Section <bold>26B-1-202</bold> is amended to read:</secline><catline lineno="34"><bold>26B-1-202<parens/>. Department authority and duties.</bold></catline><subsection ssid="96-null-1" dnum="1-o" numlevel="1" lineno="35" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section, "public funds" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-101"><ln numlevel="1" lineno="36" slineno="1-4"/>26B-5-101</xref>.</subsection><subsection ssid="96-null-2" dnum="2-o" numlevel="1" lineno="37" slineno="1-5" level="1"><display>(2)</display>The department may, subject to applicable restrictions in state law and in addition to all <ln numlevel="1" lineno="38" slineno="1-6"/>other authority and responsibility granted to the department by law:<subsection ssid="96-null-3" dnum="a-o" numlevel="1" lineno="39" slineno="1-7" level="2"><display>(a)</display>adopt rules, in accordance with Title <xref depth="1" refnumber="63G-3">63G, Chapter 3</xref>, Utah Administrative <ln numlevel="1" lineno="40" slineno="1-8"/>Rulemaking Act, and not inconsistent with law, as the department may consider <ln numlevel="1" lineno="41" slineno="1-9"/>necessary or desirable for providing health and social services to the people of this <ln numlevel="1" lineno="42" slineno="1-10"/>state;</subsection><subsection ssid="96-null-4" dnum="b-o" numlevel="1" lineno="43" slineno="1-11" level="2"><display>(b)</display>establish and manage client trust accounts in the department's institutions and <ln numlevel="1" lineno="44" slineno="1-12"/>community programs, at the request of the client or the client's legal guardian or <ln numlevel="1" lineno="45" slineno="1-13"/>representative, or in accordance with federal law;</subsection><subsection ssid="96-null-5" dnum="c-o" numlevel="1" lineno="46" slineno="1-14" level="2"><display>(c)</display>purchase, as authorized or required by law, services that the department is <ln numlevel="1" lineno="47" slineno="1-15"/>responsible to provide for legally eligible persons;</subsection><subsection ssid="96-null-6" dnum="d-o" numlevel="1" lineno="48" slineno="1-16" level="2"><display>(d)</display>conduct adjudicative proceedings for clients and providers in accordance with the <ln numlevel="1" lineno="49" slineno="1-17"/>procedures of Title <xref depth="1" refnumber="63G-4">63G, Chapter 4</xref>, Administrative Procedures Act;</subsection><subsection ssid="96-null-7" dnum="e-o" numlevel="1" lineno="50" slineno="1-18" level="2"><display>(e)</display>establish eligibility standards for the department's programs, not inconsistent with <ln numlevel="1" lineno="51" slineno="1-19"/>state or federal law or regulations;</subsection><subsection ssid="96-null-8" dnum="f-o" numlevel="1" lineno="52" slineno="1-20" level="2"><display>(f)</display>take necessary steps, including legal action, to recover money or the monetary value <ln numlevel="1" lineno="53" slineno="1-21"/>of services provided to a recipient who was not eligible;</subsection><subsection ssid="96-null-9" dnum="g-o" numlevel="1" lineno="54" slineno="1-22" level="2"><display>(g)</display>set and collect fees for the department's services;</subsection><subsection ssid="96-null-10" dnum="h-o" numlevel="1" lineno="55" slineno="1-23" level="2"><display>(h)</display>license agencies, facilities, and programs, except as otherwise allowed, prohibited, or <ln numlevel="1" lineno="56" slineno="1-24"/>limited by law;</subsection><subsection ssid="96-null-11" dnum="i-o" numlevel="1" lineno="57" slineno="1-25" level="2"><display>(i)</display>acquire, manage, and dispose of any real or personal property needed or owned by <ln numlevel="1" lineno="58" slineno="1-26"/>the department, not inconsistent with state law;</subsection><subsection ssid="96-null-12" dnum="j-o" numlevel="1" lineno="59" slineno="1-27" level="2"><display>(j)</display>receive gifts, grants, devises, and donations; gifts, grants, devises, donations, or the <ln numlevel="1" lineno="60" slineno="1-28"/>proceeds thereof, may be credited to the program designated by the donor, and may <ln numlevel="1" lineno="61" slineno="1-29"/>be used for the purposes requested by the donor, as long as the request conforms to <ln numlevel="1" lineno="62" slineno="1-30"/>state and federal policy; all donated funds shall be considered private, nonlapsing <ln numlevel="1" lineno="63" slineno="1-31"/>funds and may be invested under guidelines established by the state treasurer;</subsection><subsection ssid="96-null-13" dnum="k-o" numlevel="1" lineno="64" slineno="1-32" level="2"><display>(k)</display>accept and employ volunteer labor or services; the department is authorized to <ln numlevel="1" lineno="65" slineno="1-33"/>reimburse volunteers for necessary expenses, when the department considers that <ln numlevel="1" lineno="66" slineno="1-34"/>reimbursement to be appropriate;</subsection><subsection ssid="96-null-14" dnum="l-o" numlevel="1" lineno="67" slineno="1-35" level="2"><display>(l)</display>carry out the responsibility assigned in the workforce services plan by the State <ln numlevel="1" lineno="68" slineno="1-36"/>Workforce Development Board;</subsection><subsection ssid="96-null-15" dnum="m-o" numlevel="1" lineno="69" slineno="1-37" level="2"><display>(m)</display>carry out the responsibility assigned by Section <xref depth="3" refnumber="26B-1-430">26B-1-430</xref> with respect to <ln numlevel="1" lineno="70" slineno="1-38"/>coordination of services for students with a disability;</subsection><subsection ssid="96-null-16" dnum="n-o" numlevel="1" lineno="71" slineno="1-39" level="2"><display>(n)</display>provide training and educational opportunities for the department's staff;</subsection><subsection ssid="96-null-17" dnum="o-o" numlevel="1" lineno="72" slineno="1-40" level="2"><display>(o)</display>collect child support payments and any other money due to the department;</subsection><subsection ssid="96-null-18" dnum="p-o" numlevel="1" lineno="73" slineno="1-41" level="2"><display>(p)</display>apply the provisions of Title <xref depth="1" refnumber="81-6">81, Chapter 6</xref>, Child Support, and Title <xref depth="1" refnumber="81-7">81, Chapter 7</xref>, <ln numlevel="1" lineno="74" slineno="1-42"/>Payment and Enforcement of Spousal and Child Support, to parents whose child lives <ln numlevel="1" lineno="75" slineno="1-43"/>out of the home in a department licensed or certified setting;</subsection><subsection ssid="96-null-19" dnum="q-o" numlevel="1" lineno="76" slineno="1-44" level="2"><display>(q)</display>establish policy and procedures, within appropriations authorized by the Legislature, <ln numlevel="1" lineno="77" slineno="1-45"/>in cases where the Division of Child and Family Services or the Division of Juvenile <ln numlevel="1" lineno="78" slineno="1-46"/>Justice and Youth Services is given custody of a minor by the juvenile court under <ln numlevel="1" lineno="79" slineno="1-47"/>Title <xref depth="0" refnumber="80">80, Utah Juvenile Code</xref>, or the department is ordered to prepare an attainment <ln numlevel="1" lineno="80" slineno="1-48"/>plan for a minor found not competent to proceed under Section <xref depth="3" refnumber="80-6-403">80-6-403</xref>, including:<subsection ssid="96-null-20" dnum="i-o" numlevel="1" lineno="81" slineno="1-49" level="3"><display>(i)</display>designation of interagency teams for each juvenile court district in the state;</subsection><subsection ssid="96-null-21" dnum="ii-o" numlevel="1" lineno="82" slineno="1-50" level="3"><display>(ii)</display>delineation of assessment criteria and procedures;</subsection><subsection ssid="96-null-22" dnum="iii-o" numlevel="1" lineno="83" slineno="1-51" level="3"><display>(iii)</display>minimum requirements, and timeframes, for the development and <ln numlevel="1" lineno="84" slineno="1-52"/>implementation of a collaborative service plan for each minor placed in <ln numlevel="1" lineno="85" slineno="1-53"/>department custody; and</subsection><subsection ssid="96-null-23" dnum="iv-o" numlevel="1" lineno="86" slineno="1-54" level="3"><display>(iv)</display>provisions for submittal of the plan and periodic progress reports to the court;</subsection></subsection><subsection ssid="96-null-24" dnum="r-o" numlevel="1" lineno="87" slineno="1-55" level="2"><display>(r)</display>carry out the responsibilities assigned to the department by statute;</subsection><subsection ssid="96-null-25" dnum="s-o" numlevel="1" lineno="88" slineno="1-56" level="2"><display>(s)</display>as further provided in Subsection <xref refnumber="26B-1-202(3)" depth="4">(3)</xref>, examine and audit the expenditures of any <ln numlevel="1" lineno="89" slineno="1-57"/>public funds provided to a local health department, a local substance abuse authority, <ln numlevel="1" lineno="90" slineno="1-58"/>a local mental health authority, a local area agency on aging, and any person, agency, <ln numlevel="1" lineno="91" slineno="1-59"/>or organization that contracts with or receives funds from those authorities or <ln numlevel="1" lineno="92" slineno="1-60"/>agencies;</subsection><subsection ssid="96-null-26" dnum="t-o" numlevel="1" lineno="93" slineno="1-61" level="2"><display>(t)</display>in accordance with Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-104">26B-2-104</xref>(1)(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="4" refnumber="26B-2-902(1)(d)">26B-2-902(1)(d)</xref></amend>, accredit one or <ln numlevel="1" lineno="94" slineno="1-62"/>more agencies and persons to provide intercountry adoption services;</subsection><subsection ssid="96-null-27" dnum="u-o" numlevel="1" lineno="95" slineno="1-63" level="2"><display>(u)</display>within legislative appropriations, promote and develop a system of care and <ln numlevel="1" lineno="96" slineno="1-64"/>stabilization services:<subsection ssid="96-null-28" dnum="i-o" numlevel="1" lineno="97" slineno="1-65" level="3"><display>(i)</display>in compliance with Title <xref depth="1" refnumber="63G-6a">63G, Chapter 6a</xref>, Utah Procurement Code; and</subsection><subsection ssid="96-null-29" dnum="ii-o" numlevel="1" lineno="98" slineno="1-66" level="3"><display>(ii)</display>that encompasses the department, department contractors, and the divisions, <ln numlevel="1" lineno="99" slineno="1-67"/>offices, or institutions within the department, to:<subsection ssid="96-null-30" dnum="A-o" numlevel="1" lineno="100" slineno="1-68" level="4"><display>(A)</display>navigate services, funding resources, and relationships to the benefit of the <ln numlevel="1" lineno="101" slineno="1-69"/>children and families whom the department serves;</subsection><subsection ssid="96-null-31" dnum="B-o" numlevel="1" lineno="102" slineno="1-70" level="4"><display>(B)</display>centralize department operations, including procurement and contracting;</subsection><subsection ssid="96-null-32" dnum="C-o" numlevel="1" lineno="103" slineno="1-71" level="4"><display>(C)</display>develop policies that govern business operations and that facilitate a system of <ln numlevel="1" lineno="104" slineno="1-72"/>care approach to service delivery;</subsection><subsection ssid="96-null-33" dnum="D-o" numlevel="1" lineno="105" slineno="1-73" level="4"><display>(D)</display>allocate resources that may be used for the children and families served by the <ln numlevel="1" lineno="106" slineno="1-74"/>department or the divisions, offices, or institutions within the department, <ln numlevel="1" lineno="107" slineno="1-75"/>subject to the restrictions in Section <xref depth="3" refnumber="63J-1-206">63J-1-206</xref>;</subsection><subsection ssid="96-null-34" dnum="E-o" numlevel="1" lineno="108" slineno="1-76" level="4"><display>(E)</display>create performance-based measures for the provision of services; and</subsection><subsection ssid="96-null-35" dnum="F-o" numlevel="1" lineno="109" slineno="1-77" level="4"><display>(F)</display>centralize other business operations, including data matching and sharing <ln numlevel="1" lineno="110" slineno="1-78"/>among the department's divisions, offices, and institutions;</subsection></subsection></subsection><subsection ssid="96-null-36" dnum="v-o" numlevel="1" lineno="111" slineno="1-79" level="2"><display>(v)</display>ensure that any training or certification required of a public official or public <ln numlevel="1" lineno="112" slineno="1-80"/>employee, as those terms are defined in Section <xref depth="3" refnumber="63G-22-102">63G-22-102</xref>, complies with Title <xref depth="1" refnumber="63G-22"><ln numlevel="1" lineno="113" slineno="1-81"/>63G, Chapter 22</xref>, State Training and Certification Requirements, if the training or <ln numlevel="1" lineno="114" slineno="1-82"/>certification is required:<subsection ssid="96-null-37" dnum="i-o" numlevel="1" lineno="115" slineno="1-83" level="3"><display>(i)</display>under this title;</subsection><subsection ssid="96-null-38" dnum="ii-o" numlevel="1" lineno="116" slineno="1-84" level="3"><display>(ii)</display>by the department; or</subsection><subsection ssid="96-null-39" dnum="iii-o" numlevel="1" lineno="117" slineno="1-85" level="3"><display>(iii)</display>by an agency or division within the department;</subsection></subsection><subsection ssid="96-null-40" dnum="w-o" numlevel="1" lineno="118" slineno="1-86" level="2"><display>(w)</display>enter into cooperative agreements with the Department of Environmental Quality to <ln numlevel="1" lineno="119" slineno="1-87"/>delineate specific responsibilities to assure that assessment and management of risk <ln numlevel="1" lineno="120" slineno="1-88"/>to human health from the environment are properly administered;</subsection><subsection ssid="96-null-41" dnum="x-o" numlevel="1" lineno="121" slineno="1-89" level="2"><display>(x)</display>consult with the Department of Environmental Quality and enter into cooperative <ln numlevel="1" lineno="122" slineno="1-90"/>agreements, as needed, to ensure efficient use of resources and effective response to <ln numlevel="1" lineno="123" slineno="1-91"/>potential health and safety threats from the environment, and to prevent gaps in <ln numlevel="1" lineno="124" slineno="1-92"/>protection from potential risks from the environment to specific individuals or <ln numlevel="1" lineno="125" slineno="1-93"/>population groups;</subsection><subsection ssid="96-null-42" dnum="y-o" numlevel="1" lineno="126" slineno="1-94" level="2"><display>(y)</display>to the extent authorized under state law or required by federal law, promote and <ln numlevel="1" lineno="127" slineno="1-95"/>protect the health and wellness of the people within the state;</subsection><subsection ssid="96-null-43" dnum="z-o" numlevel="1" lineno="128" slineno="1-96" level="2"><display>(z)</display>establish, maintain, and enforce rules authorized under state law or required by <ln numlevel="1" lineno="129" slineno="1-97"/>federal law to promote and protect the public health or to prevent disease and illness;</subsection><subsection ssid="96-null-44" dnum="aa-o" numlevel="1" lineno="130" slineno="1-98" level="2"><display>(aa)</display>investigate the causes of epidemic, infectious, communicable, and other diseases <ln numlevel="1" lineno="131" slineno="1-99"/>affecting the public health;</subsection><subsection ssid="96-null-45" dnum="bb-o" numlevel="1" lineno="132" slineno="1-100" level="2"><display>(bb)</display>provide for the detection and reporting of communicable, infectious, acute, chronic, <ln numlevel="1" lineno="133" slineno="1-101"/>or any other disease or health hazard which the department considers to be <ln numlevel="1" lineno="134" slineno="1-102"/>dangerous, important, or likely to affect the public health;</subsection><subsection ssid="96-null-46" dnum="cc-o" numlevel="1" lineno="135" slineno="1-103" level="2"><display>(cc)</display>collect and report information on causes of injury, sickness, death, and disability <ln numlevel="1" lineno="136" slineno="1-104"/>and the risk factors that contribute to the causes of injury, sickness, death, and <ln numlevel="1" lineno="137" slineno="1-105"/>disability within the state;</subsection><subsection ssid="96-null-47" dnum="dd-o" numlevel="1" lineno="138" slineno="1-106" level="2"><display>(dd)</display>collect, prepare, publish, and disseminate information to inform the public <ln numlevel="1" lineno="139" slineno="1-107"/>concerning the health and wellness of the population, specific hazards, and risks that <ln numlevel="1" lineno="140" slineno="1-108"/>may affect the health and wellness of the population and specific activities which <ln numlevel="1" lineno="141" slineno="1-109"/>may promote and protect the health and wellness of the population;</subsection><subsection ssid="96-null-48" dnum="ee-o" numlevel="1" lineno="142" slineno="1-110" level="2"><display>(ee)</display>abate nuisances when necessary to eliminate sources of filth and infectious and <ln numlevel="1" lineno="143" slineno="1-111"/>communicable diseases affecting the public health;</subsection><subsection ssid="96-null-49" dnum="ff-o" numlevel="1" lineno="144" slineno="1-112" level="2"><display>(ff)</display>make necessary sanitary and health investigations and inspections in cooperation <ln numlevel="1" lineno="145" slineno="1-113"/>with local health departments as to any matters affecting the public health;</subsection><subsection ssid="96-null-50" dnum="gg-o" numlevel="1" lineno="146" slineno="1-114" level="2"><display>(gg)</display>establish laboratory services necessary to support public health programs and <ln numlevel="1" lineno="147" slineno="1-115"/>medical services in the state;</subsection><subsection ssid="96-null-51" dnum="hh-o" numlevel="1" lineno="148" slineno="1-116" level="2"><display>(hh)</display>establish and enforce standards for laboratory services which are provided by any <ln numlevel="1" lineno="149" slineno="1-117"/>laboratory in the state when the purpose of the services is to protect the public health;</subsection><subsection ssid="96-null-52" dnum="ii-o" numlevel="1" lineno="150" slineno="1-118" level="2"><display>(ii)</display>cooperate with the Labor Commission to conduct studies of occupational health <ln numlevel="1" lineno="151" slineno="1-119"/>hazards and occupational diseases arising in and out of employment in industry, and <ln numlevel="1" lineno="152" slineno="1-120"/>make recommendations for elimination or reduction of the hazards;</subsection><subsection ssid="96-null-53" dnum="jj-o" numlevel="1" lineno="153" slineno="1-121" level="2"><display>(jj)</display>cooperate with the local health departments, the Department of Corrections, the <ln numlevel="1" lineno="154" slineno="1-122"/>Administrative Office of the Courts, the Division of Juvenile Justice and Youth <ln numlevel="1" lineno="155" slineno="1-123"/>Services, and the Utah Office for Victims of Crime to conduct testing for HIV <ln numlevel="1" lineno="156" slineno="1-124"/>infection of alleged sexual offenders, convicted sexual offenders, and any victims of <ln numlevel="1" lineno="157" slineno="1-125"/>a sexual offense;</subsection><subsection ssid="96-null-54" dnum="kk-o" numlevel="1" lineno="158" slineno="1-126" level="2"><display>(kk)</display>investigate the causes of maternal and infant mortality;</subsection><subsection ssid="96-null-55" dnum="ll-o" numlevel="1" lineno="159" slineno="1-127" level="2"><display>(ll)</display>establish, maintain, and enforce a procedure requiring the blood of adult pedestrians <ln numlevel="1" lineno="160" slineno="1-128"/>and drivers of motor vehicles killed in highway accidents be examined for the <ln numlevel="1" lineno="161" slineno="1-129"/>presence and concentration of alcohol, and provide the Commissioner of Public <ln numlevel="1" lineno="162" slineno="1-130"/>Safety with monthly statistics reflecting the results of these examinations, with <ln numlevel="1" lineno="163" slineno="1-131"/>necessary safeguards so that information derived from the examinations is not used <ln numlevel="1" lineno="164" slineno="1-132"/>for a purpose other than the compilation of these statistics;</subsection><subsection ssid="96-null-56" dnum="mm-o" numlevel="1" lineno="165" slineno="1-133" level="2"><display>(mm)</display>establish a uniform public health program throughout the state which includes <ln numlevel="1" lineno="166" slineno="1-134"/>continuous service, employment of qualified employees, and a basic program of <ln numlevel="1" lineno="167" slineno="1-135"/>disease control, vital and health statistics, sanitation, public health nursing, and other <ln numlevel="1" lineno="168" slineno="1-136"/>preventive health programs necessary or desirable for the protection of public health;</subsection><subsection ssid="96-null-57" dnum="nn-o" numlevel="1" lineno="169" slineno="1-137" level="2"><display>(nn)</display>conduct health planning for the state;</subsection><subsection ssid="96-null-58" dnum="oo-o" numlevel="1" lineno="170" slineno="1-138" level="2"><display>(oo)</display>monitor the costs of health care in the state and foster price competition in the <ln numlevel="1" lineno="171" slineno="1-139"/>health care delivery system;</subsection><subsection ssid="96-null-59" dnum="pp-o" numlevel="1" lineno="172" slineno="1-140" level="2"><display>(pp)</display>establish methods or measures for health care providers, public health entities, and <ln numlevel="1" lineno="173" slineno="1-141"/>health care insurers to coordinate among themselves to verify the identity of the <ln numlevel="1" lineno="174" slineno="1-142"/>individuals the providers serve;</subsection><subsection ssid="96-null-60" dnum="qq-o" numlevel="1" lineno="175" slineno="1-143" level="2"><display>(qq)</display>designate Alzheimer's disease and related dementia as a public health issue and, <ln numlevel="1" lineno="176" slineno="1-144"/>within budgetary limitations, implement a state plan for Alzheimer's disease and <ln numlevel="1" lineno="177" slineno="1-145"/>related dementia by incorporating the plan into the department's strategic planning <ln numlevel="1" lineno="178" slineno="1-146"/>and budgetary process;</subsection><subsection ssid="96-null-61" dnum="rr-o" numlevel="1" lineno="179" slineno="1-147" level="2"><display>(rr)</display>coordinate with other state agencies and other organizations to implement the state <ln numlevel="1" lineno="180" slineno="1-148"/>plan for Alzheimer's disease and related dementia;</subsection><subsection ssid="96-null-62" dnum="ss-o" numlevel="1" lineno="181" slineno="1-149" level="2"><display>(ss)</display>ensure that any training or certification required of a public official or public <ln numlevel="1" lineno="182" slineno="1-150"/>employee, as those terms are defined in Section <xref depth="3" refnumber="63G-22-102">63G-22-102</xref>, complies with Title <xref depth="1" refnumber="63G-22"><ln numlevel="1" lineno="183" slineno="1-151"/>63G, Chapter 22</xref>, State Training and Certification Requirements, if the training or <ln numlevel="1" lineno="184" slineno="1-152"/>certification is required by the agency or under this Title <xref depth="0" refnumber="26B">26B, Utah Health and <ln numlevel="1" lineno="185" slineno="1-153"/>Human Services Code;</xref></subsection><subsection ssid="96-null-63" dnum="tt-o" numlevel="1" lineno="186" slineno="1-154" level="2"><display>(tt)</display>oversee public education vision screening as described in Section <xref depth="3" refnumber="53G-9-404">53G-9-404</xref>;</subsection><subsection ssid="96-null-64" dnum="uu-o" numlevel="1" lineno="187" slineno="1-155" level="2"><display>(uu)</display>issue code blue alerts in accordance with Title <xref depth="2" refnumber="35A-16-7">35A, Chapter 16, Part 7</xref>, Code Blue <ln numlevel="1" lineno="188" slineno="1-156"/>Alert; and</subsection><subsection ssid="96-null-65" dnum="vv-o" numlevel="1" lineno="189" slineno="1-157" level="2"><display>(vv)</display>as allowed by state and federal law, share data with the Office of Families that is <ln numlevel="1" lineno="190" slineno="1-158"/>relevant to the duties described in Subsection <xref tempid="876" depth="4" refnumber="26B-1-243(4)">26B-1-243(4)</xref>, which may include, to <ln numlevel="1" lineno="191" slineno="1-159"/>the extent available:<subsection ssid="96-null-66" dnum="i-o" numlevel="1" lineno="192" slineno="1-160" level="3"><display>(i)</display>demographic data concerning family structures in the state; and</subsection><subsection ssid="96-null-67" dnum="ii-o" numlevel="1" lineno="193" slineno="1-161" level="3"><display>(ii)</display>data regarding the family structure associated with:<subsection ssid="96-null-68" dnum="A-o" numlevel="1" lineno="194" slineno="1-162" level="4"><display>(A)</display>suicide, depression, or anxiety; and</subsection><subsection ssid="96-null-69" dnum="B-o" numlevel="1" lineno="195" slineno="1-163" level="4"><display>(B)</display>various health outcomes.</subsection></subsection></subsection></subsection><subsection ssid="96-null-70" dnum="3-o" numlevel="1" lineno="196" slineno="1-164" level="1" space="false"><display>(3)</display><subsection ssid="96-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Under Subsection <xref tempid="430" depth="4" refnumber="26B-1-202(2)(s)">(2)(s)</xref>, those local departments, local authorities, area agencies, <ln numlevel="1" lineno="197" slineno="1-165"/>and any person or entity that contracts with or receives funds from those departments, <ln numlevel="1" lineno="198" slineno="1-166"/>authorities, or area agencies, shall provide the department with any information the <ln numlevel="1" lineno="199" slineno="1-167"/>department considers necessary.</subsection><subsection ssid="96-null-72" dnum="b-o" numlevel="1" lineno="200" slineno="1-168" level="2"><display>(b)</display>The department is further authorized to issue directives resulting from any <ln numlevel="1" lineno="201" slineno="1-169"/>examination or audit to a local department, local authority, an area agency, and <ln numlevel="1" lineno="202" slineno="1-170"/>persons or entities that contract with or receive funds from those departments, <ln numlevel="1" lineno="203" slineno="1-171"/>authorities, or agencies with regard to any public funds.</subsection><subsection ssid="96-null-73" dnum="c-o" numlevel="1" lineno="204" slineno="1-172" level="2"><display>(c)</display>If the department determines that it is necessary to withhold funds from a local health <ln numlevel="1" lineno="205" slineno="1-173"/>department, local mental health authority, or local substance abuse authority based on <ln numlevel="1" lineno="206" slineno="1-174"/>failure to comply with state or federal law, policy, or contract provisions, the <ln numlevel="1" lineno="207" slineno="1-175"/>department may take steps necessary to ensure continuity of services.</subsection></subsection></section></bsec><bsec buid="1" num="26B-2-101" type="amend" src="code" uid="C26B-2-S101_2026050620260506" sort="26B02 01010020260506" numlevel="1" lineno="208" slineno="2-1" sn="2"><section number="26B-2-101" numlevel="1" lineno="209" slineno="2-2" type="amend"><secline lineno="208">Section 2. Section <bold>26B-2-101</bold> is amended to read:</secline><catline lineno="209"><bold>26B-2-101<parens/>. Definitions.</bold></catline><sectionText lineno="210"><tab/>As used in this part:</sectionText><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="211" slineno="2-4" level="1"><display>(1)</display>"Abuse" means the same as that term is defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="212" slineno="2-5" level="1"><display>(2)</display>"Adoption services" means the same as that term is defined in Section <xref depth="3" refnumber="80-2-801">80-2-801</xref>.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="213" slineno="2-6" level="1"><display>(3)</display>"Adult day care" means nonresidential care and supervision:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="214" slineno="2-7" level="2"><display>(a)</display>for three or more adults for at least four but less than 24 hours a day; and</subsection><subsection ssid="1-null-5" dnum="b-o" numlevel="1" lineno="215" slineno="2-8" level="2"><display>(b)</display>that meets the needs of functionally impaired adults through a comprehensive <ln numlevel="1" lineno="216" slineno="2-9"/>program that provides a variety of health, social, recreational, and related support <ln numlevel="1" lineno="217" slineno="2-10"/>services in a protective setting.</subsection></subsection><subsection ssid="1-null-6" dnum="4-o" numlevel="1" lineno="218" slineno="2-11" level="1"><display>(4)</display>"Applicant" means a person that applies for an initial license or a license renewal under <ln numlevel="1" lineno="219" slineno="2-12"/>this part.</subsection><subsection ssid="1-null-7" dnum="5-o" numlevel="1" lineno="220" slineno="2-13" level="1" space="false"><display>(5)</display><subsection ssid="1-null-8" dnum="a-o:_-e" ea="erase" anum="0" owner="admin" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1080" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="7" groupid="4" style="2" owner="admin" level="1" deltag="end">"Associated with the licensee" means that an individual is:</amend><amendoutend style="2"/><subsection ssid="1-null-9" dnum="i-o:_-e" numlevel="1" lineno="221" slineno="2-14" ea="erase" anum="0" owner="admin" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1081" style="2" owner="o" level="1" deltag="start">(i)</amend></display><amend anum="0" ea="erase" pairid="8" groupid="5" style="2" owner="admin" level="1" deltag="end">affiliated with a licensee as an owner, director, member of the governing body, <ln numlevel="1" lineno="222" slineno="2-15"/>employee, agent, provider of care, department contractor, or volunteer; or</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-10" dnum="ii-o:_-e" numlevel="1" lineno="223" slineno="2-16" ea="erase" anum="0" owner="admin" style="2" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1082" style="2" owner="o" level="1" deltag="start">(ii)</amend></display><amend anum="0" ea="erase" pairid="9" groupid="6" style="2" owner="admin" level="1" deltag="end">applying to become affiliated with a licensee in a capacity described in <ln numlevel="1" lineno="224" slineno="2-17"/>Subsection <xref depth="4" refnumber="26B-2-101(5)(a)(i)">(5)(a)(i)</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="1-null-11" dnum="b-o:a-e" numlevel="1" lineno="225" slineno="2-18" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1083" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1084" style="1" owner="e" level="1" amendtag="start" space="true">(a)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="11" style="1" owner="admin" level="1" amendtag="end">"Associated with the licensee" means an individual who, regardless of title, <ln numlevel="1" lineno="226" slineno="2-19"/>holds or held a position of management, control, or significant influence over the <ln numlevel="1" lineno="227" slineno="2-20"/>licensee's operations or compliance as demonstrated by being:</amend><subsection ssid="1-247" dnum="_-o:i-e" numlevel="1" lineno="228" slineno="2-21" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1084" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="17" style="1" owner="admin" level="1" amendtag="end">an owner, partner, corporate officer, director, or member of the governing body;</amend></subsection><subsection ssid="1-248" dnum="_-o:ii-e" numlevel="1" lineno="229" slineno="2-22" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1085" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="21" style="1" owner="admin" level="1" amendtag="end">a managerial or supervisory employee with responsibility for the licensee's daily <ln numlevel="1" lineno="230" slineno="2-23"/>operations or compliance with governing rules;</amend></subsection><subsection ssid="1-249" dnum="_-o:iii-e" numlevel="1" lineno="231" slineno="2-24" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1086" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="25" style="1" owner="admin" level="1" amendtag="end">an individual who exercises significant control over the management, policies, or <ln numlevel="1" lineno="232" slineno="2-25"/>operations of the licensee, whether through financial interest, contract, familial <ln numlevel="1" lineno="233" slineno="2-26"/>relationship, or other formal arrangement; or</amend></subsection><subsection ssid="1-250" dnum="_-o:iv-e" numlevel="1" lineno="234" slineno="2-27" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1087" style="1" owner="e" level="1" amendtag="start">(iv)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="admin" level="1" amendtag="end">an individual applying to be in a capacity described in this Subsection <xref depth="4" refnumber="26B-2-101(5)(a)">(5)(a)</xref>.</amend></subsection></subsection><subsection ssid="1-246" dnum="_-o:b-e" numlevel="1" lineno="235" slineno="2-28" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1088" style="1" owner="e" level="1" amendtag="both">(b)</amend></display>"Associated with the licensee" does not include:<subsection ssid="1-null-12" dnum="i-o" numlevel="1" lineno="236" slineno="2-29" level="3"><display>(i)</display>service on the following bodies, unless that service includes direct access to a <ln numlevel="1" lineno="237" slineno="2-30"/>child or a vulnerable adult:<subsection ssid="1-null-13" dnum="A-o" numlevel="1" lineno="238" slineno="2-31" level="4"><display>(A)</display>a local mental health authority described in Section <xref depth="3" refnumber="17-77-301">17-77-301</xref>;</subsection><subsection ssid="1-null-14" dnum="B-o" numlevel="1" lineno="239" slineno="2-32" level="4"><display>(B)</display>a local substance abuse authority described in Section <xref depth="3" refnumber="17-77-201">17-77-201</xref>; or</subsection><subsection ssid="1-null-15" dnum="C-o" numlevel="1" lineno="240" slineno="2-33" level="4"><display>(C)</display>a board of an organization operating under a contract to provide mental health <ln numlevel="1" lineno="241" slineno="2-34"/>or substance use programs, or services for the local mental health authority or <ln numlevel="1" lineno="242" slineno="2-35"/>substance abuse authority; or</subsection></subsection><subsection ssid="1-null-16" dnum="ii-o" numlevel="1" lineno="243" slineno="2-36" level="3"><display>(ii)</display>a guest or visitor whose access to a child or a vulnerable adult is directly <ln numlevel="1" lineno="244" slineno="2-37"/>supervised at all times.</subsection></subsection></subsection><subsection ssid="1-null-17" dnum="6-o" numlevel="1" lineno="245" slineno="2-38" level="1"><display>(6)</display>"Behavioral health receiving center" means a 23-hour non-secure program or facility <ln numlevel="1" lineno="246" slineno="2-39"/>that is responsible for, and provides mental health crisis services to, an individual <ln numlevel="1" lineno="247" slineno="2-40"/>experiencing a mental health crisis.</subsection><subsection ssid="1-null-18" dnum="7-o" numlevel="1" lineno="248" slineno="2-41" level="1" space="false"><display>(7)</display><subsection ssid="1-null-19" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Boarding school" means a private school that:<subsection ssid="1-null-20" dnum="i-o" numlevel="1" lineno="249" slineno="2-42" level="3" tab="1"><display>(i)</display>uses a regionally accredited education program;</subsection><subsection ssid="1-null-21" dnum="ii-o" numlevel="1" lineno="250" slineno="2-43" level="3" tab="1"><display>(ii)</display>provides a residence to the school's students:<subsection ssid="1-null-22" dnum="A-o" numlevel="1" lineno="251" slineno="2-44" level="4"><display>(A)</display>for the purpose of enabling the school's students to attend classes at the <ln numlevel="1" lineno="252" slineno="2-45"/>school; and</subsection><subsection ssid="1-null-23" dnum="B-o" numlevel="1" lineno="253" slineno="2-46" level="4"><display>(B)</display>as an ancillary service to educating the students at the school;</subsection></subsection><subsection ssid="1-null-24" dnum="iii-o" numlevel="1" lineno="254" slineno="2-47" level="3" tab="1"><display>(iii)</display>has the primary purpose of providing the school's students with an education, as <ln numlevel="1" lineno="255" slineno="2-48"/>defined in Subsection <xref depth="4" refnumber="26B-2-101(7)(b)(i)">(7)(b)(i)</xref>; and</subsection><subsection ssid="1-null-25" dnum="iv-o" numlevel="1" lineno="256" slineno="2-49" level="3" tab="1" space="false"><display>(iv)</display><subsection ssid="1-null-26" dnum="A-o" level="4" placement="sameline"><display>(A)</display>does not provide the treatment or services described in Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref>; <ln numlevel="1" lineno="257" slineno="2-50"/>or</subsection><subsection ssid="1-null-27" dnum="B-o" numlevel="1" lineno="258" slineno="2-51" level="4"><display>(B)</display>provides the treatment or services described in Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref> on a limited <ln numlevel="1" lineno="259" slineno="2-52"/>basis, as described in Subsection <xref depth="4" refnumber="26B-2-101(7)(b)(ii)">(7)(b)(ii)</xref>.</subsection></subsection></subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="260" slineno="2-53" level="2" space="false"><display>(b)</display><subsection ssid="1-null-29" dnum="i-o" level="3" placement="sameline"><display>(i)</display>For purposes of Subsection <xref depth="4" refnumber="26B-2-101(7)(a)(iii)">(7)(a)(iii)</xref>, "education" means a course of study for <ln numlevel="1" lineno="261" slineno="2-54"/>one or more grades from kindergarten through grade 12.</subsection><subsection ssid="1-null-30" dnum="ii-o" numlevel="1" lineno="262" slineno="2-55" level="3"><display>(ii)</display>For purposes of Subsection <xref depth="4" refnumber="26B-2-101(7)(a)(iv)(b)">(7)(a)(iv)(B)</xref>, a private school provides the treatment <ln numlevel="1" lineno="263" slineno="2-56"/>or services described in Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref> on a limited basis if:<subsection ssid="1-null-31" dnum="A-o" numlevel="1" lineno="264" slineno="2-57" level="4"><display>(A)</display>the treatment or services described in Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref> are provided only as <ln numlevel="1" lineno="265" slineno="2-58"/>an incidental service to a student; and</subsection><subsection ssid="1-null-32" dnum="B-o" numlevel="1" lineno="266" slineno="2-59" level="4"><display>(B)</display>the school does not:<subsection ssid="1-null-33" dnum="I-o" numlevel="1" lineno="267" slineno="2-60" level="5"><display>(I)</display>specifically solicit a student for the purpose of providing the treatment or <ln numlevel="1" lineno="268" slineno="2-61"/>services described in Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref>; or</subsection><subsection ssid="1-null-34" dnum="II-o" numlevel="1" lineno="269" slineno="2-62" level="5"><display>(II)</display>have a primary purpose of providing the treatment or services described in <ln numlevel="1" lineno="270" slineno="2-63"/>Subsection <xref depth="4" refnumber="26B-2-101(49)(a)">(49)(a)</xref>.</subsection></subsection></subsection></subsection><subsection ssid="1-null-35" dnum="c-o" numlevel="1" lineno="271" slineno="2-64" level="2"><display>(c)</display>"Boarding school" does not include a therapeutic school.</subsection></subsection><subsection ssid="1-null-36" dnum="8-o" numlevel="1" lineno="272" slineno="2-65" level="1"><display>(8)</display>"Certification" means a less restrictive level of licensure issued by the department.</subsection><subsection ssid="1-null-37" dnum="9-o" numlevel="1" lineno="273" slineno="2-66" level="1"><display>(9)</display>"Child" means an individual under 18 years old.</subsection><subsection ssid="1-null-38" dnum="10-o" numlevel="1" lineno="274" slineno="2-67" level="1"><display>(10)</display>"Child placing" means receiving, accepting, or providing custody or care for any child, <ln numlevel="1" lineno="275" slineno="2-68"/>temporarily or permanently, for the purpose of:<subsection ssid="1-null-39" dnum="a-o" numlevel="1" lineno="276" slineno="2-69" level="2"><display>(a)</display>finding a person to adopt the child;</subsection><subsection ssid="1-null-40" dnum="b-o" numlevel="1" lineno="277" slineno="2-70" level="2"><display>(b)</display>placing the child in a home for adoption; or</subsection><subsection ssid="1-null-41" dnum="c-o" numlevel="1" lineno="278" slineno="2-71" level="2"><display>(c)</display>foster home placement.</subsection></subsection><subsection ssid="1-null-42" dnum="11-o" numlevel="1" lineno="279" slineno="2-72" level="1"><display>(11)</display>"Child-placing agency" means a person that engages in child placing.</subsection><subsection ssid="1-null-43" dnum="12-o" numlevel="1" lineno="280" slineno="2-73" level="1"><display>(12)</display>"Client" means an individual who receives or has received services from a licensee.</subsection><subsection ssid="1-null-44" dnum="13-o" numlevel="1" lineno="281" slineno="2-74" level="1" space="false"><display>(13)</display><subsection ssid="1-null-45" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Congregate care program" means any of the following that provide services to a <ln numlevel="1" lineno="282" slineno="2-75"/>child:<subsection ssid="1-null-46" dnum="i-o" numlevel="1" lineno="283" slineno="2-76" level="3" tab="1"><display>(i)</display>an outdoor youth program;</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="284" slineno="2-77" level="3" tab="1"><display>(ii)</display>a residential support program;</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="285" slineno="2-78" level="3" tab="1"><display>(iii)</display>a residential treatment program; or</subsection><subsection ssid="1-null-49" dnum="iv-o" numlevel="1" lineno="286" slineno="2-79" level="3" tab="1"><display>(iv)</display>a therapeutic school.</subsection></subsection><subsection ssid="1-null-50" dnum="b-o" numlevel="1" lineno="287" slineno="2-80" level="2"><display>(b)</display>"Congregate care program" does not include a human services program that:<subsection ssid="1-null-51" dnum="i-o" numlevel="1" lineno="288" slineno="2-81" level="3"><display>(i)</display>is licensed to serve adults; and</subsection><subsection ssid="1-null-52" dnum="ii-o" numlevel="1" lineno="289" slineno="2-82" level="3"><display>(ii)</display>is approved by the office to service a child for a limited time.</subsection></subsection></subsection><subsection ssid="1-null-53" dnum="14-o" numlevel="1" lineno="290" slineno="2-83" level="1" space="false"><display>(14)</display><subsection ssid="1-252" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1131" style="1" owner="e" level="1" amendtag="both">(a)</amend></display>"Day treatment" means specialized treatment that is provided to:<subsection ssid="1-null-54" dnum="a-o:i-e" numlevel="1" lineno="291" slineno="2-84" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1132" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1133" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>a client less than 24 hours a day; and</subsection><subsection ssid="1-null-55" dnum="b-o:ii-e" numlevel="1" lineno="292" slineno="2-85" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1133" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1134" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>four or more persons who<amend anum="0" ea="amend" pairid="46" groupid="34" style="1" owner="admin" level="1" amendtag="both"> are receiving services individually or in a group <ln numlevel="1" lineno="293" slineno="2-86"/>setting during any 30-day period and who</amend>:<subsection ssid="1-null-56" dnum="i-o:A-e" numlevel="1" lineno="294" slineno="2-87" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1134" style="2" owner="o" level="1" deltag="both">(i)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1135" style="1" owner="e" level="1" amendtag="both" space="true">(A)</amend></display>are unrelated to the owner or provider; and</subsection><subsection ssid="1-null-57" dnum="ii-o:B-e" numlevel="1" lineno="295" slineno="2-88" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1135" style="2" owner="o" level="1" deltag="both">(ii)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="both" space="true">(B)</amend></display>have emotional, psychological, developmental, physical, or behavioral <ln numlevel="1" lineno="296" slineno="2-89"/>dysfunctions, impairments, or chemical dependencies.</subsection></subsection></subsection><subsection ssid="1-251" dnum="_-o:b-e" numlevel="1" lineno="297" slineno="2-90" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="42" style="1" owner="admin" level="1" amendtag="end">A person providing Applied Behavior Analysis to clients as described in Subsection <xref depth="4" refnumber="26B-2-101(14)(a)"><ln numlevel="1" lineno="298" slineno="2-91"/>(14)(a)</xref> is presumed to be providing day treatment unless the person is able to <ln numlevel="1" lineno="299" slineno="2-92"/>demonstrate to the office that the services meet the definition of outpatient treatment <ln numlevel="1" lineno="300" slineno="2-93"/>described in Subsection <xref depth="4" refnumber="26B-2-101(42)">(42)</xref>.</amend></subsection></subsection><subsection ssid="1-null-58" dnum="15-o" numlevel="1" lineno="301" slineno="2-94" level="1"><display>(15)</display>"Department contractor" means an individual who:<subsection ssid="1-null-59" dnum="a-o" numlevel="1" lineno="302" slineno="2-95" level="2"><display>(a)</display>provides services under a contract with the department; and</subsection><subsection ssid="1-null-60" dnum="b-o" numlevel="1" lineno="303" slineno="2-96" level="2"><display>(b)</display>due to the contract with the department, has or will likely have direct access to a <ln numlevel="1" lineno="304" slineno="2-97"/>child or vulnerable adult.</subsection></subsection><subsection ssid="1-null-61" dnum="16-o" numlevel="1" lineno="305" slineno="2-98" level="1"><display>(16)</display>"Direct access" means that an individual has, or likely will have:<subsection ssid="1-null-62" dnum="a-o" numlevel="1" lineno="306" slineno="2-99" level="2"><display>(a)</display>contact with or access to a child or vulnerable adult that provides the individual with <ln numlevel="1" lineno="307" slineno="2-100"/>an opportunity for personal communication or touch; or</subsection><subsection ssid="1-null-63" dnum="b-o" numlevel="1" lineno="308" slineno="2-101" level="2"><display>(b)</display>an opportunity to view medical, financial, or other confidential personal identifying <ln numlevel="1" lineno="309" slineno="2-102"/>information of the child, the child's parents or legal guardians, or the vulnerable adult.</subsection></subsection><subsection ssid="1-null-64" dnum="17-o" numlevel="1" lineno="310" slineno="2-103" level="1"><display>(17)</display>"Directly supervised" means that an individual is being supervised under the <ln numlevel="1" lineno="311" slineno="2-104"/>uninterrupted visual and auditory surveillance of another individual who has a current <ln numlevel="1" lineno="312" slineno="2-105"/>background check approval issued by the office.</subsection><subsection ssid="1-null-65" dnum="18-o" numlevel="1" lineno="313" slineno="2-106" level="1"><display>(18)</display>"Director" means the director of the office.</subsection><subsection ssid="1-null-66" dnum="19-o" numlevel="1" lineno="314" slineno="2-107" level="1"><display>(19)</display>"Division" means the Division of Licensing and Background Checks created under <ln numlevel="1" lineno="315" slineno="2-108"/>Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="44" groupid="32" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-103">26B-2-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="43" groupid="31" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-901">26B-2-901</xref></amend>.</subsection><subsection ssid="1-null-67" dnum="20-o" numlevel="1" lineno="316" slineno="2-109" level="1"><display>(20)</display>"Domestic violence" means the same as that term is defined in Section <xref depth="3" refnumber="77-36-1">77-36-1</xref>.</subsection><subsection ssid="1-null-68" dnum="21-o" numlevel="1" lineno="317" slineno="2-110" level="1"><display>(21)</display>"Domestic violence treatment program" means a nonresidential program designed to <ln numlevel="1" lineno="318" slineno="2-111"/>provide psychological treatment and educational services to perpetrators and victims of <ln numlevel="1" lineno="319" slineno="2-112"/>domestic violence.</subsection><subsection ssid="1-null-69" dnum="22-o" numlevel="1" lineno="320" slineno="2-113" level="1"><display>(22)</display>"Elder adult" means a person 65 years old or older.</subsection><subsection ssid="1-null-70" dnum="23-o" numlevel="1" lineno="321" slineno="2-114" level="1"><display>(23)</display>"Emergency safety intervention" means a tactic used to protect staff or a client from <ln numlevel="1" lineno="322" slineno="2-115"/>being physically injured, utilized by an appropriately trained direct care staff and only <ln numlevel="1" lineno="323" slineno="2-116"/>performed in accordance with a nationally or regionally recognized curriculum in the <ln numlevel="1" lineno="324" slineno="2-117"/>least restrictive manner to restore staff or client safety.</subsection><subsection ssid="1-null-71" dnum="24-o" numlevel="1" lineno="325" slineno="2-118" level="1"><display>(24)</display>"Foster home" means a residence that is licensed or certified by the office for the <ln numlevel="1" lineno="326" slineno="2-119"/>full-time substitute care of a child.</subsection><subsection ssid="1-null-72" dnum="25-o" numlevel="1" lineno="327" slineno="2-120" level="1"><display>(25)</display>"Harm" means the same as that term is defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>.</subsection><subsection ssid="1-null-73" dnum="26-o" numlevel="1" lineno="328" slineno="2-121" level="1"><display>(26)</display>"Health benefit plan" means the same as that term is defined in Section <xref depth="3" refnumber="31A-1-301">31A-1-301</xref>.</subsection><subsection ssid="1-null-74" dnum="27-o" numlevel="1" lineno="329" slineno="2-122" level="1"><display>(27)</display>"Health care provider" means the same as that term is defined in Section <xref depth="3" refnumber="78B-3-403">78B-3-403</xref>.</subsection><subsection ssid="1-null-75" dnum="28-o" numlevel="1" lineno="330" slineno="2-123" level="1"><display>(28)</display>"Health insurer" means:<subsection ssid="1-null-76" dnum="a-o" numlevel="1" lineno="331" slineno="2-124" level="2"><display>(a)</display>an insurer who offers health care insurance as that term is defined in Section <xref depth="3" refnumber="31A-1-301"><ln numlevel="1" lineno="332" slineno="2-125"/>31A-1-301</xref>;</subsection><subsection ssid="1-null-77" dnum="b-o" numlevel="1" lineno="333" slineno="2-126" level="2"><display>(b)</display>health benefits offered to state employees under Section <xref depth="3" refnumber="49-20-202">49-20-202</xref>; and</subsection><subsection ssid="1-null-78" dnum="c-o" numlevel="1" lineno="334" slineno="2-127" level="2"><display>(c)</display>a workers' compensation insurer:<subsection ssid="1-null-79" dnum="i-o" numlevel="1" lineno="335" slineno="2-128" level="3"><display>(i)</display>authorized to provide workers' compensation insurance in the state; or</subsection><subsection ssid="1-null-80" dnum="ii-o" numlevel="1" lineno="336" slineno="2-129" level="3"><display>(ii)</display>that is a self-insured employer as defined in Section <xref depth="3" refnumber="34A-2-201.5">34A-2-201.5</xref>.</subsection></subsection></subsection><subsection ssid="1-null-81" dnum="29-o" numlevel="1" lineno="337" slineno="2-130" level="1" space="false"><display>(29)</display><subsection ssid="1-null-82" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Human services program" means:<subsection ssid="1-null-83" dnum="i-o" numlevel="1" lineno="338" slineno="2-131" level="3" tab="1"><display>(i)</display>a foster home;</subsection><subsection ssid="1-null-84" dnum="ii-o" numlevel="1" lineno="339" slineno="2-132" level="3" tab="1"><display>(ii)</display>a therapeutic school;</subsection><subsection ssid="1-null-85" dnum="iii-o" numlevel="1" lineno="340" slineno="2-133" level="3" tab="1"><display>(iii)</display>a youth program;</subsection><subsection ssid="1-null-86" dnum="iv-o" numlevel="1" lineno="341" slineno="2-134" level="3" tab="1"><display>(iv)</display>an outdoor youth program;</subsection><subsection ssid="1-null-87" dnum="v-o" numlevel="1" lineno="342" slineno="2-135" level="3" tab="1"><display>(v)</display>a residential treatment program;</subsection><subsection ssid="1-null-88" dnum="vi-o" numlevel="1" lineno="343" slineno="2-136" level="3" tab="1"><display>(vi)</display>a residential support program;</subsection><subsection ssid="1-null-89" dnum="vii-o" numlevel="1" lineno="344" slineno="2-137" level="3" tab="1"><display>(vii)</display>a resource family home;</subsection><subsection ssid="1-null-90" dnum="viii-o" numlevel="1" lineno="345" slineno="2-138" level="3" tab="1"><display>(viii)</display>a recovery residence;</subsection><subsection ssid="1-null-91" dnum="ix-o" numlevel="1" lineno="346" slineno="2-139" level="3" tab="1"><display>(ix)</display>a behavioral health receiving center; or</subsection><subsection ssid="1-null-92" dnum="x-o" numlevel="1" lineno="347" slineno="2-140" level="3" tab="1"><display>(x)</display>a facility or program that provides:<subsection ssid="1-null-93" dnum="A-o" numlevel="1" lineno="348" slineno="2-141" level="4"><display>(A)</display>adult day care;</subsection><subsection ssid="1-null-94" dnum="B-o" numlevel="1" lineno="349" slineno="2-142" level="4"><display>(B)</display>day treatment;</subsection><subsection ssid="1-null-95" dnum="C-o" numlevel="1" lineno="350" slineno="2-143" level="4"><display>(C)</display>outpatient treatment;</subsection><subsection ssid="1-null-96" dnum="D-o" numlevel="1" lineno="351" slineno="2-144" level="4"><display>(D)</display>domestic violence treatment;</subsection><subsection ssid="1-null-97" dnum="E-o" numlevel="1" lineno="352" slineno="2-145" level="4"><display>(E)</display>child-placing services;</subsection><subsection ssid="1-null-98" dnum="F-o" numlevel="1" lineno="353" slineno="2-146" level="4"><display>(F)</display>social detoxification; or</subsection><subsection ssid="1-null-99" dnum="G-o" numlevel="1" lineno="354" slineno="2-147" level="4"><display>(G)</display>any other human services that are required by contract with the department to <ln numlevel="1" lineno="355" slineno="2-148"/>be licensed with the department.</subsection></subsection></subsection><subsection ssid="1-null-100" dnum="b-o" numlevel="1" lineno="356" slineno="2-149" level="2"><display>(b)</display>"Human services program" does not include:<subsection ssid="1-null-101" dnum="i-o" numlevel="1" lineno="357" slineno="2-150" level="3"><display>(i)</display>a boarding school;</subsection><subsection ssid="1-null-102" dnum="ii-o" numlevel="1" lineno="358" slineno="2-151" level="3"><display>(ii)</display>a residential vocational or life skills program, as defined in Section <xref depth="3" refnumber="13-53-102">13-53-102</xref>; or</subsection><subsection ssid="1-null-103" dnum="iii-o" numlevel="1" lineno="359" slineno="2-152" level="3"><display>(iii)</display>a short-term relief care provider.</subsection></subsection></subsection><subsection ssid="1-null-104" dnum="30-o" numlevel="1" lineno="360" slineno="2-153" level="1"><display>(30)</display>"Indian child" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="1-null-105" dnum="31-o" numlevel="1" lineno="361" slineno="2-154" level="1"><display>(31)</display>"Indian country" means the same as that term is defined in 18 U.S.C. Sec. 1151.</subsection><subsection ssid="1-null-106" dnum="32-o" numlevel="1" lineno="362" slineno="2-155" level="1"><display>(32)</display>"Indian tribe" means the same as that term is defined in 25 U.S.C. Sec. 1903.</subsection><subsection ssid="1-null-107" dnum="33-o" numlevel="1" lineno="363" slineno="2-156" level="1"><display>(33)</display>"Intermediate secure treatment" means 24-hour specialized residential treatment or <ln numlevel="1" lineno="364" slineno="2-157"/>care for an individual who:<subsection ssid="1-null-108" dnum="a-o" numlevel="1" lineno="365" slineno="2-158" level="2"><display>(a)</display>cannot live independently or in a less restrictive environment; and</subsection><subsection ssid="1-null-109" dnum="b-o" numlevel="1" lineno="366" slineno="2-159" level="2"><display>(b)</display>requires, without the individual's consent or control, the use of locked doors to care <ln numlevel="1" lineno="367" slineno="2-160"/>for the individual.</subsection></subsection><subsection ssid="1-null-110" dnum="34-o" numlevel="1" lineno="368" slineno="2-161" level="1"><display>(34)</display>"Licensee" means an individual or a human services program licensed by the office.</subsection><subsection ssid="1-null-111" dnum="35-o" numlevel="1" lineno="369" slineno="2-162" level="1"><display>(35)</display>"Local government" means a city, town, or county.</subsection><subsection ssid="1-null-112" dnum="36-o" numlevel="1" lineno="370" slineno="2-163" level="1"><display>(36)</display>"Mental health treatment program" means a program that:<subsection ssid="1-null-113" dnum="a-o" numlevel="1" lineno="371" slineno="2-164" level="2"><display>(a)</display>is a structured intervention; and</subsection><subsection ssid="1-null-114" dnum="b-o" numlevel="1" lineno="372" slineno="2-165" level="2"><display>(b)</display>is used to improve mental health, prevent mental disorders, and treat mental health <ln numlevel="1" lineno="373" slineno="2-166"/>conditions.</subsection></subsection><subsection ssid="1-null-115" dnum="37-o" numlevel="1" lineno="374" slineno="2-167" level="1"><display>(37)</display>"Medication assisted treatment" means the use of a prescribed medication approved by <ln numlevel="1" lineno="375" slineno="2-168"/>the United States Food and Drug Administration, such as buprenorphine, methadone, or <ln numlevel="1" lineno="376" slineno="2-169"/>naltrexone, to treat substance use withdrawal symptoms or a substance use disorder.</subsection><subsection ssid="1-null-116" dnum="38-o" numlevel="1" lineno="377" slineno="2-170" level="1"><display>(38)</display>"Minor" means child.</subsection><subsection ssid="1-null-117" dnum="39-o" numlevel="1" lineno="378" slineno="2-171" level="1"><display>(39)</display>"Office" means, except as provided in Section <xref depth="3" refnumber="26B-2-120">26B-2-120</xref>, the Office of Licensing <ln numlevel="1" lineno="379" slineno="2-172"/>within the department.</subsection><subsection ssid="1-null-118" dnum="40-o" numlevel="1" lineno="380" slineno="2-173" level="1"><display>(40)</display>"Ombudsman" means the congregate care ombudsman created in Section <xref depth="3" refnumber="26B-2-124.2">26B-2-124.2</xref>.</subsection><subsection ssid="1-null-119" dnum="41-o" numlevel="1" lineno="381" slineno="2-174" level="1"><display>(41)</display>"Outdoor youth program" means a program that provides:<subsection ssid="1-null-120" dnum="a-o" numlevel="1" lineno="382" slineno="2-175" level="2"><display>(a)</display>services to a child who has:<subsection ssid="1-null-121" dnum="i-o" numlevel="1" lineno="383" slineno="2-176" level="3"><display>(i)</display>a chemical dependency; or</subsection><subsection ssid="1-null-122" dnum="ii-o" numlevel="1" lineno="384" slineno="2-177" level="3"><display>(ii)</display>a dysfunction or impairment that is emotional, psychological, developmental, <ln numlevel="1" lineno="385" slineno="2-178"/>physical, or behavioral;</subsection></subsection><subsection ssid="1-null-123" dnum="b-o" numlevel="1" lineno="386" slineno="2-179" level="2"><display>(b)</display>a 24-hour outdoor group living environment; and</subsection><subsection ssid="1-null-124" dnum="c-o" numlevel="1" lineno="387" slineno="2-180" level="2" space="false"><display>(c)</display><subsection ssid="1-null-125" dnum="i-o" level="3" placement="sameline"><display>(i)</display>regular therapy, including group, individual, or supportive family therapy; or</subsection><subsection ssid="1-null-126" dnum="ii-o" numlevel="1" lineno="388" slineno="2-181" level="3"><display>(ii)</display>informal therapy or similar services, including wilderness therapy, adventure <ln numlevel="1" lineno="389" slineno="2-182"/>therapy, or outdoor behavioral healthcare.</subsection></subsection></subsection><subsection ssid="1-null-127" dnum="42-o" numlevel="1" lineno="390" slineno="2-183" level="1"><display>(42)</display>"Outpatient treatment" means individual, family, or group therapy or counseling <ln numlevel="1" lineno="391" slineno="2-184"/>designed to improve and enhance social or psychological functioning for those whose <ln numlevel="1" lineno="392" slineno="2-185"/>physical and emotional status allows them to continue functioning in their usual living <ln numlevel="1" lineno="393" slineno="2-186"/>environment.</subsection><subsection ssid="1-null-128" dnum="43-o" numlevel="1" lineno="394" slineno="2-187" level="1"><display>(43)</display>"Practice group" or "group practice" means two or more health care providers legally <ln numlevel="1" lineno="395" slineno="2-188"/>organized as a partnership, professional corporation, or similar association, for which:<subsection ssid="1-null-129" dnum="a-o" numlevel="1" lineno="396" slineno="2-189" level="2"><display>(a)</display>substantially all of the services of the health care providers who are members of the <ln numlevel="1" lineno="397" slineno="2-190"/>group are provided through the group and are billed in the name of the group and <ln numlevel="1" lineno="398" slineno="2-191"/>amounts received are treated as receipts of the group; and</subsection><subsection ssid="1-null-130" dnum="b-o" numlevel="1" lineno="399" slineno="2-192" level="2"><display>(b)</display>the overhead expenses of and the income from the practice are distributed in <ln numlevel="1" lineno="400" slineno="2-193"/>accordance with methods previously determined by members of the group.</subsection></subsection><subsection ssid="1-null-131" dnum="44-o" numlevel="1" lineno="401" slineno="2-194" level="1"><display>(44)</display>"Private-placement child" means a child whose parent or guardian enters into a <ln numlevel="1" lineno="402" slineno="2-195"/>contract with a congregate care program for the child to receive services.</subsection><subsection ssid="1-null-132" dnum="45-o" numlevel="1" lineno="403" slineno="2-196" level="1"><display>(45)</display>"Qualifying residential treatment program" means a residential treatment program that <ln numlevel="1" lineno="404" slineno="2-197"/>is licensed under this part and:<subsection ssid="1-null-133" dnum="a-o" numlevel="1" lineno="405" slineno="2-198" level="2"><display>(a)</display>is operated as a nonprofit corporation or foreign nonprofit corporation, as those terms <ln numlevel="1" lineno="406" slineno="2-199"/>are defined in Section <xref depth="3" refnumber="16-6a-102">16-6a-102</xref>; or</subsection><subsection ssid="1-null-134" dnum="b-o" numlevel="1" lineno="407" slineno="2-200" level="2"><display>(b)</display>receives any local, state, or federal government funding, government grant money, or <ln numlevel="1" lineno="408" slineno="2-201"/>any other form of government assistance to operate or provide services or training in <ln numlevel="1" lineno="409" slineno="2-202"/>the ordinary course of business.</subsection></subsection><subsection ssid="1-null-135" dnum="46-o" numlevel="1" lineno="410" slineno="2-203" level="1"><display>(46)</display>"Qualifying recovery residence" means a recovery residence that is licensed under this <ln numlevel="1" lineno="411" slineno="2-204"/>part and:<subsection ssid="1-null-136" dnum="a-o" numlevel="1" lineno="412" slineno="2-205" level="2"><display>(a)</display>is operated as a nonprofit corporation or foreign nonprofit corporation, as those terms <ln numlevel="1" lineno="413" slineno="2-206"/>are defined in Section <xref depth="3" refnumber="16-6a-102">16-6a-102</xref>; or</subsection><subsection ssid="1-null-137" dnum="b-o" numlevel="1" lineno="414" slineno="2-207" level="2"><display>(b)</display>receives any local, state, or federal government funding, government grant money, or <ln numlevel="1" lineno="415" slineno="2-208"/>any other form of government assistance to operate or provide services or training in <ln numlevel="1" lineno="416" slineno="2-209"/>the ordinary course of business.</subsection></subsection><subsection ssid="1-null-138" dnum="47-o" numlevel="1" lineno="417" slineno="2-210" level="1" space="false"><display>(47)</display><subsection ssid="1-null-139" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Recovery residence" means a home, residence, or facility that meets at least two <ln numlevel="1" lineno="418" slineno="2-211"/>of the following requirements:<subsection ssid="1-null-140" dnum="i-o" numlevel="1" lineno="419" slineno="2-212" level="3" tab="1"><display>(i)</display>provides a supervised living environment for individuals recovering from a <ln numlevel="1" lineno="420" slineno="2-213"/>substance use disorder;</subsection><subsection ssid="1-null-141" dnum="ii-o" numlevel="1" lineno="421" slineno="2-214" level="3" tab="1"><display>(ii)</display>provides a living environment in which more than half of the individuals in the <ln numlevel="1" lineno="422" slineno="2-215"/>residence are recovering from a substance use disorder;</subsection><subsection ssid="1-null-142" dnum="iii-o" numlevel="1" lineno="423" slineno="2-216" level="3" tab="1"><display>(iii)</display>provides or arranges for residents to receive services related to the resident's <ln numlevel="1" lineno="424" slineno="2-217"/>recovery from a substance use disorder, either on or off site;</subsection><subsection ssid="1-null-143" dnum="iv-o" numlevel="1" lineno="425" slineno="2-218" level="3" tab="1"><display>(iv)</display>is held out as a living environment in which individuals recovering from <ln numlevel="1" lineno="426" slineno="2-219"/>substance abuse disorders live together to encourage continued sobriety; or</subsection><subsection ssid="1-null-144" dnum="v-o" numlevel="1" lineno="427" slineno="2-220" level="3" tab="1" space="false"><display>(v)</display><subsection ssid="1-null-145" dnum="A-o" level="4" placement="sameline"><display>(A)</display>receives public funding; or</subsection><subsection ssid="1-null-146" dnum="B-o" numlevel="1" lineno="428" slineno="2-221" level="4"><display>(B)</display>is run as a business venture, either for-profit or not-for-profit.</subsection></subsection></subsection><subsection ssid="1-null-147" dnum="b-o" numlevel="1" lineno="429" slineno="2-222" level="2"><display>(b)</display>"Recovery residence" does not mean:<subsection ssid="1-null-148" dnum="i-o" numlevel="1" lineno="430" slineno="2-223" level="3"><display>(i)</display>a residential treatment program;</subsection><subsection ssid="1-null-149" dnum="ii-o" numlevel="1" lineno="431" slineno="2-224" level="3"><display>(ii)</display>residential support program; </subsection><subsection ssid="1-null-150" dnum="iii-o" numlevel="1" lineno="432" slineno="2-225" level="3"><display>(iii)</display>a residential vocational or life skills program; or</subsection><subsection ssid="1-null-151" dnum="iv-o" numlevel="1" lineno="433" slineno="2-226" level="3"><display>(iv)</display>a home, residence, or facility, in which:<subsection ssid="1-null-152" dnum="A-o" numlevel="1" lineno="434" slineno="2-227" level="4"><display>(A)</display>residents, by a majority vote of the residents, establish, implement, and <ln numlevel="1" lineno="435" slineno="2-228"/>enforce policies governing the living environment, including the manner in <ln numlevel="1" lineno="436" slineno="2-229"/>which applications for residence are approved and the manner in which <ln numlevel="1" lineno="437" slineno="2-230"/>residents are expelled;</subsection><subsection ssid="1-null-153" dnum="B-o" numlevel="1" lineno="438" slineno="2-231" level="4"><display>(B)</display>residents equitably share rent and housing-related expenses; and</subsection><subsection ssid="1-null-154" dnum="C-o" numlevel="1" lineno="439" slineno="2-232" level="4"><display>(C)</display>a landlord, owner, or operator does not receive compensation, other than fair <ln numlevel="1" lineno="440" slineno="2-233"/>market rental income, for establishing, implementing, or enforcing policies <ln numlevel="1" lineno="441" slineno="2-234"/>governing the living environment.</subsection></subsection></subsection></subsection><subsection ssid="1-null-155" dnum="48-o" numlevel="1" lineno="442" slineno="2-235" level="1"><display>(48)</display>"Regular business hours" means:<subsection ssid="1-null-156" dnum="a-o" numlevel="1" lineno="443" slineno="2-236" level="2"><display>(a)</display>the hours during which services of any kind are provided to a client; or</subsection><subsection ssid="1-null-157" dnum="b-o" numlevel="1" lineno="444" slineno="2-237" level="2"><display>(b)</display>the hours during which a client is present at the facility of a licensee.</subsection></subsection><subsection ssid="1-null-158" dnum="49-o" numlevel="1" lineno="445" slineno="2-238" level="1" space="false"><display>(49)</display><subsection ssid="1-null-159" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residential support program" means a program that arranges for or provides the <ln numlevel="1" lineno="446" slineno="2-239"/>necessities of life as a protective service to individuals or families who have a <ln numlevel="1" lineno="447" slineno="2-240"/>disability or who are experiencing a dislocation or emergency that prevents them <ln numlevel="1" lineno="448" slineno="2-241"/>from providing these services for themselves or their families.</subsection><subsection ssid="1-null-160" dnum="b-o" numlevel="1" lineno="449" slineno="2-242" level="2"><display>(b)</display>"Residential support program" includes a program that provides a supervised living <ln numlevel="1" lineno="450" slineno="2-243"/>environment for individuals with dysfunctions or impairments that are:<subsection ssid="1-null-161" dnum="i-o" numlevel="1" lineno="451" slineno="2-244" level="3"><display>(i)</display>emotional;</subsection><subsection ssid="1-null-162" dnum="ii-o" numlevel="1" lineno="452" slineno="2-245" level="3"><display>(ii)</display>psychological;</subsection><subsection ssid="1-null-163" dnum="iii-o" numlevel="1" lineno="453" slineno="2-246" level="3"><display>(iii)</display>developmental; or</subsection><subsection ssid="1-null-164" dnum="iv-o" numlevel="1" lineno="454" slineno="2-247" level="3"><display>(iv)</display>behavioral.</subsection></subsection><subsection ssid="1-null-165" dnum="c-o" numlevel="1" lineno="455" slineno="2-248" level="2"><display>(c)</display>Treatment is not a necessary component of a residential support program.</subsection><subsection ssid="1-null-166" dnum="d-o" numlevel="1" lineno="456" slineno="2-249" level="2"><display>(d)</display>"Residential support program" does not include:<subsection ssid="1-null-167" dnum="i-o" numlevel="1" lineno="457" slineno="2-250" level="3"><display>(i)</display>a recovery residence; or</subsection><subsection ssid="1-null-168" dnum="ii-o" numlevel="1" lineno="458" slineno="2-251" level="3"><display>(ii)</display>a program that provides residential services that are performed:<subsection ssid="1-null-169" dnum="A-o" numlevel="1" lineno="459" slineno="2-252" level="4"><display>(A)</display>exclusively under contract with the department and provided to individuals <ln numlevel="1" lineno="460" slineno="2-253"/>through the Division of Services for People with Disabilities; or</subsection><subsection ssid="1-null-170" dnum="B-o" numlevel="1" lineno="461" slineno="2-254" level="4"><display>(B)</display>in a facility that serves fewer than four individuals.</subsection></subsection></subsection></subsection><subsection ssid="1-null-171" dnum="50-o" numlevel="1" lineno="462" slineno="2-255" level="1" space="false"><display>(50)</display><subsection ssid="1-null-172" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Residential treatment" means a 24-hour group living environment for four or <ln numlevel="1" lineno="463" slineno="2-256"/>more individuals unrelated to the owner or provider that offers room or board and <ln numlevel="1" lineno="464" slineno="2-257"/>specialized treatment, behavior modification, rehabilitation, discipline, emotional <ln numlevel="1" lineno="465" slineno="2-258"/>growth, or habilitation services for persons with emotional, psychological, <ln numlevel="1" lineno="466" slineno="2-259"/>developmental, or behavioral dysfunctions, impairments, or chemical dependencies.</subsection><subsection ssid="1-null-173" dnum="b-o" numlevel="1" lineno="467" slineno="2-260" level="2"><display>(b)</display>"Residential treatment" does not include a:<subsection ssid="1-null-174" dnum="i-o" numlevel="1" lineno="468" slineno="2-261" level="3"><display>(i)</display>boarding school;</subsection><subsection ssid="1-null-175" dnum="ii-o" numlevel="1" lineno="469" slineno="2-262" level="3"><display>(ii)</display>foster home; or</subsection><subsection ssid="1-null-176" dnum="iii-o" numlevel="1" lineno="470" slineno="2-263" level="3"><display>(iii)</display>recovery residence.</subsection></subsection></subsection><subsection ssid="1-null-177" dnum="51-o" numlevel="1" lineno="471" slineno="2-264" level="1"><display>(51)</display>"Residential treatment program" means a program or facility that provides:<subsection ssid="1-null-178" dnum="a-o" numlevel="1" lineno="472" slineno="2-265" level="2"><display>(a)</display>residential treatment; or</subsection><subsection ssid="1-null-179" dnum="b-o" numlevel="1" lineno="473" slineno="2-266" level="2"><display>(b)</display>intermediate secure treatment.</subsection></subsection><subsection ssid="1-null-180" dnum="52-o" numlevel="1" lineno="474" slineno="2-267" level="1"><display>(52)</display>"Seclusion" means the involuntary confinement of an individual in a room or an area:<subsection ssid="1-null-181" dnum="a-o" numlevel="1" lineno="475" slineno="2-268" level="2"><display>(a)</display>away from the individual's peers; and</subsection><subsection ssid="1-null-182" dnum="b-o" numlevel="1" lineno="476" slineno="2-269" level="2"><display>(b)</display>in a manner that physically prevents the individual from leaving the room or area.</subsection></subsection><subsection ssid="1-null-183" dnum="53-o" numlevel="1" lineno="477" slineno="2-270" level="1"><display>(53)</display>"Short-term relief care provider" means an individual who:<subsection ssid="1-null-184" dnum="a-o" numlevel="1" lineno="478" slineno="2-271" level="2"><display>(a)</display>provides short-term and temporary relief care to a foster parent:<subsection ssid="1-null-185" dnum="i-o" numlevel="1" lineno="479" slineno="2-272" level="3"><display>(i)</display>for less than six consecutive nights; and</subsection><subsection ssid="1-null-186" dnum="ii-o" numlevel="1" lineno="480" slineno="2-273" level="3"><display>(ii)</display>in the short-term relief care provider's home;</subsection></subsection><subsection ssid="1-null-187" dnum="b-o" numlevel="1" lineno="481" slineno="2-274" level="2"><display>(b)</display>is an immediate family member or relative, as those terms are defined in Section <xref depth="3" refnumber="80-3-102"><ln numlevel="1" lineno="482" slineno="2-275"/>80-3-102</xref>, of the foster parent;</subsection><subsection ssid="1-null-188" dnum="c-o" numlevel="1" lineno="483" slineno="2-276" level="2"><display>(c)</display>is direct access qualified, as that term is defined in Section <xref depth="3" refnumber="26B-2-120">26B-2-120</xref>;</subsection><subsection ssid="1-null-189" dnum="d-o" numlevel="1" lineno="484" slineno="2-277" level="2"><display>(d)</display>has been approved to provide short-term relief care by the department;</subsection><subsection ssid="1-null-190" dnum="e-o" numlevel="1" lineno="485" slineno="2-278" level="2"><display>(e)</display>is not reimbursed by the department for the temporary relief care provided; and</subsection><subsection ssid="1-null-191" dnum="f-o" numlevel="1" lineno="486" slineno="2-279" level="2"><display>(f)</display>is not an immediate family member or relative, as those terms are defined in Section <xref depth="3" refnumber="80-3-102"><ln numlevel="1" lineno="487" slineno="2-280"/>80-3-102</xref>, of the foster child.</subsection></subsection><subsection ssid="1-null-192" dnum="54-o" numlevel="1" lineno="488" slineno="2-281" level="1"><display>(54)</display>"Social detoxification" means short-term residential services for persons who are <ln numlevel="1" lineno="489" slineno="2-282"/>experiencing or have recently experienced drug or alcohol intoxication, that are provided <ln numlevel="1" lineno="490" slineno="2-283"/>outside of a health care facility licensed under Part <xref depth="2" refnumber="26B-2-2">2, Health Care Facility Licensing and <ln numlevel="1" lineno="491" slineno="2-284"/>Inspection</xref>, and that include:<subsection ssid="1-null-193" dnum="a-o" numlevel="1" lineno="492" slineno="2-285" level="2"><display>(a)</display>room and board for persons who are unrelated to the owner or manager of the facility;</subsection><subsection ssid="1-null-194" dnum="b-o" numlevel="1" lineno="493" slineno="2-286" level="2"><display>(b)</display>specialized rehabilitation to acquire sobriety; and</subsection><subsection ssid="1-null-195" dnum="c-o" numlevel="1" lineno="494" slineno="2-287" level="2"><display>(c)</display>aftercare services.</subsection></subsection><subsection ssid="1-null-196" dnum="55-o" numlevel="1" lineno="495" slineno="2-288" level="1"><display>(55)</display>"Substance abuse disorder" or "substance use disorder" mean the same as "substance <ln numlevel="1" lineno="496" slineno="2-289"/>use disorder" is defined in Section <xref depth="3" refnumber="26B-5-501">26B-5-501</xref>.</subsection><subsection ssid="1-null-197" dnum="56-o" numlevel="1" lineno="497" slineno="2-290" level="1"><display>(56)</display>"Substance abuse treatment program" or "substance use disorder treatment program" <ln numlevel="1" lineno="498" slineno="2-291"/>means a program:<subsection ssid="1-null-198" dnum="a-o" numlevel="1" lineno="499" slineno="2-292" level="2"><display>(a)</display>designed to provide:<subsection ssid="1-null-199" dnum="i-o" numlevel="1" lineno="500" slineno="2-293" level="3"><display>(i)</display>specialized drug or alcohol treatment;</subsection><subsection ssid="1-null-200" dnum="ii-o" numlevel="1" lineno="501" slineno="2-294" level="3"><display>(ii)</display>rehabilitation; or</subsection><subsection ssid="1-null-201" dnum="iii-o" numlevel="1" lineno="502" slineno="2-295" level="3"><display>(iii)</display>habilitation services; and</subsection></subsection><subsection ssid="1-null-202" dnum="b-o" numlevel="1" lineno="503" slineno="2-296" level="2"><display>(b)</display>that provides the treatment or services described in Subsection <xref depth="4" refnumber="26B-2-101(56)(a)">(56)(a)</xref> to persons <ln numlevel="1" lineno="504" slineno="2-297"/>with:<subsection ssid="1-null-203" dnum="i-o" numlevel="1" lineno="505" slineno="2-298" level="3"><display>(i)</display>a diagnosed substance use disorder; or</subsection><subsection ssid="1-null-204" dnum="ii-o" numlevel="1" lineno="506" slineno="2-299" level="3"><display>(ii)</display>chemical dependency disorder.</subsection></subsection></subsection><subsection ssid="1-null-205" dnum="57-o" numlevel="1" lineno="507" slineno="2-300" level="1"><display>(57)</display>"Therapeutic school" means a residential group living facility:<subsection ssid="1-null-206" dnum="a-o" numlevel="1" lineno="508" slineno="2-301" level="2"><display>(a)</display>for four or more individuals that are not related to:<subsection ssid="1-null-207" dnum="i-o" numlevel="1" lineno="509" slineno="2-302" level="3"><display>(i)</display>the owner of the facility; or</subsection><subsection ssid="1-null-208" dnum="ii-o" numlevel="1" lineno="510" slineno="2-303" level="3"><display>(ii)</display>the primary service provider of the facility;</subsection></subsection><subsection ssid="1-null-209" dnum="b-o" numlevel="1" lineno="511" slineno="2-304" level="2"><display>(b)</display>that serves students who have a history of failing to function:<subsection ssid="1-null-210" dnum="i-o" numlevel="1" lineno="512" slineno="2-305" level="3"><display>(i)</display>at home;</subsection><subsection ssid="1-null-211" dnum="ii-o" numlevel="1" lineno="513" slineno="2-306" level="3"><display>(ii)</display>in a public school; or</subsection><subsection ssid="1-null-212" dnum="iii-o" numlevel="1" lineno="514" slineno="2-307" level="3"><display>(iii)</display>in a nonresidential private school; and</subsection></subsection><subsection ssid="1-null-213" dnum="c-o" numlevel="1" lineno="515" slineno="2-308" level="2"><display>(c)</display>that offers:<subsection ssid="1-null-214" dnum="i-o" numlevel="1" lineno="516" slineno="2-309" level="3"><display>(i)</display>room and board; and</subsection><subsection ssid="1-null-215" dnum="ii-o" numlevel="1" lineno="517" slineno="2-310" level="3"><display>(ii)</display>an academic education integrated with:<subsection ssid="1-null-216" dnum="A-o" numlevel="1" lineno="518" slineno="2-311" level="4"><display>(A)</display>specialized structure and supervision; or</subsection><subsection ssid="1-null-217" dnum="B-o" numlevel="1" lineno="519" slineno="2-312" level="4"><display>(B)</display>services or treatment related to:<subsection ssid="1-null-218" dnum="I-o" numlevel="1" lineno="520" slineno="2-313" level="5"><display>(I)</display>a disability;</subsection><subsection ssid="1-null-219" dnum="II-o" numlevel="1" lineno="521" slineno="2-314" level="5"><display>(II)</display>emotional development;</subsection><subsection ssid="1-null-220" dnum="III-o" numlevel="1" lineno="522" slineno="2-315" level="5"><display>(III)</display>behavioral development;</subsection><subsection ssid="1-null-221" dnum="IV-o" numlevel="1" lineno="523" slineno="2-316" level="5"><display>(IV)</display>familial development; or</subsection><subsection ssid="1-null-222" dnum="V-o" numlevel="1" lineno="524" slineno="2-317" level="5"><display>(V)</display>social development.</subsection></subsection></subsection></subsection></subsection><subsection ssid="1-null-223" dnum="58-o" numlevel="1" lineno="525" slineno="2-318" level="1"><display>(58)</display>"Unrelated persons" means persons other than parents, legal guardians, grandparents, <ln numlevel="1" lineno="526" slineno="2-319"/>brothers, sisters, uncles, or aunts.</subsection><subsection ssid="1-null-224" dnum="59-o" numlevel="1" lineno="527" slineno="2-320" level="1"><display>(59)</display>"Vulnerable adult" means an elder adult or an adult who has a temporary or permanent <ln numlevel="1" lineno="528" slineno="2-321"/>mental or physical impairment that substantially affects the person's ability to:<subsection ssid="1-null-225" dnum="a-o" numlevel="1" lineno="529" slineno="2-322" level="2"><display>(a)</display>provide personal protection;</subsection><subsection ssid="1-null-226" dnum="b-o" numlevel="1" lineno="530" slineno="2-323" level="2"><display>(b)</display>provide necessities such as food, shelter, clothing, or mental or other health care;</subsection><subsection ssid="1-null-227" dnum="c-o" numlevel="1" lineno="531" slineno="2-324" level="2"><display>(c)</display>obtain services necessary for health, safety, or welfare;</subsection><subsection ssid="1-null-228" dnum="d-o" numlevel="1" lineno="532" slineno="2-325" level="2"><display>(d)</display>carry out the activities of daily living;</subsection><subsection ssid="1-null-229" dnum="e-o" numlevel="1" lineno="533" slineno="2-326" level="2"><display>(e)</display>manage the adult's own resources; or</subsection><subsection ssid="1-null-230" dnum="f-o" numlevel="1" lineno="534" slineno="2-327" level="2"><display>(f)</display>comprehend the nature and consequences of remaining in a situation of abuse, <ln numlevel="1" lineno="535" slineno="2-328"/>neglect, or exploitation.</subsection></subsection><subsection ssid="1-null-231" dnum="60-o" numlevel="1" lineno="536" slineno="2-329" level="1" space="false"><display>(60)</display><subsection ssid="1-null-232" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Youth program" means a program designed to provide behavioral, substance <ln numlevel="1" lineno="537" slineno="2-330"/>use, or mental health services to minors that:<subsection ssid="1-null-233" dnum="i-o" numlevel="1" lineno="538" slineno="2-331" level="3" tab="1"><display>(i)</display>serves adjudicated or nonadjudicated youth;</subsection><subsection ssid="1-null-234" dnum="ii-o" numlevel="1" lineno="539" slineno="2-332" level="3" tab="1"><display>(ii)</display>charges a fee for the program's services;</subsection><subsection ssid="1-null-235" dnum="iii-o" numlevel="1" lineno="540" slineno="2-333" level="3" tab="1"><display>(iii)</display>may provide host homes or other arrangements for overnight accommodation of <ln numlevel="1" lineno="541" slineno="2-334"/>the youth;</subsection><subsection ssid="1-null-236" dnum="iv-o" numlevel="1" lineno="542" slineno="2-335" level="3" tab="1"><display>(iv)</display>may provide all or part of the program's services in the outdoors;</subsection><subsection ssid="1-null-237" dnum="v-o" numlevel="1" lineno="543" slineno="2-336" level="3" tab="1"><display>(v)</display>may limit or censor access to parents or guardians; and</subsection><subsection ssid="1-null-238" dnum="vi-o" numlevel="1" lineno="544" slineno="2-337" level="3" tab="1"><display>(vi)</display>prohibits or restricts a minor's ability to leave the program at any time of the <ln numlevel="1" lineno="545" slineno="2-338"/>minor's own free will.</subsection></subsection><subsection ssid="1-null-239" dnum="b-o" numlevel="1" lineno="546" slineno="2-339" level="2"><display>(b)</display>"Youth program" does not include recreational programs such as Boy Scouts, Girl <ln numlevel="1" lineno="547" slineno="2-340"/>Scouts, 4-H, and other such organizations.</subsection></subsection><subsection ssid="1-null-240" dnum="61-o" numlevel="1" lineno="548" slineno="2-341" level="1" space="false"><display>(61)</display><subsection ssid="1-null-241" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Youth transportation company" means any person that transports a child for <ln numlevel="1" lineno="549" slineno="2-342"/>payment to or from a congregate care program in Utah.</subsection><subsection ssid="1-null-242" dnum="b-o" numlevel="1" lineno="550" slineno="2-343" level="2"><display>(b)</display>"Youth transportation company" does not include:<subsection ssid="1-null-243" dnum="i-o" numlevel="1" lineno="551" slineno="2-344" level="3"><display>(i)</display>a relative of the child;</subsection><subsection ssid="1-null-244" dnum="ii-o" numlevel="1" lineno="552" slineno="2-345" level="3"><display>(ii)</display>a state agency; or</subsection><subsection ssid="1-null-245" dnum="iii-o" numlevel="1" lineno="553" slineno="2-346" level="3"><display>(iii)</display>a congregate care program's employee who transports the child from the <ln numlevel="1" lineno="554" slineno="2-347"/>congregate care program that employs the employee and returns the child to the <ln numlevel="1" lineno="555" slineno="2-348"/>same congregate care program.</subsection></subsection></subsection></section></bsec><bsec buid="97" num="26B-2-117" type="amend" src="code" uid="C26B-2-S117_2026050620260506" sort="26B02 01170020260506" numlevel="1" lineno="556" slineno="3-1" sn="3"><section number="26B-2-117" numlevel="1" lineno="557" slineno="3-2" type="amend"><secline lineno="556">Section 3. Section <bold>26B-2-117</bold> is amended to read:</secline><catline lineno="557"><bold>26B-2-117<parens/>. Licensing residential treatment programs and recovery residences -- <ln numlevel="1" lineno="558" slineno="3-3"/>Notification of local government.</bold></catline><subsection ssid="97-null-1" dnum="1-o" numlevel="1" lineno="559" slineno="3-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="97-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with <xref depth="1" refnumber="63G-3" start="0">Title 63G, Chapter 3, Utah Administrative Rulemaking Act</xref>, <ln numlevel="1" lineno="560" slineno="3-5"/>the office shall make rules that establish categories of residential treatment and <ln numlevel="1" lineno="561" slineno="3-6"/>recovery residence licenses based on differences in the types of residential treatment <ln numlevel="1" lineno="562" slineno="3-7"/>programs and recovery residences.</subsection><subsection ssid="97-null-3" dnum="b-o" numlevel="1" lineno="563" slineno="3-8" level="2"><display>(b)</display>The categories referred to in Subsection <xref depth="4" refnumber="26B-2-117(1)(a)" start="0">(1)(a)</xref> may be based on differences in:<subsection ssid="97-null-4" dnum="i-o" numlevel="1" lineno="564" slineno="3-9" level="3"><display>(i)</display>services offered;</subsection><subsection ssid="97-null-5" dnum="ii-o" numlevel="1" lineno="565" slineno="3-10" level="3"><display>(ii)</display>types of clients served;</subsection><subsection ssid="97-null-6" dnum="iii-o" numlevel="1" lineno="566" slineno="3-11" level="3"><display>(iii)</display>risks posed to the community; or</subsection><subsection ssid="97-null-7" dnum="iv-o" numlevel="1" lineno="567" slineno="3-12" level="3"><display>(iv)</display>other factors that make regulatory differences advisable.</subsection></subsection></subsection><subsection ssid="97-null-8" dnum="2-o" numlevel="1" lineno="568" slineno="3-13" level="1"><display>(2)</display>Subject to the requirements of federal and state law, and <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="18" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="28" groupid="14" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> <ln numlevel="1" lineno="569" slineno="3-14"/>the authority granted by Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="7" groupid="7" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-104" start="0">26B-2-104</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-902">26B-2-902</xref></amend>, the office shall establish and <ln numlevel="1" lineno="570" slineno="3-15"/>enforce rules that:<subsection ssid="97-null-9" dnum="a-o" numlevel="1" lineno="571" slineno="3-16" level="2" space="false"><display>(a)</display><subsection ssid="97-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>relate generally to all categories of residential treatment program and recovery <ln numlevel="1" lineno="572" slineno="3-17"/>residence licenses; and</subsection><subsection ssid="97-null-11" dnum="ii-o" numlevel="1" lineno="573" slineno="3-18" level="3"><display>(ii)</display>relate to specific categories of residential treatment program and recovery <ln numlevel="1" lineno="574" slineno="3-19"/>residence licenses on the basis of the regulatory needs, as determined by the <ln numlevel="1" lineno="575" slineno="3-20"/>office, of residential treatment programs and recovery residences within those <ln numlevel="1" lineno="576" slineno="3-21"/>specific categories;</subsection></subsection><subsection ssid="97-null-12" dnum="b-o" numlevel="1" lineno="577" slineno="3-22" level="2"><display>(b)</display>preclude each qualified residential treatment program and each qualified recovery <ln numlevel="1" lineno="578" slineno="3-23"/>residence from refusing to accept a client based solely on the client's use of <ln numlevel="1" lineno="579" slineno="3-24"/>medication assisted treatment consistent with the recommendation of a licensed <ln numlevel="1" lineno="580" slineno="3-25"/>prescriber or provider;</subsection><subsection ssid="97-null-13" dnum="c-o" numlevel="1" lineno="581" slineno="3-26" level="2"><display>(c)</display>require each qualified residential treatment program and each qualified recovery <ln numlevel="1" lineno="582" slineno="3-27"/>residence to allow a client to receive medication assisted treatment as recommended <ln numlevel="1" lineno="583" slineno="3-28"/>by a licensed prescriber or provider; and</subsection><subsection ssid="97-null-14" dnum="d-o" numlevel="1" lineno="584" slineno="3-29" level="2"><display>(d)</display>require that each Medicaid provider contract with a qualified residential treatment <ln numlevel="1" lineno="585" slineno="3-30"/>program or a qualified recovery residence includes a provision obligating the <ln numlevel="1" lineno="586" slineno="3-31"/>provider to comply with rules enacted <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="33" groupid="19" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="15" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> Subsections <xref depth="4" refnumber="26B-2-117(2)(b)"><ln numlevel="1" lineno="587" slineno="3-32"/>(2)(b)</xref> and <xref depth="4" refnumber="26B-2-117(c)">(c)</xref>, subject to the sanctions provided <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="34" groupid="20" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="16" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> <ln numlevel="1" lineno="588" slineno="3-33"/>Subsection <xref tempid="741" depth="4" refnumber="26B-3-108(6)">26B-3-108(6)</xref>.</subsection></subsection><subsection ssid="97-null-15" dnum="3-o" numlevel="1" lineno="589" slineno="3-34" level="1" space="false"><display>(3)</display><subsection ssid="97-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Beginning July 1, 2014, the office shall charge an annual licensing fee, set by the <ln numlevel="1" lineno="590" slineno="3-35"/>office in accordance with the procedures described in Section <xref depth="3" refnumber="63J-1-504" start="0">63J-1-504</xref>, to a <ln numlevel="1" lineno="591" slineno="3-36"/>recovery residence in an amount that will pay for the cost of the licensing and <ln numlevel="1" lineno="592" slineno="3-37"/>inspection requirements described in this section and in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-104" start="0">26B-2-104</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-902"><ln numlevel="1" lineno="593" slineno="3-38"/>26B-2-902</xref></amend>.</subsection><subsection ssid="97-null-17" dnum="b-o" numlevel="1" lineno="594" slineno="3-39" level="2"><display>(b)</display>The office shall deposit the licensing fees described in this section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="37" groupid="23" style="2" owner="admin" level="1" deltag="both">in</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="36" groupid="22" style="1" owner="admin" level="1" amendtag="both" space="true">into</amend> the <ln numlevel="1" lineno="595" slineno="3-40"/>General Fund as a dedicated credit to be used solely to pay for the cost of the <ln numlevel="1" lineno="596" slineno="3-41"/>licensing and inspection requirements described in this section and in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="9" groupid="9" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-104" start="0"><ln numlevel="1" lineno="597" slineno="3-42"/>26B-2-104</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-902">26B-2-902</xref></amend>.</subsection></subsection><subsection ssid="97-null-18" dnum="4-o" numlevel="1" lineno="598" slineno="3-43" level="1"><display>(4)</display>Before submitting an application for a license to operate a residential treatment <ln numlevel="1" lineno="599" slineno="3-44"/>program, the applicant shall serve notice of its intent to operate a residential treatment <ln numlevel="1" lineno="600" slineno="3-45"/>program on the governing body of:<subsection ssid="97-null-19" dnum="a-o" numlevel="1" lineno="601" slineno="3-46" level="2"><display>(a)</display>the city in which the residential treatment program will be located; or</subsection><subsection ssid="97-null-20" dnum="b-o" numlevel="1" lineno="602" slineno="3-47" level="2"><display>(b)</display>if the residential treatment program will be located in the unincorporated area of a <ln numlevel="1" lineno="603" slineno="3-48"/>county, the county in which the residential treatment program will be located.</subsection></subsection><subsection ssid="97-null-21" dnum="5-o" numlevel="1" lineno="604" slineno="3-49" level="1"><display>(5)</display>The notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref> shall include the following information relating <ln numlevel="1" lineno="605" slineno="3-50"/>to the residential treatment program:<subsection ssid="97-null-22" dnum="a-o" numlevel="1" lineno="606" slineno="3-51" level="2"><display>(a)</display>an accurate description of the residential treatment program;</subsection><subsection ssid="97-null-23" dnum="b-o" numlevel="1" lineno="607" slineno="3-52" level="2"><display>(b)</display>the location where the residential treatment program will be operated;</subsection><subsection ssid="97-null-24" dnum="c-o" numlevel="1" lineno="608" slineno="3-53" level="2"><display>(c)</display>the services that will be provided by the residential treatment program;</subsection><subsection ssid="97-null-25" dnum="d-o" numlevel="1" lineno="609" slineno="3-54" level="2"><display>(d)</display>the type of clients that the residential treatment program will serve;</subsection><subsection ssid="97-null-26" dnum="e-o" numlevel="1" lineno="610" slineno="3-55" level="2"><display>(e)</display>the category of license for which the residential treatment program is applying to the <ln numlevel="1" lineno="611" slineno="3-56"/>office;</subsection><subsection ssid="97-null-27" dnum="f-o" numlevel="1" lineno="612" slineno="3-57" level="2"><display>(f)</display>the name, telephone number, and address of a person that may be contacted to make <ln numlevel="1" lineno="613" slineno="3-58"/>inquiries about the residential treatment program; and</subsection><subsection ssid="97-null-28" dnum="g-o" numlevel="1" lineno="614" slineno="3-59" level="2"><display>(g)</display>any other information that the office may require by rule.</subsection></subsection><subsection ssid="97-null-29" dnum="6-o" numlevel="1" lineno="615" slineno="3-60" level="1"><display>(6)</display>When submitting an application for a license to operate a residential treatment program, <ln numlevel="1" lineno="616" slineno="3-61"/>the applicant shall include with the application:<subsection ssid="97-null-30" dnum="a-o" numlevel="1" lineno="617" slineno="3-62" level="2"><display>(a)</display>a copy of the notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref>; and</subsection><subsection ssid="97-null-31" dnum="b-o" numlevel="1" lineno="618" slineno="3-63" level="2"><display>(b)</display>proof that the applicant served the notice described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref> on the <ln numlevel="1" lineno="619" slineno="3-64"/>governing body described in Subsection <xref depth="4" refnumber="26B-2-117(4)" start="0">(4)</xref>.</subsection></subsection></section></bsec><bsec buid="86" num="26B-2-103" type="renumamend" src="code" uid="C26b-2-S901_2026050620260506" sort="26b02 09010020260506" newnum="26b-2-901" numlevel="1" lineno="620" slineno="4-1" rlineno="621" sn="4"><section number="26B-2-103" numlevel="1" lineno="623" slineno="4-4" type="renumamend" newnum="26b-2-901"><secline lineno="620">Section 4. Division of Licensing and Background Checks. </bold></catline><subsection ssid="86-null-1" dnum="1-o" numlevel="1" lineno="624" slineno="4-5" level="1" placement="noreturn"><display>(1)</display>There is created the Division of Licensing and Background Checks within the <ln numlevel="1" lineno="625" slineno="4-6"/>department. </subsection><subsection ssid="86-null-2" dnum="2-o" numlevel="1" lineno="626" slineno="4-7" level="1"><display>(2)</display>The division shall be the licensing and background screening authority for the <ln numlevel="1" lineno="627" slineno="4-8"/>department, and is vested with all the powers, duties, and responsibilities described in:<subsection ssid="86-null-3" dnum="a-o" numlevel="1" lineno="628" slineno="4-9" level="2"><display>(a)</display>this part;</subsection><subsection ssid="86-null-4" dnum="b-o" numlevel="1" lineno="629" slineno="4-10" level="2"><display>(b)</display>Part 2, Health Care Facility Licensing and Inspection;</subsection><subsection ssid="86-null-5" dnum="c-o" numlevel="1" lineno="630" slineno="4-11" level="2"><display>(c)</display>Part 4, Child Care Licensing; and</subsection><subsection ssid="86-null-6" dnum="d-o" numlevel="1" lineno="631" slineno="4-12" level="2"><display>(d)</display>Part 6, Mammography Quality Assurance.</subsection></subsection><subsection ssid="86-null-7" dnum="3-o" numlevel="1" lineno="632" slineno="4-13" level="1"><display>(3)</display>The executive director shall appoint the director of the division.</subsection><subsection ssid="86-null-8" dnum="4-o" numlevel="1" lineno="633" slineno="4-14" level="1"><display>(4)</display>There are created within the division the Office of Licensing and the Office of <ln numlevel="1" lineno="634" slineno="4-15"/>Background Processing.</subsection></section></bsec><bsec buid="88" num="26B-2-104" type="renumamend" src="code" uid="C26b-2-S902_2026050620260506" sort="26b02 09020020260506" newnum="26b-2-902" numlevel="1" lineno="635" slineno="5-1" rlineno="636" sn="5"><section number="26B-2-104" numlevel="1" lineno="637" slineno="5-3" type="renumamend" newnum="26b-2-902"><secline lineno="635">Section 5. and</subsection><subsection ssid="88-null-10" dnum="II-o" numlevel="1" lineno="649" slineno="5-15" level="5"><display>(II)</display>area and community surrounding the physical facility;</subsection></subsection><subsection ssid="88-null-11" dnum="F-o" numlevel="1" lineno="650" slineno="5-16" level="4"><display>(F)</display>transportation safety;</subsection><subsection ssid="88-null-12" dnum="G-o" numlevel="1" lineno="651" slineno="5-17" level="4"><display>(G)</display>emergency preparedness and response;</subsection><subsection ssid="88-null-13" dnum="H-o" numlevel="1" lineno="652" slineno="5-18" level="4"><display>(H)</display>the administration of medical standards and procedures, consistent with the <ln numlevel="1" lineno="653" slineno="5-19"/>related provisions of this title;</subsection><subsection ssid="88-null-14" dnum="I-o" numlevel="1" lineno="654" slineno="5-20" level="4"><display>(I)</display>staff and client safety and protection;</subsection><subsection ssid="88-null-15" dnum="J-o" numlevel="1" lineno="655" slineno="5-21" level="4"><display>(J)</display>the administration and maintenance of client and service records;</subsection><subsection ssid="88-null-16" dnum="K-o" numlevel="1" lineno="656" slineno="5-22" level="4"><display>(K)</display>staff qualifications and training, including standards for permitting experience <ln numlevel="1" lineno="657" slineno="5-23"/>to be substituted for education, unless prohibited by law;</subsection><subsection ssid="88-null-17" dnum="L-o" numlevel="1" lineno="658" slineno="5-24" level="4"><display>(L)</display>staff to client ratios;</subsection><subsection ssid="88-null-18" dnum="M-o" numlevel="1" lineno="659" slineno="5-25" level="4"><display>(M)</display>access to firearms; and</subsection><subsection ssid="88-null-19" dnum="N-o" numlevel="1" lineno="660" slineno="5-26" level="4"><display>(N)</display>the prevention of abuse, neglect, exploitation, harm, mistreatment, or fraud;</subsection></subsection><subsection ssid="88-null-20" dnum="ii-o" numlevel="1" lineno="661" slineno="5-27" level="3"><display>(ii)</display>basic health and safety standards for therapeutic schools, that shall be limited to:<subsection ssid="88-null-21" dnum="A-o" numlevel="1" lineno="662" slineno="5-28" level="4"><display>(A)</display>fire safety, except that the standards are limited to those required by law or <ln numlevel="1" lineno="663" slineno="5-29"/>rule under Title 53, Chapter 7, Part 2, Fire Prevention and Fireworks Act;</subsection><subsection ssid="88-null-22" dnum="B-o" numlevel="1" lineno="664" slineno="5-30" level="4"><display>(B)</display>food safety;</subsection><subsection ssid="88-null-23" dnum="C-o" numlevel="1" lineno="665" slineno="5-31" level="4"><display>(C)</display>sanitation;</subsection><subsection ssid="88-null-24" dnum="D-o" numlevel="1" lineno="666" slineno="5-32" level="4"><display>(D)</display>infectious disease control, except that the standards are limited to:<subsection ssid="88-null-25" dnum="I-o" numlevel="1" lineno="667" slineno="5-33" level="5"><display>(I)</display>those required by law or rule under this title, or Title 26A, Local Health <ln numlevel="1" lineno="668" slineno="5-34"/>Authorities; and</subsection><subsection ssid="88-null-26" dnum="II-o" numlevel="1" lineno="669" slineno="5-35" level="5"><display>(II)</display>requiring a separate room for clients who are sick;</subsection></subsection><subsection ssid="88-null-27" dnum="E-o" numlevel="1" lineno="670" slineno="5-36" level="4"><display>(E)</display>safety of the physical facility and grounds, except that the standards are <ln numlevel="1" lineno="671" slineno="5-37"/>limited to those required by law or rule under Title 53, Chapter 7, Part 2, Fire <ln numlevel="1" lineno="672" slineno="5-38"/>Prevention and Fireworks Act;</subsection><subsection ssid="88-null-28" dnum="F-o" numlevel="1" lineno="673" slineno="5-39" level="4"><display>(F)</display>transportation safety;</subsection><subsection ssid="88-null-29" dnum="G-o" numlevel="1" lineno="674" slineno="5-40" level="4"><display>(G)</display>emergency preparedness and response;</subsection><subsection ssid="88-null-30" dnum="H-o" numlevel="1" lineno="675" slineno="5-41" level="4"><display>(H)</display>access to appropriate medical care, including:<subsection ssid="88-null-31" dnum="I-o" numlevel="1" lineno="676" slineno="5-42" level="5"><display>(I)</display>subject to the requirements of law, designation of a person who is <ln numlevel="1" lineno="677" slineno="5-43"/>authorized to dispense medication; and</subsection><subsection ssid="88-null-32" dnum="II-o" numlevel="1" lineno="678" slineno="5-44" level="5"><display>(II)</display>storing, tracking, and securing medication;</subsection></subsection><subsection ssid="88-null-33" dnum="I-o" numlevel="1" lineno="679" slineno="5-45" level="4"><display>(I)</display>staff and client safety and protection that permits the school to provide for the <ln numlevel="1" lineno="680" slineno="5-46"/>direct supervision of clients at all times;</subsection><subsection ssid="88-null-34" dnum="J-o" numlevel="1" lineno="681" slineno="5-47" level="4"><display>(J)</display>the administration and maintenance of client and service records;</subsection><subsection ssid="88-null-35" dnum="K-o" numlevel="1" lineno="682" slineno="5-48" level="4"><display>(K)</display>staff qualifications and training, including standards for permitting experience <ln numlevel="1" lineno="683" slineno="5-49"/>to be substituted for education, unless prohibited by law;</subsection><subsection ssid="88-null-36" dnum="L-o" numlevel="1" lineno="684" slineno="5-50" level="4"><display>(L)</display>staff to client ratios;</subsection><subsection ssid="88-null-37" dnum="M-o" numlevel="1" lineno="685" slineno="5-51" level="4"><display>(M)</display>access to firearms; and</subsection><subsection ssid="88-null-38" dnum="N-o" numlevel="1" lineno="686" slineno="5-52" level="4"><display>(N)</display>the prevention of abuse, neglect, exploitation, harm, mistreatment, or fraud;</subsection></subsection><subsection ssid="88-null-39" dnum="iii-o" numlevel="1" lineno="687" slineno="5-53" level="3"><display>(iii)</display>procedures and standards for permitting a licensee to:<subsection ssid="88-null-40" dnum="A-o" numlevel="1" lineno="688" slineno="5-54" level="4"><display>(A)</display>provide in the same facility and under the same conditions as children, <ln numlevel="1" lineno="689" slineno="5-55"/>residential treatment services to a person 18 years old or older who:<subsection ssid="88-null-41" dnum="I-o" numlevel="1" lineno="690" slineno="5-56" level="5"><display>(I)</display>begins to reside at the licensee's residential treatment facility before the <ln numlevel="1" lineno="691" slineno="5-57"/>person's 18th birthday;</subsection><subsection ssid="88-null-42" dnum="II-o" numlevel="1" lineno="692" slineno="5-58" level="5"><display>(II)</display>has resided at the licensee's residential treatment facility continuously since <ln numlevel="1" lineno="693" slineno="5-59"/>the time described in Subsection <xref depth="4" refnumber="26B-2-104(1)(a)(iii)(a)(i)">(1)(a)(iii)(A)(I)</xref>;</subsection><subsection ssid="88-null-43" dnum="III-o" numlevel="1" lineno="694" slineno="5-60" level="5"><display>(III)</display>has not completed the course of treatment for which the person began <ln numlevel="1" lineno="695" slineno="5-61"/>residing at the licensee's residential treatment facility; and</subsection><subsection ssid="88-null-44" dnum="IV-o" numlevel="1" lineno="696" slineno="5-62" level="5"><display>(IV)</display>voluntarily consents to complete the course of treatment described in <ln numlevel="1" lineno="697" slineno="5-63"/>Subsection <xref depth="4" refnumber="26B-2-104(1)(a)(iii)(a)(iii)">(1)(a)(iii)(A)(III)</xref>; or</subsection></subsection><subsection ssid="88-null-45" dnum="B-o" numlevel="1" lineno="698" slineno="5-64" level="4" space="false"><display>(B)</display><subsection ssid="88-null-46" dnum="I-o" level="5" placement="sameline"><display>(I)</display>provide residential treatment services to a child who is:<subsection ssid="88-null-47" dnum="Aa-o" numlevel="1" lineno="699" slineno="5-65" level="6" tab="1"><display>(Aa)</display>at least 12 years old or, as approved by the division, younger than 12 <ln numlevel="1" lineno="700" slineno="5-66"/>years old; and</subsection><subsection ssid="88-null-48" dnum="Bb-o" numlevel="1" lineno="701" slineno="5-67" level="6" tab="1"><display>(Bb)</display>under the custody of the department, or one of its divisions; and</subsection></subsection><subsection ssid="88-null-49" dnum="II-o" numlevel="1" lineno="702" slineno="5-68" level="5"><display>(II)</display>provide, in the same facility as a child described in Subsection <xref depth="4" refnumber="26B-2-104(1)(a)(iii)(b)(i)"><ln numlevel="1" lineno="703" slineno="5-69"/>(1)(a)(iii)(B)(I)</xref>, residential treatment services to a person who is:<subsection ssid="88-null-50" dnum="Aa-o" numlevel="1" lineno="704" slineno="5-70" level="6"><display>(Aa)</display>at least 18 years old, but younger than 21 years old; and</subsection><subsection ssid="88-null-51" dnum="Bb-o" numlevel="1" lineno="705" slineno="5-71" level="6"><display>(Bb)</display>under the custody of the department, or one of its divisions;</subsection></subsection></subsection></subsection><subsection ssid="88-null-52" dnum="iv-o" numlevel="1" lineno="706" slineno="5-72" level="3"><display>(iv)</display>minimum administration and financial requirements for licensees;</subsection><subsection ssid="88-null-53" dnum="v-o" numlevel="1" lineno="707" slineno="5-73" level="3"><display>(v)</display>guidelines for variances from rules established under this Subsection <xref depth="4" refnumber="26B-2-104(1)">(1)</xref>;</subsection><subsection ssid="88-null-54" dnum="vi-o" numlevel="1" lineno="708" slineno="5-74" level="3"><display>(vi)</display>ethical standards, as described in Section <xref depth="3" refnumber="81-13-104">81-13-104</xref>, and minimum <ln numlevel="1" lineno="709" slineno="5-75"/>responsibilities of a child-placing agency that provides adoption services and that <ln numlevel="1" lineno="710" slineno="5-76"/>is licensed under this part;</subsection><subsection ssid="88-null-55" dnum="vii-o" numlevel="1" lineno="711" slineno="5-77" level="3"><display>(vii)</display>what constitutes an "outpatient treatment program" for purposes of this part;</subsection><subsection ssid="88-null-56" dnum="viii-o" numlevel="1" lineno="712" slineno="5-78" level="3"><display>(viii)</display>a procedure requiring a licensee to provide an insurer the licensee's records <ln numlevel="1" lineno="713" slineno="5-79"/>related to any services or supplies billed to the insurer and a procedure allowing <ln numlevel="1" lineno="714" slineno="5-80"/>the licensee and the insurer to contact the Insurance Department to resolve any <ln numlevel="1" lineno="715" slineno="5-81"/>disputes;</subsection><subsection ssid="88-null-57" dnum="ix-o" numlevel="1" lineno="716" slineno="5-82" level="3"><display>(ix)</display>a protocol for the office to investigate and process complaints about licensees;</subsection><subsection ssid="88-null-58" dnum="x-o" numlevel="1" lineno="717" slineno="5-83" level="3"><display>(x)</display>a procedure for a licensee to:<subsection ssid="88-null-59" dnum="A-o" numlevel="1" lineno="718" slineno="5-84" level="4"><display>(A)</display>report the use of a restraint or seclusion within one business day after the day <ln numlevel="1" lineno="719" slineno="5-85"/>on which the use of the restraint or seclusion occurs;</subsection><subsection ssid="88-null-60" dnum="B-o" numlevel="1" lineno="720" slineno="5-86" level="4"><display>(B)</display>report a critical incident within one business day after the day on which the <ln numlevel="1" lineno="721" slineno="5-87"/>incident occurs; and</subsection><subsection ssid="88-null-61" dnum="C-o" numlevel="1" lineno="722" slineno="5-88" level="4"><display>(C)</display>comply with any requirements of this part;</subsection></subsection><subsection ssid="88-null-62" dnum="xi-o" numlevel="1" lineno="723" slineno="5-89" level="3"><display>(xi)</display>guidelines for the policies and procedures described in Sections <xref depth="3" refnumber="26B-2-109">26B-2-109</xref> and <xref depth="3" refnumber="26B-2-123"><ln numlevel="1" lineno="724" slineno="5-90"/>26B-2-123</xref>;</subsection><subsection ssid="88-null-63" dnum="xii-o" numlevel="1" lineno="725" slineno="5-91" level="3"><display>(xii)</display>a procedure for the division to review and approve the policies and procedures <ln numlevel="1" lineno="726" slineno="5-92"/>described in Sections <xref depth="3" refnumber="26B-2-109">26B-2-109</xref> and <xref depth="3" refnumber="26B-2-123">26B-2-123</xref>;</subsection><subsection ssid="88-null-64" dnum="xiii-o" numlevel="1" lineno="727" slineno="5-93" level="3"><display>(xiii)</display>a requirement that each human services program publicly post information that <ln numlevel="1" lineno="728" slineno="5-94"/>informs an individual how to submit a complaint about a human services program <ln numlevel="1" lineno="729" slineno="5-95"/>to the division; and</subsection><subsection ssid="88-null-65" dnum="xiv-o" numlevel="1" lineno="730" slineno="5-96" level="3"><display>(xiv)</display>requirements for disruption plans under Section <xref depth="3" refnumber="26B-2-124">26B-2-124</xref>;</subsection></subsection><subsection ssid="88-null-66" dnum="b-o" numlevel="1" lineno="731" slineno="5-97" level="2"><display>(b)</display>enforce rules relating to the division;</subsection><subsection ssid="88-null-67" dnum="c-o" numlevel="1" lineno="732" slineno="5-98" level="2"><display>(c)</display>issue licenses in accordance with this part;</subsection><subsection ssid="88-null-68" dnum="d-o" numlevel="1" lineno="733" slineno="5-99" level="2"><display>(d)</display>if the United States Department of State executes an agreement with the division that <ln numlevel="1" lineno="734" slineno="5-100"/>designates the division to act as an accrediting entity in accordance with the <ln numlevel="1" lineno="735" slineno="5-101"/>Intercountry Adoption Act of 2000, Pub. L. No. 106-279, accredit one or more <ln numlevel="1" lineno="736" slineno="5-102"/>agencies and persons to provide intercountry adoption services pursuant to:<subsection ssid="88-null-69" dnum="i-o" numlevel="1" lineno="737" slineno="5-103" level="3"><display>(i)</display>the Intercountry Adoption Act of 2000, Pub. L. No. 106-279; and</subsection><subsection ssid="88-null-70" dnum="ii-o" numlevel="1" lineno="738" slineno="5-104" level="3"><display>(ii)</display>the implementing regulations for the Intercountry Adoption Act of 2000, Pub. L. <ln numlevel="1" lineno="739" slineno="5-105"/>No. 106-279;</subsection></subsection><subsection ssid="88-null-71" dnum="e-o" numlevel="1" lineno="740" slineno="5-106" level="2"><display>(e)</display>make rules to implement the provisions of Subsection <xref depth="4" refnumber="26B-2-104(1)(d)">(1)(d)</xref>;</subsection><subsection ssid="88-null-72" dnum="f-o" numlevel="1" lineno="741" slineno="5-107" level="2"><display>(f)</display>conduct surveys and inspections of licensees and facilities in accordance with Section <xref depth="3" refnumber="26B-2-107"><ln numlevel="1" lineno="742" slineno="5-108"/>26B-2-107</xref>;</subsection><subsection ssid="88-null-73" dnum="g-o" numlevel="1" lineno="743" slineno="5-109" level="2"><display>(g)</display>collect licensure fees;</subsection><subsection ssid="88-null-74" dnum="h-o" numlevel="1" lineno="744" slineno="5-110" level="2"><display>(h)</display>notify licensees of the name of a person within the department to contact when filing <ln numlevel="1" lineno="745" slineno="5-111"/>a complaint;</subsection><subsection ssid="88-null-75" dnum="i-o" numlevel="1" lineno="746" slineno="5-112" level="2"><display>(i)</display>investigate complaints regarding any licensee or human services program;</subsection><subsection ssid="88-null-76" dnum="j-o" numlevel="1" lineno="747" slineno="5-113" level="2"><display>(j)</display>have access to all records, correspondence, and financial data required to be <ln numlevel="1" lineno="748" slineno="5-114"/>maintained by a licensee;</subsection><subsection ssid="88-null-77" dnum="k-o" numlevel="1" lineno="749" slineno="5-115" level="2"><display>(k)</display>have authority to interview any client, family member of a client, employee, or <ln numlevel="1" lineno="750" slineno="5-116"/>officer of a licensee;</subsection><subsection ssid="88-null-78" dnum="l-o" numlevel="1" lineno="751" slineno="5-117" level="2"><display>(l)</display>have authority to deny, condition, revoke, suspend, or extend any license issued by <ln numlevel="1" lineno="752" slineno="5-118"/>the department under this part by following the procedures and requirements of Title <ln numlevel="1" lineno="753" slineno="5-119"/>63G, Chapter 4, Administrative Procedures Act;</subsection><subsection ssid="88-null-79" dnum="m-o" numlevel="1" lineno="754" slineno="5-120" level="2"><display>(m)</display>cooperate with the Division of Child and Family Services to condition, revoke, or <ln numlevel="1" lineno="755" slineno="5-121"/>suspend the license of a foster home when a child welfare caseworker from the <ln numlevel="1" lineno="756" slineno="5-122"/>Division of Child and Family Services identifies a safety concern with the foster <ln numlevel="1" lineno="757" slineno="5-123"/>home;</subsection><subsection ssid="88-null-80" dnum="n-o" numlevel="1" lineno="758" slineno="5-124" level="2"><display>(n)</display>electronically post notices of agency action issued to a human services program, with <ln numlevel="1" lineno="759" slineno="5-125"/>the exception of a foster home, on the division's website, in accordance with Title <ln numlevel="1" lineno="760" slineno="5-126"/>63G, Chapter 2, Government Records Access and Management Act; and</subsection><subsection ssid="88-null-81" dnum="o-o" numlevel="1" lineno="761" slineno="5-127" level="2"><display>(o)</display>upon receiving a local government's request under Section <xref depth="3" refnumber="26B-2-118">26B-2-118</xref>, notify the <ln numlevel="1" lineno="762" slineno="5-128"/>local government of new human services program license applications, except for <ln numlevel="1" lineno="763" slineno="5-129"/>foster homes, for human services programs located within the local government's <ln numlevel="1" lineno="764" slineno="5-130"/>jurisdiction. </subsection></subsection><subsection ssid="88-null-82" dnum="2-o" numlevel="1" lineno="765" slineno="5-131" level="1"><display>(2)</display>In establishing rules under Subsection <xref depth="4" refnumber="26B-2-104(1)(a)(ii)(g)">(1)(a)(ii)(G)</xref>, the division shall require a licensee <ln numlevel="1" lineno="766" slineno="5-132"/>to establish and comply with an emergency response plan that requires clients and staff <ln numlevel="1" lineno="767" slineno="5-133"/>to:<subsection ssid="88-null-83" dnum="a-o" numlevel="1" lineno="768" slineno="5-134" level="2"><display>(a)</display>immediately report to law enforcement any significant criminal activity, as defined <ln numlevel="1" lineno="769" slineno="5-135"/>by rule, committed:<subsection ssid="88-null-84" dnum="i-o" numlevel="1" lineno="770" slineno="5-136" level="3"><display>(i)</display>on the premises where the licensee operates its human services program;</subsection><subsection ssid="88-null-85" dnum="ii-o" numlevel="1" lineno="771" slineno="5-137" level="3"><display>(ii)</display>by or against its clients; or</subsection><subsection ssid="88-null-86" dnum="iii-o" numlevel="1" lineno="772" slineno="5-138" level="3"><display>(iii)</display>by or against a staff member while the staff member is on duty;</subsection></subsection><subsection ssid="88-null-87" dnum="b-o" numlevel="1" lineno="773" slineno="5-139" level="2"><display>(b)</display>immediately report to emergency medical services any medical emergency, as <ln numlevel="1" lineno="774" slineno="5-140"/>defined by rule:<subsection ssid="88-null-88" dnum="i-o" numlevel="1" lineno="775" slineno="5-141" level="3"><display>(i)</display>on the premises where the licensee operates<amend anum="0" ea="amend" pairid="4" groupid="2" style="1" owner="admin" level="1" amendtag="both"> </amend>a program;</subsection><subsection ssid="88-null-89" dnum="ii-o" numlevel="1" lineno="776" slineno="5-142" level="3"><display>(ii)</display>involving its clients; or</subsection><subsection ssid="88-null-90" dnum="iii-o" numlevel="1" lineno="777" slineno="5-143" level="3"><display>(iii)</display>involving a staff member while the staff member is on duty; and</subsection></subsection><subsection ssid="88-null-91" dnum="c-o" numlevel="1" lineno="778" slineno="5-144" level="2"><display>(c)</display>immediately report other emergencies that occur on the premises where the licensee <ln numlevel="1" lineno="779" slineno="5-145"/>operates its human services program to the appropriate emergency services agency.</subsection></subsection></section></bsec><bsec buid="90" num="58-17b-309.7" type="amend" src="code" uid="C58-17b-S309.7_2026050620260506" sort="58 17b03090720260506" numlevel="1" lineno="780" slineno="6-1" sn="6"><section number="58-17b-309.7" numlevel="1" lineno="781" slineno="6-2" type="amend"><secline lineno="780">Section 6. Section <bold>58-17b-309.7</bold> is amended to read:</secline><catline lineno="781"><bold>58-17b-309.7<parens/>. Opioid treatment program -- Mobile medication assisted <ln numlevel="1" lineno="782" slineno="6-3"/>treatment units.</bold></catline><subsection ssid="90-null-1" dnum="1-o" numlevel="1" lineno="783" slineno="6-4" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="90-null-2" dnum="a-o" numlevel="1" lineno="784" slineno="6-5" level="2"><display>(a)</display>"Covered provider" means an individual who is licensed to engage in:<subsection ssid="90-null-3" dnum="i-o" numlevel="1" lineno="785" slineno="6-6" level="3"><display>(i)</display>the practice of advanced practice registered nursing as defined in Section <xref depth="3" refnumber="58-31b-102"><ln numlevel="1" lineno="786" slineno="6-7"/>58-31b-102</xref>;</subsection><subsection ssid="90-null-4" dnum="ii-o" numlevel="1" lineno="787" slineno="6-8" level="3"><display>(ii)</display>the practice of registered nursing as defined in Section <xref depth="3" refnumber="58-31b-102">58-31b-102</xref>; or</subsection><subsection ssid="90-null-5" dnum="iii-o" numlevel="1" lineno="788" slineno="6-9" level="3"><display>(iii)</display>practice as a physician assistant as defined in Section <xref depth="3" refnumber="58-70a-102">58-70a-102</xref>.</subsection></subsection><subsection ssid="90-null-6" dnum="b-o" numlevel="1" lineno="789" slineno="6-10" level="2"><display>(b)</display>"Mobile unit" means a mobile unit that provides medication, such as buprenorphine, <ln numlevel="1" lineno="790" slineno="6-11"/>methadone, or naltrexone, to treat substance use withdrawal symptoms or a substance <ln numlevel="1" lineno="791" slineno="6-12"/>use disorder.</subsection><subsection ssid="90-null-7" dnum="c-o" numlevel="1" lineno="792" slineno="6-13" level="2"><display>(c)</display>"Opioid treatment program" means a program or practitioner that is:<subsection ssid="90-null-8" dnum="i-o" numlevel="1" lineno="793" slineno="6-14" level="3"><display>(i)</display>engaged in dispensing an opiate medication assisted treatment for opioid use <ln numlevel="1" lineno="794" slineno="6-15"/>disorder;</subsection><subsection ssid="90-null-9" dnum="ii-o" numlevel="1" lineno="795" slineno="6-16" level="3"><display>(ii)</display>registered under 21 U.S.C. Sec. 823(g)(1);</subsection><subsection ssid="90-null-10" dnum="iii-o" numlevel="1" lineno="796" slineno="6-17" level="3"><display>(iii)</display>licensed by the Division of Licensing and Background Checks within the <ln numlevel="1" lineno="797" slineno="6-18"/>Department of Health and Human Services created in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-103">26B-2-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-901"><ln numlevel="1" lineno="798" slineno="6-19"/>26B-2-901</xref></amend>; and</subsection><subsection ssid="90-null-11" dnum="iv-o" numlevel="1" lineno="799" slineno="6-20" level="3"><display>(iv)</display>certified by the federal Substance Abuse and Mental Health Services <ln numlevel="1" lineno="800" slineno="6-21"/>Administration in accordance with 42 C.F.R. 8.11.</subsection></subsection></subsection><subsection ssid="90-null-12" dnum="2-o" numlevel="1" lineno="801" slineno="6-22" level="1"><display>(2)</display>A covered provider may dispense opiate medication assisted treatment at an opioid <ln numlevel="1" lineno="802" slineno="6-23"/>treatment program if the covered provider:<subsection ssid="90-null-13" dnum="a-o" numlevel="1" lineno="803" slineno="6-24" level="2"><display>(a)</display>is operating under the direction of a pharmacist;</subsection><subsection ssid="90-null-14" dnum="b-o" numlevel="1" lineno="804" slineno="6-25" level="2"><display>(b)</display>dispenses the opiate medication assisted treatment under the direction of a <ln numlevel="1" lineno="805" slineno="6-26"/>pharmacist; and</subsection><subsection ssid="90-null-15" dnum="c-o" numlevel="1" lineno="806" slineno="6-27" level="2"><display>(c)</display>acts in accordance with division rules made under Subsection <xref depth="4" refnumber="58-17b-309.7(4)">(4)</xref>.</subsection></subsection><subsection ssid="90-null-16" dnum="3-o" numlevel="1" lineno="807" slineno="6-28" level="1" space="false"><display>(3)</display><subsection ssid="90-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An opioid treatment program may operate one or more mobile units to serve <ln numlevel="1" lineno="808" slineno="6-29"/>individuals without a fixed address and other individuals as appropriate.</subsection><subsection ssid="90-null-18" dnum="b-o" numlevel="1" lineno="809" slineno="6-30" level="2"><display>(b)</display>A mobile unit shall operate as an extension of, and under the registration, license, <ln numlevel="1" lineno="810" slineno="6-31"/>and certification held by, the opioid treatment program.</subsection><subsection ssid="90-null-19" dnum="c-o" numlevel="1" lineno="811" slineno="6-32" level="2"><display>(c)</display>The pharmacist-in-charge who is responsible for directing the operation of the opioid <ln numlevel="1" lineno="812" slineno="6-33"/>treatment program shall determine the number of mobile units that may be operated <ln numlevel="1" lineno="813" slineno="6-34"/>as an extension of the opioid treatment program.</subsection><subsection ssid="90-null-20" dnum="d-o" numlevel="1" lineno="814" slineno="6-35" level="2"><display>(d)</display>A covered provider may dispense prescription medication assisted treatment only:<subsection ssid="90-null-21" dnum="i-o" numlevel="1" lineno="815" slineno="6-36" level="3"><display>(i)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="admin" level="1" deltag="both">pursuant to</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="admin" level="1" amendtag="both" space="true">in accordance with</amend> a valid prescription; and</subsection><subsection ssid="90-null-22" dnum="ii-o" numlevel="1" lineno="816" slineno="6-37" level="3"><display>(ii)</display>in compliance with the requirements described in Subsection <xref refnumber="58-17b-309.7(2)" depth="4">(2)</xref>.</subsection></subsection><subsection ssid="90-null-23" dnum="e-o" numlevel="1" lineno="817" slineno="6-38" level="2"><display>(e)</display>Medication may not be left in a mobile unit during the hours that the mobile unit is <ln numlevel="1" lineno="818" slineno="6-39"/>not in operation.</subsection><subsection ssid="90-null-24" dnum="f-o" numlevel="1" lineno="819" slineno="6-40" level="2"><display>(f)</display>An opioid treatment program that intends to operate a mobile unit shall notify the <ln numlevel="1" lineno="820" slineno="6-41"/>division and board of that intention as soon as possible, but not later than one <ln numlevel="1" lineno="821" slineno="6-42"/>business day before the mobile unit begins operating.</subsection><subsection ssid="90-null-25" dnum="g-o" numlevel="1" lineno="822" slineno="6-43" level="2"><display>(g)</display>An opioid treatment program that intends to discontinue operation of a mobile unit <ln numlevel="1" lineno="823" slineno="6-44"/>shall notify the division and board of that intention as soon as possible, but not later <ln numlevel="1" lineno="824" slineno="6-45"/>than one business day before the mobile unit discontinues operating.</subsection><subsection ssid="90-null-26" dnum="h-o" numlevel="1" lineno="825" slineno="6-46" level="2"><display>(h)</display>The Department of Health and Human Services may make rules, in accordance with <ln numlevel="1" lineno="826" slineno="6-47"/>Title 63G, Chapter 3, Utah Administrative Rulemaking Act, and consistent with this <ln numlevel="1" lineno="827" slineno="6-48"/>section, to establish requirements for the operation of a mobile unit.</subsection></subsection><subsection ssid="90-null-27" dnum="4-o" numlevel="1" lineno="828" slineno="6-49" level="1"><display>(4)</display>The division shall, in consultation with practitioners who work in an opioid treatment <ln numlevel="1" lineno="829" slineno="6-50"/>program, make rules in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="830" slineno="6-51"/>Rulemaking Act, to establish guidelines under which a covered provider may dispense <ln numlevel="1" lineno="831" slineno="6-52"/>opiate medication assisted treatment to a patient in an opioid treatment program under <ln numlevel="1" lineno="832" slineno="6-53"/>this section.</subsection></section></bsec><bsec buid="91" num="80-2-1001" type="amend" src="code" uid="C80-2-S1001_2026050620260506" sort="80 02 10010020260506" numlevel="1" lineno="833" slineno="7-1" sn="7"><section number="80-2-1001" numlevel="1" lineno="834" slineno="7-2" type="amend"><secline lineno="833">Section 7. Section <bold>80-2-1001</bold> is amended to read:</secline><catline lineno="834"><bold>80-2-1001<parens/>. Management Information System -- Contents -- Classification of <ln numlevel="1" lineno="835" slineno="7-3"/>records -- Access.</bold></catline><subsection ssid="91-null-1" dnum="1-o" numlevel="1" lineno="836" slineno="7-4" level="1" placement="noreturn"><display>(1)</display>The division shall develop and implement a Management Information System that <ln numlevel="1" lineno="837" slineno="7-5"/>meets the requirements of this section and the requirements of federal law and regulation.</subsection><subsection ssid="91-null-2" dnum="2-o" numlevel="1" lineno="838" slineno="7-6" level="1"><display>(2)</display>The Management Information System shall:<subsection ssid="91-null-3" dnum="a-o" numlevel="1" lineno="839" slineno="7-7" level="2"><display>(a)</display>contain all key elements of each family's current child and family plan, including:<subsection ssid="91-null-4" dnum="i-o" numlevel="1" lineno="840" slineno="7-8" level="3"><display>(i)</display>the dates and number of times the plan has been administratively or judicially <ln numlevel="1" lineno="841" slineno="7-9"/>reviewed;</subsection><subsection ssid="91-null-5" dnum="ii-o" numlevel="1" lineno="842" slineno="7-10" level="3"><display>(ii)</display>the number of times the parent failed the child and family plan; and</subsection><subsection ssid="91-null-6" dnum="iii-o" numlevel="1" lineno="843" slineno="7-11" level="3"><display>(iii)</display>the exact length of time the child and family plan has been in effect; and</subsection></subsection><subsection ssid="91-null-7" dnum="b-o" numlevel="1" lineno="844" slineno="7-12" level="2"><display>(b)</display>alert child welfare caseworkers regarding deadlines for completion of and <ln numlevel="1" lineno="845" slineno="7-13"/>compliance with policy, including child and family plans.</subsection></subsection><subsection ssid="91-null-8" dnum="3-o" numlevel="1" lineno="846" slineno="7-14" level="1"><display>(3)</display>For a child welfare case, the Management Information System shall provide each child <ln numlevel="1" lineno="847" slineno="7-15"/>welfare caseworker and the Division of Licensing and Background Checks created in <ln numlevel="1" lineno="848" slineno="7-16"/>Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-103">26B-2-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-901">26B-2-901</xref></amend>, exclusively for the purposes of foster parent licensure <ln numlevel="1" lineno="849" slineno="7-17"/>and monitoring, with a complete history of each child in the child welfare caseworker's <ln numlevel="1" lineno="850" slineno="7-18"/>caseload, including:<subsection ssid="91-null-9" dnum="a-o" numlevel="1" lineno="851" slineno="7-19" level="2"><display>(a)</display>a record of all past action taken by the division with regard to the child and the <ln numlevel="1" lineno="852" slineno="7-20"/>child's siblings;</subsection><subsection ssid="91-null-10" dnum="b-o" numlevel="1" lineno="853" slineno="7-21" level="2"><display>(b)</display>the complete case history and all reports and information in the control or keeping of <ln numlevel="1" lineno="854" slineno="7-22"/>the division regarding the child and the child's siblings;</subsection><subsection ssid="91-null-11" dnum="c-o" numlevel="1" lineno="855" slineno="7-23" level="2"><display>(c)</display>the number of times the child has been in the protective custody, temporary custody, <ln numlevel="1" lineno="856" slineno="7-24"/>and custody of the division;</subsection><subsection ssid="91-null-12" dnum="d-o" numlevel="1" lineno="857" slineno="7-25" level="2"><display>(d)</display>the cumulative period of time the child has been in the custody of the division;</subsection><subsection ssid="91-null-13" dnum="e-o" numlevel="1" lineno="858" slineno="7-26" level="2"><display>(e)</display>a record of all reports of abuse or neglect received by the division with regard to the <ln numlevel="1" lineno="859" slineno="7-27"/>child's parent or guardian including:<subsection ssid="91-null-14" dnum="i-o" numlevel="1" lineno="860" slineno="7-28" level="3"><display>(i)</display>for each report, documentation of the:<subsection ssid="91-null-15" dnum="A-o" numlevel="1" lineno="861" slineno="7-29" level="4"><display>(A)</display>latest status; or</subsection><subsection ssid="91-null-16" dnum="B-o" numlevel="1" lineno="862" slineno="7-30" level="4"><display>(B)</display>final outcome or determination; and</subsection></subsection><subsection ssid="91-null-17" dnum="ii-o" numlevel="1" lineno="863" slineno="7-31" level="3"><display>(ii)</display>information that indicates whether each report was found to be:<subsection ssid="91-null-18" dnum="A-o" numlevel="1" lineno="864" slineno="7-32" level="4"><display>(A)</display>supported;</subsection><subsection ssid="91-null-19" dnum="B-o" numlevel="1" lineno="865" slineno="7-33" level="4"><display>(B)</display>unsupported;</subsection><subsection ssid="91-null-20" dnum="C-o" numlevel="1" lineno="866" slineno="7-34" level="4"><display>(C)</display>substantiated;</subsection><subsection ssid="91-null-21" dnum="D-o" numlevel="1" lineno="867" slineno="7-35" level="4"><display>(D)</display>unsubstantiated; or</subsection><subsection ssid="91-null-22" dnum="E-o" numlevel="1" lineno="868" slineno="7-36" level="4"><display>(E)</display>without merit;</subsection></subsection></subsection><subsection ssid="91-null-23" dnum="f-o" numlevel="1" lineno="869" slineno="7-37" level="2"><display>(f)</display>the number of times the child's parent failed any child and family plan; and</subsection><subsection ssid="91-null-24" dnum="g-o" numlevel="1" lineno="870" slineno="7-38" level="2"><display>(g)</display>the number of different child welfare caseworkers who have been assigned to the <ln numlevel="1" lineno="871" slineno="7-39"/>child in the past.</subsection></subsection><subsection ssid="91-null-25" dnum="4-o" numlevel="1" lineno="872" slineno="7-40" level="1"><display>(4)</display>For child protective services cases, the Management Information System shall:<subsection ssid="91-null-26" dnum="a-o" numlevel="1" lineno="873" slineno="7-41" level="2"><display>(a)</display>monitor the compliance of each case with:<subsection ssid="91-null-27" dnum="i-o" numlevel="1" lineno="874" slineno="7-42" level="3"><display>(i)</display>division rule;</subsection><subsection ssid="91-null-28" dnum="ii-o" numlevel="1" lineno="875" slineno="7-43" level="3"><display>(ii)</display>state law; and</subsection><subsection ssid="91-null-29" dnum="iii-o" numlevel="1" lineno="876" slineno="7-44" level="3"><display>(iii)</display>federal law and regulation; and</subsection></subsection><subsection ssid="91-null-30" dnum="b-o" numlevel="1" lineno="877" slineno="7-45" level="2"><display>(b)</display>include the age and date of birth of the alleged perpetrator at the time the abuse or <ln numlevel="1" lineno="878" slineno="7-46"/>neglect is alleged to have occurred, in order to ensure accuracy regarding the <ln numlevel="1" lineno="879" slineno="7-47"/>identification of the alleged perpetrator.</subsection></subsection><subsection ssid="91-null-31" dnum="5-o" numlevel="1" lineno="880" slineno="7-48" level="1"><display>(5)</display>Information or a record contained in the Management Information System is:<subsection ssid="91-null-32" dnum="a-o" numlevel="1" lineno="881" slineno="7-49" level="2"><display>(a)</display>a private, controlled, or protected record under Title 63G, Chapter 2, Government <ln numlevel="1" lineno="882" slineno="7-50"/>Records Access and Management Act; and</subsection><subsection ssid="91-null-33" dnum="b-o" numlevel="1" lineno="883" slineno="7-51" level="2"><display>(b)</display>available only:<subsection ssid="91-null-34" dnum="i-o" numlevel="1" lineno="884" slineno="7-52" level="3"><display>(i)</display>to a person or government entity with statutory authorization under Title 63G, <ln numlevel="1" lineno="885" slineno="7-53"/>Chapter 2, Government Records Access and Management Act, to review the <ln numlevel="1" lineno="886" slineno="7-54"/>information or record;</subsection><subsection ssid="91-null-35" dnum="ii-o" numlevel="1" lineno="887" slineno="7-55" level="3"><display>(ii)</display>to a person who has specific statutory authorization to access the information or <ln numlevel="1" lineno="888" slineno="7-56"/>record for the purpose of assisting the state with state or federal requirements to <ln numlevel="1" lineno="889" slineno="7-57"/>maintain information solely for the purpose of protecting minors and providing <ln numlevel="1" lineno="890" slineno="7-58"/>services to families in need;</subsection><subsection ssid="91-null-36" dnum="iii-o" numlevel="1" lineno="891" slineno="7-59" level="3"><display>(iii)</display>to the extent required by Title IV(b) or IV(e) of the Social Security Act:<subsection ssid="91-null-37" dnum="A-o" numlevel="1" lineno="892" slineno="7-60" level="4"><display>(A)</display>to comply with abuse and neglect registry checks requested by other states; or</subsection><subsection ssid="91-null-38" dnum="B-o" numlevel="1" lineno="893" slineno="7-61" level="4"><display>(B)</display>to the United States Department of Health and Human Services for purposes <ln numlevel="1" lineno="894" slineno="7-62"/>of maintaining an electronic national registry of supported or substantiated <ln numlevel="1" lineno="895" slineno="7-63"/>cases of abuse and neglect;</subsection></subsection><subsection ssid="91-null-39" dnum="iv-o" numlevel="1" lineno="896" slineno="7-64" level="3"><display>(iv)</display>to the department, upon the approval of the executive director of the department, <ln numlevel="1" lineno="897" slineno="7-65"/>on a need-to-know basis;</subsection><subsection ssid="91-null-40" dnum="v-o" numlevel="1" lineno="898" slineno="7-66" level="3"><display>(v)</display>as provided in Subsection <xref depth="4" refnumber="80-2-1001(6)">(6)</xref> or Section <xref depth="3" refnumber="80-2-1002">80-2-1002</xref>; or</subsection><subsection ssid="91-null-41" dnum="vi-o" numlevel="1" lineno="899" slineno="7-67" level="3"><display>(vi)</display>to a citizen review panel for the purpose of fulfilling the panel's duties as <ln numlevel="1" lineno="900" slineno="7-68"/>described in Section <xref depth="3" refnumber="80-2-1101">80-2-1101</xref>.</subsection></subsection></subsection><subsection ssid="91-null-42" dnum="6-o" numlevel="1" lineno="901" slineno="7-69" level="1" space="false"><display>(6)</display><subsection ssid="91-null-43" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division may allow a division contract provider, court clerk designated by the <ln numlevel="1" lineno="902" slineno="7-70"/>Administrative Office of the Courts, the Office of Guardian Ad Litem, or Indian tribe <ln numlevel="1" lineno="903" slineno="7-71"/>to have limited access to the Management Information System.</subsection><subsection ssid="91-null-44" dnum="b-o" numlevel="1" lineno="904" slineno="7-72" level="2"><display>(b)</display>A division contract provider or Indian tribe has access only to information about a <ln numlevel="1" lineno="905" slineno="7-73"/>person who is currently receiving services from the specific contract provider or <ln numlevel="1" lineno="906" slineno="7-74"/>Indian tribe.</subsection><subsection ssid="91-null-45" dnum="c-o" numlevel="1" lineno="907" slineno="7-75" level="2"><display>(c)</display>A court clerk may only have access to information necessary to comply with <ln numlevel="1" lineno="908" slineno="7-76"/>Subsection <xref depth="4" refnumber="78B-7-202(2)">78B-7-202(2)</xref>.</subsection><subsection ssid="91-null-46" dnum="d-o" numlevel="1" lineno="909" slineno="7-77" level="2" space="false"><display>(d)</display><subsection ssid="91-null-47" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The Office of Guardian Ad Litem may only access:<subsection ssid="91-null-48" dnum="A-o" numlevel="1" lineno="910" slineno="7-78" level="4" tab="1"><display>(A)</display>the information that is entered into the Management Information System on or <ln numlevel="1" lineno="911" slineno="7-79"/>after July 1, 2004, and relates to a child or family where the Office of Guardian <ln numlevel="1" lineno="912" slineno="7-80"/>Ad Litem is appointed by a court to represent the interests of the child; or</subsection><subsection ssid="91-null-49" dnum="B-o" numlevel="1" lineno="913" slineno="7-81" level="4" tab="1"><display>(B)</display>any abuse or neglect referral about a child or family where the office has been <ln numlevel="1" lineno="914" slineno="7-82"/>appointed by a court to represent the interests of the child, regardless of the <ln numlevel="1" lineno="915" slineno="7-83"/>date that the information is entered into the Management Information System.</subsection></subsection><subsection ssid="91-null-50" dnum="ii-o" numlevel="1" lineno="916" slineno="7-84" level="3"><display>(ii)</display>The division may use the information in the Management Information System to <ln numlevel="1" lineno="917" slineno="7-85"/>screen an individual as described in Subsection <xref depth="4" refnumber="80-2-1002(4)(b)(ii)(a)">80-2-1002(4)(b)(ii)(A)</xref> at the <ln numlevel="1" lineno="918" slineno="7-86"/>request of the Office of Guardian Ad Litem.</subsection></subsection><subsection ssid="91-null-51" dnum="e-o" numlevel="1" lineno="919" slineno="7-87" level="2"><display>(e)</display>A contract provider or designated representative of the Office of Guardian Ad Litem <ln numlevel="1" lineno="920" slineno="7-88"/>or an Indian tribe who requests access to information contained in the Management <ln numlevel="1" lineno="921" slineno="7-89"/>Information System shall:<subsection ssid="91-null-52" dnum="i-o" numlevel="1" lineno="922" slineno="7-90" level="3"><display>(i)</display>take all necessary precautions to safeguard the security of the information <ln numlevel="1" lineno="923" slineno="7-91"/>contained in the Management Information System;</subsection><subsection ssid="91-null-53" dnum="ii-o" numlevel="1" lineno="924" slineno="7-92" level="3"><display>(ii)</display>train its employees regarding:<subsection ssid="91-null-54" dnum="A-o" numlevel="1" lineno="925" slineno="7-93" level="4"><display>(A)</display>requirements for protecting the information contained in the Management <ln numlevel="1" lineno="926" slineno="7-94"/>Information System under this chapter and under Title 63G, Chapter 2, <ln numlevel="1" lineno="927" slineno="7-95"/>Government Records Access and Management Act; and</subsection><subsection ssid="91-null-55" dnum="B-o" numlevel="1" lineno="928" slineno="7-96" level="4"><display>(B)</display>the criminal penalties under Sections <xref depth="3" refnumber="63G-2-801">63G-2-801</xref> and <xref depth="3" refnumber="80-2-1005">80-2-1005</xref> for improper <ln numlevel="1" lineno="929" slineno="7-97"/>release of information; and</subsection></subsection><subsection ssid="91-null-56" dnum="iii-o" numlevel="1" lineno="930" slineno="7-98" level="3"><display>(iii)</display>monitor its employees to ensure that the employees protect the information <ln numlevel="1" lineno="931" slineno="7-99"/>contained in the Management Information System as required by law.</subsection></subsection></subsection><subsection ssid="91-null-57" dnum="7-o" numlevel="1" lineno="932" slineno="7-100" level="1"><display>(7)</display>The division shall take:<subsection ssid="91-null-58" dnum="a-o" numlevel="1" lineno="933" slineno="7-101" level="2"><display>(a)</display>all necessary precautions, including password protection and other appropriate and <ln numlevel="1" lineno="934" slineno="7-102"/>available technological techniques, to prevent unauthorized access to or release of <ln numlevel="1" lineno="935" slineno="7-103"/>information contained in the Management Information System; and</subsection><subsection ssid="91-null-59" dnum="b-o" numlevel="1" lineno="936" slineno="7-104" level="2"><display>(b)</display>reasonable precautions to ensure that the division's contract providers comply with <ln numlevel="1" lineno="937" slineno="7-105"/>Subsection <xref depth="4" refnumber="80-2-1001(6)">(6)</xref>.</subsection></subsection></section></bsec><bsec buid="92" num="80-2-1002" type="amend" src="code" uid="C80-2-S1002_2026050620260506" sort="80 02 10020020260506" numlevel="1" lineno="938" slineno="8-1" sn="8"><section number="80-2-1002" numlevel="1" lineno="939" slineno="8-2" type="amend"><secline lineno="938">Section 8. Section <bold>80-2-1002</bold> is amended to read:</secline><catline lineno="939"><bold>80-2-1002<parens/>. Licensing Information System -- Contents -- Classification of records <ln numlevel="1" lineno="940" slineno="8-3"/>-- Access -- Unlawful release -- Penalty.</bold></catline><subsection ssid="92-null-1" dnum="1-o" numlevel="1" lineno="941" slineno="8-4" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="92-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The division shall maintain a sub-part of the Management Information System as <ln numlevel="1" lineno="942" slineno="8-5"/>the Licensing Information System to be used:<subsection ssid="92-null-3" dnum="i-o" numlevel="1" lineno="943" slineno="8-6" level="3" tab="1"><display>(i)</display>for licensing purposes; or</subsection><subsection ssid="92-null-4" dnum="ii-o" numlevel="1" lineno="944" slineno="8-7" level="3" tab="1"><display>(ii)</display>as otherwise provided by law.</subsection></subsection><subsection ssid="92-null-5" dnum="b-o" numlevel="1" lineno="945" slineno="8-8" level="2"><display>(b)</display>Notwithstanding Subsection <xref depth="4" refnumber="80-2-1002(1)(a)">(1)(a)</xref>, the department's access to information in the <ln numlevel="1" lineno="946" slineno="8-9"/>Management Information System for the licensure and monitoring of a foster parent <ln numlevel="1" lineno="947" slineno="8-10"/>is governed by Sections <xref depth="3" refnumber="80-2-1001">80-2-1001</xref> and <xref depth="3" refnumber="26B-2-121">26B-2-121</xref>.</subsection></subsection><subsection ssid="92-null-6" dnum="2-o" numlevel="1" lineno="948" slineno="8-11" level="1"><display>(2)</display>The Licensing Information System shall include only the following information:<subsection ssid="92-null-7" dnum="a-o" numlevel="1" lineno="949" slineno="8-12" level="2"><display>(a)</display>the name and other identifying information of the alleged perpetrator in a supported <ln numlevel="1" lineno="950" slineno="8-13"/>finding, without identifying the alleged perpetrator as a perpetrator or alleged <ln numlevel="1" lineno="951" slineno="8-14"/>perpetrator;</subsection><subsection ssid="92-null-8" dnum="b-o" numlevel="1" lineno="952" slineno="8-15" level="2"><display>(b)</display>a notation to the effect that an investigation regarding the alleged perpetrator <ln numlevel="1" lineno="953" slineno="8-16"/>described in Subsection <xref depth="4" refnumber="80-2-1002(2)(a)">(2)(a)</xref> is pending;</subsection><subsection ssid="92-null-9" dnum="c-o" numlevel="1" lineno="954" slineno="8-17" level="2"><display>(c)</display>the information described in Subsection <xref depth="4" refnumber="80-2-1002(3)">(3)</xref>;</subsection><subsection ssid="92-null-10" dnum="d-o" numlevel="1" lineno="955" slineno="8-18" level="2"><display>(d)</display>consented-to supported findings by an alleged perpetrator under Subsection <xref depth="4" refnumber="80-2-708(3)(a)(iii)"><ln numlevel="1" lineno="956" slineno="8-19"/>80-2-708(3)(a)(iii)</xref>;</subsection><subsection ssid="92-null-11" dnum="e-o" numlevel="1" lineno="957" slineno="8-20" level="2"><display>(e)</display>a finding from the juvenile court under Section <xref depth="3" refnumber="80-3-404">80-3-404</xref> or <xref depth="3" refnumber="80-3-504">80-3-504</xref>; and</subsection><subsection ssid="92-null-12" dnum="f-o" numlevel="1" lineno="958" slineno="8-21" level="2"><display>(f)</display>the information in the licensing part of the division's Management Information <ln numlevel="1" lineno="959" slineno="8-22"/>System as of May 6, 2002.</subsection></subsection><subsection ssid="92-null-13" dnum="3-o" numlevel="1" lineno="960" slineno="8-23" level="1"><display>(3)</display>Subject to Section <xref depth="3" refnumber="80-2-1003">80-2-1003</xref>, upon receipt of a finding from the juvenile court under <ln numlevel="1" lineno="961" slineno="8-24"/>Section <xref depth="3" refnumber="80-3-404">80-3-404</xref> or <xref depth="3" refnumber="80-3-504">80-3-504</xref>, the division shall:<subsection ssid="92-null-14" dnum="a-o" numlevel="1" lineno="962" slineno="8-25" level="2"><display>(a)</display>promptly amend the Licensing Information System to include the finding; and</subsection><subsection ssid="92-null-15" dnum="b-o" numlevel="1" lineno="963" slineno="8-26" level="2"><display>(b)</display>enter the finding in the Management Information System.</subsection></subsection><subsection ssid="92-null-16" dnum="4-o" numlevel="1" lineno="964" slineno="8-27" level="1"><display>(4)</display>Information or a record contained in the Licensing Information System is:<subsection ssid="92-null-17" dnum="a-o" numlevel="1" lineno="965" slineno="8-28" level="2"><display>(a)</display>a protected record under Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="966" slineno="8-29"/>Management Act; and</subsection><subsection ssid="92-null-18" dnum="b-o" numlevel="1" lineno="967" slineno="8-30" level="2"><display>(b)</display>notwithstanding Title 63G, Chapter 2, Government Records Access and <ln numlevel="1" lineno="968" slineno="8-31"/>Management Act, accessible only:<subsection ssid="92-null-19" dnum="i-o" numlevel="1" lineno="969" slineno="8-32" level="3"><display>(i)</display>to the Division of Licensing and Background Checks created in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-103"><ln numlevel="1" lineno="970" slineno="8-33"/>26B-2-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-901">26B-2-901</xref></amend>:<subsection ssid="92-null-20" dnum="A-o" numlevel="1" lineno="971" slineno="8-34" level="4"><display>(A)</display>for licensing purposes; or</subsection><subsection ssid="92-null-21" dnum="B-o" numlevel="1" lineno="972" slineno="8-35" level="4"><display>(B)</display>as otherwise specifically provided for by law;</subsection></subsection><subsection ssid="92-null-22" dnum="ii-o" numlevel="1" lineno="973" slineno="8-36" level="3"><display>(ii)</display>to the division to:<subsection ssid="92-null-23" dnum="A-o" numlevel="1" lineno="974" slineno="8-37" level="4"><display>(A)</display>screen an individual at the request of the Office of Guardian Ad Litem at the <ln numlevel="1" lineno="975" slineno="8-38"/>time the individual seeks a paid or voluntary position with the Office of <ln numlevel="1" lineno="976" slineno="8-39"/>Guardian Ad Litem and annually throughout the time that the individual <ln numlevel="1" lineno="977" slineno="8-40"/>remains with the Office of Guardian Ad Litem; and</subsection><subsection ssid="92-null-24" dnum="B-o" numlevel="1" lineno="978" slineno="8-41" level="4"><display>(B)</display>respond to a request for information from an individual whose name is listed <ln numlevel="1" lineno="979" slineno="8-42"/>in the Licensing Information System;</subsection></subsection><subsection ssid="92-null-25" dnum="iii-o" numlevel="1" lineno="980" slineno="8-43" level="3"><display>(iii)</display>to a person designated by the Department of Health and Human Services, only <ln numlevel="1" lineno="981" slineno="8-44"/>for the following purposes:<subsection ssid="92-null-26" dnum="A-o" numlevel="1" lineno="982" slineno="8-45" level="4"><display>(A)</display>licensing a child care program or provider; or</subsection><subsection ssid="92-null-27" dnum="B-o" numlevel="1" lineno="983" slineno="8-46" level="4"><display>(B)</display>determining whether an individual associated with a child care facility, <ln numlevel="1" lineno="984" slineno="8-47"/>program, or provider, who is exempt from being licensed or certified by the <ln numlevel="1" lineno="985" slineno="8-48"/>Department of Health and Human Services under Title 26B, Chapter 2, Part 4, <ln numlevel="1" lineno="986" slineno="8-49"/>Child Care Licensing, has a supported finding of a severe type of child abuse <ln numlevel="1" lineno="987" slineno="8-50"/>or neglect; </subsection></subsection><subsection ssid="92-null-28" dnum="iv-o" numlevel="1" lineno="988" slineno="8-51" level="3"><display>(iv)</display>to a person designated by the Department of Workforce Services and approved <ln numlevel="1" lineno="989" slineno="8-52"/>by the Department of Health and Human Services for the purpose of qualifying a <ln numlevel="1" lineno="990" slineno="8-53"/>child care provider under Section <xref depth="3" refnumber="35A-3-310.5">35A-3-310.5</xref>;</subsection><subsection ssid="92-null-29" dnum="v-o" numlevel="1" lineno="991" slineno="8-54" level="3"><display>(v)</display>to the Bureau of Emergency Medical Services, within the Department of Public <ln numlevel="1" lineno="992" slineno="8-55"/>Safety, in determining whether an individual who is seeking an emergency <ln numlevel="1" lineno="993" slineno="8-56"/>medical services license has a supported finding of a severe type of child abuse or <ln numlevel="1" lineno="994" slineno="8-57"/>neglect;</subsection><subsection ssid="92-null-30" dnum="vi-o" numlevel="1" lineno="995" slineno="8-58" level="3"><display>(vi)</display>as provided in Section <xref depth="3" refnumber="26B-2-121">26B-2-121</xref>; or</subsection><subsection ssid="92-null-31" dnum="vii-o" numlevel="1" lineno="996" slineno="8-59" level="3"><display>(vii)</display>to the department or another person, as provided in this chapter.</subsection></subsection></subsection><subsection ssid="92-null-32" dnum="5-o" numlevel="1" lineno="997" slineno="8-60" level="1"><display>(5)</display>A person designated by the Department of Health and Human Services, the Department <ln numlevel="1" lineno="998" slineno="8-61"/>of Workforce Services, or the Bureau of Emergency Medical Services under Subsection <xref depth="4" refnumber="80-2-1002(4)"><ln numlevel="1" lineno="999" slineno="8-62"/>(4)</xref> shall adopt measures to:<subsection ssid="92-null-33" dnum="a-o" numlevel="1" lineno="1000" slineno="8-63" level="2"><display>(a)</display>protect the security of the Licensing Information System; and</subsection><subsection ssid="92-null-34" dnum="b-o" numlevel="1" lineno="1001" slineno="8-64" level="2"><display>(b)</display>strictly limit access to the Licensing Information System to persons allowed access <ln numlevel="1" lineno="1002" slineno="8-65"/>by statute.</subsection></subsection><subsection ssid="92-null-35" dnum="6-o" numlevel="1" lineno="1003" slineno="8-66" level="1"><display>(6)</display>The department shall approve a person allowed access by statute to information or a <ln numlevel="1" lineno="1004" slineno="8-67"/>record contained in the Licensing Information System and provide training to the person <ln numlevel="1" lineno="1005" slineno="8-68"/>with respect to:<subsection ssid="92-null-36" dnum="a-o" numlevel="1" lineno="1006" slineno="8-69" level="2"><display>(a)</display>accessing the Licensing Information System;</subsection><subsection ssid="92-null-37" dnum="b-o" numlevel="1" lineno="1007" slineno="8-70" level="2"><display>(b)</display>maintaining strict security; and</subsection><subsection ssid="92-null-38" dnum="c-o" numlevel="1" lineno="1008" slineno="8-71" level="2"><display>(c)</display>the criminal provisions of Sections <xref depth="3" refnumber="63G-2-801">63G-2-801</xref> and <xref depth="3" refnumber="80-2-1005">80-2-1005</xref> pertaining to the <ln numlevel="1" lineno="1009" slineno="8-72"/>improper release of information.</subsection></subsection><subsection ssid="92-null-39" dnum="7-o" numlevel="1" lineno="1010" slineno="8-73" level="1" space="false"><display>(7)</display><subsection ssid="92-null-40" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as authorized by this chapter, a person may not request another person to <ln numlevel="1" lineno="1011" slineno="8-74"/>obtain or release any other information in the Licensing Information System to screen <ln numlevel="1" lineno="1012" slineno="8-75"/>for potential perpetrators of abuse or neglect.</subsection><subsection ssid="92-null-41" dnum="b-o" numlevel="1" lineno="1013" slineno="8-76" level="2"><display>(b)</display>A person who requests information knowing that the request is a violation of this <ln numlevel="1" lineno="1014" slineno="8-77"/>Subsection <xref depth="4" refnumber="80-2-1002(7)">(7)</xref> is subject to the criminal penalties described in Sections <xref depth="3" refnumber="63G-2-801">63G-2-801</xref> <ln numlevel="1" lineno="1015" slineno="8-78"/>and <xref depth="3" refnumber="80-2-1005">80-2-1005</xref>.</subsection></subsection></section></bsec><bsec buid="93" num="81-14-307" type="amend" src="code" uid="C81-14-S307_2026050620260506" sort="81 14 03070020260506" numlevel="1" lineno="1016" slineno="9-1" sn="9"><section number="81-14-307" numlevel="1" lineno="1017" slineno="9-2" type="amend"><secline lineno="1016">Section 9. Section <bold>81-14-307</bold> is amended to read:</secline><catline lineno="1017"><bold>81-14-307<parens/>. Child-placing agency compliance.</bold></catline><subsection ssid="93-null-1" dnum="1-o" numlevel="1" lineno="1018" slineno="9-3" level="1" placement="noreturn"><display>(1)</display>The Division of Licensing and Background Checks, created in Section <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both"><xref depth="3" refnumber="26B-2-103">26B-2-103</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true"><xref depth="3" refnumber="26B-2-901"><ln numlevel="1" lineno="1019" slineno="9-4"/>26B-2-901</xref></amend>, may investigate an allegation that a child-placing agency has failed to <ln numlevel="1" lineno="1020" slineno="9-5"/>comply with this part and commence an action for injunctive or other relief or initiate <ln numlevel="1" lineno="1021" slineno="9-6"/>administrative proceedings against the child-placing agency to enforce this part.</subsection><subsection ssid="93-null-2" dnum="2-o" numlevel="1" lineno="1022" slineno="9-7" level="1" space="false"><display>(2)</display><subsection ssid="93-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The Office of Licensing may initiate a proceeding to determine whether a <ln numlevel="1" lineno="1023" slineno="9-8"/>child-placing agency has failed to comply with this part.</subsection><subsection ssid="93-null-4" dnum="b-o" numlevel="1" lineno="1024" slineno="9-9" level="2"><display>(b)</display>If the Office of Licensing finds that the child-placing agency has failed to comply, <ln numlevel="1" lineno="1025" slineno="9-10"/>the Office of Licensing may suspend or revoke the child-placing agency's license or <ln numlevel="1" lineno="1026" slineno="9-11"/>take other action permitted by law of the state.</subsection></subsection></section></bsec><bsec buid="94" num="81-14-308" type="amend" src="code" uid="C81-14-S308_2026050620260506" sort="81 14 03080020260506" numlevel="1" lineno="1027" slineno="10-1" sn="10"><section number="81-14-308" numlevel="1" lineno="1028" slineno="10-2" type="amend"><secline lineno="1027">Section 10.
