anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="e" level="1" amendtag="start">(xii)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="61" style="1" owner="admin" level="1" amendtag="end">intellectual property rights, fair use, and creative commons in digital <ln numlevel="1" lineno="52" amendtag="start">(xv)</amend></display><amend anum="0" ea="amend" pairid="360" groupid="283" style="1" owner="admin" level="1" amendtag="end">traditional and digital media literacy, including critical evaluation of television, <ln numlevel="1" lineno="56" slineno="1-33"/>film, music, streaming content, and short-form video platforms; and</amend></subsection><subsection ssid="3-21" dnum="_-o:xvi-e" numlevel="1" lineno="57" slineno="1-34" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="e" level="1" amendtag="start">(xvi)</amend></display><amend anum="0" ea="amend" pairid="107" groupid="85" style="1" owner="admin" level="1" amendtag="end">economic and career implications of digital literacy in a technology-driven <ln numlevel="1" lineno="58" slineno="1-35"/>society.</amend></subsection></subsection><subsection ssid="3-22" dnum="_-o:c-e" numlevel="1" lineno="59" slineno="1-36" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="361" groupid="284" style="1" owner="admin" level="1" amendtag="end">"Digital skills course" means a course offered in grade 7 or 8 that incorporates digital <ln numlevel="1" lineno="60" slineno="1-37"/>skills concepts.</amend></subsection></subsection><subsection ssid="3-73" dnum="_-o:2-e" numlevel="1" lineno="61" slineno="1-38" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="366" groupid="286" style="1" owner="admin" level="1" amendtag="end">Beginning with the 2027-2028 school year, the state board shall have established <ln numlevel="1" lineno="62" slineno="1-39"/>standards for a digital skills course that an LEA offers in grade 7 or 8.</amend></subsection><subsection ssid="3-74" dnum="_-o:3-e" numlevel="1" lineno="63" slineno="1-40" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="3-75" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="369" groupid="287" style="1" owner="admin" level="1" amendtag="end">The state superintendent may establish an advisory tech council to provide <ln numlevel="1" lineno="64" slineno="1-41"/>guidance and recommendations on technology education in the state's public <ln numlevel="1" lineno="65" slineno="1-42"/>education system.</amend></subsection><subsection ssid="3-84" dnum="_-o:b-e" numlevel="1" lineno="66" slineno="1-43" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="420" groupid="325" style="1" owner="admin" level="1" amendtag="end">The advisory tech council established under Subsection <xref depth="4" refnumber="53E-4-208(3)(a)">(3)(a)</xref> shall include <ln numlevel="1" lineno="67" slineno="1-44"/>membership the state superintendent selects.</amend></subsection><subsection ssid="3-83" dnum="_-o:c-e" numlevel="1" lineno="68" slineno="1-45" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="415" groupid="321" style="1" owner="admin" level="1" amendtag="end">The advisory tech council may:</amend><subsection ssid="3-85" dnum="_-o:i-e" numlevel="1" lineno="69" slineno="1-46" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1025" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="425" groupid="329" style="1" owner="admin" level="1" amendtag="end">review and recommend standards and objectives for the digital skills course and <ln numlevel="1" lineno="70" slineno="1-47"/>other technology related education;</amend></subsection><subsection ssid="3-86" dnum="_-o:ii-e" numlevel="1" lineno="71" slineno="1-48" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1026" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="430" groupid="333" style="1" owner="admin" level="1" amendtag="end">identify effective digital skills curriculum and instructional resources;</amend></subsection><subsection ssid="3-87" dnum="_-o:iii-e" numlevel="1" lineno="72" slineno="1-49" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="435" groupid="337" style="1" owner="admin" level="1" amendtag="end">recommend professional development opportunities for educators teaching <ln numlevel="1" lineno="73" slineno="1-50"/>digital skills;</amend></subsection><subsection ssid="3-88" dnum="_-o:iv-e" numlevel="1" lineno="74" slineno="1-51" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1028" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="440" groupid="341" style="1" owner="admin" level="1" amendtag="end">advise on emerging technologies and trends that should be incorporated into <ln numlevel="1" lineno="75" slineno="1-52"/>digital skills education;</amend></subsection><subsection ssid="3-89" dnum="_-o:v-e" numlevel="1" lineno="76" slineno="1-53" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1029" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="445" groupid="345" style="1" owner="admin" level="1" amendtag="end">coordinate with interested public, private, and nonprofit entities to improve digital <ln numlevel="1" lineno="77" slineno="1-54"/>skills education; and</amend></subsection><subsection ssid="3-90" dnum="_-o:vi-e" numlevel="1" lineno="78" slineno="1-55" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="450" groupid="349" style="1" owner="admin" level="1" amendtag="end">make recommendations to the state board on methods to assess student <ln numlevel="1" lineno="79" slineno="1-56"/>proficiency in digital skills.</amend></subsection></subsection></subsection></section></bsec><bsec buid="7" num="53F-2-510" type="amend" src="code" uid="C53F-2-S510_2026050620260506" sort="53F02 05100020260506" numlevel="1" lineno="80" slineno="2-1" sn="2"><section number="53F-2-510" numlevel="1" lineno="81" slineno="2-2" type="amend"><secline lineno="80">Section 2. Section <bold>53F-2-510</bold> is amended to read:</secline><catline lineno="81"><bold>53F-2-510<parens/>. Digital Teaching and Learning Grant Program.</bold></catline><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="82" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="7-null-2" dnum="a-o:_-e" numlevel="1" lineno="83" slineno="2-4" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1032" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="admin" level="1" deltag="end">"Advisory committee" means the committee established by the state board under <ln numlevel="1" lineno="84" slineno="2-5"/>Subsection <xref depth="4" refnumber="53F-2-510(6)(b)" start="0">(6)(b)</xref>.</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-3" dnum="b-o:a-e" numlevel="1" lineno="85" slineno="2-6" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1033" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1034" style="1" owner="e" level="1" amendtag="both" space="true">(a)</amend></display>"Digital readiness assessment" means an assessment provided by the state board <ln numlevel="1" lineno="86" slineno="2-7"/>that:<subsection ssid="7-null-4" dnum="i-o" numlevel="1" lineno="87" slineno="2-8" level="3"><display>(i)</display>is completed by an LEA analyzing an LEA's readiness to incorporate <ln numlevel="1" lineno="88" slineno="2-9"/>comprehensive digital teaching and learning; and</subsection><subsection ssid="7-null-5" dnum="ii-o" numlevel="1" lineno="89" slineno="2-10" level="3"><display>(ii)</display>informs the preparation of an LEA's plan for incorporating comprehensive digital <ln numlevel="1" lineno="90" slineno="2-11"/>teaching and learning.</subsection></subsection><subsection ssid="7-null-6" dnum="c-o:b-e" numlevel="1" lineno="91" slineno="2-12" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1036" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1037" style="1" owner="e" level="1" amendtag="both" space="true">(b)</amend></display>"High quality professional learning" means the professional learning standards <ln numlevel="1" lineno="92" slineno="2-13"/>described in Section <xref depth="3" refnumber="53G-11-303" pairid="1037" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1038" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>"Implementation assessment" means an assessment that analyzes an LEA's <ln numlevel="1" lineno="94" slineno="2-15"/>implementation of an LEA plan, including identifying areas for improvement, <ln numlevel="1" lineno="95" slineno="2-16"/>obstacles to implementation, progress toward the achievement of stated goals, and <ln numlevel="1" lineno="96" slineno="2-17"/>recommendations going forward.</subsection><subsection ssid="7-null-8" dnum="e-o:d-e" numlevel="1" lineno="97" slineno="2-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1038" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1039" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display>"LEA plan" means an LEA's plan to implement a digital teaching and learning <ln numlevel="1" lineno="98" slineno="2-19"/>program that meets the requirements of this section and requirements set forth by the <ln numlevel="1" lineno="99" slineno="2-20"/>state board and the advisory committee.</subsection><subsection ssid="7-null-9" dnum="f-o:e-e" numlevel="1" lineno="100" slineno="2-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1039" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1040" style="1" owner="e" level="1" amendtag="both" space="true">(e)</amend></display>"Program" means the Digital Teaching and Learning Grant Program created and <ln numlevel="1" lineno="101" slineno="2-22"/>described in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="74" groupid="40" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(5)" start="0">(5)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="64" groupid="30" style="1" owner="admin" level="1" amendtag="both" space="true">(4)</amend> through <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="75" groupid="41" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(10)" start="0">(10)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="31" style="1" owner="admin" level="1" amendtag="both" space="true">(9)</amend>.</subsection><subsection ssid="7-null-10" dnum="g-o:f-e" numlevel="1" lineno="102" slineno="2-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" space="true">(f)</amend></display>"Utah Education and Telehealth Network" or "UETN" means the Utah <ln numlevel="1" lineno="103" slineno="2-24"/>Education and Telehealth Network created in Section <xref depth="3" refnumber="53H-4-213.4">53H-4-213.4</xref>.</subsection></subsection><subsection ssid="7-null-11" dnum="2-o:_-e" numlevel="1" lineno="104" slineno="2-25" ea="erase" anum="0" owner="admin" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="start">(2)</amend></display><subsection ssid="7-null-12" dnum="a-o:_-e" ea="erase" anum="0" owner="admin" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="20" groupid="10" style="2" owner="admin" level="1" deltag="end">The state board shall establish a digital teaching and learning task force to <ln numlevel="1" lineno="105" slineno="2-26"/>develop a funding proposal to present to the Legislature for digital teaching and <ln numlevel="1" lineno="106" slineno="2-27"/>learning in elementary and secondary schools.</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-13" dnum="b-o:_-e" numlevel="1" lineno="107" slineno="2-28" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1043" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="21" groupid="11" style="2" owner="admin" level="1" deltag="end">The digital teaching and learning task force shall include representatives of:</amend><amendoutend style="2"/><subsection ssid="7-null-14" dnum="i-o:_-e" numlevel="1" lineno="108" slineno="2-29" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1044" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="22" groupid="12" style="2" owner="admin" level="1" deltag="end">the state board;</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-15" dnum="ii-o:_-e" numlevel="1" lineno="109" slineno="2-30" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1045" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="23" groupid="13" style="2" owner="admin" level="1" deltag="end">UETN;</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-16" dnum="iii-o:_-e" numlevel="1" lineno="110" slineno="2-31" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1046" style="2" owner="o" level="1" deltag="start">(iii)</amend></display><amend anum="0" ea="erase" pairid="24" groupid="14" style="2" owner="admin" level="1" deltag="end">LEAs; and</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-17" dnum="iv-o:_-e" numlevel="1" lineno="111" slineno="2-32" ea="erase" anum="0" owner="admin" style="2" level="3"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1047" style="2" owner="o" level="1" deltag="start">(iv)</amend></display><amend anum="0" ea="erase" pairid="25" groupid="15" style="2" owner="admin" level="1" deltag="end">the Governor's Education Excellence Commission.</amend><amendoutend style="2"/></subsection></subsection></subsection><subsection ssid="7-null-18" dnum="3-o:2-e" numlevel="1" lineno="112" slineno="2-33" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1048" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1049" style="1" owner="e" level="1" amendtag="both" space="true">(2)</amend></display>As funding allows, the state board shall develop a master plan for a statewide <ln numlevel="1" lineno="113" slineno="2-34"/>digital teaching and learning program, including the following:<subsection ssid="7-null-19" dnum="a-o" numlevel="1" lineno="114" slineno="2-35" level="2"><display>(a)</display>a statement of purpose that describes the objectives or goals the state board will <ln numlevel="1" lineno="115" slineno="2-36"/>accomplish by implementing a digital teaching and learning program;</subsection><subsection ssid="7-null-20" dnum="b-o" numlevel="1" lineno="116" slineno="2-37" level="2"><display>(b)</display>a forecast for fundamental components needed to implement a digital teaching and <ln numlevel="1" lineno="117" slineno="2-38"/>learning program, including a forecast for:<subsection ssid="7-null-21" dnum="i-o" numlevel="1" lineno="118" slineno="2-39" level="3"><display>(i)</display>student and teacher devices;</subsection><subsection ssid="7-null-22" dnum="ii-o" numlevel="1" lineno="119" slineno="2-40" level="3"><display>(ii)</display>Wi-Fi and wireless compatible technology;</subsection><subsection ssid="7-null-23" dnum="iii-o" numlevel="1" lineno="120" slineno="2-41" level="3"><display>(iii)</display>curriculum software;</subsection><subsection ssid="7-null-24" dnum="iv-o" numlevel="1" lineno="121" slineno="2-42" level="3"><display>(iv)</display>assessment solutions;</subsection><subsection ssid="7-null-25" dnum="v-o" numlevel="1" lineno="122" slineno="2-43" level="3"><display>(v)</display>technical support;</subsection><subsection ssid="7-null-26" dnum="vi-o" numlevel="1" lineno="123" slineno="2-44" level="3"><display>(vi)</display>change management of LEAs;</subsection><subsection ssid="7-null-27" dnum="vii-o" numlevel="1" lineno="124" slineno="2-45" level="3"><display>(vii)</display>high quality professional learning;</subsection><subsection ssid="7-null-28" dnum="viii-o" numlevel="1" lineno="125" slineno="2-46" level="3"><display>(viii)</display>Internet delivery and capacity; and</subsection><subsection ssid="7-null-29" dnum="ix-o" numlevel="1" lineno="126" slineno="2-47" level="3"><display>(ix)</display>security and privacy of users;</subsection></subsection><subsection ssid="7-null-30" dnum="c-o" numlevel="1" lineno="127" slineno="2-48" level="2"><display>(c)</display>a determination of the requirements for:<subsection ssid="7-null-31" dnum="i-o" numlevel="1" lineno="128" slineno="2-49" level="3"><display>(i)</display>statewide technology infrastructure; and</subsection><subsection ssid="7-null-32" dnum="ii-o" numlevel="1" lineno="129" slineno="2-50" level="3"><display>(ii)</display>local LEA technology infrastructure;</subsection></subsection><subsection ssid="7-null-33" dnum="d-o" numlevel="1" lineno="130" slineno="2-51" level="2"><display>(d)</display>standards for high quality professional learning related to implementing and <ln numlevel="1" lineno="131" slineno="2-52"/>maintaining a digital teaching and learning program;</subsection><subsection ssid="7-null-34" dnum="e-o" numlevel="1" lineno="132" slineno="2-53" level="2"><display>(e)</display>a statewide technical support plan that will guide the implementation and <ln numlevel="1" lineno="133" slineno="2-54"/>maintenance of a digital teaching and learning program, including standards and <ln numlevel="1" lineno="134" slineno="2-55"/>competency requirements for technical support personnel;</subsection><subsection ssid="7-null-35" dnum="f-o" numlevel="1" lineno="135" slineno="2-56" level="2" space="false"><display>(f)</display><subsection ssid="7-null-36" dnum="i-o" level="3" placement="sameline"><display>(i)</display>a grant program for LEAs; or</subsection><subsection ssid="7-null-37" dnum="ii-o" numlevel="1" lineno="136" slineno="2-57" level="3"><display>(ii)</display>a distribution formula to fund LEA digital teaching and learning programs;</subsection></subsection><subsection ssid="7-null-38" dnum="g-o" numlevel="1" lineno="137" slineno="2-58" level="2"><display>(g)</display>in consultation with UETN, an inventory of the state public education system's <ln numlevel="1" lineno="138" slineno="2-59"/>current technology resources and other items and a plan to integrate those resources <ln numlevel="1" lineno="139" slineno="2-60"/>into a digital teaching and learning program;</subsection><subsection ssid="7-null-39" dnum="h-o" numlevel="1" lineno="140" slineno="2-61" level="2"><display>(h)</display>an ongoing evaluation process that is overseen by the state board;</subsection><subsection ssid="7-null-40" dnum="i-o" numlevel="1" lineno="141" slineno="2-62" level="2"><display>(i)</display>proposed rules that incorporate the principles of the master plan into the state's public <ln numlevel="1" lineno="142" slineno="2-63"/>education system as a whole; and</subsection><subsection ssid="7-null-41" dnum="j-o" numlevel="1" lineno="143" slineno="2-64" level="2"><display>(j)</display>a plan to ensure long-term sustainability that:<subsection ssid="7-null-42" dnum="i-o" numlevel="1" lineno="144" slineno="2-65" level="3"><display>(i)</display>accounts for the financial impacts of a digital teaching and learning program; and</subsection><subsection ssid="7-null-43" dnum="ii-o" numlevel="1" lineno="145" slineno="2-66" level="3"><display>(ii)</display>facilitates the redirection of LEA savings that arise from implementing a digital <ln numlevel="1" lineno="146" slineno="2-67"/>teaching and learning program.</subsection></subsection></subsection><subsection ssid="7-null-44" dnum="4-o:3-e" numlevel="1" lineno="147" slineno="2-68" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1074" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1075" style="1" owner="e" level="1" amendtag="both" space="true">(3)</amend></display>UETN shall:<subsection ssid="7-null-45" dnum="a-o" numlevel="1" lineno="148" slineno="2-69" level="2"><display>(a)</display>in consultation with the state board, conduct an inventory of the state public <ln numlevel="1" lineno="149" slineno="2-70"/>education system's current technology resources and other items as determined by <ln numlevel="1" lineno="150" slineno="2-71"/>UETN, including software;</subsection><subsection ssid="7-null-46" dnum="b-o" numlevel="1" lineno="151" slineno="2-72" level="2"><display>(b)</display>perform an engineering study to determine the technology infrastructure needs of the <ln numlevel="1" lineno="152" slineno="2-73"/>public education system to implement a digital teaching and learning program, <ln numlevel="1" lineno="153" slineno="2-74"/>including the infrastructure needed for the state board, UETN, and LEAs; and</subsection><subsection ssid="7-null-47" dnum="c-o" numlevel="1" lineno="154" slineno="2-75" level="2"><display>(c)</display>as funding allows, provide infrastructure and technology support for school districts <ln numlevel="1" lineno="155" slineno="2-76"/>and charter schools.</subsection></subsection><subsection ssid="7-null-48" dnum="5-o:4-e" numlevel="1" lineno="156" slineno="2-77" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1078" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1079" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>There is created the Digital Teaching and Learning Grant Program to improve <ln numlevel="1" lineno="157" slineno="2-78"/>educational outcomes in public schools by effectively incorporating comprehensive <ln numlevel="1" lineno="158" slineno="2-79"/>digital teaching and learning technology.</subsection><subsection ssid="7-null-49" dnum="6-o:5-e" numlevel="1" lineno="159" slineno="2-80" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1079" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1080" style="1" owner="e" level="1" amendtag="both" space="true">(5)</amend></display>The state board shall:<subsection ssid="7-null-50" dnum="a-o" numlevel="1" lineno="160" slineno="2-81" level="2"><display>(a)</display>in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="161" slineno="2-82"/>adopt rules for the administration of the program, including rules requiring:<subsection ssid="7-null-51" dnum="i-o" numlevel="1" lineno="162" slineno="2-83" level="3"><display>(i)</display>an LEA to complete a digital readiness assessment the first time an LEA applies <ln numlevel="1" lineno="163" slineno="2-84"/>for the grant;</subsection><subsection ssid="7-null-52" dnum="ii-o" numlevel="1" lineno="164" slineno="2-85" level="3"><display>(ii)</display>measures to ensure that the LEA monitors and implements technology with best <ln numlevel="1" lineno="165" slineno="2-86"/>practices; and</subsection><subsection ssid="7-null-53" dnum="iii-o" numlevel="1" lineno="166" slineno="2-87" level="3"><display>(iii)</display>robust goals for learning outcomes and appropriate measurements of goal <ln numlevel="1" lineno="167" slineno="2-88"/>achievement;<amend anum="0" ea="amend" pairid="30" groupid="19" style="1" owner="admin" level="1" amendtag="both"> and</amend></subsection></subsection><subsection ssid="7-null-54" dnum="b-o:_-e" numlevel="1" lineno="168" slineno="2-89" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1084" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="28" groupid="17" style="2" owner="admin" level="1" deltag="end">establish an advisory committee to make recommendations on the program and <ln numlevel="1" lineno="169" slineno="2-90"/>LEA plan requirements and report to the state board; and</amend><amendoutend style="2"/></subsection><subsection ssid="7-null-55" dnum="c-o:b-e" numlevel="1" lineno="170" slineno="2-91" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1085" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1086" style="1" owner="e" level="1" amendtag="both" space="true">(b)</amend></display>in accordance with this section, approve LEA plans and award grants.</subsection></subsection><subsection ssid="7-null-56" dnum="7-o:6-e" numlevel="1" lineno="171" slineno="2-92" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1086" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="7-null-57" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall, subject to legislative appropriations, award a grant to an <ln numlevel="1" lineno="172" slineno="2-93"/>LEA:<subsection ssid="7-null-58" dnum="i-o" numlevel="1" lineno="173" slineno="2-94" level="3" tab="1"><display>(i)</display>that submits an LEA plan that meets the requirements described in Subsection <xref depth="4" refnumber="53F-2-510(8)" start="0">(8)</xref>; <ln numlevel="1" lineno="174" slineno="2-95"/>and</subsection><subsection ssid="7-null-59" dnum="ii-o" numlevel="1" lineno="175" slineno="2-96" level="3" tab="1"><display>(ii)</display>for which the LEA's leadership and management members have completed a <ln numlevel="1" lineno="176" slineno="2-97"/>digital teaching and learning leadership and implementation training as provided <ln numlevel="1" lineno="177" slineno="2-98"/>in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="76" groupid="42" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(7)(b)" start="0">(7)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="66" groupid="32" style="1" owner="admin" level="1" amendtag="both" space="true">(6)(b)</amend>.</subsection></subsection><subsection ssid="7-null-60" dnum="b-o" numlevel="1" lineno="178" slineno="2-99" level="2"><display>(b)</display>The state board or its designee shall provide the training described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="77" groupid="43" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(7)(a)(ii)" start="0"><ln numlevel="1" lineno="179" slineno="2-100"/>(7)(a)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="33" style="1" owner="admin" level="1" amendtag="both" space="true">(6)(a)(ii)</amend>.</subsection></subsection><subsection ssid="7-null-61" dnum="8-o:7-e" numlevel="1" lineno="180" slineno="2-101" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1091" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1092" style="1" owner="e" level="1" amendtag="both" space="true">(7)</amend></display>The state board shall establish requirements of an LEA plan that shall include:<subsection ssid="7-null-62" dnum="a-o" numlevel="1" lineno="181" slineno="2-102" level="2"><display>(a)</display>the results of the LEA's digital readiness assessment and a proposal to remedy an <ln numlevel="1" lineno="182" slineno="2-103"/>obstacle to implementation or other issues identified in the assessment;</subsection><subsection ssid="7-null-63" dnum="b-o" numlevel="1" lineno="183" slineno="2-104" level="2"><display>(b)</display>high quality professional learning for educators in the use of digital teaching and <ln numlevel="1" lineno="184" slineno="2-105"/>learning technology;</subsection><subsection ssid="7-null-64" dnum="c-o" numlevel="1" lineno="185" slineno="2-106" level="2"><display>(c)</display>leadership training and management restructuring, if necessary, for successful <ln numlevel="1" lineno="186" slineno="2-107"/>implementation;</subsection><subsection ssid="7-null-65" dnum="d-o" numlevel="1" lineno="187" slineno="2-108" level="2"><display>(d)</display>targets for improved student achievement, student learning, and college readiness <ln numlevel="1" lineno="188" slineno="2-109"/>through digital teaching and learning; and</subsection><subsection ssid="7-null-66" dnum="e-o" numlevel="1" lineno="189" slineno="2-110" level="2"><display>(e)</display>any other requirement established by the state board in rule made in accordance with <xref depth="1" refnumber="63G-3" start="0"><ln numlevel="1" lineno="190" slineno="2-111"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, including an application <ln numlevel="1" lineno="191" slineno="2-112"/>process and metrics to analyze the quality of a proposed LEA plan.</subsection></subsection><subsection ssid="7-null-67" dnum="9-o:8-e" numlevel="1" lineno="192" slineno="2-113" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1097" style="2" owner="o" level="1" deltag="both">(9)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1098" style="1" owner="e" level="1" amendtag="both" space="true">(8)</amend></display>The state board or the state board's designee shall establish an interactive dashboard <ln numlevel="1" lineno="193" slineno="2-114"/>available to each LEA that is awarded a grant for the LEA to track and report the LEA's <ln numlevel="1" lineno="194" slineno="2-115"/>long-term, intermediate, and direct outcomes in real time and for the LEA to use to <ln numlevel="1" lineno="195" slineno="2-116"/>create customized reports.</subsection><subsection ssid="7-null-68" dnum="10-o:9-e" numlevel="1" lineno="196" slineno="2-117" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1098" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1099" style="1" owner="e" level="1" amendtag="both" space="true">(9)</amend></display><subsection ssid="7-null-69" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is no federal funding, federal requirement, federal education <ln numlevel="1" lineno="197" slineno="2-118"/>agreement, or national program included or related to this state adopted program.</subsection><subsection ssid="7-null-70" dnum="b-o" numlevel="1" lineno="198" slineno="2-119" level="2"><display>(b)</display>Any inclusion of federal funding, federal requirement, federal education agreement, <ln numlevel="1" lineno="199" slineno="2-120"/>or national program shall require separate express approval as provided in <xref depth="2" refnumber="53E-3-8" start="0">Title 53E, <ln numlevel="1" lineno="200" slineno="2-121"/>Chapter 3, Part 8, Implementing Federal or National Education Programs</xref>.</subsection></subsection><subsection ssid="7-null-71" dnum="11-o:10-e" numlevel="1" lineno="201" slineno="2-122" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="both">(11)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="both" space="true">(10)</amend></display>In accordance with <xref depth="1" refnumber="63G-6a" start="0">Title 63G, Chapter 6a, Utah Procurement Code</xref>, the state <ln numlevel="1" lineno="202" slineno="2-123"/>board shall contract with an independent evaluator to:<subsection ssid="7-null-72" dnum="a-o" numlevel="1" lineno="203" slineno="2-124" level="2"><display>(a)</display>support each LEA that receives a grant as part of the program to complete an <ln numlevel="1" lineno="204" slineno="2-125"/>implementation assessment for each year that the LEA participates;</subsection><subsection ssid="7-null-73" dnum="b-o" numlevel="1" lineno="205" slineno="2-126" level="2"><display>(b)</display>report the findings of an implementation assessment to the state board; and</subsection><subsection ssid="7-null-74" dnum="c-o" numlevel="1" lineno="206" slineno="2-127" level="2"><display>(c)</display>submit to the state board recommendations to resolve issues that an implementation <ln numlevel="1" lineno="207" slineno="2-128"/>assessment raises.</subsection></subsection><subsection ssid="7-null-75" dnum="12-o:11-e" numlevel="1" lineno="208" slineno="2-129" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1105" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="both" space="true">(11)</amend></display>The state board or the state board's designee shall review an implementation <ln numlevel="1" lineno="209" slineno="2-130"/>assessment and review each participating LEA's progress from the previous year, as <ln numlevel="1" lineno="210" slineno="2-131"/>applicable.</subsection><subsection ssid="7-null-76" dnum="13-o:12-e" numlevel="1" lineno="211" slineno="2-132" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1106" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="both" space="true">(12)</amend></display>The state board shall establish interventions for an LEA that does not make <ln numlevel="1" lineno="212" slineno="2-133"/>progress on implementation of the LEA's implementation plan, including:<subsection ssid="7-null-77" dnum="a-o" numlevel="1" lineno="213" slineno="2-134" level="2"><display>(a)</display>nonrenewal of, or time period extensions for, the LEA's grant;</subsection><subsection ssid="7-null-78" dnum="b-o" numlevel="1" lineno="214" slineno="2-135" level="2"><display>(b)</display>reduction of funds; or</subsection><subsection ssid="7-null-79" dnum="c-o" numlevel="1" lineno="215" slineno="2-136" level="2"><display>(c)</display>other interventions to assist the LEA.</subsection></subsection><subsection ssid="7-null-80" dnum="14-o:13-e" numlevel="1" lineno="216" slineno="2-137" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1110" style="2" owner="o" level="1" deltag="both">(14)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1111" style="1" owner="e" level="1" amendtag="both" space="true">(13)</amend></display><subsection ssid="7-null-81" dnum="a-o" level="2" placement="sameline"><display>(a)</display>To implement an LEA plan, a contract, in accordance with <xref depth="1" refnumber="63G-6a" start="0">Title 63G, <ln numlevel="1" lineno="217" slineno="2-138"/>Chapter 6a, Utah Procurement Code</xref>, or other agreement with one or more providers <ln numlevel="1" lineno="218" slineno="2-139"/>of technology powered learning solutions and one or more providers of wireless <ln numlevel="1" lineno="219" slineno="2-140"/>networking solutions may be entered into by:<subsection ssid="7-null-82" dnum="i-o" numlevel="1" lineno="220" slineno="2-141" level="3" tab="1"><display>(i)</display>UETN, in cooperation with or on behalf of, as applicable, the state board, the state <ln numlevel="1" lineno="221" slineno="2-142"/>board's designee, or an LEA; or</subsection><subsection ssid="7-null-83" dnum="ii-o" numlevel="1" lineno="222" slineno="2-143" level="3" tab="1"><display>(ii)</display>an LEA.</subsection></subsection><subsection ssid="7-null-84" dnum="b-o" numlevel="1" lineno="223" slineno="2-144" level="2"><display>(b)</display>A contract or agreement entered into under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="78" groupid="44" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(a)" start="0">(14)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="34" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(a)</amend> may be a <ln numlevel="1" lineno="224" slineno="2-145"/>contract or agreement that:<subsection ssid="7-null-85" dnum="i-o" numlevel="1" lineno="225" slineno="2-146" level="3"><display>(i)</display>UETN enters into with a provider and payment for services is directly <ln numlevel="1" lineno="226" slineno="2-147"/>appropriated by the Legislature, as funds are available, to UETN;</subsection><subsection ssid="7-null-86" dnum="ii-o" numlevel="1" lineno="227" slineno="2-148" level="3"><display>(ii)</display>UETN enters into with a provider and pays for the provider's services and is <ln numlevel="1" lineno="228" slineno="2-149"/>reimbursed for payments by an LEA that benefits from the services;</subsection><subsection ssid="7-null-87" dnum="iii-o" numlevel="1" lineno="229" slineno="2-150" level="3"><display>(iii)</display>UETN negotiates the terms of on behalf of an LEA that enters into the contract <ln numlevel="1" lineno="230" slineno="2-151"/>or agreement directly with the provider and the LEA pays directly for the <ln numlevel="1" lineno="231" slineno="2-152"/>provider's services; or</subsection><subsection ssid="7-null-88" dnum="iv-o" numlevel="1" lineno="232" slineno="2-153" level="3"><display>(iv)</display>an LEA enters into directly, pays a provider, and receives preapproved <ln numlevel="1" lineno="233" slineno="2-154"/>reimbursement from a UETN fund established for this purpose.</subsection></subsection><subsection ssid="7-null-89" dnum="c-o" numlevel="1" lineno="234" slineno="2-155" level="2"><display>(c)</display>If an LEA does not reimburse UETN in a reasonable time for services received under <ln numlevel="1" lineno="235" slineno="2-156"/>a contract or agreement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="79" groupid="45" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(b)" start="0">(14)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="69" groupid="35" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(b)</amend>, the state board shall <ln numlevel="1" lineno="236" slineno="2-157"/>pay the balance due to UETN from the LEA's funds received under <xref depth="1" refnumber="53F-2" start="1">Chapter 2, State <ln numlevel="1" lineno="237" slineno="2-158"/>Funding -- Minimum School Program</xref>.</subsection><subsection ssid="7-null-90" dnum="d-o" numlevel="1" lineno="238" slineno="2-159" level="2"><display>(d)</display>If UETN negotiates or enters into an agreement as described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="80" groupid="46" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(b)(ii)" start="0"><ln numlevel="1" lineno="239" slineno="2-160"/>(14)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="70" groupid="36" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(b)(ii)</amend> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="81" groupid="47" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(b)(iii)" start="0">(14)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="71" groupid="37" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(b)(iii)</amend>, and UETN enters into an additional <ln numlevel="1" lineno="240" slineno="2-161"/>agreement with an LEA that is associated with the agreement described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="82" groupid="48" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(b)(ii)" start="0"><ln numlevel="1" lineno="241" slineno="2-162"/>(14)(b)(ii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="72" groupid="38" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(b)(ii)</amend> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="83" groupid="49" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-510(14)(b)(iii)" start="0">(14)(b)(iii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="73" groupid="39" style="1" owner="admin" level="1" amendtag="both" space="true">(13)(b)(iii)</amend>, the associated agreement may be <ln numlevel="1" lineno="242" slineno="2-163"/>treated by UETN and the LEA as a cooperative procurement, as that term is defined <ln numlevel="1" lineno="243" slineno="2-164"/>in Section <xref depth="3" refnumber="63G-6a-103" start="0">63G-6a-103</xref>, regardless of whether the associated agreement satisfies the <ln numlevel="1" lineno="244" slineno="2-165"/>requirements of Section <xref depth="3" refnumber="63G-6a-2105" start="0">63G-6a-2105</xref>.</subsection></subsection></section></bsec><bsec buid="10" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="245" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline
