Section <bold>81-4-501</bold> is amended to read:</secline><catline lineno="27"><bold>81-4-501<parens/>. Definitions for part.</bold></catline><sectionText lineno="28"><para/>As used in this part:</sectionText><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="29" slineno="1-4" level="1"><display>(1)</display>"Child support guidelines" means the same as that term is defined in Section <xref depth="3" refnumber="81-6-101">81-6-101</xref>.</subsection><subsection ssid="7-null-2" dnum="2-o" numlevel="1" lineno="30" slineno="1-5" level="1"><display>(2)</display>"Cohabit" means to live together, or to reside together on a regular basis, in the same <ln numlevel="1" lineno="31" slineno="1-6"/>residence and in a relationship of a romantic or sexual nature.</subsection><subsection ssid="7-null-3" dnum="3-o" numlevel="1" lineno="32" slineno="1-7" level="1"><display>(3)</display>"Fault" means any of the following wrongful conduct during the marriage that <ln numlevel="1" lineno="33" slineno="1-8"/>substantially contributed to the breakup of the marriage:<subsection ssid="7-null-4" dnum="a-o" numlevel="1" lineno="34" slineno="1-9" level="2"><display>(a)</display>engaging in sexual relations with an individual other than the party's spouse;</subsection><subsection ssid="7-null-5" dnum="b-o" numlevel="1" lineno="35" slineno="1-10" level="2"><display>(b)</display>knowingly and intentionally causing or attempting to cause physical harm to the <ln numlevel="1" lineno="36" slineno="1-11"/>other party or a minor child;</subsection><subsection ssid="7-null-6" dnum="c-o" numlevel="1" lineno="37" slineno="1-12" level="2"><display>(c)</display>knowingly and intentionally causing the other party or a minor child to reasonably <ln numlevel="1" lineno="38" slineno="1-13"/>fear life-threatening harm; or</subsection><subsection ssid="7-null-7" dnum="d-o" numlevel="1" lineno="39" slineno="1-14" level="2"><display>(d)</display>substantially undermining the financial stability of the other party or the minor child.</subsection></subsection><subsection ssid="7-null-8" dnum="4-o" numlevel="1" lineno="40" slineno="1-15" level="1"><display>(4)</display>"Length of the marriage" means, <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="admin" level="1" deltag="both">for purposes of alimony</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">except as provided in <ln numlevel="1" lineno="41" slineno="1-16"/>Subsection <xref depth="4" refnumber="81-4-502(8)">81-4-502(8)</xref></amend>, the number of years from the day on which the parties are <ln numlevel="1" lineno="42" slineno="1-17"/>legally married to the day on which the petition for divorce is filed with the court.</subsection><subsection ssid="7-null-9" dnum="5-o" numlevel="1" lineno="43" slineno="1-18" level="1"><display>(5)</display>"Payee" means the party who is or would receive alimony from the other party.</subsection><subsection ssid="7-null-10" dnum="6-o" numlevel="1" lineno="44" slineno="1-19" level="1"><display>(6)</display>"Payor" means the party who is paying, or would pay, alimony to the other party.</subsection><subsection ssid="7-null-11" dnum="7-o" numlevel="1" lineno="45" slineno="1-20" level="1"><display>(7)</display>"Temporary alimony" means money that the court orders a party to pay during the <ln numlevel="1" lineno="46" slineno="1-21"/>pendency of an action under this chapter for the support and maintenance of a party as <ln numlevel="1" lineno="47" slineno="1-22"/>described in Subsection <xref depth="3" refnumber="81-1-203">81-1-203</xref>(4).</subsection></section></bsec><bsec buid="3" num="81-4-502" type="amend" src="code" uid="C81-4-S502_1800010118000101" sort="81 04 05020018000101" numlevel="1" lineno="48" slineno="2-1" sn="2"><section number="81-4-502" numlevel="1" lineno="49" slineno="2-2" type="amend"><secline lineno="48">Section 2. Section <bold>81-4-502</bold> is amended to read:</secline><catline lineno="49"><bold>81-4-502<parens/>. Determination of alimony.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="50" slineno="2-3" level="1" placement="noreturn"><display>(1)</display>For a proceeding under Chapter 4, Dissolution of Marriage, or in a proceeding to <ln numlevel="1" lineno="51" slineno="2-4"/>modify alimony, the court shall consider at least the following factors in determining <ln numlevel="1" lineno="52" slineno="2-5"/>alimony:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="53" slineno="2-6" level="2"><display>(a)</display>the standard of living existing during the marriage, which factors shall include the <ln numlevel="1" lineno="54" slineno="2-7"/>following:<subsection ssid="3-null-3" dnum="i-o" numlevel="1" lineno="55" slineno="2-8" level="3"><display>(i)</display>income;</subsection><subsection ssid="3-null-4" dnum="ii-o" numlevel="1" lineno="56" slineno="2-9" level="3"><display>(ii)</display>the approximate value of real and personal property; and</subsection><subsection ssid="3-null-5" dnum="iii-o" numlevel="1" lineno="57" slineno="2-10" level="3"><display>(iii)</display>any other factor that the court determines to be appropriate to enable the court to <ln numlevel="1" lineno="58" slineno="2-11"/>make a determination of the standard of living existing during the marriage;</subsection></subsection><subsection ssid="3-null-6" dnum="b-o" numlevel="1" lineno="59" slineno="2-12" level="2"><display>(b)</display>the financial condition and needs of the payee, provided that the payee may show <ln numlevel="1" lineno="60" slineno="2-13"/>financial needs by itemizing expenses present during the marriage rather than by <ln numlevel="1" lineno="61" slineno="2-14"/>itemizing post petition expenses;</subsection><subsection ssid="3-null-7" dnum="c-o" numlevel="1" lineno="62" slineno="2-15" level="2"><display>(c)</display>the payee's earning capacity or ability to produce income, including the impact of <ln numlevel="1" lineno="63" slineno="2-16"/>diminished workplace experience resulting from primarily caring for a minor child of <ln numlevel="1" lineno="64" slineno="2-17"/>the payor;</subsection><subsection ssid="3-null-8" dnum="d-o" numlevel="1" lineno="65" slineno="2-18" level="2"><display>(d)</display>the ability of the payor to provide support;</subsection><subsection ssid="3-37" dnum="_-o:e-e" numlevel="1" lineno="66" slineno="2-19" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="end">the tax consequences of alimony on each party;</amend></subsection><subsection ssid="3-null-9" dnum="e-o:f-e" numlevel="1" lineno="67" slineno="2-20" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1020" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="both" space="true">(f)</amend></display>the length of the marriage;</subsection><subsection ssid="3-null-10" dnum="f-o:g-e" numlevel="1" lineno="68" slineno="2-21" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1021" style="2" owner="o" level="1" deltag="both">(f)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1" amendtag="both" space="true">(g)</amend></display>whether the payee has custody of a minor child requiring support;</subsection><subsection ssid="3-null-11" dnum="g-o:h-e" numlevel="1" lineno="69" slineno="2-22" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1022" style="2" owner="o" level="1" deltag="both">(g)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1023" style="1" owner="e" level="1" amendtag="both" space="true">(h)</amend></display>whether the payee worked in a business owned or operated by the payor; and</subsection><subsection ssid="3-null-12" dnum="h-o:i-e" numlevel="1" lineno="70" slineno="2-23" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1023" style="2" owner="o" level="1" deltag="both">(h)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1024" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>whether the payee directly contributed to any increase in the payor's skill by <ln numlevel="1" lineno="71" slineno="2-24"/>paying for education received by the payor or enabling the payor to attend school <ln numlevel="1" lineno="72" slineno="2-25"/>during the marriage.</subsection></subsection><subsection ssid="3-null-13" dnum="2-o" numlevel="1" lineno="73" slineno="2-26" level="1" space="false"><display>(2)</display><subsection ssid="3-null-14" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court may consider the fault of the parties in determining whether to award <ln numlevel="1" lineno="74" slineno="2-27"/>alimony and the terms of the alimony.</subsection><subsection ssid="3-null-15" dnum="b-o" numlevel="1" lineno="75" slineno="2-28" level="2"><display>(b)</display>The court may, when fault is at issue, close the proceedings and seal the court <ln numlevel="1" lineno="76" slineno="2-29"/>records.</subsection></subsection><subsection ssid="3-null-16" dnum="3-o" numlevel="1" lineno="77" slineno="2-30" level="1" space="false"><display>(3)</display><subsection ssid="3-null-17" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as otherwise provided by this section, the court shall consider the standard <ln numlevel="1" lineno="78" slineno="2-31"/>of living, existing at the time of separation, in determining alimony in accordance <ln numlevel="1" lineno="79" slineno="2-32"/>with this section.</subsection><subsection ssid="3-null-18" dnum="b-o" numlevel="1" lineno="80" slineno="2-33" level="2"><display>(b)</display>In considering all relevant facts and principles, the court may, in the court's <ln numlevel="1" lineno="81" slineno="2-34"/>discretion, base alimony on the standard of living that existed at the time of trial.</subsection></subsection><subsection ssid="3-null-19" dnum="4-o" numlevel="1" lineno="82" slineno="2-35" level="1" space="false"><display>(4)</display><subsection ssid="3-null-20" dnum="a-o" level="2" placement="sameline"><display>(a)</display>The court may attempt to equalize the parties' respective standards of living.</subsection><subsection ssid="3-null-21" dnum="b-o" numlevel="1" lineno="83" slineno="2-36" level="2" space="false"><display>(b)</display><subsection ssid="3-null-22" dnum="i-o" level="3" placement="sameline"><display>(i)</display>If a marriage has been in effect for 10 years or more, and if the payee has <ln numlevel="1" lineno="84" slineno="2-37"/>significantly diminished workplace experience resulting from an agreement <ln numlevel="1" lineno="85" slineno="2-38"/>between the spouses that the payee reduce the payee's workplace experience to <ln numlevel="1" lineno="86" slineno="2-39"/>care for a minor child of the payor, it shall be the rebuttable presumption that the <ln numlevel="1" lineno="87" slineno="2-40"/>court equalize the parties' standard of living.</subsection><subsection ssid="3-null-23" dnum="ii-o" numlevel="1" lineno="88" slineno="2-41" level="3"><display>(ii)</display>The presumption under Subsection <xref depth="4" refnumber="81-4-502(4)(b)(i)">(4)(b)(i)</xref> can be rebutted by a showing of good <ln numlevel="1" lineno="89" slineno="2-42"/>cause, and the court shall enter specific findings of fact as to the evidentiary basis <ln numlevel="1" lineno="90" slineno="2-43"/>for its determination.</subsection></subsection><subsection ssid="3-null-24" dnum="c-o" numlevel="1" lineno="91" slineno="2-44" level="2"><display>(c)</display>This Subsection <xref depth="4" refnumber="81-4-502(4)">(4)</xref> may not be applied to or used as the basis to modify an alimony <ln numlevel="1" lineno="92" slineno="2-45"/>award if the petition for divorce was filed before May 1, 2024.</subsection></subsection><subsection ssid="3-null-25" dnum="5-o" numlevel="1" lineno="93" slineno="2-46" level="1" space="false"><display>(5)</display><subsection ssid="3-null-26" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If the marriage is short in duration and a minor child has not been conceived or <ln numlevel="1" lineno="94" slineno="2-47"/>born during the marriage, the court may consider the standard of living that existed at <ln numlevel="1" lineno="95" slineno="2-48"/>the time of the marriage.</subsection><subsection ssid="3-null-27" dnum="b-o" numlevel="1" lineno="96" slineno="2-49" level="2"><display>(b)</display>In determining alimony when a marriage of short duration dissolves and a minor <ln numlevel="1" lineno="97" slineno="2-50"/>child has not been conceived or born during the marriage, the court may consider <ln numlevel="1" lineno="98" slineno="2-51"/>restoring each party to the condition which existed at the time of the marriage.</subsection></subsection><subsection ssid="3-null-28" dnum="6-o" numlevel="1" lineno="99" slineno="2-52" level="1" space="false"><display>(6)</display><subsection ssid="3-null-29" dnum="a-o" level="2" placement="sameline"><display>(a)</display>When a marriage of long duration dissolves on the threshold of a major change in <ln numlevel="1" lineno="100" slineno="2-53"/>the income of one of the parties due to the collective efforts of both parties, the court <ln numlevel="1" lineno="101" slineno="2-54"/>shall consider the change when dividing the marital property and in determining the <ln numlevel="1" lineno="102" slineno="2-55"/>amount of alimony.</subsection><subsection ssid="3-null-30" dnum="b-o" numlevel="1" lineno="103" slineno="2-56" level="2"><display>(b)</display>If a party's earning capacity has been greatly enhanced through the efforts of both <ln numlevel="1" lineno="104" slineno="2-57"/>parties during the marriage, the court may make a compensating adjustment in <ln numlevel="1" lineno="105" slineno="2-58"/>dividing the marital property and awarding alimony.</subsection></subsection><subsection ssid="3-null-31" dnum="7-o" numlevel="1" lineno="106" slineno="2-59" level="1" space="false"><display>(7)</display><subsection ssid="3-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="81-4-502(7)(c)">(7)(c)</xref>, the court may not order alimony for a <ln numlevel="1" lineno="107" slineno="2-60"/>period of time longer than the length of the marriage.</subsection><subsection ssid="3-null-33" dnum="b-o" numlevel="1" lineno="108" slineno="2-61" level="2"><display>(b)</display>If a party is ordered to pay temporary alimony during the pendency of a divorce <ln numlevel="1" lineno="109" slineno="2-62"/>action, the court shall count the period of time that the party pays temporary alimony <ln numlevel="1" lineno="110" slineno="2-63"/>towards the period of time for which the party is ordered to pay alimony.</subsection><subsection ssid="3-null-34" dnum="c-o" numlevel="1" lineno="111" slineno="2-64" level="2"><display>(c)</display>At any time before the termination of alimony, the court may find extenuating <ln numlevel="1" lineno="112" slineno="2-65"/>circumstances or good cause that justify the payment of alimony for a longer period <ln numlevel="1" lineno="113" slineno="2-66"/>of time than the length of the marriage.</subsection></subsection><subsection ssid="3-40" dnum="_-o:8-e" numlevel="1" lineno="114" slineno="2-67" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="e" level="1" amendtag="start">(8)</amend></display><subsection ssid="3-61" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="35" groupid="25" style="1" owner="admin" level="1" amendtag="end">If the parties to the divorce action were previously married to each other, <ln numlevel="1" lineno="115" slineno="2-68"/>divorced, and then remarried each other, the court shall consider the aggregate of the <ln numlevel="1" lineno="116" slineno="2-69"/>two marriages as the length of the marriage under Subsection (7)(a) if:</amend><subsection ssid="3-63" dnum="_-o:i-e" numlevel="1" lineno="117" slineno="2-70" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1048" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="41" groupid="29" style="1" owner="admin" level="1" amendtag="end">the parties are seeking a divorce for the subsequent marriage; and</amend></subsection><subsection ssid="3-64" dnum="_-o:ii-e" numlevel="1" lineno="118" slineno="2-71" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1049" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="31" style="1" owner="admin" level="1" amendtag="end">the petition for divorce for the subsequent marriage was filed on or after January <ln numlevel="1" lineno="119" slineno="2-72"/>1, 2026.</amend></subsection></subsection><subsection ssid="3-65" dnum="_-o:b-e" numlevel="1" lineno="120" slineno="2-73" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1050" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="47" groupid="33" style="1" owner="admin" level="1" amendtag="end">The aggregate of the two marriages described in Subsection (8)(a):</amend><subsection ssid="3-66" dnum="_-o:i-e" numlevel="1" lineno="121" slineno="2-74" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1051" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="50" groupid="35" style="1" owner="admin" level="1" amendtag="end">is the sum of:</amend><subsection ssid="3-67" dnum="_-o:A-e" numlevel="1" lineno="122" slineno="2-75" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1052" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="53" groupid="37" style="1" owner="admin" level="1" amendtag="end">the length of time beginning on the day that the parties first married and <ln numlevel="1" lineno="123" slineno="2-76"/>ending on the day that one of the parties filed the petition for divorce in the <ln numlevel="1" lineno="124" slineno="2-77"/>prior divorce action; and</amend></subsection><subsection ssid="3-68" dnum="_-o:B-e" numlevel="1" lineno="125" slineno="2-78" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1053" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="56" groupid="39" style="1" owner="admin" level="1" amendtag="end">the length of time beginning on the day that the parties remarried and ending <ln numlevel="1" lineno="126" slineno="2-79"/>on the day that one of the parties filed the petition for divorce in the current <ln numlevel="1" lineno="127" slineno="2-80"/>divorce action; and</amend></subsection></subsection><subsection ssid="3-69" dnum="_-o:ii-e" numlevel="1" lineno="128" slineno="2-81" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1054" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="59" groupid="41" style="1" owner="admin" level="1" amendtag="end">does not include the time period between the day that a party filed the petition for <ln numlevel="1" lineno="129" slineno="2-82"/>divorce in the prior divorce action and the day on which the parties remarried.</amend></subsection></subsection><subsection ssid="3-71" dnum="_-o:c-e" numlevel="1" lineno="130" slineno="2-83" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1055" style="1" owner="e" level="1" amendtag="start">(c)</amend></display><amend anum="0" ea="amend" pairid="65" groupid="45" style="1" owner="admin" level="1" amendtag="end">A court may decline to consider the aggregate of the two marriages as the length of <ln numlevel="1" lineno="131" slineno="2-84"/>the marriage if the court finds, by a preponderance of the evidence, that aggregating <ln numlevel="1" lineno="132" slineno="2-85"/>the two marriages would be inequitable.</amend></subsection><subsection ssid="3-72" dnum="_-o:d-e" numlevel="1" lineno="133" slineno="2-86" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1056" style="1" owner="e" level="1" amendtag="start">(d)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="47" style="1" owner="admin" level="1" amendtag="end">This Subsection (8) does not:</amend><subsection ssid="3-73" dnum="_-o:i-e" numlevel="1" lineno="134" slineno="2-87" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1057" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="71" groupid="49" style="1" owner="admin" level="1" amendtag="end">reopen, modify, or affect the finality of the prior divorce; or</amend></subsection><subsection ssid="3-74" dnum="_-o:ii-e" numlevel="1" lineno="135" slineno="2-88" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1058" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="51" style="1" owner="admin" level="1" amendtag="end">alter the division of property, debts, or obligations in the prior divorce.</amend></subsection></subsection></subsection></section></bsec><bsec buid="5" num="81-4-504" type="amend" src="code" uid="C81-4-S504_1800010118000101" sort="81 04 05040018000101" numlevel="1" lineno="136" slineno="3-1" sn="3"><section number="81-4-504" numlevel="1" lineno="137" slineno="3-2" type="amend"><secline lineno="136">Section 3. Section <bold>81-4-504</bold> is amended to read:</secline><catline lineno="137"><bold>81-4-504<parens/>. Modification of alimony after divorce decree.</bold></catline><subsection ssid="5-null-1" dnum="1-o" numlevel="1" lineno="138" slineno="3-3" level="1" placement="noreturn"><display>(1)</display>The court has continuing jurisdiction to make substantive changes and new orders <ln numlevel="1" lineno="139" slineno="3-4"/>regarding alimony based on a substantial material change in circumstances not expressly <ln numlevel="1" lineno="140" slineno="3-5"/>stated in the divorce decree or in the findings that the court entered at the time of the <ln numlevel="1" lineno="141" slineno="3-6"/>divorce decree.</subsection><subsection ssid="5-null-2" dnum="2-o" numlevel="1" lineno="142" slineno="3-7" level="1" space="false"><display>(2)</display><subsection ssid="5-null-3" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A party's retirement is a substantial material change in circumstances that is <ln numlevel="1" lineno="143" slineno="3-8"/>subject to a petition to modify alimony, unless the divorce decree, or the findings that <ln numlevel="1" lineno="144" slineno="3-9"/>the court entered at the time of the divorce decree, expressly states otherwise.</subsection><subsection ssid="5-null-4" dnum="b-o" numlevel="1" lineno="145" slineno="3-10" level="2"><display>(b)</display>Subsection <xref depth="4" refnumber="81-4-504(2)(a)">(2)(a)</xref> applies to a divorce decree <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">regardless of the date on which the <ln numlevel="1" lineno="146" slineno="3-11"/>divorce decree was </amend><amendoutend style="2"/>entered<amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both"> on or after May 12, 2020</amend>.</subsection></subsection><subsection ssid="5-null-5" dnum="3-o" numlevel="1" lineno="147" slineno="3-12" level="1"><display>(3)</display>The court may not modify alimony or issue a new order for alimony to address needs of <ln numlevel="1" lineno="148" slineno="3-13"/>the recipient that did not exist at the time the decree was entered, unless the court finds <ln numlevel="1" lineno="149" slineno="3-14"/>extenuating circumstances that justify that action.</subsection><subsection ssid="5-null-6" dnum="4-o" numlevel="1" lineno="150" slineno="3-15" level="1"><display>(4)</display>In modifying the amount of alimony, the court may not consider the income of any <ln numlevel="1" lineno="151" slineno="3-16"/>subsequent spouse of the payor, except that the court may consider:<subsection ssid="5-null-7" dnum="a-o" numlevel="1" lineno="152" slineno="3-17" level="2"><display>(a)</display>the subsequent spouse's financial ability to share living expenses; or</subsection><subsection ssid="5-null-8" dnum="b-o" numlevel="1" lineno="153" slineno="3-18" level="2"><display>(b)</display>the income of a subsequent spouse if the court finds that the payor's improper <ln numlevel="1" lineno="154" slineno="3-19"/>conduct justifies that consideration.</subsection></subsection></section></bsec><bsec buid="1" num="81-4-505" type="amend" src="code" uid="C81-4-S505_1800010118000101" sort="81 04 05050018000101" numlevel="1" lineno="155" slineno="4-1" sn="4"><section number="81-4-505" numlevel="1" lineno="156" slineno="4-2" type="amend"><secline lineno="155">Section 4. Section <bold>81-4-505</bold> is amended to read:</secline><catline lineno="156"><bold>81-4-505<parens/>. Termination of alimony.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="157" slineno="4-3" level="1" placement="noreturn" space="false"><display>(1)</display><subsection ssid="1-null-2" dnum="a-o" level="2" placement="sameline"><display>(a)</display>Except as provided in Subsection <xref depth="4" refnumber="81-4-505(1)(b)">(1)(b)</xref>, or unless a decree of divorce specifically <ln numlevel="1" lineno="158" slineno="4-4"/>provides otherwise, any order of the court that a payor pay alimony to a payee <ln numlevel="1" lineno="159" slineno="4-5"/>automatically terminates upon the remarriage or death of that payee.</subsection><subsection ssid="1-null-3" dnum="b-o" numlevel="1" lineno="160" slineno="4-6" level="2"><display>(b)</display>If the remarriage of the payee is annulled and found to be void ab initio, the payment <ln numlevel="1" lineno="161" slineno="4-7"/>of alimony shall resume if the payor is made a party to the action of annulment and <ln numlevel="1" lineno="162" slineno="4-8"/>the payor's rights are determined.</subsection></subsection><subsection ssid="1-null-4" dnum="2-o" numlevel="1" lineno="163" slineno="4-9" level="1" space="false"><display>(2)</display><subsection ssid="1-15" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1071" style="1" owner="e" level="1" amendtag="both">(a)</amend></display>If a payor establishes that a payee cohabits with another individual during the <ln numlevel="1" lineno="164" slineno="4-10"/>pendency of the divorce action<amend anum="0" ea="amend" pairid="10" groupid="9" style="1" owner="admin" level="1" amendtag="both"> or after the court enters a divorce decree</amend>, the court:<subsection ssid="1-null-5" dnum="a-o:i-e" numlevel="1" lineno="165" slineno="4-11" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1072" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1073" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>may not order the payor to pay <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="4" groupid="5" style="2" owner="admin" level="1" deltag="both">temporary </amend><amendoutend style="2"/>alimony<amend anum="0" ea="amend" pairid="2" groupid="3" style="1" owner="admin" level="1" amendtag="both">, including temporary <ln numlevel="1" lineno="166" slineno="4-12"/>alimony,</amend> to the payee; and</subsection><subsection ssid="1-null-6" dnum="b-o:ii-e" numlevel="1" lineno="167" slineno="4-13" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1073" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1074" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>shall terminate any order that the payor pay <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="6" style="2" owner="admin" level="1" deltag="both">temporary </amend><amendoutend style="2"/>alimony<amend anum="0" ea="amend" pairid="3" groupid="4" style="1" owner="admin" level="1" amendtag="both">, including <ln numlevel="1" lineno="168" slineno="4-14"/>temporary alimony,</amend> to the payee<amend anum="0" ea="amend" pairid="45" groupid="36" style="1" owner="admin" level="1" amendtag="both">, even if the payee is not cohabiting with the <ln numlevel="1" lineno="169" slineno="4-15"/>individual when the payor files the motion to terminate alimony</amend>.</subsection></subsection><subsection ssid="1-17" dnum="_-o:b-e" numlevel="1" lineno="170" slineno="4-16" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1074" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="27" groupid="21" style="1" owner="admin" level="1" amendtag="end">A payor may not seek termination of alimony under Subsection <xref tempid="1066">(2)(a)(ii)</xref> later than <ln numlevel="1" lineno="171" slineno="4-17"/>one year after the day on which the payor knew or should have known that the payee <ln numlevel="1" lineno="172" slineno="4-18"/>has cohabited with another individual.</amend></subsection></subsection><subsection ssid="1-null-7" dnum="3-o:_-e" numlevel="1" lineno="173" slineno="4-19" ea="erase" anum="0" owner="admin" style="2" level="1" space="false"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1075" style="2" owner="o" level="1" deltag="start">(3)</amend></display><subsection ssid="1-null-8" dnum="a-o:_-e" ea="erase" anum="0" owner="admin" style="2" level="2" placement="sameline"><display><amend anum="0" ea="erase" pairid="1076" style="2" owner="o" level="1">(a)</amend></display><amend anum="0" ea="erase" pairid="50" groupid="39" style="2" owner="admin" level="1" deltag="end">Subject to Subsection (3)(b), the court shall terminate an order that a payor pay <ln numlevel="1" lineno="174" slineno="4-20"/>alimony to a payee if the payor establishes that, after the order for alimony is issued, <ln numlevel="1" lineno="175" slineno="4-21"/>the payee cohabits with another individual even if the payee is not cohabiting with <ln numlevel="1" lineno="176" slineno="4-22"/>the individual when the payor files the motion to terminate alimony.</amend><amendoutend style="2"/></subsection><subsection ssid="1-null-9" dnum="b-o:_-e" numlevel="1" lineno="177" slineno="4-23" ea="erase" anum="0" owner="admin" style="2" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1077" style="2" owner="o" level="1" deltag="start">(b)</amend></display><amend anum="0" ea="erase" pairid="51" groupid="40" style="2" owner="admin" level="1" deltag="end">A payor may not seek termination of alimony under Subsection (3)(a) later than one <ln numlevel="1" lineno="178" slineno="4-24"/>year after the day on which the payor knew or should have known that the payee has <ln numlevel="1" lineno="179" slineno="4-25"/>cohabited with another individual.</amend><amendoutend style="2"/></subsection></subsection></section></bsec><bsec buid="9" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="180" slineno="5-1" sn="5"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="180">Section 5.  <bold>Effective Date.</bold></secline><sectionText lineno="181"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="9-1" dnum="_-o:1-e" numlevel="1" lineno="182" slineno="5-3" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1078" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" m-anum="0" m-ea="amend" m-pairid="6" m-groupid="5" m-style="1" m-owner="admin" m-level="1" amendtag="end">except as provided in Subsection (2), <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>;
