Section <bold>53E-4-307</bold> is amended to read:</secline><catline lineno="34"><bold>53E-4-307<parens/>. Benchmark assessments in reading -- Report to parent.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="35" slineno="1-3" level="1" placement="noreturn"><display>(1)</display>As used in this section:<subsection ssid="3-null-2" dnum="a-o" numlevel="1" lineno="36" slineno="1-4" level="2"><display>(a)</display>"Competency" means a demonstrable acquisition of a specified knowledge, skill, or <ln numlevel="1" lineno="37" slineno="1-5"/>ability that has been organized into a hierarchical arrangement leading to higher <ln numlevel="1" lineno="38" slineno="1-6"/>levels of knowledge, skill, or ability.</subsection><subsection ssid="3-42" dnum="_-o:b-e" numlevel="1" lineno="39" slineno="1-7" ea="amend" anum="0" owner="admin" style="1" level="2" space="false"><display><amend anum="0" ea="amend" pairid="1002" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><subsection ssid="3-44" dnum="_-o:i-e" ea="amend" anum="0" owner="admin" style="1" level="3" placement="sameline"><display><amend anum="0" ea="amend" pairid="1003" style="1" owner="e" level="1">(i)</amend></display><amend anum="0" ea="amend" pairid="61" groupid="47" style="1" owner="admin" level="1" amendtag="end">"Diagnosis" means a formal determination that an individual has dyslexia based <ln numlevel="1" lineno="40" slineno="1-8"/>on a comprehensive evaluation conducted by a qualified professional acting <ln numlevel="1" lineno="41" slineno="1-9"/>within the scope of the professional's license or credentials.</amend></subsection><subsection ssid="3-43" dnum="_-o:ii-e" numlevel="1" lineno="42" slineno="1-10" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1004" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="69" groupid="54" style="1" owner="admin" level="1" amendtag="end">"Diagnosis" does not mean:</amend><subsection ssid="3-45" dnum="_-o:A-e" numlevel="1" lineno="43" slineno="1-11" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1005" style="1" owner="e" level="1" amendtag="start">(A)</amend></display><amend anum="0" ea="amend" pairid="68" groupid="53" style="1" owner="admin" level="1" amendtag="end">screening;</amend></subsection><subsection ssid="3-46" dnum="_-o:B-e" numlevel="1" lineno="44" slineno="1-12" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1006" style="1" owner="e" level="1" amendtag="start">(B)</amend></display><amend anum="0" ea="amend" pairid="74" groupid="58" style="1" owner="admin" level="1" amendtag="end">a recommendation from an educational professional to screen a student for <ln numlevel="1" lineno="45" slineno="1-13"/>dyslexia; or</amend></subsection><subsection ssid="3-47" dnum="_-o:C-e" numlevel="1" lineno="46" slineno="1-14" ea="amend" anum="0" owner="admin" style="1" level="4"><display><amend anum="0" ea="amend" pairid="1007" style="1" owner="e" level="1" amendtag="start">(C)</amend></display><amend anum="0" ea="amend" pairid="79" groupid="62" style="1" owner="admin" level="1" amendtag="end">results from a diagnostic assessment.</amend></subsection></subsection></subsection><subsection ssid="3-null-3" dnum="b-o:c-e" numlevel="1" lineno="47" slineno="1-15" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1008" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1009" style="1" owner="e" level="1" amendtag="both" space="true">(c)</amend></display>"Diagnostic assessment" means an assessment that measures key literacy skills, <ln numlevel="1" lineno="48" slineno="1-16"/>including phonemic awareness, sound-symbol recognition, alphabet knowledge, <ln numlevel="1" lineno="49" slineno="1-17"/>decoding and encoding skills, and comprehension, to determine a student's specific <ln numlevel="1" lineno="50" slineno="1-18"/>strengths and weaknesses in a skill area.</subsection><subsection ssid="3-null-4" dnum="c-o:d-e" numlevel="1" lineno="51" slineno="1-19" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1009" style="2" owner="o" level="1" deltag="both">(c)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1010" style="1" owner="e" level="1" amendtag="both" space="true">(d)</amend></display>"Dyslexia" means a learning disorder that:<subsection ssid="3-null-5" dnum="i-o" numlevel="1" lineno="52" slineno="1-20" level="3"><display>(i)</display>is neurological in origin and is characterized by difficulties with:<subsection ssid="3-null-6" dnum="A-o" numlevel="1" lineno="53" slineno="1-21" level="4"><display>(A)</display>accurate or fluent word recognition; and</subsection><subsection ssid="3-null-7" dnum="B-o" numlevel="1" lineno="54" slineno="1-22" level="4"><display>(B)</display>poor spelling and decoding abilities; and</subsection></subsection><subsection ssid="3-null-8" dnum="ii-o" numlevel="1" lineno="55" slineno="1-23" level="3"><display>(ii)</display>typically results from a deficit in the phonological component of language that is <ln numlevel="1" lineno="56" slineno="1-24"/>often unexpected in relation to other cognitive abilities and the provision of <ln numlevel="1" lineno="57" slineno="1-25"/>effective classroom instruction.</subsection></subsection><subsection ssid="3-38" dnum="_-o:e-e" numlevel="1" lineno="58" slineno="1-26" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1014" style="1" owner="e" level="1" amendtag="start">(e)</amend></display><amend anum="0" ea="amend" pairid="29" groupid="23" style="1" owner="admin" level="1" amendtag="end">"Dyslexia assessment" means a diagnostic assessment for the identification of <ln numlevel="1" lineno="59" slineno="1-27"/>dyslexia or a psychoeducational evaluation for the diagnosis of dyslexia.</amend></subsection><subsection ssid="3-null-9" dnum="d-o:f-e" numlevel="1" lineno="60" slineno="1-28" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1015" style="2" owner="o" level="1" deltag="both">(d)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1016" style="1" owner="e" level="1" amendtag="both" space="true">(f)</amend></display>"Evidence-based" means the same as that term is defined in Section <xref depth="3" refnumber="53G-11-303">53G-11-303</xref>.</subsection><subsection ssid="3-null-10" dnum="e-o:g-e" numlevel="1" lineno="61" slineno="1-29" level="2"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1016" style="2" owner="o" level="1" deltag="both">(e)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1017" style="1" owner="e" level="1" amendtag="both" space="true">(g)</amend></display>"Evidence-informed" means the same as that term is defined in Section <xref depth="3" refnumber="53G-11-303"><ln numlevel="1" lineno="62" slineno="1-30"/>53G-11-303</xref>.</subsection><subsection ssid="3-56" dnum="_-o:h-e" numlevel="1" lineno="63" slineno="1-31" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1017" style="1" owner="e" level="1" amendtag="start">(h)</amend></display><amend anum="0" ea="amend" pairid="125" groupid="96" style="1" owner="admin" level="1" amendtag="end">"Qualified professional" means an individual who has specialized formal training in <ln numlevel="1" lineno="64" slineno="1-32"/>identifying and evaluating reading disorders, including dyslexia.</amend></subsection><subsection ssid="3-30" dnum="_-o:i-e" numlevel="1" lineno="65" slineno="1-33" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1018" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="17" groupid="14" style="1" owner="admin" level="1" amendtag="end">"Qualifying dyslexia assessment" means a dyslexia assessment administered by an <ln numlevel="1" lineno="66" slineno="1-34"/>individual who is:</amend><subsection ssid="3-39" dnum="_-o:i-e" numlevel="1" lineno="67" slineno="1-35" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1019" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="34" groupid="27" style="1" owner="admin" level="1" amendtag="end">licensed under Title 58, Occupations and Professions;</amend></subsection><subsection ssid="3-40" dnum="_-o:ii-e" numlevel="1" lineno="68" slineno="1-36" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1020" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="39" groupid="31" style="1" owner="admin" level="1" amendtag="end">practicing within the scope of practice for the individual's license; and</amend></subsection><subsection ssid="3-41" dnum="_-o:iii-e" numlevel="1" lineno="69" slineno="1-37" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1021" style="1" owner="e" level="1" amendtag="start">(iii)</amend></display><amend anum="0" ea="amend" pairid="44" groupid="35" style="1" owner="admin" level="1" amendtag="end">competent by training, education, and experience to administer the dyslexia <ln numlevel="1" lineno="70" slineno="1-38"/>assessment.</amend></subsection></subsection><subsection ssid="3-53" dnum="_-o:j-e" numlevel="1" lineno="71" slineno="1-39" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1022" style="1" owner="e" level="1" amendtag="start">(j)</amend></display><amend anum="0" ea="amend" pairid="110" groupid="84" style="1" owner="admin" level="1" amendtag="end">"Screening" means the use of evidence-based measures to identify whether a student <ln numlevel="1" lineno="72" slineno="1-40"/>may:</amend><subsection ssid="3-54" dnum="_-o:i-e" numlevel="1" lineno="73" slineno="1-41" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1023" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="116" groupid="89" style="1" owner="admin" level="1" amendtag="end">be at risk for characteristics of dyslexia; and</amend></subsection><subsection ssid="3-55" dnum="_-o:ii-e" numlevel="1" lineno="74" slineno="1-42" ea="amend" anum="0" owner="admin" style="1" level="3"><display><amend anum="0" ea="amend" pairid="1024" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="121" groupid="93" style="1" owner="admin" level="1" amendtag="end">need additional assessment, progress monitoring, and intervention related to <ln numlevel="1" lineno="75" slineno="1-43"/>dyslexia.</amend></subsection></subsection></subsection><subsection ssid="3-null-11" dnum="2-o" numlevel="1" lineno="76" slineno="1-44" level="1"><display>(2)</display>The state board shall approve a benchmark assessment for use statewide by school <ln numlevel="1" lineno="77" slineno="1-45"/>districts and charter schools to assess the reading competency of students in grades 1 <ln numlevel="1" lineno="78" slineno="1-46"/>through 6 as provided by this section.</subsection><subsection ssid="3-null-12" dnum="3-o" numlevel="1" lineno="79" slineno="1-47" level="1" space="false"><display>(3)</display><subsection ssid="3-32" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1027" style="1" owner="e" level="1" amendtag="both">(a)</amend></display>A school district or charter school shall:<subsection ssid="3-null-13" dnum="a-o:i-e" numlevel="1" lineno="80" slineno="1-48" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1028" style="2" owner="o" level="1" deltag="both">(a)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1029" style="1" owner="e" level="1" amendtag="both" space="true">(i)</amend></display>administer benchmark assessments to students in grades 1, 2, and 3 at the <ln numlevel="1" lineno="81" slineno="1-49"/>beginning, middle, and end of the school year using the benchmark assessment <ln numlevel="1" lineno="82" slineno="1-50"/>approved by the state board; and</subsection><subsection ssid="3-null-14" dnum="b-o:ii-e" numlevel="1" lineno="83" slineno="1-51" level="3" tab="1"><display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="1029" style="2" owner="o" level="1" deltag="both">(b)</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1030" style="1" owner="e" level="1" amendtag="both" space="true">(ii)</amend></display>after administering a benchmark assessment, report the results to a student's <ln numlevel="1" lineno="84" slineno="1-52"/>parent.</subsection></subsection><subsection ssid="3-33" dnum="_-o:b-e" numlevel="1" lineno="85" slineno="1-53" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1030" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="25" groupid="20" style="1" owner="admin" level="1" amendtag="end">A student's parent may provide the results of a qualifying dyslexia assessment to a <ln numlevel="1" lineno="86" slineno="1-54"/>school district or charter school.</amend></subsection></subsection><subsection ssid="3-null-15" dnum="4-o" numlevel="1" lineno="87" slineno="1-55" level="1" space="false"><display>(4)</display><subsection ssid="3-null-16" dnum="a-o" level="2" placement="sameline"><display>(a)</display>If a benchmark assessment<amendoutstart style="2"/><amend anum="0" ea="erase" pairid="5" groupid="5" style="2" owner="admin" level="1" deltag="both"> or</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="3" groupid="3" style="1" owner="admin" level="1" amendtag="both" space="true">,</amend> supplemental reading assessment<amend anum="0" ea="amend" pairid="4" groupid="4" style="1" owner="admin" level="1" amendtag="both">, or qualifying <ln numlevel="1" lineno="88" slineno="1-56"/>dyslexia assessment</amend> indicates a student lacks competency in a reading skill, is <ln numlevel="1" lineno="89" slineno="1-57"/>demonstrating characteristics of dyslexia, or is lagging behind other students in the <ln numlevel="1" lineno="90" slineno="1-58"/>student's grade in acquiring a reading skill, the school district or charter school shall:<subsection ssid="3-null-17" dnum="i-o" numlevel="1" lineno="91" slineno="1-59" level="3" tab="1"><display>(i)</display>administer diagnostic assessments to the student;</subsection><subsection ssid="3-null-18" dnum="ii-o" numlevel="1" lineno="92" slineno="1-60" level="3" tab="1"><display>(ii)</display>using data from the diagnostic assessment, provide specific, focused, and <ln numlevel="1" lineno="93" slineno="1-61"/>individualized intervention or tutoring to develop the reading skill;</subsection><subsection ssid="3-null-19" dnum="iii-o" numlevel="1" lineno="94" slineno="1-62" level="3" tab="1"><display>(iii)</display>administer formative assessments and progress monitoring at recommended <ln numlevel="1" lineno="95" slineno="1-63"/>levels for the benchmark assessment to measure the success of the focused <ln numlevel="1" lineno="96" slineno="1-64"/>intervention;</subsection><subsection ssid="3-null-20" dnum="iv-o" numlevel="1" lineno="97" slineno="1-65" level="3" tab="1"><display>(iv)</display>inform the student's parent of activities that the parent may engage in with the <ln numlevel="1" lineno="98" slineno="1-66"/>student to assist the student in improving reading proficiency;</subsection><subsection ssid="3-null-21" dnum="v-o" numlevel="1" lineno="99" slineno="1-67" level="3" tab="1"><display>(v)</display>provide information to the parent regarding appropriate interventions available to <ln numlevel="1" lineno="100" slineno="1-68"/>the student outside of the regular school day that may include tutoring, before and <ln numlevel="1" lineno="101" slineno="1-69"/>after school programs, or summer school; and</subsection><subsection ssid="3-null-22" dnum="vi-o" numlevel="1" lineno="102" slineno="1-70" level="3" tab="1"><display>(vi)</display>provide instructional materials that are evidence-informed for core instruction <ln numlevel="1" lineno="103" slineno="1-71"/>and evidence-based for intervention and supplemental instruction.</subsection></subsection><subsection ssid="3-null-23" dnum="b-o" numlevel="1" lineno="104" slineno="1-72" level="2"><display>(b)</display>Nothing in this section or in Section <xref depth="3" refnumber="53F-4-203">53F-4-203</xref> or <xref depth="3" refnumber="53G-11-303">53G-11-303</xref> requires a reading <ln numlevel="1" lineno="105" slineno="1-73"/>software product to demonstrate the statistically significant effect size described in <ln numlevel="1" lineno="106" slineno="1-74"/>Subsection <xref depth="4" refnumber="53G-11-303(1)(a)">53G-11-303(1)(a)</xref> in order to be used as an instructional material <ln numlevel="1" lineno="107" slineno="1-75"/>described in Subsection <xref depth="4" refnumber="53E-4-307(4)(a)(vi)">(4)(a)(vi)</xref>.</subsection></subsection><subsection ssid="3-null-24" dnum="5-o" numlevel="1" lineno="108" slineno="1-76" level="1" space="false"><display>(5)</display><subsection ssid="3-null-25" dnum="a-o" level="2" placement="sameline"><display>(a)</display>In accordance with Section <xref depth="3" refnumber="53F-4-201">53F-4-201</xref> and except as provided in Subsection <xref depth="4" refnumber="53E-4-307(5)(b)">(5)(b)</xref>, <ln numlevel="1" lineno="109" slineno="1-77"/>the state board shall contract with one or more educational technology providers for a <ln numlevel="1" lineno="110" slineno="1-78"/>benchmark assessment system for reading for students in kindergarten through grade <ln numlevel="1" lineno="111" slineno="1-79"/>6.</subsection><subsection ssid="3-null-26" dnum="b-o" numlevel="1" lineno="112" slineno="1-80" level="2"><display>(b)</display>If revenue is insufficient for the benchmark assessment system for the grades <ln numlevel="1" lineno="113" slineno="1-81"/>described in Subsection <xref depth="4" refnumber="53E-4-307(5)(a)">(5)(a)</xref>, the state board shall first prioritize funding a <ln numlevel="1" lineno="114" slineno="1-82"/>benchmark assessment for students in kindergarten through grade 3.</subsection></subsection><subsection ssid="3-null-27" dnum="6-o" numlevel="1" lineno="115" slineno="1-83" level="1"><display>(6)</display>A student with dyslexia is only eligible for special education services if the student <ln numlevel="1" lineno="116" slineno="1-84"/>meets federal eligibility criteria.</subsection><subsection ssid="3-48" dnum="_-o:7-e" numlevel="1" lineno="117" slineno="1-85" ea="amend" anum="0" owner="admin" style="1" level="1" space="false"><display><amend anum="0" ea="amend" pairid="1044" style="1" owner="e" level="1" amendtag="start">(7)</amend></display><subsection ssid="3-49" dnum="_-o:a-e" ea="amend" anum="0" owner="admin" style="1" level="2" placement="sameline"><display><amend anum="0" ea="amend" pairid="1045" style="1" owner="e" level="1">(a)</amend></display><amend anum="0" ea="amend" pairid="88" groupid="69" style="1" owner="admin" level="1" amendtag="end">A school district or charter school may not discipline, retaliate against, or subject <ln numlevel="1" lineno="118" slineno="1-86"/>to adverse employment action an educational professional solely for recommending <ln numlevel="1" lineno="119" slineno="1-87"/>or referring a student for dyslexia screening, consistent with:</amend><subsection ssid="3-50" dnum="_-o:i-e" numlevel="1" lineno="120" slineno="1-88" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1046" style="1" owner="e" level="1" amendtag="start">(i)</amend></display><amend anum="0" ea="amend" pairid="93" groupid="73" style="1" owner="admin" level="1" amendtag="end">the Individuals with Disabilities Education Act, 20 U.S.C. <marker pairid="104">Sec</marker><marker pairid="105">.</marker><marker pairid="106"> 1400</marker> et seq.; or</amend></subsection><subsection ssid="3-51" dnum="_-o:ii-e" numlevel="1" lineno="121" slineno="1-89" ea="amend" anum="0" owner="admin" style="1" level="3" tab="1"><display><amend anum="0" ea="amend" pairid="1047" style="1" owner="e" level="1" amendtag="start">(ii)</amend></display><amend anum="0" ea="amend" pairid="98" groupid="77" style="1" owner="admin" level="1" amendtag="end">Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. Section <bold>58-60-102</bold> is amended to read:</secline><catline lineno="125"><bold>58-60-102<parens/>. Definitions.</bold></catline><sectionText lineno="126"><tab/>As used in this chapter, unless a different meaning is established by definition under a <ln numlevel="1" lineno="127" slineno="2-4"/>specific section or part:</sectionText><subsection ssid="6-null-1" dnum="1-o" numlevel="1" lineno="128" slineno="2-5" level="1"><display>(1)</display>"Board" means the Behavioral Health Board created in Section <xref depth="3" refnumber="58-60-102.5">58-60-102.5</xref>.</subsection><subsection ssid="6-null-2" dnum="2-o" numlevel="1" lineno="129" slineno="2-6" level="1"><display>(2)</display>"Client" or "patient" means an individual who consults or is examined or interviewed by <ln numlevel="1" lineno="130" slineno="2-7"/>an individual licensed under this chapter who is acting in the individual's professional <ln numlevel="1" lineno="131" slineno="2-8"/>capacity.</subsection><subsection ssid="6-null-3" dnum="3-o" numlevel="1" lineno="132" slineno="2-9" level="1"><display>(3)</display>"Clinical supervision" means work experience conducted under the supervision of a <ln numlevel="1" lineno="133" slineno="2-10"/>clinical supervisor, including the practice of mental health therapy, direct client care, <ln numlevel="1" lineno="134" slineno="2-11"/>direct clinical supervision, direct observation, and other duties and activities completed <ln numlevel="1" lineno="135" slineno="2-12"/>in the course of the day-to-day job functions and work of:<subsection ssid="6-null-4" dnum="a-o" numlevel="1" lineno="136" slineno="2-13" level="2"><display>(a)</display>a certified social worker;</subsection><subsection ssid="6-null-5" dnum="b-o" numlevel="1" lineno="137" slineno="2-14" level="2"><display>(b)</display>an associate marriage and family therapist;</subsection><subsection ssid="6-null-6" dnum="c-o" numlevel="1" lineno="138" slineno="2-15" level="2"><display>(c)</display>an associate clinical mental health counselor; or</subsection><subsection ssid="6-null-7" dnum="d-o" numlevel="1" lineno="139" slineno="2-16" level="2"><display>(d)</display>an associate master addiction counselor, wherein the supervisor is available for <ln numlevel="1" lineno="140" slineno="2-17"/>consultation with the supervisee by personal face-to-face contact, or direct voice <ln numlevel="1" lineno="141" slineno="2-18"/>contact by telephone, radio, or other means within a reasonable time consistent with <ln numlevel="1" lineno="142" slineno="2-19"/>the acts and practices in which the supervisee is engaged.</subsection></subsection><subsection ssid="6-null-8" dnum="4-o" numlevel="1" lineno="143" slineno="2-20" level="1"><display>(4)</display>"Clinical supervisor" means an individual who oversees and mentors one or more <ln numlevel="1" lineno="144" slineno="2-21"/>mental health therapists licensed under this chapter, and who:<subsection ssid="6-null-9" dnum="a-o" numlevel="1" lineno="145" slineno="2-22" level="2" space="false"><display>(a)</display><subsection ssid="6-null-10" dnum="i-o" level="3" placement="sameline"><display>(i)</display>is licensed, in good standing, as a mental health therapist;</subsection><subsection ssid="6-null-11" dnum="ii-o" numlevel="1" lineno="146" slineno="2-23" level="3"><display>(ii)</display>is approved or certified in good standing as a supervisor by a national <ln numlevel="1" lineno="147" slineno="2-24"/>professional organization for social work, mental health counseling, addiction <ln numlevel="1" lineno="148" slineno="2-25"/>counseling, marriage and family therapy, psychology, medicine, or nursing, or <ln numlevel="1" lineno="149" slineno="2-26"/>other organization as approved by the division;</subsection><subsection ssid="6-null-12" dnum="iii-o" numlevel="1" lineno="150" slineno="2-27" level="3" space="false"><display>(iii)</display><subsection ssid="6-null-13" dnum="A-o" level="4" placement="sameline"><display>(A)</display>has completed eight or more hours of supervision instruction that meets <ln numlevel="1" lineno="151" slineno="2-28"/>minimum standards established by the division in rule; or</subsection><subsection ssid="6-null-14" dnum="B-o" numlevel="1" lineno="152" slineno="2-29" level="4"><display>(B)</display>has completed a graduate course on clinical supervision from an accredited <ln numlevel="1" lineno="153" slineno="2-30"/>program;</subsection></subsection><subsection ssid="6-null-15" dnum="iv-o" numlevel="1" lineno="154" slineno="2-31" level="3"><display>(iv)</display>completes continuing education in clinical supervision, as established by the <ln numlevel="1" lineno="155" slineno="2-32"/>division in rule; and</subsection><subsection ssid="6-null-16" dnum="v-o" numlevel="1" lineno="156" slineno="2-33" level="3"><display>(v)</display>provides supervision to no more than the number of individuals to whom the <ln numlevel="1" lineno="157" slineno="2-34"/>supervisor can reasonably provide clinical supervision by performing the duties <ln numlevel="1" lineno="158" slineno="2-35"/>and responsibilities of a supervisor, including:<subsection ssid="6-null-17" dnum="A-o" numlevel="1" lineno="159" slineno="2-36" level="4"><display>(A)</display>being available to the supervisee for consultation by personal face-to-face <ln numlevel="1" lineno="160" slineno="2-37"/>contact, or by direct voice contact by telephone, video conference, or other <ln numlevel="1" lineno="161" slineno="2-38"/>means within a reasonable time frame;</subsection><subsection ssid="6-null-18" dnum="B-o" numlevel="1" lineno="162" slineno="2-39" level="4"><display>(B)</display>providing instruction, direction, oversight, observation, evaluation, and <ln numlevel="1" lineno="163" slineno="2-40"/>feedback, to enable the supervisee to acquire the knowledge, skills, techniques, <ln numlevel="1" lineno="164" slineno="2-41"/>and abilities necessary to engage in the practice of behavioral health care <ln numlevel="1" lineno="165" slineno="2-42"/>ethically, safely, and competently; and</subsection><subsection ssid="6-null-19" dnum="C-o" numlevel="1" lineno="166" slineno="2-43" level="4"><display>(C)</display>maintaining routine personal contact with the supervisee; and</subsection></subsection></subsection><subsection ssid="6-null-20" dnum="b-o" numlevel="1" lineno="167" slineno="2-44" level="2" space="false"><display>(b)</display><subsection ssid="6-null-21" dnum="i-o" level="3" placement="sameline"><display>(i)</display>is qualified and acting as a valid supervisor, in accordance with applicable law <ln numlevel="1" lineno="168" slineno="2-45"/>and division rules, as of April 30, 2024; and</subsection><subsection ssid="6-null-22" dnum="ii-o" numlevel="1" lineno="169" slineno="2-46" level="3"><display>(ii)</display>has satisfied the requirements of Subsection <xref depth="4" refnumber="58-60-102(4)(a)">(4)(a)</xref>, as of January 1, 2027.</subsection></subsection></subsection><subsection ssid="6-null-23" dnum="5-o" numlevel="1" lineno="170" slineno="2-47" level="1"><display>(5)</display>"Confidential communication" means information obtained by an individual licensed <ln numlevel="1" lineno="171" slineno="2-48"/>under this chapter, including information obtained by the individual's examination of the <ln numlevel="1" lineno="172" slineno="2-49"/>client or patient, which is:<subsection ssid="6-null-24" dnum="a-o" numlevel="1" lineno="173" slineno="2-50" level="2" space="false"><display>(a)</display><subsection ssid="6-null-25" dnum="i-o" level="3" placement="sameline"><display>(i)</display>transmitted between the client or patient and an individual licensed under this <ln numlevel="1" lineno="174" slineno="2-51"/>chapter in the course of that relationship; or</subsection><subsection ssid="6-null-26" dnum="ii-o" numlevel="1" lineno="175" slineno="2-52" level="3"><display>(ii)</display>transmitted among the client or patient, an individual licensed under this chapter, <ln numlevel="1" lineno="176" slineno="2-53"/>and individuals who are participating in the diagnosis or treatment under the <ln numlevel="1" lineno="177" slineno="2-54"/>direction of an individual licensed under this chapter, including members of the <ln numlevel="1" lineno="178" slineno="2-55"/>client's or patient's family; and</subsection></subsection><subsection ssid="6-null-27" dnum="b-o" numlevel="1" lineno="179" slineno="2-56" level="2"><display>(b)</display>made in confidence, for the diagnosis or treatment of the client or patient by the <ln numlevel="1" lineno="180" slineno="2-57"/>individual licensed under this chapter, and by a means not intended to be disclosed to <ln numlevel="1" lineno="181" slineno="2-58"/>third persons other than those individuals:<subsection ssid="6-null-28" dnum="i-o" numlevel="1" lineno="182" slineno="2-59" level="3"><display>(i)</display>present to further the interest of the client or patient in the consultation, <ln numlevel="1" lineno="183" slineno="2-60"/>examination, or interview;</subsection><subsection ssid="6-null-29" dnum="ii-o" numlevel="1" lineno="184" slineno="2-61" level="3"><display>(ii)</display>reasonably necessary for the transmission of the communications; or</subsection><subsection ssid="6-null-30" dnum="iii-o" numlevel="1" lineno="185" slineno="2-62" level="3"><display>(iii)</display>participating in the diagnosis and treatment of the client or patient under the <ln numlevel="1" lineno="186" slineno="2-63"/>direction of the mental health therapist.</subsection></subsection></subsection><subsection ssid="6-null-31" dnum="6-o" numlevel="1" lineno="187" slineno="2-64" level="1"><display>(6)</display>"Designated examiner" means the same as that term is defined in Section <xref depth="3" refnumber="26B-5-301">26B-5-301</xref>.</subsection><subsection ssid="6-null-32" dnum="7-o" numlevel="1" lineno="188" slineno="2-65" level="1" space="false"><display>(7)</display><subsection ssid="6-null-33" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Direct client care" means the practice of mental health therapy performed as an <ln numlevel="1" lineno="189" slineno="2-66"/>applicant for licensure.</subsection><subsection ssid="6-null-34" dnum="b-o" numlevel="1" lineno="190" slineno="2-67" level="2"><display>(b)</display>"Direct client care" includes:<subsection ssid="6-null-35" dnum="i-o" numlevel="1" lineno="191" slineno="2-68" level="3"><display>(i)</display>the practice of mental health therapy;</subsection><subsection ssid="6-null-36" dnum="ii-o" numlevel="1" lineno="192" slineno="2-69" level="3"><display>(ii)</display>the utilization of patient-reported progress and outcomes to inform care; and</subsection><subsection ssid="6-null-37" dnum="iii-o" numlevel="1" lineno="193" slineno="2-70" level="3"><display>(iii)</display>direct observation.</subsection></subsection></subsection><subsection ssid="6-null-38" dnum="8-o" numlevel="1" lineno="194" slineno="2-71" level="1" space="false"><display>(8)</display><subsection ssid="6-null-39" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Direct clinical supervision" means an applicant for licensure and the applicant's <ln numlevel="1" lineno="195" slineno="2-72"/>direct clinical supervisor meeting in real time and in accordance with the applicant <ln numlevel="1" lineno="196" slineno="2-73"/>for licensure's supervision contract as defined by division rule.</subsection><subsection ssid="6-null-40" dnum="b-o" numlevel="1" lineno="197" slineno="2-74" level="2"><display>(b)</display>"Direct clinical supervision" includes group supervision.</subsection></subsection><subsection ssid="6-null-41" dnum="9-o" numlevel="1" lineno="198" slineno="2-75" level="1"><display>(9)</display>"Direct clinical supervisor" means the clinical supervisor who has signed the <ln numlevel="1" lineno="199" slineno="2-76"/>supervision contract with the applicant for licensure.</subsection><subsection ssid="6-null-42" dnum="10-o" numlevel="1" lineno="200" slineno="2-77" level="1"><display>(10)</display>"Direct observation" means observation of an applicant for licensure's live or recorded <ln numlevel="1" lineno="201" slineno="2-78"/>direct client care:<subsection ssid="6-null-43" dnum="a-o" numlevel="1" lineno="202" slineno="2-79" level="2" space="false"><display>(a)</display><subsection ssid="6-null-44" dnum="i-o" level="3" placement="sameline"><display>(i)</display>by the applicant for licensure's clinical supervisor; or</subsection><subsection ssid="6-null-45" dnum="ii-o" numlevel="1" lineno="203" slineno="2-80" level="3"><display>(ii)</display>by a licensee under Subsection <xref depth="4" refnumber="58-60-102(4)(a)">(4)(a)</xref> who the applicant for licensure's direct <ln numlevel="1" lineno="204" slineno="2-81"/>clinical supervisor approves; and</subsection></subsection><subsection ssid="6-null-46" dnum="b-o" numlevel="1" lineno="205" slineno="2-82" level="2"><display>(b)</display>after which the applicant for licensure and the observer under Subsection <xref tempid="586" depth="4" refnumber="58-60-102(10)(a)">(10)(a)</xref> <ln numlevel="1" lineno="206" slineno="2-83"/>meet, in-person or electronically, to discuss the direct client care for the purpose of <ln numlevel="1" lineno="207" slineno="2-84"/>developing the applicant for licensure's clinical knowledge and skill.</subsection></subsection><subsection ssid="6-null-47" dnum="11-o" numlevel="1" lineno="208" slineno="2-85" level="1"><display>(11)</display>"FBI Rap Back System" means the same as that term is defined in Section <xref depth="3" refnumber="53-10-108">53-10-108</xref>.</subsection><subsection ssid="6-null-48" dnum="12-o" numlevel="1" lineno="209" slineno="2-86" level="1"><display>(12)</display>"Group supervision" means an applicant for licensure meeting with the applicant's <ln numlevel="1" lineno="210" slineno="2-87"/>direct clinical supervisor and at least one of the direct clinical supervisor's other <ln numlevel="1" lineno="211" slineno="2-88"/>supervised applicants for licensure:<subsection ssid="6-null-49" dnum="a-o" numlevel="1" lineno="212" slineno="2-89" level="2"><display>(a)</display>while the clinical supervisor and the applicants:<subsection ssid="6-null-50" dnum="i-o" numlevel="1" lineno="213" slineno="2-90" level="3"><display>(i)</display>can see and openly communicate with each other; and</subsection><subsection ssid="6-null-51" dnum="ii-o" numlevel="1" lineno="214" slineno="2-91" level="3"><display>(ii)</display>are present in the same room or via electronic video; and</subsection></subsection><subsection ssid="6-null-52" dnum="b-o" numlevel="1" lineno="215" slineno="2-92" level="2"><display>(b)</display>for the purpose of developing the applicants' clinical knowledge and skill.</subsection></subsection><subsection ssid="6-null-53" dnum="13-o" numlevel="1" lineno="216" slineno="2-93" level="1"><display>(13)</display>"Hypnosis" means, when referring to individuals exempted from licensure under this <ln numlevel="1" lineno="217" slineno="2-94"/>chapter, a process by which an individual induces or assists another individual into a <ln numlevel="1" lineno="218" slineno="2-95"/>hypnotic state without the use of drugs or other substances and for the purpose of <ln numlevel="1" lineno="219" slineno="2-96"/>increasing motivation or to assist the individual to alter lifestyles or habits.</subsection><subsection ssid="6-null-54" dnum="14-o" numlevel="1" lineno="220" slineno="2-97" level="1"><display>(14)</display>"Individual" means a natural person.</subsection><subsection ssid="6-null-55" dnum="15-o" numlevel="1" lineno="221" slineno="2-98" level="1"><display>(15)</display>"Mental health therapist" means an individual who is practicing within the scope of <ln numlevel="1" lineno="222" slineno="2-99"/>practice defined in the individual's respective licensing act and is licensed under this title <ln numlevel="1" lineno="223" slineno="2-100"/>as:<subsection ssid="6-null-56" dnum="a-o" numlevel="1" lineno="224" slineno="2-101" level="2"><display>(a)</display>a physician and surgeon, or osteopathic physician engaged in the practice of mental <ln numlevel="1" lineno="225" slineno="2-102"/>health therapy;</subsection><subsection ssid="6-null-57" dnum="b-o" numlevel="1" lineno="226" slineno="2-103" level="2"><display>(b)</display>an advanced practice registered nurse, specializing in psychiatric mental health <ln numlevel="1" lineno="227" slineno="2-104"/>nursing;</subsection><subsection ssid="6-null-58" dnum="c-o" numlevel="1" lineno="228" slineno="2-105" level="2"><display>(c)</display>an advanced practice registered nurse intern, specializing in psychiatric mental health <ln numlevel="1" lineno="229" slineno="2-106"/>nursing;</subsection><subsection ssid="6-null-59" dnum="d-o" numlevel="1" lineno="230" slineno="2-107" level="2"><display>(d)</display>a psychologist qualified to engage in the practice of mental health therapy;</subsection><subsection ssid="6-null-60" dnum="e-o" numlevel="1" lineno="231" slineno="2-108" level="2"><display>(e)</display>a certified psychology resident qualifying to engage in the practice of mental health <ln numlevel="1" lineno="232" slineno="2-109"/>therapy;</subsection><subsection ssid="6-null-61" dnum="f-o" numlevel="1" lineno="233" slineno="2-110" level="2"><display>(f)</display>a physician assistant specializing in mental health care under Section <xref depth="3" refnumber="58-70a-501.1">58-70a-501.1</xref>;</subsection><subsection ssid="6-null-62" dnum="g-o" numlevel="1" lineno="234" slineno="2-111" level="2"><display>(g)</display>a clinical social worker;</subsection><subsection ssid="6-null-63" dnum="h-o" numlevel="1" lineno="235" slineno="2-112" level="2"><display>(h)</display>a certified social worker;</subsection><subsection ssid="6-null-64" dnum="i-o" numlevel="1" lineno="236" slineno="2-113" level="2"><display>(i)</display>a marriage and family therapist;</subsection><subsection ssid="6-null-65" dnum="j-o" numlevel="1" lineno="237" slineno="2-114" level="2"><display>(j)</display>an associate marriage and family therapist;</subsection><subsection ssid="6-null-66" dnum="k-o" numlevel="1" lineno="238" slineno="2-115" level="2"><display>(k)</display>a clinical mental health counselor;</subsection><subsection ssid="6-null-67" dnum="l-o" numlevel="1" lineno="239" slineno="2-116" level="2"><display>(l)</display>an associate clinical mental health counselor;</subsection><subsection ssid="6-null-68" dnum="m-o" numlevel="1" lineno="240" slineno="2-117" level="2"><display>(m)</display>a master addiction counselor; or</subsection><subsection ssid="6-null-69" dnum="n-o" numlevel="1" lineno="241" slineno="2-118" level="2"><display>(n)</display>an associate master addiction counselor.</subsection></subsection><subsection ssid="6-null-70" dnum="16-o" numlevel="1" lineno="242" slineno="2-119" level="1"><display>(16)</display>"Mental illness" means a mental <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">or emotional condition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">disorder</amend> defined in an <ln numlevel="1" lineno="243" slineno="2-120"/>approved diagnostic and statistical manual for mental disorders generally recognized in <ln numlevel="1" lineno="244" slineno="2-121"/>the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-60-102(15)">(15)</xref>.</subsection><subsection ssid="6-null-71" dnum="17-o" numlevel="1" lineno="245" slineno="2-122" level="1"><display>(17)</display>"Practice of mental health therapy" means treatment or prevention of another <ln numlevel="1" lineno="246" slineno="2-123"/>individual's mental illness or emotional disorder, whether in person or remotely, <ln numlevel="1" lineno="247" slineno="2-124"/>including:<subsection ssid="6-null-72" dnum="a-o" numlevel="1" lineno="248" slineno="2-125" level="2"><display>(a)</display>conducting a professional evaluation of an individual's condition of mental health, <ln numlevel="1" lineno="249" slineno="2-126"/>mental illness, or emotional disorder consistent with standards generally recognized <ln numlevel="1" lineno="250" slineno="2-127"/>in the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-60-102(15)">(15)</xref>;</subsection><subsection ssid="6-null-73" dnum="b-o" numlevel="1" lineno="251" slineno="2-128" level="2"><display>(b)</display>establishing a diagnosis in accordance with established written standards generally <ln numlevel="1" lineno="252" slineno="2-129"/>recognized in the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-60-102(15)">(15)</xref>;</subsection><subsection ssid="6-null-74" dnum="c-o" numlevel="1" lineno="253" slineno="2-130" level="2"><display>(c)</display>conveying an opinion as to the validity of an individual's established diagnosis;</subsection><subsection ssid="6-null-75" dnum="d-o" numlevel="1" lineno="254" slineno="2-131" level="2"><display>(d)</display>prescribing a plan for the prevention or treatment of a condition of mental illness or <ln numlevel="1" lineno="255" slineno="2-132"/>emotional disorder; and</subsection><subsection ssid="6-null-76" dnum="e-o" numlevel="1" lineno="256" slineno="2-133" level="2"><display>(e)</display>engaging in the conduct of professional intervention, including:<subsection ssid="6-null-77" dnum="i-o" numlevel="1" lineno="257" slineno="2-134" level="3"><display>(i)</display>psychotherapy by the application of established methods and procedures generally <ln numlevel="1" lineno="258" slineno="2-135"/>recognized in the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-60-102(15)">(15)</xref>; <ln numlevel="1" lineno="259" slineno="2-136"/>and</subsection><subsection ssid="6-null-78" dnum="ii-o" numlevel="1" lineno="260" slineno="2-137" level="3"><display>(ii)</display>modes of treatment designed to treat interpersonal dysfunction; and</subsection></subsection><subsection ssid="6-null-79" dnum="f-o" numlevel="1" lineno="261" slineno="2-138" level="2"><display>(f)</display>holding oneself out as providing, or has having the skills, experience, or training to <ln numlevel="1" lineno="262" slineno="2-139"/>competently provide, any of the services described in Subsections <xref refnumber="58-60-102(17)(a)" depth="4">(17)(a)</xref> through (e).</subsection></subsection><subsection ssid="6-null-80" dnum="18-o" numlevel="1" lineno="263" slineno="2-140" level="1"><display>(18)</display>"Remotely" means communicating via <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="6" groupid="6" style="2" owner="admin" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="5" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true">internet</amend>, telephone, or other electronic <ln numlevel="1" lineno="264" slineno="2-141"/>means that facilitate real-time audio or visual interaction between individuals when they <ln numlevel="1" lineno="265" slineno="2-142"/>are not physically present in the same room at the same time.</subsection><subsection ssid="6-null-81" dnum="19-o" numlevel="1" lineno="266" slineno="2-143" level="1"><display>(19)</display>"Unlawful conduct" is as defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> and <xref depth="3" refnumber="58-60-109">58-60-109</xref>.</subsection><subsection ssid="6-null-82" dnum="20-o" numlevel="1" lineno="267" slineno="2-144" level="1"><display>(20)</display>"Unprofessional conduct" is as defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> and <xref depth="3" refnumber="58-60-110">58-60-110</xref>, and may <ln numlevel="1" lineno="268" slineno="2-145"/>be further defined by division rule.</subsection></section></bsec><bsec buid="7" num="58-61-102" type="amend" src="code" uid="C58-61-S102_2026050620260506" sort="58 61 01020020260506" numlevel="1" lineno="269" slineno="3-1" sn="3"><section number="58-61-102" numlevel="1" lineno="270" slineno="3-2" type="amend"><secline lineno="269">Section 3. Section <bold>58-61-102</bold> is amended to read:</secline><catline lineno="270"><bold>58-61-102<parens/>. Definitions.</bold></catline><sectionText lineno="271"><tab/>In addition to the definitions in Section <xref depth="3" refnumber="58-1-102">58-1-102</xref>, as used in this chapter:</sectionText><subsection ssid="7-null-1" dnum="1-o" numlevel="1" lineno="272" slineno="3-4" level="1"><display>(1)</display>"Board" means the Behavioral Health Board created in Section <xref depth="3" refnumber="58-60-102.5">58-60-102.5</xref>.</subsection><subsection ssid="7-null-2" dnum="2-o" numlevel="1" lineno="273" slineno="3-5" level="1"><display>(2)</display>"Client" or "patient" means an individual who consults or is examined or interviewed by <ln numlevel="1" lineno="274" slineno="3-6"/>a psychologist acting in his professional capacity.</subsection><subsection ssid="7-null-3" dnum="3-o" numlevel="1" lineno="275" slineno="3-7" level="1"><display>(3)</display>"Confidential communication" means information, including information obtained by <ln numlevel="1" lineno="276" slineno="3-8"/>the psychologist's examination of the client or patient, which is:<subsection ssid="7-null-4" dnum="a-o" numlevel="1" lineno="277" slineno="3-9" level="2" space="false"><display>(a)</display><subsection ssid="7-null-5" dnum="i-o" level="3" placement="sameline"><display>(i)</display>transmitted between the client or patient and a psychologist in the course of that <ln numlevel="1" lineno="278" slineno="3-10"/>relationship; or</subsection><subsection ssid="7-null-6" dnum="ii-o" numlevel="1" lineno="279" slineno="3-11" level="3"><display>(ii)</display>transmitted among the client or patient, the psychologist, and individuals who are <ln numlevel="1" lineno="280" slineno="3-12"/>participating in the diagnosis or treatment under the direction of the psychologist, <ln numlevel="1" lineno="281" slineno="3-13"/>including members of the client's or patient's family; and</subsection></subsection><subsection ssid="7-null-7" dnum="b-o" numlevel="1" lineno="282" slineno="3-14" level="2"><display>(b)</display>made in confidence, for the diagnosis or treatment of the client or patient by the <ln numlevel="1" lineno="283" slineno="3-15"/>psychologist, and by a means not intended to be disclosed to third persons other than <ln numlevel="1" lineno="284" slineno="3-16"/>those individuals:<subsection ssid="7-null-8" dnum="i-o" numlevel="1" lineno="285" slineno="3-17" level="3"><display>(i)</display>present to further the interest of the client or patient in the consultation, <ln numlevel="1" lineno="286" slineno="3-18"/>examination, or interview;</subsection><subsection ssid="7-null-9" dnum="ii-o" numlevel="1" lineno="287" slineno="3-19" level="3"><display>(ii)</display>reasonably necessary for the transmission of the communications; or</subsection><subsection ssid="7-null-10" dnum="iii-o" numlevel="1" lineno="288" slineno="3-20" level="3"><display>(iii)</display>participating in the diagnosis and treatment of the client or patient under the <ln numlevel="1" lineno="289" slineno="3-21"/>direction of the psychologist.</subsection></subsection></subsection><subsection ssid="7-null-11" dnum="4-o" numlevel="1" lineno="290" slineno="3-22" level="1"><display>(4)</display>"Hypnosis" means, regarding individuals exempted from licensure under this chapter, a <ln numlevel="1" lineno="291" slineno="3-23"/>process by which one individual induces or assists another individual into a hypnotic <ln numlevel="1" lineno="292" slineno="3-24"/>state without the use of drugs or other substances and for the purpose of increasing <ln numlevel="1" lineno="293" slineno="3-25"/>motivation or to assist the individual to alter lifestyles or habits.</subsection><subsection ssid="7-null-12" dnum="5-o" numlevel="1" lineno="294" slineno="3-26" level="1"><display>(5)</display>"Individual" means a natural person.</subsection><subsection ssid="7-null-13" dnum="6-o" numlevel="1" lineno="295" slineno="3-27" level="1"><display>(6)</display>"Mental health therapist" means an individual licensed under this title as a:<subsection ssid="7-null-14" dnum="a-o" numlevel="1" lineno="296" slineno="3-28" level="2"><display>(a)</display>physician and surgeon, or osteopathic physician engaged in the practice of mental <ln numlevel="1" lineno="297" slineno="3-29"/>health therapy;</subsection><subsection ssid="7-null-15" dnum="b-o" numlevel="1" lineno="298" slineno="3-30" level="2"><display>(b)</display>an advanced practice registered nurse, specializing in psychiatric mental health <ln numlevel="1" lineno="299" slineno="3-31"/>nursing;</subsection><subsection ssid="7-null-16" dnum="c-o" numlevel="1" lineno="300" slineno="3-32" level="2"><display>(c)</display>an advanced practice registered nurse intern, specializing in psychiatric mental health <ln numlevel="1" lineno="301" slineno="3-33"/>nursing;</subsection><subsection ssid="7-null-17" dnum="d-o" numlevel="1" lineno="302" slineno="3-34" level="2"><display>(d)</display>psychologist qualified to engage in the practice of mental health therapy;</subsection><subsection ssid="7-null-18" dnum="e-o" numlevel="1" lineno="303" slineno="3-35" level="2"><display>(e)</display>a certified psychology resident qualifying to engage in the practice of mental health <ln numlevel="1" lineno="304" slineno="3-36"/>therapy;</subsection><subsection ssid="7-null-19" dnum="f-o" numlevel="1" lineno="305" slineno="3-37" level="2"><display>(f)</display>clinical social worker;</subsection><subsection ssid="7-null-20" dnum="g-o" numlevel="1" lineno="306" slineno="3-38" level="2"><display>(g)</display>certified social worker;</subsection><subsection ssid="7-null-21" dnum="h-o" numlevel="1" lineno="307" slineno="3-39" level="2"><display>(h)</display>marriage and family therapist;</subsection><subsection ssid="7-null-22" dnum="i-o" numlevel="1" lineno="308" slineno="3-40" level="2"><display>(i)</display>an associate marriage and family therapist;</subsection><subsection ssid="7-null-23" dnum="j-o" numlevel="1" lineno="309" slineno="3-41" level="2"><display>(j)</display>a clinical mental health counselor; or</subsection><subsection ssid="7-null-24" dnum="k-o" numlevel="1" lineno="310" slineno="3-42" level="2"><display>(k)</display>an associate clinical mental health counselor.</subsection></subsection><subsection ssid="7-null-25" dnum="7-o" numlevel="1" lineno="311" slineno="3-43" level="1"><display>(7)</display>"Mental illness" means a mental <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">or emotional condition</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">disorder</amend> defined in an <ln numlevel="1" lineno="312" slineno="3-44"/>approved diagnostic and statistical manual for mental disorders generally recognized in <ln numlevel="1" lineno="313" slineno="3-45"/>the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-61-102(6)">(6)</xref>.</subsection><subsection ssid="7-null-26" dnum="8-o" numlevel="1" lineno="314" slineno="3-46" level="1"><display>(8)</display>"Practice of mental health therapy" means the treatment or prevention of mental illness, <ln numlevel="1" lineno="315" slineno="3-47"/>whether in person or remotely, including:<subsection ssid="7-null-27" dnum="a-o" numlevel="1" lineno="316" slineno="3-48" level="2"><display>(a)</display>conducting a professional evaluation of an individual's condition of mental health, <ln numlevel="1" lineno="317" slineno="3-49"/>mental illness, or emotional disorder;</subsection><subsection ssid="7-null-28" dnum="b-o" numlevel="1" lineno="318" slineno="3-50" level="2"><display>(b)</display>establishing a diagnosis in accordance with established written standards generally <ln numlevel="1" lineno="319" slineno="3-51"/>recognized in the professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-61-102(6)">(6)</xref>;</subsection><subsection ssid="7-null-29" dnum="c-o" numlevel="1" lineno="320" slineno="3-52" level="2"><display>(c)</display>prescribing a plan for the prevention or treatment of a condition of mental illness or <ln numlevel="1" lineno="321" slineno="3-53"/>emotional disorder; and</subsection><subsection ssid="7-null-30" dnum="d-o" numlevel="1" lineno="322" slineno="3-54" level="2"><display>(d)</display>engaging in the conduct of professional intervention, including psychotherapy by the <ln numlevel="1" lineno="323" slineno="3-55"/>application of established methods and procedures generally recognized in the <ln numlevel="1" lineno="324" slineno="3-56"/>professions of mental health therapy listed under Subsection <xref depth="4" refnumber="58-61-102(6)">(6)</xref>.</subsection></subsection><subsection ssid="7-null-31" dnum="9-o" numlevel="1" lineno="325" slineno="3-57" level="1" space="false"><display>(9)</display><subsection ssid="7-null-32" dnum="a-o" level="2" placement="sameline"><display>(a)</display>"Practice of psychology" includes:<subsection ssid="7-null-33" dnum="i-o" numlevel="1" lineno="326" slineno="3-58" level="3" tab="1"><display>(i)</display>the practice of mental health therapy by means of observation, description, <ln numlevel="1" lineno="327" slineno="3-59"/>evaluation, interpretation, intervention, and treatment to effect modification of <ln numlevel="1" lineno="328" slineno="3-60"/>human behavior by the application of generally recognized professional <ln numlevel="1" lineno="329" slineno="3-61"/>psychological principles, methods, and procedures for the purpose of preventing, <ln numlevel="1" lineno="330" slineno="3-62"/>treating, or eliminating mental or emotional illness or dysfunction, the symptoms <ln numlevel="1" lineno="331" slineno="3-63"/>of any of these, or maladaptive behavior;</subsection><subsection ssid="7-null-34" dnum="ii-o" numlevel="1" lineno="332" slineno="3-64" level="3" tab="1"><display>(ii)</display>the observation, description, evaluation, interpretation, or modification of human <ln numlevel="1" lineno="333" slineno="3-65"/>behavior by the application of generally recognized professional principles, <ln numlevel="1" lineno="334" slineno="3-66"/>methods, or procedures requiring the education, training, and clinical experience <ln numlevel="1" lineno="335" slineno="3-67"/>of a psychologist, for the purpose of assessing, diagnosing, preventing, or <ln numlevel="1" lineno="336" slineno="3-68"/>eliminating symptomatic, maladaptive, or undesired behavior and of enhancing <ln numlevel="1" lineno="337" slineno="3-69"/>interpersonal relationships, work and life adjustment, personal effectiveness, <ln numlevel="1" lineno="338" slineno="3-70"/>behavioral health, and mental health;</subsection><subsection ssid="7-null-35" dnum="iii-o" numlevel="1" lineno="339" slineno="3-71" level="3" tab="1"><display>(iii)</display>psychological testing and the evaluation or assessment of personal characteristics <ln numlevel="1" lineno="340" slineno="3-72"/>such as intelligence, personality, abilities, interests, aptitudes, and <ln numlevel="1" lineno="341" slineno="3-73"/>neuropsychological functioning;</subsection><subsection ssid="7-null-36" dnum="iv-o" numlevel="1" lineno="342" slineno="3-74" level="3" tab="1"><display>(iv)</display>counseling, marriage and family therapy, psychoanalysis, psychotherapy, <ln numlevel="1" lineno="343" slineno="3-75"/>hypnosis, and behavior analysis and therapy;</subsection><subsection ssid="7-null-37" dnum="v-o" numlevel="1" lineno="344" slineno="3-76" level="3" tab="1"><display>(v)</display>diagnosis and treatment of mental and emotional disorders of disability, <ln numlevel="1" lineno="345" slineno="3-77"/>alcoholism and substance abuse, disorders of habit or conduct, and the <ln numlevel="1" lineno="346" slineno="3-78"/>psychological aspects of physical illness, accident, injury, or disability; and</subsection><subsection ssid="7-null-38" dnum="vi-o" numlevel="1" lineno="347" slineno="3-79" level="3" tab="1"><display>(vi)</display>psychoeducational evaluation, therapy, remediation, and consultation.</subsection></subsection><subsection ssid="7-null-39" dnum="b-o" numlevel="1" lineno="348" slineno="3-80" level="2"><display>(b)</display>An individual practicing psychology may provide services to individuals, couples, <ln numlevel="1" lineno="349" slineno="3-81"/>families, groups of individuals, members of the public, and individuals or groups <ln numlevel="1" lineno="350" slineno="3-82"/>within organizations or institutions.</subsection></subsection><subsection ssid="7-null-40" dnum="10-o" numlevel="1" lineno="351" slineno="3-83" level="1"><display>(10)</display>"Remotely" means communicating via <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="16" groupid="6" style="2" owner="admin" level="1" deltag="both">Internet</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="15" groupid="5" style="1" owner="admin" level="1" amendtag="both" space="true">internet</amend>, telephone, or other electronic <ln numlevel="1" lineno="352" slineno="3-84"/>means that facilitate real-time audio or visual interaction between individuals when they <ln numlevel="1" lineno="353" slineno="3-85"/>are not physically present in the same room at the same time.</subsection><subsection ssid="7-null-41" dnum="11-o" numlevel="1" lineno="354" slineno="3-86" level="1"><display>(11)</display>"Unlawful conduct" is as defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> and <xref depth="3" refnumber="58-61-501">58-61-501</xref>.</subsection><subsection ssid="7-null-42" dnum="12-o" numlevel="1" lineno="355" slineno="3-87" level="1"><display>(12)</display>"Unprofessional conduct" is as defined in Sections <xref depth="3" refnumber="58-1-501">58-1-501</xref> and <xref depth="3" refnumber="58-61-502">58-61-502</xref>, and may <ln numlevel="1" lineno="356" slineno="3-88"/>be further defined by division rule.</subsection></section></bsec><bsec buid="8" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="357" slineno="4-1" sn="4"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="357">Section 4.  <bold>Effective Date.</bold></secline><sectionText lineno="358"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect on <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>.</amend></sectionText></section></bsec></bdy><foot><rev><tm>3-4-26 6:45 PM</tm></rev></foot></leg>
