Cullimore</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses the regulation of milk or milk products.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">modifies an exemption from certain dairy regulations;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">defines terms;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">outlines general requirements related to raw milk or raw milk products;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">addresses prohibited counts in raw milk;</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">prescribes labeling;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">provides for the suspension and reissuance of permits;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">addresses foodborne illness outbreaks;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">addresses cease and desist orders;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">addresses rulemaking;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">provides for fees;</hl><hl numlevel="1" lineno="18" slineno="0-18" level="1">imposes penalties;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">exempts from certain requirements sales or deliveries of raw milk or raw products from a <ln numlevel="1" lineno="20" slineno="0-20"/>farm;</hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">provides for an exemption for small producers;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">provides for no severability; Section <bold>4-3-301</bold> is amended to read:</secline><catline lineno="48"><bold>4-3-301<parens/>. Permits or certificates -- Application -- Fee -- Expiration -- Renewal.</bold></catline><subsection ssid="8-null-1" dnum="1-o" numlevel="1" lineno="49" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Application for a permit to operate a plant, manufacture butter or cheese, pasteurize <ln numlevel="1" lineno="50" slineno="1-4"/>milk, test milk for payment, haul milk in bulk, or for the wholesale distribution of dairy <ln numlevel="1" lineno="51" slineno="1-5"/>products shall be made to the department upon forms prescribed and furnished by the <ln numlevel="1" lineno="52" slineno="1-6"/>department.</subsection><subsection ssid="8-null-2" dnum="2-o" numlevel="1" lineno="53" slineno="1-7" level="1"><display>(2)</display>Upon receipt of a proper application, compliance with the applicable rules, and payment <ln numlevel="1" lineno="54" slineno="1-8"/>of a permit fee determined by the department according to Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref>, the <ln numlevel="1" lineno="55" slineno="1-9"/>commissioner, if satisfied that the public convenience and necessity and the industry <ln numlevel="1" lineno="56" slineno="1-10"/>will be served, shall issue an appropriate permit to the applicant subject to suspension or <ln numlevel="1" lineno="57" slineno="1-11"/>revocation for cause.</subsection><subsection ssid="8-null-3" dnum="3-o" numlevel="1" lineno="58" slineno="1-12" level="1"><display>(3)</display>A permit issued under this section expires at midnight on December 31 of each year.</subsection><subsection ssid="8-null-4" dnum="4-o" numlevel="1" lineno="59" slineno="1-13" level="1"><display>(4)</display>A permit to operate a plant, manufacture butter or cheese, pasteurize milk, test milk for <ln numlevel="1" lineno="60" slineno="1-14"/>payment, haul milk in bulk, or for the wholesale distribution of dairy products, is <ln numlevel="1" lineno="61" slineno="1-15"/>renewable for a period of one year upon the payment of an annual permit renewal fee <ln numlevel="1" lineno="62" slineno="1-16"/>determined by the department according to Subsection <xref depth="4" refnumber="4-2-103(2)" start="0">4-2-103(2)</xref> on or before <ln numlevel="1" lineno="63" slineno="1-17"/>December 31 of each year.</subsection><subsection ssid="8-null-5" dnum="5-o" numlevel="1" lineno="64" slineno="1-18" level="1"><display>(5)</display>Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-3-301(1)" start="0">(1)</xref>, application for a permit or <ln numlevel="1" lineno="65" slineno="1-19"/>certificate to produce milk or a raw milk product, as that term is defined in Section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="11" groupid="10" style="2" owner="admin" level="1" deltag="both"> <xref depth="3" refnumber="4-3-503" start="0"><ln numlevel="1" lineno="66" slineno="1-20"/>4-3-503</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="admin" level="1" amendtag="both" space="true"> <xref depth="3" refnumber="4-3-601">4-3-601</xref></amend>, shall be made to the department on forms prescribed and furnished by <ln numlevel="1" lineno="67" slineno="1-21"/>the department.</subsection><subsection ssid="8-null-6" dnum="6-o" numlevel="1" lineno="68" slineno="1-22" level="1" space="false"><display>(6)</display><subsection ssid="8-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Upon receipt of a proper application and compliance with applicable rules, the <ln numlevel="1" lineno="69" slineno="1-23"/>commissioner shall issue a permit entitling the applicant to engage in the business of <ln numlevel="1" lineno="70" slineno="1-24"/>producer, subject to suspension or revocation for cause.</subsection><subsection ssid="8-null-8" dnum="b-o" numlevel="1" lineno="71" slineno="1-25" level="2"><display>(b)</display>A fee may not be charged by the department for issuance of a certificate.</subsection></subsection></section></bsec><bsec buid="3" num="4-3-502" type="amend" src="code" uid="C4-3-S502_2026050620260506" sort="04 03 05020020260506" numlevel="1" lineno="72" slineno="2-1" sn="2"><section number="4-3-502" numlevel="1" lineno="73" slineno="2-2" type="amend"><secline lineno="72">Section 2. Section <bold>4-3-502</bold> is amended to read:</secline><catline lineno="73"><bold>4-3-502<parens/>. Exemption.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="74" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>This chapter does not apply to milk or milk products produced on the farm if such milk <ln numlevel="1" lineno="75" slineno="2-4"/>or milk products are used by:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="76" slineno="2-5" level="2"><display>(a)</display>the owner of the farm;</subsection><subsection ssid="3-null-3" dnum="b-o" numlevel="1" lineno="77" slineno="2-6" level="2"><display>(b)</display>a member of the owner's immediate family<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="admin" level="1" amendtag="both">;</amend></subsection><subsection ssid="3-9" dnum="_-o:c-e" numlevel="1" lineno="78" slineno="2-7" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="end">a nonpaying guest of the owner of the farm</amend>;</subsection><subsection ssid="3-null-4" dnum="c-o:d-e" numlevel="1" lineno="79" slineno="2-8" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1012" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1013" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display>a participant in a cow-share program; or</subsection><subsection ssid="3-null-5" dnum="d-o:e-e" numlevel="1" lineno="80" slineno="2-9" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1013" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1014" style="1" owner="e" level="1" amendtag="both" space="true">(e)</amend></display>a member of a participant in a cow-share program's immediate family.</subsection></subsection><subsection ssid="3-null-6" dnum="2-o" numlevel="1" lineno="81" slineno="2-10" level="1"><display>(2)</display>The department may not adopt a rule that restricts, limits, or imposes additional <ln numlevel="1" lineno="82" slineno="2-11"/>requirements on an individual obtaining:<subsection ssid="3-null-7" dnum="a-o" numlevel="1" lineno="83" slineno="2-12" level="2"><display>(a)</display>raw milk in accordance with the terms of a cow-share program agreement; or</subsection><subsection ssid="3-null-8" dnum="b-o" numlevel="1" lineno="84" slineno="2-13" level="2"><display>(b)</display>an interest in a cow-share program in accordance with the terms of the cow-share <ln numlevel="1" lineno="85" slineno="2-14"/>program agreement.</subsection></subsection></section></bsec><bsec buid="10" num="4-3-601" type="enact" src="code" uid="C4-3-S601_2026050620260506" sort="04 03 06010020260506" numlevel="1" lineno="86" slineno="3-1" sn="3"><section numlevel="1" lineno="88" slineno="3-3" number="4-3-601" type="enact"><secline lineno="86">Section 3. Section <bold>4-3-601</bold> is enacted to read:</secline><headpart number="4-3-6" numlevel="1" lineno="87" slineno="3-2">6. Raw Milk</headpart><catline lineno="88"><bold>4-3-601<parens/>. Definitions.</bold></catline><sectionText lineno="89"><para/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both">As used in this part:</amend></sectionText><subsection ssid="10-1" dnum="_-o:1-e" numlevel="1" lineno="90" slineno="3-5" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="54" style="1" owner="admin" level="1" amendtag="end">"Batch" means all the milk emptied from one bulk tank and bottled in a single day.</amend></subsection><subsection ssid="10-2" dnum="_-o:2-e" numlevel="1" lineno="91" slineno="3-6" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="12" style="1" owner="admin" level="1" amendtag="end">"Designated agent" means a person that under contract with a producer, without <ln numlevel="1" lineno="92" slineno="3-7"/>ownership interest, distributes, sells, delivers, holds, stores, or offers for sale the <ln numlevel="1" lineno="93" slineno="3-8"/>producer's raw milk or raw milk product.</amend></subsection><subsection ssid="10-3" dnum="_-o:3-e" numlevel="1" lineno="94" slineno="3-9" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="23" groupid="17" style="1" owner="admin" level="1" amendtag="end">"Foodborne illness outbreak" means the occurrence of two or more cases from different <ln numlevel="1" lineno="95" slineno="3-10"/>households of a similar illness resulting from the ingestion of a common food.</amend></subsection><subsection ssid="10-13" dnum="_-o:4-e" numlevel="1" lineno="96" slineno="3-11" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="admin" level="1" amendtag="end">"Premises" means the property and facilities used for the:</amend><subsection ssid="10-14" dnum="_-o:a-e" numlevel="1" lineno="97" slineno="3-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="61" style="1" owner="admin" level="1" amendtag="end">housing or milking of lactating animals; Section <bold>4-3-602</bold> is enacted to read:</secline><catline lineno="107"><bold>4-3-602<parens/>. General operational requirements.</bold></catline><subsection ssid="12-1" dnum="_-o:1-e" numlevel="1" lineno="108" slineno="4-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="admin" level="1" amendtag="end">Except as provided in Section <xref depth="3" refnumber="4-3-608">4-3-608</xref> or <xref depth="3" refnumber="4-3-609">4-3-609</xref>, a producer of raw milk or a raw milk <ln numlevel="1" lineno="109" slineno="4-4"/>product may manufacture, distribute, sell, deliver, hold, store, or offer for sale the raw <ln numlevel="1" lineno="110" slineno="4-5"/>milk or raw milk product in accordance with this part.</amend></subsection><subsection ssid="12-8" dnum="_-o:2-e" numlevel="1" lineno="111" slineno="4-6" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="34" style="1" owner="admin" level="1" amendtag="end">To engage in an activity listed in Subsection <xref depth="4" refnumber="4-3-602(1)">(1)</xref>, the producer shall:</amend><subsection ssid="12-38" dnum="_-o:a-e" numlevel="1" lineno="112" slineno="4-7" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="42" style="1" owner="admin" level="1" amendtag="end">obtain a permit from the department in accordance with Subsection <xref depth="4" refnumber="4-3-301(6)">4-3-301(6)</xref>;</amend></subsection><subsection ssid="12-37" dnum="_-o:b-e" numlevel="1" lineno="113" slineno="4-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="38" style="1" owner="admin" level="1" amendtag="end">conduct the sale and delivery of the raw milk product on the premises where the raw <ln numlevel="1" lineno="114" slineno="4-9"/>milk or raw milk product is produced, except as provided by Subsection <xref depth="4" refnumber="4-3-602(3)">(3)</xref>;</amend></subsection><subsection ssid="12-39" dnum="_-o:c-e" numlevel="1" lineno="115" slineno="4-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1031" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="46" style="1" owner="admin" level="1" amendtag="end">sell raw milk or a raw milk product to a consumer for household use and not for <ln numlevel="1" lineno="116" slineno="4-11"/>resale;</amend></subsection><subsection ssid="12-40" dnum="_-o:d-e" numlevel="1" lineno="117" slineno="4-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1032" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="50" style="1" owner="admin" level="1" amendtag="end">bottle or package raw milk or a raw milk product under sanitary conditions and in <ln numlevel="1" lineno="118" slineno="4-13"/>sanitary containers on the premises where the raw milk or raw milk product is <ln numlevel="1" lineno="119" slineno="4-14"/>produced;</amend></subsection><subsection ssid="12-41" dnum="_-o:e-e" numlevel="1" lineno="120" slineno="4-15" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1033" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><subsection ssid="12-45" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1034" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="70" style="1" owner="admin" level="1" amendtag="end">cool raw milk or the raw milk used to produce the raw milk product:</amend><subsection ssid="12-42" dnum="_-o:A-e" numlevel="1" lineno="121" slineno="4-16" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1035" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="76" groupid="58" style="1" owner="admin" level="1" amendtag="end">to 50 degrees Fahrenheit or a lower temperature within one hour after being <ln numlevel="1" lineno="122" slineno="4-17"/>drawn from the animal; and</amend></subsection><subsection ssid="12-43" dnum="_-o:B-e" numlevel="1" lineno="123" slineno="4-18" ea="amend" anum="0" owner="admin" style="1" level="4" tab="1"><display><amend anum="0" ea="amend" pairid="1036" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="62" style="1" owner="admin" level="1" amendtag="end">to 41 degrees Fahrenheit within two hours of being drawn from the animal; <ln numlevel="1" lineno="124" slineno="4-19"/>and</amend></subsection></subsection><subsection ssid="12-44" dnum="_-o:ii-e" numlevel="1" lineno="125" slineno="4-20" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="66" style="1" owner="admin" level="1" amendtag="end">maintain raw milk at 41 degrees Fahrenheit or a lower temperature until the raw <ln numlevel="1" lineno="126" slineno="4-21"/>milk is delivered to the consumer or used to produce the raw milk product;</amend></subsection></subsection><subsection ssid="12-46" dnum="_-o:f-e" numlevel="1" lineno="127" slineno="4-22" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="74" style="1" owner="admin" level="1" amendtag="end">ensure that the production of raw milk or a raw milk product conforms to <ln numlevel="1" lineno="128" slineno="4-23"/>departmental rules for the production of grade A milk products;</amend></subsection><subsection ssid="12-47" dnum="_-o:g-e" numlevel="1" lineno="129" slineno="4-24" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1039" style="1" owner="e" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="103" groupid="78" style="1" owner="admin" level="1" amendtag="end">ensure that the dairy animals on the premises are:</amend><subsection ssid="12-48" dnum="_-o:i-e" numlevel="1" lineno="130" slineno="4-25" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1040" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="82" style="1" owner="admin" level="1" amendtag="end">permanently and individually identifiable; and</amend></subsection><subsection ssid="12-49" dnum="_-o:ii-e" numlevel="1" lineno="131" slineno="4-26" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1041" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="86" style="1" owner="admin" level="1" amendtag="end">free of tuberculosis, brucellosis, and other diseases carried through milk;</amend></subsection></subsection><subsection ssid="12-50" dnum="_-o:h-e" numlevel="1" lineno="132" slineno="4-27" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1042" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="90" style="1" owner="admin" level="1" amendtag="end">ensure that any individual on the premises performing any work in connection with <ln numlevel="1" lineno="133" slineno="4-28"/>the production, bottling, packaging, handling, or sale of raw milk or a raw milk <ln numlevel="1" lineno="134" slineno="4-29"/>product is free from communicable disease;</amend></subsection><subsection ssid="12-54" dnum="_-o:i-e" numlevel="1" lineno="135" slineno="4-30" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1043" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="137" groupid="105" style="1" owner="admin" level="1" amendtag="end">refrain from offering raw milk or a raw milk product for sale until:</amend><subsection ssid="12-55" dnum="_-o:i-e" numlevel="1" lineno="136" slineno="4-31" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="109" style="1" owner="admin" level="1" amendtag="end">the department or a third party certified by the department tests each batch of raw <ln numlevel="1" lineno="137" slineno="4-32"/>milk or raw milk used to produce a raw milk product for the standard bacterial <ln numlevel="1" lineno="138" slineno="4-33"/>count and coliform count described in Section <xref depth="3" refnumber="4-3-603">4-3-603</xref>; and</amend></subsection><subsection ssid="12-56" dnum="_-o:ii-e" numlevel="1" lineno="139" slineno="4-34" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="113" style="1" owner="admin" level="1" amendtag="end">the test results meet the minimum standards established under Section <xref depth="3" refnumber="4-3-603">4-3-603</xref> for <ln numlevel="1" lineno="140" slineno="4-35"/>the tests taken under this Subsection <xref depth="4" refnumber="4-3-602(2)(i)">(2)(i)</xref>;</amend></subsection></subsection><subsection ssid="12-57" dnum="_-o:j-e" numlevel="1" lineno="141" slineno="4-36" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="e" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="152" groupid="117" style="1" owner="admin" level="1" amendtag="end">ensure that the plant complies with Chapter 5, Utah Wholesome Food Act, and the <ln numlevel="1" lineno="142" slineno="4-37"/>rules governing food establishments enacted under Section <xref depth="3" refnumber="4-5-301">4-5-301</xref>; and</amend></subsection><subsection ssid="12-58" dnum="_-o:k-e" numlevel="1" lineno="143" slineno="4-38" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="e" level="1" amendtag="start">(k)</amend></display><amend anum="0" ea="amend" pairid="158" groupid="122" style="1" owner="admin" level="1" amendtag="end">comply with the applicable rules made in accordance with Title 63G, Chapter 3, <ln numlevel="1" lineno="144" slineno="4-39"/>Utah Administrative Rulemaking Act, as authorized by this chapter.</amend></subsection></subsection><subsection ssid="12-51" dnum="_-o:3-e" numlevel="1" lineno="145" slineno="4-40" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="12-53" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="101" style="1" owner="admin" level="1" amendtag="end">A producer may distribute, sell, deliver, hold, store, or offer raw milk or a raw <ln numlevel="1" lineno="146" slineno="4-41"/>milk product from a mobile unit, if the raw milk or raw milk product is maintained <ln numlevel="1" lineno="147" slineno="4-42"/>through mechanical refrigeration at 41 degrees Fahrenheit or a lower temperature.</amend></subsection><subsection ssid="12-52" dnum="_-o:b-e" numlevel="1" lineno="148" slineno="4-43" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="127" groupid="97" style="1" owner="admin" level="1" amendtag="end">A producer may transport raw milk or a raw milk product from the premises where <ln numlevel="1" lineno="149" slineno="4-44"/>the raw milk or raw milk product is produced and sell the raw milk or raw milk <ln numlevel="1" lineno="150" slineno="4-45"/>product at a retail establishment that is inspected by the department if the producer <ln numlevel="1" lineno="151" slineno="4-46"/>ensures that the raw milk or raw milk product is transported by a designated agent, a <ln numlevel="1" lineno="152" slineno="4-47"/>third party vendor, or employee of the producer in a mobile unit with mechanical <ln numlevel="1" lineno="153" slineno="4-48"/>refrigeration where the raw milk or raw milk product is maintained at 41 degrees <ln numlevel="1" lineno="154" slineno="4-49"/>Fahrenheit or a lower temperature.</amend></subsection></subsection><subsection ssid="12-59" dnum="_-o:4-e" numlevel="1" lineno="155" slineno="4-50" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="163" groupid="125" style="1" owner="admin" level="1" amendtag="end">A person who conducts a test required by Subsection <xref depth="4" refnumber="4-3-602(2)(i)">(2)(i)</xref> shall send a copy of the test <ln numlevel="1" lineno="156" slineno="4-51"/>results to the department as soon as the test results are available.</amend></subsection></section></bsec><bsec buid="18" num="4-3-603" type="enact" src="code" uid="C4-3-S603_2026050620260506" sort="04 03 06030020260506" numlevel="1" lineno="157" slineno="5-1" sn="5"><section numlevel="1" lineno="158" slineno="5-2" number="4-3-603" type="enact"><secline lineno="157">Section 5. Suspension of permit.</bold></catline><subsection ssid="39-1" dnum="_-o:1-e" numlevel="1" lineno="197" slineno="7-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">The department shall suspend a permit issued under Section <xref depth="3" refnumber="4-3-301">4-3-301</xref> if:</amend><subsection ssid="39-3" dnum="_-o:a-e" numlevel="1" lineno="198" slineno="7-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1075" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="admin" level="1" amendtag="end">two out of four consecutive samples or two samples in a 30-day period violate <ln numlevel="1" lineno="199" slineno="7-5"/>standards established under Section <xref depth="3" refnumber="4-3-603">4-3-603</xref>; or</amend></subsection><subsection ssid="39-4" dnum="_-o:b-e" numlevel="1" lineno="200" slineno="7-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1076" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="admin" level="1" amendtag="end">a producer violates this part or a rule made by the department, in accordance with <ln numlevel="1" lineno="201" slineno="7-7"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act, as authorized by this part.</amend></subsection></subsection><subsection ssid="39-5" dnum="_-o:2-e" numlevel="1" lineno="202" slineno="7-8" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1077" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="admin" level="1" amendtag="end">The department may reissue a permit that has been suspended under this section if the <ln numlevel="1" lineno="203" slineno="7-9"/>producer:</amend><subsection ssid="39-6" dnum="_-o:a-e" numlevel="1" lineno="204" slineno="7-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="admin" level="1" amendtag="end">obtains a test result that meets the standards described in Subsections <xref depth="4" refnumber="4-3-603(1)">4-3-603(1)</xref> and <xref depth="4" refnumber="4-3-605(2)"><ln numlevel="1" lineno="205" slineno="7-11"/>(2)</xref>; and</amend></subsection><subsection ssid="39-7" dnum="_-o:b-e" numlevel="1" lineno="206" slineno="7-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1079" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="admin" level="1" amendtag="end">complies with all of the requirements of this part and rules made by the department, <ln numlevel="1" lineno="207" slineno="7-13"/>in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, as <ln numlevel="1" lineno="208" slineno="7-14"/>authorized by this part.</amend></subsection></subsection><subsection ssid="39-8" dnum="_-o:3-e" numlevel="1" lineno="209" slineno="7-15" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1080" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="admin" level="1" amendtag="end">Upon written request by a producer with a suspended permit, the department shall <ln numlevel="1" lineno="210" slineno="7-16"/>provide the producer information on how to request a hearing regarding the department's <ln numlevel="1" lineno="211" slineno="7-17"/>decision to suspend the permit.</amend></subsection></section></bsec><bsec buid="37" num="4-3-606" type="enact" src="code" uid="C4-3-S606_2026050620260506" sort="04 03 06060020260506" numlevel="1" lineno="212" slineno="8-1" sn="8"><section numlevel="1" lineno="213" slineno="8-2" number="4-3-606" type="enact"><secline lineno="212">Section 8. Section <bold>4-3-606</bold> is enacted to read:</secline><catline lineno="213"><bold>4-3-606<parens/>. Foodborne illness outbreak -- Cease and desist.</bold></catline><subsection ssid="37-20-79" dnum="_-o:1-e" numlevel="1" lineno="214" slineno="8-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn" space="false"><display><amend anum="0" ea="amend" pairid="1081" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><subsection ssid="37-20-80" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1082" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="1" owner="admin" level="1" amendtag="end">Nothing in this chapter shall impede the Department of Health and Human <ln numlevel="1" lineno="215" slineno="8-4"/>Services or the department in an investigation of a foodborne illness outbreak.</amend></subsection><subsection ssid="37-20-81" dnum="_-o:b-e" numlevel="1" lineno="216" slineno="8-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1083" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="4-3-605(1)(a)">(1)(a)</xref>, if the Department of Health and Human Services <ln numlevel="1" lineno="217" slineno="8-6"/>or the department uses a survey to determine whether there is a foodborne illness <ln numlevel="1" lineno="218" slineno="8-7"/>outbreak linked to raw milk or a raw milk product, the survey shall include questions <ln numlevel="1" lineno="219" slineno="8-8"/>that probe the common sources of the implicated pathogen for the foodborne illness <ln numlevel="1" lineno="220" slineno="8-9"/>outbreak.</amend></subsection></subsection><subsection ssid="37-20-82" dnum="_-o:2-e" numlevel="1" lineno="221" slineno="8-10" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><subsection ssid="37-20-83" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="282" groupid="215" style="1" owner="admin" level="1" amendtag="end">The department shall issue a cease and desist order to a producer prohibiting the <ln numlevel="1" lineno="222" slineno="8-11"/>sale of raw milk or a raw milk product if after the investigation of a foodborne illness <ln numlevel="1" lineno="223" slineno="8-12"/>outbreak the department links the foodborne illness outbreak to a producer pending <ln numlevel="1" lineno="224" slineno="8-13"/>testing required by Subsection <xref depth="4" refnumber="4-3-606(4)">(4)</xref>.</amend></subsection><subsection ssid="37-125" dnum="_-o:b-e" numlevel="1" lineno="225" slineno="8-14" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="356" groupid="274" style="1" owner="admin" level="1" amendtag="end">For purposes of the cease and desist order, to positively link a producer to a <ln numlevel="1" lineno="226" slineno="8-15"/>foodborne illness outbreak, the department shall produce evidence from the <ln numlevel="1" lineno="227" slineno="8-16"/>investigation under Subsection <xref depth="4" refnumber="4-3-606(1)">(1)</xref> that the foodborne illness outbreak originated with <ln numlevel="1" lineno="228" slineno="8-17"/>the producer's raw milk or raw milk product.</amend></subsection><subsection ssid="37-126" dnum="_-o:c-e" numlevel="1" lineno="229" slineno="8-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="361" groupid="278" style="1" owner="admin" level="1" amendtag="end">A producer who receives a cease and desist order from the department shall stop the <ln numlevel="1" lineno="230" slineno="8-19"/>sale of the raw milk product named in the cease and desist order.</amend></subsection></subsection><subsection ssid="37-137" dnum="_-o:3-e" numlevel="1" lineno="231" slineno="8-20" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="37-146" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="445" groupid="345" style="1" owner="admin" level="1" amendtag="end">Subject to the requirements of Subsection <xref depth="4" refnumber="4-3-606(3)(b)">(3)(b)</xref>, the following may notify the <ln numlevel="1" lineno="232" slineno="8-21"/>public of a foodborne illness outbreak linked to raw milk or a raw milk product:</amend><subsection ssid="37-147" dnum="_-o:i-e" numlevel="1" lineno="233" slineno="8-22" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="450" groupid="349" style="1" owner="admin" level="1" amendtag="end">the department;</amend></subsection><subsection ssid="37-148" dnum="_-o:ii-e" numlevel="1" lineno="234" slineno="8-23" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="455" groupid="353" style="1" owner="admin" level="1" amendtag="end">the Department of Health and Human Services in accordance with Section <xref depth="3" refnumber="26B-1-202"><ln numlevel="1" lineno="235" slineno="8-24"/>26B-1-202</xref>; and</amend></subsection><subsection ssid="37-149" dnum="_-o:iii-e" numlevel="1" lineno="236" slineno="8-25" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="460" groupid="357" style="1" owner="admin" level="1" amendtag="end">a local health department.</amend></subsection></subsection><subsection ssid="37-150" dnum="_-o:b-e" numlevel="1" lineno="237" slineno="8-26" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="465" groupid="361" style="1" owner="admin" level="1" amendtag="end">Before an agency listed in Subsection <xref depth="4" refnumber="4-3-606(3)(a)">(3)(a)</xref> may publicly disclose a producer's name <ln numlevel="1" lineno="238" slineno="8-27"/>or identifying information, the department shall notify the producer that the <ln numlevel="1" lineno="239" slineno="8-28"/>department has linked the producer to a foodborne illness outbreak with a positive <ln numlevel="1" lineno="240" slineno="8-29"/>whole genome sequencing test.</amend></subsection><subsection ssid="37-151" dnum="_-o:c-e" numlevel="1" lineno="241" slineno="8-30" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="470" groupid="365" style="1" owner="admin" level="1" amendtag="end">Before publicly disclosing a producer's name or identifying information under <ln numlevel="1" lineno="242" slineno="8-31"/>Subsection <xref depth="4" refnumber="4-3-606(3)(b)">(3)(b)</xref>, the Department of Health and Human Services or a local health <ln numlevel="1" lineno="243" slineno="8-32"/>department shall verify that the department notified the producer that the department <ln numlevel="1" lineno="244" slineno="8-33"/>has linked the producer to a foodborne illness with a positive whole genome <ln numlevel="1" lineno="245" slineno="8-34"/>sequencing test.</amend></subsection></subsection><subsection ssid="37-138" dnum="_-o:4-e" numlevel="1" lineno="246" slineno="8-35" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><subsection ssid="37-139" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="425" groupid="329" style="1" owner="admin" level="1" amendtag="end">A cease and desist order shall remain in effect until the department:</amend><subsection ssid="37-140" dnum="_-o:i-e" numlevel="1" lineno="247" slineno="8-36" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="430" groupid="333" style="1" owner="admin" level="1" amendtag="end">verifies that the producer who is subject to the cease and desist order adheres to <ln numlevel="1" lineno="248" slineno="8-37"/>this part and has three consecutive tests of the raw milk product that show that the <ln numlevel="1" lineno="249" slineno="8-38"/>raw milk product meets the standards described in Subsections <xref depth="4" refnumber="4-3-603(1)">4-3-603(1)</xref> and <xref depth="4" refnumber="4-3-606(2)">(2)</xref> <ln numlevel="1" lineno="250" slineno="8-39"/>and is free of the pathogens listed in Subsection <xref depth="4" refnumber="4-3-603(3)">4-3-603(3)</xref>; or</amend></subsection><subsection ssid="37-141" dnum="_-o:ii-e" numlevel="1" lineno="251" slineno="8-40" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1098" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="435" groupid="337" style="1" owner="admin" level="1" amendtag="end">receives a genome sequencing test result that demonstrates that the producer's raw <ln numlevel="1" lineno="252" slineno="8-41"/>milk product is not linked to the foodborne illness outbreak that is the subject of <ln numlevel="1" lineno="253" slineno="8-42"/>the cease and desist order.</amend></subsection></subsection><subsection ssid="37-142" dnum="_-o:b-e" numlevel="1" lineno="254" slineno="8-43" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1099" style="1" owner="e" level="1" cease and desist order that <ln numlevel="1" lineno="255" slineno="8-44"/>the cease and desist order is not in effect within one working day of the conditions of <ln numlevel="1" lineno="256" slineno="8-45"/>Subsection <xref depth="4" refnumber="4-3-606(4)(a)">(4)(a)</xref> being met.</amend></subsection></subsection><subsection ssid="37-20-108" dnum="_-o:5-e" numlevel="1" lineno="257" slineno="8-46" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><subsection ssid="37-20-109" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="78" groupid="62" style="1" owner="admin" level="1" amendtag="end">The department shall collect a sample within two working days of issuing a cease <ln numlevel="1" lineno="258" slineno="8-47"/>and desist order for the purpose of the department testing or submitting the sample to <ln numlevel="1" lineno="259" slineno="8-48"/>a laboratory for testing, at the discretion of the producer:</amend><subsection ssid="37-20-110" dnum="_-o:i-e" numlevel="1" lineno="260" slineno="8-49" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="54" style="1" owner="admin" level="1" amendtag="end">for purposes of testing for a pathogen listed in Subsection <xref depth="4" refnumber="4-3-603(3)">4-3-603(3)</xref>; and</amend></subsection><subsection ssid="37-20-111" dnum="_-o:ii-e" numlevel="1" lineno="261" slineno="8-50" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="58" style="1" owner="admin" level="1" amendtag="end">if the department wants to publicly disclose a producer's name or identifying <ln numlevel="1" lineno="262" slineno="8-51"/>information under Subsection <xref depth="4" refnumber="4-3-606(3)">(3)</xref>, whole genome sequencing testing.</amend></subsection></subsection><subsection ssid="37-20-112" dnum="_-o:b-e" numlevel="1" lineno="263" slineno="8-52" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="153" groupid="120" style="1" owner="admin" level="1" amendtag="end">For purposes of a test described in Subsection <xref depth="4" refnumber="4-3-606(4)(a)(i)">(4)(a)(i)</xref>, the department shall collect a <ln numlevel="1" lineno="264" slineno="8-53"/>sample for each test within two working days of the producer requesting that a <ln numlevel="1" lineno="265" slineno="8-54"/>sample be collected.</amend></subsection><subsection ssid="37-20-113" dnum="_-o:c-e" numlevel="1" lineno="266" slineno="8-55" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="83" groupid="66" style="1" owner="admin" level="1" amendtag="end">The time between the department collecting the sample under Subsection <xref depth="4" refnumber="4-3-606(5)(a)(ii)">(5)(a)(ii)</xref> <ln numlevel="1" lineno="267" slineno="8-56"/>and the department notifying the producer of whole genome sequencing test results <ln numlevel="1" lineno="268" slineno="8-57"/>may not exceed 15 working days unless, before the 15-working day period expires, <ln numlevel="1" lineno="269" slineno="8-58"/>the department notifies the producer in writing that the department requires additional <ln numlevel="1" lineno="270" slineno="8-59"/>time to notify the producer of the whole genome sequencing test results.</amend></subsection><subsection ssid="37-20-114" dnum="_-o:d-e" numlevel="1" lineno="271" slineno="8-60" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><subsection ssid="37-20-115" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="74" style="1" owner="admin" level="1" amendtag="end">Upon the producer's request and the producer being liable for the costs of the <ln numlevel="1" lineno="272" slineno="8-61"/>second laboratory, the department shall have the sample collected under <ln numlevel="1" lineno="273" slineno="8-62"/>Subsection <xref depth="4" refnumber="4-3-606(5)(a)">(5)(a)</xref> analyzed by two laboratories.</amend></subsection><subsection ssid="37-20-116" dnum="_-o:ii-e" numlevel="1" lineno="274" slineno="8-63" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="78" style="1" owner="admin" level="1" amendtag="end">The producer shall select the second laboratory from a list of laboratories <ln numlevel="1" lineno="275" slineno="8-64"/>approved by the department.</amend></subsection></subsection></subsection><subsection ssid="37-20-124" dnum="_-o:6-e" numlevel="1" lineno="276" slineno="8-65" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="e" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="155" style="1" owner="admin" level="1" amendtag="end">Upon written request by a producer with a cease and desist order, the department shall <ln numlevel="1" lineno="277" slineno="8-66"/>provide the producer information on how to request a hearing regarding the department's <ln numlevel="1" lineno="278" slineno="8-67"/>decision to issue the cease and desist groupid="77" style="1" owner="admin" level="1" amendtag="end">building and premises requirements;</amend></subsection><subsection ssid="35-56" dnum="_-o:iii-e" numlevel="1" lineno="285" slineno="9-7" ea="amend" pairid="103" groupid="81" style="1" owner="admin" level="1" amendtag="end">sanitation and operating requirements, including bulk milk tank requirements;</amend></subsection><subsection ssid="35-57" dnum="_-o:iv-e" numlevel="1" lineno="286" slineno="9-8" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="108" groupid="85" style="1" owner="admin" level="1" amendtag="end">additional tests;</amend></subsection><subsection ssid="35-58" dnum="_-o:v-e" numlevel="1" lineno="287" slineno="9-9" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="113" groupid="89" style="1" owner="admin" level="1" amendtag="end">use of a third-party testing laboratory within or outside of the state;</amend></subsection><subsection ssid="35-59" dnum="_-o:vi-e" numlevel="1" lineno="288" slineno="9-10" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1117" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="118" groupid="93" style="1" owner="admin" level="1" amendtag="end">frequency of inspections, including random cooler checks;</amend></subsection><subsection ssid="35-60" dnum="_-o:vii-e" numlevel="1" lineno="289" slineno="9-11" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1118" style="1" owner="e" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="123" groupid="97" style="1" owner="admin" level="1" amendtag="end">recordkeeping; and</amend></subsection><subsection ssid="35-61" dnum="_-o:viii-e" numlevel="1" lineno="290" slineno="9-12" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1119" style="1" owner="e" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="128" groupid="101" style="1" owner="admin" level="1" amendtag="end">packaging and labeling.</amend></subsection></subsection><subsection ssid="35-63" dnum="_-o:b-e" numlevel="1" lineno="291" slineno="9-13" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1120" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="138" groupid="109" style="1" owner="admin" level="1" amendtag="end">The department may make rules, in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="292" slineno="9-14"/>Administrative Rulemaking Act, regarding the standards of identity for a raw milk <ln numlevel="1" lineno="293" slineno="9-15"/>product.</amend></subsection><subsection ssid="35-68" dnum="_-o:c-e" numlevel="1" lineno="294" slineno="9-16" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="160" groupid="126" style="1" owner="admin" level="1" amendtag="end">A producer operating under Section <xref depth="3" refnumber="4-3-608">4-3-608</xref> or <xref depth="3" refnumber="4-3-609">4-3-609</xref> is exempt from a rule made <ln numlevel="1" lineno="295" slineno="9-17"/>by the department under this part.</amend></subsection></subsection><subsection ssid="35-65" dnum="_-o:2-e" numlevel="1" lineno="296" slineno="9-18" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><subsection ssid="35-67" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1123" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="156" groupid="123" style="1" owner="admin" level="1" amendtag="end">The department may establish and collect a fee in accordance with Section <xref depth="3" refnumber="63J-1-504"><ln numlevel="1" lineno="297" slineno="9-19"/>63J-1-504</xref> for the testing or an inspection conducted in accordance with this part.</amend></subsection><subsection ssid="35-66" dnum="_-o:b-e" numlevel="1" lineno="298" slineno="9-20" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="118" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Section <xref depth="3" refnumber="63J-1-504">63J-1-504</xref>, the department shall retain the fee imposed <ln numlevel="1" lineno="299" slineno="9-21"/>under this Subsection <xref depth="4" refnumber="4-3-607(2)">(2)</xref> as a dedicated credit and may only use the fee to administer <ln numlevel="1" lineno="300" slineno="9-22"/>and enforce this part.</amend></subsection></subsection><subsection ssid="35-22-44" dnum="_-o:3-e" numlevel="1" lineno="301" slineno="9-23" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="35-22-45" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="31" groupid="24" style="1" owner="admin" level="1" amendtag="end">If the Department of Health and Human Services or the department links a <ln numlevel="1" lineno="302" slineno="9-24"/>producer's raw milk or raw milk product to a foodborne illness outbreak and the <ln numlevel="1" lineno="303" slineno="9-25"/>department finds that the producer has violated this part, the department may impose <ln numlevel="1" lineno="304" slineno="9-26"/>upon the producer the following administrative penalties:</amend><subsection ssid="35-22-46" dnum="_-o:i-e" numlevel="1" lineno="305" slineno="9-27" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1127" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="28" style="1" owner="admin" level="1" amendtag="end">upon the first violation, a penalty of no more than $300;</amend></subsection><subsection ssid="35-22-47" dnum="_-o:ii-e" numlevel="1" lineno="306" slineno="9-28" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1128" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="32" style="1" owner="admin" level="1" amendtag="end">upon a second violation, a penalty of no more than $750; and</amend></subsection><subsection ssid="35-22-48" dnum="_-o:iii-e" numlevel="1" lineno="307" slineno="9-29" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1129" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="36" style="1" owner="admin" level="1" amendtag="end">upon a third or subsequent violation, a penalty of no more than $1,500.</amend></subsection></subsection><subsection ssid="35-22-49" dnum="_-o:b-e" numlevel="1" lineno="308" slineno="9-30" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1130" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="51" groupid="40" style="1" owner="admin" level="1" amendtag="end">The department may impose the penalties described in Subsection <xref depth="4" refnumber="4-3-607(2)(a)">(2)(a)</xref> in addition <ln numlevel="1" lineno="309" slineno="9-31"/>to:</amend><subsection ssid="35-51" dnum="_-o:i-e" numlevel="1" lineno="310" slineno="9-32" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="63" style="1" owner="admin" level="1" amendtag="end">suspending a permit under Section <xref depth="3" refnumber="4-3-605">4-3-605</xref>; or</amend></subsection><subsection ssid="35-52" dnum="_-o:ii-e" numlevel="1" lineno="311" slineno="9-33" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1132" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="85" groupid="67" style="1" owner="admin" level="1" amendtag="end">issuing a cease and desist order under Section <xref depth="3" refnumber="4-3-606">4-3-606</xref>.</amend></subsection></subsection></subsection></section></bsec><bsec buid="33" num="4-3-608" type="enact" src="code" uid="C4-3-S608_2026050620260506" or</amend></subsection><subsection ssid="33-34" dnum="_-o:b-e" numlevel="1" lineno="317" slineno="10-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="92" groupid="73" style="1" owner="admin" level="1" amendtag="end">meeting the requirements of Sections <xref depth="3" refnumber="4-3-602">4-3-602</xref> through <xref depth="3" refnumber="4-3-605">4-3-605</xref>.</amend></subsection></subsection><subsection ssid="33-24-18" dnum="_-o:2-e" numlevel="1" lineno="318" slineno="10-7" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">To be exempt under this section, the producer shall:</amend><subsection ssid="33-24-19" dnum="_-o:a-e" numlevel="1" lineno="319" slineno="10-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="admin" level="1" amendtag="end">sell the raw milk or raw milk product to a consumer for household use and not for <ln numlevel="1" lineno="320" slineno="10-9"/>resale;</amend></subsection><subsection ssid="33-24-20" dnum="_-o:b-e" numlevel="1" lineno="321" slineno="10-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="22" groupid="17" style="1" owner="admin" level="1" amendtag="end">sell and deliver the raw milk or raw milk product upon the premises where the raw <ln numlevel="1" lineno="322" slineno="10-11"/>milk or raw milk product is produced, except the producer may use a designated <ln numlevel="1" lineno="323" slineno="10-12"/>agent to deliver the raw milk or raw milk product directly to the consumer who <ln numlevel="1" lineno="324" slineno="10-13"/>purchases the raw milk or raw milk product;</amend></subsection><subsection ssid="33-24-21" dnum="_-o:c-e" numlevel="1" lineno="325" slineno="10-14" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1139" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="admin" level="1" amendtag="end">label the raw milk or raw milk product with:</amend><subsection ssid="33-24-22" dnum="_-o:i-e" numlevel="1" lineno="326" slineno="10-15" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1140" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="32" groupid="25" style="1" owner="admin" level="1" amendtag="end">the producer's name and address;</amend></subsection><subsection ssid="33-24-23" dnum="_-o:ii-e" numlevel="1" lineno="327" slineno="10-16" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1141" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="37" groupid="29" style="1" owner="admin" level="1" amendtag="end">a date, no more than nine days after the raw milk or raw milk product is <ln numlevel="1" lineno="328" slineno="10-17"/>produced, by which the raw milk or raw milk product should be sold;</amend></subsection><subsection ssid="33-24-24" dnum="_-o:iii-e" numlevel="1" lineno="329" slineno="10-18" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1142" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="42" groupid="33" style="1" owner="admin" level="1" amendtag="end">the statement: "This raw milk or raw milk product has not been licensed or <ln numlevel="1" lineno="330" slineno="10-19"/>inspected by the state of Utah. Raw milk or a raw milk product, no matter how <ln numlevel="1" lineno="331" slineno="10-20"/>carefully produced, may be unsafe."; and</amend></subsection><subsection ssid="33-24-25" dnum="_-o:iv-e" numlevel="1" lineno="332" slineno="10-21" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1143" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="admin" level="1" amendtag="end">handling instructions to preserve quality and avoid contamination or spoilage;</amend></subsection></subsection><subsection ssid="33-24-26" dnum="_-o:d-e" numlevel="1" lineno="333" slineno="10-22" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="41" style="1" owner="admin" level="1" amendtag="end">cool the raw milk or raw milk used to produce a raw milk product:</amend><subsection ssid="33-24-27" dnum="_-o:i-e" numlevel="1" lineno="334" slineno="10-23" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1145" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="45" style="1" owner="admin" level="1" amendtag="end">to 50 degrees Fahrenheit or a lower temperature within one hour after being drawn <ln numlevel="1" lineno="335" slineno="10-24"/>from the animal; and</amend></subsection><subsection ssid="33-24-28" dnum="_-o:ii-e" numlevel="1" lineno="336" slineno="10-25" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1146" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="49" style="1" owner="admin" level="1" amendtag="end">to 41 degrees Fahrenheit or a lower temperature within two hours of being drawn <ln numlevel="1" lineno="337" slineno="10-26"/>from the animal;</amend></subsection></subsection><subsection ssid="33-24-29" dnum="_-o:e-e" numlevel="1" lineno="338" slineno="10-27" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1147" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="53" style="1" owner="admin" level="1" amendtag="end">conduct a monthly test ensuring the coliform count of the raw milk or the raw milk <ln numlevel="1" lineno="339" slineno="10-28"/>used to produce a raw milk product does not exceed 10 colony-forming units per <ln numlevel="1" lineno="340" slineno="10-29"/>milliliter;</amend></subsection><subsection ssid="33-24-30" dnum="_-o:f-e" numlevel="1" lineno="341" slineno="10-30" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1148" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="57" style="1" owner="admin" level="1" amendtag="end">ensure that the dairy animals on the producer's premises are free of tuberculosis, <ln numlevel="1" lineno="342" slineno="10-31"/>brucellosis, and other diseases carried through milk;</amend></subsection><subsection ssid="33-24-31" dnum="_-o:g-e" numlevel="1" lineno="343" slineno="10-32" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1149" style="1" owner="e" level="1" amendtag="start">(g)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="admin" level="1" amendtag="end">maintain records of tests for a minimum of six months; and</amend></subsection><subsection ssid="33-24-32" dnum="_-o:h-e" numlevel="1" lineno="344" slineno="10-33" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1150" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="65" style="1" owner="admin" level="1" amendtag="end">notify the department of the producer's intent to sell raw milk or a raw milk product <ln numlevel="1" lineno="345" slineno="10-34"/>in accordance with this section and include in the notification the producer's name <ln numlevel="1" lineno="346" slineno="10-35"/>and address.</amend></subsection></subsection></section></bsec><bsec buid="43" num="4-3-609" type="enact" src="code" uid="C4-3-S609_2026050620260506" sort="04 03 06090020260506" numlevel="1" lineno="347" slineno="11-1" sn="11"><section numlevel="1" lineno="348" slineno="11-2" number="4-3-609" type="enact"><secline lineno="347">Section 11. Section <bold>4-3-609</bold> is enacted to read:</secline><catline lineno="348"><bold>4-3-609<parens/>. Exemption for small producers.</bold></catline><subsection ssid="43-14" dnum="_-o:1-e" numlevel="1" lineno="350" slineno="11-4" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1151" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="4-3-609(2)">(2)</xref>, notwithstanding the other provisions of this part, a <ln numlevel="1" lineno="351" slineno="11-5"/>producer may manufacture, distribute, sell, deliver, hold, store, or offer for sale raw milk <ln numlevel="1" lineno="352" slineno="11-6"/>or a raw milk product without obtaining a permit or complying with this part if:</amend><subsection ssid="43-12" dnum="_-o:a-e" nextssid="43-12" numlevel="1" lineno="353" slineno="11-7" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1152" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="37" style="1" owner="admin" level="1" amendtag="end"> the producer produces 500 gallons of raw milk or less in a month that the producer:</amend><subsection ssid="43-1" dnum="_-o:i-e" numlevel="1" lineno="354" slineno="11-8" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="end">maintains as raw milk; or</amend></subsection><subsection ssid="43-2" dnum="_-o:ii-e" numlevel="1" lineno="355" slineno="11-9" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="admin" level="1" amendtag="end">uses to produce a raw milk product; and</amend></subsection></subsection><subsection ssid="43-13" dnum="_-o:b-e" nextssid="43-13" numlevel="1" lineno="356" slineno="11-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="62" style="1" owner="admin" level="1" amendtag="end">the producer sells and delivers the raw milk or raw milk product upon the premises <ln numlevel="1" lineno="357" slineno="11-11"/>where the raw milk or raw milk product is produced.</amend></subsection></subsection><subsection ssid="43-19" dnum="_-o:2-e" numlevel="1" lineno="358" slineno="11-12" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="66" style="1" owner="admin" level="1" amendtag="end">A producer exempt from this part under Subsection <xref depth="4" refnumber="4-3-609(1)">(1)</xref>:</amend><subsection ssid="43-15" dnum="_-o:a-e" nextssid="43-15" numlevel="1" lineno="359" slineno="11-13" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1157" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="82" groupid="60" style="1" owner="admin" level="1" amendtag="end">is subject to Section <xref depth="3" refnumber="4-3-606">4-3-606</xref>; and</amend></subsection><subsection ssid="43-18" dnum="_-o:b-e" nextssid="43-18" numlevel="1" lineno="360" slineno="11-14" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="59" style="1" owner="admin" level="1" amendtag="end">shall notify the department of the producer's intent to operate under the exemption of <ln numlevel="1" lineno="361" slineno="11-15"/>Subsection <xref depth="4" refnumber="4-3-609(1)">(1)</xref> by providing the department:</amend><subsection ssid="43-16" dnum="_-o:i-e" nextssid="43-16" numlevel="1" lineno="362" slineno="11-16" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="87" groupid="65" style="1" owner="admin" level="1" amendtag="end">the producer's name; and</amend></subsection><subsection ssid="43-17" dnum="_-o:ii-e" nextssid="43-17" numlevel="1" lineno="363" slineno="11-17" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="64" style="1" owner="admin" level="1" amendtag="end">a valid, current address of the location where the producer is operating under the <ln numlevel="1" lineno="364" slineno="11-18"/>exemption of Subsection <xref depth="4" refnumber="4-3-609(1)">(1)</xref>.</amend></subsection></subsection></subsection></section></bsec><bsec buid="41" num="4-3-610" type="enact" src="code" uid="C4-3-S610_2026050620260506" sort="04 03 06100020260506" numlevel="1" lineno="365" slineno="12-1" sn="12"><section numlevel="1" lineno="366" slineno="12-2" number="4-3-610" type="enact"><secline lineno="365">Section 12.
