lineno="40" slineno="1-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1001" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="194" groupid="153" style="1" owner="admin" level="1" amendtag="end">student participation is measured by physical or virtual pairid="204" groupid="161" style="1" owner="admin" level="1" amendtag="end">a student receives direct teacher interaction and instruction for the course or program <ln numlevel="1" lineno="43" slineno="1-8"/>the student is enrolled in.</amend></subsection></subsection><subsection ssid="18-null-67" dnum="1-o:2-e" numlevel="1" lineno="44" slineno="1-9" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1003" style="2" owner="o" level="1" deltag="both">(1)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="both" space="true">(2)</amend></display>"Basic state-supported school program," "basic program," or "basic school <ln numlevel="1" lineno="45" slineno="1-10"/>program" means public education programs for kindergarten, elementary, and secondary <ln numlevel="1" lineno="46" slineno="1-11"/>school students that are operated and maintained for the amount derived by multiplying <ln numlevel="1" lineno="47" slineno="1-12"/>the number of weighted pupil units for each <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="69" groupid="52" style="2" owner="admin" level="1" deltag="both">school district or charter school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="67" groupid="50" style="1" owner="admin" level="1" amendtag="both" space="true">LEA</amend> by <ln numlevel="1" lineno="48" slineno="1-13"/>the value established each year in the enacted public education budget, except as <ln numlevel="1" lineno="49" slineno="1-14"/>otherwise provided in this chapter.</subsection><subsection ssid="18-null-68" dnum="_-o:3-e" numlevel="1" lineno="50" slineno="1-15" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="5" groupid="4" style="1" owner="admin" level="1" amendtag="end">"Educational services" means providing learning opportunities and services designed to <ln numlevel="1" lineno="51" slineno="1-16"/>support a student to be prepared to succeed and lead by having the knowledge and skills <ln numlevel="1" lineno="52" slineno="1-17"/>to learn, engage civically, and lead meaningful lives through providing:</amend><subsection ssid="18-null-69" dnum="_-o:a-e" numlevel="1" lineno="53" slineno="1-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="8" groupid="6" style="1" owner="admin" level="1" amendtag="end">high quality instruction for each student that includes direct interaction between a <ln numlevel="1" lineno="54" slineno="1-19"/>teacher and students;</amend></subsection><subsection ssid="18-null-70" dnum="_-o:b-e" numlevel="1" lineno="55" slineno="1-20" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="11" groupid="8" style="1" owner="admin" level="1" amendtag="end">personalized learning supports for each student; and</amend></subsection><subsection ssid="18-null-71" dnum="_-o:c-e" numlevel="1" lineno="56" slineno="1-21" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="102" groupid="80" style="1" owner="admin" level="1" amendtag="end">appropriate instructional delivery methods based on the student's enrollment type as <ln numlevel="1" lineno="57" slineno="1-22"/>defined in this section.</amend></subsection></subsection><subsection ssid="18-null-72" dnum="_-o:4-e" numlevel="1" lineno="58" slineno="1-23" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1008" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><subsection ssid="18-null-73" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1009" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="109" groupid="85" style="1" owner="admin" level="1" amendtag="end">"Instructional day" means:</amend><subsection ssid="18-null-74" dnum="_-o:i-e" numlevel="1" lineno="59" slineno="1-24" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1010" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="114" groupid="89" style="1" owner="admin" level="1" amendtag="end">for students enrolled in an attendance validated program, a school day on which an <ln numlevel="1" lineno="60" slineno="1-25"/>LEA provides educational services through scheduled periods with direct teacher <ln numlevel="1" lineno="61" slineno="1-26"/>interaction; or</amend></subsection><subsection ssid="18-null-75" dnum="_-o:ii-e" numlevel="1" lineno="62" slineno="1-27" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1011" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="149" groupid="117" style="1" owner="admin" level="1" amendtag="end">for students enrolled in a learner validated program specifically designed for <ln numlevel="1" lineno="63" slineno="1-28"/>competency-based or self-paced learning, any day during which educational <ln numlevel="1" lineno="64" slineno="1-29"/>services are actively provided through the LEA's structured learning delivery <ln numlevel="1" lineno="65" slineno="1-30"/>system.</amend></subsection></subsection><subsection ssid="18-null-76" dnum="_-o:b-e" numlevel="1" lineno="66" slineno="1-31" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1012" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="154" groupid="121" style="1" owner="admin" level="1" amendtag="end">"Instructional day" does not include:</amend><subsection ssid="18-115" dnum="_-o:i-e" numlevel="1" lineno="67" slineno="1-32" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1013" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="248" groupid="199" style="1" owner="admin" level="1" amendtag="end">days where educational services are not actively provided to students; or</amend></subsection><subsection ssid="18-116" dnum="_-o:ii-e" numlevel="1" lineno="68" slineno="1-33" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="252" groupid="202" style="1" owner="admin" level="1" amendtag="end">any day in a program that an LEA designated as learner validated solely to avoid <ln numlevel="1" lineno="69" slineno="1-34"/>providing direct educational services that would otherwise be required for an <ln numlevel="1" lineno="70" slineno="1-35"/>attendance validated program.</amend></subsection></subsection></subsection><subsection ssid="18-null-78" dnum="_-o:5-e" numlevel="1" lineno="71" slineno="1-36" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1015" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="admin" level="1" amendtag="end">"Instructional hours" means:</amend><subsection ssid="18-null-79" dnum="_-o:a-e" numlevel="1" lineno="72" slineno="1-37" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1016" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="129" groupid="101" style="1" owner="admin" level="1" amendtag="end">for students enrolled in an attendance validated program, the hours in an instructional <ln numlevel="1" lineno="73" slineno="1-38"/>day during which an LEA provides educational services through scheduled <ln numlevel="1" lineno="74" slineno="1-39"/>instructional periods; or</amend></subsection><subsection ssid="18-null-80" dnum="_-o:b-e" numlevel="1" lineno="75" slineno="1-40" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="134" groupid="105" style="1" owner="admin" level="1" amendtag="end">for students enrolled in a learner validated program, the equivalent hours of <ln numlevel="1" lineno="76" slineno="1-41"/>educational services made available to students, as measured by the LEA's continuing <ln numlevel="1" lineno="77" slineno="1-42"/>enrollment measurement requirements established in the LEA's written policy.</amend></subsection></subsection><subsection ssid="18-null-81" dnum="2-o:_-e" numlevel="1" lineno="78" slineno="1-43" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1018" style="2" owner="o" level="1" deltag="start">(2)</amend></display><amend anum="0" ea="erase" pairid="219" groupid="171" style="2" owner="admin" level="1" deltag="end">"LEA governing board" means a local school board or charter school governing board.</amend><amendoutend style="2"/></subsection><subsection ssid="18-null-82" dnum="_-o:6-e" numlevel="1" lineno="79" slineno="1-44" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="106" groupid="83" style="1" owner="admin" level="1" amendtag="end">"Learner validated program" means an educational program specifically designed for <ln numlevel="1" lineno="80" slineno="1-45"/>competency-based or self-paced learning where:</amend><subsection ssid="18-null-83" dnum="_-o:a-e" numlevel="1" lineno="81" slineno="1-46" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="164" groupid="129" style="1" owner="admin" level="1" amendtag="end">student participation is measured by demonstrated academic progress and completion <ln numlevel="1" lineno="82" slineno="1-47"/>of learning objectives rather than by attendance at scheduled instructional periods; <ln numlevel="1" lineno="83" slineno="1-48"/>and</amend></subsection><subsection ssid="18-null-84" dnum="_-o:b-e" numlevel="1" lineno="84" slineno="1-49" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="169" groupid="133" style="1" owner="admin" level="1" amendtag="end">the LEA has established a written policy that:</amend><subsection ssid="18-null-85" dnum="_-o:i-e" numlevel="1" lineno="85" slineno="1-50" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="211" ssid="18-null-93" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Minimum School Program" means the state-supported public school <ln numlevel="1" lineno="94" slineno="1-59"/>programs for kindergarten, elementary, and secondary schools as described in this <ln numlevel="1" lineno="95" slineno="1-60"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="236" groupid="188" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)" start="0">(4)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="231" groupid="183" style="1" owner="admin" level="1" amendtag="both" space="true">(7)</amend>.</subsection><subsection ssid="18-null-94" dnum="b-o" numlevel="1" lineno="96" slineno="1-61" level="2"><display>(b)</display>The Minimum School Program established in <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="41" groupid="31" style="2" owner="admin" level="1" deltag="both">school districts and charter schools</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="39" groupid="29" style="1" owner="admin" level="1" amendtag="both" space="true">an <ln numlevel="1" lineno="97" slineno="1-62"/>LEA</amend> shall include the equivalent of a school term of nine months as determined by <ln numlevel="1" lineno="98" slineno="1-63"/>the state board.</subsection><subsection ssid="18-null-95" dnum="c-o" numlevel="1" lineno="99" slineno="1-64" level="2" space="false"><display>(c)</display><subsection ssid="18-null-96" dnum="i-o" level="3" placement="sameline"><display>(i)</display>The state board shall establish the number of <amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="admin" level="1" amendtag="both">instructional </amend>days or equivalent <ln numlevel="1" lineno="100" slineno="1-65"/>instructional hours that school is held for an academic school year.</subsection><subsection ssid="18-null-97" dnum="ii-o" numlevel="1" lineno="101" slineno="1-66" level="3"><display>(ii)</display>Education, enhanced by utilization of technologically enriched delivery systems, <ln numlevel="1" lineno="102" slineno="1-67"/>when approved by an LEA governing board, shall receive full support by the state <ln numlevel="1" lineno="103" slineno="1-68"/>board as it pertains to fulfilling the attendance requirements, excluding time spent <ln numlevel="1" lineno="104" slineno="1-69"/>viewing commercial advertising.</subsection></subsection><subsection ssid="18-null-98" dnum="d-o" numlevel="1" lineno="105" slineno="1-70" level="2" space="false"><display>(d)</display><subsection ssid="18-null-99" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An LEA governing board may reallocate up to 32 instructional hours or four <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="93" groupid="72" style="2" owner="admin" level="1" deltag="both"><ln numlevel="1" lineno="106" slineno="1-71"/>school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="90" groupid="69" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> days established under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="237" groupid="189" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)(c)" start="0">(4)(c)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="232" groupid="184" style="1" owner="admin" level="1" amendtag="both" space="true">(7)(c)</amend> for teacher <ln numlevel="1" lineno="107" slineno="1-72"/>preparation time or teacher professional development.</subsection><subsection ssid="18-null-100" dnum="ii-o" numlevel="1" lineno="108" slineno="1-73" level="3"><display>(ii)</display>A reallocation of instructional hours or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="94" groupid="73" style="2" owner="admin" level="1" deltag="both">school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="91" groupid="70" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> days under <ln numlevel="1" lineno="109" slineno="1-74"/>Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="238" groupid="190" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)(d)(i)" start="0">(4)(d)(i)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="233" groupid="185" style="1" owner="admin" level="1" amendtag="both" space="true">(7)(d)(i)</amend> is subject to the approval of two-thirds of the <ln numlevel="1" lineno="110" slineno="1-75"/>members of an LEA governing board voting in a regularly scheduled meeting:<subsection ssid="18-null-101" dnum="A-o" numlevel="1" lineno="111" slineno="1-76" level="4"><display>(A)</display>at which a quorum of the LEA governing board is present; and</subsection><subsection ssid="18-null-102" dnum="B-o" numlevel="1" lineno="112" slineno="1-77" level="4"><display>(B)</display>held in compliance with <xref depth="1" refnumber="52-4" start="0">Title 52, Chapter 4, Open and Public Meetings Act</xref>.</subsection></subsection><subsection ssid="18-null-103" dnum="iii-o" numlevel="1" lineno="113" slineno="1-78" level="3"><display>(iii)</display>If an LEA governing board reallocates instructional hours or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="95" groupid="74" style="2" owner="admin" level="1" deltag="both">school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="92" groupid="71" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> <ln numlevel="1" lineno="114" slineno="1-79"/>days as provided by this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="239" groupid="191" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)(d)" start="0">(4)(d)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="234" groupid="186" style="1" owner="admin" level="1" amendtag="both" space="true">(7)(d)</amend>, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="42" groupid="32" style="2" owner="admin" level="1" deltag="both">school district or charter <ln numlevel="1" lineno="115" slineno="1-80"/>school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="40" groupid="30" style="1" owner="admin" level="1" amendtag="both" space="true">LEA</amend> shall notify students' parents of the school calendar at least<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="22" groupid="15" style="2" owner="admin" level="1" deltag="both">:</amend><amendoutend style="2"/><subsection ssid="18-null-104" dnum="A-o:_-e" numlevel="1" lineno="116" slineno="1-81" ea="erase" anum="0" owner="admin" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1041" style="2" owner="o" level="1" deltag="both">(A)</amend><amendoutend style="2"/></display><amend anum="0" ea="amend" pairid="260" groupid="208" style="1" owner="admin" level="1" amendtag="both" space="true"> </amend>90 days before the beginning of the school year<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="23" groupid="16" style="2" owner="admin" level="1" deltag="both">; or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="221" groupid="173" style="1" owner="admin" level="1" amendtag="both" space="true">.</amend></subsection><subsection ssid="18-null-105" dnum="B-o:_-e" numlevel="1" lineno="117" slineno="1-82" ea="erase" anum="0" owner="admin" style="2" level="4"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1042" style="2" owner="o" level="1" deltag="start">(B)</amend></display><amend anum="0" ea="erase" pairid="19" groupid="13" style="2" owner="admin" level="1" deltag="end">for the 2021-2022 and 2022-2023 school years, due to circumstances within <ln numlevel="1" lineno="118" slineno="1-83"/>the LEA or a given school due to the COVID-19 pandemic, at least 14 calendar <ln numlevel="1" lineno="119" slineno="1-84"/>days before the reallocated instructional hours or school days.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="18-null-106" dnum="iv-o" numlevel="1" lineno="120" slineno="1-85" level="3"><display>(iv)</display>Instructional hours or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="225" groupid="177" style="2" owner="admin" level="1" deltag="both">school days</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="223" groupid="175" style="1" owner="admin" level="1" amendtag="both" space="true">instructional days</amend> reallocated for teacher <ln numlevel="1" lineno="121" slineno="1-86"/>preparation time or teacher professional development <marker pairid="261">pursuant to</marker> this Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="243" groupid="195" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)(d)" start="0"><ln numlevel="1" lineno="122" slineno="1-87"/>(4)(d)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="242" groupid="194" style="1" owner="admin" level="1" amendtag="both" space="true">(7)(d)</amend> is considered part of a school term referred to in Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="240" groupid="192" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53F-2-102(4)(b)" start="0">(4)(b)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="235" groupid="187" style="1" owner="admin" level="1" amendtag="both" space="true"><ln numlevel="1" lineno="123" slineno="1-88"/>(7)(b)</amend>.</subsection></subsection><subsection ssid="18-null-107" dnum="e-o" numlevel="1" lineno="124" slineno="1-89" level="2"><display>(e)</display>The Minimum School Program includes a program or allocation funded by a line <ln numlevel="1" lineno="125" slineno="1-90"/>item appropriation or other appropriation designated as follows:<subsection ssid="18-null-108" dnum="i-o" numlevel="1" lineno="126" slineno="1-91" level="3"><display>(i)</display>Basic School Program;</subsection><subsection ssid="18-null-109" dnum="ii-o" numlevel="1" lineno="127" slineno="1-92" level="3"><display>(ii)</display>Related to Basic Programs;</subsection><subsection ssid="18-null-110" dnum="iii-o" numlevel="1" lineno="128" slineno="1-93" level="3"><display>(iii)</display>Voted and Board Levy Programs; or</subsection><subsection ssid="18-null-111" dnum="iv-o" numlevel="1" lineno="129" slineno="1-94" level="3"><display>(iv)</display>Minimum School Program.</subsection></subsection></subsection><subsection ssid="18-117" dnum="_-o:8-e" numlevel="1" lineno="130" slineno="1-95" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="e" level="1" amendtag="start">(8)</amend></display><amend anum="0" ea="amend" pairid="256" lineno="133" slineno="1-98"/>the costs of a program on a uniform basis for each <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="72" groupid="55" style="2" owner="admin" level="1" deltag="both">school district or charter school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="68" groupid="51" style="1" owner="admin" level="1" amendtag="both" and</amend></subsection><subsection ssid="1-58" dnum="_-o:b-e" numlevel="1" lineno="152" slineno="2-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1060" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="36" groupid="25" style="1" owner="admin" level="1" amendtag="end">has been absent for at least 10% of days of instruction, whether the absence was <ln numlevel="1" lineno="153" slineno="2-20"/>excused or not excused.</amend></subsection></subsection><subsection ssid="1-null-4" dnum="2-o:4-e" numlevel="1" lineno="154" slineno="2-21" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1061" style="2" owner="o" level="1" deltag="both">(2)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1062" style="1" owner="e" level="1" amendtag="both" space="true">(4)</amend></display>"Educational neglect" means the same as that term is defined in Section <xref depth="3" refnumber="80-1-102">80-1-102</xref>.</subsection><subsection ssid="1-59" dnum="_-o:5-e" numlevel="1" lineno="155" slineno="2-22" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1062" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="66" groupid="47" style="1" owner="admin" level="1" amendtag="end">"Educational services" means the same as that term is defined in Section <xref depth="3" refnumber="53F-2-102">53F-2-102</xref>.</amend></subsection><subsection ssid="1-null-5" dnum="3-o:6-e" numlevel="1" lineno="156" slineno="2-23" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1063" style="2" owner="o" level="1" deltag="both">(3)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1064" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display><subsection ssid="1-null-6" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Home-based microschool" means an individual or association of individuals <ln numlevel="1" lineno="157" slineno="2-24"/>that:<subsection ssid="1-null-7" dnum="i-o" numlevel="1" lineno="158" slineno="2-25" level="3" tab="1"><display>(i)</display>registers as a business entity in accordance with state and local laws; or</subsection><subsection ssid="1-null-28" dnum="b-o" numlevel="1" lineno="189" slineno="2-56" level="2"><display>(b)</display>should be enrolled, if the school-age child is not enrolled in school.</subsection></subsection><subsection ssid="1-null-29" dnum="10-o:15-e" numlevel="1" lineno="190" slineno="2-57" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1089" style="2" owner="o" level="1" deltag="both">(10)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1090" style="1" owner="e" level="1" amendtag="both" space="true">(15)</amend></display>"School-age child" means a minor who:<subsection ssid="1-null-30" dnum="a-o" numlevel="1" lineno="191" slineno="2-58" level="2"><display>(a)</display>is at least six years old but younger than 18 years old; or</subsection><subsection ssid="1-null-35" dnum="ii-o" numlevel="1" lineno="199" slineno="2-66" level="3" tab="1"><display>(ii)</display>if the school-age child is enrolled in a learner verified program, as that term is <ln numlevel="1" lineno="200" slineno="2-67"/>defined by the state board, the relevant amount of time under the LEA's policy <ln numlevel="1" lineno="201" slineno="2-68"/>regarding the LEA's continuing enrollment measure as it relates to truancy.</subsection></subsection><subsection ssid="1-null-36" dnum="b-o" numlevel="1" lineno="202" slineno="2-69" level="2"><display>(b)</display>A school-age child may not be considered truant under this part more than one time <ln numlevel="1" lineno="203" slineno="2-70"/>during one day.</subsection></subsection><subsection ssid="1-null-37" dnum="12-o:18-e" numlevel="1" lineno="204" slineno="2-71" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1098" style="2" owner="o" level="1" deltag="both">(12)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1099" style="1" owner="e" level="1" amendtag="both" space="true">(18)</amend></display>"Truant minor" means a school-age child who:<subsection ssid="1-null-38" dnum="a-o" numlevel="1" lineno="205" slineno="2-72" level="2"><display>(a)</display>is subject to the requirements of Section <xref depth="3" refnumber="53G-6-202">53G-6-202</xref> or <xref depth="3" refnumber="53G-6-203">53G-6-203</xref>; and</subsection><subsection ssid="1-null-39" dnum="b-o" numlevel="1" lineno="206" slineno="2-73" level="2"><display>(b)</display>is truant.</subsection></subsection><subsection ssid="1-null-40" dnum="13-o:19-e" numlevel="1" lineno="207" slineno="2-74" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1101" style="2" owner="o" level="1" deltag="both">(13)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1102" style="1" owner="e" level="1" amendtag="both" space="true">(19)</amend></display><subsection ssid="1-null-41" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Valid excuse" means:<subsection ssid="1-null-42" dnum="i-o" numlevel="1" lineno="208" slineno="2-75" level="3" tab="1"><display>(i)</display>an illness, which may be either mental or physical, regardless of whether the <ln numlevel="1" lineno="209" slineno="2-76"/>school-age child or parent provides documentation from a medical professional;</subsection><subsection ssid="1-null-43" dnum="ii-o" numlevel="1" lineno="210" slineno="2-77" level="3" tab="1"><display>(ii)</display>mental or behavioral health of the school-age child;</subsection><subsection ssid="1-null-44" dnum="iii-o" numlevel="1" lineno="211" slineno="2-78" level="3" tab="1"><display>(iii)</display>a family death;</subsection><subsection ssid="1-null-45" dnum="iv-o" numlevel="1" lineno="212" slineno="2-79" level="3" tab="1"><display>(iv)</display>an approved school activity;</subsection><subsection ssid="1-null-46" dnum="v-o" numlevel="1" lineno="213" slineno="2-80" level="3" tab="1"><display>(v)</display>an absence permitted by a school-age child's:<subsection ssid="1-null-47" dnum="A-o" numlevel="1" lineno="214" slineno="2-81" level="4"><display>(A)</display>individualized education program; or</subsection><subsection ssid="1-null-48" dnum="B-o" numlevel="1" lineno="215" slineno="2-82" level="4"><display>(B)</display>Section 504 accommodation plan;</subsection></subsection><subsection ssid="1-null-49" dnum="vi-o" numlevel="1" lineno="216" slineno="2-83" level="3" tab="1"><display>(vi)</display>competition in a rodeo sanctioned by an international, non-profit organization <ln numlevel="1" lineno="217" slineno="2-84"/>dedicated to the development of sportsmanship, horsemanship, and character in <ln numlevel="1" lineno="218" slineno="2-85"/>youth through the sport of rodeo;</subsection><subsection ssid="1-null-50" dnum="vii-o" numlevel="1" lineno="219" slineno="2-86" level="3" tab="1"><display>(vii)</display>an absence permitted in accordance with Subsection <xref depth="4" refnumber="53G-6-803(5)">53G-6-803(5)</xref>; or</subsection><subsection ssid="1-null-51" dnum="viii-o" numlevel="1" lineno="220" slineno="2-87" level="3" tab="1"><display>(viii)</display>any other excuse established as valid by a local school board, charter school <ln numlevel="1" lineno="221" slineno="2-88"/>governing board, or school district.</subsection></subsection><subsection ssid="1-null-52" dnum="b-o" numlevel="1" lineno="222" slineno="2-89" level="2"><display>(b)</display>"Valid excuse" does not mean a parent acknowledgment of an absence for a reason <ln numlevel="1" lineno="223" slineno="2-90"/>other than a reason described in Subsections <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="122" groupid="87" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53G-6-201(13)(a)(i)">(13)(a)(i)</xref> through <xref depth="4" refnumber="53G-6-201(vii)">(vii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="120" groupid="85" style="1" owner="admin" level="1" amendtag="both" space="true">(19)(a)(i) <ln numlevel="1" lineno="224" slineno="2-91"/>through (vii)</amend>, unless specifically permitted by the local school board, charter school <ln numlevel="1" lineno="225" slineno="2-92"/>governing board, or school district under Subsection <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="126" groupid="91" style="2" owner="admin" level="1" deltag="both"><xref depth="4" refnumber="53G-6-201(13)(a)(viii)">(13)(a)(viii)</xref></amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="121" groupid="86" style="1" owner="admin" level="1" amendtag="both" space="true">(19)(a)(viii)</amend>.</subsection></subsection></section></bsec><bsec buid="2" num="53G-6-202" type="amend" src="code" uid="C53G-6-S202_2026070120260701" sort="53G06 02020020260701" numlevel="1" lineno="226" slineno="3-1" sn="3"><section number="53G-6-202" numlevel="1" lineno="227" slineno="3-2" type="amend"><secline lineno="226">Section 3. Section <bold>53G-6-202</bold> is amended to read:</secline><catline lineno="227"><bold>53G-6-202<parens/>. Compulsory education.</bold></catline><subsection ssid="2-null-1" dnum="1-o" numlevel="1" lineno="228" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="2-null-2" dnum="a-o" numlevel="1" lineno="229" slineno="3-4" level="2"><display>(a)</display>"Intentionally" means the same as that term is defined in Section <xref depth="3" refnumber="76-2-103" start="0">76-2-103</xref>.</subsection><subsection ssid="2-null-3" dnum="b-o" numlevel="1" lineno="230" slineno="3-5" level="2"><display>(b)</display>"Notice of compulsory education violation" means a notice issued in accordance <ln numlevel="1" lineno="231" slineno="3-6"/>with Subsections <xref depth="4" refnumber="53G-6-202(3)" start="0">(3)</xref> and <xref depth="4" refnumber="53G-6-202(4)" start="0">(4)</xref>.</subsection><subsection ssid="2-null-4" dnum="c-o" numlevel="1" lineno="232" slineno="3-7" level="2"><display>(c)</display>"Remainder of the school year" means the portion of the school year beginning on <ln numlevel="1" lineno="233" slineno="3-8"/>the day after the day on which a notice of compulsory education violation is served <ln numlevel="1" lineno="234" slineno="3-9"/>and ending on the last day of the school year.</subsection></subsection><subsection ssid="2-null-5" dnum="2-o" numlevel="1" lineno="235" slineno="3-10" level="1"><display>(2)</display>Except as provided in Section <xref depth="3" refnumber="53G-6-204" start="0">53G-6-204</xref> or <xref depth="3" refnumber="53G-6-702" start="0">53G-6-702</xref>, the parent of a school-age child <ln numlevel="1" lineno="236" slineno="3-11"/>shall enroll and send the school-age child to a public or regularly established private <ln numlevel="1" lineno="237" slineno="3-12"/>school.</subsection><subsection ssid="2-null-6" dnum="3-o" numlevel="1" lineno="238" slineno="3-13" level="1"><display>(3)</display>A school administrator, a designee of a school administrator, a law enforcement officer <ln numlevel="1" lineno="239" slineno="3-14"/>acting as a school resource officer, or a truancy specialist may only issue a notice of <ln numlevel="1" lineno="240" slineno="3-15"/>compulsory education violation to a parent of a school-age child if the school-age child <ln numlevel="1" lineno="241" slineno="3-16"/>is:<subsection ssid="2-null-7" dnum="a-o" numlevel="1" lineno="242" slineno="3-17" level="2"><display>(a)</display>in grade 1 through 6; and</subsection><subsection ssid="2-null-8" dnum="b-o" numlevel="1" lineno="243" slineno="3-18" level="2"><display>(b)</display>truant at least five times during the school year.</subsection></subsection><subsection ssid="2-null-9" dnum="4-o" numlevel="1" lineno="244" slineno="3-19" level="1"><display>(4)</display>A notice of compulsory education violation issued to a parent:<subsection ssid="2-null-10" dnum="a-o" numlevel="1" lineno="245" slineno="3-20" level="2"><display>(a)</display>shall direct the parent to:<subsection ssid="2-null-11" dnum="i-o" numlevel="1" lineno="246" slineno="3-21" level="3"><display>(i)</display>meet with school authorities to discuss the school-age child's school attendance <ln numlevel="1" lineno="247" slineno="3-22"/>problems; and</subsection><subsection ssid="2-null-12" dnum="ii-o" numlevel="1" lineno="248" slineno="3-23" level="3"><display>(ii)</display>cooperate with the local school board, charter school governing board, or school <ln numlevel="1" lineno="249" slineno="3-24"/>district in securing regular attendance by the school-age child;</subsection></subsection><subsection ssid="2-null-13" dnum="b-o" numlevel="1" lineno="250" slineno="3-25" level="2"><display>(b)</display>shall designate the school authorities with whom the parent is required to meet;</subsection><subsection ssid="2-null-14" dnum="c-o" numlevel="1" lineno="251" slineno="3-26" level="2"><display>(c)</display>shall state that it is a class B misdemeanor for the parent to intentionally or without <ln numlevel="1" lineno="252" slineno="3-27"/>good cause:<subsection ssid="2-null-15" dnum="i-o" numlevel="1" lineno="253" slineno="3-28" level="3"><display>(i)</display>fail to meet with the designated school authorities to discuss the school-age child's  <ln numlevel="1" lineno="254" slineno="3-29"/>school attendance problems; or</subsection><subsection ssid="2-null-16" dnum="ii-o" numlevel="1" lineno="255" slineno="3-30" level="3"><display>(ii)</display>fail to prevent the school-age child from being truant five or more times during <ln numlevel="1" lineno="256" slineno="3-31"/>the remainder of the school year;</subsection></subsection><subsection ssid="2-null-17" dnum="d-o" numlevel="1" lineno="257" slineno="3-32" level="2"><display>(d)</display>shall be served on the parent by personal service or certified mail; and</subsection><subsection ssid="2-null-18" dnum="e-o" numlevel="1" lineno="258" slineno="3-33" level="2"><display>(e)</display>may not be issued unless the school-age child has been truant at least five times <ln numlevel="1" lineno="259" slineno="3-34"/>during the school year.</subsection></subsection><subsection ssid="2-null-19" dnum="5-o" numlevel="1" lineno="260" slineno="3-35" level="1"><display>(5)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="14" groupid="12" style="2" owner="admin" level="1" deltag="both">Except during the period between March 17, 2021 and June 1, 2022, it </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="10" groupid="8" style="1" owner="admin" level="1" amendtag="both" space="true">It </amend>is a class B <ln numlevel="1" lineno="261" slineno="3-36"/>misdemeanor for a parent of a school-age child to intentionally or without good cause <ln numlevel="1" lineno="262" slineno="3-37"/>fail to enroll the school-age child in school, unless the school-age child is exempt from <ln numlevel="1" lineno="263" slineno="3-38"/>enrollment under Section <xref depth="3" refnumber="53G-6-204" start="0">53G-6-204</xref> or <xref depth="3" refnumber="53G-6-702" start="0">53G-6-702</xref>.</subsection><subsection ssid="2-null-20" dnum="6-o" numlevel="1" lineno="264" slineno="3-39" level="1"><display>(6)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="13" style="2" owner="admin" level="1" deltag="both">Except during the period between March 17, 2021 and June 1, 2022, it </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="11" groupid="9" style="1" owner="admin" level="1" amendtag="both" space="true">It </amend>is a class B <ln numlevel="1" lineno="265" slineno="3-40"/>misdemeanor for a parent of a school-age child who is in grade 1 through 6 to, after <ln numlevel="1" lineno="266" slineno="3-41"/>being served with a notice of compulsory education violation, intentionally or without <ln numlevel="1" lineno="267" slineno="3-42"/>good cause:<subsection ssid="2-null-21" dnum="a-o" numlevel="1" lineno="268" slineno="3-43" level="2"><display>(a)</display>fail to meet with the school authorities designated in the notice of compulsory <ln numlevel="1" lineno="269" slineno="3-44"/>education violation to discuss the school-age child's school attendance problems; or</subsection><subsection ssid="2-null-22" dnum="b-o" numlevel="1" lineno="270" slineno="3-45" level="2"><display>(b)</display>fail to prevent the school-age child from being truant five or more times during the <ln numlevel="1" lineno="271" slineno="3-46"/>remainder of the school year.</subsection></subsection><subsection ssid="2-null-23" dnum="7-o" numlevel="1" lineno="272" slineno="3-47" level="1"><display>(7)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="14" style="2" owner="admin" level="1" deltag="both">Except during the period described in Subsections <xref depth="4" refnumber="53G-6-202(5)" start="0">(5)</xref> and <xref depth="4" refnumber="53G-6-202(6)" start="0">(6)</xref>, a </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="12" groupid="10" style="1" owner="admin" level="1" amendtag="both" space="true">A </amend>local school board, <ln numlevel="1" lineno="273" slineno="3-48"/>charter school governing board, or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="35" groupid="33" style="2" owner="admin" level="1" deltag="both">school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="34" groupid="32" style="1" owner="admin" level="1" amendtag="both" space="true">LEA official</amend> shall report violations of <ln numlevel="1" lineno="274" slineno="3-49"/>this section to the appropriate county or district attorney.</subsection><subsection ssid="2-null-24" dnum="8-o" numlevel="1" lineno="275" slineno="3-50" level="1"><display>(8)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="21" groupid="19" style="2" owner="admin" level="1" deltag="both">Except during the period described in Subsections <xref depth="4" refnumber="53G-6-202(5)" start="0">(5)</xref> and <xref depth="4" refnumber="53G-6-202(6)" start="0">(6)</xref>, if </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="13" groupid="11" style="1" owner="admin" level="1" amendtag="both" space="true">If </amend>school personnel <ln numlevel="1" lineno="276" slineno="3-51"/>have reason to believe that, after a notice of compulsory education violation is issued, <ln numlevel="1" lineno="277" slineno="3-52"/>the parent has failed to make a good faith effort to ensure that the school-age child <ln numlevel="1" lineno="278" slineno="3-53"/>receives an appropriate education, the issuer of the compulsory education violation shall <ln numlevel="1" lineno="279" slineno="3-54"/>report to the Division of Child and Family Services:<subsection ssid="2-null-25" dnum="a-o" numlevel="1" lineno="280" slineno="3-55" level="2"><display>(a)</display>identifying information of the school-age child and the parent who received the <ln numlevel="1" lineno="281" slineno="3-56"/>notice of compulsory education violation;</subsection><subsection ssid="2-null-26" dnum="b-o" numlevel="1" lineno="282" slineno="3-57" level="2"><display>(b)</display>information regarding the longest number of consecutive <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="31" groupid="29" style="2" owner="admin" level="1" deltag="both">school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="29" groupid="27" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> days <ln numlevel="1" lineno="283" slineno="3-58"/>the school-age child has been absent or truant from school and the percentage of <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="32" groupid="30" style="2" owner="admin" level="1" deltag="both"><ln numlevel="1" lineno="284" slineno="3-59"/>school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="30" groupid="28" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> days the school-age child has been absent or truant during each <ln numlevel="1" lineno="285" slineno="3-60"/>relevant school term;</subsection><subsection ssid="2-null-27" dnum="c-o" numlevel="1" lineno="286" slineno="3-61" level="2"><display>(c)</display>whether the school-age child has made adequate educational progress;</subsection><subsection ssid="2-null-28" dnum="d-o" numlevel="1" lineno="287" slineno="3-62" level="2"><display>(d)</display>whether the requirements of Section <xref depth="3" refnumber="53G-6-206" start="0">53G-6-206</xref> have been met;</subsection><subsection ssid="2-null-29" dnum="e-o" numlevel="1" lineno="288" slineno="3-63" level="2"><display>(e)</display>whether the school-age child is two or more years behind the local public school's <ln numlevel="1" lineno="289" slineno="3-64"/>age group expectations in one or more basic skills; and</subsection><subsection ssid="2-null-30" dnum="f-o" numlevel="1" lineno="290" slineno="3-65" level="2"><display>(f)</display>whether the school-age child is receiving special education services or systematic <ln numlevel="1" lineno="291" slineno="3-66"/>remediation efforts.</subsection></subsection><subsection ssid="2-32" dnum="_-o:9-e" numlevel="1" lineno="292" slineno="3-67" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1144" style="1" owner="e" level="1" amendtag="start">(9)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="end">An LEA shall maintain records of each notice of compulsory education violation issued <ln numlevel="1" lineno="293" slineno="3-68"/>and any resulting referrals and general outcomes.</amend></subsection><subsection ssid="2-null-31" dnum="9-o:_-e" numlevel="1" lineno="294" slineno="3-69" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1145" style="2" owner="o" level="1" deltag="start">(9)</amend></display><amend anum="0" ea="erase" pairid="26" groupid="24" style="2" owner="admin" level="1" deltag="end">Notwithstanding this section, during the period described in Subsections <xref depth="4" refnumber="53G-6-202(5)" start="0">(5)</xref> and <xref depth="4" refnumber="53G-6-202(6)" start="0">(6)</xref>, a <ln numlevel="1" lineno="295" slineno="3-70"/>school administrator, designee of a school administrator, law enforcement officer acting <ln numlevel="1" lineno="296" slineno="3-71"/>as a school resource officer, or truancy specialist may not issue or otherwise enforce a <ln numlevel="1" lineno="297" slineno="3-72"/>notice of compulsory education.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="3" num="53G-6-203" type="amend" src="code" uid="C53G-6-S203_2026070120260701" sort="53G06 02030020260701" numlevel="1" lineno="298" slineno="4-1" sn="4"><section number="53G-6-203" numlevel="1" lineno="299" slineno="4-2" type="amend"><secline lineno="298">Section 4. Section <bold>53G-6-203</bold> is amended to read:</secline><catline lineno="299"><bold>53G-6-203<parens/>. Truancy -- Notice of truancy -- Failure to cooperate with school <ln numlevel="1" lineno="300" slineno="4-3"/>authorities.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="301" slineno="4-4" level="1" placement="noreturn"><display>(1)</display>Except as provided in Section <xref depth="3" refnumber="53G-6-204" start="0">53G-6-204</xref> or <xref depth="3" refnumber="53G-6-702" start="0">53G-6-702</xref>, a school-age child who is <ln numlevel="1" lineno="302" slineno="4-5"/>enrolled in a public school shall attend the public school in which the school-age child is <ln numlevel="1" lineno="303" slineno="4-6"/>enrolled.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="304" slineno="4-7" level="1"><display>(2)</display>In accordance with Section <xref depth="3" refnumber="53G-8-211" start="0">53G-8-211</xref>, a local school board, charter school governing <ln numlevel="1" lineno="305" slineno="4-8"/>board, or school district may impose administrative penalties on a school-age child who <ln numlevel="1" lineno="306" slineno="4-9"/>is:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="307" slineno="4-10" level="2"><display>(a)</display>in grade 7 or above, unless the school-age child is less than 12 years old; and</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="308" slineno="4-11" level="2"><display>(b)</display>truant.</subsection></subsection><subsection ssid="3-null-5" dnum="3-o" numlevel="1" lineno="309" slineno="4-12" level="1"><display>(3)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="64" groupid="50" style="2" owner="admin" level="1" deltag="both">A local school board or charter school </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="62" groupid="48" style="1" owner="admin" level="1" amendtag="both" space="true">An LEA </amend>governing board:<subsection ssid="3-null-6" dnum="a-o" numlevel="1" lineno="310" slineno="4-13" level="2"><display>(a)</display>may authorize a school administrator, a designee of a school administrator, a law <ln numlevel="1" lineno="311" slineno="4-14"/>enforcement officer acting as a school resource officer, or a truancy specialist to issue <ln numlevel="1" lineno="312" slineno="4-15"/>a notice of truancy in accordance with Subsection <xref depth="4" refnumber="53G-6-203(4)" start="0">(4)</xref>; and</subsection><subsection ssid="3-null-7" dnum="b-o" numlevel="1" lineno="313" slineno="4-16" level="2"><display>(b)</display>shall establish a procedure for a school-age child, or the school-age child's parents, to <ln numlevel="1" lineno="314" slineno="4-17"/>contest a notice of truancy.</subsection></subsection><subsection ssid="3-null-8" dnum="4-o" numlevel="1" lineno="315" slineno="4-18" level="1"><display>(4)</display>A notice of truancy described in Subsection <xref depth="4" refnumber="53G-6-203(3)" start="0">(3)</xref>:<subsection ssid="3-null-9" dnum="a-o" numlevel="1" lineno="316" slineno="4-19" level="2"><display>(a)</display>may not be issued until a school-age child has been truant at least five times during <ln numlevel="1" lineno="317" slineno="4-20"/>the school year;</subsection><subsection ssid="3-null-10" dnum="b-o" numlevel="1" lineno="318" slineno="4-21" level="2"><display>(b)</display>may not be issued to a school-age child who is less than 12 years old or in a grade <ln numlevel="1" lineno="319" slineno="4-22"/>below grade 7;</subsection><subsection ssid="3-null-11" dnum="c-o" numlevel="1" lineno="320" slineno="4-23" level="2"><display>(c)</display>may not be issued to a school-age child exempt from school attendance as provided <ln numlevel="1" lineno="321" slineno="4-24"/>in Section <xref depth="3" refnumber="53G-6-204" start="0">53G-6-204</xref> or <xref depth="3" refnumber="53G-6-702" start="0">53G-6-702</xref>;</subsection><subsection ssid="3-null-12" dnum="d-o" numlevel="1" lineno="322" slineno="4-25" level="2"><display>(d)</display>shall direct the school-age child who receives the notice of truancy and the parent of <ln numlevel="1" lineno="323" slineno="4-26"/>the school-age child to:<subsection ssid="3-null-13" dnum="i-o" numlevel="1" lineno="324" slineno="4-27" level="3"><display>(i)</display>meet with school authorities to discuss the school-age child's truancies; and</subsection><subsection ssid="3-null-14" dnum="ii-o" numlevel="1" lineno="325" slineno="4-28" level="3"><display>(ii)</display>cooperate with the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="65" groupid="51" style="2" owner="admin" level="1" deltag="both">local school board, charter school </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="49" style="1" owner="admin" level="1" amendtag="both" space="true">LEA </amend>governing board, or <ln numlevel="1" lineno="326" slineno="4-29"/>school district in securing regular attendance by the school-age child; and</subsection></subsection><subsection ssid="3-null-15" dnum="e-o" numlevel="1" lineno="327" slineno="4-30" level="2"><display>(e)</display>shall be mailed to, or served on, the school-age child's parent.</subsection></subsection><subsection ssid="3-null-16" dnum="5-o" numlevel="1" lineno="328" slineno="4-31" level="1" space="false"><display>(5)</display><subsection ssid="3-null-17" dnum="a-o:_-e" ea="erase" anum="0" owner="admin" style="2" level="2" placement="sameline"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1162" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="45" groupid="32" style="2" owner="admin" level="1" deltag="end">Except as provided in Subsection <xref depth="4" refnumber="53G-6-203(5)(b)" start="0">(5)(b)</xref>, nothing </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="44" groupid="31" style="1" owner="admin" level="1" amendtag="both" space="true">Nothing </amend>in this part prohibits a <ln numlevel="1" lineno="329" slineno="4-32"/>local <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="52" style="2" owner="admin" level="1" deltag="both">school board, charter school </amend><amendoutend style="2"/>governing board<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="54" groupid="40" style="2" owner="admin" level="1" deltag="both">,</amend><amendoutend style="2"/> or <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="53" groupid="39" style="2" owner="admin" level="1" deltag="both">school district</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="51" groupid="37" style="1" owner="admin" level="1" amendtag="both" space="true">LEA official</amend> <ln numlevel="1" lineno="330" slineno="4-33"/>from taking action to resolve a truancy problem with a school-age child who has been <ln numlevel="1" lineno="331" slineno="4-34"/>truant fewer than five times, <marker pairid="77">provided that</marker> the action does not conflict with the <ln numlevel="1" lineno="332" slineno="4-35"/>requirements of this part.</subsection><subsection ssid="3-null-18" dnum="b-o:_-e" numlevel="1" lineno="333" slineno="4-36" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1163" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="72" groupid="56" style="2" owner="admin" level="1" deltag="end">A local school board, charter school governing board, or school district may not <ln numlevel="1" lineno="334" slineno="4-37"/>take punitive action to resolve a truancy problem with a school-age child during the <ln numlevel="1" lineno="335" slineno="4-38"/>period described in Subsection <xref depth="4" refnumber="53G-6-203(2)" start="0">(2)</xref>.</amend><amendoutend style="2"/></subsection></subsection><subsection ssid="3-20" dnum="_-o:6-e" numlevel="1" lineno="336" slineno="4-39" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1164" style="1" owner="e" level="1" amendtag="start">(6)</amend></display><amend anum="0" ea="amend" pairid="10" groupid="6" style="1" owner="admin" level="1" amendtag="end">An LEA shall maintain records of each notice of truancy issued and any resulting <ln numlevel="1" lineno="337" slineno="4-40"/>referrals and general outcomes.</amend></subsection><subsection ssid="3-null-19" dnum="6-o:_-e" numlevel="1" lineno="338" slineno="4-41" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1165" style="2" owner="o" level="1" deltag="start">(6)</amend></display><amend anum="0" ea="erase" pairid="69" groupid="54" style="2" owner="admin" level="1" deltag="end">Notwithstanding this section, during the period described in Subsection <xref depth="4" refnumber="53G-6-203(2)" start="0">(2)</xref>, a school <ln numlevel="1" lineno="339" slineno="4-42"/>administrator, designee of a school administrator, law enforcement officer acting as a <ln numlevel="1" lineno="340" slineno="4-43"/>school resource officer, or truancy specialist may not issue or otherwise enforce a notice <ln numlevel="1" lineno="341" slineno="4-44"/>of truancy.</amend><amendoutend style="2"/></subsection></section></bsec><bsec buid="4" num="53G-6-206" type="amend" src="code" uid="C53G-6-S206_2026070120260701" sort="53G06 02060020260701" numlevel="1" lineno="342" slineno="5-1" sn="5"><section number="53G-6-206" numlevel="1" lineno="343" slineno="5-2" type="amend"><secline lineno="342">Section 5. Section <bold>53G-6-206</bold> is amended to read:</secline><catline lineno="343"><bold>53G-6-206<parens/>. Duties of a local school board, charter school governing board, or <ln numlevel="1" lineno="344" slineno="5-3"/>school district in promoting regular attendance -- Parental involvement -- Liability not <ln numlevel="1" lineno="345" slineno="5-4"/>imposed -- Report to state board.</bold></catline><subsection ssid="4-null-1" dnum="1-o" numlevel="1" lineno="346" slineno="5-5" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="4-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>As used in this section, "intervention" means a series of non-punitive and <ln numlevel="1" lineno="347" slineno="5-6"/>increasingly frequent and individualized activities that are designed to:<subsection ssid="4-null-3" dnum="i-o" numlevel="1" lineno="348" slineno="5-7" level="3" tab="1"><display>(i)</display>create a trusting relationship between teachers, students, and parents;</subsection><subsection ssid="4-null-4" dnum="ii-o" numlevel="1" lineno="349" slineno="5-8" level="3" tab="1"><display>(ii)</display>improve attendance;</subsection><subsection ssid="4-null-5" dnum="iii-o" numlevel="1" lineno="350" slineno="5-9" level="3" tab="1"><display>(iii)</display>improve academic outcomes; and</subsection><subsection ssid="4-null-6" dnum="iv-o" numlevel="1" lineno="351" slineno="5-10" level="3" tab="1"><display>(iv)</display>reduce negative behavior referrals.</subsection></subsection><subsection ssid="4-null-7" dnum="b-o" numlevel="1" lineno="352" slineno="5-11" level="2"><display>(b)</display>"Intervention" includes:<subsection ssid="4-null-8" dnum="i-o" numlevel="1" lineno="353" slineno="5-12" level="3"><display>(i)</display>mentorship programs;</subsection><subsection ssid="4-null-9" dnum="ii-o" numlevel="1" lineno="354" slineno="5-13" level="3"><display>(ii)</display>family connection to community resources;</subsection><subsection ssid="4-null-10" dnum="iii-o" numlevel="1" lineno="355" slineno="5-14" level="3"><display>(iii)</display>academic support through small group or individualized tutoring or similar <ln numlevel="1" lineno="356" slineno="5-15"/>methods; and</subsection><subsection ssid="4-null-11" dnum="iv-o" numlevel="1" lineno="357" slineno="5-16" level="3"><display>(iv)</display>teaching executive function skills, including:<subsection ssid="4-null-12" dnum="A-o" numlevel="1" lineno="358" slineno="5-17" level="4"><display>(A)</display>planning;</subsection><subsection ssid="4-null-13" dnum="B-o" numlevel="1" lineno="359" slineno="5-18" level="4"><display>(B)</display>goal setting;</subsection><subsection ssid="4-null-14" dnum="C-o" numlevel="1" lineno="360" slineno="5-19" level="4"><display>(C)</display>understanding and following multi-step directions; and</subsection><subsection ssid="4-null-15" dnum="D-o" numlevel="1" lineno="361" slineno="5-20" level="4"><display>(D)</display>self-regulation.</subsection></subsection></subsection></subsection><subsection ssid="4-null-16" dnum="2-o" numlevel="1" lineno="362" slineno="5-21" level="1" space="false"><display>(2)</display><subsection ssid="4-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Subject to Subsection <xref depth="4" refnumber="53G-6-206(2)(b)">(2)(b)</xref>, an LEA shall make efforts to promote regular <ln numlevel="1" lineno="363" slineno="5-22"/>attendance and resolve school absenteeism and truancy issues for each school-age <ln numlevel="1" lineno="364" slineno="5-23"/>child who is, or should be, enrolled in the LEA.</subsection><subsection ssid="4-null-18" dnum="b-o" numlevel="1" lineno="365" slineno="5-24" level="2"><display>(b)</display>A school-age child exempt from school attendance under Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref> or <xref depth="3" refnumber="53G-6-702"><ln numlevel="1" lineno="366" slineno="5-25"/>53G-6-702</xref>, or a school-age child who is enrolled in a regularly established private <ln numlevel="1" lineno="367" slineno="5-26"/>school or part-time school, is not considered to be a school-age child who is or <ln numlevel="1" lineno="368" slineno="5-27"/>should be enrolled in a school district or charter school under Subsection <xref depth="4" refnumber="53G-6-206(2)(a)">(2)(a)</xref>.</subsection></subsection><subsection ssid="4-null-19" dnum="3-o" numlevel="1" lineno="369" slineno="5-28" level="1"><display>(3)</display>The efforts described in Subsection <xref depth="4" refnumber="53G-6-206(2)">(2)</xref> shall include, as reasonably feasible:<subsection ssid="4-null-20" dnum="a-o" numlevel="1" lineno="370" slineno="5-29" level="2"><display>(a)</display>counseling of the school-age child by school authorities;</subsection><subsection ssid="4-null-21" dnum="b-o" numlevel="1" lineno="371" slineno="5-30" level="2" space="false"><display>(b)</display><subsection ssid="4-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>issuing a notice of truancy to the school-age child in accordance with Section <xref depth="3" refnumber="53G-6-203"><ln numlevel="1" lineno="372" slineno="5-31"/>53G-6-203</xref>; or</subsection><subsection ssid="4-null-23" dnum="ii-o" numlevel="1" lineno="373" slineno="5-32" level="3"><display>(ii)</display>issuing a notice of compulsory education violation to the school-age child's parent <ln numlevel="1" lineno="374" slineno="5-33"/>in accordance with Section <xref depth="3" refnumber="53G-6-202">53G-6-202</xref>;</subsection></subsection><subsection ssid="4-null-24" dnum="c-o" numlevel="1" lineno="375" slineno="5-34" level="2"><display>(c)</display>making any necessary adjustment to the curriculum and schedule to meet special <ln numlevel="1" lineno="376" slineno="5-35"/>needs of the school-age child;</subsection><subsection ssid="4-null-25" dnum="d-o" numlevel="1" lineno="377" slineno="5-36" level="2"><display>(d)</display>considering alternatives proposed by the school-age child's parent;</subsection><subsection ssid="4-null-26" dnum="e-o" numlevel="1" lineno="378" slineno="5-37" level="2"><display>(e)</display>incorporating attendance in the school-age child's course score or grade if:<subsection ssid="4-null-27" dnum="i-o" numlevel="1" lineno="379" slineno="5-38" level="3"><display>(i)</display>incorporation is determined appropriate through an individualized plan the <ln numlevel="1" lineno="380" slineno="5-39"/>school-age child's parent and teacher develops;</subsection><subsection ssid="4-null-28" dnum="ii-o" numlevel="1" lineno="381" slineno="5-40" level="3"><display>(ii)</display>parental written consent is obtained for the individualized plan; and</subsection><subsection ssid="4-null-29" dnum="iii-o" numlevel="1" lineno="382" slineno="5-41" level="3"><display>(iii)</display>the parent retains the ability to revoke the parent's consent described in <ln numlevel="1" lineno="383" slineno="5-42"/>Subsection <xref depth="4" refnumber="53G-6-206(3)(e)(ii)">(3)(e)(ii)</xref> at any time<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="66" groupid="53" style="2" owner="admin" level="1" deltag="both">.</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="65" groupid="52" style="1" owner="admin" level="1" amendtag="both" space="true">;</amend></subsection></subsection><subsection ssid="4-null-30" dnum="f-o" numlevel="1" lineno="384" slineno="5-43" level="2"><display>(f)</display>monitoring school attendance of the school-age child;</subsection><subsection ssid="4-null-31" dnum="g-o" numlevel="1" lineno="385" slineno="5-44" level="2"><display>(g)</display>voluntary participation in truancy mediation, if available; and</subsection><subsection ssid="4-null-32" dnum="h-o" numlevel="1" lineno="386" slineno="5-45" level="2"><display>(h)</display>providing the school-age child's parent, upon request, with a list of resources <ln numlevel="1" lineno="387" slineno="5-46"/>available to assist the parent in resolving the school-age child's attendance problems.</subsection></subsection><subsection ssid="4-null-33" dnum="4-o" numlevel="1" lineno="388" slineno="5-47" level="1"><display>(4)</display>In addition to the efforts described in Subsection <xref depth="4" refnumber="53G-6-206(3)">(3)</xref>, the <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="62" groupid="49" style="2" owner="admin" level="1" deltag="both">local school board, charter <ln numlevel="1" lineno="389" slineno="5-48"/>school governing board, or school district </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="63" groupid="50" style="1" owner="admin" level="1" amendtag="both" space="true">LEA governing board or LEA official </amend>may <ln numlevel="1" lineno="390" slineno="5-49"/>enlist the assistance of community and law enforcement agencies and organizations for <ln numlevel="1" lineno="391" slineno="5-50"/>early intervention services as appropriate and reasonably feasible in accordance with <ln numlevel="1" lineno="392" slineno="5-51"/>Section <xref depth="3" refnumber="53G-8-211">53G-8-211</xref>.</subsection><subsection ssid="4-39" dnum="_-o:5-e" numlevel="1" lineno="393" slineno="5-52" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1199" style="1" owner="e" level="1" amendtag="start">(5)</amend></display><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="end"> An LEA shall:</amend><subsection ssid="4-40" dnum="_-o:a-e" numlevel="1" lineno="394" slineno="5-53" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1200" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="6" style="1" owner="admin" level="1" amendtag="end">conduct regular reviews of student attendance data to identify students at risk of <ln numlevel="1" lineno="395" slineno="5-54"/>chronic absenteeism;</amend></subsection><subsection ssid="4-41" dnum="_-o:b-e" numlevel="1" lineno="396" slineno="5-55" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1201" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="10" style="1" owner="admin" level="1" amendtag="end">implement tiered interventions for students with attendance concerns;</amend></subsection><subsection ssid="4-42" dnum="_-o:c-e" numlevel="1" lineno="397" slineno="5-56" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1202" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="14" style="1" owner="admin" level="1" amendtag="end">notify parents within two instructional days of a student's unexcused absence, <ln numlevel="1" lineno="398" slineno="5-57"/>including the total number for the school year; and</amend></subsection><subsection ssid="4-43" dnum="_-o:d-e" numlevel="1" lineno="399" slineno="5-58" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1203" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="24" groupid="18" style="1" owner="admin" level="1" amendtag="end">maintain accurate and timely attendance records in the LEA's student information <ln numlevel="1" lineno="400" slineno="5-59"/>system.</amend></subsection></subsection><subsection ssid="4-null-34" dnum="5-o:6-e" numlevel="1" lineno="401" slineno="5-60" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1204" style="2" owner="o" level="1" deltag="both">(5)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1205" style="1" owner="e" level="1" amendtag="both" space="true">(6)</amend></display>This section does not impose civil liability on boards of education, local school <ln numlevel="1" lineno="402" slineno="5-61"/>boards, charter school governing boards, school districts, or their employees.</subsection><subsection ssid="4-null-35" dnum="6-o:7-e" numlevel="1" lineno="403" slineno="5-62" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1205" style="2" owner="o" level="1" deltag="both">(6)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1206" style="1" owner="e" level="1" amendtag="both" space="true">(7)</amend></display>Proceedings initiated under this part do not obligate or preclude action by the <ln numlevel="1" lineno="404" slineno="5-63"/>Division of Child and Family Services under Section <xref depth="3" refnumber="53G-6-210">53G-6-210</xref>.</subsection><subsection ssid="4-null-36" dnum="7-o:8-e" numlevel="1" lineno="405" slineno="5-64" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1206" style="2" owner="o" level="1" deltag="both">(7)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1207" style="1" owner="e" level="1" amendtag="both" space="true">(8)</amend></display>Each LEA shall annually report the following data separately to the state board:<subsection ssid="4-null-37" dnum="a-o" numlevel="1" lineno="406" slineno="5-65" level="2"><display>(a)</display>absences with a valid excuse; and</subsection><subsection ssid="4-null-38" dnum="b-o" numlevel="1" lineno="407" slineno="5-66" level="2"><display>(b)</display>absences without a valid excuse.</subsection></subsection></section></bsec><bsec buid="20" num="53G-6-210" type="amend" src="code" uid="C53G-6-S210_2026070120260701" sort="53G06 02100020260701" numlevel="1" lineno="408" slineno="6-1" sn="6"><section number="53G-6-210" numlevel="1" lineno="409" slineno="6-2" type="amend"><secline lineno="408">Section 6. Section <bold>53G-6-210</bold> is amended to read:</secline><catline lineno="409"><bold>53G-6-210<parens/>. Educational neglect of a minor -- Procedures -- Defenses.</bold></catline><subsection ssid="20-null-1" dnum="1-o" numlevel="1" lineno="410" slineno="6-3" level="1" placement="noreturn"><display>(1)</display>With regard to a minor who is the subject of a petition under Section <xref depth="3" refnumber="80-3-201">80-3-201</xref> based on <ln numlevel="1" lineno="411" slineno="6-4"/>educational neglect:<subsection ssid="20-null-2" dnum="a-o" numlevel="1" lineno="412" slineno="6-5" level="2"><display>(a)</display>if allegations include failure of a minor to make adequate educational progress, the <ln numlevel="1" lineno="413" slineno="6-6"/>juvenile court shall permit demonstration of the minor's educational skills and <ln numlevel="1" lineno="414" slineno="6-7"/>abilities based upon any of the criteria used in granting school credit, in accordance <ln numlevel="1" lineno="415" slineno="6-8"/>with Section <xref depth="3" refnumber="53G-6-702">53G-6-702</xref>;</subsection><subsection ssid="20-null-3" dnum="b-o" numlevel="1" lineno="416" slineno="6-9" level="2"><display>(b)</display>parental refusal to comply with actions taken by school authorities in violation of <ln numlevel="1" lineno="417" slineno="6-10"/>Section <xref depth="3" refnumber="53G-10-202">53G-10-202</xref>, <xref depth="3" refnumber="53G-10-205">53G-10-205</xref>, <xref depth="3" refnumber="53G-10-403">53G-10-403</xref>, or <xref depth="3" refnumber="53G-10-203">53G-10-203</xref>, does not constitute <ln numlevel="1" lineno="418" slineno="6-11"/>educational neglect;</subsection><subsection ssid="20-null-4" dnum="c-o" numlevel="1" lineno="419" slineno="6-12" level="2"><display>(c)</display>parental refusal to support efforts by a school to encourage a minor to act in <ln numlevel="1" lineno="420" slineno="6-13"/>accordance with any educational objective that focuses on the adoption or expression <ln numlevel="1" lineno="421" slineno="6-14"/>of a personal philosophy, attitude, or belief that is not reasonably necessary to <ln numlevel="1" lineno="422" slineno="6-15"/>maintain order and discipline in the school, prevent unreasonable endangerment of <ln numlevel="1" lineno="423" slineno="6-16"/>persons or property, or to maintain concepts of civility and propriety appropriate to a <ln numlevel="1" lineno="424" slineno="6-17"/>school setting, does not constitute educational neglect; and</subsection><subsection ssid="20-null-5" dnum="d-o" numlevel="1" lineno="425" slineno="6-18" level="2"><display>(d)</display>an allegation of educational neglect may not be sustained, based solely on a minor's <ln numlevel="1" lineno="426" slineno="6-19"/>absence from school, unless the minor has<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="8" groupid="8" style="2" owner="admin" level="1" deltag="both"> been absent </amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="6" groupid="6" style="1" owner="admin" level="1" amendtag="both" space="true"> absences without a valid <ln numlevel="1" lineno="427" slineno="6-20"/>excuse </amend>from school or from any given class, <amend anum="0" ea="amend" pairid="7" groupid="7" style="1" owner="admin" level="1" amendtag="both">that are also </amend>without good cause, for <ln numlevel="1" lineno="428" slineno="6-21"/>more than 10 consecutive <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">school</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">instructional</amend> days or more than 1/10 of the <ln numlevel="1" lineno="429" slineno="6-22"/>applicable school term.</subsection></subsection><subsection ssid="20-null-6" dnum="2-o" numlevel="1" lineno="430" slineno="6-23" level="1"><display>(2)</display>A minor may not be considered to be educationally neglected, for purposes of this <ln numlevel="1" lineno="431" slineno="6-24"/>chapter:<subsection ssid="20-null-7" dnum="a-o" numlevel="1" lineno="432" slineno="6-25" level="2"><display>(a)</display>unless there is clear and convincing evidence that:<subsection ssid="20-null-8" dnum="i-o" numlevel="1" lineno="433" slineno="6-26" level="3"><display>(i)</display>the minor has failed to make adequate educational progress, and school officials <ln numlevel="1" lineno="434" slineno="6-27"/>have complied with the requirements of Section <xref depth="3" refnumber="53G-6-206">53G-6-206</xref>; or</subsection><subsection ssid="20-null-9" dnum="ii-o" numlevel="1" lineno="435" slineno="6-28" level="3"><display>(ii)</display>the minor is two or more years behind the local public school's age group <ln numlevel="1" lineno="436" slineno="6-29"/>expectations in one or more basic skills, and is not receiving special educational <ln numlevel="1" lineno="437" slineno="6-30"/>services or systematic remediation efforts designed to correct the problem;</subsection></subsection><subsection ssid="20-null-10" dnum="b-o" numlevel="1" lineno="438" slineno="6-31" level="2"><display>(b)</display>if the minor's parent or guardian establishes by a preponderance of the evidence that:<subsection ssid="20-null-11" dnum="i-o" numlevel="1" lineno="439" slineno="6-32" level="3"><display>(i)</display>school authorities have failed to comply with the requirements of this title;</subsection><subsection ssid="20-null-12" dnum="ii-o" numlevel="1" lineno="440" slineno="6-33" level="3"><display>(ii)</display>the minor is being instructed at home in compliance with Section <xref depth="3" refnumber="53G-6-204">53G-6-204</xref>;</subsection><subsection ssid="20-null-13" dnum="iii-o" numlevel="1" lineno="441" slineno="6-34" level="3"><display>(iii)</display>there is documentation that the minor has demonstrated educational progress at a <ln numlevel="1" lineno="442" slineno="6-35"/>level commensurate with the minor's ability;</subsection><subsection ssid="20-null-14" dnum="iv-o" numlevel="1" lineno="443" slineno="6-36" level="3"><display>(iv)</display>the parent, guardian, or other person in control of the minor has made a good <ln numlevel="1" lineno="444" slineno="6-37"/>faith effort to secure the minor's regular attendance in school;</subsection><subsection ssid="20-null-15" dnum="v-o" numlevel="1" lineno="445" slineno="6-38" level="3"><display>(v)</display>good cause or a valid excuse exists for the minor's absence from school;</subsection><subsection ssid="20-null-16" dnum="vi-o" numlevel="1" lineno="446" slineno="6-39" level="3"><display>(vi)</display>the minor is not required to attend school under court order or is exempt under <ln numlevel="1" lineno="447" slineno="6-40"/>other applicable state or federal law;</subsection><subsection ssid="20-null-17" dnum="vii-o" numlevel="1" lineno="448" slineno="6-41" level="3"><display>(vii)</display>the minor has performed above the twenty-fifth percentile of the local public <ln numlevel="1" lineno="449" slineno="6-42"/>school's age group expectations in all basic skills, as measured by a standardized <ln numlevel="1" lineno="450" slineno="6-43"/>academic achievement test administered by the school district where the minor <ln numlevel="1" lineno="451" slineno="6-44"/>resides; or</subsection><subsection ssid="20-null-18" dnum="viii-o" numlevel="1" lineno="452" slineno="6-45" level="3"><display>(viii)</display>the parent or guardian presented a reasonable alternative curriculum to required <ln numlevel="1" lineno="453" slineno="6-46"/>school curriculum, in accordance with Section <xref depth="3" refnumber="53G-10-205">53G-10-205</xref> or <xref depth="3" refnumber="53G-10-403">53G-10-403</xref>, and <ln numlevel="1" lineno="454" slineno="6-47"/>the alternative curriculum was rejected by the school district, but the parents have <ln numlevel="1" lineno="455" slineno="6-48"/>implemented the alternative curriculum; or</subsection></subsection><subsection ssid="20-null-19" dnum="c-o" numlevel="1" lineno="456" slineno="6-49" level="2"><display>(c)</display>if the minor is attending school on a regular basis.</subsection></subsection></section></bsec><bsec buid="11" num="53G-6-213" type="enact" src="code" uid="C53G-6-S213_2026070120260701" sort="53G06 02130020260701" numlevel="1" lineno="457" slineno="7-1" sn="7"><section numlevel="1" lineno="458" slineno="7-2" number="53G-6-213" type="enact"><secline lineno="457">Section 7. Section <bold>53G-6-213</bold> is enacted to read:</secline><catline lineno="458"><bold>53G-6-213<parens/>.  Data quality and monitoring requirements.</bold></catline><subsection ssid="11-1" dnum="_-o:1-e" numlevel="1" lineno="459" slineno="7-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1228" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="admin" level="1" amendtag="end">An LEA shall:</amend><subsection ssid="11-2" dnum="_-o:a-e" numlevel="1" lineno="460" slineno="7-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1229" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">ensure the LEA's student information system accurately captures and reports student <ln numlevel="1" lineno="461" slineno="7-5"/>enrollment, attendance, and membership data; and</amend></subsection><subsection ssid="11-6" dnum="_-o:b-e" numlevel="1" lineno="462" slineno="7-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1230" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="26" style="1" owner="admin" level="1" amendtag="end">conduct an annual internal review of attendance data accuracy.</amend></subsection></subsection><subsection ssid="11-7" dnum="_-o:2-e" numlevel="1" lineno="463" slineno="7-7" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1231" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="46" groupid="35" style="1" owner="admin" level="1" amendtag="end">The state board shall:</amend><subsection ssid="11-8" dnum="_-o:a-e" numlevel="1" lineno="464" slineno="7-8" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1232" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="36" style="1" owner="admin" level="1" amendtag="end">establish minimum standards for LEA attendance data quality;</amend></subsection><subsection ssid="11-9" dnum="_-o:b-e" numlevel="1" lineno="465" slineno="7-9" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1233" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="52" groupid="40" style="1" owner="admin" level="1" amendtag="end">conduct periodic audits of LEA attendance data;</amend></subsection><subsection ssid="11-10" dnum="_-o:c-e" numlevel="1" lineno="466" slineno="7-10" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1234" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="57" groupid="44" style="1" owner="admin" level="1" amendtag="end">provide technical assistance to an LEA with data quality issues;</amend></subsection><subsection ssid="11-11" dnum="_-o:d-e" numlevel="1" lineno="467" slineno="7-11" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1235" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="62" groupid="48" style="1" owner="admin" level="1" amendtag="end">publish annual reports on statewide attendance trends and data quality; and</amend></subsection><subsection ssid="11-12" dnum="_-o:e-e" numlevel="1" lineno="468" slineno="7-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1236" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="67" groupid="52" style="1" owner="admin" level="1" amendtag="end">implement corrective action procedures for an LEA that fails to meet data quality <ln numlevel="1" lineno="469" slineno="7-13"/>standards.</amend></subsection></subsection><subsection ssid="11-13" dnum="_-o:3-e" numlevel="1" lineno="470" slineno="7-14" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1237" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="56" style="1" owner="admin" level="1" amendtag="end">An LEA that fails to meet state data quality standards shall:</amend><subsection ssid="11-14" dnum="_-o:a-e" numlevel="1" lineno="471" slineno="7-15" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1238" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="60" style="1" owner="admin" level="1" amendtag="end">develop and implement a corrective action plan within 60 days and submit the plan <ln numlevel="1" lineno="472" slineno="7-16"/>to the state board;</amend></subsection><subsection ssid="11-15" dnum="_-o:b-e" numlevel="1" lineno="473" slineno="7-17" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1239" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="84" groupid="64" style="1" owner="admin" level="1" amendtag="end">submit monthly progress reports to the state board until compliance is achieved; and</amend></subsection><subsection ssid="11-16" dnum="_-o:c-e" numlevel="1" lineno="474" slineno="7-18" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1240" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="89" groupid="68" style="1" owner="admin" level="1" amendtag="end">as the state board determines, be subject to withholding of state funding until <ln numlevel="1" lineno="475" slineno="7-19"/>compliance is demonstrated.</amend></subsection></subsection><subsection ssid="11-17" dnum="_-o:4-e" numlevel="1" lineno="476" slineno="7-20" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1241" style="1" owner="e" level="1" amendtag="start">(4)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="71" style="1" owner="admin" level="1" amendtag="end">Notwithstanding Subsection <xref depth="4" refnumber="53G-6-213(3)">(3)</xref>, an LEA may not be subject to corrective action <ln numlevel="1" lineno="477" slineno="7-21"/>procedures or withholding of state funding under Subsection <xref depth="4" refnumber="53G-6-213(3)">(3)</xref> if the LEA's only <ln numlevel="1" lineno="478" slineno="7-22"/>failure to meet state data quality standards relates to the tracking or reporting of excused <ln numlevel="1" lineno="479" slineno="7-23"/>absences as described in Subsection <xref depth="4" refnumber="53G-6-206(8)(a)">53G-6-206(8)(a)</xref>.</amend></subsection></section></bsec><bsec buid="13" num="53G-6-214" type="enact" src="code" uid="C53G-6-S214_2026070120260701" sort="53G06 02140020260701" numlevel="1" lineno="480" slineno="8-1" sn="8"><section numlevel="1" lineno="481" slineno="8-2" number="53G-6-214" type="enact"><secline lineno="480">Section 8. Section <bold>53G-6-214</bold> is enacted to read:</secline><catline lineno="481"><bold>53G-6-214<parens/>. LEA accountability measures.</bold></catline><subsection ssid="13-1" dnum="_-o:1-e" numlevel="1" lineno="482" slineno="8-3" ea="amend" anum="0" owner="admin" style="1" level="1" placement="noreturn"><display><amend anum="0" ea="amend" pairid="1242" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="10" style="1" owner="admin" level="1" amendtag="end">An LEA shall:</amend><subsection ssid="13-2" dnum="_-o:a-e" numlevel="1" lineno="483" slineno="8-4" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1243" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="admin" level="1" amendtag="end">establish written policies and procedures for attendance tracking, intervention, and <ln numlevel="1" lineno="484" slineno="8-5"/>enforcement that comply with state law;</amend></subsection><subsection ssid="13-3" dnum="_-o:b-e" numlevel="1" lineno="485" slineno="8-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1244" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="19" groupid="15" style="1" owner="admin" level="1" amendtag="end">train all relevant staff on attendance policies and procedures annually;</amend></subsection><subsection ssid="13-5" dnum="_-o:c-e" numlevel="1" lineno="486" slineno="8-7" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1245" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="admin" level="1" amendtag="end">ensure consistent implementation of attendance policies across all schools within the <ln numlevel="1" lineno="487" slineno="8-8"/>LEA; and</amend></subsection><subsection ssid="13-6" dnum="_-o:d-e" numlevel="1" lineno="488" slineno="8-9" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1246" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="admin" level="1" amendtag="end">provide clear communication to parents and students regarding attendance <ln numlevel="1" lineno="489" slineno="8-10"/>expectations and consequences.</amend></subsection></subsection><subsection ssid="13-7" dnum="_-o:2-e" numlevel="1" lineno="490" slineno="8-11" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1247" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="38" style="1" owner="admin" level="1" amendtag="end">An LEA governing board shall:</amend><subsection ssid="13-9" dnum="_-o:a-e" numlevel="1" lineno="491" slineno="8-12" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1248" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="70" groupid="57" style="1" owner="admin" level="1" amendtag="end">review relevant attendance data;</amend></subsection><subsection ssid="13-12" dnum="_-o:b-e" numlevel="1" lineno="492" slineno="8-13" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1249" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="55" style="1" owner="admin" level="1" amendtag="end">evaluate the effectiveness of attendance interventions annually;</amend></subsection><subsection ssid="13-10" dnum="_-o:c-e" numlevel="1" lineno="493" slineno="8-14" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1250" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="58" groupid="47" style="1" owner="admin" level="1" amendtag="end">ensure adequate resources are allocated for attendance monitoring and intervention <ln numlevel="1" lineno="494" slineno="8-15"/>programs; and</amend></subsection><subsection ssid="13-11" dnum="_-o:d-e" numlevel="1" lineno="495" slineno="8-16" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1251" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="63" groupid="51" style="1" owner="admin" level="1" amendtag="end">approve any changes to attendance policies in a public meeting.</amend></subsection></subsection></section></bsec><bsec buid="35" num="53G-7-203" type="amend" src="code" uid="C53G-7-S203_2026070120260701" sort="53G07 02030020260701" numlevel="1" lineno="496" slineno="9-1" sn="9"><section number="53G-7-203" numlevel="1" lineno="497" slineno="9-2" type="amend"><secline lineno="496">Section 9. Section <bold>53G-7-203</bold> is amended to read:</secline><catline lineno="497"><bold>53G-7-203<parens/>. Kindergartens -- Establishment -- Funding -- Assessment.</bold></catline><subsection ssid="35-null-31" dnum="1-o" numlevel="1" lineno="498" slineno="9-3" level="1" placement="noreturn"><display>(1)</display>Kindergartens are an integral part of the state's public education system.</subsection><subsection ssid="35-null-32" dnum="2-o" numlevel="1" lineno="499" slineno="9-4" level="1" space="false"><display>(2)</display><subsection ssid="35-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Each LEA governing board shall provide kindergarten classes free of charge for <ln numlevel="1" lineno="500" slineno="9-5"/>kindergarten children residing within the district or attending <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="15" groupid="12" style="2" owner="admin" level="1" deltag="both">the</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="14" groupid="11" style="1" owner="admin" level="1" amendtag="both" space="true">a</amend> charter school.</subsection><subsection ssid="35-null-34" dnum="b-o" numlevel="1" lineno="501" slineno="9-6" level="2"><display>(b)</display>Each LEA governing board shall:<subsection ssid="35-null-35" dnum="i-o" numlevel="1" lineno="502" slineno="9-7" level="3"><display>(i)</display>provide a half-day kindergarten option for a student that comprises the minimum <ln numlevel="1" lineno="503" slineno="9-8"/>standards for half-day kindergarten that the state board establishes, in accordance <ln numlevel="1" lineno="504" slineno="9-9"/>with Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(iii)">(4)(a)(iii)</xref>, if the student's parent requests a half-day option;<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="13" style="2" owner="admin" level="1" deltag="both"> and</amend><amendoutend style="2"/></subsection><subsection ssid="35-null-36" dnum="ii-o" numlevel="1" lineno="505" slineno="9-10" level="3" space="false"><display>(ii)</display><subsection ssid="35-null-37" dnum="A-o" level="4" placement="sameline"><display>(A)</display>inform parents of the availability of the option to register for a designated <ln numlevel="1" lineno="506" slineno="9-11"/>full-curriculum half-day kindergarten option at the time of all kindergarten <ln numlevel="1" lineno="507" slineno="9-12"/>registration, by email, posters, or other announcements when a parent requests <ln numlevel="1" lineno="508" slineno="9-13"/>kindergarten registration; and</subsection><subsection ssid="35-null-38" dnum="B-o" numlevel="1" lineno="509" slineno="9-14" level="4"><display>(B)</display>provide the option to register for a designated half-day kindergarten option at <ln numlevel="1" lineno="510" slineno="9-15"/>the time of registration;</subsection></subsection><subsection ssid="35-null-39" dnum="iii-o" numlevel="1" lineno="511" slineno="9-16" level="3"><display>(iii)</display>provide a dedicated kindergarten class specifically designated as a half-day <ln numlevel="1" lineno="512" slineno="9-17"/>kindergarten class when enrollment of half-day kindergarten students at an <ln numlevel="1" lineno="513" slineno="9-18"/>individual school or a regional school exceeds a minimum of 18 students;</subsection><subsection ssid="35-null-40" dnum="iv-o" numlevel="1" lineno="514" slineno="9-19" level="3"><display>(iv)</display>when enrollment of half-day kindergarten students at an individual school <ln numlevel="1" lineno="515" slineno="9-20"/>exceeds a minimum of 18 students, designate the school as a half-day <ln numlevel="1" lineno="516" slineno="9-21"/>kindergarten provider for the improvement of recruiting teachers that prefer <ln numlevel="1" lineno="517" slineno="9-22"/>half-day teaching;</subsection><subsection ssid="35-null-41" dnum="v-o" numlevel="1" lineno="518" slineno="9-23" level="3"><display>(v)</display>inform parents regarding the additional educational resources and opportunities <ln numlevel="1" lineno="519" slineno="9-24"/>available to parents who select the half-day kindergarten option; and</subsection><subsection ssid="35-null-42" dnum="vi-o" numlevel="1" lineno="520" slineno="9-25" level="3"><display>(vi)</display>ensure that a half-day kindergarten student who is registered in a class that <ln numlevel="1" lineno="521" slineno="9-26"/>includes full-day kindergarten students receives instruction that at least meets the <ln numlevel="1" lineno="522" slineno="9-27"/>minimum standards for half-day kindergarten that the state board establishes, in <ln numlevel="1" lineno="523" slineno="9-28"/>accordance with Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(iii)">(4)(a)(iii)</xref>.</subsection></subsection><subsection ssid="35-null-43" dnum="c-o" numlevel="1" lineno="524" slineno="9-29" level="2"><display>(c)</display>Nothing in this Subsection <xref depth="4" refnumber="53G-7-203(2)">(2)</xref>:<subsection ssid="35-null-44" dnum="i-o" numlevel="1" lineno="525" slineno="9-30" level="3"><display>(i)</display>allows an LEA governing board to require a student to participate in a full-day <ln numlevel="1" lineno="526" slineno="9-31"/>kindergarten program;</subsection><subsection ssid="35-null-45" dnum="ii-o" numlevel="1" lineno="527" slineno="9-32" level="3"><display>(ii)</display>modifies the non-compulsory status of kindergarten under Chapter 6, Part 2, <ln numlevel="1" lineno="528" slineno="9-33"/>Compulsory Education; or</subsection><subsection ssid="35-null-46" dnum="iii-o" numlevel="1" lineno="529" slineno="9-34" level="3"><display>(iii)</display>requires a student who only attends a half day of kindergarten to participate in <ln numlevel="1" lineno="530" slineno="9-35"/>dual enrollment under Section <xref depth="3" refnumber="53G-6-702">53G-6-702</xref>.</subsection></subsection></subsection><subsection ssid="35-null-47" dnum="3-o" numlevel="1" lineno="531" slineno="9-36" level="1"><display>(3)</display>Kindergartens established under Subsection <xref depth="4" refnumber="53G-7-203(2)">(2)</xref> shall receive state money under Title <ln numlevel="1" lineno="532" slineno="9-37"/>53F, Public Education System -- Funding.</subsection><subsection ssid="35-null-48" dnum="4-o" numlevel="1" lineno="533" slineno="9-38" level="1" space="false"><display>(4)</display><subsection ssid="35-null-49" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The state board shall:<subsection ssid="35-null-50" dnum="i-o" numlevel="1" lineno="534" slineno="9-39" level="3" tab="1"><display>(i)</display>develop and collect data from a kindergarten assessment that the board selects by <ln numlevel="1" lineno="535" slineno="9-40"/>rule;</subsection><subsection ssid="35-null-51" dnum="ii-o" numlevel="1" lineno="536" slineno="9-41" level="3" tab="1"><display>(ii)</display>make rules, in accordance with Title 63G, Chapter 3, Utah Administrative <ln numlevel="1" lineno="537" slineno="9-42"/>Rulemaking Act, regarding the administration of and reporting regarding the <ln numlevel="1" lineno="538" slineno="9-43"/>assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(a)(i)">(4)(a)(i)</xref>; and</subsection><subsection ssid="35-null-52" dnum="iii-o" numlevel="1" lineno="539" slineno="9-44" level="3" tab="1"><display>(iii)</display>establish minimum standards for half-day kindergarten.</subsection></subsection><subsection ssid="35-null-53" dnum="b-o" numlevel="1" lineno="540" slineno="9-45" level="2"><display>(b)</display>An LEA shall:<subsection ssid="35-null-54" dnum="i-o" numlevel="1" lineno="541" slineno="9-46" level="3"><display>(i)</display>administer the assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(a)">(4)(a)</xref> to each kindergarten <ln numlevel="1" lineno="542" slineno="9-47"/>student; and</subsection><subsection ssid="35-null-55" dnum="ii-o" numlevel="1" lineno="543" slineno="9-48" level="3"><display>(ii)</display>report to the state board the results of the assessment described in Subsection <xref depth="4" refnumber="53G-7-203(4)(b)(i)"><ln numlevel="1" lineno="544" slineno="9-49"/>(4)(b)(i)</xref> in relation to each kindergarten student in the LEA.</subsection></subsection></subsection><subsection ssid="35-null-56" dnum="5-o" numlevel="1" lineno="545" slineno="9-50" level="1"><display>(5)</display>The state board shall require LEAs to report average daily membership for all <ln numlevel="1" lineno="546" slineno="9-51"/>kindergarten students who attend kindergarten on a schedule that is equivalent in length <ln numlevel="1" lineno="547" slineno="9-52"/>to the schedule for grades 1 through 3 with the October 1 data described in Section <xref depth="3" refnumber="53F-2-302"><ln numlevel="1" lineno="548" slineno="9-53"/>53F-2-302</xref>.</subsection><subsection ssid="35-null-57" dnum="6-o:_-e" numlevel="1" lineno="549" slineno="9-54" ea="erase" anum="0" owner="admin" style="2" level="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1278" style="2" owner="o" level="1" deltag="start">(6)</amend></display><amend anum="0" ea="erase" pairid="8" groupid="5" style="2" owner="admin" level="1" deltag="end">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the <ln numlevel="1" lineno="550" slineno="9-55"/>state board shall make rules to:</amend><amendoutend style="2"/><subsection ssid="35-null-58" dnum="a-o:_-e" numlevel="1" lineno="551" slineno="9-56" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1279" style="2" owner="o" level="1" deltag="start">(a)</amend></display><amend anum="0" ea="erase" pairid="9" groupid="6" style="2" owner="admin" level="1" deltag="end">beginning with the 2025-2026 school year, require a student to be toilet trained <ln numlevel="1" lineno="552" slineno="9-57"/>before being enrolled in public school;</amend><amendoutend style="2"/></subsection><subsection ssid="35-null-59" dnum="b-o:_-e" numlevel="1" lineno="553" slineno="9-58" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1280" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="10" groupid="7" style="2" owner="admin" level="1" deltag="end">establish requirements for an LEA's enrollment process to include assurances from a <ln numlevel="1" lineno="554" slineno="9-59"/>parent that the parent's student is toilet trained; and</amend><amendoutend style="2"/></subsection><subsection ssid="35-null-60" dnum="c-o:_-e" numlevel="1" lineno="555" slineno="9-60" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1281" style="2" owner="o" level="1" deltag="start">(c)</amend></display><amend anum="0" ea="erase" pairid="11" groupid="8" style="2" owner="admin" level="1" deltag="end">create exemptions from the requirement in Subsection (6)(a) for a student who is not <ln numlevel="1" lineno="556" slineno="9-61"/>able to be toilet trained before enrolling because of a condition that is subject to <ln numlevel="1" lineno="557" slineno="9-62"/>federal child find requirements or described in an IEP or Section 504 accommodation <ln numlevel="1" lineno="558" slineno="9-63"/>plan.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="36" num="53G-7-228" type="enact" src="code" uid="C53G-7-S228_2026070120260701" sort="53G07 02280020260701" numlevel="1" lineno="559" slineno="10-1" sn="10"><section numlevel="1" lineno="560" slineno="10-2" number="53G-7-228" type="enact"><secline lineno="559">Section 10. Section <bold>53G-7-228</bold> is enacted to read:</secline><catline lineno="560"><bold>53G-7-228<parens/>. Personal care independence standards -- School enrollment.</bold></catline><sectionText lineno="561"><para/><amend anum="0" ea="amend" pairid="11" groupid="6" style="1" owner="admin" level="1" amendtag="both">In accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, the state <ln numlevel="1" lineno="562" slineno="10-4"/>board shall make rules to:</amend></sectionText><subsection ssid="36-null-8" dnum="_-o:1-e" numlevel="1" lineno="563" slineno="10-5" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1282" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="13" groupid="7" style="1" owner="admin" level="1" amendtag="end">beginning with the 2026-2027 school year, require a student to demonstrate personal <ln numlevel="1" lineno="564" slineno="10-6"/>care independence by being toilet trained before being enrolled in a public school;</amend></subsection><subsection ssid="36-null-9" dnum="_-o:2-e" numlevel="1" lineno="565" slineno="10-7" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1283" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="21" groupid="12" style="1" owner="admin" level="1" amendtag="end">establish requirements for an LEA's enrollment process to include assurances from a <ln numlevel="1" lineno="566" slineno="10-8"/>parent that the parent's student meets the personal care independence requirements <ln numlevel="1" lineno="567" slineno="10-9"/>described in Subsection <xref depth="4" refnumber="53G-7-228(1)">(1)</xref>; and</amend></subsection><subsection ssid="36-null-10" dnum="_-o:3-e" numlevel="1" lineno="568" slineno="10-10" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1284" style="1" owner="e" level="1" amendtag="start">(3)</amend></display><amend anum="0" ea="amend" pairid="26" groupid="16" style="1" owner="admin" level="1" amendtag="end">create exemptions from the requirement in Subsection <xref depth="4" refnumber="53G-7-228(1)">(1)</xref> for a student who is not able <ln numlevel="1" lineno="569" slineno="10-11"/>to meet personal care independence requirements because of a condition that is subject <ln numlevel="1" lineno="570" slineno="10-12"/>to federal child find requirements found in Section 20 U.S.C. 1412(a)(3), Individuals <ln numlevel="1" lineno="571" slineno="10-13"/>with Disabilities Education Act, and 34 C.F.R.
