lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This resolution urges Congress to eliminate marriage penalties in federal law.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This resolution:<hl numlevel="1" lineno="8" slineno="0-8" level="1">recognizes the role of marriage in promoting an optimal environment for children and <ln numlevel="1" lineno="9" slineno="0-9"/>helping to ensure economic mobility and well-being;</hl><hl numlevel="1" lineno="10" slineno="0-10" level="1">discusses the extent to which federal tax policies and assistance programs create marriage <ln numlevel="1" lineno="11" slineno="0-11"/>penalties and impact Utah's tax policies and assistance programs as a result; and</hl><hl numlevel="1" lineno="12" slineno="0-12" level="1">urges Congress to pass legislation eliminating all marriage penalties, both direct and <ln numlevel="1" lineno="13" slineno="0-13"/>indirect, that are embedded within federal tax policies and assistance programs.</hl></hp><moni numlevel="1" lineno="14" slineno="0-14" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="15">None</moniNone><oc numlevel="1" lineno="16" slineno="0-16">Other Special Clauses:</oc><ocNone lineno="17">None</ocNone></lt><enacthead lineno="18"/><enact numlevel="1" lineno="19" slineno="0-19">Be it resolved by the Legislature of the state of Utah:</enact><bdy><bsec buid="1" type="enact" src="reso" uid="RESO" sort="00000R" numlevel="1" lineno="20" slineno="1-1" sn="1"><section type="enact" display="false" src="reso"><amend anum="0" ea="amend" pairid="1" groupid="1" style="X" owner="admin" level="1" amendtag="start">WHEREAS, social science evidence shows a strong correlation between stable and healthy <ln numlevel="1" lineno="21" slineno="1-2"/>marriage and multiple positive life outcomes for adults;<eol numlevel="1" lineno="22" slineno="1-3" display="tab"/>WHEREAS, a stable and healthy marriage is the optimal environment for rearing thriving <ln numlevel="1" lineno="23" slineno="1-4"/>children and promoting greater intergenerational economic mobility;<eol numlevel="1" lineno="24" slineno="1-5" display="tab"/>WHEREAS, stable and healthy marriages provide important benefits that strengthen <ln numlevel="1" lineno="25" slineno="1-6"/>neighborhoods, communities, and nations;<eol numlevel="1" lineno="26" slineno="1-7" display="tab"/>WHEREAS, data from the U.S. Census Bureau indicates that marriage rates in the United <ln numlevel="1" lineno="27" slineno="1-8"/>States have significantly dropped from roughly 71% of all households in 1970 to about 47% of <ln numlevel="1" lineno="28" slineno="1-9"/>all households in 2022;<eol numlevel="1" lineno="29" slineno="1-10" display="tab"/>WHEREAS, marriage rates in the United States are expected to decline even further in the <ln numlevel="1" lineno="30" slineno="1-11"/>future, with recent studies projecting that one in three of America's young adults will not marry <ln numlevel="1" lineno="31" slineno="1-12"/>by age 45 and may never marry;<eol numlevel="1" lineno="32" slineno="1-13" display="tab"/>WHEREAS, research shows that federal tax policies and assistance programs can create <ln numlevel="1" lineno="33" slineno="1-14"/>financial disincentives, both directly and indirectly, for couples to marry or form a stable <ln numlevel="1" lineno="34" slineno="1-15"/>two-parent home in which to rear their children, otherwise known as marriage penalties;<eol numlevel="1" lineno="35" slineno="1-16" display="tab"/>WHEREAS, marriage penalties or disincentive effects can arise within state-administered <ln numlevel="1" lineno="36" slineno="1-17"/>tax policies and assistance programs, including Utah's, solely because the state policies and <ln numlevel="1" lineno="37" slineno="1-18"/>programs are aligned with federal policies and programs that contain marriage penalties;<eol numlevel="1" lineno="38" slineno="1-19" display="tab"/>WHEREAS, in a 2015 study, 31% of the participants surveyed knew of people who chose <ln numlevel="1" lineno="39" slineno="1-20"/>not to marry due to concerns about the loss of safety net benefits, followed by a more recent <ln numlevel="1" lineno="40" slineno="1-21"/>study in which roughly 10% of those receiving such benefits explicitly stating they did not <ln numlevel="1" lineno="41" slineno="1-22"/>marry to avoid losing such assistance;<eol numlevel="1" lineno="42" slineno="1-23" display="tab"/>WHEREAS, another study from 2022 estimated that without marriage penalties in both the <ln numlevel="1" lineno="43" slineno="1-24"/>tax code and assistance programs, an additional 13.7% of low-income single mothers would <ln numlevel="1" lineno="44" slineno="1-25"/>choose to marry each year and an additional 7.5% would be married by age 35;<eol numlevel="1" lineno="45" slineno="1-26" display="tab"/>WHEREAS, research suggests that 97% of young adults who follow the success sequence, <ln numlevel="1" lineno="46" slineno="1-27"/>which applies to individuals who attain at least a high school education, work full-time, and <ln numlevel="1" lineno="47" slineno="1-28"/>marry before having children, will not experience poverty by the time they reach their prime <ln numlevel="1" lineno="48" slineno="1-29"/>adult years;<eol numlevel="1" lineno="49" slineno="1-30" display="tab"/>WHEREAS, eliminating marriage penalties from federal tax policies and assistance <ln numlevel="1" lineno="50" slineno="1-31"/>programs would promote equality for parents and families, as parents and families will receive <ln numlevel="1" lineno="51" slineno="1-32"/>equal treatment for critical tax relief and government assistance programs regardless of <ln numlevel="1" lineno="52" slineno="1-33"/>household composition or status;<eol numlevel="1" lineno="53" slineno="1-34" display="tab"/>WHEREAS, eliminating marriage penalties at the federal level would automatically <ln numlevel="1" lineno="54" slineno="1-35"/>eliminate marriage penalties from the many state-administered tax policies and programs that <ln numlevel="1" lineno="55" slineno="1-36"/>are aligned with federal law, which include many of Utah's tax policies and assistance <ln numlevel="1" lineno="56" slineno="1-37"/>programs; and<eol numlevel="1" lineno="57" slineno="1-38" display="tab"/>WHEREAS, eliminating marriage penalties from federal tax policies and assistance <ln numlevel="1" lineno="58" slineno="1-39"/>programs would eliminate a perverse public policy obstacle on the path to prosperity and <ln numlevel="1" lineno="59" slineno="1-40"/>happiness for Americas families and children:<eol numlevel="1" lineno="60" slineno="1-41" display="tab"/>NOW, THEREFORE, BE IT RESOLVED that the Legislature of the state of Utah urges <ln numlevel="1" lineno="61" slineno="1-42"/>Congress to pass legislation eliminating all marriage penalties, both direct and indirect, that are <ln numlevel="1" lineno="62" slineno="1-43"/>embedded within federal tax policies and assistance programs by:</amend><subsection ssid="1-1" dnum="_-o:1-e" numlevel="1" lineno="63" slineno="1-44" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1000" style="X" owner="e" level="1">(1)</amend></display><amend anum="0" ea="amend" pairid="2" groupid="2" style="X" owner="admin" level="1" amendtag="end">modifying income caps and benefit levels in a manner that ensures married individuals <ln numlevel="1" lineno="64" slineno="1-45"/>do not face financial disincentives in comparison to non-married individuals;</amend></subsection><subsection ssid="1-2" dnum="_-o:2-e" numlevel="1" lineno="65" slineno="1-46" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1001" style="X" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="7" style="X" owner="admin" level="1" amendtag="end">making income thresholds exactly proportional for each additional member of the <ln numlevel="1" lineno="66" slineno="1-47"/>household; and</amend></subsection><subsection ssid="1-3" dnum="_-o:3-e" numlevel="1" lineno="67" slineno="1-48" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1002" style="X" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="X" owner="admin" level="1" amendtag="end">phasing out the head of household status while adjusting other tax credits, including the <ln numlevel="1" lineno="68" slineno="1-49"/>child tax credit, to offset any negative impacts on single parents.<eol numlevel="1" lineno="69" slineno="1-50" display="tab"/>BE IT FURTHER RESOLVED that that a copy of this joint resolution be sent to the <ln numlevel="1" lineno="70" slineno="1-51"/>Majority and Minority Leader of the United States Senate, the Speaker and Minority <ln numlevel="1" lineno="71" slineno="1-52"/>Leader of the United States House of Representatives, and the members of Utah's <ln
