Pierucci</otherSponsorhead></tbox><lt numlevel="1" lineno="2" slineno="0-2"><lthead lineno="3">LONG TITLE</lthead><gdhead lineno="4">General Description:</gdhead><gd numlevel="1" lineno="5" slineno="0-5">This bill amends provisions relating to a candidate for public office.</gd><hphead lineno="6">Highlighted Provisions:</hphead><hp numlevel="1" lineno="7" slineno="0-7">This bill:<hl numlevel="1" lineno="8" slineno="0-8" level="1">modifies the deadline for the lieutenant governor to create a master ballot position list; and</hl><hl numlevel="1" lineno="9" slineno="0-9" level="1">to reflect the intent of S.B. 2001, Election Amendments, passed in the 2025 Second <ln numlevel="1" lineno="10" slineno="0-10"/>Special Session, provides that the 2026 deadline for a candidate for the office of United <ln numlevel="1" lineno="11" slineno="0-11"/>States representative to submit signatures to qualify for placement on the primary <ln numlevel="1" lineno="12" slineno="0-12"/>election ballot is the same as for similarly situated candidates.</hl></hp><moni numlevel="1" lineno="13" slineno="0-13" display="none">Money Appropriated in this Bill:</moni><moniNone lineno="14">None</moniNone><oc numlevel="1" lineno="15" slineno="0-15">Other Special Clauses:<ocl type="effdate" sort="2" numlevel="1" lineno="16" slineno="0-16">This bill provides a special effective date.</ocl></oc><sa numlevel="1" lineno="17" slineno="0-17">Utah Code Sections Affected:<saamd numlevel="1" lineno="18" slineno="0-18"><snhead>AMENDS:</snhead><sn num="20A-6-110" src="code" uid="C20A-6-S110_1800010118000101" buid="3" sort="20A06 01100018000101" numlevel="1" lineno="19" slineno="0-19"><bold>20A-6-110</bold>, as renumbered and amended by Laws of Utah 2025, Chapter 39</sn><sn num="20A-9-408" src="code" uid="C20A-9-S408_1800010118000101" buid="1" sort="20A09 04080018000101" numlevel="1" lineno="20" slineno="0-20"><bold>20A-9-408</bold>, as last amended by Laws of Utah 2025, Second Special Session, Chapter 2</sn></saamd></sa></lt><enacthead lineno="21"/><enact numlevel="1" lineno="22" slineno="0-22">Be it enacted by the Legislature of the state of Utah:</enact><bdy><bsec buid="3" num="20A-6-110" type="amend" src="code" uid="C20A-6-S110_1800010118000101" sort="20A06 01100018000101" numlevel="1" lineno="23" slineno="1-1" sn="1"><section number="20A-6-110" numlevel="1" lineno="24" slineno="1-2" type="amend"><secline lineno="23">Section 1. Section <bold>20A-6-110</bold> is amended to read:</secline><catline lineno="24"><bold>20A-6-110<parens/>. Master ballot position list -- Random selection -- Procedures -- <ln numlevel="1" lineno="25" slineno="1-3"/>Publication -- Surname -- Exemptions -- Ballot order.</bold></catline><subsection ssid="3-null-1" dnum="1-o" numlevel="1" lineno="26" slineno="1-4" level="1" placement="noreturn"><display>(1)</display>As used in this section, "master ballot position list" means an official list of the 26 <ln numlevel="1" lineno="27" slineno="1-5"/>characters in the alphabet listed in random order and numbered from one to 26 as <ln numlevel="1" lineno="28" slineno="1-6"/>provided under Subsection <xref depth="4" refnumber="20A-6-305(2)" start="0">(2)</xref>.</subsection><subsection ssid="3-null-2" dnum="2-o" numlevel="1" lineno="29" slineno="1-7" level="1"><display>(2)</display>The lieutenant governor shall:<subsection ssid="3-null-3" dnum="a-o" numlevel="1" lineno="30" slineno="1-8" level="2"><display>(a)</display><amendoutstart style="2"/><amend anum="0" ea="erase" pairid="2" groupid="3" style="2" owner="admin" level="1" deltag="both">within 30 calendar days after the day of the candidate filing deadline</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="1" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">no earlier than <ln numlevel="1" lineno="31" slineno="1-9"/>30 days before, but no later than 14 days before, the fourth Wednesday in April</amend> in <ln numlevel="1" lineno="32" slineno="1-10"/>each even-numbered year, conduct a random selection to create a master ballot <ln numlevel="1" lineno="33" slineno="1-11"/>position list for all elections in accordance with procedures established under <ln numlevel="1" lineno="34" slineno="1-12"/>Subsection <xref depth="4" refnumber="20A-6-305(2)(c)" start="0">(2)(c)</xref>;</subsection><subsection ssid="3-null-4" dnum="b-o" numlevel="1" lineno="35" slineno="1-13" level="2"><display>(b)</display>publish the master ballot position list on the lieutenant governor's election website no <ln numlevel="1" lineno="36" slineno="1-14"/>later than 15 calendar days after the day on which the lieutenant governor creates the <ln numlevel="1" lineno="37" slineno="1-15"/>list; and</subsection><subsection ssid="3-null-5" dnum="c-o" numlevel="1" lineno="38" slineno="1-16" level="2"><display>(c)</display>establish written procedures for:<subsection ssid="3-null-6" dnum="i-o" numlevel="1" lineno="39" slineno="1-17" level="3"><display>(i)</display>the election official to use the master ballot position list; and</subsection><subsection ssid="3-null-7" dnum="ii-o" numlevel="1" lineno="40" slineno="1-18" level="3"><display>(ii)</display>the lieutenant governor in:<subsection ssid="3-null-8" dnum="A-o" numlevel="1" lineno="41" slineno="1-19" level="4"><display>(A)</display>conducting the random selection in a fair manner; and</subsection><subsection ssid="3-null-9" dnum="B-o" numlevel="1" lineno="42" slineno="1-20" level="4"><display>(B)</display>providing a record of the random selection process used.</subsection></subsection></subsection></subsection><subsection ssid="3-null-10" dnum="3-o" numlevel="1" lineno="43" slineno="1-21" level="1"><display>(3)</display>In accordance with the written procedures established under Subsection <xref depth="4" refnumber="20A-6-305(2)(c)(i)" start="0">(2)(c)(i)</xref>, an <ln numlevel="1" lineno="44" slineno="1-22"/>election officer shall use the master ballot position list for the current year to determine <ln numlevel="1" lineno="45" slineno="1-23"/>the order in which to list candidates on the ballot for an election held during the year.</subsection><subsection ssid="3-null-11" dnum="4-o" numlevel="1" lineno="46" slineno="1-24" level="1"><display>(4)</display>To determine the order in which to list candidates on the ballot required under <ln numlevel="1" lineno="47" slineno="1-25"/>Subsection <xref depth="4" refnumber="20A-6-305(3)" start="0">(3)</xref>, the election officer shall apply the randomized alphabet using:<subsection ssid="3-null-12" dnum="a-o" numlevel="1" lineno="48" slineno="1-26" level="2"><display>(a)</display>the candidate's surname;</subsection><subsection ssid="3-null-13" dnum="b-o" numlevel="1" lineno="49" slineno="1-27" level="2"><display>(b)</display>for candidates with a surname that has the same spelling:<subsection ssid="3-null-14" dnum="i-o" numlevel="1" lineno="50" slineno="1-28" level="3"><display>(i)</display>the candidate's legal first name; or</subsection><subsection ssid="3-null-15" dnum="ii-o" numlevel="1" lineno="51" slineno="1-29" level="3"><display>(ii)</display>if the candidates also have a legal first name that has the same spelling, the <ln numlevel="1" lineno="52" slineno="1-30"/>candidate's legal middle name; and</subsection></subsection><subsection ssid="3-null-16" dnum="c-o" numlevel="1" lineno="53" slineno="1-31" level="2"><display>(c)</display>the surname of the president and the surname of the governor for an election for the <ln numlevel="1" lineno="54" slineno="1-32"/>offices of president and vice president and governor and lieutenant governor.</subsection></subsection><subsection ssid="3-null-17" dnum="5-o" numlevel="1" lineno="55" slineno="1-33" level="1"><display>(5)</display>Subsections <xref depth="4" refnumber="20A-6-305(1)" start="0">(1)</xref> through <xref depth="4" refnumber="20A-6-305(4)" start="0">(4)</xref> do  not apply to:<subsection ssid="3-null-18" dnum="a-o" numlevel="1" lineno="56" slineno="1-34" level="2"><display>(a)</display>an election for an office for which only one candidate is listed on the ballot; or</subsection><subsection ssid="3-null-19" dnum="b-o" numlevel="1" lineno="57" slineno="1-35" level="2"><display>(b)</display>a judicial retention election under Section <xref depth="3" refnumber="20A-12-201" start="0">20A-12-201</xref>.</subsection></subsection><subsection ssid="3-null-20" dnum="6-o" numlevel="1" lineno="58" slineno="1-36" level="1"><display>(6)</display>Subject to Subsection <xref depth="4" refnumber="20A-6-305(7)" start="0">(7)</xref>, each ticket that appears on a ballot for an election shall <ln numlevel="1" lineno="59" slineno="1-37"/>appear separately, in the following order:<subsection ssid="3-null-21" dnum="a-o" numlevel="1" lineno="60" slineno="1-38" level="2"><display>(a)</display>for federal office:<subsection ssid="3-null-22" dnum="i-o" numlevel="1" lineno="61" slineno="1-39" level="3"><display>(i)</display>president and vice president of the United States;</subsection><subsection ssid="3-null-23" dnum="ii-o" numlevel="1" lineno="62" slineno="1-40" level="3"><display>(ii)</display>United States Senate office; and</subsection><subsection ssid="3-null-24" dnum="iii-o" numlevel="1" lineno="63" slineno="1-41" level="3"><display>(iii)</display>United States House of Representatives office;</subsection></subsection><subsection ssid="3-null-25" dnum="b-o" numlevel="1" lineno="64" slineno="1-42" level="2"><display>(b)</display>for state office:<subsection ssid="3-null-26" dnum="i-o" numlevel="1" lineno="65" slineno="1-43" level="3"><display>(i)</display>governor and lieutenant governor;</subsection><subsection ssid="3-null-27" dnum="ii-o" numlevel="1" lineno="66" slineno="1-44" level="3"><display>(ii)</display>attorney general;</subsection><subsection ssid="3-null-28" dnum="iii-o" numlevel="1" lineno="67" slineno="1-45" level="3"><display>(iii)</display>state auditor;</subsection><subsection ssid="3-null-29" dnum="iv-o" numlevel="1" lineno="68" slineno="1-46" level="3"><display>(iv)</display>state treasurer;</subsection><subsection ssid="3-null-30" dnum="v-o" numlevel="1" lineno="69" slineno="1-47" level="3"><display>(v)</display>state Senate office;</subsection><subsection ssid="3-null-31" dnum="vi-o" numlevel="1" lineno="70" slineno="1-48" level="3"><display>(vi)</display>state House of Representatives office; and</subsection><subsection ssid="3-null-32" dnum="vii-o" numlevel="1" lineno="71" slineno="1-49" level="3"><display>(vii)</display>State Board of Education member;</subsection></subsection><subsection ssid="3-null-33" dnum="c-o" numlevel="1" lineno="72" slineno="1-50" level="2"><display>(c)</display>for county office:<subsection ssid="3-null-34" dnum="i-o" numlevel="1" lineno="73" slineno="1-51" level="3"><display>(i)</display>county executive office;</subsection><subsection ssid="3-null-35" dnum="ii-o" numlevel="1" lineno="74" slineno="1-52" level="3"><display>(ii)</display>county legislative body member;</subsection><subsection ssid="3-null-36" dnum="iii-o" numlevel="1" lineno="75" slineno="1-53" level="3"><display>(iii)</display>county assessor;</subsection><subsection ssid="3-null-37" dnum="iv-o" numlevel="1" lineno="76" slineno="1-54" level="3"><display>(iv)</display>county or district attorney;</subsection><subsection ssid="3-null-38" dnum="v-o" numlevel="1" lineno="77" slineno="1-55" level="3"><display>(v)</display>county auditor;</subsection><subsection ssid="3-null-39" dnum="vi-o" numlevel="1" lineno="78" slineno="1-56" level="3"><display>(vi)</display>county clerk;</subsection><subsection ssid="3-null-40" dnum="vii-o" numlevel="1" lineno="79" slineno="1-57" level="3"><display>(vii)</display>county recorder;</subsection><subsection ssid="3-null-41" dnum="viii-o" numlevel="1" lineno="80" slineno="1-58" level="3"><display>(viii)</display>county sheriff;</subsection><subsection ssid="3-null-42" dnum="ix-o" numlevel="1" lineno="81" slineno="1-59" level="3"><display>(ix)</display>county surveyor;</subsection><subsection ssid="3-null-43" dnum="x-o" numlevel="1" lineno="82" slineno="1-60" level="3"><display>(x)</display>county treasurer; and</subsection><subsection ssid="3-null-44" dnum="xi-o" numlevel="1" lineno="83" slineno="1-61" level="3"><display>(xi)</display>local school board member;</subsection></subsection><subsection ssid="3-null-45" dnum="d-o" numlevel="1" lineno="84" slineno="1-62" level="2"><display>(d)</display>for municipal office:<subsection ssid="3-null-46" dnum="i-o" numlevel="1" lineno="85" slineno="1-63" level="3"><display>(i)</display>mayor; and</subsection><subsection ssid="3-null-47" dnum="ii-o" numlevel="1" lineno="86" slineno="1-64" level="3"><display>(ii)</display>city or town council member;</subsection></subsection><subsection ssid="3-null-48" dnum="e-o" numlevel="1" lineno="87" slineno="1-65" level="2"><display>(e)</display>elected planning and service district council member;</subsection><subsection ssid="3-null-49" dnum="f-o" numlevel="1" lineno="88" slineno="1-66" level="2"><display>(f)</display>judicial retention questions; and</subsection><subsection ssid="3-null-50" dnum="g-o" numlevel="1" lineno="89" slineno="1-67" level="2"><display>(g)</display>ballot propositions not described in Subsection <xref depth="4" refnumber="20A-6-305(6)(f)" start="0">(6)(f)</xref>.</subsection></subsection><subsection ssid="3-null-51" dnum="7-o" numlevel="1" lineno="90" slineno="1-68" level="1" space="false"><display>(7)</display><subsection ssid="3-null-52" dnum="a-o" level="2" placement="sameline"><display>(a)</display>A ticket for a race for a combined office shall appear on the ballot in the place of <ln numlevel="1" lineno="91" slineno="1-69"/>the earliest ballot ticket position that is reserved for an office that is subsumed in the <ln numlevel="1" lineno="92" slineno="1-70"/>combined office.</subsection><subsection ssid="3-null-53" dnum="b-o" numlevel="1" lineno="93" slineno="1-71" level="2"><display>(b)</display>Each ticket, other than a ticket described in Subsection <xref depth="4" refnumber="20A-6-305(6)(f)" start="0">(6)(f)</xref>, shall list:<subsection ssid="3-null-54" dnum="i-o" numlevel="1" lineno="94" slineno="1-72" level="3"><display>(i)</display>each candidate in accordance with Subsections <xref depth="4" refnumber="20A-6-305(1)" start="0">(1)</xref> through <xref depth="4" refnumber="20A-6-305(4)" start="0">(4)</xref>; and</subsection><subsection ssid="3-null-55" dnum="ii-o" numlevel="1" lineno="95" slineno="1-73" level="3"><display>(ii)</display>except as otherwise provided in this title, the party name, initials, or title <ln numlevel="1" lineno="96" slineno="1-74"/>following each candidate's name. </subsection></subsection></subsection></section></bsec><bsec buid="1" num="20A-9-408" type="amend" src="code" uid="C20A-9-S408_1800010118000101" sort="20A09 04080018000101" numlevel="1" lineno="97" slineno="2-1" sn="2"><section number="20A-9-408" numlevel="1" lineno="98" slineno="2-2" type="amend"><secline lineno="97">Section 2. Section <bold>20A-9-408</bold> is amended to read:</secline><catline lineno="98"><bold>20A-9-408<parens/>. Signature-gathering process to seek the nomination of a qualified <ln numlevel="1" lineno="99" slineno="2-3"/>political party -- Removal of signature.</bold></catline><subsection ssid="1-null-1" dnum="1-o" numlevel="1" lineno="100" slineno="2-4" level="1" placement="noreturn"><display>(1)</display>This section describes the requirements for a member of a qualified political party who <ln numlevel="1" lineno="101" slineno="2-5"/>is seeking the nomination of the qualified political party for an elective office through <ln numlevel="1" lineno="102" slineno="2-6"/>the signature-gathering process described in this section.</subsection><subsection ssid="1-null-2" dnum="2-o" numlevel="1" lineno="103" slineno="2-7" level="1"><display>(2)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-201(7)(a)" start="0">20A-9-201(7)(a)</xref>, the form of the declaration of candidacy <ln numlevel="1" lineno="104" slineno="2-8"/>for a member of a qualified political party who is nominated by, or who is seeking the <ln numlevel="1" lineno="105" slineno="2-9"/>nomination of, the qualified political party under this section shall be substantially as <ln numlevel="1" lineno="106" slineno="2-10"/>described in Section <xref depth="3" refnumber="20A-9-408.5" start="0">20A-9-408.5</xref>.</subsection><subsection ssid="1-null-3" dnum="3-o" numlevel="1" lineno="107" slineno="2-11" level="1"><display>(3)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(1)(a)" start="0">20A-9-202(1)(a)</xref>, and except as provided in Subsection <xref depth="4" refnumber="20A-9-202(4)" start="0"><ln numlevel="1" lineno="108" slineno="2-12"/>20A-9-202(4)</xref>, a member of a qualified political party who, under this section, is seeking <ln numlevel="1" lineno="109" slineno="2-13"/>the nomination of the qualified political party for an elective office that is to be filled at <ln numlevel="1" lineno="110" slineno="2-14"/>the next general election shall:<subsection ssid="1-null-4" dnum="a-o" numlevel="1" lineno="111" slineno="2-15" level="2"><display>(a)</display>except to the extent otherwise provided in Subsection <xref depth="4" refnumber="20A-9-408(13)(a)">(13)(a)</xref>, during the applicable <ln numlevel="1" lineno="112" slineno="2-16"/>declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, and before <ln numlevel="1" lineno="113" slineno="2-17"/>gathering signatures under this section, file with the filing officer on a form approved <ln numlevel="1" lineno="114" slineno="2-18"/>by the lieutenant governor a notice of intent to gather signatures for candidacy that <ln numlevel="1" lineno="115" slineno="2-19"/>includes:<subsection ssid="1-null-5" dnum="i-o" numlevel="1" lineno="116" slineno="2-20" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="117" slineno="2-21"/>political party under this section;</subsection><subsection ssid="1-null-6" dnum="ii-o" numlevel="1" lineno="118" slineno="2-22" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="119" slineno="2-23"/>nomination;</subsection><subsection ssid="1-null-7" dnum="iii-o" numlevel="1" lineno="120" slineno="2-24" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="1-null-8" dnum="iv-o" numlevel="1" lineno="121" slineno="2-25" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="1-null-9" dnum="v-o" numlevel="1" lineno="122" slineno="2-26" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="1-null-10" dnum="b-o" numlevel="1" lineno="123" slineno="2-27" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="124" slineno="2-28"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="125" slineno="2-29"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="1-null-11" dnum="c-o" numlevel="1" lineno="126" slineno="2-30" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="1-null-12" dnum="4-o" numlevel="1" lineno="127" slineno="2-31" level="1"><display>(4)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(2)(a)" start="0">20A-9-202(2)(a)</xref>, a member of a qualified political party <ln numlevel="1" lineno="128" slineno="2-32"/>who, under this section, is seeking the nomination of the qualified political party for the <ln numlevel="1" lineno="129" slineno="2-33"/>office of district attorney within a multicounty prosecution district that is to be filled at <ln numlevel="1" lineno="130" slineno="2-34"/>the next general election shall:<subsection ssid="1-null-13" dnum="a-o" numlevel="1" lineno="131" slineno="2-35" level="2"><display>(a)</display>during the applicable declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0"><ln numlevel="1" lineno="132" slineno="2-36"/>20A-9-201.5</xref>, and before gathering signatures under this section, file with the filing <ln numlevel="1" lineno="133" slineno="2-37"/>officer on a form approved by the lieutenant governor a notice of intent to gather <ln numlevel="1" lineno="134" slineno="2-38"/>signatures for candidacy that includes:<subsection ssid="1-null-14" dnum="i-o" numlevel="1" lineno="135" slineno="2-39" level="3"><display>(i)</display>the name of the member who will attempt to become a candidate for a registered <ln numlevel="1" lineno="136" slineno="2-40"/>political party under this section;</subsection><subsection ssid="1-null-15" dnum="ii-o" numlevel="1" lineno="137" slineno="2-41" level="3"><display>(ii)</display>the name of the registered political party for which the member is seeking <ln numlevel="1" lineno="138" slineno="2-42"/>nomination;</subsection><subsection ssid="1-null-16" dnum="iii-o" numlevel="1" lineno="139" slineno="2-43" level="3"><display>(iii)</display>the office for which the member is seeking to become a candidate;</subsection><subsection ssid="1-null-17" dnum="iv-o" numlevel="1" lineno="140" slineno="2-44" level="3"><display>(iv)</display>the address and telephone number of the member; and</subsection><subsection ssid="1-null-18" dnum="v-o" numlevel="1" lineno="141" slineno="2-45" level="3"><display>(v)</display>other information required by the lieutenant governor;</subsection></subsection><subsection ssid="1-null-19" dnum="b-o" numlevel="1" lineno="142" slineno="2-46" level="2"><display>(b)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-202(1)(c)" start="0">20A-9-202(1)(c)</xref>, file a declaration of candidacy, in <ln numlevel="1" lineno="143" slineno="2-47"/>person, with the filing officer during the applicable declaration of candidacy filing <ln numlevel="1" lineno="144" slineno="2-48"/>period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>; and</subsection><subsection ssid="1-null-20" dnum="c-o" numlevel="1" lineno="145" slineno="2-49" level="2"><display>(c)</display>pay the filing fee.</subsection></subsection><subsection ssid="1-null-21" dnum="5-o" numlevel="1" lineno="146" slineno="2-50" level="1"><display>(5)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-202(3)(a)(iii)" start="0">20A-9-202(3)(a)(iii)</xref>, a lieutenant governor candidate who <ln numlevel="1" lineno="147" slineno="2-51"/>files as the joint-ticket running mate of an individual who is nominated by a qualified <ln numlevel="1" lineno="148" slineno="2-52"/>political party, under this section, for the office of governor shall, during the applicable <ln numlevel="1" lineno="149" slineno="2-53"/>declaration of candidacy filing period described in Section <xref depth="3" refnumber="20A-9-201.5" start="0">20A-9-201.5</xref>, file a <ln numlevel="1" lineno="150" slineno="2-54"/>declaration of candidacy and submit a letter from the candidate for governor that names <ln numlevel="1" lineno="151" slineno="2-55"/>the lieutenant governor candidate as a joint-ticket running mate.</subsection><subsection ssid="1-null-22" dnum="6-o" numlevel="1" lineno="152" slineno="2-56" level="1"><display>(6)</display>The lieutenant governor shall ensure that the certification described in Subsection <xref depth="4" refnumber="20A-9-701(1)" start="0"><ln numlevel="1" lineno="153" slineno="2-57"/>20A-9-701(1)</xref> also includes the name of each candidate nominated by a qualified <ln numlevel="1" lineno="154" slineno="2-58"/>political party under this section.</subsection><subsection ssid="1-null-23" dnum="7-o" numlevel="1" lineno="155" slineno="2-59" level="1"><display>(7)</display>Notwithstanding Subsection <xref depth="4" refnumber="20A-9-701(2)" start="0">20A-9-701(2)</xref>, the ballot shall, for each candidate who is <ln numlevel="1" lineno="156" slineno="2-60"/>nominated by a qualified political party under this section, designate the qualified <ln numlevel="1" lineno="157" slineno="2-61"/>political party that nominated the candidate.</subsection><subsection ssid="1-null-24" dnum="8-o" numlevel="1" lineno="158" slineno="2-62" level="1"><display>(8)</display>A member of a qualified political party may seek the nomination of the qualified <ln numlevel="1" lineno="159" slineno="2-63"/>political party for an elective office by:<subsection ssid="1-null-25" dnum="a-o" numlevel="1" lineno="160" slineno="2-64" level="2"><display>(a)</display>complying with the requirements described in this section; and</subsection><subsection ssid="1-null-26" dnum="b-o" numlevel="1" lineno="161" slineno="2-65" level="2"><display>(b)</display>collecting signatures, on a form approved by the lieutenant governor that complies <ln numlevel="1" lineno="162" slineno="2-66"/>with Subsection <xref depth="4" refnumber="20A-9-405(3)" start="0">20A-9-405(3)</xref>, during the period beginning on the day on which the <ln numlevel="1" lineno="163" slineno="2-67"/>member files a notice of intent to gather signatures and ending at the applicable <ln numlevel="1" lineno="164" slineno="2-68"/>deadline described in Subsection <xref tempid="127" depth="4" refnumber="20A-9-408(12)">(12)</xref>, in the following amounts:<subsection ssid="1-null-27" dnum="i-o" numlevel="1" lineno="165" slineno="2-69" level="3"><display>(i)</display>for a statewide race, 28,000 signatures of registered voters in the state who are <ln numlevel="1" lineno="166" slineno="2-70"/>permitted by the qualified political party to vote for the qualified political party's <ln numlevel="1" lineno="167" slineno="2-71"/>candidates in a primary election;</subsection><subsection ssid="1-null-28" dnum="ii-o" numlevel="1" lineno="168" slineno="2-72" level="3"><display>(ii)</display>except as provided in Subsection <xref depth="4" refnumber="20A-9-408(13)(b)">(13)(b)</xref>, for a congressional district race, 7,000 <ln numlevel="1" lineno="169" slineno="2-73"/>signatures of registered voters who are residents of the congressional district and <ln numlevel="1" lineno="170" slineno="2-74"/>are permitted by the qualified political party to vote for the qualified political <ln numlevel="1" lineno="171" slineno="2-75"/>party's candidates in a primary election;</subsection><subsection ssid="1-null-29" dnum="iii-o" numlevel="1" lineno="172" slineno="2-76" level="3"><display>(iii)</display>for a state Senate district race, 2,000 signatures of registered voters who are <ln numlevel="1" lineno="173" slineno="2-77"/>residents of the state Senate district and are permitted by the qualified political <ln numlevel="1" lineno="174" slineno="2-78"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="1-null-30" dnum="iv-o" numlevel="1" lineno="175" slineno="2-79" level="3"><display>(iv)</display>for a state House district race, 1,000 signatures of registered voters who are <ln numlevel="1" lineno="176" slineno="2-80"/>residents of the state House district and are permitted by the qualified political <ln numlevel="1" lineno="177" slineno="2-81"/>party to vote for the qualified political party's candidates in a primary election;</subsection><subsection ssid="1-null-31" dnum="v-o" numlevel="1" lineno="178" slineno="2-82" level="3"><display>(v)</display>for a State Board of Education race, the lesser of:<subsection ssid="1-null-32" dnum="A-o" numlevel="1" lineno="179" slineno="2-83" level="4"><display>(A)</display>2,000 signatures of registered voters who are residents of the State Board of <ln numlevel="1" lineno="180" slineno="2-84"/>Education district and are permitted by the qualified political party to vote for <ln numlevel="1" lineno="181" slineno="2-85"/>the qualified political party's candidates in a primary election; or</subsection><subsection ssid="1-null-33" dnum="B-o" numlevel="1" lineno="182" slineno="2-86" level="4"><display>(B)</display>3% of the registered voters of the qualified political party who are residents of <ln numlevel="1" lineno="183" slineno="2-87"/>the applicable State Board of Education district; and</subsection></subsection><subsection ssid="1-null-34" dnum="vi-o" numlevel="1" lineno="184" slineno="2-88" level="3"><display>(vi)</display>for a county office race, signatures of 3% of the registered voters who are <ln numlevel="1" lineno="185" slineno="2-89"/>residents of the area permitted to vote for the county office and are permitted by <ln numlevel="1" lineno="186" slineno="2-90"/>the qualified political party to vote for the qualified political party's candidates in <ln numlevel="1" lineno="187" slineno="2-91"/>a primary election.</subsection></subsection></subsection><subsection ssid="1-null-35" dnum="9-o" numlevel="1" lineno="188" slineno="2-92" level="1" space="false"><display>(9)</display><subsection ssid="1-null-36" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(9)" start="0">(9)</xref> applies only to the manual candidate qualification process.</subsection><subsection ssid="1-null-37" dnum="b-o" numlevel="1" lineno="189" slineno="2-93" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="190" slineno="2-94"/>qualified political party's nomination for an elective office under this section, using <ln numlevel="1" lineno="191" slineno="2-95"/>the manual candidate qualification process, the member shall:<subsection ssid="1-null-38" dnum="i-o" numlevel="1" lineno="192" slineno="2-96" level="3"><display>(i)</display>collect the signatures on a form approved by the lieutenant governor, using the <ln numlevel="1" lineno="193" slineno="2-97"/>same circulation and verification requirements described in Sections <xref depth="3" refnumber="20A-7-105" start="0">20A-7-105</xref> <ln numlevel="1" lineno="194" slineno="2-98"/>and <xref depth="3" refnumber="20A-7-204" start="0">20A-7-204</xref>; and</subsection><subsection ssid="1-null-39" dnum="ii-o" numlevel="1" lineno="195" slineno="2-99" level="3"><display>(ii)</display>in accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, submit the signatures to the election <ln numlevel="1" lineno="196" slineno="2-100"/>officer before the applicable deadline described in Subsection <xref tempid="247" depth="4" refnumber="20A-9-408(12)">(12)</xref>.</subsection></subsection><subsection ssid="1-null-40" dnum="c-o" numlevel="1" lineno="197" slineno="2-101" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, and in <ln numlevel="1" lineno="198" slineno="2-102"/>accordance with Section <xref depth="3" refnumber="20A-9-408.3">20A-9-408.3</xref>, the election officer shall, no later than the <ln numlevel="1" lineno="199" slineno="2-103"/>earlier of 14 calendar days after the day on which the election officer receives the <ln numlevel="1" lineno="200" slineno="2-104"/>signatures, or one day before the day on which the qualified political party holds the <ln numlevel="1" lineno="201" slineno="2-105"/>convention to select a nominee for the elective office to which the signature packets <ln numlevel="1" lineno="202" slineno="2-106"/>relate:<subsection ssid="1-null-41" dnum="i-o" numlevel="1" lineno="203" slineno="2-107" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="204" slineno="2-108"/>packet to determine whether each individual is at least 18 years old;</subsection><subsection ssid="1-null-42" dnum="ii-o" numlevel="1" lineno="205" slineno="2-109" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(9)(c)(i)" start="0">(9)(c)(i)</xref> who is not at <ln numlevel="1" lineno="206" slineno="2-110"/>least 18 years old to the attorney general and the county attorney;</subsection><subsection ssid="1-null-43" dnum="iii-o" numlevel="1" lineno="207" slineno="2-111" level="3"><display>(iii)</display>with the assistance of the county clerk as applicable, determine whether each <ln numlevel="1" lineno="208" slineno="2-112"/>signer is a registered voter who is qualified to sign the petition, using the same <ln numlevel="1" lineno="209" slineno="2-113"/>method, described in Section <xref depth="3" refnumber="20A-1-1002" start="0">20A-1-1002</xref>, used to verify a signature on a petition; <ln numlevel="1" lineno="210" slineno="2-114"/>and</subsection><subsection ssid="1-null-44" dnum="iv-o" numlevel="1" lineno="211" slineno="2-115" level="3"><display>(iv)</display>certify whether each name is that of a registered voter who is qualified to sign the <ln numlevel="1" lineno="212" slineno="2-116"/>signature packet.</subsection></subsection><subsection ssid="1-null-45" dnum="d-o" numlevel="1" lineno="213" slineno="2-117" level="2" space="false"><display>(d)</display><subsection ssid="1-null-46" dnum="i-o" level="3" placement="sameline"><display>(i)</display>A registered voter who physically signs a form under Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref> <ln numlevel="1" lineno="214" slineno="2-118"/>may have the voter's signature removed from the form by, no later than 5 p.m. <ln numlevel="1" lineno="215" slineno="2-119"/>three business days after the day on which the member submits the signature form <ln numlevel="1" lineno="216" slineno="2-120"/>to the election officer, submitting to the election officer a statement requesting <ln numlevel="1" lineno="217" slineno="2-121"/>that the voter's signature be removed.</subsection><subsection ssid="1-null-47" dnum="ii-o" numlevel="1" lineno="218" slineno="2-122" level="3"><display>(ii)</display>A statement described in Subsection <xref depth="4" refnumber="20A-9-408(9)(d)(i)" start="0">(9)(d)(i)</xref> shall comply with the requirements <ln numlevel="1" lineno="219" slineno="2-123"/>described in Subsection <xref depth="4" refnumber="20A-1-1003(2)" start="0">20A-1-1003(2)</xref>.</subsection><subsection ssid="1-null-48" dnum="iii-o" numlevel="1" lineno="220" slineno="2-124" level="3"><display>(iii)</display>With the assistance of the county clerk as applicable, the election officer shall <ln numlevel="1" lineno="221" slineno="2-125"/>use the procedures described in Subsection <xref depth="4" refnumber="20A-1-1003(3)" start="0">20A-1-1003(3)</xref> to determine whether <ln numlevel="1" lineno="222" slineno="2-126"/>to remove an individual's signature after receiving a timely, valid statement <ln numlevel="1" lineno="223" slineno="2-127"/>requesting removal of the signature.</subsection></subsection><subsection ssid="1-null-49" dnum="e-o" numlevel="1" lineno="224" slineno="2-128" level="2" space="false"><display>(e)</display><subsection ssid="1-null-50" dnum="i-o" level="3" placement="sameline"><display>(i)</display>An election officer shall, in accordance with this Subsection <xref refnumber="20A-9-408(9)(e)" depth="4">(9)(e)</xref> and rules <ln numlevel="1" lineno="225" slineno="2-129"/>made under Section <xref depth="3" refnumber="20A-3a-106">20A-3a-106</xref>, conduct regular audits of signature comparisons <ln numlevel="1" lineno="226" slineno="2-130"/>made between signatures gathered under this section and voter signatures <ln numlevel="1" lineno="227" slineno="2-131"/>maintained by the election officer.</subsection><subsection ssid="1-null-51" dnum="ii-o" numlevel="1" lineno="228" slineno="2-132" level="3"><display>(ii)</display>An individual who conducts an audit of signature comparisons under this section <ln numlevel="1" lineno="229" slineno="2-133"/>may not audit the individual's own work.</subsection><subsection ssid="1-null-52" dnum="iii-o" numlevel="1" lineno="230" slineno="2-134" level="3"><display>(iii)</display>The election officer shall:<subsection ssid="1-null-53" dnum="A-o" numlevel="1" lineno="231" slineno="2-135" level="4"><display>(A)</display>audit 1% of all signature comparisons described in Subsection <xref depth="4" refnumber="20A-9-408(9)(e)(i)">(9)(e)(i)</xref> to <ln numlevel="1" lineno="232" slineno="2-136"/>determine the accuracy of the comparisons made;</subsection><subsection ssid="1-null-54" dnum="B-o" numlevel="1" lineno="233" slineno="2-137" level="4"><display>(B)</display>record the individuals who conducted the audit;</subsection><subsection ssid="1-null-55" dnum="C-o" numlevel="1" lineno="234" slineno="2-138" level="4"><display>(C)</display>record the audit results;</subsection><subsection ssid="1-null-56" dnum="D-o" numlevel="1" lineno="235" slineno="2-139" level="4"><display>(D)</display>provide additional training or staff reassignments, as needed, based on the <ln numlevel="1" lineno="236" slineno="2-140"/>results of an audit described in Subsection <xref tempid="614" depth="4" refnumber="20A-9-408(9)(e)(i)">(9)(e)(i)</xref>; and</subsection><subsection ssid="1-null-57" dnum="E-o" numlevel="1" lineno="237" slineno="2-141" level="4"><display>(E)</display>record any remedial action taken.</subsection></subsection><subsection ssid="1-null-58" dnum="iv-o" numlevel="1" lineno="238" slineno="2-142" level="3"><display>(iv)</display>The audit results described in Subsection <xref depth="4" refnumber="20A-9-408(9)(e)(iii)(c)">(9)(e)(iii)(C)</xref> are a public record.</subsection></subsection><subsection ssid="1-null-59" dnum="f-o" numlevel="1" lineno="239" slineno="2-143" level="2"><display>(f)</display>An election officer who certifies signatures under Subsection <xref refnumber="20A-9-408(9)(c)" depth="4">(9)(c)</xref> or  <xref refnumber="20A-9-403(3)(d)" depth="4"><ln numlevel="1" lineno="240" slineno="2-144"/>20A-9-403(3)(d)</xref> shall, after certifying enough signatures to establish that a candidate <ln numlevel="1" lineno="241" slineno="2-145"/>has reached the applicable signature threshold described in Subsection <xref refnumber="20A-9-408(8)" depth="4">(8)</xref> or <xref refnumber="20A-9-403(3)(a)" depth="4"><ln numlevel="1" lineno="242" slineno="2-146"/>20A-9-403(3)(a)</xref>, as applicable, continue to certify signatures submitted for the <ln numlevel="1" lineno="243" slineno="2-147"/>candidate in excess of the number of signatures required, until the election officer <ln numlevel="1" lineno="244" slineno="2-148"/>either:<subsection ssid="1-null-60" dnum="i-o" numlevel="1" lineno="245" slineno="2-149" level="3"><display>(i)</display>certifies signatures equal to 110% of the applicable signature threshold; or</subsection><subsection ssid="1-null-61" dnum="ii-o" numlevel="1" lineno="246" slineno="2-150" level="3"><display>(ii)</display>has reviewed all signatures submitted for the candidate before reaching an <ln numlevel="1" lineno="247" slineno="2-151"/>amount equal to 110% of the applicable signature threshold.</subsection></subsection></subsection><subsection ssid="1-null-62" dnum="10-o" numlevel="1" lineno="248" slineno="2-152" level="1" space="false"><display>(10)</display><subsection ssid="1-null-63" dnum="a-o" level="2" placement="sameline"><display>(a)</display>This Subsection <xref depth="4" refnumber="20A-9-408(10)" start="0">(10)</xref> applies only to the electronic candidate qualification <ln numlevel="1" lineno="249" slineno="2-153"/>process.</subsection><subsection ssid="1-null-64" dnum="b-o" numlevel="1" lineno="250" slineno="2-154" level="2"><display>(b)</display>In order for a member of the qualified political party to qualify as a candidate for the <ln numlevel="1" lineno="251" slineno="2-155"/>qualified political party's nomination for an elective office under this section, the <ln numlevel="1" lineno="252" slineno="2-156"/>member shall, before the deadline described in Subsection <xref tempid="182" depth="4" refnumber="20A-9-408(12)">(12)</xref>, collect signatures <ln numlevel="1" lineno="253" slineno="2-157"/>electronically:<subsection ssid="1-null-65" dnum="i-o" numlevel="1" lineno="254" slineno="2-158" level="3"><display>(i)</display>in accordance with Section <xref depth="3" refnumber="20A-21-201" start="0">20A-21-201</xref>; and</subsection><subsection ssid="1-null-66" dnum="ii-o" numlevel="1" lineno="255" slineno="2-159" level="3"><display>(ii)</display>using progressive screens, in a format approved by the lieutenant governor, that <ln numlevel="1" lineno="256" slineno="2-160"/>complies with Subsection <xref depth="4" refnumber="20A-9-405(4)" start="0">20A-9-405(4)</xref>.</subsection></subsection><subsection ssid="1-null-67" dnum="c-o" numlevel="1" lineno="257" slineno="2-161" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, the <ln numlevel="1" lineno="258" slineno="2-162"/>election officer shall, no later than the earlier of 14 calendar days after the day on <ln numlevel="1" lineno="259" slineno="2-163"/>which the election officer receives the signatures, or one day before the day on which <ln numlevel="1" lineno="260" slineno="2-164"/>the qualified political party holds the convention to select a nominee for the elective <ln numlevel="1" lineno="261" slineno="2-165"/>office to which the signature packets relate:<subsection ssid="1-null-68" dnum="i-o" numlevel="1" lineno="262" slineno="2-166" level="3"><display>(i)</display>check the name of each individual who completes the verification for a signature <ln numlevel="1" lineno="263" slineno="2-167"/>to determine whether each individual is at least 18 years old; and</subsection><subsection ssid="1-null-69" dnum="ii-o" numlevel="1" lineno="264" slineno="2-168" level="3"><display>(ii)</display>submit the name of each individual described in Subsection <xref depth="4" refnumber="20A-9-408(10)(c)(i)" start="0">(10)(c)(i)</xref> who is not <ln numlevel="1" lineno="265" slineno="2-169"/>at least 18 years old to the attorney general and the county attorney.</subsection></subsection></subsection><subsection ssid="1-null-70" dnum="11-o" numlevel="1" lineno="266" slineno="2-170" level="1" space="false"><display>(11)</display><subsection ssid="1-null-71" dnum="a-o" level="2" placement="sameline"><display>(a)</display>An individual may not gather signatures under this section until after the <ln numlevel="1" lineno="267" slineno="2-171"/>individual files a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="268" slineno="2-172"/>section.</subsection><subsection ssid="1-null-72" dnum="b-o" numlevel="1" lineno="269" slineno="2-173" level="2"><display>(b)</display>An individual who files a notice of intent to gather signatures for candidacy, <ln numlevel="1" lineno="270" slineno="2-174"/>described in Subsection <xref depth="4" refnumber="20A-9-408(3)(a)" start="0">(3)(a)</xref> or <xref depth="4" refnumber="20A-9-408(4)(a)" start="0">(4)(a)</xref>, is, beginning on the day on which the <ln numlevel="1" lineno="271" slineno="2-175"/>individual files the notice of intent to gather signatures for candidacy:<subsection ssid="1-null-73" dnum="i-o" numlevel="1" lineno="272" slineno="2-176" level="3"><display>(i)</display>required to comply with the reporting requirements that a candidate for office is <ln numlevel="1" lineno="273" slineno="2-177"/>required to comply with; and</subsection><subsection ssid="1-null-74" dnum="ii-o" numlevel="1" lineno="274" slineno="2-178" level="3"><display>(ii)</display>subject to the same enforcement provisions, and civil and criminal penalties, that <ln numlevel="1" lineno="275" slineno="2-179"/>apply to a candidate for office in relation to the reporting requirements described <ln numlevel="1" lineno="276" slineno="2-180"/>in Subsection <xref depth="4" refnumber="20A-9-408(11)(b)(i)" start="0">(11)(b)(i)</xref>.</subsection></subsection><subsection ssid="1-null-75" dnum="c-o" numlevel="1" lineno="277" slineno="2-181" level="2"><display>(c)</display>Upon timely receipt of the signatures described in Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(9)(b)" start="0">(9)(b)</xref>, or <ln numlevel="1" lineno="278" slineno="2-182"/>Subsections <xref depth="4" refnumber="20A-9-408(8)" start="0">(8)</xref> and <xref depth="4" refnumber="20A-9-408(10)(b)" start="0">(10)(b)</xref>, the election officer shall, no later than the day before the <ln numlevel="1" lineno="279" slineno="2-183"/>day on which the qualified political party holds the convention to select a nominee <ln numlevel="1" lineno="280" slineno="2-184"/>for the elective office to which the signature packets relate, notify the qualified <ln numlevel="1" lineno="281" slineno="2-185"/>political party and the lieutenant governor of the name of each member of the <ln numlevel="1" lineno="282" slineno="2-186"/>qualified political party who qualifies as a nominee of the qualified political party, <ln numlevel="1" lineno="283" slineno="2-187"/>under this section, for the elective office to which the convention relates.</subsection><subsection ssid="1-null-76" dnum="d-o" numlevel="1" lineno="284" slineno="2-188" level="2"><display>(d)</display>Upon receipt of a notice of intent to gather signatures for candidacy described in this <ln numlevel="1" lineno="285" slineno="2-189"/>section, the lieutenant governor shall post the notice of intent to gather signatures for <ln numlevel="1" lineno="286" slineno="2-190"/>candidacy on the lieutenant governor's website in the same location that the <ln numlevel="1" lineno="287" slineno="2-191"/>lieutenant governor posts a declaration of candidacy.</subsection></subsection><subsection ssid="1-null-77" dnum="12-o" numlevel="1" lineno="288" slineno="2-192" level="1"><display>(12)</display>The deadline before which a member of a qualified political party must collect and <ln numlevel="1" lineno="289" slineno="2-193"/>submit signatures to the election officer under this section is 5 p.m. on the last business <ln numlevel="1" lineno="290" slineno="2-194"/>day that is at least 14 calendar days before the day on which the qualified political <ln numlevel="1" lineno="291" slineno="2-195"/>party's convention for the office begins.</subsection><subsection ssid="1-null-78" dnum="13-o" numlevel="1" lineno="292" slineno="2-196" level="1"><display>(13)</display>For the 2026 election year only, an individual who desires to gather signatures to seek <ln numlevel="1" lineno="293" slineno="2-197"/>the nomination of a qualified political party for the office of United States representative <ln numlevel="1" lineno="294" slineno="2-198"/>shall:<subsection ssid="1-null-79" dnum="a-o" numlevel="1" lineno="295" slineno="2-199" level="2"><display>(a)</display>in accordance with Subsection <xref depth="4" refnumber="20A-9-408(3)(a)">(3)(a)</xref>, file a notice of intent to gather signatures <ln numlevel="1" lineno="296" slineno="2-200"/>during the period beginning at 8 a.m. on the first business day of January and ending <ln numlevel="1" lineno="297" slineno="2-201"/>at 5 p.m. on March 13, 2026; and</subsection><subsection ssid="1-null-80" dnum="b-o" numlevel="1" lineno="298" slineno="2-202" level="2"><display>(b)</display>during the period beginning on the day on which the individual files the notice of <ln numlevel="1" lineno="299" slineno="2-203"/>intent to gather signatures and ending <amendoutstart style="2"/><amend anum="0" ea="erase" pairid="3" groupid="3" style="2" owner="admin" level="1" deltag="both">at 5 p.m. on March 13, 2026</amend><amendoutend style="2"/><amend anum="0" ea="amend" pairid="2" groupid="2" style="1" owner="admin" level="1" amendtag="both" space="true">at the applicable <ln numlevel="1" lineno="300" slineno="2-204"/>deadline described in Subsection <xref depth="4" refnumber="20A-9-408(12)">(12)</xref></amend>, on a form approved by the lieutenant governor <ln numlevel="1" lineno="301" slineno="2-205"/>that complies with Subsection <xref depth="4" refnumber="20A-9-405(3)">20A-9-405(3)</xref>, collect 7,000 signatures of registered <ln numlevel="1" lineno="302" slineno="2-206"/>voters who are residents of the state and are permitted by the qualified political party <ln numlevel="1" lineno="303" slineno="2-207"/>to vote for the qualified political party's candidates in a primary election.</subsection></subsection></section></bsec><bsec buid="5" type="uncod" untype="effdate" src="uncod" uid="EF0000" sort="UZEFF" langlock="true" numlevel="1" lineno="304" slineno="3-1" sn="3"><section type="uncod" untype="effdate" display="false" src="uncod"><secline lineno="304">Section 3.  <bold>Effective Date.</bold></secline><sectionText lineno="305"><amend anum="0" ea="amend" pairid="1" groupid="1" style="1" owner="admin" level="1" amendtag="both">This bill takes effect:</amend></sectionText><subsection ssid="5-1" dnum="_-o:1-e" numlevel="1" lineno="306" slineno="3-3" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1135" style="1" owner="e" level="1" amendtag="start">(1)</amend></display><amend anum="0" ea="amend" pairid="4" groupid="3" style="1" owner="admin" level="1" m-anum="0" m-ea="amend" m-pairid="6" m-groupid="5" m-style="1" m-owner="admin" m-level="1" amendtag="end">except as provided in Subsection (2), <effdate uid="code" date="5/6/2026">May 6, 2026</effdate>; or</amend></subsection><subsection ssid="5-2" dnum="_-o:2-e" numlevel="1" lineno="307" slineno="3-4" ea="amend" anum="0" owner="admin" style="1" level="1"><display><amend anum="0" ea="amend" pairid="1136" style="1" owner="e" level="1" amendtag="start">(2)</amend></display><amend anum="0" ea="amend" pairid="9" groupid="7" style="1" owner="admin" level="1" amendtag="end">if approved by two-thirds of all members elected to each house:</amend><subsection ssid="5-3" dnum="_-o:a-e" numlevel="1" lineno="308" slineno="3-5" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1137" style="1" owner="e" level="1" amendtag="start">(a)</amend></display><amend anum="0" ea="amend" pairid="12" groupid="9" style="1" owner="admin" level="1" amendtag="end">upon approval by the governor;</amend></subsection><subsection ssid="5-4" dnum="_-o:b-e" numlevel="1" lineno="309" slineno="3-6" ea="amend" anum="0" owner="admin" style="1" level="2"><display><amend anum="0" ea="amend" pairid="1138" style="1" owner="e" level="1" amendtag="start">(b)</amend></display><amend anum="0" ea="amend" pairid="15" groupid="11" style="1" owner="admin" level="1" amendtag="end">without the governor's signature, the day following the constitutional time limit of <ln numlevel="1" lineno="310" slineno="3-7"/>Utah Constitution, Article VII, Section 8;
