lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill modifies requirements for social studies education and establishes open education <ln numlevel="1" lineno="6" slineno="0-6"/>resources.</gd><hphead lineno="7">Highlighted Provisions:</hphead><hp numlevel="1" lineno="8" slineno="0-8">This bill:<hl numlevel="1" lineno="9" slineno="0-9" level="1">requires the state superintendent to identify and develop high-quality open educational <ln numlevel="1" lineno="10" slineno="0-10"/>resource instructional materials;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">requires social studies instruction on American self-governance and comparative <ln numlevel="1" lineno="12" slineno="0-12"/>government systems;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">requires instruction from documents influencing America's founding and literary thought;</hl><hl numlevel="1" lineno="14" slineno="0-14" level="1">requires sourcing of English language arts assessment passages from primary source <ln numlevel="1" lineno="15" slineno="0-15"/>documents where appropriate;</hl><hl numlevel="1" lineno="16" slineno="0-16" level="1">requires instruction on the roles and responsibilities of government officials;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">allows local education agencies to determine whether applied crafts and technical arts <ln numlevel="1" lineno="18" slineno="0-18"/>courses meet fine arts credit requirements;</hl><hl numlevel="1" lineno="19" slineno="0-19" level="1">requires American constitutional government and citizenship to be taught as two distinct <ln numlevel="1" lineno="20" slineno="0-20"/>semester courses; </hl><hl numlevel="1" lineno="21" slineno="0-21" level="1">requires United States history to be taught as two distinct semester courses; </hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">prohibits students from taking the same semester course twice to meet graduation <ln numlevel="1" lineno="23" slineno="0-23"/>requirements;</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">requires literacy coaches to support the integration of social studies content into literacy <ln numlevel="1" lineno="25" slineno="0-25"/>instruction;</hl><hl numlevel="1" lineno="26" slineno="0-26" level="1">requires regular social studies instruction for elementary grades;</hl><hl numlevel="1" lineno="27" slineno="0-27" level="1">allows social studies instruction to be delivered through integrated instruction with <ln numlevel="1" lineno="28" slineno="0-28"/>English language arts and mathematics;</hl><hl numlevel="1" lineno="29" slineno="0-29" level="1">requires implementation of elementary social studies requirements by July 1, 2031;</hl><hl numlevel="1" lineno="30" slineno="0-30" level="1">repeals an adult education citizenship test and certain required plans;</hl><hl numlevel="1" lineno="31" 10020020260701" numlevel="1" lineno="58" slineno="1-1" sn="1"><section number="53E-3-1002" numlevel="1" lineno="59" slineno="1-2" type="amend"><secline lineno="58">Section 1. Section <bold>53E-3-1002</bold> is amended to read:</secline><catline lineno="59"><bold>53E-3-1002<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>07/01/26</date></paren></parens>. Literacy coaching -- Professional learning.</bold></catline><subsection ssid="9-null-30" dnum="1-o" numlevel="1" lineno="60" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>Subject to legislative appropriations, the state board shall provide, train, and assign <ln numlevel="1" lineno="61" slineno="1-4"/>literacy coaches to schools with low literacy achievement performance to provide early <ln numlevel="1" lineno="62" slineno="1-5"/>literacy coaching to teachers in kindergarten through grade 3, in accordance with this <ln numlevel="1" lineno="63" slineno="1-6"/>section.</subsection><subsection ssid="9-null-31" dnum="2-o" numlevel="1" lineno="64" slineno="1-7" level="1"><display>(2)</display>The state board shall make rules, in accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="65" slineno="1-8"/>Administrative Rulemaking Act</xref>, to:<subsection ssid="9-null-32" dnum="a-o" numlevel="1" lineno="66" slineno="1-9" level="2"><display>(a)</display>establish criteria to determine which schools qualify for early literacy coaching, <ln numlevel="1" lineno="67" slineno="1-10"/>prioritizing coaching among:<subsection ssid="9-null-33" dnum="i-o" numlevel="1" lineno="68" slineno="1-11" level="3"><display>(i)</display>schools that participate in partnerships that receive grants under <xref depth="2" refnumber="53F-5-4" start="0">Title 53F, Chapter <ln numlevel="1" lineno="69" slineno="1-12"/>5, Part 4, Partnerships for Student Success Grant Program</xref>; and</subsection><subsection ssid="9-null-34" dnum="ii-o" numlevel="1" lineno="70" slineno="1-13" level="3"><display>(ii)</display>schools that fall within the bottom 25% of all schools in literacy achievement <ln numlevel="1" lineno="71" slineno="1-14"/>performance, as the state board further defines;</subsection></subsection><subsection ssid="9-null-35" dnum="b-o" numlevel="1" lineno="72" slineno="1-15" level="2"><display>(b)</display>establish minimum qualifications for early literacy coach positions to ensure <ln numlevel="1" lineno="73" slineno="1-16"/>adequate preparation with necessary expertise;</subsection><subsection ssid="9-null-36" dnum="c-o" numlevel="1" lineno="74" slineno="1-17" level="2"><display>(c)</display>define roles and responsibilities for a literacy coach, including:<subsection ssid="9-null-37" dnum="i-o" numlevel="1" lineno="75" slineno="1-18" level="3"><display>(i)</display>assisting educators in analyzing data to inform instructional adjustments;</subsection><subsection ssid="9-null-38" dnum="ii-o" numlevel="1" lineno="76" slineno="1-19" level="3"><display>(ii)</display>engaging in instructional coaching cycles with educators to build capacity for <ln numlevel="1" lineno="77" slineno="1-20"/>improved classroom instructional practices;</subsection><subsection ssid="9-null-39" dnum="iii-o" numlevel="1" lineno="78" slineno="1-21" level="3"><display>(iii)</display>using principles of adult learning to effectively partner with educators to <ln numlevel="1" lineno="79" slineno="1-22"/>integrate professional learning into classroom practice;</subsection><subsection ssid="9-null-40" dnum="iv-o" numlevel="1" lineno="80" slineno="1-23" level="3"><display>(iv)</display>leveraging knowledge of the science of reading and evidence-based practices to <ln numlevel="1" lineno="81" slineno="1-24"/>support educators in maximizing student learning;</subsection><subsection ssid="9-null-41" dnum="v-o" numlevel="1" lineno="82" slineno="1-25" level="3"><display>(v)</display>partnering with a school's leader to support school-wide literacy goals to provide <ln numlevel="1" lineno="83" slineno="1-26"/>a team of support for educators to embed the state-wide goals into instructional <ln numlevel="1" lineno="84" slineno="1-27"/>plans and practice;</subsection><subsection ssid="9-null-42" dnum="vi-o" numlevel="1" lineno="85" slineno="1-28" level="3"><display>(vi)</display>delivering consistent and frequent job-embedded professional learning;</subsection><subsection ssid="9-null-43" dnum="vii-o" numlevel="1" lineno="86" slineno="1-29" level="3"><display>(vii)</display>participating actively in professional learning experiences to deepen knowledge <ln numlevel="1" lineno="87" slineno="1-30"/>and skills for coaching;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="6" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="9-null-44" dnum="viii-o" numlevel="1" lineno="88" slineno="1-31" level="3"><display>(viii)</display>designing and facilitating relevant and cohesive professional learning sessions <ln numlevel="1" lineno="89" slineno="1-32"/>to strengthen the implementation of these evidence-based practices with <ln numlevel="1" lineno="90" slineno="1-33"/>educators; and</subsection><subsection ssid="9-null-45" dnum="_-o:ix-e" numlevel="1" lineno="91" slineno="1-34" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="e" level="1" amendtag="start">(ix)</amend></display><amend anum="0" ea="amend" pairid="6" groupid="5" style="1" owner="admin" level="1" amendtag="end">beginning in the 2028-2029 school year, supporting the integration of social <ln numlevel="1" lineno="92" slineno="1-35"/>studies content into literacy instruction to enhance both reading comprehension <ln numlevel="1" lineno="93" slineno="1-36"/>and content knowledge, in alignment with the requirements of Section <xref depth="3" refnumber="53E-4-205.3">53E-4-205.<marker pairid="13"><ln numlevel="1" lineno="94" slineno="1-37"/>3</marker></xref><marker pairid="8">;</marker><marker pairid="9"> </marker><marker pairid="10">a</marker><marker pairid="11">n</marker><marker pairid="12">d</marker></amend></subsection></subsection><subsection ssid="9-null-46" dnum="d-o" numlevel="1" lineno="95" slineno="1-38" level="2"><display>(d)</display>establish parameters for the relationship between a literacy coach and school or LEA, <ln numlevel="1" lineno="96" slineno="1-39"/>including ensuring that coaches do not engage in activities or duties unrelated to <ln numlevel="1" lineno="97" slineno="1-40"/>literacy coaching, including:<subsection ssid="9-null-47" dnum="i-o" numlevel="1" lineno="98" slineno="1-41" level="3"><display>(i)</display>serving as an evaluator, substitute teacher, clerical aid, recess or lunch aid, <ln numlevel="1" lineno="99" slineno="1-42"/>behavioral therapist, tester, guidance counselor, interventionist, program manager, <ln numlevel="1" lineno="100" slineno="1-43"/>or contest leader; or</subsection><subsection ssid="9-null-48" dnum="ii-o" numlevel="1" lineno="101" slineno="1-44" level="3"><display>(ii)</display>any other assignment that frequently disrupts the coach's ability to support <ln numlevel="1" lineno="102" slineno="1-45"/>educators in improving instructional practice.</subsection></subsection></subsection><subsection ssid="9-null-49" dnum="3-o" numlevel="1" lineno="103" slineno="1-46" level="1"><display>(3)</display>The state board shall:<subsection ssid="9-null-50" dnum="a-o" numlevel="1" lineno="104" slineno="1-47" level="2"><display>(a)</display>ensure that one staff position supervises early literacy coaches statewide;</subsection><subsection ssid="9-null-51" dnum="b-o" numlevel="1" lineno="105" slineno="1-48" level="2"><display>(b)</display>select the pool of candidates for literacy coaching positions and coordinate with <ln numlevel="1" lineno="106" slineno="1-49"/>LEAs regarding interviews, final selection, and placement; and</subsection><subsection ssid="9-null-52" dnum="c-o" numlevel="1" lineno="107" slineno="1-50" level="2"><display>(c)</display>annually review coaching placements and adjust placements as necessary, based on <ln numlevel="1" lineno="108" slineno="1-51"/>the school's literacy achievement performance and the criteria established under <ln numlevel="1" lineno="109" slineno="1-52"/>Subsection <xref depth="4" refnumber="53E-3-1002(2)" start="0">(2)</xref>.</subsection></subsection><subsection ssid="9-null-53" dnum="4-o" numlevel="1" lineno="110" slineno="1-53" level="1"><display>(4)</display>The state board shall provide professional learning support in early literacy by:<subsection ssid="9-null-54" dnum="a-o" numlevel="1" lineno="111" slineno="1-54" level="2"><display>(a)</display>facilitating professional learning opportunities to support literacy coaches statewide <ln numlevel="1" lineno="112" slineno="1-55"/>that includes knowledge and skill development in adult learning practices, <ln numlevel="1" lineno="113" slineno="1-56"/>job-embedded coaching, and family engagement;</subsection><subsection ssid="9-null-55" dnum="b-o" numlevel="1" lineno="114" slineno="1-57" level="2"><display>(b)</display>providing professional learning regional consultants to:<subsection ssid="9-null-56" dnum="i-o" numlevel="1" lineno="115" slineno="1-58" level="3"><display>(i)</display>support LEAs and regional education service agencies in designing, facilitating, <ln numlevel="1" lineno="116" slineno="1-59"/>monitoring, and adjusting professional learning in early literacy that aligns with <ln numlevel="1" lineno="117" slineno="1-60"/>the professional learning standards described in Section <xref depth="3" refnumber="53G-11-303" start="0">53G-11-303</xref>; and</subsection><subsection ssid="9-null-57" dnum="ii-o" numlevel="1" lineno="118" slineno="1-61" level="3"><display>(ii)</display>serve a cohort of LEAs within a geographic region of the state; and</subsection></subsection><subsection ssid="9-null-58" dnum="c-o" numlevel="1" lineno="119" slineno="1-62" level="2"><display>(c)</display>providing statewide professional learning to support the use of collective efficacy, <ln numlevel="1" lineno="120" slineno="1-63"/>including the implementation of professional learning communities and school <ln numlevel="1" lineno="121" slineno="1-64"/>leadership teams through 2027.</subsection></subsection></section></bsec><bsec buid="10" num="53E-3-1004" type="amend" src="code" uid="C53E-3-S1004_2026070120260701" sort="53E03 10040020260701" numlevel="1" lineno="122" slineno="2-1" sn="2"><section number="53E-3-1004" numlevel="1" lineno="123" slineno="2-2" type="amend"><secline lineno="122">Section 2. Community engagement for early literacy.</bold></catline><subsection ssid="10-null-16" dnum="1-o" numlevel="1" lineno="124" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>The state board shall:<subsection ssid="10-null-17" dnum="a-o" numlevel="1" lineno="125" slineno="2-4" level="2"><display>(a)</display>partner with a private business or nonprofit organization to annually provide <ln numlevel="1" lineno="126" slineno="2-5"/>personal, home-use, age-appropriate printed books or digital books with <ln numlevel="1" lineno="127" slineno="2-6"/>accompanying electronic reading devices to students:<subsection ssid="10-null-18" dnum="i-o" numlevel="1" lineno="128" slineno="2-7" level="3"><display>(i)</display>who attend:<subsection ssid="10-null-19" dnum="A-o" numlevel="1" lineno="129" slineno="2-8" level="4"><display>(A)</display>a school that participates in partnerships that receive grants under <xref depth="2" refnumber="53F-5-4" start="0">Title 53F, <ln numlevel="1" lineno="130" slineno="2-9"/>Chapter 5, Part 4, Partnerships for Student Success Grant Program</xref>; or</subsection><subsection ssid="10-null-20" dnum="B-o" numlevel="1" lineno="131" slineno="2-10" level="4"><display>(B)</display>a Title I school, as that term is defined in Section <xref depth="3" refnumber="53F-2-523" start="0">53F-2-523</xref>; and</subsection></subsection><subsection ssid="10-null-21" dnum="ii-o" numlevel="1" lineno="132" slineno="2-11" level="3"><display>(ii)</display>at a minimum, in kindergarten through grade 3; and</subsection></subsection><subsection ssid="10-null-22" dnum="b-o" numlevel="1" lineno="133" slineno="2-12" level="2"><display>(b)</display>provide students a choice of language where possible.</subsection></subsection><subsection ssid="10-null-23" dnum="2-o" numlevel="1" lineno="134" slineno="2-13" level="1"><display>(2)</display>The state board shall develop and promote a website that provides resources for teachers <ln numlevel="1" lineno="135" slineno="2-14"/>and other educational support personnel to<amend anum="0" ea="amend" pairid="9" groupid="8" style="1" owner="admin" level="1" amendtag="both">:</amend> <subsection ssid="10-null-24" dnum="_-o:a-e" numlevel="1" lineno="136" slineno="2-15" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1037" style="1" owner="e" level="1" amendtag="both">(a)</amend></display>support targeted activities and strategies for parents to support at-home reading<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="both" space="true">; <ln numlevel="1" lineno="137" slineno="2-16"/>and</amend></subsection><subsection ssid="10-null-25" dnum="_-o:b-e" numlevel="1" lineno="138" slineno="2-17" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1038" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="11" style="1" owner="admin" level="1" amendtag="end">beginning in the 2028-2029 school year, integrate social studies content with literacy <ln numlevel="1" lineno="139" slineno="2-18"/>instruction, supporting both early literacy goals and social studies learning objectives <ln numlevel="1" lineno="140" slineno="2-19"/>described in Section <xref depth="3" refnumber="53E-4-205.3">53E-4-205.3</xref>.</amend></subsection></subsection><subsection ssid="10-null-26" dnum="3-o" numlevel="1" lineno="141" slineno="2-20" level="1"><display>(3)</display>The state board shall contract with one or more organizations that have expertise in <ln numlevel="1" lineno="142" slineno="2-21"/>coordinating community resources to:<subsection ssid="10-null-27" dnum="a-o" numlevel="1" lineno="143" slineno="2-22" level="2"><display>(a)</display>provide training and coaching to community, school, and parent engagement <ln numlevel="1" lineno="144" slineno="2-23"/>coordinators; and</subsection><subsection ssid="10-null-28" dnum="b-o" numlevel="1" lineno="145" slineno="2-24" level="2"><display>(b)</display>for a school that is not participating in a partnership that receives a grant under <xref depth="2" refnumber="53F-5-4" start="0">Title <ln numlevel="1" lineno="146" slineno="2-25"/>53F, Chapter 5, Part 4, Partnerships for Student Success Grant Program</xref>:<subsection ssid="10-null-29" dnum="i-o" numlevel="1" lineno="147" slineno="2-26" level="3"><display>(i)</display>assess the presence of existing community school infrastructure; and</subsection><subsection ssid="10-null-30" dnum="ii-o" numlevel="1" lineno="148" slineno="2-27" level="3"><display>(ii)</display>provide necessary supports for parent, community, and business engagement, <ln numlevel="1" lineno="149" slineno="2-28"/>including services and coordination support.</subsection></subsection></subsection></section></bsec><bsec buid="2" num="53E-4-202" type="amend" src="code" uid="C53E-4-S202_2026070120260701" sort="53E04 02020020260701" numlevel="1" lineno="150" slineno="3-1" sn="3"><section number="53E-4-202" numlevel="1" lineno="151" slineno="3-2" type="amend"><secline lineno="150">Section 3. and</subsection><subsection ssid="2-null-46" dnum="b-o" numlevel="1" lineno="169" slineno="3-20" level="2"><display>(b)</display>align with each other the core standards for Utah public schools and the assessments <ln numlevel="1" lineno="170" slineno="3-21"/>described in Section <xref depth="3" refnumber="53E-4-303">53E-4-303</xref>.</subsection></subsection><subsection ssid="2-null-47" dnum="3-o:4-e" numlevel="1" lineno="171" slineno="3-22" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1056" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1057" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>The basic knowledge, skills, and competencies identified <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="21" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="20" style="1" owner="admin" level="1" amendtag="both" space="true">in <ln numlevel="1" lineno="172" slineno="3-23"/>accordance with</amend> Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="34" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53E-4-202(2)(a)">(2)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="35" groupid="32" style="1" owner="admin" level="1" amendtag="both" space="true">(1)(a)</amend> shall increase in depth and complexity from <ln numlevel="1" lineno="173" slineno="3-24"/>year to year and focus on consistent and continual progress within and between grade <ln numlevel="1" lineno="174" slineno="3-25"/>levels and courses in the basic academic areas of:<subsection ssid="2-null-48" dnum="a-o" numlevel="1" lineno="175" slineno="3-26" level="2"><display>(a)</display>English, including explicit phonics, spelling, grammar, reading, writing, vocabulary, <ln numlevel="1" lineno="176" slineno="3-27"/>speech, and listening; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="18" groupid="16" style="2" owner="admin" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection><subsection ssid="2-null-49" dnum="b-o" numlevel="1" lineno="177" slineno="3-28" level="2"><display>(b)</display>mathematics, including basic computational skills<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="19" groupid="17" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="16" groupid="14" style="1" owner="admin" level="1" amendtag="both" space="true">; and</amend></subsection><subsection ssid="2-null-50" dnum="_-o:c-e" numlevel="1" lineno="178" slineno="3-29" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1059" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="13" style="1" owner="admin" level="1" amendtag="end">beginning with the 2028-2029 school year, social studies, including history and <ln numlevel="1" lineno="179" slineno="3-30"/>government as described in Section <xref depth="3" refnumber="53G-10-302">53G-10-302</xref>.</amend></subsection></subsection><subsection ssid="2-null-51" dnum="4-o:5-e" numlevel="1" lineno="180" slineno="3-31" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1060" style="2" owner="o" level="1" deltag="both">(4)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1061" style="1" owner="e" level="1" amendtag="both" space="true">(5)</amend></display>Before adopting core standards for Utah public schools, the state board shall:<subsection ssid="2-null-52" dnum="a-o" numlevel="1" lineno="181" slineno="3-32" level="2"><display>(a)</display>publicize draft core standards for Utah public schools for the state, as a class A <ln numlevel="1" lineno="182" slineno="3-33"/>notice under Section <xref depth="3" refnumber="63G-30-102">63G-30-102</xref>, for at least 90 days;</subsection><subsection ssid="2-null-53" dnum="b-o" numlevel="1" lineno="183" slineno="3-34" level="2"><display>(b)</display>invite public comment on the draft core standards for Utah public schools for a <ln numlevel="1" lineno="184" slineno="3-35"/>period of not less than 90 days; and</subsection><subsection ssid="2-null-54" dnum="c-o" numlevel="1" lineno="185" slineno="3-36" level="2"><display>(c)</display>conduct three public hearings that are held in different regions of the state on the <ln numlevel="1" lineno="186" slineno="3-37"/>draft core standards for Utah public schools.</subsection></subsection><subsection ssid="2-null-55" dnum="5-o:6-e" numlevel="1" lineno="187" slineno="3-38" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1064" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1065" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>LEA governing boards shall design their school programs, that are supported by <ln numlevel="1" lineno="188" slineno="3-39"/>generally accepted scientific standards of evidence, to focus on the core standards for <ln numlevel="1" lineno="189" slineno="3-40"/>Utah public schools with the expectation that each program will enhance or help achieve <ln numlevel="1" lineno="190" slineno="3-41"/>mastery of the core standards for Utah public schools.</subsection><subsection ssid="2-null-56" dnum="6-o:7-e" numlevel="1" lineno="191" slineno="3-42" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1065" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1066" style="1" owner="e" level="1" amendtag="both" space="true">(7)</amend></display>Except as provided in Sections <xref depth="3" refnumber="53G-10-103">53G-10-103</xref> and <xref depth="3" refnumber="53G-10-402">53G-10-402</xref>, each school may <ln numlevel="1" lineno="192" slineno="3-43"/>select instructional materials and methods of teaching, that are supported by generally <ln numlevel="1" lineno="193" slineno="3-44"/>accepted scientific standards of evidence, that the school considers most appropriate to <ln numlevel="1" lineno="194" slineno="3-45"/>meet the core standards for Utah public schools.</subsection><subsection ssid="2-null-57" dnum="7-o:8-e" numlevel="1" lineno="195" slineno="3-46" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1066" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1067" style="1" owner="e" level="1" amendtag="both" space="true">(8)</amend></display>The state may exit any agreement, contract, memorandum of understanding, or <ln numlevel="1" lineno="196" slineno="3-47"/>consortium that cedes control of the core standards for Utah public schools to any other <ln numlevel="1" lineno="197" slineno="3-48"/>entity, including a federal agency or consortium, for any reason, including:<subsection ssid="2-null-58" dnum="a-o" numlevel="1" lineno="198" slineno="3-49" level="2"><display>(a)</display>the cost of developing or implementing the core standards for Utah public schools;</subsection><subsection ssid="2-null-59" dnum="b-o" numlevel="1" lineno="199" slineno="3-50" level="2"><display>(b)</display>the proposed core standards for Utah public schools are inconsistent with community <ln numlevel="1" lineno="200" slineno="3-51"/>values; or</subsection><subsection ssid="2-null-60" dnum="c-o" numlevel="1" lineno="201" slineno="3-52" level="2"><display>(c)</display>the agreement, contract, memorandum of understanding, or consortium:<subsection ssid="2-null-61" dnum="i-o" numlevel="1" lineno="202" slineno="3-53" level="3"><display>(i)</display>was entered into in violation of Chapter 3, Part 8, Implementing Federal or <ln numlevel="1" lineno="203" slineno="3-54"/>National Education Programs, or Title 63J, Chapter 5, Federal Funds Procedures <ln numlevel="1" lineno="204" slineno="3-55"/>Act;</subsection><subsection ssid="2-null-62" dnum="ii-o" numlevel="1" lineno="205" slineno="3-56" level="3"><display>(ii)</display>conflicts with Utah law;</subsection><subsection ssid="2-null-63" dnum="iii-o" numlevel="1" lineno="206" slineno="3-57" level="3"><display>(iii)</display>requires Utah student data to be included in a national or multi-state database;</subsection><subsection ssid="2-null-64" dnum="iv-o" numlevel="1" lineno="207" slineno="3-58" level="3"><display>(iv)</display>requires records of teacher performance to be included in a national or multi-state <ln numlevel="1" lineno="208" slineno="3-59"/>database; or</subsection><subsection ssid="2-null-65" dnum="v-o" numlevel="1" lineno="209" slineno="3-60" level="3"><display>(v)</display>imposes curriculum, assessment, or data tracking requirements on home school or <ln numlevel="1" lineno="210" slineno="3-61"/>private school students.</subsection></subsection></subsection><subsection ssid="2-null-66" dnum="8-o:9-e" numlevel="1" lineno="211" slineno="3-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="both">(8)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1076" style="1" owner="e" level="1" amendtag="both" space="true">(9)</amend></display>The state board shall:<subsection ssid="2-null-67" dnum="a-o" numlevel="1" lineno="212" slineno="3-63" level="2"><display>(a)</display>submit a report in accordance with Section <xref depth="3" refnumber="53E-1-203">53E-1-203</xref> on the development and <ln numlevel="1" lineno="213" slineno="3-64"/>implementation of the core standards for Utah public schools, including the time line <ln numlevel="1" lineno="214" slineno="3-65"/>established for the review of the core standards for Utah public schools; and</subsection><subsection ssid="2-null-68" dnum="b-o" numlevel="1" lineno="215" slineno="3-66" level="2"><display>(b)</display>ensure that the report described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="38" groupid="35" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53E-4-202(8)(a)">(8)(a)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="33" style="1" owner="admin" level="1" amendtag="both" space="true">(9)(a)</amend> includes the time line <ln numlevel="1" lineno="216" slineno="3-67"/>established for the review of the core standards for Utah public schools by a <ln numlevel="1" lineno="217" slineno="3-68"/>standards <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="56" groupid="49" style="2" owner="admin" level="1" deltag="both">review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="54" groupid="47" style="1" owner="admin" level="1" amendtag="both" space="true">advisory</amend> committee and the recommendations of a standards <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="57" groupid="50" style="2" owner="admin" level="1" deltag="both"><ln numlevel="1" lineno="218" slineno="3-69"/>review</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="55" groupid="48" style="1" owner="admin" level="1" amendtag="both" space="true">advisory</amend> committee established under Section <xref depth="3" refnumber="53E-4-203">53E-4-203</xref>.</subsection></subsection></section></bsec><bsec buid="11" num="53E-4-204" type="amend" src="code" uid="C53E-4-S204_2026070120260701" sort="53E04 02040020260701" numlevel="1" lineno="219" slineno="4-1" sn="4"><section number="53E-4-204" numlevel="1" lineno="220" slineno="4-2" type="amend"><secline lineno="219">Section 4. Standards and graduation requirements.</bold></catline><subsection ssid="11-null-23" dnum="1-o" numlevel="1" lineno="221" slineno="4-3" level="1" placement="noreturn"><display>(1)</display>The state board shall establish rigorous core standards for Utah public schools and <ln numlevel="1" lineno="222" slineno="4-4"/>graduation requirements under Section <xref depth="3" refnumber="53E-3-501" start="0">53E-3-501</xref> for grades 9 through 12 that:<subsection ssid="11-null-24" dnum="a-o" numlevel="1" lineno="223" slineno="4-5" level="2"><display>(a)</display>are consistent with state law and federal regulations;</subsection><subsection ssid="11-null-25" dnum="b-o" numlevel="1" lineno="224" slineno="4-6" level="2"><display>(b)</display>use competency-based standards and assessments;</subsection><subsection ssid="11-null-26" dnum="c-o" numlevel="1" lineno="225" slineno="4-7" level="2"><display>(c)</display>include instruction that stresses general financial literacy from basic budgeting to <ln numlevel="1" lineno="226" slineno="4-8"/>financial investments, including bankruptcy education and a general financial literacy <ln numlevel="1" lineno="227" slineno="4-9"/>test-out option;</subsection><subsection ssid="11-null-27" dnum="d-o" numlevel="1" lineno="228" slineno="4-10" level="2"><display>(d)</display>include graduation requirements in language arts, mathematics, and science that <ln numlevel="1" lineno="229" slineno="4-11"/>exceed:<subsection ssid="11-null-28" dnum="i-o" numlevel="1" lineno="230" slineno="4-12" level="3"><display>(i)</display>3.0 units in language arts including up to 0.5 units emphasizing verbal <ln numlevel="1" lineno="231" slineno="4-13"/>communication completed in a course or a school sponsored activity;</subsection><subsection ssid="11-null-29" dnum="ii-o" numlevel="1" lineno="232" slineno="4-14" level="3"><display>(ii)</display>2.0 units in mathematics; and</subsection><subsection ssid="11-null-30" dnum="iii-o" numlevel="1" lineno="233" slineno="4-15" level="3"><display>(iii)</display>and 2.0 units in science;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="22" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="11-null-31" dnum="e-o:_-e" numlevel="1" lineno="234" slineno="4-16" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1086" style="2" owner="o" level="1" deltag="start">(e)</amend></display><amend anum="0" ea="erase" pairid="5" groupid="4" style="2" owner="admin" level="1" deltag="end">include a graduation requirement in social studies that is equal to or exceeds 3.5 <ln numlevel="1" lineno="235" slineno="4-17"/>units, including at least 1.0 unit in American constitutional government and <ln numlevel="1" lineno="236" slineno="4-18"/>citizenship as described in Section <xref depth="3" refnumber="53E-4-205.2">53E-4-205.2</xref>;</amend><amendoutend style="2"/></subsection><subsection ssid="11-null-32" dnum="_-o:e-e" numlevel="1" lineno="237" slineno="4-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="5" style="1" owner="admin" level="1" amendtag="end">include a graduation requirement in social studies that is equal to or exceeds 3.5 <ln numlevel="1" lineno="238" slineno="4-20"/>units, including:</amend><subsection ssid="11-null-33" dnum="_-o:i-e" numlevel="1" lineno="239" slineno="4-21" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="10" style="1" owner="admin" level="1" amendtag="end">at least 1.0 unit in American constitutional government and citizenship as <ln numlevel="1" lineno="240" slineno="4-22"/>described in Section <xref depth="3" refnumber="53E-4-205.2">53E-4-205.2</xref>, consisting of two distinct semester courses that <ln numlevel="1" lineno="241" slineno="4-23"/>may not be duplicated to satisfy the requirement; and</amend></subsection><subsection ssid="11-null-34" dnum="_-o:ii-e" numlevel="1" lineno="242" slineno="4-24" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="20" groupid="14" style="1" owner="admin" level="1" amendtag="end">at least 1.0 unit in United States history, consisting of two distinct semester <ln numlevel="1" lineno="243" slineno="4-25"/>courses that may not be duplicated to satisfy the requirement; and</amend></subsection></subsection><subsection ssid="11-null-35" dnum="f-o" numlevel="1" lineno="244" slineno="4-26" level="2"><display>(f)</display>ensure up to 0.5 units <amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both">of the 1.0 unit in American constitutional government and <ln numlevel="1" lineno="245" slineno="4-27"/>citizenship </amend>described in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="17" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53E-4-204(1)(e)(i)">(1)(e)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="22" groupid="16" style="1" owner="admin" level="1" amendtag="both" space="true">(1)(e)(i)</amend> may be earned by:<subsection ssid="11-null-36" dnum="i-o" numlevel="1" lineno="246" slineno="4-28" level="3"><display>(i)</display>completing a course or a school sponsored activity emphasizing verbal <ln numlevel="1" lineno="247" slineno="4-29"/>communication provided that a significant portion of the course or activity is <ln numlevel="1" lineno="248" slineno="4-30"/>dedicated to civic education, including:<subsection ssid="11-null-37" dnum="A-o" numlevel="1" lineno="249" slineno="4-31" level="4"><display>(A)</display>policy analysis;</subsection><subsection ssid="11-null-38" dnum="B-o" numlevel="1" lineno="250" slineno="4-32" level="4"><display>(B)</display>governmental systems; and</subsection><subsection ssid="11-null-39" dnum="C-o" numlevel="1" lineno="251" slineno="4-33" level="4"><display>(C)</display>civic engagement; or</subsection></subsection><subsection ssid="11-null-40" dnum="ii-o" numlevel="1" lineno="252" slineno="4-34" level="3"><display>(ii)</display>participation in the Junior Reserve Officers' Training Corps described in 10 U.S.C<amend anum="0" ea="amend" pairid="41" groupid="21" style="1" owner="admin" level="1" amendtag="both">.</amend> <ln numlevel="1" lineno="253" slineno="4-35"/>Sec. 2031.</subsection></subsection></subsection><subsection ssid="11-null-41" dnum="2-o" numlevel="1" lineno="254" slineno="4-36" level="1"><display>(2)</display>The state board shall establish competency-based standards and assessments for elective <ln numlevel="1" lineno="255" slineno="4-37"/>courses.</subsection><subsection ssid="11-null-42" dnum="3-o" numlevel="1" lineno="256" slineno="4-38" level="1"><display>(3)</display>The state board shall study requiring all LEAs to issue a high school diploma to students <ln numlevel="1" lineno="257" slineno="4-39"/>who receive:<subsection ssid="11-null-43" dnum="a-o" numlevel="1" lineno="258" slineno="4-40" level="2"><display>(a)</display>an associate's degree with at least 60 credit hours from an accredited post-secondary <ln numlevel="1" lineno="259" slineno="4-41"/>institution; or</subsection><subsection ssid="11-null-44" dnum="b-o" numlevel="1" lineno="260" slineno="4-42" level="2"><display>(b)</display>an industry certification with at least 500 hours of instruction from a business, trade <ln numlevel="1" lineno="261" slineno="4-43"/>association, or other industry group in accordance with Section <xref depth="3" refnumber="53E-3-501" start="0">53E-3-501</xref>.</subsection></subsection></section></bsec><bsec buid="12" num="53E-4-205.3" type="enact" src="code" uid="C53E-4-S205.3_2026070120260701" sort="53E04 02050320260701" numlevel="1" lineno="262" slineno="5-1" sn="5"><section numlevel="1" lineno="263" slineno="5-2" number="53E-4-205.3" type="enact"><secline lineno="262">Section 5. Elementary social studies e<marker pairid="253"/>ducation.</bold></catline><subsection ssid="12-null-51" dnum="_-o:1-e" numlevel="1" lineno="264" slineno="5-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1100" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" amendtag="end">As used in this section:</amend><subsection ssid="12-null-52" dnum="_-o:a-e" numlevel="1" lineno="265" slineno="5-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1101" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="249" groupid="198" style="1" owner="admin" level="1" amendtag="end">"Elementary grades" or "elementary grade level" means kindergarten through grade 6.</amend></subsection><subsection ssid="12-null-53" dnum="_-o:b-e" numlevel="1" lineno="266" slineno="5-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="247" groupid="196" style="1" owner="admin" level="1" amendtag="end">"Integrated instruction" means teaching that purposefully connects social studies <ln numlevel="1" lineno="267" slineno="5-6"/>content with other subject areas.</amend></subsection><subsection ssid="12-null-54" dnum="_-o:c-e" numlevel="1" lineno="268" slineno="5-7" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1103" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="12" style="1" owner="admin" level="1" amendtag="end">"Social studies" means the integrated study of history, geography, civics, and <ln numlevel="1" lineno="269" slineno="5-8"/>economics as outlined in the state board's standards for social studies.</amend></subsection></subsection><subsection ssid="12-null-55" dnum="_-o:2-e" numlevel="1" lineno="270" slineno="5-9" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1104" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="250" groupid="199" style="1" owner="admin" level="1" amendtag="end">The board shall make rules in accordance with Title 63G, Chapter 3, Utah <ln numlevel="1" lineno="271" slineno="5-10"/>Administrative Rulemaking Act, establishing standards to ensure that LEAs provide <ln numlevel="1" lineno="272" slineno="5-11"/>regular social studies instruction in each elementary grade level.</amend></subsection><subsection ssid="12-null-56" dnum="_-o:3-e" numlevel="1" lineno="273" slineno="5-12" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1105" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="97" groupid="76" style="1" owner="admin" level="1" amendtag="end">The state superintendent shall:</amend><subsection ssid="12-null-57" dnum="_-o:a-e" numlevel="1" lineno="274" slineno="5-13" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1106" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="80" style="1" owner="admin" level="1" amendtag="end">develop guidelines for integrating, where appropriate, social studies instruction with <ln numlevel="1" lineno="275" slineno="5-14"/>English language arts and mathematics;</amend></subsection><subsection ssid="12-null-58" dnum="_-o:b-e" numlevel="1" lineno="276" slineno="5-15" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1107" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="132" groupid="104" style="1" owner="admin" level="1" amendtag="end">develop and maintain a repository of social studies instructional materials and <ln numlevel="1" lineno="277" slineno="5-16"/>resources;</amend></subsection><subsection ssid="12-null-59" dnum="_-o:c-e" numlevel="1" lineno="278" slineno="5-17" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1108" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="142" groupid="112" style="1" owner="admin" level="1" amendtag="end">establish criteria for qualifying integrated instruction; and</amend></subsection><subsection ssid="12-null-60" dnum="_-o:d-e" numlevel="1" lineno="279" slineno="5-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1109" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="147" groupid="116" style="1" owner="admin" level="1" amendtag="end">develop methods to measure student progress in social studies learning.</amend></subsection></subsection><subsection ssid="12-null-61" dnum="_-o:4-e" numlevel="1" lineno="280" slineno="5-19" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1110" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="187" groupid="148" style="1" owner="admin" level="1" amendtag="end">An LEA shall:</amend><subsection ssid="12-null-62" dnum="_-o:a-e" numlevel="1" lineno="281" slineno="5-20" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1111" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="192" groupid="152" style="1" owner="admin" level="1" amendtag="end">ensure that students in elementary grades receive regular social studies instruction <ln numlevel="1" lineno="282" slineno="5-21"/>required in Subsection <xref depth="4" refnumber="53E-4-205.3(2)">(2)</xref>;</amend></subsection><subsection ssid="12-null-63" dnum="_-o:b-e" numlevel="1" lineno="283" slineno="5-22" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1112" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="197" groupid="156" style="1" owner="admin" level="1" amendtag="end">in accordance with Section <xref depth="3" refnumber="53G-10-304">53G-10-304</xref>, adopt social studies curricula that meet state <ln numlevel="1" lineno="284" slineno="5-23"/>standards;</amend></subsection><subsection ssid="12-null-64" dnum="_-o:c-e" numlevel="1" lineno="285" slineno="5-24" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1113" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="202" groupid="160" style="1" owner="admin" level="1" amendtag="end">ensure all elementary students have access to appropriate social studies materials;</amend></subsection><subsection ssid="12-null-65" dnum="_-o:d-e" numlevel="1" lineno="286" slineno="5-25" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1114" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="207" groupid="164" style="1" owner="admin" level="1" amendtag="end">provide resources to support integrated instruction;</amend></subsection><subsection ssid="12-null-66" dnum="_-o:e-e" numlevel="1" lineno="287" slineno="5-26" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1115" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="212" groupid="168" style="1" owner="admin" level="1" amendtag="end">ensure that elementary teachers receive ongoing professional development in social <ln numlevel="1" lineno="288" slineno="5-27"/>studies instruction, including integrated instruction;</amend></subsection><subsection ssid="12-null-68" dnum="_-o:f-e" numlevel="1" lineno="289" slineno="5-28" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1116" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="222" groupid="176" style="1" owner="admin" level="1" amendtag="end">regularly assess student progress in social studies; Utah standards assessments -- Administration -- <ln numlevel="1" lineno="296" slineno="6-3"/>Advisory committee.</bold></catline><subsection ssid="4-null-49" dnum="1-o" numlevel="1" lineno="297" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>As used in this section<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="5" style="2" owner="admin" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="admin" level="1" amendtag="both" space="true">:</amend> <subsection ssid="4-null-50" dnum="_-o:a-e" numlevel="1" lineno="298" slineno="6-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1121" style="1" owner="e" level="1" amendtag="both">(a)</amend></display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="11" style="2" owner="admin" level="1" deltag="both">"computer</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="admin" level="1" amendtag="both" space="true">"Computer</amend> adaptive assessment" means an assessment that measures the <ln numlevel="1" lineno="299" slineno="6-6"/>range of a student's ability by adapting to the student's responses, selecting more <ln numlevel="1" lineno="300" slineno="6-7"/>difficult or less difficult questions based on the student's responses.</subsection><subsection ssid="4-null-51" dnum="_-o:b-e" numlevel="1" lineno="301" slineno="6-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1122" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="admin" level="1" amendtag="end">"Founding document" means a document described in Subsections <xref depth="3" refnumber="53E-4-205.2">53E-4-205.2</xref> and <xref depth="4" refnumber="53G-10-302(4)"><ln numlevel="1" lineno="302" slineno="6-9"/>53G-10-302(4)</xref>.</amend></subsection></subsection><subsection ssid="4-null-52" dnum="2-o" numlevel="1" lineno="303" slineno="6-10" level="1"><display>(2)</display>The state board shall:<subsection ssid="4-null-53" dnum="a-o" numlevel="1" lineno="304" slineno="6-11" level="2"><display>(a)</display>adopt a standards assessment that:<subsection ssid="4-null-54" dnum="i-o" numlevel="1" lineno="305" slineno="6-12" level="3"><display>(i)</display>measures a student's proficiency in:<subsection ssid="4-null-55" dnum="A-o" numlevel="1" lineno="306" slineno="6-13" level="4"><display>(A)</display>mathematics for students in each of grades 3 through 8 until July 1, 2026, and <ln numlevel="1" lineno="307" slineno="6-14"/>3 through 10 after July 1, 2026;</subsection><subsection ssid="4-null-56" dnum="B-o" numlevel="1" lineno="308" slineno="6-15" level="4"><display>(B)</display>English language arts for students in each of grades 3 through 8 until July 1, <ln numlevel="1" lineno="309" slineno="6-16"/>2026, and 3 through 10 after July 1, 2026;</subsection><subsection ssid="4-null-57" dnum="C-o" numlevel="1" lineno="310" slineno="6-17" level="4"><display>(C)</display>science for students in each of grades 4 through 8 until July 1, 2026, and 4 <ln numlevel="1" lineno="311" slineno="6-18"/>through 10 after July 1, 2026; and</subsection><subsection ssid="4-null-58" dnum="D-o" numlevel="1" lineno="312" slineno="6-19" level="4"><display>(D)</display>writing for students in at least grades 5 and 8; and</subsection></subsection><subsection ssid="4-null-59" dnum="ii-o" numlevel="1" lineno="313" slineno="6-20" level="3"><display>(ii)</display>except for the writing measurement described in Subsection <xref depth="4" refnumber="53E-4-303(2)(a)(i)(D)" start="0">(2)(a)(i)(D)</xref>, is a <ln numlevel="1" lineno="314" slineno="6-21"/>computer adaptive assessment; <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="51" groupid="43" style="2" owner="admin" level="1" deltag="both">and</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="4-null-60" dnum="b-o" numlevel="1" lineno="315" slineno="6-22" level="2"><display>(b)</display>ensure that an assessment described in Subsection <xref depth="4" refnumber="53E-4-303(2)(a)" start="0">(2)(a)</xref> is:<subsection ssid="4-null-61" dnum="i-o" numlevel="1" lineno="316" slineno="6-23" level="3"><display>(i)</display>a criterion referenced assessment;</subsection><subsection ssid="4-null-62" dnum="ii-o" numlevel="1" lineno="317" slineno="6-24" level="3"><display>(ii)</display>administered online;</subsection><subsection ssid="4-null-63" dnum="iii-o" numlevel="1" lineno="318" slineno="6-25" level="3"><display>(iii)</display>aligned with the core standards for Utah public schools; and</subsection><subsection ssid="4-null-64" dnum="iv-o" numlevel="1" lineno="319" slineno="6-26" level="3"><display>(iv)</display>adaptable to personalized, competency-based learning, as that term is defined in <ln numlevel="1" lineno="320" slineno="6-27"/>Section <xref depth="3" refnumber="53F-5-501" start="0">53F-5-501</xref><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="47" groupid="39" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="45" groupid="37" style="1" owner="admin" level="1" amendtag="both" space="true">; and</amend></subsection></subsection><subsection ssid="4-null-65" dnum="_-o:c-e" numlevel="1" lineno="321" slineno="6-28" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="44" style="1" owner="admin" level="1" amendtag="end">beginning on or after the 2028-2029 school year, the board shall establish a timeline <ln numlevel="1" lineno="322" slineno="6-29"/>to incorporate questions derived from primary source documents and founding <ln numlevel="1" lineno="323" slineno="6-30"/>documents into the English language arts assessment described in Subsection <xref depth="4" refnumber="53E-4-303(2)(a)(i)(b)"><ln numlevel="1" lineno="324" slineno="6-31"/>(2)(a)(i)(B)</xref>.</amend></subsection></subsection><subsection ssid="4-null-69" dnum="3-o" numlevel="1" lineno="325" slineno="6-32" level="1"><display>(3)</display>A school district or charter school shall annually administer the standards assessment <ln numlevel="1" lineno="326" slineno="6-33"/>adopted by the state board under Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> to all students in the subjects and grade <ln numlevel="1" lineno="327" slineno="6-34"/>levels described in Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref>.</subsection><subsection ssid="4-null-70" dnum="4-o" numlevel="1" lineno="328" slineno="6-35" level="1" space="false"><display>(4)</display><subsection ssid="4-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="53E-4-303(4)(b)" start="0">(4)(b)</xref>, a student's score on the standards <ln numlevel="1" lineno="329" slineno="6-36"/>assessment adopted under Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> may not be considered in determining:<subsection ssid="4-null-72" dnum="i-o" numlevel="1" lineno="330" slineno="6-37" level="3" tab="1"><display>(i)</display>the student's academic grade for a course; or</subsection><subsection ssid="4-null-73" dnum="ii-o" numlevel="1" lineno="331" slineno="6-38" level="3" tab="1"><display>(ii)</display>whether the student may advance to the next grade level.</subsection></subsection><subsection ssid="4-null-74" dnum="b-o" numlevel="1" lineno="332" slineno="6-39" level="2"><display>(b)</display>A teacher may use a student's score on the standards assessment adopted under <ln numlevel="1" lineno="333" slineno="6-40"/>Subsection <xref depth="4" refnumber="53E-4-303(2)" start="0">(2)</xref> to improve the student's academic grade for or demonstrate the <ln numlevel="1" lineno="334" slineno="6-41"/>student's competency within a relevant course.</subsection></subsection><subsection ssid="4-null-75" dnum="5-o" numlevel="1" lineno="335" slineno="6-42" level="1" space="false"><display>(5)</display><subsection ssid="4-null-76" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall establish a committee consisting of 15 parents of Utah public <ln numlevel="1" lineno="336" slineno="6-43"/>education students to review all standards assessment questions.</subsection><subsection ssid="4-null-77" dnum="b-o" numlevel="1" lineno="337" slineno="6-44" level="2"><display>(b)</display>The committee established in Subsection <xref depth="4" refnumber="53E-4-303(5)(a)" start="0">(5)(a)</xref> shall include the following parent <ln numlevel="1" lineno="338" slineno="6-45"/>members:<subsection ssid="4-null-78" dnum="i-o" numlevel="1" lineno="339" slineno="6-46" level="3"><display>(i)</display>five members appointed by the chair of the state board;</subsection><subsection ssid="4-null-79" dnum="ii-o" numlevel="1" lineno="340" slineno="6-47" level="3"><display>(ii)</display>five members appointed by the speaker of the House of Representatives or the <ln numlevel="1" lineno="341" slineno="6-48"/>speaker's designee; and</subsection><subsection ssid="4-null-80" dnum="iii-o" numlevel="1" lineno="342" slineno="6-49" level="3"><display>(iii)</display>five members appointed by the president of the Senate or the president's designee.</subsection></subsection><subsection ssid="4-null-81" dnum="c-o" numlevel="1" lineno="343" slineno="6-50" level="2"><display>(c)</display>The state board shall provide staff support to the parent committee.</subsection><subsection ssid="4-null-82" dnum="d-o" numlevel="1" lineno="344" slineno="6-51" level="2"><display>(d)</display>The term of office of each member appointed in Subsection <xref depth="4" refnumber="53E-4-303(5)(b)" start="0">(5)(b)</xref> is four years.</subsection><subsection ssid="4-null-83" dnum="e-o" numlevel="1" lineno="345" slineno="6-52" level="2"><display>(e)</display>The chair of the state board, the speaker of the House of Representatives, and the <ln numlevel="1" lineno="346" slineno="6-53"/>president of the Senate shall adjust the length of terms to stagger the terms of <ln numlevel="1" lineno="347" slineno="6-54"/>committee members so that approximately half of the committee members are <ln numlevel="1" lineno="348" slineno="6-55"/>appointed every two years.</subsection><subsection ssid="4-null-84" dnum="f-o" numlevel="1" lineno="349" slineno="6-56" level="2"><display>(f)</display>No member may receive compensation or benefits for the member's service on the <ln numlevel="1" lineno="350" slineno="6-57"/>committee.</subsection></subsection></section></bsec><bsec buid="17" num="53E-4-409" type="enact" src="code" uid="C53E-4-S409_2026070120260701" sort="53E04 04090020260701" numlevel="1" lineno="351" slineno="7-1" sn="7"><section numlevel="1" lineno="352" slineno="7-2" number="53E-4-409" type="enact"><secline lineno="351">Section 7. slineno="7-4" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1153" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="7" groupid="5" style="1" owner="admin" level="1" amendtag="end">As used in this section:</amend><subsection ssid="17-null-76" dnum="_-o:a-e" numlevel="1" lineno="355" slineno="7-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1154" style="1" owner="e" level="1" slineno="7-7"/>adaptation, and distribution.</amend></subsection><subsection ssid="17-null-77" dnum="_-o:b-e" numlevel="1" lineno="358" slineno="7-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1155" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="16" groupid="12" style="1" owner="admin" level="1" amendtag="end">"Utah core standards" means the standards described in Section <xref depth="3" refnumber="53E-4-202">53E-4-202</xref>.</amend></subsection></subsection><subsection ssid="17-null-78" dnum="_-o:2-e" numlevel="1" lineno="359" slineno="7-9" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1156" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="13" style="1" owner="admin" level="1" amendtag="end">Notwithstanding any other provision in this part, and subject to legislative <ln numlevel="1" lineno="360" slineno="7-10"/>appropriation, the state style="1" level="3"><display><amend anum="0" ea="amend" pairid="1158" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="345" groupid="269" style="1" owner="admin" level="1" amendtag="end">may include resources for grades kindergarten through grade 12;</amend></subsection><subsection ssid="17-null-80" dnum="_-o:ii-e" numlevel="1" lineno="363" slineno="7-13" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1159" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="22" style="1" owner="admin" level="1" amendtag="end">align with Utah core standards;</amend></subsection><subsection ssid="17-null-81" dnum="_-o:iii-e" numlevel="1" lineno="364" slineno="7-14" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1160" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="26" style="1" owner="admin" level="1" amendtag="end">are age appropriate for the grade level in which the materials are developed;</amend></subsection><subsection ssid="17-null-82" dnum="_-o:iv-e" numlevel="1" lineno="365" slineno="7-15" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1161" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="30" style="1" owner="admin" level="1" amendtag="end">reflect Utah values as described in Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>;</amend></subsection><subsection ssid="17-null-83" dnum="_-o:v-e" numlevel="1" lineno="366" slineno="7-16" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1162" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="34" style="1" owner="admin" level="1" amendtag="end">provide accessibility to students with disabilities in compliance with federal and <ln numlevel="1" lineno="367" slineno="7-17"/>state law;</amend></subsection><subsection ssid="17-null-84" dnum="_-o:vi-e" numlevel="1" lineno="368" slineno="7-18" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1163" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="49" groupid="38" style="1" owner="admin" level="1" amendtag="end">are available in digital and, where appropriate, print formats;</amend></subsection><subsection ssid="17-null-86" dnum="_-o:vii-e" numlevel="1" lineno="369" slineno="7-19" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="e" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="315" groupid="248" style="1" owner="admin" level="1" amendtag="end">do not contain obscene or harmful material;</amend></subsection><subsection ssid="17-null-87" dnum="_-o:viii-e" numlevel="1" lineno="370" slineno="7-20" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="e" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="320" groupid="252" style="1" owner="admin" level="1" amendtag="end">are age appropriate for the grade level; and</amend></subsection><subsection ssid="17-null-88" dnum="_-o:ix-e" numlevel="1" lineno="371" slineno="7-21" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1166" style="1" owner="e" level="1" amendtag="start">(ix)</amend></display><amend anum="0" ea="amend" pairid="325" groupid="256" style="1" owner="admin" level="1" amendtag="end">promote American values and civic understanding.</amend></subsection></subsection><subsection ssid="17-null-89" dnum="_-o:b-e" numlevel="1" lineno="372" slineno="7-22" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1167" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="39" style="1" owner="admin" level="1" amendtag="end">ensure the open educational resources may include:</amend><subsection ssid="17-null-90" dnum="_-o:i-e" numlevel="1" lineno="373" slineno="7-23" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1168" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="44" style="1" owner="admin" level="1" amendtag="end">comprehensive instructional materials for all core subject areas;</amend></subsection><subsection ssid="17-null-91" dnum="_-o:ii-e" numlevel="1" lineno="374" slineno="7-24" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1169" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="48" style="1" owner="admin" level="1" amendtag="end">teacher resources;</amend></subsection><subsection ssid="17-null-99" dnum="_-o:iii-e" numlevel="1" lineno="375" slineno="7-25" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1170" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="52" style="1" owner="admin" level="1" amendtag="end">student materials and resources;</amend></subsection><subsection ssid="17-null-106" dnum="_-o:iv-e" numlevel="1" lineno="376" slineno="7-26" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1171" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="56" style="1" owner="admin" level="1" amendtag="end">implementation guides to support LEAs in the adoption and use of the materials;</amend></subsection></subsection><subsection ssid="17-null-107" dnum="_-o:c-e" numlevel="1" lineno="377" slineno="7-27" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1172" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="73" groupid="57" style="1" owner="admin" level="1" amendtag="end">establish quality standards and review processes for materials developed under this <ln numlevel="1" lineno="378" slineno="7-28"/>section;</amend></subsection><subsection ssid="17-null-108" dnum="_-o:d-e" numlevel="1" lineno="379" slineno="7-29" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1173" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="80" groupid="62" style="1" owner="admin" level="1" amendtag="end">ensure that:</amend><subsection ssid="17-null-109" dnum="_-o:i-e" numlevel="1" lineno="380" slineno="7-30" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1174" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="260" groupid="205" style="1" owner="admin" level="1" amendtag="end">the state owns all intellectual property rights, including copyright, in the open <ln numlevel="1" lineno="381" slineno="7-31"/>educational resources developed under this section; and</amend></subsection><subsection ssid="17-null-110" dnum="_-o:ii-e" numlevel="1" lineno="382" slineno="7-32" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1175" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="259" groupid="204" style="1" owner="admin" level="1" amendtag="end">the open educational resources are openly licensed under a Creative Commons or <ln numlevel="1" lineno="383" slineno="7-33"/>equivalent license to allow an LEA to use, adapt, customize, and distribute the <ln numlevel="1" lineno="384" slineno="7-34"/>materials without charge;</amend></subsection></subsection><subsection ssid="17-null-111" dnum="_-o:e-e" numlevel="1" lineno="385" slineno="7-35" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1176" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="81" groupid="63" style="1" owner="admin" level="1" amendtag="end">make the open educational resources available through a centralized digital platform <ln numlevel="1" lineno="386" slineno="7-36"/>accessible to all LEAs and the public; and</amend></subsection><subsection ssid="17-null-112" dnum="_-o:f-e" numlevel="1" lineno="387" slineno="7-37" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1177" style="1" owner="e" level="1" amendtag="start">(f)</amend></display><amend anum="0" ea="amend" pairid="261" groupid="206" style="1" owner="admin" level="1" amendtag="end">ensure that the open educational resources developed under this section are clearly <ln numlevel="1" lineno="388" slineno="7-38"/>labeled and identified as open educational resources in all formats and platforms to <ln numlevel="1" lineno="389" slineno="7-39"/>provide transparency to parents and other stakeholders.</amend></subsection></subsection><subsection ssid="17-null-113" dnum="_-o:3-e" numlevel="1" lineno="390" slineno="7-40" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1178" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="65" style="1" owner="admin" level="1" amendtag="end">In identifying, contracting, and developing open educational resources under this <ln numlevel="1" lineno="391" slineno="7-41"/>section, the state superintendent shall:</amend><subsection ssid="17-null-114" dnum="_-o:a-e" numlevel="1" lineno="392" slineno="7-42" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1179" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="91" groupid="70" style="1" owner="admin" level="1" amendtag="end">consult with LEAs, teachers, curriculum specialists, and other education stakeholders;</amend></subsection><subsection ssid="17-null-115" dnum="_-o:b-e" numlevel="1" lineno="393" slineno="7-43" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1180" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="264" groupid="208" style="1" owner="admin" level="1" amendtag="end">establish an advisory committee that:</amend><subsection ssid="17-null-116" dnum="_-o:i-e" numlevel="1" lineno="394" slineno="7-44" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1181" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="271" groupid="213" style="1" owner="admin" level="1" amendtag="end">includes individuals representing:</amend><subsection ssid="17-null-117" dnum="_-o:A-e" numlevel="1" lineno="395" slineno="7-45" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1182" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="276" groupid="217" style="1" owner="admin" level="1" amendtag="end">LEAs;</amend></subsection><subsection ssid="17-null-118" dnum="_-o:B-e" numlevel="1" lineno="396" slineno="7-46" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1183" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="281" groupid="221" style="1" owner="admin" level="1" amendtag="end">parents;</amend></subsection><subsection ssid="17-null-119" dnum="_-o:C-e" numlevel="1" lineno="397" slineno="7-47" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1184" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="286" groupid="225" style="1" owner="admin" level="1" amendtag="end">teachers;</amend></subsection><subsection ssid="17-null-120" dnum="_-o:D-e" numlevel="1" lineno="398" slineno="7-48" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1185" style="1" owner="e" level="1" amendtag="start">(D)</amend></display><amend anum="0" ea="amend" pairid="291" groupid="229" style="1" owner="admin" level="1" amendtag="end">curriculum specialists; and</amend></subsection><subsection ssid="17-null-121" dnum="_-o:E-e" numlevel="1" lineno="399" slineno="7-49" ea="amend" anum="0" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="1491" groupid="1159" style="1" owner="admin" level="1" amendtag="end">collective or state ownership of property and the means of production;</amend></subsection><subsection ssid="5-443" dnum="_-o:ii-e" numlevel="1" lineno="434" slineno="8-20" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1208" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="1494" groupid="1161" style="1" owner="admin" level="1" amendtag="end">centralized economic planning;</amend></subsection><subsection ssid="5-444" dnum="_-o:iii-e" numlevel="1" lineno="435" slineno="8-21" ea="amend" anum="0" owner="admin" style="1" owner="admin" level="1" amendtag="end">single-party authoritarian rule;</amend></subsection><subsection ssid="5-445" dnum="_-o:iv-e" numlevel="1" lineno="436" slineno="8-22" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1210" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="1500" groupid="1165" style="1" owner="admin" level="1" amendtag="end">practices that are destructive to the family structure and function; or</amend></subsection><subsection ssid="5-446" dnum="_-o:v-e" numlevel="1" lineno="437" slineno="8-23" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1211" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="1503" groupid="1167" style="1" owner="admin" level="1" amendtag="end">suppression of individual rights and liberties in favor of collective goals.</amend></subsection></subsection><subsection ssid="5-431" dnum="_-o:c-e" numlevel="1" lineno="438" slineno="8-24" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1212" style="1" owner="e" level="1" amendtag="both">(c)</amend></display> "Ten Commandments" means the Decalogue, known as the Ten Commandments, as <ln numlevel="1" lineno="439" slineno="8-25"/>recorded in the Hebrew Scriptures in Exodus 20:2-17 and Deuteronomy 5:6-21.</subsection></subsection><subsection ssid="5-null-336" dnum="2-o" numlevel="1" lineno="440" slineno="8-26" level="1"><display>(2)</display>The Legislature recognizes that a proper understanding of American history and <ln numlevel="1" lineno="441" slineno="8-27"/>government is essential to good citizenship, and that the public schools are the primary <ln numlevel="1" lineno="442" slineno="8-28"/>public institutions charged with responsibility for assisting children and youth in gaining <ln numlevel="1" lineno="443" slineno="8-29"/>that understanding.</subsection><subsection ssid="5-null-337" dnum="3-o" numlevel="1" lineno="444" slineno="8-30" level="1" space="false"><display>(3)</display><subsection ssid="5-null-338" dnum="a-o" level="2" placement="sameline"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1426" groupid="1110" style="2" owner="admin" level="1" deltag="both">The</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1424" groupid="1108" style="1" owner="admin" level="1" amendtag="both" space="true">In accordance with Section <xref depth="3" refnumber="53G-10-204">53G-10-204</xref>, the</amend> state board and local school <ln numlevel="1" lineno="445" slineno="8-31"/>boards shall periodically review school curricula and activities to ensure that <ln numlevel="1" lineno="446" slineno="8-32"/>effective instruction in American history and government is taking place in the public <ln numlevel="1" lineno="447" slineno="8-33"/>schools.</subsection><subsection ssid="5-null-339" dnum="b-o" numlevel="1" lineno="448" slineno="8-34" level="2"><display>(b)</display>The boards shall solicit public input as part of the review process.</subsection><subsection ssid="5-447" dnum="_-o:c-e" numlevel="1" lineno="449" slineno="8-35" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1217" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="1519" groupid="1178" style="1" owner="admin" level="1" amendtag="end">The state board shall ensure instruction in American history and government for <ln numlevel="1" lineno="450" slineno="8-36"/>students occurs as appropriate and includes a study of:</amend><subsection ssid="5-448" dnum="_-o:i-e" numlevel="1" lineno="451" slineno="8-37" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1218" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="1523" groupid="1181" style="1" owner="admin" level="1" amendtag="end">forms of government, such as a republic, a pure democracy, a monarchy, and an <ln numlevel="1" lineno="452" slineno="8-38"/>oligarchy;</amend></subsection><subsection ssid="5-449" dnum="_-o:ii-e" numlevel="1" lineno="453" slineno="8-39" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1219" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="1526" groupid="1183" style="1" owner="admin" level="1" amendtag="end">political philosophies and economic systems, such as socialism, communism, <ln numlevel="1" lineno="454" slineno="8-40"/>individualism, and free market capitalism;</amend></subsection><subsection ssid="5-450" dnum="_-o:iii-e" numlevel="1" lineno="455" slineno="8-41" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1220" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="1529" groupid="1185" style="1" owner="admin" level="1" amendtag="end">the United States' form of government, a compound constitutional republic;</amend></subsection><subsection ssid="5-451" dnum="_-o:iv-e" numlevel="1" lineno="456" slineno="8-42" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1221" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="1532" groupid="1187" style="1" owner="admin" level="1" amendtag="end">the roles and responsibilities of government officials, including all state and <ln numlevel="1" lineno="457" slineno="8-43"/>locally elected officials;</amend></subsection><subsection ssid="5-452" dnum="_-o:v-e" numlevel="1" lineno="458" slineno="8-44" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1222" style="1" owner="e" level="1" amendtag="start">(v)</amend></display><amend anum="0" ea="amend" pairid="1535" groupid="1189" style="1" owner="admin" level="1" amendtag="end">the voting process and election laws of this state, including the caucus and <ln numlevel="1" lineno="459" slineno="8-45"/>convention system;</amend></subsection><subsection ssid="5-453" dnum="_-o:vi-e" numlevel="1" lineno="460" slineno="8-46" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1223" style="1" owner="e" level="1" amendtag="start">(vi)</amend></display><amend anum="0" ea="amend" pairid="1538" groupid="1191" style="1" owner="admin" level="1" amendtag="end">the purpose and benefits of the Electoral College system in presidential elections, <ln numlevel="1" lineno="461" slineno="8-47"/>including:</amend><subsection ssid="5-454" dnum="_-o:A-e" numlevel="1" lineno="462" slineno="8-48" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1224" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="1541" groupid="1193" style="1" owner="admin" level="1" amendtag="end">how the system protects state sovereignty;</amend></subsection><subsection ssid="5-455" dnum="_-o:B-e" numlevel="1" lineno="463" slineno="8-49" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1225" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="1544" groupid="1195" style="1" owner="admin" level="1" amendtag="end">ensures broad geographic representation; and</amend></subsection><subsection ssid="5-456" dnum="_-o:C-e" numlevel="1" lineno="464" slineno="8-50" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1226" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="1547" groupid="1197" style="1" owner="admin" level="1" amendtag="end">maintains the federal nature of the republic;</amend></subsection></subsection><subsection ssid="5-457" dnum="_-o:vii-e" numlevel="1" lineno="465" slineno="8-51" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1227" style="1" owner="e" level="1" amendtag="start">(vii)</amend></display><amend anum="0" ea="amend" pairid="1550" groupid="1199" style="1" owner="admin" level="1" amendtag="end">the eligibility requirements to run for elected office at the federal, state, and <ln numlevel="1" lineno="466" slineno="8-52"/>local levels; and</amend></subsection><subsection ssid="5-458" dnum="_-o:viii-e" numlevel="1" lineno="467" slineno="8-53" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="e" level="1" amendtag="start">(viii)</amend></display><amend anum="0" ea="amend" pairid="1553" groupid="1201" style="1" owner="admin" level="1" amendtag="end">the elected officials who represent students at each level of government.</amend></subsection></subsection><subsection ssid="5-460" dnum="_-o:d-e" numlevel="1" lineno="468" slineno="8-54" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="1560" groupid="1206" style="1" owner="admin" level="1" amendtag="end">Beginning in the 2028-2029 school year, the state board shall ensure that social <ln numlevel="1" lineno="469" slineno="8-55"/>studies core standards for students in secondary grades include comparative <ln numlevel="1" lineno="470" slineno="8-56"/>instruction on government systems, including communism, with the state board <ln numlevel="1" lineno="471" slineno="8-57"/>determining the specific grades and frequency of instruction within secondary grades, <ln numlevel="1" lineno="472" slineno="8-58"/>that:</amend><subsection ssid="5-461" dnum="_-o:i-e" numlevel="1" lineno="473" slineno="8-59" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="1563" groupid="1208" style="1" owner="admin" level="1" amendtag="end">compare and contrast the government systems described in Subsection <xref depth="4" refnumber="53G-10-302(3)(c)">(3)(c)</xref> with <ln numlevel="1" lineno="474" slineno="8-60"/>communism and other autocratic government systems, such as:</amend><subsection ssid="5-462" dnum="_-o:A-e" numlevel="1" lineno="475" slineno="8-61" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="1566" groupid="1210" style="1" owner="admin" level="1" amendtag="end">fascist governments, including World War II-era regimes; and</amend></subsection><subsection ssid="5-463" dnum="_-o:B-e" numlevel="1" early founders and the state's history.</amend></subsection></subsection><subsection ssid="5-null-415" dnum="5-o" numlevel="1" lineno="577" slineno="8-163" level="1"><display>(5)</display>To increase student understanding of, and familiarity with, American historical <ln numlevel="1" lineno="578" slineno="8-164"/>documents, public schools may display historically important excerpts from, or copies <ln numlevel="1" lineno="579" slineno="8-165"/>of, those documents in school classrooms and common areas as appropriate.</subsection><subsection ssid="5-null-416" dnum="6-o" numlevel="1" lineno="580" slineno="8-166" level="1"><display>(6)</display>There shall be no content-based censorship of American history and heritage documents <ln numlevel="1" lineno="581" slineno="8-167"/>referred to in this section due to their religious or cultural nature.</subsection><subsection ssid="5-null-417" dnum="7-o" numlevel="1" lineno="582" slineno="8-168" level="1"><display>(7)</display>Public schools shall display "In God we trust," which is declared in 36 U.S.C. <amend anum="0" ea="amend" pairid="1419" groupid="1103" style="1" owner="admin" level="1" amendtag="both">Sec. </amend>302 <ln numlevel="1" lineno="583" slineno="8-169"/>to be the national motto of the United States, in one or more prominent places within <ln numlevel="1" lineno="584" slineno="8-170"/>each school style="1" owner="admin" level="1" amendtag="end">may use multiple translations of religious texts for comparative literary and historical <ln numlevel="1" lineno="590" slineno="8-176"/>analysis; and</amend></subsection><subsection ssid="5-null-421" dnum="_-o:c-e" numlevel="1" lineno="591" slineno="8-177" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend"
