Ipson</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill addresses provisions related to the Department of Agriculture and Food.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">updates the names of the members of the Agricultural Advisory Board;</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">creates an expendable special revenue account for the weights and measures program <ln numlevel="1" lineno="10" slineno="0-10"/>administered by the Department of Agriculture and Food;</hl><hl numlevel="1" lineno="11" slineno="0-11" level="1">clarifies the percentage of funds from the Agriculture Resource Development Fund that <ln numlevel="1" lineno="12" slineno="0-12"/>the department may use for disaster relief programs;</hl><hl numlevel="1" lineno="13" slineno="0-13" level="1">modifies the term "brand" to remove a tattoo as an identifiable mark and the brisket area <ln numlevel="1" lineno="14" slineno="0-14"/>as a brand location;</hl><hl numlevel="1" lineno="15" slineno="0-15" level="1">authorizes the commissioner of the Department of Agriculture and Food to remove a <ln numlevel="1" lineno="16" slineno="0-16"/>board member of a conservation district;</hl><hl numlevel="1" lineno="17" slineno="0-17" level="1">provides that an applicant for an agricultural water optimization grant may consult with <ln numlevel="1" lineno="18" slineno="0-18"/>the Division of Water Rights regarding the necessity of a change application or <ln numlevel="1" lineno="19" slineno="0-19"/>quantification of saved water;</hl><hl numlevel="1" lineno="20" slineno="0-20" level="1">transfers the obligation to report on the agricultural water optimization program to the <ln numlevel="1" lineno="21" slineno="0-21"/>Department of Agriculture and Food;</hl><hl numlevel="1" lineno="22" slineno="0-22" level="1">repeals a provision that requires the registration of farm names with the commissioner of <ln numlevel="1" lineno="23" slineno="0-23"/>the Department of Agriculture and Food; and</hl><hl numlevel="1" lineno="24" slineno="0-24" level="1">makes technical and one association representing veterinarians;</subsection><subsection ssid="52-null-11" dnum="viii-o" numlevel="1" lineno="82" slineno="1-24" level="3"><display>(viii)</display>one representative of an association representing livestock auctions, selected <ln numlevel="1" lineno="83" slineno="1-25"/>from a list of nominees submitted by at least one association representing <ln numlevel="1" lineno="84" slineno="1-26"/>livestock auctions;</subsection><subsection ssid="52-null-12" dnum="ix-o" numlevel="1" lineno="85" slineno="1-27" level="3"><display>(ix)</display>one representative of an association representing conservation districts, selected <ln numlevel="1" lineno="86" slineno="1-28"/>from a list of nominees submitted by at least one association representing <ln numlevel="1" lineno="87" slineno="1-29"/>conservation districts;</subsection><subsection ssid="52-null-13" dnum="x-o" numlevel="1" lineno="88" slineno="1-30" level="3"><display>(x)</display>one representative of the Utah horse industry;</subsection><subsection ssid="52-null-14" dnum="xi-o" numlevel="1" lineno="89" slineno="1-31" level="3"><display>(xi)</display>one representative of the food processing industry;</subsection><subsection ssid="52-null-15" dnum="xii-o" numlevel="1" lineno="90" slineno="1-32" level="3"><display>(xii)</display>one representative of the fruit and vegetable industry;</subsection><subsection ssid="52-null-16" dnum="xiii-o" numlevel="1" lineno="91" slineno="1-33" level="3"><display>(xiii)</display>one representative of the turkey industry;</subsection><subsection ssid="52-null-17" dnum="xiv-o" numlevel="1" lineno="92" slineno="1-34" level="3"><display>(xiv)</display>one representative of manufacturers of food supplements;</subsection><subsection ssid="52-null-18" dnum="xv-o" numlevel="1" lineno="93" slineno="1-35" level="3"><display>(xv)</display>one representative of a consumer affairs group;</subsection><subsection ssid="52-null-19" dnum="xvi-o" numlevel="1" lineno="94" slineno="1-36" level="3"><display>(xvi)</display>one representative of urban and small farmers;</subsection><subsection ssid="52-null-20" dnum="xvii-o" numlevel="1" lineno="95" slineno="1-37" level="3"><display>(xvii)</display>one representative of an association representing elk breeders, selected from a <ln numlevel="1" lineno="96" slineno="1-38"/>list of nominees submitted by at least one association representing elk breeders;</subsection><subsection ssid="52-null-21" dnum="xviii-o" numlevel="1" lineno="97" slineno="1-39" level="3"><display>(xviii)</display>one representative of an association representing beekeepers, selected from a <ln numlevel="1" lineno="98" slineno="1-40"/>list of nominees submitted by at least one association representing beekeepers; and</subsection><subsection ssid="52-null-22" dnum="xix-o" numlevel="1" lineno="99" slineno="1-41" level="3"><display>(xix)</display>one representative of fur breeders, selected from a list of nominees submitted by <ln numlevel="1" lineno="100" slineno="1-42"/>at least one association representing fur breeders.</subsection></subsection></subsection><subsection ssid="52-null-23" dnum="2-o" numlevel="1" lineno="101" slineno="1-43" level="1"><display>(2)</display>The Agricultural Advisory Board shall:<subsection ssid="52-null-24" dnum="a-o" numlevel="1" lineno="102" slineno="1-44" level="2"><display>(a)</display>advise the commissioner regarding:<subsection ssid="52-null-25" dnum="i-o" numlevel="1" lineno="103" slineno="1-45" level="3"><display>(i)</display>the planning, implementation, and administration of the department's programs; <ln numlevel="1" lineno="104" slineno="1-46"/>and</subsection><subsection ssid="52-null-26" dnum="ii-o" numlevel="1" lineno="105" slineno="1-47" level="3"><display>(ii)</display>the establishment of standards governing the care of livestock and poultry, <ln numlevel="1" lineno="106" slineno="1-48"/>including consideration of:<subsection ssid="52-null-27" dnum="A-o" numlevel="1" lineno="107" slineno="1-49" level="4"><display>(A)</display>food safety;</subsection><subsection ssid="52-null-28" dnum="B-o" numlevel="1" lineno="108" slineno="1-50" level="4"><display>(B)</display>local availability and affordability of food; and</subsection><subsection ssid="52-null-29" dnum="C-o" numlevel="1" lineno="109" slineno="1-51" level="4"><display>(C)</display>acceptable practices for livestock and farm management; and</subsection></subsection></subsection><subsection ssid="52-null-30" dnum="b-o" numlevel="1" lineno="110" slineno="1-52" level="2"><display>(b)</display>adopt best management practices for sheep, swine, cattle, and poultry industries in <ln numlevel="1" lineno="111" slineno="1-53"/>the state.</subsection></subsection><subsection ssid="52-null-31" dnum="3-o" numlevel="1" lineno="112" slineno="1-54" level="1"><display>(3)</display>The Agricultural Advisory Board may adopt best management practices for <ln numlevel="1" lineno="113" slineno="1-55"/>domesticated elk, mink, apiaries, and other agricultural industries in the state.</subsection><subsection ssid="52-null-32" dnum="4-o" numlevel="1" lineno="114" slineno="1-56" level="1"><display>(4)</display>For purposes of this section, "best management practices" means practices used by <ln numlevel="1" lineno="115" slineno="1-57"/>agriculture in the production of food and fiber that are commonly accepted practices, or <ln numlevel="1" lineno="116" slineno="1-58"/>that are at least as effective as commonly accepted practices, and that:<subsection ssid="52-null-33" dnum="a-o" numlevel="1" lineno="117" slineno="1-59" level="2"><display>(a)</display>protect the environment;</subsection><subsection ssid="52-null-34" dnum="b-o" numlevel="1" lineno="118" slineno="1-60" level="2"><display>(b)</display>protect human health; and</subsection><subsection ssid="52-null-35" dnum="c-o" numlevel="1" lineno="119" slineno="1-61" level="2"><display>(c)</display>promote the financial viability of agricultural production.</subsection></subsection><subsection ssid="52-null-36" dnum="5-o" numlevel="1" lineno="120" slineno="1-62" level="1" space="false"><display>(5)</display><subsection ssid="52-null-37" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as required by Subsection <xref depth="4" refnumber="4-2-108(1)(a)" start="0">(1)(a)</xref> or <xref depth="4" refnumber="4-2-108(5)(b)" start="0">(5)(b)</xref>, members of the Agricultural <ln numlevel="1" lineno="121" slineno="1-63"/>Advisory Board are appointed by the commissioner to four-year terms of office.</subsection><subsection ssid="52-null-38" dnum="b-o" numlevel="1" lineno="122" slineno="1-64" level="2"><display>(b)</display>Notwithstanding the requirements of Subsection <xref depth="4" refnumber="4-2-108(5)(a)" start="0">(5)(a)</xref>, the commissioner shall, at <ln numlevel="1" lineno="123" slineno="1-65"/>the time of appointment or reappointment, adjust the length of terms to ensure that <ln numlevel="1" lineno="124" slineno="1-66"/>the terms of board members are staggered so that approximately half of the board is <ln numlevel="1" lineno="125" slineno="1-67"/>appointed every two years.</subsection><subsection ssid="52-null-39" dnum="c-o" numlevel="1" lineno="126" slineno="1-68" level="2"><display>(c)</display>A member may be removed at the discretion of the commissioner upon the request of <ln numlevel="1" lineno="127" slineno="1-69"/>the group the member represents.</subsection><subsection ssid="52-null-40" dnum="d-o" numlevel="1" lineno="128" slineno="1-70" level="2"><display>(d)</display>When a vacancy occurs in the membership for any reason, the commissioner shall <ln numlevel="1" lineno="129" slineno="1-71"/>appoint a replacement for the unexpired term.</subsection></subsection><subsection ssid="52-null-41" dnum="6-o" numlevel="1" lineno="130" slineno="1-72" level="1"><display>(6)</display>The Agricultural Advisory Board shall elect one member to serve as chair of the <ln numlevel="1" lineno="131" slineno="1-73"/>Agricultural Advisory Board for a term of one year.</subsection><subsection ssid="52-null-42" dnum="7-o" numlevel="1" lineno="132" slineno="1-74" level="1" space="false"><display>(7)</display><subsection ssid="52-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Agricultural Advisory Board shall meet twice a year, but may meet more <ln numlevel="1" lineno="133" slineno="1-75"/>often at the discretion of the chair.</subsection><subsection ssid="52-null-44" dnum="b-o" numlevel="1" lineno="134" slineno="1-76" level="2"><display>(b)</display>Attendance of 11 members at a duly called meeting of the Agricultural Advisory <ln numlevel="1" lineno="135" slineno="1-77"/>Board constitutes a quorum for the transaction of official business.</subsection></subsection><subsection ssid="52-null-45" dnum="8-o" numlevel="1" lineno="136" slineno="1-78" level="1"><display>(8)</display>A member of the Agricultural Advisory Board may not receive compensation or <ln numlevel="1" lineno="137" slineno="1-79"/>benefits for the member's service, but may receive per diem and travel expenses in <ln numlevel="1" lineno="138" slineno="1-80"/>accordance with:<subsection ssid="52-null-46" dnum="a-o" numlevel="1" lineno="139" slineno="1-81" level="2"><display>(a)</display>Section <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref>;</subsection><subsection ssid="52-null-47" dnum="b-o" numlevel="1" lineno="140" slineno="1-82" level="2"><display>(b)</display>Section <xref depth="3" refnumber="63A-3-107" start="0">63A-3-107</xref>; and</subsection><subsection ssid="52-null-48" dnum="c-o" numlevel="1" lineno="141" slineno="1-83" level="2"><display>(c)</display>rules made by the Division of Finance pursuant to Sections <xref depth="3" refnumber="63A-3-106" start="0">63A-3-106</xref> and <xref depth="3" refnumber="63A-3-107" start="0"><ln numlevel="1" lineno="142" slineno="1-84"/>63A-3-107</xref>.</subsection></subsection><subsection ssid="52-null-49" dnum="9-o" numlevel="1" lineno="143" slineno="1-85" level="1" space="false"><display>(9)</display><subsection ssid="52-null-50" dnum="a-o" level="2" placement="sameline"><display>(a)</display>There is created an executive committee of the Agricultural Advisory Board <ln numlevel="1" lineno="144" slineno="1-86"/>consisting of the following seven members selected from members of the <ln numlevel="1" lineno="145" slineno="1-87"/>Agricultural Advisory Board:<subsection ssid="52-null-51" dnum="i-o" numlevel="1" lineno="146" slineno="1-88" level="3" tab="1"><display>(i)</display>the two representatives appointed under Subsection <xref depth="4" refnumber="4-2-108(1)(b)(i)" start="0">(1)(b)(i)</xref>;</subsection><subsection ssid="52-null-52" dnum="ii-o" numlevel="1" lineno="147" slineno="1-89" level="3" tab="1"><display>(ii)</display>the representative appointed under Subsection <xref depth="4" refnumber="4-2-108(1)(b)(ix)" start="0">(1)(b)(ix)</xref>; and</subsection><subsection ssid="52-null-53" dnum="iii-o" numlevel="1" lineno="148" slineno="1-90" level="3" tab="1"><display>(iii)</display>four members selected from the Agricultural Advisory Board as follows:<subsection ssid="52-null-54" dnum="A-o" numlevel="1" lineno="149" slineno="1-91" level="4"><display>(A)</display>for the initial members of the executive committee, by the commissioner; and</subsection><subsection ssid="52-null-55" dnum="B-o" numlevel="1" lineno="150" slineno="1-92" level="4"><display>(B)</display>after the initial members of the executive committee are selected, by the <ln numlevel="1" lineno="151" slineno="1-93"/>executive committee.</subsection></subsection></subsection><subsection ssid="52-null-56" dnum="b-o" numlevel="1" lineno="152" slineno="1-94" level="2" space="false"><display>(b)</display><subsection ssid="52-null-57" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A member of the executive committee shall serve a term of four years on the <ln numlevel="1" lineno="153" slineno="1-95"/>executive committee.</subsection><subsection ssid="52-null-58" dnum="ii-o" numlevel="1" lineno="154" slineno="1-96" level="3"><display>(ii)</display>A member of the executive committee may serve for more than one term on the <ln numlevel="1" lineno="155" slineno="1-97"/>executive committee.</subsection><subsection ssid="52-null-59" dnum="iii-o" numlevel="1" lineno="156" slineno="1-98" level="3"><display>(iii)</display>When a vacancy occurs in the membership of the executive committee for any <ln numlevel="1" lineno="157" slineno="1-99"/>reason, the replacement shall be selected in the same manner as under Subsection <xref depth="4" refnumber="4-2-108(9)(a)" start="0"><ln numlevel="1" lineno="158" slineno="1-100"/>(9)(a)</xref> and for the unexpired term.</subsection></subsection><subsection ssid="52-null-60" dnum="c-o" numlevel="1" lineno="159" slineno="1-101" level="2"><display>(c)</display>Four members of the executive committee constitute a quorum and an action of the <ln numlevel="1" lineno="160" slineno="1-102"/>majority present when a quorum is present is action by the executive committee.</subsection><subsection ssid="52-null-61" dnum="d-o" numlevel="1" lineno="161" slineno="1-103" level="2"><display>(d)</display>The executive committee shall annually select a chair of the executive committee.</subsection><subsection ssid="52-null-62" dnum="e-o" numlevel="1" lineno="162" slineno="1-104" level="2"><display>(e)</display>The executive committee shall meet at least quarterly, except that the chair of the <ln numlevel="1" lineno="163" slineno="1-105"/>executive committee may call the executive committee for additional meetings.</subsection><subsection ssid="52-null-63" dnum="f-o" numlevel="1" lineno="164" slineno="1-106" level="2"><display>(f)</display>The executive committee shall:<subsection ssid="52-null-64" dnum="i-o" numlevel="1" lineno="165" slineno="1-107" level="3"><display>(i)</display>recommend to the department fees to be imposed under this title;</subsection><subsection ssid="52-null-65" dnum="ii-o" numlevel="1" lineno="166" slineno="1-108" level="3"><display>(ii)</display>accept public comment received under this title; and</subsection><subsection ssid="52-null-66" dnum="iii-o" numlevel="1" lineno="167" slineno="1-109" level="3"><display>(iii)</display>carry out the responsibilities assigned to the executive committee by statute.</subsection></subsection></subsection></section></bsec><bsec buid="44" num="4-2-203" type="amend" src="code" uid="C4-2-S203_2026050620260506" sort="04 02 02030020260506" numlevel="1" lineno="168" slineno="2-1" sn="2"><section number="4-2-203" numlevel="1" lineno="169" slineno="2-2" type="amend"><secline lineno="168">Section 2. Section <bold>4-2-203</bold> is amended to read:</secline><catline lineno="169"><bold>4-2-203<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Department of Agriculture and Food Laboratory <ln numlevel="1" lineno="170" slineno="2-3"/>Equipment Fund.</bold></catline><subsection ssid="44-null-1" dnum="1-o" numlevel="1" lineno="171" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>There is created an expendable special revenue fund known as the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="2" style="2" owner="admin" level="1" deltag="both">"</amend><amendoutend style="2"/>Department of <ln numlevel="1" lineno="172" slineno="2-5"/>Agriculture and Food Laboratory Equipment Fund,<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="3" style="2" owner="admin" level="1" deltag="both">"</amend><amendoutend style="2"/> which is referred to in this section <ln numlevel="1" lineno="173" slineno="2-6"/>as the "fund."</subsection><subsection ssid="44-null-2" dnum="2-o" numlevel="1" lineno="174" slineno="2-7" level="1"><display>(2)</display>The fund consists of:<subsection ssid="44-null-3" dnum="a-o" numlevel="1" lineno="175" slineno="2-8" level="2"><display>(a)</display>collections the Division of Laboratories within the department receives under this <ln numlevel="1" lineno="176" slineno="2-9"/>title that are not expended during the previous fiscal year;</subsection><subsection ssid="44-null-4" dnum="b-o" numlevel="1" lineno="177" slineno="2-10" level="2"><display>(b)</display>appropriations from the Legislature; and</subsection><subsection ssid="44-null-5" dnum="c-o" numlevel="1" lineno="178" slineno="2-11" level="2"><display>(c)</display>interest and earnings on the fund.</subsection></subsection><subsection ssid="44-null-6" dnum="3-o" numlevel="1" lineno="179" slineno="2-12" level="1"><display>(3)</display>The state treasurer shall invest the money in the fund according to <xref depth="1" refnumber="51-7" start="0">Title 51, Chapter 7, <ln numlevel="1" lineno="180" slineno="2-13"/>State Money Management Act</xref>, except that interest or other earnings derived from those <ln numlevel="1" lineno="181" slineno="2-14"/>investments shall be deposited into the fund.</subsection><subsection ssid="44-null-7" dnum="4-o" numlevel="1" lineno="182" slineno="2-15" level="1" space="false"><display>(4)</display><subsection ssid="44-null-8" dnum="a-o:_-e" ea="erase" anum="0" owner="admin" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/></display>The department may use money in the fund only to pay for the repair, <ln numlevel="1" lineno="183" slineno="2-16"/>replacement, or upgrade of laboratory equipment in accordance with this section.</subsection></subsection><subsection ssid="44-null-9" dnum="5-o" numlevel="1" lineno="184" slineno="2-17" level="1"><display>(5)</display>The state chemist or the commissioner shall approve expenditures from the fund for <ln numlevel="1" lineno="185" slineno="2-18"/>laboratory equipment repair, replacement, or upgrade as follows:<subsection ssid="44-null-10" dnum="a-o" numlevel="1" lineno="186" slineno="2-19" level="2"><display>(a)</display>the state chemist may approve using money in the fund to repair, replace, or upgrade <ln numlevel="1" lineno="187" slineno="2-20"/>laboratory equipment if the amount to be expended is less than $10,000; and</subsection><subsection ssid="44-null-11" dnum="b-o" numlevel="1" lineno="188" slineno="2-21" level="2"><display>(b)</display>the state chemist shall obtain the approval of the commissioner for using money in <ln numlevel="1" lineno="189" slineno="2-22"/>the fund to repair, replace, or upgrade laboratory equipment if the amount to be <ln numlevel="1" lineno="190" slineno="2-23"/>expended equals or exceeds $10,000.</subsection></subsection><subsection ssid="44-null-12" dnum="6-o" numlevel="1" lineno="191" slineno="2-24" level="1" space="false"><display>(6)</display><subsection ssid="44-null-13" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to the other provisions of this Subsection <xref depth="4" refnumber="4-2-203(6)" start="0">(6)</xref>, the Division of Finance <ln numlevel="1" lineno="192" slineno="2-25"/>shall deposit into the fund the collections that the Division of Laboratories receives <ln numlevel="1" lineno="193" slineno="2-26"/>under this title that are not expended during a fiscal year.</subsection><subsection ssid="44-null-14" dnum="b-o" numlevel="1" lineno="194" slineno="2-27" level="2"><display>(b)</display>The fund may not exceed $500,000 at the end of a fiscal year.</subsection><subsection ssid="44-null-15" dnum="c-o" numlevel="1" lineno="195" slineno="2-28" level="2"><display>(c)</display>If the fund exceeds $500,000 at the end of the fiscal year, the Division of Finance <ln numlevel="1" lineno="196" slineno="2-29"/>shall deposit into the General Fund the money in excess of the amount necessary to <ln numlevel="1" lineno="197" slineno="2-30"/>maintain the fund balance at $500,000.</subsection></subsection></section></bsec><bsec buid="42" num="4-9-119" type="enact" src="code" uid="C4-9-S119_2026050620260506" sort="04 09 01190020260506" numlevel="1" lineno="198" slineno="3-1" sn="3"><section numlevel="1" lineno="199" slineno="3-2" number="4-9-119" type="enact"><secline lineno="198">Section 3. and</amend></subsection><subsection ssid="42-7" dnum="_-o:c-e" numlevel="1" lineno="206" slineno="3-9" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="19" style="1" owner="admin" level="1" amendtag="end">interest and earnings on money in the fund.</amend></subsection></subsection><subsection ssid="42-8" dnum="_-o:3-e" numlevel="1" lineno="207" slineno="3-10" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><subsection ssid="42-9" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="20" style="1" owner="admin" level="1" amendtag="end">The state treasurer shall invest the money in the fund in accordance with Title <xref depth="1" refnumber="51-7">51, <ln numlevel="1" lineno="208" slineno="3-11"/>Chapter </xref><xref depth="1" refnumber="4-7">7</xref>, State Money Management Act.</amend></subsection><subsection ssid="42-10" dnum="_-o:b-e" numlevel="1" lineno="209" slineno="3-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="33" groupid="23" style="1" owner="admin" level="1" amendtag="end">The state treasurer shall deposit interest and other earnings derived from investment <ln numlevel="1" lineno="210" slineno="3-13"/>of expendable special revenue fund money into the fund.</amend></subsection></subsection><subsection ssid="42-12" dnum="_-o:4-e" numlevel="1" lineno="211" slineno="3-14" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1089" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="40" groupid="27" style="1" owner="admin" level="1" amendtag="end">The department may use money in the fund for the maintenance, repair, and purchase of <ln numlevel="1" lineno="212" slineno="3-15"/>equipment<marker pairid="46"/> used in administering the requirements of this chapter, including:</amend><subsection ssid="42-13" dnum="_-o:a-e" numlevel="1" lineno="213" slineno="3-16" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1090" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="33" style="1" owner="admin" level="1" amendtag="end">specialized vehicles;</amend></subsection><subsection ssid="42-14" dnum="_-o:b-e" numlevel="1" lineno="214" slineno="3-17" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1091" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="37" style="1" owner="admin" level="1" amendtag="end">cranes and lifts;</amend></subsection><subsection ssid="42-15" dnum="_-o:c-e" numlevel="1" lineno="215" slineno="3-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1092" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="41" style="1" owner="admin" level="1" amendtag="end">weight carts; and</amend></subsection><subsection ssid="42-16" dnum="_-o:d-e" numlevel="1" lineno="216" slineno="3-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1093" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="72" groupid="50" style="1" owner="admin" level="1" amendtag="end">field, metrology, and fuel laboratory equipment.</amend></subsection></subsection><subsection ssid="42-11" dnum="_-o:5-e" numlevel="1" lineno="217" slineno="3-20" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1094" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><subsection ssid="42-17" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1095" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="25" style="1" owner="admin" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="4-9-119(5)(c)">(5)(c)</xref>, the Division of Finance shall deposit into <ln numlevel="1" lineno="218" slineno="3-21"/>the fund the revenue that the department receives under this chapter that the <ln numlevel="1" lineno="219" slineno="3-22"/>department does not expend during a fiscal year.</amend></subsection><subsection ssid="42-20" dnum="_-o:b-e" numlevel="1" lineno="220" slineno="3-23" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1096" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="86" groupid="57" style="1" owner="admin" level="1" amendtag="end">The fund may not exceed $1,000,000 at the end of a fiscal year.</amend></subsection><subsection ssid="42-18" dnum="_-o:c-e" numlevel="1" lineno="221" slineno="3-24" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1097" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="77" groupid="52" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="4-9-119(5)(a)">(5)(a)</xref>, the Division of Finance shall deposit into the <ln numlevel="1" lineno="222" slineno="3-25"/>General Fund the money in the account in excess of $1,000,000, if any, at the end of <ln numlevel="1" lineno="223" slineno="3-26"/>a fiscal year.</amend></subsection></subsection></section></bsec><bsec buid="5" num="4-18-106" type="amend" src="code" uid="C4-18-S106_2026050620260506" sort="04 18 01060020260506" numlevel="1" lineno="224" slineno="4-1" sn="4"><section number="4-18-106" numlevel="1" lineno="225" slineno="4-2" type="amend"><secline lineno="224">Section 4. Section <bold>4-18-106</bold> is amended to read:</secline><catline lineno="225"><bold>4-18-106<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Agriculture Resource Development Fund -- <ln numlevel="1" lineno="226" slineno="4-3"/>Contents -- Use of fund money -- Advisory board.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="227" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="5-null-2" dnum="a-o" numlevel="1" lineno="228" slineno="4-5" level="2"><display>(a)</display>"Disaster" means an extraordinary circumstance, including a flood, drought, or fire, <ln numlevel="1" lineno="229" slineno="4-6"/>that results in:<subsection ssid="5-null-3" dnum="i-o" numlevel="1" lineno="230" slineno="4-7" level="3"><display>(i)</display>the president of the United States declaring an emergency or major disaster in the <ln numlevel="1" lineno="231" slineno="4-8"/>state;</subsection><subsection ssid="5-null-4" dnum="ii-o" numlevel="1" lineno="232" slineno="4-9" level="3"><display>(ii)</display>the governor declaring a state of emergency under <xref depth="2" refnumber="53-2a-2" start="0">Title 53, Chapter 2a, Part 2, <ln numlevel="1" lineno="233" slineno="4-10"/>Disaster Response and Recovery Act</xref>; or</subsection><subsection ssid="5-null-5" dnum="iii-o" numlevel="1" lineno="234" slineno="4-11" level="3"><display>(iii)</display>the chief executive officer of a local government declaring a local emergency <ln numlevel="1" lineno="235" slineno="4-12"/>under <xref depth="2" refnumber="53-2a-2" start="0">Title 53, Chapter 2a, Part 2, Disaster Response and Recovery Act</xref>.</subsection></subsection><subsection ssid="5-null-6" dnum="b-o" numlevel="1" lineno="236" slineno="4-13" level="2"><display>(b)</display>"Fund" means the Agriculture Resource Development Fund created in this section.</subsection><subsection ssid="5-null-7" dnum="c-o" numlevel="1" lineno="237" slineno="4-14" level="2"><display>(c)</display>"Local government" means the same as that term is defined in Section <xref depth="3" refnumber="53-2a-602" start="0">53-2a-602</xref>.</subsection></subsection><subsection ssid="5-null-8" dnum="2-o" numlevel="1" lineno="238" slineno="4-15" level="1"><display>(2)</display>There is created a revolving loan fund known as the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="admin" level="1" deltag="both">"</amend><amendoutend style="2"/>Agriculture Resource <ln numlevel="1" lineno="239" slineno="4-16"/>Development Fund.<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="admin" level="1" deltag="both">"</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-9" dnum="3-o" numlevel="1" lineno="240" slineno="4-17" level="1"><display>(3)</display>The fund shall consist of:<subsection ssid="5-null-10" dnum="a-o" numlevel="1" lineno="241" slineno="4-18" level="2"><display>(a)</display>money appropriated to the fund by the Legislature;</subsection><subsection ssid="5-null-11" dnum="b-o" numlevel="1" lineno="242" slineno="4-19" level="2"><display>(b)</display>money received for the repayment of loans made from the fund;</subsection><subsection ssid="5-null-12" dnum="c-o" numlevel="1" lineno="243" slineno="4-20" level="2"><display>(c)</display>money from a preferential user to reimburse the commission for loans made from the <ln numlevel="1" lineno="244" slineno="4-21"/>fund in accordance with <xref depth="2" refnumber="73-3d-4" start="0">Title 73, Chapter 3d, Part 4, Compensation</xref>;</subsection><subsection ssid="5-null-13" dnum="d-o" numlevel="1" lineno="245" slineno="4-22" level="2"><display>(d)</display>money made available to the state for agriculture resource development or for a <ln numlevel="1" lineno="246" slineno="4-23"/>temporary water shortage emergency, as defined in Section <xref depth="3" refnumber="73-3d-101" start="0">73-3d-101</xref>, from any <ln numlevel="1" lineno="247" slineno="4-24"/>source; and</subsection><subsection ssid="5-null-14" dnum="e-o" numlevel="1" lineno="248" slineno="4-25" level="2"><display>(e)</display>interest earned on the fund.</subsection></subsection><subsection ssid="5-null-15" dnum="4-o" numlevel="1" lineno="249" slineno="4-26" level="1"><display>(4)</display>The commission may make loans from the fund for:<subsection ssid="5-null-16" dnum="a-o" numlevel="1" lineno="250" slineno="4-27" level="2"><display>(a)</display>a rangeland improvement and management project;</subsection><subsection ssid="5-null-17" dnum="b-o" numlevel="1" lineno="251" slineno="4-28" level="2"><display>(b)</display>a watershed protection or flood prevention project;</subsection><subsection ssid="5-null-18" dnum="c-o" numlevel="1" lineno="252" slineno="4-29" level="2"><display>(c)</display>a soil and water conservation project;</subsection><subsection ssid="5-null-19" dnum="d-o" numlevel="1" lineno="253" slineno="4-30" level="2"><display>(d)</display>a program designed to promote energy efficient farming practices;</subsection><subsection ssid="5-null-20" dnum="e-o" numlevel="1" lineno="254" slineno="4-31" level="2"><display>(e)</display>an improvement program for agriculture product storage or program designed to <ln numlevel="1" lineno="255" slineno="4-32"/>protect a crop or animal resource;</subsection><subsection ssid="5-null-21" dnum="f-o" numlevel="1" lineno="256" slineno="4-33" level="2"><display>(f)</display>a hydroponic or aquaponic system, including a hydroponic fodder production system;</subsection><subsection ssid="5-null-22" dnum="g-o" numlevel="1" lineno="257" slineno="4-34" level="2"><display>(g)</display>a project or program to improve water quality;</subsection><subsection ssid="5-null-23" dnum="h-o" numlevel="1" lineno="258" slineno="4-35" level="2"><display>(h)</display>a project to address other environmental issues;</subsection><subsection ssid="5-null-24" dnum="i-o" numlevel="1" lineno="259" slineno="4-36" level="2"><display>(i)</display>subject to Subsection <xref depth="4" refnumber="4-18-106(5)" start="0">(5)</xref>, a disaster relief program designed to aid the sustainability <ln numlevel="1" lineno="260" slineno="4-37"/>of agriculture during and immediately following a disaster; or</subsection><subsection ssid="5-null-25" dnum="j-o" numlevel="1" lineno="261" slineno="4-38" level="2"><display>(j)</display>subject to Subsection <xref depth="4" refnumber="4-18-106(6)" start="0">(6)</xref>, authorized for temporary water shortage emergencies as <ln numlevel="1" lineno="262" slineno="4-39"/>provided in <xref depth="2" refnumber="73-3d-4" start="0">Title 73, Chapter 3d, Part 4, Compensation</xref>.</subsection></subsection><subsection ssid="5-null-26" dnum="5-o" numlevel="1" lineno="263" slineno="4-40" level="1" space="false"><display>(5)</display><subsection ssid="5-38" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1124" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="14" style="1" owner="admin" level="1" amendtag="end">Except as provided in Subsection <xref depth="4" refnumber="4-18-106(5)(b)">(5)(b)</xref>, the department shall limit loans for <ln numlevel="1" lineno="264" slineno="4-41"/>disaster relief programs under Subsection <xref depth="4" refnumber="4-18-106(4)(i)">(4)(i)</xref> to no more than 10% of the total <ln numlevel="1" lineno="265" slineno="4-42"/>amount of:</amend><subsection ssid="5-41" dnum="_-o:i-e" numlevel="1" lineno="266" slineno="4-43" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1125" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="22" style="1" owner="admin" level="1" amendtag="end">the balance of money in the fund; and</amend></subsection><subsection ssid="5-42" dnum="_-o:ii-e" numlevel="1" lineno="267" slineno="4-44" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1126" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="30" groupid="26" style="1" owner="admin" level="1" amendtag="end">the outstanding loans issued from the fund.</amend></subsection></subsection><subsection ssid="5-null-27" dnum="a-o:_-e" numlevel="1" lineno="268" slineno="4-45" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1127" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="12" groupid="12" style="2" owner="admin" level="1" deltag="end">Loans made through a disaster relief program described in Subsection <xref depth="4" refnumber="4-18-106(4)(i)" start="0">(4)(i)</xref> may not <ln numlevel="1" lineno="269" slineno="4-46"/>comprise more than 10% of the funds appropriated by the Legislature to the fund.</amend><amendoutend style="2"/></subsection><subsection ssid="5-null-28" dnum="b-o" numlevel="1" lineno="270" slineno="4-47" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="4-18-106(5)(a)" start="0">(5)(a)</xref>, the department may use the money appropriated <ln numlevel="1" lineno="271" slineno="4-48"/>to the fund by the Legislature or another source, without limitation, if the money is <ln numlevel="1" lineno="272" slineno="4-49"/>appropriated specifically for use in a disaster relief program.</subsection><subsection ssid="5-null-29" dnum="c-o" numlevel="1" lineno="273" slineno="4-50" level="2" space="false"><display>(c)</display><subsection ssid="5-null-30" dnum="i-o" level="3" placement="sameline"><display>(i)</display>Until December 31, 2024, the department is authorized to borrow up to <ln numlevel="1" lineno="274" slineno="4-51"/>$3,000,000 of General Fund appropriations from the Agricultural Water <ln numlevel="1" lineno="275" slineno="4-52"/>Optimization Account created in Section <xref depth="3" refnumber="73-10g-204" start="0">73-10g-204</xref> to be used in making loans <ln numlevel="1" lineno="276" slineno="4-53"/>through a disaster relief program described in Subsection <xref depth="4" refnumber="4-18-106(4)(i)" start="0">(4)(i)</xref>.</subsection><subsection ssid="5-null-31" dnum="ii-o" numlevel="1" lineno="277" slineno="4-54" level="3"><display>(ii)</display>If the department borrows from the Agricultural Water Optimization Account <ln numlevel="1" lineno="278" slineno="4-55"/>under Subsection <xref depth="4" refnumber="4-18-106(5)(c)(i)" start="0">(5)(c)(i)</xref>, the department shall deposit the repayment of principal <ln numlevel="1" lineno="279" slineno="4-56"/>and interest on loans made through a disaster relief program, regardless of the <ln numlevel="1" lineno="280" slineno="4-57"/>source of the funds used to make those loans, into the Agricultural Water <ln numlevel="1" lineno="281" slineno="4-58"/>Optimization Account, with preference over the repayment of any other source of <ln numlevel="1" lineno="282" slineno="4-59"/>funds, until the Agricultural Water Optimization Account is repaid in full.</subsection></subsection></subsection><subsection ssid="5-null-32" dnum="6-o" numlevel="1" lineno="283" slineno="4-60" level="1"><display>(6)</display>The commission may not have at one time an aggregate amount of loans made under <ln numlevel="1" lineno="284" slineno="4-61"/>Subsection <xref depth="4" refnumber="4-18-106(4)(j)" start="0">(4)(j)</xref> that exceeds $5,000,000.</subsection><subsection ssid="5-null-33" dnum="7-o" numlevel="1" lineno="285" slineno="4-62" level="1"><display>(7)</display>The commission may appoint an advisory board to:<subsection ssid="5-null-34" dnum="a-o" numlevel="1" lineno="286" slineno="4-63" level="2"><display>(a)</display>oversee the award process for loans, as described in this section;</subsection><subsection ssid="5-null-35" dnum="b-o" numlevel="1" lineno="287" slineno="4-64" level="2"><display>(b)</display>approve loans; and</subsection><subsection ssid="5-null-36" dnum="c-o" numlevel="1" lineno="288" slineno="4-65" level="2"><display>(c)</display>recommend policies and procedures for the fund that are consistent with statute.</subsection></subsection><subsection ssid="5-null-37" dnum="8-o" numlevel="1" lineno="289" slineno="4-66" level="1"><display>(8)</display>The department shall obtain an approved annual budget from the commission to use <ln numlevel="1" lineno="290" slineno="4-67"/>money from the fund to pay for the costs of administering the fund and loans made from <ln numlevel="1" lineno="291" slineno="4-68"/>the fund.</subsection></section></bsec><bsec buid="14" num="4-24-102" type="amend" src="code" uid="C4-24-S102_2026050620260506" sort="04 24 01020020260506" numlevel="1" lineno="292" slineno="5-1" sn="5"><section number="4-24-102" numlevel="1" lineno="293" slineno="5-2" type="amend"><secline lineno="292">Section 5. Section <bold>4-24-102</bold> is amended to read:</secline><catline lineno="293"><bold>4-24-102<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Definitions.</bold></catline><sectionText lineno="294"><tab/>As used in this chapter:</sectionText><subsection ssid="14-null-1" dnum="1-o" numlevel="1" lineno="295" slineno="5-4" level="1"><display>(1)</display>"Brand" means an identifiable mark<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="5" style="2" owner="admin" level="1" deltag="both">, including a tattoo or cutting and shaping of the <ln numlevel="1" lineno="296" slineno="5-5"/>ears or brisket area, applied to livestock</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="admin" level="1" amendtag="both" space="true"> applied to livestock, including a cutting and <ln numlevel="1" lineno="297" slineno="5-6"/>shaping of the ears or brisket area,</amend> that is intended to show ownership and the mark's <ln numlevel="1" lineno="298" slineno="5-7"/>location.</subsection><subsection ssid="14-null-2" dnum="2-o" numlevel="1" lineno="299" slineno="5-8" level="1"><display>(2)</display>"Carcass" means any part of the body of an animal, including entrails and edible meats.</subsection><subsection ssid="14-null-3" dnum="3-o" numlevel="1" lineno="300" slineno="5-9" level="1"><display>(3)</display>"Domesticated elk" means the same as that term is defined in Section <xref depth="3" refnumber="4-39-102">4-39-102</xref>.</subsection><subsection ssid="14-null-4" dnum="4-o" numlevel="1" lineno="301" slineno="5-10" level="1"><display>(4)</display>"Hide" means any skins or wool removed from livestock.</subsection><subsection ssid="14-null-5" dnum="5-o" numlevel="1" lineno="302" slineno="5-11" level="1"><display>(5)</display>"Livestock" means cattle, calves, horses, mules, or sheep.</subsection><subsection ssid="14-null-6" dnum="6-o" numlevel="1" lineno="303" slineno="5-12" level="1" space="false"><display>(6)</display><subsection ssid="14-null-7" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Livestock market" means a public market place consisting of pens or other <ln numlevel="1" lineno="304" slineno="5-13"/>enclosures where cattle, calves, horses, or mules are received on consignment and <ln numlevel="1" lineno="305" slineno="5-14"/>kept for subsequent sale, either through public auction or private sale.</subsection><subsection ssid="14-null-8" dnum="b-o" numlevel="1" lineno="306" slineno="5-15" level="2"><display>(b)</display>"Livestock market" does not mean:<subsection ssid="14-null-9" dnum="i-o" numlevel="1" lineno="307" slineno="5-16" level="3"><display>(i)</display>a place used solely for liquidation of livestock by a farmer, dairyman, livestock <ln numlevel="1" lineno="308" slineno="5-17"/>breeder, or feeder who is going out of business; or</subsection><subsection ssid="14-null-10" dnum="ii-o" numlevel="1" lineno="309" slineno="5-18" level="3"><display>(ii)</display>a place where an association of livestock breeders under the association's own <ln numlevel="1" lineno="310" slineno="5-19"/>management:<subsection ssid="14-null-11" dnum="A-o" numlevel="1" lineno="311" slineno="5-20" level="4"><display>(A)</display>offers registered livestock or breeding sires for sale;</subsection><subsection ssid="14-null-12" dnum="B-o" numlevel="1" lineno="312" slineno="5-21" level="4"><display>(B)</display>assumes the responsibility for the sale;</subsection><subsection ssid="14-null-13" dnum="C-o" numlevel="1" lineno="313" slineno="5-22" level="4"><display>(C)</display>guarantees title to the livestock or sires sold; and</subsection><subsection ssid="14-null-14" dnum="D-o" numlevel="1" lineno="314" slineno="5-23" level="4"><display>(D)</display>arranges with the department for brand inspection of the animals sold.</subsection></subsection></subsection></subsection><subsection ssid="14-null-15" dnum="7-o" numlevel="1" lineno="315" slineno="5-24" level="1"><display>(7)</display>"Open range" means land upon which cattle, sheep, or other domestic animals are <ln numlevel="1" lineno="316" slineno="5-25"/>grazed or permitted to roam by custom, license, lease, or permit.</subsection><subsection ssid="14-null-16" dnum="8-o" numlevel="1" lineno="317" slineno="5-26" level="1"><display>(8)</display>"Slaughterhouse" means a building, plant, or establishment where animals are <ln numlevel="1" lineno="318" slineno="5-27"/>harvested, dressed, or processed and the animals' meat or meat products produced for <ln numlevel="1" lineno="319" slineno="5-28"/>human consumption.</subsection></section></bsec><bsec buid="21" num="17D-3-301" type="amend" src="code" uid="C17D-3-S301_2026050620260506" sort="17D03 03010020260506" numlevel="1" lineno="320" slineno="6-1" sn="6"><section number="17D-3-301" numlevel="1" lineno="321" slineno="6-2" type="amend"><secline lineno="320">Section 6. Section <bold>17D-3-301</bold> is amended to read:</secline><catline lineno="321"><bold>17D-3-301<parens><paren sort="00" type="original" show="true"><effect>Effective </effect><date>05/06/26</date></paren></parens>. Board of supervisors -- Number -- Term -- Chair <ln numlevel="1" lineno="322" slineno="6-3"/>and officers -- Quorum -- Compensation.</bold></catline><subsection ssid="21-null-1" dnum="1-o" numlevel="1" lineno="323" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>A board of supervisors shall govern a conservation district.</subsection><subsection ssid="21-null-2" dnum="2-o" numlevel="1" lineno="324" slineno="6-5" level="1"><display>(2)</display>The board of supervisors of a conservation district consists of five members appointed <ln numlevel="1" lineno="325" slineno="6-6"/>as provided in this part, at least three of whom shall be private agricultural land <ln numlevel="1" lineno="326" slineno="6-7"/>operators.</subsection><subsection ssid="21-null-3" dnum="3-o" numlevel="1" lineno="327" slineno="6-8" level="1" space="false"><display>(3)</display><subsection ssid="21-null-4" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="17D-3-301(3)(c)" start="0">(3)(c)</xref>, the term of office of a member of a board of <ln numlevel="1" lineno="328" slineno="6-9"/>supervisors is four years.</subsection><subsection ssid="21-null-5" dnum="b-o" numlevel="1" lineno="329" slineno="6-10" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="17D-3-301(3)(a)" start="0">(3)(a)</xref>, if multiple conservation districts are consolidated <ln numlevel="1" lineno="330" slineno="6-11"/>or a single conservation district divided or dissolved under <xref depth="2" refnumber="17D-3-2" start="2">Part 2, Creation, <ln numlevel="1" lineno="331" slineno="6-12"/>Consolidation, Division, and Dissolution of Conservation Districts</xref>:<subsection ssid="21-null-6" dnum="i-o" numlevel="1" lineno="332" slineno="6-13" level="3"><display>(i)</display>the term of each member of the board of supervisors of the consolidated <ln numlevel="1" lineno="333" slineno="6-14"/>conservation districts or the divided or dissolved conservation district terminates <ln numlevel="1" lineno="334" slineno="6-15"/>immediately upon consolidation, division, or dissolution; and</subsection><subsection ssid="21-null-7" dnum="ii-o" numlevel="1" lineno="335" slineno="6-16" level="3" space="false"><display>(ii)</display><subsection ssid="21-null-8" dnum="A-o" level="4" placement="sameline"><display>(A)</display>the commissioner shall appoint a new board of supervisors, as provided in <ln numlevel="1" lineno="336" slineno="6-17"/>this part, for the consolidated conservation district or divided conservation <ln numlevel="1" lineno="337" slineno="6-18"/>districts, as the case may be; and</subsection><subsection ssid="21-null-9" dnum="B-o" numlevel="1" lineno="338" slineno="6-19" level="4"><display>(B)</display>subject to Subsection <xref depth="4" refnumber="17D-3-301(3)(c)" start="0">(3)(c)</xref>, the term of office of a member of the board of <ln numlevel="1" lineno="339" slineno="6-20"/>supervisors appointed is four years.</subsection></subsection></subsection><subsection ssid="21-null-10" dnum="c-o" numlevel="1" lineno="340" slineno="6-21" level="2"><display>(c)</display>Notwithstanding the other provisions of this Subsection <xref depth="4" refnumber="17D-3-301(3)" start="0">(3)</xref>, the commissioner may<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="admin" level="1" deltag="both">,</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="admin" level="1" amendtag="both" space="true">:</amend> <subsection ssid="21-20" dnum="_-o:i-e" numlevel="1" lineno="341" slineno="6-22" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="14" style="1" owner="admin" level="1" amendtag="end">with the approval of the commission, remove a board member for cause; and</amend></subsection><subsection ssid="21-18" dnum="_-o:ii-e" numlevel="1" lineno="342" slineno="6-23" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1165" style="1" owner="e" level="1" amendtag="both">(ii)</amend></display>at the time of appointment or reappointment, adjust the length of terms to ensure <ln numlevel="1" lineno="343" slineno="6-24"/>that the terms of board members are staggered so that approximately half of the <ln numlevel="1" lineno="344" slineno="6-25"/>board is appointed every two years.</subsection></subsection></subsection><subsection ssid="21-null-11" dnum="4-o" numlevel="1" lineno="345" slineno="6-26" level="1"><display>(4)</display>The board of supervisors shall elect a chair from among their number for a term of one <ln numlevel="1" lineno="346" slineno="6-27"/>year, and may elect other officers from among their number that the board considers <ln numlevel="1" lineno="347" slineno="6-28"/>necessary.</subsection><subsection ssid="21-null-12" dnum="5-o" numlevel="1" lineno="348" slineno="6-29" level="1"><display>(5)</display>A majority of the board of supervisors constitutes a quorum for the transaction of board <ln numlevel="1" lineno="349" slineno="6-30"/>business, and action by a majority of a quorum present at a meeting of the board <ln numlevel="1" lineno="350" slineno="6-31"/>constitutes action of the board.</subsection><subsection ssid="21-null-13" dnum="6-o" numlevel="1" lineno="351" slineno="6-32" level="1"><display>(6)</display>For performing official duties, a member of the board of supervisors of a conservation <ln numlevel="1" lineno="352" slineno="6-33"/>district shall receive:<subsection ssid="21-null-14" dnum="a-o" numlevel="1" lineno="353" slineno="6-34" level="2"><display>(a)</display>per diem and travel expenses in accordance with Section <xref depth="3" refnumber="11-55-103" start="0">11-55-103</xref>; and</subsection><subsection ssid="21-null-15" dnum="b-o" numlevel="1" lineno="354" slineno="6-35" level="2"><display>(b)</display>actual and necessary expenses as determined by the department.</subsection></subsection></section></bsec><bsec buid="2" num="73-10g-206" type="amend" src="code" uid="C73-10g-S206_2026050620260506" sort="73 10g02060020260506" numlevel="1" lineno="355" slineno="7-1" sn="7"><section number="73-10g-206" numlevel="1" lineno="356" slineno="7-2" type="amend"><secline lineno="355">Section 7. Section <bold>73-10g-206</bold> is amended to read:</secline><catline lineno="356"><bold>73-10g-206<parens><paren sort="00" type="original" show="true" display="space"><effect>Effective </effect><date>05/06/26</date></paren><paren sort="00" type="original" show="true"><effect>Repealed </effect><date>07/01/28</date></paren></parens>. Agricultural water <ln numlevel="1" lineno="357" slineno="7-3"/>optimization grants -- Demonstration of water savings.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="358" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>The conservation commission may issue a grant described in Subsection <xref depth="4" refnumber="73-10g-204(3)">73-10g-204(3)</xref> <ln numlevel="1" lineno="359" slineno="7-5"/>in accordance with the procedures in this section.</subsection><subsection ssid="2-null-2" dnum="2-o" numlevel="1" lineno="360" slineno="7-6" level="1" space="false"><display>(2)</display><subsection ssid="2-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The committee shall establish funding application periods during which a person <ln numlevel="1" lineno="361" slineno="7-7"/>may apply for a grant under this part.</subsection><subsection ssid="2-null-4" dnum="b-o" numlevel="1" lineno="362" slineno="7-8" level="2"><display>(b)</display>During a funding application period, a person may file a funding application with the <ln numlevel="1" lineno="363" slineno="7-9"/>department for preliminary screening of eligibility to receive a grant under this part, <ln numlevel="1" lineno="364" slineno="7-10"/>including requisite water savings.</subsection><subsection ssid="2-null-5" dnum="c-o" numlevel="1" lineno="365" slineno="7-11" level="2"><display>(c)</display>The department shall screen the funding applications for eligibility.</subsection><subsection ssid="2-null-6" dnum="d-o" numlevel="1" lineno="366" slineno="7-12" level="2"><display>(d)</display>If the department determines that an applicant meets eligibility requirements and <ln numlevel="1" lineno="367" slineno="7-13"/>proposes water savings, the department shall provide the applicant preliminary <ln numlevel="1" lineno="368" slineno="7-14"/>approval.</subsection><subsection ssid="2-null-7" dnum="e-o" numlevel="1" lineno="369" slineno="7-15" level="2"><display>(e)</display>After receiving preliminary approval under Subsection <xref depth="4" refnumber="73-10g-206(2)(d)">(2)(d)</xref>, the applicant <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">shall</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="370" slineno="7-16"/>may</amend> engage in a pre-filing consultation with the Division of Water Rights under <ln numlevel="1" lineno="371" slineno="7-17"/>Subsection <xref depth="4" refnumber="73-3-3(2)">73-3-3(2)</xref> to determine whether a change application is required to <ln numlevel="1" lineno="372" slineno="7-18"/>accomplish the project proposed in the funding application or to quantify saved water<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="4" style="2" owner="admin" level="1" deltag="both"> </amend><amendoutend style="2"/>.</subsection><subsection ssid="2-null-8" dnum="f-o" numlevel="1" lineno="373" slineno="7-19" level="2"><display>(f)</display>Once the Division of Water Rights determines whether the person is required to file a <ln numlevel="1" lineno="374" slineno="7-20"/>change application, the person may complete the funding application process and file <ln numlevel="1" lineno="375" slineno="7-21"/>the completed funding application with the committee.</subsection><subsection ssid="2-null-9" dnum="g-o" numlevel="1" lineno="376" slineno="7-22" level="2"><display>(g)</display>The committee shall review completed funding applications to rank the funding <ln numlevel="1" lineno="377" slineno="7-23"/>applications and recommend to the conservation commission which applicants should <ln numlevel="1" lineno="378" slineno="7-24"/>receive a grant under this part for the relevant funding application period.</subsection><subsection ssid="2-null-10" dnum="h-o" numlevel="1" lineno="379" slineno="7-25" level="2"><display>(h)</display>The conservation commission may issue a grant under this section only after receipt <ln numlevel="1" lineno="380" slineno="7-26"/>of the recommendations of the committee.</subsection></subsection><subsection ssid="2-null-11" dnum="3-o" numlevel="1" lineno="381" slineno="7-27" level="1"><display>(3)</display>If the conservation commission issues a grant under this part, before the grant recipient <ln numlevel="1" lineno="382" slineno="7-28"/>may receive the grant money, the grant recipient shall:<subsection ssid="2-null-12" dnum="a-o" numlevel="1" lineno="383" slineno="7-29" level="2"><display>(a)</display>enter into a contract with the department that includes:<subsection ssid="2-null-13" dnum="i-o" numlevel="1" lineno="384" slineno="7-30" level="3"><display>(i)</display>the expectations for the grant recipient;</subsection><subsection ssid="2-null-14" dnum="ii-o" numlevel="1" lineno="385" slineno="7-31" level="3"><display>(ii)</display>the life expectancy of a project;</subsection><subsection ssid="2-null-15" dnum="iii-o" numlevel="1" lineno="386" slineno="7-32" level="3"><display>(iii)</display>the process of certifying completion; and</subsection><subsection ssid="2-null-16" dnum="iv-o" numlevel="1" lineno="387" slineno="7-33" level="3"><display>(iv)</display>design requirements;</subsection></subsection><subsection ssid="2-null-17" dnum="b-o" numlevel="1" lineno="388" slineno="7-34" level="2"><display>(b)</display>file any needed change application and obtain a final order from the state engineer <ln numlevel="1" lineno="389" slineno="7-35"/>approving the change application, including any judicial review of the state <ln numlevel="1" lineno="390" slineno="7-36"/>engineer's order; and</subsection><subsection ssid="2-null-18" dnum="c-o" numlevel="1" lineno="391" slineno="7-37" level="2"><display>(c)</display>demonstrate how the grant recipient shall comply with the requirements of the final <ln numlevel="1" lineno="392" slineno="7-38"/>order approving the related change application.</subsection></subsection><subsection ssid="2-null-19" dnum="4-o" numlevel="1" lineno="393" slineno="7-39" level="1"><display>(4)</display>A grant recipient shall comply with the monitoring and reporting requirements under the <ln numlevel="1" lineno="394" slineno="7-40"/>contract described in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="7" style="2" owner="admin" level="1" deltag="both">Subsection <xref depth="4" refnumber="73-10g-206(3)">(3)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="6" style="1" owner="admin" level="1" amendtag="both" space="true">Subsection <xref depth="4" refnumber="73-10g-206(3)(a)">(3)(a)</xref></amend>.</subsection><subsection ssid="2-null-20" dnum="5-o" numlevel="1" lineno="395" slineno="7-41" level="1"><display>(5)</display>The department shall:<subsection ssid="2-null-21" dnum="a-o" numlevel="1" lineno="396" slineno="7-42" level="2"><display>(a)</display>monitor the grant related activities of a grant recipient;</subsection><subsection ssid="2-null-22" dnum="b-o" numlevel="1" lineno="397" slineno="7-43" level="2"><display>(b)</display>certify a project funded by a grant once the project is complete;</subsection><subsection ssid="2-null-23" dnum="c-o" numlevel="1" lineno="398" slineno="7-44" level="2"><display>(c)</display>determine whether there are funding sources other than the account to fund the grant; <ln numlevel="1" lineno="399" slineno="7-45"/>and</subsection><subsection ssid="2-null-24" dnum="d-o" numlevel="1" lineno="400" slineno="7-46" level="2"><display>(d)</display>provide information needed by the division or the Division of Water Rights to fulfill <ln numlevel="1" lineno="401" slineno="7-47"/>the division's or the Division of Water Rights' statutory duties, including those <ln numlevel="1" lineno="402" slineno="7-48"/>designated in this chapter.</subsection></subsection><subsection ssid="2-null-25" dnum="6-o" numlevel="1" lineno="403" slineno="7-49" level="1"><display>(6)</display>The department may:<subsection ssid="2-null-26" dnum="a-o" numlevel="1" lineno="404" slineno="7-50" level="2"><display>(a)</display>conduct outreach campaigns related to the grant program, including the program's <ln numlevel="1" lineno="405" slineno="7-51"/>purpose and expectations for grant recipients;</subsection><subsection ssid="2-null-27" dnum="b-o" numlevel="1" lineno="406" slineno="7-52" level="2"><display>(b)</display>solicit funding applications and assist persons in applying for a grant under this part;</subsection><subsection ssid="2-null-28" dnum="c-o" numlevel="1" lineno="407" slineno="7-53" level="2"><display>(c)</display>assist grant recipients in developing a project; and</subsection><subsection ssid="2-null-29" dnum="d-o" numlevel="1" lineno="408" slineno="7-54" level="2"><display>(d)</display>coordinate with federal agencies and the division for evaluation of funding <ln numlevel="1" lineno="409" slineno="7-55"/>applications and for assistance with implementing projects for which funding has <ln numlevel="1" lineno="410" slineno="7-56"/>been provided under this part.</subsection></subsection><subsection ssid="2-null-30" dnum="7-o" numlevel="1" lineno="411" slineno="7-57" level="1"><display>(7)</display>Grant money may be used by the department or a grant recipient for the hiring of <ln numlevel="1" lineno="412" slineno="7-58"/>third-party consultants as appropriate to complete a project funded by grant money.</subsection><subsection ssid="2-null-31" dnum="8-o" numlevel="1" lineno="413" slineno="7-59" level="1"><display>(8)</display>The division, upon request from the committee, may assist with evaluation of funding <ln numlevel="1" lineno="414" slineno="7-60"/>applications and implementation of projects funded under this part.</subsection></section></bsec><bsec buid="47" num="73-10g-207" type="amend" src="code" uid="C73-10g-S207_2026050620260506" sort="73 10g02070020260506" numlevel="1" lineno="415" slineno="8-1" Public information and <ln numlevel="1" lineno="417" slineno="8-3"/>reporting.</bold></catline><subsection ssid="47-null-1" dnum="1-o" numlevel="1" lineno="418" slineno="8-4" level="1" placement="noreturn"><display>(1)</display>The <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="13" groupid="13" style="2" owner="admin" level="1" deltag="both">division</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="admin" level="1" amendtag="both" space="true">department</amend> shall, in coordination with the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="14" style="2" owner="admin" level="1" deltag="both">department</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="8" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">division</amend> and the <ln numlevel="1" lineno="419" slineno="8-5"/>Division of Water Rights, annually compile and publish a report on:<subsection ssid="47-null-2" dnum="a-o" numlevel="1" lineno="420" slineno="8-6" level="2"><display>(a)</display>completed projects;</subsection><subsection ssid="47-null-3" dnum="b-o" numlevel="1" lineno="421" slineno="8-7" level="2"><display>(b)</display>saved water made available from agricultural water optimization projects; and</subsection><subsection ssid="47-null-4" dnum="c-o" numlevel="1" lineno="422" slineno="8-8" level="2"><display>(c)</display>the effectiveness of the agricultural water optimization funding programs established <ln numlevel="1" lineno="423" slineno="8-9"/>by this part.</subsection></subsection><subsection ssid="47-null-5" dnum="2-o" numlevel="1" lineno="424" slineno="8-10" level="1"><display>(2)</display>On or before November 30 of each year, the committee, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="15" style="2" owner="admin" level="1" deltag="both">division</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="21" groupid="18" style="1" owner="admin" level="1" amendtag="both" space="true">the department</amend>, and <ln numlevel="1" lineno="425" slineno="8-11"/>the Division of Water Rights shall jointly present the annual report to:<subsection ssid="47-null-6" dnum="a-o" numlevel="1" lineno="426" slineno="8-12" level="2"><display>(a)</display>the Legislative Water Development Commission;</subsection><subsection ssid="47-null-7" dnum="b-o" numlevel="1" lineno="427" slineno="8-13" level="2"><display>(b)</display>the Natural Resources, Agriculture, and Environment Interim Committee;</subsection><subsection ssid="47-null-8" dnum="c-o" numlevel="1" lineno="428" slineno="8-14" level="2"><display>(c)</display>the Utah Water Task Force within the Department of Natural Resources;
