" slineno="2-22"/>consistent with state and federal regulations, for use by the special districts;</subsection><subsection ssid="4-null-10" dnum="g-o" numlevel="1" lineno="87" slineno="2-23" level="2"><display>(g)</display>implement training programs for school administrators, including basic management <ln numlevel="1" lineno="88" slineno="2-24"/>training, best practices in instructional methods, budget training, staff management, <ln numlevel="1" lineno="89" slineno="2-25"/>managing for learning results and continuous improvement, and how to help every <ln numlevel="1" lineno="90" slineno="2-26"/>student achieve optimal learning in basic academic subjects; and</subsection><subsection ssid="4-null-11" dnum="h-o" numlevel="1" lineno="91" slineno="2-27" level="2"><display>(h)</display>ensure that the local school board meets the data collection and reporting standards <ln numlevel="1" lineno="92" slineno="2-28"/>described in Section <xref depth="3" refnumber="53E-3-501">53E-3-501</xref>.</subsection></subsection><subsection ssid="4-null-12" dnum="2-o" numlevel="1" lineno="93" slineno="2-29" level="1"><display>(2)</display>Local school boards shall spend Minimum School Program funds for programs and <ln numlevel="1" lineno="94" slineno="2-30"/>activities for which the state board has established minimum standards or rules under <ln numlevel="1" lineno="95" slineno="2-31"/>Section <xref depth="3" refnumber="53E-3-501">53E-3-501</xref>.</subsection><subsection ssid="4-null-13" dnum="3-o" numlevel="1" lineno="96" slineno="2-32" level="1" space="false"><display>(3)</display><subsection ssid="4-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may purchase, sell, and make improvements on school sites, <ln numlevel="1" lineno="97" slineno="2-33"/>buildings, and equipment, and construct, erect, and furnish school buildings.</subsection><subsection ssid="4-null-15" dnum="b-o" numlevel="1" lineno="98" slineno="2-34" level="2"><display>(b)</display>School sites or buildings may only be conveyed or sold on local school board <ln numlevel="1" lineno="99" slineno="2-35"/>resolution affirmed by at least two-thirds of the school board members.</subsection></subsection><subsection ssid="4-null-16" dnum="4-o" numlevel="1" lineno="100" slineno="2-36" level="1" space="false"><display>(4)</display><subsection ssid="4-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may participate in the joint construction or operation of a <ln numlevel="1" lineno="101" slineno="2-37"/>school attended by students residing within the district and students residing in other <ln numlevel="1" lineno="102" slineno="2-38"/>districts either within or outside the state.</subsection><subsection ssid="4-null-18" dnum="b-o" numlevel="1" lineno="103" slineno="2-39" level="2"><display>(b)</display>Any agreement for the joint operation or construction of a school shall:<subsection ssid="4-null-19" dnum="i-o" numlevel="1" lineno="104" slineno="2-40" level="3"><display>(i)</display>be signed by the president of the local school board of each participating district;</subsection><subsection ssid="4-null-20" dnum="ii-o" numlevel="1" lineno="105" slineno="2-41" level="3"><display>(ii)</display>include a mutually agreed upon pro rata cost; and</subsection><subsection ssid="4-null-21" dnum="iii-o" numlevel="1" lineno="106" slineno="2-42" level="3"><display>(iii)</display>be filed with the state board.</subsection></subsection></subsection><subsection ssid="4-null-22" dnum="5-o" numlevel="1" lineno="107" slineno="2-43" level="1"><display>(5)</display>A local school board may establish, locate, and maintain elementary, secondary, and <ln numlevel="1" lineno="108" slineno="2-44"/>applied technology schools.</subsection><subsection ssid="4-null-23" dnum="6-o" numlevel="1" lineno="109" slineno="2-45" level="1"><display>(6)</display>A local school board may enter into cooperative agreements with other local school <ln numlevel="1" lineno="110" slineno="2-46"/>boards to provide educational services that best utilize resources for the overall <ln numlevel="1" lineno="111" slineno="2-47"/>operation of the school districts, including shared transportation services.</subsection><subsection ssid="4-null-24" dnum="7-o" numlevel="1" lineno="112" slineno="2-48" level="1"><display>(7)</display>A local school board shall ensure that an agreement under Subsection <xref depth="4" refnumber="53G-4-402(6)">(6)</xref>:<subsection ssid="4-null-25" dnum="a-o" numlevel="1" lineno="113" slineno="2-49" level="2"><display>(a)</display>is signed by the president of the local school board of each participating district;</subsection><subsection ssid="4-null-26" dnum="b-o" numlevel="1" lineno="114" slineno="2-50" level="2"><display>(b)</display>specifies the resource being shared;</subsection><subsection ssid="4-null-27" dnum="c-o" numlevel="1" lineno="115" slineno="2-51" level="2"><display>(c)</display>includes a mutually agreed upon pro rata cost;</subsection><subsection ssid="4-null-28" dnum="d-o" numlevel="1" lineno="116" slineno="2-52" level="2"><display>(d)</display>includes the duration of the agreement; and</subsection><subsection ssid="4-null-29" dnum="e-o" numlevel="1" lineno="117" slineno="2-53" level="2"><display>(e)</display>is filed with the state board.</subsection></subsection><subsection ssid="4-null-30" dnum="8-o" numlevel="1" lineno="118" slineno="2-54" level="1" space="false"><display>(8)</display><subsection ssid="4-null-31" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Section <xref depth="3" refnumber="53E-3-905">53E-3-905</xref> and Subsection <xref depth="4" refnumber="53G-4-402(8)(b)">(8)(b)</xref>, a local school <ln numlevel="1" lineno="119" slineno="2-55"/>board may enroll children in school who are at least five years old before September <ln numlevel="1" lineno="120" slineno="2-56"/>2 of the year in which admission is sought.</subsection><subsection ssid="4-null-32" dnum="b-o" numlevel="1" lineno="121" slineno="2-57" level="2"><display>(b)</display>A local school board may enroll a child in kindergarten who does not meet the age <ln numlevel="1" lineno="122" slineno="2-58"/>requirement described in Subsection <xref refnumber="53G-4-402(8)(a)" depth="4">(8)(a)</xref> if the child:<subsection ssid="4-null-33" dnum="i-o" numlevel="1" lineno="123" slineno="2-59" level="3"><display>(i)</display>moves to Utah from a different state in which the child, during the relevant school <ln numlevel="1" lineno="124" slineno="2-60"/>year:<subsection ssid="4-null-34" dnum="A-o" numlevel="1" lineno="125" slineno="2-61" level="4"><display>(A)</display>was a resident; and</subsection><subsection ssid="4-null-35" dnum="B-o" numlevel="1" lineno="126" slineno="2-62" level="4"><display>(B)</display>was enrolled in kindergarten in accordance with the previous state's age <ln numlevel="1" lineno="127" slineno="2-63"/>requirements for kindergarten enrollment; and</subsection></subsection><subsection ssid="4-null-36" dnum="ii-o" numlevel="1" lineno="128" slineno="2-64" level="3"><display>(ii)</display>transfers to the enrolling school after the beginning of the same school year.</subsection></subsection></subsection><subsection ssid="4-null-37" dnum="9-o" numlevel="1" lineno="129" slineno="2-65" level="1"><display>(9)</display>A local school board:<subsection ssid="4-null-38" dnum="a-o" numlevel="1" lineno="130" slineno="2-66" level="2"><display>(a)</display>may establish and support school libraries; and</subsection><subsection ssid="4-null-39" dnum="b-o" numlevel="1" lineno="131" slineno="2-67" level="2"><display>(b)</display>shall provide an online platform:<subsection ssid="4-null-40" dnum="i-o" numlevel="1" lineno="132" slineno="2-68" level="3"><display>(i)</display>through which a parent is able to view the title, author, and a description of any <ln numlevel="1" lineno="133" slineno="2-69"/>material the parent's child borrows from the school library, including a history of <ln numlevel="1" lineno="134" slineno="2-70"/>borrowed materials, either using an existing online platform that the LEA uses or <ln numlevel="1" lineno="135" slineno="2-71"/>through a separate platform; and</subsection><subsection ssid="4-null-41" dnum="ii-o" numlevel="1" lineno="136" slineno="2-72" level="3" space="false"><display>(ii)</display><subsection ssid="4-null-42" dnum="A-o" level="4" placement="sameline"><display>(A)</display>for a school district with 1,000 or more enrolled students, no later than <ln numlevel="1" lineno="137" slineno="2-73"/>August 1, 2024; and</subsection><subsection ssid="4-null-43" dnum="B-o" numlevel="1" lineno="138" slineno="2-74" level="4"><display>(B)</display>for a school district with fewer than 1,000 enrolled students, no later than <ln numlevel="1" lineno="139" slineno="2-75"/>August 1, 2026.</subsection></subsection></subsection></subsection><subsection ssid="4-null-44" dnum="10-o" numlevel="1" lineno="140" slineno="2-76" level="1"><display>(10)</display>A local school board may collect damages for the loss, injury, or destruction of school <ln numlevel="1" lineno="141" slineno="2-77"/>property.</subsection><subsection ssid="4-null-45" dnum="11-o" numlevel="1" lineno="142" slineno="2-78" level="1"><display>(11)</display>A local school board may authorize guidance and counseling services for students and <ln numlevel="1" lineno="143" slineno="2-79"/>the student's parents before, during, or following school enrollment.</subsection><subsection ssid="4-null-46" dnum="12-o" numlevel="1" lineno="144" slineno="2-80" level="1" space="false"><display>(12)</display><subsection ssid="4-null-47" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall administer and implement federal educational <ln numlevel="1" lineno="145" slineno="2-81"/>programs in accordance with Title <xref depth="2" refnumber="53E-3-8">53E, Chapter 3, Part 8</xref>, Implementing Federal or <ln numlevel="1" lineno="146" slineno="2-82"/>National Education Programs.</subsection><subsection ssid="4-null-48" dnum="b-o" numlevel="1" lineno="147" slineno="2-83" level="2"><display>(b)</display>Federal funds are not considered funds within the school district budget under <ln numlevel="1" lineno="148" slineno="2-84"/>Chapter <xref depth="2" refnumber="53G-7-3">7, Part 3</xref>, Budgets.</subsection></subsection><subsection ssid="4-null-49" dnum="13-o" numlevel="1" lineno="149" slineno="2-85" level="1" space="false"><display>(13)</display><subsection ssid="4-null-50" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may organize school safety patrols and adopt policies under <ln numlevel="1" lineno="150" slineno="2-86"/>which the patrols promote student safety.</subsection><subsection ssid="4-null-51" dnum="b-o" numlevel="1" lineno="151" slineno="2-87" level="2"><display>(b)</display>A student appointed to a safety patrol shall be at least 10 years old and have written <ln numlevel="1" lineno="152" slineno="2-88"/>parental consent for the appointment.</subsection><subsection ssid="4-null-52" dnum="c-o" numlevel="1" lineno="153" slineno="2-89" level="2"><display>(c)</display>Safety patrol members may not direct vehicular traffic or be stationed in a portion of <ln numlevel="1" lineno="154" slineno="2-90"/>a highway intended for vehicular traffic use.</subsection><subsection ssid="4-null-53" dnum="d-o" numlevel="1" lineno="155" slineno="2-91" level="2"><display>(d)</display>Liability may not attach to a school district, its employees, officers, or agents, or to a <ln numlevel="1" lineno="156" slineno="2-92"/>safety patrol member, a parent of a safety patrol member, or an authorized volunteer <ln numlevel="1" lineno="157" slineno="2-93"/>assisting the program by virtue of the organization, maintenance, or operation of a <ln numlevel="1" lineno="158" slineno="2-94"/>school safety patrol.</subsection></subsection><subsection ssid="4-null-54" dnum="14-o" numlevel="1" lineno="159" slineno="2-95" level="1" space="false"><display>(14)</display><subsection ssid="4-null-55" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may on its own behalf, or on behalf of an educational <ln numlevel="1" lineno="160" slineno="2-96"/>institution for which the local school board is the direct governing body, accept <ln numlevel="1" lineno="161" slineno="2-97"/>private grants, loans, gifts, endowments, devises, or bequests that are made for <ln numlevel="1" lineno="162" slineno="2-98"/>educational purposes.</subsection><subsection ssid="4-null-56" dnum="b-o" numlevel="1" lineno="163" slineno="2-99" level="2"><display>(b)</display>The contributions made under Subsection <xref depth="4" refnumber="53G-4-402(14)(a)">(14)(a)</xref> are not subject to appropriation by <ln numlevel="1" lineno="164" slineno="2-100"/>the Legislature.</subsection></subsection><subsection ssid="4-null-57" dnum="15-o" numlevel="1" lineno="165" slineno="2-101" level="1" space="false"><display>(15)</display><subsection ssid="4-null-58" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may appoint and fix the compensation of a compliance <ln numlevel="1" lineno="166" slineno="2-102"/>officer to issue citations for violations of Subsection <xref depth="4" refnumber="76-9-1106(3)(c)">76-9-1106(3)(c)</xref>.</subsection><subsection ssid="4-null-59" dnum="b-o" numlevel="1" lineno="167" slineno="2-103" level="2"><display>(b)</display>A person may not be appointed to serve as a compliance officer without the person's <ln numlevel="1" lineno="168" slineno="2-104"/>consent.</subsection><subsection ssid="4-null-60" dnum="c-o" numlevel="1" lineno="169" slineno="2-105" level="2"><display>(c)</display>A teacher or student may not be appointed as a compliance officer.</subsection></subsection><subsection ssid="4-null-61" dnum="16-o" numlevel="1" lineno="170" slineno="2-106" level="1"><display>(16)</display>A local school board shall adopt bylaws and policies for the local school board's own <ln numlevel="1" lineno="171" slineno="2-107"/>procedures.</subsection><subsection ssid="4-null-62" dnum="17-o" numlevel="1" lineno="172" slineno="2-108" level="1" space="false"><display>(17)</display><subsection ssid="4-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall make and enforce policies necessary for the control <ln numlevel="1" lineno="173" slineno="2-109"/>and management of the district schools.</subsection><subsection ssid="4-null-64" dnum="b-o" numlevel="1" lineno="174" slineno="2-110" level="2"><display>(b)</display>Local school board policies shall be in writing, filed, and referenced for public <ln numlevel="1" lineno="175" slineno="2-111"/>access.</subsection></subsection><subsection ssid="4-null-65" dnum="18-o" numlevel="1" lineno="176" slineno="2-112" level="1"><display>(18)</display>A local school board may hold school on legal holidays other than Sundays.</subsection><subsection ssid="4-null-66" dnum="19-o" numlevel="1" lineno="177" slineno="2-113" level="1" space="false"><display>(19)</display><subsection ssid="4-null-67" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall establish for each school year a school traffic safety <ln numlevel="1" lineno="178" slineno="2-114"/>committee to implement this Subsection <xref depth="4" refnumber="53G-4-402(19)">(19)</xref>.</subsection><subsection ssid="4-null-68" dnum="b-o" numlevel="1" lineno="179" slineno="2-115" level="2"><display>(b)</display>The committee shall be composed of one representative of:<subsection ssid="4-null-69" dnum="i-o" numlevel="1" lineno="180" slineno="2-116" level="3"><display>(i)</display>the schools within the district;</subsection><subsection ssid="4-null-70" dnum="ii-o" numlevel="1" lineno="181" slineno="2-117" level="3"><display>(ii)</display>the Parent Teachers' Association of the schools within the district;</subsection><subsection ssid="4-null-71" dnum="iii-o" numlevel="1" lineno="182" slineno="2-118" level="3"><display>(iii)</display>the municipality or county;</subsection><subsection ssid="4-null-72" dnum="iv-o" numlevel="1" lineno="183" slineno="2-119" level="3"><display>(iv)</display>state or local law enforcement; and</subsection><subsection ssid="4-null-73" dnum="v-o" numlevel="1" lineno="184" slineno="2-120" level="3"><display>(v)</display>state or local traffic safety engineering.</subsection></subsection><subsection ssid="4-null-74" dnum="c-o" numlevel="1" lineno="185" slineno="2-121" level="2"><display>(c)</display>The committee shall:<subsection ssid="4-null-75" dnum="i-o" numlevel="1" lineno="186" slineno="2-122" level="3"><display>(i)</display>receive suggestions from school community councils, parents, teachers, and <ln numlevel="1" lineno="187" slineno="2-123"/>others, and recommend school traffic safety improvements, boundary changes to <ln numlevel="1" lineno="188" slineno="2-124"/>enhance safety, and school traffic safety program measures;</subsection><subsection ssid="4-null-76" dnum="ii-o" numlevel="1" lineno="189" slineno="2-125" level="3"><display>(ii)</display>review and submit annually to the Department of Transportation and affected <ln numlevel="1" lineno="190" slineno="2-126"/>municipalities and counties a child access routing plan for each elementary, <ln numlevel="1" lineno="191" slineno="2-127"/>middle, and junior high school within the district;</subsection><subsection ssid="4-null-77" dnum="iii-o" numlevel="1" lineno="192" slineno="2-128" level="3"><display>(iii)</display>in consultation with the Utah Safety Council and the Division of Family Health, <ln numlevel="1" lineno="193" slineno="2-129"/>provide training to all students in kindergarten through grade 6, within the district, <ln numlevel="1" lineno="194" slineno="2-130"/>on school crossing safety and use; and</subsection><subsection ssid="4-null-78" dnum="iv-o" numlevel="1" lineno="195" slineno="2-131" level="3"><display>(iv)</display>help ensure the district's compliance with rules made by the Department of <ln numlevel="1" lineno="196" slineno="2-132"/>Transportation under Section <xref depth="3" refnumber="41-6a-303">41-6a-303</xref>.</subsection></subsection><subsection ssid="4-null-79" dnum="d-o" numlevel="1" lineno="197" slineno="2-133" level="2"><display>(d)</display>The committee may establish subcommittees as needed to assist in accomplishing the <ln numlevel="1" lineno="198" slineno="2-134"/>committee's duties under Subsection <xref depth="4" refnumber="53G-4-402(19)(c)">(19)(c)</xref>.</subsection></subsection><subsection ssid="4-null-80" dnum="20-o" numlevel="1" lineno="199" slineno="2-135" level="1" space="false"><display>(20)</display><subsection ssid="4-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall adopt and implement a comprehensive emergency <ln numlevel="1" lineno="200" slineno="2-136"/>response plan to prevent and combat violence in the local school board's public <ln numlevel="1" lineno="201" slineno="2-137"/>schools, on school grounds, on  school vehicles, and in connection with <ln numlevel="1" lineno="202" slineno="2-138"/>school-related activities or events.</subsection><subsection ssid="4-null-82" dnum="b-o" numlevel="1" lineno="203" slineno="2-139" level="2"><display>(b)</display>The local school board shall ensure that the plan:<subsection ssid="4-null-83" dnum="i-o" numlevel="1" lineno="204" slineno="2-140" level="3"><display>(i)</display>includes prevention, intervention, and response components;</subsection><subsection ssid="4-null-84" dnum="ii-o" numlevel="1" lineno="205" slineno="2-141" level="3"><display>(ii)</display>is consistent with the school discipline and conduct policies required for school <ln numlevel="1" lineno="206" slineno="2-142"/>districts under Chapter <xref depth="2" refnumber="53G-8-2">8, Part 2</xref>, School Discipline and Conduct Plans;</subsection><subsection ssid="4-null-85" dnum="iii-o" numlevel="1" lineno="207" slineno="2-143" level="3"><display>(iii)</display>requires professional learning for all district and school building staff on the <ln numlevel="1" lineno="208" slineno="2-144"/>staff's roles in the emergency response plan;</subsection><subsection ssid="4-null-86" dnum="iv-o" numlevel="1" lineno="209" slineno="2-145" level="3"><display>(iv)</display>provides for coordination with local law enforcement and other public safety <ln numlevel="1" lineno="210" slineno="2-146"/>representatives in preventing, intervening, and responding to violence in the areas <ln numlevel="1" lineno="211" slineno="2-147"/>and activities referred to in Subsection <xref depth="4" refnumber="53G-4-402(20)(a)">(20)(a)</xref>; and</subsection><subsection ssid="4-null-87" dnum="v-o" numlevel="1" lineno="212" slineno="2-148" level="3"><display>(v)</display>includes procedures to notify a student who is off campus at the time of a school <ln numlevel="1" lineno="213" slineno="2-149"/>violence emergency because the student is:<subsection ssid="4-null-88" dnum="A-o" numlevel="1" lineno="214" slineno="2-150" level="4"><display>(A)</display>participating in a school-related activity; or</subsection><subsection ssid="4-null-89" dnum="B-o" numlevel="1" lineno="215" slineno="2-151" level="4"><display>(B)</display>excused from school for a period of time during the regular school day to <ln numlevel="1" lineno="216" slineno="2-152"/>participate in religious instruction at the request of the student's parent.</subsection></subsection></subsection><subsection ssid="4-null-90" dnum="c-o" numlevel="1" lineno="217" slineno="2-153" level="2"><display>(c)</display>The state board, through the state superintendent, shall develop comprehensive <ln numlevel="1" lineno="218" slineno="2-154"/>emergency response plan models that local school boards may use, where <ln numlevel="1" lineno="219" slineno="2-155"/>appropriate, to comply with Subsection <xref depth="4" refnumber="53G-4-402(20)(a)">(20)(a)</xref>.</subsection><subsection ssid="4-null-91" dnum="d-o" numlevel="1" lineno="220" slineno="2-156" level="2"><display>(d)</display>A local school board shall, by July 1 of each year, certify to the state board that its <ln numlevel="1" lineno="221" slineno="2-157"/>plan has been practiced at the school level and presented to and reviewed by its <ln numlevel="1" lineno="222" slineno="2-158"/>teachers, administrators, students, and the student's parents and local law enforcement <ln numlevel="1" lineno="223" slineno="2-159"/>and public safety representatives.</subsection></subsection><subsection ssid="4-null-92" dnum="21-o" numlevel="1" lineno="224" slineno="2-160" level="1" space="false"><display>(21)</display><subsection ssid="4-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board may adopt an emergency response plan for the treatment of <ln numlevel="1" lineno="225" slineno="2-161"/>sports-related injuries that occur during school sports practices and events.</subsection><subsection ssid="4-null-94" dnum="b-o" numlevel="1" lineno="226" slineno="2-162" level="2"><display>(b)</display>The plan may be implemented by each secondary school in the district that has a <ln numlevel="1" lineno="227" slineno="2-163"/>sports program for students.</subsection><subsection ssid="4-null-95" dnum="c-o" numlevel="1" lineno="228" slineno="2-164" level="2"><display>(c)</display>The plan may:<subsection ssid="4-null-96" dnum="i-o" numlevel="1" lineno="229" slineno="2-165" level="3"><display>(i)</display>include emergency personnel, emergency communication, and emergency <ln numlevel="1" lineno="230" slineno="2-166"/>equipment components;</subsection><subsection ssid="4-null-97" dnum="ii-o" numlevel="1" lineno="231" slineno="2-167" level="3"><display>(ii)</display>require professional learning on the emergency response plan for school <ln numlevel="1" lineno="232" slineno="2-168"/>personnel who are involved in sports programs in the district's secondary schools; <ln numlevel="1" lineno="233" slineno="2-169"/>and</subsection><subsection ssid="4-null-98" dnum="iii-o" numlevel="1" lineno="234" slineno="2-170" level="3"><display>(iii)</display>provide for coordination with individuals and agency representatives who:<subsection ssid="4-null-99" dnum="A-o" numlevel="1" lineno="235" slineno="2-171" level="4"><display>(A)</display>are not employees of the school district; and</subsection><subsection ssid="4-null-100" dnum="B-o" numlevel="1" lineno="236" slineno="2-172" level="4"><display>(B)</display>would be involved in providing emergency services to students injured while <ln numlevel="1" lineno="237" slineno="2-173"/>participating in sports events.</subsection></subsection></subsection><subsection ssid="4-null-101" dnum="d-o" numlevel="1" lineno="238" slineno="2-174" level="2"><display>(d)</display>The local school board, in collaboration with the schools referred to in Subsection <xref depth="4" refnumber="53G-4-402(21)(b)"><ln numlevel="1" lineno="239" slineno="2-175"/>(21)(b)</xref>, may review the plan each year and make revisions when required to improve <ln numlevel="1" lineno="240" slineno="2-176"/>or enhance the plan.</subsection><subsection ssid="4-null-102" dnum="e-o" numlevel="1" lineno="241" slineno="2-177" level="2"><display>(e)</display>The state board, through the state superintendent, shall provide local school boards <ln numlevel="1" lineno="242" slineno="2-178"/>with an emergency plan response model that local school boards may use to comply <ln numlevel="1" lineno="243" slineno="2-179"/>with the requirements of this Subsection <xref depth="4" refnumber="53G-4-402(21)">(21)</xref>.</subsection></subsection><subsection ssid="4-null-103" dnum="22-o" numlevel="1" lineno="244" slineno="2-180" level="1" space="false"><display>(22)</display><subsection ssid="4-null-104" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A local school board shall approve an LEA's policies and procedures that an <ln numlevel="1" lineno="245" slineno="2-181"/>LEA develops to ensure that students have non-electronic notification of and access <ln numlevel="1" lineno="246" slineno="2-182"/>to:<subsection ssid="4-null-105" dnum="i-o" numlevel="1" lineno="247" slineno="2-183" level="3" tab="1"><display>(i)</display>school activities and events, including:<subsection ssid="4-null-106" dnum="A-o" numlevel="1" lineno="248" slineno="2-184" level="4"><display>(A)</display>schedule changes;</subsection><subsection ssid="4-null-107" dnum="B-o" numlevel="1" lineno="249" slineno="2-185" level="4"><display>(B)</display>extracurricular activities; and</subsection><subsection ssid="4-null-108" dnum="C-o" numlevel="1" lineno="250" slineno="2-186" level="4"><display>(C)</display>sporting events; and</subsection></subsection><subsection ssid="4-null-109" dnum="ii-o" numlevel="1" lineno="251" slineno="2-187" level="3" tab="1"><display>(ii)</display>the emergency response plans described in Subsections <xref depth="4" refnumber="53G-4-402(20)">(20)</xref> and <xref depth="4" refnumber="53G-4-402(21)">(21)</xref>.</subsection></subsection><subsection ssid="4-null-110" dnum="b-o" numlevel="1" lineno="252" slineno="2-188" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="53G-4-402(22)(a)">(22)(a)</xref>, an LEA may provide electronic notification of <ln numlevel="1" lineno="253" slineno="2-189"/>and access to school activities and events as described in Subsections <xref depth="4" refnumber="53G-4-402(22)(a)(i)">(22)(a)(i)</xref> and <xref depth="4" refnumber="53G-4-402(ii)"><ln numlevel="1" lineno="254" slineno="2-190"/>(ii)</xref> if:<subsection ssid="4-null-111" dnum="i-o" numlevel="1" lineno="255" slineno="2-191" level="3" space="false"><display>(i)</display><subsection ssid="4-null-112" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the school provides each student with an electronic device; and</subsection><subsection ssid="4-null-113" dnum="B-o" numlevel="1" lineno="256" slineno="2-192" level="4"><display>(B)</display>the electronic device is capable of receiving electronic notification of and <ln numlevel="1" lineno="257" slineno="2-193"/>access to school activities and events as described in Subsections <xref depth="4" refnumber="53G-4-402(22)(a)(i)">(22)(a)(i)</xref> and <xref depth="4" refnumber="53G-4-402(ii)"><ln numlevel="1" lineno="258" slineno="2-194"/>(ii)</xref>; or</subsection></subsection><subsection ssid="4-null-114" dnum="ii-o" numlevel="1" lineno="259" slineno="2-195" level="3"><display>(ii)</display>an emergency, unforeseen circumstance, or other incident arises and an LEA <ln numlevel="1" lineno="260" slineno="2-196"/>cannot reasonably provide timely non-electronic notification.</subsection></subsection><subsection ssid="4-null-115" dnum="c-o" numlevel="1" lineno="261" slineno="2-197" level="2"><display>(c)</display>An LEA may not require the use of a privately owned electronic device to complete <ln numlevel="1" lineno="262" slineno="2-198"/>course work.</subsection></subsection><subsection ssid="4-null-116" dnum="23-o" numlevel="1" lineno="263" slineno="2-199" level="1"><display>(23)</display>A local school board shall do all other things necessary for the maintenance, <ln numlevel="1" lineno="264" slineno="2-200"/>prosperity, and success of the schools and the promotion of education.</subsection><subsection ssid="4-null-117" dnum="24-o" numlevel="1" lineno="265" slineno="2-201" level="1" space="false"><display>(24)</display><subsection ssid="4-null-118" dnum="a-o" level="2" placement="sameline" space="false"><display>(a)</display><subsection ssid="4-167" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1" placement="sameline"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="e" level="1" amendtag="both">(i)</amend></display>As used in this subsection, "special enrollment program" means a full-day <ln numlevel="1" lineno="266" slineno="2-202"/>academic program in which a parent opts to enroll the parent's student and that is <ln numlevel="1" lineno="267" slineno="2-203"/>offered at a specifically designated school within an LEA, including:<subsection ssid="4-null-119" dnum="i-o:A-e" numlevel="1" lineno="268" slineno="2-204" level="4" tab="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1144" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1145" style="1" owner="e" level="1" amendtag="both" space="true">(A)</amend></display>gifted or advanced learning programs; or</subsection><subsection ssid="4-null-120" dnum="ii-o:B-e" numlevel="1" lineno="269" slineno="2-205" level="4" tab="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1145" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1146" style="1" owner="e" level="1" amendtag="both" space="true">(B)</amend></display>dual language immersion programs.</subsection></subsection><subsection ssid="4-168" dnum="_-o:ii-e" numlevel="1" lineno="270" slineno="2-206" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="5" style="1" owner="admin" level="1" amendtag="end">"Special enrollment program" does not mean a special class as that term is <ln numlevel="1" lineno="271" slineno="2-207"/>defined in Section <xref depth="3" refnumber="53E-7-210">53E-7-210</xref>.</amend></subsection></subsection><subsection ssid="4-null-121" dnum="b-o" numlevel="1" lineno="272" slineno="2-208" level="2"><display>(b)</display>Before closing a school, changing the boundaries of a school, or changing or closing <ln numlevel="1" lineno="273" slineno="2-209"/>the location of a special enrollment program, a local school board shall:<subsection ssid="4-null-122" dnum="i-o" numlevel="1" lineno="274" slineno="2-210" level="3"><display>(i)</display>at a local school board meeting, make and approve a motion to initiate the <ln numlevel="1" lineno="275" slineno="2-211"/>notification required under Subsections <xref depth="4" refnumber="53G-4-402(24)(b)(ii)">(24)(b)(ii)</xref> through <xref depth="4" refnumber="53G-4-402(iv)">(iv)</xref>;</subsection><subsection ssid="4-null-123" dnum="ii-o" numlevel="1" lineno="276" slineno="2-212" level="3"><display>(ii)</display>on or before 90 days before the day on which the local school board approves the <ln numlevel="1" lineno="277" slineno="2-213"/>school closure or at least 30 days before the day on which the local school board <ln numlevel="1" lineno="278" slineno="2-214"/>approves a school boundary change, provide notice that the local school board is <ln numlevel="1" lineno="279" slineno="2-215"/>considering the closure or boundary change to:<subsection ssid="4-null-124" dnum="A-o" numlevel="1" lineno="280" slineno="2-216" level="4"><display>(A)</display>parents of students enrolled in the school, using the same form of <ln numlevel="1" lineno="281" slineno="2-217"/>communication the local school board regularly uses to communicate with <ln numlevel="1" lineno="282" slineno="2-218"/>parents and also by mail, using the United States Postal Service, to the parents <ln numlevel="1" lineno="283" slineno="2-219"/>at each known address;</subsection><subsection ssid="4-null-125" dnum="B-o" numlevel="1" lineno="284" slineno="2-220" level="4"><display>(B)</display>parents of students enrolled in other schools within the school district that may <ln numlevel="1" lineno="285" slineno="2-221"/>be affected by the closure or boundary change, using the same form of <ln numlevel="1" lineno="286" slineno="2-222"/>communication the local school board regularly uses to communicate with <ln numlevel="1" lineno="287" slineno="2-223"/>parents and also by mail, using the United States Postal Service, to the parents <ln numlevel="1" lineno="288" slineno="2-224"/>at each known address; and</subsection><subsection ssid="4-null-126" dnum="C-o" numlevel="1" lineno="289" slineno="2-225" level="4"><display>(C)</display>the governing council and the mayor of the municipality in which the school is <ln numlevel="1" lineno="290" slineno="2-226"/>located;</subsection></subsection><subsection ssid="4-null-127" dnum="iii-o" numlevel="1" lineno="291" slineno="2-227" level="3"><display>(iii)</display>provide an opportunity for public comment on the proposed school closure <ln numlevel="1" lineno="292" slineno="2-228"/>during at least two public local school board meetings; </subsection><subsection ssid="4-null-128" dnum="iv-o" numlevel="1" lineno="293" slineno="2-229" level="3"><display>(iv)</display>provide an opportunity for public comment on the proposed school boundary <ln numlevel="1" lineno="294" slineno="2-230"/>change during one public local school board meeting; and</subsection><subsection ssid="4-null-129" dnum="v-o" numlevel="1" lineno="295" slineno="2-231" level="3"><display>(v)</display>hold a public hearing as defined in Section <xref depth="3" refnumber="10-20-102">10-20-102</xref> and provide public notice <ln numlevel="1" lineno="296" slineno="2-232"/>of the public hearing in accordance with Subsection <xref depth="4" refnumber="53G-4-402(24)(c)">(24)(c)</xref>.</subsection></subsection><subsection ssid="4-null-130" dnum="c-o" numlevel="1" lineno="297" slineno="2-233" level="2"><display>(c)</display>A local school board shall:<subsection ssid="4-null-131" dnum="i-o" numlevel="1" lineno="298" slineno="2-234" level="3"><display>(i)</display>ensure that the notice of a public hearing required under Subsection <xref depth="4" refnumber="53G-4-402(24)(b)(v)">(24)(b)(v)</xref> <ln numlevel="1" lineno="299" slineno="2-235"/>indicates the:<subsection ssid="4-null-132" dnum="A-o" numlevel="1" lineno="300" slineno="2-236" level="4"><display>(A)</display>name of the school or schools under consideration for closure or boundary <ln numlevel="1" lineno="301" slineno="2-237"/>change; and</subsection><subsection ssid="4-null-133" dnum="B-o" numlevel="1" lineno="302" slineno="2-238" level="4"><display>(B)</display>the date, time, and location of the public hearing;</subsection></subsection><subsection ssid="4-null-134" dnum="ii-o" numlevel="1" lineno="303" slineno="2-239" level="3"><display>(ii)</display>if feasible, hold the public hearing at the location of the school that is under <ln numlevel="1" lineno="304" slineno="2-240"/>consideration for closure;</subsection><subsection ssid="4-null-135" dnum="iii-o" numlevel="1" lineno="305" slineno="2-241" level="3"><display>(iii)</display>for at least 10 days before the day on which the public hearing occurs, publish <ln numlevel="1" lineno="306" slineno="2-242"/>the notice of public hearing occurs, publish the notice of the public hearing for the <ln numlevel="1" lineno="307" slineno="2-243"/>school district in which the school is located, as a class A notice under Section <xref depth="3" refnumber="63G-30-102"><ln numlevel="1" lineno="308" slineno="2-244"/>63G-30-102</xref>; and</subsection><subsection ssid="4-null-136" dnum="iv-o" numlevel="1" lineno="309" slineno="2-245" level="3"><display>(iv)</display>at least 30 days before the day on which the public hearing occurs, provide notice <ln numlevel="1" lineno="310" slineno="2-246"/>of the public hearing in the same manner as the notice of consideration under <ln numlevel="1" lineno="311" slineno="2-247"/>Subsection <xref depth="4" refnumber="53G-4-402(24)(b)(ii)">(24)(b)(ii)</xref>.</subsection></subsection><subsection ssid="4-null-137" dnum="d-o" numlevel="1" lineno="312" slineno="2-248" level="2"><display>(d)</display>A motion made under Subsection <xref depth="4" refnumber="53G-4-402(24)(b)">(24)(b)</xref> shall name each school under consideration <ln numlevel="1" lineno="313" slineno="2-249"/>for closure in a separate motion.</subsection><subsection ssid="4-null-138" dnum="e-o" numlevel="1" lineno="314" slineno="2-250" level="2"><display>(e)</display>For a school closure, a local school board shall complete the process described in this <ln numlevel="1" lineno="315" slineno="2-251"/>Subsection <xref depth="4" refnumber="53G-4-402(24)">(24)</xref> on or before December 31 of the calendar year preceding the <ln numlevel="1" lineno="316" slineno="2-252"/>beginning of the school year in which a school closure takes effect.</subsection><subsection ssid="4-null-139" dnum="f-o" numlevel="1" lineno="317" slineno="2-253" level="2" space="false"><display>(f)</display><subsection ssid="4-null-140" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For a school boundary change, a local school board shall complete the process <ln numlevel="1" lineno="318" slineno="2-254"/>described in this Subsection <xref depth="4" refnumber="53G-4-402(24)">(24)</xref> no more than 60 days after the day on which the <ln numlevel="1" lineno="319" slineno="2-255"/>local school board votes to approve a school closure.</subsection><subsection ssid="4-null-141" dnum="ii-o" numlevel="1" lineno="320" slineno="2-256" level="3"><display>(ii)</display>Parents of students enrolled in a school affected by a boundary change shall have <ln numlevel="1" lineno="321" slineno="2-257"/>at least 30 days after the day on which the local school board votes to approve a <ln numlevel="1" lineno="322" slineno="2-258"/>school boundary change to request an out of area enrollment request in accordance <ln numlevel="1" lineno="323" slineno="2-259"/>with Chapter <xref depth="2" refnumber="53G-6-4">6, Part 4</xref>, School District Enrollment.</subsection></subsection></subsection><subsection ssid="4-null-142" dnum="25-o" numlevel="1" lineno="324" slineno="2-260" level="1"><display>(25)</display>A local school board may implement a facility energy efficiency program established <ln numlevel="1" lineno="325" slineno="2-261"/>under Title <xref depth="1" refnumber="11-44">11, Chapter 44</xref>, Performance Efficiency Act.</subsection><subsection ssid="4-null-143" dnum="26-o" numlevel="1" lineno="326" slineno="2-262" level="1"><display>(26)</display>A local school board may establish or partner with a certified youth court in <ln numlevel="1" lineno="327" slineno="2-263"/>accordance with Section <xref depth="3" refnumber="80-6-902">80-6-902</xref> or establish or partner with a comparable restorative <ln numlevel="1" lineno="328" slineno="2-264"/>justice program, in coordination with schools in that district. A school may refer a <ln numlevel="1" lineno="329" slineno="2-265"/>student to a youth court or a comparable restorative justice program in accordance with <ln numlevel="1" lineno="330" slineno="2-266"/>Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref>.</subsection><subsection ssid="4-null-144" dnum="27-o" numlevel="1" lineno="331" slineno="2-267" level="1" space="false"><display>(27)</display><subsection ssid="4-null-145" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this Subsection <xref depth="4" refnumber="53G-4-402(27)">(27)</xref>:<subsection ssid="4-null-146" dnum="i-o" numlevel="1" lineno="332" slineno="2-268" level="3" tab="1"><display>(i)</display>"Learning material" means any learning material or resource used to deliver or <ln numlevel="1" lineno="333" slineno="2-269"/>support a student's learning, including textbooks, reading materials, videos, digital <ln numlevel="1" lineno="334" slineno="2-270"/>materials, websites, and other online applications.</subsection><subsection ssid="4-null-147" dnum="ii-o" numlevel="1" lineno="335" slineno="2-271" level="3" tab="1" space="false"><display>(ii)</display><subsection ssid="4-null-148" dnum="A-o" level="4" placement="sameline"><display>(A)</display>"Instructional material" means learning material that a local school board <ln numlevel="1" lineno="336" slineno="2-272"/>adopts and approves for use within the LEA.</subsection><subsection ssid="4-null-149" dnum="B-o" numlevel="1" lineno="337" slineno="2-273" level="4"><display>(B)</display>"Instructional material" does not include learning material used in a <ln numlevel="1" lineno="338" slineno="2-274"/>concurrent enrollment, advanced placement, or international baccalaureate <ln numlevel="1" lineno="339" slineno="2-275"/>program or class or another class with required instructional material that is not <ln numlevel="1" lineno="340" slineno="2-276"/>subject to selection by the local school board.</subsection></subsection><subsection ssid="4-null-150" dnum="iii-o" numlevel="1" lineno="341" slineno="2-277" level="3" tab="1"><display>(iii)</display>"Supplemental material" means learning material that:<subsection ssid="4-null-151" dnum="A-o" numlevel="1" lineno="342" slineno="2-278" level="4"><display>(A)</display>an educator selects for classroom use; and</subsection><subsection ssid="4-null-152" dnum="B-o" numlevel="1" lineno="343" slineno="2-279" level="4"><display>(B)</display>a local school board has not considered and adopted, approved, or prohibited <ln numlevel="1" lineno="344" slineno="2-280"/>for classroom use within the LEA.</subsection></subsection></subsection><subsection ssid="4-null-153" dnum="b-o" numlevel="1" lineno="345" slineno="2-281" level="2"><display>(b)</display>A local school board shall:<subsection ssid="4-null-154" dnum="i-o" numlevel="1" lineno="346" slineno="2-282" level="3"><display>(i)</display>make instructional material that the school district uses readily accessible and <ln numlevel="1" lineno="347" slineno="2-283"/>available for a parent to view;</subsection><subsection ssid="4-null-155" dnum="ii-o" numlevel="1" lineno="348" slineno="2-284" level="3"><display>(ii)</display>annually notify a parent of a student enrolled in the school district of how to <ln numlevel="1" lineno="349" slineno="2-285"/>access the information described in Subsection <xref depth="4" refnumber="53G-4-402(27)(b)(i)">(27)(b)(i)</xref>; and</subsection><subsection ssid="4-null-156" dnum="iii-o" numlevel="1" lineno="350" slineno="2-286" level="3"><display>(iii)</display>include on the school district's website information about how to access the <ln numlevel="1" lineno="351" slineno="2-287"/>information described in Subsection <xref depth="4" refnumber="53G-4-402(27)(b)(i)">(27)(b)(i)</xref>.</subsection></subsection><subsection ssid="4-null-157" dnum="c-o" numlevel="1" lineno="352" slineno="2-288" level="2"><display>(c)</display>In selecting and approving instructional materials for use in the classroom, a local <ln numlevel="1" lineno="353" slineno="2-289"/>school board shall:<subsection ssid="4-null-158" dnum="i-o" numlevel="1" lineno="354" slineno="2-290" level="3"><display>(i)</display>establish an open process, involving educators and parents of students enrolled in <ln numlevel="1" lineno="355" slineno="2-291"/>the LEA, to review and recommend instructional materials for board approval; and</subsection><subsection ssid="4-null-159" dnum="ii-o" numlevel="1" lineno="356" slineno="2-292" level="3"><display>(ii)</display>ensure that under the process described in Subsection <xref depth="4" refnumber="53G-4-402(27)(c)(i)">(27)(c)(i)</xref>, the board:<subsection ssid="4-null-160" dnum="A-o" numlevel="1" lineno="357" slineno="2-293" level="4"><display>(A)</display>before the meetings described in Subsection <xref depth="4" refnumber="53G-4-402(27)(c)(ii)(b)">(27)(c)(ii)(B)</xref>, posts the <ln numlevel="1" lineno="358" slineno="2-294"/>recommended learning material online to allow for public review or, for <ln numlevel="1" lineno="359" slineno="2-295"/>copyrighted material, makes the recommended learning material available at <ln numlevel="1" lineno="360" slineno="2-296"/>the LEA for public review;</subsection><subsection ssid="4-null-161" dnum="B-o" numlevel="1" lineno="361" slineno="2-297" level="4"><display>(B)</display>before adopting or approving the recommended instructional materials, holds <ln numlevel="1" lineno="362" slineno="2-298"/>at least two public meetings on the recommendation that provides an <ln numlevel="1" lineno="363" slineno="2-299"/>opportunity for educators whom the LEA employs and parents of students <ln numlevel="1" lineno="364" slineno="2-300"/>enrolled in the LEA to express views and opinions on the recommendation; and</subsection><subsection ssid="4-null-162" dnum="C-o" numlevel="1" lineno="365" slineno="2-301" level="4"><display>(C)</display>adopts or approves the recommended instructional materials in an open and <ln numlevel="1" lineno="366" slineno="2-302"/>regular board meeting.</subsection></subsection></subsection><subsection ssid="4-null-163" dnum="d-o" numlevel="1" lineno="367" slineno="2-303" level="2"><display>(d)</display>A local school board shall adopt a supplemental materials policy that provides <ln numlevel="1" lineno="368" slineno="2-304"/>flexible guidance to educators on the selection of supplemental materials or resources <ln numlevel="1" lineno="369" slineno="2-305"/>that an educator reviews and selects for classroom use using the educator's <ln numlevel="1" lineno="370" slineno="2-306"/>professional judgment, including whether any process or permission is required <ln numlevel="1" lineno="371" slineno="2-307"/>before classroom use of the materials or resources.</subsection><subsection ssid="4-null-164" dnum="e-o" numlevel="1" lineno="372" slineno="2-308" level="2"><display>(e)</display>If an LEA contracts with another party to provide online or digital materials, the <ln numlevel="1" lineno="373" slineno="2-309"/>LEA shall include in the contract a requirement that the provider give notice to the <ln numlevel="1" lineno="374" slineno="2-310"/>LEA any time that the provider makes a material change to the content of the online <ln numlevel="1" lineno="375" slineno="2-311"/>or digital materials, excluding regular informational updates on current events.</subsection><subsection ssid="4-null-165" dnum="f-o" numlevel="1" lineno="376" slineno="2-312" level="2"><display>(f)</display>Nothing in this Subsection <xref depth="4" refnumber="53G-4-402(27)">(27)</xref> requires a local school board to review all learning <ln numlevel="1" lineno="377" slineno="2-313"/>materials used within the LEA.</subsection></subsection><subsection ssid="4-null-166" dnum="28-o" numlevel="1" lineno="378" slineno="2-314" level="1"><display>(28)</display>If information, data, or action from a school district is necessary for the state board to <ln numlevel="1" lineno="379" slineno="2-315"/>fulfill a statutory data gathering, compliance, or reporting requirement, a local school <ln numlevel="1" lineno="380" slineno="2-316"/>board shall provide the relevant information, data, or action, subject to enforcement <ln numlevel="1" lineno="381" slineno="2-317"/>under Section <xref depth="3" refnumber="53E-3-401">53E-3-401</xref>.</subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="382" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="382">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="383"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="7/1/2026">July 1, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-6-26 10:37 PM</tm></rev></foot></leg>
